DNA Shocker- 14yr Old Impregnates Brother’s Wife

By A Correspondent- A 14 year old teen from Chihota learned the hard way that all actions have consequences. The youthful teen discovered conclusively that he is now a father following an illicit affair with his older brother’s wife.

The shocking case occured in the Chihota area under Chief Nyandoro. The illicit affair between the minor and his brother’s wife was exposed when the latter fell pregnant, even though her husband has spent the last two years in South Africa without returning home. In that time, the husband and wife ad no contact with each other. The woman later gave birth to a healthy baby.

Due to the unusual circumstances, the case was reported to the traditional leader’s court for judgement. During the subsequent hearings at Chief Nyandoro’s court, it was alleged that the 14-year-old teen ad been having an illicit affair with his brother’s wife.

However, the brother’s wife was alleged to have been seeing someone else, who was only identified as Tinashe. The allegations were made by the teen’s parents. She, on the other hand, vehemently denied this charge, insisting that the only other person she had been intimate with apart from her husband, is his younger brother

Due to the conflicting allegations, Chief Nyandoro ordered DNA tests to be carried out to establish the paternity of the child. The DNA tests were carried out by Global DNA Zimbabwe, and the results were announced on their weekly show.

Before the presentation of results occured at the Chief’s court, the teenager and his sister-in-law were asked to explain how they had come to have intimate relations. In this regard, both parties blamed each other for initiating the affair.

The juvenile alleged that his brother’s wife used to mock im saying that he was artless and unsophisticated. She is said to have tried flirting with him. When he filed to prove otherwise, she is alleged to have cornered him in his bedroom and ordered him to sleep with her. He claimed that she entered his room, locked the door, took off her clothes and threatened to accuse him of rape if he did not become intimate with her. He could not recall how many times they had been intimate since.

The brother’s wife, on the other hand, claimed that the teenager is the one who initiated everything. She claimed that he used to say that his brother had tasked him to look after her and to take care of all her needs. When she disputed this, he is alleged to have said that the instruction was given to him directly.

She went on to allege that one day when the mother-in-law had left them alone, the teen came into her bedroom when she was sleeping. He then took off his clothes, got into bed and had his way with her. She alleged that this would happen every single time when they were left alone. She also claimed that the two would continue with their escapades whenever they were tasked with fetching firewood.  The brother’s wife said she only disclosed the pregnancy to the teenager as she was too intimidated to tell her in-laws.

When the DNA results were announced, the minor and his parents appeared dismayed. The teen said that he is not happy that the baby is his.

The brother’s wife and her relatives on the other hand seemed happy that they had been vindicated. After delivering the results to Chief Nyandoro’s court, the DNA team left the Chief and his court to continue with the hearing. The chief was yet to pass judgement on the matter when the show concluded.

It is not clear if the Chief will hand over the case to the police as the brother’s wife clearly violated the law by being intimate with a 14-yer-old.

Zanu PF Thug Attacks Chamisa Ally, Leaves Him For Dead

By Correspondent- Zanu Pf stalwart Godfrey Mlambo is under fire for assaulting former MDC Alliance ward 2 councillor Rydes Machekera.
Mlambo beat up Machekera (Friday) and the matter was reported at Chegutu Hintonville police station under RRB number 4792968.

Said a source privy to the development:
“Mlambo attacked Machekera with fists over his body and he fell down before he started kicking him while he was lying on the ground.
This must be politically motivated violence because Machekera is a wellknown MDC Alliance supporter who in August passed through Rukau shopping centre and this was a venue where the Zanu pf stalwarts were holding their meeting. This could the reason why he was assaulted.”
ZimEye has it on good authority that on the day in question, Mlambo waylaid Machekera and started accusing him of trying to be important for nothing.
“He started shouting at him telling him that ane dzungu. When he queried what he meant and why he was shouting at him, Machekera was beaten up. Mlambo did not give any explanation on why he was attacking him.”
Machekera refused to comment on the matter but told ZimEye that he was not well.
A close relative however confirmed that Machekera had sustained ear injuries from the attack and was now experiencing a serious headache.
Efforts to get a comment from Mlambo was work in progress by the time of writing.

Govt Stopped From Interfering With NGOs

The government has been interdicted from interfering with or suspending Non-Governmental Organisations (NGOs).

Harare Provincial Development Coordinator Tafadzwa Mugwadi in June ordered NGOs operating in Harare to share their work plans for 2021, but many snubbed his directive. On July 29, Muguti issued a statement calling on police to arrest all NGOs that had refused to comply.

But Justice Esther Muremba of the Harare High Court on Friday granted an interim order sought by the Zimbabwe Human Rights NGO Forum and Crisis in Zimbabwe Coalition after the two organisations – representing 82 NGOs – argued that Muguti’s actions were illegal as they violated the right to administrative justice.

“I find merit in the applicants’ application for an interdict pending the return day (full hearing),” the judge ruled. “They have made out a prima facie case to establish the constitutional rights that are likely to be infringed, which NGOs have an inherent interest in. There is a reasonable apprehension of harm in that the operations of NGOs will be disrupted or stopped as per the press statement of the first respondent.”

Justice Muremba said the balance of convenience favours the granting of the interdict, adding that no prejudice would be suffered by Muguti.

“On the other hand, the applicants and NGOs stand to suffer irreparable harm if the interdict is not granted as operations may be stopped at any time as threatened by Mugwadi. In the result, I will grant the provisional order as prayed for by the applicant.”

In an urgent chamber application filed on August 3, Zimbabwe Human Rights NGO Forum and Crisis in Zimbabwe Coalition Trust said the directive was unconstitutional.

“Muguti does not state in his press statement the law under which he makes the declaration that NGOs will be stopped from operating. By purporting to have regulatory authority or power over applicants and other NGOs, Muguti has acted without jurisdiction,” they argued.

“As a result, his press statement and directives are a nullity and of no force and effect and liable to be set aside. The press statement is in clear breach of the Provincial Councils and Administration Act and the Private Voluntary Organisations Act.”

The NGOs said more significantly, the press statement abrogates the rights of applicants provided in section 57, 68, and 69 of the constitution.- State media

Umzingwane Villagers Face Eviction

VILLAGERS settling close to the Zimbabwe National Army (ZNA) cantonment area in Umzingwane, Matabeleland South, face eviction as government moves in to deal with illegal settlements across the country.

Land barons and local authorities accused of parcelling out land to illegal settlers will bear the cost of eviction and relocation, Local Government deputy minister Marian Chombo told Parliament this week.

Chombo was responding to Umzingwane Zanu-PF legislator Levi Mayihlome who wanted to know “when the ministry was going to stop and reverse illegal settlements in communal and A1 settlement areas in Umzingwane.

“She said an inter-ministerial committee has been set up to resolve challenges related to “dysfunctional” settlements, both urban and communal areas with a view of regularising, demolition and evicting affected people.”

In Umzingwane, the areas affected by illegal settlers are wards 20 and 5 where people settled themselves and established an urban settlement in communal and resettlement areas in the Mbalabala area, 40 kms from Bulawayo; ward 19 of Godlwayo area where people settled themselves and were given eviction notices; in wards 1 and 2, people were settled next to the cantonment area of the Zimbabwe National Army, the people need to be resettled to safe areas,” Chombo said.

“We have been going through the 10 provinces to make sure that we identify where all those dysfunctional settlements are.”

There is a programme that is being drawn up to make sure that we identify who settled those people there. Was it the land barons? Was it the local authority or was it us, the Local Government and Public Works ministry?”Recently, Lands and Agriculture minister Anxious Masuka revealed that as many as 250 000 people were on the waiting list for farming land.

Masuka said the ministry’s registry shows that most of the land has been occupied but no farming was taking place in some areas for various reasons, hence the ongoing visit to re-distribute the vacant, abandoned, and derelict farms.

“First and foremost, we have to identify a place to move those people to and the cost of moving them is going to be borne by either one of them, that is the land baron, local authority or the Local Government and Public Works ministry,” Chombo said.

“If they settled themselves on that ground, then it means that they will bear the cost of moving but the central government is trying to make sure that all those people who illegally settled themselves on those dysfunctional settlements are well settled. We will try to do that before the onset of the rain season.”

ED’s Anti Corruption Efforts, A Facade

When he took over power in a November 2017 coup, President Emmerson Mnangagwa won the hearts of many sceptics after he pledged to deal with corruption, a vice widely believed to be stalling development in the southern African country.

After disbanding the Zimbabwe Anti-Corruption Commission (Zacc) board accused of perpetrating corruption and appointing a new team, Mnangagwa went on to establish the Special Anti-Corruption Unit (Sacu) in his office to prove his determination to fight graft.

He also designated a specific court to deal with corruption cases. But four years down the line, observers say the situation on the ground shows that his anti-graft fight was nothing but a facade.

Many people think Mnangagwa is using anti-graft fight to fight factionalism in his ruling Zanu-PF party.Insiders within the ruling party have raised concerns over insignificant progress on convictions and prosecution of party members arrested by the Zacc and Sacu on graft charges.

Sacu, an arm in Mnangagwa’s office, critics say is a tool to punish his political foes. The criticism followed the arrest of several Zanu-PF bigwigs on graft charges following a “name-andshame” operation by the party youth league in 2019.

