Murowa Pvt Limited In Unfair Workers Dismissal Storm

By A Correspondent- Murowa (Pvt) Limited is reportedly terminating contracts of employment for its workers amid claims that the termination is being effected by force on the pretext that there is consensus between the affected workers and the mining giant.

According to a source privy to development, the company has not revealed why the binding contracts are being terminated and why the workers are being presented as having consented to the termination when in fact they were just told that they had been dismissed without notice.

Alleged a whistleblower:

“Murowa recently dismissed five workers who were still under contracts. Some of the employees refused to sign the termination of employment contract but were, however, told that their contracts had been terminated as of February 28, 2021.”

In an audio in our possession, Keith Mashinga who is the Human Resource Superintendent at RZM Murowa confirms to one of the employees who had his contract terminated that working at the company had ceased, without both parties agreeing to sign the mutual termination contract

“…the effective date is 28 February as the letter says…that’s the termination date,” said Mashinga in a leaked audio.

This is despite the fact that RZM Murowa Mutual Termination Of Employment Contract addressed to one of the employees, stipulates in article V on Entire agreement, that the mutual agreement can however become valid if both the employer and the employee have signed the document.

Reads part of the contract:

“This agreement constitutes the entire agreements between the employer and employee. The agreement shall become a binding document upon both parties signing this document. No variation of this agreement shall be binding unless and to the extent that the same is recorded in a written document executed by both parties.”

Speaking to this publication another employee who spoke on condition of anonymity stated that he was unfairly treated when he was dismissed without valid reasons.

“I was not notified neither did they engage me hence the decision was unilateral and lacks legal impetus. These people take us as fools. The sad thing is that they are lying that i have agreed to this termination when in actual fact they are the ones who drafted an agreement without affording me my right in terms of the Labour Act to be consulted on this issue which affects my life and future. Life is tough in the country especially during this covid- 19 period. What surprises me is that they have put forth an agreement to me as a final document and it comes without any basis on how the employer arrived at this decision and the underlying causes.”

Murowa Pvt limited is also accused of effecting unsubstantiated transfers for some of its workers in a reshuffling exercise that has seen those targeted for unfair dismissal being moved from one department to the next.

Added another worker:

“For someone to be dismissed without a basis sets the wrong precedence for all of the workers here. If there is need for a trial to assess one’s performance in accordance with the laws of the companies, every worker must be accorded that opportunity and if they have not executed their mandate as agreed in the contract, they must go through the disciplinary process instead of being fired for no apparent reason.

“If you look at all this, it seems the other Murowa is wielding an axe and wants to make it look like the affected workers have agreed to this termination when they haven’t. Its clearly a violation of the company’s initial agreement to uphold the Code of Conduct.”

Efforts to get a comment from Mashinga proved futile as he referred this reporter to the Vice President Human Resources Administrator.

“Issues to do with media correspondents are being handled by the Vice President Human Admin,” he said.

Called for comment on the matter, the Vice President Human Resources Administration for Murowa Islam Chipango was evasive on the allegations and said:

“We are speaking to them and also through their lawyers. I think to them it will not be fair, and also to us it will not be fair. So I will not make any further comments regarding that issue. They are still our employees. They were not dismissed, we are still with them. We are talking to them, through their lawyers. We actually had a meeting with them on Friday. They might not necessarily be oming to work whilst we are still discussing, but they are still our employees.

“We let the matter be managed properly through legal moves following the provisions of the Labor Act, which is what we are doing. Let’s allow the process to proceed before concluding. In any case before concluding that this is fair or not fair I think we have not yet reached a stage whereby we can say an employee was fairly or unfairly dismissed or removed No one was removed from work, Those are our employees we still have them, we are still talking to them through their lawyers.”

The arbitrary termination of an employee contract of employment by an employer outside the four corners of the law is expressly prohibited in terms of the mandatory/peremptory provisions of Section 12 (4a) of the Labour Act.

The affected workers have engaged Caleb Mucheche and Partners Law Chambers for assistance.

In a letter that Caleb Mucheche and Partners Law Chambers drafted and signed addressing RZM Murowa and was seen by this reporter, it is a violation of the constitutional labour rights for the company to dismiss employees in the name of mutual agreement when both parties have not agreed on signing.

“The employer party purported to unilaterally terminate their employment contracts under the guise of alleged mutual termination of employment in terms of Statutory Instrument 15 of 2006 section 5 (c) but as a matter of fact and law there was no “mutual” termination as alleged at all.

For the avoidance of doubt, the law requires that any mutual termination of employment be in writing, agreed upon by the employer and employee parties and bear both signatures of the aforesaid consenting parties and not one party foisting it on another.”

“Suffice to underscore that our clients’ legal rights and jobs are jealously guarded from any illegal termination by Section 12B (1) of the Labour Act (Chapter 28:01) which categorically and equivocally provides in an instructive way that “Every employee has the right not to be unfairly dismissed.”

“In the same vein arbitrary termination of an employee contract of employment by an employer outside the four corners of the law is ex p re s s l y p ro h i b i te d i n te r m s o f t h e mandatory/peremptory provisions of Section 12 (4a) of the Labour Act.

Needless to reiterate that any unfair or unlawful termination of our clients, contracts of employment is a gross violation of their constitutional labour rights embedded in terms of Section 65 of the constitution of Zimbabwe,” read the letter.

Meanwhile Legal Practitioner Lazarus Maposa stated that the termination effected by Murowa pvt Limited failed to take into cognisence the basic rights and obligations of both parties in a contractual relationship.

“Termination on mutual agreement by any parties in an employment relationship is by no doubt one of safest forms of separation, primarily because of the mutual effect that brings the contractual protagonists at the core cause of the action.

Whilst the instant circumstances do not necessarily require the details of the contractual agreements that were subsisting at the time of termination, a basic understanding of the law is relatively sufficient enough to conclude on balance of probabilities that the termination that was effected by RZM Murowa (Pvt) Limited herein referred to as the employer failed to take regard of the basic rights and obligations of parties in a contractual relationship.

“It is common cause that the procedure for mutual termination is provided for under section 12(4a)(b) of the Labour Act, Chapter 28:01. It being a consented exercise, the law gives the parties an opportunity to exercise a collective and amicable role to discontinue with the employment relationship and to the separation packages accompanying thereof.

Whilst the law confers these rights to parties, due regard must be paid to the underlying principles that satisfy or qualifies a separation that culminates from a mutual route, and two following precautions are necessary; firstly the parties involved must be fully aware of the nature, form and legal consequences underlined thereto and secondly in doing so, the process would have been born out of meeting of minds by the parties, each one of them committing to the termination voluntarily.

“Once a termination that has been effected in the name of a mutual route fails to take due regard to the aforementioned precautionary steps, the termination becomes a unilateral decision by a single party and will not be accorded recognition as one that is born out of meeting of minds. The termination thus becomes unfair in all material respects. Having given that insight, the present circumstances swiftly draw my attention to the Supreme court case of Magodora and Others v Care International SC/91/13. Although I acknowledge that the circumstances in the cited case are distinguishable, there are pertinent remarks made by the court then and can hardly be left untold for purposes of emphasis.

The court had this to say: ‘…It is not open to rewrite a contract entered into between the parties or to excuse any of them from the consequences of a contract that they entered into freely and voluntarily accepted, even if they are shown to be onerous or oppressive…’

“The underlying principles of contract law are pertinent in the preceding remarks from the court. A binding contract is one that indicates the meeting of minds by two capacitated parties and this is often expressed through the appending of signatures .

One party thus cannot unilaterally vary an agreement to the consequence of unceremoniously rendering the other redundant without having to follow the due process that made the same come into being. In short, none of the parties will be excused for either the foreseen or the unforeseen consequences of the contracts and any form of variation should certify the tenets of our law failure for which the legal consequences will be far reaching,” said Maposa.

Maposa stated that the termination contract also lacks legal basis and that it draws the attention of Section 12B of the Labour Act which deals with unfairness in terms of dismissal.

“ I am of stern understanding that the terminations that were effected by the employer in the guise of a mutual agreement are a legal nullity, they lack the qualifications due, they suffer from legal barrenness and cannot sustain any valid argument before any competent court or tribunal of this land. Consequently the results born out of such barrenness are akin to putting nothing on something and then expect such to stand. The cause of action, the action itself together with its consequences are void ab- initio.

“I will not seek to pre-empt the legal fatalities that will obviously be suffered by the employer in this case, apparently the employer is likely to suffer the allegation of unfair dismissal, the fate for which follows the rules of the thumb. It is common cause that the consequences of unfair dismissal are far reaching and will take the two remedies one being the alternative.

At the conclusion of the case, the court is more likely than not to order reinstatement or payment of damages in the alternative and on condition that the employer is able to prove the supervening impossibility of the major.

“To sum up this I can say that a claim of unfair dismissal is bound to draw the attention of the court to Section 12B of the Labour Act, Chapter 28:01. Section 12B which deals with unfairness with regards to a dismissal will test the claim from three dimensions and them being; firstly the question of procedural or substantive defects arising from a dismissal that either does not adhere to the relevant code or chooses not to use one at all and is given in terms of section 12B (2), secondly the question of constructive dismissal given in terms of section 12B (3)(a), & lastly the question of legitimate expectation given in terms of section 12B(3)(b),” he said.

Harare City Council Blocks Investor From Refurbishing Rufaro Stadium

The Harare City Council (HCC) turned away an approach from another private investor who wanted to renovate Rufaro Stadium to modern standards, Acting Mayor, Stewart Mutizwa, has confirmed.

The HCC owns the Mbare facility which is in bad condition due to lack of proper maintenance.

And in April 2019, a private investor proposed to give the stadium an all-round make-over and would, in return, get the naming rights of the stadium.

Speaking to The Herald, Mutizwa said the deal fell through after the council rejected the move to rename the venue.

“Yes, there was an investor who came and proposed that they wanted to help in renovating Rufaro Stadium, sometime in April 2019,” the acting mayor revealed.

“The issue that led to the stalling, in the talks, was to do with the naming rights.

“The conditions were a thorn in the flesh and we couldn’t go with it. There are legal connotations involved there.”

New data finds that even listening to recordings of nature can boost mood, decrease stress, and even lessen pain.

The whoosh of wind through a stretch of forest, birds calling to one another as they land on branches, the gurgle of a brook over a rocky bed — these are the kinds of sounds that are not only calming, but could have profound health and well-being benefits, according to a research review in the April 2021 Proceedings of the National Academy of Sciences.

For the review, the researchers looked at 18 studies investigating the health benefits of natural sound; study participants listened to recordings of outdoor sounds in laboratory settings. Participants reported less stress and improved health outcomes, like decreased pain, after listening to recordings of nature sounds.

Water sounds, such as that gurgling brook or a steady waterfall, tended to be the most effective at improving positive affect (the psychological term for a more positive outlook or disposition and the experience of joy and interest), while bird sounds were best for lowering stress.

The study’s lead author, Rachel Buxton, PhD, a research associate and conservation biologist in the Department of Biology at Carleton University in Ottawa, says she isn’t surprised by the findings. “From an evolutionary perspective, humans are hardwired to attend to signals of danger and security. And an environment that is filled with natural sounds feels safe and allows us to let our guard down,” she says.

This research adds to a substantial body of evidence that proximity to nature and time spent outdoors is good for human health and well-being.

Research published in June 2019 in Scientific Reports found that people who spent just two hours per week outside in a natural setting (including town parks, state parks, woodlands, and beaches) reported greater well-being compared with people who spent less time outdoors.

When lower levels of government fail, or are assumed to have failed, the role of central government must be seen as one of providing solutions and interventions.

Many people forget that there are ministries responsible for roads and for water – focus is simply on council.

ZINWA and ZINARA are forgiven kids.

Central government cannot and can never argue that a lower tier of government has denied it solutions for the people – especially in crisis times.

A lower tier of government can, as is the case with Harare City Council, argue that higher level of government actions and misrule has denied it the opportunity to deliver services.

The same way government acts in terms of disease outbreaks, food shortages, fuel and electricity deficits should be applied in the areas of perceived failures in local government.

Chiredzi Ward 18 Councillor Mutubuki Granted ZW$5k Bail

By Jane Mlambo| Masvingo magistrate Patience Madondo has granted ZW$5000 bail to Chiredzi ward 18 councilor and MDC Alliance member Gilbert Mutubuki who was arrested and charged with addressing people during a meeting held in Chivi.

Posting on Twitter, Zimbabwe Lawyers for Human Rights (ZLHR) who send lawyers to represent Mutubuki said the combative MDC Alliance youth leader was ordered to report once every week at Triangle Police Station.

“We have ended the detention of Chiredzi Ward 18 Councillor Gilbert Mutubuki by convincing Magistrate Madondo to release him on RTGS$5 000 bail. As part of his bail conditions Councillor Mutubuki has been ordered to report at Triangle Police Station once every week,” said ZLHR.

Nine other people who were arrested for participating at the Chivi meeting were recently granted bail by Masvingo High Court Judge Justice Wamambo.

Minister, Police Boss Sued For US$436k

By A Correspondent| The family of the late Paul Munakopa has sued Home Affairs Minister Kazembe Kazembe, Zimbabwe Republic Police (ZRP) Commissioner-General Godwin Matanga and two police officers for causing the death of the late Bulawayo resident.

