Police Officers Found Casting Votes Before Election Date

Police officers at Ross Camp police station in Bulawayo were on Thursday found already casting their votes ahead of scheduled election time.

The police officers who brought the matter to the public domain indicated that they were told to cast their votes under the postal votes.

The officers claimed that they were casting their votes under the supervision of their bosses and were being forced to vote for the ruling ZANU PF.

In an interview ZEC Bulawayo Provincial Elections Officer Innocent Ncube denied any knowledge of the postal vote taking place in the province.

“I am not aware of any postal votes taking place in Bulawayo,” said Ncube.

“The reason I am not aware of this is because I am not directly involved with the postal votes. I only get involved after the votes have been cast and brought to the wards concerned,” said Ncube.

MDC Alliance senate candidate Dorcas Sibanda confirmed that they were notified of the hidden postal voting and rushed to the scene where they found the voting taking place.

“There were no ZEC officials or election agents of any candidates represented at the voting,” said Sibanda.

ZEC Chief Elections Officer Utloile Silaigwana however confirmed that the postal voting was formally taking place at Ross Camp police station in Bulawayo.

Zanu PF Supporters Vandalise Property At Government School

Sources at Liebenberg High School in Chivhu have alleged that authorities are unhappy with the vandalism of property during a Zanu PF rally at the school.

Staff members who declined to be named claimed Zanu PF demanded to use the school premises for its rally and used property without seeking permission from the development committee.

“We are concerned about the vandalism of school property by Zanu PF supporters.We are afraid of approaching the relevant offices to express our grievances,” sources at the school said.

Scores of angry Zanu PF supporters in Chivhu have accused President Emmerson Mnangagwa of being dishonest following his failure to show up at a rally in the transit town.

Mnangagwa was expected to address party supporters at Liebenberg High School last Saturday.

The disgruntled supporters blamed Mnangagwa for failing to explain why he failed to address the rally.

“We are not happy because our leaders are simply taking us for granted.The organisers of the rally lied to us,” said a Zanu PF Youth League member.

“The President owes us an apology.We used our own resources to travel to and from Chivhu,” said another Zanu PF member.

ZEC Dragged To High Court Over Voters Roll

campaigners have teamed up to challenge a petition filed by a registered voter who is seeking to bar the Zimbabwe Electoral
Commission (ZEC) from releasing a voters’ roll bearing prospective voters’ photographs as stipulated by the law.

In an urgent chamber application for joinder to an urgent chamber application filed by Ethel Mpezeni, a registered voter, the opposition political parties and the pro-democracy campaigners protested that they will be seriously prejudiced by the order sought by Mpezeni, who wants to bar ZEC from releasing a voters’ roll bearing voters’ photographs.

The opposition political parties and the pro-democracy campaigners, who include MDC Alliance, Renewal Democrats of Zimbabwe, People’s Democratic Party, Coalition for Democrats, National Constitutional Assembly, Theresa Manase, Evan Mawarire, Harrison Nkomo, Jeremiah Bamu, Douglas Coltart and Warship Dumba, argued that the order sought by Mpezeni will have a negative implication on the credibility of the 30 July 2018 general elections.

“Failure by ZEC to avail a voters roll with photographs will adversely jeopardise  the prospects of economic recovery in Zimbabwe, which is dependent on the outcome of the polls,” said the Zimbabwe Lawyers for Human Rights (ZLHR) in a statement.

Mpezeni recently filed an urgent chamber application in the High Court seeking to stop ZEC from acceding to demands by various political parties for the electoral management body to provide them with a voters’ roll including her photograph or anyone else’s.

In her application, Mpezeni argued that the demands by the opposition political parties violated her constitutional right to privacy.

“Several political parties have asked ZEC to furnish them with a voters’ roll with photographs in line with the provision of section 9(c) of the Electoral (Voter Registration) Regulations of 2017.

The political parties argue that the provision of the voters’ roll in this format would enhance the transparency of the voters’ roll, which has been a hotly contested issue in previous elections thereby undermining the credibility of the outcome of past elections.”

In the urgent chamber application filed by Denford Halimani from the ZLHR, who cited Mpezeni, ZEC and Justice Legal and Parliamentary Affairs Minister Ziyambi Ziyambi as respondents, the opposition political parties and some pro-democracy campaigners argued that it is in the public interest for ZEC to issue a voters’ roll with photographs to minimise areas of contestation after elections.

“The applicants reasoned that the relief sought by Mpezeni is not in the public interest as it has the effect of undermining widespread calls for transparency and integrity of the electoral process.

The pro-democracy campaigners and the opposition political parties argued that every election process must be structured to ensure that only legitimately registered individuals who appear at the polls to vote are in fact who they claim to be,” said the ZLHR.

This process, the applicants argued, helps to prevent electoral fraud because a photograph is a very useful tool to verify the accuracy of the voters list, to check impersonation and to detect and prevent multiple registration and curb presence of ghost voters.

MDC ‘Hooligans’ Jailed For Assaulting Zanu PF Activist

 

In a ruling that is set to purge politically- motivated violence and intimidation, two MDC supporters have been slapped with a combined 24-month jail term for assaulting a Zanu PF sympathiser for wearing ruling party regalia.

The two brothers — Robert and Itai Kabvunza who reside in Mutasa Central — an opposition stronghold, were convicted after a full trial by
magistrate Tendai Mahwe who, however, set aside four months on condition of good behaviour from
each of their sentences.

They will serve an effective eight months each.Although no medical report was tendered in court, the two were handed the penalty as a deterrent to would-be-offenders as the country pushes to deliver free, fair and credible elections on July 30.

It was the State’s case that the duo approached Jairos Nyamururu who was wearing a Zanu PF T-shirt on July 4 and began quizzing him over why he was wearing it.

They were allegedly bitter over his decision to support the ruling party.
Robert then grabbed Nyamururu by the collar and Itai immediately started assaulting him with clenched fists.

Nyamururu managed to escape and he then filed an assault report at Mutasa Central Police Station, leading to the arrest of the brothers.

Chigumba In No Show At Chamisa Meeting She Convened

Reports just received indicate that the Zimbabwe Electoral Commission chairperson Priscilla Chigumba has failed to turn up for a meeting she convened with the opposition MDC Alliance leader Nelson Chamisa.

Chalton Hwende a top MDC Alliance leader revealed in a Twitter message on Thursday morning shortly after the time set for the meeting.

“After @ZECzim promised our President @nelsonchamisa that today we will meet Chigumba when we we arrived at their offices she was nowhere to be seen. We now need to unmask the real person using Chigumba to rig Elections and deal with that person,” wrote Hwende.

ED ‘Love Child’ Fined For Disorderly Conduct

A 31-YEAR-OLD Harare man who allegedly stormed into President Emerson Mnangagwa’s residence claiming to be his biological son was yesterday fined $20 by magistrate Josephine Sande

Brian Chitembeya was charged with disorderly conduct, but insisted during trial that Mnangagwa was his father and that he wanted to engage him for financial support.

But Sande told him to use proper channels to settle the matter instead of trespassing into Mnangagwa’s residence without appointment.

“You don’t refuse the presidential security personnel orders, but you must use proper channels or to approach your elders to settle your matter,” Sande said.

The court heard that on Monday, Chitembeya went to Mnangagwa’s residence, but was stopped at the gate by security personnel. Chitembeya vowed to remain put at the entrance, leading to his arrest. Francisca Mukumbiri appeared for the State.

BREAKING- MDC Alliance And Zanu Pf Stalwarts Clash At Chitungwiza Cemetery

By Own Correspondent| Violent clashes erupted yesterday between Zanu Pf and MDC Alliance stalwarts at Unit L cemetery in Chitungwiza in a development which allegedly left several people injured and cars destroyed.

Sources who witnessed the incident alleged that the Nyaradzo bus which had ferried mourners to the cemetery was also damaged during the violent clashes which were reportedly triggered by Zanu Pf supporters.

According to the source, Zanu Pf stalwarts had ferried one of their cadres for burial and they saw one of the council workers who was digging the grave wearing an MDC Alliance t-shirt.

This irked Zanu Pf supporters and they teamed up and beat the council worker. The council worker, an MDC Alliance supporter in turn reported to his colleagues that he had been beaten over party regalia.

The MDC Alliance supporters reportedly mobilised themselves and they went to the cemetery for revenge.

Zanu Pf supporters and other mourners who were burying their cadre were then beaten up by the MDC Alliance team in a development which saw several cars being destroyed including the Nyaradzo bus.

The driver of the hearse escaped the violence by a whisker after he quickly drove off from the scene leaving the two sides exchanging blows.

One woman who is a known Zanu Pf stalwart was stoned and she sustained a severe cut on her right chick.

Efforts to get a comment from the Zimbabwe Republic Police (ZRP) Spokesperson Chief Superintendent Paul Nyathi were futile as his mobile phone went unanswered by the time of going to print.

MDC Demo: Chigumba Invites Chamisa For Talks

Zimbabwe Electoral Commission (ZEC) chairperson Justice Priscilla Chigumba is reported to have called MDC Alliance for a meeting tomorrow (Thursday 12 July) over their demands for electoral reforms.

MDC Alliance is demanding access to the full voters roll and openness on the procurement, design, printing and storage of ballot papers to be used for the 2018 general elections scheduled for 30 July.

During her routine Monday media brief, Justice Chigumba indicated that ZEC has failed to build consensus over the elections and was thinking of dumping it but the door for discussion would still be open.

Addressing party supporters on the sidelines of a demonstration and after handing their petition at ZEC offices, MDC Alliance principal Tendai Biti said Chigumba has invited them for a meeting.

“It’s unfortunate that when we went in there with our petition, Justice Chigumba was not there, but she has asked us to come back tomorrow for a meeting with her.

“So we are coming tomorrow but we have left the petition which has a list of our demands which we want to be addressed before we go for elections.

“And these demands we are ready to die for them and this time we will not allow this election to be stolen from us,” he said.

The 2018 general elections have been dubbed as the “this is it” for the opposition parties especially MDC which has been trying since 2000.

The opposition, on the contrary, is of the view that they have been winning the previous elections but they have been their victories through various means.

In 2008 MDC-T came close to winning the Presidential elections but their lead candidate the late Morgan Tsvangirai though he had more votes than his main rival Robert Mugabe, he failed to get the required 50 per cent plus one vote.

Speaking after the demonstration, MDC Alliance Presidential candidate Nelson Chamisa said if nothing positive comes out of the meeting with Chigumba, demonstrations will continue until ZEC concedes.

