Correspondent|A female Police officer based in Chivhu has been dragged to court on allegations of adultery and she has been slapped with a $10 000 lawsuit.
Kirsty Mushoriwa is accusing Nyasha Gweshe of having an affair with her husband Tinashe Mushoriwa for five years now. Mushoriwa works for the Ministry of Lands Agriculture and Rural Resettlement in Nyamapanda.
Both women are being represented by lawyers and the matter which came to court on Friday is before Chivhu Magistrate Michelle Panavanhu.
Kirsty who is represented by Ruvarashe Rusemwa of Nsingo and Associates says that Gweshe engaged in a sexual relationship with Mushoriwa when she was fully aware that he was still married to her and the marriage Chapter 5:11 between them was still valid.
Kirsty said she talked to Gweshe’s superiors to intervene in the adulterous relationship but to no avail. The only thing that happened is that Gweshe was transferred from Nyamapanda to Chivhu.
Gweshe, through her attorney, Albert Mhaka of Mhaka Attorneys dismissed the claims arguing that she discovered that Tinashe was married four months after she was pregnant with his child.
She said that she was customarily married to Mushoriwa who paid bride price for her. She said that there was no longer a love relationship between Mushoriwa and Kirsty since the former had filed an application of divorce at the High Court although the matter had not yet been finalised.
Gweshe also argued that Kirsty had filed the damage claim out of malice after a Murambinda magistrate recently granted a downward variation of spousal maintenance she was getting from Mushoriwa.
“I first met Kirsty in court some four months after I had got married to Tinashe when she had filed a peace order application against me. She however had never confronted me about her husband earlier because she knew very well that there was no longer affection between them,” said Gweshe.
Rusemwa however insisted that the customary marriage between Gweshe and Mushoriwa could not override the dictates of the Chapter 5:11 marriage between her client and Tinashe.
“You should have left the man you are having an adulterous affair with as soon as you discovered that he was married to the applicant. My client has lost trust, love and companionship because of the extra marital affair he is having with you,” said Rusemwa.
Gweshe confirmed that she had a child in the alleged adulterous relationship.
The matter was postponed to November 15 2018.
