1000 Arrested For “Violating” Mnangagwa Curfew

MORE than 1 000 people were arrested on Wednesday countrywide for flouting Covid-19 national lockdown regulations while in Bulawayo, police arrested 170 people and impounded 90 vehicles for lockdown defiance.

President Mnangagwa on Tuesday announced new measures which include cutting operating hours for businesses from 8am to 3pm as well as the introduction of a 6pm to 6am curfew following a surge in new infections and deaths due to Covid-19.

Also arrested the same day were 11 people at Nyamapanda and at Beitbridge border posts for illegal border crossing and smuggling of goods.

The police also reported that one deportee escaped from Standard Hotel quarantine centre in Bulawayo.

People escaping from quarantine centres have been accused of fuelling local infections which today are at 1 046 against imports which are at 988.

Police have launched several operations targeting those operating public transport without exemption letters.

In a statement yesterday, national police spokesperson Assistant Commissioner Paul Nyathi said to date 111 979 people have been arrested for contravening the national lockdown regulations.

“The Zimbabwe Republic Police arrested 1 363 people throughout the country on 22 July for various offences related to contravention of the national lockdown regulations, bringing the total accumulative arrest to 111 979.”-Chronicle

COVID-19 Death Toll Rises To 28

With 90 patients testing positive for Covid-19 yesterday, 83 of them local infections, the Zimbabwean total reached 2 124 and two new deaths drove the death toll to 28.

The daily number of new infections shows a drop from the three-figure totals of the last few days.

In its daily report, the Ministry of Health and Child Care said just nine of the local infections had known contacts and medical staff were investigating the other 74 to try and find the source of infection.

All seven quarantined returning residents who tested positive had been infected in South Africa.

The first death reported was a Harare resident who tested positive on Monday, but also had other illnesses.

The Bulawayo death was patient admitted to hospital yesterday with Covid-19 symptoms.

The number of Zimbabweans confirmed to have recovered remains at 510.

Harare is rapidly catching up with Bulawayo in confirmed local infections with 60 of yesterday’s batch coming from the capital.

The latest figures show Bulawayo with 551 confirmed local infections and 13 deaths, and Harare with 357 confirmed local infections and nine deaths.

Midlands is third with 68 cases and two deaths.

South Africa remains the regional epicentre with 5 940 deaths from 394 948 confirmed cases, although 229 175 of these, well over half as the rate of infection slows, have now recovered-The Herald

It is with great boldness dear Zimbabweans to share with you that despite oppressive circumstances we are in, never should we give in to the suffocation of our right to speak out against the excesses of the State against its citizens.

Giving in to oppression is rewarding and burying our future to the oppressor. The arrest and incarceration of our colleagues Hopewell Chin’ono and Jacob Ngarivhume for simply speaking against looting and corruption has never been witnessed in modern civilization. It is now clear even to the most daft that the world was sold a charade of the so called new dispensation.

Criminalising a cry against looting is bringing our country to the world of the wildlife. Oppressors enjoy looting and all the luxuries of life when they are silencing everyone. 40 years of independence we have suffered indurable oppression in our own country.

From Monday this week the oppressors created a barrack of all its security agencies around my house. The Feret team was deployed at my house, as if speaking against looting and corruption is a crime. The most desperation was the tracking and chasing of my wife on her way to the Church with 3 motor vehicles, two unmarked and the other one a Double Cab Nissan NP300 with false number plates. The Feret team comprises of members of the CIO, MID, PISI and Law and Order. Their purpose is generally abduction, torture and assassinations.

Tobaiwa and Javangwe were the PISI members leading the forces of darkness. Our team on the ground kept surveillance on all their movements. Curious cars frequented past my house.

“Ngarivhume Used Inflammatory Language”: Magistrate

In making calls for public demonstrations, Jacob Ngarivhume used inflammatory language in his tweets aimed at causing violence and breaching peace in the country, a Harare regional magistrate has said when denying bail and remanding him in custody to August 6.

Ngarivhume is being charged with incitement to commit public violence or alternatively incitement to participate in a gathering with the intent to promote public violence.

His charges arose after he allegedly posted messages through his Twitter handle between March 1 and July 20, calling for protests against Government.

Magistrate Mr Trynos Utahwashe said the fears expressed by police leading to Ngarivhume’s arrest and opposing the granting of bail, were “well grounded”, as his language called for confrontational actions.

He said this while making a ruling in Ngarivhume’s bail application before remanding him to August 6 for routine remand.

Mr Utahwashe said the court took judicial notice of the prevailing economic conditions and the coronavirus pandemic when dismissing his bail application. He noted that Ngarivhume leads a small political party without even a seat in Parliament, and questioned how he intended to carry out any countrywide demonstrations.

“How does he intend to control the huge crowds during the countrywide demonstrations?” asked Mr Utahwashe. “How does he intend to carry out the demonstrations without contravening the Covid-19 regulations.”

Mr Utahwashe said police had a constitutional duty to detect and prevent the commission of crimes. Ngarivhume had applied for bail, arguing that the police took him to court after the mandatory 48 hours had lapsed and so he should be unconditionally released.

The State, led by Mr Jonathan Murombedzi and Mr Michael Reza, alleged that while in Harare’s city centre, Ngarivhume posted numerous messages on Twitter in an attempt to influence many people to engage in public violence or participate in a gathering that would disturb peace.

In some of the messages, he said he met and consulted different stakeholders including Mr Ian Makone, Dr Shingi Munyeza, Mr Elton Mangoma and Godfrey Tsenengamu, as part of his efforts to mobilise people.

Political activist, Hopewell Chin’ono, who is facing similar allegations, appeared before magistrate Mr Ngoni Nduna yesterday applying for bail. Chin’ono is expected back in court today for continuation of his bail application.

ZAPU Position On 31 July Demo

Zimbabwe African People’s Union, a long standing advocate for the Zimbabwean people’s freedom from the tyrant regime running the country since 1980, wishes to make the following remarks as pertains the planned end of July protests.

We would like to categorically state that the mother party is not an active participant to the said demonstrations that are purportedly against corruption. This is informed by the reluctance by the organisers of the said demonstrations to engage, consult, or better still to invite other opposition players into partnering them.

The mother party is also, as a responsible entity that is sensitive to the safety and well being of the populace, concerns more about the high risk citizens are being subjected to by calling them to converge and mass protest. The lives of a  desperate population are being pawned and deliberately put in firing line from both state security departments and the marauding coronavirus.

Thirdly, and most importantly, ZAPU is dismayed by the display of double standards and selective application of both law and ethics by the organisers, whose considerable number of leaders feature prominently on lists of the corrupt looters who have milked the country dry of its resources at the expense of ordinary citizens. We demand the concerned leaders, before pointing equally dirty fingers at others, must account and subject themselves to due processes to clear their names.

 We believe corruption is as criminal as is treasonous, whether it’s practiced nationally by the ruling regime or practiced at local government level by the main opposition.

We believe looting the state is as treasonous as practiced by a ruling regime official as it is as treasonous as practiced by an official of the so called main opposition. There is no good corruption or looting, so all suspected of the treasonous practices must account without any  pretence in the public eye.

We note with interests different views on the pending demonstration and how it has already made some heroes and others villains, while it has also made others cowards, just to interpret.  However, ZAPU believe in a thorough strategic planning for a holistic and sustainable solution, not only to corruption but all the ills and leadership deficiencies we had to endure the past forty years.

 Piecemeal initiatives, often motivated by individuals searching for instant glory and relevance are totally out of question especially dealing with a regime so ruthless as Zanu-PF.

 Let us also remind everyone that ZAPU, as pioneer of the struggle for freedom, equality, human rights and constitutionalism has been the most victim and uttermost recipient of Zanu-PF’s brutality at worse. Twenty thousand or so bodies are in shallow mass graves right across Matabeleland and Midlands, as we speak, as we suffered one of the many episodes of the ruling regimes violence against an innocent people.

As such, we are certain that instant popularity, gained from a moment of desperation and freedom deprivation, does not carry the magnanimity of the Zimbabwean struggle in its totality.

 Are we just interested in the moment’s popularity or we want a lasting and sustainable solution to the people’s predicament? This is a question every one must ask themselves.
 Don’t we care about the current ravaging pandemic, so long we will be popular for a moment? Is that what the Zimbabwean problem calls for?

 Again the adage, fool me once, shame on you, fool me twice, shame on me still resonates in such events. ZAPU stands ready with a plan for a much sustained and strategic approach that will yield meaningful change for good instead of small victories derived from influence and dictates of internal and factional dynamics of the same regime we fight.

In the spirit of promoting and protecting rights of Zimbabweans as enshrined in the constitution, ZAPU does not infringe on the rights of, or wish to deny those who so wish to participate in this event, they are free to do so. However, as a party we cannot be drawn into an arrangement that is a recipe for disaster in all aspects of health as the world faces the menacing corona virus, also considering the country’s  healthcare infrastructure is not capable of managing the slightest outbreak.

While we acknowledge the existence and entrenchment of corruption and looting in our society, perpetuated by both ruling regime and main opposition, we call for sensitivity to peoples well being, safety from the world pandemic induced by a virus everyone is still to learn how it behaves.

Former Tanzanian President Benjamin Mkapa Dies

Dar es Salaam. Tanzania’s former President Benjamin William Mkapa, 81, has died, President John Magufuli has announced.

