MDC Alliance National women assembly acting chairlady honourable Muchirairwa Mugidho and nine senior MDC Chiredzi leaders were arrested on the 31 July 2020, after staging at demonstration in Chiredzi town.

On 31 July 2020, Zimbabweans across the political and socio-economic divide intended to demonstrate against corruption, unemployment mismanagement and high cost of living.

But the Zimbabwean government responded by deploying armed soldiers and police officers to prohibit Zimbabweans from demonstrating.

Prominent award winning journalist Hopewell Chin’ono , opposition leader Jacob Ngarivhume, MDC Alliance National youth organiser Godfrey Kuraone, MDC Alliance National vice-chair person Job “Wiwa”Sikhala were arrested for “organising and calling for demonstration on 30 July 2020.”

Yesterday, Hopewell Chin’ono and Jacob Ngarivhume were granted bail of
$10 000 rtgs and
$50 000 rtgs respectively after 45 days in Chikurubu maximum Prison.

A renowned legal expert Dr Alex Magaisa said, “Bail is a constitutional right.”

Therefore, delaying to give the accused person is infringing on the right of the accused.

Today, the following MDC Alliance party senior leaders will in Chiredzi court for remand at the Chiredzi Magistrate Court tomorrow, 3rd September 2020: MDC National acting chairlady Honourable Mugidho, Chiredzi West district chair James kampota, Victor Bhoko ,Tendai Dhangu, Simon Mupapuri , councillor Ropafadzo, Makumire , Melania Makara, Alexander Simbi, Lucky Mpungu, and Ordy.

The court proceedings starts at 8am today.

The above accused persons are on bail.

The accused persons are being represented by Zimbabwe Human Rights Lawyer advocate Martin Mureri.

MDC Alliance President Nelson Chamisa stated that ZANU PF goverment led by Mnangagwa are arresting MDC Alliance members, civic society leaders, lawyers, church leaders and journalists and perscuting them.

Zim’s Active Covid-19 Cases Rise

ONE more person succumbed to Covid-19 while 62 tested positive for the virus in Zimbabwe in the last 24 hours.

To date, 203 deaths have been reported while 6 559 people have contracted the global pandemic in Zimbabwe since the outbreak of the pandemic and many of these cases are from local transmissions.

According to the Ministry of Health and Child Care, the death was reported in Bulawayo which now has a cumulative 36 deaths.

The new positive cases were reported in Bulawayo, Harare, Manicaland, Mashonaland Central, Mashonaland West, Midlands and Matabeleland South.

The Ministry said the seven day rolling average for new cases further declined to 51 in the last 24 hours from 61 the previous day.

“As of 1 September 2020, Zimbabwe has now recorded 6 559 cases, 5 241 recoveries and 203 deaths. Sixty-two new cases and one death were reported in the last 24 hours.

Fifty-one are local cases and 11 are returnees from South Africa,” said the Ministry.

The Ministry added that 20 recoveries were reported with the national recovery rate at 79.9 percent while positivity for the 1 013 Polymerase Chain Reaction (PCR) tests done was 6.1 percent.
Active cases went up to 1 115 from 1074 the previous day.

Bulawayo now has a total of 1 281 confirmed cases, 36 deaths with 1 140 recoveries while Matabeleland North has a total of 114 cases, three deaths and 91 recoveries.

Matabeleland South has a total of 694 cases, six deaths and 501 recoveries while Midlands has a total of 545 cases, eight deaths and 490 recoveries.-Chronicle

Army Demolishes “Illegal” Houses Near National Heroes Acre

More than 20 houses that were illegally built in a cantonment area next to the National Heroes Acre have been demolished by the Zimbabwe National Army (ZNA) with the endorsement of Harare City Council, almost a year after the house owners ignored a court order to move.

The houses were built on fake stands created and parcelled out by land barons in the area opposite the National Sports Stadium on land assigned to the army.
More than 100 stands were fraudulently created in the open space, with the affected house owners yesterday claiming to have bought the stands from a cooperative they declined to name.

But they were unable to produce receipts or other documents showing proof of purchase, even fraudulent purchase.

A claim that the cooperative was in direct contact with Harare City Council was immediately shot down by the local authority which said it fully supported the demolitions as the houses had been built illegally.

Council said the house owners ignored a court order and repeated warnings for them to vacate.
“Council has a number of court orders to remove illegal structures.

We would like to advise all people who were served with eviction orders to voluntarily move off the illegally occupied pieces of land,” said City of Harare spokesperson Mr Michael Chideme.

A visit to the site yesterday showed that among the destroyed structures, were occupied houses and incomplete buildings at various stages of construction.
There was also a crèche which was operational.

ZNA spokesperson Lieutenant-Colonel Alphios Makotore yesterday confirmed that the land was a military zone and warned land barons and corrupt council officials against illegally creating and selling stands.

“Some corrupt land barons were parcelling out stands and selling them to desperate home-seekers. If offered a stand near the Heroes Acre, someone should ordinarily be circumspect,” he said.-Chronicle

Suspension Of Marondera Mayor Null And Void

Farai Dziva|The MDC Alliance has nullified the suspension of Marondera Mayor Chengetai Murowa saying it was done unprocedurally.

Murowa had been suspended for allegedly sympathizing with Thokozani Khupe’s political formation.

In a statement MDC Alliance described Murowa’s suspension as null and void.

We want to put it clear that the mayor of Marondera, his worship Chengetai Murowa is not suspended as reported.

He is not suspended as councillor, mayor or party member.

The said suspension as reported is dubious, flimsy and void.

Murowa is a member of the provincial executive and national council and in this case, cannot be suspended by a lower structure such as the constituency co-ordinating committee.

All our councillors in Marondera subscribe to the leadership of MDC-A, the party that sponsored them during the 2018 harmonised elections.

If there are any other issues of disharmony of some sort the party leadership has got the capacity to unite our family for the good of Marondera residents and rate payers.

Govt Performs Sudden U-Turn: USD3,5 Bln PayOut Is Just for 37 Farms

Ministers have responded to the issue of reversing the Land Reform Programme saying the government is not at all doing that.

The development comes as 2 months ago, Zimbabwe agreed to pay $3.5 billion in compensation to local white farmers whose land was forcibly taken by the government to resettle Black families, moving a step closer to resolving one the most divisive policies of the Robert Mugabe era.

They said there would be no major disruptions to agriculture as only a few indigenous farmers were likely to be affected by reallocations, while a mere 37 farms covered by Bilateral Investment Promotion and Protection Agreements (BIPPAS) would be offered back to farmers who were dispossessed.

Lands, Agriculture, Water and Rural Resettlement Minister Dr Anxious Masuka yesterday said only indigenous farmers who were dispossessed of their properties during the Land Reform Programme and those covered under BIPPAs, would have the opportunity to get their land back.

The Government classifies indigenous farmers as people of Zimbabwean origin who were previously marginalised before 1980 and had acquired land either through direct purchase or through Government commercial farm schemes before the land revolution.

These farmers would either get their land back or get full compensation for the agricultural land acquired and improvements that were done on the farms.

Section 295 (1) subsection 2 of the Constitution also provides for the full compensation of persons whose agricultural land was acquired, yet it was protected.

“There is no confusion because the Constitution of Zimbabwe is very clear, Section 295 subsection 1 and subsection 2 that we have an obligation to compensate for land and improvements for indigenous Zimbabweans who constitute only 1,3 percent of the 18 600 farmers that were allocated land.

“We also have an obligation under the Constitution, to consider the BIPPAS and Bilateral Investment Treaty and those constitute just under one percent of the 18 600 beneficiaries. Those fall in the category that the SI 62 of 2020 clearly explains.

“When an application is lodged with the minister, there is consideration whether in the public interest and security of the country there is merit in doing so. Where it is no longer possible then compensation is offered,” he said.

Minister Masuka said former owners, who are still on the farms but had not regularised, should immediately approach the relevant Government offices around the country to lodge their applications.

“This indicates that the land reform programme is irreversible. So those that are there ought to follow the law because the land is vested in the State and that category of farmers is 294 and again about one percent of the 18 600. Altogether the numbers that we are looking at addressing, redressing for the clarity we gave on Monday affects a mere 3,2 percent of the beneficiaries. You will not notice because it’s a minute proportion of the beneficiaries,” he said.

He said the ministry would explain the process in vernacular to ensure everyone understood that land reform was irreversible.

“The Global Compensation Deed clearly articulates that and there is acceptance by both parties that we now want to move to a second stage which is ensuring that we increase agricultural productivity, we increase production and profitability; agriculture becomes a business and this country is way up in into food security territory from now into the future.

“Government is genuine and has done the best under the circumstances and provision of the Constitution which we overwhelmingly adopted in 2013,” he said.

This position was also reaffirmed in Parliament yesterday by Justice, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi after queries from the opposition on the import of the new Government policy which has been misinterpreted in many circles.

Responding to questions from MDC Alliance Harare East legislator Mr Tendai Biti, Minister Ziyambi said the pronouncement on compensation for white former commercial farmers was not a reversal of the Land Reform Programme.

“What we are doing now is to bring closure to the Land Reform Programme so that we move forward and focus on production,” he said.

He shot down suggestions that Parliament should have been involved in discussing the compensation deal.

“That is the role of the Executive and we will only bring it to Parliament for approval. If there is need to use taxpayers’ money, the Appropriation Bill for that will come to Parliament,” Minister Ziyambi added.

In an earlier interview with The Herald , Minister Ziyambi allayed fears of a reversal of the land revolution, saying Government would only offer land back to two categories of farmers who were dispossessed under land reform, namely black indigenous farmers and white farmers who were protected by Bilateral Investment Promotion and Protection Agreements (BIPPAs) signed between Zimbabwe and their countries.

There have been misinterpretations of Statutory Instrument 62 with some people speculating that the Government was reversing the land reform programme.

Meanwhile, Zanu PF acting secretary for Information and Publicity Patrick Chinamasa yesterday said land reform was something that the revolutionary party guarded jealously.

Speaking at the ruling party’s weekly press conference, Chinamasa said: “The issues pertaining to the land question where settled in a referendum in 2013 giving rise to our current Constitution. Section 295 of the Constitution as read with subsections 7 and 8 of section 72 of the Constitution clearly spell out the issues pertaining to compensation for land under three categories: land compulsorily acquired which was owned by indigenous black Zimbabweans, land compulsorily acquired which was owned by citizens of other countries who enjoyed protection under Bilateral Protection Agreements (BIPPAs) and land and falling outside of these two categories

Chinamasa said that land which fell under BIPPAs and compulsorily acquired would not constitute 1 percent of the total hectarage compulsorily acquired.

He warned the MDC-A and the former colonisers to stop lecturing the Government on the land redistribution exercise.

“The MDC and its allies who resisted the land reform process, and begged sanctions for our people to be punished for taking back the land cannot lecture or school us about land reform,” said Chinamasa.

The revolutionary land redistribution programme embarked upon by the Zanu PF Government from 2000 to date has been a most powerful and effective tool of empowering the previously disadvantaged black population of Zimbabwe and had made the Zimbabwean population, post-colonialism, one of the most empowered populations regionally and continentally.

In order to render the land redistribution programme irreversible in practical terms and to bring finality to the land question, it was incumbent on Government to expedite the issuance of permits to the more than 350 000 households who benefited under the A1 scheme and granting of 99-year leases to the more than 19 000 beneficiaries under the A2 scheme. -Herald

Government Makes Frantic Efforts To Suppress Black Market

Money changers in the country are finding the going tough following the ban on mobile money agent lines and the introduction of daily transaction limits.

The Reserve of Zimbabwe recently banned mobile money agent lines as well as set $5 000 as the cap for daily transactions for individuals.

The central bank also introduced a policy that limits mobile wallet users to only one account per individual.

Agent lines were being used across the country to cash-in and cash-out as well as for sales transactions.

The RBZ suspected that some of the lines were being used to fuel the black market causing a spike in foreign currency rates.

Government in June this year ordered the suspension of mobile transactions to allow for investigations in the parallel market.

“Agent wallets are no longer serving any legitimate purpose and were now being used primarily for illegal foreign exchange transactions.

Agents’ mobile money wallets are therefore abolished, with immediate effect,” the RBZ said recently in its Mid-term monetary policy statement.

MDC Alliance Secretary General Chalton Hwende, quoted by NewsDay, accused ZEC of violating the rights of thousands of voters who chose legislators of their choice.

“It is the same as what happened in 2018 when a man who lost the Presidential elections was sworn in as President.

What is happening now is that Zanu PF is using Zec in a subtle process of stealing seats from MDC Alliance and giving them to the MDC-T.

We are not surprised, they can do what they want, but we will not betray the people’s struggle.

They took away the rights of people who woke up at 4am to go and cast their votes.

I am here in Kuwadzana doing projects and residents are already signing their objections to imposition of MPs by ZEC and Khupe.

A number of people will challenge this move throughout the country, but we also know that dictators do not respect the Constitution and will do anything to subvert the people’s vote,” said Hwende.

For once, I totally agree with Stephen Chan; by denying that there was no political and economic crisis in Zimbabwe and humiliating President Cyril Ramaphosa’s first envoy; Mnangagwa crossed the double red line!

The corona virus pandemic has forced many Zimbabweans who had gone to SA and the other neighbouring countries to escape political oppression and economic poverty to return back home. The tide of humanity has since slowed to a trickle as word got round that the economic situation in SA, Botswana, etc. are bad but nothing compared to that in Zimbabwe. Nothing!

Mark my words, as soon as the corona virus pandemic blows over, the flood gates of Zimbabweans going back to SA, Botswana, etc. will open! Indeed, President Ramaphosa knows this too. “We are having to deal with a situation on our borders,” he reminded Mnangagwa.

“We are in a situation where everyone who wants a distraction from their own issues, takes a potshot at Zimbabwe,” tweeted Mangwana; in sheer exasperation of one who knows the game is up.

President Mnangagwa will not dare stop Ace Magashule, ANC secretary general, led special envoy nor stop the delegation meeting with whoever else they want in Zimbabwe.

All Mnangagwa will do now is line up his Government Organised NGOs (GONGO), POLAD, etc. They will repeat one after the other, ad nauseam, that the July 2018 elections were free, fair and credible the Zanu PF regime is the legitimate government in Zimbabwe. They will concede the need for political unity and some power sharing arrangement but would insist on Zanu PF playing the leading role.

Chamisa will line up his civic society ducks too and they will tell Comrade Magashule Chamisa won the July 2018 presidential race (they will ignore the fact that he, just like ZEC, failed to produce the V11 forms, etc.) and legitimacy can now be restored by appointing Chamisa and a few other MDC leaders ministers in a power sharing arrangement.

To find a meaningful solution to Zimbabwe’s 40 years of political and economic crisis one must first acknowledge its root cause – the country’s failure to hold free, fair and credible elections. Of course, Zanu PF blatantly rigged the July 2018 elections. The regime is illegitimate and must step down.

President Ramaphosa should know that a Zanu PF and MDC GNU will never implement the democratic reforms necessary for free, fair and credible elections, the pre-requisite for good governance and ending the crisis in Zimbabwe.

He has in his cabinet individuals like Minister Lindiwe Zulu who were heavily involved in the 2008 to 2013 GNU that failed to implement even one reform. It is naive, to say the least, to expect the same Zanu PF and MDC leaders from the 2008 GNU to implement the reforms this second time round.

President Ramaphosa does not have the political will to tell Mnangagwa he rigged the July 2018 elections and must step down. He will, instead, propose a new Zanu PF and MDC GNU in Zimbabwe knowing fully well it too, just like the 2008 GNU, will not end the crisis.

Zanu PF will never ever reform itself out of office. Never! By imposing yet another Zanu PF GNU President Cyril Ramaphosa will be racking up political and economic pressure on himself and SA because he will have, knowingly, inherited the Zimbabwe crisis as his own!

SA has 628 259 confirmed covid-19 cases and 14 263 deaths compared to Zimbabwe’s 6559 cases and 203 deaths. Zimbabwe’s population is 1/4 that of SA. The truth is Zimbabwe’s corona virus figures are artificially low only because the country has not been testing, tracing and tracking as aggressively as SA. Whilst SA had carried out 3 million tests to end July, Zimbabwe had only done 145 000 tests in the same period.

Both SA and Zimbabwe have clearly taking a hammer blow from corona virus pandemic and the social, humanitarian and economic consequences will be felt for the next decade or more. SA will have her own very serious economic and social problems to deal with.

By, once again, failing to deal with the Zimbabwe crisis SA will invite Zimbabwe’s problems on herself. Zimbabweans, escaping from the country’s economic, political and now corona virus hammer blow, will flood back into SA.