However, the party has not yet taken disciplinary action against those named as “corrupt” despite its pledges to support the government’s fight against corruption. Instead, the whistleblowers, Pupurai Togarepi and Lewis Mathutu were demoted while Godfrey Tsenegmau was fired from the party.

Zanu-PF Makonde senator and ex-Cabinet minister Priscah Mupfumira was the only one arrested and sacked in 2019 on allegations of abusing US$95 million from the National Social Security Authority (NSSA).

She denied the allegations. The court case has revolved many times and the figure reduced significantly, raising fears that the case could collapse. In fact, it appears it is only a matter of time before she is acquitted.

Despite the allegations, her bail conditions were recently relaxed and she was authorised by Mnangagwa to travel to South Africa on Parliament business. Mupfumira remains a full member of Zanu-PF.

Mupfumira recounted: “It all started with protracted social media allegations and abuse by (name supplied) and other Mashonaland West WhatsAppgroups.”

Twice, I informed the President who advised me to ignore the honourable member since he (the alleged informant) was not a member of our party.

This was followed by a name and shame by the party youth league executive members in July 2019 wherein my name was on the so-called list of government and Zanu-PF corrupt leaders.”

The politburo then resolved to appoint a commission of enquiry to validate the allegations. I have still not yet been invited to appear before the commission to present my case.

I am ready to present my story and answer any questions to the commission.”

She argued that she was the only person out of a list of over a dozen “so-called” corrupt leaders arrested by Zacc. Her prolonged pre-trial detention did not conform to constitutional tenets of “presumption of innocence” until proven guilty, she added.

The former minister also said: “If the matter was founded on proper investigations and on the premise of reasonable evidence that warrants an arrest, then the trial ought to have commenced in earnest and should, even when one considers the accused’s concerns and applications on record have been nearly finalised.

“To illustrate this point, one needs to interrogate the conduct of the prosecuting authority on October 22, 2019 wherein now three new charges separate from the original seven came to the fore and whose trial has now commenced, this notwithstanding the fact that these three are insignificant to the original seven that were the focus of the State that fuelled the damning media blitz and court of public opinion.”

But Zanu-PF acting spokesperson Mike Bimha told NewsDay Weekender that the ruling party does not interfere with functions of either Zacc or Sacu, but it was waiting for finalisation of the corruption cases involving its members at the courts for it to decisively deal with the matters.

“The party has never interfered with either Sacu or Zacc because they are independent State institutions,” Bimha said.”

When the cases are still before the courts, the party cannot take action against the accused persons. Once the cases are finalised, the party then can institute its own proceedings in dealing with such matters.

In Mupfumira’s case, for instance, the party has already taken action against her when it suspended her from her post as the secretary for environment and tourism in the politburo.

“Recently, Mupfumira, contributing in the Senate challenged law enforcement agents to thoroughly investigate cases before arresting suspects, saying the “catch and release” practice adopted by police was abetting corruption.

“The problem is that there are a lot of false allegations that are going on. So, no one will take us seriously and we will score lowly when it comes to the index,” she said.

“Human dignity should be considered when there are arrests or allegations. When there is an investigation, there should be a good investigation. Law enforcement agents should be well-trained to separate rumours and reasonable allegations.”

In 2018, then Home Affairs minister Obert Mpofu refused to appear before the Parliamentary Portfolio Committee on Mines and Energy to give evidence on the alleged $15 billion diamond funds which went missing while he was still Mines minister.

Like Mupfumira, the party secretary for administration, Mpofu has never appeared before an internal disciplinary action, raising concerns over selective application of the law for political ends.

Police Commissioner Douglas Nyakutsikwa, who was arrested by Sacu after he allegedly used his influence as a senior police officer to get residential stands for himself told Harare magistrate Ngoni Nduna that his case was being politicised. He challenged the Sacu constitutionality at the Constitutional Court.

A Zanu-PF member who declined to be named said: “Mupfumira first appeared in court on July 25, 2019 and had been on routine remand until the end of the year since the State was not ready for trial.”

“Her trial only commenced in July 2020, but throughout the period from her arrest, there has not been significant progress in the finalisation of her case for the past two years.

She is not the only one who is in this predicament. Charges are being brought against members, but without trial and the matters are being postponed continuously.

What is worrisome is that there are several other members, who have serious corruption cases to answer, but are being exempted from facing the full wrath of the law.

“Zacc spokesperson John Makamure said there was no selective application of the law in the manner the commission was handling corruption cases.

He refuted allegations that there was interference with its functions by the Executive by Zacc, Makamure said, to delay finalisation of corruption cases, but some litigants were not keen to stand trial.

“Suspects on corruption cases are granted bail by the courts, which is their constitutional right and Zacc cannot prevent granting of bail to a suspect, in accordance with the law,” Makamure said.

“On Mupfumira’s case, there has been a perceived prolonged delay in the finalisation of her cases because she was granted bail. (She) has been submitting several applications resulting in her matter being delayed.”

This week, Makamure said Zacc was engaging the National Prosecuting Authority to ensure corruption cases are resolved quickly.

Sacu director Thabani Mpofu said: “I will not respond to that. The allegations could be raised by an accused person who is trying to exonerate him or herself outside court.”

The 2020 Transparency International Corruption Perception Index (CPI) ranked Zimbabwe 150 out of 187 highly corrupt countries after it scored 24% on corruption fighting.

The country’s institutions continue to be dysfunctional, and there are limited integrity mechanisms in place to curb corruption. Yet, the government still fails to provide basic services to citizens, and the security situation remains precarious.Last year, Harare magistrate Bianca Makwande bemoaned unnecessary delays on graft cases, adding that continued postponement of the cases would result in a gridlock of pending matters at the courts.

Chaos As Woman Finds Clothed Tortoise In Garden

By A Correspondent- In a suspected witchcraft act, a Rusape woman recently woke up to find a live tortoise wrapped with a multi-coloured cloth (retso) and rabbit skin in her garden.

Tambudzai Makombe of Sanzaguru has witnessed mysterious happenings in her yard in recent weeks, phenomena that have left both traditional leaders and spiritualists baffled.

Barely a week after a mysterious fire exploded in her garden and some paraphernalia associated with witchcraft found in her yard, on Monday Makombe was visited by the strange tortoise.

The reptile, wrapped with a multi-coloured cloth and rabbit skin was seen roaming in the garden by Makombe’s grandchild who was sweeping the yard.

The tortoise was later removed by a cleric, Apostle Petros Kembo.

Headman Sanzaguru, Stephen Kamangira, confirmed the incident to Manica Post, saying he was gobsmacked with what is haunting Makombe. He said:

A live tortoise wrapped with a retso and rabbit skin was found on Monday morning at Ms Makombe’s house. Ms Makombe’s grandchild who was sweeping the yard saw it.

Everyone was shocked by the discovery and Apostle Kembo who removed the paraphernalia which was found at Ms Makombe’s gate was summoned again and removed the tortoise.

I am not sure whether he killed it or not, but what I know is that he took it away. We have advised Ms Makombe to seek help from both spiritualists and traditionalists.

When contacted for comment, Makumbe could only say: “I do not have anything to say. Please, let me rest.”

Apostle Kembo said he could not comment without Makombe’s consent.

High Court Blocks Mnangagwa From Suspending NGOs

We Will Never Betray The People- President Chamisa

Tinashe Sambiri| President Nelson Chamisa says only genuine dialogue can resolve the country’s political stalemate.

Speaking in Matabeleland South at the weekend President Chamisa said:

“What we want is genuine dialogue, not POLAD.
POLAD is a mere choir and we will not join the platform.

Chegutu Director Sells Stand for USD116

Chegutu Municipality housing director Ms Shylet Dzivai allegedly sold a residential stand measuring 1 800 square metres for $10 000 early this month which was equal to US$116, way below the initial value of US$7 000 quoted in 2007, leading to calls for the Zimbabwe Anti Corruption Commission (ZACC) to investigate in the town.
The sale was raised when Ms Dzivai and town clerk Mr Jacob Chikuruwo appeared before Parliament’s Public Accounts Committee’s sub-committee on Local Authorities to respond to issues raised in the 2019 Auditor General’s report.

The stand was allocated to Mr Takuranei Musoko in 2007 valued at $200 million (equivalent to US$7 000 then) but was repossessed in 2017.

Ms Dzivai allegedly unilaterally re-allocated the stand to Mr Musoko without following procedures and he paid $10 000 early this month.

When they appeared before the sub-committee chaired by Chegutu West legislator, Cde Dexter Nduna, Mr Chikuruwo said he had not approved the transaction while Ms Dzivai said she could not recall issues related to the deal and was granted permission to bring the file on the stand next week.

Cde Nduna said there was a possibility of corruption on the part of the director of housing and requested the Zimbabwe Anti-Corruption Commission (ZACC) to investigate the matter.

ZACC commissioner Mrs Thandiwe Mlobane, who also attended the meeting, said they would send a team to probe the matter.

The anti-corruption team was also asked to investigate the appointment of Engineer Edward Mukaratirwa in 2019 as acting town clerk. He was appointed substantively to the post in July this year.

