Ex Dynamos, Warriors Defender In Dubious Scholarship Scam

By Own Correspondent| A dubious scholarship fund allegedly owned by former Dynamos and Warriors defender James Matola has swindled thousands of dollars from desperate job seekers over the past four years, it has emerged.

The James Matola Foundation is believed to be owned by Matola and his wife Ayanda Brown and is working with a white Canadian, Brad Bino.

Several victims of the scam have spoken to a local publication about their financial loss, all in United States Dollars. One such victim said:

I joined James Matola Foundation last year. I was told to deposit US$175 as registration fee, considering I was promised to get a nursing job in Canada.

I was so excited when I was told the arrangement was to take me along with my wife and children.

Since I joined this foundation, they have been promising to hold a workshop with us firstly in Harare and then in Pretoria, and then leave for Canada.

When they were not showing up, I began to suspect the foundation was not genuine.

We were supposed to attend an indaba in SA, of which bus fares, meals and accommodation were not catered for.

So, I thought it wise to sell my car to cover the costs. To date, that meeting has not been held and Ayanda has been giving excuses that the white man from Canada is not showing up.

To add salt to the injury, the Foundation invited several “beneficiaries” to the Harare International Conference Centre (HICC) for a meeting which never took place.

Said one of the beneficiaries: On Tuesday, Brown told us on WhatsApp that we were going to meet in Harare, but she did not divulge any information concerning the venue.

It was not until in the morning (Wednesday) when she told us to converge at HICC for the meeting.

We tried to call them, but they were not reachable and unavailable on WhatsApp. To our surprise, there was no one from James Matola Foundation who showed up and the hotel staff chased us from the HICC.

We requested to see the manager, who then told us that James Matola Foundation had not even booked for a conference room at HICC.-Newsday

Churches Press Govt To Urgently Restore Socio-Economic Justice

As usual, the church will not tire in warning and admonishing the rulers of our land as long as they continue to exhibit ungodliness in their governance which continues to impoverish the masses.

Social unrest remains inevitable as long as socio-economic injustices persist in Zimbabwe and the leaders should know better. We caution that intimidation and suppression of people’s freedoms will not work.

Recently, the government arrested union leaders from the education sector and other human rights activists accusing them of plotting unrest. Subsequent to that, the Minister of Home Affairs issued warnings to civic organizations that government will descend heavily on anyone suspected to or organizing demonstrations.

We wish to state that Citizens are entitled to their freedoms and it is perfectly in order for anyone or organization for that matter to demonstrate over any disgruntlement especially where misgovernance and unfair labour practices are concerned. We all know that teachers and the entire civil service have been underpaid for decades.

The same teachers demonstrated and walked more than 200km last year just to make a point on their deplorable conditions of service, only to be arrested in Marondera just before they entered the capital. People’s earnings have been eroded and rendered useless. This erosion is a result of the loss of value in our currency which, according to the Bible, is typical of a nation whose leadership has become morally decadent.

Chapter 59 of our Constitution grants citizens, rights to demonstrate peacefully and 58 the right to associate with anyone of choice and to assemble but president ED Mnangagwa’s government has no regard whatsoever for the constitution which he as president swore to uphold.

Almost all demonstrations against government’s incompetence, no matter how peaceful, including those cleared by the courts, have been met with brute force yet we talk of new dispensation and openness to business.

The nation and economy are worse off today than they were in 2017, not implying of course that Mugabe’s era was any better. But to emerge from a coup and not experience tangible positive changes, means it is just a change of power from one dictatorship to another mafia type of governance.

Zimbabwe’s rate of inflation has shot up to more than 60%, which is by far higher than the single-digit it was in 2017, a clear indication of poor performance, a direct result of bad governance and poor economic policies.

Is it not strange that we cry about sanctions yet one of the major causes of sanctions is gross human rights violations? Are we, therefore, doing ourselves any good by continuously being repressive, killing our own people yet putting up unreasonable smokescreens?

Ironically, the government talks of austerity measures and urges everyone to be patient, and bear the hardships for a little longer, and yet government leaders are not subjecting themselves to the same lean expenditure patterns! We only get to hear about the luxurious jet having been donated after a national outcry at such senseless extravagance.

Why wasn’t the announcement made when the supposed donation of such princely value was made, if at all it was a gift? Does the president expect the nation to buy such cheap hoodwinking gimmicks?

There isn’t any amount of commitment by the government to cut back on its expenditure and the workers and the nation have eyes hence so much restlessness. Politicians spent big on personal medicals outside this economy than they do on trying to revive our ailing health system. They buy luxurious cars, fleets upon fleets from outside and pay lip service towards reviving local plants e.g. Willowvale Motor Company, Quest automobile in Mutare, we inherited from Smith in functional state.

The price increases from fuel to every other commodity and now to basic goods like bread have just gone beyond the reach of many. Why is it that we took land from whites but are now failing to grow basic cereals like maize and wheat? Who owns all the fertile arable land now, that used to produce the same to the extent of feeding the entire region? It is therefore unrealistic, not to expect demonstrations and uprisings given such untenable economic conditions?

There is no need for a foreign power to influence anything nor anyone because President ED Mnangagwa’s government has created perfect conditions for unrest, for protest and turmoil. He comes from a liberation war background and he should know better the reasons why tens of thousands left the country to wage war against Ian Smith.

However, the sad reality is that so-called liberators have become today’s greatest oppressors.

The church, therefore, sends serious warning signals to President ED’s government that, the same script that was resisted by the masses with the church included, will always play out if his government does not correct the wrong fundamentals. Bad governance never wins the favour of people no matter how many they kill, jail, intimidate and maim.

The nation is groaning because of the brutal evil system of governance that is corrupt and incompetent, that kills its own innocent and unarmed citizens for just registering their displeasure.

We warn again President Mnangagwa that God is on the side of the weak and the oppressed and he dethrones evil rulers.

VOA|It’s no joke being a comedian in Zimbabwe.

In a country where open criticism of power can spell trouble for journalists, politicians and activists, comedians say they, too, risk consequences – arrest even – for taking aim at the authorities or satirising the hardships of daily life.

The long-awaited end to President Robert Mugabe’s rule in 2017 had raised hopes of a more open society, ending years of repression and economic mismanagement that had driven 63 percent of people into poverty, according to U.N. data.

But the arrest of four comedians in recent months, confirmed by police, has dampened this confidence and any hope of using humour to vent popular frustrations over living with too few jobs, too little food and scant faith in any fix.

“We live in a country where politics is the order of the day. When people in authority do bad things, as comedians, we speak out,” comic Prosper Ngomashi told the Thomson Reuters Foundation.

“Government must see us as supporting pillars, not enemies.”

The government says it has no problem with dissent, in keeping with President Emmerson Mnangagwa’s pledge that free speech – a right routinely denied during his predecessor’s 37 years in power – would be indispensable in a “new Zimbabwe”.

“Government supports freedom of expression as enshrined in our constitution; artistic expression, satire or even dark comedy, is part of that freedom; government is not overly sensitive to criticism or satire. It is part of artistic expression,” Nick Mangwana, Permanent Secretary in the Ministry of Information, told the Thomson Reuters Foundation.

But with dollar shortages battering the economy and rocketing inflation destroying savings, the government has reacted forcefully to any resistance on the street. The country faces a laundry list of problems: food and job shortages, an HIV epidemic, unaffordable public spending and overwhelming poverty.

Lawyers and witnesses said civilians protesting over fuel hikes were beaten and detained early this year.

An internet blackout in January left many without social media, exposing the government to accusations of censorship and emboldening satirists who say they cannot sit idly by.

“Comedy works for reconciliation. I don’t live in fear because I don’t ridicule government,” said Ngomashi. “Government feels mocked by our works of comedy; they don’t fear us.”

Around the world, comedy has long acted as an outlet to rail against political oppression, dictatorship or economic hardship.

And comics find plenty of fodder in modern Zimbabwe, run by a former Mugabe security chief nicknamed ‘The Crocodile’.

“Comedians were amongst the people that marched alongside the country’s military calling for former President Mugabe’s resignation in 2017,” Claris Madhuku, a political analyst and director of the Platform for Youth Development, a civil society organisation, told the Thomson Reuters Foundation.

“Seeing that freedom then, they thought they would still see the same (liberty) under the so-called new government … but that is not the case, because just like Mugabe, Mnangagwa does not need anything to deter his stay in power.”

MISSING MUGABE

Comics are even lamenting the demise of Mugabe in sketches that underscore their acute disappointment with the new regime.

In November, Prosper Ngomashi, popularly known as Comic Pastor, said he was arrested after posting a pro-Mugabe video on Facebook in which he said “we are suffering from the side effects of your departure from office, old man”.

Ngomashi said he was released without charge.

A top police officer at Harare Central police station – who asked not to be named as he is not allowed to speak to the media – confirmed the arrest.

“But we found no charge to prefer against him following his social media video allegedly in support of Mugabe,” he added.

Ngomashi, along with his U.S.-based partner Alfred Kainga, made headlines in January when they ridiculed Mnangagwa for cutting short his vacation to resolve a doctors’ strike – that started more than a month before his break began.

A month later, there was more conflict on the comedy circuit when police arrested two performers after a video showed them in police uniform, one thrashing arrested suspects while the other denies any police brutality.

The pair – real names Samantha Kureya and Sharon Chideu – were each fined 20 dollars (about $8) for unlawful possession of police uniform and freed.

“The police didn’t like the way we exposed their brutality via our comic video; that’s truly why they arrested us,” Kureya, 31, told the Thomson Reuters Foundation.

Kureya said she was “still traumatised” by police storming her Harare home and worries about escalating repression.

“We are not safe at all; we don’t know what will happen to us as comedians. I think we are moving in that direction where at the end of the day they (police) will start coming to our shows to monitor our content,” said Kureya.

CARRY ON

The government denied any crackdown and said it welcomed vibrant, free speech and fair criticism.

“Government has absolutely no problem with political satire,” Zimbabwe’s Minister of Information, Monica Mutsvangwa, told the Thomson Reuters Foundation.

Yet she also stressed there was a limit, saying: “Comedians should always be carefully guided by the country’s laws.”

The comedians vow no letup in their mission.

“It’s scary, but we love our work and it’s our life,” Kureya said. “Comedy is growing and our content is influential and our viewership as the alternative is scaring the state.”

But she said the duo now censored its material to stay safe, while her partner Chideu, 27, said scrutiny was the new norm. “Police are not happy with our content and our work and they follow our production with keenness,” said Chideu. “Anything can happen to us.”

For ordinary Zimbabweans, laughter is more vital than ever.

“The comedians narrate our challenges in funny ways,” said 27-year old Roseline Musawu, a jobless sociologist.

Mangudya Unveils Fuel Rescue Package

By Own Correspondent| Central Bank Governor John Panonetsa Mangudya, has unveiled a rescue package which is set to ease the current fuel woes.

The package which Mangudya said will see improved fuel deliveries is set to see the central bank releasing Letters of Credit (LCs) worth US$50 million to the major fuel retailers in the country called the Big Four.

The Big Four are Zuva, Engen, Sakunda and Puma and are said to have started receiving deliveries from Wednesday by the Minister of Energy and Power Development, Joram Gumbo.

Mangudya said that in future, LCs will be processed earlier to avoid gaps which result in fuel shortages on the market.

Said Mangudya:

The situation has started to improve, starting Wednesday this week because nearly every fuel company was given LCs, including the big four.

Going forward, the RBZ is working towards synchronising the lead time between the establishment of the LCs and their confirmation so there are no gaps in the release of the product to the market.

The lead time must be minimised and we are going to be more meticulous going forward to minimise time difference between the establishment of LCs and supply of fuel.

According to Investopedia, a letter of credit is a letter from a bank guaranteeing that a buyer’s payment to a seller will be received on time and for the correct amount.

In the event that the buyer is unable to make a payment on the purchase, the bank will be required to cover the full or remaining amount of the purchase.-DailyNews

South Africa’s Voter Turnout Could Be Lowest In 25 Years

South Africa’s political parties differ on a lot of things, but there is one thing they agree on during elections, and that’s getting as many people to cast their ballots.

They all realise that the higher the number of people who go to polling stations on voting day, the higher their support may be.

Voter turnout is one of the key aspects of any election, with commentators and politicians seeing it as a level of representation of the will of the people.

As of midday, the IEC’s data was showing that voter turnout for this year’s elections was at 65.47%. At that hour, 8 103 of the 22 925 voting districts had completed their counting of votes.

Rain and cold weather in a number of provinces on Wednesday sparked concern, with political parties fearing that people would stay away from the polls, avoiding standing in long queues for hours during inclement conditions. However, it’s still too soon to conclude why a larger percentage of voters would have stayed home during Wednesday’s polls. Voter apathy and a disillusionment with the parties on offer may also have played a role.

In 1994, when the first democratic elections were run by an interim commission, it was difficult to gauge the turnout of voters, as millions of black South Africans were voting for the first time. Voters weren’t expected to register to cast their ballots and thus it was impossible to determine a voter turnout percentage.

In 1999, with a base of 18 172 751 registered voters, the final turnout was 89.3%.

As is the trend in most young democracies, voter turnout dropped five years later during the 2004 election, but the final percentage was still significantly high at 76.73%. The real number of registered voters increased to 20 674 923.

Five years later, in 2009, the number of registered voters jumped to 23 181 997. The voter turnout bucked the trend, increasing to 77.3%.

The decline resumed in 2014, when turnout dropped to 74.48%. The base of registered voters that year was 25 388 082.

Zanu PF Apologist, Tafadzwa Mugwadi Attacks Herald Editors Over Demotion

Following the demotion of journalists aligned to Deputy Chief Secretary to the President George Charamba, a Zanu PF apologist, Tafadzwa Tuboy Mugwadi has attacked Acting Editor Tichaona Zindoga over his decision to reshuffle reporters, lebelling him a school deserter.

Posting on Facebook, Mugwadi had no kind words for those who called him a Charamba loyalist saying their decision to move him from Social Media Manager to a new desk called The Knowledge Centre was their pure jealousy.

Mnangagwa Loyalist Says Chamisa Is An Imposter, Challenges MDC Supporters To Insult Him.

The MDCA is a phantom party that is based on lies, trickery and percieved popularity.

I am surprised that David Colart is shocked at the High Court rulling. I am not a lawyer but l analyse things.

I dont know what kind of weed we have smoked as Zimbabweans to believe such a lie.

Based on facts: the appointment of Chamisa and Mudzuri by Tsvangirai was illegal.

The interim leader of the MDCT that is presumably one of the Alliance partners is Thokozani Khuphe, the Secretary General is Douglas Mwonzora, Tendai Biti, Jacob Mafume, Kucaca Phulu and co are PDP, Prof Welshman Ncube and crew have their own party.

Now the million dollar question is: the MPs and councillors that were elected, which party do they belong to?

The rulling simply takes us back to 2016 and techinally nullifies the MDCA because the Alliance was premised of falsehoods that Chamisa leads the MDCT where he was ANOINTED by the late Tsvangirai.
As l earlier indicated, the MPs and councillors belong to the party whose papers were submitted to ZEC during nomination and that is MDC led by Prof Ncube.

As things stand Ncube is the legitimate leader of a party that has MPs and councillors, Chamisa himself confirmed it recently being interviewed by Zenzele Ndebele.

What this means is that there is nothing called MDCA and going to congress which constitution are they going to use?
The MDC led by Ncube has Ncube as its President and PDP has Biti as its President, Chamisa and his veciforous legion have no party.

I wonder what on basis are learned colleagues like David Coltart seek to appeal the rulling because it affects the MDCT thereby destroying the foundations of the Alliance.

The nominations of Ncube, Biti, Mafume and company into the MDCA whose parties have not gone to congresses to make a resolution to disband and form a new party is yet another time bomb awaiting the MDCA. It takes one member of these parties to approach the courts.
This means the MDCA is a fake party like l said before.

I do not see the Supreme court setting aside the High Court rulling.
An appeal is just an academic exercise like the August 2018 Concort application on election results.

The problem is that our colleagues in the MDC are so obsessed with power and they are intolerant to indipendent and sober views. They dismiss you and label you as ZANU and CIO when you dare tell the truth.

Its sad that we are building a cult that does not adhere to truth nor the tenents of democracy.

Mobocracy is not a solution to Zimbabwe’s governance challenge.

Organisation Spearhead the Reconstruction of an ECD Block in Chipinge

Jane Mlambo| A community-based organization in Chipinge, PYD secured support from FEPA to reconstruct an ECD block that was devastated by the recent tropical storm Cyclone Idai. The reconstruction initiative helped children from poor background to access education and in turn prevent the dropout rate in the area.

According to the 2017 Annual Education Statistics Profile for Manicaland Province, school age population for Chipinge is 155 944 and of this figure 54 211 are enrolled at infant level. The district has 136 primary schools and the majority of them serve low income bracket. The ECD block at Rimbi Primary School is one of the schools that serve a low-income community.

Tropical Cyclone Idai effects undermined social developments of the Rimbi community, as it exacerbates inequality and marginalization. The destruction of the ECD block in March 2019, is a clear indication of climate related vulnerabilities. In the immediate aftermath of the tropical Cyclone Idai, the damage to the ECD block interrupted children’s education. This posed serious challenges as the Rimbi community is already strained by the current harsh economic environment coupled with a looming drought.

