By A Correspondent| Prosecutor-General Kumbirai Hodzi has reportedly filed an application for rescission of the acquittal of journalist Hopewell Chin’ono by the High Court on charges of publishing falsehoods. This comes after High Court judge Justice Charehwa had ruled that the charge against Chin’ono on publishing falsehoods cannot stand as it was declared unconstitutional. He was being charged with contravening Section 31 of the Criminal Law (Codification and Reform) Act which deals with publishing or communicating falsehoods prejudicial to the State. Prior to Justice Charehwa’s ruling, Chin’ono’s lawyers had earlier argued during his appearances before the Magistrates Court in Harare, that the case was based on a non-existent charge which was declared unconstitutional by the Constitutional Court in 2014. Following the dismissal of their argument at the Magistrates Court, Chin’ono through his lawyers filed a review application with the High Court. Justice Charehwa confirmed then, that indeed the provision relied on was declared unconstitutional and therefore cannot be relied on to press charges against the journalist. |
“Communal Lands Act Illegal”
By A Correspondent- The Zimbabwe Human Rights NGO Forum yesterday approached the Attorney-General (AG)’s Office seeking the alignment of Communal Lands Act with the Constitution to protect citizens from arbitrary evictions from their homes.
The Communal Lands Act is being applied by the government to displace villagers in Chilonga in Chiredzi to pave way for a lucerne project. Villagers have occupied that land for generations, but do not have title deeds.
“It is a well-known fact that the aforesaid Act has provisions that are inconsistent with the Constitution and are regrettably being used to violate human rights in communities,” the forum said in a petition to the AG’s Office.
“We are urgently seeking you to intervene and come up with a Bill to push for the alignment of this law with the Constitution.”
The AG indicated that persons occupying communal land were not protected by the Constitution as they did not own the land despite occupying it for decades.
The forum added that the Communal Lands Act was unconstitutional as it violated freedom from arbitrary evictions, violations of property rights and failed to recognise the cultural and indigenous rights of communities over communal land. The request was forwarded to the inter-ministerial taskforce on alignment of laws for consideration.

Lawyers, War Veterans Sue JSC And Malaba Over Tinkering With The Constitution
The Young Lawyers Association of Zimbabwe (YLAZ) and Frederick Mutanda, a liberation war veteran, on Tuesday 11 May 2021 filed an urgent chamber application at Harare High Court seeking an order to stop Chief Justice Luke Malaba from continuing as the head of the Constitutional Court.
In the application filed by Honey & Blanckenberg Legal Practitioners, who are members of Zimbabwe Lawyers for Human Rights, YLAZ and Mutanda argued that Chief Justice Malaba ought not to benefit from the term extension provisions as introduced by the amendment of the Constitution since he has served 15 years as a Judge of the Constitutional Court.
YLAZ and Mutanda argued that the Judicial Service Commission (JSC) which is cited as the first respondent failed to discharge its constitutional obligations diligently and without delay as was and now is required in law and as provided in section 324 of the Constitution.
YLAZ contended that if Chief Justice Malaba continues in office there would be no Constitutional Court in Zimbabwe thereby pushing the country into a constitutional crisis because he would have retained power in clear contravention of section 328(7) of the Constitution.
In a supporting affidavit filed together with the urgent chamber application Mutanda argued that government is reversing the gains and fruits of the liberation struggle such as the Constitution.
YLAZ and Mutanda want the High Court to declare that in failing to activate the provisions of section 180 of the Constitution diligently and without delay, the JSC violated section 324 of the Constitution.
They also want Chief Justice Malaba not to benefit from the term limit extension as introduced by an amendment of section 186 of the Constitution and for him to vacate office as the Chief Justice on midnight of 15 May 2021.
In the alternative, YLAZ and Mutanda want section 14 of Constitution of Zimbabwe Amendment (No.2 Act, 2021 to be declared invalid for violating section 56(3) of the Constitution and be struck down.
High Court Judges Justice Jester Charewa, Justice Happias Zhou and Justice Edith Mushore will preside over hearing and determination of the urgent chamber application on Friday 14 May 2021.
Teachers Defy Order “To Register As Zanu Pf Voters”- Bravado Will Disapper Under Operation Mavhitera Papi Mark 2
By Nomusa Garikai- “Over the weekend, members of Zanu PF terrorised some teachers in Mutoko district, forcing them to register as part of the five million voters for Zanu PF. In some cases, Zanu PF had all the details of the teachers, they just visited to confirm. In Kagande, teachers were forced to attend a rally,” reported Zimeye, quoting Amalgamated Rural Teachers’ Union of Zimbabwe (Artuz) twit.
“A total of 31 trs reported through our hotline. Our rapid response team is in Mutoko assessing the safety of some trs who refused to attend the Kagande meeting & those who refused to register as ZANU PF voters for 2023.”
Progressive Teachers Union of Zimbabwe president Takavafira Zhou has also reported of village heads and School Development Committee members evicting teachers from school accommodation who are on strike over the ongoing wage dispute with government.
Zanu PF’s coercive power is well documented especially in the rural areas where the party has reduced to people into nothing but medieval serfs beholden to the overbearing Zanu PF operatives and proxies.
President Mnangagwa has himself launched the mobilisation of the War Veterans and the opening of the Border Gazi camps to train the party’s youth militia, the green bombers. These two were the party’s foot-soldiers in the watershed 2008 elections when the party used wanton violence to overturn Tsvangirai’s 73% in the March vote, according to Mugabe’s own Freudian slip or parapraxis, to a 84% for Mugabe in the run-off.
The war veterans and the green bombers were the infantry whose strength is in numbers but could not do much beyond harassing, beatings, rape and the destruction of property. The foot-soldiers were backed by the well-equipped and ruthless big brothers; the Soldiers, Police, CIO and Prison Service personal deployed by the Joint Operations Command (JOC); they did the heavy-duty work of kidnapping and killing. Over 500 innocent Zimbabweans were murdered in the three months run-off period.
JOC, a Junta comprising the top brass in the security services plus a select few from Zanu PF and headed by Robert Mugabe (before he was booted out in the November 2017 coup) and with Mnangagwa as his deputy. It was JOC that planned the military style 2008 wanton violence, Operation “Mavhotera papi!” (Whom did you vote for!) and deployed the personal to execute the plan.
JOC has been the real power behind Zanu PF’s long stay in power, the power behind the throne. The party and government rewarded the JOC members by granting them generous salaries and perks, they were first to be allocated farms and other privileges notably the licence to loot diamonds in Marange and Chiadzwa. JOC members are the heart and soul of Zimbabwe’s filthy rich oligarchs
The biggest mistake Robert Mugabe, the otherwise artful Dodger of Zimbabwe politics, made to align himself with the Generation 40 (G40) Zanu PF faction. Grace Mugabe, the G40 leader, stated the obvious when she accused the JOC members of being greedy and holding the nation to ransom. It was clear that G40 was going to force many of the JOC members to retire from the security services and thus end their political influence. Robert Mugabe had done the preparatory work by passing a law stipulating the retirement age of all civil servants, civilians and those in the security services! Many of the JOC members were well past their retirement age
Mugabe and his G40 had crossed swords with JOC and the later’s response was the November 2017 the military coup, “Operation Restore Legacy”, as the coup plotters called it. Mugabe was booted out of office and G40 ringleaders were either killed, are in and out of prison or are in exile.
Operation Restore Legacy just like Operation Mavhotera papi before it were clear and unambiguous statements of fact: JOC and JOC alone will decide who rules Zimbabwe. Operation Mavhotera papi was about JOC denying the ordinary Zimbabweans a meaningful say in the governance of the country by denying them free, fair and credible elections. JOC wanted Robert Mugabe and Zanu PF to rule and punished the people for daring to vote for Morgan Tsvangirai and MDC.
Operation Restore Legacy was about reminded those in the Zanu PF government, that it was JOC that put them there!
In the upcoming 2023 elections, JOC is backing President Mnangagwa and Zanu PF and will not brook anything short of a landslide electoral victory for their horse.
JOC has the plans of Operation Mavhotera papi mark 2, ready. How much of blatant cheating and wanton violence will be used depends on the situation on the ground. Soldiers, Police, etc. will be deployed if there are more reports of teachers or anyone defying Zanu PF orders.
“Nothing will be left to chance!” boasted President Mnangagwa, a few weeks ago when he announced the mobilisation of the war veterans and the green bombers.
Zimbabwe will never ever hold free, fair and credible elections as long as Zanu PF and the shadowy Junta, JOC, continues to enjoy dictatorial powers including the carte blanche powers to rig elections.
Zimbabwe had its best ever opportunity to implement the democratic reforms designed to dismantle the Zanu PF dictatorship during the 2008 to 2013 GNU. Robert Mugabe bribed Morgan Tsvangirai and his MDC friends, entrusted with the task of implementing the reforms, and, with their snouts in the feeding trough, they failed to get even one reform implemented. Not even one!
Ever since the GNU debacle, Zanu PF has allowed the opposition to win a few gravy train seats to entice them to participate in the election regardless how flawed and illegal the process. By participating the opposition have given the vote rigging Zanu PF legitimacy and thus taking the sting out of the Zanu PF vote rigging shenanigans.
“Our rapid response team is in Mutoko assessing the safety of some trs who refused to attend the Kagande meeting & those who refused to register as ZANU PF voters for 2023!” Anyone who has witnessed the sheer brutality and barbarism of the 2008 Operation Mavhotera papi knows that bravado of these teachers will disappear like morning mist as the Zanu PF vote rigging juggernaut goes through its gears.
Of course, it folly of the teachers or anyone to defy Zanu PF and JOC just as it is folly of the opposition to participate in the flawed elections and give the vote rigging Zanu PF legitimacy. The teachers as is the rest of the ordinary Zimbabweans are paying dearly for the opposition’s blatant betrayal in failing to implement the reforms and for the opposition’s greed in participating in flawed elections giving the vote rigging Zanu PF legitimacy.
As long as the opposition continue to participate in flawed and illegal elections and giving the vote rigging Zanu PF legitimacy, there is no reason why Zanu PF would ever implement the reforms and risk losing the elections in free and fair vote. If we are serious about ending the curse of rigged elections then we must stop the opposition who are the ones selling out and letting Zanu PF off the hook!
“Safeguard Independent Journalism”: Trevor Ncube
By A Correspondent- The media should not be aligned to political parties and it should serve the best interest of the country, Alpha Media Holdings (AMH) chairman Trevor Ncube has said.
Speaking at the Zimbabwe Independent’s 25th anniversary celebrations in Harare early this week, Ncube said political parties have narrow agendas that they sell as the country’s agenda which the media must not confuse with the national agenda.
The Zimbabwe Independent, AMH’s business weekly, was launched on May 10 1996 with Ncube as co-founder and editor. Ncube said citizens should fight to safeguard independent journalism.
“The most important thing at AMH is Zimbabwe. We might disagree about who is in charge, but at the heart of everything that we do is Zimbabwe. Are we making progress as a nation, human rights, the development of our people, the education of our people?” Ncube said.
Ncube said the Zimbabwe Independent and the AMH staff were patriotic and wanted the country to prosper.
“Our emphasis is that our journalism must not support a political party. We should not support the opposition; we should not support the ruling party. We should support what is important for Zimbabwe,” he added.
“What is important for Zimbabwe is economic prosperity, unity, political stability, that is what is important,” he said, adding that the media ought to look at the big picture and help create a society that will be inherited by posterity.
Ncube said Zimbabwe “is at the heart of AMH” as Zimbabwe Independent celebrates 25 years of giving the country a platform where people can robustly engage on issues affecting the country.
“We believe that we must be independent from advertisers, very important, we must be independent from opposition political parties, we must be independent from the government and we must be independent from Trevor Ncube. It is important that we protect that kind of journalism where the people in the newsroom make the decision.”
Speaking at the same occasion, AMH editor-in-chief Wisdom Mdzungairi said the Zimbabwe Independent has become an authoritative voice in the business circles.
“Our commitment to Zimbabwe is that Zimbabwe Independent continues to be an authoritative newspaper and continues to champion the country’s development going forward through factual, timely and relevant news to its readers.”
Mdzungairi said AMH looked into the future with full confidence in unfiltered journalism, adding that AMH viewed itself as an important pillar of the government and the business sector.