President Ramaphosa cannot say he was not warned that a new Zanu PF led GNU as a solution to the Zimbabwe crisis was a waste of time. He was warned, repeatedly!

National Railways of Zimbabwe (NRZ) workers have expressed concern over “hefty” exit packages reportedly being demanded by ex-general manager Engineer Lewis Mukwada and three other directors.

The other three directors are Mr Misheck Matanhire (director corporate services), Mr Samson Bhuza (director operations) and Mr Elector Mafunga (director marketing).

Transport and Infrastructural Development Minister Joe Biggie Matiza has instructed the NRZ board, which is chaired by Advocate Martin Dinha to move with speed in restructuring the parastatal and bringing in “fresh blood” to turnaround the fortunes of the entity.

It is against this background that the restructuring of senior management at NRZ has seen the four relieved of their duties.

Close sources have revealed that former senior executives are reportedly demanding US$80 000 each in addition to the new Prado Land Cruiser V8 for Eng Mukwada and three Toyota Fortuner vehicles for the other three ex-directors, which the parastatal bought sometime this year.

Zimbabwe Amalgamated Railway Workers Union president Mr Kamurai Moyo, said the matter should be addressed using the Labour Act Amendment Number 5 of 2015.

“This is a very clear case because in terms of the Labour Act, Amendment Number 5 of 2015, it clearly stipulates the exit package and this is not discriminatory to any employee,” he said.

“So, if there are certain employees who are demanding more than what is stipulated by the Amended Act, even though they say that law just provide minimum standard for negotiations, I think somehow, it will not be fair especially for those who were exited using the same provision of the Labour Act. The law is there, so why can’t they use that as the basis for negotiating the exit packages,” he said.

Some of the NRZ workers who spoke on condition of anonymity said it was not fair to have the exiting managers pampered with such a package.

“As shopfloor workers within NRZ, we are saying these guys should not even leave with anything. They destroyed the NRZ and some of them have worked for over two decades, but haven’t done anything worth their stay at NRZ,” fumed one of the workers.

“We hear that they want to be given hefty exit packages of US$80 000 each or an equivalent of that amount in local currency. This is in addition to top of the range vehicles they bought themselves sometime this year.”

Advocate Dinha and Eng Mukwada could not be reached for comment.

However, NRZ public relations manager Mr Nyasha Maravanyika, said: “This is a policy issue to be determined by Government through the Ministry of Transport and Infrastructural Development as well as the Office of the President and Cabinet.

“I am sure the Government will definitely not do things that will cripple NRZ because the shareholder’s thrust is to revive NRZ. We believe that it is in the hands of the ministry and the board. Remember there are laws, regulations and procedures to follow,” he said.

“We believe the shareholder will do what would make NRZ tick and also if these people have worked to satisfaction, definitely Government will be obliged to ensure they are given exit packages that are in tandem with their contracts.”

The workers contend that it’s not fair to pay hefty packages to ex-managers at a time NRZ was struggling. They queried why the sacked top management had bought themselves the said vehicles at the time they were about to leave the organisation and not at the time when they started their tenure.

It is understood that the former NRZ general manager’s new vehicle has already been delivered while the three Toyota Fortuner units for the other ex-directors were yet to arrive. The workers accused senior management of misappropriating funds meant to oil operations by prioritising top executive welfare.

“Most of our of customers are complaining that we have got over 200 wagons grounded at NRZ stations dotted across the country and yet over US$300 000 that was sourced to repair the locomotives was diverted to buying the cars and its actually being selfish,” said another worker. In July, Zimasco, one of NRZ major customers reported that the rail entity only managed to move 45 percent of their 89 000 chrome exports that was destined for the Far East through Beira by sea.

In the past, NRZ inefficiencies have been blamed on impropriety and maladministration. In 2019, NRZ moved 2,8 million tonnes of cargo against a projection of 4,2 million tonnes. At its peak in the 1990s, the parastatal moved 14,4 million tonnes against an installed capacity of 18 million tonnes annually. -Herald

A Zvishavane man who faked erectile dysfunction for 17 years to avoid having sex with his wife was exposed after he was arrested for rape.

Custon Jojo Machanja (68)’s wife shocked the court when she said her rape accused husband had not been intimate with her for 17 years, saying he was suffering from erectile dysfunction.

The woman said she was last intimate with her husband in 2003 and only got to know that he had been lying to her when he was arrested for rape and having sexual intercourse with a minor.

She told Gweru Provincial Magistrate Mrs Phathekile Msipa that for 17 years she lived a lie back in their rural home thinking that her husband had a sexual problem while he was busy “enjoying” other women including a minor in town.

Machanja from Zvishavane town is facing two counts of having sexual intercourse with a minor and rape.

The accused pleaded not guilty to the counts.
Machanja was remanded in custody to September 7 for judgment.

In his defence, he accused the girl of trying to frame him because he once had an affair with her mother.

Machanja said between 2016 and 2017, he had a sexual relationship with the complainant’s mother before having consensual sexual intercourse with the complainant.

“I had consensual sexual intercourse with the complainant and I also had an affair with her mother. They are fixing me,” he said.

Machanja’s wife who appeared as a witness told the court that she was shocked that her husband had a sexual affair with the complainant’s mother and was also having sexual intercourse with the complainant.

She said she thought that he had erectile dysfunction as he had told her back in 2003 when they last made love.

“All these years he would tell me that he can’t sleep with me because he is suffering from erectile dysfunction. I’m really shocked,” said Machanja’s wife.

It is the State case that in February last year, Machanja saw the minor on her way to school and told her that she is beautiful.
He allegedly took her to his dining room where he caressed her but could not have sex with her since she was on her menstrual period.

The court heard that in October, Machanja invited the minor to his house where he allegedly removed her uniform and they had consensual sexual intercourse.

The accused allegedly gave the complaint $6 before she proceeded to school and didn’t tell anyone.
Again, in October he slept with the minor and gave her $4.

The same month, the court heard that the two had sexual intercourse at the accused’s offices before he gave her $5.

On December 6, Machanja allegedly saw the complainant passing through his offices and told her that he wanted to give her some money to buy relish.

The court heard he invited the minor into his office where he wanted to have sex with her but she refused.

The court heard Machanja drew an okapi knife and threatened to stab her before he forcibly removed her jeans and raped her once.

Machanja, the court heard allegedly threatened to send goblins to deal with her if she told anyone about the incident.

The following day, the minor allegedly told her mother about her ordeal before the matter was reported to the police leading to Machanja’s arrest.

“Govt Position On Schools Opening Inconsiderate”: ARTUZ

By A Correspondent- The Amalgamated Rural Teachers Union of Zimbabwe (ARTUZ) said it is consulting parents through the School Development Association/ Committees to get their views on the Government’s plans to reopen schools for examination classes this month.

The Government announced on Tuesday that Cambridge examination classes will commence on 14 September while ZIMSEC examination classes will resume on 28 September, with exams starting on 1 December.

In a statement, ARTUZ said the decision by the Government was inconsiderate amid the coronavirus crisis.

ARTUZ also said it will be conducting an online poll for teachers to ascertain their preparedness to report for duty this month. The statement read:

The government’s position to open schools on the 14th of September for Cambridge examination classes and 28th of September for Zimsec classes before teachers grievances are fully addressed is inconsiderate.

As Amalgamated Rural Teachers Union of Zimbabwe, ARTUZ we are engaging stakeholders such as parents through the School Development Association/ Committees to give us their view on this inconsiderate decision taken by the government.

We are also engaging the health sector at provincial and district levels to assess the state and preparedness of hospitals in case of the outburst of COVID-19 in schools.

The recommendations by the health sector will determine whether we can encourage our members to report for work.

Basically, the safety of learners and teachers from COVID-19 must be fully guaranteed in schools. The government must first test all learners and teachers, provide PPEs, fumigate all learning facilities that were used as quarantine centres.

The cost of living is beyond the reach of every teacher. All basic needs are priced in USD at a time when teachers are remunerated in useless RTGS$.

To get a detailed view of nearly every teacher concerning the preparedness to report for work, we are running an online poll. An evaluation report on the recommendations will determine our next step.

The teachers, learners and parents should agree on the next steps. Government officials are not part of the school ecosystem, their declarations are not binding.

We will make a decision based on safety, remuneration and right to education.

“Respect Our Choices”: Masvingo Voters Tell ZEC

By Ryan Chiwara- Masvingo province registered voters have joined others parts in objecting to Thokozani Khupe party list candidates seeking to replace Movement for Democratic Change Alliance recalled parliamentarians.

The MDC Alliance legislators were recalled by the MDC T led by hope following a supreme court ruling in which imposed Khupe as the acting president of MDC T.

The MDC T has since released a list of individuals they want to replace those whom they have recalled. On the list Khupe is to replace former MDC Alliance legislator Tabitha Khumalo in Bulawayo province.

Masvingo MDC Alliance legislator Muchirairwa Mugido was recalled from parliament by Khupe for siding with MDC Alliance president Advocate Nelson Chamisa.

Zimbabwe Electoral Commission (ZEC) chairperson Justice Priscilla Chigumba has invited voters with objections to lodge them with her office before the nominations are confirmed.

“The public is hereby notified, in terms of section 39 (6) of the Electoral Act (Chapter2:13) that the MDC party has nominated party list members of the National Assembly and the Senate listed in the schedules below to fill in the vacancies in the National Assembly and the Senate that occurred following the recall by the MDC-T of the incumbent on the grounds that they had ceased to be members of that party,” reads the notice published by Chigumba.

One of the party list objection affidavits seen by this writer stated the grounds for objections

, “Section 45E of the electoral Act is explicit on the requirements for the identity of the party nominating the party list candidates, specifically, the Name, Party Abbreviation and Distinctive Symbols which should appear on the ballot paper. Accordingly, in the July 2018 Harmonised elections the MDC-A submitted its party list using the name Movement for Democratic Change Alliance, abbreviated as MDC-A and the characteristic distinctive symbol of an open palm and the face Adv Nelson Chamisa inside it.

“It is in this respect that the MDC -A has exclusive right to nominate replacements for the candidates to the party list , and that no any other party has the locus standi to make any such replacements outside the purview of the 2018 Harmonized Elections requirements as stated in section 45 of the Electoral Act.

“At the July 2018 Harmonised elections I voted for the MDC-A constituency candidate and my vote contributed to the cumulative provincial total votes which formed the basis for the allocation of the proportional representation or senate seats as specified in the Eighth schedule of the electoral Act.

“The Zimbabwe Electoral Commission has a duty to respect the outcome of the prescribed formula in the Eighth schedule of the electoral act by allocating the MDC-A its right full seats and not allow any other political entity to usurp the party ‘s right to choose its representatives.

“Failure to abide by its duty is an infringement of my Right of Assembly and Association as spelt out in Section 58 of the constitution,” read the affidavit.

Emmerson Mnangagwa’s spokesperson George Charamba has said the South African nation is a problem.

Charamba made his comments just as President Cyril Ramaphosa sent to Harare a second group of envoys to mediate the current crisis.

The comments also come in at a time when the courts released the two jailed: politician Jacob Ngarivhume, and journo Hopewell Chinono who have endured more than a month in the Chikurubi maximum prison on charges of plotting to overthrow the government or organising a violent uprising.

Writing on Twitter, Charamba said South Africa was deluded in supposing that it has the capacity to deal with the challenges facing the SADC region. He said: “South Africa is no donor State in SADC.

“If anything, its long apartheid legacy makes its post-1994 subregional role quite problematic for the rest of SADC States who know the continued dominance of Afrikaner capital in SADC does not benefit the ANC or blacks in Soweto or Khayelitsha.

“That is the sordid truth.

“South Africa cannot intervene militarily in any SADC country. That lesson was driven home during the Mandela days when it sought to do so in Lesotho. Since that disastrous escapade, South African diplomacy has been tempered and restrained to function within SADC structures, as should be!

“Just what is the logic and implication of Zimbabweans of insufficient history and national consciousness asking for South African intervention in Zimbabwe outside SADC structures?”

Money Chargers Giving Up

MONEY changers in the country are finding the going tough following the ban on mobile money agent lines and the introduction of daily transaction limits.

The Reserve Bank of Zimbabwe (RBZ) recently banned mobile money agent lines as well and set $5 000 as the cap for daily transactions for individuals.

The central bank also introduced a policy that limits mobile wallet users to only one account per individual. Agent lines were being used across the country to cash-in and cash-out as well as for sales transactions. The RBZ suspected that some of the lines were being used to fuel the black market causing a spike in foreign currency rates.

Following the recent daily and monthly limits pronouncement by the central bank, foreign currency dealers had resorted to multiple accounts to sustain their operations.

“Since the lockdown began in March our job has become difficult as authorities are closing all avenues for us. Now this latest ban on agent lines and the cap in daily mobile transactions has totally frustrated our business,” said one money changer in Bulawayo.

Others have since quit the trade and opted for other income generating avenues. “Running battles with police is not a nice thing, worse as a woman. I have since quit ukuphathelisa (money changing) and opted for vending where I now sell products at home. I am not going to town anymore,” said another money changer.

Others said they will remain fighting for their space, claiming that business was still there.

“The squeeze on our operations by authorities is good because it has weeded out chancers and left genuine players.

“We have been in this business for long and know how to survive. It’s good that a few players remain and not have everyone changing money,” said another operator at Tredgold.

The RBZ in June this year introduced the foreign currency auction system to determine the Zimbabwe dollar exchange rate. Since the weekly auctions were introduced, the foreign exchange rate has stabilised and the black-market rate has been tamed.

Government in June this year ordered the suspension of mobile transactions to allow for investigations in the parallel market.

“Agent wallets are no longer serving any legitimate purpose and were now being used primarily for illegal foreign exchange transactions.

“Agents’ mobile money wallets are therefore abolished, with immediate effect,” the RBZ said recently in its Mid-term monetary policy statement.

When Ecocash was first introduced, agent lines were used for cash-in purposes at a low level. However, some unscrupulous individuals took advantage of cash shortages that the country is facing to fleece members of the public, charging almost 100 percent to cash out. The RBZ said agents who currently had funds in their accounts would transfer them into their bank accounts after providing sources of the money.

“Agents currently holding value in suspended and frozen wallets shall be allowed to liquidate the funds to their bank accounts, upon the Financial Intelligence Unit (FIU) having satisfied itself of the legitimacy of the source of the funds,” said the Apex Bank.

When the RBZ suspended and froze agent and bulk-payer wallets in June, mobile money operators allowed illegal foreign currency dealers to use multiple individual wallets as a means to bypass the transaction limits and continue with their illicit transactions.

“Mobile money operators shall, with immediate effect, close all multiple wallets, and allow just one wallet per individual,” directed the RBZ.

SA government finally starts to lean on Mnangagwa

South Africa is evidently dangling a few carrots in front of Zanu-PF’s nose to try to persuade the Zimbabwe ruling party to allow President Cyril Ramaphosa’s special envoys to meet the political opposition and civil society as part of Pretoria’s efforts to help the country resolve its growing political and economic crisis.

The Zimbabwe government wants South Africa’s help with personal protective equipment (PPE) and other equipment to fight the Covid-19 pandemic, as well as support in trying to secure international loans to tide it over its desperate economic crisis.

But Pretoria is evidently withholding the requested support until Zanu-PF drops its opposition to Ramaphosa’s three special envoys meeting all Zimbabwean stakeholders so as to get a broad and true picture of the causes and possible solutions to the crisis.

Special envoys Sydney Mufamadi, a former minister of safety and security and of provincial and local government; Baleka Mbete, a former deputy president and speaker of Parliament; and Ngoako Ramatlhodi, a former public service and administration minister, visited Harare on August 10, hoping to meet a broad range of politicians and civil society leaders to assess the crisis.

But after they had met President Emmerson Mnangagwa and Zanu-PF, he blocked them from meeting anyone else, including the main opposition party, the Movement for Democratic Change-Alliance led by Nelson Chamisa, as well as a smaller splinter group, the MDC-T lead by Thokozani Khupe. Mnangagwa told the envoys he had understood from his conversations with Ramaphosa that they were presidential envoys and so should meet only him.

Mufamadi protested that the envoys had sent him in advance their list of interlocutors with no objections raised, but Mnangagwa would not budge. He suggested that they should go home and report to Ramaphosa on their meeting with him and if necessary they could return to meet other players.

However, it is understood that Mnangagwa and Zanu-PF are now resisting the idea of a return visit by Ramaphosa’s envoys to meet these other players. Among those on the original agenda of the special envoys were the Zimbabwe Council of Churches, Mnangagwa’s dialogue forum the Political Actors Dialogue (POLAD), and the Zimbabwe Institute as well as the two MDC parties.