Eng Mukaratirwa was deputy director engineering services for the city when he was appointed acting town clerk in September 2019.

However, the sub-committee said that appointment contravened the Urban Councils Act, which says in the absence of a substantive town clerk, the chamber secretary should act in that capacity.

At the time of his appointment, Mr Vitalis Shonhiwa was the acting chamber secretary and the sub-committee said he should have been appointed instead.

However, Eng Mukaratirwa disputed the sub-committee’s assertion saying the provision in the Act was for persons holding the chamber secretary’s post substantively.

This prompted Cde Nduna to request ZACC to look into the matter saying the irregular appointment could have been to facilitate corruption in light of irregularities cited in the Auditor General’s report.

Mrs Mlobane said they would investigate the matter and report to the sub-committee next Friday. -Herald

Will Police Catch the 20 Mine Murderers?

PAUL-NYATHI

Police are hunting down a gang of at least 20 they suspect attacked and killed a mine manager on Wednesday night in the Saruwe area, in Mashonaland West, before the entire night shift of the mine vanished with 20 tonnes of gold ore and a quantity of explosives.
The deceased was identified as Robert James Chilpott aged 68.

National police spokesperson Assistant Commissioner Paul Nyathi yesterday confirmed the manhunt for the 20 suspects thought to be part of the gang that killed the gold miner.

“Police have launched a manhunt for at least 20 suspects who we are keen to question over the incident as investigations on the case continue,” he said.

There is suspicion by police that the employees could have been in the habit of stealing gold or gold concentrates after processing the gold ore during the night.

Mr Chilpott was attacked at Sanary Mine at around 11pm while he was managing the mine on behalf of the owner who is based in South Africa.

He found workers at night processing gold and it is suspected that he questioned them and an argument arose, resulting in him being attacked and dying on the spot. This is not the first time that mine employees have been found on the wrong side of the law in Saruwe.

In October 2019, ZRP Saruwe recovered 30 tonnes of chrome ore that had been stolen at a mine in Selous through connivance by employees at the mine.

The truck driver was reported to have taken off with the chrome before the quantity could be verified and through the assistance of other employees, he managed to leave the company premises.

A report was then made to the police and the truck was intercepted at a roadblock.

The stolen chrome was valued at US$30 000. Gold panners have also been embroiled in clashes over gold, which have left some seriously injured and others dead.

In April this year, a man was killed by an artisanal miner at a gold mill in Amatola, within the Jumbo Mine area during a scuffle over gold proceeds. Allegations were that the deceased, Richard Makoto had sponsored a group of artisanal miners to mine the gold and in return, would share with them the proceeds after selling the ore.

Reports say a heated argument arose between Makoto and the artisanal miners before one of them hit him on the head with a shovel, killing him instantly. -Herald

High Court Blocks Mnangagwa From Sanctioning NGOs

Emmerson Mnangagwa – file

Harare High Court judge Esther Muremba yesterday dismissed an attempt by President Emmerson Mnangagwa’s administration to ban non-governmental organisations (NGOs) which refused to submit their work plans to the provincial development co-ordinator (PDC)’s office.
In July this year, Harare PDC Tafadzwa Muguti ordered NGOs that failed to submit their programmes to his office to stop operating.

This prompted the Zimbabwe Human Rights NGO Forum and Crisis in Zimbabwe Coalition to approach the High Court challenging the prohibition order.

Muguti, Harare Provincial Affairs minister Oliver Chidawu, Home Affairs minister Kazembe Kazembe, Local Government minister July Moyo and Labour minister Paul Mavima were cited as respondents.

Justice Muremba, in her ruling, said the PDC had no right to ban the NGOs, declaring Muguti’s order null and void.

“The respondents and all their agents or anyone acting on their behalf are interdicted from enforcing, interfering with, suspending or stopping operations of NGOs, trusts, CSOs and faith-based organisations or in any way acting on the contents of the press statement dated July 29, 2021 by first respondent,” the ruling read in part.

“The averment of the third respondent that in terms of government policy, on the operations of the NGOs, the applicants before commencing any activities must seek support from the Provincial Development Committees chaired by coordinator is not correct.

“In the circumstances of this case, the applicants are not challenging the validity of government’s policy on the operations of the NGOs in humanitarian and development assistance in Zimbabwe. Instead, they are challenging the legality of the directives issued by the first respondent on the basis that he does not have the power to issue the directives he issued.”

Justice Muremba added: “I am strengthened in my position by the averments that were made by the fifth respondent in his opposing affidavits. He averred that the person to whom the NGOs submit their work plan is the registrar of NGOs.”

Mnangagwa’s regime has accused NGOs of being sponsored by the West to effect illegal regime change in the country, an allegation the civic organisations deny.

There have been threats from senior government officials to ban NGOs from operating in the country and a law is on the cards to regulate the operations of the civic groups, making it a punishable offence to be involved in politics. -Newsday

Mai Chisamba: DNA Testing Not For Public View.

…Popular television show host Rebecca Chisamba said DNA test results were not for public consumption…

Not happy…Mai Chisamba- file pic

“DNA testing is good, but not for public consumption,” Chisamba said.

THE Medical Laboratory and Clinical Scientists Council of Zimbabwe (MLCSCZ) has described two companies that have been offering paternity tests and broadcasting the results on radio and television as bogus, warning people against falling prey to the con-artists.
The regulatory body red-flagged — Global DNA Zimbabwe and Expedite DNA Zimbabwe — saying they were only registered as DNA collection sites and not authorised to conduct the actual tests.

The MLCSCZ said the companies were neither professionally qualified nor competent to issue those test results with the participation of radio personality Tilder Moyo.

Global DNA principal consultant Tinashe Mugabe hosts The Closure DNA Show while Moyo hosts Expedite DNA on the Tilder Live Show.

The weekly programmes have gained popularity among ordinary Zimbabweans for exposing infidelity among couples.

But yesterday, the MLSCZ in a statement discouraged Zimbabweans from falling prey to the two firms.

The body said health professional bodies had a code of conduct which barred members from divulging, either orally or in writing, any information concerning a patient/client test result to third parties except where so required by law.

“Mr Tinashe Mugabe of Global DNA of The Closure DNA Show and Jane of Expedite DNA Zimbabwe Tilder Live Zim Show are not registered members of the Medical Laboratory and Clinical Scientists Council of Zimbabwe or sister Health Professional Councils in Zimbabwe.

“Mr Tinashe Mugabe and Jane are neither professionally qualified nor competent to issue those test results. Therefore, the MLCSCZ condemns such unethical practices on the poor and the marginalised population by Global DNA Zimbabwe and Expedite DNA Zimbabwe.”

The statement came at a time when a video by Australian broadcaster, Sunday Night has gone viral in which Mugabe was in 2019 accused of producing defective paternity results to a Zimbabwean-born Australian, who went missing at birth in 1983 and wanted to reunite with her family.

In an interview with NewsDay Weekender on Thursday before the MLCSCZ statement, Mugabe said: “DNA testing is not new, it is even mandatory in some countries. People need to be educated about DNA testing so that they learn. We have created platforms meant to educate people who come for DNA testing.

“The reason why many people come for DNA testing is because they seek peace of mind. We have noted that there are more negative than positive results, meaning there are many alleged fathers who don’t have a biological relationship with the tested child.”

Earlier in the week, Zimbabweans rapped the public disclosure of DNA paternity test results through broadcasting, saying the practice was alien to the local culture and inconsiderate to the affected children.

Popular television show host Rebecca Chisamba said DNA test results were not for public consumption.

“DNA testing is good, but not for public consumption,” Chisamba said.

“We should consider the psychological factors that can affect the child after he or she discovers that there is no biological relationship with the alleged father. We are destroying the child, forgetting that they should face the public after they are exposed on social media.”

She said although infidelity was bad and destroying families, DNA tests should be done in private to protect the image of the family.

Institute for Young Women’s Development knowledge management, documentation and advocacy co-ordinator Tinotenda Chihera said in as much as the Global DNA Zimbabwe was applauded, they should first consider the best interests of the child as per the Constitution.

“I am not against what Tinashe Mugabe is doing. Yes, infidelity is never a good act, but we should protect the image of the innocent children,” Chihera said.

National Peace and Reconciliation Commission (NPRC) spokesperson Obert Gutu said no one should be in a position to give conclusions on such an issue before the topic has been fully debated, discussed and ventilated by the various stakeholders.

Pamellah Musimwa of Justice for Children said by publicising paternity results, Mugabe was violating children’s rights.

Padare Men’s Forum on Gender national director Walter Vengesai said DNA testing should be structured in a way that does not harm those who chose to be tested.

“It may be very important for people to know their biological test results, but above all people’s rights should be considered. No one should suffer psychologically whenever there is a development process in society. DNA should, therefore, do more good than harm in society.”

Human rights lawyer Nyasha Machirori said people were much concerned with exposing infidelity and adultery on social media, but forgetting that the programme was damaging the image of children.

“It is important for children to know their correct heritage, but this should be done in a way that does not harm them,” Machirori said.

