Chief Justice Luke Malaba is on course to remaining in office beyond 15 May (next Saturday) when his tenure ends by operation of law following the passing of the Constitution of Zimbabwe Amendment (No.2) Bill by Senate this week which, together with the Constitution of Zimbabwe Amendment (No.1) Bill, are likely to be gazetted today.

By operation of law, Malaba ceases to be chief justice when he turns 70 at midnight on 15 May.

The Amendment (No.1) Bill will enable the President to appoint the Chief justice, Deputy Chief Justice and Judge President without them undergoing public interviews.

Crucially for Malaba, the Amendment (No.2 Bill) seeks to allow judges of the Constitutional Court and the Supreme Court to continue to serve beyond the current retirement age of 70, if the President, after consulting the Judicial Service Commission, consents to their doing so.

It also seeks to permit the President to promote judges of the High Court and the Supreme Court to a higher court on the recommendation of the JSC, without the need for public interviews, thereby opening the door to promotions on the basis of political suitability and cronyism, as is the case with Malaba.

The behind-the-scenes manoeuvres to extend Malaba’s tenure by hook or by crook are being orchestrated by President Emmerson Mnangagwa – the ultimate beneficiary of the extension.

Mnangagwa needs Malaba to help him navigate possible constitutional and legal minefields ahead of the 2023 elections.

With just a week before Malaba’s tenure ends, the JSC has not announced a vacancy by advertising the chief justice’s position, meaning that the shortlisting of candidates and public interviews have not been done.

Justice ministry officials told The NewsHawks that the position has not been advertised because it was known beforehand that there was a plan to amend the constitution to allow for Malaba’s extension.

Crucially also, Malaba has not said his goodbyes unlike his predecessor Godfrey Chidyausiku who announced he would be leaving office when he officiated at the opening of the 2017 legal year. He retired in February 2017 after reaching 70 years.

Malaba has been Mnangagwa’s long-time ally, including when he was deputising the late former president Robert Mugabe, and also while serving as Justice minister well before the November 2017 coup.

The Chief Justice has been a vital cog in Mnangagwa’s political machinery, helping him sanitise and legitimise the coup which toppled Mugabe, and thrust him into power.

Malaba has also run the judiciary in a way that has helped Mnangagwa’s regime, government insiders acknowledge.

The chief justice presided over the 2018 Constitutional Court electoral petition by MDC Alliance president Nelson Chamisa challenging Mnangagwa’s disputed 2018 presidential poll win.

He delivered the Constitutional Court judgement which confirmed Mnangagwa’s disputed 30 July 2018 presidential election victory, after dismissing Chamisa’s petition.

In a unanimous ruling of the nine judges of the country’s top court, Malaba said Chamisa had failed to prove allegations of fraud and manipulation of the vote during the presidential poll.

“Emmerson Dambudzo Mnangagwa is duly declared the winner of the presidential elections held on the 30th of July 2018,” Malaba said in his judgment, which had attracted widespread attention at home and abroad.

It is understood Malaba prevailed over some judges to ensure the unanimous ruling. Some judges wanted to dissent, but were whipped in line, sources said.

Government and judicial officials say Malaba was Mnangagwa’s strategic candidate to replace the late Chief Justice Godfrey Chidyausiku when he was Vice-President and Justice minister, while also plotting to succeed the late former president Robert Mugabe.

The Mnangagwa Zanu-PF faction, which battled for power against the rival group that had coalesced around Mugabe’s wife Grace, broadly wanted Judge President George Chiweshe to succeed Chidyausiku. But Mnangagwa personally thought Malaba was the man for the job.

Then as now, Mnangagwa still wants Malaba. Chiweshe, who has a military background, is now viewed by Mnangagwa’s faction as Vice-President Constantino Chiwenga’s loyalist. Mnangagwa and Chiwenga are currently locked in a simmering power struggle.

In a July 2018 ruling that helped Mnangagwa to sanitise the coup which toppled Mugabe, Malaba said Mugabe freely and voluntarily stepped down, adding Mnangagwa’s assumption of power was done in terms of the law, although it was clear he had seized power through a coup.

This followed an application by the Liberal Democrats and Revolutionary Freedom Fighters, Bongani Nyathi, Linda Masarira and Vusumuzi Sibanda who contested the legality of the Mnangagwa-led government.

They argued that Mugabe tendered the resignation under duress and that Mnangagwa’s ascendancy was unconstitutional.

They further said that the impeachment process that was instituted prior to Mugabe’s resignation was unlawful and that it served to coerce him to step down.

However, Malaba, sitting in chambers, ruled the constitutional challenge was frivolous and vexatious given that Mugabe carefully applied his mind and decided to step down without the embarrassment of impeachment.

“The former president’s written notice of resignation speaks for itself,” Malaba said.

“It sets the context in which it was written. He candidly reveals the fact that he had communicated with the Speaker of Parliament at 1353 hours. In the communication, the former President expressed to the Speaker his desire to resign from the Office of President.

“A written notice of resignation addressed to the Speaker and signed by the President, on the face of it, meets the first requirement of constitutional validity.”

Malaba argued that “what the former President said in the written notice of resignation is the best evidence available of the state of his mind at the time.”

“He (Mugabe) said he was free to express his will to resign. Not only does the former President declare in the written notice that he made the decision voluntarily, he gives reasons for doing so in clear and unambiguous language,” Malaba said.

“He said he was motivated by the desire to ‘ensure a smooth, peaceful and non-violent transfer of power that underpins national security, peace and sustainability”.

Malaba said Mnangagwa’s assumption of office was therefore done in accordance with the provisions of the constitution after a vacancy had arisen due to the resignation.

The Chief Justice’s judgment followed a November 2017 ruling by Judge President George Chiweshe which legitimised the coup.

Chiweshe had ruled that the military intervention by the Zimbabwe Defence Forces which led to Mugabe’s resignation was constitutional, as the military sought to restore order in the country.

He said the military’s actions in intervening to stop the takeover of Mugabe’s functions “by those around him are constitutionally permissible and lawful”.

Malaba and Chiweshe thus played a critical role in sanitising and legitimising the coup which propelled Mnangagwa to power.

Hot Sangoma Snatches Client’s Husband

By A Correspondent- For Sephukile Mathuthu, from Bulawayo’s Cowdray Park suburb, things were not going well for her husband Prince Mathuthu when they decided to consult a sangoma, Malandisa Ncube, from Old Magwegwe suburb.

The sangoma reportedly healed her husband without any hassles, but Sephukile is now hurt and frustrated.

This is because after helping her husband, the “devious” sangoma complicated her life by snatching him.

After she found herself sharing her husband with a “hot” sangoma, she suspected that Malandisa did other things to him.

Last week she visited the Bulawayo Civil Court seeking a peace order against her, while protesting that she wanted the sangoma to leave her man alone.

“I want a peace order against Malandisa Ncube who is my husband’s girlfriend. She constantly calls me while insulting and threatening me. Because of her acts I no longer have peace as she also texts me insulting messages.

“She is a traditional healer and I used to consult her when my husband Prince Mathuthu was sick. She ended up having a relationship with him.

“She is always calling me and my husband and we ended up fighting because of that,” protested Sephukile.

She said Malandisa was also threatening her saying she would “fix” her since she was a sangoma.

“She is also threatening me saying she is a sangoma and can fix me, the latest incident being last month. I want the court to help me by barring her from insulting and threatening me and also to stop her from coming to my house,” begged Sephukile.

Sephukile and Prince got married in 1997.

In response Malandisa admitted that she snatched Sephukile’s husband when they consulted her for help. She, however, said they had since separated.

“I never phoned her or went to her house to see her husband. She is the one who is phoning me and I don’t respond.

“There is just bad blood between us after I had an affair with her husband long back. It’s not like I’m a traditional healer, but a prophetess since I assist people with Holy water,” responded Malandisa.

Sephukile, however, insisted that she was a sangoma and that the adulterous relationship was also still subsisting.

“She is a sangoma and is still having an affair with my husband. My husband even apologised to me,” she said.

In coming up with a ruling the presiding magistrate Nkosinomusa Ncube took into consideration the fact that it was common cause that Malandisa was or is still in a relationship with Sephukile’s husband.

“Applicant is married under the Marriages Act Chapter 5:11, a strictly monogamous marriage therefore, she will be hurt by any affair involving her husband.

“The parties have bad blood and as such, there is a mutual verbal attack between them and a reciprocal order is hereby granted that parties are ordered not to threaten, call or send each other insulting messages,” ruled the magistrate.

Man Beaten For Seductive Dance Before Colleague’s Wife

By A Correspondent- A man was left bloodied after he was assaulted at a party by his close friend, who accused him of dancing in a sexually suggestive way before his wife.

A witness, who attended the party, said Sam Sabelo Sibanda became unhappy after seeing his wife, Tatenda Kasaira, marvelling at his friend Dumiso Mpabanga’s exquisite dance moves.

The witness said Sam approached his wife and accused her of admiring and salivating at Dumiso’s sexually suggestive dance moves.

After that he turned to Dumiso and angrily accused him of dancing while looking at his wife.

“He charged at the unsuspecting Dumiso, who was enjoying himself on the dance floor and accused him of trying to entice his wife with his sexually suggestive dance moves.

“After that, he manhandled him before he unleashed a heavy blow on him,” said the source.

Following that, the source said, Sam rained blows on the hapless Dumiso, who tumbled to the ground and bled from the mouth.

“He kicked him all over the body causing him to bleed. But Sam did not stop at that, as he reached for stones and hit him on the body while he was wriggling in pain on the floor,” said a witness who watched all the drama unfold.

Dumiso was rushed to Mpilo Central Hospital for treatment.

A report was made at Tshabalala Police Station, but the police were yet to arrest Sam.

Bulawayo deputy police spokesperson Assistant Inspector Nomalanga Msebele confirmed the incident:

“I can confirm that we arrested a man who assaulted his close friend for allegedly dancing in a sexually suggestive manner in front of his wife.

“The suspect also stoned the complainant.”

She appealed for information that may lead to the arrest of Sam.

“This suspect is a resident of Bulawayo and is known by some people and they have information about where he could be hiding.

“We are kindly asking you to furnish us with information that may lead to his arrest.

“Anyone with information may contact any nearest police station or contact us on (09)60358,”she said.

“Biti Vows A Floodgate To Protect Constitution”- Excuse For Participating In Yet Another Flawed Election

By Patrick Guramatunhu- There are many reasons why Zimbabwe is in this serious economic and political mess and many of them dovetail to the nation’s inability and/or disrespect for truth, facts and reality; especially the country’s leaders.

“The fight for protection and defence of our Constitution has become the defining fight of the present. There will be a floodgate of litigation which ought to be complemented by peaceful civic action,” threaten MDC A VP, Tendai Biti.

He was adding his voice to the chorus of many other Zimbabweans who have condemned the passing into law of Constitution Amendment Bill No 2. Tendai Biti, as with all the others, have conveniently ignored the facts for the purpose of pushing their agenda of brainwashing the populous for selfish political gain.

The single most important fact that cannot be ignored is that no constitution written by mere mortals CANNOT be amended by mortals. Why? Because mortals are per se fallible and to abrogate such authority as to impose a law onto others has the arrogance of one who believes is infallible. And so, we can state here and now that the March 2013 Zimbabwe constitution can be amended.

The Constitution itself has laid down the process that must be followed to amend the constitution and to on that list is the requirement that 2/3 majority in both parliament and senate must approve the amendment.

There may be other technicalities that the Zanu PF regime failed to follow in pushing through this amendment but these should not detract anyone from the key point that Zanu PF has the Constitutional power and authority to amend the March 2013 Constitution.

Tendai Biti has argued that the Amendments will give President Mnangagwa dictatorial powers and no one can, in all honest, dispute. But again one must seek guidance on this from the constitution itself. There is no chapter or clause in the March 2013 Constitution that explicitly says no one can amend the constitution to enhance or undermine the balance of power between one arm of government against the other or undermine usurp the people’s freedoms and rights. One can argue that such a clause should have been there but we are concerned about facts and reality here, that section is not there.

One inherent self-protecting mechanism in a good and well written constitution is that it should stop the election of tyrants into power and/or stop them destroying the constitution by imposing a cooling off period between passing the amendment and it being enforced.

Amendment Bill No 2 was signed into law 7 May 2021 and a week later President Mnangagwa exercises the new power granted to him in the Bill – extent the term of office of Chief Justice Luke Malaba beyond his retirement age of 70 years. Of course, it leaves a very bitter taste in one’s mouth particularly when it was the same Judge who has given some treasonous judgement to benefit Mnangagwa.

There is no deny that the July 2018 elections were flawed and illegal and should have been declared null and void. ZEC, the body appointed by law to preside over the organisation and delivery of a free, fair and credible election process not only failed to produce a verified voters’ roll but failed to produce all the V11 forms, the summary of the vote count from each of the Polling Station, on which the presidential race result was based.

ZEC staff were supposed to preside at each and every Polling Station and were responsible to the safe keeping of all materials relating to the election process. ZEC affidavit submitted to the Constitution Court showed 10% of V11 forms were missing and so 10% of the figures used in the presidential vote count could not be traced or verified. This was the reason why ZEC could not reconcile the tallies from the three counting systems; each must have received different figures from the missing V11 forms.

Of course, the July 2018 elections were rigged but Chief Justice Luke Malaba ignored the facts, truth and reality on the ground and declare the process free, fair and credible and Mnangagwa the duly elected State President of the (Banana) Republic of Zimbabwe. And now the State President of the Banana Republic has just amended the Constitution to ensure the Chief Justice keeps his job, no doubt there are many other dirty jobs for him to do!

You scratch my back and I will scratch yours! It is all so comradery and congenial as one would expect in a Banana Republic and so it is because, like it or not, Zimbabwe is a Banana Republic complete with its weak and feeble March 2013 Constitution.

“There will be a floodgate of litigation which ought to be complemented by peaceful civic action!” Will the flood of litigation transform a weak and feeble Constitution into one that will stop rigged elections? No!

The flood of litigation will the judge by the same corrupt and compromised Judiciary that judged the November military coup “legal, justified and constitutional”! Can we realistically expect the judges to be anything else other than corrupt and compromised? No!

Even if Tendai Biti was to name his own judges to preside over the flood of litigation; as long as they are there to judge on the legality of the process followed in passing the Amendment Bill No 2, they will find no fault. The fault is not with the Amendment process but with the weak Constitution that allowed Zanu PF to rig elections in the first place.

Tendai Biti was a senior MDC member in the 2008 to 2013 GNU that failed to implement even one meaningful reform and drafted the weak and feeble March 2013 Constitution. To make matters worse the MDC leaders have participating in the flawed elections giving legitimacy to the vote rigging Zanu PF because they were after the few gravy train seats Zanu PF has been giving away as bait.

Biti could not resist the enticing promise winning a seat of the gravy train, the call of the wild, and is one of the MDC who has participated in the flawed elections at every opportunity. Today, he is the Right Honourable Tendai Biti, MDC A MP for Harare East. Of course, he is positioning himself to participate in the 2023 elections and the flood of litigations will help keep his name on the public eye and thus enhance his chance of winning one of the few gravy train seats the opposition have to share.

Tendai Biti and his MDC friends, from both the Chamisa led faction and Mwonzora led faction, are all gearing to participate in the 2023 elections knowing fully well that participating will give the vote rigging Zanu PF legitimacy and thus perpetuate the corrupt and tyrannical rule. Tendai Biti Nelson Chamisa and the rest in the MDC A faction have their excuse for participating and will con the Zimbabwe populous to join them – they will be stop Zanu PF and his newly found stooges, Mwonzora and company, desecrating the sacred March 2013 Constitution!

The floodgate of litigation is be, ostensibly, to Amendment Bill No 2 becoming law and to there will be no more amendments. In reality, the floodgate of litigations, if there are any at all, will be as futile as Chamisa’s challenge of the July 2018 presidential result. The whole hoo-ha is cast MDC A leaders as the heroes of the long suffering masses of Zimbabwe when they are as guilty as Mwonzora and company of selling out to Zanu PF.