Pretoria is insisting the envoys should meet whoever they want to meet. Ramaphosa made this clear on Monday when he addressed a press conference after the ANC’s National Executive Committee (NEC) meeting. He said that in the extensive discussion which his envoys had had with Mnangagwa and Zanu-PF on August 10, “it became clear that they would need a process in which they would engage with other people. And it was felt we should give consideration to that.

“And that is obviously something we would want to see happen.”

In the meantime, he said that Mnangagwa had told him that he would like the ANC as a political party to meet Zanu-PF’s Politburo, and so ANC Secretary-General Ace Magashule and his Zanu-PF counterpart were now arranging for this visit to take place “within days”.

Ramaphosa added that the NEC had “expressed the deep desire” that the ANC mission should also have the opportunity of meeting other stakeholders.

“Clearly, it’s important we get as broad a view of what is happening as we possibly can,” Ramaphosa said – because South Africa was feeling the impact of the Zimbabwe crisis on its own borders. This was clearly a reference to the large numbers of Zimbabweans illegally crossing the border into South Africa, mainly to escape economic hardship.

Despite the NEC’s wish for the ANC delegation to meet a broad range of Zimbabwean stakeholders, it is understood that Pretoria feels it would be better for the ANC to meet only its ruling party counterpart, Zanu-PF, while Ramaphosa’s special envoys – who have a different mandate as they represent the South African government – should meet the other stakeholders, as they had originally intended to do on August 10.

Zanu-PF would evidently prefer the envoys’ mission to be merged with that of the ANC and for neither to meet the opposition and civil society.

As a result of this intransigence, there are indications that Pretoria might have started to exert economic pressure on Zanu-PF – something it has rarely done before, if at all.

The bankrupt Zanu-PF government has requested South African government support in acquiring personal protection and other equipment to fight Covid-19. It has also asked Pretoria to help it secure private international loans, though what form this assistance might take is not clear yet.

The ANC government’s response to Harare has been to say it cannot justify to its constituency providing such support to Zimbabwe while Harare is preventing it from meeting all stakeholders to try to resolve the crisis which has made such South African support necessary in the first place.

South Africa has another potential lever in that it is also providing Zimbabwe with significant amounts of grain to prevent starvation in a population where about half are suffering food insecurity.

But it is not clear if Pretoria would also use this grain supply – which comes in the form of a donation, not a loan – as a political lever as it is regarded as humanitarian support.

Emmerson Mnangagwa’s Attempt To Impose Khupe MPs On Electorate Exposed

MDC Alliance Secretary General Chalton Hwende, quoted by NewsDay, accused ZEC of violating the rights of thousands of voters who chose legislators of their choice.

“It is the same as what happened in 2018 when a man who lost the Presidential elections was sworn in as President.

What is happening now is that Zanu PF is using Zec in a subtle process of stealing seats from MDC Alliance and giving them to the MDC-T.

We are not surprised, they can do what they want, but we will not betray the people’s struggle.

They took away the rights of people who woke up at 4am to go and cast their votes.

I am here in Kuwadzana doing projects and residents are already signing their objections to imposition of MPs by ZEC and Khupe.

A number of people will challenge this move throughout the country, but we also know that dictators do not respect the Constitution and will do anything to subvert the people’s vote,” said Hwende.

Machete Thugs Resurface With A Vengeance

Gangs armed with machetes and knobkerries have resurfaced countrywide, targeting mines and individuals keeping large amounts of cash, prompting police to relaunch “Operation Chikorokoza Ngachipere” and “No to Machete Wielding Gangs”.

A few months ago, police restored order in mining areas after taking on the gangs, arresting large numbers and thwarting a wave of violence. That gangland violence claimed the lives of several people and left many injured.

Police said since January this year, 12 330 machete gang members and other criminal elements have been arrested in mining communities countrywide.

Police launched the “Operation Chikorokoza Ngachipere”, following an outcry from citizens over machete-wielding robbers who were terrorising people in mining communities.

In an interview yesterday, national police spokesperson Assistant Commissioner Paul Nyathi said they had since intensified the operation.

“We can confirm that the ZRP has intensified an operation code named ‘Chikorokoza Ngachipere/ Isitsheketsha Kasipele’ and ‘No to Machete Wielding Gangs’,” he said.

Police have since been heavily deployed to some of the areas where illegal panning is rampant to ensure peace prevails. Anyone arrested will face the full wrath of the law as some of them are violating Covid-19 regulations.

Asst Comm Nyathi said they arrested two suspects last Thursday, who were part of a gang that was armed with machetes and raided a mine in Inyathi at night.

The two were arrested at Mucklenuck A2 Mine.

“The suspects struck the victim with a machete and stole cash amounting to US$200 and $400. A follow up was made leading to the arrest of the duo and investigations are still in progress,” Asst Comm Nyathi said.

Criminal activities by the marauding gangs of machete attackers have seen reports of murder, rape, assault, housebreaking and stock theft. Police statistics show that in the mineral-rich Midlands Province, reported criminal cases rose 33 percent in the first nine months of 2019 because of the influx of machete attackers.

Recently, machete gangs raided the Circle V mine in Shurugwi and stole a firearm and $5 000 cash, stabbing and injuring one mine employee in the process. Management said the money was part of the float used to buy gold at the mine. Lately, machete gangs have been targeting people dealing in cash around Harare.

I Have Been Arrested 64 Times And Never Fled – Job Sikhala

Alliance vice chairperson Job Sikhala told a court on Tuesday that he has been arrested on 64 occasions over the years, including being charged with treason, and he never failed to abide by conditions of his release on bail.

Sikhala made the argument as he appeared before Harare magistrate Lazini Ncube in his ongoing bail application.

The outspoken politician who was arrested on August 21 faces charges of inciting Zimbabweans to stage violent mass protests to oust President Emmerson Mnangagwa’s regime.

Sikhala told court that he is a family man who has been charged with more serious offences before, but did not give the police any trouble while on remand.

“The struggle for social justice has never been fought on the plane of violence, and the State should not invite me to a territory which I’m not part of,” he said.

“I’m not a flight risk and have never absconded even while facing more serious matters such as treason or subversion.”

Sikhala also told court that he was never a fugitive from justice, despite police putting his name on a list of 14 opposition and pro-democracy activists they said were wanted in connection with incitement of public violence ahead of planned protests on July 31.

It was his testimony that he was arrested while resting in his bedroom together with his wife, and not while hiding in a ceiling as alleged.

The legislator also told court that the CID Law and Order officers were aware of all his addresses, as such they could have looked for him there before assuming he was hiding.

He also told the court during cross-examination with the state that the officers including those handling his case knew him personally.

“The police went looking for me at my rural home but they knew my second address. They never bothered to look for me there,” he said.

“Detectives Makore and Mukova know me and they frequent my office asking for money to buy lunch or beer.”

He said the state was opposing bail because it was all planned since they told him following his arrest that he was going to rot in prison.

His bail hearing continues Wednesday.

Promising Rain Season Ahead

Zimbabwe is expected to receive normal to above normal rainfall for the 2020/21 season.

This was said by the Environmental, Climate, Tourism and Hospitality Industry Minister Mangaliso Ndlovu this morning through a virtual platform when he presented the 2020-21 seasonal forecast for Zimbabwe.

Region 1, which comprises the bulk of Mashonaland East, Mashonaland Central, north eastern parts of the Midlands and parts of Manicaland, will receive normal to above normal rains from October 2020 to March 2021.

Region 2, which consists of the bulk of Matabeleland North, parts of Midlands, and parts of Mashonaland West will receive normal to below normal rainfall during the period October to December 2020 and receive normal to above normal rainfall for the period January to March 2021.

Region 3, which consists of Masvingo, most parts of Midlands, extreme southern parts of Manicaland and the bulk of Matabeleland South will have normal to above normal rains from January to March 2021.

Ziyambi Ziyambi Has Been Living In Frustration Since 2014

JUSTICE, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi has filed for divorce saying the relationship with his wife has irretrievably broken down with no prospects of restoration.

Minister Ziyambi has for the past seven years, been estranged from his wife Florence Ziyambi, nee Mhizha, a lawyer and former deputy Prosecutor-General.

In his claim filed at the High Court, Minister Ziyambi is asking for a decree of divorce saying the couple have not lived together as husband and wife since sometime in 2014.

He argues that the marriage is just a shell as they have not shared conjugal rights since then. The couple has two adult children.

“Since then, the parties have developed diverging interests and have become incompatible and have lost all love and affection for each other,” said Minister Ziyambi in his papers.

During the subsistence of their marriage, the couple acquired movable property and the Minister strongly feels it is just and equitable that upon divorce, each party retains the movable property in his or her possession.

The immovable property which the plaintiff wants distributed includes houses in Westlea and St Martins suburbs in Harare both registered in Minister Ziyambi’s name and a house in Bluffhill, Harare, registered in his estranged wife’s name.

The Minister also prays for the Westlea house to be awarded to one of their daughters, Chido Maureen Ziyambi, while the couple retains ownership of the immovable properties registered in their respective names.

“It is just and equitable that plaintiff (Minister) continues to cater for Chido Maureen Ziyambi’s welfare and educational needs until she graduates or becomes self-sufficient whichever occurs first,” said Minister Ziyambi.

Mrs Ziyambi is yet to respond to the application and has 10 days to file her response to the divorce motion.

Charamba Says South Africa Is A Problem

Emmerson Mnangagwa’s spokesperson George Charamba has said the South African nation is a problem.

Charamba made his comments just as President Cyril Ramaphosa sent to Harare a second group of envoys to mediate the current crisis.

The comments also come in at a time when the courts released the two jailed: politician Jacob Ngarivhume, and journo Hopewell Chinono who have endured more than a month in the Chikurubi maximum prison on charges of plotting to overthrow the government or organising a violent uprising.

Writing on Twitter, Charamba said South Africa was deluded in supposing that it has the capacity to deal with the challenges facing the SADC region. He said: “South Africa is no donor State in SADC.

“If anything, its long apartheid legacy makes its post-1994 subregional role quite problematic for the rest of SADC States who know the continued dominance of Afrikaner capital in SADC does not benefit the ANC or blacks in Soweto or Khayelitsha.

“That is the sordid truth.

“South Africa cannot intervene militarily in any SADC country. That lesson was driven home during the Mandela days when it sought to do so in Lesotho. Since that disastrous escapade, South African diplomacy has been tempered and restrained to function within SADC structures, as should be!

“Just what is the logic and implication of Zimbabweans of insufficient history and national consciousness asking for South African intervention in Zimbabwe outside SADC structures?”

Govt Opens Tourism Sector And Airports After 5 Months

THE Government on Tuesday gave the tourism sector the green light to re-open after a five month closure owing to the outbreak of the Covid-19 pandemic.

Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa told a post-Cabinet briefing the opening up of the sector extends to airports, which will be allowed to resume domestic flights.

The country’s tourism sector, which is expected to contract by -7.4 percent in 2020, took the hardest hit from the outbreak of the coronavirus, which was first recorded in Zimbabwe at the end of March.

The pandemic led to the closure of all hospitality and leisure spots and resultantly loss of income for hospitality firms, workers and vendors whose livelihoods are directly dependent on the sector.

“Cabinet approved the resumption of the rest of tourism operations including boat operations,” Mutsvangwa said. “Government is finalizing on modalities for the re-opening of airports to support the resumption of the tourism sector.”

Zimbabwe’s airports and borders have been closed to foreign tourists since end of March, with citizens only allowed to return to the country. “The plan is to start with the resumption of domestic flights and then move to international flights,” Mutsvangwa said.

Zimbabwe has to date recorded 202 deaths, 6 497 cases of infection and 5 221 recoveries. The high recoveries rate of over 80 percent and the fact that most of the cases of infection were mild to moderate and being managed at home is among factors that influenced the decision to re-open the tourism sector, Mutsvangwa said.

Re-opening of the sector is expected to see a recovery in hotel occupancies, which took a serious hit, declining from 33 percent in January to as low as three percent in March. Government has said recovery of tourism in the last half of the year will focus mainly on domestic tourism as assessments continue to be made on opening the country up to international tourism.

Offensive Adult Material Posted Into Met Office Virtual Meeting

A virtual meeting hosted by the Meteorological Services Department National Climate Outlook Forum had to break midway after hackers posted pornographic material on the platform.

Environment, Climate, Tourism and Hospitality Industry permanent secretary Mr Munesu Munodawafa apologised on behalf of the Government, and spoke of the need to expedite the Cyber Security Bill.

The virtual meeting is discussing the 2020/21 agricultural season forecasted weather pattern.

“We had to break the Zoom virtual meeting following the posting of offensive adult material during the meeting by some unidentified hackers. Government seriously needs to expedite passage of the Cyber Security Bill. We need to create secure virtual platforms where Government business is conducted,” said Mr Munodawafa.

The virtual meeting resumed after about 10 minutes.

Garivhume Also Going Home

The High Court has granted Jacob Ngarivhume $50,000 bail following his arrest in July for organizing a nationwide protest over corruption and the deteriorating economic situation in Zimbabwe.

Justice Siyabona Musitu granted the Transform Zimbabwe leader the bail on condition that he does not use Twitter until his case is finalized, should surrender his passport to the court and report to the police three times a week.

Ngarivhume was denied bail three times together with freelance journalist, Hopewell Chin’ono, who is still detained at Chikurubi Maximum Prison.

Ngarivhume and Chin’ono are facing charges of inciting violence.

Hopewell Chinono Going Home After 43 Horrific Days.

The High Court has granted Hopewell Chin’ono $10 000 bail.

Chin’ono, who has spent 43 days in custody, appeared before Justice Tawanda Chitapi. He was charged along with political activist, Jacob Ngarivhume who has also been granted bail today.

Chin’ono and Ngarivhume were charged with incitement to commit public violence or alternatively incitement to participate in a gathering with the intent to promote public violence by posting messages through their Tweeter handles between March 1 and July 20, 2020.

It is alleged that while in Harare city centre, Chin’ono posted numerous messages on Twitter in an attempt to influence many people to engage in public violence or participate in a gathering that would disturb peace.

 

Mnangagwa Appoints Public Service Commission Deputy Chairperson

President Emmerson Mnangagwa has, with immediate effect, appointed Dr Nomathemba Ndiweni-Masuku as a commissioner and deputy chairperson of the Public Service Commission (PSC).

Chief Secretary to the President and Cabinet Dr Misheck Sibanda said the appointment was made in terms of section 202 (1)(a) of the Constitution read together with section 320(4) of the Constitution.

Dr Ndiweni-Masuku holds several professional qualifications including a Bachelor of Science Degree in Biochemistry from the University of Zimbabwe, a Master of Philosophy Degree in Biochemistry from the University of Cambridge and Post-graduate certificates in Education, Supervisory Management and Higher Education Management.

She has served on various boards including the Health Professions Authority of Zimbabwe, the Medical Research Council of Zimbabwe and the Zimbabwe Investment Authority.

“Dr Ndiweni-Masuku’s experience in the public and academic sector will assist the PSC, particularly at a time when government is setting up the Public Service Academy,” he said.

“She brings much needed expertise as a public administrator and a renowned member of the academic society and a member of the National Defence University Council.”

Dr Ndiweni-Masuku will deputise PSC chairman Dr Vincent Hungwe.

“Align Urban Councils, Local Government Acts”: Residents Associations

Residents Associations and Civic Society Organizations lamented over the possibility of appointment of commissions to run urban local due to the rampant recalls by the MDC and suspension of Councilors on allegations of corruption.

Speaking at the  Webinar National Discussion hosted by CHRA, Bulawayo Progressive Residents Association Director Emmanuel Ndlovu lamented that,‘ the level of corruption in Councils have created a fertile ground for appointment of commissions especially on the allocation of stands.”

Dr Davison Muchadenyika an Independent Local Government Expert highlighted that appointment of Commissions should be the last resort as it contravenes section 265 of the Constitution of Zimbabwe which states, “All members of local authorities must be elected by registered voters within the areas for which the local authorities are established.”

Residents’ representatives were worried that the appointment of Commissions to run local authorities was a threat to representative democracy and the current provisions governing the appointment of Commissions was open to manipulation by the Minister of Local Government.

The Director of Urban Council Association of Zimbabwe, Mr. Mutekede said,‘if commissions are appointed to run the local authorities they will not have powers to  levy rates, taxes,  increase any charge and to levy any charge without approval from the Minister” hence the Minister will be running local authorities.

Whenever there has been people of questionable character appointed to be Commissioners to run local authorities there has been citizens uproar over the appointments ,said Mr Mutekede.