The manner in which the DNA results are disclosed brutalised children, she said. – Newsday

Legal Experts Confront Mnangagwa Over Enforcement Of Vaccination

A GROUP of lawyers have accused President Emmerson Mnangagwa’s government of unlawfully overturning a court ruling which allowed unvaccinated congregants to attend church service by insisting on enforcing the ban.

On August 11, Cabinet allowed churches to reopen only to vaccinated congregants, but the High Court judge Justice David Mangota last week issued interim order setting aside the directive following a challenge by a human rights lawyer Obert Kondogwe.

On Tuesday this week, Information minister Monica Mutsvangwa told journalists following a Cabinet meeting that government intended to enforce the ban on unvaccinated churchgoers.

“We must state that the position taken by Cabinet is now in clear violation of the court order issued by the High Court on September 9, 2021,” the lawyers, under the umbrella of Zimbabwe Lawyers for Truth, Health, Justice and Freedom said in a statement.

“The court order was clear that unvaccinated congregants cannot be barred from attending physical church meetings. The position by Cabinet is, in our view, not only unlawful and discriminatory, but bordering on contempt of a court order.”

They also said the announcement by Mutsvangwa was a threat to judicial independence and was inconsistent with the doctrine of separation of powers enshrined in the Constitution.

“We take strong exception to this unlawful and contemptuous position taken by Cabinet and point out that in our law, a litigant who is aggrieved with a court decision must take necessary legal steps against that decision and not seek to undermine the court order or threaten unlawful action against the successful litigant,” the lawyers said.

The Cabinet decision, they said, was a serious danger to justice and the rule of law in the country and conveys a wrong message to all those who uphold constitutionality and constitutionalism.

“We hope that the Cabinet will reflect and withdraw its unlawful contemptuous conduct which is inappropriate and damaging to the interests of Zimbabwe.”

The lawyers are adamant that the High Court order of September 9, 2021, is extant and remains binding on the government and all citizens.

“And as such, the now purported ban on unvaccinated church congregants is of no force or effect,” the lawyers’ statement read.

In the interim relief, the judge said any purported ban on unvaccinated sit-in congregants and any arrest or criminal proceeding of unvaccinated sit-in congregants of churches by the police was unlawful, null and void and of no force and effect and should, therefore, be set aside.

But in her statement, Mutsvangwa disregarded this order insisting that the ban was still in place.- NewsDay

Robbers Pounce On Bubi Pastor, Petrol Bomb His House

By A Correspondent- A Pastor from Enaleni Village in Bubi District, Matabeleland North, is battling for life at Mpilo Central Hospital after he suffered burns to 97 percent of body when suspected armed robbers petrol bombed his home.

Pastor Ephraim Ndlovu of Alive in Christ Pentecostal Church suffered serious burns while his wife and two minor children escaped unhurt when unknown robbers pounced at his home.

The incident occurred on Tuesday night when the family had retired to bed.

It is said that the armed robbers failed to open the doors to Pastor’s Ndlovu’s house and made their demands while they were outside.
They allegedly threatened to petrol bomb his house if he delayed giving them money.
While Pastor Ndlovu was still negotiating with them, it is alleged that the robbers threw a petrol bomb on the roof of the house and broke window panes and threw another one into his bedroom.

They are said to have got the petrol from Pastor Ndlovu who is said to have been illegally selling it.

Following an explosion in the house after the bombing, Mrs Ndlovu managed to escape to safety with two of her minor children who were sleeping in the next bedroom.
In a telephone interview last night, Mrs Ndlovu said her husband was in a stable condition.
“That is the word that I got from them (nurses). He has 97 percent burns to his body. I did not suffer any burns as I had moved to another room when the bomb was thrown into our bedroom. I was just cut by glass while trying to escape,” said Mrs Ndlovu.
Research shows that 97 percent of burns are very intense and lead to permanent scars.

High Court Humiliates Mnangagwa Ally

By A Correspondent- The High Court has nullified Harare Provincial Development Coordinator Tafadzwa Muguti’s decision to ban some non Governmental Organisations (NGOs) after they failed to submit their work plans as he had directed them to do.

In an urgent chamber application filed on 3 August, Zimbabwe Human Rights NGO Forum and Crisis in Zimbabwe Coalition Trust, a mother body of NGOs said the directive was unconstitutional.

Muguti, Minister of State for Provincial Affairs and Devolution Harare Metropolitan Province, Local government minister, Home affairs minister, Public Service minister were all cited as respondents.

In its ruling handed down this Friday, the High Court said the applicants had made out a prima facie case establishing that their constitutional rights had been violated by Muguti’s directive. The ruling read in part:

As already discussed above, the Act has not yet been amended to incorporate the first respondent’s position. Until such a time that is done, the first respondent cannot issue directives to NGOs and purport to police them.
In view of the foregoing, I find merit in the applicants’ application for an interdict pending the return day. They have made out a prima facie case establishing the constitutional rights that are likely to be infringed which NGOs have an inherent interest in.
There is a reasonable apprehension of harm in that the operations of NGOs will be disrupted or stopped as per the press statement of the first respondent.

The balance of convenience favours the granting of the interdict. No prejudice will be suffered by the respondents if the interdict is granted pending the return day.

On the other hand, the applicants and NGOs stand to suffer irreparable harm if the interdict is not granted as operations may be stopped at any time as threatened by the first respondent.

The High Court ordered Muguti to refrain “from enforcing: interfering with, suspending or stopping operations of Non-Governmental Organizations, Trusts, Civil Society Organizations and Faith-Based Organizations…”

Former Minister Survives Assasination Attempt

By A Correspondent- Aspiring Zanu PF Mashonaland Central provincial chairperson and former Education Minister Lazarus Dokora, Monday survived an assassination attempt in Bindura amid suspicions he may have been targeted by internal party rivals as the race for the influential post intensifies.

Dokora reported the attempt on his life at the Bindura Central police station.

It is alleged the hit-men used claw hammers to smash the former minister’s vehicle before they abandoned the mission after realising he was not in the car.

Dokora is challenging Home Affairs minister and current provincial chair, Kazembe Kazembe.

Although Dokora declined to comment on the matter when contacted by NewZimbabwe Thursday evening, a source close to him said the attempt on the former minister’s life was a sign colleagues in Zanu PF’s Mashonaland Central were determined to “eliminate” him before the provincial elections are held after he emerged as a clear front runner.

The provincial elections are slated for next month before Zanu PF holds its annual people’s congress also in October in Bindura.

“There was an attempt on Dokora’s life on Monday in Bindura. He parked his vehicle and got out. The assailants came and smashed his door with an intention of killing him with claw hammers,” the source said.

“However, unbeknown to them, he had left, but this actually shows there are people who want to eliminate him ahead of the internal elections set for next month.”

Dokora’s ally, Ryan Dhokwani, said he has also faced a similar manner in Madziva, Mashonaland Central. He reported the matter to the police.

Dhokwani confirmed to NewZimbabwe Thursday he was forced to withdraw the case from the police after realising his assailants were Zanu PF members, and an out-of-court settlement was reached.

“A large rock was thrown at my car while I was in Madziva some time back. The people who attacked me knew exactly where I sat in my car as I am always driven,” Dhokwani said.

“The rock missed my glass and hit the door. If it had hit the window, it would have been a different story. I reported the matter to the police at Madziva but eventually withdrew the case after realising the assailants were members of the party.

“I cannot with full confidence say this was because of the upcoming elections but this is what happened to me and my car was indeed damaged.”

The NewZimbabwe source said the attacks on Dokora and Dhokwani were coordinated and there were strong fears in the party, the internal fights would escalate once the Politburo allowed campaigning for posts to start.

Campaigns ahead of Zanu PF’s restructuring process were suspended after internal fissures, in most provinces, rose as party faithful jostled for posts.

However, Kazembe and Energy Minister Zhemu Soda have defied the Politburo order and continue campaigning. Soda is backing Kazembe to be re-elected for the second term.

Added the source: “Kazembe and Soda gathered dozens of farmers in the province Thursday under the pretext they were preparing for the winter wheat harvest but it was clear they were campaigning for the coming provincial elections.

“Winter wheat farming is far from their duties as ministers and Kazembe is using his power as Home Affairs Minister to campaign and even harass opponents as what happened when (James) Makamba was arrested recently.”

Makamba was arrested last May on charges of breaking Covid-19 regulations. He had gathered his family and friends to celebrate his welcome from self-exile in neighbouring South Africa.

Soda said could not comment as he was busy while efforts to get a comment from Kazembe were unsuccessful.

Dokora was appointed Education minister by then-President Robert Mugabe before he was dropped by his successor President Emmerson Mnangagwa in December 2018.

His sacking came amid strong criticism from Zimbabweans on social media platforms and public media blaming him for poor performance and undermining the country’s education system.

ZIMSEC Exams Dates Set

By A Correspondent- Public examinations will start at the end of November for Grade Seven candidates, while Ordinary and Advanced Level pupils will start writing in mid-December overlapping into 2022.

Government has previously stated that it is possible to write public examinations this year, despite disruptions to the school calendar caused by Covid-19.

This year, schools were supposed to open in early January for the first term but ended up reopening in March due to the threat caused by the virus.

