Was The Court Fair On Marry Chiwenga? – Mavaza

The world was shocked by a picture and video of Mary Chiwenga being wheeled to court in a very bad shape. The scenario showed the cruel and vindictive character of a system.  The decision by the magistrate to bring the accused person to court regardless of him being told her condition was outrageous overzealous and vindictive. The magistrate’s actions were inhuman and knee shaking.

 In many jurisdictions this amounts to Judicial misconduct. Judicial Misconduct occurs when a judge acts in ways that are considered unethical or otherwise violate the judge’s obligations of impartial conduct. This includes where a judge has lost any sense of reason and probably wrongly believed that by humiliating Mary Chiwenga Mubaiwa he puts himself in good books with the Vice President.

People should understand that the Vice President has no power over courts. He did not even put pressure on the magistrate to humiliate Mary Chiwenga. The vice President contrary to what people would say is a very loving person. He is a strict person and he is a man who focuses on his wishes and wants his things done but he is not a vindictive person. The fact that his estranged wife was being harassed at a court of law it did not have his signature.
Actions that can be classified as judicial misconduct include: conduct prejudicial to the effective and expeditious administration of the business of the courts and treating litigants or attorneys in a demonstrably egregious and hostile manner.  Rules of official misconduct also include rules concerning disability, which is a temporary or permanent condition failure to respect these could be misconduct.

What the magistrate did in the case of Chiwenga amounts to abuse of power.
Abuse of power or abuse of authority, in the form of “malfeasance in office” or “official misconduct”, is the commission of an unlawful act, done in an official capacity, which affects the performance of official duties. Malfeasance in office is often grounds for a for cause removal of an elected official by statute or recall election.
The magistrate in the case of Mary Chiwenga had so many options before him. He would have made a video call. Or dispatch a police officer to go and access the condition of Mrs Chiwenga. Lawyers are officers of court and the magistrate should have taken the word of the lawyer Sibale Beatrice Mtetwa.

In order to force a sick person to court the court  would have satisfied itself that the person is faking sickness. 2. Whether or not it was necessary to order and conduct an arrest.
The law demands a necessary discretion and inquiries could have been continued without an arrest.
The magistrate’s  belief at the time of the issuing the warrant of arrest can also be questioned and come under scrutiny after the event, especially if it appears that it was unreasonable to make such an order.
Zimbabwe has set the social media alive with the warrant of arrest of Marry Chiwenga and the subsqent order to bring her to court at all cost. the question borders on the reasonableness  of the warrant of arrest and whether this was done to please the Vice president.

While the narrative out there is that the vice president is the force behind the humiliation of his wife it is very clear that the Vice president could not have ordered the court to issue a warrant of arrest.  He has no reason to do so as he is aware that the hearing has not started. Why would he force her to come to court for what benefit.
Because of the Human Rights laws which exist, whenever an arrest is made, the person arrested always has the right to be treated humanely and be treated with respect. Marry Chiwenga was dragged to court in her death bed. This reminds is when she was nabbed while she was bathing dragged from the bathroom naked while her children looked. The kids screamed as the mother was being dragged to the car like a criminal condemned to death.  Then now brought in an ambulance forced to reveal her blood leaking hands. Why was that necessary?

Why not take her in chambers why open court in that condition.
The arrest of the wife of the VP and a very powerful man in the country shows that someone was seeking to please the vice president.

However there are two points to ponder. 1. Was it necessary to issue a warrant of arrest before the investigations of whether she was sick or not are completed. Was it necessary to arrest the wife of the vice president in a manner befitting the second lady of the country. Even of they are fighting.

her dignity was violated when man pulled her to court in a condition nobody will ever wish for her worst enemy.
When most people think about the police committing false arrest, they think it refers to an arrest that was not supported by evidence. But this is not the standard for measuring whether the police have falsely arrested someone. To be guilty of false arrest, the police must act without authority, or beyond the scope of their powers.

The case of Marry Chiwenga is so tainted with victimisation such that the Vice President has to prove that he is not involved in a domestic case which threatens to turn the nation and government’s institutions a personal property to be used in family fights.
It is naive to blame the husband in every domestic problems.

The vice president did not take part in the court’s decision to issue a warrant of arrest. This judiciary mistake has nothing to do with the Vice President. It is wrong to try and see elephants in a house.
It is not right that the social media goes all out only to try and tarnish the image of the good vice president.
Nobody says that the actions by the court were justifiable. It was indeed a work of an overzealous judiciary officer who thought by being unreasonable he becomes tough.
The picture of Mary showing her bleeding hand to the world shows that many people are bleeding yet the world is blind.
This was abuse of the justice system. The most confusing thing is that not even one woman activist raised a finger.
Even the suspected rapist Hopewell Chin’ono saw nothing to Twitt about in this case. What a shame.

Hundreds To Attend Gogo Chamisa Memorial

Tinashe Sambiri|The memorial service for the late Gogo Alice Chamisa is set for Saturday December 5.

According to MDC Alliance Secretary General, Hon Charlton Hwende, plans for the event are at an advanced stage.

Hundreds of MDC Alliance members and Zimbabweans in general are expected to attend the memorial service.

“This coming Saturday, the 5th of December 2020, we will be joining our President

and his family in Chiwara Village in honor and memory of our dearly departed mother ambuya Chamisa.

We hope to welcome all who are free and available to join in the memorial ceremony,” Hon Hwende wrote on Twitter.

Villagers who spoke to ZimEye.com at Ngungumbane Business Centre in Mberengwa on Sunday said they were fed up with Zanu PF’s empty promises.

Why Zimbabweans In The Diaspora Should Be Allowed To Vote

DIASPORA VOTE IS A NON-NEGOTIABLE RIGHT!

2013 CONSTITUTION IS VERY CLEAR, MDC ALLIANCE NAMIBIA DEMANDS ONE-MAN ONE-VOTE.

Mdc Alliance Namibia remains convinced that diaspora vote is a non-negotiable right conforming to the supreme law of the country as stipulated on Section 155 which unequivocally states that all citizens should vote regardless of their geographical location.

This has meant that the Zanupf government bears the responsibility to ferry the ballot box to Zimbabweans wherever they are in the diaspora be it in Namibia, South Africa, Tunisia, Zambia, United States of America, United Kingdom, Australia, Canada , Germany only to mention but a few.

Prior to the advent of the 2013 constitution, in 2006, the Supreme Court ruled that voting was not a fundamental right therefore Zanupf and their proxies argued that the diaspora vote was not a universal basic human right.

Subsequent court appeals by diaspora residents could not transform the outcome of the court but today as Mdc Alliance Namibia, we want to stand firm championing constitutional democracy. Chinamasa, the Zimbabwe Electoral Commission and their clueless Zanupf regime must realise that the aspects of Constitutional Law and Electoral Law should not be compromised aided by their unconstitutional reasoning.

Moreover, Mdc Alliance Namibia intends to inform Chinamasa that we are conscious of the fact that Zimbabwean citizens in the diaspora play a significant role in the development of the motherland.

The undoubted contribution of the diaspora residents was exhibited in 2016 when the Reserve Bank of Zimbabwe (RBZ) unearthed that the diaspora accounted for US$700 million in direct remittances.

Adding to the above mentioned astounding amount, they also spend a lot whenever they return home in support of their desperate relatives who are languishing in abject poverty.

The neglected diaspora community could also contribute through investment in available productive sectors that enhance economic boom and employment creation.

Moreso, diasporas can further be tapped to contribute to policy dialogue as well as the transfer of knowledge and skills to deal with serious national issues. The politically inept Zanupf government must hasten to realise that deprived of the inclusion of the citizens in the diaspora, we will perpetually witness an unprecedented increase in unemployment, senseless and barefaced corruption, intimidation and extremely poor livelihoods in the country.

A closer scrutiny to the denial of diaspora vote is incontrovertible evidence to prove Zanupf’s autocracy and totalitarianism. This unravels the extraordinary lack of political will on the part of desperate Zanupf to organise and process elections that will guarantee an objective fulfillment of One-Man-One-Vote. It is only the phobia of an obvious embarrassment from social democrats in the diaspora who ran away from Zanupf’s gross misgovernance. We demand comprehensive political and electoral reforms to avoid disputed elections in the country.

Furthermore, it is quite pathetic that Zec and Zanupf government are still reluctant to implement the 2013 Constitution citing the traditional political rhetoric concealed behind the membrane of resource dearths ,as well as the undersupply of information on the whereabouts of citizens that reside in the diaspora. Mdc Alliance Namibia does not resonate with these political lies that are being paddled by Zanupf power mongers.

This is a deliberate ploy to deny diasporas their right to vote since to them , voting is a way of sanitising rigging of the people’s voices with impunity. We were perturbed to hear loud mouthed( Mr Bin) Patrick Chinamasa pronouncing that the 2023 elections were already over before the votes. Namibia district would like to encourage our parliamentarians to revisit the Electoral Act to deal with disputed elections once and all. We are tired of stolen elections since the inception of the Mdc in 1999.

Mdc Alliance Namibia is furiously demanding an immediate end to selfishness, rapaciousness and unbridled individualism which have become a national religion in Zanupf politics of the belly and self-enrichment.

If Zanupf is democratic enough, it must realise that the diasporas should not be limited or restrained in their quest to decide on the governance of their beloved country like what other African, European, Asian and American states are doing to those who live beyond borders.

Zimbabwe must emulate neighbours who respect their citizens abroad by granting them voting rights.

In Namibia, Namibians in the diaspora have been accorded their voting rights in the national elections since 2014, when amendments were made to the Electoral Act of 2009, Namibian expatriates may vote at temporary registration points , usually set up at Namibian embassies or high commissions. In consonance with Chapter 1 , Section 10 of the Electoral Act 73 of 1998, South African citizens staying abroad retain the right to vote in national elections , with no expiry date.

In addition , Tunisian expatriates have been allowed the right to vote in Presidential elections since 1988, and additionally in parliamentary elections since the Tunisian Revolution in 2011.

Emmerson Dambudzo Mnangagwa and his government must be prepared to handle these reforms before 2023 because NO TOLERANCE to election rigging in the next episode.

To wind it up, Mdc Alliance Namibia District would like to make an informed fall up on this fundamental issue.

We resonate with Gabriel Shumba, the leader of Zimbabwe Exiles Forum and others who had the varlour and mettle to approach the African Commission on Human and People’s rights in Banjul (The Gambia) in 2013 which granted them a provisional order allowing diaspora vote. What the hard-headed Zanupf dictators must consider is that our Motherland can only evade poverty in all facets of development if the electorate is given their democratic rights to express his/her preference.

This will automatically act as a resounding catalyst for better and sound governance as well socio-economic transformation.

Spanish Giants Real Madrid Suffer Back-to-back Losses

KIEV. — Real Madrid suffered a second defeat at the hands of Shakhtar Donetsk in this season’s Champions League, going down 2-0 last night to leave their hopes of reaching the last 16 in the balance.

Substitutes Dentinho and Manor Solomon both scored second-half goals as Shakhtar stunned the 13-time European champions again, having already won 3-2 in Madrid in October.

Shakhtar had lost their last two Group B matches against Borussia Moenchengladbach by an aggregate score of 10-0, but this victory allowed them to move above Real into second place in the group with one game remaining.

Gladbach top the section, while Shakhtar now have the upper hand on Real thanks to their superior head-to-head record, while this result also means Inter Milan retain an outside chance of qualifying before their game later.

Man Killed Over Parking Space Dispute

POLICE have launched a manhunt for a man who fatally stabbed a fellow imbiber following a misunderstanding over parking space in Kwekwe.

Mr Alison Stambuli (43) was stabbed to death by a fellow patron at a shebeen in Mbizo Section 17 after the two argued over parking space.

Midlands police confirmed that they had since launched a manhunt for a man identified only as Magwangu for allegedly fatally stabbing Mr Stambuli.

Magwangu fled and left his vehicle, a Toyota Runx, on the scene after discovering that Mr Stambuli had died.

Midlands provincial police spokesman, Inspector Joel Goko said on Saturday at around 8.30PM, Mr Stambuli parked his vehicle, a Honda Fit, at a shebeen in Mbizo 17 where he was drinking beer.

The accused person also came and parked his vehicle, a Toyota Runx in front of the gate thereby blocking the entrance.

Mr Stambuli later approached the accused person asking him to move his vehicle as he wanted to leave.

“The accused refused resulting in a misunderstanding between the two. Mr Stambuli then slapped the accused person twice on the face. The accused went to his car and came back armed with a knife and stabbed Mr Stambuli once on the chest,” said Insp Goko.

Magwangu fled leaving his vehicle behind.

Mr Stambuli’s son, Alois received a call that his father had been stabbed and was bleeding profusely.

Alois, with the help of other residents, rushed his father to Kwekwe General Hospital where he was pronounced dead on admission.-Chronicle

Corruption Charged Allied Timbers CEO Granted Bail, To Report To ZACC Once A Month

Harare provincial magistrate Mrs Esthere Chivasa has granted $10 000 bail to Allied Timber Zimbabwe (Pvt) Ltd’s acting chief executive, Remigio Nenzou who is facing allegations of hand-picking a Germany company to supply a sawmill machine without following due tender procedure.

As part of his bail his conditions, Nenzou was ordered to report once every month at ZACC, not to interfere with witnesses and to continue residing at his given address.

Mrs Chivasa dismissed the two reasons upon which the State was relying on to deny the accused bail which were; likelihood to interfere with witnesses and absconding.

In her ruling, she said the court was surprised at how the accused is said to have interfered with witnesses in January 2019 when the allegations before the court are said to have arisen in October 2019. “Nothing cogent has been placed before the court to establish interference of the risk,” she said.

Mrs Chivasa further stated that nothing was placed before the court to establish a strong case.

“To the contrary, the case against the accused as presented taking into account the exhibits tendered, appears weak,” she ruled.

The court heard that on October 30, 2019, Nenzou as the chief executive for Allied Timber Zimbabwe (Pvt) Ltd verbally instructed his procurement officer Innocent Shenje to originate a letter for his signature addressed to the chief executive for Procurement Regulatory Authority of Zimbabwe (PRAZ) Mr Nyasha Chizu.

The letter was requesting Allied Timbers to be exempted from following the procurement procedures when procuring a sawmill machine from a Germany company, MS-Maschinenbau-GmbH (Pvt) Ltd, for a total price of US$1 128 218,25.

It is alleged that on November 15, 2019, Mr Chizu turned down the request made by Nenzou and advised him to select the most appropriate method of procurement in line with section 30 of the Public Procurement and Disposal of Public Assets Act.

The court heard that in February this year, Nenzou showed favour to the Germany company after intentionally ignoring the advice given by Mr Chizu.

He allegedly travelled to Germany to do the due diligence and expedite the procurement of the sawmill.

It is the State’s case that investigations established that at the time of Nenzou’s visit to Germany, no procurement procedures had been followed to choose MS-Maschinenbau-GmbH (Pvt) Ltd to supply a sawmill machine to Allied Timber Zimbabwe.

The court heard that Nenzou corruptly verbally instructed Mr Wilcort Dzuda, the chief finance officer, to make payment arrangements to MS-Maschinenbau-GmbH (Pvt) Ltd of US$1 848 220 for the supply of a sawmill machine.

The tests are part of strict and tight health management measures the Government employed to ensure the safety of travellers and its workers under the new border set up.

Everyone leaving or entering the country through Beitbridge is being thoroughly screened at the entrance of the border arena and all buildings.

Beitbridge, Plumtree, Forbes, Chirundu, and Victoria Falls land borders re-opened to passenger traffic on Tuesday morning.

As a precautionary measure, towards the re-opening, the Ministry of Health and Child Care tested all border workers to ascertain the exact number of those fit for duty.

In a statement today, Zimra said it was taking the necessary precautionary steps, as guided by World Health Organisation with the assistance of the Ministry of Health and Childcare to ensure the safety of its workers and travelling public.

“ZIMRA is very aware that due to the unique location of our offices and stations coupled with the essential nature of the services we provide there is a need to remain vigilant in observing and practicing procedures that reduce exposure to COVID-19.

In order to safeguard employees, clients, and the public, Zimra continues to implement guidelines from the World Health Organisation and the Ministry of Health and Childcare in reducing the impact of the COVID 19 threat to operations and human life,” said the revenue collector.

All stakeholders at Beitbridge have had tests done as well as contact tracing and our staff continues to offer essential services under Covid-19 protocols.

Some of the steps taken include; testing contacts of all suspected Covid-19 cases and that it had immediately closed some offices for disinfection.

“The re-opening of disinfected offices will be done with the assistance and guidance of the relevant local medical authorities.

“Where practical Zimra stations and offices maintain critical skeleton staff. In addition, staff are being provided with appropriate Personal Protective Equipment (PPE) and sanitisers; and services are, as much as possible, being offered to clients/agents via electronic means” said the statement.

Zimra said it was encouraging travellers to use clearance methods of goods which minimise human interface between its employees and clients.

In addition, all travellers importing dutiable goods must pre-clear and pre-pay before arriving at the border to reduce crowding and the time spent at border posts.