Key recommendations that came out of the discussions were ;

  • Alignment of the Urban Councils Act 29:15  and Local Government Act of 2016 with the Constitution of Zimbabwe

v  There is a need to  have by-elections in areas where councilors are removed to ensure representation .

v  Engage political parties  on the mode  to have robust and effective ways of choosing eligible councilors to participate in primary elections.

v  Mobilization of constituencies to ensure that residents are aware of the government intentions in order to defend their vote.

v  Lobbying for the strengthening of municipalities to have clear systems and mechanisms to pluck out corruption.

v  If commissions are to be appointed there must be representatives drawn from rate payers, political parties and associations.

Blow For Khupe As Masvingo Voters Reject Selected Candidates

By Ryan Chiwara- Masvingo province registered voters have joined others parts in objecting to Thokozani Khupe party list candidates seeking to replace Movement for Democratic Change Alliance recalled parliamentarians.

The MDC Alliance legislators were recalled by the MDC T led by hope following a supreme court ruling in which imposed Khupe as the acting president of MDC T.

The MDC T has since released a list of individuals they want to replace those whom they have recalled. On the list Khupe is to replace former MDC Alliance legislator Tabitha Khumalo in Bulawayo province.

Masvingo MDC Alliance legislator Muchirairwa Mugido was recalled from parliament by Khupe for siding with MDC Alliance president Advocate Nelson Chamisa.

Zimbabwe Electoral Commission (ZEC) chairperson Justice Priscilla Chigumba has invited voters with objections to lodge them with her office before the nominations are confirmed.

“The public is hereby notified, in terms of section 39 (6) of the Electoral Act (Chapter2:13) that the MDC party has nominated party list members of the National Assembly and the Senate listed in the schedules below to fill in the vacancies in the National Assembly and the Senate that occurred following the recall by the MDC-T of the incumbent on the grounds that they had ceased to be members of that party,” reads the notice published by Chigumba.

One of the party list objection affidavits seen by this writer stated the grounds for objections

, “Section 45E of the electoral Act is explicit on the requirements for the identity of the party nominating the party list candidates, specifically, the Name, Party Abbreviation and Distinctive Symbols which should appear on the ballot paper. Accordingly, in the July 2018 Harmonised elections the MDC-A submitted its party list using the name Movement for Democratic Change Alliance, abbreviated as MDC-A and the characteristic distinctive symbol of an open palm and the face Adv Nelson Chamisa inside it.

“It is in this respect that the MDC -A has exclusive right to nominate replacements for the candidates to the party list , and that no any other party has the locus standi to make any such replacements outside the purview of the 2018 Harmonized Elections requirements as stated in section 45 of the Electoral Act.

“At the July 2018 Harmonised elections I voted for the MDC-A constituency candidate and my vote contributed to the cumulative provincial total votes which formed the basis for the allocation of the proportional representation or senate seats as specified in the Eighth schedule of the electoral Act.

“The Zimbabwe Electoral Commission has a duty to respect the outcome of the prescribed formula in the Eighth schedule of the electoral act by allocating the MDC-A its right full seats and not allow any other political entity to usurp the party ‘s right to choose its representatives.

“Failure to abide by its duty is an infringement of my Right of Assembly and Association as spelt out in Section 58 of the constitution,” read the affidavit.

MDC Alliance National Youth Organiser Godfrey Kuraone’s Trial Set For Tomorrow

Today, Masvingo Magistrate Patience Mandondo heard the case of MDC Alliance National youth organiser Godfrey Kuraone at Masvingo Magistrate court.

According to Advocate Martin Mureri, the state drop the charge where councillor Kuraone was allegedly to have circulated a vedio on social media platform with a song, “ichava nhoroondo kana tandenderwa nababa kubvisa president Munangwangwa pachigaro ichava nhoroondo.”

This case of circulating vedio was dropped by the state because “there are no witnesses.”

MDC Alliance National youth organiser Godfrey Kuraone was allegedly to have committed this offence on 20th July 2020 in Manicaland where MDC Alliance members were burying one of the national youth members.

This means, councillor Godfrey Kuraone has one case to answer tomorrow at 9am. Tomorrow’s case councillor Kuraone is the following: The state allegdly that on the second case on 31 July 2020, at around 6am, Godfrey Kuraone blocked the road by putting stones and burnt tyres along Gaths mine-Chirumanzu road.

Advocate Martin Mureri said, “Yes, l can confirm that today the state informed the magistrate that the state has managed to get two state witnesses on the case. Therefore, tomorrow there will be trial for councillor Kuraone at 9am at Masvingo Magistrate court.”

Yesterday, the trial failed to start because the state had not completed recording statements from the witnesses.

MDC Alliance National youth chair Obey Sithole said, “I am happy that the trial of our youth national organiser Godfrey Kuraone will be heard soon. Justice delayed is justice denied.”

Today, marks Councillor Kuraone’s 43 days days in Remand prison.

The personal doctor of councillor Kuraone managed to treat him. Today councillor Kuraone was in excellent health.

The court premises was heavily gaurded by armed police officers. As usual councillor Kuraone came to court in leg irons and in handcuffs.

Outside the court premise, there were armed riot police.

People are still in need of Land in Zimbabwe.Everyday they are cases of Land conflicts in all parts of Zimbabwe.Yes the young people and women of this country did not benefit from the so called Land Reform of 2 000.

As young people we want proper Land Reform which is not partisan.It should be done properly.

We are totally against the Government’s move to reverse Land Reform.

Instead of reversing the program, the government should redistribute the land properly.

MDC Alliance Nullifies Suspension Of Marondera Mayor

Farai Dziva|The MDC Alliance has nullified the suspension of Marondera Mayor Chengetai Murowa saying it was done unprocedurally.

Murowa had been suspended for allegedly sympathizing with Thokozani Khupe’s political formation.

In a statement MDC Alliance described Murowa’s suspension as null and void.

We want to put it clear that the mayor of Marondera, his worship Chengetai Murowa is not suspended as reported.

He is not suspended as councillor, mayor or party member.

The said suspension as reported is dubious, flimsy and void.

Murowa is a member of the provincial executive and national council and in this case, cannot be suspended by a lower structure such as the constituency co-ordinating committee.

All our councillors in Marondera subscribe to the leadership of MDC-A, the party that sponsored them during the 2018 harmonised elections.

If there are any other issues of disharmony of some sort the party leadership has got the capacity to unite our family for the good of Marondera residents and rate payers.

State Drops Criminal Nuisance Charge Against Councillor Kurauone

Farai Dziva|The State has dropped the Criminal Nuisance Charge against MDC Alliance Youth Assembly organising secretary and Masvingo Urban ward 4 councillor, Godfrey Kurauone.

The State failed to find the required witnesses.

“On Thursday our Organ Secretary, Cllr G Kurauone will be appearing in court for trial.

Police dropped Criminal the Nuisance Charge so he is now being charged with Blocking Traffic.

They dropped the charge after failing to find witnesses.

They can’t prove that he circulated a video clip,” MDC Alliance said in a statement.

Voters Reject ZEC’s Attempt To Replace MDC Alliance MPs With Khupe Nominees

Farai Dziva|MDC Alliance is mobilising voters to reject the attempt by the Zimbabwe Electoral Commission to replace the party’s MPs with nominees from Thokozani Khupe’s political formation.

MDC Alliance Secretary General Chalton Hwende, quoted by NewsDay, accused ZEC of violating the rights of thousands of voters who chose legislators of their choice.

“It is the same as what happened in 2018 when a man who lost the Presidential elections was sworn in as President.

What is happening now is that Zanu PF is using Zec in stealing seats from MDC Alliance and giving them to the MDC-T.

We are not surprised, they can do what they want, but we will not betray the people’s struggle.

They took away the rights of people who woke up at 4am to go and cast their votes.

I am here in Kuwadzana doing projects and residents are already signing their objections to imposition of MPs by ZEC and Khupe.

A number of people will challenge this move throughout the country, but we also know that dictators do not respect the Constitution and will do anything to subvert the people’s vote,” said Hwende.

Money changers in the country are finding the going tough following the ban on mobile money agent lines and the introduction of daily transaction limits.

The Reserve of Zimbabwe recently banned mobile money agent lines as well as set $5 000 as the cap for daily transactions for individuals.

The central bank also introduced a policy that limits mobile wallet users to only one account per individual.

Agent lines were being used across the country to cash-in and cash-out as well as for sales transactions.

The RBZ suspected that some of the lines were being used to fuel the black market causing a spike in foreign currency rates.

Government in June this year ordered the suspension of mobile transactions to allow for investigations in the parallel market.

“Agent wallets are no longer serving any legitimate purpose and were now being used primarily for illegal foreign exchange transactions.

Agents’ mobile money wallets are therefore abolished, with immediate effect,” the RBZ said recently in its Mid-term monetary policy statement.

MDC Alliance MP Converts Council Bar To State Of The Art Clinic

By A Correspondent- MDC Alliance Gweru Urban legislator Brian Dube reportedly used Constituency Development Funds to covert a council cocktail bar into a state of the art clinic, Newsday reports.

The legislator confirmed the development to the publication and said:

We applied to council and we were given the go-ahead to convert the Ivene Cocktail Bar into a standard modern clinic. This was necessitated by the compelling need to relocate the Ivene Clinic.

The current clinic was so small that staff and patients shared one single toilet. There was no medical storeroom and the treatment room was used for three purposes. It was the sister- in-charge’s office, treatment room and storeroom. There was also no TB boom and patients were served from the veranda.

Dube further explained the major reason behind his project and said:

The old clinic was located within houses and not safe as disposals of used medical materials risked being accessed by kids. However, the location of the new clinic is at the far end of the neighbourhood, making it safer.

Giving further details about the new state of the art clinic, Dube said the clinic was proper and modern and said:

We have stand-alone rooms for TB, treatment, sister-in-charge, dispensary, drug and consultation as well as the clerk’s office. We now have a proper modern clinic. The vision is that, since there is still space, we will also develop further to have a maternity ward and day care rest wards.

Machete Gangs Resurfaces

Gangs armed with machetes and knobkerries have resurfaced countrywide, targeting mines and individuals keeping large amounts of cash, prompting police to relaunch “Operation Chikorokoza Ngachipere” and “No to Machete Wielding Gangs”.

A few months ago, police restored order in mining areas after taking on the gangs, arresting large numbers and thwarting a wave of violence. That gangland violence claimed the lives of several people and left many injured.

Police said since January this year, 12 330 machete gang members and other criminal elements have been arrested in mining communities countrywide.
Police launched the “Operation Chikorokoza Ngachipere”, following an outcry from citizens over machete-wielding robbers who were terrorising people in mining communities.

In an interview yesterday, national police spokesperson Assistant Commissioner Paul Nyathi said they had since intensified the operation.

“We can confirm that the ZRP has intensified an operation code named ‘Chikorokoza Ngachipere/ Isitsheketsha Kasipele’ and ‘No to Machete Wielding Gangs’,” he said.

Police have since been heavily deployed to some of the areas where illegal panning is rampant to ensure peace prevails. Anyone arrested will face the full wrath of the law as some of them are violating Covid-19 regulations.

Asst Comm Nyathi said they arrested two suspects last Thursday, who were part of a gang that was armed with machetes and raided a mine in Inyathi at night.
The two were arrested at Mucklenuck A2 Mine.

“The suspects struck the victim with a machete and stole cash amounting to US$200 and $400. A follow up was made leading to the arrest of the duo and investigations are still in progress,” Asst Comm Nyathi said.

Criminal activities by the marauding gangs of machete attackers have seen reports of murder, rape, assault, housebreaking and stock theft. Police statistics show that in the mineral-rich Midlands Province, reported criminal cases rose 33 percent in the first nine months of 2019 because of the influx of machete attackers.

Recently, machete gangs raided the Circle V mine in Shurugwi and stole a firearm and $5 000 cash, stabbing and injuring one mine employee in the process. Management said the money was part of the float used to buy gold at the mine. Lately, machete gangs have been targeting people dealing in cash around Harare.

Govt Warns Private Schools Hiking Fees

By A Correspondent- The government has warned Private schools against hiking school fees without getting approval from parents and the ministry of primary and secondary education.

The matter came to light as the Ministry of Primary and Secondary Education director of communications and advocacy, Mr Taungana Ndoro, laid down the procedure for hiking fees and said:

There is a procedure that schools follow for approval of new fees structures by the Ministry and these are done on a case by case base. That procedure normally involves parents and the school before being submitted to the Ministry. once submitted the Ministry gives its response and you can obtain that response from the schools. Parents and schools are involved in the adjustment. Ministry considers an agreed position between parents and the school

While Mrs Tumisang Thabela, the Permanent Secretary in the Ministry of Primary and Secondary Education said they were investigating schools hiking fees without approval:

We are investigating these schools because any increase must be approved by Government.

According to the publication, The Midlands Christian Group of Colleges (MCGC) which runs Midlands Christian College (MCC), Midlands Christian School (MCS) and Treasure Trove (TT) in Gweru have asked parents to pay what it refers to as “overhead costs” of US$1 410, US$910 and US$400 respectively. Petra College is demanding US$1 400 while Girls college is reportedly demanding $1000 from parents.

Marondera Cattle Rustlers Steal Police Beast

Three suspected cattle rustlers have been arrested in Marondera on suspicion of stealing a cow from a police farm just outside town limits.

Wilson Madzudzu (26), Fanwell Munetsi (25) from Epworth and Tichaona Matudza (32) from Marondera are now assisting police with investigations.

Provincial police spokesperson Inspector Tendai Mwanza said the herdman at the ZRP Mashonaland East project farm found one brown cow was missing when shutting up the herd for the night. He then found the carcass of the missing cow, which has been slaughtered and skinned on the farm.

The police attended the scene and used dogs to track the spoor of the suspects leading to the arrest of Madzudzu and Munetsi, who were hiding in the gum plantation nearby. On interrogation they allegedly implicated Matudza, who lives on a farm next to the police project farm.

The cow was worth $24 600 and nothing was recovered. Inspector Mwanza said, “Stock thieves are a menace and their conduct deserves harsh punishment because there are bent on derailing economic gains.”

War Veterans Breathe Fire Over Former Commercial Farmers’ Compensation

By A Correspondent- War veterans have written to President Emmerson Mnangagwa’s government demanding that he shelves his US$3,5 billion compensation pact with white former commercial farmers, describing the move as highly discriminatory, degrading and akin to selling out the liberation struggle.

Mnangagwa last month signed the global compensation agreement with white former farmers displaced during the country’s 2000 land reform programme.

Under the deal, government pledged to cough out US$3,5 billion compensation for infrastructural developments on the seized farms.

The deal followed the commitment by government to return seized farms to black farmers as well as farms protected under Bilateral Investment Protection and Promotion Agreements (BIPPAs).

The latest agreement, announced in a joint statement by Finance Minister Mthuli Ncube and newly-appointed Lands minister Anxious Masuka on Monday, has, however, triggered varying reactions with some viewing it as a reversal of the land reform programme.

But the little-known War Veterans Pressure Group wrote to Mnangagwa through their lawyers, Kanoti and Partners, ordering the Lands ministry to issue a public statement withdrawing the compensation offer.

“We act at the instance of our clients, War Veterans Pressure Group, an informal political grouping of veterans of the national liberation struggle. Please note our interest,” part of the letter, dated August 28 to Masuka, read.

“Clients are shocked government acted in the manner it did and view the agreement as a sell-out understanding.”

“Clients instruct that we demand on their behalf, as we hereby do, that you, within 48 hours of receipt of this letter, issue a response to ourselves, together with a public statement admitting that the recent July 2020 compensation for claimed farms improvements agreements between government and the former settler white race progeny citizenry was discriminatory on the grounds of race and constituted cruel, inhumane and degrading treatment upon the indigenous black race, citizens of this nation, coming as the agreement did ahead of or for having prioritised settler white race concerns as against the local black race’s own long outstanding precolonial and also post-colonial sufferances under the mechanisation of the occupying settler white race and, therefore, that government is withdrawing from or suspending performance.”

The war veterans, who form the bulk of beneficiaries of the land reform programme, said the compensation should be suspended, and interests of the indigenous farmers be catered for first.

Yesterday, various stakeholders blasted Mnangagwa’s offer to compensate black farmers and for seized land under BIPPA.

Under the new order, complying with section 295 of the Constitution, indigenous farmers and farmers protected under BIPPA will be compensated for land and developments made on the farms. White former commercial farmers, who form the majority, are covered under the compensation agreement of July 20.

The two categories can be given money or may apply to go back to their farms, and the resettled farmers displaced to alternative farms.

