By Own Correspondent| A Harare magistrate Francis Mapfumo has dismissed MDC Alliance principal Tendai Biti’s case where he was challenging his “illegal” arrest in Zambia.
Alec Muchadehama, Biti’s lawyer revealed that they are set to challeng this ruling at the High Court.
Speaking at Harare magistrates court following the ruling, Muchadehama said the magistrate’s judgement was grossly unreasonable and he did not appreciate the matters being presented.
Said Muchadehama:
“The ruling was grossly unreasonable and it is our view that the magistrate did not fully appreciate the issues that we presented.”
.Biti who is facing charges of inciting violence and contravening the Electoral Act, is challenging the jurisdiction of the court in his case, arguing that he was “abducted” by Zimbabwean authorities who returned him to Zimbabwe from Zambia.
Biti further submitted that in arresting him, the Zimbabwean authorities violated Zambia’s refugee law, Zambia Immigration and Department regulations and Sadc Protocol on Deportation.