“This is the last demonstration were we go back home, I tell if nothing comes out of negotiations then we engage the next level, which is gear number two, now gear number two is undesirable because it’s a red gear.

“The next level of demonstrations are those where we don’t go back home but we go and occupy ZEC until our demands are met. This is not a Zanu primary election, it’s a national election and we must agree on its processes.

“Chigumba is saying our demands are not provided for in the law, but I am also a lawyer, if something is not provided for in the law it does not mean it’s prohibited so I don’t know what law she is talking about.

“We are not afraid to lose anything for this cause because we have already lost everything as a country,” he said.

MDC Alliance is on record saying if their demands are not met they will not participate and also they ensure the election will take place.

It remains to be seen if ZEC will concede as one of its commissioner Qhubani Moyo announced that they have finished printing ballot papers.

MDC Alliance Officially Back In Mbare Constituency

The Zimbabwe Electoral Commission has officially corrected its omission of the MDC Alliance candidate for Mbare Constituency.

The election body confirmed in a government gazette on Tuesday that Mr Starman Chamisa will be the candidate of the opposition coalition in the constituency after being omitted in the initial gazette on June 22.

The omission had caused a wave of uncertainty amongst the Alliance supporters who could not understand how the country’s biggest opposition party may have failed to field a candidate in the country’s most contested constituency.

Judge Reserves Judgement On Maengahama, Madzokere Plea

HIGH Court Judge Justice Clement Phiri on Wednesday 11 July 2018 reserved judgment after presiding over the hearing and determination of an application filed by some prisoners seeking an order compelling Zimbabwean authorities to allow them to cast votes in this month’s general elections.

Through the application, the prisoners Tungamirai Madzokere and Last Maengahama, wanted the High Court to issue an order compelling Justice, Legal and Parliamentary Affairs Minister Hon. Ziyambi Ziyambi, Zimbabwe Electoral Commission (ZEC) Chairperson Justice Priscilla Chigumba and ZEC as the elections management body, to register them on the national voters roll and facilitate their voting on election day.

Madzokere and Maengahama are currently serving prison terms of 20 years each at Chikurubi Maximum Security Prison after they were convicted in 2016 for murdering a policeman. Yvonne Musarurwa, who was also a prisoner until she was released under an amnesty early this year, is the third applicant.

But Justice Phiri reserved judgment after indicating that he would need more time to consider all the legal authorities referred to by lawyers representing the applicants and those representing the defendants before makes a decision “expeditiously”.

The prisoners’ application was only been set down for hearing this month although they filed their petition in June 2017, more than one year ago.

In their application, Madzokere, Maengahama and Musarurwa, who were represented by Advocate Tererai Mafukidze, who was instructed by Jeremiah Bamu of Zimbabwe Lawyers for Human Rights, argued that since the period that they have been in prison detention, ZEC had neither carried out any voter education, including voter registration nor enabled prisoners to cast their vote during the several by-elections which were held in the country to elect legislators.

The prisoners argued that they were asserting their constitutional rights particularly the right to vote in elections and referendums as enshrined in Section 67 (3) (a) of the Constitution.

Musarurwa, Madzokere and Maengahama argued that it is common cause that Zimbabwe is due for general elections in 2018 and they are entitled to exercise their political rights regardless of their status as detainees.

ZESN Conducting Independent Audit Of The Voters’ Roll

The Zimbabwe Election Support Network (ZESN) as part of its oversight role on electoral processes is undertaking an independent audit of the voters’ roll. By definition, a voters’ roll audit is a systematic, statistical and scientific assessment of the quality of the voters’ roll.

ZESN trained and deployed 90 field supervisors and enumerators across Zimbabwe to interview 2 744 respondents. ZESN interviewed respondents from all 10 provinces, all districts and all constituencies for the two tests. 50/50 gender quota was maintained. ZESN ensured quality control when field work was being conducted.

ZESN conducted the people-to-list and list-to-people field tests. The people-to-list test entails randomly sampling respondents and then verifying the details on the voters’ roll. The list-to-people method involves randomly identifying registered voters’ on the roll and then locating them at their given addresses. The two tests are also used to evaluate the accuracy of personal data, including name, date of birth, identification and address in the voters’ roll.

In addition to the field test, ZESN is also subjecting the voters’ roll to a computer test to assess both internal and external consistency. The computer test will analyse variables that include registration by age, gender, province and setting (urban and rural) by making comparison with national population figures. The test will also analyse if there are duplicates or multiple entries in the voters’ roll.

The objectives of the voters’ roll audit is to increase trust and citizen confidence in the conduct of the 2018 elections and to increase credibility of the 2018 voters’ roll. This follows discrepancies and anomalies in the 2013 voters’ roll which included duplicates, under-registration of youth and women, and under-registration of those residing in the urban areas.

ZESN is in the process of data analysis and a report of the findings will be shared with the Zimbabwe Electoral Commission (ZEC) and key electoral stakeholders. The purpose of the audit is to make an independent assessment of the quality of the voters’ roll in terms of accuracy, comprehensiveness and currency.

Accuracy relates to the rate of error in entering data on the individual voter, that is name, date of birth, sex and address. Comprehensiveness focuses on the proportion of eligible voters’ included on the voters’ roll. Currency focuses on whether the information on the voters’ roll is updated, for example through transfers for those who have moved to a new location and deletions for those who are deceased.

ZESN remains committed to promoting credible elections and will continue monitoring electoral processes and the environment.

“We Will Teach Chamisa A Lesson,” Says Obert Gutu

Thokozani Khupe’s deputy, Obert Gutu has described MDC Alliance leader and presidential candidate Nelson Chamisa as a cheap junior lawyer with no respect for the country’s judiciary, as the temperatures heat up ahead of the July 30 elections.

Gutu said Chamisa will be thrashed in the July 30 elections, and that they (the MDC-T) will teach Chamisa some lesson in basic law if he rescucitates the court challenge which he shelved a few days ago to concentrate on the elections.

“A cheap,junior lawyer who has got no respect for our judiciary is welcome to resuscitate the MDC name and logo legal battle after he is thrashed in the July 30 elections. We’ll teach him a lesson in basic law,” wrote Gutu on his Twitter page.

Chamisa’s lawyer asked the High Court to downgrade the matter from urgent basis as it is election season and they are seized with election campaigns.

Chamisa apprpached the courts seeking to bar Thokozani Khupe’s camp from using the MDC-T name and logo following the death of founding leader Morgan Tsvangirai.

7 Family Members Die In Road Accident On Way To A Funeral

TEN people died while one sustained serious injuries in a head-on collision involving a Chinhoyi-bound Nissan Caravan and a haulage truck at Mapinga along the Harare-Chirundu Highway on Tuesday night.

The accident occurred at around 10pm at the 60-kilometre peg where the ascent into the Great Dyke Pass begins.

The driver of the Nissan Caravan allegedly encroached onto the lane of the oncoming haulage truck.

In a statement confirming the accident, police national spokesperson Senior Assistant Commissioner Charity Charamba urged motorists to avoid night driving.

“We announce a very sad development where a fatal road traffic accident occurred at 22:10 hours at the 60km peg along the Harare-Chirundu Road, Mapinga, on 10th July, 2018, where 10 people were killed,” she said. “Circumstances are that a driver of a Nissan Caravan commuter omnibus was driving towards Chinhoyi with 10 passengers on board when he encroached onto the lane of an oncoming haulage truck resulting in a head on collision.”

Snr Asst Comm Charamba said on impact the vehicles veered off the road and fell into a ditch with the haulage truck landing on top of the Nissan Caravan.

“The driver and eight other passengers died on the spot while another passenger in the commuter omnibus died on admission to Banket District Hospital,” she said.

The other passenger, who sustained serious injuries, has been transferred to Parirenyatwa Group of Hospitals.

Among the deceased were family members who were on their way to a funeral at the Kamurosi Family residency in Hunyani suburb of Chinhoyi.

Knowledge Kamurosi, who is a brother to the deceased woman where the mourners were going to pay their last respects, said they received the news of the accident with shock.

“At least seven of the people who died in the accident were relatives coming to my sister’s funeral. We heard they were involved in a head on collision at Mapinga. They were in a private kombi. We do not know what to say faced with such a situation. It is a heavy blow,” he said.

Khama Billiat has become the Absa South African Premiership soccer’s highest earner after securing his move to Kaizer Chiefs from rivals Mamelodi Sundowns.

Sport24 can reveal the amount the Zimbabwean forward is earning at the Glamour Boys who wouldn’t let money stand in the way of securing his services.

The 27-year-old signed a three-year contract with an option of an additional year and is reportedly earning an eye-watering R10 million a year before tax.

That’s R833 333 per month.

Taking the taxman into consideration — as footballers are taxed at 38 PERCENT — Billiat will be paid R515 000 a month, making him comfortably the top-earner in South Africa’s top-flight.

Sundowns coach Pitso Mosimane confirmed that the club could not meet Billiat’s financial demands, which prompted the star to join Chiefs.

“We gave him a good offer,” Mosimane said.

“Trust me, it was a big offer. The offer that we gave, he could have been the highest paid player, which would probably have taken four years for that record to be broken.”

Billiat is believed to have turned down another offer — and in hindsight with good reason — from Egyptian side Zamalek who were prepared to pay him an annual salary of $450 000 (R6 050 000).

Fastjet Opens Bulawayo Harare Route

Fastjet, one of Africa’s top low cost airline has announced that it will commence daily flights between Harare and Bulawayo from 20 July 2018.

Ticket sales are already open on fastjet.com, fastjet shops and all travel agents, with a special Launch Fare starting at $59 taxes included.

Fastjet will be the first affordable airline to operate the Harare Bulawayo route; the airline presently flies between Harare and Johannesburg 4 times daily, between Harare and Victoria Falls twice daily and up to 3 times a week between Victoria Falls and Johannesburg.

“Fastjet has been pursuing this route designation for several years,” says fastjet chief executive Nico Bezuidenhout.

“We are delighted to see that positive changes in the Zimbabwean environment made this development possible, enabling low-fare connectivity between more domestic destinations.”

Fastjet will celebrate its third year of Zimbabwean operations in October and “has invested substantially in the market with positive outcomes. While we are launching with a single frequency at present, fastjet intends to further grow the route following further consultation with stakeholders and ultimately to introduce additional aircraft to facilitate growth,” he adds.

Bulawayo being the second largest city in Zimbabwe and a strategic economic hub that services nearby mining, industrial and agricultural activity, Bezuidenhout believes that fastjet’s entry into this market will contribute positively in terms of further stimulating economic activity and growth.

