By Own Correspondent| Former Vice President Phelekezela Mphoko, has instructed his lawyer Professor Welshman Ncube to approach the courts because the government is refusing to award his client his full benefits.

The government is arguing that Mphoko does not deserve full benefits because he did not serve a full term as vice president.

In an interview with a local publication, Professor Ncube said he would draft court papers over the areas where there was no agreement between his client and government.

Said Professor Ncube:

“All of those things are in the Presidential Pensions Act. They are disputing these ones (security aides, an office, telephone, secretary and domestsic workers).

They are basically saying he is not entitled to these because the Act says he must have served at least one full term. We have now just been instructed that we should go to court in respect of the matters on which there is no agreement…And what we have said to them is that is not correct because that provision in the Presidential Pensions Act contradicts provisions in the constitution which does not require a former VP or President to have completed a full term.

But they do not agree so that is the part on which we have been instructed to go to court to say as far as we are concerned, the proper interpretation of the constitution requires he be entitled to these other benefits.

So that is where the dispute is. We will soon the drafting the necessary court papers over the part in which there is no agreement.”
