By Mari Matutu | The greatest test and interview of President Nelson Chamisa was presented on Friday 2 October 2020. His whole political carrier is tested by the ZEC Gazette.

I as his supporter want to put the below facts that are before President Chamisa
1) He won 2018 election as MDC A president and ZEC rigged
2) Supporters were killed fighting and defending the win
3) People have lost resources defending the win
4) People are in jail for defending the win
5) Members of Parliament and councillors who won seats under MDC A are chucked out of the house illegally for defending the win.
6) The whole nation, Churches, civil societies and international bodies have raised voices concerning the same matter, yet
7) President Nelson Chamisa is aspiring to be a National president. Whose duties are spelt in s90 of constitution
90 Duties of President
(1) The President must uphold, defend, obey and respect this Constitution as the supreme law of the nation and must ensure that this Constitution and all the other laws are faithfully observed.
(2) The President must—
(a) promote unity and peace in the nation for the benefit and well-being of all the people of Zimbabwe;
(b) recognise and respect the ideals and values of the liberation struggle;
(c) Ensure protection of the fundamental human rights and freedoms and the rule of law; and
(d) respect the diversity of the people and communities of Zimbabwe.

While Mnangagwa has failed on every word on the duties of president which is the reason why everyone has experienced all the listed problems but I am afraid to say this now;
President Nelson Chamisa is being tested if he knows and understand the roles of Head of State and how to defend the constitution.
While he could uphold, obey and respect the constitution which are things one can do without noticeable action but now DEFENDING the constitution cannot be done in silence and has got causalities should the other side react aggressively.
MR President this is my expectation as your subject
The ZEC Gazette is in violation of s157(1)(d)(i). The whole reasoning of what is purported to be reason for such action is in violation of sections 120(2) and 124(2) of constitution and by s2(1) that Gazette is inconsistent with constitution in that in 2018 election we had two party lists at nominations one from MDC A and one from MDC T which all passed the nomination court and a Gazette was published, elections were held as such. The AU observer mission was here and observed those elections too. AU’s AFRICAN CHARTER ON DEMOCRACY, ELECTION AND GOVERNANCE has article 3 and 4 which spells out the values and principles of democracy.

With all this background Mr President you have no reason to uphold, obey or respect that Gazette but to defend with all you have at disposal. Any action that is inconsistent with constitution remains invalid no matter.