The 2017 ICAO (International Civil Aviation Organisation) study shows that aviation creates substantial up and downstream economic benefits. The air transport industry employs around 381 000 people in Africa and contributes more than $ 9 billion to the continent’s GDP.

“The catalytic impact of aviation stretches this to around 6.8 million jobs and $ 72.5 billion toward GDP. On a country and city scale airlines benefit local tourism, supply chain procurement and on average the market entry of a carrier on any new route stimulates job creation of around 100-200 opportunities across various sectors.”

With the addition of the Harare Bulawayo route, fastjet’s network in Zimbabwe now totals 4 destinations with more than 100 weekly flights; this makes fastjet the leading carrier in Zimbabwe.

Imprisoned MDC Activists Sue Govt Over Voting

The High Court has reserved judgment in the case in which two jailed MDC activists are seeking an order compelling the Government to allow them to vote in this month’s harmonised elections.

Tungamirai Madzokere and Last Maengahama are serving prison terms of 20 years each at Chikurubi Maximum Security Prison.

They were convicted in December 2016 of murdering Inspector Petros Mutedza at Glen View 3 Shopping Centre in May 2011 together with Yvonne Musarurwa.

Musarurwa was freed in an amnesty early this year. The trio sued the Zimbabwe Electoral Commission (ZEC) and the Ministry of Justice, Legal and Parliamentary Affairs.

It is the trio’s contention that Zimbabwe is due for general elections in a few weeks time and they are entitled to exercise their political rights regardless of their status as detainees.

Justice Clement Phiri yesterday heard the application and reserved his ruling after hearing submissions from all the parties’ lawyers. It emerged during the hearing that there was no dispute that prisoners have a right to vote.

ZEC, which was being represented by Mr Tawanda Kanengoni, argued that prisoners’ remedy lies in lobbying Parliament, as ZEC cannot be compelled to act in the absence of enabling legislation.

The ministry’s lawyer Ms Fortune Chimbaru argued that the law was clear and hence no need for judicial pronouncement.

“All prisoners needed to do was to make logistical and administrative arrangements with prison authorities,” said Ms Chimbaru.

Mr Jeremiah Bhamu of the Zimbabwe Lawyers for Human Rights argued the matter for the trio.

Mr Bhamu argued that though the law was clear, the need for judicial pronouncement arose in that for 38 years after independence nothing has been done to facilitate voting by prisoners.

“It is, therefore, necessary to compel ZEC to put in place measures required for prisoners to vote and in the alternative for the minister to be compelled to sponsor legislation to make a provision for the mechanism through which prisoners may vote,” argued Mr Bhamu.

In their application, the trio wanted the High Court to force the Ministry of Justice, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi and ZEC chairperson Justice Priscilla Chigumba, and ZEC as the elections management body, to register them on the national voters roll and facilitate their voting on election day.

Their application was set down for hearing this month although it had been filed in June 2017.  – state media

By Wilbert Mukori| “Thousands of Zimbabwean opposition supporters took to the streets of Harare on Wednesday demanding fair elections following alleged irregularities in the electoral roll ahead of the July 30 vote,” reported AFP “The electoral register has long been a contentious feature of Zimbabwe’s elections, fuelling accusations of vote rigging in previous polls.”

The spirit is willing but, sadly, the mind is weak and inept! It is heart-breaking to see human being behaving like panicked houseflies flying repeatedly into the glass window!

If MDC leaders were ever serious about stopping Zanu PF rigging elections, then why, oh why, did they fail to implement even one democratic reform during the GNU? They had five years to implement the reforms but failed to get even one reform implemented.

SADC leaders did they best to remind Morgan Tsvangirai and his MDC friends to focus on the reforms, but no one listened. MDC leaders had their snouts in the feeding trough, one could have fired a short-gun right into their faces and still they would not have to heard it!

When SADC leaders realised that MDC had failed to implement the reforms, they made one more desperate bid to get MDC leaders to see sense. They told Tsvangirai and company should not take part in the 2013 elections without first implementing the reforms. “If you go into next month’s elections, you will lose; the elections are done!” they told Tsvangirai & co, looking them straight in the eyes. It still did not work.

MDC leaders participated in the 2013 even when they themselves could see the elections were being rigged. Once again, it was greed that got the better of them, as David Coltart, MDC senator and minister in the GNU, later admitted in his book.

“The worst aspect for me about the failure to agree a coalition was that both MDCs couldn’t now do the obvious – withdraw from the (2013) elections,” explained Senator Coltart.

“The electoral process was so flawed, so illegal, that the only logical step was to withdraw, which would compel SADC to hold Zanu PF to account. But such was the distrust between the MDC-T and MDC-N that neither could withdraw for fear that the other would remain in the elections, winning seats and giving the process credibility.”

If anyone thought the MDC leaders had learned their lesson after Zanu PF blatantly rigged the 2013 elections, just as SADC leaders had warned would happen; they were wrong. MDC leader vowed not to take part in future elections until reforms were implemented. “No reform, no elections!” they said. But as the 2018 elections approached, greed once again got the better of them.

They are taking part in these elections to try and win those few gravy train seats Zanu PF gives away as bait, knowing fully well Zanu PF will rig the vote.

It is the MDC supporters and the ordinary Zimbabweans one feels sorry for, they are the panicked houseflies flying repeatedly in the window pane. 38 years of gross mismanagement and rampant corruption under this Zanu PF dictatorship has seen unemployment soar to 90%, ¾ of the population are living on US$1.00 or less a day, basic services such as health and clean running water have all but collapse, etc., etc.; of course, they desperate for regime change.

The people know that Zanu PF has been rigging elections but instead of accepting the futility of participating in flawed and illegal elections they are now stuck in the rut of hoping to win rigged elections. Desperate people do desperate things!

Just as Coltart rightly admitted above, by participating in the flawed elections MDC and their mindless supporters are, unwittingly, giving the flawed election process some modicum of credibility and keeping Zanu PF in power!

“We want a proper voters’ roll, a free and fair election. We are tired of Zanu-PF machinations,” said Rebecca Amon, 39, a housewife and mother of two, one of demonstrators.

Rebecca, put yourself in President Mnangagwa and his junta’s shoes: would you risk losing power by implement the reforms taking away all your advantage to rig the elections and stay in power, especially when you know that the opposition will participate in the elections even if you do not implement even one reform?

SADC leaders, who are a key referee in Zimbabwe’s elections as we saw in 2008 – they are the ones who forced Mugabe to accept the need for the reform -, have already said the elections should be postponed to allow the reforms to be implemented. It is incompetent, corrupt and greedy MDC leaders and their morbid supporters who are insisting in the elections going ahead regardless, much to the joy of Zanu PF.

Printing Of Ballot Papers Finished

The Zimbabwe Electoral Commission (ZEC) has completed printing presidential ballot papers for the July 30 harmonised elections.

The electoral body yesterday said the number of ballot papers printed would be published as soon as required by the Electoral Act.

ZEC commissioner Dr Qhubani Moyo told The Herald that all was set for the polls.
“We can confirm that the presidential ballot paper has been printed and is complete,” he said.

“It was done at Fidelity Printers where political parties went and saw the printing process. Very soon the commission will, in terms of the law, publish the number of ballots that have been printed.”
He added: “We are also going to publish the printing company because the requirement in terms of the Electoral Law is that we must tell people the number of ballot papers that have been printed and the company that printed them.

“Very soon the commission will put a public notice in that regard. The ZEC chairperson (Justice Priscilla Chigumba) will soon make a detailed communication on that.”

This flies in the face of MDC-Alliance which yesterday staged a demonstration claiming they did not know who was printing the ballot papers and where they were being printed even after being taken to the premises.

ZEC is constitutionally mandated to administer all electoral processes in the country, including all material issues relating to the printing of the ballot paper.
Justice Chigumba said any political party that felt aggrieved by the law was free to seek relief from anyone.

She said the electoral body went beyond its constitutional mandate two weeks ago to invite political parties to observe the printing of the ballot paper.
She said in other jurisdictions, stakeholders were allowed to “touch the ballot or feel it” because they had a legislative framework for that.

“The strict letter of the law is that we have the exclusive constitutional mandate to procure ballot paper, to design it, to print it and to distribute it,” said Justice Chigumba on Monday.
“The reason why we keep having these disputes around these areas is that the law does not provide that members of the public or stakeholders be involved in this process. Our law says only ZEC can do that. We respect the democratic right of each and every Zimbabwean to approach any fora that they feel will give them the relief that they seek.”

She added: “We will not be releasing pictures of voters to the public and this is because the right to access to information is not absolute. It must be juggled with the right to privacy. The format in which we have released the voters’ roll, and the information that we have given on the voters’ roll, is sufficient to fulfil our constitutional mandate, that we must provide a final voters’ roll which is analysable and which is searchable.

“We are aware of our constitutional duty to be transparent, to provide a final voters’ roll which is analysable and searchable. It is our considered view that we have done so and that we have complied with the law without necessarily impinging on the rights of others. Rights are not absolute; they are subject to control in a democratic society.”

Reacting to demands by the opposition to release a voters’ roll with pictures of registered voters, Justice Chigumba said; “Would you like your picture and your fingerprint, your name and your identification card number, your telephone, address number to be flighted around somewhere in the public arena? We have a duty to actually protect our registered voters from identity thefts and all sorts of things, we balance conflicting interests.”

The final voters’ roll has 5 695 706 registered voters. Meanwhile ZEC has set up 10 985 polling stations throughout the country for the polls. – state media

ELECTRICAL FIRE AT RAINBOW TOWERS HOTEL & CONFERENCE CENTRE
An isolated fire incident occurred in one of the Rainbow Towers Hotel & Conference Centre smaller conference rooms situated on the Mezzanine Floor of the hotel at approximately 1900 hours on the evening of 11 July 2018. The fire was successfully contained to a small area in the ceiling of the conference room approximately 1 square meter. The fire alarm system was immediately triggered and the Fire Brigade was called and responded timeously. All guests and staff at the hotel were evacuated in line with the fire evacuation procedure for approximately one hour until the building was deemed safe for use.

 

Preliminary investigations by the hotel Maintenance and Engineering team indicate possibly a localised electrical fault could have caused the fire. A thorough investigation is underway. Six guests who were in the conference room when the incident happened were quickly evacuated together with all guests and hotel staff present in the building at that time. There were no casualties nor damage to property save for small affected part of the ceiling. We thank all our guests for co-operating with the staff at the time of this isolated fire incident.