In summons filed recently at Bulawayo High Court, former ZLHR Board Chairperson and senior member Josephat Tshuma representing the Munakopa family, which includes his mother Erica Munakopa, his fiancée Tracey Mufidzi, his sister and parents and guardians of his minor children, said police officers acted negligently and caused the death of Munakopa by discharging firearms without due care and attention.

Tshuma said police officers are liable for their misconduct.Munakopa was shot several times on 23 May 2020 in Bulawayo by ZRP officers who were travelling in an unmarked vehicle and later died as a result of injuries he sustained.

Tshuma wants Kazembe, Matanga and the police officers namely Digson Nyoni, Langton Makonye and two individuals Ross Johnson and Kyle Bennet to pay damages amounting to US$436 000 for loss of support to the Munakopa family including Paul’s minor children, emotional shock and trauma caused by witnessing the death of Munakopa.

Out of the US$436 000, US$346 000 will be for loss of support, US$50 000 will be damages for causing the wrongful death of Munakopa and US$2 735 will cover funeral and related expenses.

Legislator Fights Massive Harare ‘Land Theft’

By A Correspondent| Harare North legislator Allan Norman Markham has sued President Emmerson Mnangagwa, City of Harare and Local Government minister July Moyo for conniving to transfer 273 hectares of prime land valued at over US$205 Million to a controversial businessman Kenneth Raydon Sharpe as payment for the construction of Airport Road, whose contract is fraught with illegalities.

The land in question 654 Pomona Township measuring 273 hectares has its title in the President of Zimbabwe.

According to a High Court application filed by Markham, Tavonga Savings Scheme and Jacob Pikicha, the agreement to transfer of 654 Pomona Township represents a complete fraud as the City of Harare officials who acceded to the deal did not have authority from the municipality.

“The Deed of Settlement executed on the 28th of May 2018 is nullity in that, the City of Harare through its council never authorized Herbert Gomba nor any other party to execute the aforesaid agreement,” said Markham.

He added that the registration of the Deed of Settlement, done in the High Court on the application of Augur OU under the Case Number HC4528/19 is a nullity which must be set aside as City of Harare nor Minister of Local Government did not have authority to execute the Deed of Settlement.

Markham further argued that the contract awarded to Ken Sharpe’s Augur Investments for the construction of Airport Road was done illegally as there was a caretaker council that approved the deal was illegal as its appointment was never gazetted in accordance with the law.

“We contend that the caretaker council that signed the Agreement with the City of Harare was illegal. It was illegal in that it was never gazetted. it was illegal in that a caretaker council could never have been appointed when lawful councilors have just been elected,” said Markham.

“Minister Chombo appointed Mahachi to loot the City of Harare. In terms of Section 47(2) (b) of the Urban Councils Act, elected councilors assume office immediately after the announcement of an election which in this case was made on the 30th of March 2008

“Minister Chombo thus acted unlawfully in appointing a caretaker council after councillors had been elected,” Markham added.

He further questioned the awarding of the Airport Road contract to Sharpe without going to tender as required by the Procurement Act of Zimbabwe.

“The Agreement between the City of Harare and Augur Investments was never subjected to tender and because of this it is a nullity.

“Moreover, in terms of the City of Harare’s its own internal procedures, any contract beyond the sum of ZW$50 000.00 required to be subjected to public tender. Therefore the City of Harare’s its own internal regulations were flouted,” he said.

In her response to Markham’s application, Tatiana Aleshima cited as the third respondent said Sharpe and his company Aurgur Investments were absolved by the Anti-Corruption Commission.

The Anti-Corruption Commission absolved the 1st responded, 2nd respondent and myself of any wrong doing. The case never went to court and therefore the statements are irrelevant and must be expunged from the record.

She further stated that the Land Commission Secretary Virginia Mabhiza, requested the commission to conduct an enquiry so as to clear Sharpe and herself and they were not implicated in the Uchena land commission report on illegal parcelling of state land.

Family Of Slain Byo Man Sues Kazembe Kazembe, Cop

The family of the late Paul Munakopa has sued Home Affairs Minister Hon. Kazembe Kazembe, Zimbabwe Republic Police (ZRP) Commissioner-General Godwin Matanga and two police officers for causing the death of the late Bulawayo resident.

In summons filed recently at Bulawayo High Court, former ZLHR Board Chairperson and senior member Josephat Tshuma representing the Munakopa family, which includes his mother Erica Munakopa, his fiancée Tracey Mufidzi, his sister and parents and guardians of his minor children, said police officers acted negligently and caused the death of Munakopa by discharging firearms without due care and attention.

Tshuma said police officers are liable for their misconduct.

Munakopa was shot several times on 23 May 2020 in Bulawayo by ZRP officers who were travelling in an unmarked vehicle and later died as a result of injuries he sustained.

Tshuma wants Kazembe, Matanga and the police officers namely Digson Nyoni, Langton Makonye and two individuals Ross Johnson and Kyle Bennet to pay damages amounting to US$436 000 for loss of support to the Munakopa family including Paul’s minor children, emotional shock and trauma caused by witnessing the death of Munakopa.

Out of the US$436 000, US$346 000 will be for loss of support, US$50 000 will be damages for causing the wrongful death of Munakopa and US$2 735 will cover funeral and related expenses.

EXPOSED: Zanu PF Member Who Contested Party Primaries in 2018 Paraded Among Defectors

By A Correspondent| Former Chipinge South legislator Wilson Tarugarira Khumbula who joined Zanu PF party in 2017 and contested in the party primary elections was this week paraded as a new defector showing desperation by the ruling to perpetuate a narrative.

Kumbula who was the President of ZANU Ndonga before he moved to the ruling party was paraded among opposition supporters from Manicaland who defected including MDC Alliance’s Patrick Chitaka, Samson Sithole and Crosswell Takawira Mugombi from the National Patriotic Front (NPF).

However sources in Chipinge confirmed that Kumbula famously known as Kujokochera was among candidates who contested in the Zanu PF primary elections seeking to represent Chipinge South in the 2018 parliamentary elections.

Kumbula eventually lost to the incumbent Enock Porusingazi who won the seat beating MDC Alliance’s Clifford Hlatywayo and Jerry Moyana of MDC-T.

“Kumbula was recruited into the party by war veterans who wanted his financial muscle to wrestle the seat from Porusingazi whom they did not like, we are surprised by reports that he is said to have defected now when he was even approved to participate in primary elections,” said the source.

Zanu PF has been on an overdrive, poaching opposition supporters with notable names who have crossed the floor being MDC Alliance deputy treasurer Lilian Timveos, former Kwekwe central legislator Blessing Chebundo and Obert Gutu among others.

Zimbabwe’s Judicial Independence In Intensive Care Unit As ED “Pushes” For Chief Justice Luke Malaba’s Stay

On 6 April 2021, the Zimbabwean senate passed Constitutional Amendment Bill (N0.1), which had been declared null and void by the Constitutional Court (ConCourt) on 31 March 2020, after it was unconstitutionally approved by the upper House on 1 August 2017 without the required two-thirds majority (54 votes out of the total 80 membership – meaning the Bill had failed to meet the required majority threshold by one vote).

This latest development has given Chief Justice Luke Malaba a new lifeline to controversially extend his reign beyond his looming retirement on 15 May 2021.

In the public interest, The NewsHawks rehashes and republishes a story it first ran on 19 February 2021 explaining why President Emmerson Mnangagwa desperately wants the amenable judiciary boss to remain in office for another five years renewable annually.

That way, Malaba’s new tenure would be entirely dependent on Mnangagwa’s whims and caprices, posing a fatal danger to judicial independence and democracy already in the intensive care unit.

The stakes are very high in this elaborate power retention plot by Mnangagwa and Malaba ahead of the 2023 elections, with far-reaching political, constitutional and rule of law, as well as governance and accountability implications.

By Owen Gagare- Despite the fact that Chief Justice Luke Malaba’s judicial reign is coming to an end by operation of law at midnight on 15 May 2021 when he turns 70, President Emmerson Mnangagwa wants him to stay on ahead of the 2023 elections in a brazen high stakes political power retention plot which marks a new low even by Zimbabwe’s poor democratic standards, top official sources say.

Malaba – who sits at the helm of the third pillar of state as head of the judiciary – has been Mnangagwa’s long-time ally, including when he was deputising the late former president Robert Mugabe, and also while serving as Justice minister well before the November 2017 coup.

Mnangagwa heads the executive, while the legislature is under Zanu-PF control.

The media, also known as the fourth estate or an informal fourth pillar of the state, is largely under Mnangagwa’s control, especially following the now so open capture of private media houses by his regime. The public media has always largely been Zanu-PF’s mouthpiece.

Ahead of the 2023 elections, six new television licences were recently given to the Mnangagwa administration’s allies, leaving a vast swathe of the media landscape under government or Zanu-PF control and influence as part of the political strategy of cooption and capture of dissenting voices with all sorts of incentives brandished to the targets in exchange for direct or tacit support.

The Chief Justice has been a vital cog in Mnangagwa’s political machinery, helping him to sanitise and legitimise the coup which toppled Mugabe, and thrust him into power. Malaba has also run the judiciary in a way that has helped Mnangagwa’s regime to consolidate power, government insiders say.

Crucially also, Malaba delivered the Constitutional Court judgment which confirmed Mnangagwa’s disputed 30 July 2018 presidential election victory, after dismissing an electoral petition by main opposition MDC Alliance leader Nelson Chamisa.

In a unanimous ruling of the nine judges of the country’s top court, Malaba said Chamisa had failed to prove allegations of fraud and manipulation of the vote during the presidential poll.

“Emmerson Dambudzo Mnangagwa is duly declared the winner of the presidential elections held on the 30th of July 2018,” Malaba said in his judgment which had attracted widespread attention at home and abroad.

It is understood that Malaba prevailed over some judges to ensure the unanimous ruling. Some judges wanted to dissent, but were whipped into line, sources said.

Government and judicial officials say Malaba was Mnangagwa’s strategic candidate to replace the late Chief Justice Godfrey Chidyausiku when he was Vice-President and Justice minister, while also plotting to succeed the late former president Robert Mugabe.

The Mnangagwa Zanu-PF faction, which battled for power against the rival group that had coalesced around Mugabe’s wife Grace, broadly wanted Judge President George Chiweshe to succeed Chidyausiku. But Mnangagwa personally thought Malaba was the man for the job.

Then as now, Mnangagwa still wants Malaba. Chiweshe, who has a military background, is now viewed by Mnangagwa’s faction as Vice-President Constantino Chiwenga’s loyalist. Mnangagwa and Chiwenga are currently locked in a simmering power struggle.

In his monograph on the presidential election, Excelgate: How Zimbabwe’s 2018 Presidential Election Was Stolen, former minister and MP Jonathan Moyo – an ex-Mnangagwa ally and now fierce critic – says the Zimbabwe Electoral Commission helped Mnangagwa to rig the 2018 elections.

Moyo, also a professor of politics, says Malaba dismissed Chamisa’s application soon after receiving it while in Pretoria, South Africa, where he was attending his son’s wedding, which suggests a predetermined outcome.

“While there, Malaba received a copy of Chamisa’s ConCourt application from a senior legal officer at the Judicial Service Commission as he was relaxing by the swimming pool at Pretoria Sheraton Hotel,” Moyo writes.

“After reading the application, Malaba turned to the judicial officer and asked him ‘Is that all’? to which the officer replied ‘Yes Sir’. Malaba then shook his head and remarked: ‘Ok, akula lutho la (There is nothing here).

“By those words, Malaba meant there was no case and he was going to have Chamisa’s application dismissed, even before the case was heard on its merits.”

Moyo further said Malaba’s attitude was not surprising given the close relationship between the two.

“When I worked closely with him and Emmerson Mnangagwa between March 2013 and December 2014, in the run up to his elecation as Vice-President and second secretary of Zanu-PF at the expense of Joice Mujuru, Mnangagwa used to refer to the late Chief Justice Godfrey Chidyausiku as mutengesi (sellout) and to Malaba as munhu wangu uyo (my man).”

In a July 2018 court ruling, Malaba said Mugabe freely and voluntarily stepped down, adding Mnangagwa’s assumption of power was done in terms of the law, although it was clear he had seized power through a coup. It was also common cause Mugabe has resigned at gunpoint.

This followed an application by the Liberal Democrats and Revolutionary Freedom Fighters, Bongani Nyathi, Linda Masarira and Vusumuzi Sibanda who contested the legality of the Mnangagwa-led government.

They argued that Mugabe tendered the resignation under duress – surrounded by the army – and that Mnangagwa’s ascendancy was unconstitutional.

They further said that the impeachment process that was instituted prior to Mugabe’s resignation was unlawful and that it served to coerce him to step down.

However, Malaba, sitting in chambers, ruled the constitutional challenge was frivolous and vexatious given that Mugabe carefully applied his mind and decided to step down without the embarrassment of impeachment.

“The former president’s written notice of resignation speaks for itself,” Malaba said.

“It sets the context in which it was written. He candidly reveals the fact that he had communicated with the Speaker of Parliament at 1353 hours. In the communication, the former President expressed to the Speaker his desire to resign from the Office of President.

“The Speaker must have advised him that for the resignation to have the legal effect of bringing his presidency to an end, it had to be communicated to him by means of a written notice.

“A written notice of resignation addressed to the Speaker and signed by the President, on the face of it, meets the first requirement of constitutional validity.”

Malaba argued that “what the former President said in the written notice of resignation is the best evidence available of the state of his mind at the time.”