About 116 farms under BIPPA were seized and new farmers resettled, while over 400 indigenous farmers were displaced after their farms were compulsorily acquired.

Norton MP Temba Mliswa (independent) challenged government to come clean on land ownership, saying the new order signalled the reversal of the land reform programme.

Tendai Biti, the MDC Alliance vicepresident said the new law by government was a policy U-turn.

Biti said anything to do with land compensation needed an Act of Parliament.

But exiled former Local Government minister and ex-Zanu-PF commissar, Saviour Kasukuwere said: “This is going backwards. Yes, the Constitution recognises land compensation, but this should be done through an Act of Parliament. The minister should table the Bill before Parliament.

“People suffered to have restoration of land ownership, and now, two ministers without knowledge of the history of the land reform come to make this announcement without consulting critical stakeholders.”-newsday

Man Who Faked ED For 17yrs To Avoid Intimacy With Own Wife Arrested For Raping Minor

By A Correspondent- In a very strange case, a man who faked ere_ctile dysfunction (ED) for the last 17 years just so that he could avoid being intimate with his wife was exposed when he was arrested for raping a minor.

iHarare has learned that 68-year-old Custon Jojo Machanja from Zvishavane was last intimate with his wife back in 2003 when he claimed that he was suffering from ED. The wife understood his supposed plight and did not bother him, only to be shocked when Machanja was arrested this year.

Machanja is facing two counts of having sexual intercourse with a minor and rape.

The Chronicle reports that while presenting his defence Machanja denied the rape charges saying that he had consensual se_x with the minor. Ironically, he also accused the minor and her mother of trying to fix him, because he was having se_xual affairs with both of them.

“I had consensual se_xual intercourse with the complainant and I also had an affair with her mother. They are fixing me,” he said.

Machanja’s wife who also appeared in court as a witness expressed her shock at learning that her husband was capable of having se_xual affairs with two women concurrently when she was under the impression that he could not function properly.

“All these years he would tell me that he can’t sleep with me because he is suffering from ere_ctile dysfunction. I’m really shocked,” said Machanja’s wife.

Outlining the state’s case, the prosecutors told the court that in February last year, Machanja seduced the minor but was unable to be intimate with her because she was on her menstrual period.

 

The state went on to say that in October, Machanja invited the minor to his house where they became intimate. After the act, Machanja gave the minor $6. They had two more encounters in the same month, after which Machanja gave the minor $4 and $5.

In December, Machanja invited the minor to his office and tried to become intimate with her again. However, on this occasion the minor refused and Machanja allegedly drew an Okapi knife and forced himself onto the minor. He also threatened her with goblins if she ever divulged that he had raped her.

However, the minor told her mother, who then took her to the police station to file a report.

Machanja was remanded in custody to September 7 for judgment.

“Imagine A Crisis Of COVID-19 And Cholera”

Why is it that the City of Harare cannot provide its residents with just clean water.  Water provision is a basic right and should be provided to all citizens by our municipalities.

In Harare province Shortages of water are now so common with no solution in sight.  The truth is Harare City Council has failed to provide its citizens with water and this is now a State of Emergency.

The Northern suburbs have not had water for over 20 years due to a broken valve worth only USD50,000. Chitungwiza has been dry for 6 months now. Harare west which used to receive the bulk of Harare water will soon run dry.

The City is staring at a crisis, imagine a city riddled with a combination of COVID-19 and cholera, with clean water being the commodity that is essential for hygiene because  we use it to clean our hands on a regular basis.

The Constitution of Zimbabwe prescribes that national and provincial governments have the legislative and executive authority to see to municipalities’ effective execution of their functions. In Harare the leadership is not executing its duty on the provision of water to its citizens. The Water Act chapter 20:20 1996 likewise recognises that it is the duty of all spheres of government:
• to ensure that water services are provided in a manner that is efficient, equitable and sustainable; and
• to strive to provide such services for subsistence and sustainable economic activity.
It states that although municipalities have the authority to administer water services, all spheres of government have a duty, within the limits of physical and financial feasibility, to work towards this objective.
This is a State of emergency that requires all our stakeholders to find a solution to this pending national crisis which has prevailed for a very long time. Hararians should be drinking clean water and washing their hands with clean water to prevent a national crisis provided by the local authority.

BREAKING- FREEDOM AT LAST FOR TRANSFORM ZIMBABWE LEADER JACOB NGARIVHUME

By A Correspondent- A Harare High Court Judge this morning granted jailed opposition leader Jacob Ngarivhume $50 000 bail after he had been languishing nehind bars for 45 days.

Justice Musithu ended the detention of Transform Zimbabwe party leader Jacob Ngarivhume by granting him $50 000 bail, barring him from sharing messages on Twitter and ordering him to report 3 times per week to the Zimbabwe Republic Police. He was also ordered to reside at his given address and surrender his passport.

Ngarivhume, who was arrested on July 20 over the July 31 protests had been denied bail by the lower courts twice.

The opposition leader had approached the court in his second freedom bid citing changed circumstances where he argued that the reasons which had led to his initial bail denial had changed.

Ngarivhume, is facing charges of inciting citizens to revolt against government when he organised and announced that on July 31, citizens were supposed to protest over corruption and a failed leadership.

He however argued that the planned protests did not take place, hence fears of him influencing violence were no longer existent since the day of the protests had come and gone.

Harare magistrate Trynos Utahwashe dismissed Ngarivhume’s bail application arguing that he remained a national threat hence should remain behind bars

His lawyers however said they would appeal the decision at the High Court arguing that it was baffling how the state acknowledged that July 31 had come and gone with no violence reports at all but maintained that what was proposed as the July 31 protests had become a movement. The court however did not avail the evidence to back up the state’s claim.

“We are surprised that Jacob Ngarivhume is now said to be the founder of that movement. We are hearing it for the first time in court and we are shocked but we are not discouraged in any way. We will be appealing as soon as possible,” said Nkomo.

Ngarivhume was arrested on July 20 and has been languishing in jail since then.

The High Court denied him bail again on grounds that he called for protests amid the Covid-19 pandemic thereby exposing the public to dangers of contracting the disease.

 

Mpilo Hospital Nurse Succumbs To COVID-19

By A Correspondent- A Mpilo Hospital nurse reportedly tested positive for COVID-19 posthumously, the state media reports.

Pretty Mpala (36) from Emakhandeni suburb in Bulawayo was reportedly buried on Friday after she tested positive for the novel Coronavirus.

Mpala who was part of the COVID-19 health frontliners was her family’s breadwinner and her family are struggling to come to terms with her death.

Mpala’s aunt spoke to the publication and said:

We are still shocked and in deep pain following the passing of Pretty who was the sole breadwinner in the family. Our hearts are sore and we fear for her traumatized grandmother who raised her following the death of her parents as she is struggling to walk or talk since her death.

Pretty was a caring person and it was not surprising that she eventually became a nurse. She went through a lot of challenges while growing up but managed to shrug off all discouragement and qualified as a nurse.

Commenting about the death of Sister Petty who was the only child of her late parents, Mpilo Hospital CEO DR Solwayo Ngwenya said:

We are extremely saddened that Covid-19 has taken one of our staff members, her premature death is evidence that this disease is deadly. As health workers are at the forefront, we continue to bear the brunt of this virus but we still must work hard and face it while saving lives.

Most of us will be infected in the line of duty and it is sad that one of our self-sacrificing nurses had to lose her life. I would like to commend all those who come to work despite the risks that come with our jobs, this kind of sacrifice is highly commendable.

Mpala survived by her grandmother and her cousins.

Govt Mulls Re- Opening Airports To Boost Tourism

By A Correspondent-  The government of Zimbabwe is reportedly finalising the modalities that will see airports re-opening after 5 months in a bid to boost tourism.

The matter came to light in yesterday’s post-cabinet briefing.

According to the publication:

The Government is finalising on modalities for the re-opening of airports to support the resumption of the tourism sector. The plan is to start with the resumption of domestic flights and then move to international flights.  Cabinet approved the resumption of the rest of tourism operations, including boat operations.

Other countries like Kenya and Tanzania have resumed international flights while South Africa has reopened domestic flights after close to 5 months in lockdown.-Statemedia

Minister Ziyambi has for the past seven years, been estranged from his wife Florence Ziyambi, nee Mhizha, a lawyer and former deputy Prosecutor-General.

In his claim filed at the High Court, Minister Ziyambi is asking for a decree of divorce saying the couple have not lived together as husband and wife since sometime in 2014.

He argues that the marriage is just a shell as they have not shared conjugal rights since then. The couple has two adult children.

“Since then, the parties have developed diverging interests and have become incompatible and have lost all love and affection for each other,” said Minister Ziyambi in his papers.

During the subsistence of their marriage, the couple acquired movable property and the Minister strongly feels it is just and equitable that upon divorce, each party retains the movable property in his or her possession.

The immovable property which the plaintiff wants distributed includes houses in Westlea and St Martins suburbs in Harare both registered in Minister Ziyambi’s name and a house in Bluffhill, Harare, registered in his estranged wife’s name.

The Minister also prays for the Westlea house to be awarded to one of their daughters, Chido Maureen Ziyambi, while the couple retains ownership of the immovable properties registered in their respective names.

“It is just and equitable that plaintiff (Minister) continues to cater for Chido Maureen Ziyambi’s welfare and educational needs until she graduates or becomes self-sufficient whichever occurs first,” said Minister Ziyambi.

Mrs Ziyambi is yet to respond to the application and has 10 days to file her response to the divorce motion.

South Africa’s ANC Meets Zanu PF Over Zim Crisis

ZANU-PF Politburo, will soon hold a meeting in Harare with South Africa’s ruling party, African National Congress (ANC)’s National Executive Committee to discuss issues of interest amongst the two sister revolutionary parties.

The ANC delegation is expected to arrive in the country soon, although the dates are yet to be announced.

While addressing the media soon after the ANC’s NEC meeting on Monday, South African President Cyril Ramaphosa revealed that his party will send a delegation to meet Zanu-PF Politburo for a party-to-party discussion.

Last month, Zanu-PF secretary for Administration Cde Obert Mpofu and his South African counterpart ANC Secretary-General Cde Ace Magashule held a virtual meeting, which saw the two revolutionary parties pledging to work together to defend the gains of the liberation struggle.

Of late, there has been a systematic attack on Government, which began with the manufacturing of a non-existent crisis in Zimbabwe by the country’s detractors, who are working with fugitive former G40 functionaries desperate to cast aspersions on the Second Republic’s economic revival and re-engagement efforts.

Cde Mpofu yesterday confirmed that a meeting has been set between Zanu-PF and ANC leaders.

“I can confirm that we will be meeting our counterparts in the usual manner that we have already conferred with each other to discuss issues of interest amongst ourselves. The meeting is not new, ANC and Zanu-PF are sister parties both before and after our independence,” he said.

“The meeting, which will be held soon, is part of the usual dialogue that we have with ANC and this is quite a welcome development.”

Cde Mpofu said the two revolutionary parties were constantly in cordial contact at an inter-party level to confront the cross-sectional attempts to defeat the standing successes towards entrenching democracy in the Sadc region.

Cde Mpofu said there were imperialistic attempts to discredit the country by falsely claiming that there are human rights violations.

“What has been presented as the violation of human rights in Zimbabwe is part of the exhausted script of the MDC Alliance’s failure to come to terms with its defeat in the 2018 Harmonised Elections,” he said.

Cde Mpofu said the misplaced anti-Zimbabwe campaign on social media aligns with retrogressive regime change elements backed by their external neo-colonial handlers.

“We are aware that the purported instability in Zimbabwe is precipitated by disgruntled fugitives and ejected elements from the revolutionary party, Zanu-PF.”

Cde Mpofu said Presidents Mnangagwa and Cyril Ramaphosa enjoy cordial relations, with both Zanu-PF and ANC’s relationship premised on the historical values that have stood the test of time.

Zimbabwe and South Africa enjoy strong cordial relations which date back to the liberation struggle against colonialism and Apartheid.

Last month, President Ramaphosa in his capacity as African Union (AU) chairperson, deployed envoys to Zimbabwe to assess the political situation in Zimbabwe.

The three-member delegation returned a day after meeting President Mnangagwa where they exchanged notes at State House.

Former South African Minister of Safety and Security Dr Sydney Mufamadi was leading the team which comprised former Speaker of Parliament Baleka Mbete and former Minister of Public Service and Administration Advocate Ngoako Ramatlhodi.

The three came to Zimbabwe to assess the political situation in Zimbabwe after a sustained social media onslaught against the Harare administration.

The anti-Zimbabwe crusade follows the flop of the protests that had been planned for July 31, which had been heavily-funded by Western embassies aimed at toppling President Mnangagwa and his Government.

Nurse Dies Of COVID-19

MPILO Central Hospital has lost a nurse to Covid-19 who died at the institution last week.

Sister Pretty Mpala (36) from Emakhandeni suburb in Bulawayo tested positive posthumously and was buried on Friday.

She is one of the hundreds of frontliners in Zimbabwe who have been infected while trying to save lives. According to a weekly situational report from the Ministry of Health and Child Care, nurses are the most affected workers when it comes to Covid-19 and they constitute 37 percent of total health care workers affected.

As of Monday, there were 6 497 confirmed Covid-19 cases in Zimbabwe and 202 deaths. Bulawayo province has a cumulative total of 1 276 cases, 25 deaths and 1 140 recoveries.

Statistics from the Ministry show that more than 480 health workers have contracted the global pandemic in Zimbabwe.

Bulawayo (137) and Midlands (128) account for a greater proportion of infected front liners.

Healthcare workers have been greatly exposed to Covid-19 due to the global shortage of personal protective equipment.

More than 120 nurses at Mpilo Central and United Bulawayo Hospitals have contracted the virus, forcing them into quarantine, thereby reducing the number of workers who are manning the public institutions.

According to the World Health Organization (WHO), nearly 1 000 nurses have been infected by Covid-19 in Africa alone.

The outbreak of Covid-19 has seen nurses worldwide making huge personal sacrifices, sometimes attending to patients without adequate personal protective equipment (PPEs) risking their health and that of their families.

The world over, at least 90 000 health care workers had been infected by Covid-19 and more than 260 nurses had died by the end of May according to the International Council of Nurses (ICN).

In an interview, Sr Mpala’s aunt, Mrs Kezzeneth Mpala, said the family had lost its breadwinner and was struggling to accept the nurse’s fate. She said Sr Mpala’s guardian, her grandmother, had fallen sick after receiving news of her untimely death last week.

“We are still shocked and in deep pain following the passing of Pretty who was the sole breadwinner in the family. Our hearts are sore and we fear for her traumatized grandmother who raised her following the death of her parents as she is struggling to walk or talk since her death,” said Mrs Mpala.

“Pretty was a caring person and it was not surprising that she eventually became a nurse. She went through a lot of challenges while growing up but managed to shrug off all discouragement and qualified as a nurse.”

According to Mrs Mpala, Sr Mpala was passionate about serving her people and community which made her a committed and resilient nurse.

Mpala, the only child born to her late parents, started her nursing studies in 2013 and had never looked back. She also struggled with some illnesses which never killed her hardworking spirit as she managed to do her duties at Mpilo while battling the ailment. “We used to meet members of the public in town who would stop and thank her for the care she rendered while they were admitted to Mpilo. She was also a darling to the community and our relatives and would easily give health advice so that everyone around is healthy and fit. Her loss has brought a lot of pain in our lives and we hope one day we will understand why her life had to end this way,” she said wiping away tears.

Mpala is survived by her grandmother and cousins.

Mpilo acting chief executive officer Professor Solwayo Ngwenya sent his condolences to the family saying Covid-19 had cost the institution a hard-working staffer.

Can the International Criminal Court Help Belarus? Chatham House Opinion.

A referral of election violence in Belarus to the International Criminal Court could enhance the support for the Belarusian people at other crucial platforms.

Making the case

The recent election results in Belarus have triggered revolution in yet another post-Soviet country and Aliaksandr Lukashenka’s response has been devastatingly brutal. However, the Belarusian people’s resilience and Western sanctions – adopted on 14 August – have proved effective. As some of the 6,700 jailed protesters were released, accounts of horrific treatment by law enforcement emerged: overcrowded cells, no food, torture, forced confessions, severe beatings, and threats of rape.

With reports of mounting violence, Polish MEP Radosław Sikorski warned Lukashenka to expect not just sanctions but also the possible intervention of the International Criminal Court (ICC), an idea supported by the opposition-led Belarus’ National Salvation. While there are significant impediments to the Court’s involvement, the impact of such an initiative could be ground-breaking.