Vehicle Smuggling Racket Busted

By A Correspondent- The South African National Defence Forces (SANDEF) on Monday busted vehicle smuggling racket, intercepting two sports utility vehicles which were being smuggled to Zimbabwe through a sandy beach.
Several Zimbabweans and other nationals have been nabbed for trying to smuggle cars stolen in South Africa through the Beitbridge Border Post into Zambia, Malawi, Mozambique and other regional countries.
Reports say vehicle trafficking syndicates smuggle the stolen cars through the Limpopo River where donkeys are used to pull the vehicle across the river into Zimbabwe.
In a statement on Monday, the SANDEF said it impounded a Toyota Fortuner and a Nissan SUV worth half a million rands which were being smuggled into the country through an illegal entry point.
“The SANDEF soldiers deployed at Madimbo Operational Base Intercepted these luxury SUV’s which were about to be smuggled to Zimbabwe by vehicle smugglers,” SANDEF said.
Smuggling of vehicles and other contraband is rampant at the porous Beitbridge Border Post.
Zimbabwe is used as a transit point to smuggle luxury cars from South Africa for resale in other countries in the region.
In 2018, a 63-year-old South African national was sentenced to seven years in jail in Zimbabwe for vehicle smuggling.
Anti-crime operations by local police and soldiers and their counterparts in the neighbouring country have done little to stop the vice.
According to the Zimbabwe Republic Police, an anti-crime operation at the border post that began on January 7 targeting touts and organised criminal gangs involved in the smuggling of goods and other contraband has resulted in the arrest of over 16 000 offenders.
“Police warn members of the public against smuggling goods into the country and entering or exiting through unauthorised points.
“On 27 April 2021, 209 people were arrested for violating immigration laws during operation No to Border Crimes/ Mhosva Pamiganhu Ngadzipere/Amacala Kawaphele Emingceleni Yelizwe,” police said.
“Since the onset of the operation on January 7, 2021, 16 069 people have been arrested.”

Kazembe Kazembe Speaks On Zim Man Arrested For Smuggling Gold In South Africa
Government will leave no stone unturned in unearthing what transpired at the Robert Mugabe International Airport after 23 pieces of gold were smuggled from Zimbabwe into South Africa.
Debate on the security of the country’s ports of entry has been reignited after a suspect, Tashinga Nyasha Masinire, was recently found in possession of 23 pieces of gold allegedly smuggled from Zimbabwe into South Africa.
Masinire was arrested at OR Tambo International Airport on Sunday by South Africa’s anti-organised crime unit, the Hawks, and is facing charges of contravening the Customs Act 91 of 1964 and Precious Metals Act 37 of 2005.
Home Affairs and Cultural Heritage Minister, Hon Kazembe Kazembe says government is working flat out to ensure the culprits are brought to book.
“We are going to leave no stone unturned until we get to the bottom of it. We want to establish how that happened, how he managed to go through all the security points. We will be able to establish what transpired and investigations are ongoing. We have already established that when he walked in He didn’t have a bag, so we are going to find out how he ended up having a bag. To complete our investigations, we need information from Interpol, ZRP is already engaging Interpol for relevant information given that the culprit was arrested in South Africa. We not going to leave no stone unturned to unearth what actually transpired,” he said.
The smuggled 23 gold pieces are worth 783 thousand United States Dollars.
The suspect has already appeared in a South African court and was granted bail.
The second republic has indicated its strong desire to fight corruption across all sectors of the economy.

Financial Appeal For 18yr Old Zhombe Son
By A Correspondent- A man from Zhombe in the Midlands is appealing for assistance from well-wishers to raise US$1 500 to take his 18 year old son for emergency surgery in South Africa.
Mr Takesure Khumalo from Chief Gwesela’s area said his son Duduzile is not able to eat owing to a gum growth which has been giving him problems since 2009.
“In 2009, he was diagnosed with a growth on the left jaw. Up to this day, he has been in pain and has difficulties eating. He now survives on liquids as the growth has been swelling and now affects the whole left side of the face,” he said.
Mr Khumalo said for the past 13 years, his son has been suffering and doctors have failed to treat him. He said they have referred him to neighbouring South Africa for an urgent operation.
“I do not work and there is nowhere I can get the money. I am therefore asking well-wishers who can assist me to help me raise the amount needed for transport and the bills. The money can go up to US$1 500. I will be grateful if I raise the money on time so that I can save the life of my son,” he said.
Mr Khumalo relies on food handouts from the Government through the department of Social Welfare.
“We have been assisted by Social Welfare to cater for Duduzile’s medical expenses since 2009 under the Assistance Medical Treatment Order (AMTO) up to this date, but it’s unfortunate they do not cater for international expenses, hence our appeal,” he said.

ED To Commission Causeway Dam
By A Correspondent- President Emmerson Mnangagwa is today expected to commission Causeway Dam outside Marondera that is set to benefit close to 200 farmers.
The dam, which forced the relocation of 146 families, was constructed on Mucheke River and is set to benefit the Marondera University of Agricultural Science and Technology (MUAST) which is situated at Dosmerry Farm in the Masomera area.
The project was fast-tracked by former Agriculture minister Joseph Made and then Finance minister Patrick Chinamasa whose farms are close to the giant water source.
According to an invitation to stakeholders dated May 7 and signed by Mashonaland East Provincial Affairs minister Aplonia Munzverengwi, Mnangagwa is expected in Marondera East constituency today for the event.
“The Minister of State for Provincial Affairs and Devolution, Mashonaland East province, Honourable Aplonia Munzverengwi invites you to join her in witnessing the commissioning of Muchekeranwa Dam by His Excellency the President of the Republic of Zimbabwe, Cde ED Mnangagwa on 13 May 2021, in Mashonaland East Province,” the invite read.
Families whose homesteads were close to the dam were relocated into open spaces in the same area.
The relocated farmers are now part of the Machiki Irrigation Scheme. Government availed $2,7 millian as compensation to be shared among displaced farmers.
The dam project was funded by government to the tune of US$5 million. It has a storage capacity of 75 000m3.
Causeway Dam is at the boundary of Mashonaland East’s Marondera district and Manicaland’s Makoni district.
The areas that will benefit from the dam are Svosve in Mashonaland East province and Chiduku in Manicaland province.

Cocaine Swallowing Woman Further Detained
By A Correspondent- Police intends to further detain a woman who was found with 975 grammes of cocaine in her stomach at the Robert Gabriel Mugabe International Airport so that they recover the swallowed drug.
The suspect, Sheila Khumalo, appeared before magistrate Dennis Mangosi yesterday.
Khumalo flew into the country from Brazil aboard Ethiopian Airways on Monday and was intercepted by a team of detectives from the CID Drugs and Narcotics Harare, Central Intelligence Organisation operatives and personnel from Zimbabwe Revenue Authority who were acting on a tip-off.
A search of her language led to the discovery of cocaine stashed inside a pair of black socks inside her undergarments weighing 975 grammes worth $7 800 000.
The investigating officer told the court that they had information that Khumalo had ingested 60 sachets with the substance, but had so far has discharged 58 of them.
He argued that Khumalo was a foreign national whose identification particulars were yet to be ascertained.
Khumalo was likely linked to a drug syndicate whose members were still at large, he added. She is expected back in court tomorrow.

Zim Man Jailed 5yrs Over Passports, Permits, Drivers’ Licences Fraud
By A Correspondent- A 30 year old Zimbabwean national has been sentenced to five years in prison in South Africa for issuing and selling Zimbabwean and South African drivers’ licenses as well as asylum seeker temporary permits and passports.
Peter Makuvire appeared at the Mothibistad Magistrate’s Court near Kuruman, in the Northern Cape where he was convicted of fraud and contravening the Immigration Act.
Makuvire was arrested in 2029. He reportedly charged between R1 000 and R 2500 for the fake documents.
Provincial Hawks spokesperson, Nomthandazo Mnisi, said Mapuvire will serve an effective five years direct imprisonment.
Said Mnisi:
Mapuvire was sentenced to eight years’ imprisonment of which three years is suspended for the period of five years, he will serve an effective five years direct imprisonment without an option of a fine.

Mugabe Family Breathe Fire Over Grace’s Summons

By A Correspondent- The late former President Robert Mugabe’s family says it will not entertain calls to rebury the country’s former strongman.
This comes after a Zvimba traditional leader summoned former First Lady Grace Mugabe to appear before his traditional court on a charge of “improper” burial.
But the Mugabe family spokesperson and nephew to the late feared former ruler, Leo Mugabe, said it was improper to summon Grace since the burial of his uncle was a done and dusted issue.
He said:
No one will force us to change even if they come up with many court cases. They can go to hell.
Our position as a family is that we will not entertain this issue. We buried Mugabe and that’s all.
This person who is complaining is not part of the family and we don’t know why he is doing that.
We don’t know why the chief is summoning Grace on his charge sheet. Grace is not a Mugabe, she is an in-law in the family and the decision to bury him was a Mugabe family decision.
Leo vowed that no one would attend the court session and even if the complaint wins the case, no one has the power to force the family to exhume Mugabe for reburial.
He said:
In any case, what will happen even if the complainant wins the case? It is an exercise in futility because as far as we are concerned, we are done and nobody can force us and we cannot say he was buried in a house when we all know he was buried in a courtyard.
Had we gone to the National Heroes Acre he was going to be buried in a proper room they call a mausoleum and was the chief going to summon President (Emmerson) Mnangagwa over that?
Chief Zvimba summoned Grace to appear before his court later this month after a ZANU PF official identified as Tinos Manongovere approached the court demanding that she be tried for the “irregular” burial of Mugabe.
Chief Zvimba warned that a ruling will be made even if Grace snubs the summons.
Mugabe, who was deposed by the military in a coup in November 2017, died in September 2019 at a hospital in Singapore. He died a bitter man, according to his nephew Walter Chidhakwa.

Zim Gold Smuggler Exposes Mnangagwa
By A Correspondent- The Recent arrest by the South African Authorities of a Zimbabwean gold smuggler, Tashinga Nyasha Masinire, at OR Tambo International Airport, Johannesburg, with 23 prices of gold worth R11m (US$783 000) after managing to pass through the security checkpoints in Zimbabwe has exposed President Emmerson Mnangagwa’s administration.
The development has confirmed that Mnangagwa’s top allays are involved in the smuggling of precious minerals from Zimbabwe through the country’s borders.
Masinire appeared in court early this week and was granted R100 000 bail by Kempton Park Regional Court in Joburg.
He was remanded out to 1 July 2021, with stringent bail conditions, ordered not to leave SA until the case is concluded and reporting to police 3 times a week.

By A Correspondent- Home Affairs Minister, Kazembe Kazembe has embarrassingly responded to the case in which Zimbabwean gold smuggler, Tashinga Nyasha Masinire, who by South African police at OR Tambo International Airport, Johannesburg, for possessing 23 prices of gold worth R11m (US$783 000) after managing to pass through the security checkpoints in Zimbabwe.
Kazembe told the state media that the local police were investigating the cases to establish how Masinire managed to smuggle the gold to South Africa.
Masinire appeared in court early this week and was granted R100 000 bail by Kempton Park Regional Court in Joburg.
He was remanded out to 1 July 2021, with stringent bail conditions, ordered not to leave SA until the case is concluded and reporting to police 3 times a week.
Hamba Uye eKhaya Luke Malaba
By Mari Matutu | am watching the events of the court case filed by Mr Musa Kika with interest. Two days ago Luke Malaba and his fellow judges indicated that they are opposing the application.