“PYD places education and health of the most vulnerable members of our community at the core of the community development agenda.” Artwell Chingwara, PYD’s Information and Social Media Officer said.

“When Cyclone Idai struct in March this year, there was a rather depressing picture in terms of the impact of the destruction. PYD provided a strong framework with which reconstruction was possible and fell within the time for the school opening” Palmer Simango, Chairperson of the SDC Committee at Rimbi Primary School applauded the role of PYD. “The support that we received confirmed that PYD is indeed socially embedded in our local community.”

It becomes imperative that for social development to be realized in rural communities, quality school infrastructure has to be constructed. The quality infrastructure improves student outcome and reduces school dropouts. This augurs well with the 2030 agenda for sustainable development goal no. 4. Thus, the reconstruction of the ECD block at Rimbi Primary School was done with main objective of improving every child’s well-being.

Mangudya Introduces More Bond Notes Taking The Tally Of The Unpopular Currency To $450m

Own Correspondent|Financial news site and watchdog Financial Express reports that the Reserve Bank of Zimbabwe (RBZ) has introduced a new lot of Bond Notes to cater for tobacco growers.

According to the report Dr Mangudya introduced $12m new notes to cater for the demands of the farmers.

The amount takes the total value of Bond Notes in circulation in the country to $450m.

Mangudya has previously said that the central bank continues to exercise restraint on the release of cash into the market to curb inflation.

Bond coins and bond notes in circulation in the economy account for around 5% of money supply.

“But following the start of the tobacco marketing season, new notes were injected to enable growers to withdraw cash.”

Speaking on inflation, Mangudya said the central bank is targeting inflation to end the year at 15% with deceleration expected to start around October.

Losing Bulawayo Mayoral Candidates Condemned For Revolting Against Chamisa

The newly-elected MDC Bulawayo provincial executive has lashed out at losing candidates who have appealed against the results, claiming the action was tantamount to an insurrection against party leader Nelson Chamisa.

MDC Bulawayo members, who comprise legislator Phelela Masuku and 11 others, appealed to the party’s national executive council (NEC) challenging the elections in the province, claiming the process was flawed.

Yesterday, the newly-elected Bulawayo executive came out guns blazing, describing the losers as trying to discredit Chamisa.

Provincial spokesperson Swithern Chirowodza said: “From the look of things, it comes across more as an insurrection against MDC president Nelson Chamisa than an appeal against alleged electoral irregularities.

“The appellants are bent on disfiguring president Chamisa’s image by falsely portraying him as one who presided over the April 17 MDC Bulawayo provincial congress.”

The MDC Bulawayo members’ appeal came at a time when Chamisa has already been nominated, uncontested, as the party’s president by all the 13 provinces and now waits to be confirmed by the national congress to be held in Gweru from May 24 to 26.

Southern Eye understands that an MDC special committee has been put in place to deliberate on issues raised by some members to the NEC.

In the provincial elections, James Sithole beat Masuku with 509 votes to 307; Felix Mhaka won the deputy chair position; while Earnest Rafamoyo won the provincial secretary position and is deputised by Walter Taranhike.

The new provincial organiser is Helen Zviviri, deputised by Colet Ndlovu. Chirowodza won the spokesperson position, and is deputised by Gladys Mathe and the treasurer became Sonny Phiri, deputised by Grace Mathe.

Meanwhile, MDC Midlands’ women assembly members, who petitioned the party’s national organising department seeking to reverse the election process for the provincial wing held on April 10 in Gweru, have withdrawn their challenge and thrown their weight behind the winners.

MDC Hopes Economic Collapse Will Aid Their Victory In Mutasa By-Election

PRESIDENT Emmerson Mnangagwa’s continuous failure to solve the country’s economy will hand the MDC-Alliance an electoral victory in the Mutasa Rural District Council ward 10 by-election slated for tomorrow, the opposition candidate said.

Rosemary Mukodza, who is representing the MDC in the by-election made the remarks on Wednesday at Masere Business Centre in Mutasa Central constituency where she was addressing scores of party supporters.

She will battle it out with Magret Tindika from the ruling party and Justine Chirimo from the Lovemore Madhuku-led National Constitutional Assembly.

Mukodza said she has been doing door-to-door campaigns prior to the rally that was graced by party vice-president Morgan Komichi, national organiser Amos Chibaya, Mutasa Central MP Trevor Saruwaka, Mutasa South MP Regai Tsunga, among others.

“I want to thank leaders of my party for coming to show support. I am very humbled by your gesture, we have been doing door-to-door campaigns urging voters to go and vote early in the morning and secure our victory,” Mukodza said.

“I don’t think the Zanu PF candidate has a chance to win because her leader has already failed. Do you think the Zanu PF candidate can stand any chance in this ward election when her leader (Mnangagwa) has failed? Mnangagwa’s failure to run the country will work in our favour.”

She added: “We are not going to sleep on Saturday because we are very aware that this party is capable of rigging this election. Zanu PF has the mechanism to do that.”

Saruwaka said the ward was a MDC-Alliance stronghold and the party will retain the seat that fell vacant after the conviction and later imprisonment of councillor Frank Chitembwe of the MDC over the violent January fuel price hike protests.

“This is our stronghold and we are very confident that we are going to win the ward at all cost,” he said.

MDC has a history of not faring well to Zanu PF in by-elections and has lost several seats to the ruling party during by-elections.

Last month, the opposition was stunned by the ruling party when Kidwell Mujuru (Zanu PF) won the Cowdry Park council seat in Bulawayo urban, the opposition’s strong hold. The MDC had fielded two candidates for the election characterised by voter apathy.

Chipinge Villagers Face Eviction

By Platform for Youth Development| On 29 April 2019 villagers in Munyokowere were served with eviction notices by the Ministry of Lands, Agriculture, Water, Climate and Rural Resettlement. The eviction notices gave at least 750 villagers seven days to vacate the land they have been occupying since the early 1990s.

PYD, a community based organization is dismayed by the government’s penchant to use institutionalized intimidation in an environment where the communities might have little bargaining power to contest the evictions, as they often lack formal documentation of their customary land rights and access to justice.

In the process, PYD engaged the Zimbabwe Lawyers for Human Rights (ZLHR) on behalf of the villagers. The ZLHR wrote to the Ministry of Lands, Agriculture, Water, Climate and Rural Settlement.

That some of our clients have been in occupation for a long period as such have built their livelihood, they have built their houses and they have minor children who cannot soldier the harsh winter.” Reads part of the letter to the government. They went on to state that “The state despite demand of request for offer letters has either failed or neglected to provide them with security of tenure.” The letter continued.

The eviction notices are deemed to be necessitated by a 2018 Cabinet resolution on illegal settlers. The cabinet resolved that all people found in farms without any offer letter, permit, lease or title deed are committing a crime in terms of the Lands Consequential Provisions Act Chapter 20:28.

The cabinet resolution is admittance that there is rampant corruption in the land governance system and that the evictions are not structured but just a moment to punish some communities that did not vote for Zanu PF in the 2018 plebiscite.” Claris Madhuku, PYD Director said.

He went on to state the role of his organisation in the matter. “PYD is at the community level to protect the vulnerable members of our community who are exposed to political vindication and manipulation. Again, we applaud the organizational value of ZLHR in its response to our human rights violation alert.”

Administration of the Lands Consequential Provisions Act Chapter 20:28 neglected the land rights of resettled villagers

The Munyokowere villagers case dates back to the colonial era. In the 1950s, they were forcibly evicted by the colonial government to pave way for the commercialization of Middle Sabi.

They were resettled back in the area in the early 1990s. The first batch of resettled villagers amounted to 39 families and the number has since grown to 750 families. The then Chipinge District Administrator (DA) Mufukera formalized the villagers’ settlement. This move by the local authority heightened villagers’ perceptions and expectation regarding the right to the land.

The manner and timing of the notice of eviction is likely to impact negatively on the villagers’ food security and livelihoods. The absence of formal offer letters, permit, lease or title deed in the area clearly proved a glaring weak land governance system in Zimbabwe.

This seriously impair the land use rights of local people as they are not properly reflected in our domestic legal system. Weak land governance systems can thus negatively affect local populations and their food security since they will be open to political manipulation as being witnessed in Munyokowere village.

This case from a face value can obscure important but masked socio – economic and political issues. The political culture in Zimbabwe has created social inequities in rural communities and they are seemingly allowed to persist, and in the process violate the notion of social justice within the local context.

What they have done to the villagers is unjust and smacks of arbitrary authority from our government. The government must ensure that customary land rights are protected and leveraged against manipulation.  is the same institution that is exposing vulnerable communities.”

Allan Murozvi said. Allan Murozvi is a community activist working with the Platform for Youth Development Trust (PYD).

The villagers claim to the land evolve through the principle of kinship that was recognized by local government authorities including the then Local Government Deputy Minister Morris Sakabuya.

Distortions around customary ownership of land is the bedrock of the villagers” dilemma. The eviction notices enunciated by the government make it clear that the presence of the villagers in Munyokowere since the early 1990s was a result of political patronage.

The false sense of security that the local political and administrative leadership provided to the Munyokowere villagers became an instrument for regulating access to communal land, and also determined the granting of rights. This was done in the narrative of procuring and maintaining political support in the Middle Sabi.

The government has to understand and interpret their laws in the context that the control of land is vested in an ancestry group and access is determined by social identity. This particular defines our social identity as a people and we cannot be denied that identity.”

Headman Munyokowere is quoted as saying. He is one of the 750 villagers served with a notice to vacate the land. Headman Munyokowere bemoaned the fact that the government since the period of their resettlement failed to ensure that customary land rights are protected.

TWO Zimbabwean football referees have been accused of accepting bribes when they officiated in an Under-23 African Cup of Nations qualifier between a Central and North African country in March this year.

One of the referees has since been suspended by the ZIFA Referees’ Committee for alleged insubordination after he refused to respond to the allegations.

He had been challenged by the committee headed by Bryton Malandule to write a report over the damaging allegations.

According to sources, the particular match, which was eventually won by the North African country, featured four Zimbabwean match officials.

Two were from Harare, one from Matabeleland South and the other from Bulawayo.

“No-one one has been suspended, it’s just speculation,” said Malandule yesterday. Sources said the referee had been suspended and CAF have already been appraised of the developments.

“He will not be officiating any local games in the foreseeable future as investigations are underway,’’ the sources said.

“The other one, who was also targeted, is said to have given his side of the story, but we don’t know what exactly he told the committee.’’

State Media|POLICE in Matabeleland North have arrested 53 Hwange villagers after they allegedly looted an assortment of groceries from a truck that was involved in an accident near St Mary’s on Wednesday night.

Matabeleland North provincial police spokesperson Chief Inspector Siphiwe Makonese confirmed the arrest of 40 women and 13 men from Lukosi area under Chief Nekatambe.

She said the suspects, whose details will be availed after investigations, were being held at the Hwange Police Station yesterday.

“I can confirm that a total of 53 people from Lukosi were arrested and are being charged with theft after they allegedly stole some groceries from a truck that was involved in an accident,” said Chief Insp Makonese.

She said police raided some homesteads following a report about the looting leading to recovery of the groceries that included mealie-meal, rice, snacks, biscuits, salt and cooking oil.

Chief Insp Makonese said the truck which was headed for Hwange, overturned at around 2AM on Wednesday, scattering an assortment of goods on the road.

Instead of helping the driver Mr Emmanuel Kontinyu who fractured an ankle in the accident, villagers allegedly looted the goods and went to their homesteads.

“On May 8 at around 2AM, a road accident occurred at the 320km peg along the Bulawayo-Victoria Falls road. On approaching the area, the driver Emmanuel Kontinyu of Number 4149 Shato Crescent in Budiriro, Harare who was driving a freight liner loaded with bags of mealie-meal, snacks, salt, rice, biscuits and cooking oil lost control of the truck which then veered off the road and fell on its left side,” said Chief Insp Makonese.

She said the driver is admitted to Hwange Colliery Hospital.

Police attended the scene after a report was made and found out that some of the goods had already been looted.

State Media was told that two cops who had been deployed to attend to the accident scene were overwhelmed by the number of villagers who looted the truck.

In the morning on Wednesday a team was sent to search all nearby homesteads from which 1 059x10kg and 252x5kg bags of mealie-meal, 51x10kg packets of salt, 58x5kg rice, 33x2kg packets of biscuits, and 800×210 packs of snacks were recovered.

The search continues for other goods and the value for the recovered items is yet to be ascertained. The suspects are expected to appear in court soon facing theft charges.

Mwonzora Responds To Allegation That He’s Secretly Behind High Court Verdict “Removing” Chamisa

Below was the full discourse with the man who this week was accused of conniving with the judiciary so to crush his enemy of many years, Nelson Chamisa through Wednesday’s high court verdict.

Simba Chikanza (SC) spoke with Advocate Douglas Mwonzora.

SC: Good afternoon honourable Mwonzora. Can you hear me sir? Simba Chikanza here.
Are you happy? Excited?

Mwonzora: Yes.

SC: …with the court verdict Sir? I have been trying to hear (from you), are you in acceptance with the court verdict; are you one of those who are calling for an appeal against it?

Mwonzora: I am not commenting on the High Court verdict Simba. I am sure the spokesperson of the party made a statement on behalf of the party.

SC: Ok so you stand by that statement of the spokesperson?

Mwonzora: I have spoken to you already I have already spoken to you Sir. I have already answered.

SC: But sir, Thokozani Khupe claimed that she was going to be working with you.

Mwonzora: I am sorry I am sorry my friend, I think you should forewarn me if you want to interview me.

SC: Oh I apologise, I thought that I had done that; I had notified your aide when you were in Parliament?

Mwonzora: I did not know.

SC : Would you like us to start right now?

Mwonzora: You know what Simba, I am sorry. I am sorry I may sound rude to you; it is not my nature but I do not want to comment about it.

SC: Thank you sir. I had to ask you because your name is in print. Thokozani Khupe has already has made ownership…

Mwonzora: What are the specific allegations against me maybe I can throw it off?

SC: The allegation against you is that you are behind the High Court defeat of Nelson Chamisa yesterday and also that you are working with Khupe and she has communicated in a statement that you are working with her, this morning.

Mwonzora: Well, you must understand that the High Court application was filed last year in September and in that High Court application I am the 5th Respondent, in other words I am being sued as well and the judgement was against me as well; how can I be behind it and for what reason? This is just a smear campaign by my opponents in the party they always want to find something to blame me when things go wrong. There is a court case the party has lost the court case my own opinion I did communicate my opinion to the leaders of the party on how we could have averted that disaster; but to say that I have anything to do with it it is simply a smear campaign Simba; I have nothing to do with it.
Regarding now what Thokozani Khupe said in her statement, I saw it today; the statement says that she will communicate with the Secretary-General of the party. What it means is right now as we speak there is a court judgement, and in terms of that court judgement there is a certain status which is there until that verdict has been varied; until the court verdict has been overturned, then the status quo as per judgement, so I don’t see anything sinister about that; so she has not communicated with me and unfortunately she has issued a statement but I have not received any formal communication with her.

People lose court cases, they don’t lose court cases because there is Douglas Mwonzora there. This is not the first time that we have lost a court case. We lost the election petition it was not my fault; now that there is a high court case yesterday, how is that my fault?

SC: And, lastly thank you for that. Your having been mentioned by her in her statement, are you not going to respond against it because she has stated… are you not disturbed that she has rushed to mention you?

Mwonzora: Certainly not, I see nothing wrong with that. I see nothing really wrong there because she says that she is going to get in touch with the Secretary General of the party. I am the Secretary General of the party it is when she gets in touch with me that I will appropriately respond to her, remember this is a statement in public I don’t have to respond to it. I will respond to the specific communication that she talks about me in her statement. That is the civilized thing to do in my view. So I am waiting for her communication, and I will respond to it accordingly. But for me to trade conversations with her through the press will not be proper. She simply was not directing this to me, she was directing to the public to inform them that I am the secretary-general of the party when she does that I will speak to her I want to put it up that i do not view her as an enemy, I do not view her as a person that I do not talk to and converse with. So I will talk to her and will hear what she has to say and I will respond.

SC: Are you not concerned Sir. I am sorry that I am repeating it but this is the other bit now which is how other legal experts have interpreted that judgement that it has numerous failures, misdirections that have led to it being seen as a defective judgement?

Mwonzora: Sorry, Simba.

SC: Other legal experts say that the verdict which she is celebrating is a defective judgement, there are numerous misdirections over 12 misdirections and would that not give some sort of position or preposition to you not to even imagine communicating with her?

Mwonzora: I am a legal expert as well. And I see nothing wrong with talking to a person who has said she wants to talk to me in my official capacity as the secretary-general I am not going to close that door, it is not a civilized thing to do and it does not make political sense to me. Now, I have seen a lot of commentaries on the judgement, I agree with some I do not agree with some and so on. And I have looked at the judgement myself, I have my opinion and I have communicated my opinion to the leadership.

SC: In private you communicated all that in private and did not make it public?