Legal framework
The ICC considers criminal responsibility of top civilian or military leaders for only the most serious atrocities – war crimes, genocide, crimes against humanity and, in certain cases, the crime of aggression. In the context of Belarus, the Court’s jurisdiction over crimes against humanity might be relevant. According to the Rome Statute, the ICC’s founding treaty, crimes against humanity include widespread or systematic abuses directed against a civilian population. Atrocities relevant to Belarus include arbitrary imprisonment, torture, inhuman treatment, sexual violence, and enforced disappearances.

The ICC is a last resort. It can intervene only if states are unable or unwilling to properly investigate and prosecute serious crimes themselves. Although Belarus’s Criminal Code punishes crimes against humanity, as Lukashenka himself is implicated, impartial trials in the country are impossible while he is still in power. Other countries may investigate specific atrocities in Belarus under the universal jurisdiction principle. Universal jurisdiction greenlights investigations into the most serious crimes regardless of where they are perpetrated. German, Swedish and French proceedings on Syria are illustrative examples of this. Protesters may also file individual complaints of abuse to UN bodies under the protocols of the International Covenant on Civil and Political Rights and the Convention on the Elimination of All Forms of Discrimination against Women. The European Court of Human Rights is not an option for the protesters because Belarus is not a member of the Council of Europe.

As the UN mechanisms are yet to be triggered and there has not yet been any talk of universal jurisdiction proceedings, the question of recourse to the ICC remains. But as Belarus is not party to the Rome Statute, the only way to trigger the Court’s jurisdiction is a referral by the UN Security Council (UNSC). Even though it would be vetoed by Russia – and, almost certainly, China – it could be worth pursuing.

The importance of symbolism
So far, the UNSC has referred to the ICC two situations in non-party states – Sudan and Libya. But for cases that dont end up being referred to the Court, the UNSC debates are as significant for what they manage to agree upon as they are for what they do not. Regarding Belarus, two impeded UNSC accountability initiatives are relevant: on Syria and MH17.

In 2014, Russia and China vetoed the referral of cases of violence in Syria to the ICC. In 2015, Russia was the only country to block the creation by the UNSC of a special tribunal to investigate Malaysian Airlines flight MH17, downed by a Russian missile over war-affected eastern Ukraine. In both cases, the vetoes delayed justice, but they did not prevent it. For Syria, special independent mechanisms to collect evidence for adjudication were developed. Although justice has yet to be done, except in states like Germany, the evidence is ready for any future court. For MH17, a proceeding at a domestic Dutch court became an alternative. Parallel to that, new evidence of Russia’s role in both Syria and the downing of MH17 emerged – contextualising its UNSC vetoes.

Russia’s stakes in the Belarusian elections are probably even higher: the victory of democracy in Belarus will deprive it of one of its closest and most dependent post-Soviet allies.

Even if Russia destroys any chance of Belarusian citizens using the ICC, the attempted ICC-Belarus discussion will not have been in vain. Russia’s opposition to the respective UNSC resolution would be a self-defeating validation of Lukashenka’s atrocities against his own people, unashamedly restated at one of the world’s top diplomatic negotiation tables. Similar to Syria and MH17, the UNSC would reconfirm its self-imposed impotency to defend basic human rights amid political conjuncture. This would bring more attention to the issue and catalyse action through other platforms, including the discussions across UN bodies and the consideration of Belarusians’ individual complaints of abuse, and could lead to tougher sanctions. It could also further make the case for universal jurisdiction proceedings in other countries.

Supporting civil society
Belarusian civil society will need stronger support from democratic governments and human rights organizations in reporting and documenting the crimes. Other countries, neighbouring states in particular, should be ready to welcome Belarusian protesters through refugee schemes, so they are able to continue their activities from abroad.

When nationwide strikes enveloped Belarus, singers from the Minsk Opera supported protesters by singing Va, pensiero, the famed chorus of the Hebrew slaves from Verdi’s Nabucco – and a symbol of united Italy’s revival. The people of Belarus also want to live in a democratic state ‘where the mind is without fear and the head is held high’. And they deserve all the support they can get. The inevitable fall of Lukashenka’s regime might take time but it should not take more lives.

ZANU PF To Meet Over Makhosini Hlongwane

THE Zanu-PF Midlands executive will soon meet to deliberate on applications made by two former ministers who have applied to be readmitted into the ruling party following their sacking.

Former Minister of Sports, Recreation, Arts and Culture, Makhosini Hlongwane and former Deputy Minister of Public Service, Labour and Social Welfare Tapiwanashe Matangaidze are part of many Zanu-PF members who were expelled after they were found guilty of misconduct in 2018.

In an interview, Zanu-PF Midlands provincial chairperson Engineer Daniel Mackenzie Ncube confirmed that the pair were among those who made applications to be readmitted into the party.

“We have applications from expelled members who include former ministers. We have got applications from Makhosini Hlongwane and Tapiwa Matangaidze. We will be sitting down to make our decision.

“It’s something we should have done about two weeks ago, so we are trying to get a slot so that we deliberate on the issue and make the necessary recommendation to the party headquarters. We are far behind on the issue,” said Engineer McKenzie Ncube.

The Midlands provincial chairperson said Zanu-PF is a “big tent”, and that people who want to join or re-join the party were most welcome after being vetted.

“In the event the applicants are re-admitted, they will start fom bottom rank and they will be observed over time to ensure that they are now compliant in everything they do,” said Engineer Mackenzie Ncube.

Last year, Zanu-PF readmitted its former secretary for Administration Cde Didymus Mutasa and retired Brigadier-General Ambrose Mutinhiri.

30 Year Old Forex Dealer Loses US$70k To Robbers

State Media

A 30-year-old foreign currency dealer lost US$70 000 to armed robbers who blocked his Mercedes Benz E300 while he was on his way to Harare from a Norton farm where he had collected the cash.

The armed robbers, in an unregistered black BMW, blocked the road and demanded the cash at gunpoint.

No arrests have been made and police are still investigating the matter.

National police spokesperson, Assistant Commissioner Paul Nyathi, said people should not travel with or keep large sums of cash.

Another gang of four armed robbers raided a house in Beitbridge last Friday night and robbed a family of a Honda Fit, R10 000 in cash, four cellphones, a laptop, and seven pairs of shoes. The vehicle was found dumped a few metres from the homestead.

Police said the robbers were armed and fired shots into the air to frighten the victims during the robbery.

In another case, a Harare man lost US$2 000 after he was lured to Hwange by three robbers who had duped him into believing that they were selling a Toyota Hiace minibus.

Bruce Grobbelaar Says He Is Too Honest To Work In South Africa

Former Liverpool and Zimbabwe goalkeeper Bruce Grobbelaar thinks he maybe “too honest” to be offered another job in South Africa’s Premier Soccer League.

His comments come despite his desire to work there again and he has been in touch with several clubs in South Africa.

Speaking to On The Whistle podcast, Grobbelaar said it would take a lot of guts for club owners to appoint him.

“They don’t want me there because I’m too honest,” he insisted.

“And, if there’s anything that goes wrong, I’ll take them straight to the courtroom. Because it’s happened before and they know who they are.”

Grobbelaar, who played in South Africa early in his career and also helped coach several clubs after his retirement, says he is keen to return.

“South Africa, I’d love to come back there, but it depends if these owners have got b***s to get Bruce Grobbelaar back for their team,” he said.

He highlighted the court cases he claims to have won against clubs in South Africa, including PSL giants SuperSport United and Mamelodi Sundowns.

“I took them to court and got paid out the rest of my contract at SuperSport and that is contrary to what rumours are in South Africa that I was fired,” he insisted.

SuperSport United chief executive, Stanley Matthews, refused to get into details about why Grobbelaar left in 2001.

“Bruce had a great chapter in our history, saving us from a serious relegation threat and that’s the part our club chooses to focus upon,” Matthews said.

Grobbelaar also opened up about an opportunity he once had to coach Sundowns.

“This is something that South Africans don’t know. I was asked to take over Mamelodi Sundowns with the Tsichlas family and I signed a pre-contract agreement (in 2000),” he said.

But Grobbelaar says he was then shocked when Sundowns appointed Clemens Westerhof.

“I took them to court and I got paid three years of a three-year contract without coaching the team once.’’

Sundowns declined to comment when contacted.

The former Zimbabwean international says he has had success at all the clubs he worked with in South Africa.

“They know my potential as a coach. If you ever look at my history of coaching in South Africa, no team has ever gone down,” he pointed out to the podcast.

“And I’m talking about places in the league. They’ve always gone up. And that’s what I strive to, to make people play better and to enjoy themselves on the park.

“If you can make the players better, that’s what I’m about.

“I’ll argue with the owners all day long when they do not allow the players to get the best. Then they gonna have me to go through.” Grobbelaar said that he’s been in recent contact with South African PSL teams like AmaZulu and Chippa United but nothing has materialised as yet.

Even though Grobbelaar is struggling to land a job in South Africa he has been working as a goalkeeping coach with Norwegian second-tier outfit Øygarden FK.

He also spends time in Liverpool following his former club and appearing as an expert on various television outlets.

While Grobbelaar was full of praise for the Reds achievements last season he could only pick three players from the side that won the title to join his combined XI with the stars from his Liverpool playing days.

“I’d probably take out Phil Thompson and put in Virgil van Dijk . . . left fullback I’d put Robertson,” he mused.

“Then upfront, who’s going to take out Kenny Dalglish from the three that we’ve got now — Mane, Salah or Firmino?

“I would say maybe Craig Johnson comes out, Rush and Dalglish with one of the others. I would pick Salah out of the three of them.”

The Zimbabwe dollar firmed marginally for the first time yesterday, by just under a tenth of one percent, to $83,3209: US$1 in the 11th auction, reinforcing the high-level of stability seen in recent weeks as markets succeeded in finding the real value of the Zimbabwean currency.

The weighted average fell from $83,3994 to $83,3209, a drop of just under 8c or 0,094 percent.

The previous two auctions had seen minute slipping in the exchange rate of around half a percent, the ninth auction slightly less and the 10th auction slightly more, and yesterday’s tiny gain was expected at some stage as Zimbabwe moves into the sort of stability that sees tiny weekly changes that can be up or down, with trends only apparent over several weeks.

Yesterday’s change was the smallest seen since the start of the auctions, and the progress over the last month is leading analysts to predict that prices could even start falling as producers and others accept that they do not have to factor in the danger of huge exchange-rate swings into their pricing models to cover the replacement cost of stock.

Without exchange rate pressures, actual costs rather than feared costs, are more likely to dominate in costing models.

The gap between top and bottom successful bids remained small. The top bid on the main auction dropped very slightly from $88 to $87,50 while the bottom bid fell from $80 to $76, as some importers looked for a modest bargain while testing the market.

The SME auction saw a narrower bid range, from $76,50 to $86.

For the fourth week running, all valid bids were successful.

There were 154 bids on the main auction, of which 25 were ruled invalid since the bidder had missed one of the requirements set by the Reserve Bank of Zimbabwe (RBZ), and 75 bids on the SME auction, with only 11 disqualified.

The fall in the number of disqualified bids suggests bidders are getting better at ticking off the checklists.

The SME auction came close to allotments of US$1 million, a new high for these smaller businesses, while the main auction saw total allocations of just over US$15 million, roughly in line with the previous trends.

As always, the bulk of allocations went to raw materials with that category getting almost US$6,4 million of the allotted US$16 million. Equipment got US$3,77 million, services US$1,6 million, consumables US$1,4 million and chemicals and pharmaceuticals just under US$1 million.

Economist Mr Eddie Cross, who is in the RBZ monetary policy committee, described results of the latest auction as encouraging and a strong indicator that the auction system now meets the needs of importers.

“We have seen a lot of stability in prices over the last three months and we should start to see prices falling,” he said.

Mr Cross said the combination of the market-related auction system and continuing measures to keep a tight control on liquidity flows and expansion, which had been used speculatively to trade in currencies and so hurting the Zimbabwe dollar, had narrowed the gap between the official auction rate and the black-market rates to less than 10 points on street prices.

In his recent mid-term monetary policy statement, RBZ Governor Dr John Mangudya noted that the auctions were now supplying 87 percent of importers’ currency needs and the auction system had reduced volatility in exchange rates, which had been the main driver in price increases in the first six months of the year.

A Gwanda based activist, Ndaniso Mpande, has individually petitioned the parliament of Zimbabwe to urgently facilitate for a referendum to be voted for by the people of Matabeleland and parts of Midlands province demarcated as former precolonial Mthwakazi Kingdom to decide if they want to remain as part of present day Zimbabwe.

Proponents of Mthwakazi restoration believe that Zimbabwe is made up of two nations which were brought together by the colonial regime in 1893. The proponents now Want the two countries to be separated under the pre 1893 boundaries.

Residents Associations Speak On MDC Councillors Recall And Defections

Residents Associations are preparing a voice against the ongoing recalls and defections by MDC councillors within local authorities.

Greetings Cdes. Residents Associations have no business getting entangled in Political Parties factions. I will attempt to trace the political developments in the MDC T, the creation of the MDC Alliance, the Constitution and the Electoral Act. I argue that the rule of law means respecting court judgements irrespective of our personal preferences.

1. The MDC T, under Morgan Tsvangirai forges an electoral political pact with six other political parties ahead of the 30 July 2018 Harmonised Elections.

2. The coalition of these political parties is named MDC Alliance.

3. The MDC T is the leader, which provides the President of the MDC Alliance.

4. Morgan Tsvangirai appointed Nelson Chamisa, then one of three Vice Presidents of the MDC T as the MDC T representative to the MDC Alliance.

5. MDC Alliance contested the 2018 elections. Transform Zimbabwe abandons the MDC Alliance after the elections, but six others remained.

6. Morgan Tsvangirai dies on 14 February 2018.

7. Nelson Chamisa assumes the presidency of the MDC T. Thokozani Khupe, the only MDC T Vice President who had been elected by their Party Congress opposes the Chamisa presidency. A fight ensues among the two MDC T leaders.

8. A disgruntled MDC T member from Gokwe challenges the appointment of Nelson Chamisa as MDC T President.

9. The High Court rules that Thokozani Khupe is the legitimate Acting President of the MDC T, and therefore should facilitate the holding of an extraordinary Congress of the MDC T to elect the successor to Morgan Tsvangirai.

10. The MDC T led by Nelson Chamisa holds its Congress as the MDC Alliance in Gweru. Members of the other Political Parties on the MDC Alliance participates in the Gweru Congress.

11. The MDC T under Nelson Chamisa appeals against the High Court ruling which declared illegal the appointment of Nelson Chamisa and Engineer Elias Mudzuri as Vice Presidents of the MDC T, and the appointment of Chamisa as MDC T President.

12. The Supreme Court upholds the High Court ruling and declares Thokozani Khupe as the Acting President of the MDC T. The Supreme Court further directed that Khupe organises the convening of their Party Congress in three months.

13. The MDC T begins a process of recalling MDC T officials in local authorities and Parliarment who openly rejected the Supreme Court ruling affirming Thokozani Khupe as the MDC T Acting President.

14. The Supreme Court ruling and Section 129 (j) and (k) give effect to the recalls. This is the Constitution that came into effect in 2013.

Residents were denied the powers to recall underperforming and corrupt Councillors and Members of Parliament in the Constitution. That power was given *only* to political parties on whose ticket the official would have been elected into office. The MDC T deployed the MDC Alliance into the election with other Political Parties. Therefore According to the Court ruling the MDC Alliance is an electoral pact institution with a lifespan of five years. The MDC T may only recall MDC T members on the MDC Alliance network. You will find that PDP members in the MDC Alliance will not be recalled because they do not belong to the MDC T.

Recommendations

1. Residents Associations should unite and lobby the Central Government to fully implement Devolution, and enact all necessary legislation to give effect to Devolution.

2. Residents Associations should uphold the rule of law and avoid being involved in MDC T factional fighting between Nelson Chamisa and Thokozani Khupe.

3. The Devolution Acts of Parliament should provide for the full involvement of Residents in the process of recalling elected representatives.

4. The ongoing recalling of MDC T officials, elected on the MDC Alliance ticket, is an internal Political Party conflict that has nothing to do with service delivery, corruption, abuse of office or underperformance. There is nothing in all this for the residents. These are partisan fights.

Conclusion:

Genuine Residents Associations should avoid partisan narratives when fighting against on behalf of Elected Councillors defying their own Political Parties. Residents should fight against the exclusion of residents in local authorities processes that are crucial for the provision of social services.

THE United Nations Human Rights Council (UNHRC) must step in to stop a culture of State-sponsored human rights violations as the “price of silence is huge”, former National Healing minister Moses Mzila-Ndlovu has said.

