MDC Youth Leader Attacks Khupe For Compromising The Struggle For Cash

Farai Dziva|A member of the MDC A Youth Assembly has described Thokozani Khupe as a misguided dim-wit who has compromised the people’s struggle for cash.

Arnold Batirai Dube, a national executive member of the MDC Youth Assembly castigated Khupe for letting down the souls of millions of party members who were tormented by the Zanu PF regime -after being hoodwinked by Emmerson Mnangagwa.

Batirai Dube is also a councillor for ward 24 in Bulawayo and he is vying for the post of national vice chairperson of the Youth Assembly.

“Khupe is a misguided element and we will not allow her to seize the people’s project.

Khupe and her people are daydreaming.As far as we are concerned the court ruling counts for nothing.

Our Constitution is crystal clear on issues of the presidency.

You get the mandate from the people, that’s very simple,” said Batirai Dube.

NGO Wary Of Onslaught On Civil Society

Farai Dziva|The Institute for Community Development is deeply concerned about the onslaught on the civil society.

In a statement released on Tuesday the organization said it would petition the Parliament of Zimbabwe to exercise its oversight role on fundamental rights of marginalised groups.

“During the meeting held last week the Institute for Community Development resolved to develop a petition to Parliament beseeching Parliamentarians to exercise their oversight role on the rights of people with disabilities, as well as an urgent chamber application which will be filed with the High Court of Zimbabwe on the rights of the LGBT people in Zimbabwe.

This will enable them to express themselves like all citizens of Zimbabwe.

We are making calls to the government of Zimbabwe to be much more proactive on safeguarding the rights of the LGBT fraternity as well as fighting corruption – which is prevalent in most municipalities and government departments.

We are also disturbed by the current crackdown on CSOs.With recent suspensions of CSOs the rate at which the civic space is closing is alarming hence the organization is calling on the government to widen the democratic space for civic groups,” said the Institute for Community Development in a statement.

Harare Lawyer Bashes Bryan Mteki

A PROMINENT Harare lawyer has been arrested on charges of assaulting one of last year’s losing presidential candidates, Bryan Mteki, over a misunderstanding on court proceedings at the Harare Civil Court.

Moses Nkomo (40) yesterday pleaded not guilty when he appeared before magistrate Obedience Matare, who remanded him out of custody on free bail.

It is alleged that on March 26 this year, Mteki was attending court at Harare Civil Court and Nkomo was the defence counsel of the applicant in the undisclosed matter.

During the court session, Mteki asked for change of court date and the magistrate told him to go to the clerk of court and be given another date.

The State alleges that on their way to the clerk of court, Nkomo reportedly said to Mteki: “President, give us our money. Why do you want to change dates when you know you have won the case You want to change dates, that is why you are not winning elections.”

It is further said while at the clerk of court’s office, Mteki was given May 11, 2019.

But Nkomo demanded May 20 and he purportedly assaulted Mteki by pushing him using an elbow once on the chest.

The State further avers that Nkomo stated that: “F**k you, that is why you failed to win elections.”

It is alleged Mteki then went back to court, where he told the magistrate and Nkomo allegedly apologised.

Mteki is not new to the court. Early this year, he was acquitted of assaulting his employee after he demanded his salary.

Confirmed, Britain Has No Sanctions On Zimbabwe As British Investor Takes Over CSC.

Source State Media|In a landmarking move, cabinet has approved a joint venture between the Cold Storage Company (CSC) and a United Kingdom firm, Boulstead Beef (Pvt) Limited, which will see the investor injecting US$130 million into the meat processing firm.

The deal just but dispels long standing ZANU PF claims of British sanctions against the country. The British firm would never have been allowed to invest in Zimbabwe if the country was under sanctions.

A few Zimbabwean people and companies aligned to ZANU PF were put on targeted sanctions by the EU and America. The ruling party has been deliberately misinforming the country on the sanctions claiming that they are the reason behind government’s economic failures.

The deal was announced by Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa during a post- Cabinet Press briefing yesterday.

“Cabinet was informed by Finance and Economic Development Minister Professor Mthuli Ncube that the CSC is to be revitalised through a Concession Agreement under Rehabilitate, Operate and Transfer (ROT) terms,” said Minister Mutsvangwa.

She said under the agreement, Boustead would “raise and invest a minimum of US$130 million into CSC over five years”.

The funds will be for capital expenditures and working capital for the business.

It will also pay off CSC’s financial debts totalling US$42 530 597 and pay rentals of US$100 000 per annum during the first five years of the concession agreement.

Boustead will also take over and manage CSC ranches in Maphaneni, Dubane, Umguza, Chivumbuni, Mushandike, Willsgrove and Darwendale for an initial period of 25 years.

Minister Mutsvangwa said Boustead will take over and run CSC abattoirs in Bulawayo, Chinhoyi, Masvingo, Marondera and Kadoma for an initial period of 25 years.

It will also take over and manage CSC’s distribution centres and residential properties in Harare, Gweru and Mutare for the same period.

Minister Mutsvangwa said the benefits to accrue to Zimbabwe from the investment agreement include, “increased capacity utilisation at CSC ranches and abattoir plants; increased prospects for restoration of the enterprise’s viability and higher throughput; stemming of further deterioration of equipment which is currently lying idle, and the growth of the local livestock and beef industry.”

Asked if 25 years was not too long while CSC was being operated by the private investor, Prof Ncube said the period was sort of a standard across the world, and can stretch to 35 years, since they are funded by debt.

Prof Ncube said 25 years would allow the investor to recoup their US$130 million and then give the CSC back to Government.

He said there are numerous advantages which include bringing back abattoirs to full functionality, providing raw materials to industry such as fat for soap making, and setting up out-growers.

Boustead Beef also plans to export products to countries like China, Botswana, and Angola, said Prof Ncube.

“So the benefits are incredible for the economy. We are happy with the progress so far and as Government are supporting them to make sure that they can really resuscitate CSC to its former glory,” said Prof Ncube.

He explained that Boustead Beef is “already on the ground” and has audited CSC’s infrastructure.

In the first year, Boustead is expected to invest US$45 million, with US$10 million set to be channelled towards the purchase of cattle to replenish the stock.

The herd had dwindled to 341 animals across the country as of March 2017.

Boustead will invest US$6 million into abattoirs’ refurbishment, canning factory, distribution infrastructure, working capital and IT systems while US$500 000 plant equipment has been ordered and paid for.

The equipment is ready for shipping and would be installed upon arrival.

The investor has started paying employee salaries from February this year and is also cleaning its facilities.

Boustead has also started buying cattle from South Africa and is also looking at restocking through facilities in Botswana, while some tenants who were occupying CSC ranches without permission have been relocated.

Illegal hunting in CSC ranches is also being stopped.

Willowvale Motor Industries would assemble Boustead’s vehicles, creating backward and forward linkages.

2The revival of CSC is in line with the Transitional Stabilisation Programme which seeks to arrest the rot in most parastatals.

Qualified Zimbabwean Pilot Arrested In South Africa For Drunken Driving

Police have identified the man who was arrested for reckless and negligent driving following an accident along Port Elizabeth’s Beachfront on Sunday morning

The 31-year-old Kelvin Zirema is also facing a charge of culpable homicide and drunk driving.

Spokesperson Colonel Priscilla Naidu says it is alleged that Zirema was driving in an Audi A4 in the right lane towards Kings Beach when he hit two pedestrians near the McDonald’s intersection, killing one instantly.

The deceased was identified as the 36-year-old Anthony Agbo from Nigeria.

According to police, Agbo had only been in the country for a couple of days.

Naidu says it is further alleged that Zirema then lost control of the vehicle and collided into four stationary cars parked near the Humewood Hotel.

Zirema allegedly fled the scene but was arrested shortly afterwards.

The accused, who is also a qualified helicopter pilot, is a Zimbabwean National who lives and works in Port Elizabeth.

Naidu says a 26-year-old woman from Zwide who lost her left leg in the accident is still in hospital.

Zirema will be back in court on Thursday where he is expected to apply for bail. – Agencies/Algoafm

FULL TEXT: CHRA Concerned Over Govt’s Policy Inconsistency On Debt Collectors

On May 9, 2019 the Minister of Local Government, Public Works and National Housing, Honorable July Moyo told Parliament that local authorities are allowed to engage debt collectors as a way of recovering debts owed by residents.

The Minister’s pronouncement reveals huge policy inconsistency on the part of the government regarding the engagement of debt collectors by local authorities.

In November 2018, Minister Moyo tabled a Ministerial Statement in the National Assembly in which he warned local authorities against engaging debt collectors saying it was illegal to do so.

The Minister reiterated that there is no legal provision supporting the engagement of debt collectors in the Urban Councils Act or the Rural District Councils Act. He also made reference to the Local Government Circular No. 3 which directed all local authorities to desist from engaging debt collectors.

His latest pronouncement (on May 9, 2019) to the effect that local authorities are allowed to engage debt collectors is a cause for concern.

In 2017, the Combined Harare Residents Association (CHRA) ran a series of community engagements during which we urged residents to resist debt collectors and instead, approach council for payment plans.

We reiterate that the operations of debt collectors are illegal as there is no Act of Parliament that allows debt collectors to attach property or issue threats on behalf of creditors. CHRA will continue on the same path of mobilizing residents to resist the debt collectors.

The operations of debt collectors amounts to daylight robbery as they charge an extra 10 percent on top of what the residents owe council. In some cases, the money collected by the debt collectors is not remitted to council and residents remain in debt despite having parted with their hard earned money.

CHRA would also wish to draw the attention of Minister Moyo to the 2018 High Court ruling that declared the operations of debt collectors illegal in the case of the Law Society of Zimbabwe and Wellcash Debt Collectors (Pvt) Ltd.

We are also fully aware that government departments (primarily the Ministry of Local Government and Defence) owe the Harare City Council huge amounts of money and the Minister has no moral ground to authorize the engagement of debt collectors against residents when government itself is equally a bad debtor.

Failure by the government to pay rates to the Harare City Council amounts to over taxation of residents who are now being forced to subsidize the government.

“Grace Mugabe’s Bloody Assault Exposed”

By Own Correspondent- Papers filed in Zimbabwe’s high court by lawyers for Shupikai Chiroodza allege that former first lady Dr Grace Mugabe used her fists and then her shoe in a prolonged attack that left a government employee at her residence injured.

Mugabe is accused of beating the housekeeper with a shoe until blood ‘gushed’ from her face before threatening to kill her if she told anyone about the assault.

Mugabe, is accused of attacking the employee at the family’s home with a shoe in 2017, lawyers said Tuesday. She also faces an arrest warrant in neighbouring South Africa for her alleged assault with a power cable on a female model in Johannesburg in the same year.

Mugabe allegedly attacked Chiroodza after accusing her of “milking” her husband because she had accepted a cash wedding gift from him, the papers say.Chiroodza was a government employee working at the Mugabes’ private Blue Roof mansion in Harare when the alleged attack took place in March 2017, eight months before then-president Mugabe was forced from office.

“I represent Chiroodza, who was part of the domestic staff at Blue Roof in a case of unlawful dismissal,” lawyer Douglas Coltart told AFP.

In her court papers demanding her job back, Chiroodza said Grace Mugabe punched her and ordered her to return an unspecified amount of money. “She started beating me with clenched fists shouting, ‘Who do you think you are? You are milking my husband behind my back’,” Chiroodza said in her court application.

‘I was terrified’, “I was terrified. She removed her shoe and continued assaulting me with it and blood started gushing out of my forehead, mouth and nose. The assault continued for about 20 minutes.”