“As a mitigating measure against the spread of COVID-19 virus, clients are encouraged to access, utilise the available ZIMRA e-service facilities on www.efiling.zimra.co.zw or www.zimra.co.zw and reduce the risks associated with travelling or handling physical documents,” said the revenue collector.

The authority also called on people to prioritise public health at all ports of entry.

Ecocash Revenue Continues To Dwindle After Mthuli Tough Measures

CASSAVA Smartech Zimbabwe Limited’s subsidiary, EcoCash’s revenue contributions to the group continue to dwindle following recent operating measures effected by the Reserve Bank of Zimbabwe (RBZ) to curb the platform’s abuse by illegal money changers.

In a trading update issued by Cassava, it states transactions processed on the EcoCash platform went down to about 19% of the total value processed on the National Payments System.

This is down compared to the 30% recorded the previous year.

Presenting the company’s performance for six months ended August 31 2020, the company’s chairperson Sherree Shereni said revenue contributions from the business unit had also dropped compared to a similar period in 2019.

“EcoCash revenue contribution, at 63% compared to 73% realised last year have declined, both as a result of macro-economic factors and regulatory changes that took place during the period under review, as well as contribution from the exponential growth in the Insurtech and ODS business units,” she said.

The EcoCash platform was severely impacted by a series of measures implemented by the RBZ early this year.

Between April 2020 and September 8, 2020, the RBZ through its subsidiary, the Financial Intelligence Unit (FIU) issued a total eight directives targeted at the EcoCash platform.

These included reductions in transactional limits, suspension of agent lines, directive to integrate on the Zimswitch platform, among others measures.

The RBZ defended the directives arguing they were meant to block illegal foreign currency dealers from abusing the platform by increasing parallel market exchange rates and derailing government’s efforts to stabilise the economy.

The period after the implementation of these directives has been marked by both price and exchange rate stability.

Zimbabwe has received 450 tractors under the Belarus facility ahead of the summer cropping season as Government moves to enhance productivity and adapt to climate change as well as adopting new farming technologies.

In a post cabinet briefing Information, Publicity and Broadcasting Services Minister Hon Monica Mutsvangwa said the country had received 450 tractors of the 474 expected under the Belarus facility.

“Of the 474 tractors expected under the Belarus facility, 450 tractors have now been received for distribution to farmers through designated banks,” she said.

Minister Mutsvangwa said the country expects to meet its target of more than 290 000 hectares of maize under the National enhanced Crop Productivity Programme.

She said 286 chiefs have benefitted from the reintroduced Zunde Rambo concept.

“The Zunde raMambo concept had been revived and inputs are now being distributed to 286 chiefs.

On National enhanced Crop productivity Programme, the nation is advised that 285 440 hectares of the targeted 290 000 hectares had been registered by 11 829 farmers, and 43 067 hectares had been registered for soya beans out of the targeted 60 000 hectares by 932 farmers. The farmers had received the following inputs: maize seed; soya beans seed; basal fertilizer; soya blend; and top-dressing fertilizer,” she said.

Johannesburg: Two men were killed, and another left critically injured, following a shooting on Xavier Road in Ormonde, south of Johannesburg. The incident occurred at the M1 Bridge, a popular commuter route in the city.

Reports first came in after 13:30 that there had been gunshots fired. Emergency teams arriving on the scene found that a silver vehicle had been riddled with bullets. Two people were found dead in the car, with a third rescued and now receiving life-saving treatment in hospital. Sadly, nothing could be done to revive the deceased.

The circumstances behind these killings remain unestablished. There was no trace of the perpetrators by the time the alarm was raised on the M1 Bridge, but some unverified reports have claimed that this bloody incident was triggered by a gangland dispute. Police remain on the scene to carry out their preliminary investigations:

ER24, the first responders who arrived at Xavier Road, issued the following statement on Wednesday afternoon:

“At approximately 13h30 ER24 paramedics arrived on the scene to find the local authorities already in attendance. A light motor vehicle was found parked in the middle of the road riddled with numerous bullet holes. On closer inspection, medics found two men in the front of the vehicle while a third man was found seated in the rear of the vehicle.”

“Medics assessed the men and found that the two in front had sustained numerous gunshot wounds and showed no signs of life while the man in the rear was in a critical condition. Unfortunately, nothing could be done for the two men, and they were declared dead.”

“The third man was carefully extricated from the vehicle, treated for his injuries, and provided with advanced life support interventions. After treatment, the man was transported to a nearby hospital for further care. The details surrounding this incident are not yet known, but local authorities were on the scene for further investigations.”

Chiwenga Says Under His Ministry, Zimbabwe Will Not Be Having Any New HIV Infections By 2030

Zimbabwe is experiencing a significant decline in new HIV and Aids infections, but unity is still required among citizens for a further reduction in new cases.

The same commitment is equally required in the fight against Covid-19, for which almost 700 new cases have been recorded in the last seven days.

Vice President Constantino Chiwenga, who is also the Health and Child Care Minister, said this in his World Aids Day commemoration address yesterday during an event hosted by the National Aids Council (NAC) in Harare.

“The commemoration serves as both a national and local platform for the unity of nations to remember those that have died due to Aids and reflect on the progress we have recorded in 2020 in responding to the pandemic as well as we dedicate ourselves to revitalising the response and change its trajectory towards ending Aids by 2030,” said VP Chiwenga.

“We are commemorating the World Aids Day this day under unprecedented circumstances, which have been forced upon us by the Covid-19 pandemic whose impact has been far-reaching for humanity across the globe.

“Lives have been lost, ways of life have been altered, geography, social and economic spaces have all been altered too. In addition to this, Covid-19 has been a major wake-up call to all health delivery systems.

“The pandemic caught us all unaware and we have had to learn as we go, including collaborating with regional and global partners in building systems and structures, as well as introducing necessary social economic adjustments to tackle the pandemic.”

This year’s commemorations ran under the theme: “Global Solidarity, Shared Responsibility”.

VP Chiwenga said Zimbabwe had so far minimised the overall impact of Covid-19 compared to the modelling projections.

NAC chief executive Dr Bernard Madzima, said Zimbabwe’s national response had improved over the years on the strength of global solidarity and shared responsibility.

“Out of the estimated 1,3 million people living with HIV, nearly 1,2 million are on treatment. The HIV prevalence has been declining over the years from 13,70 percent in 2015 to 12,78 percent in 2019.

“Prevalence has also fallen from 0,62 percent in 2016 to 0,49 percent in 2019, taking us closer to achieving the 90-90-90 targets. The percentage of people living with HIV who know their status has already reached 90 percent, while treatment coverage is over 90 percent.

“Estimates project that 20 000 Zimbabweans will be infected by HIV in 2030.”

Interpol Issues Global Alert Warning Of Criminals Waiting To Strike On Covid-19 Vaccine

The Interpol global police co-ordination agency warned on Wednesday that organised criminal networks could be targeting COVID-19 vaccines and could look to sell fake shots.

Interpol, which is headquartered in France, said it had issued a global alert to law enforcement across its 194 member countries, warning them to prepare for organised crime networks targeting COVID-19 vaccines, both physically and online.

“As governments are preparing to roll out vaccines, criminal organisations are planning to infiltrate or disrupt supply chains. Criminal networks will also be targeting unsuspecting members of the public via fake websites and false cures, which could pose a significant risk to their health, even their lives,” said Interpol secretary general Juergen Stock.

South Africa Set To Announce New Tight Coronavirus Lockdown Regulations As Cases Rise Ahead Of The Festive Season

The South African government is likely to implement tighter localised restrictions, including tighter restrictions on the sale of alcohol, to curb the spread of Covid-19 in hotspot areas as infections surge in parts of the Eastern Cape and Western Cape.

South African media, Business Day, reports that they were reliably informed that the health department has recommended to the national coronavirus command council (NCCC), which met on Tuesday, that the government will also reduce the maximum size of indoor gatherings and implement an earlier curfew.

Another media, News24 reported on Wednesday that the NCCC agreed that a 10pm curfew be put in place in Covid-19 hotspots around the country, that alcohol sales be restricted from Monday to Thursday, and that bars and taverns close by 9pm.

The command council’s recommendations will need to be approved by the cabinet before they can be implemented.

President Cyril Ramaphosa is expected to address the nation later this week about these new regulations.

The issue is pressing, as a large number of people are expected to travel between provinces after public schools close on December 15, then again when the festive season ends, raising the risk that they could reseed the epidemic in places where transmission is now low.

The entire country is at level 1 of the risk-adjusted strategy.

In November, Ramaphosa announced that level 1 regulations would be amended to allow for borders to be opened to all tourists and allow for normal trading hours for the sale of alcohol.

This allowed the tourism and alcohol sectors to start operating at full capacity after eight months of strict regulations that cost the industries billions of rand and led to widescale job losses.

The opening up of the sectors came amid concerns raised by business and labour about the government’s decision not to extend wage protection schemes for workers affected by the restrictions.

The temporary employer/employee Rrelief scheme (Ters), was extended for just one more month until October 15.

95 New Covid-19 Cases On Tuesday

Ninety-five new Covid-19 cases were recorded yesterday, as cases continue to rise.
However, no death was reported in the last 24 hours.
The rise in cases has left the seven-day rolling average for new cases at 104.
This Wednesday, 1 029 PCR tests were done, implying a positivity rate of 9,2 percent.
A daily Covid-19 update released by the Ministry of Health and Child Care last night shows that all the 95 cases are local transmissions.
The spate of new cases recorded in the last seven days has left active cases at 1 209.
As of yesterday, Zimbabwe has recorded 10 129 cases, 8 643 recoveries and 277 deaths.
Government continues to implore citizens to observe guidelines aimed at containing the spread of Covid-19, which include wearing of face masks in public, maintaining social distance, washing hands with soap or ash and sanitising, among others.
South Africa has now surpassed 780 000 cases and has the highest cases and deaths per capita in the SADC region.

Two Zimbabweans Jailed 15 Years For Smuggling Explosives Into South Africa

Two Zimbabweans men were on Tuesday jailed for an effective 15 years by a Musina Magistrate for smuggling explosives worth R470 000 into South Africa through Beitbridge Border Post.

Patson Banda (25) and Life Mbazi (33) were arrested by the Directorate for Priority Crime Investigation (Hawks) in March while crossing into the neighbouring country.

The duo had loaded the contraband in two trolleys.

Since their arrest, Banda and Mbazi have been languishing in remand prison after their several applications for bail pending trial were dismissed at the Musina Magistrate Court.

Hawks spokesperson for Limpopo Province, Captain Matimba Malulele said the conviction and sentencing of the accused persons was a warning to would-be offenders.

The explosives have since been forfeited to the state.

“On 13 March 2019, the Hawks’ Serious Organised Crime Investigation members received a tip-off about people who were smuggling explosives from Zimbabwe into South Africa,” he said.

“The Hawks members assisted by Beitbridge Crime Prevention members kept an observation at Beitbridge Port of Entry until they saw two suspicious people pushing a trolley full of parcels.

Upon searching the trolley, explosives worth over R470 000-00 were found wrapped with plastics and the duo was arrested”.

The smuggling of explosives into South Africa through Beitbridge gas become a perennial headache for border authorities.

The Herald understands that these are used for ATM bombings or illegal mining activities in the neighbouring country.

Over 20 people have been arrested along Zimbabwe boundary with South Africa with explosives in the last 24 months.

For many Zimbabweans, the cost of the Covid-19 tests necessary to cross the border will make the annual return home unaffordable.

Many Zimbabweans staying and working in South Africa travel back home at the end of the year to spend the Christmas and New year holidays with their families. But several told GroundUp they would not be able to afford the test which both the Zimbabwean and South African governments demand.

Zimbabweans travelling home must present a negative Covid-19 test not older than 48 hours. The test costs R850 in a private laboratory. “If you want to travel to another country, yes you need a Covid-19 certificate. It is your own private thing so you can visit private laboratories for the Covid-19 test and get a certificate,” said Thilivhali Muavha, spokesperson for the Limpopo health department. “Public hospitals do not do that.”

On their return to South Africa, travellers from Zimbabwe must present a negative test not older than 72 hours. That test costs $60USD (around R920).

At a meeting in Musina on 27 November, Minister of Home Affairs Aaron Motsoaledi and Zimbabwean Minister of Home Affairs and Cultural Heritage Kazembe Kazembe said the regulations must be followed.

“We are going to be demanding Covid-19 certificates,” said Motsoaledi.

Marvelous Moyo, who runs a food stall near the South African gate, said since March this year she had not been able to afford to visit her family in Masvingo because lockdown had affected her business.

“Though borders were opened for us to travel back home I could not travel back home. My only means of sustaining a living is through selling food at this place. The little money I am getting since we were allowed to go back to business is not enough to meet the travel costs including Covid-19 certificates.”

I wish both governments would drop this requirement because I really need to visit my family,” said Moyo.

Another Zimbabwean trader, Ruth Chirinda, also expressed concerns about the certificate. “I really miss my three children who are being taken care of by my mother. Since March I could not travel back home. Now it is December time I need to spend the holiday with the family,” said Chirinda. Other Zimbabweans told Groundup they would use illegal routes to return home.

Speaking to the media Kazembe said, “We need to save lives. This pandemic is real. We urge our citizens to plan their trips. If you know you want to travel in a couple of weeks, just do what is expected of you so that you do not have challenges at the border.”

“Now that the borders are open it is not going to be free for all,” said Motsoaledi. “We are going to be very strict.” He said there would be joint operations involving the SANDF, SAPS, municipal police and SARS to minimise illegal crossing. And measures were in place to detect fake Covid-19 certificates, he said.

Goromonzi And Waddilove High Schools Close Due To Covid-19

Goromonzi and Waddilove high schools have been forced to close after a combined total of 52 students tested positive for Covid-19 since the opening of schools, according to a report for Mashonaland East Covid-19 daily updates.

A total of 24 cases of Covid 19 were recorded at Wadilove High School on Monday bringing the total number of positive cases at the school to 40 since opening of schools.

Twelve positive cases were also reported at Goromonzi High School where 37 samples were collected.

The report reads, “Waddilove and Goromonzi are now closed communities with no one allowed to get in or out.

“The Health and Child Care Ministry is working with Ministry of Primary and Secondary Education to see if all non-examination classes can be sent back home under strict monitoring to de-congest the schools.”

“A total of 56 students have so far been infected in Mash East since the opening of schools,” reads the report.

Last month Wise Owl Private School in Marondera was also forced to close after a pupil had tested positive for Covid-19. The school however, re-opened after contact tracing was done and results came out negative.

Meanwhile, Government is organising logistics for implementing practical measures to minimise the recurrence of the John Tallach High School in Matabeleland North where 110 pupils got infected last month.

Breaking The Nation Divide; IsiNdebele Learning Compulsory At Mvurwi Primary School In Mash Central

While the people of Matabeleland have been complaining about some teachers and lecturers teaching local students in Shona, Mashonaland Central has been busy embracing Ndebele as a national language.

“Salibonani,” the children speak in unison as we enter a Grade 5 class at Umvukwesi Primary School in Mvurwi.

“Sikhona, linjani bantwana?” we answered.

“Thina siyaphila,” they replied, before sitting down.

One could have been forgiven for thinking that we were in the heart of Matabeleland, but this is Mashonaland Central where Ndebele has been introduced as part of the school curriculum.
Pupils at Umvukwesi are breaking the language barriers to unify Zimbabwe.

The idea of introducing national languages across the board was first mooted by education officials in Mashonaland Central before being put on the debate table by the Education Ministry.
Umvukwesi Primary School has set the ball rolling as a pilot project.

“We found it rational to introduce it as a communicable language first in 2001. The emphasis was placed on the national spectrum in that communication would be made easier,” said the headmaster of Umvukwesi, Andrew Taruvinga.

“We thought that the language might be of use, in case the children might find themselves in Ndebele-speaking regions, thus they will be able to apply the basics of the language,” he added.
Taruvinga said the whole school, which comprises more than 450 pupils, was now able to read and write isiNdebele.

To test his assertion, the headmaster took us to a Grade One class where two pupils picked at random showed their new language skill.

“Igama lami nguRopafadzo Mukwati, ngivela emaphandleni eShamva (My name is Ropafadzo Mukwati, I come from Shamva),” said a seven-year-old.

“Namhla kuyatshisa, engxenye izulu lingana (Today it is hot, maybe it will rain),” added another seven-year-old boy who wanted to show his proficiency in the language.
Taruvinga is proud of the legacy his school is creating.

He said: “Impressed by the enthusiasm displayed by the kids, the Ndebele community in the surrounding areas have come en masse to help in the setting and moderation of the subject.

“The problem was that supervisors from the district and the province are Shona speakers who were hitting a brick wall in as far as supervision of the subject is concerned viz-a-vis the curricula and the syllabi.”

Taruvinga said they had now set their target on grasping the concept before the first class can sit the Grade Seven national examinations in the not-too-distant future.

Taruvinga said the other major obstacle they were facing was the shortage of Ndebele teaching resources.

“The whole school of more than 12 classes is being catered for by only two teachers who are finding it hard to cope with the increasing demands of the subject,” he said.
Taruvinga added that the children are showing a lot of excitement and enthusiasm about the subject.

“It’s amazing that you find the pupils using the Ndebele language everywhere, whether it’s on the playing fields or in the school corridors. They are now just proud of the language,” he said.

