High Court Okays Chamisa’s Kwekwe Rally, Says ZRP Ban Was “Unlawful And Shocking”

By Own Correspondent| A Bulawayo High Court judge Justice Nokuthula Moyo on Thursday overturned the decision by the ZRP to block Nelson Chamisa’s Kwekwe rally arguing that police actions were unlawful consodering that this was a constitutionally guaranteed right.

Justice Moyo said that police acted unlawfully when they blocked the rally citing fears of typhoid.

MDC Alliance lawyer Tonderai Chitere revealed that the High Court ad overturned the ban and had okayed the rally.

Said Chitere:

“The rally has been okayed by the High Court. In fact, the judge said it was the applicant’s constitutional right to hold the rally and it was even shocking that the police had blocked the meeting.”

Part of the MDC’s application to the court was as follows:

“The action of the first respondent attempts to infringe on Section 58 of the Constitution of Zimbabwe, which enshrines the right to freedom of assembly and association as well as the freedom of expression enshrined in Section 61. That is so important that it cannot be arbitrarily or unreasonably taken away by any person, including first respondent.”-Newsday
