Meanwhile Magistrate Chikwekwe had granted Mahiya $300 bail but the State invoked section 121 as amended by the 2016 Amendment to the criminal procedures and evidence act. Mahiya’s lawyer Nkomo argued that the section has been amended to the effect that the Pp or PG needs to make an application for suspension of bail before the magistrate