The general background is Mr Kika wants Malaba to retire on the 15th May when he turns 70. He cites s328(7)
as the bedrock of his case.
Of interest I have seen the lawyers that represent the 16 Judges also requesting that the Judicial Service
Commission(JSC) be joined in the case as respondent.
The matter is set for case management meeting today at 9.30 Harare High Court. Whether the Judicial Service Commission will be allowed or not as a party to the case is another issue. My
concern is to hear what the Judicial Service Commission wants to say on Mr Musa Kika’s application.
Few things remain clear from Mr Kika’s application:
i) That Judges must not receive a favours from Executive.
ii) That Judges must be independent from any form of influence or be forced to do something.
iii) That Judges have a fiduciary duty to exercise judicial authority on behalf of Zimbabweans.
These are clear cut arguments of Mr Kika. Now one asks “is the Judicial Services Commission an institute of the state”? The answer is yes it is an institution formed in terms of section 189 of Constitution.
Now section 164.
164 Independence of the judiciary
(1) The courts are independent and are subject only to this Constitution and the law, which they must apply impartially, expeditiously and without fear, favour or prejudice.
(2) The independence, impartiality and effectiveness of the courts are central to the rule of law and democratic governance, and therefore—
(a) neither the State nor any institution or agency of the government at any level, and no other person, may interfere with the functioning of the courts;
It is clear that the Courts are only subject to the constitution and the law.
It is clear that no institute may interfere with the functioning of the courts. Is the Judicial Service
Commission an institute? Yes. Does the law exempt the Judicial service Commission and allow only the Judicial Service Commission to interfere with Courts? No. It is clear no institution must interfere with the independence of Courts.
The mere fact that the same lawyers of the 16 Judges are applying on behalf of the JSC, poses questions on the independence of Judges.
Take it any how. Use the 16 Judges as the “courts,” be it Constitutional Court or Supreme Court.
These Judges do not need assistance of JSC to tell them if having your term extended by executive is a favour or not. That is an independent view of a Court Judge and not a
Commission.
Maybe let’s, look at the functions of the Judicial Service Commission and try to understand their
interests.
190 Functions of Judicial Service:
(1) The Judicial Service Commission may tender advice to the Government on any matter relating to the judiciary or the administration of justice, and the Government must pay due regard to any such advice.
(2) The Judicial Service Commission must promote and facilitate the independence and accountability of the judiciary and the efficient, effective and transparent administration of justice in Zimbabwe, and has all the powers needed for this purpose.
(3) The Judicial Service Commission, with the approval of the Minister responsible for justice, may make regulations for any purpose set out in this section.
(4) An Act of Parliament may confer on the Judicial Service Commission functions in connection with the employment, discipline and conditions of service of persons employed in the Constitutional Court, the Supreme Court, the High Court, the Labour Court, the Administrative Court and other courts.
We can see from the first function that the Judiciary Service Commission tenders advice to the
government and in this case the Minister of Justice who is the main client of Judiciary Service is the
first Respondent. One would think all what the minister was doing was coming from the advise of Judiciary Service Commission. Can we then have the advisor come as separate being to defend his advice? Advise is not law. Some advises end up where we are. Ultimately the Minister has to stand
responsible for the actions. In any case it was going to be different if JSC was standing with Mr Kika
and saying Minister refused its advise. In this case its advise is fully represented. It does not need JSC to come again and state the same thing it advised Minister of Justice
Function two . The Judiciary Service Commission must promote and facilitate Judicial independence. One now wonders, who is Judiciary here between Luke Malaba and 15 other Judges
or the Judges of High Court that must hear this matter and decide over it?
Who needs independence? Which side must the Judicial Service Commission be standing with and promoting?
Is Judicial Service Commission for individual Judges standing as respondents or for Judges presiding
over the matter. Which hand of independence must hold Malaba to the stand and which hand of
impartiality must hold the Judge presiding over the case to the bench? At the end what advice does
the Commission give to the Minister?
And whose interest is Judiciary Service Commission coming to serve?
The personal interest of Judges who must not receive a favour but retire upon attaining 70 or the
minister who they advised to sprint the amendment of constitution in order to cover up its own infidelity or the Judge of High Court who must seat and hear the case and subject him or herself only to the constitution and the law without looking at the status of people involved? Choose
Any normal person must see that the Function of Judicial Service Commission is there to protect the
High Court Judge who shall sit and rule over the matter. This is an every day function of the Commission in every court case. At no time the Commission can stand in support of individual independency before a Court it is managing. Unless the Judicial Service Commission is the
respondent.
Third function is making regulations. That is legislative function. We are not dealing with any of its
regulation. I see no interests based on that.
Fourth function. Lets say it is the employer of Judges. They employ Judges man and woman of ages.
They do not confer a judge with years of life. The constitution says the incumbents cannot benefit from any changes to time limit. What is it that an employer want to come and say on behalf of its employee? Whose interest will this explanation be benefitting? The Judicial Service Commission is
for the benefit of us citizens and not Luke Malaba.
I am still yet to hear their side but again it shows there is lack of separation of powers. A Court is not
a Commission. If Malaba is a Judge of Constitutional Court it does not follow the Judicial Service
Commission is a Court. If Malaba is a Chief Justice it does not mean he can bring every institution he leads into a Court. The matter before Court is, he was born 15 May 1952 and therefore on 15 May 2021 he will be 70 years. By s186(1) of 2013 constitution he must retire, should there be an amendment seeking to change s186(1) the person in office by date of amendment does not benefit
from the amendment in terms of section 328(7). Is receiving a year after attaining 70 a loss or benefit to Malaba? It is benefit. He cannot receive it in terms of section 165(5). Chidyausiku did not
benefit on it.

Bindura Man Pleads Guilty Of Raping, Several Minor Girls
By A Correspondent- Kwaramasa Kwaramasa, a 39-year-old man from Chiwaridzo, Bindura, who targeted minor girls aged between five and 12, luring them into secluded bushy areas before raping them, pleaded guilty to seven counts of rape.
He appeared before Bindura magistrate Mr Lungile Ncube and was remanded to yesterday for sentencing.
Prosecutor Mrs Gossy Mutambu said on May 6 at around 9 am, a nine-year-old girl was playing by the roadside with her eight-year-old friend when Kwaramasa approached them asking for directions to Garati gold panning site.
He offered a dollar for the assistance.
The nine-year-old agreed and walked the man towards Garati site while her friend returned home.
Upon reaching a grassy area, Kwaramasa ordered the minor to sit down and he sexually assaulted her.
He fled the scene and the minor walked back home and revealed the matter to her mother.
On March 5, a seven-year-old minor who was coming from school with her two friends aged three and four met Kwamarasa, who held her hand and asked to be shown the way to Ran Mine.
She instructed her friends to go home and agreed to accompany the man.
After approaching a secluded bushy area, Kwaramasa raped the girl and after the act, he escorted her towards her home.
The matter came to light on March 15 when the minor started discharging whitish substances and she revealed the sexual assault.
On April 23 at around 2pm, the complainant, a 12-year-old was coming from school with her friend when Kwaramasa started chasing them.
He caught the 12-year-old and carried her to a grassy area where he raped her and fled.
The minor proceeded home and advised her guardian who reported to the police.
Sometime in March, another eight-year-old agreed to show Kwaramasa directions to Garikai residential area.
While accompanying him there, he raped her.
In another case, sometime in April, a five-year-old and her sibling agreed to accompany Kwaramasa to Ran Mine where he ordered one of them to remain behind while he took the five-year-old to a bushy area where he raped her.

Court Further Remands Drug Dealer Who Swallowed 60 Balls Of Cocaine
By A Correspondent- A suspected foreign drug dealer who was caught with contraband of cocaine valued at $7,8 million before swallowing 60 plastic balls of the drug has been further remanded in custody to May 14 to allow her to excrete some of the balls left in her intestines.
Shila Khumalo was facing unlawful possession of dangerous drugs charges when she appeared before Harare magistrate Mr Dennis Mangosi.
The State led by Mr Lancelotte Mutsokoti applied for further detention to allow her to excrete two remaining balls.
The court heard that on May 9, information was received to the effect that Khumalo was coming to Zimbabwe from Brazil with contraband of cocaine aboard an Ethiopian Airways and was expected to arrive at the Robert Mugabe International Airport.
It is the State’s case that on May 10, acting on the information, a team of detectives, officials from the Central Intelligence Organisation and personnel from the Zimbabwe Revenue Authority intercepted Khumalo at the airport.
It is alleged that a search was conducted on her luggage and on her person, leading to the recovery of 53 small white balls with whitish powder from her undergarment.
It is alleged that Khumalo is a foreign national whose identification particulars are yet to be ascertained with the international police.
Khumalo, the court heard, is highly linked with a serious drug syndicate and most of the syndicate members are still at large.

Shock As Woman Hangs Self Hours After Mum’s Burial
A BULAWAYO family suffered double tragedy when a grief-stricken woman from Mpopoma committed suicide shortly after the burial of her mother in an incident that has left the community in shock.
Mrs Sithembiso Phiri -Sibanda who stayed with her husband in Gwanda, had travelled to Bulawayo to attend her 65-year-old mother, Mrs Rita Phiri’s funeral. Sithembiso committed suicide by hanging herself with a wrapping cloth in one of the rooms a few hours after burying her mother who reportedly died in her sleep on Sunday. The deceased’s visibly shocked husband, Mr Obadiah Sibanda said he was at a loss for words following the double tragedy that befell the family.
“We went to bury my mother-in-law at around 11am. I had not realised that she did not go to the cemetery. When we returned from the cemetery, we had lunch and neighbours dispersed to their homes,” he said.
Mr Sibanda said other female relatives were in the house while men were seated outside.
He said his wife took a bath after which she went into one of the rooms intending to change clothes.
“Everyone thought she was changing after taking a bath, but it seems she used that chance to kill herself. We got suspicious when she took long to come out of the room,” said Mr Sibanda.
He said efforts were made to look for her and they discovered her room was locked.
“We tried to knock on the door and there was no response. I got worried and alerted relatives and we peered through the window leading to the discovery of her body hanging from the trusses,” said Mr Sibanda.
She did not leave a suicide note.
Another family member Mr Wurayai Shiri said they were struggling to come to terms with the double tragedy.
“This is so painful and unbelievable. I cannot even join the pieces, it is tough. Maybe if she had left a note, we would be having some answers. We have never experienced something like this in our family. It is a hard time for sure,” said Mr Shiri.
A sister to the deceased, Ms Regina Phiri could only say: “I am just heartbroken about my sister.”
A neighbour who identified himself only as Mr Ndlovu said they were shocked to hear cries coming from the house a few hours after they left.
“It was shocking as everyone could identify the crying as that of a person mourning the death of someone. We rushed to the house where we discovered what had happened,” he said.
Consumer Council of Zimbabwe manager for Matabeleland Mr Comfort Muchekeza who is a neighbour and was at the house said:
“It is shocking in the sense that we buried the mother in the morning and then she commits suicide.
“Possibly that is when you will understand that those who commit suicide it is not out of their liking. I think there is an element of mental stress somewhere where people fail to accept reality.”
He said it was paramount for communities to use channels like the church to be taught about the realities of life so that people accept what befalls them.
Mr Muchekeza said death was not a way of evading whatever problem they face but should rather share with others so that they are assisted to overcome their challenges.- Chronicle

Boy (16) Kills Man Over Cigarette Stub
A 26-YEAR-OLD Kwekwe man succumbed to injuries he sustained fighting a 16-year-old boy over a cigarette stub.
Rueben Mukwaturi died following a fight with the teenager over a cigarette which the latter had thrown onto the ground.
Midlands provincial police spokesperson Inspector Emmanuel Mahoko confirmed the incident which occurred in Mbizo suburb in Kwekwe on Sunday around 4PM.
“Rueben Mukwaturi, the now deceased, met the suspect who was smoking a cigarette. The suspect dropped the stub of the cigarette on the ground. A misunderstanding ensued between the two after Mukwaturi ordered the suspect to pick up his cigarette stub from the ground,” said Insp Mahoko.
He said Mukwaturi then snatched a packet of snacks from the suspect.
“The suspect struck Mukwaturi with stones and ran away. Mukwaturi pursued the suspect and another fight ensued leading to Mukwaturi being overpowered by the suspect. Mukwaturi subsequently proceeded home where his condition deteriorated. He was escorted to the police where he reported the matter. He was referred to Kwekwe General Hospital where he died upon admission,” said Insp Mahoko.
The matter, he said, was reported to police who attended the scene and the body of the deceased was taken to Kwekwe District Hospital for post mortem.
“The suspect was arrested and awaits the due justice process,” said Insp Mahoko.
He appealed to members of the public to shun violence in all its forms.
“May society at household level, our community leaders –village heads, chiefs and church leaders help in spreading the message against violence. There is a serious concern over the rate at which lives are being lost through the crime of murder. Most of the murder cases are happening after minor differences which it is felt can be solved easily through dialogue,” said Insp Mahoko.- Chronicle

Abuse Of Dangerous Mutoriro Drug Increases
Over 30 percent of the young population is reportedly abusing the crystal methamphetamine, commonly referred to as mutoriro, gukafella, ice or glass in street lingo, a court heard yesterday.
Dr Clancy Taiwa Nyamakure, a medical practitioner and forensic tests expert, who is also serving as Assistant Commissioner in the Zimbabwe Republic Police, told Chief Magistrate Munamato Mutevedzi that although a study on prevalence on use of crystal methamphetamine was yet to be conducted countrywide, he believes 30 percent of youths are partaking the dangerous drug.
Asst Comm Nyamukure said this while testifying when the State led by Mr Michael Reza was making aggravating submissions in a case where Matthew Hopkins (29), had admitted to possessing the dangerous drug.
In admitting possession of crystal meth, which he claimed to have bought in Mbare’s Joburg Lines, Hopkins said he wanted to consume the drug out of curiosity.
He claimed that he only bought it after seeing others using it.
Chief Magistrate Mr Mutevedzi is expected to sentence him today.
Asst Comm Nyamukure said there has not been a study to quantify the prevalence of use of the drug, but from stories written and number of reported incidents, “30 percent of the (youth) population are using crystal methamphetamine”.
“The increase of admissions at mental health institutions and outcry from social media also pointed to the number of people using the crystal methamphetamine,” he said.
Asst Comm Nyamukure said the drug was being smuggled from India, Brazil and other Asian countries.
He said the drug is made in a laboratory using pseudoephedrine which is a parent drug that is combined with others.
“It is classified as amphetamine which contains a chemical structure that looks like amphetamine.
“Medically, it is used as metamorphic in the treatment of obesity or hyper-disorder. It is toxic to the brain.”- The Herald

