Mnangagwa And Chiwenga Clash On Cabinet Selection

By Paul Nyathi|Reports have emerged that President Emmerson Mnangagwa has heavily clashed with his deputy Constantino Chiwenga over who should be in the new cabinet.

Highly placed sources around the presidency indicated that Mnangagwa rejected a cabinet list proposed by Chiwenga which was made up mostly of senior army officials.

The sources further indicated that the two could also not agree over the inclusion of Obert Mpofu in the cabinet.

Chiwenga is reported to haven been strongly against Mpofu being included in the cabinet a proposal which Mnangagwa threw away.

Meanwhile, reports also yet to be confirmed indicate that Mnangagwa is highly interested in including opposition MDC-T leader Nelson Chamisa on his administration.

The sources claim that Mnangagwa has already presented his proposal to Chamisa who has not yet responded.

Zanu Pf Senator Hauled Before The Courts For Kidnapping

By Own Correspondent| Newly elected Zanu-PF Senator for Seke, Tabeth Murwira together with 4 other accomplices were hauled before a Chitungwiza magistrate, Yeukai Chigodora jointly charged with kidnapping and destroying a man’s property over a political dispute.

Murwira together with her accomplices, Christopher Mujeyi (51), Cater Matengambiri (59), Kalisto Pemiwa (72) and Lawrence Guwa (65) however pleaded not guilty to th charges levelled against them and their trial is set to start on September 6.

Murwira was implicated in the matter after her vehicle was allegedly used in committing the offence. She however dismissed the claims as unfounded adding that the matter was political.

The court heard that on December 13 2017, Phillip Mashongahande (50) was sleeping in his shop at Cornerstone, Beatrice at night when the suspects arrived.

They knocked on his door and assaulted him the moment he opened it. They allegedly handcuffed Mashongahande and searched his shop.

One of the suspects allegedly tried to set the shop on fire while Mashongahande was inside. They left Mashongahande handcuffed in the shop and he was only rescued the following day by Constable Tinashe Katsuwa.-StateMedia

Shiri said farmers had other resources such as water and land which have nothing to do with sanctions.

Said Shiri:

“Sanctions have nothing to do with our farming and productivity so we should free ourselves in that sector.

We can perform better even when we have sanctions. We have land, water and other resources that would enable us to enhance productivity.”

Man Escapes Prison After Fondling Sister In Law

A BULAWAYO man who fondled his wife’s younger sister and undressed in her presence, has been sentenced to three months in prison.

Onias Moyo, however, breathed a sigh of relief when Western Magistrate Mr Lungile Ncube wholly suspended the sentence on condition that he does not commit a similar offence.

In passing the sentence Mr Ncube said Moyo’s conduct was shameful and he could not be trusted.

On August 13, Moyo was sent by his wife to collect the sister-in-law so they could go to a church camp meeting.

On arrival at home his wife had already left.

Prosecuting Mr Kenneth Shava told the court Moyo took his sister-in-law to the shops where they bought some meat for supper.

When they got back home Moyo locked the door and placed the keys on the table before fondling his sister-in-law’s breast.

She tried pushing him but Moyo threatened her saying he would get her deported back to South Africa where she was attending school.

Moyo stripped naked before his sister-in-law and dragged her to the bedroom.

She managed to escape to her aunt’s place at Entumbane.

A family meeting was held before the matter was reported to the police.

June 2018 Zimsec O’Level Results Out

Zimbabwe School Examinations Council (Zimsec) June 2018 Ordinary Level results are out and centre heads can start collecting them from Zimsec regional offices tomorrow.

Zimsec board chairman Professor Eddie Mwenje made the announcement in a statement yesterday.

“The Zimbabwe School Examinations Council board and management would like to advise the nation of the release of the June 2018 Zimsec Ordinary Level results,” he said.

“Heads of examination centres will be able to collect the results for their respective schools or centres from our regional offices on Wednesday, 29 August 2018.”

Prof Mwenje said there was an increase in candidature this year as compared to last year.

“A total number of 141 246 candidates registered and sat for a range of subjects from one to 10 compared to 78 655 in June 2017,” he said.

“Of the 141 246 registered candidates, 136 were special needs candidates. The total candidature increased by 75 866, a percentage increase of 79,58.”

According to Zimsec, 17 232 school candidates and 124 014 private candidates sat for the June 2018 examination.

Prof Mwenje also highlighted the increase in candidates who sat for five or more subjects.

“The total number of candidates who sat for five or more subjects was 10 974 which is 7, 77 percent of the total candidature while 130 272, (92,23 percent) sat for four or less subjects,” he said.

“In the June 2017 examinations, the number of candidates who sat for five or more subjects was 3 045 constituting 3,89 percent of the total candidature of 78 655.

Prof Mwenje did not indicate the pass rate.

Mugabe Retains Airport Name After Bona Stunt

ZANU PF secretary for legal affairs Munyaradzi Paul Mangwana (pictured) yesterday said they were in no hurry to sever ties with former President Robert Mugabe and to rename the Robert Gabriel Mugabe International Airport as requested by the war veterans.

The developments came in the wake of Mugabe’s decision to send representatives to President Emmerson Mnangagwa’s inauguration on Sunday.

Mugabe, who has previously snubbed national gatherings, sent his daughter Bona and son-in-law Simba Chikore to represent him at his successor’s installation.

Mangwana said there was need for maturity and wisdom in dealing with the war veterans’ demands given that Mugabe appeared to be softening towards the new administration by “showing statesmanship”.

“It is gratifying. That is the kind of message Zimbabwe has been expecting. You heard the applause, we expect that as our founding President, he must occupy that respectable place and today, he behaved just exactly as we expected,” Mangwana said.

“There has been a request to change the Robert [Gabriel] Mugabe International Airport, but government has not taken a decision and so has the party not taken a position. It is a request which has come from some sections within the party, but that request would be considered in light of behaviour and conduct made today (Sunday) and going forward.”

The development was likely to put Zanu PF and the war veterans association on a collision path, with the Zimbabwe National Liberation War Veterans’ Association secretary-general Victor Matemadanda insisting that Mugabe should be banished even after his endorsement of Mnangagwa’s administration as he was a “sellout”.

“We are not convinced with that. I am not sure if he is sincere. I think he is doing that to avoid the name change that we are undertaking at the airport. I don’t see any good reason why he should congratulate ED when, in actual fact, he said he would not vote for him,” he said.

Matemadanda said Mugabe should do more before his former allies rethink their relationship with him, otherwise they would stop at nothing to have him excommunicated and his name removed from the international airport.

Mugabe has previously expressed dislike for his successor’s administration since his ouster in November last year.

On the eve of the July 30 polls, the former head of State announced that he would not vote for Zanu PF, but would throw in his lot with MDC Alliance leader Nelson Chamisa.

Kombi Driver In Trouble For Bumping On Chiwenga’s Vehicle

A 30-YEAR-OLD unlicensed commuter omnibus driver was on Monday remanded in custody for cutting off Vice-President Constantino Chiwenga’s motorcade in Borrowdale, Harare, causing serious damage to the vehicles.

Silent Hungwe was not asked to plead when he appeared before magistrate Rumbidzai Mugwagwa, who remanded him in custody to September 4 pending finalisation of investigations.

Allegations are that on August 24 along Borrowdale Road at the intersection of Kingsmead, Hungwe was driving due south and, in his bid to avoid vehicles that had blocked the road, hit Chiwenga’s vehicle on the rear side.

Although no injuries were recorded, both vehicles sustained serious damages.

OPINION: Zimbabwe Needs A Rebirth; Women Must Play A Central Part

Dear Editor|The situation of women in Zimbabwe has been gradually deteriorating since the country gained its independence from Britain in 1980. As one who grew up in the country at a time when things were still relatively fine, I can still vividly recall the easy-go kind of life we led then.

As little girls, we completely enjoyed our childhoods, without having to worry about the cares of the world, something which cannot be said of today’s girls who have to do something to assist the family that is if they are not heading it altogether. In the past all the basic requirements were provided for.

As little kids we had plenty of time to play by in the streets and had access to good, nutritious food as well as snacks between meals.

The country celebrated two important holidays this week which are the Heroes Day and Defence Forces Day. Heroes Day is a day set aside to commemorate the fallen liberation war fighters whose sacrifice made it possible for Zimbabwe to gain independence in 1980.

However Zimbabwe has just proved to be a classic case of the phenomenal “from riches to rags.” At independence Zimbabwe was just an envy of many but alas, some bad influence started crippling in with record corruption levels eating away the riches of our country.

Like a greedy herd boy who milks his master’s cows and sell the milk for a song, the once liberation war heroes turned themselves tyrants and villains. With a little effort, they reversed all the progress that Zimbabwe had achieved. The once breadbasket of Southern Africa is now a basket case.

What surprises me is that those we accuse of destroying the country have always found themselves back into power. It’s now 38 years after Independence but with nothing to show for it and we wonder if the fallen heroes we were commemorating on Monday are not turning in their graves.

Each electoral season we emerge a more divided nation, what a shame on us. It affects the economy too.

Zimbabwe just needs a break from all the drama of selfish politicians. The country needs a rebirth. I yearn for a country where exactly the opposite in terms of leadership style becomes the order of the day.

The question is who is going to be our saviour, who is going to be our next heroes now?

I think it’s time for all men and women of valour to stand up. The largely male dominated leadership has brought us to where we are now. Not discrediting their contribution during the liberation war, we are now in a phase where our leadership style must change and allow young women and men to take over. It is the skill that one has that must count and not the proximity to power.

Zimbabwe’s rebirth lies in all its citizens, both men and women who have something new to offer away from the ruinous politics of the male dominated, corruption ridden and continuously recycled Zanu PF leadership.

A rebirth which acknowledges that we are all equal citizens in practice and anyone who has the best idea must be listened to.

In this rebirth I challenge my fellow women to emerge out of this messy and be the country’s new crop of heroes. Women must rise up and defeat patriarchy that has shaped our ideology to think that we will not move forward without this failed crop of leaders that have ruled us for the past 38 years.

Women seriously need to build self-confidence and take up key positions of power and influence. It is time for a rebirth and it’s time to stand and break the propaganda that only men can do it.

What we enjoyed as little kids must be the basic privilege of everyone. We need a rebirth where both men and women of character reshape our national vision and allowed to play a part in the reawakening of Zimbabwe.

End Of Indigenisation Laws, Canadian Company Retains Majority Holding At Blanket Mine

CALEDONIA Mining Corporation of Canada has gained a controlling stake at its subsidiary Blanket Mine after purchasing 15 percent shares from Fremiro Private Investments Limited.

Caledonia, which owned 49 percent shares of the business, entered into a Memorandum of Understanding (MoU) with Fremiro with the intention to purchase Fremiro’s 15 percent shareholding at the Gwanda-based mine.

The move is in line with previous public statements where Caledonia expressed interest in increasing its shareholding at Blanket Mine.

In a statement released on Friday, Caledonia chief executive Mr Steve Curtis said the group was pleased with the transaction, which remains subject to approval from various Zimbabwean regulatory authorities and the execution of a legally binding sale agreement.

“We are very pleased to increase our shareholding in Blanket to a majority stake, moving from 49 percent to 64 percent following this transaction. Blanket Mine has been an excellent investment for Caledonia since we originally invested in Zimbabwe in 2006 and we are delighted to be able to increase our shareholding in this outstanding asset,” he said.

“Today’s transaction forms an important step in our stated goal of increasing our shareholding in Blanket since the Zimbabwean government removed the indigenisation requirement for gold mining businesses earlier this year.”

Government has reviewed the indigenisation laws by scrapping the 51/49 percent requirement on major natural resources’ investments except for diamond and platinum minerals. According to Mr Curtis, Caledonia will acquire Fremiro’s shareholding in Blanket for a gross consideration of $16,667 million to be settled through a combination of the cancellation of the loan between the two entities which stood at $11,467 million as at June 30, 2018 and the issue of 727 266 new shares in Caledonia at an issue price of $7,15 per share. On completion of the transaction, Fremiro will hold 6,42 percent of Caledonia’s diluted equity.

