The full glare of Zanu’s thuggery and violence was laid bare yesterday when Takudzwa Ngadziore, the ZINASU president was abducted, butchered and left for dead by State security agents. Ngadziore is being persecuted for merely asking for justice for Tatenda Muchehiwa another student who was abducted and severely tortured by state security agents with the brazen assistance of Impala Car Rentals. His only crime was to demand answers from Impala Car Rental on the abduction of Tatenda Muchehiwa.

The abominable ways of silencing the people which Zanu pf is using will always be abortive as it is the great crisis in the country that actuates the people to rise and speak. Therefore we warn ZANU PF that its evil tactics to instill fear in people through abducting, torturing, unlawful arrests of members of the opposition and civic organizations will not stop the people’s revolution.

The utterances by the illegitimate government that there is no crisis in Zimbabwe is just but nonsense. The level of human rights violations is reaching its peak, people are living in abject poverty as the economy continues shrinking and falling into an abyss, accelerated by ZANU PF’s excessive looting.

A nation’s leadership that is only adept at brutalizing its people clearly indicates that it is not from the people but self imposed. In Zimbabwe, we are as good as without a leader. Our security forces know nothing about patriotism but act on a partisan basis.

Surely if we do not liberate ourselves, no one else shall!

President Chamisa Denounces Harassment Of Ngadziore

Zanu PF youths assaulted ZINASU leaders and journalists during a media briefing in Harare on Friday.

President Chamisa described the level of lawlessness in the country as shocking.

Sports Minister Kirsty Coventry’s seriousness on the stadia ban might be questioned after she said that the CAF has not announced dates for the resumption of AFCON qualifiers.

The football authorities are racing against time to ensure that the Zimbabwe’s Group G qualifier against Algeria, slated for November, is staged on home soil as all stadiums in the country are currently banned from hosting international matches due their failure to meet set standards.

Coventry is however not even aware that the  continental governing body has already set dates for the resumption of AFCON and Champions League games, putting her seriousness into question.

“Confederation of African Football (Caf) has not spoken or sent any reference to any of the stakeholders that the resumption of play will be within this year. So, we are at this point in time, very positive that we will be approved for our games to go on,” the Minister said on Thursday while responding to questions by the senate.

“If at any point in the next few weeks we see that Caf is not going to be positive with the upgrade that has been done, we could then start to look at other things, but until we have confirmation as to when these games will take off, there is no reason for us not to be confident in the upgrade that we have done to pass CAF inspections.”-Soccer 24 Zimbabwe

We Appointed Chiwenga To Health To Deal With Striking Nurses-Mnangagwa

President Emmerson Mnangagwa said the appointment of Vice President Constantino Chiwenga, a retired army general, as Health Minister was meant to put an end to a crippling nurses’ strike.

Addressing a Zanu PF central committee meeting in Harare on Friday, Mnangagwa boasted that since Chiwenga’s appointment, doctors and nurses are now back at work.

He said:
We realised that year after year, we would not go for four or five months without a strike in the health sector.

I realised we needed a soldier there. We had to second a soldier there and now they are back at work.

Chiwenga was the Zimbabwe Defence Forces (ZDF) Commander during the 2017 military coup that toppled the late former President Robert Mugabe in November 2017.

Soccer Star “Bashes” Wife

FOOTBALLER Kudzai Nyamupfukudza is at the centre of a domestic violence storm after his wife accused him of violent behaviour.

Pauline Nyamizinga is nursing injuries after he was reportedly attacked by the footballerfor confronting him over a series of cheating allegations last week.

Pauline told H-Metro on Thursday that the defensive midfielder , who belongs to CAPS United but currently on loan at Mambas, has been ‘playing’ hard on her.

“This has been happening for a long time, besides this recent incident. I tolerated it for so long but I have reached a point that I am now afraid that he can hurt me more or kill me.  People should now know how we have been living,” said Pauline.

Contacted for comment, Nyamupfukudza acknowledged that Pauline is his wife and that they have a dispute.

He, however, declined to comment saying he will give comment later, which he failed to do.

“Oh okay. Yes, I know her. But I need to think of what to respond to that issue.

“Can you call me later or I will come back to you,” he said.

Narrating her ordeal, Pauline said a misunderstanding ensued when she saw WhatsApp chats of Nyamupfukudza and his alleged girlfriends.

“What happened is I went to our rural area and when I came back our child was playing with Kudzai’s phone.

“So I took the phone like any other wife would do and I encountered his messages with some girls and started taking pictures of the chats while he was asleep.

“I then went to his brother’s place that same night since I was very angry but his brother insisted on us going back to our house for counselling.

When we arrived home, he didn’t want all of that. So I decided to find somewhere to go with my child to avoid unnecessary disputes,” said Pauline.

Pauline alleged that Nyamupfukudza punched her and knocked her to the ground when she decided to leave the house during the night.

“So I decided to take keys since he had an option of just locking from inside sleep. So he followed me and demanded the keys and started assaulting me.

“He knocked me to the ground and took the keys. I then phoned his brother who took me to their relative’s place,” she said.

The fed-up woman accused the footballer of being a serial cheater and that he reportedly turns violent when confronted.

“He is used to harass and assault me whenever I confront him about his cheating habits. We have a home together, we have a kid, he is loving and caring to his child but the fact that after cheating me he then assaults me, ndiri kutsva kumusana nepadumbu.

“I have been in pain for so many days now. My love for him will leave me crippled.

“I am afraid that he can infect me with STIs and I am now at a point that people out there should know his habit.

Couple’s Bedroom Insults Spills Into The Court

By A Correspondent- A woman whose husband presumably no longer feels the tightness of her ‘nether region’ complained that she was deeply hurt by her husband who was regularly insulting her with her ‘lady part’ saying it was now too loose.

Sekai Shoko from Bulawayo’s Emganwini suburb claimed her husband Tinago Shoko (52), together with his second wife, were mercilessly teasing her in an attempt to get a reaction from her.

Their bedroom quarrels spilled into the public domain after Sekai took her husband to Bulawayo Civil Court praying for redress.

In her papers for a protection order she stated that the worst was when her husband and his second wife occasionally insult her with her private parts and silly names that are intended to anger her.

“Tinago Shoko is my husband and we got married in 1997. Last year he however, married another wife whom he is now staying with at our rural home. He is now teaming with his second wife to insult me with vulgar language while also labelling me a prostitute. He regularly insults me and my private parts saying they are now too loose,” complained Sekai.

She said her husband was also accusing her of being a goblin’s wife.

“Besides insulting and labelling me an old woman with loose private parts, he is also threatening to kill me saying I will leave our matrimonial home in a coffin,” she said.

In response Tinago didn’t dispute his wife’s accusations. He said she too used hurtful words whenever they argued.

“We will be insulting each other. Sometimes if I ask her, she doesn’t respond and when she does, she also uses vulgar language. She also labelled my second wife an old woman with loose private parts caused by having a lot of sex with other men,” said Tinago.

He, however, insisted that he still loved his wife so much despite exchanging hurtful words whenever their tempers flared.

For the purpose of maintaining peace between the two feuding parties the presiding magistrate Adelaide Mbeure granted a binding order which compels both parties to keep peace by not insulting and threatening each other.-bmetro

Mob Justice For Cemetery Rapist

By A Correspondent- A man who allegedly raped a woman at a cemetery was severely thrashed with sticks and later died at a hospital.

It is said on 11 September at around 4.30 pm a 23-year-old woman was fetching firewood near a cemetery at Babcock compound in Kwekwe, Midlands province.

A source close to investigations said Darlington Munyaradzi Maphosa reportedly spotted her before ambushing her near a cemetery.

The source said when she was passing by a cemetery Darlington grabbed her hand and dragged her into the bush.

“He violently pushed her to the ground before he quickly undressed her and raped her once,” said the source.

After the act he freed her and she went home, and narrated the ordeal to her brother. Seething with anger the brother, the source said, teamed up with his four friends and went to Darlington’s homestead.

“They caught up with Darlington at his homestead. They took turns to assault him with sticks all over the body. After they were satisfied that they had meted out instant justice to the victim, they took him to a police base,” said the source.

The source said Darlington sustained bruises around the neck and swollen hands.

“He also suffered a cut on the toes and injuries on the left ear and he complained of dizziness. He was rushed to Kwekwe General Hospital. Sadly, he died upon arrival,” said the source.

A report was made to the police leading to the arrest of the accused.

Midlands police spokesperson Inspector Joel Goko confirmed the incident.

“We are handling a case where a man was murdered after he allegedly raped a woman. As police we would like to urge community members not to take the law into their hands. If a person has committed a crime the community members should hand him to the police,” he said.

Meanwhile, Jothan Chidende from a village under Chief Nhema, Shurugwi allegedly lured a 37- year-old mentally challenged woman to his homestead. The woman in question went to his homestead and upon arrival, he enticed her to get into his room where he raped her once.

But his luck ran out after the sister of the rape victim noticed blood stains on her skirt.

“That worried her sister who then asked her about the blood and she revealed that she was raped by Chidende. She reported the matter to the police and the victim was referred to Shurugwi district hospital,” said the source.

“Gutu People Dominate ED’s Ministerial Appointments?”

By Ryan Chiwara- The following ministers appointed by president Emmerson Mnangagwa are all from Gutu district in Masvingo province raising public speculation that the president is seeking to counter MDC Alliance president Advocate Nelson Chamisa’s influence in his home district.

The ministers in Mnangagwa’ government who come from Gutu are Minister of Mines and Mining development, Winston Chitando, Minister of Agriculture, Water and land resettlement Dr Anxious Masuka, Minister of State for  Provincial Affairs and Devolution for Masvingo Province, Ezra Chadzamira, Minister of Higher and tertiary education, Professor Amon Murwira, Deputy Minister of National housing and social amenities, Yeukai Simbanegavi and Deputy Minister of Public Service, Labour and Social Welfare Lovemore Matuke.

MDC Alliance secretary for communications in Gutu central Langton Guvava said:

“Mnangagwa is already preparing for 2023 presidential election hence appointing so many ministers from Gutu the home district of his arch rival Movement for Democratic Change Alliance President Advocate Nelson Chamisa.

“I think Mnangagwa is already preparing for 2023 election and is trying to counter Chamisa’s influence in the district because he knows that Chamisa comes from Gutu,” said Guvava.

MDC Alliance President Nelson Chamisa comes from Gutu in Chidyamakuni village under chief Chiwara. He also did his secondary education at Alheit secondary school in Gutu.

 

 

“The Zim Crisis Exists In Your Minds”: ED Scoffs At “Critics”

By A Correspondent- President Emmerson Mnangagwa yesterday claimed that regional leaders were laughing off claims that there was a crisis in the country.

Addressing a Zanu-PF central committee meeting in Harare yesterday, Mnangagwa said he chats with regional leaders regularly and that they laugh off at insinuations on social media that there was a crisis in the country.

“I can assure you almost on a weekly basis, currently almost on any other day, I discuss with my brother (South African President Cyril) Ramaphosa, I discuss with my brother (Botswana President Mokgweetsi) Masisi (and) with Hage Geingob (Namibian President), we chat and laugh at your social media insinuations,” Mnangagwa said.

“So you are wasting your time.

“This meeting (central committee) comes after another crushing failure of machinations by our detractors on social media to reverse and destabilise the unity peace, security milestones.”

He added: “I applaud the party and the people of Zimbabwe and leadership of the party for remaining resolute in the wake of the opposition’s regime change agenda and worrying levels of self-hate through a sustained call to make our country ungovernable saying there is a crisis in Zimbabwe.”

Mnangagwa also dismissed claims that there was bad blood between the South African ruling party, African National Congress (ANC), and his Zanu-PF party following weeks of exchanges between the two liberation parties over the crisis in the country.

“The crisis exists in their minds, it exists in their parties. The crisis exists in their bedrooms, not in Zimbabwe,” he said.

Ramaphosa has dispatched two delegations to Harare to have an appreciation of the situation following reports of gross human rights violations head of the foiled July 31 protests.

Although Zanu-PF has insisted there was no crisis in the country, the ANC delegation led by Ace Magashule, the secretary-general of the South African ruling party, has maintained that the country was a “mess” following reports of abductions, politically-motivated arrests and torture of perceived opponents, including journalists and lawyers, ahead of the July 31 protests.

Mnangagwa, whose regime has hogged international media for the human rights abuses, closed the door on external mediation to end the crisis.
We will not seek outside mediation to deal with challenges which they themselves have,” Mnangagwa said, in apparent reference to the ANC intervention, but insisted there was no bad blood between the two liberation movements.

“The solidarity existing between our party Zanu-PF and other sister revolutionary parties like the ANC of South Africa can never be shaken by social media. We have elements peddling falsehoods that there is misunderstanding between ANC and Zanu-PF, there is nothing (like that),” he said.

On churches, Mnangagwa said the Zion Christian Church, whose farming programmes he officiated on Thursday, must focus on productivity and stop wasting their time complaining about the human rights situation in the country.

His call was a not so subtle attempt to silence vocal church groups, including Catholic bishops, who have condemned his administration on human rights violations.

“I call upon churches in our country and the nation as a whole to shift our mind set and reorient our discourse towards economic productivity not to have malicious claims of ‘human rights, human rights’. We need productivity. The development of a country is productivity based,” he said.

“No country develops out of demonstrations. Let us shun divisive and evil concoctions by merchants of doom and their handlers who are bent on keeping our country stuck in a cycle of disunity and confusion. Let us continue to preach unity, peace, love and harmony so that we develop our nation.”-newsday

“Zanu Pf Youths Assault Detectives”

By A Correspondent- The invasion of a drug peddler’s base in Kwekwe Mbizo 17 and his arrest caused violence and commotion reportedly perpetrated by Zanu PF youths yesterday.

Two detectives arrested a Kwekwe drug dealer only known as Selassie and recovered dagga and bronclear at his house which was full of youths taking drugs.

Sources close to a local publication revealed that the detectives were getting the dealer to the nearest police station when two Zanu PF youths Brian Shava and Widzo followed and stopped them.

The youths assaulted the detectives in front of onlookers.

Investigations carried out indicate that the youths at Selassie’s are the ones who contacted their superiors who allegedly defeated the course of justice and took away the accused and exhibits from the vehicle.

The victims did not report the matter for fear of victimization from Zanu PF.

Daring Thief Steals Officer’s Uniform

By A Correspondent- A police officer based in Bulawayo was left clutching thin air after a thief opened his car and stole his uniform.

The incident happened last week on Thursday at corner Fort Street and 8th Avenue.

The unfortunate cop, Noar Munongowera, is stationed at DHQ Suburban.

A source who is close to investigations said on the day in question Constable Munongowera was travelling along Fort Street when his car developed a fault. He parked his car, a Honda CRV at corner Fort Street and 8th Avenue.

“He opened the bonnet of his car and checked what could have been the problem. While he was still fixing his car thieves pounced on his car and stole a satchel containing riot trousers, webbing belt and a grey shirt,” said a source.

The source said the accused person then ran to a Corolla registration number AHE 7235 which was parked a few metres away from his car.