Chigumba Has A Secret 141 Year Old On Voters Roll

By AP – HARARE: The world’s oldest person is 141 years of age and lives in Zimbabwe. Not far behind is a 134-year-old, also in Zimbabwe.

At least that’s according to the country’s voters’ roll, which has come under sharp scrutiny ahead of the July 30 election, the first in decades without longtime leader Robert Mugabe.

The main opposition party has called the voters’ roll deeply flawed and the most prominent sign that the election’s credibility is at risk. On Wednesday, thousands of people were rallying in the capital, Harare, to call for more transparency.

While President Emmerson Mnangagwa, who took power when Mugabe was pressured to step down in November, and the election commission have pledged a free and fair election, the issues with the voters’ roll have many worried that Zimbabwe’s government is failing to break with a long past of alleged election fraud.

The strikingly old voters are just one concern. The voters’ roll also shows more than 100 people registered at a single address and has multiple people sharing a single ID number, according to the main opposition’s chief election agent, Jameson Timba.

“In our view, the voters’ roll is not fit for purpose,” said main opposition leader Nelson Chamisa, who is in a coalition with several smaller parties that also took part in Wednesday’s demonstration.

The opposition’s suspicions extend to the ballots’ printing, storage, design and even paper quality.

Confidence in the election has run so low that the opposition now encourages its supporters to carry their own pens into the voting booths because they don’t trust the ones provided.

Mnangagwa, a longtime ally of Mugabe until he was fired as a result of a ruling party feud, is under pressure to deliver a free and fair election as a key step in lifting years of international sanctions.

Zimbabwe’s past elections have been marked by accusations of violence and fraud. Mugabe banned Western election observers but Mnangagwa has welcomed them for the first time in almost two decades.

Observers from the European Union and United States have raised concerns that are similar to the opposition’s although, in a break from the past, this year’s election has been largely free of violence.

Mnangagwa, his ruling ZANU-PF party and the election commission are defending the credibility of the vote. The electoral commission chairwoman, Priscilla Chigumba, has rebuffed the opposition’s demands, which include touching the ballot paper or examining it closely. Party representatives were allowed to view the ballot printing process from a distance last month, she said.

People had to watch from about 10 meters away, said another opposition candidate, Noah Manyika.

Political parties physically inspecting the ballot paper is unlawful, Chigumba, a former High Court judge, told reporters on Monday, calling the opposition demands “an abuse of the right to transparency.”

The election commission chairwoman also has denied problems with the voters’ roll, which was released to opposition parties and the public only after pressure and a court ruling.

The commission has said any mistakes in the roll are being corrected. The case of the single address with more than 100 registered voters “is in fact a church shrine with 122 voters,” Chigumba said.

Winning confidence in the remaining weeks before the vote will be a challenge. According to a survey released over the weekend by the Zimbabwe Council of Churches, 58 percent of registered voters do not trust the elections commission. The churches surveyed more than 1,600 people from Bulawayo, an opposition stronghold, and Midlands province, which has a mix of opposition and ruling party supporters.

While Mugabe is gone, “the regime remains,” said Munyaradzi Gwisai, a political analyst and law lecturer at the University of Zimbabwe. He concluded: “If anything, the hard men and hard women of that regime are the ones who have taken power and they are now in charge, so very little has changed.”

Rainbow tours hotel in Harare has been reportedly gutted by fire.

The cause of the fire was not ascertained at the time of going to press.

However it has been established that most guests have been evacuated from their rooms.

Hotel guests had to be evacuated and pictures show many standing outside.

“We Will Camp At ZEC If Our Demands Are Not Met:” Chamisa

By Own Correspondent| The MDC Alliance leader Nelson Chamisa has challenged the Zimbabwe Electoral Commission (ZEC) to avail the voter’s roll and accommodate the opposition parties to witness the printing process of the ballot papers to dispel mounting fears that ZEC is working in connivance with Zanu Pf to rig the forthcoming elections.

Addressing thousands of party supporters in Harare, Chamisa said Zimbabweans are not asking for too much from ZEC besides transparency in the conduct of elections.

Said Chamisa:

“Our people are not asking for gold or treasure, simply to see the ballot paper before we go into an election.

These are not unreasonable demands.

The people of Zimbabwe have been taken advantage of by Zanu PF for a very long time, it ends with this election.”

Chamisa said failure by the ZEC to implement the demands on their petition which they delivered to ZEC today (Wednesday) would see opposition supporters camp at ZEC offices until their demands are met.

“We will give ZEC one week to implement our demands. Failure to do that, we will stay put at ZEC. Wash the blankets, get ready,” Chamisa told party supporters.

“We Will Announce The Election Results Ourselves,” Say Chamisa.

|Opposition MDC Alliance President Nelson Chamisa says that his party will announce the election results on its own as they can not trust the Zimbabwe Electoral Commission, ZEC.

Addressing thousands of MDC Alliance supporters at the end of a mass demonstration against ZEC on Wednesday, Chamisa said that his party does not have confidence with the electoral body which he accuses of being biased towards the ruling ZANU PF.

“We will announce the results ourselves as we do not trust ZEC who may announce the wrong results,” said Chamisa.

The youthful opposition leader warned incumbent President Emmerson Mnangagwa and the ZEC chairperson Priscilla Chigumba not to temper with the results of the elections as it may lead to chaos in the country.

“Voting is national security,” warned Chamisa.

“Mnangagwa and Chigumba must not temper with the election result at all,” he said.

The opposition party delivered a petition to the electoral commission demanding that it reverses the ballot paper printing and involve the opposition parties in the designing and printing process of the ballot papers.

Thousands of the party supporters took part in the demonstration which marched to the ZEC office in the capital city. Scores others MDC Alliance supporters insisted on remaining camped outside the ZEC offices until the commission responds favourable to the demands made by the party.

Independent Candidate Launches Door To Door Campaign

Aspiring independent MP for Masvingo Urban Sam Chapfudza has launched a door to door campaign programme as part of frantic efforts to explain his vision to residents of the ancient city.

Chapfudza is the only independent candidate who has managed to embark on a door to door campaign programme in Masvingo Urban Constituency.

There are three main contenders in the Masvingo Urban Parliamentary election- Chapfudza, Benjamin Taguma Mazarire of Zanu PF and Jacob Nyokanhete of MDC Alliance.

Speaking to Zimeye.com in an interview yesterday, Chapfudza said he was ready to romp to victory in the July 30 polls.

“We have just launched a door to door programme and the thrust of the exercise is to interact and interface with the electorate,” said Chapfudza.

“As a vendor, I am a man of the people. I understand the problems we face in the constituency.

As such I am appealing to local residents to support my vision.As an independent candidate I represent development,” Chapfudza added.

Court Blocks Zanu PF Women’s League Boss From Grabbing Private Property

A senior Zanu PF Women’ s League official’ s attempt to seize a farm in Chirumanzu District has been foiled by a Mvuma Magistrate.

Senior Zanu PF Women’s League official Violet Nhari wanted to take over Golden Spiderweb Lodge situated at Rockdale Farm but her shenanigans hit a brick wall following Mvuma Resident Magistrate Tayengwa Chibanda’ s ruling on an appeal from the owner of the farm , Denis Muzunze.

Nhari also attempted to use her political stamina to push Muzunze out of the property.

Nhari also allegedly threatened officials at the Lands Ministry offices in Mvuma.

Chibanda ruled that Nhari’ s arguments were baseless and her bid to grab the property was illegal.

A self declared war veteran in Masvingo has threatened to expose President Emmerson Mnangagwa’ s multiple farms across the country.

The war veteran, who identified himself as Comrade Torai Zvombo sensationally described Mnangagwa as a wicked man, despite the President’ s frantic efforts to portray himself as a political saint.Torai Zvombo resides in Mucheke A Suburb, ward 2 Masvingo Urban Constituency.

“Do you know that Mnangagwa owns many farms across the country. In Masvingo Province he owns two farms near Mbungo Estates.

I have a list of his farms and he is not a saint as he wants the generality of Zimbabweans to believe.

He also owns several farms in Midlands Province,” claimed Torai Zvombo.

“That man is very wicked, he also owns countless mining concerns in the country.I am ready to expose his hypocrisy,” added Torai Zvombo.

Concerns have been raised over the motive of Zanu PF Youth League members who are demanding national identity details from residents in the city of Masvingo.

Zanu PF youths and members of the Women’s League are moving around wards in Masvingo Urban Constituency demanding national identity details without specifying the reasons for doing so.

The Zanu PF activists are also asking the residents to disclose their preferred candidates.

A Zanu PF activist in Zaka District has been arrested for contravening the Electoral Act (chapter 2:13).

According to police sources in Zaka, Lydia Rugede was arrested for tearing MDC Alliance leader, Nelson Chamisa’s posters.

Rugede also destroyed Zaka East MDC Alliance candidate James Gumbi’s posters at Benzi Business Centre last weekend.

The matter was reported under RRB number 3528803 and CR number 53/07/18.

MDC Alliance Petition on Urgent Electoral demands

We, the MDC alliance as the largest representative of the working people of Zimbabwe note the following:

1. That Section 239 (a)  of the Constitution of Zimbabwe obliges the ZEC to conduct  elections , efficiently, Freely, fairly, transparently and in accordance with the law.

2. That ZEC satisfies the Zimbabwe’s electoral law regional and international standards which also demand that elections are held efficiently freely fairly and transparently.

3. That ZEC has been subjective partial dishonest and incompetent in the manner it has run the 2018 election process to date.

4. That contrary to the provision of the law  the Zimbabwe Electoral Commission has:

a) Refused consensus and full disclosure, the Source, Security , Traceability and openness of the  BALLOT PAPER.

b) Has refused to provide a voter’s roll as defined in terms of the law with pictures in searchable and analyzable form.

c) Has granted full and open access to its database to Zanu PF contrary to the law.

d) Continued denial to equal access to the media as required by law section 61(4) (C) as well as the electoral law.

We therefore make the following demands which if not availed will threaten the holding of the election scheduled on the 30th of July 2018:

i. The urgent release of A COMPLETE Biometric Voters Roll, in searchable and analyzable form with requisite biometric features.

ii. The independent auditing of the said Biometric voters roll by agreed independent and impartial external auditors.

iii.The immediate cessation of the printing of the ballot paper pending agreement of observation by stakeholders.

iv. Agreement on and full disclosure of the printing, the quality the status, the traceability, transmission and distribution of ballot paper and election material.

v. Transparency around the remaining stages of the electoral process including effective observation by stakeholders of the printing, storage and distribution of all electoral materials.

vi. The unquestionable impartiality and professionalism on the part of ZEC in compliance with the Electoral Law, the Constitution of Zimbabwe, the SADC Guidelines and Principles for Democratic Elections.

vii. An independent forensic audit of the contacts-gate scandal where Zanu PF accessed voter information that was supposed to be in the sole custody of ZEC.

viii. Equal access to public media by political players.