The people’s willingness to believe whatever the leaders tell them, no questions asked, has allowed the leaders to tell one hen’s teeth tale after another and get away with the consequences every time. There is no excuse for participating in the 2023 elections without first implementing the reforms but we can be certain stopping Zanu PF amending the constitution is one of many to follow!

ZINASU Leaders Arrested For Shouting At Cops Released

By A Correspondent- Two Zimbabwe National Students Union (ZINASU) leaders who were arrested for disorderly conduct by police in Harare on Friday have been freed.

ZINASU Gender Secretary Nancy Njenge and Women’s University in Africa SRC president Paidamoyo Masaraure were arrested yesterday for allegedly shouting at some police officers who were arresting vendors and touts in Harare and taken to the Harare Central Police Station.

According to their lawyers, the Zimbabwe Lawyers for Human Rights (ZLHR), Njenge and Masaraure were initially accused of inciting public violence and undermining police authority but the police later changed the charge to disorderly conduct.

They were taken to the Harare Magistrates Court for an initial remand appearance on Saturday afternoon.

Meanwhile, the two students activists have been released into the custody of their lawyer Douglas Coltart of the Zimbabwe Lawyers for Human Rights.

Police advised that they will proceed by issuing summons against them if they intend to have them prosecuted.

“I Am Zanu Pf To The Core And Have Never Left The Party”

By A Correspondent- Masvingo businessman Pascal Mudzikisi who contested as an independent candidate against Minister Davis Marapira for the Masvingo North parliamentary seat in the 2018 general election, has now rejoined Zanu-PF.

He says he has always been a member of Zanu-PF whose principles and values are rooted in the party, and had never really left it.

Mudzikisi appeared at a Masvingo Provincial Coordinating Committee PCC) meeting held at Great Zimbabwe University’s (GZU) Robert Mugabe School of Education on Sunday, May 02, where he was formally introduced into the party.

He was welcomed together with former MDC stalwarts Tongai Matutu, Dr William Zivenge and former Senator James Makore by Zanu-PF secretary for science and technology in the politburo Christopher Mutsvangwa and the provincial leadership of the party.

“I was Zanu-PF and I am still Zanu-PF. I never stopped supporting it because that’s where my principles lay so I couldn’t go to another party where I will be forced to fight my principles. That is the reason why I did not join any other political party after my expulsion,” Mudzikisi later told TellZim News.

He was automatically expelled from the party after he contested for the Masvingo North parliamentary seat as an independent, having failed to contest in the primaries after his CV failed to sail through during the vetting process.

“Quarrels are good for democracy in any community but what is important is that at the end people reconcile and move forward,” Mudzikisi said.

He said he had a huge following which could add to the party’s vote tally in the 2023 general election.

“When I contested as an independent I got 2 000 votes and most of those people are still loyal to me and they can contribute to the party’s five million votes target in the general election.

“The reception we got at the PCC was warm. We were allowed to stay and hear them deliberate, a thing which shows that we have been forgiven,” he said.

On whether he will contest in the 2023 elections, Mudzikisi said he was ready to serve but will stand guided by the party.

“I am loyal to Zimbabwe and to Masvingo North where I was born and bred. So if there is anyone who is able to represent and fulfill the needs of Masvingo North, I will support them regardless of where they come from.

“However I will then make noise about it if they fail. If the party and the people of Masvingo North want me to represent them, I will do but if Zanu-PF sees that there is someone who can represent its interests better in the constituency, I will gladly support that someone,” said Mudzikisi.

Ex-cop Jailed 33yrs For Armed Robbery

By A Correspondent- A 33 year old ex-cop who was stationed at Chiredzi Central Police Station, Taurai Mujatiwa was last week imprisoned for 33 years by Chiredzi Regional Magistrate Judith Zuyu after being found guilty on three counts of armed robbery.

Mujatiwa was found guilty on three counts of armed robbery after he stole property worthy $63 000 and US$820 and R70 200.

Of the 33-year-long jail term, two years were set aside provided he paid back US$125 for count one, R58 720 and US$788 for count two before May 27, 2021.

The State represented by Noel Muranda stated that on March 05 this year, Mujatiwa in company of Collins Chauke, who is still at large, approached Calisto Jairos Mapikire, who is a taxi driver at N. Richards Wholesalers in Chiredzi asking for his services to Hippo Valley Section 27.

When they got to Chitsanga Hill, the accused strangled the complainant, tightened his hands and legs, covered his face and discharged a firearm threatening to kill him if he failed to cooperate.

The accused drove off to Triangle and dumped the complainant in a cane field near High Siringa and took his Toyota Fan cargo, US$125.00, a pair of tennis shoes, a belt and a cellphone. The complainant later managed to reach for help and reported the matter to Triangle Police Station.

On the second count, along Masvingo-Beitbridge highway the following day, Mujatiwa gave Lydia Maphosa a lift and threatened to kill her and took her Gtel cellphone, S$ 21 000 and a monarch with clothes before dumping her alongside the road and drove off.

The state presented that on March 07, in Zvinonyanya Village, Mwenezi district, the accused in the company of four gang members, approached Nokutula Moyo’s homestead around 03:00hrs and broke into her house before threatening the complainant and his family with a machete.

They requested for safe keys but the complainant refused to give them. The accused harassed and assaulted Moyo’s daughter with open and threatened to chop them into pieces.

They demanded a cellphone and took a safe with US$770, P250, R70 200 and property worthy S$16 310.

The accused was later arrested at a police road block in Chivi, where he refused to cooperate with the police before running away, leaving the stolen car behind.

The police searched in his car and found a machete with dry blood strains, a screw driver and discovered that vehicle been stolen.

On passing her verdict, Magistrate Zuyu said there was enough evidence to prove that the accused was guilty.-TellZim

Serial Rapist Busted

By A Correspondent- A serial rapist who was allegedly raping minors between ages of seven to 10 was arrested on Wednesday.

Sources familiar with the incident alleged that Kwaramasa Kwaramasa (39) was ambushed by the police and arrested in Chiwaridzo, Bindura.

“Working on a tip-off the police managed to arrest the rapist who had terrorised Bindura,” said a source who declined to be named.

“He would lure girls between the ages of seven to 10 and  lie to them that he does not know directions to Garati area where he would take them in a bush and rape them.”

Meanwhile, rape cases in Mashonaland Central province are on the increase.

Daring Woman “Steals” Car From ZIMRA Offices

By A Correspondent- A Plumtree woman appeared in court Friday for allegedly stealing a motor vehicle she had not imported, by clearing and paying duty fees for it at the border town’s Zimbabwe Revenue Authority (ZIMRA) offices.

Sharmaine Mlambo (33) a car dealer from the border town, was arrested and charged with theft of a motor vehicle.

The stolen vehicle belongs to Marita Mangani (36) from Bulawayo’s Burnside suburb, who found her car ‘gone’ after travelling to Plumtree to clear it.

Mangani bought the vehicle from Car Max Africa, a private company based in Durban, South Africa.

She requested that that car be ferried to Botswana, while she sorted the funds to pay for duty.

The state represented by Willbrought Muleya, alleges Mlambo obtained a proforma invoice pertaining to Mangana’s car from the same company, yet it was not supposed to be used as proof of payment of the motor vehicle.

“Mlambo went ahead and fixed the imported pre-clearance of the vehicle at ZIMRA Plumtree Border Post and paid duty in that regard,” the prosecutor said.

Muleya added that when Mangani’s car arrived at Plumtree Border Post, which was under her name, as per the Customs and Exercise cargo manifest, Mlambo altered the name and entered hers.

“Mlambo proceeded to process the final clearance before taking the car into her possession without Mangani’s consent,” the prosecutor added.

Mlambo, who pleaded not guilty to the charge, was however freed on ZWL$5 000 bail.

Plumtree Magistrate, Tayengwa Chibanda, said as part of the bail conditions, ordered Mlambo to surrender her passport to the police and to reside at her home in George Silundika in the border town.

Mlambo was also ordered not to interfere with state witnesses.

In her bail application, Mlambo’s legal representative, Tutu Ncube, pleaded with the court to unconditionally release his client as it was her constitutional right.

“My client is not a flight risk, when the police summoned her to the police station yesterday (Thursday) she gladly availed herself. This in its own essence, Your Worship, is a sign that she has every intention to stand trial. She even provided her residential address so that should the police need anything from her, they can easily access her,” said the lawyer.

“Denying her bail right now would be trampling on her constitutional right. The state, as we speak has not provided us with any witnesses’ statements, so there is no need to worry about interference, as we do not even know whom they intend to call as their witnesses.”

In laying charges, Muleya said the complainant -Mangana purchased her vehicle on March 1 2021, and on March 20,  Mlambo obtained a proforma invoice of the same vehicle, which she used to commit the alleged offence.

“On March 23, 2021 Mlambo did an import pre-clearance of the vehicle at ZIMRA Plumtree Border Post and paid duty in that regard. On March 30, 2021 Mangani’s car arrived at Plumtree Border Post under her name according to the Customs and Exercise cargo manifest and (somehow) was altered by Mlambo into her name. She went on to process the final clearance and took the car into her possession without Mangani’s consent,” Muleya said.

“On April 30, Mangani’s import waiver was approved by ZIMRA Plumtree Border Post and was given green light to import her car and that was when she discovered the offence. On May 3, 2021 Director of Car Max Africa, Junaid Bhatti, issued an affidavit statement indicating that Mangani was the sole owner of the car and was not aware how Mlambo had obtained the proforma invoice.”

The value of the vehicle was US$1 400 and nothing was recovered, said Muleya.

Five Battling For Life After Eating Porridge

By A Correspondent- In an incident that has shocked residents of Old Magwegwe in Bulawayo, a four-year-old boy died while five of his relatives and neighbours are battling for life at Mpilo Central Hospital after they reportedly ate porridge suspected to have been laced with poison yesterday.

The incident reportedly happened at around 11 am and resulted in the four-year-old dying within minutes after consuming the porridge. Three other boys aged eight, 12 and 18 are said to be in critical condition. Two other children from the house next door who also tasted the porridge are said to be in a stable condition.

Bulawayo provincial police spokesperson Inspector Abednico Ncube said he could not readily comment on the matter but when Sunday News visited the house yesterday at around 3pm, the body of the deceased was still in the house with police taking statements from family and neighbours.

A spokesperson for the Siyanzembwe family, Ms Ethel Munkuli said she was called by neighbours to go and find out what was happening at her mother-in-law’s house after the children were seen vomiting.

“The deceased and the three other boys in a critical condition reside together with my mother-in-law who was at work. From what we gathered, the 18-year-old Donald Mudimba cooked porridge which he shared with three other boys aged four, eight and 12 as he usually does because he is the one who looks after them when my mother-in-law is at work.

There were two other kids from next door who also tasted the porridge while playing there. However, Donald started having a running tummy and he went to relieve himself. The four-year-old boy then started eating Donald’s porridge resulting in him being more critical and dying before being ferried to hospital,” said Ms Munkuli.

She noted that at first when she arrived at the house, which is a street away from her house, Donald was vomiting non-stop and in a state of shock. Ms Munkuli said she thought Donald had been bewitched so she rushed him to a nearby prophetess to seek for prayers.

“While we were praying for Donald I was then called again and told the other three boys were now vomiting as well. We then asked Donald who said they ate porridge only a few minutes ago.

 We then called the ambulance but by the time it arrived the four-year-old boy was no longer breathing. The three boys and two kids from next door were then ferried to Mpilo hospital together with the pot of the porridge and the sugar they used.”

While other neighbours were suggesting that Donald could have used a pesticide instead of sugar, Ms Munkuli said the sugar was in a normal sugar packet and it was “the usual brown sugar”.

The 18-year-old boy and the 12-year-old boy are said to be siblings to Ms Munkuli’s husband, while the eight-year-old boy and four-year-old boy are her mother-in-law’s grandchildren.

Kombi Carrying Stolen Tyres Involved In Accident During High Speed Chase

By A Correspondent- The driver of a kombi carrying stolen tyres was nabbed after he was involved in an accident after a high-speed chase by the rapid response team from Junior Security Company.

Though the police were not available to give a comment immediately, some 112 brand new tyres of assorted type and sizes, and with a worth of over US$40 000 dollars, were recovered after the driver of the vehicle lost control of the kombi and it fell into a ditch.

A source who refused to be named said four robbers attacked and tied the Junior Security guard manning the Crown Duo tyre outlet close to Byword Motors in the industrial area of Masvingo.

They then loaded the brand new tyres into their Mazda kombi and into the trailer.

Unbeknown to them, the security guard, despite his hands being tied-up, had managed to pull out a small cell-phone from his pocket which he used to painstakingly sent an SOS text message to the security control room.

A rapid response team was then dispatched, only to find the robbers still loading their loot.

One of the robbers who acted as a sentry then alerted his colleagues that they had been busted and the overloaded kombi, tugging an overloaded trailer, took off at high-speed towards the VID Masvingo Depot but it fell just after the DocZine Fuels service station.

The ruffians, however, managed to extricate themselves from the wreckage and fled the scene on foot.

No arrest had been made by the time of writing after the police reacted hours later.

Police In Drug Trafficking Scandal

By A Correspondent- Some law enforcement agents who are supposed to secure illicit drugs seized during operations are reportedly working in connivance with drug syndicates in Harare, pocketing huge sums of money by selling the same opioids back on the streets, investigations by The Sunday Mail have revealed.

While police have taken action through a crackdown on drug peddlers which netted more than 200 drug hawkers and was hailed as a major victory in the war against drug abuse, the tentacles of the syndicates in the capital extend far beyond imagination.

In most suburbs, criminal dealers sell dangerous drugs to adults and children in broad daylight, often not taking too many precautions, while allegedly enjoying the protection of rogue cops.

What is more disturbing is that the suspected drug peddlers are enlisting the services of children roaming Harare’s streets as drug mules to avoid detection.

The innocent children “hawking sweets” have become part of a bigger drug syndicate rearing its ugly head in the capital.

Besides marijuana, other commonly distributed drugs are crystal methamphetamine — which has evolved to be commonly known as “guka, marijuana cakes and a prohibited cough syrup called BronCleer (Bronco).

National police spokesperson Assistant Commissioner Paul Nyathi confirmed that some police officers were indeed ‘conniving with drug peddlers’.

“We have received information in regards to police officers conniving with drug lords and we have since effected arrests on some of those officers,” he said, urging the public to pass on to the Police General Headquarters (PGHQ) any information that could be helpful in apprehending more culprits.

“The ZRP is on record as saying it has no place for such unruly elements.
“We have zero tolerance to corruption. Give us information on these unruly officers and ZRP will pluck them out.

“As long as there is any incriminating evidence, feel free to come forth. The police officer involved will face the full wrath of the law”.
Police are running drug abuse awareness campaigns countrywide with a view to conscientising the public about the devastating effects of the dangerous substances.

The CID Drugs and Narcotics section recently embarked on an operation to curb drug abuse code-named “No to drug and substance abuse” and a number of suspects were rounded up.

Drug abuse is also contributing to a rise in serious offences.
The Sunday Mail recently went behind the scenes to find out how the drug syndicates operate.

The former Zimex Mall area, located along Jason Moyo and Inez Terrace streets in the CBD, aside from being the location of popular mobile phone vendors and foreign currency traders, is now synonymous with the drug trade.

As money changers solicit customers, so do the suspected drug hawkers, mostly women and teenagers.