“He (Mugabe) said he was free to express his will to resign. Not only does the former President declare in the written notice that he made the decision voluntarily, he gives reasons for doing so in clear and unambiguous language,” Malaba said.

“He said he was motivated by the desire to ‘ensure a smooth, peaceful and non-violent transfer of power that underpins national security, peace and sustainability’.”

Malaba said Mnangagwa’s assumption of office was therefore done in accordance with the provisions of the constitution after a vacancy had arisen due to the resignation. He did not address the issue of former vice-president Phelekezela Mphoko who was the next in line to take over in the interregnum, as the last acting vice-president after Mnangagwa’s dismissal, in terms of the constitution.

The Chief Justice’s judgment followed a November 2017 ruling by Justice Chiweshe which legitimised the coup. Chiweshe had ruled that the military intervention by the Zimbabwe Defence Forces which led to Mugabe’s resignation was constitutional, as the military sought to restore order in the country.

He said the military’s actions in intervening to stop the takeover of Mugabe’s functions “by those around him are constitutionally permissible and lawful”.

Malaba and Chiweshe thus played a critical role in sanitising and legitimising the coup which brought Mnangagwa to power.

A government official said Mnangagwa knows that Malaba is loyal to him and he should stay on for the 2023 elections and other issues.

“He has demonstrated beyond any reasonable doubt that he is loyal to the President. He helped him during Chamisa’s ConCourt application and played a big role to legitimise his rise to power. So that’s why the President wants him to remain in the position with 2023 in mind,” the official said.

All of Zimbabwe’s presidential elections since 2002, except the bloody 2008 poll, have been contested in the courts. After his appointment as chief justice in 2017, Malaba has sought to control the judiciary to help Mnangagwa’s administration consolidate power, insiders say.

As a result, there has been no separate or dissenting judgment in the higher courts since then. A separate judgement is when a judge differs with colleagues usually on reasons, but not necessarily on the conclusion.

The reasoning forming the basis of the court’s decision is separate from the judgment and is called “reasons” or “reasons for judgment.”

A dissenting judgement is when a judge differs with colleagues on a judgment and writes his or her own ruling.

Judges were always concurring until the Justice Rita Makarau judgment on Constitutional Amendment (No. 1) Bill of 25 February 2021 in which Justice Anne-Marie Gowora wrote a sharp dissenting ruling on how senate must handle the issue. This was before senate on 6 April passed the Bill, which now awaits presidential assent into law, amid a series of constitutional and legal irregularities.

Ironically in 2013, Malaba, then deputy chief justice, wrote a prominent dissenting judgement in a case in which political activist Jealousy Mawarire approached the courts to force the government to hold elections by 31 July that year, while opposition parties wanted reforms first to ensure credible polls.

The constitutional court granted the order, although Malaba and Justice Bharat Patel dissented and had “reasons for judgment” respectively, with the judgement directing Mugabe to hold elections by 31 July 2013.

This was despite the court finding that Mugabe was in breach of his constitutional responsibilities.

Malaba famously said the judgment “defied logic”.

“That is a very dangerous principle and has no basis in law. The principle of the rule of law just does not permit such an approach,” said Malaba.”I, however, refuse to have wool cast over the inner eye of my mind on this matter.”

In his book, Moyo also says in the run up to the coup, Mnangagwa worked hard to amend section 180 of the constitution to bar public interviews for the chief justice, deputy chief justice and judge president so that he could handpick his preferred judges when he came in.

“When the amendment was introduced by Mnangagwa shortly before the coup, its intended beneficiaries were Mnangagwa himself and Malaba. It is not surprising that, with the amendment in their pocket,- now Mnangagwa wants to raise the retirement age for judges to ensure that Malaba remains at the helm of the judiciary to do in 2023 what he did for him in 2018,” Moyo writes.

Moyo says those who saw Malaba as a jurisprudentially progressive judge have been surprised and disappointed by his support of the coup, and the subsequent repression.

“The point many have missed is that Malaba was anti-Mugabe and pro-Mnangagwa, not a neutral judge bound by constitutionalism. For Malaba it was personal and thus had nothing to do with justice, constitutionalism or progressive jurisprudence.”

Government officials this week said Moyo was correct in his assessment of Mnangagwa and Malaba’s relations and their 2023 electoral agenda.

Former Zim President’s Son Convicted Of Sex Attack In UK.

The former president of Zimbabwe Canaan Banana’s son, Martin, 49, admitted engaging in sexual activity with a female with a mental disorder impeding choice.

Martin from Liverpool initially denied the offence but later pleaded guilty to sexual activity with a female with a mental disorder, Liverpool ECHO reports.

Although the girl was over 16, the age of consent, it is a criminal offence for a care worker to engage in sexual activity with a patient who has a mental health disorder affecting choice. 

Cardiff Crown Court heard Banana, of Silvester Street, Vauxhall, used his position as her support worker to take advantage of her – telling her he liked her and that she “looked like an angel”.

The two exchanged messages about their relationship and matters came to a head in when Banana approached his victim in the hospital, hugged her, and kissed her on the lips using tongues.

A sentencing hearing today was told the victim reported the incident to the hospital and Banana’s employment was subsequently terminated.

Judge Daniel Williams, sentencing, said: “She was extremely vulnerable and had an emotionally unstable personality disorder as a result of a traumatic background.

“The offence was committed in a place where there’s a particular need for safety, where our most vulnerable in society are looked after by a profession which is shamed by this sort of behaviour.”

He admitted the defendant had “fallen far off the trust placed in him” but was now volunteering with a foodbank as part of his church.

Banana was sentenced to a two-year community order and was ordered to carry out the Horizon sex offenders’ programme, complete 25 days of a rehabilitation activity requirement, and to pay court costs of £1,500.

He will be required to sign the sex offenders’ register for 10 years.

Woman Axes Boyfriend For Going On A Beer Drinking Binge Alone

By A Correspondent A fifty year old woman from Binga reportedly struck her boyfriend with an axe at the back of the neck after he went to drink beer leaving her alone.

It is the state’s case that in March last year, the accused, Saria Munkombwe of Siawara village under Chief Siachilaba and Mr Gilbert Mumpande of neighbouring Siafugama village under Chief Saba fell in love and arranged to visit each other’s homestead weekly on a rotational basis.

They agreed to spend a week at Munkombwe’s homestead and the following at Mr Mumpande’s.

In October of last year, the duo arrived at Mumpande’s homestead who left in the morning to drink beer at a neighbouring village only to return around 8 pm.

Munkombwe had gone when he returned and he then followed her to her homestead that is said to be about 20 km from his.

Munkombwe came out when he knocked on the door, became violent, pushed him and went back into the house to take an axe.

She struck Mumpane on the back of the neck causing him to bleed profusely. In the morning, she took the axe and handed herself to the police.

Munkombwe pleaded not guilty to attempted murder charges when she appeared before Hwange regional magistrate Mr Collet Ncube.

She was remanded out of custody on her own cognisance to April 24 for the continuation of trial.

“Education Ministry Lied To Cabinet Over Learners’ Safety”: PTUZ Breathes Fire

THE Progressive Teachers Union of Zimbabwe (PTUZ) yesterday alleged that the Primary and Secondary Education ministry misled Cabinet into recommending the premature opening of schools on March 15, which has resulted in a surge in COVID-19 infections.

This comes at a time when the country has recorded a surge in COVID-19 cases, with most of the recorded positive cases last week being at learning institutions.

“Prince Edward High School recently recorded seven cases, Dove Secondary School in Mberengwa (40), Sacred Heart Primary School in Esigodini in Matabeleland South (117), Sacred Heart High School in Matabeleland South (114), Girls College in Bulawayo (3), Umzingwane High School in Matabeleland South (55) and Mzilikazi Primary School in Bulawayo (8),” PTUZ president Takavafira Zhou said in a statement.

“The ministry misled the Cabinet into recommending the open-ing of schools prematurely. Lies have short legs as shown by a quantum leap of COVID-19 cases in schools since last month.”

“To assume that this is a result of boarding schools allowing pupils to travel over Easter holidays as Taungana Ndoro (Primary and Secondary Education ministry spokesperson) would like us to believe is not only unfortunate but scandalous, vague and vacuous,” he said.

Ndoro said his ministry was working in collaboration with the Health ministry to contain the new COVID-19 outbreak at schools.

“In collaboration with the Health ministry, we are working tirelessly to contain the COVID-19 situation which has arisen in very few of our schools,” he told NewsDay yesterday. But Zhou said government should have consulted teachers’ unions as they were better informed about the situation on the ground.

“We, therefore, urge the government not to listen to propaganda manufactured by the ministry officials, but to sober professional trajectory from teacher unions.”

He said there was need to ur-gently test teachers, pupils and ancillary staff in schools to contain the spread of the disease.-newsday

FULL TEXT- Statement To African Union Member States On The Deployment Of The AstraZeneca COVID-19 Vaccine To The Continent And Concerns About Adverse Event Reports Coming From Europe

On 15 February 2021, the World Health Organization listed the AstraZeneca/Oxford COVID-19 vaccine for both emergency use and distribution via the COVAX facility. The African Regulatory Taskforce subsequently endorsed the WHO emergency use listing for this vaccine and the first shipments to Africa were initiated from the COVAX facility, with Ghana receiving the first consignment.

On 10 March 2021, the European Medicines Agency announced that four European countries suspended the use of the AstraZeneca COVID-19 vaccine (batch no. ABV5300) following reports of blood clots and bleeding disorders from Austria.

Similar events were reported by additional European members states during this time and by 15 March 2021, six countries suspended the use of the AstraZeneca vaccine (batch no. ABV5300), 11 countries paused their AstraZeneca vaccination campaigns entirely regardless of batch, while three countries indicated that they will continue use of the vaccine.

What do these reports mean?

Reporting of adverse events following immunization is part of the routine monitoring system put in place to ensure that vaccines remain safe and are being safely administered.

The adverse events reported from Europe are not listed as side effects associated with the AstraZeneca vaccine. To date, there has been no causal link established between the administration of the vaccine and the events reported. Most importantly, the number of blood clots and bleeding disorders reported is no more than would normally occur in the population.

As a precautionary measure, some European member States have opted to either suspend use of the specific vaccine batch concerned, or to pause their vaccination campaigns with the AstraZeneca vaccine entirely as investigations are ongoing.

Statement from the European Medicines Agency (EMA)

• On the 16th of March 2021, the European Medicines Agency issued a statement that its Pharmacovigilance Risk Assessment Committee (PRAC) is reviewing all reports of thromboembolic events occurring post vaccination.
• As of the 10th of March 2021, 30 thromboembolic events have been reported among more than 5 million people vaccinated with the AstraZeneca COVID-19 vaccine (batch no. ABV5300) in the EU. This number of thromboembolic events is no higher than what is seen in the general population in absence of the vaccine.
• Accordingly, the PRAC position is that the vaccine’s benefits continue to outweigh the risks and the vaccine can continue to be administered while investigations are ongoing. The PRAC will conclude its investigations and advise on any further actions needed during an extraordinary meeting scheduled for the 18 March 2021.

Statement from the World Health Organization

• On the 17th of March 2021,7 the World Health Organization indicated that its Global Advisory Committee is carefully assessing the latest safety data regarding the AstraZeneca vaccine. The World Health Organization reiterated the EMA position that the benefits of the AstraZeneca vaccine outweigh its risks and recommends that vaccination campaigns continue.

Statement from vaccine manufacturer, AstraZeneca

• On the 14th of March 2021,AstraZeneca noted it had undertaken a review of available safety data of more than 17 million people vaccinated in the European Union and United Kingdom. AstraZeneca found no evidence of an increased risk of pulmonary embolism, deep vein thrombosis, or thrombocytopenia in any defined age group, gender, batch or country.
• Furthermore, during clinical trials, the number of thrombotic events was small, and was lower in those receiving the vaccine as compared to those who did not. There has also been no evidence of increased bleeding in over 60,000 participants enrolled.
• AstraZeneca highlighted that during production of the vaccine, more than 60 quality tests were conducted by AstraZeneca and over 20 independent testing laboratories. There have been no confirmed issues related to any batch of the vaccine used in Europe, or the rest of the world.

AstraZeneca vaccine use in Africa

Africa is facing significant challenges in securing access to the COVID-19 vaccines needed to achieve its goal of vaccinating at least 60% of the continent’s population. As of 15 March 2021, 23.6 million doses of vaccine had been distributed on the continent. This corresponds to a continental coverage of only 1.7%. The AstraZeneca vaccine, allocated principally via the COVAX facility, accounts for 20.5 million (87%) doses and is the main vaccine used in Africa.

Africa CDC’s recommendations to AU Member States and health authorities

COVID-19 vaccines remain a strategic approach for the prevention of severe cases of and COVID-19 related deaths. Africa CDC encourages AU member States to facilitate rapid access to safe and effective vaccines that reduce COVID-19 severity and COVID-19 related hospitalizations. This is strategic for the control of the epidemic and the rapid return of the growth and development of the continent.

On Tuesday 16th of March, Africa CDC called for a special session of the African Taskforce for Coronavirus (AFTCOR), which include experts from across Africa and the world, to review the AstraZeneca situation. From the evidence available and discussed during the AFTCOR special session, Africa CDC concluded that the benefits accruable from the AstraZeneca COVID-19, continue to outweigh its risks. 