Unless these issues are addressed there cannot be any chance of a free, fair, credible and legitimate election taking place on the 30th of July 2018.

Stop Misuse of Schools and Abuse of Schoolchildren: Update and Comment on ZANU-PF Response

Last month Veritas, with the Association of Rural Teachers Unions of Zimbabwe [ARTUZ], launched an urgent application in the Masvingo High Court to prohibit the use of school property for political purposes and the forced attendance of schoolchildren at political rallies. The Judge granted the application on 28th June and issued a provisional interdict prohibiting ZANU-PF from:
· forcing schoolchildren to attend rallies
· causing the closure of schools for any of its rallies or activities
· compelling teachers to attend rallies, to wear party regalia, to prepare performances for children to deliver at rallies, or to make contributions towards rallies
· holding rallies on school premises
· using school property for political purposes.
The court also prohibited the Minister of Primary and Secondary Education and his officials from assisting political parties in any of the above activities, and ordered the Minister to take active measures, including the making of regulations, to prevent political parties from abusing school property, staff and schoolchildren.

The Case is Non-Partisan: It should be noted that Veritas and ARTUZ are not taking up this issue to strike a blow to ZANU-PF, as was suggested by one newspaper. We do not take political sides. We are taking up this case to strike a blow for children’s and teachers’ rights, the correct use of our educational resources, and for the rule of law and constitutionalism.

If there is evidence of other political parties using schools, school buses, teachers and schoolchildren for party-political purposes we will do our best to ensure that any court ruling also applies to them.

Court Decision Praised by United Nations: The court’s decision was praised by the United Nations as being in line with the UN Convention on the Rights of the Child, that the best interests of the child must be the paramount consideration in every situation and at all times. [UN statement link]

In Line with Zimbabwe Human Rights Commission Report: In 2017 the Zimbabwe Human Rights Commission investigated complaints by various teachers’ unions about ZANU-PF’s misuse of school premises and property and abuse of schoolchildren. Its conclusions were:

“The compelling of children and teachers (and to contribute financially for teachers) to attend political rallies is a violation of their right to freedom of association and assembly in terms of the Constitution. … It was also noted that there was abuse of school property and other public property as the ruling party tried to secure attendance at their political rallies. There was use of vehicles from schools and other public institutions which is undesirable.”

The Commission recommended various measures to stop the abuses, but its report and its recommendations were ignored. [ZHRC Report link]

Response by ZANU-PF

ZANU-PF has responded to the High Court’s interdict by filing a notice of appeal which is noteworthy for its vagueness and does not address the real issue in the case, namely the illegality of compelling children and their teachers to attend political rallies and of using school property for political purposes [For those interested, the response and all the other court papers are on Veritas Website [link].] The effect of noting the appeal was to suspend the High Court’s interdict pending the hearing of the appeal.

The Supreme Court will hear ZANU-PF’s appeal on the 27th July, too late for the appeal court’s decision to have any impact on the conduct of ZANU-PF and other parties in their current electoral campaigns – polling day will be only three days later.

Abuse of Schools and School Children Continuing:
In the meantime, ZANU-PF has ignored the interdict. According to ARTUZ, during the period 6th-8th July, the party held a rally at Arcturus Mine to which supporters and schoolchildren were transported in school buses. The President [in his role as a presidential candidate] himself addressed a rally at Mapfungautsi Primary School in Gokwe which schoolchildren were forced to attend, and buses from various schools were used to ferry supporters to it. The party also convened a rally at Liebenberg High School in Chivhu which teachers from the surrounding district were asked to attend. These incidents are confirmed by photographs, press reports and letters from teachers.

Undemocratic Conflation of Party and State:

ZANU-PF’s conduct is just one example of the conflation of ruling party and State which has been a feature of Zimbabwe’s political life since 1980. Senior members of ZANU-PF have regarded the party as the real government of Zimbabwe with the right to use, commandeer and dispose of State assets for its own purposes. This attitude is inimical to democracy and good governance, which section 3 of the Constitution of Zimbabwe defines as including “a multi-party democratic political system”.
Veritas/ARTUZ Urgent Application Lodged
Veritas and ARTUZ therefore instructed their lawyer, Mr Doug Coltart, to lodge an urgent application with the Masvingo High Court seeking an order that the court’s interdict should remain in force pending the hearing of the appeal. This seems the only way to stop the continuing abuse.

Appeal to ZEC:

Stop political Parties Use of State Resources and Abuse of School Children
The repeated abuse of children and State property is deplorable.
Veritas appeals to ZEC, as the body responsible for ensuring that electoral campaigns are conducted fairly in accordance with the law, to put a stop to this abuse of schoolchildren and misuse of school premises and property.
Holding political rallies at government schools; commandeering school buses for transporting people to rallies; compelling schoolchildren to attend rallies and provide entertainment there; and making teachers attend rallies, wear party regalia and contribute to party funds: all these are illegal and always have been:
· School vehicles and other school property belong to the government or to school development committees. They cannot legally be used for party political purposes or for furthering non-educational objectives.
· Teachers are civil servants and as such are supposed to be politically neutral. The Constitution of Zimbabwe prohibits civil servants from being partisan or furthering the cause of any political party. Teachers who allow school property to be misused are guilty of misconduct under regulations governing their conditions of service.
· Intimidating people to attend rallies is a criminal offence in Zimbabwe. It is also prohibited by the Constitution of Zimbabwe.
· Compelling schoolchildren to attend political rallies amounts to child abuse and is specifically prohibited by the Constitution.
Moreover teachers stand in loco parentis towards their pupils and have heavy responsibilities towards them. Children who are in their teachers’ charge should not be allowed to leave school property without a letter from their parents giving permission for them to go out with a specific person or persons. If teachers allowed pupils to leave their schools to attend political rallies they would be grossly irresponsible because rallies are not safe environments for children: there can be intra- and inter-party violence and crushes in which people get injured, and recently an explosion at a presidential rally killed and injured several people. If a political party compels teachers to bring schoolchildren to its rallies or even ferries willing pupils to rallies without parental permission, the party is acting very irresponsibly, perhaps even criminally. The argument put forward by some political parties that children attend voluntarily is not tenable.

France Storm Into The World Cup Finals

France will face England or Croatia in the World Cup final after edging past European neighbours Belgium in the semi-final in St Petersburg.

Defender Samuel Umtiti scored the winning goal for the 1998 champions in the second half with a towering header from Antoine Griezmann’s corner.

With so many women present it seemed like a pertinent kitchen example at that unprepared time. I am very sorry for the unfortune analogy hastily put together to try make a point. I know and understand the historical context and in hindsight I believe I should have used other examples to avoid handing the violent Zanu PF party a PR victory. I am a strong believer in a peaceful free and fair election, and am fighting for a positive change in Zimbabwe. God Bless Everyone in , on all political divides in Zimbabwe.”

Veteran Zim TV Drama Actor Dies

“Tete Jari”

The country’s film industry has been plunged into mourning following the death of Elizabeth Nyanguridza known for her role in Studio 263 as ‘Tete Jari’.

58-year-old Nyanguridza who was in the film industry for more than 15 years, passed on early Monday (yesterday) morning at the Mbuya Dorcas Hospital after a short illness.

Family members and former workmates in the arts industry gathered at her house in Chitungwiza described the late as a unifier and added that the film industry has lost a great treasure.

Nyanguridza was known for her role in the once popular drama Studio 263 where she featured as ‘Tete Jari’ aunt to Vimbai and Jabu.

She was also in other productions including Ganyawu, Playing Warriors and Gringo.

She will be buried in Chiendambuya Headlands this Wednesday (tomorrow) and is survived by her husband and five children.

Mourners are gathered at house number 606, Unit F, Seke, Chitungwiza.

Chiefs Want ZANU PF Linked Charumbira Out

Some traditional leaders have reportedly started pushing for the ouster of the Chiefs’ Council president Fortune Charumbira (pictured), whom they accuse of frog-marching them into Zanu PF politics when they were supposed to be non-partisan.

The council is set to hold elections for new office bearers today in Masvingo under the auspices of the Zimbabwe Electoral Commission (Zec).

Efforts are reportedly also underway to strip Charumbira of his chieftainship after the Traditional Leadership Support Services Department (TLSSD) last year questioned his legitimacy.

The department wrote to the Local Government and National Housing ministry calling on the minister to set up a probe team to investigate the traditional leader’s legitimacy.

Chief Vezi Maduna is tipped to take over from Charumbira as the Chiefs’ Council president while in Matabeleland North and South, Chief Sibasa and Chief Jahana are likely to take over as provincial chiefs’ council chairpersons.

The TLSSD memorandum to the minister provides a clear lineage of the Charumbira chieftainship, which excludes the incumbent Chief Charumbira.

“We refer to an application by F Mhihwa Mapingure to His Excellency (President Emmerson Mnangagwa) for the resolution of the Charumbira chieftainship dispute. After perusal of the Charumbira file, the department thinks that the claim has substance… The Charumbira chieftainship was started by Mudavanhu Chief number one who passed on the chieftainship to his sons in order of seniority as follows: Mututuware − chief two, Mapingure − chief three, Mutana − chief four, Mataruse − chief five, Mudzimbasekwe − chief six, Mawoni − chief Seven, Magura − chief eight and Magyira − chief nine,” the memorandum read in part.

TLSSD further traced how the chieftainship was handed down before it was abolished and Mazha was appointed Headman Charumbira under Chief Chekai Shumba on May 1, 1950, on the grounds that he had been acting chief for several years and he was relatively younger than the correct claimants.

A meeting held in March 1961 established that Mazha was not the correct office holder and the resuscitation of the chieftainship had to pave way for the right heir (from the Mapingure house), according to the memo.

It was further noted that the legitimacy of Mazha’s claim was never questioned even though the sons of Mapingure and Magura had stronger claims.

TLSSD stated that appointment was done in terms of the vote against the Charumbira custom on March 5, 1962 when a meeting which comprised of 24 kraal heads voted to select a successor among Mazha of the Madyira house, Nyaku of the Mapingure house and Muchati of the Mataruse house. Nyaku had 37 votes, Mazha 35 and Muchati 2.

