MDC-T PRESS STATEMENT ON THE ARREST AND PROSECUTION OF THE PROSECUTOR GENERAL

The MDC T is bemused by the startling arrest and prosecution of the Prosecutor General. The MDC T hopes that this sensational development is a big lesson to the Prosecutor General and all law enforcement authorities and officials that they must pursue justice and fairness and respect the Constitutionally enshrined fundamental rights and freedoms of everyone including those they consider as political foes or of low social status. The Prosecutor General as everyone else, has the right to equal protection and benefit of the law. The MDC-T is all the same concerned that the arrest and prosecution of the Prosecutor General for decisions made in handling a prosecution tend to undermine the guarantee in
Section 260 of the Constitution Prosecutor General and his officers’ capacity to independent and not under the direction
and control of anyone. This development has the real possibility of militating against the National Prosecuting
Authority’s officials’ capacity to prosecute impartially without fear or favour, prejudice or bias as stipulated by the Constitution. Indeed the unusual step taken is contrary to the 4 the rule of the United Nations Guidelines on the Role of Prosecutors adopted in Havana 1990 which discourages the intimidation, harassment improper interference or unjustified exposure to civil and criminal liability of prosecutors. It worsens the already untidy state of affairs by whittling down the already where the Prosecutor General exhibits little independence and impartiality, for which he must be ultimately, but lawfully and Constitutionally brought to book.