ZRP Appears Not Interested In Asking SA To Extradite Gold Smuggler
The Zimbabwe Republic Police has appeared disinterested in getting a gold smuggling suspect extradited from South Africa.
Mr Tashinga Nyasha Masinire (33), was caught at Oliver Tambo Airport with 23 pieces of gold after landing from Zimbabwe.
Instead of boldly reporting the crime, the Herald newspaper stated that “the gold might have been smuggled through the country’s biggest airport,” just as the Zimbabwe Republic Police in a statement indicated that they are not interested in pursuing an extradition order.
Previously, the police has passed extradition requests for politicians the likes of the exiled Saviour Kasukuwere, and Jonathan Moyo.
The ZRP claimed they promise they will leave no stone unturned in establishing how Masinire sneaked out of the Robert Gabriel Mugabe International Airport undetected, only to be arrested in South Africa.
Even Home Affairs and Cultural Heritage Minister Kazembe Kazembe was mute on the possibility of an extradition request.
Kazembe claimed heads will roll at the RGM International Airport where it’s suspected a syndicate could have aided the smuggler’s exit.
“We are going to leave no stone unturned in finding out what happened. We want to know how this man left the country with all that gold. So far we have established that when he walked in at the RGM International Airport (on Sunday) he didn’t have a bag, now we want to establish who gave him that bag, where, and how. Investigations are ongoing, as I said, I am confident we will unearth what transpired on the day as soon as possible, working with our Interpol colleagues,” he said.
Since the smuggler was nailed in South Africa, Minister Kazembe said Zimbabwe is closely working with Interpol to get to the bottom of the matter.
“Investigations are ongoing; our police are in contact with Interpol because the person in question was caught in South Africa. However, here investigations are also being done thoroughly. We will get to the bottom of all this,” he said.
The Civil Aviation is in charge of security at the RGM International Airport, with the police at standby at a police post in the precincts of the airport for back-up.
There are also concerns that gold smugglers might have upped their game following the arrest, seven months ago, of Zimbabwe Miners Federation president Henrietta Rushwaya who was nabbed at the same port with 6kgs of gold worth US$366 destined for Dubai, after canners blipped.
Her case is still pending at the courts. In the latest case, insiders at the airport said someone could have aided Masinire by helping him by-pass the scanners. His luck later ran out at the Oliver Tambo International Airport where the customs section of the South African Revenue Service (SARS) busted him leading to his arrest.
He had not declared the goods and did not have a permit to transport the gold. South Africa’s anti-organised crime unit, the Hawks was alerted and he was arrested. He is facing charges of contravening the Customs Act 91 of 1964 and Precious Metals Act 37 of 2005.
Masinire has since appeared in the Kempton Park regional court in Gauteng province and granted R100 000 bail and ordered not to leave the country until the matter has been finalised.

Mdc Alliance Namibia concurs with the former Leader of the Democratic Alliance (DA) who was once the Leader of Opposition in South Africa, Mmusi Maimane when he propagated that the Southern African Development Community (SADC) region is faced with crises in Mozambique and Zimbabwe which regional countries should tackle as a matter of urgency.
He further asserted that an unfolding dictatorship can be averted by granting Zimbabweans scattered in the diaspora the right to vote to ensure free, fair and credible elections that are not contested in the captured Courts.
Maimane who is the Convenor of the One South Africa Movement (OSA), said if South Africa fails to push Harare for the much needed diaspora vote, it would be subsidising Mr Mnangagwa’s brutal and corrupt dictatorship. As a district , we are clear on our demand of the diaspora vote as a non-negotiable right. We think that SA and other SADC countries should encourage Zanupf to democratically govern their people. In Namibia diaspora vote was granted back in 2014 and Zambia was clear that in the next elections they will consider it.
It has to be clear to Mr Mnangagwa that Mdc Alliance Namibia will soldier on mobilising and recruiting social democrats to continue demanding the diaspora vote.
Moreover, Leader Maimane said, “in order to effectively #ResistDictatorship Zimbabwe must allow for #DiasporaVoting and cede voting abroad rights to all its citizens. We do that here in South Africa”. All SADC states must support this! That is how we will have a free and fair election in Zimbabwe. If we ignore threats to the fundamental voters’ rights in Zimbabwe, it will become our cancerous local malady to perpetuate authoritarianism. As part of our #ReformAgenda, diaspora vote remains our priority not forgetting other comprehensive political and electoral reforms needed before 2023 harmonised elections. It now imperative for these foreign matters to be confronted more forcefully and proactively.

Caught In The Act: Kidnapping Suspect Arrested In Mutare
Police in Mutare have announced they are investigating a case of kidnapping, where a woman approximately 30 years old, snatched a minor (2) today in Dangamvura.
The suspect, who was clad in apostolic white garments, was noticed by an alert neighbour whilst walking away with the baby before she was attacked by members of the public.
Meanwhile, the ZRP warns members of the public against meting instant justice, the police said in a brief statement.
Residents teamed up in the morning to assault the woman who they suspected of kidnapping a two-year-old boy and hiding the toddler in her church garments.
The suspect only identified as Melody, is believed to be a resident of Area 13 in the same suburb.
The baby’s mother, Ms Shylet Mudengerezwa (20), said she shouted for help and residents gave chase in maize fields in the Nyamauru section of Dangamvura, after she saw Melody with her baby.
The suspect was subsequently arrested and the baby taken into the custody of the mother. She was detained at Dangamvura Police Station.

Legumes in their many forms should definitely be on your radar if you’re trying to cut down on your meat intake.
Beans and lentils are staples in plant-based diets thanks to their nutritional profile. “[Legumes] can make a superb high-protein substitute for meat in almost every dish,” says Shannon Henry, RDN, a registered dietitian with EZCareClinic in San Francisco. “Their refined and cooked texture means that they can fit perfectly into balls and patties. You can also use them in soups, casseroles, burgers, chili, and tacos.”
What Are Legumes?
Legumes belong to the Fabaceae or Leguminosae family. According to Harvard T.H. Chan School of Public Health, the terms “legumes,” “pulses,” and “beans” are sometimes used interchangeably, but legumes technically refer to the entire plant (including the leaves, stems, and pods) while a pulse is the edible seed (such as beans, peas, or lentils).

Promote a Healthy Heart

May Lower the Risk of Type 2 Diabetes
Legumes may also aid in preventing and managing serious health conditions, including type 2 diabetes and related conditions such as hypertension and high cholesterol, according to past research.
A study published in March 2017 in Clinical Nutrition found that regular consumption of legumes — especially lentils — as part of a Mediterranean diet led to a 35 percent lower risk of diabetes among older adults with a high cardiovascular risk. Those researchers found that substituting legumes for half a serving a day of eggs, bread, rice, and baked potato also helped lower type 2 diabetes risk.
Offer a Plant-Based Protein
Legumes are a great meat-free protein source and can take the place of meat in many recipes, Henry says. Following a predominantly plant-based diet — such as a vegetarian diet, a vegan diet, or a flexitarian diet — over a meat-heavy one may help lower your risk of heart disease, stroke, obesity, high blood pressure, high cholesterol, diabetes, and many cancers, according to the AHA. Plant-based diets were also associated with a lower risk of cardiovascular morbidity and mortality in a study published in the Journal of the American Heart Association in August 2019.

Bosso Unveil New Partner
HIGHLANDERS have entered into a business partnership with Sanctuary Insurance.
Club spokesperson, Ronald Moyo, said the deal will see them become the official agents of the insurance company.
‘‘The partnership, which we launched at the weekend, confirmed that Highlanders is, from now, on the official agent list of Sanctuary Insurance,’’ said Moyo.
“The club will be selling insurance (packages) to the world, on behalf of Sanctuary Insurance and, in return, we will get a certain percentage of money from the sales.
“We are happy with this partnership and we expect it to grow.’’
Sanctuary Insurance official, Kudzai Muza, confirmed the development.
A number of the PSL clubs have been going into bed with sponsors, in recent weeks, to boost their revenue streams, to help them battle the cost of running their entities.
Ngezi Platinum Stars and CAPS United have, in the past two weeks, secured deals with some sponsors.
The Covid-19 pandemic has hit the local Premiership clubs in a hard way.
Bosso principal sponsors, NetOne, last year pulled out of the deal, with the company saying they were now diverting the resources to help the country fight the pandemic.
Highlanders, though, have kept on wearing the NetOne logo on their shirts.

Gamblers Brutally Attack, Kill Colleague With Bricks
By A correspondent-Three mine workers allegedly beat up their colleague to death during a gambling dispute.
Matabeleland South acting provincial police spokesperson, Assistant Inspector Thabani Mkhwananzi confirmed the incident which occurred at Vulture Mine in Collen Bawn.
He said the trio reportedly assaulted Precious Siziba (23) from Filabusi on Sunday at around 4 PM and he died the following day at around 6 AM while admitted to the Gwanda Provincial Hospital.
“I can confirm that we recorded a murder case which occurred at Eagle Vulture Mine in Collen Bawn area. Four miners were gambling at the mine when three of them had a misunderstanding with the now-deceased Precious Siziba overpayment of the money.
“The trio started assaulting Siziba who then fled from the scene. One of them threw a brick at Siziba and it hit him on the head and he fell to the ground. They caught up with Siziba and sprayed pepper spray in his eyes and hit him on the head using unknown weapons until he lost consciousness,” he said.
Ass Insp Mkhwananzi said other miners who were in the area heard cries from Siziba as he was calling out for help during the attack and they rushed to help him. He said the trio fled from the scene and left Siziba lying on the ground.
Ass Insp Mkhwananzi said Siziba was rushed to Gwanda Provincial Hospital where he was admitted but died the following morning.
He said the matter was reported to the police who conducted investigations leading to the arrest of one suspect Marshal Sibanda who is assisting police with investigations.
Ass Insp Mkhwananzi appealed to members of the public with information on the whereabouts of the other two suspects Johnson Moyo and Shepherd Moyo to contact the police.
“We would like to urge members of the public to desist from engaging in violence when faced with disputes. People should also desist from engaging in gambling activities as they are illegal and they have become the cause of several deaths and violent crimes,” he said.

She is appealing to members of the public to assist her so that her son can receive treatment as she can not afford the medical bill.
Rodwell Ngomazana who was under the custody of his grandmother, Martha Sasikayi, 62, at an all-night prayer meeting organized by Zviratidzo Zvevapositori Church was mauled on his face by a hyena at Benzi village under kraal head Pedzayi.
Narrating what happened on that fateful night, Gogo Sasikayi told a local tabloid that Rodwell was rescued from further attack by church members.
Gogo Sasikayi said during the all-night church service, Rodwell came to her asking for blankets to cover himself since he wanted to sleep.
She said she gave him the blanket and he went to sleep where the other kids were sleeping.
Shortly after that, she said she heard Rodwell scream in pain and saw a hyena biting his face.
Alert church members quickly rushed towards Rodwell to save him and the hyena fled.
She added that she thanks God that he survived the attack.
After the hyena attack, Rodwell was rushed to a clinic in a critical condition and was later transferred to Masvingo General Hospital then to Parirenyatwa Group of Hospitals where he is receiving treatment.

Police Blames Mental Illness For High Murder Cases

In a statement, national police spokesperson Assistant Commissioner Paul Nyathi said some of the cases are being committed by mentally challenged people who are not on medication.
He urged members of the public to make sure that mental patients receive medication.
“The Zimbabwe Republic Police urges members of the public to ensure that mentally challenged persons are assisted in getting medical attention regularly,” said Asst Comm Nyathi.

On 7 May 2021, at Gasva Village Gutu, a suspected mentally challenged man (40) attacked his father (82) with a wooden hoe handle before turning it on to the mother (76). The father died on the spot and the mother became unconscious for some time before gaining consciousness and she reported the matter to the police. The weapon used in the crime was recovered and the suspect was arrested,’’ said Asst Comm Nyathi.
In another suspected murder case, the police spokesperson said a Harare man (41) was found drunk and unconscious in an abandoned car at Kuwadzana 4 Shopping Centre with no visible injuries.
“The victim was taken home by relatives and was medically examined after his condition deteriorated. The medical report indicated that the victim had head injuries and he eventually died on 9 May,” said the police spokesperson.

Gweru Police Criminalises Carrying Of Knive, knobkerries
By A Correspondent- Police have banned for three months, members of the public around Gweru rural communities from carrying machetes and other dangerous weapons in a bid to reduce increased murder cases that have been occurring in the area.
Midlands provincial police spokesperson, Inspector Emmanuel Mahoko said Gweru Rural District Chief Superintendent Enthia Muzvidziwa has issued the ban under section 4 of the Maintenance of Peace and Order Act.
“This prohibition order has been issued in terms of Section 4 of the Maintenance of Peace and Order Act Chapter 11:23 which says any person failing to comply with such a prohibition shall be guilty of an offence and liable to a fine not exceeding level 5 or imprisonment for a period not exceeding six months or to both such a fine and imprisonment,” said Insp Mahoko.
He said the ban will be effective for three months from Tuesday next week to 16 August.

Givemore Panganayi, a Harare businessman disappeared during a party at RainBow Towers which he attended with Sulumani Chimbetu was found dead in a non-functioning elevator at the hotel.
According to his friends, Panganayi stood up during the night to answer a call on his mobile phone, but he never returned.
A police source said the decomposing remains of Panganayi were discovered by a hotel employee on Tuesday afternoon in a non-functioning lift.
The body was recovered to Parirenyatwa Hospital by police officers later in the evening for a post-mortem.