“Once again, despite the vote which Nyaku won, customs and tradition were at this point deliberately violated by the colonial system when the provincial native commissioner recommended Mazha in his stead. Mazha was appointed Chief Charumbira 10 on March, 1964,” the memo read.

“On December 23, 1968, one of Mazha’s sons, Zefaniya was appointed deputy chief to assist his father in performing his duties. While he was deputy chief, Zefaniya was appointed into the provincial assembly. Following Mazha’s death, his son Zefaniya was appointed acting chief.”

Zefaniya acted for four years during which he rose through the ranks to beSenator Chief Charumbira. He is believed to have used his influence in the Council of Chiefs and his relationship with the Rhodesian authorities to rise to the chieftainship “contrary to the succession custom of the Charumbira clan”.

Zefaniya was appointed substantive chief in 1975. Following his death on February 10, 1991, his son, Fortune, was appointed acting chief on January 14, 1992, before he was promoted substantive chief by former President Robert Mugabe.

The Mapingure clan contends that the chieftainship was supposed to come to their house.

It is against this backdrop that TLSSD recommended a probe to correct the error and appoint the deserving chief in line with the culture, customs, traditions and practices of the Charumbira community.

Efforts to get comment from Charumbira and TLSSD director Felix Chikovo on the developments were fruitless as their mobile phones went unanswered since last week.

On Monday, Local Government minister July Moyo said he could not comment as he was in a meeting and his number was unreachable yesterday.

Hwende revealed his intended arrest without giving details on Wednesday morning claiming that the ruling ZANU PF is abusing the police in the on-going campaigns.

“Just been informed that Law and order has issued a warrant of my arrest through the Kuwadzana Police,” said Hwende.

“ZANU PF Official must stop abusing the Police all candidates must be allowed to campaign freely without this abuse of State institutions,” he said.

Mnangagwa Concedes Defeat To Chamisa On Spaghetti Roads

Mnangagwa and his ruling ZANU PF party members have been castigating Chamisa for making “outrageous” promises for the nation like promising to build spaghetti roads when he comes to power.

“Yesterday, we launched the Zimbabwe National Critical Skills Audit , the Zimbabwe National Qualifications Framework and the Zimbabwe National Geospatial and Space Agency programmes,” said Mnagagwa.

“The New Zimbabwe is a forward looking, optimistic and ambitious Zimbabwe.

This is why we have decided to invest not only in the future of our nation, but we have chosen to invest in an ambitious future. A future with the right skills for the right jobs.

The message must be clear: Through education and hard work, we can and will achieve our dreams.

Auxillia Won’t Vote For ED, Says Manungo | IS THIS TRUE?

Nominated MDC T Candidate’s Name Missing On Voters Roll: Is This True?

By Own Correspondent| Linda Masarira, MDC T Spokesperson and aspiring legislator for Harare Central has claimed that despite being nominated to contest the forthcoming polls, her name is missing from the voters’ roll for her constituency which she recently acquired from ZEC.

She revealed that findings that her name is missing from the voters roll availed by ZEC is a reflection  that the elections body has more than one database of the voters roll which will be used in the forthcoming polls.

Masarira implored ZEC to conduct its mandate professionally accusing the elections body of unprofessionalism.

Below is the full text of Masarira’s Open letter to ZEC:

Dear ZEC

I am writing to you this letter raising my concerns as an MDC-T MP candidate for Harare Central Constituency with regard to the Harare Central Constituency voters roll which is in shambles and shows lack of seriousness and professionalism from ZEC.

The 2018 harmonised elections are polling station based and l expected to receive the Harare Central voters roll which was polling station specific since this year’s elections are polling station based.

Firstly, l would like to note the irregularities during the voter registration period which was slow and seemed like a deliberate ploy to frustrate people registering to vote. The voter registration was not adequately advertised.

Many people faced challenges in accessing the voter registration form and the VR9 proof of residence form which were not readily available at ZEC and l had to find sponsors to print the voter registration forms and VR9 forms and acquire the services of commissioner of oaths to certify the VR9 forms of those who wanted to register in ward 6 and ward 2 of Harare Central constituency.

Secondly, the voter inspection process was not given ample time for mistakes to be noted and for complaints to be lodged at ZEC regarding accuracy. The time given for voter inspection was too little and there wasn’t sufficient adverts and information dissemination in regard to the same.

Thirdly, ZEC supplied us with a Harare Central Constituency voters roll which is in shambles considering that the 2018 elections are polling station based, we expected a more professional polling station based voters roll from ZEC rather than the electronic copy which they supplied which can not be opened on a laptop and is also a hustle to log into the voters roll.

In the Harare Central Constituency voters roll we have noted a lot of irregularities such as persons who are given addresses that do not exist in the given constituency e.g ZRP Camp, Chikurubi and Morris Depot. This is a cause of concern considering the election history of vote rigging and electoral fraud. Number 61 Cameroon street has nearly 500 registered voters on the same address.

It is evident that ZEC has more than one database of the voters roll and l demand to be furnished with the actual voters roll that will be used in Harare Central Constituency and the voters roll for all polling stations for accountability and transparency.

I am a duly nominated candidate for Harare Central Constituency and my name is missing from the given voters roll including my chief elections agent Trust Ruvoko and my son Kuzivakwashe Mhlanga who registered to vote the same day with me is also not appearing on the electronic voters roll which ZEC supplied to me.

For the past two decades, successive audits of the voters roll have shown that the voters roll is not a true reflection of the registered voter population in Zimbabwe. Although section 194(1)(h) of the Constitution of Zimbabwe requires all tiers of government including ZEC to foster transparency by providing the public with timely, accessible and accurate information, this is not reflected in the Electoral Act and ZEC has not been transparent about many issues. For example, it has not published its procedural manuals, has refused to put the contract for printing ballot papers to public tender and continue to be very secretive about the source, storage and distribution of the ballot paper.

In 2013 every polling station in each constituency received copies of the same voters roll even though the election was ward based. Without other measures against multiple voting such as indelible ink a person could vote at all polling stations in the constituency. I implore ZEC to furnish me with polling station based voters roll to curb vote rigging and electoral fraud and the same to be done to all constituencies in Zimbabwe.

In the previous election 750 000 urban registered voters were missing from the voters roll. If ZEC was prepared for this year’s harmonised elections why haven’t they supplied the print voters roll yet, when we are now 19 days before an election?

It should be noted that Section 17 A and 21 (6) (a)(b) of the Electoral Act requires the continual updating of the voters roll and it’s inspection including issuing the same within a reasonable time before the polling date yet ZEC closed the voter registration for 2018 elections end of May 2018 thereby denying potential voters the opportunity to exercise their right to vote in 2018 harmonised elections. In 2013 Harare Central Constituency had 27 595 registered voters yet in 2018 Harare Central constituency has 14264 registered voters.

The right to vote under section 67 (3) of the Constitution states that, “every Zimbabwean citizen who is of or over 18 years of over age has the right to vote in all elections and referendums” and section 155(2)(b) says “The State must take all appropriate measures, including legislative measures” to ensure that every eligible citizen has an opportunity to vote. Paragraph 1(2) of the Fourth Schedule to the Constitution allows the Electoral Law to prescribe residential requirements, but only “to ensure that voters are registered on the most appropriate voters roll” – not to prevent them from being registered at all.

The Electoral Act even with its new amendments, will deny the right to vote to several classes of citizens.

Citizens living outside Zimbabwe cannot be registered as voters and so will not be able to vote. This is because section 23 of the Electoral Act insists that persons must be resident in a constituency before they can be registered on a voters roll in that constituency. In any event ZEC provided no facilities for citizens outside the country to register on the new voters roll, so no one in the Diaspora will be registered unless they came back to Zimbabwe to apply for registration.

Hospital patients, persons manning essential services and registered voters who cannot go to a polling station to vote on election day will not be able to cast their votes unless they are permitted to vote by post and the only people who will be allowed a postal vote are election officials, members of the security services on electoral duty, and Zimbabwean diplomats overseas off which during the 2013 elections the special voting was paralyzed by failure to deliver the ballot paper on time. Special voting did not go well on 14/15 July 2013 due to shortage of voting materials, ink, ballot papers and ballot boxes and how are we guaranteed that this time around history will not repeat itself. This is the effect of sections 56(1) and 72 of the Electoral Act, and is stated expressly in section 22A(3). Hence many people like doctors and nurses, hospital patients, fire officers, long-distance drivers will be disenfranchised. Can the result of the forthcoming general election be regarded as representing the views of the people of Zimbabwe if so many citizens have been denied the right to express their views through the ballot?

It is clear that the Electoral Act is not yet aligned with the Constitution. This is very regrettable and does not augur well for the forthcoming elections.

There are other problems with the Act apart from its unconstitutionality.

√Unavailability: the only updated version of the Act currently available is the one on the Veritas website. An important requirement of the rule of law a foundational principle of the Constitution is that laws must be accessible, because if people cannot find out what the laws are they will not be able to obey them or know their rights under them. The Act should have been amended months ago and published in its amended form well before the election.
√Incomprehensibility: Those who can find an accurate copy of the Electoral Act will not find it an easy read. It is long, repetitive and sometimes obscure. It is five years since the last election, and Parliament had ample time to produce a new simplified Act.
√Errors: There are many errors in the Act that remain uncorrected. For example, the procedure to be followed after polling in a presidential election is dealt with by two sections, sections 37C and 110, which are inconsistent with each other.

It must be pointed out, however, that the deficiencies in the Act do not mean the elections will inevitably be unfree and unfair. A good Electoral Act does not guarantee good elections just as a bad one does not guarantee flawed elections. Much depends on the people who conduct and contest the elections.

Hopefully your commissioners and staff will conduct themselves in a transparent manner. Zimbabweans need elections that are free, credible and fair even if the Electoral Act itself is inadequate.

l urge ZEC to diligently and efficiently discharge it’s mandate and stop hiding behind the law which they are continuously violating.

Linda Masarira Not On The Voters Roll

By Paul Nyathi|Aspiring Harare Central constituency Member of Parliament Linda Masarira is actually not a registered voter.

Masarira revealed in a letter written to the Zimbabwe Electoral Commission, ZEC, that her name does not appear on the voters roll issued to her by the commission yet she was accredited as a candidate by the nomination court on June 14.

According to Zimbabwean law, a person can not be a candidate if they are not registered as a voter in the area they intend to contest in.