Chiroodza said she received a dismissal letter two months later. Coltart said the civil service commission had indicated it would not contest the case. “We are hoping to get some form of settlement,” he said.

Mugabe, 53, was seen as a possible successor to her husband in a race against Emmerson Mnangagwa, the current president. Mugabe, now 95, was ousted following a brief military takeover in 2017 after 37 years in office and replaced by Mnangagwa, the favoured choice of the military.

Zim Cricketer’s Wife Mugged By Four Armed Men

Jane Mlambo| Zimbabwe cricketer Brendan Taylor’s wife was mugged by four men who were driving a red Honda Fit outside their house two days ago amid reports of an increased number of robberies since the beginning of massive load shedding in the country.

Posting on Twitter yesterday, Taylor narrated the events that unfolded outside their house when four armed men who were driving a red Honda Fit descended on his wife who was coming home.

“Just had an alarming situation outside my house, I was waiting for my wife’s return in my driveway. I started hearing her screaming about 100m from my gate, she was getting mugged by 4 armed men. I ran outside and they sped away in red Honda Fit.

“Fortunately she only lost her handbag and it could of been a lot worse. People are getting desperate, be vigilant when entering your property and try keep off the roads after dark. With all this load shedding we’re easy targets,” said Taylor.

Reports of muggings since the intensification of load shedding have been many especially in Harare.

ZCDC Boss To Appear In Court

By Own Correspondent- ZIMBABWE Consolidated Diamond Company (ZCDC) chief executive Morris Bekezela Mpofu will today appear in court facing charges of criminal abuse of duty.

On Monday, Mpofu was picked up for questioning by the police before being released, while the company’s finance director, Charles Gambe, was arrested for criminal abuse of office after he allegedly bought 1 200 bags of cement at Lafarge Cement for personal use using his employer’s account.

National police spokesperson Assistant Commissioner Paul Nyathi confirmed the latest developments but could not divulge further details on Mpofu’s case.

“Morris Mpofu will appear in court [today] for criminal abuse of duty. All I can say for now is that he abused his duty after he recommended a person with criminal records which was not procedural,” he said.- StateMedia

By Own Correspondent- Zanu-PF Secretary for External Affairs Simbarashe Mumbengegwi who is the former Minister of Foreign Affairs has heaped praises on China saying the nation has been the backbone of Zimbabwe’s survival in the wake of the Western imposed sanctions.

Mumbengegwi made the remarks after touring China’s Qingdao National High-Tech Industrial Development Zone where he is part of a Zanu-PF delegation led by national chairperson Oppah Muchinguri, which is on a 10-day exchange visit with the Communist Party of China (CPC).

He said:

“Zimbabwe has been on sanctions for decades and China has been the backbone of our survival from these sanctions.

I am not exaggerating to say we would not be able to achieve this status without China’s support and we are extremely encouraged that China has stood by us so that we can be able to stand on our feet.

You will recall that in 2008, China took the extraordinary step of exercising its veto in favour of Zimbabwe.

For this, Zimbabwe will forever be grateful because sanctions under the UN Security Council would have destroyed our country.

It would have reopened our country to recolonisation but we continue to be an independent country today.”

England Based Star Player Declares That He Will Play For Zim At AFCON

England-based Macauley Bonne has declared he is travelling with the team to the 2019 Afcon despite being left out of the provisional squad announced on Tuesday.

Bonne was dropped from the selection due to delays in getting him a local passport as he holds British citizenship and new government laws require him to denounce it first.

But following the squad announcement, the Leyton Orient striker took to Twitter to “clear the air”, saying he has completed everything needed to get the passport and is going to Afcon with the team.

30 Gogos Nabbed For Fraud

By Own Correspondent- An unlikely group of women accused of being thieves has been arrested as part of a special police operation called “Project Combat”.

South Africa’s Free State police Brig Sam Makhele said 30 suspects are implicated in defrauding the state through social grants, and will now stand trial on a charge of fraud. They were arrested this week.

The project, which was launched in July 2018, was informed by crime intelligence-led information on fraud committed by undeserving Sassa beneficiaries who were applying for government grants, Makhele said.

Among those arrested is a 41-year-old woman alleged to be the mastermind behind the scam.

Makhele said she was issuing people with fraudulent doctor’s referral letters, qualifying them to apply for grants.

She would allegedly charge them various amounts ranging from R200 for the service.

Various fraudulent documents and stamps were found at her house.

“It is alleged that this woman made unsuspecting victims to believe that she was a doctor’s assistant, who was authorised with performing these duties whilst the doctor was on leave,” Makhele said.

Saps Lt-Gen Moeketsi Sempe said the investigation was ongoing.

“This is the first phase of the operation, more arrests are imminent. Any form of fraud and corruption against government will not be tolerated. We will arrest whoever is involved without fear of favour,” stated Sempe.

Anti-gay Preacher Who Prayed For Obama’s Death Banned From All EU Countries

BBC|A radical American preacher is now banned from all 28 European Union countries, including Ireland, which has used an exclusion order for the first time under its 20-year-old immigration law.

Irish Minister for Justice Charlie Flanagan signed the order Sunday to keep out Steven Anderson, the anti-gay extremist pastor of a fundamentalist Baptist church in Arizona, the Irish Times reports.

Anderson, who has been likened to an “American Taliban” and once told parishioners he prayed every night for former President Obama’s death, was due to speak at an event in Dublin on May 26. His Faithful Word church has described gay people as “abominations which God punishes with the death penalty.”

Anderson, who also denies the Holocaust, has praised the gunman who killed 49 people in the Pulse nightclub attack in Florida in 2016.

“I have signed the exclusion order under my executive powers in the interests of public policy,” said Flanagan.

This is the first time an exclusion order has been granted since the Immigration Act was introduced in 1999, the BBC reports.

After Anderson’s Ireland visit was announced, more than 14,000 people signed a petition calling for him to be banned from the country.

The Netherlands banned Anderson last month under what officials said was a policy of “taking strong action against extremist speakers who, by spreading their beliefs, restrict the freedoms of others or even incite hatred or violence.”

Gvnt Partners Private Sector In Bid To Rehabilitate Public Health Services

By Own Correspondent- Health and Child Care minister Dr Obediah Moyo has revealed that government has started a massive rehabilitation programme for public health institutions in a development expected to result in a marked improvement in standards and the availability of critical health services.

Dr Moyo said the programme, which is going to be implemented in partnership with private players provided for under the 2015 Joint Ventures Act, will initially target central hospitals, after which similar joint ventures will cascade down to other health institutions throughout the country.

Parirenyatwa Group of Hospitals, Mpilo Central Hospital and United Bulawayo Hospitals have since invited bidders interested in partnering them in refurbishing and re-equipping various sections of the hospitals.

Successful firms or groups will also operate a super-specialty hospital wing within each institution

Said Dr Moyo:

“We want to make sure that the healthcare facilities are of very high level, providing first-class service. We want to make sure that our customers access affordable services, which is also within easy reach so we want to make sure that all the facilities are all rehabilitated.

“Our facilities had gone for a long time without going major rehabilitation and at the same time we also need to replenish all the institutions with medicine, surgical sundries so that it make sense,” said Dr Moyo.

“For us to be able to tackle all these problems, as a Government and on our own, we cannot be able to fulfil it, that is why you here the Zimbabwe is open for business mantra and this is not just in other industries, it includes the healthcare industry as well.”-StateMedia

What Part Of Zanu PF Rigged The Elections, Is Chamisa Failing To Understand!

Listen to the quality of debate, the MDC is rich. We want 2023 right now. We’re not going to shirk,” Chamisa said.

Mnangagwa and Zanu PF blatantly rigged last year’s elections. The whole election process was full of flaws, irregularities and illegitimacies it was a joke. ZEC failed to produce something as basic as a voters’ roll for Pete’s sake.

What part of Zanu PF rigged the elections, is Chamisa failing to understand!

If the country goes into elections without first implementing the reforms Zanu PF will rig the elections as readily as it has done in the past. The only reason the opposition has continue to participate in flawed and illegal elections is greed, as David Coltart readily admitted.

“The worst aspect for me about the failure to agree a coalition was that both MDCs couldn’t now do the obvious – withdraw from the (2013) elections,” confessed David Coltart in his book, The Struggle Continues 50 years of tyranny in Zimbabwe.

“The electoral process was so flawed, so illegal, that the only logical step was to withdraw, which would compel SADC to hold Zanu PF to account. But such was the distrust between the MDC-T and MDC-N that neither could withdraw for fear that the other would remain in the elections, winning seats and giving the process credibility.”

Coltart was a Senator and an MDC-N minister in the 2008 to 2013 GNU that failed to implement even one democratic reform in five years. SADC leaders begged, literally, Tsvangirai and the other MDC leaders NOT to take part in the 2013 elections without first implementing the reforms and their warning fell on deaf ears because of greed.

The people of Zimbabwe must now accept the political reality that has emerged this last decade: MDC leaders are no longer interested in demanding free, fair and credible elections. They will accept rigged elections as long as Zanu PF throws at them a few gravy train seats.

Indeed, Chamisa, his MDC A friends and the whole contingent of the opposition candidates who participated in last year’s elections have all accepted the parliamentary and presidential elections as free, fair and credible regardless of all the flaws and illegalities.

Chamisa has accepted the flawed and illegal process but would not accept Mnangagwa as the presidential winner of the feeble ground that he received more votes. Chamisa has failed to produce ALL the V11 forms, summary of the vote count from Polling Station, just as ZEC has failed to produce the V11 forms to support Mnangagwa vote tally.

If Mnangagwa had offered Chamisa a gravy train seat, the position of official opposition leader complete with the minister salary and allowance, Chamisa would have endorse Mnangagwa’s victory without further ado! So because Chamisa did not get a gravy train seat, the nation is being dragging into another election with no hope of the process will be free, fair and credible just because Chamisa did not get a gravy train seat he is after.

Insanity is participating in flawed and illegal elections and after 39 years and counting of repeating the same folly hope for free, fair and credible result. How naïve!

Rural Communities In Domboshava Stand Up To Chinese

By Own Correspondent- Rural communities in Zimbabwe are beginning to stand up to Chinese mining companies operating in the country.

This is shown by recent demonstrations against plans by Aihua Jianye, a Chinese company that sought to evict thousands of villagers in Domboshava to open a quarry mine.

The residents of Domboshava, a settlement a few kilometres north of Harare, staged the demonstration on May 6. One of the signs held by protestors said; “Leave our Domboshava alone. Go back to your Beijing.”

The Chinese company said that the $500 million mining project would generate 500 jobs, but the locals are not convinced.

A resident of Domboshava and opposition party (MDC) official Luke Tamborinyoka said:

We have seen in other areas that investment by the Chinese does not benefit people in areas they are operating in. The Chinese investors bring their own labour and they bring their own equipment.

A research coordinator with the Centre for Natural Resource Governance, Tapuwa O’Brien Nhachi said:

If mining were supposed to benefit the country, why would over 20,000 people were displaced to pave way for foreign investors who will take the minerals and the profits outside the country? … who gave them the licence to mine and in exchange for what?

Our constitution is clear on fundamental rights that the citizens have, and these include environmental and cultural rights.

Taking this into account, the community has the right to say ‘no’ to destructive and unsustainable development and that right should be respected by those who are in authority.

In Manicaland, another Chinese company, Anjin Investments is returning to the Marange area, to resume diamond mining operations.

The Marange villagers are reportedly planning to hold a protest against the company, following the example of those in Domboshava.

An NGO that promotes the of marginalized and vulnerable communities in natural resource-rich areas, the Zimbabwe Environmental Law Association (ZELA), released a report in March.