While relaying the news on Tanzania Broadcasting Corporation (TBC) July 24, President Magufuli said Mr Mkapa died at Dar es Salaam Hospital where he was admitted.

“I call on all Tanzanians to receive the news of his death and to pray for Mzee Mkapa. More information will be released but Mzee Mkapa is no more,” he said in brief television statement.

He also declared a seven-day mourning period. During this time, all flags in the country will be flown at half-mast.

Mr Mkapa led Tanzania from 1995 to 2005 before handing over to Jakaya Mrisho Kikwete.

He was born on November 12, 1938.

Trials Suspended Over COVID-19 Scare

By A Correspondent- Magistrates’ courts at Western Commonage Court in Bulawayo have suspended all trials after 12 public prosecutors, among them seven police officers attached to the National Prosecuting Authority (NPA), were placed on self-isolation for 14 days after one of them tested positive for Covid-19.

All criminal cases were immediately transferred to the magistrates’ court at Tredgold Building.

Public institutions have been hit hard by the global pandemic which left scores of people in Bulawayo infected and many quarantined. On Monday, 43 inmates and 23 prison officers at Bulawayo Prison tested positive for Covid-19.

Zimbabwe Prisons and Correctional Services (ZPCS) recently launched its Covid-19 operational plan, which is aligned to the national health guidelines. This comes as local transmissions are rising with the total number now at 2 034 since Zimbabwe confirmed the first case on March 20.

The country has recorded 26 Covid-19 deaths. When The Chronicle visited Western Commonage Magistrates’ Court yesterday, there was no business activity although the courtrooms were open to the public. Prosecutor -General Mr Kumbirai Hodzi confirmed yesterday that a prosecutor at Western Commonage Court had been infected by the deadly virus. He said NPA was now working with health authorities in Bulawayo and the Judicial Service Commission (JSC) to track down contacts of the positive case, including visiting their homes.

“As NPA, we are working together with the Judicial Service Commission, the Ministry of Health and Child Care and our parent ministry to come up with a comprehensive response to safeguard the interests of the public. We want to safeguard the health of the public without compromising the administration of justice,” said Mr Hodzi. He said measures were being taken including contact tracing and testing of other members within the institution.

“The local Covid-19 taskforce has been notified to assess the situation so that they come up with the best possible recommendations on what ought to be done. The Ministry of Health and Child Care will give advice on the way forward and come up with the best course of action,” said Mr Hodzi.

He said investigations are underway to establish the source of infection for the positive case although the building is not under quarantine. Sources at Western Commonage Magistrates’ Courts told Chronicle that a list of all prosecutors and their contacts have since been submitted to the Ministry of Health and Child Care for tracing.

Meanwhile, National University of Science and Technology (Nust) has indefinitely suspended all activities at the campus for both staff and students, and ordered all local students to vacate the university halls of residence by tomorrow.

This follows reports that there is a student who shares accommodation outside the campus with a Covid-19 case that is being traced by the rapid response team in Bulawayo. The university also deferred all examinations until further notice.

In a statement, Nust Registrar, Mr Biggy Ngwenya said all teaching and learning will be done 100 percent online after suspending face-to-face lectures, projects consultations and any other physical contact with students. Final year projects will be submitted on line. The Faculty of Medicine clinical classes will however continue with their lectures and examinations as planned.

“The university wishes to advise staff and students that it has been contacted by the Covid-19 rapid response team about a student who shares accommodation outside campus with a case that they are tracing. All activities on campus for both students and staff are suspended with effect from end of day, Friday 24th of July 2020 until further notice,” said Mr Ngwenya.

“All students in the university halls of residence, except foreign students must vacate by 10am on Saturday, 25th of July 2020.”

The university said only critical staff including those that are involved in Polymerase chain reaction (PCR)-testing, production of sanitisers and personal protective equipment, cleaning and security will be allowed on campus.

“Second Republic Prioritises Reforms”: Monica Mutsvangwa

By A Correspondent- Six independent television channels will soon get licences as part of the movement by the Second Republic to open up airwaves and implement media reforms, Senators heard yesterday.

There are 15 applications for the six licences on offer in the first phase and these are now being considered by the Broadcasting Authority of Zimbabwe.

Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa said licensing of the six independent television channels was part of Government’s desire to provide diverse broadcasting content as provided for in the Constitution where the right to access information is entrenched. Minister Mutsvangwa said this in the Senate during a Question and Answer session.

Midlands Senator, Mr Morgan Komichi (MDC-T), had asked why was Government taking long to have alternative broadcasting stations other than the Zimbabwe Broadcasting Corporation, in fulfilment of the reforms that Zimbabweans had been asking for.

Said Minister Mutsvangwa:

“The Second Republic prioritises reforms and with Zimbabwe boasting high literacy rate, citizens deserve diverse content, be it sport, culture, educational issues.

“That is what my ministry is spearheading since the inception of the Second Republic, as part of the reforms.

“The Broadcasting Authority of Zimbabwe is now fully constituted and started by identifying the number and type of frequencies available. We have 12 licences up for grabs, but at the moment, we will be licensing six players. Applications have since been received and are now being considered.”

Minister Mutsvangwa said beyond commercial television licences, they will also be licensing community radio stations.

“All that is being done in fulfilment of the Constitution, the right to information,” she said.

“Had it not been for Covid-19 related challenges, I would be telling you by when we will have completed the process. We have 15 applications for commercial television.”

In the same spirit of reforms and openness, Government has since repealed the Access to Information and Protection of Privacy Act (AIPPA) and replaced it with three separate legal instruments as part of media reforms.

Early this month, President Mnangagwa signed into law the Freedom of Information Act after it sailed through Parliament.

The new Act, a giant step forward in the reform agenda, brings Zimbabwe’s information-related laws into conformity with the Declaration of Rights in the Constitution.

The law went through a long examination and multi-party amendment process by Parliament, and especially through the relevant portfolio committee, which is chaired by Binga North MP, Mr Prince Sibanda, an opposition MP. After its passage early this month, Minister Mutsvangwa said the development marked a notable milestone in Government’s media legislative reform programme.

Since assuming office in August 2018, President Mnangagwa has prioritised the creation of a conducive national media environment through the repeal of AIPPA and the amendment of the Broadcasting Services Act.

Chipinge Villagers Face Eviction- Human Rights Lawyers Intervene

We have intervened to save 750 families in Munyokowere village in Chipinge who are facing arbitrary eviction by the government, which has told them to leave the village by 26 July, failure of which police and soldiers will forcefully evict them.

Justice Mwayera at Mutare High Court will at 2:30 PM preside over [the] hearing and determination of an urgent application filed by Tariro Tazvitya of [the Zimbabwe Lawyers for Human Rights] on behalf of the villagers seeking to stop Government from evicting them and stop demolishing their homes and stop threatening/harassing them.

We are worried that Government is resorting to self-help by arbitrarily evicting the villagers without a court order and we are also concerned about the manner and timing of the forced eviction, which is likely to impact negatively on the villagers’ food security and livelihoods.

Man Kills Friend Over Mug Of Beer

POLICE in the Midlands Province have launched a manhunt for a man from Mberengwa who allegedly murdered his colleague over a mug of beer.

The fugitive, Zuvarashe Mahohoma, and the now deceased Brighton Hove, both of Chief Maziofa in Mberengwa, were drinking beer at Matekedza Business Centre when the incident happened.

Midlands police spokesperson Inspector Joel Goko confirmed the incident to B-Metro.

“We are investigating a case of murder where Mahohoma struck Hove with an unknown object several times after they had a misunderstanding over a cup of beer and he fell down while bleeding profusely.

The accused went on to assault his victim several times and was restrained by the informant who also reported the matter to the police after discovering that Hove was no longer breathing,” he said.

Inspector Goko said Hove had several cuts on the head and body sustained from the assault.

Meanwhile, another Mberengwa man was stabbed to death by a rival while playing snooker.

Twenty-seven-year-old Emmanuel Zinaka, of Muchado Village under Chief Maziofa, was allegedly stabbed by Tauya Mangwere at Mandava tuckshops in Mberengwa.

Zinaka was in the company of his colleague Kudakwashe Gumbo.

Inspector Joel Goko confirmed the incident saying they had since arrested Mangwere and he was assisting the police with investigations.

“He says while playing, a misunderstanding arose between the now deceased and the accused, leading to the accused drawing a knife which he used to stab the deceased,” he said.

Inspector Goko said Gumbo tried to render Zinaka some assistance but he died on the spot from the injuries sustained in the attack.

Policewoman Arrested For Assaulting Daughter With Electric Cord

A BULAWAYO woman who is also a police officer was arrested for allegedly whipping her nine-year-old stepdaughter with an electric cord.

Shelita Zulu from Mahatshula North and stationed at Queens Park Police Station is being accused of repeatedly beating her stepdaughter and inflicting injury.

Records say on an unknown date but sometime in June this year a fight ensued between Zulu’s stepdaughter and another minor child who also stays at the same house.

It is reported that Zulu intervened and instead of disciplining the two, she allegedly assaulted her stepdaughter several times all over the body with an electric cord.

It is yet to be proven that the alleged brutal assault was committed on top of the numerous abuses that she was perpetrating on the minor child.

After the alleged abuse the minor child reportedly sustained injuries and it was later discovered by her mother who took her to the hospital for treatment.

The matter was reported to the police leading to Zulu’s arrest.

Zulu has since appeared in court facing a charge of ill-treating a child as defined in section (7) (1) of the Children’s Act Chapter 5:06.