Hugo took over the reins this month after he was named as the replacement of Molefi Ntseki who was sacked after failing to book a place at the Afcon 2021.
Speaking to reporters for the first after his appointment, Broos said he wants to drop a couple of old horses and rebuild the team around young players similar to what he did with Cameroon in 2017.
The Belgian won the Afcon with a youthful Indomitable Lions team.
“With the information I have received and analysis I made in the last few weeks, I think it’s the moment to build a new team in South Africa‚” the 69-year coach said.
“I was a little bit surprised when I saw in the selections of the last games that there were a number of players who were 30 or more.
“So, I think we have to rebuild the team. Why a younger team? If you take the example of Cameroon … I did the same there.
“When you work with young players, they are motivated and hungry to show something.”
Broos’ first competitive fixture will be against Zimbabwe in the World Cup qualifiers.

Healthy food sometimes seems prohibitively expensive, but it doesn’t need to be. Case in point: legumes, the family of foods that encompasses beans, peas, and lentils, according to the Mayo Clinic.
While legumes are a nutritional powerhouse, that’s not all they have going for them — they’re also inexpensive, easy to find in stores, and versatile enough to work in a wide variety of dishes.
“They provide nourishment in a form that is inexpensive, highly storable, and delicious,” says Laura Poe, RDN, who is in private practice in Viroqua, Wisconsin. “They’re an affordable way to ‘stretch’ a meal, adding nutrition and bulk for very little cost.”
Legumes in their many forms should definitely be on your radar if you’re trying to cut down on your meat intake.
Beans and lentils are staples in plant-based diets thanks to their nutritional profile. “[Legumes] can make a superb high-protein substitute for meat in almost every dish,” says Shannon Henry, RDN, a registered dietitian with EZCareClinic in San Francisco. “Their refined and cooked texture means that they can fit perfectly into balls and patties. You can also use them in soups, casseroles, burgers, chili, and tacos.”
What Are Legumes?
Legumes belong to the Fabaceae or Leguminosae family. According to Harvard T.H. Chan School of Public Health, the terms “legumes,” “pulses,” and “beans” are sometimes used interchangeably, but legumes technically refer to the entire plant (including the leaves, stems, and pods) while a pulse is the edible seed (such as beans, peas, or lentils).

Deliver Antioxidants

According to the National Center for Complementary and Integrative Health, antioxidants can prevent or delay cellular damage, and people who eat an antioxidant-rich diet have a lower risk of several diseases — including cardiovascular disease, stroke, and cancer.
Promote a Healthy Heart

May Lower the Risk of Type 2 Diabetes
Legumes may also aid in preventing and managing serious health conditions, including type 2 diabetes and related conditions such as hypertension and high cholesterol, according to past research.
A study published in March 2017 in Clinical Nutrition found that regular consumption of legumes — especially lentils — as part of a Mediterranean diet led to a 35 percent lower risk of diabetes among older adults with a high cardiovascular risk. Those researchers found that substituting legumes for half a serving a day of eggs, bread, rice, and baked potato also helped lower type 2 diabetes risk.
Offer a Plant-Based Protein
Legumes are a great meat-free protein source and can take the place of meat in many recipes, Henry says. Following a predominantly plant-based diet — such as a vegetarian diet, a vegan diet, or a flexitarian diet — over a meat-heavy one may help lower your risk of heart disease, stroke, obesity, high blood pressure, high cholesterol, diabetes, and many cancers, according to the AHA. Plant-based diets were also associated with a lower risk of cardiovascular morbidity and mortality in a study published in the Journal of the American Heart Association in August 2019.

Man Hangs Self After Being Denied S*x By Wife
A 21-year-old Gweru man committed suicide by hanging after he was reportedly denied conjugal rights by his 18-year-old wife on Tuesday last week.
Councillor Adam Shava said the now-deceased man, Dumisani Matonsi of Plot 12 Rodell Farm, Somabula had a misunderstanding over conjugal rights with his newly-married wife.
In protest, he then walked out of the bedroom.
It was reported that after about an hour of the husband walking out of the bedroom, the wife, Sarah Mazambatate woke up to check out on him only to find him hanging on a Msasa tree branch within the yard.
The matter was then reported to Gweru Rural Police Station under sudden death report RBR number 4703082 – State media

Mdc Alliance Namibia concurs with the former Leader of the Democratic Alliance (DA) who was once the Leader of Opposition in South Africa, Mmusi Maimane when he propagated that the Southern African Development Community (SADC) region is faced with crises in Mozambique and Zimbabwe which regional countries should tackle as a matter of urgency.
He further asserted that an unfolding dictatorship can be averted by granting Zimbabweans scattered in the diaspora the right to vote to ensure free, fair and credible elections that are not contested in the captured Courts.
Maimane who is the Convenor of the One South Africa Movement (OSA), said if South Africa fails to push Harare for the much needed diaspora vote, it would be subsidising Mr Mnangagwa’s brutal and corrupt dictatorship. As a district , we are clear on our demand of the diaspora vote as a non-negotiable right. We think that SA and other SADC countries should encourage Zanupf to democratically govern their people. In Namibia diaspora vote was granted back in 2014 and Zambia was clear that in the next elections they will consider it.
It has to be clear to Mr Mnangagwa that Mdc Alliance Namibia will soldier on mobilising and recruiting social democrats to continue demanding the diaspora vote.

JUST IN: Malaba Term of Office Extended By 5 Years
President Mnangagwa has extended Chief Justice Luke Malaba’s term of office by an additional five years after his medical report proved that he is still mentally and physically fit to continue in the esteemed judicial office.
Chief Secretary to the President and Cabinet Dr Misheck Sibanda has written to Chief Justice Malaba advising him that President Mnangagwa has accepted his election to continue in the office of Chief Justice beyond 70 years for an additional five years.
Judicial Service Commission secretary Mr Walter Chikwana confirmed the latest development.
Chief Justice Malaba became head of the judiciary following his appointment as the country’s Chief Justice on March 27 2017, having been Acting Chief Justice since March 1 2016 following the retirement of the late Chief Justice Godfrey Chidyausiku.

“No State Can Define Patriotism”
By A Correspondent- Zimbabwe is planning to introduce a law to punish people who are deemed “unpatriotic” because they criticise the country when abroad – and it has left activists feeling nervous.
Constitutional lawyer and opposition politician Lovemore Madhuku calls the proposal “dangerous”, saying that “no state can define patriotism”.
People seen as unpatriotic for allegedly undermining the national interest abroad could face criminal charges if the measures being considered are passed.
The move is part of a plan to improve the government’s international reputation but campaigners and opposition parties argue it is another “vehicle for oppression”, in the words of Dr Madhuku.
“Activists travel – we are the voice of the voiceless and speak the truth,” says campaigner Rita Nyampinga, who spent years in the trade union movement.
But those who back the proposed Patriotic Bill, as it has been called, say that it is about national cohesion.
“The government has always tried to persuade its citizens to behave in a patriotic way to maintain unity,” Chief Whip for the governing Zanu-PF party Pupurai Togarepi told the BBC.
“But after the coming in of opposition parties [in 1999] many agendas came to the fore and it led to a situation where you are at war as a country.
“It is difficult to manage behaviour and you cannot arbitrarily arrest people without a law to back that.”
The MP, who seconded a motion in parliament in March calling for the law, said the measures should also apply to the media and NGOs.
Pariah status
The reputations of both Zanu-PF and the government have been damaged over the past two decades.
Controversial policies, such as the seizure of white-owned farms, economic mismanagement and alleged human rights abuses, including the killing of opposition activists, have led to its pariah status among Western nations.
The US and EU imposed economic and travel sanctions on party officials, military figures and companies over the alleged abuses and also election irregularities.
The government, however, believes the sanctions were a result of pressure from opposition activists and civil society groups.
For years the government has accused the main opposition party, the Movement for Democratic Change, of getting too close to Western diplomats. It says that its representations to US congressional hearings as well as other foreign meetings have tarnished the image of the country.
Those who back the measure think that a patriotism law would address this negative portrayal, which they say has discouraged foreign investment.
Outlining the proposals, government official Virginia Mabhiza told the state-owned Sunday Mail newspaper that “conniving with hostile foreign governments and nationals to inflict harm on the country and its citizens will be criminalised”.
“In the event of a conviction, stiff penalties will be imposed,” the Justice, Legal and Parliamentary Affairs permanent secretary added.
This has had a chilling impact on people like Ms Nyampinga, the 63-year-old veteran campaigner.
She has been arrested a number of times over the past 40 years and was left traumatised by her last detention in May 2019.
Talking to the BBC about the debate in parliament over the plans for a Patriotic Bill, she broke down and cried remembering her arrest, along with six others, after returning from a peace-building workshop in the Maldives.
They were charged with subverting the government and accused of undergoing insurgency and weapons training.
Though released on remand, after 15 months the charges still hang over her and she believes a new law could shrink civil liberties further, restricting freedom of expression.
“If I cross the border and people ask me why I am shopping in South Africa and I say these items are not there in Zimbabwe, am I being unpatriotic?” she asks, suggesting that people could be unfairly targeted.
“Even those who live in the diaspora, when they speak about their experiences [in Zimbabwe] it does not mean they are not being patriotic.”
Zanu-PF MP Mr Togarepi denies that the law will be used to stifle criticism, but acknowledges that people will be expected to express those views in Zimbabwe only.
“We are not saying we are not going to be criticised but we cannot allow a Zimbabwean to go and meet those who are hostile to us… You can criticise me here in Zimbabwe, just don’t go there and do it,” he says.
An increase in arrests in Zimbabwe, though, seems to contradict the view that people are free to speak out at home.
Over the last year, more than a dozen journalists, civil society activists and opposition members have been detained.
Neither have private citizens been spared, according to the Zimbabwe Lawyers for Human Rights. It says it has represented a number of people charged for criticising President Emmerson Mnangagwa using a law which criminalises “undermining the president”.
The government has said there is international precedent for the Patriotic Bill, citing the US Logan Act.
This is a rarely invoked measure enacted in 1799 aimed at preventing private citizens from conducting foreign affairs without the permission or involvement of the US government.
Several people have been accused of violating the law, including Reverend Jesse Jackson for travelling to the Kremlin in the 1980s. None of the accusations led to prosecutions.
“Look at [Julian] Assange. Why is he being arrested and taken to America? It is because he has violated their interests,” Mr Togarepi says.
It is not clear when the proposed bill will be brought before parliament, but presidential spokesman George Charamba has said that it is next on the legislative agenda.
If it is passed, lawyer Dr Madhuku says it will be challenged in court, where he feels it would be deemed unconstitutional. He wonders why the government and MPs are even considering this.
“It is unnecessary, undesirable and dangerous,” he adds.

Examination Marking Teachers Lament Payment Delays

By A Correspondent- Teachers who marked the Zimbabwe School Examinations Council (ZIMSEC)’s O’ and A’ Level examinations are at loggerheads with the council over delays in payment of marking allowances.
The November 2020 Advanced (A’) level examination results were announced over three weeks ago while a week has passed since Ordinary level results were released.
However, teachers who marked the examinations are yet to be paid their dues by the examination council, and they are not happy.
Zimbabwe Teachers Association (Zimta) Secretary-General Goodwill Taderera told ZTN that Zimsec should not engage teachers to mark examinations if they cannot pay them. He added:
We have always said Zimsec must engage teachers when they have the money to pay them. It is bad labour practice to engage somebody and not pay them.
Zimsec spokesperson Nicki Dlamini acknowledged that they owe the markers.
She added: Our ‘O’ and ‘A’ level examiners have not been paid, as we are speaking there are payments that are being processed so as to rectify the situation.
Due to the Covid-19 pandemic there were issues with the cash flow. It is prudent to note that this is the first time in many years that this delay has happened.
In March, teachers who were marking exams reportedly downed tools due to payment issues prompting ZIMSEC to issue a statement saying the monies that were deposited into the markers’ bank accounts were part payments.
Meanwhile, Zimsec has cancelled the traditional June final examinations this year for both Ordinary and Advanced Level, citing disruptions to the school calendar.