Part of the ZELA reports reads:

Some of the companies that are foremost in violation of EESCRs (environmental, economic, social, and cultural rights) are Chinese mining companies.

Mountains in Chiadzwa [Marange area] are considered sacred and cultural shrines, but company officials of Chinese descent built their temple on top of one of the mountains.

… the Chinese companies violated the graves by exhuming the bodies and exposing them without carrying out the necessary cultural rights and at one point they left skeletons scattered all over, which is a taboo in Zimbabwe.-Epoch

Gvnt To Acquire 500 More Buses From Belarus

By Own Correspondent- Finance and Economic Development Minister Mthuli Ncube said that negotiations are ongoing to acquire buses for the Zimbabwe United Passengers Company (ZUPCO) from three countries.

Ncube was speaking to journalists in Harare on Tuesday during a post-cabinet media briefing. He revealed that 500 buses are expected from Belarus.

Said Ncube:

The 500 buses from Belarus; all these are negotiations still underway. These (buses) are certainly coming on board, just watch this space and be patient.

It’s not just Belarus, we are procuring 100 buses from China and then 200 buses from South Africa. Our intention in the interim is to have a target of 1 000 new buses and also try to crowd-in the local suppliers.

But when Zupco is in full flight when the new partner comes in, we expect the bus yield to grow to 3 000 and higher.-StateMedia

Mnangagwa Promotes Two Senior Airforce Officers

President Mnangagwa has promoted two senior Air Force of Zimbabwe (AFZ) officers to ranks of Air Commodore.

The newly-promoted officers are Air Commodore Edgar Munyarari Kamusoko who is now Dean faculty Defence Engineering at Zimbabwe National Defence University (ZNDU) and Air Commodore Marcelino Jakuvos Jaya, new Base Commander at Josiah Tungamirai Air Force Base in Gweru.

The promotions are with immediate effect.

Speaking during the conferring of ranks at AFZ headquarters in Harare, the Air Force of Zimbabwe commander, Air Marshal Elson Moyo urged the new Commodores to be disciplined and to lead exemplary lives.

“The promotion comes with new responsibilities and expectations from junior officers under your command as well as your superiors.

“Junior officers will look up to you, hence your performance will be their yardstick in the execution of their duties,” he said.

Air Marshal Moyo said the new promotions were made with a focus on innovative and research in order to find solutions to native challenges.

“The Air Force of Zimbabwe officers have prioritised research and development and with these new ranks and appointments we expect you to lead this drive for innovation in order to find solutions to local challenges,” said Air Marshal Moyo .

“I want to congratulate you for earning these promotions through hard work and dedication in your previous work.”

S.A. Police Warn Public Not To Attempt To Arrest Escaped Prisoners

Limpopo police on Monday cautioned the public not to try to apprehend seven awaiting prisoners who escaped over the weekend as they were considered highly dangerous.

Some of them are feared to have fled into Zimbabwe.

The prisoners broke out during a routine police check at the Modimolle holding cells in Limpopo.

They had been identified as Polano Ndebele, Thapelo Mello, Themba Ncube, Sello Rengane, Kenneth Shuma, Kazen Dluwayo as well as Mpho Obvious Lesese.

Police spokesperson Colonel Moatshe Ngoepe said they were investigating how exactly the escapees broke out.

“Taking into consideration the type of offences they were arrested for like house robberies… they are highly dangerous and members of the community must not attempt to arrest them. But when they see them they must just inform us, we will quickly take action and arrest them,” he said

Mugabe Fails To Pay For Car Service

Gushungo Dairies (Pvt) Ltd has been taken to the High Court by Auto World Harare (Pvt) Ltd for allegedly failing to pay $11 000 for service done on one of the farm’s motor vehicle.

Gushungo Dairies is owned by former President Robert Mugabe’s family.

Auto World Harare (Pvt) Ltd also urged the court to slap Mugabe’s business with costs of the litigation on a higher scale.

In its declaration filed alongside the court summons, Auto World Harare said the Gushungo Dairies Isuzu vehicle, registration number, AZC 2327, came to their garage on October 29, 2018.
Auto World Harare argued it carried out the major service on the car by providing labour and supplying motor vehicle parts as well as service sundries.

“The plaintiff (Auto World) accordingly charged the defendant (Gushungo Dairies) for the services provided as per invoice number 1653622 … in the sum of $11 004,” the company said.
“It was the plaintiff’s terms and conditions that invoices are paid within seven days upon receipt. The defendant was issued with an invoice on October 29, 2018 and to date, the invoice remains unpaid,” Auto World said.

“Notwithstanding demand, the defendant has failed and/or refused to pay the sums due and owing to the plaintiff for its labour, motor parts and professional service. The defendant is accordingly liable to the plaintiff for the outstanding invoice as described together with costs on an attorney and client scale.”

The former President’s business concern is yet to respond to the litigation.

Mnangagwa Dialogue Partner Thoroughly Assaulted In Court For Failing To Pay Lawyer

State Media|Harare lawyer Moses Nkomo yesterday appeared in court for allegedly assaulting presidential aspirant Mr Bryn Taurai Mteki over a money dispute.

Muteki is apparently one of the losing presidential candidates who are involved in some talks with President Emmerson Mnangagwa on how to move the country forward.

Nkomo (40), a senior partner with Donsa-Nkomo and Mutangi IP Attorneys, was not asked to plead to assault when he was arraigned before magistrate Mr Obedience Matare.

Mr Matare remanded the lawyer out of custody on own recognition.

Nkomo will be back in court on May 31. It is alleged that on March 26, Mteki and Nkomo were attending court at the Harare Magistrates’ Civil Court.

The court heard that during a court session Mteki, who was represented by Nkomo, successfully applied for postponement of his civil case. While on their way to the clerk of court’s office to be given a new court date, the two clashed over payment of outstanding legal fees.

It is the State’s case that Nkomo, who was not happy with the postponement of the case, charged at the presidential aspirant demanding his payment.

He reportedly said:

“You, president, give us our money, why do you want to change the court date when you know you have won the case? You want to change dates, that is why you are not winning elections.”

The court heard that while at the clerk of court’s office, Mteki’s case was rescheduled for May 11, 2019.

Nkomo, who was comfortable with May 20 as the new court date, allegedly assaulted the politician.

Bill To End ZANU PF Abuse Of ZBC And State Media Set For Gazette

State Media|Cabinet has approved the Broadcasting Services Amendment Bill and the Freedom of Information Bill, which are expected to be gazetted by Friday.

Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa and Justice, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi presented the respective Bills in Cabinet yesterday.

Minister Ziyambi chairs the Cabinet Committee on Legislation.

Briefing journalists after the Cabinet meeting, Minister Mutsvangwa said the Broadcasting Services Amendment Bill seeks to harmonise the Broadcasting Services Act (Chapter 12:06) with Section 61 of the Constitution of Zimbabwe.

She highlighted the major proposed changes to the country’s broadcasting laws.

“The proposed amendment Bill provides that every person has the right to freedom of expression and freedom of media,” she said.

“It also proposes that freedom of expression and freedom of the media excludes incitement to violence, advocacy of hatred or hate speech, malicious injury to a person’s reputation or dignity, and malicious or unwanted breach of a person’s right to privacy.”

The proposals, Minister Mutsvangwa said, also included the freedom to establish broadcasting and other electronic media of communication, subject only to State licensing procedures.

“That all state-owned media of communications must be impartial and free to determine independently the editorial content of their broadcasts,” she said. It is also proposed that Section 21 of the principal Act be amended to indicate that the role of BAZ is to regulate and supervise rather than to control broadcasting services bands.

“. . . that the objectives of the Broadcasting Services Act be broadened to address the diversity of opinion, ideas, values, artistic, creativity and talent of citizens in programming in order to advance the freedom of expression, multiculturalism and linguistic plurality,” she said. The Bill also seeks to provide for transparency and accountability in the appointment of members of the board among several other changes being proposed.

4 500 Criminals Have Escaped Police Arrest

Police are looking for 4 500 criminals who are on the run for committing various offences.

Eighteen of the fugitives from justice were arrested during an operation conducted by the police Women Network last week.

In a statement yesterday, police national spokesperson Assistant Commissioner Paul Nyathi said the operation targeted wanted persons for cases of violence against women and children.

“The ZRP (Zimbabwe Republic Police) recently conducted a simultaneous Southern Region Police Chiefs Cooperation Operation (SARPCCO), code named BASADI from 8 to 10 May 2019.

“By the second day of the operation, 18 wanted persons had been arrested out of 4 583 wanted persons on record across the country’s provinces,” said Asst Comm Nyathi.

He said the police will continue to hunt for the wanted persons in all the country’s provinces.

“The decision for this operation came as a result of decision 22 by SARPCCO police chiefs at the 19th Annual General Meeting (AGM) held on May 23, 2014 in Namibia, which mandated National Police Women Network structures to annually conduct this simultaneous regional operation.

“However, the ZRP continues to hunt for these people wanted for various crimes even after the operation is concluded,” said Asst Comm Nyathi.

He added that apart from arresting wanted persons, the ZRP had also been involved in conducting crime awareness campaigns to educate the public on crimes of passion.

“A total of 237 crime awareness campaigns reaching 16 670 people were conducted across the country by day two of the operation,” said Asst Comm Nyathi.

The country has in the past months recorded an upsurge in crime, with the police calling for the involvement of members of the public and corporate world in the prevention and management of crime. The Chronicle

Married Man Kills Own Girlfriend Over SMS

A Bulawayo City Council security guard allegedly murdered his girlfriend over sms messages..

The man, Absolom Ndlovu, allegedly strangled his girlfriend Ms Vonai Mhoya (29) in Mpopoma and fled.

He has since been arrested.

The court heard that he is also a married man.

“We have arrested a suspect in connection with the murder of a 29-year-old woman in Mpopoma on Saturday,” the Bulawayo acting police spokesperson Assistant Inspector Nomalanga Msebele, said.

She added that Ndlovu was admitted at Mater Dei Hospital under police guard. She continued saying,

“We got information that the suspect was in Ntabazinduna and was very sick. The wife had summoned an ambulance to ferry him from Ntabazinduna to Mater Dei Hospital.

“The police went to Mater Dei Hospital and arrested him.”

A report alleges that Ndlovu attempted suicide by drinking poison.

Allegations were that Ndlovu and Mhoya fought over a text message that was received on the deceased’s phone. – state media

“Companies Are Trying To Remove Gvnt Through Price Distortions”: Information Minister

Minister of Information, Publicity and Broadcasting Services, Monica Mutsvangwa has said that the government has come up with a number of measures to cushion customers in the face of the soaring inflation.

She was speaking to Zimbabweans staying in the UK at the country’s London Embassy recently.

The minister added:

Some of these companies seem to be trying to find ways of removing the government. On the eve of independence, we woke up to a new price of bread.

This is despite that the President is preaching the message of engagement…he is saying let’s engage, we don’t want to effect price controls, since Zimbabwe is open for business we want the principles of demand and control to take root in our economy.

The industry has been invited several times to the negotiation table so that problems are ironed out but it however decided to disregard that channel.

She added that the government was working towards disaggregating the Grain Marketing Board and redefining its functions. She also confirmed that the government has already allocated $70 million to the board for it to start selling the basic commodities

“MDC Bulawayo Province mourns the passing away of Ward 7 Mt Pleasant Councillor, Sekuru Tafadzwa Mhundwa and Glenview South District Organising Secretary, Paul Rukanda.

Sekuru Mhundwa was a brother to the late Susan Tsvangirai.

The famous and soft-spoken Rukanda was Glenview South MP, Hon Vimbai Tsvangirai Java’s campaign manager.

May their souls rest in eternal peace.