She, however, pleaded not guilty when she appeared before Bulawayo magistrate Marygold Ndlovu. The matter was postponed to 22 July for trial.

Kwekwe City Council Boss “Kills” MuShurugwi

Kwekwe town council housing director Edson Chiyangwa has been hurled before the court facing murder charges after he reportedly shot and killed a member of a machete-wielding gang (MaShurugwi) that invaded his mine in Totororo, Zhombe on Tuesday evening.

Kwekwe magistrate denied Chiyangwa bail and advised him to apply for bail at the High court before remanding him in custody till 6 August 2020.
It is the state’s case that:

On 21 July around 11PM, Chiyangwa was at his Forever Mine in Zhombe with Mr Cornelius Dube where they were overseeing their mining operations.

While they were conducting mining operations, a gang armed with machetes and axes among an assortment of weapons attacked the pair and the mine employees.

While Dube escaped and hid himself in a car, Chiyangwa, the court heard, tripped and fell and the gang continued advancing intending to hack him with machetes.
He then produced a 357 Taurus Pistol and fired a warning shot in the air.

The gang however continued advancing leading to Chiyangwa firing another shot towards the gang, killing one of them instantly.

The gang left him and charged towards the Toyota D4D Hilux where Dube had locked himself inside.

The gang hit the vehicle with machetes and forced open the car, dragged Dube outside the vehicle and attacked him all over the body with machetes leaving him for dead and in a pool of blood.

Sensing danger, Chiyangwa vanished from the scene and made a report to the police. The following day Chiyangwa was picked up by police detectives leading to his appearance in court.

In a statement yesterday, national police spokesperson Assistant Commissioner Paul Nyathi said to date 111 979 people have been arrested for contravening the national lockdown regulations.

“The Zimbabwe Republic Police arrested 1 363 people throughout the country on 22 July for various offences related to contravention of the national lockdown regulations, bringing the total accumulative arrest to 111 979.”-Chronicle

COVID-19 Death Toll Rises To 28

With 90 patients testing positive for Covid-19 yesterday, 83 of them local infections, the Zimbabwean total reached 2 124 and two new deaths drove the death toll to 28.

The daily number of new infections shows a drop from the three-figure totals of the last few days.

In its daily report, the Ministry of Health and Child Care said just nine of the local infections had known contacts and medical staff were investigating the other 74 to try and find the source of infection.

All seven quarantined returning residents who tested positive had been infected in South Africa.

The first death reported was a Harare resident who tested positive on Monday, but also had other illnesses.

The Bulawayo death was patient admitted to hospital yesterday with Covid-19 symptoms.

The number of Zimbabweans confirmed to have recovered remains at 510.

Harare is rapidly catching up with Bulawayo in confirmed local infections with 60 of yesterday’s batch coming from the capital.

The latest figures show Bulawayo with 551 confirmed local infections and 13 deaths, and Harare with 357 confirmed local infections and nine deaths.

Midlands is third with 68 cases and two deaths.

South Africa remains the regional epicentre with 5 940 deaths from 394 948 confirmed cases, although 229 175 of these, well over half as the rate of infection slows, have now recovered-The Herald

Minister Slapped With Lawsuit For Renaming Bulawayo st To Mnangagwa

BULAWAYO residents have taken Local Government and Public Works Minister July Moyo to court challenging Government’s decision to change some of the city’s street names as contained in Statutory Instrument 167/20.

In terms of SI 167/20, Minister Moyo announced a number of street name changes in the country’s major cities, a development that saw a number of the nation’s heroes both living and dead being honoured.

Bulawayo Progressive Residents Association (BPRA) through their lawyers Job Sibanda and Associates, filed an application at the Bulawayo High Court challenging Minister’s approval of street name changes as contained in S1 167/20 under Names (Alterations) (Amendment of Schedule) Notice.

The Statutory Instrument, in its preamble, states that in exercising his powers under section 4(1) of the Alteration of Names Act (Chapter10:14) (hereinafter called “the enabling Act”).

Minister Moyo issued a Notice altering the names of certain street names by amending Part VII of the Act by the repeal of certain names of roads and substituting them with those in the amended schedule.

The residents want the court to declare SI 167/20 and the resultant renaming of the streets in Bulawayo, a nullity, arguing it was in violation of some provisions of the Urban Councils Act.

In papers before the court, Minister Moyo and Bulawayo City Council (BCC) were cited as respondents.

In his founding affidavit, BPRA executive chairperson, Mr Ambrose Sibindi said some of the proposed name changes related to the streets that have been altered in terms of SI 167/20 despite council having made its own name proposals.

Mr Sibindi said Minister Moyo ignored the council proposals and came up with a list of names different from what was forwarded to him by BCC.

“The second respondent (BCC), not too long ago, and exercising its prerogative in terms of section 212 of the Urban Councils Act, brought the matter up for debate in council following proper consideration of the issue by the relevant committee to rename the streets.

“The names were forwarded to Government but they have been altered in terms of SI 176/20,” he said.

Mr Sibindi said the Minister’s actions by issuing a Notice altering the names of the identified streets in Bulawayo is an illegality which the court should nullify.

“The first respondent (Minister Moyo)’s attempt to alter the names of the concerned streets runs afoul the very law that allows him to alter such names.

“He did not consider the provisions of section 4 (2) of the enabling Act before coming up with a raft of names that he sought to impose on second respondent and the residents of Bulawayo,” he said.

Mr Sibindi said section 4(2) of the enabling Act, prohibits Minister Moyo from altering any names in terms of subsection (1) unless he has consulted the owner of the land where the alteration is to take place.

The alteration of names of streets and buildings in any place is a very sensitive and personal affair, which the enabling Act was alive to, by making it a condition precedent for consultations to take place with the owner of the land before it is done. Viewed through an impartial eye, such actions are, I submit, grossly an eyesore, unnatural and patently illegal,” he said.

Mr Sibindi wants the court to set aside S1 167/20, arguing that it is in violation of section 4(2) of the Alteration of Names Act.

In terms of SI 167/20, Sixth Avenue Extension has been renamed Emmerson Dambudzo Mnangagwa Way in honour of the President.

Other major roads that have been renamed include; 12th Avenue, which is now Joseph Msika Avenue, Collenbrander Road is now Lookout Masuku Avenue, 9th Avenue is Simon Vengai Muzenda Avenue and 4th Avenue through to 7th Street up to King George is Landa John Nkomo Road.

Connaught Avenue is now Cephas Cele Avenue, 5th Avenue has been renamed Maria Msika Avenue, 10th Avenue is now Nikita Mangena Avenue and 3rd Avenue is now Naison Khutshwekhaya Ndlovu Avenue.

Fife Street through to Bellevue Road up to Plumtree Road is now Benjamin Burombo Street, 23rd Avenue is Jairos Jiri Avenue and Victoria Falls Road has been renamed Mosi-Oa-Tunya Road and 11th Avenue is now Daniel Madzimbamuto Avenue.

Cecil Avenue continuing up to Wellington Road is now Albert Nxele Road, Fife Street and Queens Road is now Queen Lozikeyi Street and 1st Avenue is now Lazarus Nkala Avenue.

Other roads renamed are Doncaster Road which is now Sikanjaya Muntanga Road and 13th Avenue to include Antony Taylor Avenue is now George Nyandoro Avenue.

The respondents are yet to file opposing papers. -Chronicle

Ngarivhume Challenges Bail Ruling

Farai Dziva|The lawyer representing Jacob Ngarivhume, Advocate Moses Nkomo has said he will challenge the dismissal of his client’s bail application by a Harare magistrate.

Advocate Nkomo said he would file opposing papers at the High Court as a matter of urgency.

Ngarivhume was denied bail by Magistrate Trainos Utahwashe on Thursday.

He was remanded in custody to August 6.

Former Kwekwe City Councillor, Alderman Reason Nyamadzawo has died.

Nyamadzawo is former councillor for Ward 5 where he served for two terms on a ZANU-PF ticket.

A veteran educationist who was a teacher for more than two decades before venturing into politics, Nyamadzawo died of suspected sugar diabetes at a private clinic.
He was 76.

Nyamadzawo was also paternal grandfather to 6-year old Axellia Nyamadzawo who was allegedly murdered by her mother in South Africa.

His son Tino Nyamadzawo said the family was still in shock.

“I was called this morning (Tuesday) and told that his sugar levels were giving problems. I rushed him to private clinic where he was pronounced dead upon admission,” said Tino.

He said the family was still to come to terms with Nyamadzawo’s death.

“We are still in shock as a family as we never expected anything of that nature to would happen. He was strong all along and going about business but then all of a sudden, this happens,” said Tino.

Mourners are gathered at his Mbizo 4 residence.
Burial arrangements will be announced in due course.

At the time of his death, Nyamadzawo was Zanu-PF vice chairperson for Rusununguko District in Kwekwe.

Meanwhile, Zanu PF Provincial Spokesperson Cornelius Mpereri said the province had applied that he be accorded provincial hero status.

“As Kwekwe district, we are lobbying with the national and relevant authorities that he be accorded at provincial hero status.

This is so because he is a national war liberator who went on to work hard for the party even after independence. As you are aware, he was a councillor and served the party diligently,” he said-Chronicle

Chinono Spends Another Night In Custody – MISA

The bail hearing for journalist Hopewell Chin’ono continued in Harare on 23 July 2020 with the State calling its second witness who is one of the arresting police officers before adjourning to tomorrow.