Mwonzora: Yes I communicated in private just like I did last year before this matter was even lodged in court;you may want to know that I did convene a meeting involving Dr Khupe, Advocate Chamisa, and Elias Mudzuri, I did commit I did convene a meeting with them in my capacity with the Secretary General and legal advisor and I did give them what I thought was the legal opinion, was the legal position of the party, whether they took or did not take it is another matter; and I also in my capacity as the secretary-general I then advised that they should seek external legal counsel, and get an external legal opinion on the issue; we got that legal opinion, whether they followed it or not is another issue, but the thing is I did what I could in my capacity as Secretary General. Now there will be a lot of comment on a judgement. Some of the comments are political some of them are legal now this in my view when you look at that judgement you will have to look at it from a legal point of view does it make legal sense what are those things that the judge is talking about do they make legal sense? So the fact that a lot of people have commented I saw one comment by a respected academic which showed me that he did not read the judgement. Errm he was rambling and so on I did not expect that from an academic of his calibre he is a person that I respect, and I have privately conversed with him that he should first read things before he comments.

SC: So in essence, you are seeing that this judgement is strong;it is sound basically?

Mwonzora: Well, I have opinion on this judgement that I don’t want to communicate right now to the public I have communicated opinion to my leaders now I won’t tell the leaders what they want to hear; I will tell the leaders the legal position and the legal opinion; that is what I am there for. That is what I am elected to do; I am not defending anything;I am not attacking anything but I think that the analysis of the judgement so far done is poor.

SC: You mean that the analysis that is criticizing the judgement so far is poor?

Mwonzora: The analysis that has been done, it does not criticise the judgement only. Now, what people have been commenting on the judgement… for and against has convinced me in some instances that they did not apply their minds to it; and I am urging all our legal experts to read the judgement first so they can give sound Advice. Now we are unable to get sound Advice from what has been written so far, because it has been done in a poor way.

SC: would you say here that the threat for instance to seize property by Obert Gutu is normal, because he has already announced that MDC property is going to be transferred to Khupe. You as the Secretary General would you stand in opposition against that?

Mwonzora: Exactly Simba this is my point; it shows that Mr Gutu did not read the judgement; the judgement did not say transfer property it does not talk about property at all. There is no way in the judgement where there is the issue of property or money is talking about this is an extension of the judgement it is not there in the judgement Simba if you look at it. So these are political statements this is political banter and it is not helpful what is important is what the judgement says. What the issue at stake is. What does the judge say, it does not make a judgement on property at all.

SC: So, lastly let me ask you there are accusations; I am sure you have seen allegations against your character… generally you being that very same person who is standing to gain because now quite frankly Nelson Chamisa has been your nemesis ever since 2014 the very same year to which this judgement extends, the roll back. How could you assure the public here, that you do not stand to gain from a loss in this case of Nelson Chamisa or a de legitimising of Nelson Chamisa [LONG PAUSE]. I think I have lost you there sir.

MDC Set To Appeal Against The “Brutum Fulmen” High Court Ruling

Zimbabwe’s main opposition the MDC plans to appeal against a ruling by the high court that its leader Nelson Chamisa illegitimately succeeded the late Morgan Tsvangirai.

Justice Edith Mushore made the ruling in a case brought before her by Elias Mashavire, the party’s Gokwe district organising secretary, who challenged Tsvangirai’s decision to appoint Chamisa and Elias Mudzuri as two of his three deputies.

In 2017 the same court dismissed an earlier lawsuit challenging Tsvangirai’s appointment of Chamisa and Mudzuri.

Justice Mushore, in her ruling on Wednesday, directed the party to hold an elective congress in a month’s time using MDC-T’s 2014 structures.

At the party’s 2014 elective congress Nelson Chamisa lost to outgoing secretary for information and publicity Douglas Mwonzora for the post of secretary general. Thokozani Khupe, who leads the current breakaway MDC, was elected vice president.

Chamisa along with Elias Mudzuri were appointed as deputies by Tsvangirai to join Khupe,  a move largely seen as a balancing act to contain Khupe’s growing support base. 

If the party uses the 2014 structures, as ruled by the high court, Chamisa will effectively not be up for the party’s leadership. The ruling falls in favour of Khupe who, after the death of Tsvangirai in 2018, failed to wrestle power from Chamisa leading her to contest the general elections as the breakaway MDC-T while Chamisa went with MDC Alliance.

Responding to the court decision, Chamisa’s spokesperson, Nkululeko Sibanda, said it did not affect them because they were not “MDC-T”.

“It is just the MDC, MDC T is not the legal name of the party for which Advocate Chamisa is president,” he said.

The MDC Alliance defines itself as “an electoral bloc formed between seven political parties.”

Senior MDC Alliance member David Coltart said they would appeal against the ruling and party business would go on uninterrupted.

“It will be appealed. This is what is called a brutum fulmen [empty thunder], an ineffective order. By the time the appeal is heard a duly constituted congress of the MDC will have been held and Chamisa elected,” he said.

The MDC Alliance will hold its elective congress between May 24 and 26 in Gweru, Zimbabwe’s third largest city. Chamisa will go into the congress uncontested after all of the party’s 13 provinces endorsed him to lead the party for the next five years.

Meanwhile, heading to congress, Chamisa said the alliance’s strategy for the next five years was to put pressure on Zanu-PF.

“If there is no political dialogue, we say this and we will say it again, we are going to resort to constitutional avenues and platforms around our rights to express ourselves until what we believe to be the legitimate request is acceded,” he said.

ANC In Trouble In Gauteng And KZN Provinces

ANA|The African National Congress (ANC) has a fight on its hands in the key provinces of Gauteng and KwaZulu-Natal where by late Thursday night it held a slim majority in each.

In Gauteng, South Africa’s economic heartland as well as its most populous province, the party had obtained just over one million votes, for 51% of the votes tallied.

The ANC was followed by its two main political rivals, the Democratic Alliance (DA) with 538 000 votes, or just under 27%, and the Economic Freedom Fighters (EFF) with 284 000 votes, or 14% of the vote.

In the 2014 elections the ANC had garnered 53.5% of the vote and faces another tough battle to keep its nose in front.

In KwaZulu-Natal, a traditional ANC stronghold, the ANC was polling at just under 54% of the votes tallied, with 756 000 votes. In the 2014 general elections, the ANC had won the province with 64.5% of the vote.

By Thursday night, the Inkatha Freedom Party (IFP) was putting in a strong showing and on track to overtake the DA and become the official opposition in the province, carrying 266 000 votes or almost 19%, while the DA had around 180 000 votes for 12%.

With the exception of the Western Cape, where the ANC is in opposition to the DA, the party was polling in the mid to upper 60 percent bracket in the remaining six provinces where it is expected to cruise to comfortable victories.

He said, “I am here today at the investing in Africa summit and it is a fantastic opportunity to talk about, the fact that the African population is one of the biggest drivers of the world economy. By 2051, 1 in 10 children will be born in the world will be born in Nigeria alone, by the end of this century perhaps 40% of the population of the world will be African, and the missing element here one of the missing elements is finance. And this is where Britain comes in.

“…Britain comes in, the city of London and Britain comes actually through the Department of International Development. So today I am absolutely delighted to announce a partnership with the Bank of England where we’re going to be working with regulators in African countries, to get the right structures for these economies.

It is wrong to try and compare me with Grace Mugabe.

“I am not a government employee. I have no powers over ministers, but I just help in my role as the First Lady to raise awareness on health issues. I also take care of their mothers and their supporters.”

“I don’t get any cent from Treasury for all the projects I do. There are many people who support us and not even a single cent comes from government. People should appreciate that through my humanitarian work, I assist people across the political divide. I don’t select whether Zanu PF or MDC.

Magaya Set To Lose His Waterfalls Property After Failing To Settle A $23m Debt.

State Media|PROPHETIC Healing and Deliverance (PHD) Ministries leader Walter Magaya and his wife, Tendai, have been taken to the High Court for failure to repay a US$23 million loan to Homelink Finance (Private) Limited.

Magaya and his wife bound themselves as surety and co-principal debtor to a loan extended to Yadah Connect (Private) Limited last year.

He risks losing his sprawling property in Waterfalls, Harare, which is used as a guest house.

Stand numbers 167 and 168 of Prospect, Harare, measuring a combined 7,9 hectares, were tendered as security for the loan and they become executable upon failure by the debtors to service the loan.

They also offered mining machinery, equipment and vehicles financed under the facility as security.

Homelink, through its lawyers, Shomwe-Nyakuedzwa Attorneys filed summons for provisional sentence against Mr and Mrs Magaya as well as Yadah Connect.

The company argues that the defendants breached the loan agreement, hence an order compelling them to pay should be issued.

Homelink, according to the papers filed at court, extended a facility of US$23 338 745 to Yadah Connect in 2018.

The parties agreed that the loan would be repaid in 33 monthly instalments of US$784 873,62 inclusive of interest, with effect from December 31 last year.

Repayment, according to the papers, was to be paid in US dollars.

Interest on the loan facility, according to the agreement, should be charged at the aggregate rate of 7,5 percent per annum but subject to change in line with the prevailing market conditions.

Magaya is yet to respond to the civil claim.

Mwonzora: What are the specific allegations against me maybe I can throw it off?

SC: The allegation against you is that you are behind the High Court defeat of Nelson Chamisa yesterday and also that you are working with Khupe and she has communicated in a statement that you are working with her, this morning.

Mwonzora: Well, you must understand that the High Court application was filed last year in September and in that High Court application I am the 5th Respondent, in other words I am being sued as well and the judgement was against me as well; how can I be behind it and for what reason? This is just a smear campaign by my opponents in the party they always want to find something to blame me when things go wrong. There is a court case the party has lost the court case my own opinion I did communicate my opinion to the leaders of the party on how we could have averted that disaster; but to say that I have anything to do with it it is simply a smear campaign Simba; I have nothing to do with it.
Regarding now what Thokozani Khupe said in her statement, I saw it today; the statement says that she will communicate with the Secretary-General of the party. What it means is right now as we speak there is a court judgement, and in terms of that court judgement there is a certain status which is there until that verdict has been varied; until the court verdict has been overturned, then the status quo as per judgement, so I don’t see anything sinister about that; so she has not communicated with me and unfortunately she has issued a statement but I have not received any formal communication with her.

People lose court cases, they don’t lose court cases because there is Douglas Mwonzora there. This is not the first time that we have lost a court case. We lost the election petition it was not my fault; now that there is a high court case yesterday, how is that my fault?

SC: And, lastly thank you for that. Your having been mentioned by her in her statement, are you not going to respond against it because she has stated… are you not disturbed that she has rushed to mention you?

Mwonzora: Certainly not, I see nothing wrong with that. I see nothing really wrong there because she says that she is going to get in touch with the Secretary General of the party. I am the Secretary General of the party it is when she gets in touch with me that I will appropriately respond to her, remember this is a statement in public I don’t have to respond to it. I will respond to the specific communication that she talks about me in her statement. That is the civilized thing to do in my view. So I am waiting for her communication, and I will respond to it accordingly. But for me to trade conversations with her through the press will not be proper. She simply was not directing this to me, she was directing to the public to inform them that I am the secretary-general of the party when she does that I will speak to her I want to put it up that i do not view her as an enemy, I do not view her as a person that I do not talk to and converse with. So I will talk to her and will hear what she has to say and I will respond.

SC: Are you not concerned Sir. I am sorry that I am repeating it but this is the other bit now which is how other legal experts have interpreted that judgement that it has numerous failures, misdirections that have led to it being seen as a defective judgement?

Mwonzora: Sorry, Simba.

SC: Other legal experts say that the verdict which she is celebrating is a defective judgement, there are numerous misdirections over 12 misdirections and would that not give some sort of position or preposition to you not to even imagine communicating with her?

Mwonzora: I am a legal expert as well. And I see nothing wrong with talking to a person who has said she wants to talk to me in my official capacity as the secretary-general I am not going to close that door, it is not a civilized thing to do and it does not make political sense to me. Now, I have seen a lot of commentaries on the judgement, I agree with some I do not agree with some and so on. And I have looked at the judgement myself, I have my opinion and I have communicated my opinion to the leadership.

SC: In private you communicated all that in private and did not make it public?

Mwonzora: Yes I communicated in private just like I did last year before this matter was even lodged in court;you may want to know that I did convene a meeting involving Dr Khupe, Advocate Chamisa, and Elias Mudzuri, I did commit I did convene a meeting with them in my capacity with the Secretary General and legal advisor and I did give them what I thought was the legal opinion, was the legal position of the party, whether they took or did not take it is another matter; and I also in my capacity as the secretary-general I then advised that they should seek external legal counsel, and get an external legal opinion on the issue; we got that legal opinion, whether they followed it or not is another issue, but the thing is I did what I could in my capacity as Secretary General. Now there will be a lot of comment on a judgement. Some of the comments are political some of them are legal now this in my view when you look at that judgement you will have to look at it from a legal point of view does it make legal sense what are those things that the judge is talking about do they make legal sense? So the fact that a lot of people have commented I saw one comment by a respected academic which showed me that he did not read the judgement. Errm he was rambling and so on I did not expect that from an academic of his calibre he is a person that I respect, and I have privately conversed with him that he should first read things before he comments.

SC: So in essence, you are seeing that this judgement is strong;it is sound basically?

Mwonzora: Well, I have opinion on this judgement that I don’t want to communicate right now to the public I have communicated opinion to my leaders now I won’t tell the leaders what they want to hear; I will tell the leaders the legal position and the legal opinion; that is what I am there for. That is what I am elected to do; I am not defending anything;I am not attacking anything but I think that the analysis of the judgement so far done is poor.

SC: You mean that the analysis that is criticizing the judgement so far is poor?

Mwonzora: The analysis that has been done, it does not criticise the judgement only. Now, what people have been commenting on the judgement… for and against has convinced me in some instances that they did not apply their minds to it; and I am urging all our legal experts to read the judgement first so they can give sound Advice. Now we are unable to get sound Advice from what has been written so far, because it has been done in a poor way.

SC: would you say here that the threat for instance to seize property by Obert Gutu is normal, because he has already announced that MDC property is going to be transferred to Khupe. You as the Secretary General would you stand in opposition against that?

Mwonzora: Exactly Simba this is my point; it shows that Mr Gutu did not read the judgement; the judgement did not say transfer property it does not talk about property at all. There is no way in the judgement where there is the issue of property or money is talking about this is an extension of the judgement it is not there in the judgement Simba if you look at it. So these are political statements this is political banter and it is not helpful what is important is what the judgement says. What the issue at stake is. What does the judge say, it does not make a judgement on property at all.

SC: So, lastly let me ask you there are accusations; I am sure you have seen allegations against your character… generally you being that very same person who is standing to gain because now quite frankly Nelson Chamisa has been your nemesis ever since 2014 the very same year to which this judgement extends, the roll back. How could you assure the public here, that you do not stand to gain from a loss in this case of Nelson Chamisa or a de legitimising of Nelson Chamisa [LONG PAUSE]. I think I have lost you there sir.

Teenager Drinks To Death At Vuzu Party In Byo

State Media|A FORM four pupil allegedly drank himself to death in a suspected Vuzu party binge in Nkulumane suburb.

Brandon Zimba (18) of Nkulumane suburb died on Saturday night at a party in the company of his friends and cousin at a house in the same suburb.

He was staying with his grandfather following the death of his father years ago and his mother works in South Africa.

The mother, Ms Sithembiso Zimba said she was devastated by her son’s death.

She said his behaviour completely changed when he moved to a new school and she suspects it was as a result of influence from bad friends.

“Never at any point in my life did I ever imagine that my child would drink himself to death. Growing up, he was obedient and brilliant in school. He started school in South Africa and came home for his secondary. I took him to Sizane High School and his school performance was very pleasing.

“The school, however, hiked fees and I was forced to transfer him. I regret that move because it has led to the death of my son. At the new school, I started receiving reports that he had started drinking. The elders who stayed with him would sit him down and each time he apologised and promised to change,” said Ms Zimba.

She decried the growing culture of juvenile delinquency and said she believed her child’s demise was a result of bad friends.

“This society and this new culture of today will ‘finish’ our children and something needs to be done to stop it. We don’t know what transpires at these Vuzu parties, perhaps they abuse all sorts of drugs besides alcohol. Those that were with him should have called for help when Brandon passed out but unfortunately they decided to watch him die. I am asking myself why him?” she said.

Ms Zimba said she now regretted her decision to work in South Africa to fend for the family.

“I keep asking myself if the situation would have been different had I stayed home and taken care of my children. But I am living in South Africa to work and fend for my children. I did all I could for him as a single parent. I am doing all I can even for his younger siblings, his sister aged 14 and his younger brother aged six,” she said.

Bulawayo police spokesperson Inspector Abednico Ncube confirmed the death.

“I can confirm that we are dealing with a case of sudden death and investigations are underway.

Brandon’s grandfather, who only identified himself as Mr Ndebele and was Brandon’s guardian said he was shocked by the boy’s death.

“I knew him to be a quiet fellow but there is a saying that still waters run deep. I cannot express my devastation and I cannot even imagine what his mother must be feeling following his death. He was the eldest and his father died some years ago.

“There is a sick culture that is slowly engulfing the youths and it is time communities took a stand. We have been reading about these strange parties and happenings but I never thought that one of these things done by youths could lead to the death of my grandson,” said Mr Ndebele.

Brandon will be laid to rest today at Athlone Cemetery after a funeral service at Kings and Queens’ funeral parlour at 8AM.