In an online petition to the UNHCR, Mzila-Ndlovu said the culture of impunity was on the rise at a time the country’s human rights situation is under international spotlight.

Some opposition and human rights activists have been forced to go into hiding or skip the borders fearing arrest for organising anti-government protests. Some have been arrested, while others have been abducted and tortured in recent weeks.

Mzila-Ndlovu, in a petition to the UNHCR titled Justice for Matabeleland Gukurahundi Genocide and Ongoing Injustices in Zimbabwe, argued that perpetrators “should not continue to enjoy a culture of impunity in Zimbabwe”.

“This petition is a call to the UNHCR to officially recognise the 1980 to 1987 Matabeleland Gukurahundi genocide where more than 20 000 people died,” the petition read in part.

“Today they (State actors) are conducting the same acts of murder, abductions and terror and the world is watching. Zanu PF and its leadership should not continue to enjoy a culture of impunity in Zimbabwe.

“The more they are given this culture of impunity, the more they commit crimes against humanity. All victims of Zanu PF government’s State-sanctioned genocide and ongoing human rights violations are demanding truth, justice and reparations for the systematic violations of their rights.”

Government and the ruling Zanu PF party have denied reports of State-sanctioned human rights abuses.

In July, opposition MDC Alliance legislator Joanah Mamombe and activists Cecilia Chimbiri and Netsai Marova, who were allegedly abducted and tortured for participating in a peaceful demonstration in Harare, were charged with stage-managing their abduction.

Mzila-Ndlovu, who also leads the opposition Alliance for National Salvation, appealed to Zimbabweans to demand justice for all victims of State-sponsored violence dating back to the 1980s.

Govt’s Deal To Reverse Land Reform Stinks And Is A Total Betrayal.

By Dr Masimba Mavaza | The term land goes far beyond the noun, it refers to all the materials and forces which nature gives freely for man’s aid in land, water, in air and light and heat.

In Economics, the word ‘land’ is used not merely in the sense of the soil or surface of the earth as is ordinarily understood. It is used to describe all nature, living and lifeless. It includes all natural resources that we can get free from air, water and land. It covers the land surface, whether level or mountainous.
It includes oceans, lakes and rivers, mineral deposits, rainfall, water-power, fisheries, forests and numerous other things which nature provides and man uses. The term ‘land’ thus embraces all that nature has created on the earth, above the earth, and below the its surface.

Land as a factor of production is of immense importance. As has already been pointed out, everything that we use can be traced ultimately to land. Land may be rightly called the original source of all material wealth.

The economic prosperity of a country is closely linked with the richness of her natural resources.

Generally speaking, it is true to say that a country is what nature has made it.
Land or nature has a determining influence in moulding the life, occupations and standard of living of a people.

Land as a factor of production is quite peculiar. It possesses some important features, which distinguish it from other factors of production.
Land is a free gift of nature. It cannot be quantified and must not be given to foreigners. Mbuya Nehanda and all Chimurenga heroes died for this land. For her trouble Mbuya Nehanda has been left displayed in a human museum as a trophy in England. She will hear from her murderers that the land she died for is being returned back to them by those she died for.

Mbuya Nehanda knew that land is not a ‘produced’ or man-made agent. It was God given and it is worth dying for.
Land is limited in area and will never expand. We are recreating children so people grow in large numbers and land remains the same.

Land is permanent and must never be distributed to strangers.

It is not easy to take it back. All other factors are destructible, but land cannot be completely destroyed. Even the havoc wrought by an atom bomb can be cured and natural powers restored after some time.
Land cannot be moved bodily from one place to another. Land is a gift from God It is not man-made.

It has been 20 years since land reform and the issue of compensation for those who lost land has rumbled on. The government has always said it was committed to compensation of improvements (and not the land) and this was confirmed in the 2013 Constitution, which was supported by all parties and a public referendum.
The signing of the Global Compensation Deed Agreement by President Mnangagwa and Andrew Pascoe, head of the Commercial Farmers Union on July 29 was therefore an important moment to the white farmers and Mr Mike Pompeo of America who has declared in the Bloomberg that the Zimbabwean government must return all the land to the white farmers. The whitemen and none other. This was a crucial step in creating some sort of closure to the land reform episode, and getting on with supporting agriculture and boosting the economy while opening the wounds of many survivors of the war of freedom. Independence without land is not independence. Zimbabwe has actually made several steps back by signing an agreement with the white farmers.
It is ironic that in the month comrade Robert Mugabe died Zimbabwe commemorated his death by giving the land back to the white farmers who stole it from us in the first place.
In fact the Zimbabwean government has already paid around 500 claims, with some quite large individual settlements and the greedy unthankful, twisted the government arms a bit further, now they are getting the land back plus billions of dollars in compensation. The state, the Commercial Farmers Union and various private parties, notably Valcon representing white farmers who lost the black man’s land to the black man have attempted valuations over the years. Mugabe had remained steadfast in his resolve not to reverse the land program.

But the science of asset valuation is a mockery to the nation while the white victors claim that the valuation “has no value as some of which have disappeared and all have deteriorated after 20 years – is far from exact.” Indeed with currency variations, hyperinflation and general economic chaos intervening, precise valuation is nigh on impossible.

“ Such is the arrogance of the White man. As a consequence, until now the overall deal remained incomplete with much wrangling over the numbers.”

This wrangling which was viewed as an insult by the Zimbabweans has been vindicated by this agreement.

In a very insulting manner the White commercial farmers put up an estimate of US$5.4 billion (down from some earlier outrageously massive figures), while the government estimated US$1.2 billion was due. Others were still holding out for compensation of the land value too, and suggesting the total cost should be upwards of US$20 billion, so in the end the compromise had to be a political one, assisted by the thorough work of all those involved. The govt finally gave in and agreed to give back the land and money on top.

Just wondering would Perrance Shiri the late have read this agreement? I wonder. This was achieved in part because everyone needed a deal to be reached. The govt was desperate to get international recognition, and the lack of compensation had been a long-running hurdle in discussions with Western nations and institutions. So this was a total surrender by the Zimbabwean people. This deal stinks and it is a total betrayal.

“Meanwhile, commercial farmers who lost land were not getting any younger, and some pay-out as a pension payment and final closure was desired. In the end, the compromise over valuation spreadsheets was reached through diligent work and trust being built across all parties.”

But did anyone pause to think about those who were kicked out of the land, by the settlers?

Did they not get young? Did the live to see the total redemption of their land? Mbuya Nehanda was killed and her bones are in the UK as a trophy. What does she say about this deal? Those who killed her are being rewarded by those for whom she died. Really.

To add salt to injury the white farmers apparently made the valuation of ‘biological’ assets (things like plantations) a sticking point, and a difficult one to put a number to. The same applied to land clearance – when was this done, and by whom and what did it cost? And what assets should be included as improvements – how many swimming pools, dog kennels and tennis courts were really improvements to the value of the farm property? And then there were the basic choices of depreciation rates, which inevitably had a big impact on the totals.
Credit to the teams of government officials, Valcon staff, independent assessors and consultants that a global figure was brokered. It can’t have been easy. Did any one remember the virgin land which was grabbed at gun point. Is someone hearing the screams of pain and fear when our forefathers were kicked out of the land. How much were they given as compensation?

Despite getting the land back, some white camps are those believing that this was selling out and that full compensation for land was needed, despite the Constitutional settlement. This group is a small (but vocal) minority, of unrepentant thugs.
Initially the idea of compensation seemed reasonable, yes the conditions were clear – these were improvements only and paid in US dollars, and BIPPA properties (those under Bilateral Investment Treaties) could still pursue compensation for the land in the courts. But the Uturn is angering. Who was fooling who?

Is this not a betrayal of the revolutionary ideals of land reform and that no compensation at all should have been paid?

This again is not playing politics. Land is what defines us. Zimbabwe is the only country we can call ours in the whole world. Some people seem to be missing the point. Indulging in conspiracy theories is not patriotism. Those who voice their revulsion to this deal are not enemies of the state. They are offended Zimbabweans. Assuming that 3.5 billion dollars is paid, the payment of such a huge sum in the dire economic circumstances that Zimbabwe faces, exacerbated massively by COVID-19, is it diligent?

In case we did not know the money will be coming from your pocket that is what is called tax payers fund.

The official line is that half the sum will be raised as a sovereign bond with payments over 30 years, meaning we are bonding our children to a debt which is perverse and vulgar.

There is perhaps no societal problem more wicked, more intractable and more tangled than losing land. Forest degradation, food security, water security and climate must never be given in the hands of the few. By giving the land back to the whites we surrender our sovereignty.
Zimbabweans desire to be addressed on subjects connected with our present national difficulties to understand why as a people are we giving up on our land. But it will not be necessary for us to attempt to retrace the history of the war. It is written in the memory and upon the hearts of all our people. We desire only to be told some general views in relation to the purpose of that war. Was it not for the land or are we mistaken? During that whole period subjects of the deepest interest have engaged all minds and hearts, from the fireside of the chambers of the President.

By a clear understanding of this course, the nation took more pride in taking back the land. What are we doing now? Have we endeavoured to perform our duty with hearts faithful to our rights and our honor, but we shall be the judges of our success?

Have we changed our opinion, that we know of, during the varying circumstances and in the fearful necessities of this war? Men may well change their opinions when circumstances change as they have done too often during the past 40 years; and he is not a wise man, nor an expedient one, who does not employ circumstances and guide himself by them to some extent, always, however, being true to principle. We saw the size of this freedom fight but We could hardly realize the fact that war was to come in this fearful form upon us, nor could you. The idea was strange to the Zimbabwean mind, that the land issue will give us a headache in the independent Zimbabwe.

Throughout this great land no single individual could be pointed out, to whom the Government had done injustice; no man from whom the Government had taken property, or whose liberties had been encroached upon; no man who had been unjustly imprisoned for our land. So what has caused this abdication of our duty to protect our land?

Unless we are missing a point can we be enlightened. The land is still warm with the blood spilt for the land. The land is the only thing given the name mother. Mother land. Mother earth. So who is giving the mother away to the rapist?

Zimbabwe does not have to compensate anyone. We can not give this land back. Displaced Zimbabweans yearn for a compensation. Who will compensate them? Our grand Children will throw stones at our graves in anger. We will put our heads in the graves with shame. I can not imagine what I will tell Anesu my granddaughter about our land. Land is life and our land is our life.

Another Zimbabwean Protest Fails

THE planned August 31 protest over human rights abuses scheduled for the Beitbridge Border Post failed to take off with organisers citing lack of police clearance and reasons “beyond our control”.

The planned demonstration by South Africa-based Zimbabwe Economic Freedom Fighters (ZEFF) saw activists and ordinary Zimbabweans based in South Africa also announcing plans to stage a similar protest in Musina to force the closure of the border.

South Africa’s opposition Economic Freedom Fighters (EFF) leader Julius Malema had extended support for the demonstrations, saying his party would participate.

However, the protest failed to take off with ZEFF leader Innocent Ndibali confirming that the party failed to rally support for the protests while also blaming police in the neighbouring country for not sanctioning the protest.

“Due to multiple factors beyond our control, EFF Zimbabwe has with difficulty and sadness seen it necessary to call off the planned protest,” he said.

“Until the last day, we had not been able to secure permission from the South African authorities to hold a peaceful protest at the border post despite making an application and notification of our plans. It is regrettable that the protest was not allowed to proceed.”

The planned protest came at a time President Emmerson Mnangagwa was under international spotlight over recent abductions, torture and arrest of opposition activists and civic rights activists.

The government and Zanu PF have angrily hit out at critics, accusing them of being sponsored by the West in a regime change agenda plot.

South African President Cyril Ramaphosa last month deployed envoys to Zimbabwe over the deteriorating human rights situation in the country although Harare maintains that there is no crisis.

“We would like to apologise to our fighters and our allies (Zapu, 31st July Movement) that the protest had to be cancelled,” Ndibali added.

“We will not be deterred in our generational mission to bring about total change in Zimbabwe. We have dedicated ourselves to a cause with only one certain outcome: total change meaning that Zanu PF must go and our people be liberated from tyranny.”

Botswana Village Chief Sentences Zimbabwean Man To 2 Years In Prison For Lying

Acting Village Chief Magistrate, Batho Kgerethwa has sentenced a Zimbabwean man, Philemon Sithole (51) to two years imprisonment for violating lockdown regulations.
Sithole pleaded guilty to charges of uttering a false document and giving false information to persons employed in the public service. Kgerethwa sentenced Sithole to two years imprisonment on each count. The sentences are to run consecutively.

On April 24, 2020 near Block 9 in Gaborone, Sithole and his co-accused person, Donald Marondedzi (33) were arrested and later charged with two counts of entering Botswana at an ungazetted point and movement of persons without a permit during lockdown.

Then, it was established before Court that the accused persons near Block 9 in Gaborone unlawfully sold alcohol worth P805 to one Keineetse Puna Lepekoane during the country’s State of Emergency (SoE).

On the second count, the two allegedly sold alcohol worth P115 to Jephias Nhira during SoE. At the time of their arrest, the two did not have a permit to move around.

On July 27, 2020 Sithole paid P1,000 on each of the two counts of selling liquor during lockdown, P500 for unlawful remaining in Botswana and P500 for unlawful movement of person without a permit during lockdown. The other accused person, Marondedzi pleaded not guilty to the charge of selling liquor during lockdown. On July 27 he (Marondedzi) paid P500 for unlawful remaining in Botswana.

On searching Sithole’s car, Detective Marapo said they found alcohol and he claimed to have bought it at Horse Shoe club in Block 6, in Gaborone. Marapo said they found a receipt that proved that indeed Sithole bought alcohol worth P13,020 at the said club.

He said they called the owner of the club, Kegomoditswe Magana, who confirmed selling alcohol during SoE and was also charged for the offence.

Detective Marapo explained to the Court that he contacted SADC to confirm if indeed the accused worked for the organisation, but the Secretariat personnel denied any knowledge of Sithole. Furthermore, Marapo said when searching Sithole’s car thoroughly, the team also found a gun and a taser.

The IO said Sithole produced a residence and a work permit showing that he was a Director at Current Logistics Company. Detective Marapo stated that later on when doing investigations, they established that the documents were fake and Sithole confessed to have bought them from notorious fraudster, Edmore Murufu, who has since been deported for similar offences.

Marapo also said they found out that the two had valid passports, but investigations further revealed that they only had stamps of departure to Zimbabwe last year and they did not have any Botswana arrival stamps for 2020.

Obert Mpofu Says Ramaphosa’s New Envoys Will Not Speak Ill Of ZANU PF

Zanu-PF secretary for Administration Dr Obert Mpofu says that envoys expected on the country from South African President Cyril Ramaphosan will exonerate the ruling ZANU PF party of human rights violation allegations against it.

The African National Congress (ANC) envoys are expected to come to Zimbabwe and meet with Zanu PF and all other stakeholders including opposition political parties, civic society and the church to hear on the situation in the country.

Mpofu however twists the intended visit claiming that the ANC will use the opportunity to strengthen relations with ZANU PF.

“The gesture by the ANC not only epitomises our shared nostalgic anti-colonial position, instead it reasserts a contemporary reproduction of our consciousness to the hidden but the ever-present hand of imperialism in the SADC region.

“In our view as a revolutionary powerhouse in Zimbabwe and in the region, this party-to-party dialogue convened at the urgency of the malicious deconstruction of the ‘Zimbabwean situation’ must expose the imagined desires of a political crisis as misrepresented in the cyber space. We are aware of the input of our opposition in this as its existence is only sustained by creating despondency and demonisation of our nation in a bid to justify its regime-change project. They have failed before and many more failures wait on their part,” said Dr Mpofu.

He said Zimbabwean President Emmerson Mnangagwa and South African President Cyril Ramaphosa were constantly in touch and the expected visit of the South African delegation would dispel any misconceptions of a crisis in Zimbabwe.

“They are expected as soon as possible, it’s an initiative that is being done by our principals, we are sister parties we should never allow a third party to divide us,” said Dr Mpofu.

“Therefore, this forthcoming party to party dialogue substantiates our timely response as liberation movements to the ever-changing complexities of the neo-colonial decimation of the SADC region.

“The only obtaining crisis in Zimbabwe is the continued demonisation of our Government by many forces opposed to the milestones of the Second Republic. In the face of this pro-opposition postured ‘political crisis in Zimbabwe’, this ZANU PF-ANC dialogue on Zimbabwe must reinforce our ideological convergences in as much as it should unpack the two nationalist parties’ shared existential threats.