This means Chin’ono will spend another night in custody.

His lawyer, Beatrice Mtetwa, also made her closing submissions on the application for bail. However, the hearing could not be finalised as the court had to adjourn early in light of the curfew instituted as part of the recent Covid-19 lockdown regulations.

Chin’ono is being charged with incitement to participate in a gathering with intent to promote public violence, breaches of peace or bigotry or alternatively incitement to commit public violence continued today.

The opposition has with one voice voiced their opinion about the government’s decision to impose stiffer lockdown restrictions and a curfew aimed at curbing the spread of COVID-19 after positive cases surged in the last few weeks, the Daily News reports.

MDC Alliance vice president, Tendai Biti is one of the leaders who spoke against the second lockdown and said:

The new lockdown directive has nothing to do with the Covid-19 pandemic. It is about paranoia and authoritarian consolidation. We will resist the de facto declaration of state of emergency. We will resist the curtailment of our rights.

Former Zanu Pf Youth leader and FEE leader Godfrey Tsenengamu also questioned the timing of the new lockdown and said:

Is it a coincidence that since the day we gave notice of our intention to act against corruption, then suddenly Covid-19 cases began to rise?

How do you lock down people without giving them any means of survival? Other countries released emergency funds and provided people with essential supplies.

July 31 protests should proceed. We demand answers. We demand accountability from these corrupt officials.

Speculation is rife that the government only imposed the lockdown as a way to stop masses from protesting in the 31 July planned protests being championed by Jacob Ngarivhume who is currently in custody till 14 August after he was arrested and charged with enticing public violence.

Former Warriors captain Benjani Mwaruwari has said the football fraternity must rally behind former warriors winger Alois Bunjira who has announced his decision to run for ZIFA presidency in 2022, the Daily News reports. Speaking to South African Sports reporter Robert Marawa, Mwaruwari said:

Bunjira is running for presidency, I think we need to support him. Let’s hope he’s ready, I spoke to him two weeks ago and I said I will be there for you and I will support you.
He (Bunjira) asked me if I’m still going to run and I said I’m still preparing myself so go ahead and do it. We will support you and all the footballers if they see you, they will support you. Let’s hope he will (be able to) change football in Zimbabwe.
Bunjira initially wanted to run for the presidency in 2018 but he could not meet the 40 year age ceiling started in the bylaws. UK based administrator Ellen Chiwenga has hinted that she will throw her head in the game in 2022 as well.

Mthuli Ncube Says Country Is Infested With Matsotsi Who Are Diverting Gold From RBZ

Finance Minister Mthuli Ncube yesterday conceded that gold production had actually increased but it is not finding its way to Fidelity Printers.

“The gold price has gone up because that is a refuge point when in times of crisis because of the COVID-19 crisis, but the deliveries at Fidelity have dropped and that has to do with various things like matsotsi who are taking gold out and all manner of things,” he told the Senate.

“We are dealing with them, but we also dealt with the other thing which was a retention issue. We changed retention ratio from 45:55 to 70:30 in favour of the miner. So at least we have done our part as Government.

“We still have to deal with the illicit side. So when we say gold output has gone down, it is not really correct. Technically, in a sense, it is about official deliveries to Fidelity but the actual gold output out there has gone up. We know that only that pane matsotsi, otsotsi bayakhupha igolide leliyana. That is our problem, but the future is bright with the mining sector.”

Mutare Man Rakes In Big Money After Setting Up His Own “Toll Gate” Along Masvingo – Mutare Highway.

The parliamentary committee on Transport and Infrastructure Development had a pleasant surprise after a brief stopover at the 22 Miles toll plaza in Mutare on Wednesday to have an appreciation how the system at the tollgate works.

At this tollgate along the Mutare-Masvingo Highway, Zinara is reportedly losing potential revenue through an illegal bypass that goes though the field of a man identified as Padhina Dzumbira.

At the illegal bypass, the man is charging motorists varying sums of money which are below those gazetted by Zinara.

The man denied the parliamentarians access through the bypass.

Some lawmakers tried to remove a wooden boom gate erected, but the man verbally assaulted MPs.

“This is my farm and you do not have a right to enter the premises, I am now calling the Lands Commissioner,” he ranted.

Shurugwi North MP, Robson Nyathi, who was leading the Portfolio Committee, said they will take the matter up.

“What is happening is illegal and we are going to raise our concern with the relevant authorities. We also want to find out the identity of the Lands Commissioner where he gets his power,” said Nyathi.

Kwekwe City Council Director Of Housing In Court For Murder

Kwekwe City Council Director of Housing has appeared in court facing murder charges after he allegedly shot and killed an illegal miner who was part of machete wielding gang that had besieged his mine in Totororo, Zhombe in a mine wrangle on Wednesday night.

Edson Chiyangwa (51), was yesterday arraigned before Kwekwe Magistrate Ms Mildred Matuvi.

He was remanded in custody to 6 August and urged to apply for bail at the High Court.

Prosecuting Mrs. Meleni Nkala told the court that on 21 July around 11PM, Chiyangwa was at his Forever Mine in Zhombe with Mr Cornelius Dube where they were overseeing their mining operations.

While they were conducting mining operations, a gang armed with machetes and axes among an assortment of weapons attacked the pair and the mine employees.

While Dube escaped and hid himself in a car, Chiyangwa, the court heard, tripped and fell and the gang continued advancing intending to hack him with machetes.

He then produced a 357 Taurus Pistol and fired a warning shot in the air.

The gang however continued advancing leading to Chiyangwa firing another shot towards the gang, killing one of them instantly.

The gang left him and charged towards the Toyota D4D Hilux where Dube had locked himself inside.

The gang hit the vehicle with machetes and forced open the car, dragged Dube outside the vehicle and attacked him all over the body with machetes leaving him for dead and in a pool of blood.

Sensing danger, Chiyangwa vanished from the scene and made a report to the police.

The following day Chiyangwa was picked up by police detectives leading to his appearance in court.

Dube is battling for life at Kwekwe General Hospital.

Chiyangwa is represented by Valentine Mutatu of Mutatu and Partners Legal Practitioners.

Byo Church Leaders Welcome Decision To Ban Church Gatherings

CHURCHES in Bulawayo have welcomed the move by President Mnangagwa to once again, ban church gatherings in a move to mitigate the spread of Covid-19.

Churches recently broke the 86-day jinx when they were allowed to operate once again, but due to the rise of Covid-19 cases in the country and city, Government has been forced to once again ban church gatherings until further notice.

 Johane Masowe Apostle Sector leader, Madzibaba Emmanuel Mutumwa said they will revert to the online worshipping strategy.

“As the apostolic church sector, we believe that we have a role to play in supporting the Government. We’re in no position to defy the rules set by the Government thus we welcome their move to re-ban church gatherings.

“We’ve since notified congregants that we won’t be congregating physically and our focus now is to have them pray at their homes so as to mitigate the spread of Covid-19.

“As such, we’re returning to using the WhatsApp platform for our services,” said Mutumwa.

Association of the Apostolic Churches in Zimbabwe (AACZ) President, Bishop Vushe said: “It’s very important to follow the rules and regulations of the Government. The increase in number of the positive coronavirus cases is worrying and we also observed that although churches were operating, most were not following the rules and regulations and did not have the required sanitisers and infrared thermometers.

“It was also difficult for the church members to maintain social distance. We urge the nation to pray indoors until the right time comes.”

 Bishop Vushe said church organisations should not see this as a punishment, but a role for them to play in saving lives.

 He hailed the frontline workers for their hard work and dedication in such a difficult time.

Harare Mayor Bail Hearing Pushed To Friday.

HARARE Mayor Herbert Gomba, who is facing criminal abuse of office charges, has been remanded in custody until tomorrow for his bail application.

He appeared before Magistrate Bianca Makwande.

Gomba was picked by police on Monday night on charges related to land scams. Head of the Special Anti-Corruption Unit (Sacu) Mr Thabani Mpofu said Gomba’s related land scams that have rocked the city.

In some of the charges, he is being jointly charged with other top council officials who have already been arrested. Harare has seen a batch of officials, two at the top director level, arrested.

The charges emanate from allegations that 150 stands were created in Kuwadzana from open spaces and sold for private gain, along with more stands in other areas. There are further allegations that police officers ranging in rank from constable to assistant commissioner, and a chief public prosecutor, did not push forward with investigations and prosecutions of some of the suspects and were paid off with stands in Westlea.

The police officers and public prosecutor have since been arrested and appeared in court. City of Harare officials arrested over the last few weeks and have appeared in court on corruption charges include the housing director Addmore Nhekairo, who is facing a charge of criminal abuse of office that arises from his approval of the Westlea stands allocation.

He was denied bail on Monday.

Acting human resources director Matthew Marara and principal housing director Edgar Dzehonye, with other co-accused, also appeared in court and were denied bail. They were allegedly involved in the Kuwadzana land scam, prejudicing council of US$1 141 779.

Dzehonye is facing a charge of criminal abuse of office while Marara is facing a fraud charge along with Aaron Tayerera, the acting chief clerical officer.

Marara and Tayerera are charged with fraudulently selling council land in Strathaven for US$20 900 to an unsuspecting land seeker and pocketing the money.

The court refused bail citing significant risks that Marara and co-accused Tayerera would abscond and that Nhekairo would likely interfere with a crucial prosecution witness.