How Is Madhuku Going To Make 2,6mln People Love Khupe This Time?

By Own Correspondent- Following the High Court ruling which declared that Nelson Chamisa was not the legitimate leader of the opposition Movement for Democratic Change, leader of the other MDC faction, Thokozani Khupe has engaged Professor Lovemore Madhuku to implement provisions of the ruling.

Professor Madhuku is a renowned constitutional lawyer and lecturer of law at the University of Zimbabwe.

Speaking to the state media, Professor Madhuku confirmed that he has been engaged by Khuphe.

He also said that he has already commenced preparing on how to implement the court ruling.

Madhuku said:

After being engaged by Dr Khupe, who has been declared the legitimate MDC president by the court, I have started studying the judgment on how best to implement it.

Madhuku further said that the ruling was clear that Chamisa was no longer the party president and he was free to form his own party.

He said:

Chamisa is somebody but nobody to claim the MDC presidency, the ruling is clear and his lawyers know better that he has been rendered a somebody who can form his own party where he can declare himself president

Breakthrough: Mthuli Says UK Firm Investing US130mln Into CSC

Cabinet has approved a joint venture between the Cold Storage Company (CSC) and a United Kingdom firm, Boulstead Beef (Pvt) Limited, which will see the investor injecting US$130 million into the meat processing firm.

This was said by Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa during a post- Cabinet Press briefing yesterday.

“Cabinet was informed by Finance and Economic Development Minister Professor Mthuli Ncube that the CSC is to be revitalised through a Concession Agreement under Rehabilitate, Operate and Transfer (ROT) terms,” said Minister Mutsvangwa.

She said under the agreement, Boustead would “raise and invest a minimum of US$130 million into CSC over five years”. The funds will be for capital expenditures and working capital for the business.

It will also pay off CSC’s financial debts totalling US$42 530 597 and pay rentals of US$100 000 per annum during the first five years of the concession agreement.

Boustead will also take over and manage CSC ranches in Maphaneni, Dubane, Umguza, Chivumbuni, Mushandike, Willsgrove and Darwendale for an initial period of 25 years.

Minister Mutsvangwa said Boustead will take over and run CSC abattoirs in Bulawayo, Chinhoyi, Masvingo, Marondera and Kadoma for an initial period of 25 years.

It will also take over and manage CSC’s distribution centres and residential properties in Harare, Gweru and Mutare for the same period.

Minister Mutsvangwa said the benefits to accrue to Zimbabwe from the investment agreement include, “increased capacity utilisation at CSC ranches and abattoir plants; increased prospects for restoration of the enterprise’s viability and higher throughput; stemming of further deterioration of equipment which is currently lying idle, and the growth of the local livestock and beef industry.”

Asked if 25 years was not too long while CSC was being operated by the private investor, Prof Ncube said the period was sort of a standard across the world, and can stretch to 35 years, since they are funded by debt.

Prof Ncube said 25 years would allow the investor to recoup their US$130 million and then give the CSC back to Government.

He said there are numerous advantages which include bringing back abattoirs to full functionality, providing raw materials to industry such as fat for soap making, and setting up out-growers.

Boustead Beef also plans to export products to countries like China, Botswana, and Angola, said Prof Ncube.

“So the benefits are incredible for the economy. We are happy with the progress so far and as Government are supporting them to make sure that they can really resuscitate CSC to its former glory,” said Prof Ncube.

He explained that Boustead Beef is “already on the ground” and has audited CSC’s infrastructure.

In the first year, Boustead is expected to invest US$45 million, with US$10 million set to be channelled towards the purchase of cattle to replenish the stock. The herd had dwindled to 341 animals across the country as of March 2017.

Boustead will invest US$6 million into abattoirs’ refurbishment, canning factory, distribution infrastructure, working capital and IT systems while US$500 000 plant equipment has been ordered and paid for.

The equipment is ready for shipping and would be installed upon arrival. The investor has started paying employee salaries from February this year and is also cleaning its facilities.

Boustead has also started buying cattle from South Africa and is also looking at restocking through facilities in Botswana, while some tenants who were occupying CSC ranches without permission have been relocated.

Illegal hunting in CSC ranches is also being stopped. Willowvale Motor Industries would assemble Boustead’s vehicles, creating backward and forward linkages.

The revival of CSC is in line with the Transitional Stabilisation Programme which seeks to arrest the rot in most parastatals. – state media

NORTON’s legislator Temba Mliswa has called on the government to speed up the arrest and prosecution of those implicated in corruption.

Mliswa also says President Mnangagwa must appoint him Minister of anti-Corruption as he will do the job which he says Justice Minister Ziyambi Ziyambi has failed to do.

Mliswa said ZANU-PF is full of land barons and gold barons which were stalling progress in key economic sectors.

Said Mliswa: “It’s common knowledge that ZANU-PF is responsible for the creation of land and gold barons. They’ve been ruling since 1980 and it’s unfair of them not to own up. ED Mnangagwa is loved by more people out of the party than in and it’s time he reshuffled Cabinet and got rid of the corrupt.

“When you have a Parliamentary portfolio committee full of gold barons who lead makorokoza, can you see it representing ordinary people’s rights and wishes?

Mliswa also said tourism minister Prisca Mupfumira was removed from the labour Ministry by former President Robert Mugabe because she was corrupt with her handling of NSSA funds.

President Emmerson Mnangagwa yesterday chided Justice, Legal and Parliamentary Affairs minister Ziyambi Ziyambi in public, accusing him of poorly executing his duties.

Mnangagwa made the remarks while officially opening the new Labour Court building constructed by the Judiciary Service Commission (JSC) in Harare.

“The Minister of Justice, who also chair the inter-ministerial taskforce in Parliament is relaxing; don’t relax,” Mnangagwa said. “I am disappointed that corruption cases are not moving. I implore all those who play a mammoth role in dealing with corruption cases to remain steadfast and deal with the cases,” he added.

Ziyambi, who also chairs the inter-ministerial taskforce in Parliament, was told to pull up his socks and be vigilant as Mnangagwa lamented the pace at which corruption cases were being handled.

Mnangagwa said his government was alive to the challenges being faced by the courts, but said he was not happy by the pace at which corruption matters were being executed. The President added that government will not interfere with the decisions of the court, but strive to respect the principle of separation of powers.

Khupe Ropes In Madhuku In Bid For MDC Presidency

By Own Correspondent- Following the High Court ruling which declared that Nelson Chamisa was not the legitimate leader of the opposition Movement for Democratic Change, leader of the other MDC faction, Thokozani Khupe has engaged Professor Lovemore Madhuku to implement provisions of the ruling.

Professor Madhuku is a renowned constitutional lawyer and lecturer of law at the University of Zimbabwe.

Speaking to the state media, Professor Madhuku confirmed that he has been engaged by Khuphe.

He also said that he has already commenced preparing on how to implement the court ruling.

Madhuku said:

After being engaged by Dr Khupe, who has been declared the legitimate MDC president by the court, I have started studying the judgment on how best to implement it.

Madhuku further said that the ruling was clear that Chamisa was no longer the party president and he was free to form his own party.

Chamisa is somebody but nobody to claim the MDC presidency, the ruling is clear and his lawyers know better that he has been rendered a somebody who can form his own party where he can declare himself president

Gumbura Fed Poisonous Beef At Chikurubi

State Media|The trial of jailed RMG Independent End Time Message leader Robert Martin Gumbura and his six co-accused on charges of attempting to escape from prison yesterday hit a snag after their lawyer indicated that his clients were not fit for trial as a result of sickness which came after consuming beef at Chikurubi Maximum Security Prison recently.

Gumbura, Blessing Chauke (29), Lucky Mhungu (42), Taurai Dodzo (51), Thomas Chacha (41), Elijah Vhumbunu (42), and Lucky Matambanadzo (43) are facing charges of attempting to escape from lawful custody, incitement in aggravating circumstances or alternatively conspiracy in aggravating circumstances for malicious damage to property.

Professor Lovemore Madhuku told the court that his clients were not feeling well and were not given time to see their doctors.

He said he had instructions to apply for referral to the Constitutional court following the dismissal of his client’s application for discharge at the close of the state’s case.

He said his clients felt an infringement of their constitutional rights.

Prof Madhuku said the question is whether or not the accused whose application for discharge at the close of the state’s case has been dismissed has an automatic constitutional right for review as part of his right for a fair trial.

Prof Madhuku said he was going to file the application today.

In response prosecutor Mr Michael Reza said the court has the power dismiss that application if it finds it frivolous and vexatious.

Mr Reza told the court that Prof Madhuku’s application is frivolous and vexatious and that he was opposing it.

“We cannot therefore proceed with trial if the accused persons are not feeling well,” he said.

Prof Madhuku last week had his application for the postponement of the trial dismissed.

It is alleged that during the morning of February 13, 2015 in B Hall, Gumbura allegedly incited other inmates to protest over the quality of food they were being served.

Chauke, Matambanadzo, Mhungu, Dodzo, Chacha, Vhumbunu, and three other inmates — who are now deceased — allegedly also influenced inmates to reject the porridge they were served, which did not have sugar, to aid their escape.

This resulted in prisoners vandalising property estimated at $500 000.

ED In Trouble As Doctors Issue Fresh Demands

ZHDA Secretary General, Dr Mthabisi Anele Bhebhe,

State Media|The Zimbabwe Hospital Doctors’ Association (ZHDA) has appealed to the Health Services Board (HSB) for better conditions of service saying inflation has eroded their salaries.

In a letter addressed to the HSB, ZHDA Secretary General, Dr Mthabisi Anele Bhebhe, said many government doctors were failing to meet their day-to- day costs as salaries had been devalued by the high cost of living.

“In the core of this economic decline, it is now impossible for government doctors to address their day-to-day basic financial obligations. Imperatively, since the last meaningful salary review in March 2018, transport costs, rentals, medical aid subscriptions and prices of basic household commodities have sharply increased.

“The parallel market rate of the USD remains a single determent of pricing of basic commodities,” he said.

Dr Bhebhe said they signed contracts which stipulated that they shall be paid in United States dollars under the multi-currency system and that must be honoured.

“The HSB must also recall that in the work contracts that doctors signed, salaries and allowances were clearly pegged in USD. We request the HSB to abide by labour laws and honour legally binding agreements,” he said.

Dr Bhebhe said many doctors risk contracting diseases and infections while attending to patients as hospitals were not providing them with sufficient materials to protect themselves.

Brutality; Police Officer And Council Security Officer Pull 16 Year Old Boy’s Private Parts And Leave Him For Dead

Usually very brutal Bulawayo City Security Officers seen here grabbing street vendors wares.

A police officer based in Bulawayo reportedly teamed up with a Bulawayo City Council security officer to abduct and brutally assault a schoolboy (16), leaving him for dead after pulling his private parts.

The two accused the boy of stealing a cell phone at a carwash last month.

The boy has since filed a police report at the West Commonage Police Station, which enabled him to be attended to at the United Bulawayo Hospital.

Acting Bulawayo Police spokesperson Inspector Abedinico Ncube on Friday confirmed having received such a report.

“Yes, the report was received and is under investigation,’’ Ncube said.

The boy was in great pain when Southern Eye visited him at his Mpopoma home.

The boy, a Form Four pupil at Msitheli Secondary School and stays with his brothers, said he now stayed indoors due to the trauma, adding he was having challenges in passing urine and walking.

He said his ordeal started on April 4, when he went to download his school material using Wi-Fi at a carwash owned by his neighbour, Thulani Tshuma in the suburb of Mpopoma.

“A Bulawayo council security officer identified as Milister Shumba told me and my colleague to wash a car. Shumba said the car belonged to his relative, only identified as Malfred.