“He got inside the Corolla and they sped off with the satchel,” said the source close to investigations

Schools Mull Fees Payment In Forex

By A Correspondent- Most schools want to peg fees and levies in foreign currency, with some boarding schools proposing US$350 or the equivalent in Zimbabwe dollars, while day schools are proposing US$100.

This follows an appeal by the National Association of Secondary Heads (NASH) for the Ministry of Primary and Secondary Education to allow schools to charge levies and fees in foreign currency.

The schools say suppliers of educational consumables were charging them in United States dollars and it makes sense that they also collect fees in foreign currency. NASH president, Arthur Maphosa said:

Nash recommends that schools be authorised to budget in US dollars on the grounds that suppliers are charging goods and services in foreign currency.

The purchase of examination material for science and technical practicals will be a tall order unless Government allows schools to receive fees in foreign currency.

Suppliers are refusing to take the local currency and school heads will collapse at work because of this.

Ministry of Primary and Secondary Education’s spokesperson, Taungana Ndoro told The Manica Post this week that there are procedures which schools should follow before they raise fees.

Ndoro said the Ministry will look at the applications by schools individually before new fees structures are approved and that as of now, no new fees regime has been approved.

However, some schools have already started sending circulars informing parents of the new fees structure.

Prophetess “Defrauds” Congregant Of A Wife

By A Correspondent- A self-styled Bindura prophetess was on Friday sentenced to two months in jail by a magistrate following her conviction on fraud charges.

Spiwe Gwashure (40) of Grace in Abundance Ministries was also was ordered to pay the US$320 within two months to the complaint by Bindura provincial magistrate Tinashe Ndokera.

Sometime in April 2018, Gwashure reportedly “prophesied” to one of her congregants, Abina Maliwo (46), that she will find him a wife to marry.

In July 2019, the prophetess then requested Maliwo to give her US$320 which, which he raised in two.  She said the money was for bride price, claiming that she had found a wife for Maliwo in Guruve.

Maliwo was also instructed to buy a cellphone for his “wife” but later realised that the wife she was speaking to over the phone was Gwashure.

That was he realised that he had been duped and he proceeded to file a police report leading to Gwashure’s arrest.-newsday

CONCERNED by the crisis of legitimacy, the closure of political space, attack on civil liberties and human rights, persecution and arrests of activists, the torture and violence against the citizens:

FURTHER NOTING the humanitarian crisis in respect of which 8 million Zimbabweans are food insecure and 5 million people have to be provided with humanitarian assistance and concerned by the massive leakages and looting of humanitarian aid and assistance;

TAKING COGNISANCE of the COVID19 pandemic and the gross mismanagement of the pandemic through the lack of financial resources, mass testing and provision of PPEs, drugs, isolation and quarantine centres:

DISTURBED by ZANU PF-driven threats to the people’s political party – the MDC Alliance, the unlawful arrests of our leaders and members, the unlawful recalls of elected people’s representatives and the abuse in the interpretation of the Supreme Court judgment:

1. The party expresses concern over Zimbabwe’s multi-faceted governance, economic and social crisis which has manifested in mass starvation, poverty, joblessness, wage erosion, poor earnings by civil servants, the remuneration crisis in the education sector, grand corruption and a deepening crisis in the health sector including inadequate remuneration and PPEs for health workers and insufficient isolation facilities. We call for NGOs to give aid directly to communities to avoid abuse by ZANU PF. We condemn corruption in COVID19 procurement and the use of COVID19 as an excuse to clampdown on human rights.

2. The party condemns the closure of democratic space, human rights abuses, violence, wanton arrests and demands the immediate release of all political prisoners and an immediate cessation of all malicious prosecutions, particularly of Job Sikhala, Joanna Mamombe, Cecillia Chimbiri, Chalton Hwende, Tsitsi Dangarembwa, Netsai Marova, Hopewell Chin’ono, Jacob Ngarivhume and Godfrey Kurzone.

3. The party notes the efforts of South Africa and the ANC in facilitating the resolution of the national crisis. The party restates its commitment to dialogue centred on comprehensive reforms, national healing and the return to legitimacy and democracy. The party supports the efforts of the ANC and calls for the involvement and scaffolding of the process by the international community, in particular SADC and the African Union.

4. The party affirms the democratic right of citizens to protest peacefully as enshrined in section 59 of the Constitution and places all citizens on notice with regard to the need for a broad front to challenge ZANU PF and mass mobilization because Zimbabwean Lives Matter and the March is not Ended.

5. The party restates that it is the MDC Alliance party. It contested the 2018 election as the MDC Alliance. As the alternative, it has MPs in Parliament and councillors in local authorities. It has been victimized as the MDC Alliance and will win as the MDC Alliance. It will remain the MDC Alliance.

6. The party demands comprehensive electoral and political reforms as set out in our RELOAD and PRICE policy documents. The party considers participation in free, fair and credible elections as a necessary zone of struggle.

7. As a people-driven party, the NEC mandated the leadership at various levels to consult stakeholders, opinion leaders, grassroots structures and party organs countrywide on the multiple options that are available to it.

Mnangagwa Adamant That There Is No Crisis In Zimbabwe

President Mnangagwa has shot down claims of a prevailing crisis in the country and thanked Zimbabweans for remaining resolute in defiance of machinations by opposition elements to foment instability in the country.

The President said this in his opening remarks during the 113 Ordinary Session of Zanu PF’s Central Committee on Friday.

He said the so-called crisis that was being peddled by the opposition and their allies were a creation of the imaginations that was being spread through false social media narratives.

President Mnangagwa called on Zimbabweans not be side-tracked by such claims aimed at causing disharmony in the country but focus on the development agenda being pursued by Government.

The President also dispelled notions that Zanu PF had a strained relationship with South Africa’s ruling party ANC saying the ties remained cordial and was in constant communication with his counterpart President Cyril Ramaphosa.

THE Zimbabwean government recently gazetted the Finance Bill (HB 4 of 2020) which validates the fiscal changes that were tabled in the Mid-Term Budget Review in July.

The Bill amends the Gains Tax Act (Chapter 23:01), the Finance Act (Chapter 23:04) and the Income Tax Act (Chapter 23:06). The Bill also carries changes to various tax heads such as mining royalties, income tax, value-added tax, customs and excise duties. Of significance is the fact that the government is reverting back to the taxation model of the Finance Act of 2009, which allows it to collect taxes in foreign currency from corporates and individuals that earn their income in foreign currency.

The individual income tax-free threshold has been raised from ZW$5 000 to ZW$25 000 (US$302) and aligns to the foreign currency tax free threshold of US$350. The individual income tax bands will be as follows: From US$351 to US$1 500 (20%), US$1 501 to US$5 000 (25%), US$5 001 to US$10 000 (30%), US$10 001 to US$15 000 (35%) and above US$15 000 (40%). The changes are with effect from August 1, 2020.

Zimbabwe officially dollarised on April 9, 2009, and adopted a basket of multiple currencies led by the United States dollar and South African rand. The market had rejected the Zimbabwean dollar and started using foreign currencies after record hyperinflation eclipsed 250 million percent (officially) in July 2008.

However, the Zimdollar was hurriedly re-introduced in February last year to thwart pressure from civil servants, who were demanding to be paid in US dollars. Statutory Instrument (SI) 142 of 2019 was then gazetted in June 2019 to ban the use of multiple currencies and enforce the use of a mono-currency regime in the economy.

However, the local currency experienced a record free-fall, losing 90% of its value in 2019. Annual inflation increased from 59% in February 2019 to 838% in July 2020.

In July 2020, a dual pricing regulation (SI 185 of 2020) directed all sellers of various goods and services to display and quote prices in both the Zimdollar and US dollar using the auction rate. This paved the way for the government to follow businesses and labour with new US dollar tax proposals.

The economy is now heavily skewed towards official dollarisation again, with the government now amending its taxation arsenal and partially remunerating in US dollar. Most businesses have also moved to charge in foreign currency and will be more than happy to trade in a stable currency for planning purposes.

Impact on tax revenues
The revenue performance for 2019 looked rosy on face value despite regressing in real terms. The country’s tax and non-tax revenue jumped to ZW$22,971 billion (US$2,691 billion using monthly interbank rates).

In spite of surpassing gross and net revenue targets every month, tax revenues fell below the 2013 total net-of-refunds collections of US$3,430 billion. This means that the Zimdollar depreciation and the subsequent general economic contraction have seriously hit government pockets, thereby adversely impacting public service delivery and infrastructure spending.

Service delivery in hospitals, education, housing, social welfare and policing have been seriously affected due to compensation related industrial action and limited budget allocations.

Inflation still poses the greatest risk to revenue collection, utilisation of allocated budgets and service delivery in various government departments.

ZSE, pension funds losses
In December 2013, the Zimbabwe Stock Exchange (ZSE) market capitalisation reached US$4,2 billion. As of September 14, 2020 the combined market capitalisation was ZW$217,44 billion (less than US$2,630 billion). After pouring millions of capital into new production lines and ramping up production, all counters on the ZSE have seen their values eroded by more than 50% as a result of exchange rate losses.

The same can be said of the pensions and insurance sector where pension and investment values were severely battered. The value of pension and insurance assets has plummeted from a value of US$4,358 billion in December 2013 to about US$2,013 billion in December 2019. There has been an increase in product termination of policies as premiums, contributions and benefits can no longer keep pace with the rate of inflation. For the second time in a decade, pensioners have lost their life savings due currency changes and most are struggling to make ends meet.

Increase in poverty levels
Poverty levels in Zimbabwe spiked in 2019 as access to food, basic education, health care, decent housing, electricity, power, transport, safe drinking water and other insurance became elusive to many Zimbabweans as a result of loss of income.

Salaries and wages in both the private and public sector are not being adjusted in line with changes in inflation rate or consumer price indices. Civil servants are currently getting a Covid-19 allowance of US$75 plus a basic salary of ZW$3 000 for the least-paid worker (below the Zimstat Poverty Datum Line of ZW$11 334 for June 2020).

The same can be said for the private sector where salaries average just below that amount for the least-paid worker. This means that the Zimdollar has decimated incomes for labour and most are now living in extreme poverty if compared to 2010 to 2018 income levels or World Bank standards on poverty.

The impact is being felt on decline in consumer confidence and spending in the economy. According to the World Bank, extreme poverty reached 40% of the population in 2019, up from 33,4% in 2017, with urban poverty rising faster (from 4% to 10%) than rural poverty.

Corporate sector losses
Zimbabwe’s corporate sector has been hard hit by the rushed introduction of the local currency. Businesses have lost billions through erosion of asset value, exchange rate losses, foreign debt overhang and decline in revenue as a result diminished consumer spending.

British American Tobacco (BAT) Zimbabwe posted a loss of ZW$27,69 million in 2019. Financial behemoth, Old Mutual Zimbabwe suffered a massive loss of ZW$2,61 billion, while telecoms giant Econet Wireless Zimbabwe posted a heavy loss of ZW$1,28 billion in 2019.

Listed entities such as Simbisa Brands, Nampak, Pretoria Portland Cement, National Foods, Delta Beverages and RioZim experienced their worst trading period in 2019 characterised by production stoppages and failure to meet foreign obligations.

The business sector has blamed their losses on currency depreciation, foreign exchange losses and decline in consumer disposable incomes. After introducing the Zimdollar, the government took over foreign debts amounting to about US$2 billion. Most of the debt has not yet been paid and this has had a negative impact on local businesses in terms of importing raw materials, getting new credit lines, outsourcing critical foreign services, debt-to-equity ratio, cash flow management and business stability.

The country’s de-dollarisation plan was doomed from the onset as the country did not meet the basic fundamentals required to bring stability to a mono-currency. The country was not actively implementing any macro-economic stabilisation plan that would lead to low inflation or have an efficient foreign exchange market to talk of.

Further, the country has no foreign currency reserves or external facilities to back the stability of the domestic currency, an acceptable sovereign debt repayment plan or the governance discipline required to curb rampant money supply growth. The rushed introduction of the Zimdollar has not only left labour, business and the economy nursing wounds of inflation, but it has also battered the government in terms of tax revenue collections and service delivery.

The government is now covertly undoing the mono-currency legislation and exchange controls, but economic output lost due to the ill-timed currency changes can never be recovered.

Undeniably, every country needs a domestic currency to push its export and economic growth agenda. However, that currency borrows its stability for a stable economic and political climate. The currency changes were reactionary, mistimed and lacked alignment to other economic policies and reforms.

NOTING the extent of the national crisis, the suffering of the masses, increased poverty, economic instability, hyperinflation, economic disequilibrium;

CONCERNED by the crisis of legitimacy, the closure of political space, attack on civil liberties and human rights, persecution and arrests of activists, the torture and violence against the citizens:

FURTHER NOTING the humanitarian crisis in respect of which 8 million Zimbabweans are food insecure and 5 million people have to be provided with humanitarian assistance and concerned by the massive leakages and looting of humanitarian aid and assistance;

TAKING COGNISANCE of the COVID19 pandemic and the gross mismanagement of the pandemic through the lack of financial resources, mass testing and provision of PPEs, drugs, isolation and quarantine centres:

DISTURBED by ZANU PF-driven threats to the people’s political party – the MDC Alliance, the unlawful arrests of our leaders and members, the unlawful recalls of elected people’s representatives and the abuse in the interpretation of the Supreme Court judgment:

1. The party expresses concern over Zimbabwe’s multi-faceted governance, economic and social crisis which has manifested in mass starvation, poverty, joblessness, wage erosion, poor earnings by civil servants, the remuneration crisis in the education sector, grand corruption and a deepening crisis in the health sector including inadequate remuneration and PPEs for health workers and insufficient isolation facilities. We call for NGOs to give aid directly to communities to avoid abuse by ZANU PF. We condemn corruption in COVID19 procurement and the use of COVID19 as an excuse to clampdown on human rights.

2. The party condemns the closure of democratic space, human rights abuses, violence, wanton arrests and demands the immediate release of all political prisoners and an immediate cessation of all malicious prosecutions, particularly of Job Sikhala, Joanna Mamombe, Cecillia Chimbiri, Chalton Hwende, Tsitsi Dangarembwa, Netsai Marova, Hopewell Chin’ono, Jacob Ngarivhume and Godfrey Kurzone.

3. The party notes the efforts of South Africa and the ANC in facilitating the resolution of the national crisis. The party restates its commitment to dialogue centred on comprehensive reforms, national healing and the return to legitimacy and democracy. The party supports the efforts of the ANC and calls for the involvement and scaffolding of the process by the international community, in particular SADC and the African Union.

4. The party affirms the democratic right of citizens to protest peacefully as enshrined in section 59 of the Constitution and places all citizens on notice with regard to the need for a broad front to challenge ZANU PF and mass mobilization because Zimbabwean Lives Matter and the March is not Ended.

5. The party restates that it is the MDC Alliance party. It contested the 2018 election as the MDC Alliance. As the alternative, it has MPs in Parliament and councillors in local authorities. It has been victimized as the MDC Alliance and will win as the MDC Alliance. It will remain the MDC Alliance.