Fremiro acquired its 15 percent shareholding in Blanket when Caledonia implemented transactions in 2012 in compliance with the Indigenisation and Economic Empowerment Act. As part of the transaction, Caledonia sold 41 percent of Blanket Mine to other players. This saw Fremiro getting (15 percent), the National Indigenisation and Economic Empowerment Fund (16 percent) and the Blanket Employee Trust Services Private Limited (10 percent).

In addition, 10 percent of Blanket Mine was donated to the local community in the form of the Gwanda Community Share Ownership Trust.

Mr Curtis also highlighted that Blanket Mine is well-advanced in implementing the investment programme, which commenced in early 2015 and is expected to result in Blanket achieving an annual production rate of at least 80 000 ounces per annum by 2021, at a low cash cost. The investment plan is expected to extend the life of the mine by providing access to deeper levels for production and further exploration.

Mr Curtis said Caledonia is evaluating further investment opportunities in Zimbabwe.

“Such new opportunities, if they result in one or more transactions, are likely to be held directly by Caledonia and/or its subsidiaries rather than by Blanket. By moving its participation up from Blanket to Caledonia, Fremiro is well-positioned to participate with Caledonia in any further investment opportunities,” he said, adding that they look forward to evaluating further investment opportunities in Zimbabwe as they become available. Caledonia remains on track to achieve the production target of 80 000 ounces by 2021 at Blanket.

Man Sentenced To 25 Years For Rape Committed 11 Years Ago

A 29-YEAR-OLD man from Mvuma who had been on the run for seven years after raping and robbing a passenger in his vehicle, has been sentenced to 25 years in prison.

Patrick Chakuwamba of Mucheri village, Chaka in Mvuma appeared before Gweru Regional Magistrate Mrs Phathekile Msipa facing rape and robbery charges

Chakuwamba had been on the run since 2011 when he committed the offence.

He denied the charges claiming that he had consensual sex with the complainant (name withheld to protect her identity) accusing her of being a lady of the night.

Mrs Msipa convicted Chakuwamba after a full trial and sentenced him to 20 years for rape and 5 years for robbery.

Chakuwamba will, however serve an effective 18 and half years in prison after six and half years were suspended on condition of good behaviour.

During trial, a friend of the complainant said she was the target of the rape but Chakuwamba turned to the first complainant after learning that she was on her menstrual period.

“I was seated in front when he said he wanted to sleep with me. I told him that I was on my menstrual period and because he doubted me, he forced his fingers down my private parts,” she said.

Chakuwamba, the complainant said, then tied her friend with a cable before raping her twice.

It is the State’s case that on May 19, 2011 Chakuwamba met the first complainant at Chicken Slice Complex in Mvuma where she was looking for transport to Beitbridge.

Chakuwamba offered to transport the complainant and her friend who boarded his vehicle before he drove off towards Masvingo.

On approaching the 223km peg along Harare-Masvingo road, Chakuwamba pulled off the road and disembarked.

He armed himself with an iron bar and took an electrical cable from the bonnet of his car.

The court heard that Chakuwamba initially wanted to rape the complainant’s friend but she was saved by being on her menstrual periods.

Chakuwamba tied the friend up with an electrical cable and ordered the complainant to lie down on the back seat of the car and raped her once using a condom. After 30 minutes of rest, he raped her once more but without using a condom.

The accused person robbed the complainant and her friend of $25, two pairs of trousers, two Samsung cell phones and a bottle of perfume.

Chakuwamba forced them off his vehicle and drove off. Total value stolen was $120 and nothing was recovered.

A report was made to the police but Chakuwamba fled before he could be arrested.

He was however, arrested this year following a tip off. Mr Kelvin Guveya appeared for the State.

Daring Zimbabwean Thug Who Escaped From Police Custody Rearrested In S.A.

By Paul Nyathi| One of the two Zimbabwean awaiting trial prisoners, who escaped while being transported in a State vehicle in Limpopo South Africa, was rearrested on Friday.

South African Police spokesman Colonel Moatshe Ngoepe said Petrus “Small” Moyo was rearrested at Ga-Mushi village, outside Lephalale on Friday evening.

Moyo and fellow Zimbabwean Witness Simango were arrested for murder and house robberies. They cut open the roof of the moving police truck, jumped off and vanished in the bushes earlier on Friday. Police were transporting the prisoners from Lephalale to Polokwane when the incident happened.

Moyo faces charges of murder, house-breaking, and theft. He was confirmed to have entered South Africa illegally. Simango was linked to a series of house robberies and burglary in Lephalale and surrounding areas.

Moyo said:After claiming they won the disputed election and even after the ConCourt has endorsed that claim, the self-claimed winners are still running scared.

Now they’ve a new scapegoat.
On the eve of the 30 July election, they said a vote for Chamisa was a vote for Mugabe. And on the eve of the ConCourt decision, they again pointed fingers at Mugabe, who appointed the bench. After the ConCourt sided with them, they needed a new bogeyman:Jonathan Moyo. LMAO! Me Chamisa’s advisor? I’m flattered to learn from the reliable Sunday Mail that, out of the blue, the junta has appointed me as Nelson Chamisa’s advisor.

I hope Chamisa will confirm
this great appointment for which I

ZEC Says We’re Cleared Now

The Zimbabwe Electoral Commission (Zec) yesterday said it was relishing the ruling of the Constitutional Court and reports from observer missions that it superintended over a credible election.

The Constitutional Court on Friday ruled against MDC Alliance presidential candidate Advocate Nelson Chamisa who had filed an application challenging President Mnangagwa’s victory, alleging electoral malpractice.

He however, failed to produce evidence to support his case resulting in the Chief Justice Luke Malaba sitting with eight other ConCourt judges dismissing his case with costs.

The court upheld President Mnangagwa’s electoral victory declaring him the President of Zimbabwe and he was sworn into office on Sunday.

In an interview yesterday, Zec Acting Chief Elections Officer Mr Utoile Silaigwana said the apex court’s ruling dispelled unfounded claims that the commission rigs elections.

“ZEC has been vindicated by the Constitutional Court which shows that Zec conducted this election in terms of the Electoral Law. The election was credible hence it was also proved through the petition which went through the Constitutional Court,” said Mr Silaigwana.

He said inviting international observers was a plus for the commission as preliminary reports by most observer missions have credited Zec for running the election in a professional manner.

Government invited international observers to watch as the country’s citizens chose their political leaders.
The pre-election environment was peaceful serve for post election violence sparked by the MDC Alliance that was refusing to accept results, before most of them had been announced. The incident in Harare claimed six lives.

“The lessons we are learning through inviting observers is that it is important to have observers as most of them have given us the thumbs up on the electoral process. It’s a lesson that we need to stick to the Electoral Law as was done,” Mr Silaigwana said.

“We are still to get the full reports. But from the preliminary reports we have received, the observers are saying the elections were conducted professionally.”

The Acting Chief Elections Officer said Zec was also impressed with the upsurge in the number of people who voted.

He said more than 85 percent of registered voters voted on July 30 compared to past elections which attracted just over 50 percent of the registered voters.

Mr Silaigwana said the electorate should accept the poll outcomes as the country’s democracy was enhanced.

“I think it’s important for our citizens to accept the outcomes of the elections, particularly an election like this one which was observed by the whole world. It was confirmed by the observer missions that the election was credible. So it is important for us to accept the outcomes of a credible election,” he said.

Khupe Demands $1,8 mln From Chamisa

The MDC-T led by Dr Thokozani Khupe says it will soon take MDC Alliance leader Mr Nelson Chamisa to court claiming $1,8 million he received under the Political Parties Finance Act for the 2018 campaign.

Dr Khupe’s party claims it is the legitimate MDC-T and that Mr Chamisa illegitimately received the funds because he contested the poll using a different name.
Under the Political Parties Finance Act, only serious political parties who would have garnered at least five percent of the total vote were eligible for the funding.

MDC-T, which was led by Mr Tsvangirai, in terms of the Act, is the one entitled to the funding.

However, after the demise of the former party leader Mr Morgan Tsvangirai in February, a leadership wrangle ensued between Mr Chamisa and Dr Khupe.

Ultimately, Dr Khupe registered to contest in this year’s election under MDC-T while Mr Chamisa chickened out and opted to participate as leader of the MDC Alliance.
Under unclear circumstances, Mr Chamisa’s MDC received $1,8 million funding from Government despite the fact that it was no longer part of the MDC-T.

In an interview, MDC-T deputy president Mr Obert Gutu said that his party had since instructed Professor Lovemore Madhuku to sue the MDC over the $1,8 million fraud.
“We have since instructed our lawyer Professor Madhuku to file a claim for the $1,8 million.
“The money was wrongly disbursed to Mr Chamisa’s MDC when it was meant for the MDC-T which participated in the 2013 election.

“I am yet to meet Prof Madhuku and we map the way forward,” he said.
Meanwhile, Zanu-PF lawyers said they also intend to sue Mr Chamisa’s party over legal costs in the hyped presidential petition which was dismissed by the Constitutional Court on Friday with costs.
Mr Chamisa sought to overturn President-elect Cde Emmerson Mnangagwa’s July 30 election victory, but the ConCourt unanimously dismissed his challenge.

Speaking to our Harare Bureau on Saturday, Zanu-PF Secretary for Legal Affairs Cde Paul Mangwana said the ruling party’s lawyers were quantifying the exact amount due to them, but they had indicated an approximate bill of $3 million.

That figure excludes the Zimbabwe Electoral Commission’s legal bill.
Cde Mangwana said the final bill required approval of the Registrar of the Court.
He said in the event Mr Chamisa failed to pay, the opposition leader risked losing his personal property.

Meanwhile, the cash-strapped opposition MDC Alliance has once again sent begging bowls to raise $3 million to foot the legal costs for their Constitutional Court electoral petition and is seeking more money to fund its case at the African Commission on Human and Peoples’ Rights (ACHPR).

The judgement handed by the Constitutional Court carried a punitive condition requiring Mr Chamisa to pay the legal costs of everyone involved.

In bid to raise this money, the party launched an ‘I donate to protect our vote’ campaign on the Gofundme website on Sunday, appealing to both Diaspora and local supporters to donate for a “good cause.”

The Alliance, which has hit hard times, survived the election period from hand-outs from well-wishers who funded its campaign.

The MDC’s situation has been worsened by donor fatigue and a series of blunders over the years, its poor performance in the inclusive government that ran between 2009 and 2013 key among them.

In a Facebook post, MDC National Deputy Treasurer Mr Chalton Hwende said people can send their donations via EcoCash or make their donations online at gofundme.com .

He has also appealed to well wishers across the world to support it with the costs of suit at the Constitutional Court and African Union appeal, whose bill is not yet known.

MDC Alliance leader Mr Nelson Chamisa has taken his fight to overturn President Emmerson Mnangagwa’s recent electoral victory to the African Commission for Human and People’s Rights following the dismissal of his petition last Friday.

After the declaration of Cde Mnangagwa’s victory by the Zimbabwe Electoral Commission on August 3, Mr Chamisa filed a ConCourt application challenging the victory, arguing that the whole electoral process had been marred by irregularities and massive poll fraud.

But his petition was dismissed with costs by the full bench of the ConCourt led by Chief Justice Luke Malaba on grounds that he failed to provide sufficient primary evidence to prove the alleged irregularities.

But in a statement that goes against the $3 million appeal, the Alliance has said the estimated figure is too high and the legal costs “can’t exceed $20 000”.

“The costs are taxed and allowed by the Registrar of the court, taking into account the exact hours spent. It can’t even go up to $20 000. Besides, the costs awarded are not on a higher scale. It’s just costs on an ordinary scale. People like Paul Mangwana must stop inciting our people,” said Mr Hwende on social media.

Mnangagwa Dishes Out 90 Brand New Cars To Chiefs

Zimbabwe’s internal and international engagement was exhibited at President Emmerson Mnangagwa’s inauguration in Harare yesterday.

Mnangagwa said this while addressing traditional leaders at the handing over of more than 90 Isuzu vehicles to chiefs in Harare today.