Nancy Mudiwa, the District Education Officer for the Mvurwi area, concurred with the headmaster on the need to augment the available resources.

“Emphasis should be put on widening the obtaining resource base like increasing Ndebele teaching staff and buying more textbooks before the subject can be transformed from being communicable to examinable,” she said.

Mudiwa said more schools in the region were now clamouring for the subject after witnessing the successful Umvukwesi Primary School pilot project.

“Issues pertaining to the sound administration of the subject must first be addressed before the subject can be offered to other schools,” she said.

Progressive Teachers’ Union of Zimbabwe secretary-general Raymond Majongwe said the idea was a brilliant move which must be applauded by all.

“I would want to believe that pupils must be able to converse in all the recognised languages in this country so that we may become one,” he said.

“We should not become foreign in our land and I would want to pray for a situation where Tonga is taught in Manicaland, Kalanga in Masvingo and Venda in Mashonaland,” said Majongwe.

Walter Vengesai, a linguistics expert formerly with the Midlands State University, said students from Mashonaland Central should be applauded for piloting the Ndebele project as language plays a significant role in unifying a nation.

He said: “Language is a major vehicle for fomenting conflicts or uniting people all over the world. A considerable number of tribal and genocidal conflicts have been caused by differences mainly in language, so the universality of language plays a significant role in uniting people.

“Language difference has been used by merchants of tribalism as a means of identifying the perceived enemy, so the future generation has actually shamed those who harboured fuelling tribal conflicts in future as it will be difficult to identify enemies or foes through the use of language.”

Logarusic Unhappy With Warriors Preparations For CHAN Tournament

National team coach Zdravko Logarusic says he is disappointed after the plans to hold a mini-league tournament have been scrapped off.

There is no official word from the PSL nor ZIFA but it is believed the competition is no longer happening due to lack of funds.

Logarusic, who wanted to use the mini league for Warriors’ Chan squad selection,is not happy and has bemoaned how this will affect the team.

An all locally-based Zimbabwe team is set to take part at the CHAN tournament in January and will play in the opening match against hosts Cameroon.

Speaking to the Herald, the gaffer said: “Of course, I am disappointed the mini-league is not taking place, we are missing competitive games, that’s for sure, but what we can do?

“We have to adapt to the situation, which is there right now, and that’s all.

“A player with competitive games, and a player without competitive games, is not the same, it’s very simple.

“We needed the mini-league but if league couldn’t go on we must adapt. Our players are better when they play competitive games.

“Competitive football is competitive game, friendly game is friendly game.”

By A Correspondent- A Kwekwe man has sued the Zimbabwe Electoral Commission (Zec) seeking to nullify the swearing into Parliament of MDC-T leader Thokozani Khupe and 14 MPs from her party following the recalls of MDC Alliance legislators.

In a High Court application, Charles Madhiwa cited Zec and its chairperson Priscilla Chigumba, Khupe, the MDC-T and the 14 legislators as respondents.

Khupe was sworn in together with her allies Memory Munochinzwa, January Sawuke, Lindani Moyo, Sipho Makone, Yvonne Musarurwa and Lwazi Sibanda after the recall of the MDC Alliance legislators.

Others who took up seats in the Senate are Khaliphani Phugeni, Piniel Denga, Chief Ndlovu, Nomalanga Khumalo, Teti Chisorochengwe, Gertrude Moyo, Tamani Moyo and Molly Dorothy Ndlovu.

Madhiwa, who voted in Mbizo constituency during the 2018 general elections, said Zec could only fill proportional representation vacancies in Parliament with with members of the party previously holding the seat.

He said according to the Constitution, members of independent commissions are prohibited from exercising their functions in a partisan manner to “further the interests of any political party or cause; prejudice the interests of any political party or cause; or violate fundamental rights or freedoms of any person”.

“As voters in 2018, I and other voters had to choose whom we would vote for. We could choose a candidate sponsored either by MDC-T or by MDC Alliance in an election, but not for a candidate sponsored by both, as those did not exist,” Madhiwa argues.

“Hence everyone, including myself, who voted validly in that election had made a choice and clearly shown the party (or independent) we wanted to hold a seat.”

Madhiwa said following recalls of MDC Alliance MPs, their vacancies ought to have been filled by persons belonging to the same party as theirs in compliance with Section 157 of the Constitution.

Madhiwa and several other citizens filed their objections with Zec on September 1 which were allegedly ignored and on October 2, Chigumba published in the Government Gazette a list of MDC-T members who were scheduled to fill the positions that had become vacant after the recalls.

“I humbly submit that the proceedings of Zec and the chairperson and the resultant decision to accept hook, line and sinker the communication from Parliament advising of the recalls, acting on that advice, and proceeding to invite the MDC-T, which only had two legislators in Parliament, to submit nominees for the replacement of the 15 legislators from MDC Alliance, was grossly irregular.

“I further submit that the Zec and the chairperson were irrational in this decision, in the sense that they arrived at a decision so outrageous in its defiance of logic or accepted moral standards that no sensible person who has applied his mind to the question to be decided could have arrived at it,” he argued.

The matter is yet to be set down for hearing.

Pieter de Jongh found himself on the receiving end after trying to potray Bulawayo Chiefs as a team with no championship-winning material.

De Jong, who is jobless after parting was with FC Platinum last month, was responding to a comment posted on Twitter when the clash began.

“No Psycho social Support For Families Of Trapped Miners”

By A Correspondent- Bindura communities have blasted government over failure to offer support to families of victims who perished in the Ran Mine disaster.

Families of the estimated 30 men who are feared dead when the mine collapsed last week have been camped at the site for over a week now.

Ran gold mine, which is situated 70 kilometres north of Harare collapsed in Bindura last Wednesday, trapping an estimated 40 illegal gold panners.

It is reported that only six men emerged alive from the disaster while leaving an estimated 30 others trapped and unaccounted for, according to officials. Rescue efforts delayed to start off and only started 3 days later after the tragedy.

The generator used to drain the 100-metre-deep mine shaft jammed and another one had to be sourced, a development that delayed the rescue effort.

Said a local villager only identified as Moyo:

“These women, men and children are traumatised. From day one when news filtered in that their relatives had been trapped underground, these people had hope that government would move in swiftly and rescue the trapped miners alive. That hope is now gone and we have a people in anguish.

“Government officials who are supposed to be bringing good news of how government will rescue the trapped miners or retrieve their dead bodies come here in their lavish cars, wearing their expensive suits and holding tablets. They just walk around as if they are showing off to us. They come here to ask questions and nod their heads without offering any solution to the problem.”

Farirai Dube, who resides near the abandoned Ren mine accused the government of neglecting families of the victims of the tragedy.

“As you can see, there are two tents here one for the police and one for the families of the victims. When the police officers are getting their food, these families will just be watching. Besides food supplies, these families need social workers for psychological support and counselling services but they are getting nothing. There is a crisis here and the communities are becoming agitated because of the poor co-ordination by government to retrieve these trapped miners.”

Last week, one man died while offering rescue services.

The victim Wellington House fell into the tunnel around 6pm on Saturday and he was buried with government assistance.

Information ministry permanent Secretary Nick Mangwana revealed that government provided a coffin as well as food items to the grieving family.

Duo Jailed 15yrs For Explosives Smuggling In S.A

By A Correspondent- A Musina magistrate on Tuesday jailed two Zimbabwean men for 15 years for smuggling explosives worth R470 000 into South Africa through the Beitbridge Border Post.

Patson Banda (25) and Life Mbazi (33) were arrested by the Directorate for Priority Crime Investigation (Hawks) in March while crossing into the neighbouring country.

They had loaded the contraband in two trolleys.

Since their arrest, Banda and Mbazi have been languishing in remand prison after their several applications for bail pending trial were dismissed at the Musina Magistrates Court.

Hawks spokesperson for Limpopo Province, Captain Matimba Malulele said the conviction and sentencing of the accused persons was a warning to would-be offenders.

The explosives have since been forfeited to the state.

“On 13 March 2019, the Hawks’ Serious Organised Crime Investigation members received a tip-off about people who were smuggling explosives from Zimbabwe into South Africa,” he said.

“The Hawks members assisted by Beitbridge Crime Prevention members kept an observation at Beitbridge Port of Entry until they saw two suspicious people pushing a trolley full of parcels.

Upon searching the trolley, explosives worth over R470 000-00 were found wrapped with plastics and the duo was arrested”.

The smuggling of explosives into South Africa through Beitbridge has become a perennial headache for border authorities.

It is understood that the explosives are used for ATM bombings or illegal mining activities in the neighbouring country.

More than 20 people have been arrested along Zimbabwe boundary with South Africa with explosives in the last 24 months.

Popular Warriors Supporter Alvin Zhakata Discharged From Hospital

Warriors and Dynamos superfan Alvin ‘Aluvha’ Zhakata has been discharged after spending almost two weeks admitted at Harare’s Parirenyatwa hospital.

Aluvha was attacked by thugs in Chitungwiza last month and suffered three broken ribs which perforated his right lung, resulting in Pneumothorax.

Posting on Twitter, the superfan said: “(I am) Glad to share with you the good news that I have been discharged from hospital.

21 Countries Eliminate Malaria

The World Health Organization (WHO) is calling on countries and global health partners to step up the fight against malaria, a preventable and treatable disease that continues to claim hundreds of thousands of lives each year.

A better targeting of interventions, new tools and increased funding are needed to change the global trajectory of the disease and reach internationally-agreed targets.

According to WHO‘s latest World malaria report, progress against malaria continues to plateau, particularly in high burden countries in Africa. Gaps in access to life-saving tools are undermining global efforts to curb the disease, and the COVID-19 pandemic is expected to set back the fight even further.

“It is time for leaders across Africa – and the world – to rise once again to the challenge of malaria, just as they did when they laid the foundation for the progress made since the beginning of this century,” said WHO Director-General Dr Tedros Adhanom Ghebreyesus. “Through joint action, and a commitment to leaving no one behind, we can achieve our shared vision of a world free of malaria.”

In 2000, African leaders signed the landmark Abuja Declaration pledging to reduce malaria deaths on the continent by 50% over a 10-year period. Robust political commitment, together with innovations in new tools and a steep increase in funding, catalyzed an unprecedented period of success in global malaria control. According to the report, 1.5 billion malaria cases and 7.6 million deaths have been averted since 2000.

A plateau in progress

In 2019, the global tally of malaria cases was 229 million, an annual estimate that has remained virtually unchanged over the last 4 years. The disease claimed some 409 000 lives in 2019 compared to 411 000 in 2018.

As in past years, the African Region shouldered more than 90% of the overall disease burden. Since 2000, the region has reduced its malaria death toll by 44%, from an estimated 680 000 to 384 000 annually. However, progress has slowed in recent years, particularly in countries with a high burden of the disease.

A funding shortfall at both the international and domestic levels poses a significant threat to future gains. In 2019, total funding reached US $3 billion against a global target of $5.6 billion. Funding shortages have led to critical gaps in access to proven malaria control tools.

COVID-19 an added challenge

In 2020, COVID-19 emerged as an additional challenge to the provision of essential health services worldwide.

According to the report, most malaria prevention campaigns were able to move forward this year without major delays. Ensuring access to malaria prevention – such as insecticide-treated nets and preventive medicines for children – has supported the COVID-19 response strategy by reducing the number of malaria infections and, in turn, easing the strain on health systems. WHO worked swiftly to provide countries with guidance to adapt their responses and ensure the safe delivery of malaria services during the pandemic.

However, WHO is concerned that even moderate disruptions in access to treatment could lead to a considerable loss of life. The report finds, for example, that a 10% disruption in access to effective antimalarial treatment in sub-Saharan Africa could lead to 19 000 additional deaths. Disruptions of 25% and 50% in the region could result in an additional 46 000 and 100 000 deaths, respectively.

“While Africa has shown the world what can be achieved if we stand together to end malaria as a public health threat, progress has stalled,” said Dr Matshidiso Moeti, WHO Regional Director for Africa. “COVID-19 threatens to further derail our efforts to overcome malaria, particularly treating people with the disease. Despite the devastating impact COVID-19 has had on African economies, international partners and countries need to do more to ensure that the resources are there to expand malaria programmes which are making such a difference in people’s lives.”

WHO response

A key strategy to reignite progress is the “High burden to high impact” (HBHI) response, catalyzed in 2018 by WHO and the RBM Partnership to End Malaria.

The response is led by 11 countries – including 10 in sub-Saharan Africa – that account for approximately 70% of the world’s malaria burden.

Over the last 2 years, HBHI countries have been moving away from a “one-size-fits all” approach to malaria control – opting, instead, for tailored responses based on local data and intelligence. A recent analysis from Nigeria, for example, found that through an optimized mix of interventions, the country could avert tens of millions of additional cases and thousands of additional deaths by the year 2023, compared to a business-as-usual approach.

While it is too early to measure the impact of the HBHI approach, the report finds that deaths in the 11 countries were reduced from 263 000 to 226 000 between 2018 and 2019.  India continued to make impressive gains, with reductions in cases and deaths of 18% and 20%, respectively, over the last 2 years. There was, however, a slight increase in the total number of cases among HBHI countries, from an estimated 155 million in 2018 to 156 million in 2019.

Meeting global malaria targets

This year’s report highlights key milestones and events that helped shape the global response to the disease in recent decades.

Beginning in the 1990s, leaders of malaria-affected countries, scientists and other partners laid the groundwork for a renewed malaria response that contributed to one of the biggest returns on investment in global health.

According to the report, 21 countries eliminated malaria over the last 2 decades; of these, 10 countries were officially certified as malaria-free by WHO. In the face of the ongoing threat of antimalarial drug resistance, the 6 countries of the Greater Mekong subregion continue to make major gains towards their goal of malaria elimination by 2030.

But many countries with a high burden of malaria have been losing ground. 

According to WHO global projections, the 2020 target for reductions in malaria case incidence will be missed by 37% and the mortality reduction target will be missed by 22%.

Plans For Gogo Chamisa Memorial Service At Advanced Stage

Tinashe Sambiri|The memorial service for the late Gogo Alice Chamisa is set for Saturday December 5.

According to MDC Alliance Secretary General, Hon Charlton Hwende, plans for the event are at an advanced stage.

Hundreds of MDC Alliance members and Zimbabweans in general are expected to attend the memorial service.

“This coming Saturday, the 5th of December 2020, we will be joining our President

Grade One Pupil Shoplifts Condoms

By A Correspondent- A Grade One pupil at Helen McGhee Primary School was apprehended by alert staff at OK Supermarket on Monday after he stole a packet of condoms that he had mistaken for sweets.

According to Masvingo Mirror, the boy’s mother noticed that her son was holding something in his hand as she got to the security checkpoint at the point of exit.

Security guards who searched the boy found more condom packets in his pockets and when asked, the boy said he mistook the condoms for sweets.

The boy and his mother were taken to the back of the supermarket where he was cautioned and let go. Masvingo Mirror quoted a source as having said:

A boy who was accompanied by his mother took packets of Durex condoms and put some in his pockets. The mother realised after she had paid for her goods at the till that her child was holding something.

ZIMRA Employees Test COVID-19 Positive

By A Correspondent- The Zimbabwe Revenue Authority (ZIMRA) is streamlining operation at Beitbridge where eight of its employees tested positive for Covid-19.

The tests are part of strict and tight health management measures the Government employed to ensure the safety of travelers and its workers under the new border set up.

Everyone leaving or entering the country through Beitbridge is being thoroughly screened at the entrance of the border arena and all buildings.

Beitbridge, Plumtree, Forbes, Chirundu, and Victoria Falls land borders re-opened to passenger traffic on Tuesday morning.

As a precautionary measure, towards the re-opening, the Ministry of Health and Child Care tested all border workers to ascertain the exact number of those fit for duty.

In a statement today, Zimra said it was taking the necessary precautionary steps, as guided by World Health Organisation with the assistance of the Ministry of Health and Childcare to ensure the safety of its workers and travelling public.

“ZIMRA is very aware that due to the unique location of our offices and stations coupled with the essential nature of the services we provide there is a need to remain vigilant in observing and practicing procedures that reduce exposure to COVID-19.

In order to safeguard employees, clients, and the public, Zimra continues to implement guidelines from the World Health Organisation and the Ministry of Health and Childcare in reducing the impact of the COVID 19 threat to operations and human life,” said the revenue collector.

All stakeholders at Beitbridge have had tests done as well as contact tracing and our staff continues to offer essential services under Covid-19 protocols.

Some of the steps taken include; testing contacts of all suspected Covid-19 cases and that it had immediately closed some offices for disinfection.

“The re-opening of disinfected offices will be done with the assistance and guidance of the relevant local medical authorities.

“Where practical Zimra stations and offices maintain critical skeleton staff. In addition, staff are being provided with appropriate Personal Protective Equipment (PPE) and sanitisers; and services are, as much as possible, being offered to clients/agents via electronic means” said the statement.

Zimra said it was encouraging travelers to use clearance methods of goods which minimise human interface between its employees and clients.

In addition, all travelers importing dutiable goods must pre-clear and pre-pay before arriving at the border to reduce crowding and the time spent at border posts.