6. The party demands comprehensive electoral and political reforms as set out in our RELOAD and PRICE policy documents. The party considers participation in free, fair and credible elections as a necessary zone of struggle.

7. As a people-driven party, the NEC mandated the leadership at various levels to consult stakeholders, opinion leaders, grassroots structures and party organs countrywide on the multiple options that are available to it.

CIO Agent Nabbed For Smuggling

A MEMBER of the President’s Office based in the border town of Chirundu is wanted by detectives who yesterday swooped in on a daring syndicate that smuggled goods from Zambia and stored them in a disused common room of ZRP Chirundu Mess., Zimbabwe Voice can reveal.

According to an internal police memo, detectives from CID Chirundu together with officers from the Zimbabwe National Army (ZNA), President’s Office (the CIO) and ZIMRA officials discovered 35 sacks loaded with goods ranging from clothes to hardware.

The incident took place yesterday (Friday) at about 0830 hours when CID Chirundu received information through a phone call from ZIMRA Chirundu Bonds Manager, one Mrs Kudzunga, that there were suspected smuggled goods in a disused common room of ZRP Chirundu Mess.

“Detectives identified witnesses at the scene leading to the arrest of Charles Mainoti (38), a resident of Southlea Park in Harare who works for Kabor Bus Services.

“The accused was interviewed and he indicated that he engaged one Denga, a member of the President’s Office based at Chirundu who together with Cliff NFPK transported the goods from Zambia to Zimbabwe via the entry gate of the border.

“The accused further indicated US$ 350-00 to Zimra Officials, US$430 -00 to members of ZNA and CIO who all facilitated entrance of the smuggled goods into the country. Detective Constable Karimakwenda of CID MFFU Chirundu also witnessed the payments,” reads the memo in part.

It further says that nn unregistered Kombi, white in colour and belonging to one Cliff was used to smuggle the goods from Zambian Border into the country during the night of 17 September 2020 and the goods were taken to the disused Police Mess for safekeeping waiting for them to be transported to various destinations.

“The goods were smuggled via the Border’s entry gate and the accused made payments to Officials manning the gate to be allowed to pass.

“A Toyota Dyna unregistered, engine number nil, chassis number XZU338-100139 being driven by Shingirai Derrick Nyadore, aged 38 Years, NR 26-133580 P 50 was found parked about 50 meters away from the scene.

“The driver was located and indicated that he had been hired by the accused to transport some goods but was not aware of the nature of goods. The vehicle was taken to ZIMRA Chirundu for seizure.

“The recovered goods were to ZIMRA for counting and seizure,” reads the memo, which the Zimbabwe Voice is in possession of.

Detectives in Chirundu say they are seeking the whereabouts of Denga, the CIO officer, and Cliff who is being implicated and are keen to interview the duo.

CID also wants to recover the Kombi that was used to smuggle the goods as well as identify ZIMRA authorities namely Magaya and Mutasa who were manning the Border’s entry gate so they can jointly charge them.

Meanwhile, Mainoti is expected to appear in court soon.

President Emmerson Mnangagwa has all but given up on the Coronavirus declaring the “each man for himself” stance on the Coronavirus scourge.

Mnangagwa said this stating that the Government of Zimbabwe will ease Zimbabwe’s national COVID-19 lockdown regulations as has done neighbouring South Africa.

Addressing the Zanu PF Central Committee on Friday, Mnangagwa said Government will be easing the country’s COVID-19 lockdown measures in the coming week.

He said:

“Hapana anoraramira hupenyu hweumwe. Mumwe nemumwe anofa pachake kana kurarama pachake. Isu ndima yedu yekuudza vanhu kuti kune chirwere ichi taifambisa, taisunda ndima iyoyo. Kwatavakuenda uku, tichionazve kuti vazhinji vakunzwisisa, takutsudzunura zvishoma nezvishoma. Tichange tichitsidzunura zvimwe svondo rinouya iri. Saka ndati ndinyatsokutsanagura apa kuitira kuti tese tive nerimwe kana totaura. (No one lives on behalf of another. An individual will die or live alone. We have done our part as Government to inform the public on Covid-19. We will be relaxing regulations this coming week. I have told you this so that we are on the same page.)”

Earlier this week, Government announced that business hours for exempted businesses not defined as essential, along with most of the retail end of most essential sectors had been extended to 6.30 am to 6.30 pm.

This period is outside the curfew which the government clarified remains in place despite the extension of business hours.

The Deputy Chairman of the Ad-Hoc Inter-Ministerial Taskforce on Covid-19, Professor Amon Murwira told The Herald that the 10-hour curfew remains in place despite the extension of business hours permitted for exempted non-essential businesses.

The government instituted an 8 pm to 6 am curfew to restrict night activities as part of measures to contain the spread of Covid-19.

Schools are resuming examination classes, under new rules, restrictions in domestic tourism have been eased and intercity bus travel has been allowed with the new rules for that sector.

Chiwenga Was Appointed Health Minister To Give Soldier Mentality Into The Sector

PRESIDENT Emmerson Mnangagwa yesterday told a Zanu PF central committee meeting in Harare that he appointed Vice-President Constantino Chiwenga to head the Health portfolio to sort out striking doctors and nurses with a “soldier mentality”.

Chiwenga was appointed to the portfolio last month following the ouster of Obadiah Moyo, who is facing abuse of office charges that also involve associates of Mnangagwa’s Family.

The former Zimbabwe Defence Forces Commander, who traded the military fatigue for political office after a military coup that ousted the late former President Robert Mugabe in November 2017, came into the health portfolio amid a crippling job action by nurses demanding a living wage.

“We realised that year after year, we would not go for four or five months without a strike in the health sector. I realised we needed a soldier there. We had to second a soldier there and now they are back at work,” Mnangagwa said in apparent reference to Chiwenga.

In August, armed police were deployed to beat up striking nurses at Sally Mugabe Central Hospital in Harare, while others were also deployed in Bulawayo and other cities.

Nurses were also arrested for downing tools during that period.

Chiwenga, soon after his appointment, pleaded with the health workers to return to work and pledged to end the culture of looting by those politically connected.

He came in when the health workers had declared war on their employers, insisting they would not go back to work before their concerns were raised.

Their concerns included United States dollar-pegged salaries, personal protective equipment, among other essentials, and the government had failed to convince them to go back to work.

There were reports soon after his appointment that Chiwenga was targeting some members of Mnangagwa’s family who were fingered in the COVID-19 looting scandals that involved alleged abuse of millions of dollars.

Several people, including Moyo and one Delish Nguwaya, a close associate of the Mnangagwa family, have since been arrested over the scandals, while journalists who exposed the said rot have either been arrested or are in hiding.

In 2013 he came in front and declared NIKUV has used a ballot that change votes. No matter what you say he set an agenda for Zimbabwe and explanation for MDC T. On 15 February 2018 He stood up and declared that Nelson Chamisa is the president of the party MDC T and it set the record. Khupe lost. At election result 2018 he grabbed the mike and said the elections are fake.

When he lost post of VP he became a sellout yes but he took his talent.

At the door steps of the Supreme Court, he declared saying Chamisa is illegitimate. For 6 months now it’s as he declared. Today he has announced he is MDC A. It looks like the obvious will happen.

If you do not have a person brave to stand up declare things and stand your ground you might as well help the nation and stop politics.

We voted you as MDC-A. The constitution is clear that elections are done in accordance with electoral laws. SC: MDC A or MDC T are not electoral laws.

s129(1)(k) does not provide for recall of member for ceasing to belong to party A which is a member of party B.

The wording of election results declaration are not changed by anyone beside an electoral court order after petition.

S4 of Act say MDC A is a political party and the party registered office bearers in terms of s38A. The candidates chose MDC A on prescribed form and were accepted by MDC A. As candidates who sot authority of office bearers from a party they are not bound by agreements of the party with any other person.

Right to stand for election is in terms of s67 (3)(b) given to citizens not political parties who then exercise s67(1)(b) political choice of who to contest in conjunction with. They made choice. No one can give them party to belong. MDC T is yet to prove how these members ever belonged to them in terms of electoral law.

Seats are not vacant we wait for you ZEC in terms of s233(f) to remedy the injustice and direct Parliament to cancel their declaration vacancies because ZEC has duty to see constitutionalism is observed and ZEC has to secure the observance of values and principles democracy are observed.

The only seats we shall contest are those vacant by death and recalls by other parties.

Should ZEC accept the directive of parliament and MDC T then let the world know that the will of the people is stolen and there is no independent electoral body. The world must know that the electoral body has subjected itself to a political agreement and constitution of a party and disputes are which civil matters and not electoral disputes.

Takudzwa Ngadziore, ZINASU president who was recently arrested for merely asking for justice for Tatenda Muchehiwa was yesterday abducted by suspected state agents, butchered and left for dead.

His only crime was to demand answers from the impala car rental on the abduction of a fellow student Tatenda Muchehiwa.

The abominable ways of silencing the people which Zanu pf is using will always be abortive as it is the great crisis in the country that actuates the people to rise and speak.

Therefore we assure ZANU PF that its evil tactics to instill fear in people through abducting, torturing, unlawful arrests of members of the opposition and civic organizations will not stop the people’s revolution.

Surely the utterances by the illegitimate government that there is no crisis in Zimbabwe is just but nonsense.

The level of human rights violations is reaching its peak, people are living in abject poverty as the economy continues shrinking and falling into an abyss, accelerated by ZANU PF’s excessive looting.

A nation’s leadership that is only adept at brutalizing its people clearly indicates that it is not from the people but self imposed itself.

In Zimbabwe we are as good as leadershipless.

Our security forces know nothing about patriotism but act on a partisan basis.

Surely if we do not liberate ourselves, no one else shall!

Impact Of COVID-19 On Health Workers Worldwide

The World Health Organization (WHO) is calling on governments and health care leaders to address persistent threats to the health and safety of health workers and patients.

“The COVID-19 pandemic has reminded all of us of the vital role health workers play to relieve suffering and save lives,” said Dr Tedros Adhanom Ghebreyesus, WHO Director-General. “No country, hospital or clinic can keep its patients safe unless it keeps its health workers safe. WHO’s Health Worker Safety Charter is a step towards ensuring that health workers have the safe working conditions, the training, the pay and the respect they deserve.”

The pandemic has also highlighted the extent to which protecting health workers is key to ensuring a functioning health system and a functioning society.

The Charter, released today for World Patient Safety Day, calls on governments and those running health services at local levels to take five actions to better protect health workers.

These include steps to protect health workers from violence; to improve their mental health; to protect them from physical and biological hazards; to advance national programmes for health worker safety, and to connect health worker safety policies to existing patient safety policies.

Mounting reports of infections, illness and attacks among health workers fighting COVID-19

COVID-19 has exposed health workers and their families to unprecedented levels of risk. Although not representative, data from many countries across WHO regions indicate that COVID-19 infections among health workers are far greater than those in the general population.

While health workers represent less than 3% of the population in the large majority of countries and less than 2% in almost all low- and middle-income countries, around 14% of COVID-19 cases reported to WHO are among health workers. In some countries, the proportion can be as high as 35%.

However, data availability and quality are limited, and it is not possible to establish whether health workers were infected in the work place or in community settings.

Thousands of health workers infected with COVID-19 have lost their lives worldwide.

In addition to physical risks, the pandemic has placed extraordinary levels of psychological stress on health workers exposed to high-demand settings for long hours, living in constant fear of disease exposure while separated from family and facing social stigmatization.

Before COVID-19 hit, medical professionals were already at higher risk of suicide in all parts of the world.

A recent review of health care professionals found one in four reported depression and anxiety, and one in three suffered insomnia during COVID-19.

WHO recently highlighted an alarming rise in reports of verbal harassment, discrimination and physical violence among health workers in the wake of COVID-19.

Addressing a Zanu PF central committee meeting in Harare on Friday, Mnangagwa boasted that since Chiwenga’s appointment, doctors and nurses are now back at work.

He said:
We realised that year after year, we would not go for four or five months without a strike in the health sector.

I realised we needed a soldier there. We had to second a soldier there and now they are back at work.

Chiwenga was the Zimbabwe Defence Forces (ZDF) Commander during the 2017 military coup that toppled the late former President Robert Mugabe in November 2017.

Chamisa, Mnangagwa Should Relate The Same Way They Did During GNU

In 2009, former Prime Minister of Zimbabwe Dr Morgan Richard Tsvangirai appointed the then MDC National Organizing Secretary, Nelson Chamisa to be in charge of Ministry of Information and Communication Technology and served as a cabinet minister until the expiry of the Global Political Agreement (GPA). His tenure as a cabinet minister exuded virtuosity and he won several minister of the year awards. The former President of Zimbabwe Robert Mugabe once described him as a supersonic minister following Chamisa’s successful computerization initiative back then.

Chamisa also served as Member of Assembly for Kuwadzana East and he also did excellent work to develop his constituency which includes successful feedback mechanism in the constituency, the MP scholarship fund for the girl child, computerization and internet connection for Kuwadzana schools and construction of state of the art Kuwadzana library.

Whilst Advocate Chamisa was serving as a cabinet Minister in the Government of National Unity, he shared the same cabinet boardroom at Munhumutapa offices with Emmerson Mnangagwa then Justice Minister before the latter switched to Defense Ministry.

The two used to share some lighter moments in Parliament and they were believed to be only political opponents and not enemies. Videos and images in which the two were joking and laughing together are awash on the internet.

When Mnangagwa and Chamisa took over as leaders of ZANU PF and MDC Alliance respectively, many people hoped the two’s affability could push them to engage in serious talks for the betterment of the ailing nation. Moreover Nelson Chamisa’s lawyer Thabani Mpofu also ‘legitimized’ the November 2017 military coup by representing two applicants at the High Court arguing that the army’s intervention was necessary on the basis that Mugabe could no longer be in a position to make independent decisions and was now acting under his wife Grace’s influence. He won the case. We all thought dialogue between Chamisa and Mnangagwa was inevitable and it seemed people were ready to work together.

My questions which linger unanswered are; what has changed, apart from one being the Head of State, and the other being the main opposition leader in Zimbabwe? Do these two gentlemen need a South African delegation appointed by Cyril Ramaphosa for them to meet in their own country? Does it have to take Thabo Mbeki or Olusegun Obasanjo to come and mediate for them to dialogue?

Mnangagwa argues that Chamisa must recognize him as the legitimate head of state for him to consider him on the negotiating table. On the other hand, Chamisa says the legitimacy issue should form the basis of the dialogue between the two.

Advocate Chamisa and President Mnangagwa need to understand the fact that in a dialogue you have to sacrifice something. No one should expect to win everything in a dialogue hence the need for the two to swallow their pride and negotiate purposefully.

Let me close by saying we need the two leaders right on the same table, and if it means people have to flood the streets, let them do so as this might be the only sagacious protest worthy overwhelming national participation. Prayer warriors on the other hand should go onto the mountains to pray for peace in our country.