Purporting to be an interested client, this reporter approached multiple suspected drug dealers peddling illicit substances around the area.
“We only have codeine syrup and BronCleer – meth is now hard to come by, it is now expensive since police swoop on us,” a dealer identified as Jerald, (also known by his peers as Murungu), said.
Out here, everything is on the fast lane.
Dealers as well as buyers are wary of the police and security operatives who raid the location regularly.
As the conversation continued, the dealer furtively brandished bottles of BronCleer and codeine at the reporter’s request.
“With this one you will never go wrong,” said another dealer who came in from the opposite end.
He must have felt the transaction was taking too long.
As the deal was ongoing, other illicit drug vendors were either on the look-out for cops or beckoning on prospective customers.
But for Jerald ‘Murungu’, everything seemed normal as he went about his business unperturbed – calm and collected to the shock of this reporter.
We further learnt that Jerald enjoys special protection from some rogue cops whom many believe are the ones who supply him with seized drugs.
This was the same situation at Fourth Street and Cobacabana bus ranks, where suspected drug peddlers could be seen on both sides of the road discreetly exchanging money for different types of drugs, including codeine.
A security source – who we will not name because of the nature of his job, revealed that indeed some police officers were working with drug peddlers in the distribution of drugs in Harare.
He said the ring involves officers who are in strategic positions of influence and only sell to the rich and affluent.
What is so striking is that women seem to be the biggest mules and peddlers in these syndicates.
Residents – mostly from Mbare – said dangerous drugs have become a menace and accused some law enforcement agents of tipping-off well-known dealers in advance before they launch their raids.
In Mbare, this reporter was introduced to Natasha (surname supplied) who lives in Tagarika Flat D – and posing as a potential client, the woman hesitantly inquired about the person who had recommended this reporter to her.
After assuring her that we meant no harm, the lady told us that she deals in Crystal Meth.
Known scientifically as methamphetamine, Crystal Meth is a highly addictive stimulant popular for its powerful euphoric effects.
“Which one do you want so that I can collect it for you – you don’t have to go inside the flats because I am not sure where you are coming,” she said.
She sells it in grammes and has a mini-weight scale she uses to measure according to request.
A 10 gramme satchet of meth costs between US$5 to US$7.
Further inquiry from our sources revealed that Natasha works for a police officer called Chemuli (surname supplied), popularly known in the area as ‘Muchawa’.
“She is not even afraid because she knows ‘Muchawa’ will always come to her rescue. During a recent raid that netted almost every known drug peddler in the area – Natasha was left untouched,” revealed our source.
They also enlist the services of children as mules.
“These children are young and vulnerable to these drug peddlers because they too need money and have been denied their fundamental right to education,” said Loice Ruzha, a vendor and a mother who has been observing the trend for quite some time.
“There are also those who have been pushed to the streets to seek solace because of poverty, family breakdown and abandonment,” she added.
In a brief interview, Home Affairs and Cultural Heritage Minister Kazembe Kazembe said drug cartels will be hunted down.
“The Zimbabwe Republic Police is coming after all drug cartels peddling drugs in communities. The syndicates will be dealt with once and for all by law enforcement officers,” he said.

Zimglass, Zimbabwe’s sole producer of glass used to export to Malawi and Zambia, churning out 120 tonnes per week and employing 500 workers. It was one of the biggest companies in Gweru run by the state-owned IDC.

The Mirror visited the company and established that the sprawling 10-hectare premises located along Bristol Road in Gweru are now used as grazing and a cattle pen for Kwande’s 100 herds of cattle.

Patrick Chirombo a former HR Officer at Zimglass said it was painful to see the giant company sinking further into an abyss.

He attacked the government for giving the company to someone who has no capacity.

Gweru Mayor Josiah Makombe lamented the deal between IDC and Kwande as an economic disaster for Gweru. Zimglass closed shop in 2010.

The arrangement is a violation of the City’s by-laws which bans the keeping of cattle in the city.

The Mirror established that Kwande has also set up grinding mills at Zimglass where he is processing Premier maize meal that is sold in his …………supermarkets.

Kwande acquired the company through his Brainman Investments at a time when the new dispensation under President Mnangagwa promised a quick fix of defunct companies including CSC, Shabani Mashaba Mines and Zisco.

Kwande requested a face-to-face interview with The Mirror but failed to show up on numerous occasions.

Makombe said that it is illegal for Kwande to keep cattle in the city and a team of council workers would be dispatched to investigate. He said the grinding mills must be properly licensed for them to operate.

The glass produced by Zimglass was mainly sold to Delta Beverages, African Distillers, Mutare Bottling Company, Straitia Investments, Olivine Industries, Datlabs and E. Snell and Company.

“It is sad for the city and the country that the firm was bought by someone who cannot revive it. We needed an investor who comes to create jobs and wealth,” said Makombe.

Residents who spoke to The Mirror said Government assets in Gweru have become fruits for easy picking by those connected to Zanu PF leadership.

Moses Chikwadzi, a former secretary for the workers’ committee said Zimglass remains a strategic company to the country and called for immediate intervention.

He said that hundreds of workers including some who worked for the company for 30 years walked out of the company empty-handed. The understanding was that the workers were going to be paid their benefits from the proceeds of the sale of the company.

“It’s painful and l feel like crying. All workers walked out with nothing. We must be paid our benefits from the US$22m that IDC received from Kwande,” said Chikwadzi.

Chirombo dismissed the US$22m tag on the company and said there is evidence from lawyers that the company was sold for a song. He said it went for RTGS$22m

He described the price as peanuts considering that the company has machinery worth millions of dollars.

The Mirror understands that Kwande also got the industrial sand claim some 10km outside Gweru.

This is where sand used for making glass is obtained but instead of keeping the sand for glass making, this is now being sold to those building houses and moulding bricks.

Another Gweru Man Petrol Bombs Family

A 42-year-old Gweru man handed himself to the police after locking seven family members, including his wife and kids, in a house before petrol-bombing it after a domestic dispute.

Midlands provincial police spokesperson, Inspector, Emmanuel Mahoko confirmed the incident which occurred in Raylands suburb Gweru on Thursday night.

He said property was destroyed in the attempted arson attack while all family members escaped unhurt.

“The suspect, Darlington Miti (42) has since surrendered himself to the police and is now in custody. He is now facing attempted murder charges and will appear in court soon,” he said.

Insp Mahoko said those who escaped the arson attack were Miti’s wife Chipo Mafunda, her two children from a previous marriage, her 3-year child with Miti and two other family members.

“It is said Miti had a misunderstanding with his wife on Wednesday night. He then left the house only to return home around 2am the following morning armed with a five litre container full of petrol. He then sprinkled the fuel around the house before setting the house on fire together with the wife’s car which was parked outside,” he said.

When The Herald newscrew visited the house yesterday, Ms Mafunda and other family members were busy cleaning the house while throwing away some of the burnt property.

Ms Mafunda told The Herald that they were lucky to be alive after the arson attack from her husband whom she described as a suicidal character.

She said Miti committed the crime some weeks after he attempted to kill himself by consuming poison.

“We have been having some problems in this marriage and recently he wrote a suicide note and later consumed termite poison. We rushed him to the hospital and he spent two weeks in the intensive care unit. He was about to recover but still on medication,” she said.

Ms Mafunda said she is into some business and was fending for the family but Miti was now accusing her of infidelity.

She said on the fateful day, he came home charging while accusing her of seeing other men but without corroborating the allegations.

“He has for a long time, been threatening to kill me and the kids while accusing me of infidelity but I would always ask him to provide evidence because I knew I was clean. He was just insecure because I had become the breadwinner for the family with my business ever since he lost his job some few years back but he was still in denial,” she said.

Ms Mafunda said Miti left home on Wednesday night without communicating where he was going only to come back home at around 2am the following morning armed with some petrol.

“He then started throwing stones at our bedroom where I was sleeping, damaging window panes before he sprinkled petrol on my car which was parked outside and around the house. He then petrol-bombed the house through the bedroom where our three-year-old girl was sleeping,” he said.

Ms Mafunda said she managed to rescue the minor in the bedroom where the fire started before it spread into other rooms.

“Some neighbours then responded to the screams for help and we managed to put out the fire but some of the property had already been damaged,” she said.

The belated World Press Freedom Day commemorations were held yesterday throughout the country.

MISA-Harare Advocacy committee held its event at Mungate shopping centre in Domboshava where villagers raised concern over delays by the government to licence community radio stations.

Locals said their area was lagging behind developmental programs because of limited access to information.

The villagers said they wanted the government to establish a community radio in their area so that they could discuss issues that concern their area.

The meeting was attended by village heads, church leaders, local political leadership women and youths.

Apostle Chiwenga Says Quit MDC Alliance Let’s Just Focus On Getting Peace.

By A Correspondent | The controversial street preacher, Talent Chiwenga has somewhat proved his identity by announcing that the MDC Alliance party is now irrelevant, and all Zimbabweans need is to pursue peace. The latter phrase is a theme speech of the ZANU PF President Emmerson Mnangagwa for several years to date.

In the sermon, Chiwenga said MDC is not into serving the interests of Zimbabweans. He added saying they just want job posts .

He said when MDC voted to impeach the late President Robert Mugabe in 2017, “they trampled on the very principles which they say they stand for in their manifesto, and as their party ideology.”

Chiwenga’s aide, Thomas Marange, then quipped in with the following, “they wanted positions,” to which Chiwenga screamed back exclaiming,

“Vaida zvigaro! They forgot the principles and they salivated for political positions, that’s a bad precedence.”

“And that’s what our problem is today, our problem is does the MDC have an interest in serving the people of Zimbabwe, or they only condemn ZANU PF because they themselves are not in power, because when something is wrong it should not be condemned by someone else, but when it is done by you it is fine, something that is wrong should be principally wrong across the board; so they and now complaining that the military and the police were involved in the factions that were in ZANU PF.

“If they want to attract the attention of real thinkers and sober thinkers in Zimbabwe, to join them or to identify with them, to sympathise with them they have to revise their methods of trying to get relevance at any given time… MDC at that point scored an own goal.

“They scored themselves up,” he said.

“That’s why you have to know what is right before you say which party you support because you will end up in danger, after choosing a party that is getting lost because you rushed to get identified by it, before you got to know what exactly they stand for.

“Our problem is in identifying our common goals as Zimbabweans, as for myself what I want is a peaceful environment and I think that is not an expectation that is far fetched, and far stretched, it is an institution and a constitutional expectation. We have to have a peaceful environment, as Zimbabweans it doesn’t matter who is our president, we don’t have much interest in that, we don’t care where you come from you come from Midlands or Manicaland,” he added.

In February, his mother in law, Vivian Yafele revealed that before the accident that killed his wife, in which he was the driver, he had over the 3 years prior this, secretly married a small house Tariro Mafuka who he smuggled to South Africa and the latter would only return just after the Chatsworth- Masvingo Road accident. He served her papers and lied to her that he had copied Simba Chikanza, issuing her. 30 day demand which period has since expired at end of March.

He is also known for announcing saying truck drivers are lazy, adding that a person who gets to the age of 40 driving a truck is in a worthless career.

Mnangagwa Rewards Gutu For Selling Out

By A correspondent-President Emmerson Mnangagwa last week rewarded former MDC spokesperson Obert Gutu for selling out.

Gutu was among the six new National Peace and Reconciliation Commission (NPRC) commissioners who were sworn in by Mnangagwa at State House.

The six commissioners are replacing commissioners whose terms have expired and will serve under the chairmanship of Justice Selo Nare who was only appointed in 2018.

Gutu, is also a former and deputy justice minister during the all-inclusive government between 2009 and 2013.

He joined ZANU PF in March this year.
The other commissioners are Donwell Dube and Tinashe Rukuni, Reverend Chiropafadzo Moyo of the Evangelical Lutheran Church in Zimbabwe, former deputy police commissioner-general crime Josephine Shambare and Nomaqhawe Gwere.

Zanu PF At It Again, Denies Opposition Members Food Aid

Zanu PF officials in Matabeleland North’s Tsholotsho district are accused of denying opposition supporters food aid as the ruling party starts campaigning ahead of the 2023 elections.

According to the latest monitoring report by the Zimbabwe Peace Project (ZPP),  in one incident in Tsholotsho South, citizens were told by Zanu PF activists only identified as Fani Moyo and Lameck Tshuma that in order for them to benefit from food aid, they had to be part of the Zanu PF cell groups in the area.

“As in other provinces, food and other aid have remained tools of political manipulation for poor villagers,” ZPP said in the report.

You Are Worse Than Mugabe, Mnangagwa Told

MTHWAKAZI Republic Party (MRP) leader Mqondisi Moyo says state-sponsored persecution has inspired him to cause government sleepless nights as he described President Emmerson Mnangagwa as worse than the late Robert Mugabe.

Moyo has not been staying at his home since March 12 claiming that he is in hiding fearing possible arrest, or kidnapping after leading MRP activists in a surprise protest outside Bulawayo Central police station days before.

Police fired warning shots to deter MRP activists, who were threatening to storm the station as they protested the alleged harassment and intimidation of their leader.

Nine MRP activists were arrested during the protest and detained at Khami maximum prison for over a month.

They were only released a fortnight ago by Bulawayo High Court judge Justice Evangelista Kabasa.

They are set to appear in court later this month facing public violence charges.

In an interview, Moyo, a former civil servant who said he had been arrested over a dozen times since the formation of the party in January 2014, said state-sponsored persecution and harassment had hardened him and his party followers.

He said he now understood that politics was his calling that he cannot run away from.

He added that in the process of that fear and persecution, he was being motivated and inspired to do more because it ruffing sent a message that, whatever he was doing with his colleagues in the MRP, really getting to this government.

Moyo said if whatever they were doing was not shaking the authorities, they would not be facing these arrests.

He said he was also encouraged that whatever persecution they were enduring, they (ministers, Zanu PF and government officials) also went through them during the Smith regime era.

Moyo said he believed state security agents wanted to abduct and possibly kill him when they raided his home in March. He revealed that state security agents have also been visiting his relatives asking about his whereabouts.

“I think I have been arrested over 17 times and in all the arrests, police had never come to my house at night as was the case on March 10,” he said.

“It was a first; it was unique and I feel that those people either wanted to kill me or kidnap me,” Moyo said.

“To this day, they continue visiting the residential homes of my relatives interrogating them about my whereabouts.

“They have not given up on my persecution, but whether they kill me or not, the seed has already been planted.”

Moyo bemoaned alleged state-sponsored human rights violations in the country under Mnangagwa, saying the MRP had suffered worse persecution than they endured under  the Mugabe  era.

“I think Mnangagwa’s era is even worse than that of Mugabe,” he said.

“So many arrests of our members have happened during Mnangagwa’s era more than Mugabe’s era. He is even worse than Mugabe. He has exposed his true colours,” Moyo said.

Human rights watchdogs have recorded countless rights violations since Mnangagwa assumed office.

Armed soldiers and police have killed protesters participating in anti-government demonstrations, and arrested opposition activists with many facing various charges.

Some activists have been abducted, tortured and left for dead.

Chicken Inn, Pizza Inn Threatened With Closure

THE Bulawayo City Council (BCC) has condemned some major food outlets in the city, including Chicken Inn and Pizza Inn outlets and a number of butcheries and has given them warnings to improve their hygienic levels or face closure.

The local authority carries out routine spot checks on restaurants, butcheries and all facilities that deal with food to ensure adherence to by-laws and that they do not expose the public to health hazards. According to the latest council report four restaurants, three food factories and six butcheries were condemned and warned to improve their hygiene.

The condemnations came out after BCC put up a programme targeting food premises in the Central Business District for compliance where health and hygiene education was also given to food handlers during inspections.

The affected outlets are; Pizza Inn (Jason Moyo branch), Chicken Inn (Jason Moyo branch), Eastern Delights Takeaways, Fish and Chip King Takeaways (9th Avenue), Mr Chips Takeaways (Fife Street branch), Mumsie”s Kitchen Restaurant, Sunrise Meats (Pelandaba), Zimbabwe Cash Butchery (Pelandaba), Oceans Foods Butchery (Pelandaba), Ramcode Butchery (Pelandaba) and Matabele Meat Market (Nkulumane), which all recorded a grading of C. Creamy Inn (Jason Moyo branch) and Snappy’s Butchery both recording a grading of C minus.

“The results were shared with the area environmental health officers who were assisting the premises to maintain hygiene status. Grade C indicates that the standard of hygiene in most of the food outlets was unsatisfactory.

Environmental health officers were to intensify inspections and health education to prevent food-related illnesses,” reads the report.

During the exercise the local authority’s health inspectorate department condemned seven, one litre soft drinks and 44, 500 millimetre soft drinks which had expired but were displayed at various supermarkets for sale.

An uninspected beef carcass and head were also condemned from a butchery in the CBD. Clarifying on the move, BCC director of health services Dr Edwin Sibanda said this was the first step they take, with the institution required to adhere to laid down hygiene procedures or risk being closed down when found to be retaining unsatisfactory results.

