By A Correspondent- High Court judge Jacob Manzunzu has removed from the roll an application filed by the widow of the late chief justice and national hero Godfrey Chidyausiku.
The widow is seeking an order compelling the pension master to process and transfer into her bank account, all the pension and terminal benefits from the Judiciary.
Manzunzu ruled yesterday that Farai Chidyausiku (nee Kunaka)’s court papers were not in order.
Chidyausiku died in May 2017, barely two months after retiring from his position and was buried at the National Heroes’ Acre in Harare.
Kunaka who was not mentioned in Chidyausiku’s inheritance claimed she was customarily married to the late judge and that her brother received US$1 000 as bride price.
She further told the court after the pride price was paid in Bhora, Murewa, she even changed her surname and started using the Chidyausiku family name, adding that she was the only surviving spouse and as such was entitled to all pension and terminal benefits.
Kunaka further told the court that Musunga & Associates Legal Practitioners assisted in changing her name on the basis of her marriage to the late Chidyausiku.
She wanted the court to direct the Judicial Services Commission (JSC) and the pension master to speedily process and pay her the amounts due, in an application in which she also cited Justice minister Ziyambi Ziyambi as a respondent.
Kunaka said during Chidyausiku’s tenure, she used to enjoy the benefits of a married woman, adding that she was even issued with a diplomatic passport. -DailyNews
