Staff Reporter Mbare Magistrate Stan Mambanje will on Tuesday, hand down the ruling on an application for referral to the Constitution Court by the detained female political activist Linda Masarira who is languishing in prison.
Masarira a mother of five, is one of the Occupy Africa Unity Square organisers, arrested early this month in Harare together with several other political activists during the anti-President Robert Mugabe campaign code named #SHUTDOWNZIM2016.
The pro-democracy activist who is facing charges of obstructing the free flow of movement of traffic as defined in section 38 of the Criminal Law and Codification Act and public violence.
Masarira is now seeking recourse at the Constitutional Court arguing that her right to protection of the law was breached when she was brought to the courts 53 hours after her arrest.
Zimbabwe Lawyers for Human Rights (ZLHR)’s  Kudzai Kadzere is representing her.