On March 9, 2018 Kenya’s President Uhuru Kenyatta and the leader of the main opposition Raila Odinga publicly shook hands and agreed to work together. It did not take the two foreign conciliators to achieve such a commendable milestone. Now there is political stability in Kenya and their economy is growing rapidly and the environment is conducive for investors. Recently Ramaphosa and Julius Malema held a joint press conference calling for unity amongst citizens in the fight against Covid-19 pandemic, an indication they put people first.

I therefore call upon Chamisa and Mnangagwa to start talking to each other. Mnangagwa as the president of the country should put people first and understand that Chamisa is a vital cog in every development of this country and dialogue without Chamisa is a façade.

The two are legal minds and we believe they speak the same language. They must understand they are all Zimbabweans hence their actions should be pro-people. Before the two became the leaders of their respective political parties, they made some remarkable achievements as both government ministers and political leaders.

We want sincere talks between the two political giants and home-grown solutions to scaffold the country for growth and stability. The country is in the middle of an enervating political crisis which can only be resolved through a candid dialogue.

“We cannot impose ourselves on Zimbabwe” says SA – yet no qualms imposing illegitimate Zanu PF

By Patrick Guramatunhu| South African International Relations Minister Naledi Pandor says South Africa’s intervention in Zimbabwe can only happen at the request of the Government of Zimbabwe.

There is real very little point in talking endlessly about the hows, whens, whys, etc. of South Africa’s intervention in Zimbabwe until we have dealt with the question of what SA’s intervention can realistically achieve.

If we agree that the root cause of Zimbabwe’s seemingly never ending economic and political crisis is the country’s failure to hold free, fair and credible elections. Zimbabwe is a Banana Republic, a pariah state, ruled by incompetent, corrupt, vote rigging and murderous thugs. 40 years and counting of gross mismanagement, rampant corruption and rank lawlessness have taken a heavy toll on the economy and the nation at large.

The solution to ending Zimbabwe’s crisis is self-evident – the country must implement the democratic reforms designed to end the curse of rigged elections and bad governance. Since this Zanu PF government, on its own or in a GNU, cannot be trusted to implement the democratic reforms; the 2008 to 2013 Zanu PF and MDC GNU failed to implement even one reform; Zanu PF must step down to allow the appointment of a body that will implement all the reforms.

It should be remember at this point that Zanu PF blatantly rigged the July 2018 elections, just as the party has rigged other elections in the past. The regime failed to produce something as basic as a verified voters’ roll, for Pete’s sake.

“The final results as announced by the Electoral Commission contained numerous errors and lacked adequate traceability, transparency and verifiability,” stated the EU Observer Mission final report.

“As such, many aspects of the 2018 elections in Zimbabwe failed to meet international standards.”

The July 2018 elections were flawed and illegal and therefore failed to produce a legitimate result and government. This Zanu PF is illegitimate and must step down.

The question then arises; Can President Ramaphosa, SA, SADC and AU get Zanu PF to step dow?

The realistic answer to that question has to be a no. President Ramaphosa said the July 2018 elections “Went well!” and as far as Zanu PF is concerned that was a resounding endorsement of the election as free, fair and credible and of Zanu PF’s legitimacy. SADC and AU gave a more guarded endorsement. The bottom line is SA, SADC and AU cannot withdraw their legitimacy endorsement now!

Zanu PF rigged the July 2018 elections. Of course, it was very foolish of President Cyril Ramaphosa to blindly endorsed the rigged elections. But such are the realities we are having to deal with here.

The best solution SA, SADC and AU can impose on Zimbabwe is to ask Zanu PF to form a new GNU and, fingers crossed, hope the arrangement will implement some reforms, at least. After 40 years of appeasing Zanu PF and with the nation’s very survival now at stake; no one in his/her right mind would ever accept another time wasting gimmick.

The solution to Zimbabwe’s crisis is for Zanu PF to step down so the nation can appoint a body that will implement the democratic reforms. Since SA, SADC and AU cannot ask Zanu PF to step down they must ask the UN to step in.

If President Cyril Ramaphosa, SADC and AU had joined the EU, USA, the Commonwealth and many other nations and international organisation in condemning Zimbabwe’s rigged July 2018 elections then Zanu PF’s illegitimacy would have been settled there and then.

“We cannot impose ourselves. When we have openly sort out and openly gone out and said look we have a problem in this area. Could we talk. Only when you reach that level of openness and admission that you begin to address the challenges that confront you,” explained Minister Naledi Pandor.

Yeah right! Did Minister Naledi Pandor have an open and candid discussion with President Cyril Ramaphosa before or after the latter so foolishly endorsed the rigged July 2018 Zimbabwe elections?

Indeed, Minister Pandor and President Ramaphosa must now take a generous doze of the advice they are giving and admit endorsing Zanu PF’s rigged elections was a very foolish and is at the very heart of the crisis in Zimbabwe.

The UN is the one organisation best placed to help end this crisis. President Ramaphosa, as the neighbour of Zimbabwe and current chairman of AU, is best place to ask the UN to assist. The UN will not impose itself on SA, SADC and AU particularly given the “African solutions to African problems!” mentality in some quarters.

“We cannot impose ourselves!” SA imposed Zanu PF on Zimbabwe by endorsing the rigged elections. All we are now asking SA to do is admit the folly and ask the UN to assist; that is not asking for too much!

Harare Model Ra_ped By “Facebook Friend”

By Own Correspondent| A 19 year old Harare model was raped on Thursday by a man she had befriended on social media site, Facebook.

According to the Zimbabwe Republic Police (ZRP) statement, the young woman who resides in Waterfalls was invited for modelling auditions by the man.

When the woman went for the auditions, she was raped her Facebook friend. The man was arrested and is yet to appear in court to face rape charges.

Police said in a statement:

Members of the public are warned against trusting people they meet online. This warning follows the rape of a 19-year-old woman in Waterfalls on 17/9/20 after she was purportedly invited for modelling auditions by a man she befriended on Facebook.

The man has since been arrested and will appear in court soon.

Byo Mayor Distances Self From Undervalued Land As ZACC Pounces

BULAWAYO City Council (BCC) recently offered mayor Councillor Solomon Mguni a piece of land where he intended to build six town houses for an unjustifiable amount of US$2 500.

According to council minutes, council resolved that Clr Mguni should go ahead and construct duplex flats on stand number 19789 Bulawayo Township subject to full compliance with the council regulations.

“On the recommendations of the Town Clerk, it was resolved that a development permit to construct six town houses on stand number 19789 Bulawayo Township be granted to Solomon Mguni subject to full compliance with the requirements of the director of engineering services, director of housing and community services, and any other municipal by-law requirement including payment of a once off premium of $161 700 or US$2 500,” read the council minutes.

Contacted for comment, Clr Mguni claimed the council minutes were “withdrawn from council”.

He said the proposal was rejected by the Town Lands and Planning Committee’s sub-committee on allocation of stands and premises for development.

“Of course, I applied to council for a piece of land where I wanted to develop six duplex apartments and the responsible committee rejected that proposal, saying it was not proper. It never went before full council hence there is no resolution to that effect. This matter is being resurrected because the Zimbabwe Anti-Corruption (ZACC) team is in town and they want to find some wrongdoing on my part,” he said.

“You can check with the Chamber Secretary because she is the one with all council resolutions, she will tell you that this was withdrawn before it went before full council. These guys (ZACC) are meeting tomorrow and they want to find a case against me.”

Efforts to contact the Town Clerk Mr Christopher Dube or the Chamber Secretary Mrs Sikhangele Zhou were fruitless as their phones continuously went unanswered.

Recently, there was a public outcry after BCC offered Clr Mguni agricultural land in Lower Rangemore under a 25-year lease at $165 per month rent.

Residents accused local authority officials of abusing privileges and parceling out land to cronies at what they described as ridiculously low rentals.

Some residents have widely circulated on social media an advert confirming the 25-year land lease being offered to Clr Mguni, arguing that it is tantamount to corruption.

According to the notice flighted on May 29, Mr Dube revealed that Clr Mguni has been offered a land lease in Rangemore for agricultural purposes on Lot 3 of plot 3 Lower Rangemore.

The lease is for an initial 25-year period while monthly rentals are pegged at $165, subject to review.

The notice stated that residents objecting to the proposed lease should submit their written submissions at Tower Block by June 18 at the Director of Housing and Community Services offices.

Neighbour Sells Out Three Byo Residents To The Police For Smuggling 120 TV Sets

THREE men from Nkulumane suburb in Bulawayo were yesterday arrested after being found in possession of 121 television sets which were smuggled from Botswana.

The three – Oscar and Pardon Chinanai, as well as Providence Dhaitiya – were arrested in Nkulumane 11 yesterday afternoon.

An unnamed resident notified police after spotting the three offloading the smuggled TVs into their home.

The Customs and Exercise Act defines smuggling as any importation or exportation with intent to defraud the State or evade any prohibition, restriction or regulation on the importing or exporting of any goods required to be accounted for under the Act.

Police could not readily give the total value of the recovered television sets but the three accused persons will appear in court in due course facing smuggling charges.

The smuggled smart TVs are a mixture of 25”, 32”, 42” and 70” in size.

Officer commanding Nkulumane Police Station Chief Superintendent Sherita Bizeki Nyoka applauded members of the public for helping police with information.

“We received a tip off at around 12PM from concerned members of the public concerning smuggled TVs which came through an illegal entry point in Botswana. Our members responded and managed to arrest three accused persons who were found in possession of 121 TV sets in Nkulumane 11,” said Chief Supt Bizeki Nyoka.

She said the three men who could have smuggled the goods for resale were in police custody. “We are yet to establish the total cost of the television sets but we understand that they came through an illegal entry point considering that borders are still closed,” she said.

Chief Supt Bizeki Nyoka said members of the public should continue working hand in hand with police to bring an end to criminal activities in Bulawayo.

Family Robbed Of US$47k Cash Before Being Tied Up And Set On Fire

Four robbers on Tuesday tried to kill a Marlborough family they attacked by tying them to their car seats and setting the vehicle on fire before disappearing with goods and huge sums of cash, US$47 000 and R15 000.

Daniel Tsimba (49), his wife Ropafadzo Mukamba and their seven-year-old daughter managed to untie themselves and escaped unhurt from their burning vehicle, which had been dumped at Kimcot Farm in Beatrice.

Mashonaland East provincial police spokesperson Inspector Tendai Mwanza said police were now hunting for the gang and appealed to the public for any information that would help identify the four.

According to the police, on Tuesday at around 11am, Mrs Mukamba was at her house in Malborough, Harare, when she was approached by the four robbers who pretended to be police officers investigating a fraud case.

They handcuffed her and told her that they knew she had received money from her former employer. The robbers force-marched her into the house, where they waited for her husband to arrive from work. As soon as Mr Tsimba arrived they pounced on him before demanding cash.

They ransacked the house and found US$47 000 and R15 000 plus two laptops and two Huawei cellphones, before forcing the family into the unregistered Honda Fit belonging to Mrs Mukamba.

They drove towards Beatrice and stopped at Kingston Farm.

At around 11pm, the robbers tied their victims with a rope on to the car seats, got out of the vehicle, and set it ablaze before running away.

Mnangagwa’s Son Duped US$1 500

PRESIDENT Mnangagwa’s son, Emmerson Tanaka Mnangagwa, reportedly lost US$1 500 to a bogus wedding garments supplier whom he had contracted to supply suits ahead of his wedding last year.

Samson Mavhunga (31) of Hillside, Harare, promised to deliver five men’s suits from Italy two weeks before the wedding.

He charged US$3 500 and Mnangagwa paid US$1 500 deposit, but nothing was delivered.

Mavhunga yesterday appeared before Harare magistrate Mrs Judith Taruvinga charged with fraud and was remanded out of custody to May 7 on $1 000 bail.

As part of his bail conditions, Mavhunga was ordered to report once a week to the police and to surrender his passport.

Prosecutor Mr Tatenda Mukatera alleged that sometime in May last year, Mnangagwa met Mavhunga who indicated that he specialised in making and supplying wedding suits.

Mnangagwa expressed interest since he was preparing for his wedding, which was scheduled for August 25 of the same year.

Mnangagwa then gave Mavhunga an order to supply five bridegroom’s suits which he was supposed to order from Italy.

He was charged US$3 500 and paid a deposit of US$1 500. The balance was to be paid upon delivery of the suits on an agreed date.

It later came to light that Mavhunga had lied to Mnangagwa that he had capacity to supply the said suits.

Mnangagwa asked for a refund after nothing materialised and made a police report when he failed to get his money back.

Govt Legalises Marijuana, Regulations Gazetted

It is now legal to grow, process and sell mbanje in Zimbabwe, but this does not mean throwing a few seeds in your backyard and waiting for a crop: There is a 32-page statutory instrument giving the rules and regulations that will be the bible of all involved in the business if they want to stay out of jail.

Statutory Instrument 218 Agricultural Marketing Authority (Industrial Hemp) Regulations was gazetted yesterday by Minister of Lands, Agriculture, Water and Rural Resettlement Dr Anxious Masuka, after consultation with the with the board of the Agricultural Marketing Authority and using his powers in section 50 of the Agricultural Marketing Authority Act.

The object of these regulations “is to regulate the production, procurement, distribution, possession, sale, provision and transportation of industrial hemp”.

And industrial hemp is not just mbanje, it is “the plant cannabis sativa and any part of the plant, including the seeds thereof, and all derivatives, extracts, cannabinoids, isomers, acids, salts and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis”.

That 0,3 percent limit, incidentally, cannot be exceeded. Growers have to present samples to approved laboratories and if your crop is a bit too potent, well bye-bye crop; it must be destroyed. On the other hand, your crop has to be good quality, by law, and you need to hire someone knowledgeable to be in charge of quality assurance.

Growing, researching or dealing in mbanje requires a permit. There are three types: general grower’s, research and breeding, and industrial hemp merchant’s. The application fee for the first two, and the renewal fee, is US$200. The merchant needs to fork out US$500.

The general grower can grow, process and sell mbanje products, but can only use approved cultivars and varieties and the permit can narrow what an individual holder can grow down to just one variety. The research permit holder can hold non-approved cultivars, but only for research. General hemp farmers must grow at least 1ha.

The merchant permit does not allow the merchant to grow the stuff directly, although a merchant can contract farmers to do this, but does allow the merchant to supply or procure industrial hemp within Zimbabwe, to process it into specific products laid out in the permit, and to possess industrial hemp for the purposes in the permit.

Permit holders have to be citizens or permanent residents of Zimbabwe, and that includes a majority of directors for a company although the Agriculture Minister can exempt an individual from this requirement and the AMA can exempt a company.

The application for any permit requires quite a bit of detail: three copies of the plan of the field being used, along with its geo-coordinates, proof of citizenship, permanent residence or exemption, and a declaration that the permit applicant is familiar with the provisions of the Agricultural Marketing Authority Act.

But that is just the start. The application has to be accompanied by a security clearance, for: the authorised person in charge; the responsible person in charge; the alternate responsible person in charge; the individual for an individual permit or each officer and director of the company for a company application.

And then the applicant has to describe, in detail, how they propose to keep records that ensure compliance with the regulations (and a lot of records are required), allow the AMA to audit those records, and ensure that orders and inventories of industrial hemp can be reconciled, that is no leakages from the legal marketing.