Accordingly, Africa CDC recommends:
• AU Member States continue to roll-out the AstraZeneca vaccine as part of their vaccination campaigns.
• AU Member States ensure the routine monitoring, reporting and evaluation of Adverse Events Following Immunization.
• Policy decisions pertaining to vaccination roll-out be based on evidence and thorough regulatory review processes.
Africa CDC will continue to monitor the adverse events following immunization with all the COVID-19 vaccines and provide evidence-based recommendations as the situation evolves.

Man Axes Brother Over Inheritance

By A Correspondent- A 40 year old Gokwe man fatally axed his younger brother following a dispute over who was the rightful heir of their parents’ homestead.

The accused, Khangelani Sibelo then handed himself over to the police.

Police said Sibelo had a dispute with his deceased brother, Sizani (30) and he then struck him twice with an axe killing him on the spot.

Midlands provincial police spokesperson, Inspector Emmanuel Mahoko confirmed the incident that occurred last Friday.

Mahoko also confirmed the arrest of a 22-year-old man from Chief Mataruse, Mberengwa after he fatally struck a fellow drinker with a chair following a dispute in a bar.

Insp Mahoko said the suspect, Lawrence Maphosa, was drinking beer inside Makandise Bottle store at Poland Business Centre, Mberengwa when he later picked up an argument with the now deceased, Godfrey Mangena.

Mahoko said:

Circumstances are that the suspect, Lawrence Maphosa was drinking beer inside Makandise Bottle store when he then struck Mr Godfrey Mangena with a steel chair in the head. Mangena suffered a fractured scalp and was rushed to Matibi Hospital where he was pronounced dead on arrival.

Covid-19 Helped Cure Cancer_ UK Doctors Believe

Doctors at a hospital in Cornwall in the United Kingdom believe COVID-19 helped a 61-year-old man who had recently been diagnosed with cancer to heal from the complication.

During a follow-up check on the cancer patient, doctors found that the tumours, which scans just a few weeks earlier revealed were littering his torso, had almost gone.

The patient had not yet started chemotherapy for the disease, called Hodgkin lymphoma, a type of blood cancer, therefore, the sudden disappearance of the cancerous cells was a complete mystery.Just a few days after receiving his diagnosis, the patient was admitted to the hospital with severe Covid-19.

It was a few weeks later that a CT scan to check his cancer revealed it had all but gone prompting his doctors to conclude that Covid-19 had destroyed his cancer by firing up his immune system enough to both see off the virus and to destroy malignant cells.

In a published report, Dr Sarah Challoner, one of the doctors treating cancer at the Royal Cornwall Hospital in Truro, said she believes that infection-fighting cells, called T-cells, fought the coronavirus and the cancer cells which they recognised as ‘foreign’.

She said:

We think Covid-19 triggered an anti-tumour immune response.

Meanwhile, Paul Hunter, a professor of medicine at the University of East Anglia warns cancer patients against deliberately exposing themselves to COVID-19 to get healed. Hunter said:

The message for anyone with cancer is that, deliberately exposing yourself to Covid-19 in the hope it will heal you is much more likely to lead to your untimely demise than to a cure.

There is also a case reported last August in the journal Acta Biomedica of a 20-year-old man with non-Hodgkin lymphoma who was also healed of cancer after contracting COVID-19.

In the report, doctors at Cremona Hospital in Italy reported that the patient’s cancer appeared unresponsive to chemotherapy or radiotherapy but a few weeks after testing positive for Covid-19 in early 2020, scans showed cancer had gone.

Another case was reported at the Humanitas Research Hospital in Milan, Italy in February in the European Journal of Nuclear Medicine and Molecular Imaging in which all signs of lymphoma rapidly disappeared in a 61-year-old man who caught Covid-19.

However, British experts stress that such cases of spontaneous remission are probably more likely to occur in blood cancers such as lymphoma than solid tumours, such as breast, lung or prostate.

Gold Deliveries To Fidelity Improve

By A Correspondent- Gold deliveries to Fidelity Printers and Refineries (FPR) improved by 54.57% in March 2021 to 1.8 tonnes from February’s 1.17t as weather conditions improved.

Mining activities across the country were affected by wet weather conditions that saw mining operations suspended after a number of mines collapsed killing miners.

It has also been argued that miners were not delivering gold to FPR due to late payment and unattractive prices.

According to Bloomberg Business, gold worth a staggering $1.5 billion is being smuggled out of the country every year.

Despite the rise in gold deliveries in March, cumulative deliveries for the quarter saw a 30.48% decline to 3.98t from the 5.72t achieved in the 2020 first quarter.

Gold is one of the major foreign currency earners for Zimbabwe, therefore, a decline is a cause for concern for the Southern African country.

Zimbabwe also gets foreign currency from diamond, platinum and agricultural products such as tobacco.

The tobacco selling season recently commenced with stakeholders expecting that this year’s produce to bring more forex because of its high-quality grade.

Valerio Sibanda, Matanga Sued Over Land Grab

Goede Hoop Farm proprietors have approached the High Court for a second time seeking to rescind offer letters for land granted to Zimbabwe Defence Forces commander Valerio Sibanda and police commissioner-general Godwin Matanga.

In the court application, Andreas, Peter and Shaun Livaditakis cited Matanga, Sibanda, a provincial lands officer and the Lands ministry as respondents.

According to an affidavit submitted by Andreas, the Sibanda and Matanga invaded Goede Hoop in Mazowe, Mashonaland Central, in 2018 and demanded that the family vacate the premises as ownership had been transferred to them.

“Sometime in 2018, the first (Matanga) and second (Sibanda) respondents stormed the farm and told me that I needed to leave the farm as the farm was now theirs.  

“I showed them the proof that I was in lawful occupation, but they forcibly entered the farm and started accommodating in my own structures on the farm.

“The first and second respondents then gave me copies of their offer letters some two months after they stormed the farm.  

“I then noted that the two documents are not really offer letters per se, but mere letters written by the fourth respondent (Lands ministry) to the first and second respondents confirming the allocations of the applicants’ farm,” Andreas submitted.

He is arguing that the Goede Hoop Farm belongs to the family as they entered into an agreement with the government in 2001 which converted the farm into State land.

“The applicants then agreed with the government that since the land programme had to be carried, it was important that the applicants be given and allocated Goede Hoop Farm and that the rest of the farms be given to other beneficiaries…

“The Goede Hoop Farm is protected under a Bilateral Investments Protection and Promotion Agreement (Bippa).  

“What it means is that even though the farm is now State land, it falls under Bippa and is protected accordingly,” Andreas submitted.

He is demanding that the hectares of land granted to Matanga and Sibanda be declared unlawful and that the respondents give him and his fellow applicants unhindered access to the farm.

Matanga, Sibanda and the Lands ministry are yet to respond to the lawsuit.

Notorious Byo Carjacker Arrested

Police have arrested a suspected notorious Bulawayo carjacker who went about robbing people at night in different parts of the country.

Edmore Zinyoro (27) originally from Gutu was arrested in Harare on Friday after police circulated his details appealing to residents to help them apprehend the carjacker.

He was arrested with his two accomplices Calvin Nere and Munekani Zinyoro.

In his series of crimes, Zinyoro would allegedly be in the company of four accomplices and would use machetes, knives and axes to threaten his victims before robbing them.

Bulawayo provincial police spokesperson Inspector Abednico Ncube said police were grateful to members of the public who had acted swiftly to help police fight crime.

He said his recent incident occurred along Robert Mugabe Way and 1st Avenue around 12 midnight about two weeks ago.

“As the police we would like to appreciate the media fraternity and the members of the public that worked hand in hand with the police leading to the arrest of Zinyoro. His arrest cleared a number of outstanding robberies and unlawful entries dotted around the country,” said Insp Ncube.

“We are still battling with armed robbers that are terrorising our community and if we continue working as a unit with residents we are assured of a peaceful Bulawayo and Zimbabwe eventually.”
Insp Ncube said Zinyoro’s last known address was 3156 Simbi Park, Kwekwe.

“For his recent incident, the complainant was driving his Silver Honda Fit while coming from Inyathi to Bulawayo when he was approached by Zinyoro. He was in the company of five unknown accomplices at Green Bus Stop near Nkenyane which is along the Bulawayo-Inyathi Highway,” said Insp Ncube.

“The complainant was hired by Zinyoro and his five accomplices. When the gang reached Bulawayo, they then connived and robbed the complainant of his vehicle at knife point around midnight.”
He also said the six men took the complainant and dumped him along Rosetta Road in Montgomery suburb which branches off from Harare road.

“Zinyoro also tied the complainant’s legs and hands with seat belts and drove away leaving him helpless. A few days later, police received information that the stolen car was spotted at Zinyoro’s house in Kwekwe and a follow up was made which led to the recovery of the Silver Honda Fit,” he added.

High Court Registrar Quizzed Over Failure To Take Orders From Ndewere

High Court registrar Donald Ndirowei last Friday gave evidence before a tribunal headed by retired judge Justice Simbi Mubako, which was tasked to investigate and recommend whether or not suspended judge Justice Erica Ndewere was still suitable to sit on the bench following allegations of incompetence levelled against her.

Justice Ndewere stands accused of failing to complete and submit written judgments on time, a charge she denies.

Ndirowei’s evidence pertained to allegations that Justice Ndewere failed to give reasons why she refused to give bail to an accused person, Tapson Nyowani, and also failed to give written reasons for the appeal for bail in the Supreme Court.

In his evidence, Ndirowei admitted that Justice Ndewere had requested him by telephone on November 27 last year to collect from her home the written judgment for Nyowani for typing as she was on suspension.

When Justice Ndewere’s lawyer Beatrice Mtetwa asked him why he did not pick the judgment from Justice Ndewere’s home, Ndirowei said it was because he had already finished writing his witness statement against the judge.

Justice Mubako then further asked him to give a good reason why he failed to assist the Supreme Court to do its work.

Ndirowei said his understanding was that High Court staff should not deal with any person who has been suspended from work.

Justice Ndewere has denied the allegations of gross incompetence, and maintained that she was being victimised by Chief Justice Luke Malaba for refusing to accept his unlawful instructions to deny bail to MDC Alliance vicechairperson Job Sikhala and former Public Service minister Priscah Mupfumira.

Justice Ndewere asked the tribunal to explain how Nyowani’s issue was smuggled onto the charge sheet on December 8, 2020, long after the tribunal had been sworn in.

She said she had followed the practice direction for bail judgments, as no judge provided written judgments for bail unless it was requested by the Supreme Court.

She said after her salary and benefits were restored, including her driver, she then sent him to deliver the judgment for typing and had it filed as judgment No HH788/20 on December 7, 2020.

She told the tribunal that she was not informed of the new charge, and had a right to be heard before being punished.

Justice Ndewere further argued that the charge was not authorised by the Judicial Service Commission (JSC) and was not covered by the terms of reference of Proclamation No 7 which was gazetted by President Emmerson Mnangagwa on November 5, 2020.

She said the charge was, therefore, unlawful and should be struck off the charge sheet.

Justice Ndewere also submitted that the tribunal secretary Virginia Mabhiza, who is also the Justice ministry secretary, had no legal authority to generate new charges that were not authorised by the JSC.

Earlier, she had demanded that Mabhiza be removed from the tribunal secretariat to allow for separation of power among arms of the State as she represented the Executive .
The tribunal hearing continues today.

Goreraza (37) appeared before magistrate Moreblessing Makati together with his accomplices, Paul Sithole (45), Aaron Muchenje (31) and Trymore Madzitire (36).

The four were remanded in custody to today for bail ruling.

Goreraza is Grace’s son from her previous marriage.

The complainant in the matter is Prince Danda of Number 9 Calgary Farm, Mazowe, who is employed by Tian Bao Mineral Industry (Pvt) Ltd as managing director.

Allegations are that on April 10 this year at around 7am at Tian Bao Mineral Industry (Pvt) Ltd Smithfield Farm, Mazowe Farm owned by the late former President Robert Mugabe and his wife Grace, Sithole, Muchenje and Madzitire dismantled a processing plant under the instructions of Goreraza.

The trio then loaded a gold smelter, ball mill, electric motor, approximately 200 ball mill metal balls, 50 ball mill liners, 20 slay pumps and 15 angle iron bars into a truck using a crane.

They were intercepted by Mazowe police and arrested.

The value of the stolen property is US$130 0000 and only property worth US$30 0000 was recovered.

Govt Decision To Suspend June Exams Irks Parents, Teachers Happy

Parents are up in arms with government over its recent decision to suspend Zimbabwe Schools Examination Council (Zimsec) June “O” and “A” Level examinations.

Most parents interviewed by NewsDay yesterday said they had spent a lot of money on extra lessons, only to be told that the examinations had been suspended.

Government last week announced that it had suspended the June Zimsec examinations that normally cater for supplementary examinations, citing COVID-19 delays in writing and marking of the November/ December examinations, which negatively impacted the timing and the cycle of public examinations.

Information minister Monica Mutsvangwa last week said the suspension of the June 2021 examinations would allow teachers and learners to focus on November examinations.

But parents said their children could not spend another full year preparing for examinations as they would have to fork out more money for extra lessons.

National Association of School Development Associations Committee chairperson Max Mkandla described government’s decision as irrational and unilateral.

“The government should put its house in order. The school calendar should have been clear at the beginning and this was supposed to be discussed in Parliament. How can we allow all the candidates to be grouped together in November, neglecting the mid-year national examinations as usual?” Mkandla said.

He said the nation should work towards raising education standards, not to destroy them.