Nurses Bemoan Poor Conditions Of Service
By A Correspondent- Nurses unions have hailed their members for playing a pivotal role in the country’s health delivery system, especially during the outbreak of the COVID-19 pandemic, although authorities have not appreciated their efforts.
The Zimbabwe Urban, Rural Council of Nurses Union (ZURCNU) and the Zimbabwe Nurses Association (Zina) yesterday told NewsDay that as a result of their work, thousands of nurses got infected by the respiratory virus, while others succumbed to the deadly disease.
Their statement comes at a time when the world today celebrates International Nurses Day, while May 6 to May 12 is Nurses’Week.
They said despite their work, their welfare and conditions of service continued to deteriorate.
Zina president Enock Dongo said: “Nurses have selflessly carried out their duties in the face of a dreadful disease and that is remarkable. We want to celebrate their bravery for the hard work despite the glaring lack of recognition.”
He said chief among several challenges that they faced while caring for COVID-19 patients was lack of adequate personal protective equipment.
Dondo added: “From the clinics right up to central level, nurses are the first port of call for patients. Successful management of COVID-19 was executed by nurses and even now the ongoing vaccination is being driven by these cadres.
“However, nurses are not even considered for key positions in the (Health) ministry and will remain on the periphery.”
ZURCNU president Simbarashe Tafirenyika said nurses had intended to launch a movement today to celebrate Nurses’ Day, but their plans were shelved due to COVID-19 safety concerns.
“We are appealing to stakeholders to help in making this day a future celebration, where we will recognise the nurses who work beyond their normal working hours and go beyond in saving lives,” he said.
Tafirenyika said the day would also present an opportunity for the nurses to share testimonies to encourage and motivate each other. He, however, said it was saddening that their salaries were not commensurate with their roles and many were wallowing in poverty.
“We have cases of retired nurses who can no longer afford healthcare when they need it. Some have been denied entry in hospitals, while others eventually died without ever getting help. That is disappointing as they would have toiled for years saving lives,” he said.
The ZURCNU president called on officials to look into the issue of the welfare of nurses and the staffing challenges that they faced.
“Council nurses are also leaving in droves to take up positions abroad where they are recognised and paid well. Nurses’ plight has been an eyesore for years and the perpetual industrial actions are an indication of how terrible their situation is. Their absence was felt when they downed tools in the midst of the COVID-19 pandemic. Hospitals and clinics were left paralysed and patients suffered greatly,” Tafirenyika said.

Woman, Two Minors Drown In Lake Kariba
By A Correspondent- A woman and her two children drowned yesterday in Lake Kariba on the north eastern side of Binga after a wooden dinghy boat they were travelling in capsized.
Binga district development coordinator Farai Marinyane confirmed the accident yesterday, adding the police and members of the community were already on the ground searching for two bodies, after one of the bodies was recovered.
It is reported that the three were travelling in a wooden dinghy-boat, but their transporter survived after he managed to swim to safety.
The deceased were said to have been coming from Binga Hospital where they had gone for medical attention.
“Yes I can confirm that three people, a mother and her two children, who were coming from Binga District Hospital, drowned after the wooden dinghy boat they were travelling in capsized,” Marinyane said.
“One body has so far been recovered and two are still missing. Police and the community are on the ground searching for the two remaining bodies,” he said.
Marinyane urged the community to wear life jackets for their safety whenever they are travelling by boat.
“It’s so sad to lose life this way, hence I urge travellers to wear life jackets whenever they travel by boat.”
He also urged Kariba residents to use certified water transporters whenever they use boats as transport.
Reports said the wooden vessel that the three were travelling on developed a crack, resulting in it capsizing.
The vessel was said to have been carrying four people, including the transporter and was travelling from Binga centre to Kalulwe Fishing Camp, 10km away.
Two illegal smugglers drowned two months ago near Chirundu in Hurungwe district while trying to cross the Zambezi River.
Gold Smuggling- Interpol Roped
Police have widened investigations into the smuggling of 23 gold pieces worth US$783 000 by a Zimbabwean who was arrested in South Africa, and are waiting for a detailed report from Interpol officials based in Pretoria, which will be critical in assisting their inquiry.
This comes as Parliament has summoned Home Affairs and Cultural Heritage Minister, Kazembe Kazembe, to give a ministerial statement on the security situation at the country’s ports of entry and exit following a surge in cases of smuggling which are prejudicing the country of millions of dollars.
Minister Kazembe was directed to issue the statement by Speaker of Parliament Advocate Jacob Mudenda after a request by Dzivaresekwa legislator, Mr Edwin Mushoriwa. Advocate Mudenda A suspect, Tashinga Nyasha Masinire (33), was found in possession of 23 pieces of gold allegedly smuggled from Zimbabwe.
He was arrested at OR Tambo International Airport on Sunday by South Africa’s anti-organised crime unit, the Hawks and is facing charges of contravening the Customs Act 91 of 1964 and Precious Metals Act 37 of 2005.
Masinire has since appeared in the Kempton Park regional court in Gauteng province and granted R100 000 bail and ordered to not leave the country until the matter has been finalised. Masinire was also ordered to report at any nearest police station three times per week. The matter was remanded to the July 1.
Ordinary citizens in Zimbabwe are concerned over the circumstances under which Masinire passed through security checkpoints at the Robert Gabriel Mugabe International Airport, without declaring his luggage, only to be arrested in South Africa.
National police spokesperson Assistant Commissioner Paul Nyathi told The Herald yesterday that they were determined to get to the bottom of the matter.
Asst Comm Nyathi “It is something that we are currently seized with. We are presently waiting for a full report from Interpol offices in Pretoria. It is really a case of interest which the police are investigating.
“We want to know if he (Masinire) was alone by the time he got to the airport, was he under escort and did he declare the luggage or was the luggage with someone?” he said.
On arrival at OR Thambo International Airport, Masinire was requested to scan his luggage at the international arrivals customs section of the South African Revenue Service (SARS), and 23 pieces of gold were allegedly found in his luggage.
It was then established that he had not declared the goods and did not have a permit to transport the gold. The Hawks were then called to effect the arrest.
Masinire’s arrest comes about seven months after Zimbabwe Miners Federation president Henrietta Rushwaya was arrested at Robert Gabriel Mugabe International Airport with 6kg of gold worth US$366 destined for Dubai.
Rushwaya’s case is still before the courts.
Government has indicated its desire to fight corruption across all sectors of the economy but despite the many arrests in the recent past as the Second Republic intensifies the fight against graft, some officials at ports of entry and exit and in critical offices, continue to engage in the vice.
Several top ranking officials including ministers and permanent secretaries such as former ministers Obadiah Moyo and Prisca Mupfumira, have been arrested and appeared in court over corruption and their cases are at different stages.

Locusts Ravage Chilonga
By A Correspondent- Villagers in the Chilonga area of Chiredzi have said that their small grain crops have been ravaged by locusts, leaving very little to fall back on.
This development adds to their woes after government recently announced plans to set up an irrigation programme in the area, which might displace some of them from their ancestral land.
Chilonga ward seven Agritex officer Excervia Mbiza said the problem of locusts began in February, leaving villagers with very little food stocks.
He said the grains left would not last until the next farming season.
“The locusts mainly affected small grains, which are the main crops here in Region Five. People did not manage to harvest as much as expected,” Mbiza said. But he said people in Chilonga were taught diversified farming under the Zimbabwe Resilience Building Fund-Enhancing Community Resilience and Sustainability (ZRBF-ECRAS) project, which will leave them with something to fall back on.
“ZRBF-ECRAS programmes have taught us that when such disasters come to affect us, we will always have a plan. Now that the small grains have been destroyed, we can still have other avenues of earning money and making sure we have enough to eat,” he said.
Agritex supervisor for Chiredzi district Sibusisiwe Tshuma said the 2020-21 season, especially the months of February and March were plagued by locusts which mainly affected white sorghum.
“Under the ECRAS programme, we encourage farmers to grow small grains as our region is dry and conducive for small grains,” Tshuma said.
Chiredzi headman Fani Chinyeruse said timely intervention by donors would save the community from the damage caused by the locusts.
“ZRBF-ECRAS is empowering people in this area, and lessening the effects of climate change which are usually harsh and always leave us with nothing to fall back on. The help from ZRBFECRAS has made it easy for us to survive.”
The ZRBF-ECRAS initiative is supported by the Lands ministry and covers 34 wards and 10 500 households in Chiredzi.

Inter-ministerial Team To Deal With Congestion In Harare
By A Correspondent- Cabinet yesterday agreed to set up an inter-ministerial team to deal with congestion on the country’s roads that has become a menace especially in urban areas.
This was announced by Information minister Monica Mutsvangwa during a post-Cabinet media briefing in Harare, where she said the inter-ministerial team would be led by Local Government minister July Moyo and would look at ways of decongesting the roads.
Congestion has become a menace in the cities, mainly in Harare, where the government, through the Zimbabwe National Road Administration, has been accused of failing to develop the road network due to corruption.
“Cabinet notes that there is increased economic activity due to the decisive interventions by government on the financial sector. Additionally, the easing of the lockdown measures, the increased availability of fuel on the local market, and increased economic activity, has seen the number of cars on our roads increase and this has resulted in vehicle traffic congestion,” Mutsvangwa said.
“To that end, an inter-ministerial committee chaired by the Minister of Local Government has been directed to look into decongesting the roads and addressing the poor lighting in our cities. Road users are also reminded to be cautious on the roads and observe the laid down regulations, as some are now causing chaos.”
Mutsvangwa also warned drivers of unregistered kombis, saying that only transporters under Zupco would be allowed to operate under strict COVID-19 guidelines.
On the education sector, she said all COVID-19 positive cases reported at Prince Edward, Sacred Heart and Bonda Mission schools had fully recovered.
On teacher absenteeism, Mutsvangwa said government would continue to apply the no-work, no-pay principle.
Meanwhile, President Emmerson Mnangagwa yesterday left for Uganda to attend the inauguration of President Yoweri Museveni, who won the January 14, 2021 elections.-newsday
Attempt To Extend Chief Justice’s Tenure Challenged
The Forum’s Executive Director, Dr Musa Kika has approached the High Court on an urgent basis seeking to bar the extension of the term of office of the outgoing Chief Justice Luke Malaba, under the recently passed Constitution of Zimbabwe Amendment (No. 2) Act which was signed into law by President Mnangagwa on 7 May 2021.
Malaba turns 70 on 15 May 2021 and is due to go on retirement in terms of the provisions of the original 2013 Constitution. Kika argues that the provisions under which Malaba would benefit from, which were introduced in terms of an amendment to Section 328(7) of the Constitution, would allow the Chief Justice, his deputy, Justice Elizabeth Gwaunza as well as Constitutional Court and Supreme Court judges to have their terms of office extended by the President on production of a medical certificate confirming that such a judge would be fit enough to continue on the bench.
Section 328 requires the holding of a referendum where an amendment Bill seeks to amend a term-limiting provision. Section 328(7) also makes it clear that any amendment to a term-limit provision does not apply to any person who held or occupied that office at the time before the amendment. Kika has also cited as respondents all the Constitutional Court and Supreme Court.
Kika is seeking to have any purported extension of Malaba’s term of office after 15 May 2021 to be null and void and that anything Malaba attempts to do after 15 May 2021 be equally declared to be null and void. Pending the appointment of a substantive Chief Justice to replace Malaba, Kika seeks to have the current Deputy Chief Justice Elizabeth Gwaunza fill in the vacancy in an acting capacity while the third most senior judge, Paddington Garwe, becomes the Acting Deputy Chief Justice.
Kika, who is represented by the Zimbabwe Human Rights NGO Forum where he is the Executive Director, has filed this application in his personal capacity.
Legal Pressure For Chief Justice Luke Malaba
By A Correspondent- Human rights lawyers and civic groups are piling legal pressure for Chief Justice Luke Malaba to resign ahead of his 70th birthday on Friday, instead of accepting a flawed extension of his retirement age by five more years through the recently signed constitutional amendment.
Malaba turns 70 this Friday and was set to retire according to the Constitution, before President Emmerson Mnangagwa last week hastily signed the Constitution of Zimbabwe Amendment (No 2) Bill into law, which will now allow judges to continue serving on the bench until they reach 75.
Legal experts yesterday said the “undue and indecent haste” in which the amendments were pushed through raised suspicion that it was “inextricably intertwined” with Chief Justice Malaba’s impending retirement.
Harare lawyer and executive director of the Zimbabwe Human Rights NGO Forum, Musa Kika, on Monday filed an urgent High Court application suing Justice minister Ziyambi Ziyambi and all judges of the Supreme Court and Constitutional Court over the matter.
Kika’s application comes at a time when civic society organisations, the opposition MDC Alliance and other stakeholders have threatened multi-faceted action to oppose the constitutional amendments, saying they would slide Zimbabwe into authoritarian rule.
The NGO Forum boss is seeking an order to have Chief Justice Malaba cease to hold the office of the Chief Justice at midnight on May 15, 2021 and have his deputy, Justice Elizabeth Gwaunza, take over in an acting capacity pending the appointment of a substantive Chief Justice below 70 years of age.
“Any action, conduct or deed of Luke Malaba post the 15th of May 2021 purportedly as the Chief Justice of Zimbabwe is null and void and of no effect,” Kika wrote in papers filed on Monday.
“It was also clear that the purpose behind the amendment was to assail judicial independence. It is a matter of regret that the impression is given that the honourable and distinguished judges concerned are being made to receive a favour, one which is fundamentally improper under the circumstances.
“In accordance with provisions of section 164(1) and (2), the developments that have led to this application also constitute a deliberate and calculated assault on the independence of the judges concerned. Such independence has been assaulted by the first respondent.”
Kika, who is being represented by Advocate Thabani Mpofu instructed by Cinginkosi Dube of Scanlen and Holderness, added that the Constitution provided that “members of the Judiciary should not receive any gift or favour that may give the appearance of judicial impropriety”.
He said the clause on judges’ retirement age was rejected during public hearings in December 2019, but Parliament chose to pass it all the same, plunging the country into a constitutional crisis.
The Constitution of Zimbabwe Amendment No 2 Bill was last month fast-tracked by Ziyambi in the National Assembly before Zanu PF and MDC-T senators voted for it on May 4 in the Senate, with Mnangagwa signing it into law three days later.
“In view of the correct legal position, whether the amendment be valid or otherwise, the fact of the matter is that it cannot benefit the respondents,” Kika added.
“I also point out that the general failure to adhere to the law has caused an avoidable constitutional crisis. By now, the second respondent should have proceeded on leave to make for a proper transitional mechanism.
“There is danger that the second respondent may continue in office post the 15th of May 2021 and that if he does that, all his actions would be void. These include the administration of the Judiciary and the resolution of disputes in court.”
In another High Court application filed yesterday by Harare lawyer Paul Christopher under case number HC/21, the applicants, Young Lawyers Association of Zimbabwe, and Fraderick Charles Moses Mutanda, who is the second applicant, also stated that if Chief Justice Malaba’s term of office was extended, this would plunge the nation into a constitutional crisis.
They cited the Judicial Service Commission, Chief Justice Malaba and Attorney-General Prince Machaya as respondents.
In a tweet, the Zimbabwe Congress of Trade Unions said: “If Chief Justice Malaba accepts the extension of his tenure under the circumstances, the Judiciary will lose any residual respect it still has. He then becomes a politician. Politicians usually do stupid things, but judges are expected to be beyond reproach.”
Lawyer and MDC Alliance vice-president Tendai Biti said the “fight to protect our Constitution is reaching fever pitch. By the end of the week, a record number of applications will have been filed to protect the Constitution. Our efforts as lawyers should be complemented by peaceful constitutional civic action.”
Chief Justice Malaba, who has been accused of political bias in the manner he conducted his duties, was appointed to the post in March 2017, replacing the late Godfrey Chidyausiku.