And you have to attach the fee. A separate application and fee is needed for each field.

Permits can be refused on a lot of grounds, including fake information, lack of security, official information from the police all the way up the United Nations that the applicant has been involved in the drug business, or the applicant refuses to allow a requested inspection (another US$200).

Permit holders have to make sure their fields are secure, that only those who need to be in the “cultivation area” are allowed in and that any unauthorised intrusions are recorded, including the date and time of the intrusion, the identities of the intruders and the action taken.

There has to be an authorised person in charge and a responsible person in charge, with alternates if necessary, and these people have to be approved in advance and the AMA has to be told of all changes and all changes to record-keeping.

Before anything is planted full details of varieties and the like have to be given to the AMA and after material is harvested everything has to be labelled. All residue in a harvested field has to be destroyed in seven days.

Those possessing, processing or supplying industrial hemp have to have approved premises, must destroy any mbanje plant growing in the processing area, have to label everything in detail and have to keep the AMA informed of staff changes and of any convictions for drug offences and any thefts. Detailed reports have to be given each year.

Growers have to follow good farming practices and the AMA can inspect when it likes to ensure this, and there are requirements for compulsory tests at approved laboratories and the AMA can in any case order a lab test at any time. Mbanje that flunks the tests can be ordered destroyed, although there is an appeal process.

Permit holders have to destroy plants that grow outside their approved fields and there are rules on the destruction of abandoned fields or stocks.

Destruction is covered in the regulations. It has to be done in front of five people: a superintendent or above of the police plus senior officials of zimra, Medicines Control Authority of Zimbabwe, the Justice Ministry and the AMA or Agriculture Ministry.

The regulations detail the procedure for imports and exports and devote several pages to the records that need to be kept.

Failure to follow the regulations can see permits cancelled, along with a jail sentence of four months, a level four fine or both.

Late Journalist Godwin Muzari Had “A Number Of Personal And Confidential Issues.”

Herald Entertainment Editor Godwin Muzari who died on Friday in a suspected suicide was a very distressed man, his family and work mates have revealed.

Muzari was found dead yesterday at his Retreat, Waterfalls, residence.

His elder brother, Bishop Israel Muzari, said he last spoke to his younger brother on Monday.

“He told me a number of personal and confidential issues, but I did not know that it would come to this. We did not see him from Monday and neither were we aware of his whereabouts until yesterday when I decided to check on him at his home. That was when I saw him hanging in a room,” said Bishop Muzari.

He described his younger brother as a cheerful person. “He was always jovial and we will dearly miss him,” he said.

Herald Editor Hatred Zenenga expressed shock at the demise of Muzari.

“It’s unbelievable that Muzari is no more. He had not been coming to work for a while and we started looking for him. He then showed up on Monday and Tuesday and then went away. We then got in touch with his sister who came for a meeting with us and we agreed he needed counselling. We immediately initiated the process, but little did we know Godwin had other ideas. What a loss. He was a brilliant writer. Our newsroom will be poorer without him,” said Zenenga.

Born in Harare in 1980, Muzari was the last born in a family of seven. He went to Hondo School in Mount Darwin for his primary and secondary education before attending St Francis Magwenya in Mashonaland Central for his Advanced Level studies. He then enrolled at Midlands State University from where graduated with a Media and Society Studies degree in 2005.

In 2006, he joined Zimpapers as an intern before he became an Entertainment Reporter until 2009 when he briefly left to join Alpha Media Holdings. Muzari returned as Entertainment Editor of The Herald in 2013, a position he held until his untimely death.

He is survived by a wife and three children.

Byo Residents Invite ZACC To Investigate Corruption At BCC

THE Zimbabwe Anti-Corruption Commission has descended on Bulawayo City Council to investigate alleged corruption and malpractices in the municipality, particularly issues to do with allocation and sales of council land.

A team of zacc investigators arrived in Bulawayo on Wednesday and met organisations who had raised a red flag over suspected graft at the local authority. The investigators also met Bulawayo Progressive Residents Association (BPRA) leadership and other civic society organisations, which have been voicing concern over alleged unprocedural parcelling of land in the local authority.

Sources said the zacc investigators are expected to review town clerk, Mr Christopher Dube’s contract renewal and a plot allocated to mayor Councillor Solomon Mguni today.

BPRA last week wrote to council’s land committee querying the town clerk’s contract renewal and a plot allocated to Cllr Mguni in Rangemore.

zacc spokesperson Commissioner John Makamure said although a team of investigators had been deployed, he cannot comment on the assignment.

“I can confirm that we are investigating Bulawayo City Council among other local authorities. I can’t say more, but matters are under investigation.

“I can’t say what exactly is being investigated because we don’t want to jeopardise any investigation. But our team is on the ground as we speak,” said Comm Makamure.

Mr Dube said zacc officials notified council of the investigation they were conducting.

“Yes, they had an entrance meeting with me yesterday and they are going ahead with their mission. We also have communication from the Ministry (of Local Government and Public Works) notifying the council of the same,” said Mr Dube.

Cllr Mguni said council has been notified about zacc officials who will be investigating alleged corruption in the council.

But he could not comment further on investigations since he has not met the investigating team.

BPRA coordinator, Mr Emmanuel Ndlovu confirmed meeting zacc investigators.

“We met with ZACC investigators yesterday and supplied them with information that they required regarding the mayor’s land and the town clerk’s proposed conditions of service.

“Remember we wrote letters regarding the two matters and copied ZACC.

“Their visit looks into issues that we raised,” he said.

Health Ministry Says It Is Winning Battle Against Covid-19

Zimbabwe has gone for seven days without recording a death associated with Covid-19, in a strong statement yet of the effectiveness of the country’s response.

Already, 224 lives have been claimed by Covid-19 in Zimbabwe, while over 900 000 people have died of the disease globally.

Yesterday, Zimbabwe registered 14 new cases, down from 26 cases on Thursday.

Overall, Zimbabwe has recorded 7 647 cases, although 5 883 people have recovered.

Speaking to state media on Friday, Deputy Minister of Health and Child Care, Dr John Mangwiro, commended Zimbabweans for the discipline shown in adhering to the prescribed World Health Organisation (WHO) guidelines.

“It shows the message from President Mnangagwa is now cascading down to the people,” he said.

“He has always been saying people should continue following the health protocols. I need to thank the people of Zimbabwe who have been adhering to the prescribed regulations; their discipline is beginning to bear fruit.”

Dr Mangwiro said there was need to continue observing the guidelines to remain safe from the pandemic.

He saluted all frontline health personnel for continuing to provide critical services to save lives, despite the obvious risks associated with the pandemic.

Government interventions to curb the spread of Covid-19 received a major boost when nurses ended their industrial action recently.

Motorists Scramble To Register Vehicles As Police Impound Hundreds Of Cars

Motorists flooded the police’s Vehicle Theft Squad in Harare yesterday as they sought to get the needed clearance that will allow them to obtain registration number plates, on a day when 420 cars were impounded countrywide.

Police have demanded that all vehicles on the roads should have number plates since they are now readily available, and police teams have been heavily deployed on the roads targeting unregistered vehicles.

The Zimbabwe National Roads Administration (Zinara) has joined the drive to eliminate vehicles without registration numbers through denying such vehicles passage at tollgates.

On Thursday, Zinara public relations manager Mr Tendai Mugabe advised the public to register their vehicles or otherwise they will not be allowed to pass through tollgates.

The crackdown on unregistered vehicles comes in the wake of a spate of armed robberies countrywide, with some criminals using unmarked vehicles to evade police.

Following the blitz, police indicated yesterday that they were now overwhelmed by motorists as they have capacity to clear 0nly 160 vehicles a day.

Over 12 000 pirate taxis and unregistered vehicles have been impounded.

The Vehicle Registration and Licensing Act demands that vehicles be registered and always display the registration marks and numbers.

Temporary registration number plates normally have a 14-day lifespan, which is enough to get the vehicle home and secure permanent registration.

National police spokesperson Assistant Commissioner Paul Nyathi has urged motorists to cooperate with the police.

Police commanders in all provinces were recently directed to ensure that only vehicles with number plates were allowed to pass through roadblocks and security check points.

At Southerton Police Station police were manning roadblocks and impounding such vehicles.

Most of the impounded vehicles were unregistered small cars such as the Honda Fit and police said they will only release the cars once the owners produce receipts from the Central Vehicle Registry proving that they have paid for number plates and were waiting to collect them.

Some of the vehicles were parked at the Southerton Police Station Traffic Section, while others were at the district headquarters where the Vehicle Theft Squad is also based.

The squad is a specialised section that deals with cases of theft and robbery of motor vehicles. It is also responsible for clearing of motor vehicles for registration, permission to drive outside Zimbabwe temporarily and clearance for change of ownership.

Yesterday, there was a winding queue of motorists seeking to have their vehicles cleared, ahead of registration with the Central Vehicle Registry.

At the registry in the city centre, there was another long queue of people buying registration number plates which police said are being sold for US$80.

Some motorists yesterday complained that they were being turned away by CVR officials who told them that they did not have number plates in stock, although the Ministry of Transport and Infrastructural Development insists they have enough in stock. Some were claiming there were officials demanding kick-backs ranging between US$20 and US$100, for a motorist to get registration number plates.

Police in Mutare have been impounding all unregistered vehicles since Thursday.

At the roadblock located near Mutare Teachers’ College, numerous vehicles without registration number plates had been impounded by the end of yesterday.

Motorists who spoke to The Herald said they had not been given enough time to visit the CVR offices to register their vehicles before the order to impound was given.

“We are appealing to the Government to give us more time to register our vehicles. As it is, I have been working out of town and only managed to travel today so I obviously have not had time to do it,” said one motorist, who declined to give his name.

The requirements for vehicle registration are an application form (CVR4), Customs Clearance Certificate issued by Zimra, police clearance, copy of insurance policy document, photocopy of acceptable own personal identification in the form of Zimbabwe national identity card or a valid Zimbabwe driver’s licence or a Zimbabwean passport, proof of residence in the form of rates or utility bill or bank statement, and proof of payment of import duty.

Let me be quick to say the whole idea is not to spend time explaining problems MDC A have.
The whole idea is to spend time explaining solutions.

PART A
The Party list members have a replacement criteria of s39(4) to (8) of act and the regime had thought it was a walk over and we sat down and raised 300K objectives. ZEC has a constitutional duty to respond to that. When they realised the contents of the objections they immediately issued a press statement that they are removing election restrictions. They now want to call for by elections. This is a diversionary tactic to move from objections going to election. People are planted make campaigns to people to accept by elections thereby defeating the objection. If can check they moved to councils and recalled more. Also as diversionary tactic.

This is were strategist begin to take over. Simple terms I say objections was a battle won. Do not mess it up.

How do you mess it up?

1) While Party List candidates has objection method from voters who have a way of explaining in detail the reasons behind objections; the constituency member has only voting by a by election way of replacing.

This is like finding an opinion from totally new people on a matter that is before us.
The by election does not respond to the constitutional violation by Speaker, president of senate or Minister of Local government but rather legitimise it and say there is vacancy when there is no vacancy.

2) The real reason to vote for constituency member is to choose a representative of the area for period of 5yrs. If by elections are called and accepted they will never answer the question that is before us which are:

i) Is it constitutional to create a vacancy by recalling members of another party using letters written by another party?

ii) What will stop the recall of the next person using the same method?

iii) In the first place is there a vacancy when the recall is unconstitutional.

PART B

1) Ony thick skin and those who have stamina can stand up and challenge this.
If the constitution is violated, every citizen has legal duty to stand up and resist any unconstitutional action. We deal with strategies each responding to a particular area.
i) The parliament and local government minister’s letters are responded to only by court papers and we have done so. The legal minds are dealing with it.

ii) The next part is ZEC which has potential to call for elections. Just like I said above we had a remedy of objection in party list members which is written in the act. The remedy is just a casual way of doing the same I suggest below.

iii) In terms of s233 ZEC as a chapter 12 institution has a direct duty which is its responsibility spelt out as follows

a)to support and entrench human rights and democracy.
b)to protect the sovereignity and interests of the people.

c)promote constitutionalism.

d)to promote transparence and accountability in the public institutions.

e)to secure the observance of democratic values and principles by the state and all institutions and agencies of government and government controlled entities and,

g)ensure injustices are remidied.

This is exactly what s233 demands from all chapter 12 of Zimbabwe constitution. ZEC is the first listed institution mandeted to carry out these objectives. If this matter is swept under carpet and we go to by election, from all the listed objectives of chapter 12 institution which one do you say remain as ZEC’s objective?

iv) s235 of constitution state that all independent commissions are not subject to control of anyone and no person must intefer with their function. The state must assist and protect their independence. This is just a summary of the said s235.

2) Armed with these sections that bind ZEC we build our strategy. We have noted that

a) the state insitutions have violated our constitutional political rights as in s67 of constitution.

b) that elections MUST be conducted only in accordance with electoral laws in terms of s120(2) and s 124(2) of constitution

c)that in terms of s4 of electoral act a political pact is a political party

d) in terms of s45B a candidate is what makes a member after election. By interpretation in s45B you first become a party candidate for election by process in s46 of act and after winning elections, a declaration in terms of s66 of act is made to the effect of making one a member as defined by s45B.
This declaration must state the name of the member and political party he stands for as duly elected member of a constituency.
In terms of s66(4) of act the contents of this declaration cannot be changed. So where it say “Chalton Hwende of MDC A is duly elected as member of parliament for Kuwadzana”, must stand for ever unless an order of ELECTORAL COURT changes the wording.
To say Chalton Hwende​​ of MDC T which is a member of MDC A has ceased to belong to MDC T does not create a vacancy in any way. As it stand the declaration of election 2018 is there and states that he is MDC A and MDC A has not informed parliament that he has ceased to belong to MDC A.

e) state that Clerk of parliament and all town clerks are in posession of 2018 declaration with full wording of who the members are by national identity number and political party they stand for by s66 of electoral act declaration.

f) We have noted that SC ruling and MDC Alliance agreements relied on are all not electoral court decisions or electoral laws as required by s120(2) and 124(2) therefore cannot be used for anything to do with elections by any state institution, especially were the electoral laws are clear on the facts.

g) noted that ZEC registered office bearers of MDC A who signed under oath the nomination papers of members as legally appointed officers of a party MDC A.
No one else without a declaration under oath can claim right over the party MDC A or Candidate beside the party and party representative in legal papers.

All the above are electoral law provisions which ZEC cannot address by a by election.

3) In terms of s239(k) ZEC has a constitutional function of receiving and considering complaints from public and to take such action in regard to the complaints as it considers appropriate.

As I highlited the objective of ZEC in s243, as chapter 12 of constitution ; with ZEC’s independence as in s235 of constitution and as we noted all the requirements of electoral law and the constitutional obligation to only use electoral law, we now direct ZEC to do its s239(k) function.
It cannot give any excuse.

PART C
This is where the plan begins.

First Step
Make a statement on a press conferance stating all the above.