Bulawayo City Council health, housing and education committee chairperson Sinikiwe Mutanda said most of the parents were against the suspension of the June examinations.

“The problem is that people complain while seated and they do not know which offices to approach when faced with such setbacks. A lot of people from different groups are against the idea; the government should listen to people’s plea. This is something that we had before preparing for these examinations and students will lose knowledge by staying too long without writing,” Mutanda said.

But Zimbabwe Teachers Association chief executive officer Sifiso Ndlovu welcomed government’s decision to suspend the examinations, saying it gave learners ample time to prepare for examinations in November.

Land Barrons, Thugs Block Tongai Mnangagwa Southlea Park Tour

By James Gwati- Suspected land Barrons in Harare South’s Southlea Park high-density suburb, at the weekend sponsored local thugs and blocked the area’s Member of Parliament, Tongai Mnangagwa from meeting with residents.

Mnangagwa was scheduled to visit the area on Saturday where he wanted to interact with residents and hear their concerns.

His failed trip was also going to be a fact-finding tour which he wanted to use to lobby for the urgent regularisation of the peri-urban setting.

According to the Zimbabwe National Organisation of Associations and Residents Trusts (ZNOART), an Apex body representing all associations and residents which had organised the visit by Mnangagwa, violent youths disrupted the tour.

“ There was a barbaric scene yesterday in Southlea park when violent youths attacked residents who were waiting to be addressed by Honourable Tongai Mnangagwa,” said ZNOART.

The residents association said the violent youths were sent by one Pfundukwa whom Southlea Park residents have been are accusing of selling stands on wetlands and on areas set aside for schools, clinics etc illegally.

Odzi Dumps Homestead, Relocates To The Mountain To Stay With “God”

By James Gwati- An Odzi family man has abandoned his home and taken his family to stay in a “sacred” mountain saying he is following God’s voice.

Ringisai Manjeese (49), his wife wife Therieza Mawoyo, as well as their four children aged 15, nine, six and two moved to the Urase Mountain in Katsunzuma Village which they now claim to be their home.

As a result, the children no longer have access to education, social life, health care and proper housing.

The Manjeeses left their home in November 2020 and have been staying in a very small one-roomed plastic shack on the Urase Mountain with no clean water and ablution facilities at the site.

Manjeese and his wife claim that they live on the principles of the Bible, which they have christened their own ‘constitution.’

The family used to stay in Chipfatsura Village under Chief Marange.

Efforts to bring Manjeese before Chief Marange’s court have failed as he has snubbed the summons on many occasions.

Chief Marange confirmed the case and said his office is in the process of making a police report. He said:

He refused to appear before my court. I have sent my aides to look for him, but they couldn’t find him. He hid from them so our next move is to involve the police.

No one is supposed to be staying in the mountains, particularly our sacred Urase Mountain.

Pastor’s Son Killed At Church House…

THE late founder of the Apostolic Faith Mission (AFM) of Portland Oregon, Reverend Morgan Sengwayo’s youngest son, Missiondom succumbed to injuries sustained following a brutal attack by thugs at a church house in Pelandaba suburb in Bulawayo.
Missiondom was the only surviving son of the late Rev Sengwayo who died in 1982.

He died on Sunday evening at United Bulawayo Hospitals (UBH) where he had been on a weeklong life support following the attack.

The assault, which occurred a week ago, has left the Pelandaba community with more questions than answers amid strong suspicions by family members that the murder could be linked to a rivalry within the trouble-ridden church.

The church popularly known as Ivangeli, was founded by Missiondom’s father in 1955.

Family spokesperson Dr Rayban Sengwayo said Missiondom (46) was attacked by unknown suspects before the assailants left him lying unconscious in one of the rooms at the house.

He said he was discovered by a church member who had brought him food at his room.

“About a week ago, Missiondom was found at his house in Pelandaba with severe head injuries and bruises all over the body. He had been attacked the night before and left for dead and we took him to UBH where he had been in a coma since then,” he said.
Dr Sengwayo alleged that Missiondom was a victim of infighting in the church.

“We are not sure what happened but police are investigating the circumstances surrounding his killing. What we know is that there has been some long-standing rivalry between Missiondom and some church members aligned to a rival faction who didn’t want him to stay at the church house,” he said.

“There is a fight happening at the church resulting in splits. When Missiondom’s camp lost in court following a series of litigations, everyone was evicted from the church premises. We are saying, no matter what hatred in the church, I don’t think it was fair for Missiondom to be a victim of that anger.”

Dr Sengwayo said the rival faction failed to evict Missiondom since the house is still registered under his father’s name.

He said Missiondom’s wife died in Botswana recently. However, due to the closure of the country’s borders as part of Covid-19 regulations, he failed to travel to the neighbouring country for his wife’s funeral.

“Sadly, we were in the process of assisting Missiondom to renew his expired travel documents to facilitate his travel to Botswana so that he could see where his wife was buried,” said Dr Sengwayo- Chronicle

Binga Woman Exes BoyFriend For Leaving Her Alone

By A Correspondent -A 50-year-old Binga woman allegedly struck her live-in boyfriend once on the head with an axe accusing him of leaving her alone at home as he went for a beer drink.

Saria Munkombwe (50) of Siawara village under Chief Siachilaba and Mr Gilbert Mumpande of neighbouring Siafugama village under Chief Saba fell in love sometime in March last year and came up with a weekly roaster whereby they would rotate visiting each other’s home.

Mr Mumoande’s age was not given.

They agreed to spend a week at Munkombwe’s homestead and the following at Mr Mumpande’s.

There is a distance of about 20km between the two villages.

Sometime in October last year, the two lovebirds arrived at Mr Mumpande’s home and the following day he left home for a booze.

She packed her bag and went back to her homestead and when he returned at night, she was gone and he followed her.

When Mr Mumpande knocked on her door, she came out and became violent.

She allegedly pushed him and he fell down before she picked an axe and struck him on the back of the head leaving him for dead.

Munkombwe pleaded not guilty to attempted murder when she appeared before Hwange regional magistrate Mr Collet Ncube.

She was remanded out of custody on her own cognisance to April 24 for continuation of trial.

Prosecuting, Mr Vumizulu Mangena said the lovebirds went to Mr Mumpande’s place of residence on October 12 to spend seven days together.

The following day, Mr Mumpande left home to go and drink beer at a nearby village and returned home at around 8PM.

She had left and he followed her to her home and was attacked.

Woman (50) Kills Lover

A fifty-year-old woman from Binga reportedly struck her boyfriend with an axe at the back of the neck after he went to drink beer leaving her alone.

It is the state’s case that in March last year, the accused, Saria Munkombwe of Siawara village under Chief Siachilaba and Mr Gilbert Mumpande of neighbouring Siafugama village under Chief Saba fell in love and arranged to visit each other’s homestead weekly on a rotational basis.

They agreed to spend a week at Munkombwe’s homestead and the following at Mr Mumpande’s.

In October of last year, the duo arrived at Mumpande’s homestead who left in the morning to drink beer at a neighbouring village only to return around 8 pm.

Munkombwe had gone when he returned and he then followed her to her homestead that is said to be about 20 km from his.

Munkombwe came out when he knocked on the door, became violent, pushed him and went back into the house to take an axe.

She struck Mumpane on the back of the neck causing him to bleed profusely. In the morning, she took the axe and handed herself to the police.

Munkombwe pleaded not guilty to attempted murder charges when she appeared before Hwange regional magistrate Mr Collet Ncube.

She was remanded out of custody on her own cognisance to April 24 for the continuation of trial.- Chronicle

A 40-year-old Gokwe man fatally axed his younger brother following a dispute over who was the rightful heir of their parents’ homestead.

The accused, Khangelani Sibelo then handed himself over to the police.

Police said Sibelo had a dispute with his deceased brother, Sizani (30) and he then struck him twice with an axe killing him on the spot.

Midlands provincial police spokesperson, Inspector Emmanuel Mahoko confirmed the incident that occurred last Friday.

President Chamisa Accuses Mnangagwa Of Abusing Civil Servants

Tinashe Sambiri|MDC Alliance leader President Nelson Chamisa has challenged the Zanu PF regime to stop abusing civil servants by giving them worthless salaries in RTGS dollars.

Restore Civil Servants Dignity, President Chamisa Challenges Mnangagwa

“Exorbitant Passport Fees Unreasonable”

Tinashe Sambiri|The MDC Alliance has slammed the decision by the Zanu PF regime to peg prohobitive passport fees at a time civil servants and the majority of workers are earning worthless salaries.

In a statement, the MDC Alliance secretary for Home Affairs Rittah Ndlovu described the decision to hike passport fees as unreasonable and anti-poor.

Former First Lady Grace Mugabe’s son, Russell Goreraza, was yesterday remanded in custody at the Concession Magistrates Courts on charges of stealing gold processing equipment at Tian Bao Mineral Industry in Mazowe. 


Goreraza (37) appeared before magistrate Moreblessing Makati together with his accomplices, Paul Sithole (45), Aaron Muchenje (31) and Trymore Madzitire (36). The four were remanded in custody to today for bail ruling.

Goreraza is Grace’s son from her previous marriage. The complainant in the matter is Prince Danda of Number 9 Calgary Farm, Mazowe, who is employed by Tian Bao Mineral Industry (Pvt) Ltd as managing director.

Allegations are that on April 10 this year at around 7am at Tian Bao Mineral Industry (Pvt) Ltd Smithfield Farm, Mazowe Farm owned by the late former President Robert Mugabe and his wife Grace, Sithole, Muchenje and Madzitire dismantled a processing plant under the instructions of Goreraza.

The trio then loaded a gold smelter, ball mill, electric motor, approximately 200 ball mill metal balls, 50 ball mill liners, 20 slay pumps and 15 angle iron bars into a truck using a crane.

They were intercepted by Mazowe police and arrested. The value of the stolen property is US$130 0000 and only property worth US$30 0000 was recovered.

Alderman Howera died at Bonda Hospital at the weekend.He was the councillor for ward 15, Mutasa District.

Alderman Howera was a true shepherd of the electorate.

“The MDC Alliance mourns the sad passing of #Alderman Howera who died at Bonda Hospital.

He will be buried on Monday in Sherukuru Village under Ishe Mudzindiko. Alderman Howera was a councilor for Ward 15 in Mutasa District. #MHSRIP,” MDC Alliance posted on Twitter.

Sengwayo’s Youngest Son Killed

The late founder of the Apostolic Faith Mission (AFM) of Portland Oregon, Reverend Morgan Sengwayo’s youngest son, Missiondom succumbed to injuries sustained following a brutal attack by thugs at a church house in Pelandaba suburb in Bulawayo.

Missiondom was the only surviving son of the late Rev Sengwayo who died in 1982. He died on Sunday evening at United Bulawayo Hospitals (UBH) where he had been on a weeklong life support following the attack.

The assault, which occurred a week ago, has left the Pelandaba community with more questions than answers amid strong suspicions by family members that the murder could be linked to a rivalry within the trouble-ridden church.

The church popularly known as Ivangeli, was founded by Missiondom’s father in 1955. Family spokesperson Dr Rayban Sengwayo said Missiondom (46) was attacked by unknown suspects before the assailants left him lying unconscious in one of the rooms at the house.

He said he was discovered by a church member who had brought him food at his room.

“About a week ago, Missiondom was found at his house in Pelandaba with severe head injuries and bruises all over the body. He had been attacked the night before and left for dead and we took him to UBH where he had been in a coma since then,” he said.

Dr Sengwayo alleged that Missiondom was a victim of infighting in the church.

“We are not sure what happened but police are investigating the circumstances surrounding his killing. What we know is that there has been some long-standing rivalry between Missiondom and some church members aligned to a rival faction who didn’t want him to stay at the church house,” he said.

“There is a fight happening at the church resulting in splits. When Missiondom’s camp lost in court following a series of litigations, everyone was evicted from the church premises. We are saying, no matter what hatred in the church, I don’t think it was fair for Missiondom to be a victim of that anger.”

Dr Sengwayo said the rival faction failed to evict Missiondom since the house is still registered under his father’s name.

He said Missiondom’s wife died in Botswana recently. However, due to the closure of the country’s borders as part of Covid-19 regulations, he failed to travel to the neighbouring country for his wife’s funeral.

“Sadly, we were in the process of assisting Missiondom to renew his expired travel documents to facilitate his travel to Botswana so that he could see where his wife was buried,” said Dr Sengwayo.

Spokesperson of the rival faction Mr Caleb Fefe Chidhakwa said Missiondom had turned into a nuisance.

“Missiondom was a drug addict and abused alcohol such that he would vandalise church property. He would come home at night and find the gate locked and then jump over the precast wall,” he said.

“As a church, we would take him to Ingutsheni Central Hospital for rehabilitation but his relatives would go and fetch him.

“Upon his return he would cause mayhem and continue with unruly behaviour and destroying things. In fact, he was a member of the faction that was evicted from church premises through court rulings, but out of pity we spared him since he is the son of our founder.”

Mr Chidhakwa alleged that Missiondom was being used by the rival camp to cause chaos within their camp.

The church has, since the death of Rev Sengwayo, been plagued by numerous divisions which resulted in several splinter groups.

Contacted for comment, Bulawayo police spokesperson Inspector Abednico Ncube and the AFM of Portland Oregon’s regional superintendent Rev Oniyas Gumbo both said they were yet to get detailed information.