Veteran ZBC Radio Broadcaster Dies

VETERAN broadcaster, Cephas Dlamini has died. He was 82.

Dlamini passed away on Tuesday at Corporate 24 Medical Centre where he had been admitted on Sunday.

Dlamini had more than two decades experience in the broadcasting industry as he joined the then Rhodesia Broadcasting Corporation in 1975 as a producer/presenter and retired in 1998.

His son, Mnqobi confirmed his death adding he will be buried tomorrow at Kensington Cemetery.

Dlamini joined ZBC from the teaching profession and was heavily involved at the then Mthwakazi Radio at Montrose Studios.

He was a producer/presenter of various programmes that included Izihlahla Ziyimpilo and Ezivela Ezigodini. He also anchored ukukubingelelana and Inhlupho zalamuhla

Dlamini worked with several broadcaster that include the late Maplot Jubane, Inglam Nyathi, Ezra Sibanda, Nonceba Mnkandla, Harry Nleya and Luke Mkandla among others.

Luke Mnkandla said he was saddened by Dlamini’s passing on, saying he played an immense role in radio despite joining the profession later in his life.

“He came from teaching to join us at Radio Mthwakazi and he was a quiet and reserved man who diligently went about his work.

“Dlamini was passionate about his job and very good with interacting with people and interviewing them.

“He presented several programmes that include iSqokoqela sanamuhla, Ezamasiko, Ezasemakhaya and also did a book review programme where he would invite poets to come and talk about their work,” he said.

Mnkandla said Dlamini’s loss is a great loss to the industry.

Dlamini attended Ngwenya Misson for secondary education after which he trained as a teacher at Mtshabezi Mission.

He worked as a teacher in various schools including Gampu Primary and St Columbus and left teaching to join the then RBC in 1975.

Dlamini worked there as a producer presenter until he retired in 1998.

He is survived by 6 children and 14 grandchildren

Mourners are gathered at number 14 Paul Street in Kensington.

OPINION: Leave Hopewell Out Of It. It’s The Economy, Stupid! – Ken Mufuka

My computers have been going haywire-one in chatter mood, the other announcing breaking news and yet another flashing headlines across the screen, most of them concerning the arrest and abduction of journalist, Supreme Brother Hopewell Chin’ono.

After a thorough examination of the information before me, I was surprised to find how far off-side the government of Zimbabwe has been as the story unfolds.

The warrant of arrest was defective, apparently written by a judge under duress. Hopewell’s attorney, who can be seen in real time, says the warrant was short of specifics and the police were in a mood to collect everything that they fancied.

Secondly, the persons of interest in this matter are the managers of Zimbabwe’s economy, whose management and ethics border on criminal negligence and perhaps treason. Leave Hopewell out of this. He is only a scribe. It is the economy, stupid!

Simply stated

A feisty woman, by the name of Alice Hungwe, whom I have never seen or heard from before, but says that she is my young mother (aminini) sought to educate me through her WHATSAPP account.

The issue, simply stated is that ZANU-PF stalwarts have been living off the hog, messing things up, and then asking Zimbabwe’s taxpayers to clean up their mess.

That is the story, simple!

“Listen to me Ken,” she said. It was obvious this Mainini was not going to take any nonsense from me. “They take the white men’s farms, crops, animals, machinery and everything. They sell everything, vandalize the equipment and externalize the proceeds.”

“Yes,  Mainini.” I replied.

“Under presidential inputs program, they get fertilizers, tractors and seeds. They sell everything instead of growing food.” She went on. “Are you listening Ken?” My Mainini is unbearable, but she is my small mother. I must show her some respect.

“The country suffers from famine, and they are given contracts to buy food abroad, and they charge the government U$600 per ton when the going price is Z$240.”

Now I am beginning to get the picture. I say so, but she is not finished with me yet.

“Listen to me good. Mwana waSisi. They get some more free goods under Command agriculture. What do they produce? Nothing.”  I can hear her breathing.

“Now this thing about Coronavirus, once more, they swindle the government of U$60 million. The person of interest goes to court and pays Z$50 000 in small bills. Tell me the bank which gave him Z$50 000 in small bills when I cannot get Z$300 per week?”

She asks a rhetorical question which needs no answer.

There is not a single mention of Hopewell in all this. The looters in the Command Agriculture are not of interest to the police. The German World (GW) television anchor lady asked Sibusiso Moyo whether the police are interested in the “higher ups” involved in this looting of public funds.

Of course, he denied any interest.

The issue raised by Brothers Alex Magaisa, with reference to the Farm Mechanization Program of 2007/8 is only a tip of the iceberg. Hopewell has nothing to with any of it.

Magaisa, lawyer like, has been too kind to the looters of the FMP. In an explanation to the Zimbabwe Broadcasting Corporation (ZBC), former Reserve Governor says that: “At inception (2007/8) the FMP was meant to be a loan that would be paid for by beneficiaries. After the GNU (National Unity) was consummated in 2009 and when the RBZ sought guidance on the matter, there was a change of heart. Joseph Made advised… that Government had decided in 2012 to include the program as part of its national Mechanization and Irrigation and that was the end of the story.” (sic)

The Governor is avoiding the issue here. The issue, as he has stated, was that at inception meant to be a loan. In its decision to include the FMP in the irrigation program, the Ministry of Agriculture did not “end the story” as he says because the matter came up later in 2015.

What the Governor is avoiding is the fact that the fat cats had no intention of paying back. This view is supported by the Auditor General in 2010. She questioned why beneficiaries had not been told the true costs of the implements, nor were they told when, to whom, and how the payments were to be made.

I can answer that for you. They had no intention of paying.

Hopewell is nowhere to be found in all this.

There is another anomaly. Consultations about whether to pay or not to pay were done after the equipment was already in the hands of the farmers. That issue was addressed by the Auditor General. We will not delay the reader any further.

The question now is that the procedures were sloppy at best, as already indicated by the Auditor General. Whether intentional or not, they amount to gross negligence. If intentional, they are outright treasonous.

In all this Hopewell is nowhere to be seen.

There is definitely a pattern of abuse of public funds, beginning with Coronavirus supplies, Zupco buses, Tanzanian maize supplies, Command Agriculture, and the Presidential inputs program. If I were to make a big deal out of it, there would no end to the list.

Hopewell is a journalist and a publicist. So am I. There is nothing illegal about that. While no person of interest in all the shenanigans listed above has been brought to book to my knowledge, the economy continues to fall apart.

It is the economy that has exposed the entire fly by night deals.

The persons of interest continue, like those in Sodom and Gomorrah, to dance, marry, trade under the table with impunity, act out and cut up, and even challenge those like Hopewell who look into their affairs.

To be sure, the names of the FMP beneficiaries were kept under lock and key. We know for certain that Attorney Beatrice Mtetwa requested the list and was denied.

Professor Magaisa has done Zimbabweans a favor by publishing the list. Here is the juicy bit of the list. The honorable president received U$411,728, Maphid Mnangagwa, a relative got U$93,111, Gerald Mlotshwa, president’s son in law got away with U$59,605 and just for the heck of it Malawi president Bingu wa Mutharika skipped town with U$124,111.

The police are investigating Hopewell leaving other persons of interest in plain sight.

My Mainini had the last word. “Kenny, Mwanangu, I tell you that man is a serious candidate for interrogation by ZACC (Anti-Corruption Commission).” She said.

“Which one?” I asked.

“Have you been listening to what I said?” She concluded.

Over 10 000 health workers in Africa infected with COVID-19

Brazzaville, 23 July 2020 – The World Health Organization (WHO) today warned of the threat posed by COVID-19 to health workers across Africa. 

More than 10 000 health workers in the 40 countries which have reported on such infections have been infected with COVID-19 so far, a sign of the challenges medical staff on the frontlines of the outbreak face.

This comes as COVID-19 cases in Africa appear to be gathering pace. There are now more than 750 000 cases of COVID-19, with over 15 000 deaths. Some countries are approaching a critical number of infections that can place stress on health systems. South Africa is now among the worst-hit countries in the world.   

“The growth we are seeing in COVID-19 cases in Africa is placing an ever-greater strain on health services across the continent,” said Dr Matshidiso Moeti, WHO Regional Director for Africa.

“This has very real consequences for the individuals who work in them, and there is no more sobering example of this than the rising number of health worker infections.”

So far, about 10% of all cases globally are among health workers, though there is a wide range between individual countries. In Africa, information on health worker infections is still limited, but preliminary data finds that they make up more than 5% of cases in 14 countries in sub-Saharan Africa alone, and in four of these, health workers make up more than 10% of all infections.

Inadequate access to personal protective equipment or weak infection prevention and control measures raise the risk of health worker infection. Surging global demand for protective equipment as well as global restrictions on travel have triggered supply shortages.

Health workers can also be exposed to patients who do not show signs of the disease and are in the health facilities for a range of other services.

Risks may also arise when health personnel are repurposed for COVID-19 response without adequate briefing, or because of heavy workloads which result in fatigue, burnout and possibly not fully applying the standard operating procedures.

In many African countries infection prevention and control measures aimed at preventing infections in health facilities are still not fully implemented. When WHO assessed clinics and hospitals across the continent for these measures, only 16% of the nearly 30 000 facilities surveyed had assessment scores above 75%.

Many health centres were found to lack the infrastructure necessary to implement key infection prevention measures, or to prevent overcrowding. Only 7.8% (2213) had isolation capacities and just a third had the capacity to triage patients.

