Specialist Surgeon Faces Dismissal

Zimbabwe’s only Pelvis Orthopedic surgeon who is based at Parirenyatwa Group of Hospitals, Dr Mageza Chiwamba, has been summoned to a disciplinary hearing.

Government accuses the surgeon of not coming to work during the ongoing doctors’ incapacitation.

MISCONDUCT CHARGE AND INVITATION TO DISCIPLINARY HEARING

This letter serves to notify you of the misconduct charge against you. You are hereby charged in terms of section 4 of the Labour (National Employment Code of Conduct) Regulations, Statutory Instrument 15 of 2006 (the Code).

The hospital has reason to believe that you committed an act of misconduct or acts of misconduct as defined under section 4 of the Code in that:
(1) Contrary to section 4(e) of the Code, you were absent from work for a period of five or more working days without leave or reasonable cause in a year.

(2) Contrary to section 4(a) of the Code, your conduct was inconsistent with the fulfilment of the express or implied conditions of your contract.

Particulars of the aforementioned acts of misconduct are as follows:
(1) Absence from duty; You did not report for duty from 16 September 2019 to date without reasonable cause.

(2) Conduct or omission inconsistent with the fulfilment of the express or implied conditions of your contract; You participated in an unlawful collective job action. Your participation in the job action was inconsistent with your express and or implied contract of employment in that Doctors are not allowed or expected to take part in collective job action as you are classified as essential service.