Mourners are gathered at Number 159 Matopos Road, Fourwinds in Bulawayo. Burial is set for Friday at Greengables Farm on the outskirts of Bulawayo. -Chronicle

New data finds that even listening to recordings of nature can boost mood, decrease stress, and even lessen pain.

The whoosh of wind through a stretch of forest, birds calling to one another as they land on branches, the gurgle of a brook over a rocky bed — these are the kinds of sounds that are not only calming, but could have profound health and well-being benefits, according to a research review in the April 2021 Proceedings of the National Academy of Sciences.

For the review, the researchers looked at 18 studies investigating the health benefits of natural sound; study participants listened to recordings of outdoor sounds in laboratory settings. Participants reported less stress and improved health outcomes, like decreased pain, after listening to recordings of nature sounds.

Water sounds, such as that gurgling brook or a steady waterfall, tended to be the most effective at improving positive affect (the psychological term for a more positive outlook or disposition and the experience of joy and interest), while bird sounds were best for lowering stress.

The study’s lead author, Rachel Buxton, PhD, a research associate and conservation biologist in the Department of Biology at Carleton University in Ottawa, says she isn’t surprised by the findings. “From an evolutionary perspective, humans are hardwired to attend to signals of danger and security. And an environment that is filled with natural sounds feels safe and allows us to let our guard down,” she says.

This research adds to a substantial body of evidence that proximity to nature and time spent outdoors is good for human health and well-being.

Research Shows Green Space Benefits Health in Many Ways
Research published in June 2019 in Scientific Reports found that people who spent just two hours per week outside in a natural setting (including town parks, state parks, woodlands, and beaches) reported greater well-being compared with people who spent less time outdoors.

Billiat Scores Crucial Goal For Kaizer Chiefs

Zimbabwe international Khama Billiat scored an important goal for Kaizer Chiefs against Horoya in the CAF Champions League, as the Soweto giants booked a place in the last eight of Africa’s premier club competition.

The diminutive winger, who recently recovered from a leg injury which kept him out of action since January, started for Gavin Hunt’s men in attack.

Schools Rescue The Depleted National Blood Supplies

By James Gwati-The National Blood Services Zimbabwe (NBSZ) has been receiving significant blood donations since the beginning of the new school calendar in March.

The COVID-19 induced lockdown measures had a negative bearing on blood collections as it interrupted the steady flow of blood donations from high yielding panels especially schools and tertiary institutions that contribute more than 70% of blood to the national blood bank.

NBSZ communications officer Mr Ephraim Mubayi said:
‘‘Since the opening of schools there has been significant improvement on blood stocks nationally. This is mainly attributed to the support we have received from both ministries of Primary and Secondary Education and Higher and Tertiary Education who have so far granted us the letters of approval for NBSZ to access their facilities,” he said.

Chiwenga Parades Chilonga Village Heads

By James Gwati-Vice President Constantino Chiwenga at the weekend paraded Chilonga traditional leadership and ordered them to order local villagers to accept his government’s anti-development grass project.

Chiwenga’s visit to Chilonga followed resistance by local villagers to pave way for a grass keeping project which the government wanted to give to a so-called investor.

“More empowerment projects are coming here, that is Chilonga Two and Chilonga Three. Again the Government is in the process of making sure that each district in the country gets at least 200 hectares under irrigation, and we expect everyone to benefit in the agriculture value chain,” Chiwenga told village heads on Sunday.

Mwonzora Demands Stake In Mnangagwa’s Administration

By James Gwati-Daglous Mwonzora, the president of the minor MDC-T party said he wants to join hands with President Emmerson Mnangagwa so that they work together.

Mwonzora who has of late become a darling of the state media said if Mnangagwa agrees to work with him, they will change the lives of Zimbabweans.

“We are prepared to discuss with Government,” he told the state media. 

“We are discussing with Government in Parliament anyway; we are discussing with Government in the local authorities anyway. So we need to discuss so that the lives of our people are transformed for the better.

“The MDC-T wants to work with all the stakeholders, including the Government for the betterment of the lives of the Zimbabwean people. That is why we have called for dialogue. We have a number of issues that will help to improve the lives of our people,”he said.

Zanu PF Hijacks Harare City Council

By James Gwati- Local government minister, July Moyo has moved to take over operations of the capital city as he plans to appoint a new Local Government Board (LGB) comprising Zanu PF apologists.

According to the state media, July Moyo said the new board would expedite the resolution of labour issues involving senior council officials and the appointment of substantive department heads in councils.

“The city (Harare) presently suffers a corporate governance malaise following the expulsion or suspension of a huge chunk of its councillors, while most senior management positions are vacant,” said Minister Moyo in a speech read on his behalf by his ministry official at the weekend.

“I want to assure you that we shall within the shortest possible time, appoint the Local Government Board so that all outstanding disciplinary cases may be concluded, while new substantive appointments are made to fill the existing gaps which are also contributing to the operational challenges presently facing the City,” he said.

Residents Resort To Open Defacation As Council Employees Strike

The job action by City of Harare employees has deepened a sewer burst crisis that has a potential of causing a serious waterborne disease outbreak in Harare as residents opt to open defecation.

According to the City of Harare “the impact of the lockdown and the crippling financial impasse took their toll on the City, employees responded by withdrawing their labour over Personal Protective Equipment and allowances resulting in accumulation of unattended sewer blockages particularly within the (CBD) Central Business District and high density residential areas.”

“The Acting Director of Harare Water further reported that with regards to water distribution was limited activity due to industrial action undertaken by the workforce at Council’s various sites”, reads part of the Environmental Committee minutes.

Residents of Harare are currently grappling with unattended sewer bursts and poor water supplies, a situation that has a potential of causing a serious waterborne disease outbreak.

In New Tafara residents have made makeshift septic tanks that are filled with raw sewerage as the City has failed to respond to sewer chokes. “We have made these pits for sewer to flow in since we have had no response from the local authority” said a dejected woman from Tafara.

Areas such as Glen View, Budiriro and Highfields yards of houses have been flooded by unattended raw sewerage. In Glen View people affected by the sewer chokes are defecating in plastic bags and then throw at illegal dumpsites which have sprouted within the location.

The situation in most high density areas requires a serious emergency humanitarian response as it is degenerating to the total collapse of service delivery likened to the 2008 era.

Despite the fact that Council communication indicates that there has been a job action in the local authority local plumbers are citing that there is lack of rods to attend to the sewer chokes and protective clothing.

CHRA is calling for an urgent humanitarian intervention to prevent a serious health time bomb currently brewing in most high density suburbs and the City of Harare to resolve labor disputes with its employees which is another contribution to the crisis.

Mwonzora Hero-Worships Mnangagwa

By James Gwati -MDC-T leader Daglous Mwonzora has praised Zanu PF and its President Emmerson Mnangagwa’s anti-people policies.

Mwonzora showered praises to Mnangagwa through the state media on Monday when he said that Mnangagwa’s policies such as the National Development Strategy 1 (NDS1) was going to turn around the fortunes of the country.

NDS1 is Mnangagwa’s ambitious policy which he dreams to attain what he calls Vision 2030 of achieving a middle-income economy in the next decade.

“What is important is that all the stakeholders must work together towards implementing Government policies. A good blueprint needs implementation, it needs the cooperation of everyone. All stakeholders must be involved,” said Mwonzora.

Mother Throws Baby Into Croco Infested River

By James Gwati- A teen mother from Masvingo’s Nyevedzanai Village in Chivi District has shocked locals after she allegedly threw her two-year-old baby into the crocodile-infested Tugwi River following a dispute with her brother over her alleged promiscuous behaviour.

The baby, which was thrown into one of the biggest rivers in the province which also feeds into the giant Tugwi-Mukosi Dam, has not been found since the incident happened on 1 April.

Masvingo police spokesperson Inspector Kudakwashe Dhewa confirmed the incident to the state media and said the teen mother has been arrested while officials are still searching for the baby.

“On 1 April the 17-year-old female juvenile was coming from fetching water at a nearby stream when her 16-year-old brother saw her from a distance talking to a local boy, which did not go down well with the brother. When they went back home, they had an argument and the juvenile mother got angry and told him that she was going to commit suicide,” he said.

Insp Dhewa said later that day the teen mother took her two-year-old daughter to the river which is two kilometres away from their homestead and allegedly threw her into the water. She later came back and told her brother that she had thrown the baby into the river.

Insp Dhewa said the brother told their grandmother who reported the matter to the police leading to the teen being arrested. Villagers told Sunday News that the teen mother’s brother was not happy with the way his sister had been behaving for some time.

Willard Katsande says he is unfazed by speculation surrounding his future as he believes the media is only stirring it to make money through his name.

The Zimbabwean has been linked with an exit at Amakhosi when his contract expires at the end of the season.

Speaking to the Sunday Mail, Katsande brushed aside talk that his days could be numbered at the Soweto giants and blamed the reports on the media.

“Obviously, speculation will always be speculation,” the midfielder said. “Each and every day there will be speculation about something.

“We are professionals and we have contracts to honour. The most important thing is to focus on a day to day basis, that is, to try to give your best every day at training and try your best to improve the team. Whatever happens in future we are going to deal with it when the season ends.”

Meanwhile, Katsande has put all contracts talks with other clubs on hold.

The midfielder is prioritising Kaizer Chiefs before considering a move away from Naturena, his agent Sean Roberts revealed last week.

Vongai Tome Fondled By Police, Arrested Now Denied Bail

By A Correspondent| MDC Alliance member Vongai Tome has been denied bail by Magistrate Mangosi in Harare Today.

Tome was arrested while raising alarm that a police officer had touched her breast during a melee between police and journalists at the Harare Magistrates Court on 6 April.

The MDC Alliance Masvingo provincial Secretary General councillor Gilbert Mutubuki has been arrested. The Chiredzi Rural District Ward 18 Councillor, who is being represented by Martin Mureri, apparently communicated to colleagues saying “I am currently detained at Law and Order section at Masvingo Central police station.”

The Masvingo Criminal Investigations Department is also said to have communicated: “Councillor Mtubuki participated in a gathering with intention to cause public violence.”

AFCON Tournament : Musona Calls For Proper Preparations

Knowledge Musona believes the Warriors need proper preparations for them to succeed at international tournaments.

The national team recently qualified for the AFCON 2021 for the third successive time but there have been fears it will not perform well there.

Zimbabwe have never gone beyond the first round in all of their appearances at the continental competition.

Speaking to the NewsDay, Musona has explained what the Warriors require to succeed in thier Afcon campaign in Cameroon in January next year.

“Every team’s success starts with good preparations, so there are no two ways about it. If you have good preparations, results will come easy on the field of play,” he said.

The Warriors will warm up for the tournament with six World Cup qualifying games between June and October.

Zimbabwe will face South Africa in the first match to be played at home in June before travelling to Ethiopia a few days later.

The qualifiers resume in September with back-to-back clashes against Ghana in the first week of that month.

The Warriors will then travel to South Africa between October 10 and 12 and wrap up their campaign with a home match against Ethiopia the following week.

And the captain is hoping for a positive start in the World Cup Qualifiers.

“It is good to start and finish at home because if you do well in the first game and collect three points, it gives you confidence going to the next games. Mwonzora Politics Being Driven By Money

By Leonard Koni| MDC-T President Douglas Mwonzora’s appetite for money rather than politics of saving the people from the sharp piercing jaws of Zanu PF will dearly cost him.
It is unfortunate that he is reading the Zimbabwean political book upside down and failing to take note of the current political mood on the ground.

Most Zimbabweans now liken him to the late Bishop Abel Muzorewa who was a bonafide sell out during the Ian Smith regime. 

What Mr Douglas Mwonzora is failing to understand is that most ordinary Zimbabweans who are prospective voters, are not constitutional gurus and all what they want is a leader who is ready to take them to Cannan a promised land. 

They trust a leader who does not dance to the tune of their oppressor. 

Zimbabweans know the kind of the leader they want and trying to force them on someone else will not work. They have suffered a lot under Zanu PF government and they are looking for a leader who will bring them out of economic quagmire and political morass.

The social media is even rejecting him. Mwonzora continues to make some glaring blunders and recently he voted for  Constitutional  Amendment Bill 1 which gives powers to President Emmerson Mnangagwa to appoint and handpick his cronies as judges.

Mr Mwonzora was one of the architects who drafted the Constitution and inserted the provision for public interviews of judges.

He has traded strong politics of checks and blances with politics of the belly and bootlicking.

For the love of money Mr Douglas Mwonzora has decided to leave the people’s struggle which was started by the late political icon Mr Morgan Tsvangirai.

His attempt to meet the people of Kuwadzana Constituency last week hit a brickwall. This shows that Mwonzora has a lot to prove his political muscles to the country.

Only a few days, this Mwonzora said he had a large following and was questioning people on what yardstick are/were they using to arrive at a conclusion that has no followers.

Their failed trojan horse is failing to gain traction in the political ecosystem and that is why there is all this political grandstanding from the MDC-T leader.

The bridegroom is right at the door steps but the preparations to receive her are in shambles. Time is running out for this surrogate party to put its house in order.

Douglas Mwonzora is trying hard to push for a dialogue with President Emmerson Mnangagwa. Inviting him for a dialogue is like inviting an armature boozers football club to play a premiership game. There will be no competition at all.

Douglas Mwonzora is a shameless puppet who is being used the threat of recall to get “MDC-T Senators” to vote with government in the Senate in exchange for Zanu PF support to fight the MDC-A. He has sold out the legacy of the late Morgan Tsvangirai. 