Schools then closed on June 4 and were set to open on June 28 but the re-opening was postponed.

Schools were eventually re-opened on August 30 for examination classes and September 6 for the rest of the classes.

Due to the pandemic, school holidays have been prolonged, leaving learners with limited time to have face-to-face lessons with their teachers. Schools have been relying more on virtual lessons and radio lessons which other learners have failed to access.

The Ministry of Primary and Secondary Education introduced catch up strategies to bring learners up to date.

This includes blended learning and teachers can combine some topics and also target certain key topics in order to compress the syllabus, and online learning

Responding to questions in Parliament on Wednesday, Primary and Secondary Education Deputy Minister Edgar Moyo said in the meantime, catch up strategies have been put in place to prepare learners.

He said frantic efforts were being made to ensure that learners will be ready for the exams.

“The examination dates have only been given so far as when they are going to begin and that is end November for Grade Sevens. Mid-December, we are going to have the O and A Levels which are going to overlap into 2022.

“We think our children would have been prepared for examinations by that time. With regards to the point that children have lost time, we are employing catch up strategies to ensure that the children do catch up and one of them is through blended learning where we are using different learning and teaching platforms,” he said.

“Inclusive of that is going to be materials that are going to be given to children. Some of them have been given those materials and e-learning is also underway so that they do catch-up.”

Deputy Minister Moyo said in order to cater for learners that did not have access to online learning, modules and study packs have been distributed to schools which do not have network or signal.

He said the Education Ministry was aware that there was shortage of teaching staff in some schools and efforts to address the matter were underway. Deputy Minister Moyo said a human resources deployment strategy was in place to try and address the challenge.

The Zimbabwe School Examinations Council (Zimsec) has said it is ready for the examinations.

Zimbabwe Teachers Association (Zimta) chief executive officer, Dr Sifiso Ndlovu said although the exams could be written starting at the end of November, there was need for exam papers to be set according to what learners would have been taught.

“Learners have to be assessed on what they have covered and exam papers should be set according to that. Another issue is on CALAs (Continuous Learners Assessments), this is a long process of coursework and considering limited learning time learners can be assessed in one activity,” he said

Progressive Teachers Union of Zimbabwe (PTUZ) President, Dr Takavafira Zhou recently said exams could only be written next year as pupils needed three months of uninterrupted time of learning in order to cover the time lost through lockdown.

He said learners should write exams around mid-January to February next year. He also said exams could only be written when teachers had completed their syllabuses.-statemedia

Officer In Charge Sells Guns To Robbers, Poachers

By A Correspondent- Mashonaland West police Armoury officer-in-charge Inspector Clive Kadambure and his three-co-accused facing charges of illegally acquiring and selling firearms to armed robbers and poachers while smuggling some to neighbouring countries have been denied bail at the High Court.

Kadambure, Edmore Manuwere, Wonder Kwaramba and Patrick Chirara had approached the High Court seeking bail pending trial.

But Justice Benjamin Chikowero dismissed the application saying the release of the suspects would undermine the public confidence in the criminal justice delivery system.

The three are facing charges of contravening the Firearms Act pertaining to purchasing, acquiring or possessing any ammunition without holding a firearm certificate.

Charges against Kadambure are that on March 16, detectives from CID Masvingo heard that he was wanted by CID Mwenezi in connection with the smuggling of guns through the Sango Border Post.

Drama As Woman Beats Up Hubby For Asking Why She Brings Boyfriends Home

By A Correspondent- A woman from Cowdray Park suburb recently left people in her neighbourhood shocked after she ran amok and thoroughly assaulted her husband with fists after he asked her why she brings her boyfriends to their home.

Sithandazile Lunga is reportedly in the habit of bashing her husband Masala Zikhali in full glare of the neighbours, a development that has resulted in the latter being a laughing stock in the community.

As if that is not enough, Lunga, who seems to have totally lost affection for her husband, sometimes threatens to poison or stab him.

Efforts to rein in Lunga by her relatives have all gone down the drain, leaving Zikhali with no option but to seek justice from the courts.

“I have been living with Sithandazile Lunga for almost six years. This woman is so violent that she physically assaults me, verbally abuses me and is always insulting me.

“She is always threatening to poison or stab me so that she can inherit my house. She even has the guts to bring her boyfriends to my house and when I confront her she beats me.

“This has caused me emotionally stress. I have on numerous occasions told her to leave me but she says she will leave after I’m dead,” said Zikhali.

He added that their marriage had been full of thorns and that he has been living in misery.

“Lunga once left me in 2018 and went to South Africa for four months and when she came back we sat down and solved our problems which had caused her to leave me.

“But she left me again and went away for one year. Ever since she came back our problems have since gone from bad to worse. I wish the honourable court to help me by granting me a protection order barring her from continuously

staying in my house, physically assaulting me, threatening me and verbally abusing me,” said Zikhali.

CIO Minister Leaks WhatsApp Chats Humiliating President Mnangagwa Policy

Owen Ncube

By A Correspondent | As ZANU PF gears up for provincial elections, some of the CIO minister’s WhatsApp messages have leaked, embarrassing his boss Emmerson Mnangagwa’s leadership.

The communications show a sabotage-mission by the minister against a group of members he calls, ZAPU members. The development could worsen relations between the party leadership and the ZIPRA wing of members, in what throws suggestions Mnangagwa wants to weaken that section and widen the rift between the tribes.

The head of Al Shabaab, Ncube together with Midlands warlord July Moyo, are up in arms against McKenzie Ncube and his executive.

The chats are between the minister Owen Mudha Ncube with a member of the militant Al Shabaab, More Muzwira.

Ncube wants to be appointed provincial party Chairman, in what cheapens and politicizes his senior role as State Security Minister.

Mudha, as he is affectionately called, is greeted as the discussion follows-

Teacher In Soup For Beating Up Cheating Wife

By A Correspondent- In a dramatic incident, a teacher at Inyathi Mission School in Bubi District assaulted his wife after he accused her of prostitution.

It is understood that Fibion Mkhwananzi resorts to beating his wife, accusing her of prostitution every time they have a misunderstanding.

This was revealed by Mkhwananzi’s wife, Lungisani Ndlovu, who sought a protection order at the courts to seek justice against Mkhwananzi.

“I am applying for a protection order against Fibion Mkhwananzi who is also my husband. He assaults me at any given time and accuses me of prostitution and always says the kids that we have are not his.

“Whenever we have a misunderstanding he resorts to fighting. I no longer feel comfortable because of his behaviour. May the court grant me this protection order so that he stops abusing me,” said Ndlovu.

Western Commonage magistrate Jeconia Prince Ncube, ordered Mkhwananzi to refrain from physically and verbally abusing Ndlovu.-statemedia

Woman Vows To Get Married Lover Back

By A Correspondent- Nomsa Gonouya, a defiant ex-girlfriend, vowed in court that she will not rest until she gets her married ex-lover back.

But her ex-lover wants nothing to do with her because he is now happily married, so she has resorted to tormenting the couple.

Sources say she regularly visits the couple’s place unannounced and starts destroying their property saying all she wants is her ex-lover.

This has caused her ex-lover’s wife, Milicent Moyo, to live in fear, leading her to seek justice from the courts.

“I am applying for a peace order against my husband’s ex-girlfriend Nomsa Gonouya. She always comes into my place of residence threatening that I dispossessed her of her husband and she wants him back, besides that I will die and leave him.

“She sometimes comes and breaks my window. She can even fight with my husband in my house. She also collected some soil from my yard promising to perform rituals to get him back. I pray that the honourable court may grant me a peace order that will stop her from coming into my place of residence and she must stop threatening me in any manner. I am now living in fear because of her actions.

I want to live a peaceful life,” said Moyo.

In her response, Gonouya said: “She should know that we share a man. I don’t mind not going to her place of residence but what I want is my ex-lover.”

Western Commonage magistrate Jeconia Prince Ncube ordered Gonouya not to enter Moyo’s premises and to refrain from threatening Moyo.

Goblins Terrorise Nurses

By A Correspondent- In a real-life drama whose script reads like folklore plucked from Gothic literature, nurses at Tsholotsho District Hospital in Matabeleland North province are being terrorised by suspected goblins which are allegedly stealing their food and underwear before dumping them in any of the rooms occupied by the victims.

The mischievous creatures are also reportedly making strange noises at night and disturb couples whenever they want to have sex.

The ‘reign of terror’ is alleged to have started last month and it’s ongoing.

A nurse, who declined to be named, said the menacing creatures were making their colleagues’ lives a misery as they were stealing food from their fridges and underwear before dumping them in their neighbours’ rooms.

“Some of our colleagues are living in terror and we don’t know what to do as staff members at the hospital.

There are chilling complaints from them that they always hear footsteps of strange creatures which are also taking food from their fridges and sometimes they wake up and the food thrown on the floor.

“The menacing creatures are also taking their underwear before dumping these in any of the victims’ rooms,” said an official who requested anonymity.

The official said for couples they also complained of seeing creepy creatures standing next to the bed whenever they want to have sex and it is believed that the goblins were only visible to their victims. Another source from the hospital who also requested anonymity said: “This thing has been happening for quite a long time.

