£80,000 Vanished – Qoki V Dumi Moyo Saga: There’s No Pending Court Case in Byo Courts or Anywhere in Zimbabwe

Qoki V Dumi Moyo Land Saga:
There is no pending court case in Bulawyo Courts or anywhere in Zimbabwe involving Qoki ZiNdlovukazi & Synergy Zimbabwe against Mr Dumi Moyo. The record at the High Court indicates that the case which was listed for hearing this January was withdrawn by the ladies before trial for reasons known to them. Below is the confirmation that the case was struck off.

RE: SYNERGY ESTATES ZIMBABWE (PVT) LTD v DUMISANI MOYO AND THE REGISTRAR OF DEEDS N.O CASE NO. HC 493/19; HC 1567/19

We refer to the above matters.

Pursuant to receipt of the Notice of Set Down for Pre-Trial Conference under Case No HC 493/19, we confirm that our Miss V. attended at the High Court on 15th November 2019 and appeared before the Honourable Justice M.

The legal practitioners for the Plaintiff were not in attendance, neither was there any communication from their offices. Consequently, the matter was removed from the roll with the Plaintiff being ordered to pay wasted costs of the Pre-Trial Conference on an ordinary scale.

We advise that at the time of attending the Pre-Trial Conference, we became aware that the Plaintiff had withdrawn its Summons and Application for Joinder but failed to tender costs of suit which, if desirable may be pursued. However, the effect of the Plaintiff’s withdrawal of both matters is that there is no longer any pending litigation between the parties. Please find herewith copies of the Notices of Withdrawal for your information.

We further confirm that, subsequent to the Plaintiff’s withdrawal of its Summons and Application for Joinder, the Plaintiff’s legal practitioners served us with Notices of Renunciation of Agency in both matters confirming that they no longer represent the Plaintiff in the same. Copies of the Notices of Renunciation are annexed hereto for your records.

We now await to hear from the Plaintiff.