Shumba said Tshuma had told him to instruct me to wash the car,” he said.

“After a week, the owner of the car accused us of having stolen his cell phone, power bank, bank cards and a flash card from his car. He reported the matter to West Commonage Police Station.”

The boy said they were taken to the police station where they met Constable Shumba, who interviewed them and only freed them after they had spend a night at the police station.

“After nine days, the policeman, the BCC security officer and Malfred came home around 11pm and took me to a dark place near Gampu Primary School, having deceived my neighbours that they were taking me to the police station,” the boy narrated.

“They told me to remove my clothes and stepped on my feet before kicking me and pulling my private parts for almost two hours. They took me back home and while on the way, the policeman hit me on the neck with fists, telling me not to tell anyone.”

Southern Eye saw the boy’s medical report, compiled by a doctor at the United Bulawayo Hospital, dated April 24.

Vimbai Tsvangirai Java On Path To Full Recovery Following Horror Crash

By Own Correspondent- Doctors say Vimbai Tsvangirai-Java, the daughter of the late opposition leader Morgan Tsvangirai, “will make a full recovery” after she was involved in a head on collision near truckers Inn just outside Kwekwe last night that killed two MDC Alliance officials.

A close member of the family said, “Vimbai suffered superficial head wounds, broken left hand and broken pelvis. Doctors say she will make a full recovery.”

Tsvangirai-Java is reportedly admitted at the Avenues clinic in Harare.

MDC Alliance national organiser, Amos Chibaya confirmed the death of two party officials, Paul Rukanda, who was Tsvangirai-Java’s campaign manager and Tafadzwa Mhundwa, Tsvangirai-Java’s relative who was also an active party member.

“We are deeply saddened by the unfortunate incident which took the lives of two of our cadres. We are in prayers with the bereaved families,” he said.

“We had a meeting in Bulawayo where we are conducting provincial caucuses with candidates presenting their manifestos and they were on their way to Harare when they were involved in the accident,” he said.

Kwekwe’s Assistant District Administrator, Clemence Muduma who was one of the first people to arrive at the scene said the Tsvangirai-Java was trapped together with the other occupants in the vehicle for close to 30 minutes.

“I called the fire fighters after efforts to retrieve them failed. The fire fighters came after about 30 minutes, and one person was confirmed dead by the police at the scene while the other is said to have died on admission to hospital,” he said.

Police in the Midlands confirmed the accident and said the crash was as a result of an overtaking error by the driver of a Toyota Mark X which was driving towards Kwekwe.

UK: What Are the Legal Rights of Agency Workers?

By Muchie Shamuyarira| Based on statistics provided by Acas, it is clear that there are agency workers who are unsure about their rights at work. But are companies aware of their legal obligations towards agency workers?

Indeed, recent Employment Tribunal cases such as Kocur v Angard Staffing Solutions, where the
Royal Mail Group was found to be in breach of the Agency Workers Regulations for treating an
agency worker less favourably, highlight that many companies are unclear of the legal requirements.

I consider some of the important questions and rights concerning agency workers below:

What is an agency worker?
An agency worker is an individual who has a contract with a recruitment company, to be supplied to work temporarily for a hiring company (or, as commonly known, a temp). This tripartite relationship means there are obligations on two parties: the agency and hiring company.

A genuinely self-employed individual will not be an agency worker, so if the individual is on business on their own account, the following rights will not apply to them.

Agency Workers Regulations 2010 (AWR).

The AWRs provide important rights for agency workers, concerning their basic working and employment conditions, from day one and after a 12-week qualifying period.

Day one rights: From the first day of an agency worker’s assignment, he or she must be given the same access as directly employed staff to facilities and amenities. This includes the canteen,
childcare facilities (such as a crèche) and car-parking or transport services.

Agency workers also have the right to be informed of any relevant job vacancies at the hiring company, to give them the opportunity to find permanent employment.

Importantly, the liability for failing to provide day one rights will fall on the hiring company only, as an agency has no involvement in providing these day one rights.

Week 12 rights: An agency worker will be entitled to the same basic conditions as they would have
been entitled to for doing the same job, had they been directly recruited by the hiring company.
This only applies once they have undertaken the same role, whether on one or more assignments, with the same hirer for 12 continuous calendar weeks.

There are complicated rules surrounding calculating the 12-week qualifying “clock”, so it might be worth speaking with a legal adviser if you are in any doubt whether an individual has reached the qualifying period.

The equivalent terms and conditions that agency workers are entitled to after the qualifying period
are:
• pay (including basic pay, holiday pay, individual performance-related bonuses, commission or
overtime);
• duration of working time;
• night work;
• rest periods;
• rest breaks; and
• annual leave.
This must be looked at on a term-by-term basis, rather than looking at the whole package. As recent case law has shown, it is not possible to compensate for less favourable terms in one respect, with more favourable terms in another (for example, a higher hourly rate to compensate for poorer rest breaks).

Importantly, an agency and a hiring company are each responsible for a breach of an agency worker’s week 12 rights, to the extent that they are responsible for the infringement.

It is therefore crucial for both parties to work together to ensure that the individual receives the
correct terms and conditions.

What about pensions auto-enrolment?

Pensions are not included within the AWR, which does mean that agency workers are not entitled to
pensions that match what they would receive directly from the hiring company.

However, agency workers are still jobholders for the purposes of automatic enrolment. As such,
agency workers must be automatically enrolled into a qualifying pension scheme.

The responsibility for automatic enrolment will fall on the agency, which has the contract with and pays the individual directly.

What about statutory sick pay (SSP)?
Provided the qualifying conditions are satisfied, agency workers will be entitled to receive SSP.

Again, the obligation to pay this to the individual will fall on the agency, but commercial
arrangements may dictate that the hiring company has to cover the cost.

Any enhanced company sick pay that a hiring company offers will not come within the AWR, so an
agency worker will not be entitled to receive this.

What parental rights do they have?

The AWR contains specific requirements for pregnant workers, once the 12-week qualifying period has been met.

After this time, pregnant workers are entitled to paid time off for antenatal appointments, and
alternative work (or pay) must be provided where they are unable to continue with an assignment
for health and safety reasons.

Agency workers are entitled to statutory maternity, paternity, adoption or shared parental pay, if the qualifying conditions are met. The obligation to pay these statutory amounts will fall on the agency, with the contract with the individual.

However, agency workers will only be entitled to statutory maternity, paternity, adoption or shared
parental leave if they are employed by the agency (as in, they have a contract of employment, rather
than the usual contract for services).

What next for agency workers’ rights?

The topic of atypical ways of working, including agency work, is a hot topic right now, with the
Government still considering and consulting on the recommendations made in Matthew Taylor’s review of modern employment practices. His review contained a number of recommendations specifically affecting agency workers, so the above rights may be expanded upon in due course. Watch this space!

Providence Pangira from Mutasa attained 13 points after he did Mathematics, Biology and Chemistry at Advanced Level. At Ordinary Level, he had 7 As and 4 Bs. His story captured the hearts of many after it was publicised by photojournalist Shepherd Tozvireva of Alpha Media Holdings.

Fortunately for Providence, his story was seen by social media personality and businessman Kuda Musasiwa who offered to Providence employment. Bhebhe Wants Chamisa And Khupe To Get Back Together, Will It Work?

FORMER MDC national organizing secretary Abdenico Bhebhe has added his voice to the High Court ruling which last week Wednesday nullified party incumbent Nelson Chamisa’s presidency saying the party needs to be united in this turmoil.

The High Court ordered that the MDC go for an extra ordinary congress giving a lifeline to all party members who were chucked out of the party after they refused to recognize Chamisa’s appointment as the interim leader in February 2018 by the party’s highest decision making organ; national council, following the death of party founding father Dr Richard Morgan Tsvangirai.

In an exclusive interview with 263Chat, Bhebhe said the party should use the ruling as an opportunity to unite for the benefit of the generality of the people of Zimbabwe.

“If the two MDCs were genuine that a mistake happened in the past they should take advantage of the ruling and possibly reunite not only for the good of the party but also for people of Zimbabwe who are tired of the current government’s machinations where the economy is grinding to a halt,” Bhebhe said.

Bhebhe’s remarks come after MDC T splinter leader Dr Thokozani over the weekend called for a dialogue among party members mentioned as respondents in Mashavire court application.

Bhebhe warned that opposition party members should be careful not create a political environment that gives Zanu PF an opportunity to pounce on them saying Elias Mashavire’s court application would have been avoided had the MDC’s politics been clean.

“Our politics in Zimbabwe is polarized. Polarization was started by Zanu PF and unfortunately, it has spilt into the opposition. Politics by its nature in Zimbabwe is not clean. It’s always dirty.

“We have been ruled by one political party that has abused the political power such that even within the opposition. We are no longer able to play clean politics and this creates a fertile ground for Zanu PF to abuse political power by interfering in opposition political affairs.

“The opposition should learn to play clean politics. If it plays clean politics, I don’t see any member of the opposition taking party or its leadership to court. Because the opposition politics was not clean, a man from Gokwe decided to sue the party.

“I don’t think Mashavire could have sued the party and its leadership if the opposition politics was clean,” Bhebhe said.

Bhebhe further opened up on the prospects of returning to the Chamisa led MDC saying if the party fan base and leadership realize his value he will gladly welcome the idea to readmit him back into the main opposition.

“My politics is not driven on individualism but it is the interests of Zimbabweans that continue to drive my politics. If Zimbabweans decide today to say go and join party X or B I will gladly do that,” he said.

Bhebhe was kicked out of the party last year alongside Thokozani Khupe, former party chairman Lovemore Moyo and former spokesperson Obert Gutu, after they refused to abide by the party’s decision to ascend Chamisa into the party driving seat on an interim basis. — 263Chat

Green Fuel Exposes Mnangagwa’s Empty Promise To Workers

President Emmerson Mnangagwa yesterday officially opened the new premises for the Labour Court of Zimbabwe in Harare where he made a commitment to enhance the administration of justice in the labour market.

While this colorful event was underway in Harare, Green Fuel, a company partly owned by government was busy dishing out dismissal letters to over 100 workers in Chisumbanje, Chipinge.

In its letter, Green Fuel quoted Section 12 subsection 4(c) of the Labour Act;

“This letter serves as notice to terminate your contract of employment. Your notice period will run from 10th May 2019 to 10th June 2019 in terms of section 12 subsection 4(c) of the Labour Act (Chapter 28:01).”

In his speech during the official opening of the Labour Court, Mnangagwa promised to be a defender of the workers’ rights.

“Employers and employees are at the centre of business, business in turn relies on the courts to protect not only proprietary interests but also the interests of workers” said Mnangagwa.

It is worrisome to have Green Fuel dismissing workers despite the government’s recent approval of 10 percent mandatory blending.

Armed with the government’s support on its product, it was prudent for the company to contribute towards the social and economic development of Chipinge community and the nation at large.

The laying off of workers by Green Fuel despite a government commitment to workers’ justice show a high level of insincerity on the part of the both the government and Green Fuel. 

“We are now skeptical about this project. Does it create or destroy employment? If I compare cotton farming that I was previously engaged in, I have a lot of regrets.” Fumed one of the laid off workers who preferred anonymity.

“We have always raised concerns as community stakeholders to pressure government to reign in on Green Fuel with little success. Green Fuel continues to operate without any considerations for social license as long as they continue to make profit,” said Claris Madhuku, Platform for Youth Development Trust.

“We hope the President will quickly realize that Green Fuel is exposing him by continuously operating without respecting fundamental human rights of local communities as always raised by PYD,” added Madhuku.