There are also complaints from the victims that on some days they wake up after they felt that they were being pulled from their ears by those invisible things.

Because of fear some of them are now sleeping with their lights and radios turned on.” It is reported that a sangoma from Binga once came and conducted a cleansing ceremony to try to get to the bottom of the drama but he did not succeed apparently.

“A sangoma from Binga once came and conducted a cleansing ceremony but the torment only stopped for about a week before it started again. The latest incident is that of a 10-year-old boy who was haunted by those mysterious creatures. During the torment the boy was crying while claiming that he was seeing a short and bold creature like a man,” added the source from the hospital.

Tsholotsho District Medical Officer Dr Mbonisi Nyathi confirmed having received reports of the strange happenings at the hospital.

“About last week only a single household that had three occupants were complaining of some funny things that were happening so we sent a team to inquire and among themselves they thought of those things called goblins and they assured us that they will x the problem within two days.

“From what we heard, they axed it and fortunately enough they (suspected goblins) were not terrorising other households except theirs.

“So, the last time I heard is that they had resolved it in an internal manner and I don’t know how it stands as of now but I’m hoping that whatever it is be it games or goblins I’m just hoping that it doesn’t taint our name,” said Dr Nyathi.

Wrangle Over Shiri’s Estate

By A Correspondent- The family of late national hero and Cabinet minister Perrance Shiri has questioned the authenticity of documents used by the Master of the High Court Eldard Mutasa to handle his vast empire.

A decorated national hero and ex-Air Force of Zimbabwe commander, Shiri became Agriculture minister soon after President Emmerson Mnangagwa took over in a November 2017 coup and served in that capacity until he succumbed to COVID-19 on July 29 last year.

Some of his children have, through their lawyers, written to Mutasa on several occasions, arguing that the estate administration documents were not authentic.

Shiri’s estate beneficiaries also challenged Mutasa’s appointment of former Attorney-General Sobusa Gula-Ndebele as executor when the late Agriculture minister had a family trust with its own executor.

They claimed that Gula-Ndebele had shown bias in executing the estate as he had un-procedurally given authority to undeserving relatives to use Shiri’s property, namely his nephew Bornwell Chitanda who is now staying at the deceased’s property in Borrowdale after moving out of his Hatcliffe home to occupy the house which had key documents and family safes.

But Chitanda yesterday said: “I was asked to stay at the late minister’s house because there was no relative staying with him at the time of his death. I am just looking after the property. I know nothing about the late minister’s documents to do with his estate. I wouldn’t concern myself with his estate because I am not a beneficiary anyway.”

The matter is now being investigated by police under reference ER5/2021 with the hope that the estate does not fall into wrong hands.

Shiri’s children argued that Mutasa had used a 1995 will, which the late minister had disregarded after registering a family trust with one of his children Rufaro Stephanie Shiri as executor, but who some family members are allegedly wanting to muscle out.

According to documents seen by NewsDay, the late Agriculture minister’s children, Rufaro Stephanie reportedly with the support from sisters Tatenda and Cynthia, accused the Master’s office of using fraudulent documents to deprive them of their inheritance.

“The estate issue has ceased to be a family issue as portrayed to the public and government. People are using government letterheads and offices to execute their fraudulent activities. Mr Gula-Ndebele was appointed executor both dative and testamentary, was the Master’s Office confused on what role to give to him since the family trust has its own executor? His (Mutasa) letter appointing him as administrator was stamped on August 20, 2020, but signed on August 21. Was the stamp stolen on the 20th and someone who was not supposed to sign signed his letters of administration,” Stephanie queried.

The children also questioned the addition of other individuals to benefit from the estate among them Tawanda Zulu and Tanaka Stephanie Shiri who they claimed her real name was Tanaka Musvamhiri, yet they were allegedly not Shiri’s biological children. Zulu has been given Shiri’s farm under unclear circumstances through a letter reportedly signed by the late minister.

“After approaching the Agriculture ministry officials who had worked with our father they happened to confirm the offer letter existed and that the farm had been subdivided, but the question is if the farm was truly subdivided, and if the Agriculture minister chairs the committee for subdivision of farms. Why did he decide to write to himself stating he wanted his farm to be given to Tawanda Zulu, whom he had not given the name Shiri and (though) (he) had stayed with the family for 10 years. The letter can only be read over the phone and had been read on the phone with ministry officials requiring a family meeting to release the letter. No one has ever seen a hard copy of the letter, but what we can confirm is it’s on the ministry’s letterhead,” she said.

But Gula-Ndebele dismissed the allegations in heated exchanges with Stephanie and her sisters’ lawyers.

Shiri’s estate was registered on August 3, 2020 by his daughter Stephanie.

“If Mr Sobusa Gula-Ndebele knew he was an executor, why didn’t he register the estate? Under the laws and statues of Zimbabwe, a family meeting is done to appoint an executor and the decision lies among deceased’s spouse and/or children. Such a meeting was not done,” Stephanie said.

“The Master of High Court has records of all wills and trusts and it is his duty to scrutinise wills and approve if they can be used to administer one’s estate. The 1995 will in particular, has the following grey areas: (for instance) the marital clause states that: In the event of death of any of my daughters, her inheritance will go to her children. If the daughter has no children at the time of her death, her share of the inheritance will be shared equally among her.”

She added: “The clause eliminates Mr Titus Takudzwa Chikerema Shiri. I believe when the will was registered in 1995 according to the document we have only three children listed. Titus being one of them!  How could he have been included in one clause and eliminated in the marital clause.  How did the deceased know that Titus would not be able to marry and would not die, but the daughters would die and clearly states their children were to benefit and or siblings if there were no children?

“Today, Titus is no more, he died in 2013, he had been allocated a house in the will, had no children, what is going to happen to that house since the will eliminated him in the marital clause?  The clauses also suggest that he no longer has male children which people could have derived from the trust and the reason why Titus was eliminated in the new documents is because he doesn’t exist, he died in 2013.”

Stephanie confirmed that Gula-Ndebele was once Shiri’s lawyer, but argued that as an interested party, he should not have drafted and executed the will.

“Witness names are not there, only signatures present, no names with ID numbers. At the time of my father’s death, Sobusa Gula-Ndebele was no longer his lawyer.”

She added that the documents provided to Gula-Ndebele as executor had many disparities.

“The document Acceptance of Trust as Executor MHC 11 on the top left part is printed by Printflow (Private) Limited and the signature used to sign that document is not Sobusa Gula-Ndebele’s.

“The bond of security for the issue of letters of administration to executor also on the top left part is printed by Printflow (Private Limited) on the top right reference number 63911-0 MHC 52 333 (J). Letter of administration is on the other hand printed by the Government Printer, Harare M.H.C.16,” she said, adding that the bond of security document and letters of administration did not have the Master’s signature and stamp.

She also argued that there were two copies of letters of administration — the one with the government emblem date-stamped on August 20, 2020 and deemed to have been signed by one D Gutu (for the Master of High Court) on August 21, 2020.

“These are to certify that ……. (But) how do they certify that he (Gula-Ndebele) has a letter of administration with no official stamp or signature from the Master. This letter was only issued on the 29th of August 2020, while the one with the government emblem was issued on the 21st of August 2020, weren’t they supposed to be done on one day?  The letter to certify him as executor has no stamp and no signatures,” Stephanie questioned.

She added that according to every document provided, Gula-Ndebele was appointed executor dative and testamentary.

“Executor dative is an executor that is appointed by the Master of the High Court where the deceased died without a will (intestate and/or real executor doesn’t wish to accept the appointment).  So on whose behalf was he being appointed executor testamentary on executor nominated by will?” Stephanie asked.

Documents show that Shiri in 1995 appointed Gula-Ndebele as executor of his will and administrator of his estate together with late General Solomon Mujuru in the event that Gula-Ndebele would have failed to perform his duty properly. But Mujuru died in 2011 in a mysterious inferno at his Beatrice farmhouse.

In the will, Shiri bequeathed 50% of his bank savings, insurance policies to his now late son Titus and the other half of savings to his children Tatenda and Cynthia Shiri, and all his other children who were yet to be born and to come.

A death notice filed at the Master’s Offices indicated that three more children Tawanda (adopted son who stayed with his family for 10 years before he reportedly moved out), Stephanie and Tanaka were also listed as beneficiaries of Shiri’s estate.

“So this implies even those that Gula-Ndebele would want to include can only benefit from the savings and nothing else which then nullifies his distribution account which allocates shares to Tawanda Zulu and Tanaka Musvamhiri also in the overall estate distribution,” Stephanie argues.

Yesterday, Tanaka responded: “I do not dispute the documents that are being used by the Master of the High Court. I accept them as authentic. I can’t comment further, but I insist that I am the late minister’s daughter and I have proof to that effect.”

Zulu said: “I can’t comment on the matter. Those who are making claims on the authenticity of the documents are better placed to answer your questions.”

On April 12, 2021, Stephanie wrote to Mutasa requesting to be appointed as executrix dative of her father’s estate, since Gula-Ndebele as the executor testamentary had allegedly failed to register the estate following her father’s death.