Second step
i) Make a declaration that you shall only participate in by elections that were created by death or some other party recalls.
ii) State that in terms of constitution and all the statutes above the s66 of electoral act declarations that brought members to parliament still stand and non have met the vacant requirements of s129(1) (a-n)

iii) state that ZEC cannot be given directives by parliament or government minister to create vacancy when it holds in its records valid s66 of electoral act declarations. If ZEC accept a notice of vacancy that does not match and correspond to declarations of duly elected members it is in breach of s235(3) and taking directive from state and government , thereby defeating all the the objectives of chapter 12 institution as spelt in s233 of constitution.

iv) State that its no longer a secret that through s39(6)(b) objection submitted before ZEC the issue of illegal action by parliament and minister are before you. The information in public domain is that over 300k people objected.

v) In terms of s239 of constitution you now have to direct the speaker and minister using your constitutional powers to a matter that is clearly before you and clearly unconstitutional and electoral laws.

vi) State that any attempt to call for by election on these constituencies will be subjecting yourself and the whole institution to an MDC T constitution and its articles as well as MDC A agreement which are all not electoral laws.

Should vacancies by s129(1)(k) arise in MDC A the notification shall only and only come from MDC A because we have office bearers registered in terms of s38A under MDC A. No other person or party can act on behalf of MDC A other than legal electoral law channels.

vii) We therefore declare that in terms of s120(2) and 124(2) of constitution all the seats in questions are still valid and carry the mandate of people. We will not accept any by election to be declared on those seats and if ever ZEC declare them vacant for elections let the world know that ZEC has lost its independence and there is no value in going for elections in Zimbabwe because any law or agreement by two people can come and poop on national constitution.

viii)ZEC was not directed neither can it be directed of vacancies by individuals. Vacancies are created by law. As it stand the law has no provision for a political party which is a member of a political party to recall members neither ceasing to belong to a political party which is a member of a political party yet a ground to recall.

ix) s129(1)(k) speaks of “ceasing to belong to a party”, the constitution of the country cannot direct to a cease that no law has first register to exist. You cease what the national laws have spelt out. A conviction has to be by courts not disciplinary actions of your house, death has to have a certificate by RG office, independent member has to state it on prescribed paper which is in schedule 9 of act and party membership has be the one you chose and made an oath before a commissioner of oaths that this is your s67 of constitution political choice. Then and only then can s129(1)(k) can talk of ceasing. As it stand we just have “death certificates” while we are alive. We have not ceased to belong to MDC A so s129(1)(k) does not apply.

Finish.
We start to campaign on that and tell people if ever ZEC declare these vacant then Zimbabwe has no more constitution. If others are allowed to violet the constitution, why not others?

I Saw A Letter Written By Chigumba To Hwende.

By Mari Matutu | I saw a letter written by the Chairperson of Zimbabwe Electoral Commission to the MDC Alliance Secretary General, Chalton Hwende​​. While I have no contents of what exactly the SG had asked ZEC, from the response I will make my assumption.

From the heading it looks like a response to the objections of party-list candidates nominated by MDC T.

Whatever the SG could have said, all ZEC states is that the vacancy filling is not by instruction from MDC T but a peremptory process triggered by parliament notices given to ZEC.

I have people asking for my comment on the letter. I will not just opinionate, but put forward my comments even on by-elections.

1) ZEC is a constitutional body formed in terms of chapter 12 of the Constitution. There is a reason for its formation and existence. The objectives of all chapter 12 institutions are listed in s233 of the constitution.

They are listed a-to f. I am just going to take three objectives on why ZEC was formed and why it exists. This does not mean the other listed are not important. I want those that are direct to issues at hand.

s233 – The Independent commission have the following general objectives in addition to those given to them individually:

i) (c) promote constitutionalism.

ii) (e) to secure observance of democratic values and principles by the state and all institutions and agencies of government and government controlled entities.

iii) (f) to ensure injustices are remidied

2) Having found the above as objectives of ZEC which ZEC cannot at any time forget or miss as core to its existence, upon receipt of notice from parliament the following should have been obvious:

i) What they received from parliament was a notice. A notice is not a directive. A notice just informs you of something that has happened or is alledged to have happened.

ii) ZEC has oversight duties spelt in s233 of the constitution and as I selected the three above, one can see that it is duty of ZEC and the reason why it was formed that constitutionalism is observed: to make sure parliament as an arm of the state observe values and principles of democracy and that injustices are remedied.

iii) There is nothing preremptory about receipt of a notice of fake vacancy. It is the duty of ZEC to check the notice if it complies with the law and the constitution. Check with its records if in their records MDC T ever it had a seat in the said constituency. It has to check if the parliament has complied with all the laws of the land and observed the democratic values and principles.

iv) It is the duty of ZEC in terms of s233(f) that injustice are remedied at any stage they happen.

3) The next point is highlighting to ZEC the violations of the constitution by parliament, the electoral act provisions that were violated bringing injustice by parliament which by constitution is the duty of ZEC to secure and bring to justice

i) Senators must elected in accordance with electoral laws in terms of s120(2) and National Assembly member are elected in accordance with electoral law in terms of s124(2).

ii)s157(1) of constitution direct that there be an Act of parliament to run elections and referendums as the electoral law.

iii) s157(3) of constitution direct that the electoral law provide for the nomination of candidates to take place at least 14 days after proclamation of ection date. Polling must be held at least 30 days after nominations.

iv) The above provision directly show that from constitution itself only electoral laws which are by act of parliament and not party constitution or agreements are relevant. This is were I feel SG was saying ZEC is directed by MDC T because parliament and ZEC are guided only by constitution and act of parliament as their laws. If speaker is now holding an agreement of political parties to declare a vacancy or if a chapter 12 institution holding all information showing that MDC T never had seats in those constituencies go on to fill the seats as if there is vacancy then its taking directives from MDC T. If not for that the laws are there to respond with to MDC T’s letter or for ZEC s233 of constitution is there to respond to parliament notice with.

v) Above all s235 state it clearly that ZEC is not subject to direction and control of anyone, must act in accordance with constitution and exercise their functions without fear, favour or prejudice.
No person may interfer with their independence. If a notice from parliament can direct ZEC to fill vacancies where there is clear evidence of injustice and unlawful actions then where is the independence of ZEC. It is clear that ZEC has taken away the jacket of a commossion to become a polical conduit of sections of political parties fighting against MDC A.

4) The following electoral laws are clear to this matter and enough to decide without inviting any party agreement or constitution or SC ruling.

i) s2 Of Electoral act says it all that the act is only for elections non of it must be used for settling political and civil duties
ii) s4 of Act interprets a political pact as a political party such that nobody must ever bring any interpretation of what MDC A is which is an intepretation not from electoral law.
iii) s38A state it clearly that only political parties that come forward and show interest to contest and submit names of office bearers are recognised as political parties in electoral laws. The office bearers have roles that are stipulated in the Act and they make declarations under oath. MDC A had such office bearers who signed nomination papers for MDC A.

iv) s45B interprets what is a constituency candidate. This shows clearly that before one becomes a member you first have to be a candidate. This takes us back to s157(3) of constitution where it says the electoral act must provide for a law on nomination to be done 14 days after date of election. This is the official period of the act where candidates look for political parties of their choices as stipulated by constitution of the land. Now all what is given as October 2017 agreement used to nominate candidates is far away from period of nominations such that it can be inferred that it ever happened for purpose of election. The signatory mentioned in the document died well before the date of elections. That agreement does not show how MDC T presented itself to ZEC as willing to contest election as required by s38A. The document does not show how MDC T registered its office bearers to sign nomination papers for candidates. Above all it does not show us the relationship that was there between the said candidate and MDC T on a sworn paper.

v) The s157 (3) set periods shows us that after elections date has been announced next there is nomination time which make up a candidate. This is the official state of whom you are before election. The party that the candidate belong to in this period from day after nomination to election is the only stipulated period before election that can be used for electoral law purposes. You cannot use October 2017 in July 2018.

vi) The nominations are done on a prescribed form. One which the law state the details. In particular these members chose MDC A which was a party registered by ZEC in terms of s38A. Some members from MDC T of 2017 who were so vocal in impeachment of Mugabe declared that they had no political party. They were not MDC T or MDC A yet there were MPs in 2017 when the agreement was signed. The point is political choices are made during the stipulated time and by way of choice made on a prescribed form. In this case these chose MDC A as theirs before election and by s45B they became candidates.

vii) s45B further interpret a constituency member as on elected for a constituency and party list seats as those elected for seats allocated for party list.
Clearly it shows that event before one becomes a member of Parliament is candidate. The event before one becomes party member is party candidate.
The official document of membership is election declaration and the official document to show joining of the party is nomination paper. s129(1) Should any MEMBER OF PARLIAMENT cease to belong to that which the law established as the way of being a member then he or she must be recalled again by the party.

viii) What is constitutional in receiving a letter from a party that is not on one’s election declaration and use the party name that is not on declation and say you have ceased to belong to it. Assume you have ceased to belong to MDC T by article 5.10 of its constitution, how does that explain ceasing to belong to a party that you were belonging at time of election?

ix) s66(4)State it clear that no one can change the election declaration except an electoral court after a petition. No electoral court or petion has sat to say that these MPs were MDC T members which is a member of MDC A hence if they cease to belong to MDC T then s129(1)(k) apply.

x) The whole of s129(1) has no provision where a vacancy is created by ceasing to belong to a political party A which is a member of B. As far as law shows MDC T contested election against MDC A each as political party.

xi) s161 of electoral law establishes an electoral court and its jurisdiction. s161(2) give the electoral court exclusive jurisdiction over appeals, applications or petitions in terms of electoral act. The SC ruling was a civil division matter between MDC T members on matters of who was to take over Tsvangirai in February2018. This had nothing to do with elections because even then no election date had been set then. It never as an electoral court at all and the matter was never electoral law matter. Again should it be established that Khupe was to succeed Tsvangirai but still their party had to present it self for election and register office bearers. There was also no law that precluded Chamisa from standing as a candidate and Khupe as candidate and all as MDC A candidates.
xii)s191(1)(b) requires only ZEC to provide laws that guide the elections to public. If it was a law to guide us as voter ZEC should have provided the copy Alliance agreement to us the public and decide with full knowledge.

5) I conclude and say the party must use this letter to respond now at a prrss conference and tell the world that ZEC has lost the constitutional mandate. Filling of vacancies by by election or s39(4) does not address the following questions which will alwsys be there
i) Is it constitutional for a party A to write letter of recall for party B
ii) Is it constitutional to refer to SC ruling or party agreements or constitution which are not electoral laws or courts and direct electoral process which must only be done by electoral laws
iii) What will stop another event like that from happening.
iv) What does ZEC’s independence serve if it is for rubber stamping thefts.

I hear that the likes of Ruhanya and others are calling for rebrsnding of the party. These are talking from corporate law point of view. They also limit themselves to law yet a mitary junta does not operate that way. It unfortunate our leaders being lawyers contitue to seek advise of lawyers. It does not add value.

At this juncture rebranding is no option for following reasons

i) Mnangagwa’s challenge is legitimacy. He got 2/3rds majority so do not think he wants more seats. He want an opposition to present to the world.

Ii) Chamisa’s challenge is in 2018 election results. This is the political currency that he must never throw away at least for duration of term.
iii) Once you rebrand you show a weakness to electorate that you have no spine to fight and defend its mandate, you show weakness to international community that you cannot stand up. Above all the strenght in opposition is in mismanagement of things. Trust me all those being spared in parliament are not yours but capital for establishing a puppet opposition.

iv) What ever brand you bring they just rig and give Khupe the votes.

Why do we give in easy like that. The law is on our side. I fail to trust such advisors. Stand up and defend our vote.

UZ Student Rapes Niece During Lockdown

A 21-year-old University of Zimbabwe student has been brought before the court accused of r_ping his niece.

The suspect, Terrence Musekiwa, was not asked to plead when he appeared before Harare magistrate Judith Taruvinga who released him on $1000 bail and strongly warned him not to interfere with State witnesses till the matter is finalised.

The court heard that in April this year just after the first 21 days of the national lockdown, Musekiwa and the complainant were at home while her parents were at work and her siblings were playing outside.

Musekiwa reportedly told the complainant to take her books to his bedroom so that she would study under his supervision and when she entered the room, he reportedly told her that he loved her and she kept quiet.

He then pushed her onto the bed and took off her clothes and r_ped her but she didn’t scream because he had told her that he would beat her up if she did, the court heard.

After the incident, he further threatened the complainant that if she confessed ‘to any living soul’ that she had been r_ped, he was going to beat her and that if asked she should say that she had consented to have sexual intercourse with him.

The complainant is said to have gone away and cried but didn’t tell anyone about it and he continued to r_pe her on several occasions.

The court heard that the matter came to light on August 6 when the complainant told her mother that she had v_ginal thrush and when she asked to see it, she confessed that she had been r_ped by Musekiwa leading to his arrest.

Five Zimbabwean artists have been nominated for the African Musik Magazine Awards (AFRIMMA) set for the 15th of November in Dallas, Texas.

The prestigious awards saw Zimbabwe’s Ammara Brown, Shashl, Gemma Griffiths, and Shasha being nominated among other female powerhouses in the Best Female Musician Southern Africa category.

Afro-pop star Ammara Brown, who scooped an AFRIMMA award in 2018, is ecstatic after being nominated for the third year in a row.

Domestic Dispute Turns Nasty As Wife Burns Hubby’s Manhood

A 23-YEAR-OLD Goromonzi man is battling for life at Marondera Provincial Hospital after his wife allegedly poured hot cooking oil on his manhood following a domestic dispute.

Moreblessing Muteswa (23), of Tafirenyika village under Chief Chikwaka, is expected to appear in court soon over the attempted murder of her husband, Tinotenda Mutsetse.

Mashonaland East provincial police spokesperson Inspector Tendai Mwanza confirmed the incident.

According to police, on September 13 at around 4pm, Muteswa gave her husband US$5 to buy meat before he proceeded to Majuru Business Centre, where he bought beer.

The complainant returned in the evening visibly drunk without the relish, resulting in a fistfight.

The following morning, a fight broke again between the two, resulting in the suspect pouring hot cooking oil on her husband’s manhood.

Mutsetse sustained serious burns and was rushed to Marondera Hospital, while his wife was arrested and charged with attempted murder.

420 Cars Impounded Countrywide As Police Clampdown On Unregistered Vehicles

Motorists flooded the police’s Vehicle Theft Squad in Harare yesterday as they sought to get the needed clearance that will allow them to obtain registration number plates, on a day when 420 cars were impounded countrywide.

Police have demanded that all vehicles on the roads should have number plates since they are now readily available, and police teams have been heavily deployed on the roads targeting unregistered vehicles.

The Zimbabwe National Roads Administration (Zinara) has joined the drive to eliminate vehicles without registration numbers through denying such vehicles passage at tollgates.

On Thursday, Zinara public relations manager Mr Tendai Mugabe advised the public to register their vehicles or otherwise they will not be allowed to pass through tollgates.

The crackdown on unregistered vehicles comes in the wake of a spate of armed robberies countrywide, with some criminals using unmarked vehicles to evade police.

