By A Correspondent | ZimEye | Alpha Media Holdings journalist Blessed Mhlanga has been denied bail by the High Court.
Mhlanga’s appeal was dismissed by High Court Judge Justice Gibson Mandaza, who upheld the lower court’s conclusion about the likelihood of interference with investigations. Mandaza remarked that “everyone including journalists should know that no one is above the law” and emphasized that the charge was about transmission, regardless of whether violence occurred.
The defense argued that no violence followed the publication and that witness statements were not recorded, but Mandaza clarified, “It is not an essential element of the offence that violence should have occurred.” He supported the lower court’s sentiment that the statements could affect peace and tranquillity.
Mandaza dismissed claims that Mhlanga was unfairly punished for Geza’s words. He stated, “The fact that the messages were uttered by Geza does not change the colour of the allegations.”
Although the defense argued that Mhlanga should be presumed innocent and should not be denied bail, Mandaza countered that “bail is not absolute” and could be denied based on circumstances.
On the matter of Mhlanga turning himself in, Mandaza noted this might have aided his case had he been deemed a flight risk. He highlighted Mhlanga’s senior position, suggesting it could lead to significant influence over investigations.
Mandaza concluded that the appeal lacked merit and stated, “The appeal cannot succeed and… is hereby dismissed.”