He said the handing over of the vehicles to traditional leaders is in line with his promise soon after taking over the reigns of power last year, when he said chiefs need to be respected and should have decent transport and accommodation.
President Mnangagwa, who pledged to avail more resources to chiefs, said he delayed distributing the vehicles during the election period as this could have been misconstrued by some.

He also said foreign leaders and some local political leaders who attended his inauguration is a sign of respect given to him and his government, adding that the absence of the MDC Alliance leadership at the National Sports Stadium yesterday is a sign of immaturity on the part of the leaders.

Marry stated that the country’s flagship beauty contest should be a scandal-free pageant, where the queen is identified on merit and crowned on professional grounds.

She is currently the pageant’s licence holder of the global event in Zimbabwe.

Speaking to the aspiring models vying for this year’s crown who are currently in boot-camp in Harare, marry told the beauties to report any form of abuse during the boot camp.

“As you are here in boot camp, there is no difference as you are at home, so let me advise you that no one must pressurize or abuse you in any way with claims that they might be closer to me as the Miss World Zimbabwe licence holder. Even those who are closer to me they don’t have the capacity to influence the crowning of the queen, this cannot happen at all, let professionalism carry the day,” she said.

“Those men who are facilitating your grooming progression as part of this boot camp program must be treated as your brothers or fathers as they are not potential boyfriends or husbands. City Of Bulawayo Introduces Stringent Water Rationing

|The City of Bulawayo has sent a warning to citizens of the second capital that it will be resuming stringent water rationing programme in some of the areas in the city.

The City blamed the water rationing on pumping challenges on the popular Magwegwe water reservoir.

“The City of Bulawayo would like to advise members of the public and stakeholders that there is an ongoing exercise to normalise the Magwegwe Reservoir level. The level has been critical for the past two weeks, due to erratic pumping from Nyamandlovu Aquifer,” said the Town Clerk Christopher Dube in a statement.

The statement further reads:

“The boreholes have been affected mainly by power failure. ZETDC is working to restore the power supply and therefore increase the boreholes pumping to the City.

In a bid to manage water supply from the Reservoir. Council would like to advise that there will be an emergency interruption of water supplies to the following areas fed directly from the Criterion and Magwegwe Reservoirs and some surrounding areas.

• Nkulumane
• Cowdray Park
• Mganwini

Residents are advised that the programme is subject to change should the Reservoir level improve or deteriorate beyond the critical level.

All high areas that are likely to be affected for more than 24 hours will be supplied by water Bowsers.

Kagame Wines And Dines With Mnangagwa Leaving 36 Yr Old Lady In Jail For Challenging Him In Elections

By Paul Nyathi|Highly acclaimed Rwandan President Paul Kagame was in Zimbabwe over the weekend smiling and laughing with his newly elected Zimbabwean counterpart Emmerson Mnangagwa with very few Zimbabweans aware that he has been holding a young women in custody for a year for challenging him at the 2017 elections.

Tuesday will mark exactly one year to date that Diane Rwigara was arrested by police in Rwanda on trumped up numerous charges her crime being challenging Kagame at the election.

Diane Rwigara was originally charged with forgery and tax evasion alongside her mother in September, 2017. A few months earlier she was prevented from running for president against current leader Paul Kagame and later accused of forging signatures of support during her application.

During her campaign, nude photos appearing to show Rwigara circulated online but she says the images were fake.

Kagame went on to win the election by a world breaking 98% landslide in August and Rwigara was soon arrested with her mother and sister. In October, prosecutors then charged the trio with attempting to incite insurrection, which means they could be looking at lengthy prison sentences.

In March, the Rwanda Revenue Authority (RRA) auctioned property owned by the family for $599,040 (Rwf512 million) to contribute towards more than $5.85 million (Rwf5 billion) in tax arrears.

Diane has remained in prison against calls from various human rights organisations for her release.

Mnangagwa To Embark On “Thank You Zimbabwe” Tour

Newly sworn in President elect Emmerson Mnangagwa is set to embark on a countrywide tour to thank Zimbabweans for voting him and Zanu PF in the just ended July 30 harmonised elections.

Mnangagwa will take this opportunity to outline Government’s programme on devolution of power.

President Mnangagwa revealed this when he handed over 90 cars to chiefs to fulfill Government’s commitment to improve the welfare of the traditional leaders.

Said Mnangagwa:

“We are going to have rallies in your respective areas to thank the people for voting me into power.

We will be saying the message of peace that we have been saying all along and we will also announce plans we have to improve provincial economies because we do not want everything to be centred on Harare.

Woes Mount For MDC Led By Nelson Chamisa: As Sheriff Issues Writ To Attach Property

By Own Correspondent| The MDC faction led by Nelson Chamisa is set to lose its property amid revelations that the Sheriff of the High Court has been instructed to attach its property over labour damages amounting to $264 000.

The labour damages, owed to its former director general Mr Toendepi Shonhe will see the party lose its property at its headquarters, Morgan Tsvangirai House in Harare.

Last week Mr Shonhe obtained a writ of execution which empowers and directs the Sheriff to attach property.

MDC unfairly dismissed 17 employees, including Mr Shonhe, from work and the Labour Court confirmed an arbitral award compelling the party to pay damages to the 17 workers.

Reads the writ:

“You (Sheriff) are required and directed to attach and take into execution the movable goods of the Movement for Democratic Change (Tsvangirai) 44 Nelson Mandela Avenue, Harare the above mentioned respondent of the same to be realised the sum of US$264 444 together with cost of suit for the above-named applicant Toendepi Shonhe, which he recovered by a court order of this court on the 20th day of July 2017 granted by this honourable court in the above mentioned suit.”

Recently, Labour Court judge Justice Betty Chidziva, with the concurrence of Justice Lawrence Murasi, struck off the roll a labour appeal by the MDC-T, a development that exposed the political outfit’s property execution.

MDC owes the 17 workers a total of $665 000 but the writ is in respect of Mr Shonhe’s $264 444.

Civil Society Refuses To Back Chamisa On Mass Protests Call

MDC Alliance leader Nelson Chamisa’s plans to roll out protests in the wake of Friday’s decision by the Constitutional Court (Con-Court) to uphold President Emmerson Mnangagwa’s hotly-disputed victory in last month’s polls might spectacularly backfire, social and political analysts content.

They also believe this action is misdirected and a wrong strategy because whipping up emotions will not get him to State House, at least for now.

On Saturday, Chamisa told a media briefing: “It is a constitutional option (demonstrations) and very viable. We have demonstrated two or three times successfully without any problems. We just want to put mechanisms to make sure that we don’t have people who come and disrupt our programme. I can tell you we have the right to demonstrate. This is going to be one of the routes which we are going to take among others.

“Victory can’t be certain twice, victory was certain before election and secured during the Election Day. We won, what we are doing now is protecting that victory; we will continue to pursue democratic means to make sure that result is respected. We cannot afford five more years in this kind of hardships, people want answers.”

Chamisa said they are ready to sacrifice their lives in defending people’s votes.

“They think that perhaps they will intimidate people like myself but I am dead already, by merely challenging dictatorship you have signed a death warrant so they can’t kill me twice. We are very clear and we are not going to be intimidated that’s why we are ready for any eventuality they can’t run the country by terror.

“The legal door is not the only door to happiness and democracy, there are many other doors, and the political doors are going to be opened very soon using our Constitution. We have the right to peaceful demonstrations and protests that is going to be done in the shortest period of time.”

Political analyst MacDonald Lewanika said if Chamisa wants to fight on, it is well in his rights to do so, but the consequences of such actions must find him prepared.

“Politics is also the art of the possible, and at the moment the cake he says he won’t share with Mnangagwa is actually a cake that he doesn’t have — he has nothing to share.

“A real danger is that this need for continued resistance will not be matched by a similar appetite from his supporters and Zimbabweans in general, who see this presidential fight as lost and would like to move on to focusing on how to survive under the Zanu PF regime and continuing economic challenges.

“Zanu PF will push the narrative that he is petty and a sour loser, while others will see him as an unrepentant fighter for his just desserts.

“At the end of the day it is about Chamisa staying in touch with the pulse of a people, who are generally not known to be persuaded to the kind of radical positioning he is pitching.

“Zimbabweans have been known to be risk averse and the likelihood is that the onward march to challenging the presidential results through mass action, which has already proved to be not just futile but also fatal, will be a march that he will make with less and less people.

“History has recorded that Chamisa believes he won the election but was cheated out of victory, the legal process denied this claim but the court of public opinion largely agrees with him.

“If I were Chamisa, I would bank the public sympathy and turn it into future political capital — attempting to spend it now through mass action will prove to be a waste, and come across as lacking the political maturity to roll with the punches, taking your hits and living to fight another day,” said Lewanika.

He added that Zanu PF and its “varakashi” will portray this as intolerance and a total disrespect of political and democratic processes that Chamisa entered into willingly and knowing the odds against him.

“It will feed into a bad narrative that Chamisa cannot lose, and believes that everything but a win for Chamisa is a wrong outcome — such traits are not attractive and will begin to undermine the formidable political capital that he had built over the last six months.”

Media and political analyst Rashweat Mukundu said the right to protest is constitutionally-guaranteed and protected.

“As a political strategy the MDC Alliance must however, consider its effectiveness in achieving the desired end. In my view Chamisa must keep his power base energised through mobilisation and political awareness.

“The Con-Court case is sufficient basis to seek electoral reforms that could make the 2023 election far better. Age is on Chamisa’s side and all he needs are equally capable lieutenants to prepare for the next election.

“The MDC Alliance must use its presence in Parliament to monitor Zanu PF actions and use its dominance in urban councils to address residents’ issues. Political mobilisation is more sustainable than protests.

Political analyst Piers Pigou said protests are not unexpected tactics in the circumstances, but they must be tied to a clear strategy that pushes a reform programme tied to constitutional deficits, realignment, institutional reform and that holds Mnangagwa to his reform commitments as laid out in GoZ presentation in DC in April.

“Peaceful protest is important expression, but can Zimbabwe’s security forces be trusted to act professionally. This is a major worry after post-election events.

“Mnangagwa says his door is open to Chamisa. He is now president and must proactively reach out, not sit his hands.

Political analyst Maxwell Saungweme said after running a successful campaign on a shoe-string budget and “you garner over two million out of five million votes and for some reason your victory is stolen, and you go to the nation’s apex court you knew was captured and lost, the logical thing to do is not mobilising people to oppose a court decision. That will border on illegality.

“What I would advise Chamisa if I was in his inner-circle is to use whatever resources and popularity he has now to do the following: quickly call all party leadership at all levels to a strategic retreat and genuinely reflect on what happened, where the party did well and areas in need of improvement, including 2013 lessons not learnt from. Then do a party elective congress, have a proper leadership structure, formalise a party name, go to rural and urban areas to set and strengthen structures. Then start selling your message of alternative policies and approaches to your supporters first so that they know exactly how different you will be from the current regime.”

Saungweme said let the mobilisation for an action be bottom-up and not top-down. “Top-down protests tend to be urban-based and negate the views and wishes of where the bulk of the voters are — rural areas. “With the level of organisation shown by the MDC Alliance during polls where they could not field council and MP candidates in all constituencies and polling agents at all polling stations, unorganised demonstrations will not be sustained and will fizzle within a few weeks, if not days, with blood of the innocent people potentially lost from heavy-handed State responses.

“Zimbabwe is our home and leaders should be acting in manners that build national cohesion than dividing us. Look at the November 2017 coup; it was a Harare thing that did not get buy-in from people in the rural areas, hence contributed to Mnangagwa’s poor showing in the presidential poll.”

Human rights lawyer Dewa Mavhinga said: “As human rights activists we do not prescribe what political strategies political leaders should take save to note that the route to approach the Con-Court is enshrined in the Constitution, just like the right to peacefully demonstrate which is protected by section 59 of the Zimbabwe Constitution.

“Whichever political strategy one pursues, it is important that the rule of law and human rights are protected in the process. The violence and use of excessive force by the security forces on August 1 should not happen again.”

Elections Resource Centre director Tawanda Chimhini said demonstrations are a constitutional expression of political rights.

