By Farai D Hove| ANALYSIS | At a time when it is illegal to open the courts, Luke Malaba panel judge, Bharat Patel is this afternoon delivering the verdict set to destroy MDC President Nelson Chamisa forever, as legal projectors allege.

Last year Thokozani Khupe’s lawyer Prof Lovemore Madhuku told ZimEye he is confident of a victory against Chamisa. By this morning, Khupe had already tweeted a celebratory message saying she is ready to build the country and the party.

The development comes as Zimbabwe is on day 2 of its 21 Day Lockdown following confirmations of coronavirus in the country which claimed son to Zimbabwean telecommunications mogul and businessman James Makamba’s son Zororo.

The ruling, was reserved on October 23 2019 following a decision by Justices Paddington Garwe, Antoinette Guvava and Bharat Patel in a matter in which Chamisa is accused of having grabbed power illegally.

Chamisa ascended to the MDC leadership in February 2018 when party founding leader Morgan Tsvangirai was on his deathbed in South Africa, leading to a fallout between his then co-Vice President colleagues Thokozani Khupe and Elias Mudzuri.

Both parties to the matter have been called to the Supreme Court this Tuesday at 2.30pm, and Senator Morgen Komichi is tipped to address the media immediately after the ruling, according to impeccable sources.

In May last year, the High Court ruled that breakaway politician and MDC founder Thokozani Khupe was the legitimate head of the country’s main opposition.

The High Court decision followed a challenge filed earlier by a Gokwe-based party activist, Elias Mashavira.

Aggrieved by the High Court outcome, Chamisa and his then deputy, Morgen Komichi appealed the ruling through the Supreme Court.

He cited as respondents, Mashavira, Elias Mudzuri and Khupe,

Mudzuri was appointed co-Vice President by Tsvangirai in 2016 while Khupe was elected during a party congress in 2014.

Komichi was the elected chairman in the 2014 congress, and has recently been sidelined by Chamisa, leading to him pinning his hope on the Supreme Court ruling which according to sources will go against Chamisa.

“It’s a done deal; the Chamisa camp will he out of the Harvest House by end of today,” a source close to the developments revealed Tuesday morning.

The ruling, a lawyer told a local publication, will also see Chamisa’s camp losing party assets as well as.

Douglas Mwonzora, who was the party’s Secretary-General after defeating Chamisa at the October 2014 congress, is also set for a dramatic comeback after having been relegated to the back seat of the party when Chamisa transitioned to power.