At Midrand in Johannesburg,a colourful meeting was convened under the disguise of fundraising.There was eating and drinking and broad smiles.

Some high ranking officials from Harare were present,and they had already seen themselves vatopinda.In their minds and according to their plan,Tsvangirai was already history.

Huge sums of monies were pledged. The plan was drawn.Target names were tagged.Responsibilities were given.Kwaimakwa vanhu kunge mubhora.

At congress,in Bethlehem Bloemfontein,th
e first phase of the plan was achieved.What followed was confusion and chaos as some members resisted the plan.Not long after the congress I was suspended,together with the then Information and Publicity Secretary Dr
Richard Wangu Mazodze who was subsequently “fired from the party”.

The plan was already in motion.I was the deputy Chairperson of the youth(MDC SAYA).

Most of the people who were used to spearheard the agenda were paid,and/or rewarded handsomely.Some are small business owners,as we speak.Some were sent to schools,their tution fees fully paid.I feel sorry for those were captured in the agenda they didnt know.Some have their eyes opened,some are still in the dark and in denial.

The agenda failed.Now we have entered a new phase.The agenda is still on.Like always we will triumph coz God is in it.

MDC Hails Its Supporters In Manicaland For Refusing To Be Intimidated By Zanu PF

Obert Gutu Is A “Nutcase”-Analyst

Farai Dziva| Prominent social media analyst Antony Taruvinga has described MDC T vice president Obert Gutu as “a nutcase and a bitter political figure.”

“While the party is aware of the fact that the Judiciary is 100% captured by the Mnangagwa Executive, the party will appeal against the flawed, incorrect, unenforceable and politically motivated judgement at the Supreme Court.

Political. The membership will defend the party from Zanu PF and such Zanu PF stooges as Mwonzora and Khupe. Gutu is a nutcase, no need to have anything said of him.

No assets will be taken, it’s their own dreaming.

The judgement is a non event. Nothing happened, Congress is going ahead as planned,” said Taruvinga.

UK: British Police Search For Missing Takunda Nyakabau

Police are appealing for help to find a missing 23-year-old man from Northampton.

Takunda Nyakabau was last seen on Friday, May 3, in the Duston and Dallington areas of Northampton.

He is described as a black man, about 5ft 6in, of slim build, with short black hair and brown eyes. He has a Midlands accent and is clean shaven.

Officers are concerned for his welfare and are urging Takunda to get in touch to let them know he is safe and well.

Takunda, or anyone who has seen him or knows of his whereabouts, is asked to call Northamptonshire Police on 101.

Killer, Rapist Cop Denies Police Statement, Pleads Innocent

By Own Correspondent- The cop who allegedly killed his 19 year old step-daughter after allegedly raping her has appeared in court where he disowned the statement produced by the police and pleaded not guilty.

Moses Nigel Jalasi appeared before Harare magistrate Babra Mateko before whom he raised complaints against the police alleging that he surrendered himself to the police and was assaulted severely and sustained injuries on his feet and knees.

Jalasi told the court that he was compelled by the police to write that he had raped the girl before murdering her but in actual fact, he hadn’t raped her but they had an altercation in the kitchen over food.

“During the altercation, we fought till we reached the bedroom and when we fell down, I took a scissors and stabbed her before I took her cellphone which I sold in town and proceeded to Mbare and bought beer at a shebeen,” said Jalasi.

As a result, Magistrate Mateko said the court will no longer consider his statement as he had disowned it.

The State led by Sabastian Mtizirwa alleged that on May 10, Jalasi was at their home in Eastlea with his step daughter Nyasha Unganai.

Jalasi is said to have approached his step-daughter who was in the kitchen and dragged her to his bedroom where he raped her before he stabbed her several times in the stomach until she died.

Jalasi stole the girl’s phone before he fled the house.

The State is also alleging that neighbours heard screams from Unganai but failed to assist as the door was locked and the same witnesses saw him fleeing through the front door.

Mtizirwa opposed bail prompting Mateko to refer Jalasi to the High Court for bail application.

The matter was remanded to May 27.-HMetro

MDC Mourns Accident Victims

The MDC expresses its heartfelt condolences to the Rukanda and Mhundwa families in particular and the MDC family in general, for the sad loss of Paul Rukanda and Tafadzwa Mhundwa in a tragic accident last night in Kwekwe.

Rukanda was the Glenview South District Organising Secretary, while Mhundwa was the Ward 7 Mt Pleasant vice chairperson.

Meanwhile, Glen View South legislator, Hon Vimbai Tsvangirai Java and Mrs Muringani, the Harare West ward 16 Women’s Assembly Chairperson, were injured in the same accident.

Mhundwa is the brother to the late Susan Tsvangirai.

Rukanda was Hon Tsvangirai Java’s campaign manager, and they were on their way to Harare after attending the Bulawayo provincial campaign caucus. She is campaigning to be the Assembly of Women’s Secretary.

Hon Tsvangirai Java has been admitted at a Harare Hospital while Mrs Muringani has since been discharged.

We wish Hon Java a speedy recovery.

Tragedy, As 11month Old Baby Drowns While Trying To Retrieve Toy

By Own Correspondent- Tragedy struck a Headlands family after an eleven-month-old baby drowned while while attempting to retrieve a toy.

Leshley Mawarira drowned in a 20 litre bucket while her mother, Nyaradzai Nyamariodza, (26) was doing laundry a few metres away from their homestead.

Manicaland police spokesperson Inspector Tavhiringwa Kakohwa confirmed the incident which occurred in Headlands near the Half Way House along the Mutare-Harare highway.

“On May 12 this year at around 10am, the mother of the child Nyaradzai Nyamariodza (26) left her baby playing with other kids as she went to do her laundry some 30 metres away from their house,” he said.

“Nyamariodza left three 20-litre buckets filled with water near where the kids were playing along with her baby. It was when her baby dropped the toy into one of the buckets.

“The baby then fell into the bucket head first as she was attempting to retrieve the toy from the bucket and drowned,” he said.

Insp Kakohwa said Nyamariodza found other kids trying to rescue her daughter from the bucket upon her return home.

She reportedly took her child to the hospital where she was pronounced dead on arrival.

Her husband reported the matter to the police.

In a related matter, another woman from Sereko Village under Chief Saunyama in Nyamaropa, Nyanga, returned home to find her one-year-four-month-old baby dead in a bucket full of water.

Jane Khumbula had gone to fetch water from a borehole and had left the baby playing with her three-year-old sister.

The body of the child was taken to Regina Coeli for a post-mortem.

“You Are Singing For Your Supper”: Chief Ndiweni Hits Back At Matemadanda

By Own Correspondent- Ntabazinduna Chief Felix Ndiweni who was recently mocked by deputy defense minister Victor Matemadanda for inviting more sanctions on Zimbabwe has hit back suggesting that the war veteran stalwart is singing for his meal.

Chief Ndiweni wrote on Twitter suggesting that actually, Matemadanda was the real security threat to the general populace. Ndiweni wrote:

Secretary general of the war veterans has labelled me Chief Ndiweni as a security threat. Question to you Victor Matemadanda is between us. Who is a security threat, considering citizens are now worse off than they were and you sing for your meal,?.

Matemadanda warned Chief Ndiweni yesterday saying that he was playing with fire by inviting sanctions and calling for the removal of president Mnangagwa. He also described Ndiweni as an attention seeker who cannot do anything to influence the removal of president Mnangagwa.

Chief Ndiweni, however, got support from various social media users who argued that Matemadanda and ZANU PF never rebuked Chief Council President Fortune Charumbira who unceasingly has been endorsing president Mnangagwa.

Walter Mzembi Faces Extradition, To Stand Trial

By Own Correspondent- The State has made an undertaking to ensure that former Minister Walter Mzembi is extradited from South Africa to stand trial in Zimbabwe.

Representing the State special unit prosecutor Brian Vito sought a postponement for the umpteenth time asking for the indulgence of presiding magistrate Hosea Mujaya to give them a long remand.

“We are seeking the indulgence of the court for one more long remand as we are anticipating that the extradition proceedings are going to take long as they involve jurisdiction from another country.

“We are hoping that on the next date, he will be here and trial will commence,” said Vito.

The application prompted Magistrate Mujaya to question Vito whether he was aware of President Mnangagwa’s grievance at the official opening of the new Labour Court yesterday where he said he was unhappy at the slow pace in which the courts were dealing with anti-corruption cases.

When asked where Mzembi is, his lawyer Job Sikhala said he is not aware of his actual location at the moment but has instructions that Mzembi is still indisposed due to colon cancer.

Mzembi’s accomplices Aaron Mushoriwa and Miriam Sangarwe opposed the applicatuion for postponement saying that the two times they consented to the application, they always find themselves in the same position.

“The accused persons were arrested on February 7 last year and a period of 15 months has lapsed but the presiding magistrate has the mandate to oversee that accused persons are brought to trial within a reasonable time.

“One and a half years is unreasonably long and the court must look at the due process and see if it is going to harmed if accused persons are removed from remand, they are of fixed aboard, Sangarwe is the chairperson of the Gender Commision and she would never flee,” said lawyer Farai Mushoriwa.

Generator Thieves To Spend 1yr Behind Bars

By Own Correspondent- Two generator thieves were sentenced to 12 months in prison for their crime

The two Harare men will spend the next one year behind bars for stealing a generator worth US$250.

Innocent Tore, 23 and Takunda Chikodzi, 22, were found guilty of stealing a generator when they appeared before a Harare magistrate.

The State proved that on May 5 this year around 11pm Ndlovu and her husband went to bed and left their storeroom door locked.

Tore, Chikodzi and their accomplice who is still at large went to Ndlovu’s house and used an unknown object to break the storeroom door and gained entry where they took a Nexus 5,5 horse power generator and went away unnoticed.

On May 6 around 5 am Ndlovu’s husband woke up and discovered that the storeroom door was open, he then checked inside and discovered that the generator was missing.

Ndlovu then reported the matter to the police.

On the same day around 2pm Tore and Chikodzi were apprehended by the security guards who were patrolling in the area and they took them to Highlands Chishawasha base where they were interviewed by the police.

Tore and Chikodzi admitted that they stole the generator and they led the police to Ndlovu’s house where they demonstrate how they stole the generator.

Two Victims In Vimbai Tsvangirai Java Accident Named

By Own Correspondent- Vimbai Tsvangirai-Java is reportedly admitted at the Avenues clinic in Harare.

There are, however, conflicting reports on Tsvangirai-Java’s condition with Midlands based MDC Alliance national organiser, Amos Chibaya saying she is stable while the party’s spokesperson Jacob Mafume said she is battling for her life.

Two MDC Alliance officials were killed when a car belonging to the late MDC- T leader, Morgan Tsvangirai’s daughter, Vimbai, was involved in a head on collision near truckers Inn just outside Kwekwe last night. Tsvangirai-Java who is also Member of Parliament for Glen View South was said to have sustained serious injuries together with another unidentified occupant.

Mr Chibaya identified the two deceased as Paul Rukanda, who was Tsvangirai-Java’s campaign manager and Tafadzwa Mhundwa, Tsvangirai-Java’s relative who was also an active party member.

“We are deeply saddened by the unfortunate incident which took the lives of two of our cadres. We are in prayers with the bereaved families,” he said. Chibaya said Tsvangirai-Java and company were coming from a party meeting in Bulawayo when the accident occurred.

“We had a meeting in Bulawayo where we are conducting provincial caucuses with candidates presenting their manifestos and they were on their way to Harare when they were involved in the accident,” he said.

Kwekwe’s Assistant District Administrator, Clemence Muduma who was one of the first people to arrive at the scene said the Tsvangirai-Java was trapped together with the other occupants in the vehicle for close to 30 minutes.