“The decision by the opposition to use such an option in the aftermath of the decision of the Con-Court is an opportunity for the new administration to exhibit the respect for the rule of law and protect the Constitution. The option to demonstrate must also be approached with the necessary responsibility to abstain from any action that may be deemed as illegal. Regardless of what options political stakeholders take, Zimbabwe must definitely find a sustainable way to extricate itself from a cycle of failed electoral and democratic processes. “All options adopted must put Zimbabwe first,” said Chimhini.

Political analyst Vivid Gwede said without a doubt it is within Chamisa’s democratic rights to express himself on both the outcome of the election and the court.

“This is important in highlighting the reality of captured public institutions in Zimbabwe and the need for the continuation of the democratic agenda. Everyone gave the Zec and the courts the benefit of doubt but these institutions do not seem to have lived up to their duties satisfactorily. In light of this reality, the Constitution affords citizens, including the aggrieved MDC Alliance leadership, political rights to campaign for a cause which their conscience justifies.

“As you can see, the MDC Alliance has taken varied post-election strategies to put its grievances on the table, including that they will approach the African Commission for Human and People’s rights to protest the outcome of the Constitutional Court. Chamisa is right that in all this struggle, there is need to mobilise and explain to the people how he thinks they have been shortchanged because in the final calculation the people matter going forward.”

Mugabe And Grace Unwell

Paul Nyathi|Former Zimbabwe President Robert Mugabe says he and his wife Grace are unwell.

The 94-year-old revealed this in a surprise congratulatory message sent to President Emmerson Mnangagwa at his inauguration ceremony on Sunday. Mugabe apologised that he and his wife couldn’t be at the inauguration ceremony.

In a letter read out by Mnangagwa, the former president said his wife is unwell and in Singapore. He also said he wasn’t well, which is why he sent his daughter Bona and her husband Simba Chikore to stand in for them.

Mugabe gave no details on what he and his wife were suffering from. But his congratulatory note took many by surprise.

Case Was More Than Chamisa vs Mnangagwa It Was People vs Zanu PF – We Were Cheated Again.

Opinion By: Wilbert Mukori|The single most important issue raised in Nelson Chamisa’s Con-Court challenge of Emmerson Mnangagwa’s electoral victory was that the election process was not free, fair and credible. This is important because it is our repeated failure to hold free elections has landed us in this economic and political mess. And, of immediate importance to us all, until we hold free and fair elections, we are not getting out of the mess.

Given Zimbabwe’s checked history of rigged elections and the tragic and dire consequences this repeated failure to hold free, fair and credible elections have brought to the entire nation. It was therefore wrong for Chief Justice Luke Malaba and his fellow eight Chief Justices to consider the case before the court mere as a Chamisa vs Mnangagwa and ZEC. It was a lot more than that, it was The People of Zimbabwe vs Zanu PF and its surrogate undemocratic institutions.

Zimbabwe is in a serious economic mess, no one can ever dispute that point, with unemployment a nauseating 90% and 3 out of 4 Zimbabweans living on US$1.00 or less a day. It is a well-established fact the country is in this mess because of 38 years of corrupt and tyrannical rule, which even the hardliner Zanu PF supporters like President Mnangagwa and his junta have since accepted and hence their justification for staging the coup last November.

“We are only targeting criminals around (Mugabe), who are committing crimes that are causing social and economic suffering in the country, in order to bring them to justice,” the coup spokesman, Major General and now Minister of Foreign Affairs, Sibusiso Moyo announced in the small hours of 15 November 2017.

Ever since the coup President Mnangagwa and the junta have again and again tried to put distance between the Mugabe era and the post-coup era, insisting this was a new democratic dispensation. They have even promised to hold free, fair and credible elections, to underline their commitment to democratic rule and values.

So the importance of Zimbabwe holding free, fair and credible elections as the only sure way to end the country’s very serious economic situation in obvious to all especially the country’s learned and who is more so than a Con-Court judges. The issue of whether these elections were free, fair and credible was of great national importance; far beyond the individual or party political interest of Nelson Chamisa and MDC Alliance and Emmerson Mnangagwa and Zanu PF respectively. To listen to Chief Justice Malaba deliver the Con-Court decision one could not help but feel the Chief Justice considered the case a personal matter.

Whilst the Chief Justice did not deny that there were very serious irregularities in the conduct of these elections such as ZEC’s failure to release a clean and verified voters’ roll although this is a legal requirement; ZEC’s failure to record cases where individuals had requested and were allowed to cast the presidential vote only, also a legal requirement; etc. He went to town in explaining that the full import of these irregularities were lost because the applicant, Nelson Chamisa, had failed to demand that the sealed ballot boxes must be opened so the quality of the voters’ roll could be ascertained, that no record of those casting presidential ballots only was kept, etc.

It is a historic fact that Zanu PF did bus its supporters around in the 2013 elections who were able to cast multiple votes but with no verified voters’ roll, the smoking gun, it was impossible to prove anything. With no verified voters’ roll again this year there is a distinct possibility that Zanu PF would have tried the same or similar vote rigging tactics.

Agreed, Chamisa should have exercised his right as the applicant to demand access to the contents of the sealed ballot boxes, “primary source evidence,” as the Chief Justice called it, and based his court challenge on that evidence. He did not and so his case collapsed and rightly so too!

But since this case was a lot more than Chamisa vs Mnangagwa but The people of Zimbabwe vs the Zanu PF dictatorship it was incumbent on the judges to demand that the sealed ballot boxes must be opened so that the court’s judgement on this matter is itself based on the primary source evidence.

Whilst underlining the reason why Chamisa’s case had failed because it failed to produce “primary source evidence” one tell that no one was more relieved that no ballot boxes had been opened that the Chief Justice himself and his fellow eight judges. Of course, they know that the elections were rigged and opening those 11 000 plus ballot boxes would have been the equivalent of opening the graves of 11 000 mass murder victims. Each with its own individual identity and its own gruesome horror tale to tell! The stench would have been nauseating.

It is common knowledge that these elections were rigged. By failing to keep his promise to hold free, fair and credible elections President Mnangagwa and his coup junta friends have consolidated their iron grip on power but at a very high price. They have also reaffirmed to the world that his new democratic dispensation was a lie, Zimbabwe is still a pariah state ruled by vote-rigging thugs.

Justice was not served by Con-Court confirming Emmerson Dambudzo Mnangagwa as the duly elected president when the court itself, not just Chamisa, failed to bring out the primary source evidence everyone knows would have proven beyond doubt that the elections were rigged. Indeed, the betrayal by both Chamisa and Con-Court in demanding the opening of ballot boxes will go down in history as yet another golden opportunity to end the Zanu PF dictatorship that was wasted!

Mnangagwa’s Traditional Chief Interred

The late Chief Mapanzure who died on Wednesday evening has been laid to rest at his homestead in the Mapanzure area near Zvishavane.

Mourners who include top government officials joined the Mapanzure community at the burial of Chief Mapanzure.

In his address at the burial, President of the Chief’ S Council Chief Fortune Charumbira said the Mapanzure family should remain united and celebrate the legacy left behind by a hero in traditional leadership.

“The death of Chief Mapanzure should not bring sorry instead it should bring jubilation for the people of this area who voted for ED,” said Chief Charumbira.

Chief mourner Minister of Local Government, Public Works and National Housing Cde July Moyo said the death of Chief Mapanzure is a blow as he was a fountain of knowledge.

Chief Secretary to the President and Cabinet Dr Misheck Sibanda paid tribute to all individuals and corporates who stood with the Mapanzure family during trying times.

“As a family we are humbled by the gesture shown by the people in taking responsibility of the funeral,” said Dr Sibanda.

Addressing mourners on Friday, President-elect Cde Emmerson Mnangagwa who hails from the Mapanzure clan said they is no rush to talk of the replacement to the chief as Collen Shonhayi will hold fort for two years.

Chief Mapanzure died at the age of 96.

He is survived by 10 children and 61 great grandchildren.

In a statement yesterday Masvingo Residents’ Trust Advocacy Officer Ephraim Mutombeni urged the local authority to address the critical shortage of water as a matter of urgency.

“The city council has chosen to remain mum in the wake of the critical water crisis the city is facing.

We have now gone for 5 days without water and the local authority has been silent.

We are demanding answers from the city council bosses. Why are they taking residents for granted? They must consider the gravity of the matter.

ZANU PF Says Chamisa Case Was Irrelevant And He “Can Go And Hang.”

|The ruling ZANU PF says that it has learnt a lesson from the recent Constitutional Court on the outcome of the Presidential election appeal by opposition leader Nelson Chamisa.

The party Deputy Secretary for Legal Affairs Munyaradzi Paul Mangwana told weekend media that the party learnt a lesson that it must never leave elections to chance.

Mangwana said that the Zimbabwe Electoral Commission is the one that has got to be worried on issues raised by the court not themselves as a party.

“For Zanu PF, the whole test was useless because it had no basis. The lessons learnt are not for Zanu PF, but probably to the Zimbabwe Electoral Commission (Zec),” he said.

“The only lesson we should draw from that is that we should campaign harder and win resoundingly next time because the MDC Alliance was taking advantage of the slender margin we had to think that they should have been victorious.”

Mangwana expressed concerns at the ZANU PF “bhora musango” tactic which saw members of parliament get far much more votes than their presidential candidate Emmerson Mnangagwa.

“We now need to sell our presidential candidate in a stronger way and ensure that in the future he wins by the same margin like in the parliamentary elections.”

Mangwana disputed on-going speculations that ZANU PF are involved in any talks for a unity governmemt with the MDC or Chamisa indicating that the opposition party could “go and hang.”

“We do not need to talk to them because we have the mandate to rule from the people of Zimbabwe. They can go to hang.

People elected Mnangagwa as president. He is the father of the nation, and he wants his children to live in peace.

The president did not offer the MDC Alliance a coalition government,” he added.

Big bustling former Caps United striker Nyasha Mushekwi’s withdrawal from the Warriors squad for the upcoming 2019 AFCON qualifiers has raised eyebrows.

The robust 30-year-old pulled out of the team due to what ZIFA described as a nagging injury issue.

However, Mushekwi still features for his Chinese team, Dalian Yifang, according to Soccer 24.

According to sources in the Warriors camp Mushekwi rejected the call-up following a fall-out with ZIFA in 2017.

Mushekwi, Willard Katsande and Matthew Rusike were banned by ZIFA after they allegedly influenced others to boycott a farewell dinner organised by the government before they left for the 2017 AFCON finals held in Gabon.

Knowledge’ the Smiling Assassin’ Musona scored his first goal for mighty Anderlecht in a 2-1 loss against Club Brugge on Sunday.

The 28-year-old forward joined the Belgian giants at the end of the previous season from KV Oostende.

He started in first XI and netted his debut goal in the 19th minute, cancelling out Emmanuel Bonaventure’s 3rd-minute strike. Brugge restored their lead on the 43rd minute through Hans Vanaken.

The forward was however substituted in the 65th minute.

MDC Activist Abducted For Allegedly Possessing A Gun

A Chiredzi based MDC Alliance activist has been abducted by state security agents for allegedly possessing a gun, ZimEye.com has been informed.

MDC Alliance sources in Chiredzi alleged that the activist, Mupwanyiwa, a cane haulage driver was abducted by state security agents who accused him of illegally possessing a gun.

” One of our members by the name Mupwanyiwa, a cane haulage was abducted for allegedly possessing a gun.

Mupwanyiwa was abducted after a Zanu PF activist had accused him of possessing a gun, following a political altercation between the two.

Our efforts to locate Mupwanyiwa have been futile,” said Mugova Tongai, an MDC Alliance official.

Young Ladies Burn Love Rival To Death While Recording Act On Mobile Phone

By Paul Nyathi|The South African High Court has sentenced Gugulethu Thwala and Koketso Moyo were today sentenced for burning to dearth 19 year old Boitumelo Dlamini in 2015.

The two ladies in the company of two others who are yet to meet their fate burnt Dlamini to death while recording a video of her screaming while they laughed for dating one of their ex boyfriends Tokelo Makhelepho.