Masarira’s wide ranging letter to the commission reads as follows:

I am writing to you this letter raising my concerns as an MDC-T MP candidate for Harare Central Constituency with regard to the Harare Central Constituency voters roll which is in shambles and shows lack of seriousness and professionalism from ZEC.

The 2018 harmonised elections are polling station based and l expected to receive the Harare Central voters roll which was polling station specific since this year’s elections are polling station based.

Firstly, l would like to note the irregularities during the voter registration period which was slow and seemed like a deliberate ploy to frustrate people registering to vote. The voter registration was not adequately advertised. Many people faced challenges in accessing the voter registration form and the VR9 proof of residence form which were not readily available at ZEC and l had to find sponsors to print the voter registration forms and VR9 forms and acquire the services of commissioner of oaths to certify the VR9 forms of those who wanted to register in ward 6 and ward 2 of Harare Central constituency.

Secondly, the voter inspection process was not given ample time for mistakes to be noted and for complaints to be lodged at ZEC regarding accuracy. The time given for voter inspection was too little and there wasn’t sufficient adverts and information dissemination in regard to the same.

Thirdly, ZEC supplied us with a Harare Central Constituency voters roll which is in shambles considering that the 2018 elections are polling station based, we expected a more professional polling station based voters roll from ZEC rather than the electronic copy which they supplied which can not be opened on a laptop and is also a hustle to log into the voters roll. In the Harare Central Constituency voters roll we have noted a lot of irregularities such as persons who are given addresses that do not exist in the given constituency e.g ZRP Camp, Chikurubi and Morris Depot. This is a cause of concern considering the election history of vote rigging and electoral fraud. Number 61 Cameroon street has nearly 500 registered voters on the same address. It is evident that ZEC has more than one database of the voters roll and l demand to be furnished with the actual voters roll that will be used in Harare Central Constituency and the voters roll for all polling stations for accountability and transparency.

I am a duly nominated candidate for Harare Central Constituency and my name is missing from the given voters roll including my chief elections agent Trust Ruvoko and my son Kuzivakwashe Mhlanga who registered to vote the same day with me is also not appearing on the electronic voters roll which ZEC supplied to me.

For the past two decades, successive audits of the voters roll have shown that the voters roll is not a true reflection of the registered voter population in Zimbabwe. Although section 194(1)(h) of the Constitution of Zimbabwe requires all tiers of government including ZEC to foster transparency by providing the public with timely, accessible and accurate information, this is not reflected in the Electoral Act and ZEC has not been transparent about many issues. For example, it has not published its procedural manuals, has refused to put the contract for printing ballot papers to public tender and continue to be very secretive about the source, storage and distribution of the ballot paper.

In 2013 every polling station in each constituency received copies of the same voters roll even though the election was ward based. Without other measures against multiple voting such as indelible ink a person could vote at all polling stations in the constituency. I implore ZEC to furnish me with polling station based voters roll to curb vote rigging and electoral fraud and the same to be done to all constituencies in Zimbabwe.

In the previous election 750 000 urban registered voters were missing from the voters roll. If ZEC was prepared for this year’s harmonised elections why haven’t they supplied the print voters roll yet, when we are now 19 days before an election?

It should be noted that Section 17 A and 21 (6) (a)(b) of the Electoral Act requires the continual updating of the voters roll and it’s inspection including issuing the same within a reasonable time before the polling date yet ZEC closed the voter registration for 2018 elections end of May 2018 thereby denying potential voters the opportunity to exercise their right to vote in 2018 harmonised elections. In 2013 Harare Central Constituency had 27 595 registered voters yet in 2018 Harare Central constituency has 14264 registered voters.

The right to vote under section 67 (3) of the Constitution states that, “every Zimbabwean citizen who is of or over 18 years of over age has the right to vote in all elections and referendums” and section 155(2)(b) says “The State must take all appropriate measures, including legislative measures” to ensure that every eligible citizen has an opportunity to vote. Paragraph 1(2) of the Fourth Schedule to the Constitution allows the Electoral Law to prescribe residential requirements, but only “to ensure that voters are registered on the most appropriate voters roll” – not to prevent them from being registered at all.

The Electoral Act even with its new amendments, will deny the right to vote to several classes of citizens.

Citizens living outside Zimbabwe cannot be registered as voters and so will not be able to vote. This is because section 23 of the Electoral Act insists that persons must be resident in a constituency before they can be registered on a voters roll in that constituency. In any event ZEC provided no facilities for citizens outside the country to register on the new voters roll, so no one in the Diaspora will be registered unless they came back to Zimbabwe to apply for registration.

Hospital patients, persons manning essential services and registered voters who cannot go to a polling station to vote on election day will not be able to cast their votes unless they are permitted to vote by post and the only people who will be allowed a postal vote are election officials, members of the security services on electoral duty, and Zimbabwean diplomats overseas off which during the 2013 elections the special voting was paralyzed by failure to deliver the ballot paper on time. Special voting did not go well on 14/15 July 2013 due to shortage of voting materials, ink, ballot papers and ballot boxes and how are we guaranteed that this time around history will not repeat itself. This is the effect of sections 56(1) and 72 of the Electoral Act, and is stated expressly in section 22A(3). Hence many people like doctors and nurses, hospital patients, fire officers, long-distance drivers will be disenfranchised. Can the result of the forthcoming general election be regarded as representing the views of the people of Zimbabwe if so many citizens have been denied the right to express their views through the ballot?

Only 7 People Confirmed Registered Voters At Pagati Primary School In Matobo North

By Own Correspondent| There are 7 people who have registered to vote at Pagati Primary school in Matobo North according to the recently released voters roll from the Zimbabwe Electoral Commission (ZEC).

According to the voters roll, of the registered voters in Ward 21, 5 are women and 2 are men, revealed a source who has analysed the availed voters roll.

However, one Discent Collins Banjila revealed on Facebook that:

“I have been to that polling station several times. The first time I went there was in 2010 when we were conducting consultations on the New Constitution as COPAC.

9 people attended the meeting. There was 12 of us in the outreach team. We were therefore more than the meeting attendants.

As a team we caucused across the parties and agreed that the meeting must be postponed. We then went to the people to announce that because they are too few we will have to reschedule the meeting and they must encourage others to attend the rescheduled meeting.

The people told us that everyone who stays in the area was actually at the meeting so there was no need to reschedule. We proceeded to hold the meeting.

There was no response for more than half the 26 questions on the questionnaire. The only strong point raised was “Asifuni inkotshani.”

 

Mliswa Shakes ZANU PF and MDC Alliance in Norton

By Munesu Chigada| Norton MP Temba Mliswa defied the odds and drew a staggering crowd at his Ward 12 and 15 rallies on Saturday in a move that shook the ZANU PF and MDC Alliance camps on Saturday ahead of the July 30 harmonized elections.

The rallies, coming a day after Chris Mutsvangwa held his own rally at Takunda Primary, was a huge testament of intent from the independent candidate as his crowd dwarfed the paltry audience that came to listen to the Special Advisor to President Mnangagwa, Chris Mutsvangwa.

The venues the rallies are reputed strongholds for ZANU PF and MDC.

Mutsvangwa had a paltry crowd just below hundred at his own Nyaga City event where he lambasted those seeking to support Mliswa.
However events from Saturday showed that many are not to be deterred from following the man they call Bhuru.

People started flocking out in huge numbers as early as 9 am defying the winter weather and assembling at the school whilst the combative legislator was still at another rally in Ward 15 at Nyaga City.

Eyewitnesses spoke.

“There were thousands here from morning but some went home when they saw that the MP was late in arriving at the venue but still you can see there are thousands still here,” said one lady at the rally.

Mliswa has slowly entrenched his hold on Norton through a huge number of developmental initiatives which have seen the building of school blocks, drilling of boreholes and repairing of roads.

Various roads in Garikayi, Maridale, Mashlands, the Chibero-Sandringham road and Madziyire, from Zvimba road to Bulawayo road, have been graded courtesy of his sponsorship.
All these have endeared him with the Norton population which is still smacking from 7 failed years under ZANU PF and MDC-T leadership.

Speaking at the rally in Ward 12 which is the biggest constituency in the urban zone, Mliswa promised to remain the people’s representative by working outside the limitations of parties.
“I don’t have time for cell or ward meetings, I only have time for doing the job that I’m elected to do which is to represent the people”, he said to an elated crowd.
An equally joyous occasion unfolded in Ward 15 earlier in the day when Mliswa addressed the biggest rural ward where thousands again braved the cold weather to gather for the penultimate rally before the July 30 harmonized elections.
Mliswa has vowed to finish his developmental projects if he wins this year and then proceed to contest for higher office.

Mphoko Taken To Court For Looting Cash

THE Mphoko family has come under fire for allegedly hijacking the Choppies retail business and “looting” cash from the outlets countrywide without board approval.

Mr Siqokoqela Mphoko, son to former Vice President Phelekezela Mphoko, is a director of Nanavac Investments (Private) Limited, a local partner for the Botswana-registered Choppies Distribution Centre (Proprietary) Limited.

A shareholder in the retail business, Mr Mphoko is accused of abusing his power to “loot” cash realised from sales at different supermarkets and replacing it with transfers.

Another family member identified as Nomagugu Mphoko is also accused of bulldozing various shops demanding cash.

The two, according to the foreign investors, are using threats of deportation against Choppies employees.

The boardroom war has spilled into the High Court, with Choppies seeking to bar the Mphoko family from interfering with the retail business’ operations.

Choppies wants the family barred from taking money from the business and harassing workers.

Mr Mphoko and Nomagugu have been listed as respondents in an urgent interdict filed at the High Court this week.

Choppies accuses Mr Mphoko of being ungrateful considering that he was being paid $10 000 monthly and a dividend annually as part of their deal.

He also uses a company vehicle and draws fuel from Choppies.

Mr Mphoko, according to court papers, gets school fees allowances for his children, among other benefits.

A founding affidavit by Choppies chief executive Mr Ramachandran Ottapathu says the Mphoko family is on a looting spree.

“First respondent (Mr Mphoko) has, without board authority from third respondent (Nanavac Investments), agreement with any of the applicants and without seeking their consent, demanded and looted cash from different supermarkets. He has embezzled to date the sum of $45 258. He has also extended himself unauthorised lines of credit, which have seen him misappropriating the company’s stocks and fuel amounting to $6 687,06.

“He has also, without authorisation, transferred $7 000 from the company for his personal use,” read the affidavit.

Ms Nomagugu Mphoko, who is not a director or employee of Choppies, is said to have demanded and collected $30 230 cash from the daily takings at various outlets in Zimbabwe.