Police have been raiding Vuzu parties where youths abuse alcohol and drugs and also engage in sex but it is proving difficult to ban these parties completely.

Minister Boasts That Zimbabwe Has Diesel To Last For 23 Days

We also have the pipeline in Beira pumping fuel into the country. Therefore, what we are facing are not challenges of fuel in the country.”

*HON. CHIKWINYA: Thank you Mr. Speaker. My question is directed to the Minister of Energy and Power Development, Hon.  Gumbo and I believe he is in the House today. However, before I pose my question, allow me together with this august House to recognise and congratulate Hon. Kirsty Coventry for giving birth to a baby on Friday. It is not a new issue that people give birth but I have never seen a pregnant Minister before, that is why I have seen it as pertinent to congratulate her. I have also been continuously seeing her duties until she gave birth. I also hope that Hon. Nzenza by the end of the year would have addressed that issue as well.

My question to the Minister of Energy is that since January, we have been experiencing unending long fuel queues. Therefore, I am requesting that the Hon. Minister explains to the House Government’s measures and when these long unwinding fuel queues will come to an end.

THE MINISTER OF ENERGY AND POWER
DEVELOPMENT (HON. DR. GUMBO): Thank you Mr. Speaker. I  would like to thank Hon. Chikwinya for the question he raised. Although it is not in relation to policy, in which policy says that people should be able to access fuel. What he has requested is that he wants to understand what the Government is doing to ensure that we have fuel that is accessible. I think that on that matter, I would have required a Ministerial Statement but despite that, let me say that the Ministry of Energy and Power Development’s main mandate is to engage companies outside the country that produce oil so that it can be brought into the country. Once the oil is within the country, there would be need of foreign currency that should be used by companies such as Total, Zuva and Engen to go and then buy that oil because they would have been brought into the country in RTGS$. So, that is the duty of Ministry of Finance and Economic Development; it has nothing to do with my Ministry but it is my hope once the economic situation improves, the foreign currency will be available – [HON. SIKHALA: Inaudible interjections.] –

THE HON. SPEAKER: Order, Hon. Sikhala! If you have got an issue, why not wait for a supplementary question.

HON. SIKHALA: Understood Mr. Speaker Sir. I think the  Minister is diverting the question from the Hon. Member. The Hon. Member is talking about mitigating the situation of today and he is saying what he hopes, we do not want to hear about that but how to mitigate these measures today.

Chikwinya is important and is a good question but it a question that has been raised since January. If he had requested me to explain what is happening today, I would have explained that. I had to give the historical background because he mentioned the period from January. If I understood Shona so well, he said, since January, we have been witnessing long winding queues which are still there and his question was, when will this come to an end. I gave a back ground that all of us as Hon. Members should know what
is happening because any one of us can become a Minister tomorrow and they should know the mandate of my Ministry in terms of fuel and oil. I said our mandate is to procure oil and fuel from outside the country. Once it comes into the country, forex which is needed by oil companies to access the fuel that will be stored in the bond warehouse for it to be available in filling stations, that is what I do. Concerning what Hon. Chikwinya, assisted by Hon. Sikhala have said why we are still seeing winding queues today – before I came into the august House Mr. Speaker, I talked to the Reserve Bank Governor. He informed me that he had released funds and the five big companies in the country such as ZUVA, Engen and Sakhunda which is Puma have started procuring oils. The ACs have begun transporting fuel to service stations. We are hoping that by the end of the day, tomorrow and the following days, fuel will be available in the country. I thank you.
*HON. MAUSWA: My supplementary question is that the Hon. Minister has said his Ministry is responsible for securing oil from other countries, how much fuel do we have currently which his Ministry has managed to secure for Zimbabwe?
*HON. DR. GUMBO: I thank the Hon. Member for the question. We have a month’s supply of petrol in the country. We have about two million in Mabvuku and Msasa. We have diesel in bond warehouse that can last for 23 days. We also have the pipeline in Beira pumping fuel into the country. Therefore, what we are facing are not challenges of fuel in the country but the shortage of foreign currency that is affecting the fuel situation to enable service stations to continue getting forex from the RBZ in order to feed the service stations. I thank you.

HON. P. D. SIBANDA: In his response, the Hon. Minister indicated that his Ministry simply deals with importing fuel that will be under bond warehouse. My supplementary question is, which department is responsible for purchasing of ethanol which is compulsorily or mandatorily blended in our fuel in this country? What is the mischief of mandatorily blending ethanol which you are buying from a private player, imposing it upon the whole nation? Thank you Mr. Speaker.
THE HON. SPEAKER: That is a very good question Hon. Member but it does not arise – [HON. P. D. SIBANDA: Inaudible interjection.] – I have ruled. You can ask that question.

HON. GONESE: In his response, the Hon. Minister indicated that the crux of the problem emanates from our lack of foreign currency and I will beg your indulgence to redirect that supplementary question to the Leader of Government Business to clarify for us and to the nation. We have had this perennial problem for quite a long time. What is Government policy to holistically deal with the issue in sustainable way so that we do not continuously have these intermittent shortages and problems which are recurring from time to time?

THE HON. SPEAKER: I am afraid again, that is not a supplementary question. It is a totally comprehensive new question altogether.

Own Correspondent|MDC Secretary General Douglas Mwonzora has blasted excited MDC-T Deputy President Obert Gutu over claims that his party is readying to take over all MDC properties and recall members of parliament in the wake of the controversial High Court ruling issued on Wednesday.

Mwonzora, who like Gutu, is also a legal practitioner accused the MDC-T leader of rushing to speak on the court judgement without reading through it.

Speaking in a breaking interview with Simba Chikanza of ZimEye.com on Thursday, Mwonzora rubbished claims by Gutu that the Thokozani Khupe led splinter was accorded rights to the MDC property through the judgement.

“Mr Gutu did not read the judgement; the judgement did not say transfer property it does not talk about property at all. There is no way in the judgement where there is the issue of property or money is talking about this is an extension of the judgement it is not there in the judgement Simba if you look at it. Man Faints As Magistrate Reads Judgement

A father who was jointly charged with his son, for assaulting a man who was fixing their car, fainted before a Kwekwe Magistrate.

Portipha Musiiwa (49) collapsed after magistrate Mr Storey Rushambwa started reading out the judgment.

Musiiwa was on trial with his son, Talent.

The magistrate ended up putting proceedings on hold to allow for Musiiwa to be attended to and after an hour, court proceeding continued.

But it emerged Musiiwa would not be jailed as him and his son were sentenced to 3 months in prison each, which was wholly suspended.

The jail term was suspended on condition they do not commit a similar offence within the next four years.

The court ruled the duo teamed up against Mr Ndiwoneyi who they accused of taking too much time to repair their damaged vehicle. Musiiwa allegedly hit the complainant once on the back of the head, shoulder and right hand with an iron bar.

The son is alleged to have kicked Ndiwoneyi on the nose causing him to bleed. Ndiwoneyi was later taken to Kwekwe Provincial Hospital where he was treated and discharged.- state media

Muchinguri Tells Diasporans Zimbabwe Will Be A Middle Income Economy in 2030

The state owned Herald has quoted Defence Minister Oppah Muchinguri speaking to Zim diasporans in China at a meeting attended by Zimbabwe’s envoy to China, Ambassador Paul Chikawa and embassy staff.

Muchinguri said, “the ball is in your court to do the right thing. China has advanced tremendously and has the latest technology. China is our friend which is going to play an important role in our development. It is up to you the young people who need to emulate what China has done and bring such projects back home.

“If you do that we will be able to take our country forward in line with the President’s vision to achieve a middle income economy by 2030.”

Speaking at the same meeting, Zanu-PF national political commissar Cde Engelbert Rugeje explained the road that the party has travelled since the 2018 election, adding Zanu PF had dubbed 2019 “the year of strengthening the party.

Mwonzora: Yes.

SC: …with the court verdict Sir? I have been trying to hear (from you), are you in acceptance with the court verdict; are you one of those who are calling for an appeal against it?

Mwonzora: I am not commenting on the High Court verdict Simba. I am sure the spokesperson of the party made a statement on behalf of the party.

SC: Ok so you stand by that statement of the spokesperson?

Mwonzora: I have spoken to you already I have already spoken to you Sir. I have already answered.

SC: But sir, Thokozani Khupe claimed that she was going to be working with you.

Mwonzora: I am sorry I am sorry my friend, I think you should forewarn me if you want to interview me.

SC: Oh I apologise, I thought that I had done that; I had notified your aide when you were in Parliament?

Mwonzora: I did not know.

SC : Would you like us to start right now?

Mwonzora: You know what Simba, I am sorry. I am sorry I may sound rude to you; it is not my nature but I do not want to comment about it.

SC: Thank you sir. I had to ask you because your name is in print. Thokozani Khupe has already has made ownership…

Mwonzora: What are the specific allegations against me maybe I can throw it off?

SC: The allegation against you is that you are behind the High Court defeat of Nelson Chamisa yesterday and also that you are working with Khupe and she has communicated in a statement that you are working with her, this morning.

Mwonzora: Well, you must understand that the High Court application was filed last year in September and in that High Court application I am the 5th Respondent, in other words I am being sued as well and the judgement was against me as well; how can I be behind it and for what reason? This is just a smear campaign by my opponents in the party they always want to find something to blame me when things go wrong. There is a court case the party has lost the court case my own opinion I did communicate my opinion to the leaders of the party on how we could have averted that disaster; but to say that I have anything to do with it it is simply a smear campaign Simba; I have nothing to do with it.
Regarding now what Thokozani Khupe said in her statement, I saw it today; the statement says that she will communicate with the Secretary-General of the party. What it means is right now as we speak there is a court judgement, and in terms of that court judgement there is a certain status which is there until that verdict has been varied; until the court verdict has been overturned, then the status quo as per judgement, so I don’t see anything sinister about that; so she has not communicated with me and unfortunately she has issued a statement but I have not received any formal communication with her.

People lose court cases, they don’t lose court cases because there is Douglas Mwonzora there. This is not the first time that we have lost a court case. We lost the election petition it was not my fault; now that there is a high court case yesterday, how is that my fault?

SC: And, lastly thank you for that. Your having been mentioned by her in her statement, are you not going to respond against it because she has stated… are you not disturbed that she has rushed to mention you?

Mwonzora: Certainly not, I see nothing wrong with that. I see nothing really wrong there because she says that she is going to get in touch with the Secretary General of the party. I am the Secretary General of the party it is when she gets in touch with me that I will appropriately respond to her, remember this is a statement in public I don’t have to respond to it. I will respond to the specific communication that she talks about me in her statement. That is the civilized thing to do in my view. So I am waiting for her communication, and I will respond to it accordingly. But for me to trade conversations with her through the press will not be proper. She simply was not directing this to me, she was directing to the public to inform them that I am the secretary-general of the party when she does that I will speak to her I want to put it up that i do not view her as an enemy, I do not view her as a person that I do not talk to and converse with. So I will talk to her and will hear what she has to say and I will respond.

SC: Are you not concerned Sir. I am sorry that I am repeating it but this is the other bit now which is how other legal experts have interpreted that judgement that it has numerous failures, misdirections that have led to it being seen as a defective judgement?

Mwonzora: Sorry, Simba.

SC: Other legal experts say that the verdict which she is celebrating is a defective judgement, there are numerous misdirections over 12 misdirections and would that not give some sort of position or preposition to you not to even imagine communicating with her?

Mwonzora: I am a legal expert as well. And I see nothing wrong with talking to a person who has said she wants to talk to me in my official capacity as the secretary-general I am not going to close that door, it is not a civilized thing to do and it does not make political sense to me. Now, I have seen a lot of commentaries on the judgement, I agree with some I do not agree with some and so on. And I have looked at the judgement myself, I have my opinion and I have communicated my opinion to the leadership.

SC: In private you communicated all that in private and did not make it public?

Mwonzora: Yes I communicated in private just like I did last year before this matter was even lodged in court;you may want to know that I did convene a meeting involving Dr Khupe, Advocate Chamisa, and Elias Mudzuri, I did commit I did convene a meeting with them in my capacity with the Secretary General and legal advisor and I did give them what I thought was the legal opinion, was the legal position of the party, whether they took or did not take it is another matter; and I also in my capacity as the secretary-general I then advised that they should seek external legal counsel, and get an external legal opinion on the issue; we got that legal opinion, whether they followed it or not is another issue, but the thing is I did what I could in my capacity as Secretary General. Now there will be a lot of comment on a judgement. Some of the comments are political some of them are legal now this in my view when you look at that judgement you will have to look at it from a legal point of view does it make legal sense what are those things that the judge is talking about do they make legal sense? So the fact that a lot of people have commented I saw one comment by a respected academic which showed me that he did not read the judgement. Errm he was rambling and so on I did not expect that from an academic of his calibre he is a person that I respect, and I have privately conversed with him that he should first read things before he comments.

SC: So in essence, you are seeing that this judgement is strong;it is sound basically?

Mwonzora: Well, I have opinion on this judgement that I don’t want to communicate right now to the public I have communicated opinion to my leaders now I won’t tell the leaders what they want to hear; I will tell the leaders the legal position and the legal opinion; that is what I am there for. That is what I am elected to do; I am not defending anything;I am not attacking anything but I think that the analysis of the judgement so far done is poor.

SC: You mean that the analysis that is criticizing the judgement so far is poor?

Mwonzora: The analysis that has been done, it does not criticise the judgement only. Now, what people have been commenting on the judgement… for and against has convinced me in some instances that they did not apply their minds to it; and I am urging all our legal experts to read the judgement first so they can give sound Advice. Now we are unable to get sound Advice from what has been written so far, because it has been done in a poor way.

SC: would you say here that the threat for instance to seize property by Obert Gutu is normal, because he has already announced that MDC property is going to be transferred to Khupe. You as the Secretary General would you stand in opposition against that?

Mwonzora: Exactly Simba this is my point; it shows that Mr Gutu did not read the judgement; the judgement did not say transfer property it does not talk about property at all. There is no way in the judgement where there is the issue of property or money is talking about this is an extension of the judgement it is not there in the judgement Simba if you look at it. So these are political statements this is political banter and it is not helpful what is important is what the judgement says. What the issue at stake is. What does the judge say, it does not make a judgement on property at all.

SC: So, lastly let me ask you there are accusations; I am sure you have seen allegations against your character… generally you being that very same person who is standing to gain because now quite frankly Nelson Chamisa has been your nemesis ever since 2014 the very same year to which this judgement extends, the roll back. How could you assure the public here, that you do not stand to gain from a loss in this case of Nelson Chamisa or a de legitimising of Nelson Chamisa [LONG PAUSE]. I think I have lost you there sir.

Magaya Falls On Hard Times

Spiritist preacher, Walter Magaya has fallen on hard times and risks losing his massive guest house.

The leader of the Prophetic Healing and Deliverance (PHD) Ministries and his wife, Tendai, are under a High Court probe for failing to repay a US$23 million loan to Homelink Finance (Private) Limited, having bound themselves as surety and co-principal debtor.

The loan extended to Yadah Connect (Private) Limited last year.

Failure to service the loan, Magaya risks losing his guest house in Waterfalls, Harare, which was tendered as security for the loan. The spiritual leaders also offered mining machinery, equipment, and vehicles financed under the facility as security.

The creditor, Homelink, through its lawyers, Shomwe-Nyakuedzwa Attorneys is arguing that the defendants breached the loan agreement, hence an order compelling them to pay should be issued.

Magaya and wife were supposed to pay 33 months instalments of US$784 873,62 inclusive of interest, with effect from December 31 last year.

Magaya had not responded to the civil claim, last night.

Mwonzora Unmoved By “Attacks”

Farai Dziva|Embattled MDC A Secretary General Douglas Mwonzora says he does not regard Thokozani Khupe as an enemy.

Speaking in an interview with ZimEye.com Mwonzora said:”Well I am not bothered by what Thokozani Khupe has said.In actual fact she merely informed the public about her desire to have a meeting with me, in my official capacity as the Secretary General of the MDC.

With all due respect I do not regard Khupe as an enemy.I have to hear her side of the story.”

“We have lost court cases before and why should I be blamed for the High Court ruling? I think that is not fair to be frank with you.

As far as I am concerned Khupe is yet to contact me formally so I will wait for the appropriate time to respond to her remarks,” added Mwonzora.

Mwonzora is also unmoved by allegations of plotting to topple party leader Nelson Chamisa and he has somehow managed to avoid direct confrontation with the youthful MDC leader.

Stop Abusing The Courts, Bvondo Tells Zanu PF

Farai Dziva|MDC Youth Assembly leader Happymore Chidziva has described yesterday’s High Court Ruling On the opposition party’s presidency as laughable.

Bvondo has further pointed out that the party will not be be swayed by the court ruling.

It has emerged to us that the regime is once again tampering with the judiciary- in the process capturing the same to issue political judgements.

It’s a fight, a fight we in the youth assembly are prepared to execute.
We will not watch powerlessly while the executive visibly interferes with the affairs of the judiciary in a bid to punish, persecute and harrass perceived opponents.

It must be known here and now that the MDC is a voluntary organisation whose members have a constitutionally guaranteed right to belong to.

The leadership we chose is our choice and never the decision of these kangaroo courts!

Thus said,yersterday’s high court judgement which purports to have dethroned our President Adv Nelson Chamisa should not be taken seriously as it is laughable.