“One infection among health workers is one too many,” said Dr Moeti. “Doctors, nurses and other health professionals are our mothers, brothers and sisters. They are helping to save lives endangered by COVID-19. We must make sure that they have the equipment, skills and information they need to keep themselves, their patients and colleagues safe.”

WHO has been working closely with health ministries to reduce health worker infections since the outbreak began. The Organization has trained more than 50 000 health workers in Africa in infection prevention and control, with plans to train over 200 000 more, as well as providing guidance documents and guidelines on best care practices and the most up-to-date treatment regimes.

WHO is also helping to fill gaps in the supply of personal protective equipment. Currently, 41 million items of personal protective equipment are ready to ship from China to cover the needs of 47 African countries. Shipments for an initial set of 23 African countries are planned to start during this weekend.

As a result of concerted efforts by WHO and partners some African countries have managed to reduce health worker infections considerably. For example, two months ago over 16% of COVID-19 infections in Sierra Leone were among health workers.

The figure has now dropped to 9%. Cote d’Ivoire has reduced the proportion of infections among health workers from 6.1% to 1.4%. Scaling up infection prevention and control measures can further reduce infections among health workers.

She was joined by Hon Dr Léonie Claudine Lougue, Minister of Health of Burkina Faso; Hon Dr Alpha T. Wurie, Minister of Health and Population of Sierra Leone; and Dr Jemima A. Dennis-Antwi, International Maternal Health & Midwifery Specialist.

TM Pick n Pay Closes Strathaven Branch After Staffers Test COVID-19+

TM Pick n Pay has announced that it has closed its Strathaven Branch in Harare after some of its staff members tested positive of the deadly Coronavirus.

In a statement the company said the branch will remain closed indefinitely.

We write to notify you that our Strathaven Branch has been temporarily closed due to our Staff members testing positive to COVID-19, the employees are now self- quarantined.

All other staff members at the branch are being screened and tested in accordance with Ministry of Health and Child Care guidelines. They shall all be self-quarantined until we have obtained their results.

We have contacted the Rapid Response Team to deep clean and thoroughly disinfect the branch as a measure to ensure decontamination. The branch will therefore remain closed until further notice.

Bindura Man Axes Wife, Kills Self

By A Correspondent- Villagers of Retreat Farm in Bindura were left shell shocked after a 41 year old man axed his wife over a television dispute on Monday.

Mashonaland Central police spokesperson Inspector Milton Mundembe confirmed the case.

“I can confirm a case of an attempted murder in Bindura where Virimai Kambezo axed his wife Enita Manyara on the head once and committed suicide by hanging 400meters away from the scene,” Mundembe said.

Allegations are that Manyara came home late from her parents’ home where she was watching television and slept.

The following day their 23 year old daughter found her mother in a pool of blood with an axe stuck on her head while the father’s dead body  was hanging from a tree 400 meters away.

Manyara was rushed to hospital and latter transferred to Parirenyatwa group of hospital where the axe was removed and her condition is critical.

Police warned people to desist from domestic violence but instead seek counselling.

MDC-T Vice-Chairman Morgen Komichi said the MDC T secretary-general Douglas Mwonzora’s nomination by some Harare MDC T members is not valid because the standing committee directed all provinces to stop any nomination processes till a directive with guidelines by the party’s standing committee is issued.

Komichi went on to say the meeting that convened and nominated Mwonzora yesterday defied procedures and will bear no official recognition.

Komichi’s statement reads:

On Wednesday 15th July 2020, the Standing Committee set and resolved that the following happen:

  1. Since we had failed to get clearance from the Police and the Ministry of Health because of the WHO’s Covid 19 restrictions on movement and gatherings, we immediately instructed our lawyers to approach the courts to seek variation of the time frames set in the judgment that actuated the Extraordinary Congress.
  1. The Organising Department was tasked with compiling the list of genuine 2014 delegates as they stand today.
  2. At this last Tuesday, Standing Committee meeting, it was directed that all provinces stop any nomination processes until the issuance of a directive with guidelines by the Standing Committee.

Yesterday’s Harare ‘Provincial meeting’ and it’s produce was therefore a defiance of procedures, processes and the leadership and must be condemned and dismissed by all. We must observe discipline and order at all times as we move towards our historic Extraordinary Congress which is a constitutional requirement which must be fulfilled.

We hear the ‘meeting’ was attended by 38 people and allegedly chaired by Mr. Simon Hove, and it being unilateral, will bear no official recognition.

The ground rules of the party shall be set and a neutral electoral board appointed and tasked to run all processes leading up to the Extraordinary Congress

Meanwhile, the MDC T has indefinitely postponed the court-sanctioned extraordinary congress due to the COVID-19 pandemic which is putting restrictive measures on people congregating in large numbers.

The South African Presidency has announced that President Cyril Ramaphosa will address that nation at 8pm on Thursday on developments in South Africa’s risk-adjusted strategy to manage the spread of COVID-19.

The President’s address follows a number of meetings of the Cabinet and the National Coronavirus Command Council.

Some unions, parents and pupils are keen to hear if he will announce that schools will be completely closed, and for how long.

South Africans have been locked in a charged debate on whether more pupils should return to class as the country approaches the peak of the COVID-19 pandemic.

Supporters of the move say children would be low-risk patients if they contracted the virus, while critics insist that more pupils at schools would exacerbate the outbreak.

South Africa’s COVID-19 pandemic is now among the worst in the world – with an unprecedented 572 deaths recorded in the past 24-hour cycle.

COVID-19 has infected almost 400,000 South Africans and 5,940 people have died from the disease.

Teacher unions are divided, but some say the accelerating infection rate should be used as a sign to put the brakes on the academic calendar.

The National Professional Teachers’ Organisation of South Africa is calling for contact classes to be halted for about at least a month.

If schools do close, speculation is rife that matric pupils would be among the first to return, while all other grades would again be phased in.

Hopewell Chinono Sent Back To Prison Due To Covid-19 Curfew.

The Harare Magistrates Court on Thursday adjourned to Friday the bail hearing for Hopewell Chin’ono, as courts are closing early due to the Covid-19 curfew that the government imposed.

A freelance journalist, Chin’ono was arrested together with Jacob Ngarivhume of Transform Zimbabwe, accused of fronting plans to hold anti-government protests on July 31.

In adjourning the bail hearing, magistrate Ngoni Nduna said, “Court staff need to get home before the curfew starts at 6 PM”.

This was after examination and cross-examination of state witnesses had taken most of the bail hearing.

President Emmerson Mnangagwa on Tuesday set stricter Covid-19 lockdown rules and imposed a 12-hour dusk to dawn curfew which began on Wednesday.

Ngarivhume has been widely quoted in the media in recent weeks threatening the protests on July 31 would go ahead with or without government permission while the state alleges Chin’ono, a prominent social media user, has also been allegedly linked to the same protests.

Earlier on Ngarivhume was denied bail in a separate courtroom after the State proved that if admitted to bail, he would proceed to lead the planned demonstrations.

Court Says Ngarivhume Is Remanded In Custody So That He Is Not Available Until After 31 July

The Harare Magistrates Court on Thursday denied bail to Transform Zimbabwe leader Jacob Ngarivhume who was arrested on Tuesday on allegations of inciting public violence.

Ngarivhume was remanded in custody to August 6 this year.

Presiding magistrate Tranos Utahwashe said he was convinced by the State assertion that if released on bail, Ngarivhume would organise violent demonstrations.

Ngarivhume has been using social media to incite the public to engage in street protests on July 31 this year ostensibly against corruption.

“It is in the interest of justice that the accused be denied bail,” said Utahwashe.

Defense lawyer Moses Nkomo told the media they would be appealing against the ruling at the High Court.

“The reason why he us being denied bail is that the state fears that if he is released on bail, there are going to be demonstrations.
“The State alleges that he has incited the nation to demonstrate against corruption and they fear if he is given bail, the demonstrations will proceed on the 31st of July,” he said.

“We will be appealing at the High Court in the earliest possible time,” he told reporters.

Gono Clears Chamisa From The RBZ Funds Looting Scandal.

Former Reserve Bank of Zimbabwe Governor, Dr Gideon Gono has cleared MDC Alliance leader Nelson Chamisa from the list of people accused of corruptly benefiting from the controversial RBZ Farm Mechanisation Programme 2007 and 2008.

Speaking on Zimbabwe Television Network (ZTN) today, Gono said that some senior members of the opposition did receive the money but exonerated Chamisa.

“Very senior members from MDC were beneficiaries of the programme in question. It is unfortunate that Alex’s list omits some names of people from the party that he was advising at the time.

“I’m not here to spell out all the names of beneficiaries neither am I aware of Chamisa benefiting from the program, but I can surely confirm that Welshman Ncube benefited,” said Gono.

Kaitano Tembo Completes LaLiga Course

SuperSport United coach Kaitano Tembo has revealed his plans after competing the LaLiga Masterclass Course, saying he hopes it will help him fight for his maiden ABSA Premiership title.

The Zimbabwean coach, who turned 50 yesterday, worked with Celta Vigo coach Oscar Garcia, Athletico Bilbao’s Gaizka Garitano and a coordinator of LaLiga Sports Projects Department, Juan Florit Zapata, over a four-week period during May and June.

After completeling the course, the former Warriors defender responded, after being asked if it will propel him to league glory, as cited by Goal.com: “Most definitely. I think La Liga has really played a huge role for me in my development and my confidence as a coach.”