“As a mitigating measure against the spread of COVID-19 virus, clients are encouraged to access, utilise the available ZIMRA e-service facilities on www.efiling.zimra.co.zw or www.zimra.co.zw and reduce the risks associated with travelling or handling physical documents,” said the revenue collector.

The authority also called on people to prioritise public health at all ports of entry.

Meanwhile, ninety-five new Covid-19 cases were recorded today, as cases continue to rise.

However, no death was reported in the last 24 hours.

The rise in cases has left the seven-day rolling average for new cases at 104.

Yesterday, 1 029 PCR tests were done, implying a positivity rate of 9,2 percent.

A daily Covid-19 update released by the Ministry of Health and Child Care last night shows that all the 95 cases are local transmissions.

The spate of new cases recorded in the last seven days has left active cases at 1 209.

As of yesterday, Zimbabwe has recorded 10 129 cases, 8 643 recoveries and 277 deaths.

Government continues to implore citizens to observe guidelines aimed at containing the spread of Covid-19, which include wearing of face masks in public, maintaining social distance, washing hands with soap or ash and sanitising, among others.

South Africa has now surpassed 780 000 cases and has the highest cases and deaths per capita in the SADC region.-statemedia

Villagers who spoke to ZimEye.com at Ngungumbane Business Centre in Mberengwa on Sunday said they were fed up with Zanu PF’s empty promises.

According to the villagers, Zanu PF leader, Mr Emmerson Mnangagwa, has nothing to offer to the suffering Zimbabweans.

“We are tired of being used by Zanu PF, this time we will not be cowed into submission,” said a villager who identified himself as Hove.

“Mr Mnangagwa is useless, actually he has nothing to offer to the people of Zimbabwe.
He gave us regalia but we mind you we do not eat t-shirts,” said a villager called Chuma.

According to President Chamisa, the construction of spaghetti roads is possible but that can only happen when the legitimacy crisis has been resolved.

President Chamisa has also pointed out that winning Zimbabwe for total transformation is possible.

Relief As Popular Warriors Supporter Is Discharged From Hospital

Warriors and Dynamos superfan Alvin ‘Aluvha’ Zhakata has been discharged after spending almost two weeks admitted at Harare’s Parirenyatwa hospital.

Aluvha was attacked by thugs in Chitungwiza last month and suffered three broken ribs which perforated his right lung, resulting in Pneumothorax.

Posting on Twitter, the superfan said: “(I am) Glad to share with you the good news that I have been discharged from hospital.

“The fight, however, is far from over, I’m still nursing three broken ribs, but the healing process can take place while I’m at home.”-Soccer 24

Diaspora Vote A Non-negotiable Right

DIASPORA VOTE IS A NON-NEGOTIABLE RIGHT!

2013 CONSTITUTION IS VERY CLEAR, MDC ALLIANCE NAMIBIA DEMANDS ONE-MAN ONE-VOTE.

Mdc Alliance Namibia remains convinced that diaspora vote is a non-negotiable right conforming to the supreme law of the country as stipulated on Section 155 which unequivocally states that all citizens should vote regardless of their geographical location. This has meant that the Zanupf government bears the responsibility to ferry the ballot box to Zimbabweans wherever they are in the diaspora be it in Namibia, South Africa, Tunisia, Zambia, United States of America, United Kingdom, Australia, Canada , Germany only to mention but a few.

Prior to the advent of the 2013 constitution, in 2006, the Supreme Court ruled that voting was not a fundamental right therefore Zanupf and their proxies argued that the diaspora vote was not a universal basic human right.

Subsequent court appeals by diaspora residents could not transform the outcome of the court but today as Mdc Alliance Namibia, we want to stand firm championing constitutional democracy. Chinamasa, the Zimbabwe Electoral Commission and their clueless Zanupf regime must realise that the aspects of Constitutional Law and Electoral Law should not be compromised aided by their unconstitutional reasoning.

Moreover, Mdc Alliance Namibia intends to inform Chinamasa that we are conscious to the fact that Zimbabwean citizens in the diaspora play a significant role in the development of the motherland.

The undoubted contribution of the diaspora residents was exhibited in 2016 when the Reserve Bank of Zimbabwe (RBZ) unearthed that the diaspora accounted for US$700 million in direct remittances.

Adding to the above mentioned astounding amount, they also spend a lot whenever they return home in support of their desperate relatives who are languishing in abject poverty.

The neglected diaspora community could also contribute through investment in available productive sectors that enhance economic boom and employment creation.

Moreso, diasporas can further be tapped to contribute to policy dialogue as well as the transfer of knowledge and skills to deal with serious national issues. The politically inept Zanupf government must hasten to realise that deprived of the inclusion of the citizens in the diaspora, we will perpetually witness an unprecedented increase in unemployment, senseless and barefaced corruption, intimidation and extremely poor livelihoods in the country.

A closer scrutiny to the denial of diaspora vote is incontrovertible evidence to prove Zanupf’s autocracy and totalitarianism. This unravels the extraordinary lack of political will on the part of desperate Zanupf to organise and process elections that will guarantee an objective fulfillment of One-Man-One-Vote. It is only the phobia of an obvious embarrassment from social democrats in the diaspora who ran away from Zanupf’s gross misgovernance. We demand comprehensive political and electoral reforms to avoid disputed elections in the country.

Furthermore, it is quite pathetic that Zec and Zanupf government are still reluctant to implement the 2013 Constitution citing the traditional political rhetoric concealed behind the membrane of resource dearths ,as well as the undersupply of information on the whereabouts of citizens that reside in the diaspora. Mdc Alliance Namibia does not resonate with these political lies that are being paddled by Zanupf power mongers.

This is a deliberate ploy to deny diasporas their right to vote since to them , voting is a way of sanitising rigging of the people’s voices with impunity. We were perturbed to hear loud mouthed( Mr Bin) Patrick Chinamasa pronouncing that the 2023 elections were already over before the votes. Namibia district would like to encourage our parliamentarians to revisit the Electoral Act to deal with disputed elections once and all. We are tired of stolen elections since the inception of the Mdc in 1999.

Mdc Alliance Namibia is furiously demanding an immediate end to selfishness, rapaciousness and unbridled individualism which have become a national religion in Zanupf politics of the belly and self-enrichment.

If Zanupf is democratic enough, it must realise that the diasporas should not be limited or restrained in their quest to decide on the governance of their beloved country like what other African, European, Asian and American states are doing to those who live beyond borders.

Zimbabwe must emulate neighbours who respect their citizens abroad by granting them voting rights.

In Namibia, Namibians in the diaspora have been accorded their voting rights in the national elections since 2014, when amendments were made to the Electoral Act of 2009, Namibian expatriates may vote at temporary registration points , usually set up at Namibian embassies or high commissions. In consonance with Chapter 1 , Section 10 of the Electoral Act 73 of 1998, South African citizens staying abroad retain the right to vote in national elections , with no expiry date.

In addition , Tunisian expatriates have been allowed the right to vote in Presidential elections since 1988, and additionally in parliamentary elections since the Tunisian Revolution in 2011.

Emmerson Dambudzo Mnangagwa and his government must be prepared to handle these reforms before 2023 because NO TOLERANCE to election rigging in the next episode.

To wind it up, Mdc Alliance Namibia District would like to make an informed fall up on this fundamental issue.

We resonate with Gabriel Shumba, the leader of Zimbabwe Exiles Forum and others who had the varlour and mettle to approach the African Commission on Human and People’s rights in Banjul (The Gambia) in 2013 which granted them a provisional order allowing diaspora vote. What the hard-headed Zanupf dictators must consider is that our Motherland can only evade poverty in all facets of development if the electorate is given their democratic rights to express his/her preference.

This will automatically act as a resounding catalyst for better and sound governance as well socio-economic transformation.

We Do Not Eat T-shirts, Mberengwa Villagers Tell Mnangagwa

Tinashe Sambiri|Although Mberengwa District is traditionally regarded as a no-go area for the opposition, the winds of change are blowing across the region.

Villagers who spoke to ZimEye.com at Ngungumbane Business Centre in Mberengwa on Sunday said they were fed up with Zanu PF’s empty promises.

According to the villagers, Zanu PF leader, Mr Emmerson Mnangagwa, has nothing to offer to Zimbabweans.

“We are tired of being used by Zanu PF, this time we will not be cowed into submission,” said a villager who identified himself as Hove.

“Mr Mnangagwa is useless, actually he has nothing to offer to the people of Zimbabwe.
He gave us regalia but we mind you we do not eat t-shirts,” said a villager called Chuma.

Another villager added:
“Mr Mnangagwa is insensitive to the plight of the suffering people of Zimbabwe.He wants our support yet he is not concerned about our welfare – this time we will not be hoodwinked by his party.”

KWEKWEZA, ZIMUDZI PLEAD NOT GUILTY AS TRIAL OVER PROTEST AGAINST TINKERING WITH CONSTITUTION COMMENCES

TWO budding pro-democracy campaigners on Tuesday 1 December 2020 pleaded not guilty to charges of promoting public violence when their trial commenced before Harare Magistrate Vongai Muchuchutu-Guwuriro.

22 year-old Namatai Kwekweza and 23 year-old Esther Vongai Zimudzi denied accusations preferred against them of participating in a gathering with intent to promote public violence, breaches of peace, or bigotry as defined in section 37(1)(b) of the Criminal Law
(Codification and Reform) Act.

Kwekweza and Zimudzi, who are represented by Tinashe Chinopfukutwa and Rudo Bere of Zimbabwe Lawyers for Human Rights, were arrested by Zimbabwe Republic Police (ZRP) officers on Friday 19 June 2020 after they allegedly gathered at the New Government Complex in Harare, where they intended to hand over a petition to Justice, Legal and
Parliamentary Affairs Minister Hon. Ziyambi Ziyambi in which they were protesting against the holding of some public hearings into proposed amendments to the Constitution.

Prosecutors claimed that Kwekweza, who is a member of WeLead Organisation for Young People and Zimudzi, who is a member of Section 20 Organisation and are currently out of prison custody on RTGS$3 000 bail each, displayed placards which read; “A senseless charade in the name of the Constitution Amendment No. 2 Bill public hearing—–Minister you are out of order”; “!!!#Ngazvitangidzwe!!!”; “3.3 million Zimbabweans were consulted about the Constitution in 2013, 94.4% voted yes”; “Don’t amend the Constitution until you
consult 3.3 million Zimbabweans”; “#Stop cosmetic Constitutions” and “Don’t take advantage of COVID-19”.

The prosecutors, who led evidence from one witness Assistant Inspector Joram Mupona of ZRP, charged that Kwekweza and Zimudzi’s actions were abusive, insulting and intended to provoke the breach of peace.

The two pro-democracy campaigners return to court on Friday 4 December 2020 for continuation of their trial, where two other State witnesses namely Constable Austin Muzvuve and Constable Rosemary Mutsure, who are both members of ZRP will give evidence against Kwekweza and Zimudzi.

Senior Politburo Members To Supervise DCC Elections

By A Correspondent- The ruling ZANU PF has told its structures that due to financial constraints, senior politburo members will be supervising the District Coordinating Committees (DCC) elections instead of poll observers as initially stated.

The elections were scheduled to run between December 5 and 6 in eight provinces.

This new position was announced in a letter addressed to provincial chairpersons from the party director for the commissariat, Davison Gomo, dated November 28. Reads the letter in part:

Due to logistical and financial constraints, the original plan where all polling officers were meant to come from a supervising province is no longer sustainable.

The supervising team will be made up of senior leaders from the politburo, one commissariat commissioner, provincial chairpersons and a team from his or her province, from whom the presiding officer will be appointed.

Consequently, the polling officers, at ward centre level will be selected from senior members of the party.

Gomo also asked the provincial chairpersons to “facilitate the provision of district executive registers that were used in the 2017/18 polls for the general election of 2018”.

In a different letter also dated 28 November, Gomo said:

The leadership determined that the forthcoming DCC elections will be conducted on the basis of the registers referred to above and therefore, there is urgent need to make these available to us at the earliest convenience possible.

The party goes to the polls amid reports of factionalism and tussling to control the districts.

Meanwhile, there are concerns in some quarters over the government’s “double standards” after Chiwenga who doubles as the minister of Health and Child Care suspended by-elections indefinitely citing the prevalence of the coronavirus.

8 ZIMRA Employees At Beitbridge Border Post Tests COVID-19 Positive

The Zimbabwe Revenue Authority (ZIMRA) is streamlining operation at Beitbridge where eight of its employees tested positive for Covid-19.

The tests are part of strict and tight health management measures the Government employed to ensure the safety of travelers and its workers under the new border set up.

Everyone leaving or entering the country through Beitbridge is being thoroughly screened at the entrance of the border arena and all buildings.

Beitbridge, Plumtree, Forbes, Chirundu, and Victoria Falls land borders re-opened to passenger traffic on Tuesday morning.

As a precautionary measure, towards the re-opening, the Ministry of Health and Child Care tested all border workers to ascertain the exact number of those fit for duty.

In a statement today, Zimra said it was taking the necessary precautionary steps, as guided by World Health Organisation with the assistance of the Ministry of Health and Childcare to ensure the safety of its workers and travelling public.

“ZIMRA is very aware that due to the unique location of our offices and stations coupled with the essential nature of the services we provide there is a need to remain vigilant in observing and practicing procedures that reduce exposure to COVID-19.

In order to safeguard employees, clients, and the public, Zimra continues to implement guidelines from the World Health Organisation and the Ministry of Health and Childcare in reducing the impact of the COVID 19 threat to operations and human life,” said the revenue collector.

All stakeholders at Beitbridge have had tests done as well as contact tracing and our staff continues to offer essential services under Covid-19 protocols.

Some of the steps taken include; testing contacts of all suspected Covid-19 cases and that it had immediately closed some offices for disinfection.

“The re-opening of disinfected offices will be done with the assistance and guidance of the relevant local medical authorities.

“Where practical Zimra stations and offices maintain critical skeleton staff. In addition, staff are being provided with appropriate Personal Protective Equipment (PPE) and sanitisers; and services are, as much as possible, being offered to clients/agents via electronic means” said the statement.

Zimra said it was encouraging travelers to use clearance methods of goods which minimise human interface between its employees and clients.

In addition, all travelers importing dutiable goods must pre-clear and pre-pay before arriving at the border to reduce crowding and the time spent at border posts.

“As a mitigating measure against the spread of COVID-19 virus, clients are encouraged to access, utilise the available ZIMRA e-service facilities on www.efiling.zimra.co.zw or www.zimra.co.zw and reduce the risks associated with travelling or handling physical documents,” said the revenue collector.

The authority also called on people to prioritise public health at all ports of entry.

Meanwhile, ninety-five new Covid-19 cases were recorded today, as cases continue to rise.

However, no death was reported in the last 24 hours.

The rise in cases has left the seven-day rolling average for new cases at 104.

Yesterday, 1 029 PCR tests were done, implying a positivity rate of 9,2 percent.

A daily Covid-19 update released by the Ministry of Health and Child Care last night shows that all the 95 cases are local transmissions.

The spate of new cases recorded in the last seven days has left active cases at 1 209.

As of yesterday, Zimbabwe has recorded 10 129 cases, 8 643 recoveries and 277 deaths.

Government continues to implore citizens to observe guidelines aimed at containing the spread of Covid-19, which include wearing of face masks in public, maintaining social distance, washing hands with soap or ash and sanitising, among others.

South Africa has now surpassed 780 000 cases and has the highest cases and deaths per capita in the SADC region.

Friend Kills Colleague For Wearing His Clothes Without Permission

By Own Correspondent| Mangwe illegal gold panner is on the run after he allegedly beat up his workmate to death for wearing his clothes without permission.

Matabeleland South acting provincial spokesperson, Inspector Loveness Mangena confirmed the incident which occurred in Togotshweu Village in Mphoengs area.

She said the suspect Mpilo Nyoni of Makhubu Village assaulted the now deceased Mr Philani Gumbo on Thursday and his body was found on Sunday.

“I can confirm that we recorded a murder incident which occurred in Togotshweu Village in Mphoengs area. Mpilo Nyoni and Philani Gumbo who are both illegal panners were drinking at Mahlangu Mine at around 3AM when Nyoni started accusing his peer of wearing his clothes without permission which resulted in a misunderstanding.

“Nyoni started assaulting Gumbo who then fled from the scene. Nyoni pursued him and is suspected to have caught up with him and further assaulted him before leaving him in the bush. Gumbo’s body was found two days later by a passerby who then alerted other villagers.

The matter was reported to the police who attended the scene,” she said.

Insp Mangena said Nyoni was on the run and appealed to members of the public with information that could lead to his arrest to contact any nearest police station.

Pfumvudza Launched In Harare

By A Correspondent| Government has launched the pfumvudza programme in Harare with the Provincial Development Coordinator Tafadzwa Muguti saying their focus is to ensure food security in urban and peri urban areas.

Posting on Twitter soon after launching the programme, Muguti said Agritex will work with City of Harare, Chitungwiza, Ruwa and Epworth in identifying suitable non-wetland areas.

Muguti said they are targeting 205 000 families.