President Chamisa is not just the legitimate president of MDC but the president of the Republic of Zimbabwe whose victory was stolen through violence, terror and cohesion by man military fatigue.

We will not watch powerlessly while they play see-saw with people’s project.

I want to warn Zanu PF to stop it’s interference in judicial processes.

Instead they should confront the ever worsening economic crisis showing its urgly face through fuel shortages, lack of foreign currency, price increases,
shortages among others. Those amongst us who don’t want President Nelson Chamisa’s Leadership are free to go and form their own party or rather join Zanu PF.

As the national youth commander, I urge the youth across the country to be vigilant and prepare to protect our assets and our movement. They will rather destroy us first before they can destroy our movement.

South Africa Election Results Latest: ANC Leading

The latest of South Africa’s national elections results last night showed that the African National Congress was leading in 70.7% of all declared districts.

ANC had nearly 57% of the ballot, well ahead of the Democratic Alliance (DA) which followed on with 23%. The Economic Freedom Fighters was far behind with 10%.

Last night there were numerous complaints about irregularities in the voting process and an audit was commissioned. The Independent Electoral Commission promised to conduct a full audit before the final results are announced which is likely on Saturday. Below was the LIVE video coverage:

Farai Dziva|Controversial MDC T deputy president Obert Chaurura Gutu has urged Nelson Chamisa to appeal to the Supreme Court of Zimbabwe against the High Court Ruling that reversed his appointment as MDC A leader.

“Today’s political issues are anchored on soft power as opposed to buffoonery and populism. Political strategy entails using brains and not brawn to outwit and outsmart your detractors.

Sell them a dummy and make them believe they have made it before unleashing lethal soft power. A sucker punch,” declared Gutu.

He added :”Any decent lawyer will tell you that when you don’t agree with the ruling of a court of law, you don’t lambast the judicial officer and/or any other court official for that matter.

It’s False, Bank Of Botswana Denies Story On Missing p22 Billion | FULL TEXT

MISSING BILLIONS STORY FALSE, MALICIOUS – BoB

Bank of Botswana has dismissed as false and a malicious fabrication of facts a Botswana Gazette story published Wednesday headlined “Shocking! P22 Billion Missing at Bank of Botswana”.

A BoB press release describes the story as not only false and malicious but also calculated to tarnish the bank’s good reputation and integrity as well as compromising the country’s financial compliance record.

According to the release, the story was reportedly founded on Auditor General’s report entitled “Report of the Auditor General on the Accounts of the Botswana Government for the Financial Year ended 31 March 2018”.

The story grossly and erroneously misinterprets the contents and substance of the report on pages 24 – 25 which state “The Remittances Account, the main Government bank account at Bank of Botswana had a balance of P787 137 598 as at 31 March 2018 ”, says the release further stating BoB does not have any outstanding reconciliations and that those mentioned in the report are at government and not bank level.

Explaining that the perennial reconciliation problems of the said account had persisted in the year under review, the release adds:

“In his submission to the Public Accounts Committee on the accounts of the previous year, the Accounting Officer had informed the committee that efforts to resolve the reconciliation issues of that year were in progress and had hoped to complete by October 2018, which is 19 months after the year to which they relate”.

The release also indicates that the unreconciled items in the statement should be examined and resolved as soon as possible after discovery and therefore in the year under review, unreconciled payments totaled P2 274 266 757 while unreconciled receipts totaled P19 660 376 833.

“The P22 billion purported to be missing is a careless and irresponsible addition of the above figures (P2 274 266 757 and P19 660 376 833) by the Gazette newspaper,” says the release.

BoB explains that account reconciliation is a process through which customers compares their records with a statement from their banker and that the figures mean a total of P2 274 266 757 was paid out by government while P19 660 376 833 was paid to, or received by government “therefore it is shocking that deposits of P19 660 376 833 are considered missing money”.

It is the Auditor General’s concern that the amounts have not been reconciled not that they were missing, the release states.

The bank further clarifies that other than its function of providing banking services to government, it is also a statutory institution that has its own accounts while its audited annual financial statements are submitted to Parliament by April 30 each year as required by the Bank of Botswana Act.

“The record clearly demonstrates that successive financial statements have generated clean audit reports, confirming appropriate maintenance of accounts, existence of sound risk management and internal control environment, and in general, effective governance structures at the Bank of Botswana,” says the release (BOPA)

By Farai Maguwu|Well, today I had the honour of speaking at the African Development Bank in Abidjan at the invitation of AfDB and Nordic African Institute, standing in for my Professor, Patrick Bond. It was about balancing the energy needs of Africa and the transition to clean energy as enunciated in many policy documents of AU and African countries.

Both myself and the audience got a shock therapy a bit. I presented climate change as an act of war, an act of aggression against the poor by the rich, structural violence and ..in light of the devastating cyclone Idai – crimes against humanity! Wow! When I I finished speaking the moderator said ‘I first need to put a disclaimer that the views expressed are those of the presenter and not of the AfDB or the Nordic African Institute’ and I bowed my head in appreciation. It truly felt good to say things as truthfully as I could. Then a very senior official with AfDB followed up by apologising to govts and the private sector, saying its unfortunate when they chose speakers they overlooked the need to put a session for govts and private sector so that they can respond to some of the accusations, articulate their positions and challenges too. Again I felt honoured!

I argued that if there was absolutely nothing we can do about the changing climate then violence is absent, just like a baby and mother who died during child birth in 1898, the year Mbuya Nehanda and Kaguvi died. Then we had primitive medical facilities that caused high infant mortality rates and even with the greatest of efforts nothing could be done to save the little soul and the mother. But if we have mothers dying in child birth or infants dying during delivery today, then violence has occurred even though you don’t see someone holding a machete decapitating the child and the mother, because we have the resources and skills set to prevent it from happening. Climate Change denialists like Donal Trump do so because coal serves his business constituency well which is well covered in terms of mitigation against adverse effects. Now compare that with the more than 3 million affected by Cyclone Idai in southern Africa. I said the actual number of Cyclone Idai deaths could be more than double the official statistics as some govts are playing down the full scale of the disaster due to their lackadaisical response. Its high time we treat the impacts of climate change on those least responsible for it as an act of aggression or manslaughter.

I banned the use of phrases like ‘natural disasters’ or ‘acts of God’ when describing tropical cyclones. This removes humans from the centre of these disasters.

I also talked of the logic of keeping minerals in the ground….until we have patriotic leaders who can make good decisions. At the moment poor Africa is the greatest donor to the world. Undeniable fact! Natural capital accounting is essential, we are giving away our national assets for a song and then we tour the world with a begging bowl. The world need African resources and they must come to us begging. Then I talked about how Africans negotiate the so called mega deals. I said when ‘investor countries’ come to Africa they have a plan. They bring a team of competent people but who do they meet in Africa? Probably a Minister and his girlfriend! The deals are so ugly that they cant be published.

Then i came to NDCs, arguing that African govts talk green economy whilst receiving billions of dirty money for fossil energy. Rich countries are shutting down coal fired power stations whilst pouring billions into Africa to construct the same. Bad and corrupt energy deals, esp from China which we shall repay through the nose with huge interests. I also talked about the corruption around Climate Finance and countries that develop climate change response strategies just to access climate finance and never implement anything tangible on the ground. Then I talked briefly about Wicknell Chivhayo’s Gwanda solar circus.

I challenged Africa to dare dream and transition economies to green economies, modify legislations, create conducive environments for renewables / clean jobs and genuinely fight corruption etc. Challenges bring opportunities. Climate change has many opportunities and those that quickly embrace the challenge will lead in technology and innovation

I also talked about BRICS versus the Western fossil fuel investors – two man fighting to rape a woman chained to the wall. I was again reminded during questions and responses by an AfDB official that a study by John Hopkins University said the Chinese are doing very good projects in Africa and well received by Africans. I laughed! I refused to be intimidated by the name John Hopkins University. I then responded and said, ‘you better listen to me who lives and work with communities and activists in Africa than professors at John Hopkins University who probably finished their research paper before the field trip to a certain capital in Africa, if ever they had one! I said Chinese investors are loved only by African ruling elites and NOT by majority of African citizens to whom Chinese investments come with violence, corruption, pollution, water grabbing and inhuman and degrading treatment of the African citizen.

In the end, when I finished I apologized and told my audience ‘on reflection I think I should have been more academic…., next time!’ Afterwards one official from AfDB came to me and said ‘my brother thank you for raising these critical issues, we have had some very uncomfortable internal discussions about these issues, and today I felt vindicated!’

SA Election Results Entering Final Stretch And The 11th Hour Will Surely Be Intriguing

The South African|The capturing of election results is entering the final phase, with South Africans, from all walks, anxiously anticipating the outcome.

It’s been an exciting week for South Africans. While the political playing field has experienced a flurry of tremendous transformations since 1994, the excitement surrounding this sacrosanct democratic process still inspires a similar sense of hope. A certain disposition has, for a moment in time, drowned out the usual misanthropic monotony.

All feelings are, however, fleeting, and, depending on your personal political preference, emotions attached to the ever-nearing outcome of South Africa’s sixth democratic election, are likely to fall either side of the fence of indifference. This result will, undoubtedly, impact every South African – for better, or for worse.

The Electoral Commission (IEC), tasked with overseeing the entire voting process, has had a torrid time. From the impermanence of indelible ink, to a dire shortage of ballot boxes; the complaints lodged against the commission are many and varied. Unfortunately, issues of incompetence and electoral fraud have left a bitter taste in the mouths of the electorate and political parties alike.

Has the integrity of this year’s ballot been compromised? Has the IEC broken its solemn promise of a ‘free and fair election’? Many are saying it has. The Commission, acutely aware of the fallout, has promised to investigate every complaint. Until these investigations are complete, hypothesis regarding Electoral Law and its rank within the judiciary, serve as a spurious reactionary discourse or simply socio-political pillow talk.

Election results and prediction programs

The IEC’s result rollout has been tedious, forcing South Africa to the edge of an already well-worn seat. The Commission promised to have 90% of all results completed for public consumption, before 22:00 on Thursday evening. This isn’t going to happen.

Instead, we’re left in limbo. It’s likely that results will edge closer to the 100% mark on Friday, after which, court challenges, audits and a host of other delays will push an official announcement out until Saturday. It’s a journey.

Luckily, finely tuned projection programs, developed by people with a penchant for numbers, promise accurate final tallies ahead of the time. Dr Oloff de Wet is one such mathematician, who, together with Pretoria FM, has developed an early outcomes system. Veteran journalist, Jan Jan Joubert, who is working together with De Wett and his team, offered his views on the projection model, which, admittedly, is not infallible:

“We are satisfied that the current results are feeding into our projected model ever more smoothly. It does, however, depend on the predictability of human nature, which is not an exact science.”

Still, even to the untrained eye, the predictions, in comparison to the current tallies, seem to be within reason.

Before we get into the controversial gains and losses, let’s compare the above predictions with where the results currently stand as the finish line draws near. At 21:15 on Thursday night the results stood as follows:

Certain provincial results lagging behind

It’s important to note that election results emanating from KwaZulu-Natal and Limpopo have been slow. Currently, KZN has 49.72% of votes captured and Limpopo 43.49%.

This is of specific significance when considering that these regions are ANC strongholds, promising to deliver a flurry of votes in the eleventh hour.

Nationally, the tally is 65.17% complete, with results in areas like the Western Cape, Northern Cape and Eastern Cape almost officially decided.

What does this mean for the Big Three?

While we’ll need to wait for the final announcement from the IEC, some poignant deductions can already be made with the information at our disposal.

It makes sense to start with the ruling party, the African National Congress (ANC), which will undoubtedly hold onto its seat of national power. Its grip, however, is loosening. In 2014, the party garnered 62.15% of the national vote. Current results put the party 6% lower, making the prospects of the lowest ever voter share quite likely.

The situation on a provincial level is also intriguing. In Gauteng, talk of a coalition government has been doing the rounds. If the ANC fails to achieve a majority, then a coalition seems inevitable. The party is currently holding on by a thread, with its provincial voter share sitting at 51%.

The party has also lost ground in the Western Cape, where it currently stands at 28.71%, compared to its 2014 total of 32.89%

In the Eastern Cape, the IEC has held onto its majority, comfortably, garnering 68.11% of the provincial vote.

It’s the national losses which will worry the ruling party. At one time, the ANC enjoyed a two-thirds majority in the National Assembly. But the Zuma-years were cruel, and President Cyril Ramaphosa, despite his business acumen and call for unity, has failed to pull the party of its self-inflicted quagmire.

The Democratic Alliance (DA), which should be rejoicing at the ANC’s losses, has been left perplexed and perturbed by stagnation. On a national level, the party achieved 22.23% of the vote in 2014. The Official Opposition currently sits, uneasy, with 22.61%

Still, the party has, most likely, managed to retain control of the Western Cape and has made valuable inroads in Gauteng. It has, however, failed to penetrate the North, namely, Limpopo, Mpumalanga and the North West province.

Losses incurred by the DA and the ANC have been snapped up by the Economic Freedom Fighters (EFF); the only ‘top-three’ party showing any real signs of growth on both a national and provincial level.

On the national ballot, the EFF currently sits at 9.8% after achieving only 6.3% in the 2014 elections. More importantly, the Red Berets seem likely to grip the title of official opposition in the following provinces.

  • Mpumalanga
  • North West

The most impressive showing, however, belongs to the Freedom Front Plus (VF), who in 2014 only managed to secure 0.90% of the national vote. The party currently sits with a relatively powerful tally of 2.62%, putting them firmly in fifth place on the national leader board.

Lionel Messi was confronted by angry Barcelona fans after Liverpool’s dramatic Champions League comeback on Tuesday.

The Argentina international was forced to head home by himself after a random drugs test kept him at Anfield and his team-mates left without him.

At the airport the Barcelona forward was caught on camera making his way through security when he was berated by some travelling supporters.

Fans were understandably angry that Barcelona had crashed out of the Champions League at the semi-final stage for the second year running, after going into the away leg of the tie with a three-goal advantage.

Messi was a man on a mission in the first match at the Nou Camp, where he netted two goals in the 3-0 victory – the second a world-class free-kick from 35 yards.

He was largely quiet at Anfield, but was far from Barcelona’s worst player on the night and perhaps wrongly picked out for criticism.

‘I see that Barcelona has a great team and has the best player in the world, which is Messi.

‘The other day I heard that when they lose, it’s because of Valverde, Coutinho… but not Messi.

iol|Economic Freedom Fighters (EFF) leader Julius Malema on Wednesday slammed the Electoral Commission of South Africa (IEC) official at his voting station for wanting to remove his wife’s artificial nails before she could cast her vote.

Malema, who cast his vote at the Mponegele Primary School in Seshego together with his wife Mantwa, his aunt and his grandmother, said an IEC official was waiting with a pair of scissors to remove artificial nails in order to put a mark on voters’ nails as per the rules.

“There was some official who said to my wife that she must take out her nail so that they can put a mark [on her thumb]. And I found that bizarre because where is that written in the rules that women who have long nails can’t vote?” Malema said.

“We cannot have such a patriarchal arrangement happening at the voting station. Luckily the electoral officer came and said there is no such a thing, she can vote with her nail. But the person who puts a mark on people has a scissor there and she uses these scissors to take your nails out.”

Malema said that it should never be costly for people to vote because applying artificial nails costs money, and the IEC would not refund voters after removing their artificial nails.

“If someone goes to court and argues that Mr Mnangagwa was illegitimately installed as President in November 2017 and that under Zimbabwe’s Constitution Mr Mphoko should have been the lawful successor in the interim, Justice Mushore might just agree. But I’m NOT going to bet on it!

“Many did not notice what the coup authors did in November 2017 to create a veneer of legality.  Dubious cases were brought to court;  one of them was to declare that the military’s conduct was constitutional and another to declare that Mnangagwa’s firing as VP had been unconstitutional,” Magaisa wrote on his micro-blog Twitter Thursday morning.

Magaisa further laid into the judiciary saying the same High Court was skewed by the November 2017 power transition architects, who intelligently sold the nation a dummy in a bid to clear a way for Mnangagwa ahead of Mphoko.

“In this way, the authors of the coup used the High Court to legally sanitise the coup and incredibly, to reinstate Mnangagwa! This was to pretend that Mnangagwa and Mphoko were at par therefore opening a way for Mnangagwa to succeed Mugabe while elbowing out Mphoko.

“The capture of referees is probably the most egregious assault on democracy. They bend to the ruler’s will while the rest are under the spell of legitimacy, believing that referees are impartial, fair and deliver legitimate decisions. One has to overcome that naivety,” he added.

Mugabe Slowly Moving From Riches To Rags, Gushungo Dairies Collapsing.

Own Correspondent|Vehicles and farm equipment belonging to former Zimbabwean president Robert Mugabe’s company Gushungo Holdings are set to be auctioned on Saturday.

In a notice by Ruby Auctions, the auctioneer said they had been instructed by their “most valued client” to sell at least 40 vehicles, most of them Toyota D4D off-road trucks.

There were also about 30 tractors and accessories to be sold in-situ at the Gushungo Dairy estate in Mazowe where 80 newly resettled farmers were forcibly removed from the area to make way for a dairy project.