“What we usually do is we take swabs from people’s hands, sometimes going up to the rectum, from the facilities’ surfaces even utensils, which we send to our labs. If the results come out unsatisfactory, we go back after a period and re-swab, advice and teach the affected institution to guide them such that they move away from the unsatisfactory level.

We continue monitoring them but if we note that there is no improvement, then we are forced to invoke some of our by-laws which may allow us to even close the place temporarily or for a long time,” said Dr Sibanda.

He said the move was not necessarily meant to shut down the premises but just to protect the general public from being exposed to health hazards.

One Dead, Five Hospitalised After Eating Poisoned Porridge

IN an incident that has shocked residents of Old Magwegwe in Bulawayo, a four-year-old boy died while five of his relatives and neighbours are battling for life at Mpilo Central Hospital after they reportedly ate porridge suspected to have been laced with poison yesterday.

The incident reportedly happened at around 11 am and resulted in the four-year-old dying within minutes after consuming the porridge. Three other boys aged eight, 12 and 18 are said to be in a critical condition. Two other children from the house next door who also tasted the porridge are said to be in a stable condition.

Bulawayo provincial police spokesperson Inspector Abednico Ncube said he could not readily comment on the matter but when Sunday News visited the house yesterday at around 3pm, the body of the deceased was still in the house with police taking statements from family and neighbours.

A spokesperson for the Siyanzembwe family, Ms Ethel Munkuli said she was called by neighbours to go and find out what was happening at her mother-in-law’s house after the children were seen vomiting.

“The deceased and the three other boys in a critical condition reside together with my mother-in-law who was at work. From what we gathered, the 18-year-old Donald Mudimba cooked porridge which he shared with three other boys aged four, eight and 12 as he usually does because he is the one who looks after them when my mother-in-law is at work.

There were two other kids from next door who also tasted the porridge while playing there. However, Donald started having a running tummy and he went to relieve himself. The four-year-old boy then started eating Donald’s porridge resulting in him being more critical and dying before being ferried to hospital,” said Ms Munkuli.

She noted that at first when she arrived at the house, which is a street away from her house, Donald was vomiting non-stop and in a state of shock. Ms Munkuli said she thought Donald had been bewitched so she rushed him to a nearby prophetess to seek for prayers.

“While we were praying for Donald I was then called again and told the other three boys were now vomiting as well. We then asked Donald who said they ate porridge only a few minutes ago. We then called the ambulance but by the time it arrived the four-year-old boy was no longer breathing. The three boys and two kids from next door were then ferried to Mpilo hospital together with the pot of the porridge and the sugar they used.”

While other neighbours were suggesting that Donald could have used a pesticide instead of sugar, Ms Munkuli said the sugar was in a normal sugar packet and it was “the usual brown sugar”.

The 18-year-old boy and the 12-year-old boy are said to be siblings to Ms Munkuli’s husband, while the eight-year-old boy and four-year-old boy are her mother-in-law’s grandchildren.

Ambassador Mutsvangwa who was quickly whisked away by an AirForce vehicle, confirmed the development with ZimEye.com early Saturday morning.

The accident happened at intersection of Airport Road and St Patrick’s.

The man’s Discovery vehicle was severely damaged at the front in what could easily have been a fatal accident.

Explaining the development, ambassador Mutsvangwa told ZimEye someone who went through a red robot smashed into his car.

“He miscalculated but nobody got hurt for sure,” ambassador Mutsvangwa told ZimEye.

The identity of the other driver had not been disclosed at the time of writing.

Government Official Caught In Passport Scam

A WOMAN employed as a general hand at the Registrar-General’s Central Registry Headquarters in Harare was arrested last week after allegedly receiving a bribe from a desperate passport applicant.

She reportedly promised to facilitate the expeditious processing of the document but, however, failed to deliver.

Detectives from the Zimbabwe Anti-Corruption Commission (ZACC) pounced on Gloria Mashanda (30) of Warren Park following the botched cash-for-passport deal with Tofara Mapundu, a Namibia-based Zimbabwean.

In a statement, ZACC spokesperson Commissioner John Makamure said Mashanda failed to deliver on her undertaking, after which the matter was reported to the authorities. “Sometime in March 2021, the complainant was approached by Tofara Mapundu, a female Zimbabwean who is based in Namibia, to assist her in applying for a Zimbabwean passport,” said Comm Makamure.

“She gave her the passport application form that had already been filled in with her personal details to submit to passport offices at Makombe Complex, Harare, on her behalf.”

Mashanda charged Mapundu a substantial amount of money which was delivered through an emissary.

“The complainant gave the accused US$318 for passport application and US$110 as the facilitation fee, which is a combined total of US$428, and the passport application form in the name of Tofara Mapundu for passport processing.”

The accused promised that Mapundu’s passport would be processed and ready for collection in a fortnight from the date the accused was given the application form.

After the agreed two-week period lapsed before the passport was delivered, Mashanda started evading the complainant.

“After the expiry of the agreed two-week period, the complainant started making enquiries for Tofara Mapundu’s passport from the accused, but the accused started to be evasive.

“The complainant approached Makombe Complex passport offices to verify whether Mashanda had submitted the application, only to be told that there was no record of her application.

“The accused did not facilitate the passport application in the name of Tofara Mapundu but converted US$428 she was given by the complainant to her own use,” added Comm Makamure.

Mashanda appeared in court yesterday and was remanded in custody to May 10.- The Sunday Mail

SOME police officers who are supposed to secure illicit drugs seized during operations are reportedly working in connivance with drug syndicates in Harare, pocketing huge sums of money by selling the same opioids back on the streets, investigations by The Sunday Mail have revealed.
While police have taken action through a crackdown on drug peddlers which netted more than 200 drug hawkers and was hailed as a major victory in the war against drug abuse, the tentacles of the syndicates in the capital extend far beyond imagination.

In most suburbs, criminal dealers sell dangerous drugs to adults and children in broad daylight, often not taking too many precautions, while allegedly enjoying the protection of rogue cops.

What is more disturbing is that the suspected drug peddlers are enlisting the services of children roaming Harare’s streets as drug mules to avoid detection.

The innocent children “hawking sweets” have become part of a bigger drug syndicate rearing its ugly head in the capital.

Besides marijuana, other commonly distributed drugs are crystal methamphetamine — which has evolved to be commonly known as “guka, marijuana cakes and a prohibited cough syrup called BronCleer (Bronco).

National police spokesperson Assistant Commissioner Paul Nyathi confirmed that some police officers were indeed ‘conniving with drug peddlers’.

“We have received information in regards to police officers conniving with drug lords and we have since effected arrests on some of those officers,” he said, urging the public to pass on to the Police General Headquarters (PGHQ) any information that could be helpful in apprehending more culprits.

“The ZRP is on record as saying it has no place for such unruly elements. “We have zero tolerance to corruption. Give us information on these unruly officers and ZRP will pluck them out.

“As long as there is any incriminating evidence, feel free to come forth. The police officer involved will face the full wrath of the law”.

Police are running drug abuse awareness campaigns countrywide with a view to conscientising the public about the devastating effects of the dangerous substances.

The CID Drugs and Narcotics section recently embarked on an operation to curb drug abuse code-named “No to drug and substance abuse” and a number of suspects were rounded up.

Drug abuse is also contributing to a rise in serious offences. The Sunday Mail recently went behind the scenes to find out how the drug syndicates operate.

The former Zimex Mall area, located along Jason Moyo and Inez Terrace streets in the CBD, aside from being the location of popular mobile phone vendors and foreign currency traders, is now synonymous with the drug trade.

As money changers solicit customers, so do the suspected drug hawkers, mostly women and teenagers.

Purporting to be an interested client, this reporter approached multiple suspected drug dealers peddling illicit substances around the area.

“We only have codeine syrup and BronCleer – meth is now hard to come by, it is now expensive since police swoop on us,” a dealer identified as Jerald, (also known by his peers as Murungu), said.

Out here, everything is on the fast lane. Dealers as well as buyers are wary of the police and security operatives who raid the location regularly.

As the conversation continued, the dealer furtively brandished bottles of BronCleer and codeine at the reporter’s request. “With this one you will never go wrong,” said another dealer who came in from the opposite end.

He must have felt the transaction was taking too long. As the deal was ongoing, other illicit drug vendors were either on the look-out for cops or beckoning on prospective customers.

But for Jerald ‘Murungu’, everything seemed normal as he went about his business unperturbed – calm and collected to the shock of this reporter.

We further learnt that Jerald enjoys special protection from some rogue cops whom many believe are the ones who supply him with seized drugs.

This was the same situation at Fourth Street and Cobacabana bus ranks, where suspected drug peddlers could be seen on both sides of the road discreetly exchanging money for different types of drugs, including codeine.

A security source – who we will not name because of the nature of his job, revealed that indeed some police officers were working with drug peddlers in the distribution of drugs in Harare.

He said the ring involves officers who are in strategic positions of influence and only sell to the rich and affluent. What is so striking is that women seem to be the biggest mules and peddlers in these syndicates.

Residents – mostly from Mbare – said dangerous drugs have become a menace and accused some law enforcement agents of tipping-off well-known dealers in advance before they launch their raids.

In Mbare, this reporter was introduced to Natasha (surname supplied) who lives in Tagarika Flat D – and posing as a potential client, the woman hesitantly inquired about the person who had recommended this reporter to her.

After assuring her that we meant no harm, the lady told us that she deals in Crystal Meth. Known scientifically as methamphetamine, Crystal Meth is a highly addictive stimulant popular for its powerful euphoric effects.

“Which one do you want so that I can collect it for you – you don’t have to go inside the flats because I am not sure where you are coming,” she said.

She sells it in grammes and has a mini-weight scale she uses to measure according to request. A 10 gramme satchet of meth costs between US$5 to US$7.

Further inquiry from our sources revealed that Natasha works for a police officer called Chemuli (surname supplied), popularly known in the area as ‘Muchawa’.

“She is not even afraid because she knows ‘Muchawa’ will always come to her rescue. During a recent raid that netted almost every known drug peddler in the area – Natasha was left untouched,” revealed our source.

They also enlist the services of children as mules.

“These children are young and vulnerable to these drug peddlers because they too need money and have been denied their fundamental right to education,” said Loice Ruzha, a vendor and a mother who has been observing the trend for quite some time.

“There are also those who have been pushed to the streets to seek solace because of poverty, family breakdown and abandonment,” she added. In a brief interview, Home Affairs and Cultural Heritage Minister Kazembe Kazembe said drug cartels will be hunted down. “The Zimbabwe Republic Police is coming after all drug cartels peddling drugs in communities. The syndicates will be dealt with once and for all by law enforcement officers,” he said. -Sunday Mail

The cleric further declared that Mwonzora would never stand for the people’s interests.

According to the preacher, the demon is also controlling some of Mwonzora’s top allies.

One ex -MDC-T leader claimed that Makomichi wrote a letter to Douglas Mwonzora early this year, telling him not to lead any group of people because the demon was misleading him.

Makomichi also reportedly invited Mwonzora to Masvingo for deliverance .

However sources say Mwonzora rejected the invitation.

“The letter states that we should stay away from Mwonzora.He was instructed not to lead anyone until the demon is removed.

I think Makomichi is right,”said an MDC-T official.

Giants Real Madrid, Barca, Juve Stick To Super League Project

Fútbol Club Barcelona, Juventus and Real Madrid Club de Fútbol have refused to abandon their European Super League (ESL) project despite the withdrawal of the other 9 founding clubs from the competition.

In a joint statement issued this Saturday in response to the statement released by UEFA on the 7 May (yesterday) in respect of the Super League, the three clubs said they continue to experience unacceptable third-party pressures and threats to force them to abandon the project.

The three clubs urged FIFA and UEFA to observe the rule of law by adhering to a court ruling that ordered them to, either directly or through their affiliated bodies, refrain from taking any action which may hinder the ESL in any way while court proceedings are pending.

The clubs insisted that the material issues that led the 12 founding clubs to announce the Super League weeks ago have not gone away. They wrote:

… we reiterate that to honour our history, to comply with our obligations towards our stakeholders and fans, for the good of football and for the financial sustainability of the sector, we have the duty to act in a responsible manner and persevere in the pursuit of adequate solutions, despite the unacceptable and ongoing pressures and threats received from UEFA.

Furthermore, we reiterate to FIFA, UEFA and all football stakeholders, as we have done on several occasions since the announcement of the Super League, our commitment and determination to discuss, with respect and without intolerable pressure and in accordance with the rule of law, the most appropriate solutions for the sustainability of the whole football family.

The statement comes after UEFA has fined nine out of twelve clubs that sought to join a breakaway European Super League last month.

The nine clubs involve six Premier League sides – Arsenal, Liverpool, Manchester United, Manchester City, Chelsea and Tottenham Hotspur plus Italian pair of AC Milan and Inter Milan, and La Liga’s Atletico Madrid.

By Dr Masimba Mavaza | The present Constitution of Zimbabwe became fully operational on the 22nd August, 2013, having been assented to on the 22nd May, 2013, by the President as Amendment (No. 20) Act, and published on that same day. So the utterances by some panelists that the constitution was not yet law is false and seriously misleading.

However the Constitution of Zimbabwe amendment bill number 2 of 2019 sets out a number of clauses it sought to amend or repeal. We must remember that Zimbabwe practices representative democracy, so the vote of parliamentarians represents each and everyone in their constituencies.
We will analyse clause by clause of the Bill in showing that the amendment is meant in all fairness to be catering for the best interests of Zimbabweans.

While people are bound by law they remain the custodian of the same law which binds them. Society is not slaves to law when the law becomes unbearable society is legally expected to change the law and to conform to it.

The Bill had clauses which can be summarised as:
Clause 1
This clause sets out the Bill’s short title. It gives the Bill its name.
Clauses 2, 3, 4, 5, 6, 7 and 8
These clauses dispense with the “running-mate” concept of the Vice-Presidency. Instead, the 2 Vice-Presidents will be chosen on the President’s own authority.
Clauses 9
This clause adopts the provisions of paragraph 14 of the 6th Schedule to the Constitution as the operative provisions relating to the question of the succession to the Presidency (given that the Vice-Presidents are not elected as running mates).
Clause 10
Under this clause the President may appoint up to 7 (instead of 5) additional Ministers from outside Parliament.
Clause 11
This clause extends the provision for the party-list women members of the National Assembly by another two extra Parliaments (from 2 to 4 Parliaments), and makes provision for the party-list representation of youths in the National Assembly.
Clause 12
This clause de-couples ZEC’s delimitation function from the population census held every 10 years.
Clause 13
This clause will allow the President acting on the recommendation of the JSC to appoint sitting judges to vacancies in the higher courts, without subjecting them to the public interview procedure.
Clause 14
This clause will allow Judges of the Constitutional Court and Supreme Court to extend their tenure after reaching the age of 70 annually for up to 5 years, subject to a favourable medical report as to the mental and physical fitness of the judge so to continue in office.
Clause 15
This clause rewords the functions of the Public Service (previously called the Civil Service).
Clause 16
This clause provides for the appointment and role of the Chief Secretary to the Office of the President and Cabinet and his or her deputies.
Clauses 17 and 18
These clauses create the office of the Public Protector, who will take over certain functions concerning public maladministration, etc, from the Zimbabwe Human Rights Commission.
Clause 19
This clause will provide for the appointment of the Prosecutor-General by the President on the advice of the JSC, without the intervention of a public interview procedure, and makes special provision for his or her removal for cause by a Tribunal.
Clauses 20, 21, 22 and 25
These clauses remove members of Parliament from the membership of provincial councils, merge the provisions relating to provincial and metropolitan councils by removing the special provisions relating to the latter (they will no longer be chaired by mayors, but be elected in terms of section 272 like provincial councils), and provide for the election of 10 of the members of Metropolitan Councils by a system of party-list proportional representation.
Clause 23
This clause uses the defined term “international organisations” in subsection (3)(a) instead of “foreign organisations or entities”, which term is undefined in the Constitution.
Clause 24
This clause repeals the definition of “Civil Service” and replaces it with a definition of “Public Service”.
Clause 27 and Schedule
This clause provides for minor amendments to the Constitution (mainly the substitution of references to the “Civil Service” or “Civil Service Commission” by references to the “Public Service” and “Public Service Commission”)

The opposition in different face became prophets of doom by saying that Zimbabwe is descending into a constitutional crisis with the recent amendment to the national constitution. Amendment No. 2 has seen the most efficient and fast way in its going through all stages until it’s lying flat on the President’s desk. Its journey through parliament and Senate was so efficient and seen very little drama thanks to the martyring of the opposition. On Tuesday 4 May 2021 it was passed by senate with little opposition and just 3 days later, President Emmerson Mnangagwa assented to it a circumstance that marked the commencement of the amendment’s life as a law. The President did not waste time he lived right to his word hit the ground running.
The efficiency in putting the amendment to law had nothing to do with Chief Justice Malaba’s birthday. The fact that the president discharged his duties with such amazing speed does not mean he was motivated by age of the Chief Justice somewhere.
While 70 years was the mandatory age of retirement for judges in Zimbabwe the new law allows the president to extent the tenure in office. All we can say is that this was entirely a very good coincidence. The amendment extends the retirement age of judges to 75 years, so the tenure of the Chief Justice is now extended by law. It is not the misleading reasons being flown around by those who are refusing to accept that president Mnangagwa and his government are doing their best to lead by example.