Organisation Welcomes High Court Ruling On Govt Publishing Loans Concluded With Afrexim Bank

FULL TEXT: Community Water Alliance welcome the judgement delivered by Justice Zhou where the organization sued Government for failure to publish loans concluded between Government and African Export Import Bank. Transparency in administration of loans has a bearing on access to water since majority of government funded capital projects in the WASH sector have been financed through water loans.

Justice Zhou declared that failure to publish loans is a violation of Section 300(3) of the Constitution of Zimbabwe and Section 18(2) of the Public Debt Management Act.

Justice Zhou instructed the Government of Zimbabwe through Ministry of Finance to publish in an Extraordinary Government Gazette terms and conditions of any loans and guarantees concluded with African Export Import Bank or any third party international financier. A deadline of 30 January 2021 was given.

More MDC Alliance Councillors Dump Chamisa

By A Correspondent- Gokwe mayor Never Gwanzura, Kadoma deputy mayor Tendai Kokera and four Gokwe councillors as well as three Kwekwe councillors have officially crossed the floor from MDC Alliance led by Nelson Chamisa to the Thokozani Khupe-led MDC-T.

The four Gokwe councillors are Machinda Mtembedzi, Darlington Mudondo, Tichaona Muhora and Charity Mungwani.

Kwekwe councillors, who also ditched the Chamisa-led party, include Eric Rukavairo (ward 11), Silas Mukaro (ward 1) and Joshua Tinago (ward 11). They made the announcement at a meeting held at Gokwe centre over the weekend.

The nine councillors said that they had decided to join MDC-T as a way of continuing the people’s mandate since they were elected in 2018.

The nine councillors pledged to honour the leadership of MDC-T.

The MDC-T Midlands north 2014 provincial structures met in Gokwe to brief each other on the progress made in the preparation for the extraordinary congress which is set to elect a replacement of the late founding leader Morgan Tsvangirai.

It was at this meeting that the councillors declared their allegiance to MDC-T.

The meeting was chaired and facilitated by 2014 provincial chairperson Sedwel Bhebhe, who highlight-ed the importance of the delegates to participate in the extraordinary congress processes.

Kwekwe Urban ward 11 councillor Joshua Tinago told NewsDay that he and two other councillors were fully behind Khupe.

“I am happy that my other comrades, Eric Rukavano and Silas Mukaro, openly revealed that they belonged to the MDC-T,” he said.

Kokera, who was the MDC-T deputy provincial chairperson in 2014, said he was going back to MDC-T as it was the party that seconded him during the 2018 general election where he was elected councillor and subsequently voted deputy mayor.

Mtembedzi, popularly known as Comrade Evergreen in Gokwe, who was Midlands North provincial deputy chairperson for the youth in the 2014 structures and currently the acting provincial chairperson, said: “It is not like I am rejoining MDC-T, but the fact of the matter is that I have simply did what the Supreme Court judgment ordered me to do.

“I want to uphold the Supreme Court judgment, hence, my decision to ditch MDC Alliance and move to MDC-T. All we want is to respect our party constitution, nothing else.

He added: All the councillors in Gokwe belong to MDC-T which is led by Thokozani Khupe as the acting president and Chamisa does not have any councillors who is aligned to him.”

Presidential aspirants Douglas Mwonzora and Khupe attended the meeting and took time to present their manifesto to the province.

Mwonzora said:

“I am a constitutionalist and always want to uphold the party constitution. As you know, I was seconded to Copac (Constitution Parliamentary Committee) by the late president Morgan Tsvangirai to represent the party in the Constitution-making process and the results speak volumes about my capabilities.”

“Phugeni R_aped My Daughter”: Victim’s Mother Speaks

By A Correspondent- The mother of a minor, who was allegedly raped by suspended MDC-T spokesperson Khaliphani Phugeni on Monday denied claims that she wanted to “politically soil” his image after he was nominated for Senate.

Phugeni appeared before Western Commonage regional magistrate Sibongile Msipa-Marondedze for continuation of trial for the crime he allegedly committed between June and November 2018 in Emhlangeni and Magwegwe suburbs in Bulawayo.

He denies the charges as defined under section 65 of the Criminal Law, (Codification and Reform) Act, Chapter 9:23.

The complainant’s mother said she informed politicians such as Lovemore Moyo, the United Movement for Devolution leader, and ousted MDC-T organising secretary Abednico Bhebhe, as she wanted to resolve the matter politically.

“(Lovemore) Moyo is my party president and I wanted Moyo to engage Phugeni on this matter at a political level,” the complainant’s mother said when she was being cross-examined by Phugeni’s lawyer Kholwani Ngwenya.

“(Abednico) Bhebhe is my cousin and I did not want him to hear about the matter through the Press or rumours.”

Ngwenya had asked why she took a political route to solve a criminal matter, adding that this fuelled suspicion that she sought to soil Phugeni’s image after he was nominated for Senate.

“I am only after justice for my daughter.

“It is just coincidence as it is also the same time my daughter opened up for the first time.

Phugeni snubbed family meetings to discuss the matter,” the complainant’s mother added.

The woman cannot be named for ethical reasons to protect the identity of the minor.

According to the mother, her daughter suffered depression after the rape ordeal resulting in her turning to intoxicating substances to numb the pain.

“Her behaviour changed — sleeping out and getting drunk. She would refuse to disclose what was going on except to say ‘my problems are piling up’.

“She disclosed the rape ordeal after I threatened to beat her up for untoward behaviour,” the mother said.

The magistrate remanded Phugeni to December 7.

Phugeni has been removed from the position of spokesperson for the MDC-T following the rape charges.

Speaking at a post budget, the central bank chief said it was important for companies to know their customers to avoid being entangled in money laundering cases.

State Withdraws Ginimbi’s Cases

By A Correspondent- The State has withdrawn fraud, tax evasion and money laundering charges against late businessman and socialite Genius “Ginimbi” Kadungure who was set to appear in court yesterday.

Kadungure’s lawyer, Brighton Pabwe of Venturas and Samkange, appeared before Magistrate Trynos Wutawashe and tendered his death certificate, marking the closure of the cases.

Kadungure died on November 8, 2020 in a head on-collision car accident along Borrowdale road in Harare on way to his Domboshava home.

He was being accused of misrepresenting to Zimra that his company Piko Trading Private Limited made total sales of $2 777 678, inclusive of Value Added Tax between February 2009 and March 2016, when in actual fact the company had made sales amounting to $9 092 951.

It was also alleged that Kadungure smuggled about 5 289kg of liquefied petroleum gas into the country between January 2015 and March 2016, prejudicing Zimra of $672 533 in taxes.

He was out on bail the time he died. Teddy Kamuriwo appeared for the State.

Thokozani Khupe In Trouble

HARARE – A Kwekwe man has sued the Zimbabwe Electoral Commission (Zec) seeking to nullify the swearing into Parliament of MDC-T leader Thokozani Khupe and 14 MPs from her party following the recalls of MDC Alliance legislators.

In a High Court application, Charles Madhiwa cited Zec and its chairperson Priscilla Chigumba, Khupe, the MDC-T and the 14 legislators as respondents.

Khupe was sworn in together with her allies Memory Munochinzwa, January Sawuke, Lindani Moyo, Sipho Makone, Yvonne Musarurwa and Lwazi Sibanda after the recall of the MDC Alliance legislators.

Others who took up seats in the Senate are Khaliphani Phugeni, Piniel Denga, Chief Ndlovu, Nomalanga Khumalo, Teti Chisorochengwe, Gertrude Moyo, Tamani Moyo and Molly Dorothy Ndlovu.

Madhiwa, who voted in Mbizo constituency during the 2018 general elections, said Zec could only fill proportional representation vacancies in Parliament with with members of the party previously holding the seat.

He said according to the Constitution, members of independent commissions are prohibited from exercising their functions in a partisan manner to “further the interests of any political party or cause; prejudice the interests of any political party or cause; or violate fundamental rights or freedoms of any person”.

“As voters in 2018, I and other voters had to choose whom we would vote for. We could choose a candidate sponsored either by MDC-T or by MDC Alliance in an election, but not for a candidate sponsored by both, as those did not exist,” Madhiwa argues.

“Hence everyone, including myself, who voted validly in that election had made a choice and clearly shown the party (or independent) we wanted to hold a seat.”

Madhiwa said following recalls of MDC Alliance MPs, their vacancies ought to have been filled by persons belonging to the same party as theirs in compliance with Section 157 of the Constitution.

Madhiwa and several other citizens filed their objections with Zec on September 1 which were allegedly ignored and on October 2, Chigumba published in the Government Gazette a list of MDC-T members who were scheduled to fill the positions that had become vacant after the recalls.

“I humbly submit that the proceedings of Zec and the chairperson and the resultant decision to accept hook, line and sinker the communication from Parliament advising of the recalls, acting on that advice, and proceeding to invite the MDC-T, which only had two legislators in Parliament, to submit nominees for the replacement of the 15 legislators from MDC Alliance, was grossly irregular.

“I further submit that the Zec and the chairperson were irrational in this decision, in the sense that they arrived at a decision so outrageous in its defiance of logic or accepted moral standards that no sensible person who has applied his mind to the question to be decided could have arrived at it,” he argued.

The matter is yet to be set down for hearing.

Marry Mubaiwa Says She Is Being Stalked, Calls Monitored

By Jane Mlambo| The ex-wife of Vice President Constantino Chiwenga, Marry Mubaiwa has spoken out against what she said are plans to kill her as the ongoing divorce battle continues to take centre stage.

Marry appeared in court on Monday on a hospital stretcher after the Harare Magistrates Court had issued her with a warrant of arrest for skipping trial.

This was despite her lawyer Beatrice Mtetwa telling the court that her client could not turn up for trial due to ill-health.

Now Marry says she is a victim of continuous stalking and monitoring of calls from people she did not disclose.

She says she is now living in fear as her tormentors are using every trick in the book to make sure she is dead.

“I am very much afraid for my personal life at the moment. I am living in fear. I just don’t know why I am being stalked and my calls being monitored. They want me dead and are using every trick in the book,” said Marry Mubaiwa.

Last week (on 25 November 2020) a visitor called Camrin came from South Africa. She tested positive for Covid-19.

The following day she was given a negative result to enable her to go back to wherever she came from. One guy she was in contact with (name provided) tested Covid-19 positive on the 27th of November and he is currently in isolation as we speak.

There is need for the authorities at Unki Mine to be transparent about the disease as a way of curbing the spread of the virus.

Zimbabwe is in this economic and political hell-on-earth because for the last 40 years the country has been stuck with a corrupt, incompetent and murderous Zanu PF dictatorship. Zanu PF has rigged the elections and again and again we, the people have allowed the party to govern regardless of its illegitimacy hoping against hope that this time it will be a competent. 

Sadly, after 40 years there are some people who still seek to appease Zanu PF hoping against reason that the regime will put aside its dictatorial powers to become a model democracy. 

Zimbabwe’s Council of Church are back again to their old song, calling on Zanu PF leader, Emmerson Mnangagwa, and MDC A leader, Nelson Chamisa “to find each other”!

“If you want to walk fast, walk alone. But if you want to walk far, walk with others.” argued ZCC advisory board member Bishop Ignatius Makumbe. 

True, for the last 40 years the overwhelming majority of Zimbabweans have allowed Zanu PF to ride roughshod over them; to deny them their basic freedoms and rights including the right to a meaningful vote and even the right to life itself. And after 40 years look where “walking with others” has landed the nation – in this hell-on-earth. 

Following a particularly obnoxious election in 2008, in which Zanu PF blatantly cheated and used wanton violence to win the elections, Zanu PF was forced by SADC to join MDC to form a GNU. The primary purpose of the GNU was to implement a raft of democratic reforms to stop the cheating and violence and thus end the curse of rigged elections and bad governance. 

The leaders of the country’s main political parties did “find each other”, as Bishop Makumbe would put it in forming the 2008 to 2013 GNU. The country had more ministers, deputy ministers, governors, etc., etc.; more chiefs than Indians; and they all sat and enjoyed the trappings of high office. Sadly, that was all they did. 

The GNU failed to implement even one token democratic reform in five years. Not even one! 

With no reforms in place, Zanu PF was able to blatantly rig the 2018 elections and continue with its corrupt, incompetent and tyrannical rule and hence the reason are still stuck in this hell-on-earth. 

Whilst there is a tacit acknowledgement by Bishop Makumbe and his ZCC colleagues that the Zanu PF dictatorship has been a disaster for the country, the reason why the country is stuck in this hell-on-earth. But instead of putting and end to the curse of rigged elections and bad governance the church leaders want to retain Zanu PF and hence the call for Zanu PF and MDC A leaders to find each other. 

This is just foolish because the two party were in the 2008 to 2013 GNU that failed to implement even one reform. It is naive to believe the two parties will do any better given a second GNU. 

After 40 years of appeasing Zanu PF by letting the party rig elections and stay in power regardless, 40 years of blundering from pillar to post dragging the nation deeper and deeper into abject poverty, hopelessness and despair; we have travelled far and fast. The real important question all these has not been how far or how fast we are traveling. It was and still is to this day: Where are we going? 

In 1980 Zimbabwe produced enough food feed her own people with plenty left over to be the breadbasket of the region. The country had the potential to be the South Korea of Africa. “Zimbabwe is jewel of Africa, make sure you look after it,” the late Tanzania President, Julius Nyerere told Mugabe in 1980.

Nyerere’s wise words fell on deaf ears because Mugabe and his Zanu PF cronies have all but destroyed Zimbabwe. After 20 years of misrule Mugabe crowned it with the looting of the farms to give to his ever demanding but wasteful cronies. Ever since the country has relied on imported food aid, we are so poor we cannot even pay for it. 

Zimbabweans are starving in a country that is for all practical purposes, the Biblical Garden of Eden; at least it was under white rule. A damning indictment of failed Zanu PF leadership. 

In 40 years Zanu PF has turning a rich country with a promising future into a basket case Banana Republic, a pariah ruled by corrupt, incompetent, vote rigging and murderous thugs. All ZCC is proposing is that Zanu PF and MDC should “find each other” and continue down the same ruinous path Zanu PF has dragged the nation these last 40 years is the epitome of insanity. 

For the last 40 years we have been travelling in the wrong direction. The right direction and only direction we should travel is one that will finally dismantle the Zanu PF dictatorship, end the curse of rigged elections and bad governance. Appeasing the Zanu PF dictatorship is what got us into this mess in the first place and to hope against reason that it would, even after 40 years, is insane.

Landmark Ruling As Govt Is Ordered to Publish Terms of Loans Borrowed Between 2017 And 2020

In his ruling, High Court Judge Justice Zhou said this should be published in an Extraordinary Government Gazette by 30 January 2021 showing loans and guarantees borrowed or transacted between 2017 to Nov 2020.

Mutsvangwa Party Aftermath- Govt Increases Public Gatherings To 100

By A Correspondent- The maximum limit at any gathering, regardless of what it is for, has now been set at 100, and restaurants can now stay open until 8pm, as Government continues to open society and the economy while maintaining the guard against the Covid-19 threat.

Announcing the changes after yesterday’s Cabinet meeting, Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa said there had been confusion among the public over just how many people were allowed to attend gatherings, with different maximums set for different types.

To simplify the system Cabinet had agreed to set the maximum at 100, regardless of what the gathering was for. This was the maximum for some types of gathering, while others had been kept at a lower limit. Other existing public health regulations make it clear that public health regulations have to be followed at all gatherings, regardless of how many people attend.

The new limits should help people avoid violations at weddings and church services in particular.

60 Litres of Water Per Inmate Daily, High Court Orders

THE government has been ordered by the High Court to ensure that every inmate at the highly fortified Chikurubi Maximum prison gets 60 litres of water daily.

The prison, on the outskirts east of Harare, is home to over 2 000 serving and awaiting trial prisoners.

The majority are classified as dangerous inmates.

The order was granted by Justice Siyabonga Musithu and compels Commissioner General of Prisons and Correctional Services (ZPCS) Moses Chihobvu, Justice Minister Ziyambi Ziyambi, Water Minister Anxious Masuka, and Finance Minister Mthuli Ncube to ensure the temporary measure is enforced.

The Zimbabwe Human Rights NGO Forum and a serving prisoner, Taurai Dodzo had filed an urgent chamber application complaining about the critical water shortages and outbreak of diarrhea at the prison.

Mthuli Ncube was also been ordered by the court to release funds for the purchase of water containers and payment of the mineral’s deliveries to the heavily congested prison.

“Justice Musithu ordered the Commissioner General of Prisons and Correctional Services, Minister of Justice, Minister of Water, and Minister of Finance to: Take temporary measures for the daily supply of at least 60 litres of potable water to each prisoner at Chikurubi Maximum Prison,” Zimbabwe Human Rights NGO Forum.

“The Minister of Finance was also directed to; immediately release funds for supplementary daily water supplies to Chikurubi Maximum Prison through water bowsers and any other sources of potable water and to purchase water containers for the prisoners.

“To immediately release funds for the satisfaction of the food supplies that are spelt out in S.I (Statutory Instrument) 96 of 2012 and release funds within two weeks for the supply of adequate essential medicines and requisite medical technology at Chikurubi Maximum Prison,” the NGO Forum said.

“The Forum will monitor the situation at this prison to ensure that the government authorities comply with this court order.”