Since being deposed in a coup in November 2017, the Mugabe family’s  business fortunes at Alpha and Omega Dairy have taken a gradual dip, just like most companies operating in the failing economy.

Last year the company reduced salaries and commission fees for its workers before going into this year without paying at all. 

Earlier this week, Alpha and Omega’s southern region sales executive Cassim Asani told journalists that the company’s flagship products such as milk and ice cream were not selling as well as in the past.

“We are producing the products but the rate of uptake in supermarkets is very low because the majority of the people do not have enough buying power,” he said.

Asani added that the company was struggling to raise foreign currency to source ingredients and spare parts for its imported machinery.

“When we want to import ingredients and spare parts, forex is not yet readily available,” he said.

However, in January Alpha Omega Dairy was one of the companies allowed to import duty-free powdered milk. The company has a government agreement where it is meant to import a maximum of 100,000kg of full-cream milk powder a year and a maximum of 50,000kg of skimmed milk powder.

The ambitious project by the former first family was marketed as a beacon of hope for the local dairy industry by the Mugabes when they were in power.

Using political leverage in 2009, the Mugabes, through proxies, forced Nestlé Zimbabwe – the local subsidiary of the Swiss company – to buy milk from them despite the milk not meeting minimum standards required by Nestlé.

Addressing a Zanu-PF crowd at his birthday party, Mugabe instructed his then indigenisation minister Saviour Kasukuwere to start with Nestlé when embarking on company seizures because they refused to buy his milk.

“Nestlé refused to buy milk from Gushungo dairies. I told Kasukuwere to begin with them and tell them he was sent by me. We should deal with them; let them get out of the country,” Mugabe said.

But despite preferential treatment the company failed to bring back the glory years of the dairy sector which at its peak in the 1990s produced an average of 260 million litres of milk.

Last year, the country’s milk producers came up with an underwhelming 70 million litres of raw milk against a demand of 120 million litres.

The deficit is covered by milk imports from SA. As such government has since engaged a state-run Belarus milk enterprise with the hope of setting up shop in Zimbabwe.

The committee said the utterances by Butale undermined the internal processes of the party.

Morupisi also announced that Masisi had appointed Fidelis Molao as Minister of Agricultural Development and Food Security while Moiseraele Master Goya was appointed Assistant Minister of Tertiary Education, Research Science and Technology. He was previously Assistant Minister of Investment, Trade and Industry.

Gutu And Khupe Threatens To Repossess MDC Parly Seats And Assets

Correspondent|MDC-T Deputy President Obert has threatened that his party will move in to recover all the party assets that are in the custody of the MDC led by Nelson Chamisa.

Gutu’s statements comes after a High Court judge on Wednesday delivered a ruling that Chamisa is not the legitimate President of MDC.

“There shall be very, very serious and far-reaching implications and repercussions following upon Justice Edith Mushore’s judgment handed down yesterday.” Gutu said. “Party assets and funds that are presently in unlawful hands shall be recovered. Absolutely no doubt about that!”

Gutu told the MDC that if they agree with the court judgement they must not attack the court but lodge an appeal.

“Any decent lawyer worth his/salt will tell you that when you don’t agree with the ruling of a court of law, you don’t lambast the judicial officer and/or any other court official for that matter. You simply lodge an appeal against the court’s ruling to a superior court. Simple!”

The State of the Church for the sake of the Nation

1. We, the leaders of the ZHOCD made up of EFZ, UDACIZA, ZCBC and ZCC, come together as the leadership of the Zimbabwean Church which makes up the majority of the citizens of this nation’ today to call the nation towards a united, sincere and committed approach to solving the pressing challenges affecting our people. We reiterate our call for a comprehensive and inclusive national dialogue.

2. Church leaders are disheartened as they witness the heavy toll of ongoing fuel shortages, price hikes, heavy taxation and currency crisis. The desperate cries of struggling Zimbabwean families as they battle to put food on the table, send children to school, seek healthcare for the ill, make a living in difficult economic conditions and cope with life’s struggles in a context of austerity require urgent attention.

3. The time to act is now. It is not God’s will for our people to be divided, suffering and to be in perpetual conflict. Our relationships with each other need healing. Our economy must do more to meet our people’s needs for dignified and fulfilled lives free from want. Our people’s desire to be heard and to meaningfully participate in the decisions that impact their daily lives must be honoured.

4. To this end we will immediately begin preparations for the holding of an inclusive National Convention convened by the Church to explore ways towards practical resolutions to pressing challenges based on a shared national vision.This National Convention towards National healing and reconciliation; Responsible and responsive governance; and a Just economic and social contract will seek the support of all stakeholders.

5. We are also instructing our technical teams to formally request the expansion of the Tri- partite Negotiation Framework and its legislative mechanism to accommodate the Church, Civil Society and other organised interests in dialogue processes to secure the nation’s shared
future.

6. We also instruct our technical teams to establish three Ecumenical Commissions on National
healing and Reconciliation; Economic justice; and Constitutional Democracy to coordinate the preparations towards the upcoming National Convention and the on-going work of the National Dialogue Process.

7. We are calling the nation for a Sabbath season of rest from all forms of polarising political activities and contestation, finger pointing and violent conflict. This is vital to build trust and confidence in the national dialogue process and to ensure ownership for its outcomes.

8. We appeal to the International Community for respectful solidarity and accompaniment as we pursue a locally driven process. Further, we implore you to remove sanctions even as we call upon our own government to comply with International standards and norms of human rights, democracy and good governance.

9. We reiterate our preferential option for the vulnerable, marginalised, voiceless and all those in the diaspora to be given opportunities to voice their concerns and fully contribute to the National Dialogue as full citizens of our great nation.

10. We request all Christians to remain in prayer for the Church’s efforts to unite the nation and facilitate nation building dialogue under the will of God.

SC: …with the court verdict Sir, I have been trying to hear (from you), are you in acceptance with the court verdict; are you one of those who are calling for an appeal against it?

Mwonzora: I am not commenting on the High Court verdict Simba. I am sure the spokesperson of the party made a statement on behalf of the party.

SC: Ok so you stand by that statement of the spokesperson?

Mwonzora: I have spoken to you already I have already spoken to you Sir. I have already answered.

SC: But sir, Thokozani Khupe claimed that she was going to be working with you.

Mwonzora: I am sorry I am sorry my friend, I think you should forewarn me if you want to interview me.

SC: Oh I apologise, I thought that I had done that; I had notified your aide when you were in Parliament?

Mwonzora: I did not know.

SC : Would you like us to start right now?

Mwonzora: You know what Simba, I am sorry. I am sorry I may sound rude to you; it is not my nature but I do not want to comment about it.

SC: Thank you sir. I had to ask you because your name is in print. Thokozani Khupe has already has made ownership…

Mwonzora: What are the specific allegations against me maybe I can throw it off?

SC: The allegation against you is that you are behind the High Court defeat of Nelson Chamisa yesterday and also that you are working with Khupe and she has communicated in a statement that you are working with her, this morning.

Mwonzora: Well, you must understand that the High Court application was filed last year in September and in that High Court application I am the 5th Respondent, in other words I am being sued as well and the judgement was against me as well; how can I be behind it and for what reason? This is just a smear campaign by my opponents in the party they always want to find something to blame me when things go wrong. There is a court case the party has lost the court case my own opinion I did communicate my opinion to the leaders of the party on how we could have averted that disaster; but to say that I have anything to do with it it is simply a smear campaign Simba; I have nothing to do with it.
Regarding now what Thokozani Khupe said in her statement, I saw it today; the statement says that she will communicate with the Secretary-General of the party. What it means is right now as we speak there is a court judgement, and in terms of that court judgement there is a certain status which is there until that verdict has been varied; until the court verdict has been overturned, then the status quo as per judgement, so I don’t see anything sinister about that; so she has not communicated with me and unfortunately she has issued a statement but I have not received any formal communication with her.

People lose court cases, they don’t lose court cases because there is Douglas Mwonzora there. This is not the first time that we have lost a court case. We lost the election petition it was not my fault; now that there is a high court case yesterday, how is that my fault?

SC: And, lastly thank you for that. Your having been mentioned by her in her statement, are you not going to respond against it because she has stated… are you not disturbed that she has rushed to mention you?

Mwonzora: Certainly not, I see nothing wrong with that. I see nothing really wrong there because she says that she is going to get in touch with the Secretary General of the party. I am the Secretary General of the party it is when she gets in touch with me that I will appropriately respond to her, remember this is a statement in public I don’t have to respond to it. I will respond to the specific communication that she talks about me in her statement. That is the civilized thing to do in my view. So I am waiting for her communication, and I will respond to it accordingly. But for me to trade conversations with her through the press will not be proper. She simply was not directing this to me, she was directing to the public to inform them that I am the secretary-general of the party when she does that I will speak to her I want to put it up that i do not view her as an enemy, I do not view her as a person that I do not talk to and converse with. So I will talk to her and will hear what she has to say and I will respond.

SC: Are you not concerned Sir. I am sorry that I am repeating it but this is the other bit now which is how other legal experts have interpreted that judgement that it has numerous failures, misdirections that have led to it being seen as a defective judgement?

Mwonzora: Sorry, Simba.

SC: Other legal experts say that the verdict which she is celebrating is a defective judgement, there are numerous misdirections over 12 misdirections and would that not give some sort of position or preposition to you not to even imagine communicating with her?

Mwonzora: I am a legal expert as well. And I see nothing wrong with talking to a person who has said she wants to talk to me in my official capacity as the secretary-general I am not going to close that door, it is not a civilized thing to do and it does not make political sense to me. Now, I have seen a lot of commentaries on the judgement, I agree with some I do not agree with some and so on. And I have looked at the judgement myself, I have my opinion and I have communicated my opinion to the leadership.

SC: In private you communicated all that in private and did not make it public?

Mwonzora: Yes I communicated in private just like I did last year before this matter was even lodged in court;you may want to know that I did convene a meeting involving Dr Khupe, Advocate Chamisa, and Elias Mudzuri, I did commit I did convene a meeting with them in my capacity with the Secretary General and legal advisor and I did give them what I thought was the legal opinion, was the legal position of the party, whether they took or did not take it is another matter; and I also in my capacity as the secretary-general I then advised that they should seek external legal counsel, and get an external legal opinion on the issue; we got that legal opinion, whether they followed it or not is another issue, but the thing is I did what I could in my capacity as Secretary General. Now there will be a lot of comment on a judgement. Some of the comments are political some of them are legal now this in my view when you look at that judgement you will have to look at it from a legal point of view does it make legal sense what are those things that the judge is talking about do they make legal sense? So the fact that a lot of people have commented I saw one comment by a respected academic which showed me that he did not read the judgement. Errm he was rambling and so on I did not expect that from an academic of his calibre he is a person that I respect, and I have privately conversed with him that he should first read things before he comments.

SC: So in essence, you are seeing that this judgement is strong;it is sound basically?

Mwonzora: Well, I have opinion on this judgement that I don’t want to communicate right now to the public I have communicated opinion to my leaders now I won’t tell the leaders what they want to hear; I will tell the leaders the legal position and the legal opinion; that is what I am there for. That is what I am elected to do; I am not defending anything;I am not attacking anything but I think that the analysis of the judgement so far done is poor.

SC: You mean that the analysis that is criticizing the judgement so far is poor?

Mwonzora: The analysis that has been done, it does not criticise the judgement only. Now, what people have been commenting on the judgement… for and against has convinced me in some instances that they did not apply their minds to it; and I am urging all our legal experts to read the judgement first so they can give sound Advice. Now we are unable to get sound Advice from what has been written so far, because it has been done in a poor way.

SC: would you say here that the Threat for instance to seize property by orbit is normal because he has already announced that MDC property is going to be transferred to Khupe. You as the Secretary General would you stand in opposition against that?

Mwonzora: Exactly Simba this is my point; it shows that Mr Gutu did not read the judgement; the judgement did not say transfer property it does not talk about property at all. There is no way in the judgement where there is the issue of property or money is talking about this is an extension of the judgement it is not there in the judgement Simba if you look at it. So these are political statements this is political banter and it is not helpful what is important is what the judgement says. What the issue at stake is. What does the judge say, it does not make a judgement on property at all.

SC: So, lastly let me ask you there are accusations; I am sure you have seen allegations against your character… generally you being that very same person who is standing to gain because now quite frankly Nelson Chamisa has been your nemesis ever since 2014 the very same year to which this judgement extends, the roll back. How could you assure the public here, that you do not stand to gain from a loss in this case of Nelson Chamisa or a de legitimising of Nelson Chamisa [LONG PAUSE]. I think I have lost you there sir.

Speaking in an interview with ZimEye.com Mwonzora said:”Well I am not bothered by what Thokozani Khupe has said.In actual fact she merely informed the public about her desire to have a meeting with me, in my official capacity as the Secretary General of the MDC.

With all due respect I do not regard Khupe as an enemy.I have to hear her side of the story.”

“We have lost court cases before and why should I be blamed for the High Court ruling? I think that is not fair to be frank with you.

As far as I am concerned Khupe is yet to contact me formally so I will wait for the appropriate time to respond to her remarks,” added Mwonzora.

Mwonzora is also unmoved by allegations of plotting to topple party leader Nelson Chamisa and he has somehow managed to avoid direct confrontation with the youthful MDC leader.

Farai Dziva|MDC Youth Assembly leader Happymore Chidziva has described yesterday’s High Court Ruling On the opposition party’s presidency as laughable.

Bvondo has further pointed out that the party will not be be swayed by the court ruling.

It has emerged to us that the regime is once again tampering with the judiciary- in the process capturing the same to issue political judgements.

It’s a fight, a fight we in the youth assembly are prepared to execute.
We will not watch powerlessly while the executive visibly interferes with the affairs of the judiciary in a bid to punish, persecute and harrass perceived opponents.

It must be known here and now that the MDC is a voluntary organisation whose members have a constitutionally guaranteed right to belong to.

The leadership we chose is our choice and never the decision of these kangaroo courts!

Thus said,yersterday’s high court judgement which purports to have dethroned our President Adv Nelson Chamisa should not be taken seriously as it is laughable.

President Chamisa is not just the legitimate president of MDC but the president of the Republic of Zimbabwe whose victory was stolen through violence, terror and cohesion by man military fatigue.

We will not watch powerlessly while they play see-saw with people’s project.

I want to warn Zanu PF to stop it’s interference in judicial processes.

Instead they should confront the ever worsening economic crisis showing its urgly face through fuel shortages, lack of foreign currency, price increases,
shortages among others. Those amongst us who don’t want President Nelson Chamisa’s Leadership are free to go and form their own party or rather join Zanu PF.

As the national youth commander, I urge the youth across the country to be vigilant and prepare to protect our assets and our movement. They will rather destroy us first before they can destroy our movement.

High Court Ruling Mirrors Mnangagwa’s Plot To Coax Zimbabweans After Rigging Polls – MDC

Farai Dziva| The MDC Youth Assembly has described yesterday’ s High Court ruling as a clear attempt by Emmerson Mnangagwa to coax Zimbabweans after “stealing the 2018 polls.”

The MDC Youth Assembly hereby re-affirms that the legitimate President of the MDC is President Nelson Chamisa.

The choice of President Chamisa is the best choice that was done by the MDC.

President Chamisa is our constitutionally and legitimately chosen leader as per our Party’s Constitution.
The MDC Youth Assembly is happy with preparations for Congress so far and nothing will stop the People’s Movement from proceeding with its legitimate processes.

The Youth Assembly is impressed by the performance and discharge of duty by President Chamisa, including but not limited to the successful integration of Alliance Partners and maintaining stability and massive growth of the party resulting in winning 2.6million votes in the elections.

President Chamisa is the most popular political figure in the country and the court of public opinion points to him as the most trusted and loved political leader in Zimbabwe.

We note that it is Mnangagwa’s strategy to shed-off his illegitimacy stigma by casting aspersions on our legitimate leader, President Chamisa.
Mnangagwa is trying to run away from his 2018 defeat and is restless and has made many attempts against the People’s President, which are notably:

1) Attempted to increase Presidential age limit to 53 just to exclude President Chamisa and failed
2) Recognized Khupe as the main opposition leader for dialogue at the exclusion of President Chamisa and the process has failed.

3) Attempted to sponsor candidates to challenge President Chamisa at congress and failed
4) Attempted to tarnish and blackmail President Chamisa through the State Media and failed
5) Now trying to impose a process for the MDC, and it will fail.
President Chamisa is the Party and National President and not a court President. We will not allow anyone to choose a leader for us.
President Chamisa is the People’s President, the People’s Choice.

Ngezi Platinum Fire Senior Players

Ngezi Platinum Stars have dismissed two senior players.

The two Liberty Chakoroma and Simba Nhivi have been fired on allegations of being ring leaders in last week’s protest by players.

The players staged a sit-in last Friday and threatened not to fulfil their match against TelOne if their demands for a pay rise and allowances were not met.

The players went on to play the match after coach Erol Akbay broke the impasse between the players and the management.

Chakoroma who was still to start any match this season having missed the early matches through suspension carried over from last season, confirmed receiving the dismissal letter.

” Yes I have been fired, they gave me a letter terminating by contract. I am not in a position to talk now but will issue a statement later,” said Chakoroma.

Nhivi could not be reached for a comment but he is the other player dismissed by the Mhondoro-Ngezi based side. The forward joined Ngezi Platinum Stars midway last season from Caps United. He scored in the 1-0 over TelOne last weekend.