They were sentenced to 18 and 14 years respectively for murder and both got a added 5 years for kidnapping.

Mosopi, Koketso Moyo, Gugulethu “Sharon” Thwala, and Victor Pilane have been charged with kidnapping and murdering Boitumelo Dlamini.

The four allegedly kidnapped Dlamini at Eletsa High School in Letlhabile near Brits on June 18, after Mosopi accused her of dating her boyfriend.

Dlamini was allegedly doused with petrol and set alight. Thwala, 26, told the court that Mosopi poured petrol from a five-litre container over Dlamini in the bushes near Klipgat.

“She [Cynthia] pulled Boitumelo out of the car and slapped her, she asked her whether she was in love with Tokelo [Cynthia’s former boyfriend]. She apologised, but Cynthia asked her for what reason she was apologising,” Thwalwa told the court.

She went on to say that when she saw Cynthia pour petrol over Dlamini, she pulled Dlamini and she too was sprinkled with petrol.

“At that moment I saw Victor Pilane [Cynthia’s then boyfriend] recording the incident [on a cellphone video]. I screamed to him to help free Boitumelo from Cynthia…I then heard flames and when I turned, I saw Boitumelo burning.”

She said Mosopi’s feet was burning and she ran to her boyfriend (Pilane) for help, while Dlamini ran in the opposite direction.

War Vets Slam “Spoilt” Mugabe For Sending “Innocent” Bona To Mnangagwa Inauguration

By Own Correspondent| The Zimbabwe National Liberation War Veterans Association (ZNLWVA) have torn into former president Robert Mugabe for failing to attend President Emmerson Mnangagwa’s inauguration on Sunday adding that his absence portrayed him as a “spoilt child”.

Mugabe failed to attend Mnangagwa’s inauguration revealing that he was not well and his wife Dr Grace Mugabe was also not well so he had sent his daughter and son in law Bona and Simba Chikore.

The war veterans however claimed that Mugabe was acting like a spoilt child despite Mnangagwa acknowledging his congratulatory message part of which read:

“…I am not well so I am sending my daughter and her husband to represent us. Hearty congratulations, R.G Mugabe”.

ZNLWVA spokesperson Douglas Mahiya telling however blasted Mugabe’s actions and told a local online publication:

“Mugabe understands the dynamics and politics of the revolution and he must stop acting like a spoilt child.

He thinks sending his daughter to attend our President’s inauguration ceremony is enough…Bona is just an innocent girl child who is not into politics and her husband Simba is a foreigner to us; mukuwasha (he is a son-in-law)…

He knows the mistake he has made despite all what the new dispensation has done for him.”

Zimbabwe is perhaps the only country in the world whose President announces to foreign investors that he is the Supreme court “judge who will rule and rule and rule, while everyone else barks and barks like a bunch of dogs.” He regularly repeats this all literally in the Shona language, and furthermore says for a person to prosper in business, they must first join his political cult.

He even has a special song that he sings at all his meetings political and government level where he declares himself the crocodile who rules and has now arrived to change the laws.

On Friday afternoon, while delivering his verdict against MDC Alliance leader Nelson Chamisa Friday afternoon, Chief Justice Luke Malaba said: “we believe in facts, not figures.”

He then ruled that Chamisa does not have evidence to support his case against Emmerson Mnangagwa.

This verdict irked Zimbabweans with the exiled Prof Jonathan Moyo exclaiming that it is “breathtakingly scandalous. What are facts without figures? In elections figures represent voters & their votes!”

This guy suddenly entered the packed supermarket and started screaming ED Pfeeee, Pfeeeeeee, pfeeeeeee Pfeeeeeeeeee Pfeeeeeeeeeee. He was jumping up and down as if something had possessed him. This went on for 7 – 10 minutes. But I noticed something that really troubled my soul. Almost everyone in the supermarket, with the exception of 2 other subdued young men with him, were looking at him in disgust and horror. They politely told him with their facial expression that he was out of touch with reality. I saw one elderly man who went very close to him and looked at him with a holy scorn At one point this seemingly demented guy grabbed a supermarket trolley with groceries and lifted it up with his teeth. After grabbing my items I went to the counter and everyone’s head was turning to this guy. One young lady whispered ‘I am sure if you visit his home his family is starving, they survive nemaricho’. The gloom in that Supermarket was telling. ZRP officers in the queue were clearly nauseated. They never wanted to look at him, knowing they had a duty to protect the shoppers from this apparent criminality. Some were just softly shaking their heads in protest.

What was also very notable was the aura of fear or rather terror among the shoppers and even the shop security. Whilst it was clear this guy was breaking the law and could be charged for being a public nuisance and could have been reported to the Police who were in the Shop, no one dared take action.

I then asked myself, If ED won Masvingo so resoundingly, how come the people were so dejected at the mention of pfeeeeee. I also think if the popular candidate had been pronounced the winner, even nurses and doctors in hospitals were going to celebrate with their patients. There was going to be continuous horning on our highways as was the case when Mugabe signed that famous resignation letter.

ZANU PF broke the 8th Commandment of the Torah which explicitly says ‘Thou Shalt Not Steal’.

 

 

Lovemore Moyo Urges Chamisa To Accept Court Ruling Though Elections Were Suspect

Opposition United Democratic Movement leader and former MDC-T national chairman, Lovemore Moyo, has called on his former party to accept the Constitutional Court’s Friday ruling upholding President Emmerson Mnangagwa’s election victory.

Moyo’s remarks came as MDC Alliance presidential hopeful Nelson Chamisa on Saturday rejected the ConCourt ruling and petitioned the African Commission on Human and People’s Rights for recourse.

“However, it is our plea to the ruling party to be chivalrous in its victory. Equally so, we encourage the MDC Alliance to accept the outcome handed down by the honourable court,” Moyo, who leads the United Movement for Devolution (UMD), said on Saturday.

Chief Justice Luke Malaba dismissed Chamisa’s petition that had sought to overturn the result of the hotly contested polls.

Moyo applauded the manner in which the whole court process was handled by the apex court.

“The UMD notes and respects the decision handed down by the honourable court and we hope that this will put to rest the presidential contestation,” Moyo said.

“This indeed was an applausible act that conveyed strongly the respect of the constitutional right of the aggrieved parties to approach the court for just redress.

“In light of the above, we, however, want to caution the idea that the judiciary is there to resolve political contestations.”

While he applauded the role of the Zimbabwe Electoral Commission in the just-ended plebiscite, Moyo, however, said: “with great concern the glaring electoral inadequacies and lack of transparency as exposed by the applicant’s legal counsel.”

“We believe that this court case should be used as a learning curve to correct such inadequacies and close any loopholes for rigging. Accordingly, Zec should not be quick to celebrate the judgement handed down by the Constitutional court as a victory.”

Above all, Moyo said they were looking forward to the new government to do its best for the long-suffering Zimbabweans.

“As we look forward to a new political dispensation, we strongly urge both parties to recognise and priorities that Zimbabwean citizens have their dreams which ought to be respected,” he said.

“In other words, the rights of the people ought to be given precedence over personal and party interests. Henceforth, the people of Zimbabwe deserve to be governed fairly and justly.”

He said since elections have come and gone, it was now time for the ruling party to deliver on its campaign promises of devolution, economic growth, jobs and attracting foreign direct investments as well as the fight against corruption.

Charamba Defends Khupe Attendance At Mnangagwa Inauguration

By Own Correspondent| Secretary for Information, Media and Broadcasting Services, George Charamba defended leader of the MDC T faction, Dr Thokozani Khupe for attending President Mnangagwa’s inauguration at the National Sports Stadium (Sunday) arguing that if the late founder of the MDC Morgan Tsvangirai attended Mnangagwa inauguration following the ouster of former president Robert Mugabe in November 2017, then Khupe’s attendance was justified.

The state media reported that Khupe and her deputy, Mr Obert Gutu were criticised by MDC Alliance supporters who accused them of being “sellouts”.

Charamba said the real story is in those that didn’t come considering that Mnangagwa’s inauguration was a national event.

Said Charamba:

“December 24, 2017, the late MDC-T leader Mr Morgan Tsvangirai attended President Mnangagwa’s inauguration and on 18 April 2018 MDC-Alliance leader Mr Nelson Chamisa attended proceedings of the Independence Day celebrations.

Now, does that not harken to the proverbial cheetah which delights in dragging another through mud but gets upset when its turn comes? This is a national event which is rooted in popular will and reinforced by the highest court of the land.

What can be more legitimate and more fitting than to grace such an occasion? I think the real story is in those that didn’t come.”

Chamisa Not Amused By ZANU PF Supporters Distasteful Celebration, Watch Video

By Paul Nyathi|Opposotion MDC Alliance leader Nelson Chamisa has expressed his dissatisfaction over a very unpleasant celebration stunt by some ZANU PF supporters.

The over excited ZANU PF supporters were on Sunday captured in a widely circulated video carrying a coffin and singing behind it claiming they were burying the MDC leader who controversially lost to the ZANU PF leader Emmerson Mnangagwa in the presidential elections last month.

Writing on his social media pages, Chamisa castigated the stunt describing it as hateful.

“Elections and politics must leave citizens Better not Bitter. Why is our politics so hateful and such a fix-you zero-sum affair? Elections must be a marketplace of ideas and characters. The sole purpose being to seek the best in making nations and communities greater and better!!,” said Chamisa on the video.

Mnangagwa Sworn In, Promises “A New Zimbabwe.”

President Mnangagwa was yesterday sworn in as the third President of the Republic of Zimbabwe and Second Executive President since the Constitutional amendments of 1987.Canaan Banana was the first ceremonial President from 1980 until 1987 when former President, Robert Mugabe took over as the first Executive President after the Constitution was amended.

Taking oath of office, President Mnangagwa promised a new Zimbabwe in the Second Republic underpinned by servant leadership where corruption and unnecessary bureaucracy in service delivery will not be tolerated.

The Second Republic was born yesterday following President Mnangagwa’s inauguration as the Second Executive President of Zimbabwe at the National Sports Stadium in Harare.

In the new Zimbabwe, he said, all citizens will be equal before the law and prosecution of corrupt cases will be done without fear or favour.

Addressing a bumper crowd at the giant National Sports Stadium, President Mnangagwa said those appointed to serve in public offices should also adopt his servant leadership approach to transform the country.

“I am your listening President, a servant leader,” President Mnangagwa said.

“In this vein, those who will occupy public office at any level, under my Government will be required to exercise servant leadership in the execution of their duties and to be humble and responsive in their interactions and dealings with the citizenry.

“Equally, the bureaucracy in the Second Republic will be expected to be development oriented, responsive to the people’s needs as well as exhibit high principles of professional ethics and integrity.

“My administration will therefore expect public sector officials to deliver quality and timely services to the people as well as facilitate business, trade and investment. Bureaucratic bottlenecks, unnecessary delays, lethargic and corrupt activities will not be tolerated.

“We must as a society encourage and inculcate the culture of hard honest work. The prosecution of perpetrators of corruption will be carried out without fear or favour. In the Second Republic, no person or entity will be allowed to steal, loot or pocket that which belongs to the people of Zimbabwe. No one is above the law. This is a New Zimbabwe, the Zimbabwe we all want.”

Mnangagwa continued: “As per our pledge during the campaign trail, my Government will be implementing the Constitutional provisions with regards the devolution of Government powers and responsibilities. Provinces will now be expected to plan and grow their provincial economies.

“Economic development at every level is the ultimate goal. I therefore challenge local authorities in the Second Republic, to be the engines of local economic development and growth. My Government will not stand by and watch people suffer due to dereliction of duty, corruption or incompetence within our local authorities.

“It will not be easy, but as the Holy Bible teaches us: ‘For you have need of endurance, so that when you have done the will of God, you may receive what was promised.’

“We have indeed endured; we have toiled; and now as we walk in unity the path that lies ahead, we will reap a better and more prosperous future.

“As I have repeatedly said in the past months, real change does not happen overnight. However, inspired by our national anthem, we must work together, nothing is beyond our reach. With love and unity, we will reach the Promised Land, we will build the Zimbabwe we all want, brick upon brick, stone upon stone.”