“I called the firefighters after efforts to retrieve them failed. The firefighters came after about 30 minutes, and one person was confirmed dead by the police at the scene while the other is said to have died on admission to hospital,” he said.

Police in the Midlands confirmed the accident and said the crash was as a result of an overtaking error by the driver of a Toyota Mark X which was driving towards Kwekwe.

Woes Mount For Mnangagwa, What Next?

By Own Correspondent- President Mnangagwa is facing a difficult moment as crises continue to worsen. In addition to the shortage of fuel, soaring inflation that has eroded salaries, and the shortage of medicines in health facilities, the country is entering into winter without power.

This follows the recently imposed blackouts schedules by the Power utility Zesa Holdings which shall see industries and households going without electricity for up to eight hours per day. ZESA Holdings is attributing the power outages to low water levels at Kariba Dam which supplies water to the key Kariba South Power Station.

Sifelani Jabangwe, Confederation of Zimbabwe Industries president said that the blackouts shall worsen an already undesirable situation. He further suggested that imports be increased since locally produced goods will be insufficient for the demand.

To make matters worse, doctors and teachers at public institutions yesterday gave the government a half a month ultimatum to rectify issues regarding their salaries and working conditions.

They are demanding salaries in United States dollars, among other benefits, or else they withdraw their services. They claim the salary adjustment awarded to them last month has already been eroded by the escalating cost of living.

Takavafira Zhou, president of the PTUZ and Obert Masaraure, leader of the Artuz said that they have written to the government demanding better salaries.

S.A Police Launch Manhunt For Robbers Who Terrorised Guest Houses

By Own Correspondent- Police in Apel near Lebowakgomo outside Polokwane have launched a massive manhunt for a group of armed suspects, among them a Zimbabwean man, in connection with a case of robbery at guest houses in the Mohlaletse area.

Limpopo police spokesperson Colonel Moatshe Ngoepe identified the Zimbabwean as Bothwell Mlagisi.

“It is alleged that a group of suspects attacked the employees at this overnight accommodation, shot one of them and ransacked the building,” he said.

“The suspects thereafter uninstalled the plasma TVs on the walls, loaded them inside their vehicle and stole several other electrical appliances before they fled the scene in a white BMW sedan.

“The police were summoned and reacted swiftly. They immediately went after the suspect’s car until its driver lost control, veered off the road and rammed into a tree. The suspects then fled on foot.

“Our officers searched the car and recovered more than 10 plasma TVs, cellphones, TV remote controls, laptops, CCTVs, clothing, etc.”

Col Ngoepe said the vehicle used by the suspects belonged to one of the national soccer team players.

He said the player has not been arrested but was assisting police with investigations.

“Preliminary investigations revealed that he was not in the car during this incident but he is cooperating with the police to track down the suspects, one of whom has already been identified.

“The suspects involved in this matter, including the driver of this motor vehicle, is still on the run.

‘‘The police are calling upon Bothwell Maligasi, who is a Zimbabwean national, to come to Apel Police Station or the nearest police station to assist with investigations in this matter,” said Col Ngoepe.

Soul Jah Love Admits Abusing Drugs

By Own Correspondent- Soul Jah Love has admitted to taking all sorts of drugs but said he is now on the path to recovery and has stopped taking some of them.

The Conquering Family boss admitted to taking cocaine, broncleer (cough syrup) and marijuana but said he has since stopped taking cocaine and broncleer.

He said his weakness is still with marijuana, which he preferred to categorise as a herb.

“Zvimwe zvese ndakasiya, but chandichiri kurova imbanje, mbanje pazvese unonyatso meditator haikuvhiringi sezvimwe izvi, plus ndiyo yatakatanga kuziva so maybe it the first love.

“I actually pray we legalise it like other countries have done,” he said.

He said it is cocaine that made him go insane and affected many things in his life like losing his wife Bounty Lisa, whom he apologised to.

“When I started travelling abroad for shows ndakasangana nezvakawanda, that’s where I discovered drugs like cocaine.

“I kept on taking it and it changed me to a person I didn’t want to be, I lost my wife Bounty Lisa and I want to say I’m really sorry.

Vimbai Tsvangirai Java, the daughter of the late former Prime Minister Morgan Tsvangirai escaped the accident with injuries and is in Hospital. Posting on his Twitter page, president Mnangagwa said:

Very sorry to hear of the tragic car crash that claimed the lives of two committed MDC activists and injured Vimbai Tsvangirai.

My thoughts are with the loved ones of the deceased, and I join the Tsvangirai family and the nation as a whole in praying for Vimbai’s speedy recovery,

Furore Over Maintenance Of Peace And Order Bill, Is It Another POSA?

By Own Correspondent- Opposition and ruling party legislators have clashed over the new Maintenance of Peace and Order Bill (MPOB). The bill is yet to be exposed for public hearings before it is debated in Parliament.

MPOB was proposed as a replacement of the infamous Public Order and Security Act (POSA) which was viewed as draconian in some cricles.

Critiques have claimed that the bill is a reflection of POSA and the purported changes are superficial.

Opposition party MDC legislator Theresa Makoni said:

Police as the authorities responsible for these things can give or not give permission. I personally think that if the situation is maintained, then there will be no difference between the old POSA and this new Bill.

I believe that the authority of the police is excessive. They should not be the ones to say yes or no to the demonstration, It should just be a notification and nothing more than that.

Makoni’s remarks caused displeasure to some legislators belonging to the ruling party among them Joseph Chinotimba. Chinotimba accused opposition parties and civil society groups of “complicating” things, describing the bill as perfect. His sentiments were shared by Zanu Pf Deputy Chief Whip Obedingwa Mguni who said that the authority given to the police shall ensure law and order.

The clause in this Bill is very welcome, the one which states that for those who seek to hold a meeting publicly, be it a political rally, a wedding, a church gathering and so forth with people exceeding 15 they should notify the police

Security Agents Seize Chombo’s Passport At Robert Mugabe International Airport

By Own Correspondent- Ignatius Chombo, a former cabinet minister aborted his trip on Sunday after his passport was seized by security agents at Robert Gabriel Mugabe International Airport in Harare.

The passport had been released to him on Friday last week by Harare magistrate Barbara Mateko who postponed his matters to June 27. Prosecutor Tapiwa Kasema consented to Chombo’s application for the release of the passport on the grounds that he wanted to seek medical attention in South Africa.

NewsDay reports that there was a brawl at the RGM International Airport after the security agents took his passport which was later surrendered at the Harare Magistrates’ Court clerk office.

Chombo’s lawyer Tungamirai Muganhiri could neither confirm nor deny the developments, asking to be contacted today for a comment.

Chombo is among several former top government officials who were arrested following the demise of former president Robert Mugabe in connection with corruption.

There are some who argue that arrests are not enough for a country that is close to the top of the list of most corrupt countries world wide. Some have even went on to suggest that these arrests were selectively targeted on G40 members.

Mnangagwa Ropes Himself Into Vimbai Tsvangirai Accident.

Zbc News|President Emmerson Mnangagwa has mourned two MDC activists who died in an accident while travelling from Bulawayo after a party meeting.

The accident happened last night in Kwekwe and left Glenview South legislator and daughter of MDC founder, Morgan Tsvangirai, Vimbai Java Tsvangirai seriously injured.

President Mnangagwa took to his Twitter account to express his sadness to the tragedy.

“Very sorry to hear of the tragic car crash that claimed the lives of two committed MDC activists and injured Vimbai [Java] Tsvangirai. My thoughts are with the loved ones of the deceased, and I join the Tsvangirai family and the nation as a whole in praying for Vimbai’s speedy recovery,” said President Mnangagwa.

The opposition party’s Twitter account confirmed that another senior party member, whose name has been withheld, is in a critical condition.

Reports indicate that the deceased were trapped in the wreckage for about 3 hours.

Killer, Rapist Cop Hauled To Court Over Stepdaughter’s Murder

A 27-year-old Harare man yesterday appeared in court on allegations of fatally stabbing his stepdaughter with a scissors after reportedly raping her.

Moses Nigel Jalasi, a policeman stationed at Braeside Police Station, was charged with murder when he appeared before Harare magistrate Mrs Barbra Mateko.

His lawyer Blessing Mupwanyiwa told the court that his client had complaints against the police whom he accused of physically assaulting him.

Asked whether he freely wrote a statement tendered before the court by the State, Jalasi said he was forced to write it as he was being assaulted by the police.

He said he was being forced and told what to write in the statement.

Mrs Mateko deferred the matter to May 27 and advised Jalasi to apply bail at the High Court.

It is alleged that on May 10 this year, Jalasi was at number 41 Northampton Cresent, Eastlea Harare, together the now deceased Nyasha Olga Unganai who is his stepdaughter.

It is the State’s case that Jalasi approached Unganai who was in the kitchen and dragged her into the bedroom where he forcibly removed her pant and raped her.

After raping her, Jalasi allegedly took a scissors which was in the wardrobe and stabbed Unganai several times on the stomach until she died.

The court heard that Jalasi stole Unganai’s cellphone before vanishing from the scene leaving her in a pool of blood.

In a related story, Gletwin man recently shot and killed his wife and brother-in-law at their Gletwin home following a protracted marital dispute.

Petros Pomborokani (50), a former Ministry of Health and Child Care official, has since gone into hiding.

He shot his wife, Olivia Zenda (42), and brother-in-law, Robert Zenda (49), in front of his three children, mother-in-law, a relative and a housemaid, with a CZ pistol at around 7am.

The couple had been married for 20 years and has four children aged 19, 12, 10 and eight. -StateMedia

Chidzambwa To Name Preliminary AFCON Squad Today

Farai Dziva|Warriors coach Sunday Chidzambwa will today announce his preliminary squad for the Afcon and Cosafa tournaments.

The squad announcement will be made at the Holiday Inn in Harare at 12 pm.

The national team will feature at Cosafa tournament in South Africa from June 1 before travelling to Egypt for the Afcon which starts on June 21.

They will start their title defence at the regional competition in the quarterfinals on the 1st of June against winners of Group B. At Afcon, the Chidzambwa coached side will begin the campaign on the first day versus the hosts, Egypt.

Zimbabwe is also scheduled to play a couple of friendly games before the trip to North Africa, with the match against Nigeria on the 8th of June already confirmed.

The date of the fixture, however, clashes with that of the Cosafa final.

Serious Water Rationing, As Gweru Is Left With 3 Months Supply

By Own Correspondent- Gweru City Council has introduced water rationing, amid indications that Gwenoro dam, is now left with only three months’ water supply.

The development has seen suburbs such as Mkoba 19 and 20 going for months without water.

Gweru Mayor Councillor Josiah Makombe said the local authority has introduced water rationing.

“To save the situation, we have decided to introduce water rationing and we are in process of coming up with a programme to manage existing supplies and to share the equitably.

“The situation is bad but we are trying to make sure that every suburb gets water as scheduled,” he said.

Clr Makombe said the local authority will also drill an additional 20 boreholes in residential areas to augment the already existing boreholes which he said were now overwhelmed.

“Now that we have introduced water rationing, as council, we agreed that we need to come with measures to cushion residents during water rationing, and one of the measures includes drilling 20 boreholes throughout the city,” he said.

Clr Makombe said the boreholes will be using electric power to pump water and will be linked to the municipality’s water system.

“The type of boreholes we want to drill will be connected to the city’s water infrastructure and they will use electricity to pump water. The pumped water will then be channelled through water pipes to various suburbs so that we can still bill the consumers,” he said.

Clr Makombe said they were working with partners in the boreholes project.