The court also ordered Chihobvu to immediately separate healthy inmates from those who are ill to prevent a likely diarrhea outbreak in the cells.

Journalist Hopewell Chin’ono who has spent nearly two months incarcerated at the notorious Chikurubi Prison has been constantly been complaining over the poor hygiene and living conditions at the facility where prisoners are also provide very little food supplies.

According to Chin’ono, the prison is overcrowded and cells meant to accommodate 16 prisoners are occupied by up to 40 inmates.

SACU Arrests Harare City Council Director

By A Correspondent- Harare City Council (HCC) director of Human Capital Development Cainos Chingombe has been arrested by police working with the Special Anti-corruption Unit (SACU).

In a statement on Tuesday, Zimbabwe Republic Police (ZRP) national spokesperson Assistant Commissioner Paul Nyathi said Chingombe was arrested in connection with criminal abuse of office and fraud allegations at HCC.

Said Nyathi:

The ZRP Special investigations team and SACU have arrested Harare City Council’s Dr Cainos Chingombe in connection with criminal abuse of office and fraud allegations at Harare City Council. He is expected to appear in court soon.

Chingombe was reinstated to his position during a full council meeting held at the council chambers on 22 November this year.

He had been on suspension for the past three years on suspicion of misconduct.

The reinstatement of Chingombe ironically came after Government had warned the local authority against reinstating officials with pending court cases.

Delish Nguwaya Off The Hook As Magistrate Removes Him From Remand

By A Correspondent- Controversial businessman Delish Nguwaya was on Tuesday removed from remand by Harare magistrate Ngoni Nduna.

In his ruling, Nduna pointed out the fact that Nguwaya has been remanded 10 times without trial, the State was seeking for another postponement.

Said Nduna:

The State alleged that the case involved extraterritorial investigations and as for now nothing has been done.

The State had cited the COVID-19 pandemic as a restriction for them to conduct extra-territorial investigations.

… It seems the State has no idea why it needs further remand for.

Magistrate Nduna further ruled that the State proceeds by way of summons.

Nguwaya was arrested in June this year after he allegedly misled government into believing that his company Drax International, also known as Drax Consult SAGL, was a medical firm and could supply COVID-19 equipment to the Health ministry.

Meanwhile, investigative journalist Hopewell Chin’ono said the removal of Nguwaya from remand is the end of the case as he predicted on 15 June.

Impala Car Rental Denies CIO Links

By A Correspondent- Impala Car Rental, a car hire company whose vehicle was used in the abduction of university student Tawanda Muchehiwa by suspected State agents in July this year has refuted a report that it is owned by the Central Intelligence Organisation (CIO).

In a letter to The NewsHawks, the online publication that published the story linking the company to the CIO, Impala’s lawyers, Mudimu Law Chambers, cited twelve allegations carried by the story which they refuted, calling them lies.

The lawyers insisted that Impala Car Rental is a family business whose directors are Matirasa Francisca Dondo and Clara Dondo and not the CIO.

Further, Impala’s lawyers gave The NewsHawks 48 hours to retract the story, which they described as defamatory, frivolous and vexatious, or face litigation. They wrote:

We are advised by our client of a fictitious story written by Owen Garare Bridget Mananavire who operate under News Hawks.

Their story’s net effect was that the company in question is owned by the State security service Central intelligence Organisation (CIO).

… it’s clear that your story is actuated by malice and evil intention, the allegations in your story are not only defamatory but also frivolous and vexatious.

We do hereby demand that you kindly retract your story in its entirety, using the same mode of platform and giving it the same due weight as it was published, find hereto attached the CR14 of the company.

Chin’ono Makes It On 10 Most Urgent List Of Press Freedom Abuses Around The World

By A Correspondent| Hopewell Chin’ono has been included on a list of journalists who are victims of press freedom abuses around the word, following his recent arrest on charges of inciting public violence.

Chin’ono was arrested on the 18th of July and charged with incitement and spend over 40 days at Chikurubi Maximum prison.

He was to be arrested again on charges of interference, spending 17 days in remand prison before his release on bail.

Chin’ono joins nine other journalists from Turkey, Egypt, Iran, China, Russia and Malysia among other countries.

Nine MDC Alliance Councillors Join Khupe’s MDC-T

GOKWE mayor Never Gwanzura, Kadoma deputy mayor Tendai Kokera and four Gokwe councillors as well as three Kwekwe councillors have officially crossed the floor from MDC Alliance led by Nelson Chamisa to the Thokozani Khupe-led MDC-T.

The four Gokwe councillors are Machinda Mtembedzi, Darlington Mudondo, Tichaona Muhora and Charity Mungwani.

Kwekwe councillors, who also ditched the Chamisa-led party, include Eric Rukavairo (ward 11), Silas Mukaro (ward 1) and Joshua Tinago (ward 11).

They made the announcement at a meeting held at Gokwe centre over the weekend.

The nine councillors said that they had decided to join MDC-T as a way of continuing the people’s mandate since they were elected in 2018. The nine councillors pledged to honour the leadership of MDC-T.

The MDC-T Midlands north 2014 provincial structures met in Gokwe to brief each other on the progress made in the preparation for the extraordinary congress which is set elect a replacement of the late founding leader Morgan Tsvangirai.

It was at this meeting that the councillors declared their allegiance to MDC-T.

The meeting was chaired and facilitated by 2014 provincial chairperson Sedwel Bhebhe, who highlighted the importance of the delegates to participate in the extraordinary congress processes.

Kwekwe Urban ward 11 councillor Joshua Tinago told NewsDay that he and two other councillors were fully behind Khupe.

“I am happy that my other comrades, Eric Rukavano and Silas Mukaro, openly revealed that they belonged to the MDC-T,” he said.

Kokera, who was the MDC-T deputy provincial chairperson in 2014, said he was going back to MDC-T as it was the party that seconded him during the 2018 general election where he was elected councillor and subsequently voted deputy mayor.

Mtembedzi, popularly known as Comrade Evergreen in Gokwe, who was Midlands North provincial deputy chairperson for the youth in the 2014 structures and currently the acting provincial chairperson, said: “It is not like I am rejoining MDC-T, but the fact of the matter is that I have simply did what the Supreme Court judgment ordered me to do.

“I want to uphold the Supreme Court judgment, hence, my decision to ditch MDC Alliance and move to MDC-T. All we want is to respect our party constitution, nothing else.

He added: “All the councillors in Gokwe belong to MDC-T which is led by Thokozani Khupe as the acting president and Chamisa does not have any councillor who is aligned to him.”

Presidential aspirants Douglas Mwonzora and Khupe attended the meeting and took time to present their manifesto to the province.

Mwonzora said: “I am a constitutionalist and always want to uphold the party constitution. As you know, I was seconded to Copac (Constitution Parliamentary Committee) by the late president Morgan Tsvangirai to represent the party in the Constitution-making process and the results speak volumes about my capabilities.”

Khupe chronicled her history and how she worked with Tsvangirai and her achievements as the deputy Prime Minister.

VICE-PRESIDENT Constantino Chiwenga’s estranged and ailing wife Marry Mubaiwa yesterday claimed she is living in fear as unknown people were frequenting her offices and stalking her and some of her relatives.

Marry and Chiwenga are going through a nasty divorce which is playing out in public, with the Vice-President alleging that the former model tried to kill him in July last year when he was bedridden in a South African hospital.

A visibly sick Mubaiwa was on Monday forced to attend court from an ambulance stretcher to cancel two warrants of arrest that were issued after she had failed to attend court due to

ill-health to answer to allegations of money-laundering and attempting to kill Chiwenga.

Mubaiwa has, however, hit back at the retired military commander, alleging that he was fabricating charges against her in a bid to fast-track the divorce.

In an exclusive interview with the NewsDay, yesterday, Mubaiwa said unidentified people driving an unregistered blue Mazda BT50 visited her Eastlea offices on Monday and Tuesday while her relatives have also been put under surveillance.

Mubaiwa said her life had been turned upside down since her arrest in December last year on allegations of trying to kill Chiwenga and money-laundering.

“I am very much afraid for my personal life at the moment. I am living in fear. I just don’t know why I am being stalked and my calls being monitored. They want me dead and are using every trick in the book and if anything happens to me, there would be no witnesses,” she said in between sobs.

“On Monday, while I was coming from court, I was told that an unregistered Mazda BT50 with three people was parked at my offices. The people were taking pictures. They are said to have even slept there, why are they doing this, they know better.”

The former top model said her workers were also living in fear that anything could happen to them.

“The level of intimidation is just too much,” she said.

“This has been happening for a while now. What wrong have I done? What sin have I committed to deserve this?

“First, it was him (Chiwenga) who instructed his subordinates to pack my belongings, including my undergarments and dumb them at my offices. Who does that to the mother of his children, instructing subordinates to take your spouse’s undergarments?” she said.

“It is really sad that we have men who still take pride in dehumanising women to that extent. God has ways of bringing out the truth and as they say, the truth will set me free. I have a lot to say, but I am human, I will be quiet. My silence will be out of respect for my children, my and his (Chiwenga) own integrity.”

On her court appearance on a stretcher from an ambulance, she said: “I am sick, I really cried outside the court. I felt I had had enough and felt like giving up, but I just prayed to God to protect me. That is how I gathered strength.”

Mubaiwa said she missed her children whom she is being denied access to and as a result, was under emotional stress and “as good as dead”.

“A lot has been cooked, what is worse than being called a potential killer, a witch, a drug addict?

“My rights as a woman have been violated. I have faced the worst because of my husband. He is even preparing more, do I care, no. I know the truth and I will stand for that,” she said.

“They have created all sorts of allegations against me, labelling me all sorts of names and vowing to crush me with all arsenals at their disposal, sounds scary, but God will always protect his own. I pray one day, people will get to know the truth and it will be soon.”

Mubaiwa said she was supposed to seek medical attention outside the country after suffering severe injuries from the White City Stadium, Bulawayo, bomb blast on June 23, 2018 at a rally that was addressed by President Emmerson Mnangagwa.

“They cannot allow me to go outside the country to seek medical attention, but I was injured while supporting my husband at work. I am not a politician, I knew nothing about politics, but

I went there to support him, being a supportive wife that I was and this is what I get in return,” she said.

“Everyone, who got injured that time is receiving medical attention outside the country, including him (Chiwenga), but I can’t because they can’t release my passport. They want me dead and are using every trick in the book. I only pray to God that I get healed. I am in pain.”

Mubaiwa is out on bail and facing charges of attempted murder and externalisation. She denies the charges.

Party Host Fires Warning Shots At Ravellers Accidentally Shoots His Three Children

A 47-YEAR-OLD man was arrested on Saturday night after he accidentally shot his three children at his home in Bulawayo.

The man (name withheld) who is from Hope Fountain on the outskirts of Bulawayo, had earlier on fired the same gun to disperse a rowdy crowd at a party he had hosted at his dealership.

National Police spokesperson Assistant Commissioner Paul Nyathi said the man brandished his weapon and fired a 9MM CZ pistol during the party.

He did not disclose the injuries suffered by the three children but said they were hit by a ricocheting bullet.

“The incident occurred on 28 November where a certain man was holding a party for about 35 people. This was around 11.30PM during a lockdown and people who were partying started fighting,” said Asst Com Nyathi.

He said the man then fired some shots in the air to disperse the crowd and people fled in different directions.

Asst Comm Nyathi said after dispersing the people, the man went to his house and that is where tragedy struck.

“After dispersing the crowd he went home where his children aged four, 12 and 13 stay and he is said to have accidentally pulled the trigger and the bullet ricocheted off the floor thereby injuring the children. The children were rushed to United Bulawayo Hospitals (UBH) and he was arrested,” said Asst Comm Nyathi.

He said the man is facing charges of firing a gun and violating Covid-19 regulations.

“This was during and after a party that was being held at 11.30PM, way after curfew time. People are breaking Covid-19 regulations, the issue of social distancing the issue of masks and partying. When police move in people start complaining. It seems that people are not taking the issue of Covid-19 seriously,” said Asst Comm Nyathi.

Be Careful Of Highway Robbers Smashing Windscreens With Stones On Byo – Vic Falls Highway

MOTORISTS using the Victoria Falls-Bulawayo highway have been urged to be vigilant amid reports of suspected highway robbers who are allegedly smashing windscreens of moving cars.

This is reportedly happening between Insuza shops and the 120km peg towards Mbembesi River.

A number of motorists have reportedly fallen prey in the past week where their vehicles were smashed by stones coming from unknown sources.

No formal report of robbery has been made so far to the police.

None of the victims saw the source of the suspected stones which reportedly target the windscreen.

The Chronicle got to know about the matter after a Victoria Falls resident posted on a WhatsApp group narrating his ordeal.

Five responded saying they had also fallen victim to the suspected stone throwers with three of them posting pictures of shattered windscreens.

The smash and attack trend is prevalent along highways in South Africa where thugs wait by the traffic lights where they smash the windscreen and grab valuables.

Previously, similar reports were once reported in Zimbabwe where stones or old tyres would be thrown onto the road in front of oncoming vehicles and robbers would then pounce on the driver once he or she stops to avoid hitting the boulders.

Motorists suspect a group of illegal fuel dealers who used to operate between Insuza and Mbembesi River are behind the attacks.

“I was going to Bulawayo and approaching Insuza when suddenly there was a loud band on the side of the car. I almost panicked but something told me that I shouldn’t stop. I kept driving until I got to where I felt I could stop and upon checking I found that it could have been a stone that hit the side door,” said Mr Chris Moyo from Bulawayo.

A lady who was driving to Bulawayo with her husband and preferred to remain anonymous said she was scared of driving back along the same road.

“We were attacked as well but initially we didn’t suspect anything. It was around midday and I was the one driving when I heard a loud bang that sounded like a gunshot on the windscreen on the passenger side. I slowed down and eventually stopped to make a U-turn so that we could check. We got to the place where we were hit but we could not find anything or see anyone around.

“The windscreen was shattered. We got out of the car to take pictures as we didn’t suspect anything. We only realised that it was a mischievous attack when we heard several other people talking about the same experience. I am still in Bulawayo and am scared to drive back,” she said.

Another Victoria Falls resident said his workmate’s car was smashed a few days ago while driving from Bulawayo to Victoria Falls.

Matabeleland North police spokesperson Chief Inspector Siphiwe Makonese said police will investigate the issue although no formal report had been made.

“We haven’t received a formal report but we are looking into it. We want to urge motorists not to speed but exercise extreme caution when driving along the roads. People should be vigilant and avoid any unnecessary distraction and we encourage motorists not to stop whenever such things happen or stop for strangers.

If your car is hit you rather continue driving and only stop when you get to where there are people and it’s safe to do so,” she said.

BUSINESSMAN Delish Nguwaya, who has been out on bail on charges of misrepresentation in a deal over the supply of Covid-19 medical supplies and sundries, was yesterday removed from remand and the State will proceed by way of summons when it is ready to go to trial.

Nguwaya, connected to Drax International, has been seeking his trial date for some months at his routine remand hearings, saying he wants a trial to clear his name and to prove he has no connections with the First Family, as social media false reports alleged at the time of his arrest.

The removal from remand came after the court noted that the State was failing to show seriousness in investigating and prosecuting the charges and failing to justify delays in giving a trial date.

Harare regional magistrate Mr Ngoni Nduna said it was almost six months since Nguwaya was arrested, with the State promising to complete investigations and give him a trial date on July 28.

Nguwaya had been remanded 10 times, and he had been religiously attending court with the State failing to give cogent reasons for further postponing any trial.

He then ordered the State to proceed by way of summons once it has put its house in order.

“State was to give general reasons and nothing has been done save to say there are extra-territorial investigations to be done.

“They did not give the nature of investigations and where they want to carry out the investigations. State does not at all appear to be meaningfully interested in the case and want to simply remand the accused without trial.

“We expect the State to be serious and show that they are seized with the matter and ready to prosecute. The State had no idea why they want further remand. There is no reason given. The State has demonstrated that they are not in a hurry to prosecute.”

In the application for refusal of further remand, Nguwaya’s lawyer, Mr Admire Rubaya, told the court that Nguwaya had been demanding his day in court to clear his name and prove that the Drax International deal had nothing to do with the President and his family.

He accused the State of not taking the matter seriously considering the amount of vilification that the First Family, Government and Nguwaya suffered on social media because of the State’s allegations.

“Accused has been indicating that he needs to be tried and demanded a trial date. State has been changing explanations day in day out. It seems as if the State is not taking these proceedings seriously; they believe that a remand is there if they ask, yet there ought to be a cogent reason to juxtapose with the interests of the accused. It is important for the court to take note of the allegations accused facing.

“It is not a secret that when he was arrested, the social media went crazy with conspiracy theories saying accused was close to the First Family and the deal was for the (First) Family. The detractors went on an overdrive to soil his (President Mnangagwa’s) otherwise good name and seems as if the State, which is seized with the mandate to deal with these matters, has applied brakes.

“The accused wants to be tried and anticipate for that chance to tell the world that he is a businessman with no connection with First Family and there was no reason why the First Family was vilified,” he said.

Mr Rubaya said once the accused was continuously remanded, it was giving opposition political parties an opportunity to denigrate his persona and that of the Government.