In order for these amendments to be done a lot of consultations have been done. This was not done by one person as it is alleged by the MDC Chamisa and some of their wailers around the world. There has been a broad based consultative process in which one hundred and twenty-six (126) organisations that include but are not limited to civil society organisations (CSOs) and community based organisations (CBOs) that are working on varying mandates in Zimbabwe took part. They came with their own analysis to show that Zimbabwe government does follow and abide by the rule of law. The Civic societies responded to the intention by the Parliament of Zimbabwe to institute further process to effect amendments to the Constitution of Zimbabwe Amendment (No.20) Act 2013. The civic organisations took a position and provided an overview of the proposed amendments, summary of each section of the amendment, a brief analysis and recommendations on the way forward. It must be borne in mind that on the 17th December 2019 Cabinet approved the formulation of the Constitutional Amendment (No.2)-H.B.23, 2019 that would amend several provisions of the Constitution of Zimbabwe. The Bill was published in a Government Gazette Extraordinary on 31 December 2019. The Bill was published again on 17 January 2020 to correct the anomaly which had occurred in the initial publication where the clerk and not the speaker had gazetted the Bill contrary to the Constitution. The Bill proposes amendments to provisions relating to these broad thematic areas;
1) Judiciary: Appointment of judges to the superior courts, retirement ages of judges;
2) Prosecution: Appointment and removal of the Prosecutor General;
3) Election processes: Removal of running mate provisions, extension of proportional representation
provisions for female parliamentarians, proportional representation of youths in parliament;
4) Composition of executive: Number of unelected ministers that can be appointed;
5) Legislative oversight role: Oversight and approval of agreements
It is therefore not true that the amendments were rushed through. It is again not correct to say that the government took advantage of the COVID 19 to dribble the people. In 2017 no one was even aware that there will be something coming called Covid 19. Such allegations against Zimbabwe are demonic devilish and total idiocy of those alleging it like Dhewa Mavhinga and Dzvokora who have graduated in demonising whatever is Zimbabwean.
We must remember that the Constitution was voted for by an overwhelming majority of Zimbabweans. The Constitution is the supreme law (highest law) in Zimbabwe, over the last forty one years, we remain upbeat that Zimbabwe has become one of the best African nations to be bound by its constitution.
The amendments introduced, address issues that covered all Zimbabweans. The extension of the women’s quota system addressed the area which many countries have failed to address. The Zimbabwe Election Commission had failed to fully implement provisions of the Constitution on gender equality as provided in the National Objectives chapter, neither did the opposition suggest a change through an amendment to the Electoral Act to fully align electoral laws and regulations with the Constitution. All what the opposition did was to cry for electoral reforms without raising a motion in parliament.
Thanks to the amendments because there was no legislative or administration measures which could be taken to safeguard youth participation. The delimitation provisions could have simply been addressed by aligning the Census and Statistics Act with the Constitution but the MPs did not. The full amendments came as a relief. The provisions will consolidate executive powers, without eroding any existing checks and balances currently provided for. Contrary to the falsehoods being spread around there is no centralisation of power in the President.
The provisions are an active participatory democracy. The amendments are necessary and ascertain that the issues could not have been resolved through other legal reform measures. If we were to take these matters to court the opposition will say the judiciary is compromised. So in short the amendments are indeed reasonably justifiable in a democratic society and they uphold the objectives as set out in the Constitution of Zimbabwe, 2013.
Clauses 2, 3, 4, 5, 6, 7, 8
(Sections 91,92,93,94,95,97 & 101)
These clauses removed the provisions that relate to election of Vice Presidents, or that tie the assumption of office of the Vice President, the terms of office of Vice Presidents to that of the President (sections 91, 92, 93, 94, 95, 97 & 101 of the Constitution). This gives the president the privilege of choosing his team. It was a mistake to chose a team for the coach. Coaches are at their best with their own team.
The running mate clause would have created an unstable presidium. Imagine a Vice President who does not care about his principal.
According to the amendment, in the event of resignation, death or incapacitation of the President, the ruling party has power to nominate a President to take over for the rest of the term. This is a universal practice. Most countries do that, as was done in Tanzania when Magufuli passed on and again in Malawi when the President passed on her Vice President Banda became President.

The President to appoint up to 7 (instead of 5) additional Ministers from outside Parliament. This gives the nation a chance to benefit from professionals and not politicians.
Since these are executive appointments, solely made by the President there is a guarantee that these appointments will be based on need, and motivated by the experience and expertise of those to be appointed.
Again the extension of the quota for women by two more terms is progressive and must be applauded for attaining women representation. This ensures robust participation of women in electoral processes.
It will also increase the number of women who participate in competitive elected positions as there will be many places to compete for.
So it should be stated clearly that the amendments do not pause a Constitutional Crisis.
A constitutional crisis generally refers to a situation where the existing constitutional mechanism is unable to resolve a fundamental political problem or where the constitutional mechanism has become so broken that it leads to a stand-off or a never-ending chain of illegalities. So this has been avoided by these amendments.

The constitution is the supreme law of a country and it is supposed to have mechanisms to resolve political disputes and other problems.
One of the highly misrepresented amendment is Clause 13
(Section 180).

This clause will allow the President acting on the recommendation of the JSC to appoint sitting judges to vacancies that may arise in the higher courts, without subjecting them to the public interview procedure. The detractors are making it appear as if the president just appoints or promotes a judge completely alone. Section 180 (2) (c) of the current Constitution prescribes public interviews for prospective candidates who wish to be appointed as judges of superior courts. The proposal for the President to appoint judges to the superior courts after consultation with the Judicial Service Commission (JSC) is a welcome move. It Completely removes the present public humiliation, that ensured that judges will be appointed following a public interview process that is humiliating and never guaranteed a public scrutiny. The final selection despite the public interviews was done in a private office by a few without public input.

Older democracies that have long-standing political practices and traditions have the advantage of having developed these unwritten understandings that operate silently to avert crises. In these older democracies Judges are appointed by the government and or national leader. There is no way a judge should be subjected to an election campaign. The judge must only be answerable to The Law of the land.

We expect the opposition to applaud the president of Zimbabwe and his government for the efficiency they have shown in the bringing this bill to law.

The minister of Justice Honourable Ziyambi Ziyambi will bag this one as a great achievement and the parliament and the house of senate will go into history as the ones who have made significant changes to Zimbabwean laws. [email protected]

New data finds that even listening to recordings of nature can boost mood, decrease stress, and even lessen pain.

The whoosh of wind through a stretch of forest, birds calling to one another as they land on branches, the gurgle of a brook over a rocky bed — these are the kinds of sounds that are not only calming, but could have profound health and well-being benefits, according to a research review in the April 2021 Proceedings of the National Academy of Sciences.

For the review, the researchers looked at 18 studies investigating the health benefits of natural sound; study participants listened to recordings of outdoor sounds in laboratory settings. Participants reported less stress and improved health outcomes, like decreased pain, after listening to recordings of nature sounds.

Water sounds, such as that gurgling brook or a steady waterfall, tended to be the most effective at improving positive affect (the psychological term for a more positive outlook or disposition and the experience of joy and interest), while bird sounds were best for lowering stress.

The study’s lead author, Rachel Buxton, PhD, a research associate and conservation biologist in the Department of Biology at Carleton University in Ottawa, says she isn’t surprised by the findings. “From an evolutionary perspective, humans are hardwired to attend to signals of danger and security. And an environment that is filled with natural sounds feels safe and allows us to let our guard down,” she says.

This research adds to a substantial body of evidence that proximity to nature and time spent outdoors is good for human health and well-being.

Research Shows Green Space Benefits Health in Many Ways
Research published in June 2019 in Scientific Reports found that people who spent just two hours per week outside in a natural setting (including town parks, state parks, woodlands, and beaches) reported greater well-being compared with people who spent less time outdoors.

Former Zimbabwe national netball team coach Ledwin Dondo has died.

She was 74.

Dondo, a decorated administrator and coach is fondly remembered for helping to set up structures for organised netball in the country, forming the Netball Super League in 1993 together with Eva Chirwa.

She held a number of portfolios in netball, she was the Zimbabwe Netball Association president from 1996 up to 2002 after taking over from Chirwa.

Dondo holds the record of longest serving coach in the country and the region as she coached the national team from 2000 up to 2017.

In 2018 she was appointed the Gems team manager and played a key role in the team qualifying for the World Cup in Liverpool in 2019.

Truck Driver Wrestles Knife Wielding Robbers

By A Correspondent- A truck driver last week escaped death by a whisker along Masvingo-Beitbridge road after wrestling two knife-wielding robbers attacked him while his truck was in motion.

Palmer Kativhu (46), was robbed of US$60 and R50 by the two robbers after he had put up a spirited fight against them.

The robbers ended up holding to the steering wheel of the truck, prompting him to stop the vehicle.

Matabeleland South provincial police spokesperson Inspector Loveness Mangena confirmed the incident yesterday.

She said:

Palmer Kativhu was driving from Masvingo to Beitbridge and picked up two men from Ngundu business centre who claimed were going to Beitbridge.

On reaching 220 km peg road near Joko turn off, one of the suspects produced a knife and ordered the driver to park in the bush.

The suspects escaped after another driver, who had noticed the melee, stopped his truck.

Cops Rob Cigarettes Smuggler

By A Correspondent- Four serving members of the Zimbabwe Republic Police (ZRP), working with three civilians allegedly robbed a man who was attempting to smuggle boxes of cigarettes to South Africa.

Two of the police officers were armed with rifles when the gang intercepted Comfort Matombo (36) who was transporting 20 boxes of Remington gold blue cigarettes worth US$2 500 along the Beitbridge-Chikwalakwala road and confiscated his contraband.

Matombo reported the matter to the police, leading to the arrest of two police officers. The other two police officers and civilian accomplices are on the run.

National police spokesperson Assistant Commissioner Paul Nyathi confirmed the incident, saying investigations into the case are ongoing. He said:

We are investigating a case of robbery that involves civilians and members of the police. They are said to have robbed a complainant, Comfort Matombo of 20 boxes of Remington blue cigarettes valued at USD 2500 and one of them is Constable Twala and they are currently assisting police with investigations.

ZTN reported sources as saying on Monday, the complainant was transporting 40 boxes of Remington Gold Blue cigarettes intending to get the contraband across to South Africa through an illegal crossing point along the Limpopo River.

Seven men, two of whom were armed with rifles, intercepted the vehicle and threatened the complainant and his team who then ran away, leaving behind boxes of Remington Gold Blue cigarettes in their vehicle.

The accused persons then loaded the boxes into their motor vehicle and drove off towards Beitbridge.

Matombo however managed to capture the registration number of the accused persons’ white Toyota Hiace vehicle before running away.

He then reported the matter at Beitbridge Rural Police Station.

Zim Man Jailed 15yrs For Smuggling Explosives

By A Correspondent- A Zimbabwean man was on Friday jailed for an effective 15 years at a Musina magistrate court in South Africa for smuggling explosives worth R95 000 into the neighbouring country.

Brighton Chuma (27) was arrested on 17 December 2020 by the Directorate for Priority Crime Investigation (Hawks) at the Beitbridge Border Post while driving a Toyota Hilux. Hawks spokesperson for Limpopo Captain Matimba Maluleke said:

The man was travelling from Zimbabwe to South Africa in a Toyota Hilux double cab when he was stopped and searched at the Beitbridge Port of Entry by the police.

Upon searching the vehicle, 32 blasting cartridges of explosives to the value of R95 000 were found hidden in the loading portion covered with packed bags and the accused was subsequently arrested.

Capt Maluleke said the Zimbabwean’s case was referred to the Hawks’ Serious Organised Crime Investigation team which successfully opposed Brighton’s bail application during the duration of his trial.

Chuma will serve an effective 15 years direct imprisonment with no option of a fine, Capt Maluleke said.

ANC Women’s League Dumps Ace Magashule

By A Correspondent- The ANC Women’s League distanced itself from suspended ANC secretary-general Ace Magashule at the weekend, saying it will not support an individual leader but the entire collective leadership of the party.

Magashule was suspended early this week by the party for failing to step aside after the 30-day period he was given by the ANC.

He is facing criminal charges relating to the Free State asbestos tender and is out on R200 000 bail.

News24 reported that during a virtual meeting on Friday, ANCWL president Bathabile Dlamini proposed that the league meet with party officials to ask them to defer the implementation of a decision to suspend criminally charged leaders who did not step aside within a 30-day deadline, in the interests of uniting the party.

Some league leaders who support Magashule reportedly insisted that the ANC should review the step-aside policy and that the party should convene an urgent national general council.

However, other delegates, such as former ANCWL secretary Sisi Tolashe, said the ANC Women’s League could not seek to defy a resolution of the ANC conference that it was part of.

In an interview with the SABC on Friday, Magashule hinted that he had the support of the ANCWL, singling out its secretary-general Meokgo Matuba as having voiced the league’s support for him.

However, on Saturday morning, the ANCWL issued a statement noting its concern about Magashule’s conduct and distancing the league from him. The statement says:

With the suspension imposed on him, we appeal to him, as women, to consider humbling himself while organisational processes unfold.

The ANCWL will not support any individual leader of the ANC but stands to reaffirm the entire collective leadership of the ANC and our confidence in them to deliver a better life for all, especially women and other marginalised groupings.

The ANCWL chooses the ANC above all divisions in the movement. We refuse to be drawn in on the differences of ANC men who don’t care about the future of the liberation movement.

We will remain unshaken to fight for the soul of the ANC and we are confident that those who choose the ANC will stand with us.

ZINASU Student Leaders Arrested For Shouting At Police Officers

By A Correspondent- Two Zimbabwe National Students Union (ZINASU) leaders who were arrested for disorderly conduct by police in Harare on Friday have been freed.

ZINASU Gender Secretary Nancy Njenge and Women’s University in Africa SRC president Paidamoyo Masaraure were arrested yesterday for allegedly shouting at some police officers who were arresting vendors and touts in Harare and taken to the Harare Central Police Station.

According to their lawyers, the Zimbabwe Lawyers for Human Rights (ZLHR), Njenge and Masaraure were initially accused of inciting public violence and undermining police authority but the police later changed the charge to disorderly conduct.

They were taken to the Harare Magistrates Court for an initial remand appearance on Saturday afternoon.

Meanwhile, the two students activists have been released into the custody of their lawyer Douglas Coltart of the Zimbabwe Lawyers for Human Rights.

Police advised that they will proceed by issuing summons against them if they intend to have them prosecuted.

Warriors and Olympique Lyon striker Tinotenda Kadewere says his side’s ultimate goal is to play Champions League football next season.

Postponement Of World Cup Qualifiers: ZIFA Count Losses

The postponement of the World Cup qualifying campaign has left ZIFA counting losses after the local football board had already invested a lot of money in preparing for the games.