Passport Office Syndicate Admits Bribery Charges

By A Correspondent- A member of a syndicate that roams around the Registrar General’s offices in Harare, fleecing desperate passport seekers of money, Nicholas Chogugudza, today admitted in court to soliciting for bribes on behalf of the passport office’s employees.
Chogugudza, who was arrested along with an official from the passport offices, Prisca Moyo, today admitted to the offence when he appeared before Harare regional magistrate Mr Stanford Mambanje.
“I would want to tell the court the truth in front of everyone, including those who arrested me, that I committed the offence,” he said.
He was being charged with bribery.
Chogugudza hangs around Makombe Building as a link between the public and RG’s employees facilitating the underhand dealings.
The State will separately prosecute Moyo on criminal abuse of office and bribery.

Grace Mugabe Hauled To Court Over Late Husband’s Remains

The development could see the ZANU PF leader Emmerson Mnangagwa getting access to the remains over 1 year, 8 months after his burial, something the late president’s core family members have said they disapprove because the deceased gave instructions saying his body parts will be used for rituals.
The case, the first if its kind, is being heard in a traditional court on the 20th May.

Sticky Fingered Byo Woman Jailed
y A Correspondent- A 52 year old woman from Bulawayo has been jailed for eight months for stealing a cellphone and cash.
Lindiwe Ncube of Makokoba suburb and her accomplice, who is still on the run, hatched a plan and mugged Ms Janet Ndlovu (25) of Lobengula suburb before robbing her of an Itel A56, R50 and a plastic bag containing baby clothes.
The dramatic incident occurred on April 25 at corner Leopold Takawira Avenue and Joshua Nkomo Street Bulawayo.
Ncube was once convicted on two counts of fraud and sentenced to 18 months in prison.
The imprisonment was wholly suspended on condition of good behavior and that she completed 210 hours of community service.
The court heard that Ms Ndlovu was heading to Zapalala supermarket in the city center to board a commuter omnibus before she met Ncube.
Ncube approached Ms Ndlovu under the guise of a friendly interaction.
During their conversation, the two were joined by an unknown woman who dropped a bunch of folded United States dollar notes.
Ncube picked the cash and informed both the stranger and Ms Ndlovu that they have to cross the alley to share the money.
She went to count the money at a secret place and she came back saying the money was US$ 800.
Ncube suggested that Ms Ndlovu goes with the stranger to share the money on condition that she left her belongings as surety that she will come back.
She handed over a bulged green sock to Ms Ndlovu where she claimed to have put the money.
Ms Ndlovu rushed to a hiding place to divide the cash leaving behind her belongings. As she unfolded the sock, she was shocked to discover folded square papers inside.
The complainant rushed back and found the suspects had disappeared. Ms Ndlovu then made a police report.
The vice came to light when police showed Ms Ndlovu different photographs of suspected culprits. She positively identified Ncube and her accomplice leading to Ncube’s arrest.
An identification parade was conducted and Ms Ndlovu caught up with Ncube again.
Ncube denied one charge of theft when she appeared before Bulawayo magistrate Ms Nomagugu Maphosa.
During cross examination Ncube denied having met Ms Ndlovu in the city center.
However, Ncube claimed that she was at TM Hyper supermarket opposite Bulawayo Centre (BC) selling weaves with her colleague, Fungai Njabulo.
To support the defense case, Ncube led her evidence from her friend Ms Njabulo who confessed that they were together for the entire day at TM Hyper supermarket not selling weaves but changing money.
Before passing the judgement, Ms Maphosa said the State found incriminating evidence against Ncube.
Ms Maphosa said there was corroborating evidence from Ms Ndlovu in that she managed to positively identify the accused twice on both identification processes.
She further reiterated that Ms Ndlovu had a daylight advantage as she spent more than 10 minutes with the accused and her accomplice hence, she could not be mistaken for the accused’s identity.
The magistrate said both the accused and the defense witness stated that they were at TM Hyper opposite BC on that particular day but varied on what the accused was doing.
She said their defense did not corroborate and it shows that the accused and the witness were lying before the court.
Ms Maphosa said the State managed to prove its case beyond reasonable doubt and a custodial sentence cannot be escaped.
Ncube asked for lenience from the court when passing a sentence and if possible, pay a fine.
In passing the sentence, Ms Maphosa said Ncube was not a good candidate for any sentence beside a custodial one as she is a repeat offender. She sentenced her to serve an effective eight months in jail.
Prosecuting, Mr Owen Mugari said on April 25 at around 11AM at corner Leopold Takawira Avenue and Joshua Nkomo Street in Bulawayo the accused connived with her colleague who is still at large and took Lindiwe Ncube’s Itel A56, $50 cash and a plastic bag containing baby clothes.
The value of the stolen cellphone and cash is $9 794 and nothing was recovered.

Mtshabezi Primary School Hostel Gutted By Fire
By A Correspondent- Mtshabezi Primary School learners with disabilities escaped unharmed after their hostel and learning class caught fire but they lost clothes and other property.
The eleven learners comprising seven girls and four boys lost their clothing, stationery bedding and food among other stuff during the incident.
The fire which broke out on Friday at around 1AM is suspected to have been caused by an electric fault.
Gwanda District Development Coordinator (DDC) Mr Thulani Moyo said they were in the process of mobilising resources to assist the learners and repair the damaged block
“The Mtshabezi Primary School disability block was engulfed by fire on Friday morning at around 1AM. There was no loss of life or injuries but property worth thousands of dollars was lost. A teacher who was with the children was able to pull the children out of the building before anyone could get hurt,” he said.
“The staff from the school managed to put out the fire but the damaged had already been done. The children lost clothing, stationery, blankets and food in the fire. Furniture, cooking utensils and the roof were also damaged. This block houses pupils with various disabilities and now the learners have been left stranded. We would like to appeal to well-wishers to chip in with any form of assistance which they have.”
Mr Moyo said the building materials, blankets, beds, clothing food among others are needed.
Gwanda District School’s Inspector (DSI), Mr Sidney Sibanda said he visited the school to assess the damage and a report has been compiled. He said the pupils from the special disability class had now been moved to a temporary structure.

Gwanda Solar Project Tender Headache For Wicknell Chivhayo

By A Correspondent- Wicknell Chivayo has lost the Supreme Court case on the multimillion-dollar Gwanda solar project tender he had been granted by the ZESA subsidiary, the Zimbabwe Power Company (ZPC).
The ruling overturns a 2019 High Court judgment that observed that prohibited ZPC from cancelling the contract and suing to recover over US$5 million it had already paid to Chivayo’s company.
High Court judge Justice Tawanda Chitapi ignored the fact that Chivayo’s Intratek had apparently breached its contract with the ZESA subsidiary.
ZPC then appealed against the ruling arguing that the breach of the contract had automatically resulted in the collapse of the deal.
In their ruling on Monday, Supreme Court judges Francis Bere, Elizabeth Gwaunza and Chinembiri Bhunu said Justice Chitapi erred in not finding that there was a material dispute of facts, following which he should have dismissed Intratrek’s application. The learned judges said:
_There were allegations and counter factual allegations as to who is to blame for the alleged breach of contract. There is also a dispute as to whether or not the contract has since expired due to the effluxion of time._
_Without any further ado, it is clear that this was a case incapable of resolution without going to trial to determine the merits on the basis of viva voce evidence. Intratrek’s endeavour to avoid trial in the face of glaring material disputes of facts gives the unmistaken impression that it has something to hide that could be unearthed in the course of trial proceedings._
Chivayo’s lawyers had argued in the Supreme Court that he had, after Justice Chitapi’s ruling, completed pre-commencement works and was in the middle of fulfilling his side of the contract.
Man Kills Self After Wife Denies Him S_ex
By A Correspondent- A 21 year old man from Somabula communal farms on the outskirts of Gweru committed suicide by hanging, allegedly after he was denied conjugal rights by his 18-year-old wife.
According to the local Councillor Adam Shava, the now deceased man, Dumisani Matonsi of Plot 12 Rodell Farm, Somabula had a misunderstanding over conjugal rights with his newly-married wife.
He then walked out of the bedroom at night in protest.
The incident occured Tuesday last week.

Latest on Marry Chiwenga’s Divorce Case
By A Correspondent- The hearing into the matter in which Vice President Constantino Chiwenga is seeking to divorce his estranged wife Marry has been postponed to July 5.
Justice Esther Muremba said the court would on the return date get an update on the condition of Marry, before setting a new date for the hearing.
Chiwenga’s lawyer Advocate Lewis Uriri confirmed before the judge that Mubaiwa was unwell and admitted to a local private hospital.
Both parties’ lawyers yesterday visited Marry at the hospital to confirm her condition.
In his divorce summons, Chiwenga indicated that he had no problem with Mubaiwa getting all their kitchen utensils, a bed and three cars in their divorce, but argues that the cash amounting to US$245 428 that is kept in Mubaiwa FBC Bank account, belonged to him.
Marry failed to appear at the Harare magistrates’ courts yesterday where she is facing attempted murder charges for allegedly trying to kill Chiwenga when he was hospitalised in South Africa.
“If Malaba is a Chief Justice It Does Not Mean He Can Bring Every Institution He Leads Into A Court”