He added that the continued postponement of the matter without trying Nguwaya would work against the vision of President Mnangagwa’s new administration and give an advantage to his detractors.

“The accused person asserts with respect that the moment this matter gets postponed to another date, the political opponents of the current Government will start to conduct themselves in a manner which is detrimental to the political narrative of the current Government.

“If the matter was to be dealt with, the public will see that there was nothing to write home about,” he said

Mr Charles Muchemwa, appearing for the State, had applied for further remand of the matter to January 18 saying the docket had been referred to the Prosecutor General.

He said there were extra-territorial investigations which needed to be conducted with a few things needed to be confirmed with the Ministry of Health and Child Care and NatPharm.

Mr Muchemwa said the State expected to have completed investigations by January 10 next year.

Gukurahundi Activists Blasted For Running In Too Many Groups

NATIONAL Peace and Reconciliation Commission (NPRC) has urged stakeholders to unite in the formulation of progressive strategies to resolve the contentious Gukurahundi issue.

NPRC representative Johnson Mkandla made the remarks on Monday in Bulawayo during a public lecture organised by Ibhetshu Likazulu for Njini Ntutha, the late Zipra cadre.

Ntutha was murdered in cold-blood by suspected State security operatives masquerading as dissidents during the Gukurahundi disturbances of the 1980s when the late former President Robert Mugabe deployed North Korea-trained Fifth-Brigade in Matabeleland and Midlands regions “to deal with an insurgency.”

Non-governmental organisations place the number of people killed during the raids at about 20 000.

Mnkandla said all the groups or parties that were dealing with Gukurahundi should unite to bring finality to the issue.

“It needs us all as victims, who come from Matabeleland region, together and stop forming other groups,” Mnkandla said.

“We should come together and stop forming new groups that purport to be also dealing with Gukurahundi because we are in this together.”

Mnkandla said it was important for the NPRC to talk to the people in the rural areas and hear what they have to say before taking matters to high offices.

“When the time comes for us to go on outreach, let us find out from the people what they want, let them tell us what it is that they really want to be done for them.

“They should be the ones to tell us how they want the burials to be done when the time for exhumation comes,” he said.

He said different regions had different approaches towards Gukurahundi and, therefore, the need for working together and achieve unity of purpose and come up with a strategy among the different stakeholders.

Mnkandla urged war veterans to work as a united front in their quest for justice for the slain Gukurahundi victims.

“We do not need to be a divided force. We do not need to go in different ways, we need to know that the perpetrator is not divided,” he said.

Nicholas Mathonsi Adds Salt On Justice Ndewere’s Wounds

The Supreme Court has blasted suspended High Court judge Justice Erica Ndewere for refusing to furnish a prisoner with a full judgment when denying him bail, saying such conduct is not expected of judicial officers.

Justice Ndewere, who is on suspension pending a disciplinary tribunal, threw out an application for bail pending appeal by convicted housebreaker Tapson Nyowani, but did not hand down a judgment explaining her decision.

The judge is under investigation for delays in writing her judgments. She also stands accused of failing to properly read a record of proceedings resulting in the quashing of a repeat offender’s prison term on the basis that he was a first offender on review.

While a tribunal set by the President is yet to determine her suitability to continue serving as a judge, Justice Ndewere has been criticised for the delay.

Nyowani had to approach the Supreme Court without the reasons for denial of bail, which made life difficult for the judges of appeal at the Supreme Court.

While Nyowani still lost his bid for bail, Justice Nicholas Mathonsi took a swipe at the conduct of Justice Ndewere saying judges were obliged to give written reasons for their decisions through full judgments.

“There is no judgment of the court a quo refusing bail pending appeal. In fact, the judge a quo did not prepare a written judgment and upon being requested by the appellant to give reasons for dismissing the application, she commented that the reasons were given in the presence of the appellant. She then flatly refused to render any further reasons for judgment,” said Justice Mathonsi.

When Nyowani asked for a judgment, Justice Ndewere, through her clerk, refused to issue a detailed judgment.

The letter reads: “I gave the reasons in court, in the presence of the applicant. The reasons I gave are as summarised in the typed State response whose copy he was served with, that he had no prospects of success against both conviction and sentence because there was overwhelming evidence against him as well as his identification by witnesses.

“So he can use those reasons if he wants to appeal against my decision.

“He ought to have noted the reasons for my decision in court.”

Justice Mathonsi said expressed disquiet at the conduct of Justice Ndewere.

“With respect, this is a very unorthodox way of giving reasons for judgment. It becomes extremely difficult for this court to assess the soundness of the decision of the court a quo refusing bail given that this court does not engage the matter as a court of first instance. It is settled that a written judgment is the foundation stone upon which a litigant builds or loses his or her hopes of succeeding on appeal.

“It is also trite that judicial officers are obliged to give full written reasons for judgment.

“This they do as duty owed to the consumers of their services, the litigants. Reasons that are stored in the mind of the judge are of no benefit to the litigants or the administration of justice, and a judicial officer should dispel all fears of arbitrariness by rendering a written judgment,” said Justice Mathonsi.

However, after hearing the case, the Supreme Court agreed with Justice Ndewere that Nyowani had no prospects of success on appeal.

“There is no basis for interference with both the exercise of the court a quo’s discretion and its factual finding that he has no prospects of success.

“Indeed the power of this court to interfere with the decision of the court a quo in a case of this nature is limited to instances where the discretion was exercised so unreasonably as to vitiate the decision made,” he said.

A three-member tribunal led by retired judge Justice Simbi Mubako was sworn in recently by President Mnangagwa to inquire into the fitness of Justice Ndewere, to hold office.

The other members are lawyers Mr Charles Warara and Ms Yvonne Masvora.

Justice Ndewere was automatically suspended following the President’s appointment of the three-member team on the recommendations of the Judicial Service Commission (JSC).

The commission reportedly alleges slipshod work and a large batch of overdue judgments.

The Constitution provides that a judge may be removed from office only for inability to perform the functions of his or her office, due to mental or physical incapacity, or gross incompetence, or gross misconduct. Otherwise judges serve until retirement or resignation.

The process is deliberately designed to ensure judges have practical independence since ruling against the Government of the day in a judgment cannot lead to a tribunal hearing.

The Constitution further stipulates that if the Judicial Service Commission advises the President that the question of removing any judge, including the Chief Justice, from office ought to be investigated, the President must appoint a tribunal to inquire into the matter.

He does not have much discretion in the matter.

President Emmerson Mnangagwa says that Zimbabwe is on the cusp of greatness with the construction of a new Parliament building and erection of a highly criticised statue of Mbuya Nehanda.

This follows his tour on Monday of the new Parliament building which is nearing completion in Mt Hampden, as well as his visit to the site where the memorial statue of Mbuya Nehanda will be hoisted in Harare’s central business district.

Posting on micro-blogging platform Twitter yesterday, the President said Zimbabweans must take pride in the country’s institutions and assured the nation that in the march forward no one will be left behind.

On the construction of the statue for the iconic First Chimurenga war heroine Mbuya Nehanda, Mnangagwa said it was important to tell the Zimbabwean story for the benefit of both present and future generations.

“The construction of the monument in honour of Mbuya Nehanda is nearing completion. It is vital that we show to our children and grandchildren that Zimbabwe has a rich history of heroes that fought for our freedom,” he said.

“Zimbabwe is on the brink of greatness, but we can only achieve it if we fight for it together.”

White Lady Claims Tendai Biti Assaulted Her At Harare Magistrates Court

POLICE are investigating a case of assault involving MDC Alliance vice president Tendai Biti who allegedly manhandled a white lady at the Magistrate Courts in Harare during a heated exchange.

Biti allegedly assaulted Ms Tatiana Aleshina who is involved in a property wrangle with one of his clients.

Police spokesperson Assistant Commissioner Paul Nyathi confirmed the fracas that took place on Monday.

“A 54-year-old lady Tatiana Aleshina has reported a case of assault at the Harare Central Police Station against Tendai Biti.

“Police are investigating charges of assault that were filed against Biti. We are conducting investigations with a view of finding out what happened. We understand that there was a mob which witnessed the whole incident,” he said.

Government officials pictured at minister’s birthday party, triggering outcry over police lockdown double standards and irresponsible behaviour in Mnangagwa’s New Dispensation.

Several news outlets said “Government has shown serious lockdown hypocrisy after photographs showing dozens of guests attending Information minister Monica Mutsvangwa’s birthday party, in violation of lockdown regulations, were published by a government official.” “The pictures showed no regard for social distancing at the time CORONA second wave is raging and causing havoc in the lives of many.” Screamed another online paper echoed by the parrot Fadzai Mahere the loud spoken MDC spokesperson.

However looking at the events of that day the honourable minister did not flout any regulations. Zimbabwe is guided by the WHO’s guidelines which Zimbabwe has followed to the book. As a result of such guidance Zimbabwe has managed to control the spread of the mad flue known as COVID 19.


Of all the people Monica Mutsvangwa knows how to follow rules she is the one who announces them and she leads by example.

We must all understand that any decision to hold an event during the COVID-19 pandemic, no matter how large or small, should rely on a risk-based approach. WHO has provided guidance on how such a risk-based approach can be taken.


The minister did all risk management checks and in this instance the group was
limited to a maximum of 15 people. In case people did not know that Indoor organised events for over 18s will no longer be exempt from the rule of six. Which means the maximum number will be 15 to 30. All this depends on your ability to discern danger. There is an exemption for indoor organised team sports for disabled people.
What is considered a “mass gathering” during COVID19?


Minister Mutsvangwa was surrounded by people who always surround her. Workmates who are always around her in the day to day business. This means the people who graced the birthday celebration of Mrs Mutsvangwa were largely work mates who have been tested and did not have symptoms. There are no restrictions on people from a single household spending time together outdoors or in regulated premises. This is irrespective of the size and composition of the household.  For example one large single household composed of five adults and two children under 11 could go to a restaurant, café, bar or pub together as a group.
However, if some members of that household wish to meet up with other people they do not live with, that gathering should contain no more than four people at any one time (not including children under 11). This is because the risk of spreading the virus gets much greater when you meet people you do not live with. But in actual sense the group which met with the minister is the household which is best explained as workmates. They meet anyway at work and they just changed the venue of their meeting as they ate in honour of their minister.
The minister is very much alive to the fact that To reduce the risk of catching or spreading coronavirus, you should minimise time spent outside your home, and when around other people ensure that you are two metres apart from anyone not in your household or support bubble. Social distancing is essential to stop the spread of the virus, as it is more likely to spread when people are close together. An infected person can pass on the virus even if they do not have any symptoms, through talking, breathing, coughing or sneezing.
When with people you do not live with, you should also avoid: physical contact; being close and face-to-face; and shouting or singing close to them.
Where you cannot stay 2 metres apart you should stay more than 1 metre apart, and take additional steps to stay safe.
The minister did not need to be socially distanced from anyone in her household, or daily social bubble meaning the people you live with or those you work with. You also do not need to be socially distanced from anyone in your support bubble.
it may not always be possible or practicable to maintain social distancing measures were taken to make sure every person who was allowed in there was of the right temperature. There was a limit of close contact as much as possible during the whole time and other precautions such as washing hands and opening windows for ventilation were taken and religiously followed. So people you can meet with includes anyone you are in an established relationship with but do not live with – unless they are in your support bubble. Couples that do not live together and are not in a support bubble with each other can continue to see each other outdoors.
You can exercise outdoors, or visit outdoor public places, with the people you live with, your support bubble, or 1 person from another household. Children under 5, and up to two carers for a person with a disability who needs continuous care are not counted towards the gatherings limit on two or more people meeting outside.
We need to understand that Zimbabwe has relaxed the rules and churches schools and funerals are now on a relaxed regime. So meeting of workers at a place and take two minutes to take photos and wishing Happy Birthday to their minister is not a breaking of any rule.
It is clear that this gathering was a specific exception where people from different households can gather in groups.
It is a shame that people rush to make flammable statements. It is in the nature of losers to bad mouth others.
This the time when we all as a nation wish minister Mutsvangwa a Happy birthday and wish her many more.
We ought to be talking about the progress achieved by her in her ministry.
In the two years of the new dispensation under the able leadership of President Emmerson Mnangagwa, the Ministry has attained the following achievements among other things
Re-aligning the existing media laws to the Constitution. The Ministry spearheaded the repeal of the Access to Information and Protection of Privacy Act (AIPPA), replacing it with the Freedom of Information Act. The repeal of AIPPA was done to fulfil provisions of Section 62 of the Constitution, which enshrines the Declaration of Rights, the right to access information.
Another law initiated by the Ministry, which was gazetted by Government is the Zimbabwe Media Commission Bill. The Bill elaborates the functions of the Media Commission as detailed in Section 249 of the Constitution, which relates to the regulation and control of the media.
In line with democratic ethos The ministry has
awarded Free-to-Air Commercial Television licences to six broadcasting players, ending a 64 year-old monopoly enjoyed by the Zimbabwe Broadcasting Corporation (ZBC). This has freed the air waves and created a political land scape which is safe and sound. The stakeholders now have a choice of which broadcaster they favour. This has put to an end the unending song by the opposition that there is a monopoly to media.
With the hard working minister Mrs M Mutsvangwa and her hard working team the ministry has managed to Build bridges with media stakeholders by involving them in the crafting of the Freedom of Information Bill and the Zimbabwe Media Commission Bill. Every interested party has been given a chance to have a say in the laws that govern them.
The ministry has Initiated the process of licensing more Community Radio Stations.
Again the ministry has Directed parastatals that have gone for long without functional boards like the Zimbabwe Mass Media Trust (ZMMT) to appoint new boards to improve the operations of the organisations.

In order to fit in the nee world order the ministry has Introduced the robust use of the social media or new media by Ministry officials to promote Government projects and programmes; and to liaise with media stakeholders.
Not to be left behind the ministry has Resuscitated and rebranded the Ministry website in line with global trends.
Created a news website www.zimreport.co.zw that features developmental stories from around the country.

Govt Restricts All Public Gatherings To A Maximum Of 100 People

Government has limited the number of people permitted at any public gathering to 100 to avoid confusion and violation of COVID-19 restrictions.

The government had specified different numbers for various types of public gatherings as a way to control the spread of the pandemic.

But addressing a post-cabinet media briefing Tuesday, Information Minister Monica Mutsvangwa said the different numbers were causing confusion and violation of COVID-19 restrictions.

“Accordingly, henceforth, the number of people permitted at any gathering is restricted to 100, irrespective of what the gathering is being convened for,” she said.

At the height of the COVID-19 pandemic, the government had imposed a limit of 100 people or less for church gatherings and 50 people or less at funerals but this was later relaxed as the rate of new infections declined around September.

Mutsvangwa said in view of the need to promote the tourism sector, closing hours for restaurants have been extended from the current 6:30 p.m. to 8 p.m. and for the operators to continue strictly observing COVID-19 prevention guidelines.

“Cabinet takes this opportunity to call upon all citizens to strictly adhere to COVID-19 protective and preventive guidelines in order to arrest the surge in confirmed cases,” Mutsvangwa said.

As of Monday, Zimbabwe had recorded 10,034 COVID-19 cases, 8,489 recoveries and 277 deaths.

Meanwhile, the country reopened a number of its busiest land borders on Tuesday to private motorists and pedestrians under a phased reopening of ports of entry and exit.

Man Stabbed To Death Over Parking Space

POLICE have launched a manhunt for a man who fatally stabbed a fellow imbiber following a misunderstanding over parking space in Kwekwe.

Mr Alison Stambuli (43) was stabbed to death by a fellow patron at a shebeen in Mbizo Section 17 after the two argued over parking space.

Midlands police confirmed that they had since launched a manhunt for a man identified only as Magwangu for allegedly fatally stabbing Mr Stambuli.

Magwangu fled and left his vehicle, a Toyota Runx, on the scene after discovering that Mr Stambuli had died.

Midlands provincial police spokesman, Inspector Joel Goko said on Saturday at around 8.30PM, Mr Stambuli parked his vehicle, a Honda Fit, at a shebeen in Mbizo 17 where he was drinking beer.

The accused person also came and parked his vehicle, a Toyota Runx in front of the gate thereby blocking the entrance.

Mr Stambuli later approached the accused person asking him to move his vehicle as he wanted to leave.

“The accused refused resulting in a misunderstanding between the two. Mr Stambuli then slapped the accused person twice on the face. The accused went to his car and came back armed with a knife and stabbed Mr Stambuli once on the chest,” said Insp Goko.

Magwangu fled leaving his vehicle behind.

Mr Stambuli’s son, Alois received a call that his father had been stabbed and was bleeding profusely.

Alois, with the help of other residents, rushed his father to Kwekwe General Hospital where he was pronounced dead on admission.-Chronicle

Armed Robbers Pounce On Cash-in- transit Vehicle

FIVE armed robbers ambushed a cash-in-transit vehicle at Chivi Growth Point, Masvingo province, disarmed three security guards and got away with US$35 000, R350 000 and $2 000.

The Safeguard Security vehicle was delivering the cash to Mukuru branch at the Growth Point when the robbers struck on Monday at 9.34AM.

According to police, the robbers pounced on the cash in transit vehicle as the guards were about to deliver the cash to the branch.