CAF announced on Thursday that the qualifiers scheduled for June will not happen and the games have been pushed to September due to the effects of the coronavirus pandemic which left several host stadiums in bad condition.

ZIFA had started the preparations for their games against South Africa at home and a trip to Ethiopia.

In an interview with The Herald, Warriors team manager Wellington Mpandare said, they had already secured air tickets for the invited players and made hotel bookings.

“In terms of preparations, we were at an advanced stage where we had secured air tickets for all the invited players and had done hotel bookings for the local camp, ahead of the first match against South Africa,’’ said Mpandare.

“We were actually in the process of sending an advanced party to Ethiopia, to sort out the logistics, for the next game.”

The whoosh of wind through a stretch of forest, birds calling to one another as they land on branches, the gurgle of a brook over a rocky bed — these are the kinds of sounds that are not only calming, but could have profound health and well-being benefits, according to a research review in the April 2021 Proceedings of the National Academy of Sciences.

For the review, the researchers looked at 18 studies investigating the health benefits of natural sound; study participants listened to recordings of outdoor sounds in laboratory settings. Participants reported less stress and improved health outcomes, like decreased pain, after listening to recordings of nature sounds.

Water sounds, such as that gurgling brook or a steady waterfall, tended to be the most effective at improving positive affect (the psychological term for a more positive outlook or disposition and the experience of joy and interest), while bird sounds were best for lowering stress.

The study’s lead author, Rachel Buxton, PhD, a research associate and conservation biologist in the Department of Biology at Carleton University in Ottawa, says she isn’t surprised by the findings. “From an evolutionary perspective, humans are hardwired to attend to signals of danger and security. And an environment that is filled with natural sounds feels safe and allows us to let our guard down,” she says.

This research adds to a substantial body of evidence that proximity to nature and time spent outdoors is good for human health and well-being.

Research Shows Green Space Benefits Health in Many Ways
Research published in June 2019 in Scientific Reports found that people who spent just two hours per week outside in a natural setting (including town parks, state parks, woodlands, and beaches) reported greater well-being compared with people who spent less time outdoors.

Latest On NASH Paints US$27 000 Rental Refusal Payment Court Case

By A Correspondent- NASH Paint Group executive chairman, Tinashe Mutarisi’s US$27 000 rentals stalemate with the Mining Industry Pension Fund (MIPF), has been cleared after the pensions fund body withdrew its claim with costs.

The impasse, which hogged the limelight in March, this year, after the businessman refused to pay rentals that the pensions fund body had raised in retrospect, has proved to be a no-brainer, albeit with some unwarranted bad publicity to the paint giant.

Reads part of the notice of withdrawal: “Take notice that the plaintiff (MIPF) herein withdraws its claim and tenders wasted costs.”
Of the new developments, Mr Mutarisi said he was happy to have the issue behind.

However, he feels some clarity would have helped avoid the “unnecessary” hype it carried.

“I am one person who upholds ethical business practices and I honestly felt the decision by MIPF was unfair to me and my business.

“We have had a fruitful business relationship and I was disappointed by their decision to unilaterally raise rentals in retrospect hence the fallout and subsequent court case, which could have been avoided through simple engagement and mutual respect,” he said.

According to the plaintiff’s founding affidavit, the Nash Paints boss agreed to be bound as surety and co-principal debtor with Nash Furnishers in a deed of suretyship signed on January 24, 2019.

The terms of agreement were that he would pay monthly rentals which include basic rent and operational costs.

They also agreed that if his company fails to pay, the plaintiff would be entitled to recover rent already due and damages for breach of contract being holdover damages.

Mr Mutarisi who also owns Nash Furnishers, Nashtv and Avion Mobile Technology, was trolled on social media over the reported rentals fall out, but remained steadfast in his call for justice.

Questions were raised how the business reportedly worth millions of US dollars would fail to pay such an outstanding rentals debt.
“Business is about respecting each other and my decision to question the rental increase was coming from a place of respect for standards.

“Everyone deserves respect and business is all about applying the rule of thumb hence my decision to question the move by MIPF. I am, however, happy that the case has been thrown out with costs and it’s back to business,” said Mr Mutarisi.

Mr Mutarisi has been dragged to court over the rentals stalemate with MIPF at premises housing his other business, Penmen Investments, trading as Nash Furnishers.

Penmen Investments were cited as the first respondent while Mr Mutarisi was second.

BCC Disconnects College Water Over $5million Debt

Bulawayo City Council said it was disconnected water at the Bulawayo Polytechnic a $4,5 million unpaid water debt.

Hundreds of students who are writing examinations are resorting to buying bottled water to drink as the borehole water is said to be unsafe for drinking.

The students and staff are using buckets to carry borehole water to flush the toilets.

In response to questions from the state media Thursday, council corporate communications manager Mrs Nesisa Mpofu said: “Bulawayo Polytechnic was cut off for non-payment. We, unfortunately, cannot advise how much they owe as that is confidential information between Bulawayo City Council and its client. You may wish to check with Bulawayo Polytechnic on how much they owe.”

However, sources within the local authority said the academic institution owes $4,5 million in water arrears.

Higher and Tertiary Education, Science and Technology Development Professor Amon Murwira yesterday said his office will ensure that the Bulawayo Polytechnic clears its arrears.

“It is the Government which is owing BCC and our policy is that we pay, it’s just a matter of time. The most important thing is that our institutions have boreholes. There is no one who has measured or tested that the water is contaminated because we need to be factual in handling these issues,” said Prof Murwira.

“We always pay our debts and I know that something is going to be done about this issue as per our policy which says when we owe, we pay. We may resort to using a payment plan if we cannot afford the whole amount at once, but we will pay.”

Prof Murwira added that it was important for staff members and students to understand that water challenges affect everyone in Zimbabwe.

“We have sunk boreholes at all our institutions, so there is balance because if we consider raising fees so that we clear the debt we will have a huge outcry,” he said.

Contacted for comment, the Bulawayo provincial Environmental Management Agency manager Mrs Sithembisiwe Ndlovu said so far there was no evidence to prove that borehole water at the Bulawayo Polytechnic is unsafe.

“For now, we cannot really say anything pertaining to the condition of the borehole water from Poly because no tests have been carried to prove that it is contaminated. We will therefore get some samples during our routine checks on all boreholes and establish if there is an anomaly. It is only then when we can take measures to investigate who may be polluting the water among other things,” said Mrs Ndlovu.

Bulawayo Polytechnic principal, Engineer Gilbert Mabasa told Chronicle that it was not true that there was no water because there were several boreholes at the college.

He said it was normal for the institution to have arrears just like every citizen in Zimbabwe.

Eng Mabasa said the water challenges were a nationwide problem hence there was no need to amplify Bulawayo Polytechnic’s challenges.

“Someone is trying to make up a story, we have our water supplies and I don’t know what the problem is. Dirty water has nothing to do with having a water problem and some people have always been proud who prefer buying drinking water,” said Eng Mabasa.

Zim holds Historical Boxing Tournament

By A Correspondent- Veteran boxing promoter Stalin Mau Mau is today host the biggest local boxing tournament at Magamba Hall in Warren Park 1, Harare.

Dubbed “The great boxing revival’’, the tournament will have 36 boxers, from different clubs, battling it out for honours.

This is the first time, in the history of Zimbabwean boxing, to have a tournament with such a huge number of boxers, taking part.

Local boxers who will take part in the were urged to be punctual as they are to undergo medicals and weigh-ins early tomorrow morning.

“We are encouraging boxers to be punctual as we need to have weigh-ins and medicals before the tournament. Athletes should avail themselves by 8am so that we can manage to keep up with the time.

“The event is going ahead and I think it is a plus for boxers who had gone for months without action.

“The youths are indulging in drug abuse because they are staying idle, hence the need for them to spend most of their time in gyms, building their bodies and engaging in professional fights,” said Mau Mau.

Duo Nabbed For Possessing Fake Government Stamps

By A Correspondent-THE two men accused of using fake immigration stamps to clear travellers into Zimbabwe and South Africa will have to wait a little longer to know their fate after a Beitbridge magistrate further pushed their trial to May 13.

Farai Moyana (42) and Trymore Mhlanga (30) all of Dulivhadzimu suburb are also facing another charge of processing fake Covid-19 clearance certificates for people travelling between the two countries.

The two men’s trial kicked off on Tuesday and the matter is now set for defence.

They were arrested on April 5 by a security team comprising the police (ZRP) and immigration officers as they went about their illegal business in the border town.

Moyana and Mhlanga have been charged for violating sections of the Immigration Act and the Criminal Law, Codification and Reform Act respectively.

Beitbridge magistrate Ms Annia Chimweta remanded both of them to the trial date on $20 000 bail each.

Prosecuting, Ms Fezile Mpofu, said the duo was raided by a security team at a house in Dulivhadzimu suburb leading to the recovery of two fake MEDLABS Covid-19 clearance certificates which had been processed for Kizito and Patience Mupndori.

The two were also in possession of one fake Zimbabwean immigration date stamp, one fake South African immigration stamp, a canon printer, a Toshiba laptop, stapler, 16 gig memory card and Toshiba laptop they were using to run their operations and four Zimbabwean passports.

SA Court Slaps Zim Man With 15 Year Jail Term For Smuggling Explosives

By A Correspondent- A Zimbabwean man (27) was yesterday jailed for an effective 15 years at a Musina magistrate court under Limpopo province for smuggling contraband of explosives worth R95 000 into South Africa.

Brighton Chuma was recently arrested by the Directorate for Priority Crime Investigation (Hawks) on December 17 last year at the Beitbridge Border Post while driving a Toyota Hilux.

Hawks spokesperson for Limpopo Captain Matimba Maluleke said the explosives were found hidden in the truck and packed in bags.

“The man was travelling from Zimbabwe to South Africa in a Toyota Hilux double cab when he was stopped and searched at the Beitbridge Port of Entry by the police.

“Upon searching the vehicle, 32 blasting cartridges of explosives to the value of R 95 000 were found hidden in the loading portion covered with packed bags and the accused was subsequently arrested,” said Capt Maluleke.

He said the case was referred to the Hawks’ Serious Organised Crime Investigation team which successfully opposed Brighton’s bail bid during his trial until his fate was sealed recently.

“The Court has effectively condemned him to an effective 15 years direct imprisonment with no option of a fine,” said the official.

Komichi Under Fire For Demanding Accountability From Mwonzora

By A Correspondent- MDC-T chairperson Morgen Komichi, and several top executives are in the line of fire by their President, Douglas Mwonzora after they insisted that he accounts for the $6 million illegally withdrawn from party coffers ahead of the party’s extraordinary congress in December last year.

According to NewsDay, the resolution to purge defiant executives was read out to Khupe and her team on Wednesday this week following a national standing committee meeting held two weeks ago.

A party insider is quoted as saying the resolution was smuggled as a way of bringing cohesion in the party cockpit and ensuring that the top leaders do not seem to be working against each other.

The Mwonzora camp wants Khupe, Komichi and Ndlovu to withdraw affidavits with the police but Khupe reportedly insisted that Mwonzora should come out clean on the matter.

However, MDC-T presidential spokesperson Lloyd Damba denied reports of a looming purge, saying the party was simply working towards cohesion.

MDC-T activist Patson Murimoga who recently mobilised for demonstrations against Mwonzora, on Thursday claimed on social media that he had been fired from the party for refusing to withdraw theft charges against Mwonzora. He said:

Property Company Boss Up For US$26 000 Fraud

By A Correspondent- A 32-year-old Bulawayo man has been arrested for allegedly duping a home seeker of US$26 000 on the pretext that he was selling him a residential stand.

Acting Bulawayo provincial police spokesperson Assistant Inspector Nomalanga Msebele confirmed the arrest of Mpumelo Mhlanga (32) who is the director of Corbital Properties.

His alleged victim is a 29-year-old man who is the Director of Prime Crown Company.

“Police in Bulawayo have arrested Mpumelo Mhlanga (32) in connection with a fraud case which occurred between October 2020 and May 2021,” she said.

Asst Insp Msebele said Mhlanga allegedly misrepresented himself as an agent who deals in selling stands and houses.

She said the complainant approached Mhlanga at his company offices on October 5, 2020 intending to buy a residential stand.

“Mhlanga who misrepresented himself as an agent told the complainant that there was a client who was selling a stand in New Parklands suburb, Bulawayo. The cost of the residential stand was said to be US$26 000 and the complainant agreed to the offer,” said Asst Insp Msebele.

She said the complainant made three instalments to Mhlanga of US$13 000 in October 2020, US$7 000 in November 2020 and US$6 000 in December 2020.

After making the full payment, Asst Insp Msebele said, the complainant was shown the stand he had purportedly bought.

Asst Insp Msebele said the complainant met the real owner of the stand on May 1, who denied selling the stand or engaging Mhlanga to sell the residential stand on his behalf.

The complainant then made a report to the police leading to Mhlanga’s arrest.

Asst Insp Msebele urged members of the public to exercise extreme care when buying valuables that involve a lot of money.

“The case is still under investigation to make sure that there are no other cases connected to this accused person.

“Police would like to urge members of the community to be more careful and involve lawyers when buying stands or houses as they risk losing a lot of money to fraudsters,” she said.

Ambassador Mutsvangwa who was quickly whisked away by an AirForce vehicle, confirmed the development with ZimEye.com early Saturday morning.

The accident happened at intersection of Airport Road and St Patrick’s.

The man’s Discovery vehicle was severely damaged at the front in what could easily have been a fatal accident.

Explaining the development, ambassador Mutsvangwa told ZimEye someone who went through a red robot smashed into his car.

“He miscalculated but nobody got hurt for sure,” ambassador Mutsvangwa told ZimEye.

The identity of the other driver had not been disclosed at the time of writing.

OPINION: Zimbabwe 2020 ‘O’ Level results disastrous

By Takavafira Zhou| THE Zimbabwe School Examinations Council (Zimsec) has released Ordinary Level results for the 2020 academic year. 

A total of 184 249 students wrote five or more subjects and 45 644 passed five or more subjects with grade C or better, giving an average pass rate of 24.8%. This represents a decrease of 6.8% from the 31.6% pass rate for 2019. 

It is also noteworthy that 15 813 other candidates wrote less than five subjects because they were ill-prepared to write more than five subjects, or failed to get money to register for more than five subjects. 

Furthermore, more than 16 000 other students did not write examinations after realising that they had not prepared well or at all for examinations. The 24.8% is not, therefore, reflective of a greater disaster that would have ensued had the more than 32 000 other students not accounted for in Zimsec statistics written the examinations or more than five subjects.

In light of this reality, it is therefore puzzling that Zimsec perceives the 24.8% as a commendable outcome and has the temerity to justify such poor performance (compared to previous good results), citing unnamed countries that allegedly went into national lockdown due to Covid-19 and experienced a similar decrease in pass rate.

The minister of Primary and Secondary Education, Cain Mathema, has also amazingly joined Zimsec chairperson Professor Eddie Mwenje in welcoming and hyping up the 24.8% pass rate.

Mathema surprised many by thanking parents, pupils and President Emmerson Mnangagwa for the “good pass rate” to the total exclusion of teachers.

This is understandable given his commandist approach to the education system, lack of educational taxonomy, and threats to incapacitated teachers that he would employ the principle of “no work, no pay” which unfortunately may worsen the plight of students in the 2021 academic year, as teachers may also apply the principle of “no pay, no work”. 

Mathema should be reminded of the importance of dialogue in resolving these issues and ensuring progress in the education system.

It is important for Mathema and Mwenje to understand that there is nothing to celebrate over a 24.8% pass rate, especially if you consider the previous pass rates of 66.6% in 1980, 57.1% in 1981, 59.2% in 1982, and 54.6% in 1983, to mention just a few. 

The great question that Mathema and Mwenje must answer is: What happened to 75.2% of the students? Should we not worry over this rather than celebrate a 24.8% pass rate?

While the effects of Covid-19 cannot be downplayed, major factors in the demotivation and incapacitation of teachers include limited investment in quality public education, poor infrastructural development in rural schools, and inaccessible pedagogical methods of television and radio lessons adopted by the government in a situation where more than 75% of students in rural areas had no radio and television frequency.