“We are working very hard together with our partners to make this project a success,” he said. The Herald

Gumbura Trial In False Start, As Co- Accused Fall Sick

By Own Correspondent- The trial of jailed RMG Independent End Time Message leader Robert Martin Gumbura and his six co-accused on charges of attempting to escape from prison yesterday hit a snag after their lawyer indicated that his clients were not fit for trial as a result of sickness which came after consuming beef at Chikurubi Maximum Security Prison recently.

Gumbura, Blessing Chauke (29), Lucky Mhungu (42), Taurai Dodzo (51), Thomas Chacha (41), Elijah Vhumbunu (42), and Lucky Matambanadzo (43) are facing charges of attempting to escape from lawful custody, incitement in aggravating circumstances or alternatively conspiracy in aggravating circumstances for malicious damage to property.

Professor Lovemore Madhuku told the court that his clients were not feeling well and were not given time to see their doctors.RELATED ARTICLES

He said he had instructions to apply for referral to the Constitutional court following the dismissal of his client’s application for discharge at the close of the state’s case.

He said his clients felt an infringement of their constitutional rights.

Prof Madhuku said the question is whether or not the accused whose application for discharge at the close of the state’s case has been dismissed has an automatic constitutional right for review as part of his right for a fair trial.

Prof Madhuku said he was going to file the application today.

In response prosecutor Mr Michael Reza said the court has the power dismiss that application if it finds it frivolous and vexatious.

Mr Reza told the court that Prof Madhuku’s application is frivolous and vexatious and that he was opposing it.

“We cannot therefore proceed with trial if the accused persons are not feeling well,” he said.

Prof Madhuku last week had his application for the postponement of the trial dismissed.

It is alleged that during the morning of February 13, 2015 in B Hall, Gumbura allegedly incited other inmates to protest over the quality of food they were being served.

Chauke, Matambanadzo, Mhungu, Dodzo, Chacha, Vhumbunu, and three other inmates — who are now deceased — allegedly also influenced inmates to reject the porridge they were served, which did not have sugar, to aid their escape.

Victim Becomes Villain, As Newsday Journalist, Wife Are Charged With Assaulting Former Deputy Minister

By Own Correspondent-The trial of NewsDay senior reporter Blessed Mhlanga, who is accused of assaulting former Finance deputy minister during a radio show last year failed to kick off after the docket documenting the case disappeared.

Mhlanga, who is being charged together with his wife, Florence, was summoned to appear on trial yesterday by the State, which asked for a postponement because the presiding magistrate Eric Kadye was being transferred and could not take new matters.

Mhlanga then complained through his lawyer Chris Mhike and demanded that his matter be heard because the State could not summon him to court for a postponement.

The State then told the court that they could not find the docket and then released, him saying they will proceed by way of summons.

Allegations were that on May 24, last year at SpotFM studio, Pockets Hill, Highlands, Harare, Mhlanga and Florence allegedly assaulted Mukupe by pushing him with open hands and pulling his jacket.

Mhlanga, however, alleges that Mukupe, who was in the company of his two bodyguards, was the one who actually attacked Mhlanga and stole his wife’s cellphone after a radio interview.

Mukupe was unhappy over a story published by NewsDay, after being captured on camera saying the army had forcibly grabbed power from former President Robert Mugabe in a coup in 2017, in an effort to block opposition leader Nelson Chamisa from taking leadership of the country.

Mhlanga then reported the assault and theft of property case by Mukupe,who was at that time the legislator for Harare East to the ZRP at Highlands.

However, the police have taken a year to investigate the matter and have instead charged the victims.-Newsday

Resident Receives Death Threats For Exposing Corruption


A Budiriro 5 resident is reportedly receiving death threats from Ward 43 councillor after mobilising other residents to remove land barons in the area.


The development comes after Henry Chimbiri organised a meeting with other residents in a bid to chase away alleged land barons.


Chimbiri has since lodged a report with Budiriro 2 police under CR-469/04/19 and the councillor Norman Makondo has also been summoned to the police to help police with investigations.


“I am a resident in the area and I addressed a meeting concerning land barons in our area.


“The meeting was held on April 26, 27, 28 and 29 and present was the Member of Parliament Costa Machingauta, officials from the Harare Wetlands Trust, Water Alliance Trust and the residents.
“After the meeting, I started receiving death threats from Makondo.


“The night after the last day of the meeting, people came to my house around 2am and smashed my car.
“That is when I knew that my life was now in danger which made me report the case to Budiriro police station.


“We were able to stop the land barons after the meeting and I will not stop fighting for our area even if they threaten me,” he said.


Added Chimbiri:
“We had a meeting with the District Officer, the land barons and the Member of Parliament but the councillor refused to come before he went on to tell people that the meeting was cancelled and that I was chased away,” he said.


Councillor Makondo said the alleged threats were responses to what Chimbiri had posted to him.
“I did not pose any threats on him but what I did was responding to what he started.


“I think he is having problems because he is saying things that are not true at all. I was even summoned at the police station where he reported the case.


“He is having an issue with me because I refused to chase away a legal owner of a stand he wanted to buy but failed since he did not have the money,” said the councillor.H-Metro

“I Will Play My Father’s Songs”: Selmor Mtukudzi

By Own Correspondent- The late music icon and national hero Oliver “Tuku” Mtukudzi’s daughter, Selmor — who has been largely touted as heir to the superstar’s music throne — said she has worked hard over the years to develop herself into a brand without ever riding on her father’s coattails.

Speaking during a presentation held under the theme Taking over my Future Today at Chinhoyi University of Technology (CUT) recently, Selmor, however, said she would continue performing her father’s music.

“The Tuku legacy is living on, definitely. We may have lost him; the hero, he is no longer with us today… (but) his music will live on. I will continue to play my father’s songs during my shows,” she said, to wild applause.

“I personally will not stop performing my father’s music.”

The sentiments came in the wake of questions flying around on whether or not she would be able to continue playing Tuku’s music.

The deceased discography is housed under the Tuku Music Promotions (Pvt) Ltd that was part of the estate willed to Daisy Mtukudzi in Tuku’s last will and testament recently lodged with the Master of the High Court.

Selmor, who was accompanied by her husband Tendai Manatsa and elder sister Sandra, said her rise to stardom was a result of sheer determination and hard work spanning over 15 years.

She admitted that being the daughter of a legendary musician made life tough because “being the daughter of the legend, many thought I would be thrust on the grand stage without any hard work.

“People believed life would have been easy for me, but what I’m happy about is that I managed to find myself and followed my passion.”

The now much-sought-after star said the road was arduous.

She started off as a backing vocalist for bands, including Jabavu Drive, Kwekwe Band, Tanga WekwaSando and as part of Pax Afro.

Selmor recalled the dry years when she sometimes had to play in virtually empty venues as promoters and proprietors of entertainment joints slotted her during odd, mid-week days when patrons were very few.

“People would unfairly compare me with my dad, the legend, instead of judging my talents against my contemporaries such as Tariro NeGitare,” she lamented.-Newsday

Jah Signal Eyes BAA Nomination

By Own Correspondent- Fast-rising Zimdancehall artiste Jah Signal who staged a stellar performance at the MSU Main Campus in Gweru over the weekend, says he wants a Bulawayo Arts Awards (BAA) nomination.

The musician who has been outshining established artistes in the industry at most shows, failed to earn a spot in this year’s Outstanding Arts Personality from outside Bulawayo category which has big names in the industry in the form of Oskido, Winky D and Jah Prayzah.

Towards the end of last year and the beginning of this year, Jah Signal was constantly in Bulawayo performing due to public demand.

All the shows were well attended showing that he has become a darling of the city revellers.

It is this support that has made him want to be part of the BAAs.

“The support we’ve been receiving from Bulawayo is amazing. In a period of six months we had more than seven shows which were marketed in a day or so but attracted full houses.

“The Swaah family is now working flat out to meet the BAA requirements for the outside of Bulawayo artistes’ category next year,” Jah Signal, through his manager, Hillary ‘Punchline’ Mutake said.

Chitungwiza Vending Stalls Demolitions, High Court To The Rescue

By Own Correspondent- The High Court has come to the rescue of vendors operating at Zengeza 2 market place instructing Chitungwiza Municipality to stop demolishing their vending stalls.

The development comes amid indications that the local authority intended to clear the area for Econet Wireless to establish its business centre.

The High Court ruled in favour of the vendors who were set to lose their vending sites.

This was revealed from recent minutes of the Municipality’s Finance Committee, where it said that it has shelved plans to build the centre until the court case has been finalised.

There was a letter which was written by the then town clerk Tanyanyiwa which was used against us in court and the council lost the case.

It was advised that the council was not supposed to tamper with the structures and the area was supposed to continue housing the markets.

He indicated that there was an interdict against council not to demolish and at the moment municipality hands were tied.

The vendors are reportedly operating without licenses and this has prejudiced the council of over $5 500.

Further, the Acting Housing and Community Services director Mr Tendai Chinganga revealed that the land the vendors were operating from was not pegged by the council.

Gwanda Robber Breaks Into Shop, Rapes Shopkeeper

By Own Correspondent- A Gwanda man has been arrested after he allegedly broke into a shop, raped the shopkeeper before stealing $45 and property worth $200.

Vincent Dube of Kafusi Village was not asked to plead when he appeared before Gwanda magistrate, Miss Lerato Nyathi, facing rape and robbery charges.

He was remanded in custody to May 20.

Prosecuting, Miss Ethel Mahachi said Dube raided Bambazonke Shop at Simbuka Business Centre on May 14 last year in the middle of the night.

“On 14 May 2018 at around 6PM, the complainant closed the shop and locked the doors before retiring to her bedroom which is within the shop. During the night the complainant heard some movements outside the shop and when she woke up she heard someone trying to open the back door of the shop which was locked,” said Miss Mahachi.

“The complainant screamed but no one came to her aid. Dube forcibly opened a window to the shop and gained entry. He grabbed the complainant and dragged her outside the shop into the darkness.

“The complainant screamed for help but Dube produced a knife and threatened to stab her if she continued making noise. Dube pushed the complainant to the ground and raped her.”

Miss Mahachi said after raping her, Dube dragged the complainant back into the shop and ordered her to give him all the cash that she had.

She said Dube took $45 cash, a black amplifier, two pairs of North Star shoes and a Samsung cell phone all valued at $200 and fled.

Miss Mahachi said the matter was reported to the police and Dube was arrested following investigations.

She said the police recovered the stolen property from Dube’s house but the money was missing.

“The complainant was summoned to the police station where she positively identified the recovered property as hers. Dube was later apprehended by members of the public who found him driving stolen donkeys,” Miss Mahachi said.

“Stop Wasting Water”: Bulawayo Residents Told

By Own Correspondent- Bulawayo residents have been accused of wasting water at a time when dam levels recede at a faster rate.

The low water levels in the city’s supply dams were exacerbated by a drought-induced by the El Nino weather phenomenon experienced during the 2018/19 rainy season.

The latest council report shows that water consumption in the city has been rising steadily since last month.

Engineering Services Director Engineer Simela Dube said:

Weather forecasts for the year 2018/2019 show that the country is likely to experience an El-Nino induced drought.

In addition to this, the City of Bulawayo has seen a steady rise in the consumption of water from an average of 120ML per day to about 145ML per day.

Consequently, this has had an effect in the depletion period of an average of theoretical 29 months.

In this regard, a downward revision of water allocation is sought to hedge against the negative impact of limited rains anticipated in the 2018/2019 season and increased water usage in the city. This request has been approved by council and implementation is in progress.

The council advised residents against the habit of water hoarding, saying such acts result in artificial shortages of water.-StateMedia