“The robbers pointed guns at the security guards as they were disembarking from the vehicle and disarmed them before taking away a cash box containing US$35 000, R350 000 and $2 000.

“They then jumped into an unregistered blue Toyota Revo twin cab and sped off towards Mandamabwe Business Centre.

“The gang also robbed the guards of their three pistols,” said national police spokesperson Assistant Commissioner Paul Nyathi in a statement.

He said police are concerned about the increasing cases of armed robbers targeting cash in transit vehicles.

“The Police are disturbed by robbery incidents which are targeting cash-in-transit vehicles. We implore security companies to strengthen their security measures in consultation with clients.-Chronicle

Fire Guts Murder Accused Tapiwa Makore Senior’s House

TAPIWA Makore (senior), who is in remand prison for allegedly killing his seven-year-old nephew for suspected ritual purposes, is counting losses after his hut was on Sunday morning gutted by fire.

The fire occurred a few hours after police had demolished Makore’s pit latrine and recovered skulls and some bones.

On Saturday morning, Makore led a team of detectives to the recovery of the body parts at his homestead.

The following morning, villagers woke up to find the thatched kitchen in flames before a police report was made.

The cause of fire is still a mystery considering no one stays at that homestead. Officer Commanding Murehwa District Chief Superintendent George Mugonda confirmed receiving the fire report, saying investigations were still underway to ascertain the cause.

“We received the report on Sunday morning and some officers attended the scene in the company of Makore, who assisted in assessing the loss.

“The motive and cause of fire is yet to be established. We are still investigating,” he said.

When The Herald arrived at the homestead, only the cracked walls had remained.

Ashes covered the floor while burnt pots, plates and cups were all over the structures.

Rubble of the demolished toilet were scattered in the yard while some animal skulls and other remains left behind by the detectives on Saturday were visible on the ground.-The Herald

KIEV. — Real Madrid suffered a second defeat at the hands of Shakhtar Donetsk in this season’s Champions League, going down 2-0 last night to leave their hopes of reaching the last 16 in the balance.

Mtshabezi High School Records 15 COVID-19 Cases

Fifteen coronavirus cases have been recorded at Mtshabezi High School in Matabeleland South Province, with 11 pupils, 2 teachers, and 2 workers among the confirmed cases.

In a statement, Mtshabezi High head Morgan Moyo said necessary precautions have been taken. He said:

On behalf of the school family, Brethren in Christ Church and the Ministry of Primary and Secondary Education, I would like to confirm 15 cases of Covid-19 wherein 11 learners, two teachers and two workers affected.

Tests for Covid-19 were administered on 26-11-2020 and results thereof delivered to the school on 29-11-20.

All necessary precautions have been taken in line with Covid-19 protocols.

In a related development, a teacher at Christian Brothers College (CBC) in Bulawayo recently tested positive for coronavirus and is currently in isolation.

This comes as a number of COVID-19 cases have been reported in schools across the country, with some education stakeholders calling for schools to be closed. However, the government has resisted the calls, saying schools should accept the “new normal”.-State media

Zimbabwe is approaching a level greatness with the construction of a new (Chinese built) Parliament building being a symbol of the Second Republic’s commitment to democracy and the rule of law, Emmerson Mnangagwa has said.

This follows his tour on Monday of the new Parliament building which is nearing completion in Mt Hampden, as well as his visit to the site where the memorial statue of the revered Mbuya Nehanda will be hoisted in Harare’s central business district.

Posting on micro-blogging platform Twitter yesterday, Mnangagwa said Zimbabweans must take pride in the country’s institutions and assured the nation that in the march forward no one will be left behind.

“Our new Parliament building will be a symbol of our commitment to democracy and the rule of law. Zimbabwe may not be an old democracy but we are proud of our institutions of government and our belief that all Zimbabweans should have a say in the running of our country,” said Mnangagwa.

On the construction of the statue for the iconic First Chimurenga war heroine Mbuya Nehanda, Mnangagww, who has pledged to honour more of the country’s heroes and heroines through immortalising their legacy in sculpture and history, said it was important to tell the Zimbabwean story for the benefit of both present and future generations.

“The construction of the monument in honour of Mbuya Nehanda is nearing completion. It is vital that we show to our children and grandchildren that Zimbabwe has a rich history of heroes that fought for our freedom,” he said.

The Second Republic, under the visionary leadership of Mnangagwa, is currently pursuing Vision 2030 to become an upper middle-class economy, with the recent budget presentation by Finance Minister and Economic Development Professor Mthuli Ncube focussing more on infrastructural development projects such as dam and road construction.

To this end, Mnangagwa said when it comes to national development, no one should be left behind. He said there was need for the country to pull in one direction to reach its full potential.

“Zimbabwe is on the brink of greatness, but we can only achieve it if we fight for it together.”

The budget for the coming year is built on the gains of the Transitional Stabilisation Programme (TSP) of the last two years and the National Development Strategy 1 (NDS1), that aims at an average economic growth of 5 percent in the next five years and employment creation.

This multi-pronged approach of the strategies is designed to see Zimbabwe and Zimbabweans become wealthier, with everyone able to participate and no one, even the most vulnerable, left behind.

Recently, the highly respected Ibrahim Index of African Governance (IIAG) ranked the Zimbabwe Government among countries with the most improved governance system in Africa in a 10-year survey.

The IIAG assesses governance performance in 54 African countries over the latest available 10-year period, providing a framework and dashboard to assess the delivery of public goods and services and public policy outcomes in African countries.

According to its latest report Zimbabwe, which is undergoing rapid transformation under the leadership of President Mnangagwa, is ranked 33rd with a percentage score of 46 percent, +7.4 improvement during the 2010 to 2019, it is among the five most improved African countries over the past decade.

Zimbabwe recorded improvements in the categories of Human Development; Foundations for Economic Development and Security and Rule of Law.

This comes as the Second Republic has been entrenching far-reaching political and economic reforms that have seen the opening of the airwaves as was witnessed when six new television stations were licensed, while on the economic front the New Dispensation is hard at work on various infrastructural development projects such as dam and road construction.

So far, Mnangagwa has presided over the commissioning of dams in different parts of the country such as Marovanyathi in Buhera, power generation projects in Hwange, the road constructions as well as the reopening of parts of Chipinge and Chimanimani which were ravaged by Cyclone Idai a year ago. -Herald

Mdc Alliance Namibia bears the comprehension that all industrial societies use police to control crime and contribute to public order manifesting in mediating and arbitrating disputes as well regulating traffic and helping in times of emergencies. Astonishingly, the wild and authoritarian manner that was exhibited by non-democratic pro-Zanupf police against Mdc Alliance Youth Assembly members at their party offices in Masvingo is characteristic of a hybrid dictatorship in the Motherland. We are very frustrated in the partisan approach of all our securocrats in Zimbabwe. As an external district in the national democratic revolution, we insist that law enforcement requires a delicate balancing act.

Whilst Zanupf party is busy with its District Coordinating Committee (DCC) meetings, our political dynamo (Mdc Alliance) was denied the chance to undertake the much awaited Provincial Congress to elect each other on Saturday. The police must be reminded that Zimbabwe is not a private property of the Zanupf regime and all citizens are at par before the law. Section 2 as enshrined in the supreme law of the country stipulates that the constitution is the superior law of the land and anything generated must be consistent with the national law therefore our police must desist from from manipulating their legal mandate to use force to advance Zanupf political scores.

Moreover, as social democrats in Namibia, we are cognisant of the democratic role of our police. We demand that the police must be a central element in constitutional democracy.

Our captured police should surely subject itself to the rule of law not the rule of Zanupf fat cows. The police must be publicly accountable to any abuse of authority by political leaders and the general citizenry not excluding themselves. They should hastily undress their Zanupf political jackets to ensure that state power must be used in a restrained fashion. The police force is expected to resist being subject to a greater degree of direct political control by Zanupf belly politicians of rhetoric.

Moreso, Mdc Alliance Namibia emphasises that police are trained to see themselves as exemplars of moral behaviour. They must give a cold shoulder to individuals who want to be protected at the expense of our unemployed Youths who are degreed but wallowing in excruciating poverty. Police need to protect democratic liberties while maintaining effectiveness against crime and pandemonium as provided in the 2013 constitution. With a concoction of a One-party state, military, personalist and hybrid dictatorships it becomes apparent that when the policing of crime and politics merge, political dissent automatically generates spurious charges. We urge our vibrant Youths to resist this with equal measure.

Mdc Alliance Namibia advocates for democratic policing. The police in Zimbabwe must respect our constitutional democratic rights to join,assemble, support and express our feelings and thoughts in a purported free country. We are clamouring for an objective police who are allergic to using police power and covert surveillance to advance a dictatorial regime and its rotten, stinking political and social practises. Social democrats in Namibia seriously demand democratic policing that seeks to avert the extremes of either anarchy and gross crackdown on the voices of dissent. We are absolutely exhausted to see our democratic space shrinking every now and then. It’s time for our Youths to embrace participatory democracy through dangerous freedom because it’s the only panacea to socio-economic transformation.

Unless our police consider the existence of an open democratic society which values the dignity of our beleaguered Youths and the general populace , they shall remain an anomaly in the motherland. Lets remain focused on our #OneMillionCompaign. After the ugly and horrible Saturday in Masvingo, we shall remain convinced that our police resembles a police state which is desperately punctuated by the rule anchored on professionalised and captured police as a Zanupf institution.

In a nutshell, Mdc Alliance Namibia encourages all social democrats led by vibrant Youth Assembly to use all their organs to resist this extreme form of dictatorship composed of atomised , isolated and greedy belly politicians. We shall continue saying NO TOLERANCE to any form dictatorship in Zimbabwe. Supreme Court Attacks Justice Ndewere

The Supreme Court has blasted suspended High Court judge Justice Erica Ndewere for refusing to furnish a prisoner with a full judgment when denying him bail, saying such conduct is not expected of judicial officers.
Justice Ndewere, who is on suspension pending a disciplinary tribunal, threw out an application for bail pending appeal by convicted housebreaker Tapson Nyowani, but did not hand down a judgment explaining her decision.

The judge is under investigation for delays in writing her judgments. She also stands accused of failing to properly read a record of proceedings resulting in the quashing of a repeat offender’s prison term on the basis that he was a first offender on review.

While a tribunal set by the President is yet to determine her suitability to continue serving as a judge, Justice Ndewere has been criticised for the delay.

Nyowani had to approach the Supreme Court without the reasons for denial of bail, which made life difficult for the judges of appeal at the Supreme Court.

While Nyowani still lost his bid for bail, Justice Nicholas Mathonsi took a swipe at the conduct of Justice Ndewere saying judges were obliged to give written reasons for their decisions through full judgments.

“There is no judgment of the court a quo refusing bail pending appeal. In fact, the judge a quo did not prepare a written judgment and upon being requested by the appellant to give reasons for dismissing the application, she commented that the reasons were given in the presence of the appellant. She then flatly refused to render any further reasons for judgment,” said Justice Mathonsi.

When Nyowani asked for a judgment, Justice Ndewere, through her clerk, refused to issue a detailed judgment.

The letter reads: “I gave the reasons in court, in the presence of the applicant. The reasons I gave are as summarised in the typed State response whose copy he was served with, that he had no prospects of success against both conviction and sentence because there was overwhelming evidence against him as well as his identification by witnesses.

“So he can use those reasons if he wants to appeal against my decision. He ought to have noted the reasons for my decision in court.”

Justice Mathonsi said expressed disquiet at the conduct of Justice Ndewere.

“With respect, this is a very unorthodox way of giving reasons for judgment. It becomes extremely difficult for this court to assess the soundness of the decision of the court a quo refusing bail given that this court does not engage the matter as a court of first instance. It is settled that a written judgment is the foundation stone upon which a litigant builds or loses his or her hopes of succeeding on appeal.

“It is also trite that judicial officers are obliged to give full written reasons for judgment.

“This they do as duty owed to the consumers of their services, the litigants. Reasons that are stored in the mind of the judge are of no benefit to the litigants or the administration of justice, and a judicial officer should dispel all fears of arbitrariness by rendering a written judgment,” said Justice Mathonsi.

However, after hearing the case, the Supreme Court agreed with Justice Ndewere that Nyowani had no prospects of success on appeal.

“There is no basis for interference with both the exercise of the court a quo’s discretion and its factual finding that he has no prospects of success.

“Indeed the power of this court to interfere with the decision of the court a quo in a case of this nature is limited to instances where the discretion was exercised so unreasonably as to vitiate the decision made,” he said.

A three-member tribunal led by retired judge Justice Simbi Mubako was sworn in recently by President Mnangagwa to inquire into the fitness of Justice Ndewere, to hold office. The other members are lawyers Mr Charles Warara and Ms Yvonne Masvora.

Justice Ndewere was automatically suspended following the President’s appointment of the three-member team on the recommendations of the Judicial Service Commission (JSC).

The commission reportedly alleges slipshod work and a large batch of overdue judgments.

The Constitution provides that a judge may be removed from office only for inability to perform the functions of his or her office, due to mental or physical incapacity, or gross incompetence, or gross misconduct. Otherwise judges serve until retirement or resignation.

The process is deliberately designed to ensure judges have practical independence since ruling against the Government of the day in a judgment cannot lead to a tribunal hearing.

The Constitution further stipulates that if the Judicial Service Commission advises the President that the question of removing any judge, including the Chief Justice, from office ought to be investigated, the President must appoint a tribunal to inquire into the matter.

MUTSVANGWA BIRTHDAY BOOZE: Crowd Gathering Raised To 100, Four Days Later

The maximum limit at any gathering, regardless of what it is for, has now been set at 100, and restaurants can now stay open until 8pm, as Government continues to open society and the economy while maintaining the guard against the Covid-19 threat.
Announcing the changes after yesterday’s Cabinet meeting, Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa said there had been confusion among the public over just how many people were allowed to attend gatherings, with different maximums set for different types.

To simplify the system Cabinet had agreed to set the maximum at 100, regardless of what the gathering was for. This was the maximum for some types of gathering, while others had been kept at a lower limit. Other existing public health regulations make it clear that public health regulations have to be followed at all gatherings, regardless of how many people attend.

The new limits should help people avoid violations at weddings and church services in particular.

Confirmed :MDC Alliance Chairperson Out Of Danger

Tinashe Sambiri|Two senior MDC Alliance officials were involved in a terrible accident near Mutimurefu Prison in Masvingo on Sunday.

The two, MDC Alliance provincial chairperson(Masvingo) Senator Misheck Marava and Hon Muchirairwa Mugidho had just attended the party’s management committee meeting and they were travelling back to Zaka and Chiredzi respectively .Hon Mugidho’s husband was also in the vehicle.

“Senator Marava sustained serious head injuries while Hon Mugidho is yet to be examined by doctors.

The vehicle they were travelling in was hit by an oncoming car.

There is need to beef up the security of our officials.

During the meeting, Senator Marava emphasized the need for unity in Masvingo Province,” the MDC Alliance said in a brief statement.

MDC Alliance Taunts Mnangagwa Over Nehanda Statue

Tinashe Sambiri|The MDC Alliance has challenged Mr Emmerson Mnangagwa to concentrate on reviving the economy instead of telling Zimbabweans about Mbuya Nehanda’s history which is now “a public record.”

According to the MDC Alliance, everyone is aware of the role that was played by Mbuya Nehanda in fighting against colonial rule.

Speaking during a tour of Nyati Gallery near Snake Park, where the statue of Mbuya Nehanda is being made by sculptor David Mutasa, Mnangagwa said Government decided to honour her for the heroic rebellion against colonialism.

The statue is being erected at the intersection of Samora Machel Avenue and Julius Nyerere Way in the capital.

“Mbuya Nehanda led the war during the First Chimurenga and she led us when we fought during the Second Chimurenga that is why we are recognising her so that the young generation will know who led the war against the colonial regime,”said Mnangagwa.

“This has nothing to do with rituals as some of you think,” added Mnangagwa.

Responding to Mnangagwa’s remarks, MDC Alliance Namibia said in a statement:

“Everyone knows that Mbuya Nehanda played a key role in the battle for freedom.Even schoolchildren know that Mbuya Nehanda was a brave woman who inspired black people to fight for freedom.

Mnangagwa should simply focus on reviving the economy.”

Woman Ruins Own Marriage After Receiving Love Charm

A 25-year-old Masvingo woman has been ordered to pack her bags after putting love charm charm in her her father-in-law’s plate.

Nomatter Mariona was forced to return to her parents’ home after placing love charm in her father-in-law’s plate. Her father-in-law began to shower her with gifts and calling her during the night.

Nomatter’s husband, Tichaona said her wife mistakenly charmed his father.

“My relationship with my father was very good until I started noticing some strange moves.

My father has been calling my wife more than five times a day and he even gave her some money.

I then confronted my wife and she confessed that she got the love charm from Pastor Isaac Makomichi.

She said she put the charm in the wrong plate,” said Tichaona.

“As a family we decided to send her back to her parents’ house.

Makomichi called us saying he can reverse the charm if I take my wife back.

I’m now afraid that my wife might use the charm on me if I take her back,” added Tichaona.

Makomichi denied giving Nomatter the love charm.
