Legendary human rights lawyer and Nelson Mandela’s personal solicitor, George Bizos, made a surprise attendance at the bail hearing of war veterans leader Douglas Mahiya, a development that could raise the profile of the case.
Bizo’s legal career stretches over decades; includes the 1960’s famous Rivonia trial in which he was Mandela’s lawyer when Mandela was charged with treason by the apartheid regime. Bizos was also the lead defense lawyer in the case involving MDC President Morgan Tsvangirai and a suspected Israeli spy, Ari Ben Menashe, in which Tsvangirai was alleged to have connived with Menashe to kill President Robert Mugabe.
Bizos appearance at Mahiya’s case shows how seriously developments in Zimbabwe are being taken especially after Mugabe himself made it clear last week, that he would deal ruthlessly with all opposition against his rule.
Mahiya appeared in court this morning facing charges of undermining the authority of President Mugabe.
His bail hearing has been set for Monday morning at Rotten Row Magistrate’s court and he has been remanded in custody until then.
Magistrate Vakayi Chikwekwe presided over the matter.
Mahiya is being charged with undermining the authority of or insulting President Robert Mugabe in contravention of Section 33 (2) of the Criminal Law (Codification and Reform) Act Chapter 9:23.
According to Lawyers for Human Rights, the State is opposing bail on the grounds that Mahiya’s release might present a danger to him and affect public security safety and order. They further argued the 61- year- old’s release might result in clashes between the accused person and security forces and this may undermine the security of the country.
Harrison Nkomo and Andrew Makoni who are representing the war veteran’s leader argue that their client must be released on bail in accordance with Section 50(1)(d) of the Constitution as there are no congent reasons accompanied by sufficient evidence to support that state’s assertion.
This comes after lawyers argued that the matter should not proceed as the prosecutor had failed to produce a certificate of prosecution signed by the Prosecutor General according to Section 34 of the Constitution. Magistrate Chikwekwe has since ordered the State to obtain a signed certificate by Monday 1 August 2016.
The State tried in vain to oppose the Defense’s submissions claiming that the certificate was not necessary as Mahiya was already on remand.

3. Oral tradition tells me stories about marauding gangs of savages who were referred then as Madzviti. Some Shona tribes used to think that the Dzviti was a mystic being with a tail. This little story happened in Masvingo during Lobengula’s time.
In a small village, the people spotted a gang of Dzvitis coming, as was their norm after EVERY HARVEST in order to get farm produce. There was no time to flee, so the people had to hide in the nearby bushes.
An old man was spotted, and the Dzviti without any mercy smashed the old man’s head with a nduni and he died. Upon hearing the sound, another old man hiding from a distance says, “Ndiyani apuzhe dhamba andipewo?”, and that was the last words he ever uttered. Another old man sees the Dzviti and retorts, “ndaiti Hwiti rine muwshe ( muswe)”, that was his last words as well. Why were they killing the same Shonas whom they depended upon for food? The average black South African speaks about three African languages. No Government Minister, President or official addresses the nation or national gatherings in their language. They all respect every language and community. They take their Constitution seriously. Not so in Zim. Equality is practiced; its not just on paper as in Zim where everywhere they speak Gukurahundi. Even in Matebeleland to the locals. That is the difference.