On May 17, 2021, she wrote another letter requesting for the removal of Gula-Ndebele as the executor of Shiri’s estate, accusing him of neglecting his duties.

She also accused the executor of a litany of issues including failing to register the estate, read the will on time and to urgently address important issues for estate administration.

Stephanie recommended her lawyer to be appointed as executor of the late Shiri’s properties, in place of Gula-Ndebele and implored Mutasa to carry out investigations on suspected fraudulent acts on her father’s estate.

“Sometime in December 2020, the executor refused me the right to legal representation, violating my constitutional right to legal representation by a lawyer of my choice,” she stated in the letter.

“This is why my lawyers have been writing directly to the Office of the Master of the High Court because the executor refused them the opportunity to represent me. I, therefore, now appeal to your high offices as the Master of the High Court to remove the executor from office in terms of section 116 of the Administration of Estates Act (Chapter 6:01).”

She asked Mutasa to convene a meeting of the beneficiaries, with two sisters, Cynthia and Tatenda to appoint an executor.

But, Mutasa in response stated that there was no need for a meeting to deliberate on the dictates of section 116 of the Administration of Estates Act.

“We note that Ms Rufaro filed an objection to the account, which the executor has already filed. The estate appears to us to be almost finalised,” Mutasa said in a May 17, 2021, letter.

“What remains is to address the issues you raised as the basis for your objection to the account which we have forwarded to the executor and now awaits his responses before the office takes a position.

“On the issue of registration of the estate, please note that any of the interested parties connected to the deceased could have registered the estate and what Ms Rufaro did was completely in order. There was no need to wait for the lawyers to attend to the registration.”

Yesterday, Mutasa said: “I am not allowed to comment to the media without authorisation from the Judicial Service Commission secretary. I have to seek his authority first.”

Stephanie questioned why the Master’s Office had failed to remove Gula-Ndebele as executor of the Shiri estate given Shiri’s children’s misgivings over how the estate was being handled.

“We, therefore, appeal to the leadership of this country to see to it that those involved in these shenanigans are brought to book. This poses a serious security threat to us as beneficiaries if it’s not addressed urgently. We believe we still have a lot to benefit from our father’s colleagues, but there are people who would want to taint them for no reason. All culprits should be brought to book,” Stephanie said.

Gula-Ndebele was recently at the centre of a messy wrangle which erupted over the distribution of another hero’s estate which includes several houses, a farm, residential stands and cash.

Chief Makope Humiliated

By A Correspondent- Chief Makope of Mazowe district was left with an egg on his face after he tried to swindle five  villagers from Nyandirwi farm, Mvurwi by  ordering them  to pay a hefty combined fine of 40 beasts  for  cutting down trees in his area.

Dave Juna, Kudakwashe Chipura, Dunmore Masangoapera, William Nyoka and Asmaras Makuva did not honour the chief’s sentence and were dragged to Guruve magistrates courts facing a contempt of court charge.

The chief’s sentence was however dismissed after the court evaluated the case.

The suspects’ lawyer Alice N Mujakachi of BChipadza law Chambers told this publication that her clients were not given to argue their case at the chief’s court.

“My clients were exonerated by the magistrate court because the charge was purely defective, the allegations emanated from a ruling that was granted by Chief Makope were he ordered each accused to pay a hefty fine and eight beasts for cutting down trees on their plots citing that it was a scared place,” the lawyer said.

“The accused were not given a chance to argue their case at the chief’s court. They were later surprised to note the chief’s messenger approaching them to execute the order granted by the chief.”

Allegations are that  on 8 August the five were seen by chief’s advisors cutting down trees and were summoned to his traditional court were they were charged and sentenced.

Gvt To Compromise On Lobola

By A Correspondent- The government is prepared to compromise and agree to the inclusion of the payment of lobola as a legal requirement for registering customary unions in the proposed integrated Marriages Act.

This comes after traditional leaders, in the Senate, rejected a clause in the Bill which stipulates that payment of lobola must not be used as a prerequisite for a couple to register any marriage.

The clause says only the couple can make any conditions for marriage and that no one else can grant or withhold permission for a union.

Chiefs, however, insist that bride price was the hallmark of any customary union and have therefore steadfastly rejected the government’s argument that lobola could not be used as an obstacle in solemnising marriage by two consenting adults.

Justice, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi steered debate on the Bill again in the Senate on Wednesday, proposing that the Bill be passed, capturing the concerns of the traditional leaders over the lobola issue.

Ziyambi said continued deferment of the passage of the Bill over just one point had the effect of prejudicing the nation of other pertinent benefits in the proposed law such as criminalising child marriage which has been a menace in society of late.

Following a protracted debate, there was no headway resulting in another adjournment of the debate on the Bill.

The adjournment would now mean that the Bill would be re-tabled during the Fourth Session of the Ninth Parliament.

The Constitution provides that where the Senate and National Assembly disagrees on a Bill, it is the view of the National Assembly that will prevail, but Ziyambi said he was reluctant to take that route.

Fresh Details Emerge On Security Guard Who Killed ZUPCO Conductor

murderer

By A Correspondent- A security guard, who shot dead a ZUPCO bus conductor in Dzivaresekwa on Monday night, was first caught red-handed draining 25 litres of diesel from buses at Eagle Liner Coaches garage and fired a gun shot towards the bus company’s two employees who pursued him, a court heard.

Campion Marowa (35) of Dzivaresekwa, Harare was allegedly armed with a 38 Astra Revoler loaded with four rounds of ammunition.

The State led by Mrs Heather Mhlanga had it that on the day in question at around 5pm, Marowa commenced night duty at Eagle Liner Coaches garage while armed with a 38 Astra revolver loaded with four rounds of ammunition.

On the same day, Nqobile Nsingo, who works at Eagle Liner Coaches, knocked off duty and went into Harare’s city centre to buy some items.

Nsingo later realised that he had left his jersey at the workplace and upon arrival, he knocked at the gate expecting Marowa, who was on duty to open for him, but there was no response, which prompted him to use another entrance.

The court heard that while Nsingo was within the premises, he noticed that security lights had been switched off.

Nsingo then switched on the lights and spotted Marowa at the diesel pump trying to reassemble the pump pipes.

It is alleged that there was a 20 litre plastic container and another separate five litre plastic container that had been filled with diesel.

Nsingo then allegedly phoned his employer, Alex Kautsiro, who instructed him to manhandle Marowa.

It is alleged that Marowa then threatened Nsingo with the revolver before he fled from the place towards the CBD. Nqobile Nsingo and Simbarashe Bhaureni then pursued him, the court heard.

Upon realising that he was being tracked, Marowa fired a shot scaring away Nsingo and Bhaureni.

The two backtracked and went to lodge a complaint at Milton Park police station. It is said that at around 8.45pm on the same day, Marowa boarded a Zupco bus (ACL3930) where the late Joy Moyo was a conductor.

Marowa was allegedly armed with the revolver loaded with three rounds of ammunition.

The court heard that when the bus reached its destination, Marowa, was among the last passengers to disembark.

Allegations are that when the late Moyo was said to be completing her log sheets, Marowa pulled the trigger and shot her on the head.

Marowa allegedly disappeared into the night.

He was not asked to plead when he appeared before magistrate Mr Dennis Mangosi, who remanded him in custody to September 30.-statemedia

Shiri Predecessor In Court Over Gold Mine Dispute

By A Correspondent- Air Force of Zimbabwe (AFZ) commander Air Marshal Elson Moyo has approached the High Court to defend a gold mine court challenge.

He is defending a court challenge by a former subordinate he fired last year for trespassing into a gold mine Kwekwe.

Air Marshal Moyo fired Mr Thembelani Ndlovu, an AFZ serviceman, last year in June for allegedly trespassing into Goodhope Mine in Kwekwe sometime last year.

Air Marshal Moyo argued that Mr Ndlovu’s dismissal was fair and above board.

Mr Ndlovu is challenging his dismissal and accuses his former employers of violating his constitutional right by discharging him without conducting a disciplinary hearing.
Mr Ndlovu has filed an application for review at the Bulawayo High Court citing Air Marshal Moyo and the Zimbabwe Defence Forces (ZDF) Commission as respondents.
In his founding affidavit, Mr Ndlovu, who is a self-actor, said he was dismissed from the AFZ without notice.
Air Marshal Moyo, through the Civil Division in the Attorney-General’s Office, yesterday filed a notice of opposition challenging Mr Ndlovu’s application.

In his opposing affidavit, Air Marshal Moyo said the termination of the applicant’s service was done in accordance with the law.
“Authority to sit a board and inquire into the applicant’s suitability to continue serving in the AFZ was obtained through a convening order. Moreover, a member of the Zimbabwe Defence Forces may be subjected to both criminal and disciplinary law in respect of the same set of facts,” Air Marshal Moyo said.
“The applicant cannot therefore exceptionally rely on the outcome of the proceedings in the criminal court without also looking at the disciplinary proceedings.”
Air Marshal Moyo said in discharging Mr Ndlovu, he relied on the reasons that were proffered by the board of suitability in its recommendations.
“The applicant’s behaviour fell short of the required standards of a member of the disciplined force. I, therefore, exercised my discretion judiciously and fairly having taken into consideration the factors in question,” he argued.
Air Marshal Moyo said Mr Ndlovu became aware of his discharge from the AFZ in June 2020 and therefore had ample time to prepare and lodge his application for review before the lapse of time.