Trailing 1-0 from the first leg, Spurs made the worst possible start in Amsterdam when a towering fifth-minute header by 19-year-old Ajax captain Matthijs de Ligt doubled the advantage for Erik ten Hag’s exciting young side.

Tottenham hit the post through Son Heung-min before Hakim Ziyech doubled Ajax’s lead on the night with a sweeping finish after an assist by former Southampton winger Dusan Tadic.

That left Spurs 3-0 behind on aggregate yet, in another pulsating semi-final, Mauricio Pochettino’s side scored twice within five minutes in the second half.

Moura reduced the deficit with a composed finish before the Brazilian’s shot on the turn, after keeper Andre Onana had denied substitute Fernando Llorente, levelled the scores on the night and left Spurs requiring one goal to reach the final in Madrid on 1 June.

Chidzambwa’sWarriors Dilemma

Farai Dziva| Zimbabwe National Soccer team coach Sunday Chidzambwa has said if his team manages to reach the Cosafa Cup final he will split his squad so that the Warriors can fulfil the friendly match against Nigeria’ s Super Eagles.

Zimbabwe Warriors are scheduled to lock horns with the West Africans on the 8th of June, the same day the Cosafa final will be played. The practice match is part of the preparations for the Afcon tournament set for Egypt from June 21.

Speaking to H-Metro, Chidzambwa revealed that he was assembling a 30-man squad for Cosafa and would pick some players from the selection and form a team for the trip to Nigeria.

“Both matches are important to us. We are almost done with our squad, we are finalizing. And I was told that we have to assemble 30 players for Cosafa,” he said.

“If we get to the finals, I think we will have to select from the 30 players a team to go to Nigeria.

“The Nigeria game is important for us because we need to assess ourselves. This is a practice match for us and it will be good for us because we will know where we need to work on.

“Nigeria is one of the biggest teams in Africa so this match is important for us as we prepare for AFCON,” he said.

Respect Court Ruling, Gutu Tells Chamisa

Farai Dziva|Controversial MDC T deputy president Obert Chaurura Gutu has urged Nelson Chamisa to appeal to the Supreme Court of Zimbabwe against the High Court Ruling that reversed his appointment as MDC A leader.

“Today’s political issues are anchored on soft power as opposed to buffoonery and populism. Political strategy entails using brains and not brawn to outwit and outsmart your detractors.

Sell them a dummy and make them believe they have made it before unleashing lethal soft power. A sucker punch,” declared Gutu.

He added :”Any decent lawyer will tell you that when you don’t agree with the ruling of a court of law, you don’t lambast the judicial officer and/or any other court official for that matter.

You simply lodge an appeal against the court’s ruling to a superior court. Simple.”

Tragedy As Student Is Run Over By University Bus

By Own Correspondent| Tragedy struck the Chinhoyi University of Technology, CUT, Wednesday night when a male student was run over by the institution’s bus.

The accident occurred as students stampeded to board one of the University buses.

The stampede resulted in the victim falling underneath the bus while it was still in motion with the driver trying to park it properly.

The student was initially taken to Chinhoyi Provincial hospital where he was further transferred to Parirenyatwa hospital in Harare.

He however, died on his way to Parirenyatwa hospital.

Police spokesperson for Mashonaland West Inspector Clemence Mabgweazara confirmed the tragedy.

Coltart Describes High Court Ruling On Chamisa As “Empty Thunder”

Farai Dziva|MDC founding member and lawyer, David Coltart has described the High Court ruling that nullified Nelson Chamisa’s presidency as “empty thunder.”

Journalist and filmmaker Hopewell Chin’ono said :” I am not a lawyer, I expect lawyers to give us their views in due course.”

Coltart referred to the judgement as “a brutum fulmen – ‘empty thunder’, an ineffective order.
He also called it a “pathetic interference with the due processes of a political party.”

Mnangagwa Desperate To Destroy People’s Project- MDC A

Farai Dziva|Emmerson Mnangagwa is losing sleep in a desperate attempt to destroy the people’ s project, the MDC A has said.

Addressing the media at a news conference on Wednesday in Harare, MDC A spokesperson Jacob Mafume said:”We are fully aware of the machinations and strategies being deployed by the Mnangagwa administration to destabilize and destroy the people’s project.

We reiterate that Emmerson Mnangagwa is illegitimate and no amount of diversionary tactics will change this fact.”

“For the avoidance of doubt, preparations for the main Congress are at an advanced stage and 6 800 delegates will attend. That process is irreversible,” added Mafume.

Mwonzora In Hiding As Vanguard Bays For His Blood

MDC secretary-general Douglas Mwonzora has allegedly gone into hiding amid reports that party youths are baying for his blood over his links with the High Court ruling that nullified Nelson Chamisa’s appointment.

According to reports, Mwonzora is believed to have decided to stay away from public places and is also shunning the party headquarters for fear of being attacked.

This follows a ruling by the High Court of Zimbabwe that nullified Nelson Chamisa’s presidency of the party, with journalist Hopewell Chin’ono insinuating on social media that Mwonzora had the High Court judgement a week before it was delivered.

A group of party youths, popularly known as the Vanguards, have also been seen surrounding party vice President Elias Mudzuri’s Milton Park home in Harare, singing derogatory songs. The youths accused Mudzuri of undermining Chamisa, saying Mudzuri sponsored the High Court application by a Gokwe MDC official which resulted in yesterday’s ruling.

ZOOMZimbabwe understands a report has been made to the police regards Mudzuri’s safety and the disturbance of peace at his home at lunchtime Thursday.

ZOOMZimbabwe has received information that Starman Chamisa, a relative of Nelson who is also the legislator for Mbare, is at the centre of an operation hunting for Mwonzora.

“Starman Chamisa has been tasked with hiring thugs that should find and beat up Mwonzora,” a source close to the developments told ZOOMZimbabwe.

“This followed a social media post by Chin’ono that linked Mwonzora to the leak of a High Court ruling to a NewsDay journalist, Blessed Mhlanga, last week,” the source said.

Writing on social media last night, Chin’ono said: “Weeks ago I urged Wamba (Nelson Chamisa) and the MDC to accommodate Mukoma Douglas Mwonzora after he had been rejected by the MDC branches in his quest to lead the main opposition party.

“Today he stands accused of having known ahead of time about the exact nature and contents of today’s court ruling that nullified Wamba’s Presidency.

“Senior MDC folks are saying that he told a Newsday journalist about it and that they chose to keep quiet to see how it will pan out.

“In a toxic political environment like this one, I urge Mukoma Douglas Mwonzora to clear his name. ‬Did he tell a Newsday Journalist or not about the contents of today’s judgement?

“Is he the source referred to in Blessed Mhlanga’s tweets? Did he mention the ruling days ago and it’s nature and contents?”

Stampede Results In CUT Student Being Killed By University Bus

A male student at Chinhoyi University of Technology (CUT), was on Wednesday night run over and killed by the institution’s bus.

The incident occurred during a stampede, with students trying to board the bus.

The bus is said to have been in motion as the driver was in the process of parking it properly when the student fell down and critically injured.

The injured student was initially taken to Chinhoyi General Hospital but later referred to Parirenyatwa hospital in Harare.

He, however, succumbed to his injuries en route to Parirenyatwa.

The incident was confirmed by Mashonaland West police spokesperson Inspector Clemence Mabgweazara.

The name of the deceased student has not yet been revealed.

GMB Taken To Task Over Silo Repairs Grant

PARLIAMENT yesterday demanded to know how $9 million, allegedly extended to the Grain Marketing Board (GMB) by the Grain Millers Association of Zimbabwe (GMAZ) for the repair of silos, was used.

The Parliamentary Portfolio Committee on Lands and Agriculture chaired by Gokwe Nembudziya MP Justice Mayor Wadyajena grilled GMB chief executive officer Rockie Mutenha over the issue and the progress made so far in repairing silos that store grain.

Wadyajena said GMAZ chairperson Tafadzwa Musarara had indicated to the committee that GMAZ gave GMB $9 million in 2017 for rehabilitation of silos, and even pointed out that they had an agreement with GMB that the amount would be offset through grain.

GMAZ spokesperson Garikai Chaunza was also mentioned by Wadyajena as having indicated that as GMAZ they were waiting for an audit report indicating how the $9 million was used.

But Mutenha denied that GMB had received money for repair of silos from GMAZ, adding that they never entered into any loan agreement with anyone.

“We did not sign any contract with anyone and as far as we are concerned we did not receive money from anyone, other than Treasury and the Reserve Bank of Zimbabwe,” Mutenha said.

“The funding for repair of silos came from two sources and $6 318 627 came from Treasury through the Reserve Bank of Zimbabwe from the grain procurement account and $1 016 281 came from GMB funds, giving a total of money paid for repair of silos at $7 334 909,” he said.

Mutenha said the $7,3 million for silos repairs was paid to a company called Adherechem. But the committee demanded that Mutenha must produce the contract between GMB and Adherechem, and papers which showed the shareholding structure of Adherechem.

The GMB boss said in 2017 they submitted a list for rehabilitation of all 12 silos in the country in Karoi, Magunje, Mukwichi, Lions Den, Banket, Norton, Chegutu, Concession, Chiweshe, Murewa, Bulawayo and Aspindale. The tender was won by Adherechem.

“The job for the first 10 concrete silos was completed by October 12, 2018. For the steel silos in Chiweshe and Mukwichi, they needed to remove old steel and put new sheets, and these were completed in April this year,” he said.

Wadyajena then asked Mutenha to explain how RBZ allocated $27 million to GMAZ for wheat and maize purchases when it was a private entity and not the parastatal responsible for grain purchases.

“The RBZ said we cannot have parallel structures to import wheat and we were told to allow them (GMAZ) to bring wheat. The RBZ governor said GMAZ was already running it and we cannot have two parallel structures,” Mutenha said.

“Leave Our Domboshava And Go Back To Your Beijing,” Zimbabweans Fume At Mnangagwa’s Chinese

VOA|Zimbabwe has clamored for outside investment in recent years, but villagers north of the capital are resisting a Chinese mining project they say will spoil the environment and fail to bring them much benefit.

The villagers are from Domboshava, a rocky area north of Zimbabwe’s capital, and they are disputing a Chinese company’s decision to start quarry mining.

Seventy-year-old Florence Nyamande is among those saying no to the proposed project by Aihua Jianye Company.

“The Chinese are the money mongers of Zimbabweans. They take riches here, they take it to China. They do not develop our places. So we do not need them here,” Nyamande said. “Seriously with a deeper heart, seriously with a mind, we are disappointed. We said ‘No’ and ‘No’. That is multiplicated (multiplied) ‘No.’”

​The villagers do not think Aihua Jianye will create the 500 jobs in the area it promised. They also say the quarry mining will leave large ponds filled with dirty water.

Zimbabwe Deputy Minister of Information Energy Mutodi – who is the parliament member for the area – is also against the $500 million quarry mining project.

He says he is not going against President Emmerson Mnangagwa’s mantra that “Zimbabwe is open for business.”

“It is open to business, but not to business that is gong to affect our environment. We want to preserve the environment. We want our community to develop, yes. But let our environment remain intact. We cannot have a situation come here take the proceeds, enjoy it in other countries, yet our people remain poor,” Mutodi said.

Mutodi notes the Chinese company has advertised for only 40 jobs in the area, less than one-tenth of what it promised.

Percy Mudzidzwa, whose company GeoGlobal Environmental Solutions is representing the Chinese firm, rejects allegations that 20,000 people would be affected by the 33 hectare mining project.

Some locals say the project will affect a graveyard and a natural spring. Mudzidzwa says that is not so.

“Not even a grave is going to be moved. But there is a misconception. We proposed that that the graves be fenced. There is a spring, which is above the grave site, we proposed that the spring be fenced too,” Mudzidzwa explained.

Now the project waits for the country’s Environmental Management Agency to make a final call if the Chinese company can go ahead.

Own Correspondent|An overly excited MDC-T leader, Thokozani Khupe has hit the road running in embracing the controversial High Court ruling which declared Nelson Chamisa as illegitimate President of the opposition.

In a statement issued on Wednesday, Khupe said she was ready to seek audience with party secretary general Douglas Mwonzora to take over the opposition party.

“This victory not only vindicates Dr Khupe and those in the MDC that have always stood for principle over political expediency but it’s a victory for all democratic forces and the rule of law in our country,” said Khupe.

Dr Thokozani Khupe, welcomes and accepts today’s judgement of the High court of Zimbabwe in Harare.

This victory not only vindicates Dr Khupe and those in the MDC that have always stood for principle over political expediency but it’s a victory for all democratic forces and the rule of law in our country.

This judgement is also a damning indictment to the many so called legal scholars in the broader 
democratic movement who for the past years like the disgraced biblical Pontius Pilate looked the other way when the movement was veering off our founding values with such alarming impunity.

Justice Edith Mushore, reminded us again what it is to be Zimbabwean by choosing courage and integrity over bigotry, misogyny, cowardice and mobocracy. It is therefore not surprising that those who seek power through violence and fraud are not able to successfully impeach her “Ratio decidendi” and are descending to their lowest weapon of choice which is personal insults and attacks on our judiciary.

Dr Khupe will soon be contacting the SG of the party, Dr Mwonzora, and other elected leaders to see how best they can implement the ruling of the High Court.

Dr Khupe has noted and welcomes the intention by some to appeal the judgment as this will give the superior courts an opportunity to confirm the universal rights of all Zimbabweans to fair and just
administrative justice within any social organisation of their choice.

Dr Khupe demands all members of our movement to unite and be magnanimous at this time irrespective of their chosen side in this debacle.

Honourable Advocate Nelson Chamisa, and those close to him must not be verbally abused or belittled in any way, shape or form. He remains an indispensable leader of our movement and to that end he deserves the uttermost respect from all disciplined cadres of our movement.

Chamisa Blasts ZEC Sings Praises For South Africa Elections Body

Jane Mlambo| Opposition MDC leader, Nelson Chamisa has praised South African election commission (IEC) for the transparent manner in which they are running the elections hailing how all participating political parties have direct access to the portal receiving results from polling stations.

Posting on Twitter, Chamisa blasted the Zimbabwe Electoral Commission (ZEC) for denying them access to the results server.

“Unlike with ZEC in Zim, the IEC of RSA results center is fully transparent. The management system works & each party has direct access to the portal receiving results from the polling stations.This works & no V11s are alterable.We demanded but were denied access to the server.”

High Court Ruling On Chamisa Senseless And Smells A Pure ZANU PF Agenda

Dear ZimEye.com Editor|This High Court ruling on Nelson Chamisa leadership of the MDC is just senseless. No matter how much ZANU PF may try to clear its name out of the judgement everyone can tell that it smells of their influence on the judiciary.

No sane High Court judge could have come up with the kind of ruling unless there would be a gun to their head to make the ruling.

I thought the initial clear fact is that Nelson Chamisa is not the leader of the MDC-T that the High Court judge refers to. A court ruled sometime ago that Thokozani Khupe is the genuine leader of the MDC-T and made almost exactly the same inferences as with the current ruling.

MDC-T went on to hold its extra ordinary congress which the High Court judge says must be held. In that congress,  Khupe was elected as the new President of the MDC-T.

Khupe further went on to officially dismiss Chamisa from the MDC-T and also wrote to parliament asking for Chamisa to be recalled from the August house.

Now how else does Nelson Chamisa come into the leadership dispute of the MDC-T?

The judge in his judgement further stated that ALL endorsements that were made by Chamisa when he was Acting MDC President are duly declared null and void.

It is not clear what the judgement refers to here. If the spirit of the judgement is what it appears to be, then it means that all Members of Parliament who contested elections on Chamisa’s endorsement are invalid and may need to be removed from parliament prompting nearly fresh general elections in the country.

With all due respect to the judiciary system in the country,  this ruling calls for a strong nationwide voice to demand for the removal of ZANU PF influence into the operations of the courts.

High Court Throws Out Yet Another MDC Election Legitimacy Petition

State Media|THE High Court has dismissed a petition by losing MDC Alliance candidate for Bulawayo South Mr Muvirimi Francis Mangwendeza who was challenging Zanu PF candidate Mr Rajesh Kumara Indukant Modi’s victory in last year’s harmonised elections.

In his petition filed at the Bulawayo High Court citing Cde Modi and the Zimbabwe Electoral Commission (Zec) as respondents, Mr Mangwendeza alleged that the polls were tainted with irregularities.

Mr Mangwendeza, through his lawyers Ncube Attorneys, sought an order nullifying the results of the July 30 harmonised elections for the Bulawayo South seat. 

He wanted the seat to be declared vacant.

Bulawayo High Court judge Justice Thompson Mabhikwa ruled that the petition lacked merit and failed to meet the required legal standards.

“In casu, a reading of the petition gives an impression that the petitioner did not have a chief elections agent or polling agent. There is no mention of their role, observations or any complaints received or made by them on the alleged irregularities,” he said.

In dismissing the petition, Justice Mabhikwa said Mr Mangwendeza failed to prove to the court the alleged malpractices and irregularities which he claimed affected the outcome of the election.