Indeed, the government’s unilateral reduction of teachers’ salaries from between US$520 and US$550 to the current equivalent of US$100-US$130 has left teachers demoralised, dejected and deflated, therefore unable to perform at their best. 

Needless to mention that, before June 2020, teachers’ salaries had gone down to as little as US$35. 

Teachers have been financially emasculated, marginalised and impoverished to an extent that they no longer have the energy and stamina to operate at their maximum. 

The concept of intrinsic motivation is crucial in the dissemination of knowledge – teaching – and where both intrinsic and extrinsic motivation are absent, we certainly cannot achieve good results. 

It is dangerous to entrust the future of pupils – which means their lives – to hungry, angry and poverty-stricken teachers. Teachers who have tested positive to poverty and misery cannot produce good results. 

Equally important is investment in quality public education and infrastructural development in rural schools. It is noteworthy that one of the overriding objectives of education is the provision of school facilities. 

The liberation struggle was partly fought for equal access to education by children of all races and ethnicities.

It is thus baffling for the government to allocate a mere 12.7% of the total budget to primary and secondary education against the Dakar framework that agreed on a budget above 22% of the national budget. 

With such a limited budget, it has been difficult to pay reasonable salaries to teachers, let alone invest in infrastructural development in rural schools with the consequent negative effects on pass rates. 

Most students who passed were attending urban schools and mission schools, with very few from rural day secondary schools making it. It is important to note that 80% of primary schools in Zimbabwe do not have electricity, while 65% of secondary schools do not have power. 

The majority of students, therefore, do not have basic facilities and tools in the 21st century where education is driven by information communication technologies. Computers are accessed by only a few schools, with the majority remaining offline. 

With a restricted education budget, the government is not able to give educational equalisation funds to help most rural schools to catch up with urban and mission schools. Such schools have continued to produce dismal results.

After Covid-19 there was a need for new pedagogical teaching methods such as e-learning. But with most schools having no electricity and computers, this was futile.

While the efficiency of radio and television lessons is not in doubt, it is also puzzling for government to adopt such an approach in a situation where 75% of schools, particularly in rural areas, have no radio and television frequencies and reception. 

Connectivity is also a problem. Teachers had designed appropriate class WhatsApp groups for primary and secondary schools, but then needed data bundles for effective communication with students. 

As such, if the monies from the United Nations Children’s Fund were channelled towards teachers’ data bundles and the purchase of educational gadgets for a few pupils whose parents or guardians had no phones, an appropriate way would have been designed to ensure that students continued to learn effectively even during Covid-19 period.

Our politics has trumped pragmatism and realism, leaving a legacy of failure which we must collectively overcome. De-industrialisation, corruption and predatory leadership have collectively destroyed our education system in Zimbabwe, just like all other sectors of the economy and society.

We need to retool our industries, be productive and inspire students to have hope in our country.

A country that has largely become a supermarket for products produced by China and neighbouring countries, let alone reduced to a nation of street vendors, cannot inspire students to pursue education. 

Our education system has also remained largely academic-oriented and examination-driven at a time we must be focusing on functional literacy or life-serving skills. Examinations are certainly not the best means to measure learning achievements. 

A situation where the vast majority fail and have nothing to do is not enviable in society. Worse still, even those who pass have limited opportunities in a shrinking economy. 

This has also instilled a negative attitude towards learning and contributes to low pass rates at all levels, and thus social ills.

When students think better opportunities for the future lie in becoming a border jumper into South Africa, Mozambique, Botswana, Namibia and Zambia, or even in engaging in the growing practice of illegal gold digging and panning in rivers, then there is a big problem.

The government has to come up with robust plans to inspire confidence among the youth to learn, and that can only be possible if the education system has utilitarian value in practical life.

It is also noteworthy that when teachers were earning salaries above US$500 in the 1980s and 1990s, the pass rates at Grade 7, “O” and “A” levels were very high.

The issues of welfare of teachers, government support for teachers and conducive teaching and learning environments are crucial in driving a skills-focused education approach that students can use in life or beyond the classroom. 

It is therefore prudent to invest in the knowledge, innovation and motivation of teachers so that they can effectively blend theory and practical experience in learning and teaching. That feat can never be achieved by incapacitated teachers. 

Teachers are the heartbeat of the economy and society; for they produce all other professionals and lead by example in most cases.

They are role models or ought to be. To perform those roles properly, they need support from the government and communities. 

It is critical for the government to focus on key issues such as education and not waste time, energy and resources pursuing retrogressive political and power retention agendas.

Mnangagwa Signs Controversial Bill Into Law

The Constitution of Zimbabwe Amendment (No.2) Act has been gazetted after President Emmerson Mnangagwa signed it into law.

The Bill recently sailed through the National Assembly and Senate by 191 to 20 and 65 to 10 votes, respectively, and was awaiting President Mnangagwa’s signature to become law.

Among other things, the new law gives the president unchecked authority to fill the seats of the three most senior judges in the country.

According to Kubatana, in making the appointments, while the president would be required to consult the Judicial Services Commission, he would not be required to accept any of the body’s recommendations.

Furthermore, while the president must inform the Senate if his decision is not consistent with the recommendation of the JSC, the Senate would not have the authority to block or change, or force him to change, his decision.

The new law also removes a clause on running mates and retains the present system of the President appointing vice-presidents, extends the quota of extra women MPs by two more terms, adds 10 more seats reserved for people aged 21 to 35 and extends the tenure of judges beyond 70 years of age.

The Zim envoy to London refused to assist UK Govt in releasing travel documents for volunteering returnees, in protest over the UK’s failure to title him, “His Excellency, Ret Col Christian Katsande,” in their correspondence letters. The British are simply calling him by his work title, ambassador.
This time another retired soldier has clashed with Bulawayo City Council on his request to be referred to as a Retired Major. It has emerged that the clerk Mr Christopher Dube sent a letter to the General Purposes Committee on April 26 requesting to be referred to with the rank of Major (Retired) that he retired holding from the army. However, council sources say the request was rejected by councillors who argued that Mr Dube had all along used his civilian title even when he was at the Victoria Falls Municipality before joining Bulawayo City Council as Town Clerk in 2016. “Councillors wondered why all of a sudden Dube wanted his title to be changed after so many years in public service and there was a feeling that there should be consistency. “After the request was rejected by members of the General Purposes Committee, Dube then said he was withdrawing the letter and it was agreed to proceed as if the matter was never discussed,” said a council source. “The agreement seems to have skipped the recorders who included the matter in the latest council minutes. The matter has caused ructions within council.” According to the latest council minutes, the town clerk wrote a letter requesting that he be addressed as Major (Retired). “The Town Clerk reported (26th April, 2021) that Members of the Committee may be aware of the fact that he had served in the army and retired from it having reached the rank of Major. It was normal practice that retired senior army officers were called by their title even after retirement. It was his desire to use this title in line with practice the world over,” read the minutes. Contacted for comment yesterday, Mr Dube denied making the request and referred this reporter to the chamber secretary Mrs Sikhangele Zhou. “Just contact the chamber secretary, she will explain because I do not know anything about that letter. The document that you are referring to is not council minutes, just ask Mrs Zhou. She will tell you that thing does not even exist,” said Mr Dube. No comment could be obtained from Mrs Zhou as she was said to be out of town. However, Bulawayo deputy Mayor Councillor Mlandu Ncube said Mr Dube’s letter was sent to the General Purpose Committee. “This came after his recent interview with the media so the letter just reminded the General Purpose Committee that he served in the army. It has nothing to do with the council as we cannot discuss how anyone should be addressed, it’s up to individuals that is why the letter was withdrawn. It’s just that there was an error in documenting the minutes,” said Clr Ncube. Mr Dube, a veteran of the liberation struggle having trained in Angola, served in the Zimbabwe National Army (ZNA) until he left the military in 1994 for civilian service. Before becoming Bulawayo’s town clerk in 2016, he served in Victoria Falls for four years. Between 2003 and 2008, Mr Dube was a director of finance in the Ministry of Local Government, Public Works and National Housing. In 2009, Mr Dube became Victoria Falls Town Treasurer and in May 2014 became the resort city’s town clerk. There is nothing amiss for Mr Dube to ask to be addressed as Retired Major because senior army officers from Major and above retain their titles even after leaving the army. Gweru Man Petrol Bombs Own Family Over Domestic Dispute

A 42-year-old Gweru man allegedly locked his wife, his three-year-old daughter, two stepsons and three relatives in their house before petrol-bombing the bedroom in a foiled bid to burn them following a domestic dispute.

The man who also torched one of the family vehicles, had before the latest incident attempted to commit suicide by drinking poison.

Darlington Miti (42) who is said to be suicidal, fled after bombing the family house in Heritage Park in Gweru early Thursday morning but has since handed himself over to the police.

The family’s neighbours quickly responded to the distress calls and managed to put out the fire before it spread to other rooms.

The other property burnt besides the car, includes a bed, blankets and clothes all with a combined value of US$8 000.

Midlands provincial police spokesperson, Inspector Emmanuel Mahoko confirmed the incident.

He said all the family members escaped unhurt.

“Police are investigating an attempted murder case where a 42-year-old man set on fire a house in which seven people, including his wife, were sleeping following a domestic dispute. The incident occurred on Thursday at about 2am at the family house in Heritage Park suburb,” said Insp Mahoko.

He said Miti was now in police custody after surrendering himself to the police.

Ins Mahoko said Miti’s wife, Ms Chipo Mafunda, her two children from a previous marriage, her three-year-old daughter with Miti and three relatives were sleeping in the house when Miti torched the house.

“It is alleged the complainant Chipo Mafunda aged 42 has twin sons from her previous marriage aged 23 while Miti also has a son from his previous marriage aged 21. Miti and his wife were staying with their stepchildren during their nine-year-old marriage. The misunderstanding arose after the wife asked her stepson to move out and stay with his mother,” said Insp Mahoko.

He said this did not go down well with Miti who is said to have taken his son to an unknown place.

Insp Mahoko said Ms Mafunda was awakened by Miti who was smashing window panes to their bedroom and thereafter poured petrol into the room before setting it on fire.

Miti, Insp Mahoko said, then torched the car belonging to his wife which was parked outside the house.

When a Chronicle news crew visited the house yesterday, Ms Mafunda and other family members were busy cleaning the house while electricians were rewiring the house.

In an interview, Ms Mafunda said they were lucky to be alive after the arson attack.

She said her husband was suicidal.

“We have been having problems and recently he drank poison and we rushed him to hospital where he spent two weeks in the Intensive Care Unit (ICU).

He was about to recover but still on medication,” she said.

Ms Mafunda said trouble started when Miti lost his job and ventured into mining without success.

She said as a result he has been failing to support the family and started accusing her of infidelity since she had taken it upon herself to provide for the family.

“He has for a long time been threatening to kill me and the kids while accusing me of infidelity but I would always ask him to provide evidence which he has failed.

He is just insecure because I have become the breadwinner for the family,” she said.

On the day of the arson attack, Ms Mafunda said Miti allegedly came home and accused her of having an extra-marital affair.

She said on Wednesday evening he left home without saying where he was going only to come back home at around 2AM the following morning with some petrol.

“He smashed our bedroom windows before sprinkling petrol into the room and setting the room on fire.

I managed to rescue our three-year-old daughter who was sleeping in the bedroom,” said Ms Mafunda.

She said neighbours responded quickly to their distress calls and managed to put out the fire before it spread to other rooms.

Man Attempts To Kill Own Wife, Children…

A 42-year-old Gweru man handed himself to the police after locking seven family members, including his wife and kids, in a house before petrol-bombing it after a domestic dispute.

Midlands provincial police spokesperson, Inspector, Emmanuel Mahoko confirmed the incident which occurred in Raylands suburb Gweru on Thursday night.

He said property was destroyed in the attempted arson attack while all family members escaped unhurt.

“The suspect, Darlington Miti (42) has since surrendered himself to the police and is now in custody. He is now facing attempted murder charges and will appear in court soon,” he said.

Insp Mahoko said those who escaped the arson attack were Miti’s wife Chipo Mafunda, her two children from a previous marriage, her 3-year child with Miti and two other family members.

“It is said Miti had a misunderstanding with his wife on Wednesday night. He then left the house only to return home around 2am the following morning armed with a five litre container full of petrol. He then sprinkled the fuel around the house before setting the house on fire together with the wife’s car which was parked outside,” he said.

When The Herald newscrew visited the house yesterday, Ms Mafunda and other family members were busy cleaning the house while throwing away some of the burnt property.

Ms Mafunda told The Herald that they were lucky to be alive after the arson attack from her husband whom she described as a suicidal character.

She said Miti committed the crime some weeks after he attempted to kill himself by consuming poison.

“We have been having some problems in this marriage and recently he wrote a suicide note and later consumed termite poison. We rushed him to the hospital and he spent two weeks in the intensive care unit. He was about to recover but still on medication,” she said.

Ms Mafunda said she is into some business and was fending for the family but Miti was now accusing her of infidelity.

She said on the fateful day, he came home charging while accusing her of seeing other men but without corroborating the allegations.

“He has for a long time, been threatening to kill me and the kids while accusing me of infidelity but I would always ask him to provide evidence because I knew I was clean. He was just insecure because I had become the breadwinner for the family with my business ever since he lost his job some few years back but he was still in denial,” she said.

Ms Mafunda said Miti left home on Wednesday night without communicating where he was going only to come back home at around 2am the following morning armed with some petrol.

“He then started throwing stones at our bedroom where I was sleeping, damaging window panes before he sprinkled petrol on my car which was parked outside and around the house. He then petrol-bombed the house through the bedroom where our three-year-old girl was sleeping,” he said.

Ms Mafunda said she managed to rescue the minor in the bedroom where the fire started before it spread into other rooms.

“Some neighbours then responded to the screams for help and we managed to put out the fire but some of the property had already been damaged,” she said.- The Herald

Man Steals Cash From Lover’s Brother

IN a modern day Bonnie and Clyde tale, a 25-year-old Nyanga man is on the run after stealing US$300 from his girlfriend’s brother, leaving his lover to face the music.

The matter recently came to light at Chief Saunyama’s court after Misheck Matambanadzo dragged his younger sister, Vimbai Matambanadzo (20) and her lover, Luston Satumba, to the traditional court accusing them of squandering his money.

Satumba defaulted, thereby leaving Vimbai to answer to all the allegations.

Matambanadzo told the court that Vimbai worked for him at his grocery and clothing shop in Mutigwa Village, Nyanga, while he stayed at Mount Mellary with his family.

During his absence, his sister would invite her boyfriend Satumba for sleepovers.

The two would allegedly squander Matambanadzo’s money.

“What really hurts me is that Vimbai would invite Satumba for sleepovers and they would become intimate in my shop and on my bed, while squandering my money. She is only 20, yet she was entertaining men on my bed. This is a bitter pill for me to swallow.

“When I confronted her over the missing US$300, she first professed ignorance but later accused Satumba of stealing the money when I threatened to have her arrested.

“I questioned why she suspected it was him and that is when she revealed that he usually sleeps at the shop.

‘‘I did not even know that my sister is sexually active and it came as a shock. She was actually spoiling her boyfriend with my money while using my shop as a lodge,” said a furious Matamanadzo.

He told the court that he needs Satumba to pay back his money, adding that he has no desire to marry off his sister to him.

However, Vimbai declared that she is head over heels in love with Satumba and would want to marry him.

“I love my boyfriend and I am prepared to settle down with him. In fact, I do not mind being taken to his home right away because he texted telling me that I am his wife and that my brother should not bother us over a mere US$300. He will pay back the money,” she said without any form of remorse.

However, she said she was not involved in stealing from the shop.

“I think my boyfriend stole some goods from the shop and sold them elsewhere because no money ever went missing.

‘‘Only the stock would go missing, but people err. I have already forgiven my man,” she said.

The matter was adjourned to a later date to allow Satumba attend the court session.- Manica Post

Business Tycoon Takes Girl(14) To Popular Night Spot

A MUTARE businessman has been hauled before the courts for allegedly taking a 14-year-old girl out partying before pointing a pistol at her father and threatening to kill him.