Church leaders have accused the youthful preacher of using juju to gain popularity.

Bunjira Is The Right Man For ZIFA Presidency-Mwaruwari

FORMER Warriors skipper, Benjani Mwaruwari, has thrown his weight behind Alois Bunjira to be the next ZIFA president.

The ex-Manchester City and Portsmouth forward is currently working on his coaching badges and sports management courses in England.

He believes it was a blessing in disguise when he was barred from fighting for the ZIFA presidency, a few years ago, on a technicality, as this has enabled him to boost his football knowledge.

Speaking to South African broadcaster, Robert Marawa, on his daily radio show, Benjani said the future, for him, and Zimbabwe football, was exciting.

He believes he will have another go at the ZIFA presidency, in the future but, for now, he was backing Bunjira to be the next boss of domestic football.

“I think in future, yes, because when I tried, there was a loophole, so, sometimes chances come early but, unfortunately, age was not on my side,’’ he said.
“They said I was too young, the constitution said no under 40s should lead the association.

“People are scared that footballers will come and do great and they tighten it up and, that time, the FIFA president won it at 39 years.

“I think it was a blessing, as well, I am doing sports management, sometimes you need to be ready.

“I am doing my coaching badges. I am halfway through my UEFA A, we are just waiting for the practicals.

“I am attached to Portsmouth at the moment, hopefully, by September everything would be running and we will just wrap it up.’’

MARVELOUS Nakamba’s Aston Villa face a decisive closing weekend of the 2019/20 English Premiership season and need nothing short of victory against West Ham in London to avoid the dreaded chop.

Chigova Speaks On “Bleak” Future

George Chigove says he is not thinking much about his future at Polokwane City, insisting his sole focus is on helping the team avoid relegation.

The Zimbabwean was offered a two-month deal just to finish off the season after his contract had expired in June.

Chigova told Sowetan: “The club wanted me to finish the season with them and that was also my wish, so I signed a two-month extension. The club is happy with me, I have been here for the past five years, and I am happy to be here, so I accepted the deal to finishing the season here.

“The fact that the club gave me two months shows that they love me, so I must continue to deliver on the pitch. My main focus is to play the remaining matches and fight to save the club from relegation.

Chin’ono To Spend Fourth Night Behind Bars

By Jane Mlambo| Journalist Hopewell Chin’ono who was arrested on Monday on charges of inciting the public to protest against President Emmerson Mnangagwa’s administration on the 31st of July will spend his fourth night behind bars after the Harare Magistrates Court rolled over the matter to tomorrow.

The court had to adjourn due to the curfew laws put imposed on the country by the government to curb the spread of COVID-19.

Before the adjournement of the court, Chin’ono’s lawyer was making submissions on her application for bail pending trial.

Posting on Twitter, MDC Alliance Vice President Tendai Biti said;

“So Hope will spend a further night in remand after the bail application proceedings were adjourned due to Mnangagwa s curfew laws ,SI 174 . Bail is elementary & should be granted as of right .State capture is pervasive .State capture is a crime against humanity.”

He was not informed of the reason for his arrest or afforded any of his constitutional safeguards as required by the law.

This nocturnal arrest by security agents cannot go unchallenged.

Advocate Nkomo said he would file opposing papers at the High Court as a matter of urgency.

Nasty Split Rocks Khupe’s MDC T

A nasty split is brewing in the Thokozani Khupe led MDC-T outfit after a faction aligned to Douglas Mwonzora has commenced nominations for the 31st of July Extra-Ordinary Congress.

On Tuesday, Acting Party Spokesperson Khalipheni Phugeni told journalists that it will be difficult to convene the 31st of July event. In a turn of events the Mwonzora faction convened a Harare Provincial meeting where he was endorsed as the preferred candidate to take over as a substantial President.

The latest fallout follows an incident were Khupe’s aides allegedly assaulted by Mwonzora’s security staff at the Morgan Richard Tsvangirai House party headquarters in Harare

According to reports Khupe’s aide, identified as Kudzanai Mashumba, was allegedly assaulted by Mwonzora’s security.

By A Correspondent- MDC National Youth Assembly leader Shakespeare Mukoyi’s father succumbed to the deadly Coronavirus, a screenshot from an MDC-T Whatsapp chat group has alleged.

According to a screenshot seen by this reporter, a participant said, “Mourners are still gathered at 3506 Kuwadzana 3 Postmortem results are now out and it is sad to note that our baba succumbed to covid19.

“The body will leave Harare tomorrow Thursday 23/07/20 @ 9AM hearding to Rukweza in Rusape for burial same day. We have been advised that mourners can travel in the morning together with the body. All funeral contributions to be sent to our National Treasurer. (sic)”

MDC-T Acting President Thokozani Khupe took to Twitter to send his condolence message to the Mukoyi family.

The donation was done by Chinese Ambassador Guo Shaochun after a meeting with Secretary for Information Nick Mangwana.

After receiving the laptops Mangwana said:

Police Officers, Health Ministry Officials To Be Deployed At Funerals

By A Correspondent- Zimbabwe Republic Police officers and officials from the Ministry of Health and Child Care will now be deployed to funerals as part of measures to combat the spread of the coronavirus.

Ministry of Information, Publicity and Broadcasting Services, Ndavaningi Nick Mangwana, revealed that traditional leaders, faith-based ministries, Non-governmental organisations and community-based volunteers will be trained to play a role.

Mangwana posted on Twitter:

From now, Police and Health officials will be deployed at funerals COVID-19 measures.

[Shamva District Medical Officer] DMO, Dr Kamuriwo says only 4 people would be in the room with the body.

Traditional leaders, ministries, NGOs and Community Based Volunteers will be trained to play a role.

The Zimbabwean government on Tuesday announced new, stringent measures to deal with the novel coronavirus.

The measures include the restriction of business operating hours (from 8 AM to 3 PM) and a countrywide dawn-to-dusk curfew as well as a stay-at-home order for the non-working population.

Khupe Postpones Extra- Ordinary Congress Indefinitely Over Lockdown

By A Correspondent- The opposition MDC-T led by Thokozani Khupe has indefinitely postponed the Supreme Court-ordered extraordinary congress (EOC) that was scheduled for July 31 due to lockdown measures that have been in force since March.

Khupe had applied for clearance from the Ministry of Health and Child Care (MoHCC) for direction on how to hold the extraordinary congress set to be attended by over 4 000 delegates.

Responding to Khupe’s request, MoHCC acting permanent secretary Gibson Mhlanga, in a letter dated June 29 and addressed to the former, said it was not possible for the EOC to be held under the ongoing health crisis.

Speaking during a press briefing at Harvest House on Wednesday, Khupe’s spokesperson, Khaliphani Phugeni, said:

We are sad to announce that our July 31 extraordinary congress can no longer go ahead as planned because we tried all that we could humanly to ensure compliance with the Supreme Court ruling.

However, considering the fears expressed by the executive through the ministry of Health, we have realised that it is not possible so we have instructed our lawyers to approach the courts to seek a waiver.

In March this year, the Supreme Court ruled that Nelson Chamisa’s ascendancy to the leadership of the MDC-T party in 2018 was null and void.

The court instated Khupe as interim party president and ordered her to organise an EOC within 90 days to elect a substantive president.

Cornered Malaba Responds To Law Society Of Zimbabwe’s Concerns Over Memorandum

The Judicial Services Commission (JSC) has responded to concerns raised by the Law Society of Zimbabwe (LSZ) over a memorandum that was issued by the Chief Justice Justice Malaba on July 16.

Malaba had directed judges that they could only issue court judgements after approval by the head of the division.

In a letter dated 21 July 2020 and addressed to E. Mapara, LSZ executive secretary, Judicial Service Commission secretary Walter Chikwanha sought to clarify Malaba’s directive.

Chikwanha wrote:

Thank you for your letter dated 20 July 2020 addressed to the Chief Justice which you copied to me.

We do confirm that a memorandum was issued by the Chief Justice’s office on the 16th of July 2020.

The background to that memorandum is that the Judicial Service Commission had been receiving a lot of complaints for quite a while from litigants, legal practitioners and members of the public in general on the non-availability of judgments which would have been read in court by Judges.

Following these complaints and subsequent investigations, it was revealed that there were instances where a Judge would deliver a judgment or the operative part of a judgment in court or in chambers but the Judge, for various reasons some of which were genuine, would not immediately avail the judgment for distribution and accessibility to the concerned parties and the public.

The Chief Justice then consulted and engaged with Judges of all the courts on this challenge and received contributions from the Judges on how to deal with the issue.

The memorandum issued was intended to address that problem and it was based on the input that the Chief Justice received from the Judges.

It was meant to guide the Courts and the Judges on the need to pronounce judgments only when they are ready and to make judgments accessible and available to the litigants, legal practitioners and the public immediately after such pronouncement.

This is the spirit upon which the memorandum of 16 July 2020 was written.

We have taken note of the concerns that have been raised by the public, interested persons and organisations regarding paragraph 2 (iv) of the memorandum.

We also believe this is the context in which you have communicated with us on the issue.

We wish to assure the profession and the public at large that the memorandum was not meant to stifle the independence of the Judiciary, neither was it meant to give Heads of Courts/ Stations/ Divisions review powers over judgments and decisions made by fellow Judges.