“Second respondent, who is neither an employee, member, director nor shareholder of third respondent, with apparent blessing of the first respondent, has been taking all the cash generated from the business operations of the third respondent forcibly from cashiers and swiping back at point of sale machines from her own personal account or those of her family members,” read the affidavit.

Any attempts by workers to deny the Mphokos access to cash, the papers read, was met with threats of deportation, physical harm and in some cases, riotous, vulgar and racist utterances.

“The first and second respondents’ behaviour has continued unabated leaving the company on the brink of a financial meltdown and a genuine fear and reality of a potential exodus of highly skilled expatriate staff. The business survival is at risk and there is real fear of irreparable harm should the first and second respondents continue with their destructive behaviour unabated,” the court papers read. The behaviour of the Mphokos, the court heard, was likely to strain the bilateral relations between Zimbabwe and Botswana.

Choppies claims to have invested $66 million in the retail business and that it employs 1 800 people. The Mphoko family is yet to respond to the urgent chamber application.

ZEC Completes Presidential Ballot Paper Printing

By Paul Nyathi|The Zimbabwe Electoral Commission (ZEC) has finished printing the Presidential election ballot paper.

ZEC commissioner Dr Qhubani Moyo declared in a statements that the commission completed printing the highly disputed ballot papers on Tuesday.

“Update: The Printing of the Presidential ballot paper for the 2018 elections has been completed in Harare,” said Dr Moyo in a brief statement on his official Facebook page.

Some opposition parties particularly the Nelson Chamisa led MDC Alliance have been resisting the ballot paper and the printing process.

The MDC Alliance will in fact be holding a mass demonstration in Harare on Wednesday against the ballot paper printing process.

The opposition parties claim that the ruling ZANU PF used the ballot paper to rig the 2013 elections and they wanted to decide on the design, quality of paper and monitor the printing of this year’s ballot paper.

ZimEye.com could not get an immediate comment from the MDC Alliance.

Chigumba Says Foreign Election Observers Must Report To Her Office

By Simba Chikanza| The Zimbabwe Electoral Commission chairperson Priscilla Chigumba has said that election observers must report to her organisation.

Justice Chigumba made these statements on Monday during her presser.

She said this while making legal threats against all election observers saying they will have breached the nation’s laws if they monitor the upcoming polls. She claimed that there is a difference between observing and monitoring the polls.

In her statement, Justice Chigumba said observers must, “obey every lawful instruction by an electoral officer.” She also stated that they must “bring to the attention of the presiding officer or constituency elections officer any observed irregularity in the conduct of the poll or counting of the votes.”

This means that Election Observers will not be able to communicate anything after the polls beyond what they will have engaged her office during the voting period. SEE FULL STATEMENT BELOW –

Meanwhile, Justice Chigumba’s statement that observers must not carry out the role of monitors could be read as a direct threat against the European Union observers who last week  passed comments protesting against organisation’s handling of the upcoming polls.l, particularly the printing of ballot papers.

Free Bail For Mob Justice Murderers

TWO Filabusi siblings who were reportedly part of a mob that beat up and killed a man after accusing him of stealing have been arrested two years after committing the offence.

Aotar (26) and Innocent Ndlovu (24) were not asked to plead when they appeared before Gwanda magistrate, Mr Obedience Matare facing murder charges.

They were remanded out of custody on free bail to August 13 after the State pointed out that investigations were still underway to link the two men to the case.

Two other murder suspects Nkululeko Ncube and Wisdom Mkandla recently appeared at the Gwanda Magistrate’s Court facing a murder charge and they were placed off remand pending further investigations.

Mr Matare ordered the two siblings to report to Filabusi Police Station once each month and warned them against interfering with State witnesses.

“The State is not opposed to free bail and they have pointed out that investigations are still underway to link you to this offence. Furthermore you came to the court willingly after being summoned by the police. Therefore I will remand you out of custody to August 13 on free bail,” he said.
Prosecuting, Mr Moses Gondongwe said Aotar and Innocent were part of a mob comprising about 150 people that beat up Thabisani Moyo to death on November 7 in 2016.

“On 7 November 2016 at Hayhill Farm in Filabusi area Aotar and Innocent connived with Nkululeko Ncube and Wisdom Mkandla and other people numbering about 150 who are still a large and attacked Thabisani Moyo whom they had accused of stealing.

“They beat him up with sticks, stones and machetes and left him seriously injured before fleeing. Moyo died as a result of injuries sustained during the attack,” he said

$4m Pay Out For Outgoing MPs

Members of Parliament are set to get a $4million windfall in the next few days for their outstanding allowances.

Each MP is expected to pocket about $30 000.

The money is over and above what the legislators have been getting in previous weeks as Treasury paid them allowances covering September last year up to March this year.

Parliament has submitted bids to Treasury covering the last five months, which should clear all the outstanding allowances for the Eighth Parliament.

Those expected to make rich pickings are MPs who consistently attended sittings and those with distant constituencies but used private accommodation like residential houses in Harare if Parliament could not book them into hotels.

In an interview yesterday, Clerk of Parliament, Mr Kennedy Chokuda confirmed the development saying they had gone a long way in clearing their indebtedness to MPs.

“We have already paid MPs up to March. Right now MPs are getting their outstanding allowances. In fact we have paid the bulk of what we owe them. What now remains is payment of the last five months that is from March to July. We expect the money to be released in the next few days because we have submitted bids,” said Mr Chokuda.

He could not however say how much in total they received or how much each MP got in the last batch and what an individual legislator would get for the remaining months.

“As we speak MPs are getting their allowances in respect of the previous period. The balance for March up to July we will pay them before the month comes to an end,” he said.

Over the past months, parliamentary business has been disrupted as legislators pressed to have their allowances paid. At one stage, a pre-budget seminar was delayed as MPs insisted that they wanted concrete time frames on when they would be paid. In another instance, Parliament had to prematurely adjourn after MPs refused to conduct business of the day demanding their outstanding allowances given that their term of office was coming to an end.

Most of them complained that they were subsiding Parliament by coming to work using their own resources.

Windfall For All Civil Servants Before Elections

Government yesterday released pay dates for civil servants for this month with its employees also expected to start receiving their 17,5 percent salary rise.This will be their first pay increase in nearly a decade.

The health sector, Zimbabwe National Army and Air Force of Zimbabwe will get their salaries on Monday, while police and Zimbabwe Prisons and Correctional Service officers will receive theirs on July 20.

The education sector will be paid on July 24 and the rest of the civil servants will be paid on July 27.
Pensioners will be paid on July 31.

Civil servants body, Apex council secretary general Mr David Dzatsunga confirmed this month’s pay dates.

He said in fulfilment of an agreement between Government and civil servants following salary negotiations, employees are expected to receive an increment this month.

“Unless something drastic happens, the agreement we have with them (Government) is that the salary increment is coming this July, with effect from 1st of July. So it will be legitimate to say they will certainly effect an increment this month,” he said.

Zimbabwe Teachers’ Association chief executive officer Mr Sifiso Ndlovu said teachers were expecting to receive a pay rise as no communication to the contrary has been made.

He said what teachers were now seeking is Government’s clarification on the payment of cash-in-lieu of outstanding vacation leave days.

“We expect them to start rolling out the issue of cash-in-lieu because that is a special allowance for civil servants,” he said.

The Minister responsible for the administration of the Public Service Cde Simbarashe Mumbengegwi could not be reached for comment yesterday.

Chiwenga: Chamisa is A Cry Baby

The MDC Alliance should stop being cry-babies and let the Zimbabwe Electoral Commission (ZEC) do its job as mandated by the Constitution, Vice-President Constantino Chiwenga said yesterday.

Addressing a rally at Simchembo 1 Primary School in Gokwe North, the Vice President said Zanu-PF has no control over ZEC as it is an independent body.

Of late the MDC Alliance led by Mr Nelson Chamisa has been accusing ZEC of being biased towards the ruling party. The coalition has a scheduled demonstration against ZEC today and has previously threatened to pull out of the July 30 harmonised elections citing some alleged irregularities.

“ZEC is an independent body and as Zanu PF we have nothing to do with it. The elections will go as planned. Surprisingly they are being cry-babies yet they were part of the process to put the electoral body in place,” said Vice President Chiwenga.

He said Zanu-PF was not slowing down its campaign machinery in a bid to win the elections. He said Zanu-PF was the only party that was going to develop the country in the next five years as evidenced by the socio-economic growth witnessed by the country in the past seven months under the new dispensation.

“The future of our country is in our hands so is the future of our children. So come July 30 you must vote for your Zanu-PF councillor, your Member of Parliament who in this case is Cde Lovemore Chikomba and President Mnangagwa. President Mnangagwa on July 31 will become our new leader of the country and he has already declared Zimbabwe is open for business meaning a brighter future for every Zimbabwean,” he said.

Vice President Chiwenga said following Operation Restore Legacy, Zimbabwe under the leadership of President Mnangagwa would not recede to the levels of yesteryear.

“President Mnangagwa after November 24 promised a new Zimbabwe of opportunities for everyone and so Zimbabwe won’t go back to the old. We are doing new things and we want to satisfy every Zimbabwean,” he said.

The VP said the masses were the rightful owners of the party adding that no individual was bigger than it.

“It’s you who elect the leadership of the party and you elect the leaders of the country. Zanu PF is too big and can’t be placed in anyone’s pocket. Gokwe North, Vice President Chiwenga said, was being considered for development in health, education and infrastructure development.

The Vice President said Government was also recruiting qualified teachers so that they teach Tonga in primary and secondary schools in Tonga-speaking Gokwe North.

He said Government was going to install electricity in Simchembo area shortly so that there is power at schools and health facilities.

I have promised the Midlands Minister of State for Provincial Affairs Cde Owen Ncube and the Zanu-PF Provincial chairperson Cde Daniel MacKenzie Ncube that we are going to bring centre pivots and start an all year irrigation scheme which will be under Chief Simchembo as a matter of urgency,” he said.

Zanu-PF Matabeleland South provincial chairman, Cde Rapelang Choene said the province was preparing to meet VP Chiwenga.

“As a province we’ve started preparing and we’re trying to mobilise transport to get all people to attend and also to meet Vice President Chiwenga,” he said.

He said the first rally will be held near Zhove Dam where they’re planning to launch a very big irrigation project.

“Zhove Dam is one of the dams that is underutilised and an irrigation project is expected to be launched there by Vice President Chiwenga,” he said.-state media