Following the blitz, police indicated yesterday that they were now overwhelmed by motorists as they have capacity to clear 0nly 160 vehicles a day.

Over 12 000 pirate taxis and unregistered vehicles have been impounded.

The Vehicle Registration and Licensing Act demands that vehicles be registered and always display the registration marks and numbers.

Temporary registration number plates normally have a 14-day lifespan, which is enough to get the vehicle home and secure permanent registration.

National police spokesperson Assistant Commissioner Paul Nyathi has urged motorists to cooperate with the police.

Police commanders in all provinces were recently directed to ensure that only vehicles with number plates were allowed to pass through roadblocks and security check points.

At Southerton Police Station police were manning roadblocks and impounding such vehicles.

Most of the impounded vehicles were unregistered small cars such as the Honda Fit and police said they will only release the cars once the owners produce receipts from the Central Vehicle Registry proving that they have paid for number plates and were waiting to collect them.

Some of the vehicles were parked at the Southerton Police Station Traffic Section, while others were at the district headquarters where the Vehicle Theft Squad is also based.

The squad is a specialised section that deals with cases of theft and robbery of motor vehicles. It is also responsible for clearing of motor vehicles for registration, permission to drive outside Zimbabwe temporarily and clearance for change of ownership.

Yesterday, there was a winding queue of motorists seeking to have their vehicles cleared, ahead of registration with the Central Vehicle Registry.

At the registry in the city centre, there was another long queue of people buying registration number plates which police said are being sold for US$80.

Some motorists yesterday complained that they were being turned away by CVR officials who told them that they did not have number plates in stock, although the Ministry of Transport and Infrastructural Development insists they have enough in stock. Some were claiming there were officials demanding kick-backs ranging between US$20 and US$100, for a motorist to get registration number plates.

Police in Mutare have been impounding all unregistered vehicles since Thursday.

At the roadblock located near Mutare Teachers’ College, numerous vehicles without registration number plates had been impounded by the end of yesterday.

Motorists who spoke to The Herald said they had not been given enough time to visit the CVR offices to register their vehicles before the order to impound was given.

“We are appealing to the Government to give us more time to register our vehicles. As it is, I have been working out of town and only managed to travel today so I obviously have not had time to do it,” said one motorist, who declined to give his name.

The requirements for vehicle registration are an application form (CVR4), Customs Clearance Certificate issued by Zimra, police clearance, copy of insurance policy document, photocopy of acceptable own personal identification in the form of Zimbabwe national identity card or a valid Zimbabwe driver’s licence or a Zimbabwean passport, proof of residence in the form of rates or utility bill or bank statement, and proof of payment of import duty.

The marauding Zanu PF youths severely bashed ZINASU leaders as police officers watched.

The rowdy youths also attacked journalists covering the event and reportedly seized mobile phones and cameras belonging to some of the reporters.

They chased after a female reporter from Techmag TV as she sought cover inside her car, they took her car keys and handbag among other valuables which have not been recovered to date.

“The Zanu PF hooligans violently disrupted the ZINASU media briefing and they also attacked journalists covering the event,” a source told ZimEye.com.

The police did not act but kept protecting Impala Car rental premises.

Asked by one of the reporters who lost his gadgets on why they did not act or arrest the attackers, one of the police officers who was commanding the operation said they had no jurisdiction over the area as it fell under Rhodesville.

Pauline Nyamizinga is nursing injuries after he was reportedly attacked by the footballerfor confronting him over a series of cheating allegations last week.

Pauline told H-Metro on Thursday that the defensive midfielder , who belongs to CAPS United but currently on loan at Mambas, has been ‘playing’ hard on her.

“This has been happening for a long time, besides this recent incident. I tolerated it for so long but I have reached a point that I am now afraid that he can hurt me more or kill me.  People should now know how we have been living,” said Pauline.

Contacted for comment, Nyamupfukudza acknowledged that Pauline is his wife and that they have a dispute.

He, however, declined to comment saying he will give comment later, which he failed to do.

“Oh okay. Yes, I know her. But I need to think of what to respond to that issue.

“Can you call me later or I will come back to you,” he said.

Narrating her ordeal, Pauline said a misunderstanding ensued when she saw WhatsApp chats of Nyamupfukudza and his alleged girlfriends.

“What happened is I went to our rural area and when I came back our child was playing with Kudzai’s phone.

“So I took the phone like any other wife would do and I encountered his messages with some girls and started taking pictures of the chats while he was asleep.

“I then went to his brother’s place that same night since I was very angry but his brother insisted on us going back to our house for counselling.

When we arrived home, he didn’t want all of that. So I decided to find somewhere to go with my child to avoid unnecessary disputes,” said Pauline.

Pauline alleged that Nyamupfukudza punched her and knocked her to the ground when she decided to leave the house during the night.

“So I decided to take keys since he had an option of just locking from inside sleep. So he followed me and demanded the keys and started assaulting me.

“He knocked me to the ground and took the keys. I then phoned his brother who took me to their relative’s place,” she said.

The fed-up woman accused the footballer of being a serial cheater and that he reportedly turns violent when confronted.

“He is used to harass and assault me whenever I confront him about his cheating habits. We have a home together, we have a kid, he is loving and caring to his child but the fact that after cheating me he then assaults me, ndiri kutsva kumusana nepadumbu.

“I have been in pain for so many days now. My love for him will leave me crippled.

ZACC Descends On Byo, Takes Mayor For Questioning

THE Zimbabwe Anti-Corruption Commission (Zacc) has quizzed Bulawayo City Council managers and the Mayor Councillor Solomon Mguni as it probes alleged corruption in the sale of stands as well as in procurement processes.

The investigating team arrived in Bulawayo on Wednesday to start the investigations.

The Bulawayo Progressive Residents Association (BPRA) raised a red flag in what it believed was undue distribution of land to council officials.

Among others, the residents pressure group queried how the mayor was offered a plot in Rangemore and questioned the proposed allocation of a stand to Bulawayo Town Clerk Mr Christopher Dube, under his conditions of service, ahead of the renewal of his contract.

The anti-graft team met with residents associations among other civil society organisations to kick-start the investigations.

The Zacc team is said to have started questioning council officials on Thursday and continued yesterday.

The investigators are said to have asked for some paperwork on council resolutions.

Cllr Mguni has been in the spotlight after council offered him a plot in Rangemore at a time when some urban councils elsewhere across the country are accused of illegal parcelling of land among other corruption activities.

Cllr Mguni said the Zacc team was not just investigating what residents perceived as irregular allocation of land but the investigation was all encompassing.

“It was basically about prevention of corruption by checking systems compliance to combat corruption. They touched on a number of issues that affect service delivery such as land sales, housing, procurement, health and water provision which affect the image of the city,” said Cllr Mguni.

He said the council was happy to receive the anti-graft commission in the city.

“We have now been given audience unlike before where people were relying on social media. Now we have an independent arm of Government coming in to get first hand information, to gather facts and not to conclude on speculations from social media users and outsiders. Whatever decision is going to be made is from an informed position and we also have been given an opportunity to give our side of the story,” he said.

Mr Dube said: “I can’t comment on Zacc investigations and outcomes of such investigations. May you kindly seek a comment from Zacc, it has its communication protocols and I can’t be seen to be talking on their behalf.”

Zacc spokesperson Commissioner John Makamure said it was too early to comment on the outcomes of the investigations.

“Investigations continue. The commission cannot share findings when investigations are yet to be completed,” said Comm Makamure.

Sources within council said the Zacc team interviewed not just the mayor and town clerk but others as well.

“They engaged all the heads of departments and senior managers in their investigations. It was not a witch hunt but they were professional in their investigations. We hope to hear the outcomes of their investigations soon,” said the source.

BPRA coordinator Mr Emmanuel Ndlovu said council’s bid to offer the Town Clerk another stand in the upmarket Selbourne Park suburb was unreasonable and ridiculous.

Mr Dube’s four-year contract is set to expire on September 30 but council has renewed it by another four years.

“As residents we are worried about the terms and conditions of renewal of the Town Clerk’s contract. Council was proposing to offer him 2,4 hectares at Selbourne Park adjacent to another property that he got from the same suburb when his contract commenced. We are saying this is a ridiculous endeavour and it is not reasonable to make those demands as part of his conditions of service,” said Mr Ndlovu.

“However, when Zacc went to investigate they discovered that the council has since reversed it.”

According to an extract of the council minutes dated August 7, 2020, the proposed conditions of service for the Town Clerk, in his renewed contract of employment effective October 1, 2020, were deliberated on by the General Purposes committees at its meeting held on July 29.

The committee resolved to recommend to council that the Town Clerk be offered a commercial stand, specifically Stand No. 14661 measuring 2,4407 hectares in Selbourne Park. The value of the stand was not stated.

The piece of land is adjacent to Stand No. 14662 which Mr Dube was offered as part of conditions of service in his initial contract, which is set to expire on September 30.

It was also resolved that the Town Clerk should be offered to buy his official vehicle at 25 percent of the netbook value at the end of his contract or termination through mutual agreement or for any other reason before it naturally comes to an end.

“However, because of the prevailing adverse economic conditions, which may make it difficult for council to buy another car for him, the Town Clerk proposed that he be offered one of the Bulawayo Water and Sewerage Services Improvement Project (BWSSIP) project vehicles, an Isuzu twin cab truck at 25 percent netbook value considering that the project would have been completed by end of 2021,” read the council minutes.

The committee resolved that the report on the conditions of service proposed by the Town Clerk be deferred to a later date to allow councillors to have time to digest the matter.

Mr Ndlovu, on behalf of BPRA, recently wrote a letter to the BCC’s Town Lands and Planning Committee venting his organisation’s anger at the council’s decision to offer Mr Dube the commercial stand, arguing that he already had one, which he was offered in his initial contract.

“We are very disturbed and concerned with this growing trend of council officials being given land when more than 121 000 residents remain on the council housing waiting list with no prospects of getting any land. To us, this comes across as criminal abuse of office as defined in section 174 of the Criminal Law (Codification and Reform) Act,” he said.

“We are of the view that there has been a noticeable trend between the Town Clerk and the Mayor doing each other favours at least reciprocal, one after the other.”
Mr Ndlovu said residents felt there was a need for the Town Clerk and the Mayor to declare what they already own in line with the Declaration of Assets and Interests Policy adopted by BCC and Section 198 of the Constitution.

Impala Car Hire Defies Court Order.

Impala Car rental has reportedly defied a court order to turn over personal details of its client who hired out the Ford Ranger used in the abduction of journalism student Tawanda Muchehiwa.

This followed a High Court application which was granted for Impala Car rental to avail details including route maps used by the vehicle during the abduction of Muchehiwa.

The Sheriff of Zimbabwe executed the order on September 11.

“Respondent’s offices were attended and we spoke to Impala’s general manager Viola Chirata who said they do not have any documentation relating to the hiring of Ford Ranger AES 2433 since all the documents have been surrendered to Braeside Police Station.” the sheriff said.

Separately, Impala’s lawyers Mudimu Law Chambers wrote to the Sheriff stating that “the file was seized by police” and “the motor vehicle which you inspected has no tracker.”

This contradicts what Impala Car rental owner Thompson Dondo told SABC News that all his vehicles had trackers fitted to monitor how they are used by clients.

Yesterday, scores of journalists were attacked and had their cameras stolen while covering a press conference by the Zimbabwe National Students Union near Impala Car rental.

ZINASU student leader Takudzwa Ngadziore was heavily assaulted and later handed over to the police by plain clothes thugs who were hired to disperse the press conference.

BULAWAYO has recorded a sharp increase in the number of teenage pregnancies involving girls as young as 12.

According to statistics from Mpilo Central Hospital, one of the two major health institutions in the city, children aged from 12 to 16 years now account for about 30 percent of deliveries.

Teenagers, despite mental immaturity, have under-developed pelvises which increase the risk to obstructed labour, maternal deaths, paralysis and obstetric fistula.

Early sexual engagement also increases the risk of girls suffering cervical cancer which is the leading cancer in Zimbabwe and one of killer diseases among women.

Reports also show that when a girl falls pregnant, they drop out of school and eventually give up on their studies.

According to the United Nations Population Fund (UNFPA), early sexual debut and sexual abuse of female adolescents increase the girls’ risk to unintended pregnancies, sexually transmitted infections including HIV and psycho-social challenges in their lives.-Chronicle

More Details Emerge On The Attack Of ZINASU Members And Journalists Near Impala Car Rental

Following Friday’s attack on journalists and members of the Zimbabwe National Students Union (ZINASU) by plain clothed security personnel near Impala Car rental, Pachedu has unmasked one of the vehicles used by the thugs in their evil deeds.

The Toyota Noah, according to Pachedu was first spotted outside Impala Car rental at 1037hours before the students arrived to hold their press conference.

There were other vehicles including two Nissan Navara, a Land Cruiser that were milling around the Impala car rental premises ahead of the press conference.

“The Toyota Noah used by State thugs to abduct ZINASU President Takudzwa Ngadziore was first spotted outside Impala Car rental at 10:37am before the student activists were on the premises.

“More than 15 armed Police officers were also later dropped off,” said Pachedu.

No COVID-19 Deaths In Zimbabwe For One Week

ZIMBABWE has gone for seven consecutive days without recording any Covid-19 deaths amid reports that 35 new cases were recorded on Thursday.

Statistics from the Ministry of Health and Child Care show that the last two Covid-19 deaths were recorded on September 11 bringing the total number of deaths to 224.

Since the outbreak of the disease locally on March 21, 7 633 people have been infected and by Thursday, 77 percent of them had recovered.

The first Covid-19 death in Zimbabwe was recorded on March 21 after 30-year-old Zororo Makamba succumbed to the virus at Wilkins Hospital in Harare.

Harare remains the hardest hit province, accounting for 120 of the total deaths recorded in Zimbabwe and 3 219 of the confirmed cases.

Bulawayo on the other hand is the second most affected with 1 381 cases, 1 222 recoveries and 42 deaths followed by Matabeleland South with 757 cases, seven deaths and 574 recoveries.

Matabeleland North has the least confirmed cases in the country with 126 cases, three deaths and 107 recoveries followed by Mashonaland Central which has 181 cases, four deaths and 171 recoveries.

“No death was recorded in the last 24 hours and the 7-day average for the new cases goes up from 24 to 26.

A total of 35 new cases were recorded in the last 24 hours and two of them are returnees, one from Namibia and the other from South Africa,” read the statement from the Ministry.-Chronicle

ZION Christian Church leader Nehemiah Mutendi, one of President Emmerson Mnangagwa’s closest allies, yesterday warned that the high levels of hunger in the country could trigger mass uprisings, hence the need for government to urgently address the issue.

Mutendi told Mnangagwa during a tour of Mbungo Estate in Masvingo that it was too risky for the nation to depend on donor food handouts, adding “a hungry man is ungovernable”.
“A hungry man is ungovernable. How can the nation depend on donations when we have our land?” he asked.

Besides high levels of poverty characterised by food shortages, job losses, currency volatility, Mnangagwa’s tenure has also been rocked by allegations of gross human rights abuses which have triggered recurrent opposition-led protests against his government.