Whilst other countries are moving forward like Kenya and continue to progress as far as recruitment of judges including the Chief Justice is concerned, our country with the aid of Mwonzora is busy shredding the same constitution which he worked tirelessly to draft.

Giants Kaizer Chiefs, Mamelodi Sundowns Through To CAF Champions League Quarter Finals

The list of teams that have qualified for quarter finals of the 2020/21 season of the Champions League is now complete.

South African clubs Kaizer Chiefs and Mamelodi Sundowns are the only teams from the COSAFA region to book their places in the knockout round.

Tanzania’s Simba SC finished as Group A winners to progress through while the other five qualified sides are from North Africa.

The quarter-final draw will be held on 30 April 2021.

The first legs are scheduled for 14 and 15 May, and the second legs are will be played on 21 and 22 May 2021.

Alderman Howera died at Bonda Hospital at the weekend.He was the councillor for ward 15, Mutasa District.

Alderman Howera was a true shepherd of the electorate.

“The MDC Alliance mourns the sad passing of #Alderman Howera who died at Bonda Hospital.

The MDC Alliance Youth Assembly applauds President Nelson Chamisa for sending a special delegation composed of top party leadership yesterday to the Haruzivishe family following the jailing of Makomborero Haruzivishe on Tuesday.

The visit to Mako’s rural home in Masvingo by the Secretary General Charlton Hwende led delegation must not only be viewed as a sign of astute leadership but of a true revolutionary spirit of solidarity which is the life blood of people’s struggles against oppression.

As an Assembly, we feel energized and reinvigorated by such revolutionary gestures from the party’s top leadership especially at a time when many of our youth leaders are languishing in prisons for demanding a just society.

Yesterday’s visit is not only a guard of honor to Cde Mako and his family but a deluge of emotional support to the Youth Assembly at large and all progressive young people in the country who are still trying to come to terms with his incarceration.

Its a fact that Murowa Diamonds is the largest producer of high grade diamonds in Zimbabwe. Management and shareholders of Murowa Diamonds are the most cruel and capitalists to ever exist on this planet earth.

For over 20 years of mining high grade gems the local community has virtually nothing positive to talk about as the primary custodians of the diamonds. Murowa ward is the developed area in the world with a diamond mining company. When they came they promised employment, tarred roads, electricity, piped water, empowerment of locals and
environmentally friendly mining.

The obtaining situation makes the locals regret big time. No employment for locals as the manager hire his homies, no roads as employees fly to and from work, no portable water as water bodies are heavily polluted by mine waste.

A lot of villagers had their homes destroyed due to have blasting and some now
suffer from dust induced diseases.

Yes this mine has brought more misery and suffering to the locals. The mine has done nothing in terms of CSR and ploughing back into the community. Management has really jailed the community as the local leadership is bribed with ice-cream. I really wonder if to MP is aware of the existence of this mine as he himself is a missing person.

Why the Sounds of Nature Are So Good for Health and Well-Being
New data finds that even listening to recordings of nature can boost mood, decrease stress, and even lessen pain.

The whoosh of wind through a stretch of forest, birds calling to one another as they land on branches, the gurgle of a brook over a rocky bed — these are the kinds of sounds that are not only calming, but could have profound health and well-being benefits, according to a research review in the April 2021 Proceedings of the National Academy of Sciences.

For the review, the researchers looked at 18 studies investigating the health benefits of natural sound; study participants listened to recordings of outdoor sounds in laboratory settings. Participants reported less stress and improved health outcomes, like decreased pain, after listening to recordings of nature sounds.

Water sounds, such as that gurgling brook or a steady waterfall, tended to be the most effective at improving positive affect (the psychological term for a more positive outlook or disposition and the experience of joy and interest), while bird sounds were best for lowering stress.

The study’s lead author, Rachel Buxton, PhD, a research associate and conservation biologist in the Department of Biology at Carleton University in Ottawa, says she isn’t surprised by the findings. “From an evolutionary perspective, humans are hardwired to attend to signals of danger and security. And an environment that is filled with natural sounds feels safe and allows us to let our guard down,” she says.

This research adds to a substantial body of evidence that proximity to nature and time spent outdoors is good for human health and well-being.

Research Shows Green Space Benefits Health in Many Ways
Research published in June 2019 in Scientific Reports found that people who spent just two hours per week outside in a natural setting (including town parks, state parks, woodlands, and beaches) reported greater well-being compared with people who spent less time outdoors.

Special Tribute To Alderman Shepard Howera

Still waters run deep, a gentle giant gone too soon – Alderman Shepard Howera

On the 4th of April in 1974 the Howeras were blessed with a son who was delivered at the Roman Catholic run St Barbaras Hospital in Ward 13 of Mutasa District.

They named him Shepard as if they knew he was going to be a shepherd, not of livestock but, of a troubled and oppressed people seeking a better life for themselves and their children. Today his flock has been left shepherdless.

He was the seventh born in a family of 8. Shepard went to Berthania Primary school before he proceeded to Sherukuru school for his secondary education up to O level. He went to Harare where he had a stint in the Ministry of Transport. He trekked back to his roots in 2006 and his return coincided with local government elections that were to be held that year. This was a period only the brave could dare step forward and present themselves as candidates for the opposition. Doing so was akin to commiting suicide because Zanu PF then, just as now, did not take lightly anyone who was prepared to challenge their stranglehold on power. Shepard, a quiet, thoughtful, determined and courageous 32 years young man became the pioneer opposition Councillor for ward 15 Mudzindiko in Mutasa district together with 3 others – Ward 8 (Sahumani) Clr Aaron Kamhungira, Ward 18 (Dunsinane-Sheba) Alderman Ringoziwa and Ward 2’s (Penhalonga Tsvingwe) Clr Machiriri in the 31-seat Zanu PF dominated council. Clr Howera served in the Road Works and Planning committee where he distinguished himself as a focused, knowledgeable and steady leader. He put the experience he had gained from the Min of Transport to good use. His performance, recognised by his peers, was to take him to greater heights in the coming years.

In 2008 Clr Howera was retained as the MDC candidate for Ward 15 and he romped to victory past Zanu PF with ease. Mutasa Central recorded a clean sweep of the 12 seats, Mutasa North won 12 of the 13 seats whilst in Mutasa South MDC won 4 of the 6 seats to give an overwhelming majority of 28 versus 3 for Zanu PF. At its first sitting of council in 2008 Shepard was elected by his peers to shepherd the Mutasa RDC as Council Chairperson. The period under his stewardship saw Mutasa District experiencing unprecedented levels of progress and development. This was underpinned by professionalism, respect for diversity and allowing professionals at council to execute their mandate without undue political influence.

Clr Howera took over a broke Council in 2008 during the worst hyperinflation era in the history of our country and the world. He led with wisdom and passion, setting council on a recovery path that saw staff retention, improved systems, purchase of utility vehicles and motorbikes, road equipment (grader), installation of a backup generator at the council offices and computerisation of the Registry department. He oversaw the construction and renovations of health facilities at Nyamukwara and Tsvingwe. Grading of and maintenance of roads became priorities at council and construction of bridges were undertaken. Examples include Mapfekera-Njerama road on Nyadera River (ward15) and Ward 6’s (Gatsi ) Buyoyo causeway. His new position allowed him to sit in all committees hence he was able to guide development in all spheres of life throughout the district. He pushed for the establishment of Berthania Secondary, Saruwaka Primary and facilitated Primrose Pre-schools during his tenure. In Agriculture and self sustenance programs he invited the Irrigation department and Mudzindiko irrigation scheme was surveyed. It is now awaiting funding by the government but all the paperwork has been approved.

Unfortunately the coming of 2013 and the electoral disaster suffered by MDC led to the change of guard at Mutasa RDC. Clr Howera routinely won his seat but due to the slight majority of 16 to 15 Zanu PF took the chairmanship. Politics of development, respect and tolerance were replaced with politics of partisanship, interference with professional conduct of business at council and outright politicization of council business. Life was never the same and Mutasa as a district has regressed ever since.

In December 2016 Clr Howera was accorded his status as an Alderman after diligently serving MRDC for 10years.

In 2018 Alderman Howera again retained his seat which he held until the day we lost him at Bonda Hospital on Friday the 9th of April, only 5 days after his 48th birthday.

At the Party level he served as the Provincial Secretary for Local government from 2014 to 2019.

Alderman Howera was a rare breed of a leader. Sambiri was a humble man, an individual who listened more than he spoke, a remarkable Clr, an unassuming community member, a dedicated activist, an unapologetic democrat and patriot who loved his country so much that he was prepared to go through hell so that Zimbabwe becomes a better place to live in.

Alderman Shepard Howera believed that one day Zimbabwe is going to come right. He believed Zimbabweans are going to enjoy freedom in their own motherland and Zimbabwe is going to prosper under a new government. He believed that Zanu PF is going to leave office and allow capable people to run this country. He believed in Change not for sake of it but real change.

His loss is, not only to his immediate family but, to Ward 15, Rusanhi area, Mutasa Central Constituency, Mutasa District, Manicaland and Zimbabwe.

Alderman Howera is survived by his wife and 4 children (3 daughters – Cathrine, Mutsa, Nokutenda and a son, Wayne).

He is also survived by Ward 15, Mutasa Central Constituency and Mutasa District.

Go well Sambiri. We are going to fondly remember you.

MDC Alliance delegation visits Makomborero Haruvizishe’s rural home

Striking Harare City Council Employees Push Residents To Open Defecation

The job action by City of Harare employees has deepened a sewer burst crisis that has a potential of causing a serious waterborne disease outbreak in Harare as residents opt to open defecation.

According to the City of Harare “the impact of the lockdown and the crippling financial impasse took their toll on the City, employees responded by withdrawing their labour over Personal Protective Equipment and allowances resulting in accumulation of unattended sewer blockages particularly within the (CBD) Central Business District and high density residential areas.”

“The Acting Director of Harare Water further reported that with regards to water distribution was limited activity due to industrial action undertaken by the workforce at Council’s various sites”, reads part of the Environmental Committee minutes.

Residents of Harare are currently grappling with unattended sewer bursts and poor water supplies, a situation that has a potential of causing a serious waterborne disease outbreak.

In New Tafara residents have made makeshift septic tanks that are filled with raw sewerage as the City has failed to respond to sewer chokes. “We have made these pits for sewer to flow in since we have had no response from the local authority” said a dejected woman from Tafara.

Areas such as Glen View, Budiriro and Highfields yards of houses have been flooded by unattended raw sewerage. In Glen View people affected by the sewer chokes are defecating in plastic bags and then throw at illegal dumpsites which have sprouted within the location.

The situation in most high density areas requires a serious emergency humanitarian response as it is degenerating to the total collapse of service delivery likened to the 2008 era.

Despite the fact that Council communication indicates that there has been a job action in the local authority local plumbers are citing that there is lack of rods to attend to the sewer chokes and protective clothing.

CHRA is calling for an urgent humanitarian intervention to prevent a serious health time bomb currently brewing in most high density suburbs and the City of Harare to resolve labor disputes with its employees which is another contribution to the crisis.

ZAPU Official In Soup For Being A Zanu Pf Mole

Suspended Zapu organising secretary Derek Katsenga has been accused of being a mole and working with Zanu-PF to lure the party into joining the Political Actors Dialogue (Polad) initiated by President Emmerson Mnangagwa.

Katsenga was suspended from the opposition party last month over allegations of fanning tribalism and factionalism in Mashonaland Central province.

His suspension comes at a time when the party is inching towards its watershed elective congress which has been moved from April 30 to August.

Party insiders told Southern Eye that Katsenga had allegedly struck a deal with Zanu-PF to ensure that the incoming Zapu leader joins Polad.

“The secret deal was well at an advanced stage and it sent the party leadership into action resulting in immediate suspension of the frontman of the deal (Katsenga),” said a Zapu source.

“Several officials from some provinces had been mobilised into supporting the secret deal with one of them, Edward Chodewa openly attacking the acting party president Isaac Mabuka for allowing the suspension of Katsenga,” the source said.

After Katsenga’s suspension by Zapu secretary-general Strike Mkandla, Chodewa wrote to Mabuka protesting the decision.

But internal sources said the party was well aware that the faction that Katsenga worked with was receiving huge funding from the State in order for it to aid the agenda of a one-party State that Mnangagwa is allegedly pushing for.

Zapu spokesman Iphithule Maphosa could neither confirm nor deny the allegations levelled against Katsenga.

He said the matter had since been referred to the party’s arbitration body.

“We still maintain that any dialogue that could take place must be outside the control and instigation of Zanu-PF or Mnangagwa.

“We have prescribed the national transitional authority as the only vehicle towards a sustainable transition to a truly democratic and developmental dispensation.

“We haven’t shifted and any party official or group that deviates from this will be in violation of the very beliefs and policy positions of Zapu. On the Polad issue, Zapu does not subscribe to that cosmetic process.

“We believe in real dialogue that will pluck our country from this dictatorship and maladministration ditch.”

Katsenga on Thursday said the allegations were part of a smear campaign against him.

“The problem is that these people, who claim to be national leaders, have not been visiting the provinces for many years and when they recently visited the provinces to campaign, people did not know them.

“The provincial chairpersons asked them who they were.

“In fact there are provinces that have not seen these leaders for more than 10 years and all of a sudden they saw them coming to campaign.