I am watching the events of court case filed by Mr Musa Kika with interest. Yesterday Luke Malaba and his fellow judges indicated that they are opposing the application.
The general background is Mr Kika wants Malaba to retire on 15 May when he turns 70. He cites s328(7) as the bedrock of his case.
Of interest I have seen the lawyers that represent the 16 Judges also requesting that Judiciary Service Commission(JSC) be joined in the case as respondent.
The matter is set for case management meeting today at 9.30 Harare High Court.
Whether Judiciary Service Commission will be allowed or not as a party to the case is another issue. My concern is to hear what Judiciary Service Commission want to say on Mr Musa Kika’s application.
Few things remain clear from Mr Kika’s application
i) That Judges must not receive a favour from Executive.
ii) That Judges must be independent from any form of influence or be forced to do something.
iii) That Judges have a fiduciary duty to exercise judiciary authority on behalf of Zimbabweans.
These are clear cut arguments of Mr Kika. Now one asks “is Judiciary Services Commission an institute of the state”? The answer is yes it is an institution formed in terms of section 189 of Constitution.
Now section 164 164 Independence of judiciary
(1) The courts are independent and are subject only to this Constitution and the law, which they must apply impartially, expeditiously and without fear, favour or prejudice.
(2) The independence, impartiality and effectiveness of the courts are central to the rule of law and democratic governance, and therefore—
(a)neither the State nor any institution or agency of the government at any level, and no other person, may interfere with the functioning of the courts;
It is clear that the Courts are only subject to the constitution and the law. It is clear that no institute may interfere with the functioning of the courts. Is Judiciary Service Commission an institute? Yes. Does the law exempt Judiciary service Commission and allow only
the Judiciary Service Commission to interfere with Courts? No. It is clear no institution must interfere with independence of Courts.
The mere fact that the same lawyers of the 16 Judges are applying on behalf of JSC it poses
questions on the independence of Judges.
Take it any how. Use the 16 Judges as the “courts” , be it Constitutional Court or Supreme Court.
These Judges do not need assistance of JSC to tell them if having your term extended by
executive is a favour or not. That is an independent view of a Court Judge and not a
Commission.
Maybe lets look at the functions of Judiciary Service Commission and try to understand their interests.
190 Functions of Judicial Service Commission
(1) The Judicial Service Commission may tender advice to the Government on any matter relating to the judiciary or the administration of justice, and the Government
must pay due regard to any such advice.
(2) The Judicial Service Commission must promote and facilitate the independence and accountability of the judiciary and the efficient, effective and transparent
administration of justice in Zimbabwe, and has all the powers needed for this purpose.
(3) The Judicial Service Commission, with the approval of the Minister responsible for justice, may make regulations for any purpose set out in this section.
(4) An Act of Parliament may confer on the Judicial Service Commission functions in connection with the employment, discipline and conditions of service of persons
employed in the Constitutional Court, the Supreme Court, the High Court, the Labour Court, the Administrative Court and other courts.
We can see from the first function that the Judiciary Service Commission tenders advice to the government and in this case the Minister of Justice who is the main client of Judiciary Service is the first Respondent. One would think all what the minister was doing was coming from the advise of Judiciary Service Commission. Can we then have the advisor come as separate being to defend his advise?
Advise is not law. Some advises end up where we are. Ultimately the Minister has to stand
responsible for the actions. In any case it was going to be different if JSC was standing with Mr Kika and saying Minister refused its advise. In this case its advise is fully represented. It does not need JSC to come again and state the same thing it advised Minister of Justice
Function two .
The Judiciary Service Commission must promote and facilitate Judiciary independence. One now wonders, who is Judiciary here between Luke Malaba and 15 other Judges
or the Judges of High Court that must hear this matter and decide over it? Who needs
independence? Which side must the Judiciary Service Commission be standing with and promoting?
Is Judiciary Service Commission for individual Judges standing as respondents or for Judges presiding over the matter. Which hand of independence must hold Malaba to the stand and which hand of impartiality must hold the Judge presiding over the case to the bench? At the end what advice does the Commission give to the Minister? And whose interest is Judiciary Service Commission coming to serve?
The personal interest of Judges who must not receive a favour but retire upon attaining 70 or the minister who they advised to sprint the amendment of constitution in order to cover up its own infidelity or the Judge of High Court who must seat and hear the case and subject him or herself only to the constitution and the law without looking at the status of people involved?
Choose Any normal person must see that the Function of Judicial Service Commission is there to protect the High Court Judge who shall sit and rule over the matter. This is an every day function of the Commission in every court case. At no time the Commission can stand in support of individual independency before a Court it is managing. Unless the Judiciary Service Commission is the respondent.
Third function is making regulations. That is legislative function. We are not dealing with any of its regulation. I see no interests based on that.
Fourth function. Lets say it is the employer of Judges. They employ Judges man and woman of ages. They do not confer a judge with years of life. The constitution says the incumbents cannot benefit from any changes to time limit. What is it that an employer want to come and say on behalf of its employee?
Whose interest will this explanation be benefitting? The Judiciary Service Commission is
for the benefit of us citizens and not Luke Malaba. I am still yet to hear their side but again it shows there is lack of separation of powers. A Court is not a Commission.
If Malaba is a Judge of Constitutional Court it does not follow the Judiciary Service
Commission is a Court. If Malaba is a Chief Justice it does not mean he can bring every institution he leads into a Court.
The matter before Court is, he was born 15 May 1952 and therefore on 15 May 2021 he will be 70 years.
By s186(1) of 2013 constitution he must retire, should there be an amendment seeking to change s186(1) the person in office by date of amendment does not benefit from the amendment in terms of section 328(7). Is receiving a year after attaining 70 a loss or
benefit to Malaba? It is benefit. He cannot receive it in terms of section 165(5). Chidyausiku did not benefit on it.

Mnangagwa Wants Mugabe’s Remains Exhumed
By A Correspondent | In what is understood to be renewed efforts to seize the late president Robert Mugabe’s remains, former First Lady Grace Mugabe has been sued over her husband’s corpse.

The development could see the ZANU PF leader Emmerson Mnangagwa getting access to the remains over 1 year, 8 months after his burial, something the late president’s core family members have continued to disapprove because the deceased gave instructions saying his body parts will be used for rituals if handed to the coup-criminal.
In September 2019, Mugabe family spokesperson, Leo, told ZimEye the clan resolved to never give Mnangagwa or anyone else his uncle’s body. He said Mugabe would be given a secret burial since he was a chief, according to him.
Analysts suggest that the remains are needed for ritual purposes to obtain powers to govern the country.
The case, the first if its kind, is being heard in a traditional court on the 20th May.

Gumbura Graduates in Prison

Gumbura graduated last Friday graduated with a certificate in Peace Education.
He was, however, awarded the certificate in absentia since he was attending a routine court appearance on fresh charges that arose during his incarceration.
Mtshabezi Primary School Gutted By Fire
By A Correspondent- Mtshabezi Primary School learners with disabilities escaped unharmed after their hostel and learning class caught fire but they lost clothes and other property.
The eleven learners comprising seven girls and four boys lost their clothing, stationery bedding and food among other stuff during the incident.
The fire which broke out on Friday at around 1AM is suspected to have been caused by an electric fault.
Gwanda District Development Coordinator (DDC) Mr Thulani Moyo said they were in the process of mobilising resources to assist the learners and repair the damaged block.
“The Mtshabezi Primary School disability block was engulfed by fire on Friday morning at around 1AM.
There was no loss of life or injuries but property worth thousands of dollars were lost.
A teacher who was with the children was able to pull the children out of the building before anyone could get hurt,” he said.
“The staff from the school managed to put out the fire but the damage had already been done. The children lost clothing, stationery, blankets and food in the fire. Furniture, cooking utensils and the roof were also damaged. This block houses pupils with various disabilities and now the learners have been left stranded. We would like to appeal to well-wishers to chip in with any form of assistance which they have.”
Mr Moyo said the building materials, blankets, beds, clothing food among others are needed.
Gwanda District School’s Inspector (DSI), Mr Sidney Sibanda said he visited the school to assess the damage and a report has been compiled. He said the pupils from the special disability class had now been moved to a temporary structure.

Zanu PF Torments Teachers In Mutoko
The Amalgamated Rural Teachers’ Union of Zimbabwe (Artuz) on Monday claimed that its members were at the weekend forced to attend a Zanu PF rally at Kagande in Mutoko and were ordered to register as voters for the party in 2023.
The union posted on Twitter claiming that teachers affiliated to Artuz were now refusing to go back to their workstations for fear of victimisation. Artuz posted on its Twitter handle:
Over the weekend, members of Zanu PF terrorised some teachers in Mutoko district, forcing them to register as part of the five million voters for Zanu PF. In some cases, Zanu PF had all the details of the teachers, they just visited to confirm. In Kagande, teachers were forced to attend a rally.
A total of 31 trs reported through our hotline. Our rapid response team is in Mutoko assessing the safety of some trs who refused to attend the Kagande meeting & those who refused to register as ZANU PF voters for 2023.
Progressive Teachers Union of Zimbabwe president Takavafira Zhou who is also the MDC Alliance spokesperson for Midlands echoed the Artuz report. Zhou said:
We also are witnessing a sad situation where village heads are teaming up with school development committee members and are evicting the incapacitated teachers from school accommodation.
We want to warn such misguided figures that they have no locus standi in intervening in cases between teachers and their employer.
Zanu PF party spokesperson Simon Khaya Moyo dismissed the claims saying Zanu PF is a party of law and order which subscribes to the rule of law. He added:
If there are any instances of what Artuz is alleging, then they should report such matters to the police.
If they want to get to the bottom of the issue, the Zanu PF provincial leadership is there. They should ask the provincial chairman what is happening. The police are there to contain such characters.

HIGHLANDERS have entered into a business partnership with Sanctuary Insurance.
Club spokesperson, Ronald Moyo, said the deal will see them become the official agents of the insurance company.
‘‘The partnership, which we launched at the weekend, confirmed that Highlanders is, from now, on the official agent list of Sanctuary Insurance,’’ said Moyo.

Kwekwe Grapples With $100m Debt
CASH-strapped Kwekwe City Council is struggling to settle a Zesa debt which has ballooned to $111 million.
The power utility has slapped the local authority with an ultimatum to offset the debt, or risk being cut off.
Speaking during a full council meeting recently, Mayor Councillor Angeline Kasipo said the local authority was yet to recover from the effects of the Covid-19 induced lockdown which has resulted in dwindling cash in-flows.
“As it is, we are only collecting about 42 percent of the targeted income and it has become a challenge for us to offer services effectively. As a result, we have been failing to settle the Zesa debt hence it has ballooned to this figure. They have written to us giving us an ultimatum to pay or else we risk being cut off,” said Cllr Kasipo.
She said power was critical for the pumping of water from the Kwekwe Water Works to the residents and companies hence the local authority’s decision to pull all stops to ensure the bill is settled.
If cut off, the move may also affect the smooth flow of business in Kwekwe, a mining and industrial hub.
Cllr Kasipo said the local authority was engaging debtors, chief among them Redcliff Municipality as it seeks to boost its coffers.
“We also have debtors who owe us a lot and we are trying to engage them so that they can help us out in this situation. As for Redcliff, we are in this together because if we are cut off, they also suffer because we supply them with water,” she said.
Redcliff owes Kwekwe $45 million, Government institutions a total of $23 million and Zisco $16 million.
Cllr Kasipo told a portfolio committee on local government that they were facing challenges with Government institutions.
“We are having problems with Government companies and Zisco whose debt was taken over by the Government. We are kindly asking your committee to intervene because we are suffering. I know there might be challenges but we need to help each other out,” she said.
Recently the city has been disconnecting water from defaulting residents in a desperate bid to raise the much-needed money.
The local authority has also urged those with outstanding bills to approach the authorities and come up with payment plans.- Chronicle

Teachers Forced To Attend Zanu PF Rally

Over the weekend, members of Zanu PF terrorised some teachers in Mutoko district, forcing them to register as part of the five million voters for Zanu PF. In some cases, Zanu PF had all the details of the teachers, they just visited to confirm. In Kagande, teachers were forced to attend a rally.

Progressive Teachers Union of Zimbabwe president Takavafira Zhou who is also the MDC Alliance spokesperson for Midlands echoed the Artuz report. Zhou said:
We also are witnessing a sad situation where village heads are teaming up with school development committee members and are evicting the incapacitated teachers from school accommodation.
We want to warn such misguided figures that they have no locus standi in intervening in cases between teachers and their employer.
Zanu PF party spokesperson Simon Khaya Moyo dismissed the claims saying Zanu PF is a party of law and order which subscribes to the rule of law. He added:
If there are any instances of what Artuz is alleging, then they should report such matters to the police.
If they want to get to the bottom of the issue, the Zanu PF provincial leadership is there. They should ask the provincial chairman what is happening. The police are there to contain such characters.

Mwonzora’s Party Presidency To Be Challenged In High Court

MDC-T leader Douglas Mwonzora’s presidency faces a new threat after the party’s United States provincial leadership yesterday resolved to challenge his election in court.
US MDC-T provincial chairman Den Moyo yesterday said the province had already set up a legal team which will soon approach the High Court in Harare in a bid to set aside Mwonzora’s controversial election as party president in December last year.
Mwonzora won the presidency in 2020 after beating Thokozani Khupe, Morgen Komichi and Elias Mudzuri during a controversial extraordinary congress (EOC) held in December.
“We are approaching the High Court to come up with a strong case. We have to take time to gather all the evidence as we don’t want a half-baked lawsuit that will end up failing to achieve its intended results.
“So we are taking our time, interviewing people who were present at the EOC, people who were attacked, the events that unfolded, people who witnessed a different voters’ roll being presented than the one that was used, people who witnessed non-party members that were bussed in, and those who were not delegates being allowed to vote at the congress,” Moyo said.
Khupe, Komichi and Mudzuri had initially dismissed the elections as a farce, but they have since accepted the results and are now working under Mwonzora.
MDC-T party spokesperson Witness Dube said: “How can Den Moyo challenge a congress result he got to know of more than four months ago and only after being suspended from the party? His actions are a further vindication of the decision to suspend him because he is clearly motivated by selfish reasons.”
The US province’s challenge comes just a few days after an independent electoral management body (IEMB) hired by the MDC-T to run its elections endorsed Mwonzora’s victory. The IEMB admitted that the voters’ roll was not perfect.
“There were cases where some delegates’ names did not have national identity numbers, so some had spelling errors on their names. They were allowed to vote after verification of their authenticity by the commissioners and their ID numbers captured by commissioners as per the agreement that had been made between the IEMB and candidates.
“At least 95% of the delegates that turned out to vote and had their names on the voters roll or the supplementary roll, or the verified provincial list managed to cast their vote despite some having had to cast their vote late into the night,” the report read.
A total of 1 026 votes out of the expected 4 500 were cast on December 27, with 883 voting for Mwonzora, 118 voting for Khupe, 14 for Mudzuri and nine for Komichi. Newsday