“While there is a dedicated onslaught on Zimbabwe and ZANU PF in particular to disfigure the political situation in the country, we hope our ANC counterparts will be better acquainted with the genuine state of affairs in our country beyond the sinister propagandas of our detractors,” he said.

The meeting, Dr Mpofu said, is also expected to strengthen regional interparty solidarities through enhanced peer-reviews of the governance questions.

“The ultimate output of this dialogue should produce a determined resolution to move the agenda for our development in our own terms. As ZANU PF, we anticipate that the major resolution of this dialogue will see our shared anti-colonial political soul magnified towards strengthening our bilateral ties in the areas of commerce, industry, trade and the mutual exchange of sustainable political ideas to build a better continent whose tenets of state-craft are not determined by neo-colonial prefects and their proxies on the doorsteps of our continued fight for unity, development and freedom in Africa,” said Dr Mpofu.

Last month, President Mnangagwa hosted three envoys from President Ramaphosa who included former South African Minister of Safety and Security Dr Sydney Mufamadi, who was leading the team, the former Speaker of Parliament Baleka Mbete and former Minister of Public Service and Administration Advocate Ngoako Ramatlhodi.

Mnangagwa quickly dismissed the envoys before they could meet with other stakeholders. ZANU PF claimed that the envoys were not meant to meet with anyone else except Mnangagwa. The move necessitated the expected visit but a whole new team with specific instructions to meet all stakeholders in the country.

“The meeting was part of a peer to peer review of two brotherly nations, which have shared historical ties forged in their nations’ struggle for independence from the white colonialists who are now sponsoring mayhem in the region to install puppet regimes,” said Dr Mpofu of the first envoys.

Morgan Komichi Says He Is Auditing Chamisa

The Thokozani Khupe led MDC-T national chairman Senator Morgan Komichi says the Supreme created party is now in the process of carrying an audit to expose any theft or abuse of the party properties by the MDC Alliance.

Komichi told state media that the party has taken possession of a lot of the MDC Alliance properties and beginning to audit the properties.

“We managed to repossess most of our offices. We started with the occupation of the party headquarters Morgan Richard Tsvangirai House, which is the flagship of the party.

“After the headquarters we went on to occupy Bulawayo, Masvingo, Hwange, in Matabeleland North, Gwanda in Matabeleland South, Marondera, Mashonaland East, Gweru in Midlands province offices.

“We are now in the process of occupying Mashonaland Central, Mashonaland West and Manicaland provinces. So far, we have managed to secure some of our vehicles, but I do not have the numbers off-head,” he said.

This all comes after the Supreme Court in March reversed the leadership of the party left behind by the late MDC founding President Morgan Tsvangirai from Nelson Chamisa and reinstated Thokozani Khupe as the interim president of the MDC-T pending an extraordinary congress.

After taking control of the MDC-T, the Khupe camp went on to recall and replace senators, MPs and councillors loyal to Chamisa.

Now the Khupe team says it is carrying out an audit that Komichi said is designed to unearth any abuse of the party properties including vehicles and computers.

“We are currently carrying out an audit of party assets such as vehicles, furniture, books of accounts and party offices in all the provinces and appropriate action will be taken at the appropriate time. The legitimate leadership of the MDC party has finally occupied their offices,” said Senator Komichi.

Mr Komichi said the occupation of their offices is a fulfilment of the Supreme Court ruling that stated that everything that was presided over by Chamisa, since he took over leadership of the party in 2018 from Tsvangirai is null and void.

He added that since Chamisa has claimed to be the leader of the MDC Alliance he cannot lay claim to any offices whose ownership is enshrined in the party’s constitution to be the MDC.

“Guided by the Supreme Court judgment, which reinstated madam Khupe and gave us power to organise an extraordinary congress to choose a new leadership, we have taken over because the party’s constitution in section 1:4 stipulates that the headquarters of MDC is 44 Nelson Mandela, Harvest House building,” said Komichi.

Mutsvangwa Says Govt Is Not Reversing The Land Reform But Only Improving Agriculture Productivity

Zimbabwe’s Land Reform remains irreversible with Government efforts now focused on improving agricultural productivity, Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa said last night in a post-Cabinet media briefing.

Her remarks followed a joint Press conference by Lands, Agriculture, Water and Rural Resettlement Minister Dr Anxious Masuka and his Finance and Economic Development counterpart Professor Mthuli Ncube.

The two were clarifying the recent Global Compensation Deed between Government and white former commercial farmers which deals with constitutionally-required compensation for improvements made by the previous owners.

“There is absolutely nothing that should be misinterpreted from this agreement. It’s very clear. It’s not a form of land reform reversal. What Zimbabwe now want is agricultural productivity that’s what we want,” Minister Mutsvangwa said.

“So going forward the Government’s priority in agriculture is to increase production and productivity through the collaborative efforts of all Zimbabweans. This include skills transfer from the former owners to the resettled farmers and the provision of an attractive land tenure system that will be supportive of increased levels of investment on our farms.”

In his Monday briefing, Minister Ncube clarified the security of tenure for former farm owners still on the land, indigenous farmers and those that farms covered by Bilateral Investment Promotion and Protection Agreements and were affected during the Land Reform programme that redressed colonial land imbalances.

Former farm owners on compulsorily acquired land should urgently regularise their tenure through designated Government institutions before consideration could be made for the issuance of 99-year leases.

Those who had already gone through the processes, like any Zimbabwean, and who already held offer letters could proceed to apply for 99-year leases.

Farm owners who are indigenous Zimbabweans or citizens of countries which had ratified investment agreements or bilateral investment treaties with Zimbabwe at the time their land was compulsorily acquired for resettlement are entitled to compensation for both land and improvements.

Minister Mutsvangwa said the compensation of improvements on the farms was provided for in the Constitution which was endorsed in 2013 and all Government was doing was implementing the provisions.

“She Managed To Do Her Duties ATt Mpilo While Battling The Ailment,” Nurse Confirmed To Have Died Of Covid-19 A Week After Death.

MPILO Central Hospital has lost a nurse to Covid-19 who died at the institution last week.

Sister Pretty Mpala (36) from Emakhandeni suburb in Bulawayo tested positive posthumously and was buried on Friday.

She is one the hundreds frontliners in Zimbabwe who have been infected while trying to save lives.

According to a weekly situational report from the Ministry of Health and Child Care, nurses are the most affected workers when it comes to Covid-19 and they constitute 37 percent of total health care workers affected.

As of Monday, there were 6 497 confirmed Covid-19 cases in Zimbabwe and 202 deaths. Bulawayo province has a cumulative total of 1 276 cases, 25 deaths and 1 140 recoveries.

Statistics from the Ministry show that more than 480 health workers have contracted the global pandemic in Zimbabwe.

Bulawayo (137) and Midlands (128) account for a greater proportion of infected front liners.

Healthcare workers have been greatly exposed to Covid-19 due to the global shortage of personal protective equipment.

More than 120 nurses at Mpilo Central and United Bulawayo Hospitals have contracted the virus, forcing them into quarantine, thereby reducing the number of workers who are manning the public institutions.

In an interview, Sr Mpala’s aunt, Mrs Kezzeneth Mpala, said the family had lost its breadwinner and was struggling to accept the nurse’s fate. She said Sr Mpala’s guardian, her grandmother, had fallen sick after receiving news of her untimely death last week.

“We are still shocked and in deep pain following the passing of Pretty who was the sole breadwinner in the family. Our hearts are sore and we fear for her traumatized grandmother who raised her following the death of her parents as she is struggling to walk or talk since her death,” said Mrs Mpala.

“Pretty was a caring person and it was not surprising that she eventually became a nurse. She went through a lot of challenges while growing up but managed to shrug off all discouragement and qualified as a nurse.”

According to Mrs Mpala, Sr Mpala was passionate about serving her people and community which made her a committed and resilient nurse.

Mpala, the only child born to her late parents, started her nursing studies in 2013 and had never looked back. She also struggled with some illnesses which never killed her hardworking spirit as she managed to do her duties at Mpilo while battling the ailment.

“We used to meet members of the public in town who would stop and thank her for the care she rendered while they were admitted to Mpilo. She was also a darling to the community and our relatives and would easily give health advice so that everyone around is healthy and fit. Her loss has brought a lot of pain in our lives and we hope one day we will understand why her life had to end this way,” she said wiping away tears.

Mpala is survived by her grandmother and cousins.

Mpilo acting chief executive officer Professor Solwayo Ngwenya sent his condolences to the family saying Covid-19 had cost the institution a hard-working staffer.

“We are extremely saddened that Covid-19 has taken one of our staff members, her premature death is evidence that this disease is deadly. As health workers are at the forefront, we continue to bear the brunt of this virus but we still must work hard and face it while saving lives,” said Prof Ngwenya.

“Most of us will be infected in the line of duty and it is sad that one of our self-sacrificing nurses had to lose her life. I would like to commend all those who come to work despite the risks that come with our jobs, this kind of sacrifice is highly commendable.”

State Dismisses Beatrice Mtetwa Evidence On Job Sikhala Bail Application

The Harare Magistrates Court on Tuesday discredited evidence given by lawyer Beatrice Mtetwa as a witness in the case of MDC Alliance national vice chairperson, Job Sikhala, who is facing charges of inciting public violence ahead of the flopped July 31 protests.

Mtetwa took to the witness stand to testify that Sikhala had not been on the run from the police as she had personally delivered correspondence to the police indicating the availability of Sikhala if they were looking for him.

In her testimony, Mrs Mtetwa exonerated Sikhala after telling the court that she made all the arrangements to accompany him to the police if they were indeed looking for him.

However, the State led by Mr Garudzo Ziyadhuma opposed Ms Mtetwa’s claims saying she never delivered the said letter to the police since it was not signed.

Another witness, Mr Albert Masaka who is the editor of Zim Community News was called in to testify and also exonerated Sikhala confirming that he had interview with him to show that Sikhala was not in hiding from the police.

The court heard that the video and audio clips under controversy were retrieved from the Zim Community news.

In opposing bail, prosecutor Garudzo Siyadhuma previously told the court that Sikhala was a flight risk, hence not a suitable candidate for bail.

Mr Siyaduma led evidence from Detective Collins Makore of the CID Law and Order section who told the court that police struggled to arrest Sikhala.

Detective Makore said when they arrived at the house where Sikhala was, he was hiding in the ceiling.

Sikhala is said to have only responded after police threatened to throw a teargas canister into the house.

“When we entered the house, we met a woman who lied that she was alone in the house,” he said.

The court heard that during the period stretching from March 2020, Sikhala called on the people to demonstrate against the Government on July 31, by saying “there is a war we should fight and if we don’t fight, nothing will come out . . . I will fight the State since I’m not easily intimidated.”

According to the State, the declarations were made by Sikhala on his social media platforms, adding there was reasonable suspicion that he committed an offence.

Prison Doctor Says Hopewell Chinono Does Not Have Covid-19 Symptoms But “Only Had A Headache And Elevated Temperature”

Jailed investigative journalist Hopewell Chin’ono has no symptoms of Covid-19 and is not a risk to other inmates, the court heard yesterday.

Chin’ono, who is facing charges of inciting public violence, appeared in court for his routine remand.

This came after Chin’ono’s lawyer Advocate Taona Nyamakura told the court that his client had been dragged to court by prison officers.

Adv Nyamakura told the court that his client was examined by a professional physician who observed that he was exhibiting symptoms of Covid-19.

“His doctor had advised that my client should not be brought to court or be in contact with other inmates since he was exhibiting symptoms of Covid-19,” he said.

Adv Nyamakura said prison authorities misled his client that his doctor wanted to examine him before manhandling him to court.

“My client is currently on medication, which he cannot take here at court. His doctor was supposed to examine him this morning, but all that could not happen because my client was forcibly brought here,” he said.

Before responding to Mr Nyamakura’s submissions, Prosecutor Mrs Tendai Shonhai successfully asked the court for a brief adjournment saying she wanted to contact the Chikurubi Maximum Security Prison doctor to get full information on the issue.

After the brief adjournment Mrs Shonhai told the court that she had spoken to Dr Blessing Dhorobha who indicated that the accused was complaining of having a headache on Monday and had a slight elevated temperature.

“Dr Dhorobha said he tried to examine the accused, but he refused saying he wanted his personal doctor,” said Mrs Shonhai.

She said from Dr Dhoroba’s observation, the accused was not showing any symptoms of Covid-19 like coughing and shortness of breath and was not a risk to other inmates.

“The accused has not exhibited any symptoms of Covid-19 except a slight elevated temperature and a headache,” she said.

Harare regional magistrate, Mr Ngoni Nduna said Chin’ono’s doctor should have submitted a report of his own findings for the court to have a clear picture on the issue.

He deferred the matter to September 15 after Mrs Shonhai assured the defence that she was going to furnish them with a trial date.

Advocate Nyamakura put the State on notice that he was going to make an application for refusal of further remand if a trial date was not given on the next remand date.

Oppah Muchinguri Briefs Cabinet On Covid-19 Situation In The Country

Cabinet was on Tuesday briefed by the chairperson of the Covid-19 Inter-Ministerial Taskforce, Defence and War Veterans Affairs Minister Oppah Muchinguri-Kashiri, on the situation of the Covid-19 pandemic in the country.

Zimbabwe now has 6 559 confirmed Covid-19 cases with 203 deaths, although recoveries have reached 5 241.

“Cabinet acknowledged that despite the surge in positive local cases, the majority of the cases of local transmission are mild to moderate, with a recovery rate of about 80 percent.

“Most of these cases are managed at home and in isolation facilities. The national testing strategy however will continue to prioritise the testing of all health care workers and other frontline personnel, inclusive of public transport drivers,” Minister Mutsvangwa said.

Minister Muchinguri-Kashiri said Treasury had released US$20 million for the procurement of testing kits that have been in short supply.

Govt Says All Key Stakeholders Were Consulted In Coming Up With Dates For Schools Opening

Schools reopen on September 28 for Zimsec examination classes with the exams starting on December 1, Cabinet decided yesterday.

Cambridge examination classes can start a fortnight earlier, on September 14, with Cambridge examination dates being earlier as they are set internationally by a British-based board.

Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa said after the Cabinet meeting that the Ministry of Primary and Secondary Education was working closely with other ministries and stakeholders to guarantee the safety of pupils and staff during the examinations period.

“Standard operating procedures have been distributed to all schools,” she said.

Minister Mutsvangwa said preparations for the holding of examinations were in progress with consultations involving relevant stakeholders ongoing.

Schools were closed late in March ahead of the initial 21-day national lockdown, but reopened briefly for June examinations.

Fifteen stakeholders have already made their submissions, with nine others expected to make theirs shortly.

Stakeholders that have been consulted include teachers’ unions, the Parliamentary Portfolio Committee on Education, the Association of School Development Committees, the Independent Colleges in Zimbabwe, the Private Schools Association of Zimbabwe, and the Association of Trust Schools.

Zimbabwe Teachers Association (Zimta) chief executive officer Dr Sifiso Ndlovu said later that the major concerns of teachers were ensuring that schools had adequate hygiene and that there was adequate personal protective equipment (PPE) for pupils and teachers.

“To us, the issue of safety comes first. Our concern is, does the Government have capacity to provide a hygienic environment that will not allow the spread of the pandemic?”

The second problem was remuneration of teachers, with Dr Ndlovu noting that illegal transport operators were charging in foreign currency, although Zupco — which runs services within cities — charges subsidised fares in local currency.

Past opening proposals had Zupco providing buses to get pupils and staff to schools.

Progressive Teachers Union of Zimbabwe (PTUZ) president Dr Takavafira Zhou wanted all pupils, teachers and ancillary staff tested before schools reopen.

He said the remuneration of teachers had to be addressed, but cast doubt on the practicality of reopening and preparing students in time for them to write examinations this year.

Meanwhile, Minister Mutsvangwa said the Government was finalising modalities for the reopening of airports for passenger and tourist traffic to support the resumption of the tourism sector.

She said the plan was to start with the resumption of domestic flights and then move to international flights.

Cabinet also approved the resumption of the rest of tourism operations, including boat operations.

Speeding Motorist Hits ZRP Cop

A ZIMBABWE Republic Police officer died after being hit by a speeding motorist yesterday.

Terrence Kavhayi (26) was involved in a tragic road accident in Gweru while on patrol.

He was seriously injured and died at Gweru General Hospital upon admission.

Kavhayi was knocked down by Kudakwashe Manyuchi (32) who was speeding.

The deceased flew into the air landed on the tarmac about 10 meters from the point of impact and started bleeding profusely from the forehead, Bulawayo24 has learnt.

The accused is being charged for culpable homicide and investigations are in progress under Gweru Traffic.