President Mnangagwa said he was humbled by the confidence reposed in him by the people of Zimbabwe and would do everything in his capacity to bring positive change in the country.

“I am emboldened and inspired by your collective hopes, dreams and desires; and the trust reposed in me. I will work tirelessly, as a servant leader, to improve the quality of life for all of us,” he said.

“To all my colleagues and other political parties who contested in the just ended harmonised elections, especially those represented in Parliament, I exhort us to commit ourselves to collectively develop our motherland. We are all Zimbabweans; what unites us is greater than what could ever divide us.

“Let me assure you that tomorrow is brighter! Let us look forward to the journey ahead, a journey we will walk together as one people, a united people. Eyebrows As Mnangagwa Forgets To Acknowledge Chiwenga

There was drama when ZANU PF leader Emmerson Mnangagwa forgot to acknowledge his deputy Constantino Chiwenga at the national sports stadium today.

This was during the man’s inauguration ceremony.

Mnangagwa ended up shifting his speech to announce saying, “sorry I skipped a line, to my deputies Chiwenga and Mohadi, my apologies I acknowledge you.” Pakaipa!

Nurse Broke Into Bar And Stole $180, Court Hears

A nurse aide from Bulawayo has appeared in court for allegedly breaking into a bar and later stealing $180 from his ailing employer.

Nobert Phiri, on July 10, was at Mpopoma where, as a nurse aide, he was looking after Ms Beauty Ncube’s ill husband. Ms Ncube found Phiri searching in her wardrobe and he claimed he was looking for a blanket to cover the patient.

After Phiri had knocked off, Ms Ncube discovered some money was missing and she suspected Phiri.

Phiri denied the allegations before Western Commonage Magistrate Mr Lungile Ncube saying he had promised to pay back the money he had taken.

Asked why he had agreed to repay the money if he had not taken it, Phiri could not answer.

“I asked Phiri if he had taken money that was in the wardrobe and he admitted saying he would pay it back. I told him to put in writing everything that he had told me,” said Ms Ncube.

The note was produced in court. Prosecuting Ms Sibekithemba Dube told the court that for the second charge, on August 7, Phiri broke into Nyalungwe sports bar which belongs to Mr Ngonidzashe Dzikamunhenga.

Mr Dzikamunhenga knocked off leaving all the windows of his bar closed and doors locked.
At around 10PM, Phiri broke burglar bars and got in.

Some passersby heard a noise from the bar and called Mr Dzikamunhenga.
Mr Dzikamunhenga quickly rushed to the bar and found Phiri hiding in the ceiling.

Phiri was armed with a hammer, hacksaw, screw driver and a metal pipe.

The Second Republic was born yesterday following President Mnangagwa’s inauguration as the Second Executive President of Zimbabwe at the National Sports Stadium in Harare.

When it is Chamisa being voted for, it is  treason, when it is Mnangagwa getting support, it is called “endorsement.”

Former President Mr Robert Mugabe has been suddenly celebrated by the state broadsheet, Herald which says the 94 year old has endorsed and congratulated Emmerson Mnangagwa on his election victory and sent his daughter, Bona, to represent him at the inauguration ceremony, yesterday.

The report continues saying: Bona was accompanied by her husband Mr Simbarashe Chikore to the ceremony that took place at the 60 000-seater National Sports Stadium in Harare.
Several Heads of State and Government, Vice-Presidents of various countries, special envoys from across the world and opposition party leaders came to witness President Mnangagwa’s swearing-in ceremony.

Mr Mugabe, who could not attend the ceremony together with his wife Grace, as they were both not feeling well, wrote a hearty congratulatory letter to President Mnangagwa.

The President read out the letter before he delivered his acceptance speech, much to the applause of the crowd.

“At this juncture let me read the letter I have received from our former President,” said President Mnangagwa.

“Your Excellency, thank you for your invitation to me and my wife to attend the inauguration ceremony. My wife is not well in Singapore and also I am not well. So I am sending my daughter and her husband to represent us. Hearty Congratulations!”

Mr Mugabe seemed bitter since his resignation in November last year after the military intervened to arrest a fast deteriorating socio-economic and political environment in the country.
He had aligned himself with MDC-Alliance in the just ended July 30 harmonised elections, declaring on the eve of the polls that he would not vote for Zanu-PF.

The move attracted wide condemnation from across sectors with most people labelling Mr Mugabe a sell-out as he had spent decades denouncing MDC.
President Mnangagwa eventually won the polls, getting 50,67 percent of the total votes cast while Mr Chamisa got 44,3 percent.

While Mr Mugabe has come to terms with reality, Mr Chamisa is having difficulties in conceding defeat threatening to roll out street protests.

Other opposition political parties and some senior MDC-Alliance members are also against Mr Chamisa’s intentions.

Mr Mugabe resigned after being in power for 37 years and President Mnangagwa completed his final term before the latest polls were held.

The former President, who had been encircled by criminals in the G40 cabal, stood accused of serious misconduct inter-alia abrogating his constitutional mandate to his wife who was making utterances on business of Government and accessing classified information without constitutional authority.

Mr Mugabe was also accused of causing disaffection among the Zimbabwe Defence Forces by allowing his wife to make false and reckless allegations against them.

He also stood accused of ignoring corruption and inability to perform functions of his Office because of alleged physical or mental incapacity.

WHO’S GUILTY HERE? – Lawyer Faces Imprisonment For Failing To Pay Legal Costs

A TOP Bulawayo lawyer Mr Mlweliwenkululeko Ncube faces civil imprisonment over a debt of more than $4 400 in unpaid legal costs.
The legal costs emanate from a four-year legal battle in which Mr Ncube was fighting Bulawayo businesswoman Ms Sipiwo Nkomo who sold him a BMW X5 in 2013.

Mr Ncube has since 2014 been fighting a $12 000 claim and denying that he failed to pay for the car, which cost him $23 825, claiming Ms Nkomo had brought forward a malicious claim.

In papers before the court, Mr Ncube was cited as the defendant while Ms Nkomo is the plaintiff under case numbers HC 2281/18 and HC2282/18 filed at the Bulawayo High Court.

The debt emanates from taxed costs which were recovered by Ms Nkomo from a bill of costs dated July 5, 2017 following High Court judgments delivered in her favour on January 24, 2014 and March 3, 2015.

A writ of execution signed by the assistant registrar of High Court on behalf of Chief Justice Luke Malaba was in June this year issued directing the Sheriff of the High Court to attach and take into execution the movable goods of Mr Ncube.

Mr Ncube, is obliged to either pay $4 419,70 or face civil imprisonment of up to 90 days in jail.
The court will conduct an inquiry into Mr Ncube’s financial position and depending on the circumstances, it may commit him to prison or alternatively give him further time to pay the money in instalments over a specified period.

In 2015, Ms Nkomo filed an application at the Bulawayo High Court for a rescission of a default judgment which was erroneously ruled in favour of Mr Ncube on October 12 in 2014.

The late Bulawayo High Court judge Justice Andrew Mutema rescinded the judgment and subsequently ordered Ms Nkomo to file her notice of opposition and opposing affidavit under HC548/14

According to court papers, Mr Ncube paid a deposit of $11 000 for the car but the balance of about $12 000 plus £109 was to be paid before September 30 in 2013 at an interest of five percent per annum.

Mr Ncube allegedly failed to pay the balance until October when he was charged a further $1 200 collection fee.

The lawyer, in reply to Mr Nkomo’s claim, said at some point he offered to return the car to Ms Nkomo and her son and that she retains $3 000 of his $11 000 deposit but she refused.
Instead, the lawyer claimed, Nkomo offered to extend the payment period by six months.

Ms Nkomo’s lawyer, Mr Godfrey Nyoni of Moyo and Nyoni Legal Practitioners said Mr Ncube has been evading paying the balance including legal costs prompting the plaintiff to issue summons for civil imprisonment against the defendant.

Mr Ncube was in January 2014 ordered by Bulawayo High Court judge Justice Maxwell Takuva to pay Ms Nkomo $12 175 together with five percent interest and legal costs. – state media

Tottenham captain Lloris was arrested for driving under the influence of alcohol.

He was intercepted by police details in London.

The 31-year-old goalkeeper who won the World Cup with France in July failed a roadside breathalyser test and was taken to Charing Cross Police Station.

He was later released on bail and is set to appear in court on Tuesday, 11 September.

Lloris is now a major doubt to feature for Spurs ahead of their crucial Premier League encounter against Manchester United on Monday.

Big bustling Zimbabwean international striker Nyasha Mushekwi helped Dalian Yifang get a crucial away point when he scored in the 1-1 draw against Chongqing Lifan on Saturday.

Commenting on the Constitutional Court Ruling on the MDC Alliance Election Challenge on social media, Kanengoni said:

“Even my learned co-representing the other party are not shocked by the judgement.They had a weak case.We
are not politicians, we are law upholders,the law is the law despite the popular feeling.

ZNA Soldiers Beat Up Man On Way To Airport

ZimEye is looking into a developing story in which a Zimbabwean man was reportedly beaten up by soldiers while traveling to RGM airport.

The event happened is Seke road (airport road) where the man was forced off the road and severely assaulted as punishment for overtaking an army truck.

“They said you are not supposed to overtake soldiers,” a source said.

The UK bound man (name withheld) was not speeding at all; he was traveling at a normal speed when the army truck appeared too slow prompting him to overtake it.

The incident happened two days ago.

The man flew into England with serious injuries from the assault, the source added.

Mnangagwa Lacks Spirit Of Ubuntu- Political Analyst

President Emmerson Mnangagwa is a man who lacks the spirit of Ubuntu and he will never transform the country’ s economy, Tino Mambeu, a political analyst based in South Africa has said.

Speaking in an interview with a South African television station Mambeu described Mnangagwa as a cunning political figure who used the Zimbabwe Electoral Commission(ZEC) and the judiciary system to muzzle the will of the people.

“How will Mnangagwa deal with the legitimacy issue? His hands are dirty and he has to cleanse himself before cleansing the image of the country.

The man has clearly demonstrated that he is a selfish politician who is determined to cling to power at all costs,” said Mambeu.

“The mystery remains unsolved because the man has failed to deal with corruption, the biting shortage of cash and a ruthless system of operation,” added Mambeu.

I hope my letter finds you well, in good spirits and in good health.
Allow me to be one of those who have chosen to congratulate you on your being inaugurated the President of the Republic of Zimbabwe today the 26th of August 2018.

May l take this opportunity to assure you that there are more than 6 Million Zimbabweans both in the diaspora and in Zimbabwe who are behind your leadership. You are not President of the disporans only but for all Zimbabweans including those few who were cheated and forced into voting Mnangagwa. You should know that we are prepared to defend the wishes of the majority of the people of Zimbabwe who happened to have voted you into power but whose victory wanted to be stolen by Zanu PF by using a section of the military and a “Constitutional Court” which is not a court. We voted you to be our leader and so you are.

We are therefore now only waiting for you to put in place more practical steps. These include forming your government. We are ready to save under your leadership.

This is time to appoint those whom you think are ready to take up positions in your government. I am personally willing, ready and more than capable. If you feel you do not wish to do it publicly so as to avoid victimisation by the fake regime of Mr Mnangagwa then appoint someone to be your government’s chief spokesperson. I am more than willing to take up that position should you wish to appoint me right there. l do not have anyone to be afraid of since this is what the people of Zimbabwe would have chosen me to do for our nation. I assure you that l will do as per the interest of Zimbabwe. However you may appoint anyone whom you feel is more suitable and we l am prepared to give him/her all the support.

Let this be real. This is a good step in the right direction. Let us have our ambassadors in all countries. Let these not be seen as jokes since you are the genuine and legitimate Zimbabwean President. We say a big NO to a GNU with Mnangagwa and team who are the losers. We do not recognise their fake government. We are 100% behind your win and behind this inuguration.

We declare that Zimbabwe has fallen into the abyss of a failed and pariah state and we urge the international community not to pay lip service to the problems affecting our country but action must be taken to bring those responsible for the human rights abuses and those defying the rule of law to be identified and punished. It is unfortunate that our country Zimbabwe has fallen prey to a person and a party that is in perpetual violation of the constitution and frustrating the wishes of the majority.