“The provinces where these leaders have not been visiting are Harare, Mashonaland East, West, Central, Masvingo and Manicaland.

“They are saying I am influencing the people in these provinces just because as an organiser I am always with the people in these provinces.”

He said he was not involved in the Polad issue, adding that as the Zapu organising secretary he was also using his resources to assist the party.

He said due to the attacks on his person, the party leadership in the northern provinces was planning to boycott the congress.-newsday

Second Hand Bales Confiscated

By A Correspondent- Police in Marondera on Saturday night intercepted three trucks transporting over 400 bales of second-hand clothes.

The three trucks are being held at Marondera Police Station while their drivers were detained pending investigations.

The arrested trio are Nommater Mutsanza (31), Godfrey Matimati (49) and Chengerai Gonzo (35), all of Mutare.

Officer-in-Charge (operations) in Mashonaland East province, Assistant Commissioner Amon Ndou yesterday said the suspects were arrested in Marondera along the Harare-Mutare Highway.

“Three trucks were intercepted at the 74km peg along the Harare-Mutare Highway carrying second-hand clothes, which are believed to have been smuggled. Three suspects have since been arrested,” Ndou said.

He said police in Marondera received a tip-off that there was a grey Toyota Hilux which was escorting the trucks from Mutare towards Harare.

Acting on the tip-off, the trucks were spotted by the team at Murewa turn-off before police officers alerted their colleagues who were at a checkpoint.

He said on arrival at the checkpoint, the leading truck was signalled to stop, but it did not comply, resulting in police officers firing shots and deflating its tyres.

“All the truck drivers were arrested and are currently assisting police with investigations at Marondera Central. The contraband comprising hundreds of bales is also at the same police station,” Ndou said.

Chitungwiza Men Fight Over Married Vendor

A row over a married woman landed a Chitungwiza man in deep trouble yesterday after two men clashed.

Emilia Katonha, a married vendor at Chikwanha Shopping Centre, was yesterday at the centre of the drama after her boyfriend, Tonderayi Munodawafa, caught her with another man.

Katonha and Munodawafa are both married and claim their affair gave birth to a now four-year-old child.

According to Munodawafa, he was about to take Katonha as his second wife. “I caught her with another man who she said was her uncle, but surprisingly, she didn’t know his last name and neither did he know hers.

“I confronted the two when the man in question started calling her and she couldn’t pick up his calls in my presence.

“I forged a plan and followed her to a nearby road where she was picked up. “After catching them, I reported the matter to the police, who referred us to the Civil Court,” said Munodawafa.

Katonha later pressed charges against Munodawafa, claiming he had stolen her documents. “He is not my husband and he is always jealous of me whenever he sees me with another man.

“I have been seeing him for the past six years now and he introduced me to his wife and we are in good books.

He is just insecure and pretends like he knows all my relatives; he is not entitled to anything that’s mine. “After our misunderstanding,

He took away papers from my residential stand claiming the property was his when I used my own money to buy it,” said Katonha.

She said she only got involved with Munodawafa as revenge for her husband’s cheating. “My husband is stationed in Gweru. He is fully aware of my relationship with Munodawafa and they are on speaking terms.

“I have three children with my hubby and I only started seeing my Munodawafa after catching my husband in bed with several other women.

“I tried breaking up with Munodawafa a couple of times, but we ended up together again,” she said. Munodawafa’s wife said she was aware of the two’s relationship and was surprised they had taken their matter to the police.

“This woman was introduced to me by my husband and I accepted her as his soon-to-be second wife.

“However, I am surprised why they have decided to take their fight to the public.

I live in Seke rural and had to rush here to try and resolve the issue. “I wasn’t aware that she was married and had other children and the man she was caught with was not even her close relative, which means she was seeing another man behind our husband’s back,” she said.

Efforts to get comment from the man caught with Katonha were fruitless last night as his mobile phone went unanswered and was eventually switched off.

Nurses Victimised Over PPEs Protests

By A Correspondent- Nurses at Sally Mugabe Central Hospital (formerly Harare Central Hospital) say they are continually being harassed by the hospital’s management for participating in last year’s protests over the lack of Personal Protective Equipment (PPE).

Some nurses including some top executives and members of the Zimbabwe Nurses Association (ZINA) have resigned following the alleged victimisation.

ZINA president, Mr Enoch Dongo, has since resigned from Sally Mugabe Hospital and Mr Samson Gurupira, the organizing secretary at Sally Mugabe Hospital, have also resigned from the institution.

Speaking to Health Times, Gurupira said he resigned early this year after being subjected to harassment. He added that the resignation was a way of preventing the situation from deteriorating further.

He said:

The conditions that was created by my superiors had become so unbearable. I was arrested last year in June and spent a night in the police cells for allegedly leading a demonstration against poor salaries and wages, and lack of personal protective equipment. This arrest was caused by my employer.  I was served with three different charges and a suspension letter.

Gurupira said he tried to engage authorities hoping to find an amicable way to resolve the issue but “things only got worse.”

Sally Mugabe Hospital’s Chief Executive Officer (CEO), Dr Christopher Pasi dismissed the alleged victimisation reports as untrue.

He said every profession has a code of ethics and the nurses defied theirs by speaking to the media when they were not authorised to do so.

Pasi added that their remarks were untrue and when they were asked to substantiate their claims, they could not do that.

He added:

There was one of them who came out in the press and it went viral all the world. She came out saying the National Reference Laboratory at the Sally Mugabe was falsifying COVID-19 results.

He said the claims were detrimental to the institution but the nurse failed to substantiate her claims.

He described the nurses’ actions as “just insubordination,” adding that they just don’t want to be asked to account for their actions.

Zanu PF Party Has Begun Preparations For By-Elections

The ruling Zanu PF party has begun preparations for by-elections, although the Zimbabwe Electoral Commission (Zec) recently announced that it had indefinitely postponed elections due to the COVID-19 pandemic.

Zanu PF has already rolled out campaigns in Manicaland province, where two candidates were chosen to represent the party in the impending elections to replace Dangamvura Chikanga MP Prosper Mutseyami and Mutasa South MP Regai Tsunga of the MDC Alliance, who were recently recalled by the rival MDC-T.

Last year, Vice-President and Health minister Constantino Chiwenga published Statutory Instrument (SI) 225A of 2020, which indefinitely postponed all by-elections citing COVID-19 fears.

However, other countries have successfully conducted elections during the COVID-19 era.

Analysts have said SI 225A of 2020 is ultra vires section 68 of the Public Health Act or sections 158 and 159 of the Constitution, as well as the Electoral Act.

Despite the ban, the Zanu PF Manicaland province is already preparing for parliamentary and local authority by-elections.

Zanu PF Manicaland chairperson Mike Madiro told a party provincial coordinating committee meeting yesterday that the party was preparing for the by-elections.

“I would like to say that we have by-elections that are coming and what is only left is for our President Emmerson Mnangagwa to declare the dates,” he said.

“In Mutasa South, people in the constituency agreed that Misheck Mugadza should represent the party as the candidate for MP in the by-elections, and in Dangamvura/Chikanga constituency, there is comrade Esau Mupfumi, who will represent the party. We gave people five months to submit their curriculum vitaes, but no one else did so.

“Unfortunately, after the five months, there are some individuals who have started giving us their CVs, but what we are saying is that we follow party direction first.”

Madiro said the ruling party was hoping to win seven wards in Mutare after seven MDC Alliance councillors were recalled by the MDC-T.

More than 40 MDC Alliance MPs and around 80 councillors lost their parliamentary and council seats after they were recalled by the MDC-T and the People’s Democratic Party led by Lucia Matibenga.

The MDC-T has since filled in more than 15 National Assembly and Senate seats that were occupied by proportional representation MPs.

Constituency seats will need to be filled in through by-elections.

MDC T Senator Says Striking Teachers Must Resign

By A Correspondent- An opposition MDC-T senator last Thursday said teachers who were not reporting for work should leave employment and let unemployed qualified teachers take over.

Masvingo senator Tichinani Mavetera asked Information minister Monica Mutsvangwa, who is also leader of the Senate, to explain government policy on striking teachers.

“Mr President, teachers are now striking or giving threats. My question is: if government is negotiating with the representatives of workers, are they open to each other because right now people are tired in the country?

“There are endless talks between government and the teachers. If they cannot accept what is being given by government, they must retire and leave an opportunity for qualified teachers who are not practising,” Mavetera said.

Mutsvangwa, who responded on behalf of the Primary and Secondary Education minister Cain Mathema, said government was committed to improving the working conditions of teachers and to ensure normal learning at schools.

“Government is trying its best to see that teachers are well-paid and is open to negotiate with its citizens. Children must be educated. Salaries continued to be paid during the COVID-19 lockdown, which shows the government’s commitment. Therefore, the teachers must also work together with the government. If our children fail to go to school, we have failed generations to come,” she said.

“Our country, Zimbabwe, is known for better education. United Nations Educational, Scientific and Cultural Organisation rated Zimbabwe as number one in Africa. Therefore, as Zimbabweans, we must focus on this issue (education) so that we know what legacy we are trying to leave for this country.”

Mutsvangwa said 90% of the teaching staff was attending lessons.

Since last year, teachers have been on industrial action demanding to be paid between US$520 and US$550 which they used to get in 2018, or its equivalent.

Last week, civil servants rejected a 70% salary hike offered by their employer.

Civil servants have since pleaded incapacitation and resolved that they will only report to work twice per week.-Newsday

Zanu Pf Escalates Bakery Projects

By A Correspondent- Zanu-PF has escalated its bakery project throughout the rural areas in the country, with women in some districts, saying that they have started realising the benefits of the project.

The ruling party introduced the bakery project in 2019 in an effort to economically capacitate women.

However, at the inception of the bakery project, Zanu-PF was under fire for implementing Stone Age projects which use mud ovens powered by firewood.

Women interviewed by NewsDay in Mangwe district in Matabeleland South said their project at Vukuzenzele in Ward 1 had been successful.

But evidence on the ground shows that most of the bakery projects in urban areas around the country collapsed as the old-model ovens could not mass produce.

Women Affairs minister Sithembiso Nyoni said the bakery projects in rural areas had changed the lives of women.

She said the projects were using both old and modern baking methods to enable the women to make prompt returns.

“In Mangwe, the villagers used infrastructure that is made of metal, that is the old traditional way, but with improved technology, which is the modern way. They now use baking stoves,” Nyoni said.

“In a day, women bake two to three dozen loaves of bread. Bakery projects are quick and efficient and they have created employment for the women, thus bringing them income,” she said.-Newsday

Chamisa, Komichi Find Each Other On Constitutional Amendment Bill Number 1

Last week when MDC-T President Douglas Mwonzora and other party senators voted in favour of Constitutional Amendment number 1, Chairperson Morgan Komichi broke ranks with everyone insisting he will not support moves to temper with the new charter adopted in 2013.

Komichi’s stance on the amendment has found support from the Nelson Chamisa-led opposition MDC Alliance which has resolved to challenge the passage of the Bill in court saying the manner in which it was passed by Parliament was unconstitutional and ultra vires the 2013 Constitution.

“The resolution was made last week and the party leadership is in the process of putting in motion the legal challenge. Vice-president Tendai Biti is seized with the matter to challenge the amendment as it has been widely condemned by the party as unconstitutional and a reverse of the gains which were achieved by the 2013 Constitution,” said an MDC Alliance party insider.

Speaking to The Standard on Saturday, Komichi said he was against changes to the constitution to benefit an individual.

“The national constitution needs to be protected from arbitrary amendments because it will do away with what the people actually voted for.

“The people of Zimbabwe voted for the current national constitution,” said Komichi.

Violent Youths Disrupt Mnangagwa Tour

Zimbabwe National Organisation of Associations and Residents Trusts (ZNOART), an Apex body representing all associations and residents alleges that violent youths disrupted a residents association and Tongai Mnangagwa (Harare South Member of Parliament) tour in Southlea Park.

The was a barbaric scene yesterday in Southlea park when violent youths attacked residents who were waiting to be addressed by the Member of Parliament for Harare South Honourable Tongai Mnangagwa.

The lawmaker was set to meet and address Southlea Park residents at an event organized by ZIMBABWE NATIONAL ORGANISATION OF ASSOCIATIONS AND RESIDENTS TRUSTS(ZNOART).The program aimed to address the issues of service delivery and infrastructure development that have been a cause of concern in Southlea Park and Harare in general.

Last year the president H.E ED Mnangagwa declared war on land barons followed by a land commission that aimed to address the issue of land barons and several people have been arrested.

Land barons are distributing land set aside for schools, clinics and sometime doing double allocations of stands this is being done illegally, well-known land barons are using their political muscles to protect their illegal dealings.

ZNOART organised a tour accompanied by Hon Tongai Mnangagwa to Southlea park to get first-hand information on the issue of land barons and to address the issue of Regularisation of stands. Southlea Park residents were gathered near Candy shops waiting for the lawmaker and ZNOART executive, at around 9 in the morning violent youths led by a man only identified as Nhakiwa arrived at the venue holding empty bottles, sticks and stones. They displaced the gathering and assaulted local residents association leaders and reportedly told them that Southlea park is a no go area.

The youth are said to have been sent by Pfundukwa whom Southlea Park residence are accusing of selling stands on wetlands and on areas set aside for schools, clinics etc illegally. The residence are believing that the attack was meant to stop ZNOART and Hon Mnangagwa from exposing the situation on the ground.