“No cogent explanation has been given as to why the first respondent (Mr Modi) should be so punished. Accordingly, it is ordered that the petition is dismissed with costs on ordinary scale. The election result for the National Assembly seat for Bulawayo South Constituency pronouncing the first respondent as duly elected winner, stands,” ruled Justice Mabhikwa.

Mr Mangwendeza contested with several other candidates from other political parties as well as independent candidates.

In his founding affidavit, he said on July 3, Zec allegedly published a malicious statement declaring that he was part of the 24 people who had withdrawn from the race without his knowledge and verification. 

He argued the statement de-campaigned him as those who supported him would have thought he was no longer in the race. 

Mr Mangwendeza said his loss in last year’s July 30 election was largely due to Zec’s declaration, claiming to have discovered the anomaly on July 28 during the inspection of ballot papers.

“The election for the Member of the National Assembly seat for Bulawayo South on July 30, 2018 was not conducted in accordance with the principles laid down in the Electoral Act and such mistake or non-compliance did affect the outcome of the election. The election of the first respondent (Mr Modi) in such an election therefore cannot stand and has to be set aside,” he said.

Mr Mangwendeza said during the inspection he realised that some ballot papers for the MP did not have his name on them as a candidate. 

Mr Mangwendeza said on July 29, it turned out that more ballot papers had his name missing in ward 21 and ward 6.  He said Zec indicated that their system was fool-proof, but it turned out that this was not the case as it emerged that not all the ballot papers in question were cancelled.

The voting station came alive when the former president arrived. Even IFP members in a tent adjacent to the school’s entrance cheered at the sight of Zuma’s arrival.

The former leader cracked jokes with the IEC official who inspected his identity document.

He also shared a light moment in the queue with Inkosi yamaNxamalala Bhekumuzi Zuma and promised to make time to see the chief after the elections.

Choice Of Who Leads The MDC Is Not An Issue To Be Decided By The Court But The Members, MDC Reacts.

MDC Statement 8 May 2019|We have just been advised of the High Court of Zimbabwe judgement issued by Justice Edith Mushore today.

We fundamentally disagree with the judgement.

The choice of leaders of any political party, the world over is the sole preserve of the members of that party.

It can never be a judicial process. Equally, the actions, activities and programmes of a political party, being a voluntary organisation whose existence is protected by the Constitution, is the sole preserve of the members that party.

In the past few months, over 500 000 members of the MDC have been involved in a process of electing their leaders at lower levels, from branch to the province. More particularly, over 10 200 branches, 1 958 wards, 210 districts and 13 provinces have been elected.

In just a few weeks’ time, the MDC will complete the process of democratically electing its leadership at a Congress convened in terms of its Constitution.

Strangely, Justice Mushore’s judgement contradicts and totally ignores an earlier judgement of the High Court which ruled on the case of Murimoga versus the MDC.

We are fully aware of the machinations and strategies being deployed by the Mnangagwa administration to destabilize and destroy the people’s project.

We reiterate that Emmerson Mnangagwa is illegitimate and no amount of diversionary tactics will change this fact.

For the avoidance of doubt, preparations for the main Congress are at an advanced stage and 6 800 delegates will attend. That process is irreversible. We shall hold a historic and joyous Congress under the theme: Defining a new course for Zimbabwe.

All roads lead to Gweru.

New FIFA Rules That Will Change Football Entirely As We Know It.

THE International Football Association Board (Ifab) has announced some changes in football laws that will see, among other amendments, a coach being sanctioned for an offence committed by an unidentified team official.

Another key change is that the ball will now be deemed to be out of play if it touches the referee, remains in play and a team starts a promising attack; the ball goes directly into the net or the team in possession of the ball changes. Play will resume with a drop ball.

These and other changes that will come into effect on June 1 were announced during Ifab’s 133rd annual general meeting in Aberdeen, Scotland, in March this year.

“A number of changes to the laws of the game for 2019/20 were approved which follow the principal aims of the ‘play fair’ strategy; improving player behaviour and increasing respect, increasing playing time and making the game fairer and attractive,” wrote Lukas Brud, the Ifab secretary.

He said all changes are compulsory for friendly matches and competitions starting on or after June 1, 2019.

“Competitions which start before June 1, 2019 may implement them or delay their implementation until no later than the start of the next competition,” wrote Brud.

The meeting considered feedback from two years of experiments with law changes, which have the potential to improve the image of the game and reduce the time lost to substitutions and goal-kicks.

Players being substituted must leave the field at the nearest point on the boundary line unless the referee allows the player to leave quickly or immediately at the halfway line.

“The current dropped ball procedure is unsatisfactory as it often leads to confrontation or a ‘manufactured’ restart which is exploited unfairly like kicking the ball out for a throw in deep in the opponents’ half.

“The new procedure is for the dropped ball to be uncontested, it will be dropped for only one player and all other players must remain at least four metres away.

“Play will then continue as normal, that is the ball is not given back to the opponents,” reads the Ifab circular.

If play was stopped when the ball or the last touch of the ball was in the penalty area, the ball will be dropped for the defending team goalkeeper.

In all other cases, the ball will be dropped for one player of the team that last touched the ball at the place where it was last touched.

The Ifab first met on June 2, 1886, in London, in an event attended by two representatives each from the English, Irish, Scottish and Welsh associations.

The Ifab soon became established as the guardian of the unified laws of the game and tasked with preserving, monitoring, studying and amending football rules.

To this day the laws of the game can only be changed by the Ifab.

Laws of the game changed significantly over time.

The penalty kick and goal nets were introduced in 1891. Between 1896 and 1899 it was agreed that each team should have 11 players on the field; that a match is to last for 90 minutes and that the field ought to have the dimensions it still retains today.

Integration was formalised as Fifa joined the Ifab as a full member in 1913.

In the newly restructured body, Fifa was given the same voting power as the original four associations put together.

ANC Takes Massive Early Lead In SA Elections As EFF Trails Way Behind

Own Correspondent|Vote counting in South Africa’s sixth democratic elections resumed in earnest after polling stations closed last night and initial results are slowly trickling into the province’s elections nerve centre in Century Centre.

Nationally, the African National Congress (ANC) is enjoying an early lead followed by the Democratic Alliance (DA) and the Economic Freedom Fighters (EFF).

By 4am on Thursday morning, 887,867 valid votes had been captured.

Party agents sat anxiously with their eyes fixed to their computer screens and monitors showing the early votes.

The ANC has taken an early lead at just over 50% nationally followed by the DA and EFF at 28% and 7%, respectively.

In the Western Cape, the DA was sitting on 60% of the vote so far.

It will still be more than 48 hours before South Africans know the final results.

Leaked Documents Suggest Russian Plan To Sway South Africa Election Away From Julius Malema

Julius Malema, the firebrand leader of South Africa’s Economic Freedom Fighters (EFF) looks on before addressing his supporters during one of his campaigns.

The Guardian|Russian specialists planned to influence South Africa’s general election in order to strengthen the ruling African National Congress party (ANC), documents seen by the Guardian and local media in South Africa suggest.

The documents were apparently prepared by an organisation linked to Yevgeny Prigozhin, a St Petersburg businessman who is close to Vladimir Putin. They promise a campaign “to support the ruling ANC ahead of elections” and to counteract and “discredit” the pro-western Democratic Alliance party. It is unclear whether the plan was executed. The plan was first reported by the Daily Maverick newspaper.

Voting booths opened on Wednesday in South Africa’s sixth general election since the first free polls in the country in 1994. The ANC has held power ever since but faces widespread discontent among voters angered by a series of major corruption scandals, power cuts, inflation and unemployment.

There is little doubt that the ANC will obtain a majority in parliament and that the incumbent president, Cyril Ramaphosa, will get a new mandate. However, supporters say he needs to show he has reversed a steady decline in the ANC’s popularity if he is to implement an ambitious reform agenda that has stalled since he took power last year.

The plan to interfere in South Africa’s election was coordinated by a Russian political technologist, Peter Bychkov, who works for Prigozhin, according to the documents. The disinformation campaign was plotted by a Russian-owned NGO, the Association for Free Research and International Cooperation (Afric), under the guise of research.

In February, according to the documents, Bychkov dispatched a small team of political analysts from St Petersburg to South Africa. They were based within Afric and another research outfit, the International Anticrisis Center (IAC). This appears to be the first time the Prigozhin network has been active in South Africa, but there is no evidence it had any effect, the paper said.

The documents were obtained by the Dossier Center, an investigative unit based in London and funded by the Russian businessman and Kremlin critic Mikhail Khodorkovsky.

Moscow’s goal was to tarnish the reputation of the leaders of the Democratic Alliance (DA) and the Economic Freedom Fighters (EFF), a far-left party headed by a former ANC official, the documents suggest. Tactics include “public rhetoric”, “generating and disseminating video content”, “coordinating with a loyal pool of journalists” and “producing pro-ANC videos”.

The documents include several pages of analysis that suggest the ANC will struggle to poll above 50% and that the EFF is likely to come second.

This runs against most experts’ projections, which place the ruling party on between 55% and 60%, the DA on about 20% and the EFF on 15% at most.

In recent years, Russia has sought to play an increasing role in Africa and to boost its military and political presence on the continent. In October, Putin will host an Africa-Russia summit in the resort of Sochi. The Kremlin’s apparent strategy is to support incumbent presidents and to work against “pro-western” parties and reform movements.

According to the US special counsel Robert Mueller, who investigated Russia’s attempts to influence the 2016 US election, Prigozhin runs the notorious troll factory in St Petersburg – the Internet Research Agency (IRA) – and was responsible for an extensive social media operation in 2016 to mobilise support for Donald Trump and to disparage Hillary Clinton. Afric and the IAC are IRA offshoots, according to the documents.

Prigozhin is linked to the Wagner Group, a paramilitary organisation that has been active in several African states, including the Central African Republic. His political operatives popped up last year in Sudan and tried unsuccessfully to keep President Bashir in power. They also travelled to Madagascar ahead of elections there last November.

The South Africa operation was smaller and more lacklustre than Moscow’s recent extensive effort in Sudan. Nevertheless it appears to be an example of the Kremlin’s ambition, opportunism, and desire to stop dead in its tracks any “pro-western” shift, whether in Africa or elsewhere.

Bychkov denied any knowledge of the operation, the Daily Maverick reported, saying: “Yes, listen, well, if someone somewhere wrote something, it’s a fantasy. I have never dealt with all this African politics. I am in St Petersburg and doing other things.”

The ANC has had good relations with Moscow since the days of its long and bitter battle against the racist apartheid regime.

Harare City Council Implored To Respect Human Rights On Demolitions

State Media|The Combined Harare Residents’ Association (CHRA) has urged the Harare City Council to respect residents’ rights and follow the legal route when demolishing houses that were built without its approval.

Council recently warned owners of such properties that their structures faced demolition if they failed to regularise them in terms of city building by-laws.

CHRA director Mrs Loreen Mupasiri-Sani told the media yesterday that they were concerned about the complete disregard for the law by the City of Harare when carrying out demolitions.

She said council should first find an alternative place for the people likely to be affected by the demolitions.

“CHRA is deeply concerned by the complete disregard of the law by the City of Harare when executing house demolitions around the capital. They are creating a major humanitarian disaster because residents are not only left homeless but are exposed to various diseases as well,” she said.

“Inasmuch as we do not condone illegal housing structures, we note with concern that the City of Harare has failed to respect citizens’ constitutional right of freedom from arbitrary eviction as enshrined under Section 74 of the country’s supreme law.

“Arbitrary evictions not only violate the right to shelter but the right to life, which is enshrined under Section 48 of the Constitution. With regards to the illegal structures, the City of Harare’s Planning Department is equally to blame as they have been complicit on issues of double allocation of stands and of housing stands on wetlands.

“Corruption and abuse of power thus remains the main issues fuelling the sprouting of illegal structures in Harare,” she said.

In an interview with state media over the proposed demolitions yesterday, Harare City Council corporate communications manager Mr Michael Chideme said council’s preoccupation was not on demolitions but on giving security of tenure to residents through regularisation of their houses and to ensure that they pay for services which they have been enjoying for free.

He, however, said those who settled on wetlands, spaces reserved for the construction of schools, hospitals, clinics and business will be removed so that those pieces of land can be tirned over to their original purposes.

Own Correspondent|Zanu-PF national spokesperson Simon Khaya Moyo has scoffed at what he called the MDC’s attempt to involve the ruling party in its internal affairs after the High Court nullified the appointment of Nelson Chamisa and Eng Elias Mudziri as party co-vice presidents and directing the party to hold an extraordinary congress a month after the date of the order.

Speaking to state media after the shock High Court Ruling, Khaya Moyo, claimed the ruling by the High Court was purely an internal matter of the MDC and his party has no role in it.

“The court ruling by Justice Edith Mushore ordering the MDC party to hold an extraordinary congress within a month to elect a substantive leadership is purely an internal matter within the MDC,” he said.

“It has absolutely nothing to do with Zanu-PF and its visionary leader Cde ED Mnangagwa as insinuated by its spokesperson Mr Jacob Mafume. It is clear from the court proceedings that the applicant is an MDC member. Zanu-PF is too principled a party with a revolutionary history to engage in MDC shenanigans.

“President ED Mnangagwa is too pre-occupied with matters of the state economy as evidenced by the ‘Zimbabwe is open for business’ mantra and vision 2030.”

The High Court ruled that the decision by the late MDC-T president Morgan Tsvangirai to hand-pick two additional vice presidents was illegal and that the party should hold an extraordinary congress within a month using 2014 structures.

This follows an application by Gokwe district organising secretary Elias Mashavire challenging the 2016 decision by the late MDC-T leader who chose Chamisa and Engineer Mudzuri as his other deputies on top of Dr Thokozani Khupe, who had been voted in the congress of 2014 .

Chamisa and Khupe went their separate ways following the death of Mr Tsvangirai in February, last year.

At the time, Khupe insisted she was the bona fide MDC-T leader because she was the only one elected party vice president at congress.

Yesterday, Justice Edith Mushore ruled that the appointments by Tsvangirai Chamisa and Mudzuri as party co-vice presidents three years ago was invalid.

Chamisa and Mudzuri were listed as second and third respondents in the matter.

“The appointment of second (Chamisa) and third (Mudzuri) respondents as deputy presidents of the MDC party were unconstitutional and therefore null and void,” said Justice Mushore.

“The appointment of the second respondent as acting president and president of the MDC party were unconstitutional and therefore null and void.”

In addition, the judge ruled that all the decisions made under the Nelson Chamisa administration are invalid and he cannot preside over party matters.

“All appointments and or reassignments and all actions of the second respondent in his purported capacities as deputy/acting or incumbent president were unconstitutional.

“The first respondent (MDC) be and is hereby ordered to hold an extra-ordinary congress after the lapse of at least one month after the date of this order.”

Nullification Of Chamisa’s Presidency Is An Evil And Unholy Correlation Between Judiciary And ZANU PF

Dear Editor|It is now clear that ZANU PF government has been (and is) manipulating judiciary to suppress the voice of the people. The nullification of Nelson Chamisa Presidency is not only evil but a reflection of an unholy correlation between judiciary and ZANU PF.

I am afraid that ZANU PF and judiciary are now provoking people to go on rampage.  There is no doubt that our judiciary’s dead image has been further tainted by this politically motivated ruling against Nelson Chamisa.

This piece seeks to demonstrate that the latest court ruling will not work but it’s likely to cause anarchy and despondence in our country.

The then Vice President ED Mnangagwa’s suspension by the then legitimate Head of State President RG Mugabe was above board. What was interesting to note is that the then President appointed the Vice Presidents Mphoko and Mnangagwa. An appointee is like someone on probation, the one who appointed the appointee can terminate him/her anytime.

However, the judiciary of Zimbabwe overturned the expulsion because ZANU PF didn’t want Mphoko to lead (probably because he is a Ndebele). In politics Vice Presidents are terminated without court interferences, Jacob Zuma was terminated by Thabo Mbeki but nothing happened.

I was also equally shocked when the judiciary declared that the removal of RG Mugabe from power was not a coup. The army machinery were brought on streets, some (like Munetsi & others) died. The soldiers went to RG Mugabe’s residential home and forced him to resign. The judiciary of Zimbabwe legitimized the coup they failed to provide convincing reasons in their ruling.

Today, the same judiciary wants to frustrate the darling of the people Nelson Chamisa because he promised mass action soon after the MDC alliance’s congress.  The nullification of Nelson Chamisa’s Presidency is an attack on democracy and suffering Zimbabweans. Chamisa was not expelled like what happened to Vice President Mnangagwa. Surprisingly, the (expelled) ED Mnangagwa was given a positive ruling by the judiciary while the one appointed by the party’s highest organ is nullified by the same judiciary. Zimbabweans need answers to this?

The ruling party and judiciary should be very careful. Suck kinds of rulings are likely to push the citizens to a wall. The judiciary of Zimbabwe should try to be fair all the time. There is evidence that ZANU PF is interfering with the judiciary. We want peace in our country and not despondence.

This ruling by the subjective judiciary has already dealt a blow to the national dialogue. The only hope of Zimbabwe is on dialogue but the latest ruling has just destroyed our only hope. The ruling is also going to affect the Zimbabwe’s dying economy negatively. Investors are not comfortable in investing in areas that are undemocratic.

I urge MDC alliance to go ahead with the congress. Going to court is a waste of time because everything has been stage managed. Chauya Chauya.