This declaration is backed by millions of Zimbabweans who are in the diaspora and eager to see change and have their voices heard backed by millions who are suffering locally.

“Zim Minister Had No Reason Barring Me,” Says Chamisa SA Lawyer

Zimbabwe’s justice minister Ziyambi Ziyambi provided no solid grounds for his refusal to grant permission to SA lawyers Jeremy Gauntlett, Dali Mpofu and Tembeka Ngcukaitobi to represent MDC Alliance leader Nelson Chamisa in Wednesday’s constitutional court hearing, fresh details have emerged.

This comes as the nine-member constitutional court bench will on Friday deliver judgment on Chamisa’s application to nullify President Emmerson Mnangagwa’s victory in the July 30 election.

Gauntlett told Business Day South Africa that he was denied permission to argue in the court despite having previously appeared before Zimbabwe’s courts a number of times.

“I have appeared [with Law Society support and ministerial assent] on eight previous occasions in Zimbabwe’s courts.

“I have only once before been refused the right to appear. This was when I was briefed against the government of Zimbabwe in 2008 to have the Sadc [Southern African Development Community] tribunal’s award against land seizures registered in the high court in Harare.

“By statute, any foreign legal counsel appearing in a Zimbabwe court must have the support of the Zimbabwe Law Society and the assent of the minister of justice. This assent requires the minister to consult a member of the Legal Education Council and to confirm that the country in question is a ‘reciprocating country’ with Zimbabwe as regards admission,” he said.

Repeated efforts to contact Ziyambi on Thursday night were fruitless. Mpofu and Ngcukaitobi could also not be reached.

Sources from Harare told Business Day Ziyambi’s actions were inconsistent, after he appeared to have granted Gauntlett permission, before making a U-turn.

In a letter on Monday to Chamisa’s attorneys in Harare, the minister’s office had first suggested it had not been given required supporting documents for the admission applications. However, it conceded this did not apply to Gauntlett.

“Thereafter, the minister said there was a delay because the Legal Education Council member needing to be consulted was ‘out of the country’. It was not explained why the ‘consulting’ could not be done by e-mail or telephonically,” said Gauntlett.

“Shortly before 10am he [the minister] notified the Chamisa attorneys, as the challenge was about to start, that he in fact had refused all the applications on the grounds that these had been made too late and because South Africa is not a ‘reciprocating country’ with Zimbabwe,” Gauntlett said.

In an interview in Harare, Chamisa’s spokesperson, Nkululeko Sibanda, said denial of permits to the SA lawyers was not a surprise as Ziyambi acted as Mnangagwa’s electoral agent in the election.

“The minister involved was the election agent of President Mnangagwa and he was certainly compromised.

“The law in Zimbabwe also clearly states that no-one should be denied the chance to use a lawyer of their choice, and this provision was clearly breached,” he said.

Chamisa Warns Of Widespread Protests

Zimbabwe’s main opposition leader, Nelson Chamisa, has refused to accept a court ruling that upheld Emmerson Mnangagwa’s victory in last month’s presidential elections.

In his first comments since the country’s highest court overturned the opposition’s challenge to have the results annulled, Chamisa vowed yesterday to lead “peaceful protests”.

“I have a legitimate claim that I am supposed to lead the people of Zimbabwe,” the leader of the Movement for Democratic Change (MDC) party said. “Yes, judgment has been made, but as far as we are concerned we have a view that is contrary to the view of the constitutional court.

“The court’s decision is not the people’s decision. The people who voted do not believe in [Mnangagwa]. We have got a clear majority.”

In a verdict widely predicted by analysts, Chief Justice Luke Malaba strongly criticised the MDC’s case and upheld Mnangagwa’s win.

Robert Mugabe’s successor as leader of the ruling Zanu-PF party won the election on 30 July with 50.8% of the vote – just enough to meet the 50% threshold needed to avoid a run-off against Chamisa, who scored 44.3%. The elections were largely judged to be free of the violence that had characterised previous elections in the country.

Chamisa insists he won more than two-thirds of the vote. “The legal door is not the only door to happiness,” he said. “Using our constitutional right, we have a right to peaceful protests. This is the route we will take. One of them.”

Mnangagwa took over from Mugabe after the long-time ruler was ousted following a short military takeover in November 2017 after 20 years as president. He vowed to hold free and fair elections and repair strained relations with the west, but his plan was marred when soldiers fired at protesters on 1 August, killing at least six people.

His inauguration is scheduled to take place on Sunday (today).

How Government Sabotaged Chamisa Case

THE government employed a cocktail of crippling measures which severely weakened MDC Alliance leader Nelson Chamisa’s Constitutional Court (ConCourt) case in which he is challenging President-elect Emmerson Mnangagwa’s slim electoral victory, including denying his South African legal team practising certificates shortly before the matter kicked off, throwing it completely off balance.

Chamisa alleges that Mnangagwa, who was declared winner of the July 30 presidential election with a wafer-thin 50,8% of the total vote, was the beneficiary of a calculated vote rigging mechanism by the Zimbabwe Electoral Commission (Zec).

Commentators noted that the government’s refusal to grant temporary practising certificates to Chamisa’s South African lawyers, coupled with the highly inquisitorial approach of the nine-member ConCourt bench led by Chief Justice Luke Malaba, appeared to reinforce widely-held perceptions that there was no level playing field in the justice system.

Across the length and breadth of the country, people discussed the court’s adversarial approach against Chamisa’s lawyer Thabani Mpofu, with some saying it was overly aggressive and even bordered on hostility. Lawyers representing Zec and Zanu PF were not subjected to the same level of grilling, it was noted.

The judges repeatedly pressed Mpofu to produce what they termed “primary evidence” in the form of electoral residue such as V11 and V23 forms without which they said his case would not meet the evidentiary dictates of such an election petition. In any case, the court said, such evidence should have been attached to the founding affidavits on application and any other documents adduced thereafter would be deemed inadmissible.

Malaba struck off affidavits supporting Chamisa’s petition, saying the respondents should have filed separate petitions challenging the election outcome.

The court is set to make a ruling today and, in the event that a winner is confirmed, inauguration is likely to take place on Sunday in accordance with a constitutional stipulation that the investiture take place within 48 hours of a declaration of the winner by the ConCourt.

Justice minister Ziyambi Ziyambi denied Chamisa’s South African advocates Dali Mpofu, Jeremy Gauntlett and Tembeka Ngcukaitobi practising certificates, claiming the neighbouring country did not pass the test of reciprocity as outlined in the Legal Practitioners Act.

The law stipulates that lawyers residing outside the country but willing to represent a client in Zimbabwe for a specific case ought to obtain a certificate of exemption.

The Zimbabwe Independent has established that the South African lawyers had prepared their arguments to corroborate lead attorney Thabani Mpofu’s verbal submissions, but were reduced to helpless bystanders upon being denied the certificates.

Thabani Mpofu was assisted by top Harare lawyer Sylvester Hashiti and three other local attorneys.

This forced Thabani Mpofu to improvise and deviate from the original plan, disregarding the long hours they had invested in preparing for the case with his South African colleagues.

The South African lawyers had, in fact, been denied entry into the courtroom, but were only allowed in later as bit-part counsel.

During the court proceedings, Thabani Mpofu endured long periods of grilling from the nine ConCourt judges pressing him to prove allegations of electoral fraud which Chamisa levelled against Mnangagwa and Zec and did not have the benefit of joint oral submissions with his South African colleagues as had been planned.

An urgent chamber application which sought relief for the team of legal experts was also thrown out.

Dali Mpofu, the most senior of the three expatriates, confirmed the predicament to the Independent.

“The client had already expressed his choice as to which one of us should be making submissions and we had divided up the arguments. My colleague here (Tembeka Ngcukaitobi) was going to deal with a certain section; I was going to deal with another and Advocate Mpofu as well. So it does obviously affect that planning. It becomes clear that the plan is not going to work. Until last night (Tuesday) we didn’t sleep, preparing on the basis that perhaps this morning that sanity would prevail, but unfortunately that did not happen,” Dali Mpofu said.

“Even this morning (Wednesday), it was made clear that as far as the court was concerned everything was ready but the politicians chose not to grant us,” he said, describing Ziyambi’s decision to deny Chamisa legal representation of his choice as a travesty of justice.

“Our colleague Thabani Mpofu did an amazing job under the circumstances. He was able to improvise from our original plan. We are quite satisfied, this is not actually a difficult case. It is an important case because of the significance but, as far as the legal issues are concerned, it is a simple case,” he said. “If we had had time, we could have raised it in a separate court application. But the prejudice is not ours; we are just professionals doing our work. The prejudice is for the client who is being denied representation of his choice.”

The Independent also established that one of the three lawyers, Gauntlett, actually had all his papers in order but was still not permitted to represent Chamisa.

Chamisa’s spokesperson, Nkululeko Sibanda, said Zanu PF had attempted to sabotage the MDC Alliance’s chances of winning the case.

“Obviously Zanu PF would like to try by all means to frustrate us. This is an attempt to frustrate President Nelson Chamisa’s chances of getting befitting legal representation and to the best of our ability he is getting enough representation,” he said.

It also emerged from documents seen by the Independent yesterday that the MDC Alliance made a last-ditch attempt to subpoena Zec to bring to court information on its server, as Chamisa’s lawyers sought to solidify their case.

Chamisa’s lawyers also sought an urgent meeting with Malaba on Tuesday, but the chief justice turned down the request, saying since the trial date had already been set, time for such meetings had lapsed.

The lawyers had not raised the issue in their founding affidavits and had also not highlighted them during the pre-trial meetings held last week.

Documents show that MDC Alliance lawyers Atherstone and Cook on Monday sought a court order compelling Zec to bring the material from its servers.

“You are required and directed to attend before the Constitutional Court of Zimbabwe at Harare on Wednesday, the 22nd August 23, 2018 at the hour of 10 o’clock in the forenoon, and so from day today until the above case is tried, to give evidence on behalf of the plaintiff and also to bring with you and produce all details of the Zec server from the 30th of July 2018 to the 3rd of July 2018,” reads the order, which was sought by the alliance lawyers dated August 20, 2018.

On the same day, the registrar of the ConCourt, Anita Tshuma, wrote back to Chamisa’s lawyers advising them that the court could not accept the subpoena.

“Kindly note that we are unable to accept the subpoena duces tectum (court summons ordering the recipient to appear before the court and produce documents or other tangible evidence for use at a hearing or trial) in question since there is no provision for its issuance in the pre-trial conference order issued by the Honourable Chief Justice on 16 August, 2018,” reads the letter.

The lawyers immediately wrote back to the ConCourt, requesting a meeting with Malaba.

“We have seen the letter by the chief registrar concerning the subpoena we issued. Pursuant to our previous correspondence, we contend that it is still an issue to be dealt with by the chief justice and we kindly request audience with him,” the lawyers wrote.

Malaba turned down their request on Tuesday.

“We placed the letter before the Honourable Chief Justice who advised that he is no longer meeting any lawyers and that if there are issues, they should be raised in court,” Tshuma wrote.

This comes as it also emerged that Chamisa, sensing that the state was bent on derailing his challenge, adroitly altered his earlier pleading from seeking to be declared an outright winner to seeking a presidential election run-off.

He then reached out to three other losing presidential candidates, Elton Mangoma, Noah Manyika and Daniel Shumba, whom he had cited among respondents to back his application for the invalidation of the presidential election in favour of a run-off.

There was an agreement that Mangoma, Manyika and Shumba would throw their weight behind Chamisa in the event of a run-off and, in return, Chamisa had promised to reward them with senior appointments in his government, in the event he prevailed.

Sources within the legal fraternity say the relief sought by Chamisa from court to be declared the outright winner was a ruse to convince the court to declare a run-off election.

“It is almost clear that there was no outright winner in the first round of the election. Neither Mnangagwa nor Chamisa garnered the required 50% plus one vote to be declared an outright winner,” a source from the Coalition of Democracy (Code) led by Mangoma said.