We now realise that this paragraph has created the unfortunate and unwelcome perception to a memorandum which was put together in an effort to address grievances raised by the profession and litigants regarding the non-availability of judgments that would have been delivered in court.

The Chief Justice is a firm believer in the independence of the Judiciary.

This is a principle that is provided for in our Constitution and which is sacrosanct.

No one, and no arm of government nor even the Chief Justice and the Judicial Service Commission itself should attempt to interfere with such independence.

There should not even be a perception of such interference. This is the perception that has been created by paragraph 2 (iv) of the memorandum and as the Judicial Service Commission, we have to take a position to attend to that perception.

In the circumstances, therefore, the Chief Justice has directed that paragraph 2 (iv) of his memorandum of 16 July 2020 be expunged from that memorandum.

We attach hereto for the attention of the profession a copy of the new memorandum which is also being distributed to the attention of all Judges.

For the avoidance of doubt, the new memorandum cancels and replaces the 16 July 2020 memorandum.

We thank you for raising these concerns with us.

By A Correspondent- Transform Zimbabwe opposition leader Jacob Ngarivhume has been denied bail over fears by the state that if he is released on bail, the July 31 protests will continue.

He was remanded in custody to August 6 2020.

Ngarivhume is being accused of organising and planning the July 31 mass protests against corruption.

He was charged with “incitement to participate in a gathering with intent to promote public violence, breaches of peace or bigotry.”

Harare Mayor Hauled To Court Over Land Deals

By A Correspondent- Harare mayor Councillor Herbert Gomba is expected to appear in court this Thursday following his arrest on Monday night on charges related to land scams.

Gomba’s arrest was confirmed by the head of Special Anti-Corruption Unit (SACU) Thabani Mpofu. He said:

Yes, police have arrested Gomba and are recording his statements. The charges have to do with land scams.

He will appear in court tomorrow (today) and in some of the charges, he is being jointly charged with other council officials who have already been arrested.

Combined Harare Residents Association director Loreen Mupasiri-Sani said all officials who are involved should also be brought to book and due diligence done so that there is fairness and objectivity in terms of dealing with the matter.

Meanwhile, Zimbabwe National Organisation of Associations and Residents Trust, Shepherd Chikomba has called for an independent auditor to audit councils in a non-partisan manner.

Mutsvangwa Says: 31 July Won’t Happen…

The War Veterans chairperson Christopher Mutsvangwa has announced saying the 31 July demo will not happen.

Mutsvangwa spoke as he outlined decisions adopted by his organisation’s national executive committee.

“The trinity that is the people, the war veterans stand in support of President Mnangagwa. We hold elections after every five years and those who think they can rule this country should wait for the next election, we will not tolerate those who are planning to remove the government unconstitutionally. Chamisa you lost the election, Bide your time any other recourse to try and remove the government by force will be met with total resistance,” said Mutsvangwa.

War veterans secretary-general, Victor Matemadanda and Bulawayo province representative, Japhet Pfuti added their voices saying they will rally behind their leader, Emmerson Mnangagwa.

“Anyone who wishes to have a dialogue with the president must join POLAD, that is the platform that was established to enable leaders of all parties to deliberate on any issue that concerns the country, anything outside POLAD will not be entertained,” they said.

Mutsvangwa Dares 31 July Protest Organisers

By A Correspondent- The Zimbabwe National Liberation War Veterans Association (ZNLWVA) has warned 31 July protest organisers that their plot to overthrow the government will not succeed.

ZNLWVA chairperson Christopher Mutsvangwa accused the protest organisers of a devious plot of wanting to subvert the will of the people expressed in the 2018 elections.

Mutsvangwa said an unconstitutional change of government will not happen and those who planning to do so will be met with force. He said:

… There are people who think that they can change governments extra-constitutionally before elections — the likes of Ngarivhume, (political activist) Hopewell Chin’ono and many people behind MDC of Chamisa.

Chamisa you lost an election, your party lost an election, elections are coming in 2023. Bide your time if you can organise, which you are not capable of.

… we are warning anybody who is trying to go against the Constitution that you will pay the price because the defence and security establishment will be there to address such kind of miscreant behaviour.

Jacob Ngarivhume, leader of a small opposition political party, Transform Zimbabwe, has been at the forefront in organising anti-corruption demonstrations set for July 31.

He was arrested on Monday on allegations of inciting public violence through social media posts.

Bulawayo Residents Ignore Lockdown Regulations

By A Correspondent- Bulawayo residents on Wednesday ignored the new lockdown regulations which, among other things, stipulates that non-working sections of the population should stay at home.

The regulations were announced by President Emmerson Mnangagwa during a televised national address on Tuesday.

However, residents filled Bulawayo central business district and public areas in residential suburbs, defying the regulations which took effect yesterday.

Unregistered informal sector operators and illegal money changers were operating in the city centre as usual.

Security forces were apparently not thorough in enforcing announced measures especially on people travelling on private vehicles and those walking into town.

Bulawayo police spokesperson Inspector Abednico Ncube said they have increased deployment of officers to enforce the new regulations and those who continue to defy the regulations will only have themselves to blame when they get arrested.

He said:

Today we have been conducting campaigns educating the public about the need to adhere to laid down regulations. Hence, the public should not cry foul when they get arrested. Regulations should be followed without people making excuses.

Bulawayo Provincial Affairs and Devolution Minister Judith Ncube said complying with laid down regulations is not for Government’s benefit but citizens’.

“Corona Judgement Backfires?”

By Kennedy Kaitano- Media reports are that the MDC-T Acting President plans to approach the Supreme Court to seek extension of her tenure at the helm of the opposition party without going to the extra-ordinary congress due to circumstances beyond control.

But I have advised Dr. Khupe and Morgan Komichi before that the Supreme Court Judgement was issued during Corona, and was supposed to be implemented in a Corona environment as it was already known by the time the judgement was passed that Corona was going to be around for a long while.

I warned them to devise methods that suited the corona environment to ensure the Extra-Ordinary Congress was held within the stipulated period, but also advised them to stick to the MDC constitutional requirements for holding an Extra Ordinary Congress, advice which all fell on the deaf ears of both Dr. Khupe and Senator Komichi.

Interestingly, these Comrades were wise enough to hold a Whatsapp Council meeting knowing that a physical meeting was impossible due to Corona.

So are they now saying e-meetings are not official now that they have failed to prepare for the Extra Ordinary Congress?

The only anomaly regarding their whatsapp Council, which is the basis for which all the planning that has taken place was based on, is that the whatsapp was not constitutional, and for that reason the planning process can be challenged at law as it was an outcome of a constitutionally flawed Council meeting. 

It was on the basis of the whatsapp unconstitutional council meetings that legislators were recalled from Parliament and fired from the Party. If they cannot hold an e-Congress when they made decisions based on an e-Council meeting, then the whole process was fraudulent from the word go.

The Supreme Court ruling gave Dr. Khupe 90 days to organise an Extra Ordinary Congress, but her energies were expended on ensuring that legislators were recalled from Parliament and Senate to create room for her and her cronies instead of planning for the Extra-Ordinary Congress.

As advised in a previous post, there are 210 constituencies across the country, and voting could have taken at these 210 centres, and if 5000 delegates were expected to participate in the Congress, only 24 people would have been required to assemble at each election centre to cast their votes. Add a few monitors, the maximum number would have been well below 50 at each centre.

It is just bad leadership and greedy which made Dr. Khupe fail to lead the process to organise the Congress within the 90 day period. The Court gave 90 days knowing very well that 90 days was adequate to prepare for a Congress that met Covid-19 requirements, and simple, Dr. Khupe failed the test, leaving it to Senator Komichi who is not left with seven days to accomplish what Dr. Khupe failed to achieve in the first 90 days.

It would appear Senator Komichi was not given the room to take charge as it appears Dr. Khupe was still in charge of the process, but that is his own problem because the court judgement was very clear that he was supposed to be the key driver after Dr. Khupe’s failure, even though he was given that authority out of the judges ignorance as they assumed he was the chair in 2014 because the court papers presented him as Chair, but it is a role he only assumed post Dr. Tsvangirai’s demise.

The Standing Committee of the 2014 MDC structures never met, and made up Standing Committee of the Dr. Khupe faction is the one that has been planning the non-event, and a request by the majority of the 2014 structures  National Council members never materialised.  

Good luck Senator Komichi in leading the Congress process, although the outcome will be challenged as it is based on a  whatsapp Council meeting that did not meet the requirements of the MDC Constitution. 
 

“Return All Vehicles”: Parliament Tells Expelled MDC Alliance MPs

By A Correspondent- Parliament has written to all the 22 expelled legislators requesting them to return the vehicles they got under its car loan scheme.

Clerk of Parliament, Kennedy Chokuda said that legislators who wish to keep the vehicles will have to pay off the difference. Said Chokuda:

Members who have been recalled from Parliament have an option to fully pay for their vehicles or surrender them to Parliament.

If they surrender them they will have to pay any differences between the valuation of the vehicle.

As required by the law we have already written to affected MPs to make a decision on the matter. We are simply guided by the law on this.

The MDC-T led by Thokozani Khupe has expelled a total of 21 Members of Parliament from both Houses who contested the 2018 general elections under Nelson Chamisa’s MDC Alliance.

Khupe used a controversial Supreme Court ruling issued in March to expel legislators who refused to switch their allegiance from the MDC Alliance.

The ruling ZANU PF recalled Chivi South MP Killer Zivhu following his expulsion from the party.