“The applicant failed to display a sense of urgency as it took him 14 months to seek condonation. It is humbly submitted that the applicant’s delay was inordinate. His explanation is not at all satisfactory thus the case is doomed to fail on review,” he said.
Air Marshal Moyo said Mr Ndlovu was examined by the board and responded to all its questions. “The applicant was asked if he wanted legal representation to which he declined. This is contrary to his averment that his right to legal representation and to be heard was violated,” he said.
In his application, Mr Ndlovu argued that the respondents’ decision to fire him was arrived at in a malicious manner.
“There was also bias, malice and procedural irregularities in the manner in which the process was conducted,” Mr Ndlovu said.
Mr Ndlovu said he was taken to the Kadoma Magistrates’ Court on allegations of trespassing and the charges were withdrawn before plea.
“Subsequently, the second respondent (Air Marshal Elson Moyo) discharged me from the Air Force of Zimbabwe without any notice whatsoever. Further, he never conducted any disciplinary hearing in terms of the Defence Forces Act and as such his decision is a nullity at law,” he said.

Lawyers Clash With Mnangagwa Over Enforcement Of Vaccination…

Jah Prayzah Opens Up On New Business Plans

By A Correspondent- Musician Jah Prayzah says he wants to invest in music advertisement.

The music sensation who this year released eight videos off his latest album Gwara, was ecstatic at the feat which he described as a milestone on Zimbabwean terms.

“In other countries like Nigeria who have huge populations of over 200 million, one million Facebook followers is nothing but in Zimbabwe with our population of less than 15 million, having one million followers who are all organic is huge!” said the dreadlocked musician.

He stressed that having organic followers on social media will give an artiste an idea on what direction to follow.

“This milestone means we now know where our people are and we no longer need to stick to the traditional advertising methods like posters and billboards.

“We can now directly talk to the people that love us through our social media pages like Facebook,” he said.

Jah added that there are a number of advantages of using social media for artistes.

“What I love about social media is communication with the fans is instant and we get to view their feedback almost immediately. Dialogue is also possible because social media came and changed the game.

“We are happy with our followers not just on Facebook but other social media networks like Twitter and Instagram. We are also very happy with our YouTube numbers and subscribers,” he said.

Jah even shared some tips for artistes on how to grow their following on social media.

“If you want followers, you have to entertain people. You cannot just start a page and expect it to grow when you are not posting anything to engage your audience. You have to put some effort. You have to feed your followers with regular content, be it a funny picture, a skit or video.

“That is the strategy we have used and it is working as shown by these one million followers. I do not take them for granted for they each took their time to click ‘like’ on my Facebook Page so I’m always thinking of ways to entertain them and make it worth their while,” he said.

The response from Jah’s fans and corporate partners was overwhelming and below are some of the comments that appeared on social media.

Congratulations Jah Prayzah on hitting one million Facebook followers! It takes hard work, persistence and determination to find such loyalty from your audience. Keep shining, keep going Mwendaz, you are a shooting star. We are proud to have you as our brand ambassador.

About Prostate Cancer

Prostate Cancer
The prostate gland is an organ found only in males positioned just below the bladder and surrounds the top portion of the tube that drains urine from the bladder. The major function of the prostate is to produce fluids that nourishes and transports sperms.

This organ called the prostate gland is more likely to develop cancer. Cancer occurs when cells in the body start to grow without control.

Cells in nearly any part of the body can become cancer cells, and can then spread to other parts of the body.

Prostate cancer is a type of cancer that affects the prostate gland. It is one of the most common types of cancer in males. Many prostate cancers grow slowly and are confined to the prostate gland. However, while some types of prostate cancer grow slowly and may require minimal or even no treatment, other types are aggressive and can vastly spread to other parts of the body.

Some of the signs of prostate cancer include.

• Frequent urination.

• Weak or interrupted urine flow or the need to strain to empty the bladder.

• Frequent urge to urinate at night.

• Blood in the urine.

• New onset of erectile dysfunction.

• Pain or burning during urination, which is much less common.

• Discomfort or pain when sitting, caused by an enlarged prostate.

• Back pain and bone pain if cancer have spread.

Risk factors for prostate cancer include:

  1. Age- common in the elderly usually above 50years
  2. Race- blacks have a high risk of having aggressive and advanced prostate cancer
  3. Family history- previous history of prostate cancer or breast cancer has shown an increased risk of having prostate cancer.

How to know you have prostate cancer?

Prostate cancer sometimes in its early stages one is asymptomatic and difficult to tell if they have prostate cancer.

Even with symptoms above one cannot tell alone with that as other prostate diseases might have similar symptoms.

If one suspects or have symptoms above should consult a doctor to have a physical examination and investigations done to assess if they have prostate cancer.

Treatment can be started early and the type of treatment to be administered one will discuss with their doctor.

France Sends Home 3,000 Unvaccinated Health Workers

President Emmanuel Macron’s administration has sent home over 3,000 unvaccinated health workers, it has emerged.

Thousands of health professionals have been suspended without pay across France for failing to get vaccinated against COVID-19 before a deadline this week, France’s Health Minister Olivier Veran, has said.

Last week, France’s national public health ministry estimated that about 12% of hospital employees and 6% of private practise doctors had not yet been vaccinated.

“Some 3,000 suspensions were notified yesterday to employees at health centres and clinics who have not yet been vaccinated,” Veran said.

In France, vaccinations are now required for medical, home care, and emergency professionals, and the deadline for receiving at least one shot was Wednesday.

If that fails, they risk having their salary suspended or being unable to work. However, a high court has ruled that employees cannot be sacked outright.

The mandate was authorised by the French parliament last summer to safeguard patients and the general public from further COVID-19 outbreaks.

In France, more than 113,000 people have died from the virus, with health officials claiming that the majority of those hospitalised during the most recent outbreak were not vaccinated.

Overall, 70 per cent of the French have received both doses required to be fully vaccinated, which are available to everyone over age 12 — one of the highest rates in the world.

On Wednesday, the health ministry reported 79 Covid deaths over the previous 24 hours, bringing the French total to 115,829. – Agencies, AFP

Mnangagwa Fires Tribunal Head

President Emmerson Mnangagwa on Tuesday fired retired judge Justice Maphios Cheda as chairperson of a tribunal he set up to determine Justice Thompson James Mabhikwa’s fitness to hold the office of High Court judge.

Mnangagwa appointed Retired Justice November Matshiya as new chairperson of the tribunal in Proclamation 6 of 2021 under Statutory Instrument 233 of 2021.

In the proclamation, Mnangagwa said the investigations could be carried out with an extension of further six months after the expiry of the initial five months.

Justice Cheda was appointed chairperson of the tribunal on June 17, 2021.

“Now, therefore, under and by virtue of the powers vested in the President as afore said, I do hereby, by this proclamation, amend the proclamation published in Statutory Instrument 170A of 2021 by the deletion in paragraph (b) of the words, Retired Justice Maphios Cheda and the insertion of Retired Justice November Matshiya,” Mnangagwa said.

Justice Mabhikwa went under probe after nude pictures allegedly from his phone went viral on social media earlier this year.

The pictures exposed his alleged affair with Oratile Nare, a female staff member at the Bulawayo High Court.

It is alleged that Nare forwarded pictures from Mabhikwa’s phone to a judges’ WhatsApp group and contacts in his phone after she had discovered that the judge was flirting with another woman.

Chaka Mashoko, a procedural law lecturer and lawyer Phillipa Magnify Philips are the other members of the tribunal.

The tribunal is investigating whether or not Mabhikwa committed acts of sexual harassment or possessed pornographic material. -Newsday

Shurugwis Kill Mine Manager

A mine manager was attacked and killed on Wednesday night in Saruwe area, Mashonaland West, and the entire night shift of the mine has vanished with 20 tonnes of gold ore and a quantity of explosives.
Asst Comm Nyathi identified the dead man as Robert James Chilpott aged 68. A manhunt has been launched, focussing on the missing shift.

Although the details were still sketchy by yesterday, police suspect that the employees could have been in the habit of stealing gold or gold concentrates after processing the gold ore during the night.

In October 2019, ZRP Saruwe recovered 30 tonnes of chrome ore that had been stolen at a mine in Selous through connivance by employees at the mine. The driver of the truck was reported to have taken off with the chrome before the quantity could be verified and through assistance by other employees he managed to leave the company premises.

A report was then made to the police and the truck was intercepted at a roadblock. The chrome was valued at US$30 000.

Gold panners have also been embroiled in clashes over gold, which have left others seriously injured and others killed. In April this year, a man was allegedly murdered by an artisanal miner at a gold mill in Amatola within the Jumbo Mine area during a scuffle over gold proceeds.

Allegations were that the deceased, Richard Makoto, had sponsored a group of artisanal miners to mine the gold and in return would share with them the proceeds after selling the ore.

Reports said a heated argument arose between Makoto and the artisanal miners before one of them hit him on the head with a shovel, killing him instantly. -Herald