“Chamisa’s real plan was to get a ruling calling for a run-off. This was supported by various respondents who were supporting his petition challenge.”

The plan also fell through after the court refused to entertain the trio, arguing they could not support another presidential candidate after they had been cited as respondents.

The court ruled that they could have filed their own separate papers challenging the results or a joinder with Chamisa.

However, Manyika and Mangoma reiterated yesterday that they had supported Chamisa out of principle.

“I did my submissions out of principle. Everything else is not accurate,” Mangoma said.

Manyika said: “I have no arrangement with anyone. I am not looking for a job.”

During the court hearing, which lasted nearly seven hours, the bench insisted on Chamisa’s legal team to furnish the court with substantial evidence to corroborate allegations of massive electoral fraud.

Chamisa Snubs Mnangagwa On His Offer

The Constitutional Court (ConCourt) on Friday dismissed Chamisa’s petition challenging the Zanu PF leader’s victory after the judges unanimously ruled that he did not provide enough evidence to overturn the election outcome.

After the ruling, Mnangagwa took to Twitter posting: “Nelson Chamisa, my door is open and my arms are outstretched.”

Chamisa yesterday told journalists in Harare that while he respected the ConCourt ruling, it did not solve what he termed a legitimacy crisis facing the president.

“Mnangagwa must know that the court decision is not the people’s decision,” he said.

“We have a majority in the urban areas. Over 50% of the people do not believe in Mnangagwa.

“We control over 90% of those who contribute the tax revenue. Mnangagwa must understand the reality in this country.

“We have a disputed election, a legitimacy issue and a constitutional crisis around the elections in Zimbabwe.”

Chamisa, who got 44,3% of the vote against Mnangagwa’s 50,6%, claims the election was rigged.

Yesterday he said Zanu PF was not celebrating because the party knew the election was stolen from him.

“The first problem we must resolve for this country to move forward is the return to legitimacy. Let the will of the people be respected. Zanu PF could not celebrate because they know it’s fiction. President Mnangagwa knows who won the election,” said Chamisa.

“Vice-President [Constantino] Chiwenga is convinced of who won the election, ask him. They must give the people of Zimbabwe the actual election result.”

Chamisa said the ConCourt ruling did not mark the end of their challenge against Mnangagwa’s election.

“We are sticklers to rule of law, constitutionalism and democratic practices,” he said.

“We felt we needed to exhaust all the available constitutional remedies within the confines and dictates of peace.

“The legal route has led us to a dead end in the context of the result of that court, which does not accord with the legitimate case we put before the court.

“We respect the ConCourt not only because it is expected to respect issues of law and constitutionalism.

“I am alive to my professional code to respect the decisions of the court. These do not mean accepting.

“I respectfully disagree and reject the position that was arrived at by the ConCourt.”

He said regional leaders who would attend Mnangagwa’s inauguration today would be endorsing an “illegitimate leader”.

“We cannot resolve these issues with a disputed leader. Mnangagwa is a disputed leader,” he added.

“I have legitimate claim that I am supposed to be leading the people of Zimbabwe. Sadc and AU may come, but they will be simply endorsing an unacceptable outcome.”

He said he could not negotiate anything with Mnangagwa before the election dispute was resolved.

There was speculation that there were behind-the-scenes negotiations that could culminate in a deal that might appease Chamisa and the MDC Alliance.

“You cannot steal my goats and then ask me to come and share them with you,” Chamisa said when asked about the alleged talks.

“Give me the goats first, then we can talk about sharing.

“I wrote to Mnangagwa before the elections and the only response I have seen was a tweet from a handle I don’t know whether it’s his.

“I wrote to Sadc and the AU and we have not received any response.

“We hope they will attend to our issues.

“A phantom inauguration will not change the reality.”

Chamisa said insisted they had evidence that the Zimbabwe Electoral Commission rigged the election, which could have been obtained through a subpoena against Zec.

The MDC Alliance wanted the court to force Zec to allow them access to their server so they could scrutinise the election data.

“Our subpoena would have revealed why we insist we won this election by 2,6 million votes and that President Mnangagwa got less than two million votes,” Chamisa added.

Chamisa said he was shocked that the ConCourt had not quizzed Zec on why it had declared three sets of results and other anomalies raised by his legal team.

He argued the ConCourt had confused his representatives by insisting on re-opening of ballot boxes when the same court had ruled against this a few years ago.

“In the (2013 Jameson) Timba case, the MDC-T went to the court to seek a re-opening of the election residual material,” Chamisa said.

“It was ruled that one cannot ask for the re-opening of election ballot boxes, but now the same court says we should have requested for the re-opening of the ballot boxes.

“But we did not want this as we had a clear case and did not need the election material,” fumed the opposition leader.

Chamisa hinted the MDC Alliance could roll out protests against Mnangagwa, saying “the legal route is not the only route to freedom”.

Meanwhile, Chamisa’s lawyers will reportedly launch a petition with the African Commission on Human and People’s Rights protesting against the way the ConCourt handled his case.

Nkosana Moyo Happy With Mnangagwa Court Victory

By Paul Nyathi|Losing presidential candidate and leader of opposition Alliance for the People’s Agenda APA, Nkosana Moyo has expressed appreciation of President Emmerson Mnangagwa’s election victory.

In a statement, Moyo says that the final endorsement of Mnangagwa as the president of the country clears the illegitimacy of the November 2017 coup.

“Whilst it must be clear that APA firmly stood against the unconstitutional take over of power, we nevertheless acknowledge that an election has taken place on the basis of which the Constitutional Court has affirmed President Mnangagwa’s win as indicative of the will of the people,” said Moyo.

“As such, APA would like to congratulate President-elect Emmerson Mnangagwa on his recent electoral win.”

Bushiri Church Under Fire For Claiming To Cure AIDS

A CHURCH founded by Malawian Prophet Shepherd Bushiri, Enlightened Christian Gathering church (ECG) in Zimbabwe, has come under fire from HIV and Aids and child activists after it exposed a child living with HIV, by posting a picture of him on their Facebook page, claiming to have healed the minor of the disease.

So daring was the church that it even took a jab at science, saying that through the power of God, HIV had been eliminated, through faith.

Some human and child rights organisations have since condemned the church, saying it was a reckless, negligent act, solely and pitiable aimed at luring congregants to the church. The pictures, with the boy carrying an HIV self testing kit, were posted on 9 July this year under the caption:

“Thulani Dube* (not real name) since birth the young boy was born HIV positive but today when Apostle declared healing he is now HIV negative,” read the caption.

The church also posted another picture of a man whom it claimed to have been living with HIV for the past 11 years:
“…Indeed our God is a specialist for impossibilities, where science says no, God says yes; where man says it can’t, our great physician shows himself up expressing his great love and power and embarrassing his people with mighty miracles. A man being diagnosed with HIV 11 years ago has lived all these years positive but by the move of God and the touch of God, the tables have turned for him.

“He tested once again and in astonishment his results came out negative. Doctors and nurses came up front overwhelmed by the power of God that embarrassed the word of science that says ‘HIV cannot be cured’. God of Major 1 is indeed not a man that should lie, when he says he is Jehovah Rapha, the great physician,” read the caption.

Contacted for comment, the church professed ignorance, referring all questions to its headquarters in Pretoria, South Africa.

“It’s best you seek comment from head office in Pretoria. You may speak to the director, Apostle Mishech. I don’t have his direct contacts, you may use the general office number your paper has used before,” said one Pastor Nyathi from the church.

Childline Zimbabwe said it was deplorable for the church to post such pictures without the consent of the child or his guardians.

“At the moment, we have not seen the page neither have we verified if the page actually belongs to the church in question or if the incident is real since we also have fake news going around a lot.

“However, we have noted with concern similar trends online, where images of children are posted online either reporting violence or sharing anything the child had done. This is done by parents, guardians, teachers, other children or neighbours who record or capture something and share without the consent of the child involved.

“This shows our limited understanding of consent and online abuse. When a child’s identity is associated with a certain image or video online that child will have to live with the trauma of being associated with that incident till they become an adult and this can have serious negative effects on the child,” said Childline Zimbabwe communications and documentation officer Miss Daphne Jena.

She said it was imperative for adults, organisations and or guardians to protect children from such cases.

“It is actually the role of adults and to ensure that the privacy of a child is protected instead of compromising a child’s privacy in the name of sharing information or jokes. For some of us who grew up before the Internet, we can ask ourselves how many pictures were taken of us as children that we are not proud of sharing?” added Miss Jena.

A lawyer from a human rights organisation in Bulawayo said the church should be held accountable for its negligence and that as a custodian of the people it had no right to display or publish such pictures.

“It is disappointing to note that a church could have done such, all in the name of luring congregants. They are trusted with protecting people yet instead it is the one entity that has gone against the value of upholding people’s rights. It is just appalling and they ought to be brought to book,” said the lawyer requesting anonymity.

Mnangagwa Slapping Chamisa With $3 Mil Legal Bill

By Farai D Hove| ZANU PF leader Emmerson Mnangagwa is preparing to slap MDC Alliance leader, Nelson Chamisa with a $3 million legal bill after losing the election petition announced Friday.

This was revealed by the party’s Secretary for Legal Affairs Paul Mangwana.

This also follows clear threats by Mnangagwa as the latter declared that Chamisa will face consequences of either winning or losing the case.

Mangwana while saying the ruling party’s lawyers were quantifying the exact amount due to them, indicated an approximate bill of $3 million.

That figure excludes the Zimbabwe Electoral Commission’s legal bill.

“Lawyers charge according to the number of hours they spend on a case. You will appreciate that a humongous amount of hours were spent on this case because of its high profile nature and also because of the need to ensure that everything was on point,” he told the state media.

Mangwana said the final bill required approval of the Registrar of the Court.

“The amount has to be in line with the prescribed rates which lawyers charge. Such rates are approved by the Registrar of Courts who also has to grant the approval. The amount will also undergo the necessary taxation processes,” he said.

Mangwana said in the event Mr Chamisa failed to pay, the opposition leader risked losing his personal property.

“What the ruling means is that Zanu-PF doesn’t have to pay, it is Chamisa who has to pay our lawyers. The law says if he doesn’t pay we will have to attach his personal property.

‘‘This law is made to guard against people who approach the courts with cases that are not of any substance,” he said.

Breaking: US Senator John McCain Dies

Staff Reporter|US Senator John McCain, the Vietnam war hero turned senator and presidential candidate, has died aged 81.

Mr McCain died on Saturday surrounded by his family, according to a short statement released by his office.

He was diagnosed with an aggressive brain tumour in July 2017 and had been undergoing medical treatment.

His family announced McCain, who left Washington in December, had decided to stop treatment on Friday.

Announcing her father’s death McCain’s daughter Meghan said the task of her lifetime would now be “to live up to his example, his expectations, and his love.

“The days and years to come will not be the same without my dad – but they will be good days, filled with life and love, because of the example he lived for us,” she wrote in a statement shared on Twitter .

The six-term senator and 2008 Republican presidential nominee was diagnosed after doctors discovered his tumour during surgery to remove a blood clot from above his left eye last July.

The son and grandson of Navy admirals, Mr McCain was a fighter pilot during the Vietnam War. When his plane was shot down, he spent more than five years as a prisoner of war.

While in the custody of his captors, he suffered torture that left him with lasting disabilities.

Former Botswana President Ian Khama Will Not Attend Mnangagwa Inauguration

By Own Correspondent| Former President of Botswana Ian Seretse Khama will not be attending President elect Emmerson Mnangagwa’s inauguration due to prior commitments, the government of Botswana has revealed.

The inauguration, slated for Sunday 26 August 2018 follows the declaration by Chief Justice Luke Malaba that Mnangagwa was the country’s duly elected leader after the apex court dismissed with costs MDC Alliance leader, Nelson Chamisa’s poll petition challenging the ZEC presidential results.

In a statement released today, Botswana said Khama’s successor President Mokgweetsi Masisi will travel to Harare for the inauguration.

It was revealed that Masisi and his entourage which includes former President Festus G. Mogae and other senior Government officials, will return to Botswana on the same day.