Mutendi’s warning came at a time the World Food Programme has raised the red flag over food security in the country, once regarded as the breadbasket of southern Africa.
The United Nations agency has launched a campaign to raise more than US$250 million in emergency aid for starving Zimbabweans.

In a joint report released in April, the European Union, the Food and Agricultural Organisation, United Nations Office for the Co-ordination of Humanitarian Affairs, Unicef, United States Agency for International Development and World Food Programme said over seven millions Zimbabweans were food insecure.

Mutendi, who once told Mnangagwa that he should work with opposition MDC Alliance leader Nelson Chamisa to keep him under check, said there was urgent need to address the food situation in the country.

He, however, said some of the food shortages were engineered by Zanu PF rivals to incite anti-government protests.“It is a ploy by enemies to make people hungry and angry,” Mutendi said.

“This is no time to wait to be given a job by someone. You say there are no jobs when you have land. Why wait when you have land? Even on your small yard, plant something,” he added.

In his brief address, Mnangagwa, who denies that the country is in a crisis, accused the opposition of criticising him without proffering solutions to the problems facing the country.

“We have people in this country who just shout from morning to dusk talking of human rights.

They do not have time to see the good in their country. They look for the negatives.

We have organisations that do not preach peace, but violence,” he said.

Exam classes are supposed to commence on the 28th of September. We can no longer afford transport to our duty stations, to buy basic foodstuffs, to pay for rentals, water, electricity bills and other essential services now priced in USD.

Our paltry salaries in RTGS cannot sustain us for a whole month or even a week. We hereby declare incapacitation.

We request an urgent review of our salaries in United States Dollars, USD or RTGS at the prevailing Interbank rate (with a monthly review) from the government.

We urge the employer to come up with an urgent solution to avert our situation.

Full Text: MDC Alliance Statement On Gukurahundi Atrocities

GUKURAHUNDI REBURIAL PROCESS MUST ADDRESS HISTORICAL INJUSTICES

We note with concern plans by the State to fast-track exhumations and reburials of Gukurahundi victims before there has been any accountability for the massacres and without the consultative participation of all stakeholders, particularly survivors and victims. Over 20 000 people were killed during Gukurahundi in Matabeleland and the Midlands between 1983and 1987. Most of the victims were buried in shallow graves.

However, over three decades later, there has been no formal acknowledgement or apology from the State for the commission of this genocide and the grave atrocities that took place. The perpetrators have never been brought to book.

The proposed reburials constitute the first indirect, official acknowledgement of the atrocities.

While the reburial of the victims is important, the surviving relatives’ and other key stakeholders must be heard and consulted on how the process should be carried out. The communities that were affected must play a central role in the reburials through their traditional leaders and churches. Truth-telling and justice must accompany any redress for survivors.

The evidence associated with the atrocities must be carefully managed. This is the only way we can ensure that there is full closure on this important national issue.

We call for a transparent, comprehensive, inclusive, gender-sensitive and consultative transitional justice process for the victims and survivors of Gukurahundi. The process should be victim-centred and must involve representatives of all stakeholders including the traditional leaders, the surviving victims, rights based groups, the Church and civic society. Reburials must be a part of this comprehensive process, not a standalone initiative.
The MDC Alliance stands for restorative justice, rehabilitative justice and, in appropriate cases, restorative justice.

Reburying the victims without healing, justice, truth telling and reparations will undoubtedly result in the wounds resurfacing in the future to the detriment of nation building, lasting peace and reconciliation.

Commuter Uses Snake As “Face Mask”

The commuter and his reptilian mask, which was wrapped around his neck and mouth, were seen on a bus from Swinton to Manchester on Monday.

One passenger, said she thought the passenger was wearing a “funky mask” until she spotted it slithering over hand rails.

The eyewitness, who asked to remain anonymous, said she found the incident “really funny”, adding the animal did not seem to be bothering any of her fellow passengers.

Transport for Greater Manchester said a snake was not a valid face covering.

Using a face covering on public transport is mandatory, except for children under the age of 11 or those who are exempt for health or disability reasons.

A Transport for Greater Manchester spokesperson said: “Government guidance clearly states that this needn’t be a surgical mask, and that passengers can make their own or wear something suitable, such as a scarf or bandana.

Cop Sues Police Commissioner General

A TOP cop who was recently acquitted on charges of allegedly stealing guns, more than 180 live bullets and an assortment of related weaponry from the police armoury has taken his boss, Police Commissioner-General Godwin Matanga to court challenging an imminent disciplinary hearing.

David Fugao (age not given), the officer-in-charge of the ZRP provincial armoury in Matabeleland North, was jointly accused with Wonder Tawanda Karamba (33) and Francis Chaterera (39), of theft and criminal abuse of duty as public officers.

They were arrested last year in March after detectives from the Criminal Investigations Department homicide section received information that there were suspicious movements of firearms at the armoury.

The detectives through investigations found out that some police officers were allegedly removing firearms that are subject to a handover-takeover from the armoury to a backyard room.

This was discovered following the arrest of Fugao after he was implicated by a suspected armed robber, Ame Mpala, who was arrested with an AK-47 rifle along the Bulawayo-Beitbridge Road.

Fugao, through his lawyers VJ Mpofu and Associates, filed an application for review at the Bulawayo High Court citing Comm-Gen Matanga and Hwange magistrate Ms Barbara Phiri as respondents. In his founding affidavit, Fugao said Comm-Gen Matanga’s decision to convene a suitability board was irrational and malicious given that he was acquitted of the charges of theft and criminal abuse of duty.

“On August 31, 2020, I was informed by the officer commanding district in Hwange that a suitability board was to be convened in order to determine whether I was suitable to remain in the police or not. In the circumstances, I found the decisions marred by malice, bias and procedural irregularities,” he said.

Fugao argued that the imminent disciplinary hearing comes at a time when he was acquitted by Ms Phiri.

He said upon his acquittal, he was shocked when Ms Phiri warned him that he should in future record rifles in the occurrence book yet he was not convicted.He said the magistrate erred by issuing that warning, which his boss is now using as a basis to convene a board of suitability.-Chronicle

Political analyst Kimberely Tariro Mamhende said, “Zanu PF is using intimidating tactics such as arresting political opponents such Godfrey Kuraone, Jacob Ngarivhume, Mrs Mugidho among other. This is satanic and uncalled for in mature democracy.”

Senator Marava, encouraged MDC Alliance members not to join MDC T party led by Khupe. He argued that MDC T led by Khupe is Zanu PF proxy employed by Zanu PF to destroy MDC Alliance.

On the other related story, MDC T presidential hopeful at the forthcoming extraordinary congress Senator Elias Mudzuri was rejected in Chivi South.

There is growing infighting in MDC T led by court appointed president Khupe.

MDC T presidential hopefuls Mwonzora, Komichi, Khupe and Mudzuri supporters have been engaged in both verbal and physical fights as extraordinary congress dates are drawing nearer.

In Masvingo, there 3 MDC T camps that are visible: Mwonzora, Komichi and Mudzuri factions.

Khupe faction is non-existing in Masvingo.

ZIFA Given Up To Sunday To Settle Issue Of Stadia Ban

The Zimbabwe Football Association (ZIFA)’s grounds inspection committee has up to this Sunday to produce a report to CAF on progress made in the renovations of stadiums in the country, it has emerged.

All arenas in the Zimbabwe are currently banned by the regional body due to their failure to meet required standards, a setback which might force the Warriors to host Algeria in the AFCON qualifier slated for November, at a neutral venue.

According to The Herald, ZIFA have up to Sunday to present the report of  what has been done at the National Sports Stadium and Babourfields in terms of renovations, with the continental governing body then determining, based on the submitted report, if its necessary to dispatch an inspection team.

“We are done with the inspections at the National Sports Stadium and Barbourfields and we have compiled a report that is going to be sent to CAF,’’ said Mabhena,” the head of the ZIFA grounds inspection committee Piraishe Mabhena told the publication.-Soccer 24 Zimbabwe

“The COVID-19 pandemic has reminded all of us of the vital role health workers play to relieve suffering and save lives,” said Dr Tedros Adhanom Ghebreyesus, WHO Director-General. “No country, hospital or clinic can keep its patients safe unless it keeps its health workers safe. WHO’s Health Worker Safety Charter is a step towards ensuring that health workers have the safe working conditions, the training, the pay and the respect they deserve.”

The pandemic has also highlighted the extent to which protecting health workers is key to ensuring a functioning health system and a functioning society.

The Charter, released today for World Patient Safety Day, calls on governments and those running health services at local levels to take five actions to better protect health workers.

These include steps to protect health workers from violence; to improve their mental health; to protect them from physical and biological hazards; to advance national programmes for health worker safety, and to connect health worker safety policies to existing patient safety policies.

Mounting reports of infections, illness and attacks among health workers fighting COVID-19

COVID-19 has exposed health workers and their families to unprecedented levels of risk. Although not representative, data from many countries across WHO regions indicate that COVID-19 infections among health workers are far greater than those in the general population.

While health workers represent less than 3% of the population in the large majority of countries and less than 2% in almost all low- and middle-income countries, around 14% of COVID-19 cases reported to WHO are among health workers. In some countries, the proportion can be as high as 35%.

However, data availability and quality are limited, and it is not possible to establish whether health workers were infected in the work place or in community settings.

Thousands of health workers infected with COVID-19 have lost their lives worldwide.

In addition to physical risks, the pandemic has placed extraordinary levels of psychological stress on health workers exposed to high-demand settings for long hours, living in constant fear of disease exposure while separated from family and facing social stigmatization.

Before COVID-19 hit, medical professionals were already at higher risk of suicide in all parts of the world.

A recent review of health care professionals found one in four reported depression and anxiety, and one in three suffered insomnia during COVID-19.

WHO recently highlighted an alarming rise in reports of verbal harassment, discrimination and physical violence among health workers in the wake of COVID-19.

Mdc Alliance Namibia is solidly behind the amplification of rural voices through the sensitive program promoting branch supremacy in the party.

The polling station based branches shall successfully fight against voter apathy in marginalised areas in the motherland.

We are greatly inspired by our vibrant national organiser Hon Amos Chibaya who is invading rural constituencies spreading the doctrine of social democracy.

This is a demonstration that the attempt by Zanupf terrorists and their surrogates to divert our attention from real issues never worked and it will not work.

We are not going to be diverted by Zanupf lite into petty issues, we shall remain glued to the stinking corruption and gross misgovernance.

The party will continue recruiting and mobilising for 2023 elections, we are now aware of their exhausted baboon tactics.

Furthermore, the idea behind the program is to make sure that there is active citizenry democratic participation of the rural folk.

As a people’s project,we are committed and dedicated to invest our human and financial resources to conscientise and strengthen our structures in rural areas where we have a great populace. In any national democratic revolution, peasants play a fundamental role in the emancipation of their society. Mdc Alliance is a pro-poor party hence it is our moral obligation to prepare our people for poverty liberation through voting responsibly. We are genuinely supporting the cultivation of the revolutionary commitment to avert low voters’ participation.

Moreover, Mdc Alliance Namibia has the political conviction that rural constituencies play a significant role to usher complete transformation in Zimbabwe. We eulogise our astute leader, President Advocate Nelson Chamisa for appointing Hon Happymore Chidziva as the secretary for rural mobilisation. The youthful leader is going to spearhead more recruitment of leadership and membership. It is also critical for our party to ensure that members are immune from the tradition of intimidation, torture and the abuse of traditional leaders who are always manipulated by Zanupf stomach politicians during bloody general elections.

In a nutshell, as a district, we shall assist in the recruitment and mobilisation of our rural constituencies. The party is encouraged to guarantee security of membership and leadership through electoral and security sector reforms. Mdc Alliance Namibia believes that solidarity and unity as our core values in social democracy shall guide us in our democratic endeavour.

Social democrats in Namibia are convinced that this program will mobilise , capacitate,educate and politically activate young and old people to vote against stinking corruption,gross human rights abuses,age- related discrimination and partisan distribution of food aid and other handouts by Zanupf morons.

MDC Alliance Statement On Gukurahundi Atrocities

GUKURAHUNDI REBURIAL PROCESS MUST ADDRESS HISTORICAL INJUSTICES

We note with concern plans by the State to fast-track exhumations and reburials of Gukurahundi victims before there has been any accountability for the massacres and without the consultative participation of all stakeholders, particularly survivors and victims. Over 20 000 people were killed during Gukurahundi in Matabeleland and the Midlands between 1983and 1987. Most of the victims were buried in shallow graves.

However, over three decades later, there has been no formal acknowledgement or apology from the State for the commission of this genocide and the grave atrocities that took place. The perpetrators have never been brought to book.

The proposed reburials constitute the first indirect, official acknowledgement of the atrocities.

While the reburial of the victims is important, the surviving relatives’ and other key stakeholders must be heard and consulted on how the process should be carried out. The communities that were affected must play a central role in the reburials through their traditional leaders and churches. Truth-telling and justice must accompany any redress for survivors.

The evidence associated with the atrocities must be carefully managed. This is the only way we can ensure that there is full closure on this important national issue.

We call for a transparent, comprehensive, inclusive, gender-sensitive and consultative transitional justice process for the victims and survivors of Gukurahundi. The process should be victim-centred and must involve representatives of all stakeholders including the traditional leaders, the surviving victims, rights based groups, the Church and civic society. Reburials must be a part of this comprehensive process, not a standalone initiative.
The MDC Alliance stands for restorative justice, rehabilitative justice and, in appropriate cases, restorative justice.

Reburying the victims without healing, justice, truth telling and reparations will undoubtedly result in the wounds resurfacing in the future to the detriment of nation building, lasting peace and reconciliation.

Daring Man Uses Snake As “Face Mask”

The commuter and his reptilian mask, which was wrapped around his neck and mouth, were seen on a bus from Swinton to Manchester on Monday.

One passenger, said she thought the passenger was wearing a “funky mask” until she spotted it slithering over hand rails.

The eyewitness, who asked to remain anonymous, said she found the incident “really funny”, adding the animal did not seem to be bothering any of her fellow passengers.

She said: “No-one batted an eyelid.”

Transport for Greater Manchester said a snake was not a valid face covering.

Using a face covering on public transport is mandatory, except for children under the age of 11 or those who are exempt for health or disability reasons.

A Transport for Greater Manchester spokesperson said: “Government guidance clearly states that this needn’t be a surgical mask, and that passengers can make their own or wear something suitable, such as a scarf or bandana.

“While there is a small degree of interpretation that can be applied to this, we do not believe it extends to the use of snakeskin – especially when still attached to the snake.” -BBC.

Farai Dziva|There was pandemonium in Harare on Friday as Zanu PF hooligans violently disrupted a ZINASU media briefing on the Impala Car Rental rigmarole.

The marauding Zanu PF youths severely bashed ZINASU leaders as police officers watched.

The rowdy youths also attacked journalists covering the event and reportedly seized a mobile phone belonging to one of the reporters.

“The Zanu PF hooligans violently disrupted the ZINASU media briefing and they also attacked journalists covering the event,” a source told ZimEye.com.