Tawanda Godwin Mufute (32) this week appeared before Mutare magistrate, Ms Perseverance Makhala, for contravening Section 27 (B) of the Firearms Act, Chapter 10:09, after pointing a gun at Godfrey Dombo (40).

Dombo had confronted Mufute over his wayward behaviour.

Mufute pleaded not guilty and will be back in the dock.

The State, led by principal public prosecutor Mr Tiriwamambo Kangai, said on December 31, 2020 at about 8pm, Dombo and his family retired to bed.

However, his 14-year-old daughter woke up and sneaked out to celebrate with Mufute the dawn of the New Year at a popular night joint.

Mufute dropped the teenager home around 3am.

“On January 1, Dombo called Mufute reprimanding him for taking his daughter to the night club. Mufute invited Dombo to his place of residence since they stay in the same neighbourhood. Dombo proceeded to Mufute’s house where he found him seated in his car, while his wife was on the passenger seat.

“A misunderstanding ensued between the two, resulting in Mufute producing a pistol and pointing it at Dombo. He threatened to kill him. Dombo went to report the matter at Chikanga Police Station, thereby leading to Mufute’s arrest,” said Mr Kangai.- Manica Post

South Africa: Chaos broke out inside Khangelamankengane palace after the announcement of Prince Misuzulu as the next Zulu King this Friday.

Prince Misuzulu’s security detail had to draw high calibre rifles and whisk the heir apparent away after a security threat at the reading of Queen Regent Mantfombi Dlamini Zulu’s will reading, IOL reports.

In the will, the queen named the US-educated Prince Misuzulu as the heir to the throne. Prince Misuzulu is the oldest son of Queen Mantfombi and the late king Goodwill Zwelithini kaBhekuzulu.

She left her Kwakhangelamankengane Royal Palace to all her children and their descendants, and shared her savings in various policies, assets and bank accounts, equally, among all her children.

Prince Misuzulu Zulu, 47, will have to accept the nomination, failing which, any of his brothers could be the next king by vote, through secret ballot.

Making the announcement, advocate Madoda Griffiths Madonsela SC said the late queen nominated Prince Misuzulu because he had no previous conviction, was of sound mind and has no impediment that prevents him from assuming the throne.

The prince, who is not yet married, called for unity, saying all the wives of the late king, starting with Queen Sibongile Dlamini Zulu, should be embraced henceforth.

“Zanu PF Amendments Will Lead Another Coup D’état” – Some Professor, Doesn’t Even Know What Led To 2017 Coup | OPINION

By Patrick Guramatunhu | For a University graduate much more a University Professor of a highly acclaimed institution like University of Oxford, UK; one would expect Arthur Mutambara to have common sense and thus say something that makes sense. Clearly that is too much to ask!

“What we are doing now will lead to another coup de tat. You know why? Because when the first one happened, Mugabe had these useless vice presidents, he was hiring and firing at will and one of them (Mnangagwa) left the country and engineered a coup d’état (in November 2017),” Mutambara told a Zoom audience.

He was commenting on the Constitutional Amendment Bill No 2 recently passed by both the Zimbabwe parliament and senate. The Bill, among other things, scraps the clause requiring the presidential candidates to have running mate(s); the elected State President will be allowed to appoint and fire VP(s) as he please. The Bill also allows the State President to extend the term of a serving Judge beyond the retirement age of 70 years by another 5 years if he so wished.

Amendment Bill No 1 scrapped the clause calling for senior Judges to appointed through public interview system; the State President will interview and appoint the Judges.

“What Mnangagwa is doing could lead to another coup d’état by somebody else because right now he is controlling succession. He is controlling everything and maybe some people may say the only answer is a coup de tat. If we are not careful these shenanigans will lead to another coup d’état,” warned Mutambara.

What Mutambara is will make sense if the March 2013 Constitution he is so outraged to see being amended was a strong democratic constitution worth protecting. Mutambara and the other MDC leaders heralded it as “one of the best in the world”, said Professor Welshman Ncube. “It is an MDC child!”, chided Morgan Tsvangirai. The truth is the March 2013 Constitution is not even worth the paper it is written on and therefore all hoo-ha against the amendment bills is just hot air.

The new constitution failed its first litmus test; it failed to delivery free, fair and credible July 2013 elections – the ink on the new constitution had not even dried then!

Next the new constitution failed to stop the November 2017 military coup, as Mutambara readily admitted! High Court Judge, George Chiweshe said the November 2017 coup d’état was “legal, justified and constitutional!” Of course, this has set a dangerous precedence; the gene is out of the bottle and cannot be put back.

Zanu PF MP Paul Mangwana, Mugabe’s man on the GNU parliamentary committee that drafted the new constitution, boasted that it was Mugabe who “dictated” the document. It is therefore not surprising that the March 2013 Constitution is all the dictatorial powers a dictator wants including power to amend it to consolidate his/her dictatorial powers.

By failing to deliver and guarantee free, fair and credible elections in 2013 and in future the March 2013 Constitution cum dictator’s creed had in it the seed of the November 2017 military coup and, yes, there will certainly be more violent changes in future coups.

Change is part of nature and no mortal can stop change, the most mortals can do is delay change. Those who have delayed regime change by rigging elections have closed the door to peaceful and orderly change free and fair elections bring. The pressure for change will build up and sooner or later the dam wall will not be strong enough to hold it back.   

“They have butchered the Constitution. We are returning to a constitutionalised authoritarian regime. It is only the beginning of a process. By the time they are done with the amendments, the Constitution will not be recognised from the one adopted through a referendum,” added UK-based University Law Lecturer and former Chief Advisor to Morgan Tsvangirai during the GNU, Dr Alex Magaisa.

“The whole aim of adopting the Constitution was to trim the powers of the President, but the amendment in both Bills No. 1 and No. 2 has given back the draconian rule by Zanu PF, aided by MDC-T and its leader (Douglas) Mwonzora who was one of the builders of the decapitation of the Constitution.”

The March 2013 Constitution was supposed to take away Zanu PF’s dictatorial powers including the carte blanche powers to rig elections. It did no such thing, that is precisely the point. Zanu PF went into the 2008 to 2013 GNU with its dictatorial powers and emerged at the end with all its dictatorial powers nicely disguised in the March 2013 Constitution and with not even one democratic reform in place.

Dr Magaisa as Tsvangirai’s Chief Advisor should have advised Tsvangirai, MDC leaders and the nation at large to reject the March 2013 Constitution in the referendum because it is a dictator’s creed. He advised them to do the exact opposite, accept it.

SADC leaders advised the MDC leaders not to participate in the 2013 elections without implementing some democratic reforms designed to stop Zanu PF rigging the elections. The SADC leaders realised immediately that the March 2013 Constitution was weak and feeble and will not deliver free, fair and credible elections.

By participating in flawed and illegal elections in 2013 and then again in 2018 the MDC and the rest in the opposition camp gave credibility to the flawed electoral process and, by extension, gave legitimacy to the vote rigging Zanu PF regime. Of course, as the legitimate Zimbabwe government Zanu PF has the power and authority to amend any part of the March 2013 Constitution.

Professor Mutambara and Dr Magaisa are suggesting that if Zimbabweans can stop Zanu PF amending the March 2013 Constitution then the country can expect to have a democratic Zimbabwe is a fallacy.

Zanu PF will rig elections to stay in power because the March 2013 Constitution gives the party dictatorial powers to do so. We not only foolishly approved that weak and feeble constitution but continue to defend it as the democratic constitution we want. By participating in flawed and illegal elections we have given the vote rigging Zanu PF regime legitimacy. And after giving Mnangagwa the dictatorial powers and a weak constitution to allow to do as he pleases we can, somehow, neither Mutambara nor Magaisa have said anything on the subject, still get him to behave like a democrat! Of course, the suggestion is idiotic!

What is the way forward? First, people must accept the reality that the March 2013 Constitution is a feeble and weak that will never deliver and guarantee our freedoms and rights including the right to free and fair elections and even the right to life. Accept the reality the 2008 to 2013 GNU failed to implement even one of the raft of democratic reforms agreed at the onset of the GNU.

It is self-defeating to pretend the GNU delivered the democratic changes the nation has been dying for when it did no such thing. Yes, the recent amendments to the March 2013 Constitution will give Zanu PF extra dictatorial powers; the emphasis is on extra, the feeble constitution has given him many dictatorial powers already. Our time and energy must be to dismantle the Zanu PF dictatorship and take away all the dictatorial powers not just to deny the dictator the extra dictatorial powers   

Second, the fight to end the Zanu PF dictatorship starts with the demand to implement all the democratic reforms to ensure free, fair and credible elections. If no reforms are implemented before the next elections due in July 2023, just over two years away and so it is almost certain no reforms will be implemented now; Zimbabweans must not participate in the elections.

 After 41 years of rigged elections, it really is insane to keep participating in flawed and illegal elections and expecting to win “rigged” elections.

The Professor Mutambara and Dr Magaisa of this world will argue that Zimbabweans must participate in the coming elections, regardless of all the evidence that Zanu PF will rig the process, to stop the regime passing more March 2023 Constitutional Amendments. Of course, this is nonsense Zimbabweans participated in the 2013 and then in 2018 elections and that did not stop Zanu PF passing the two amendment Bills referred to above.

If people participate in the flawed elections and give Zanu PF legitimacy the regime will amend the constitutions if it so wished. We the people will only have ourselves to blame for our folly in having participated in the flawed elections and given the regime legitimacy for the umpteenth time!

Zanu PF as the party in government has the duty to ensure national elections are free, fair and credible; it owns this to every Zimbabwean as a birth right and not a favour. If the regime cannot implement the reforms to ensure free, fair and credible elections, then the nation has the right to declare the elections null and void and find others who will deliver free, fair and credible election!

“If we are not careful these (Constitution) shenanigans will lead to another coup d’état!” Please spare us your foolishness, you can see into the future and yet even now you cannot say what shenanigans led to the November 2017 coup d’état? Barcelona Eye Aguero

Barcelona have reportedly initiated talks with Sergio Aguero’s representatives as they look to sign the striker on a free transfer at the end of this season.

The Argentine will not extend his stay at Manchester City beyond this season and will become a free agent when his deal expires in June.

According to Sky Sports, Barca are interested in signing the 32-year old have started holding talks.

It’s also believed Aguero is prepared to reduce his salary while playing for the Liga giants.

The club is expected to make a final decision at the end of the campaign along with that of the transfers of Memphis Depay and other targets.

ZANU PF President Emmerson Mnangagwa has signed the controversial Constitutional Amendment No 2 Bill into law, which gives effect to 27 changes to the Constitution and giving him unfettered powers over the Judiciary and Parliament.

The Bill sailed through the Senate this week with a two-thirds majority of 65 to 10 after 11 senators from the Douglas Mwonzora-led MDC-T faction coalesced with Zanu PF legislators.

Mnangagwa moved with speed to sign the Bill into law despite opposition from civic organisations and lawyers who intended to challenge the way the Bills sailed through Parliament.

In General Notice 907, Chief Secretary to the President and Cabinet Misheck Sibanda said: “… The following laws have been assented to by his Excellency the President are published in terms of section 131(6) of the Constitution of Zimbabwe. Manpower Planning and Development Amendment Act, 2020 (No 12 of 2020). Constitution of Zimbabwe Amendment (No 2) Act (No 2 of 2021.”

Zanu PF yesterday claimed that it pushed for the amendments because the issue of a running mate was chaotic and a major cause of strife, citing the United States, Kenya and Malawi as examples.

“The issue of running mate is not working in other countries and it causes strife. You are aware of the issue in the United States, who are champions of the clause and how the former President Donald Trump acted. We don’t want to reach a situation where we have strife for us to remove the running mate clause,” Zanu PF spokesperson Simon Khaya Moyo told journalists at the ruling party headquarters yesterday.

“There’s no problem in studying other countries where the issue of the running mate caused problems. It’s not only in the US where it has caused problems, even in Kenya and Malawi, they had such problems. We can’t wait to fall in a ditch when we know that we will fall in. You want us to wait and get bruises and see whether they are treatable?”

He said there was nothing amiss for Zimbabwe to remove the running mate clause as a number of countries did not have it, including neighbouring South Africa.

“There’s nothing amiss about it. There are a number of countries which don’t have the running mate clause. Even in South Africa, it is not there. It is not like countries not having the running mate clause are heading for disaster. We have to do what we want. The succession issue is a matter of political parties to resolve internally,” he said.

Khaya Moyo denied that Zanu PF had colluded with Mwonzora’s party to pass the controversial amendments.

“We, as a party, don’t have any inclination to bribe anyone for anything. We are a principled party with values and if our values appeal to you and you vote with us, we can’t stop you. We have policies which appeal to the people and they vote with us, we don’t bribe. That’s democracy, we are a clean party,” he said.

The ruling party spokesperson said Zanu PF was proud to have steered the passage of the Bill, which he claimed attests to the seriousness of the government to adjust the Constitution in line with its standards of governance.

“We, however, take note of the spirited attempts by the sworn critics of the government misinforming the public about the amendments,” he said.

“Nothing can be further from the truth. These amendments are aimed at strengthening our flourishing constitutional democracy through the deliberate creation of a stable institution of the presidency by removing the imported running mate clause which has proved to be chaotic where it has been used.”

But others has a different view. “Those amendments were not necessary, he was already a dictator,” analyst Wilbert Mukori told ZimEye on Friday night.

“Many are overlooking the fact that the 2013 Constitution made Mugabe a dictator,” he continued.

Mdc Alliance deputy Chairperson Hon Job SaroWiwa Sikhala confirmed the arbitrary arrest of Transform Zimbabwe and founder of the July Movement, Jacob Ngarivhume.

Regardless of his notification to carry out a clean-up exercise in one of Harare’s old high density suburb of Mbare. The captured law enforcement agents turned his application down but Ngarivhume defied the notice and proceeded to pick up litter at Mbare Msika.

In barring him, the Zanupf-controlled police claimed that the ardent opposition leader had waved placards with political messages in a previous clean up campaign. It is quite pathetic to learn that communicating political messages is now a crime in a purported new ‘dispensation’.

As a district, we call upon regional and international legal instruments to aid us in our fight against Zanupf’s appetite to muzzle democratic space through persecution by prosecution.

The presence of a heavily armed Anti-riot police in Mbare Tuesday morning to obstruct Ngarivhume and his determined team’s cleaning blitz is a demonstration of the levels of Fascism in the desperate Zanupf outfit.

It is sarcastic to arrest a social transformer for picking up litter in the neighborhood, Zanupf represents a hybrid dictatorship.

Moreover, in the course of such arbitrary and unlawful deprivations of liberty, the detainees are frequently also deprived access both to lawyers and family ,basic health rights and also subjected to torture, harassment and other forms of inhuman treatment from partisan prison guards and police. It has been unearthed when Hon Joana Mamombe was denied medical attention when she was withdrawn from hospital even if our leader was in agony. Mdc Alliance Namibia supposes that it is fundamental , therefore,that the legal rules that exist in international law to remedy and prevent these kinds of basic human rights violations be adhered to by independent national judges and prosecutors , and that lawyers are aware of their contents ,to enable them to act effectively on behalf of their clients.

In a nutshell, Mdc Alliance Namibia demands the immediate and unconditional release of all political prisoners in the names of the illegally convicted Cde Makomborero Haruzivishe, Jacob Ngarivhume, Lengwani, Munyaradzi, Last Maengahama, Tungamirai Madzokere, only to mention but a few. We urge the thugocratic Zanupf regime to stop the gross abuse of human rights through abductions, disappearances, torture and long pre-trial detentions. Citizens Convergence for Change is the only panacea to socio-economic transformation. Citizens must converge to confront Zanupf dictatorship to promote comprehensive political and electoral reforms, respect of the rule of law and Constitutionalism as well as economic transformation.

Man Axes Wife

FOR several years she has stayed with her husband, not because she wants to, but because she has no option.
Gertrude Dube from Sigola Village made shocking revelations that her husband Mxolisi Dube disciplines her with an axe.

Whenever they have misunderstandings Mxolisi reportedly beats her using the handle of the axe then threatens to use the axe to kill her, forcing her to behave in a manner that pleases him.

The issue came to light after Mxolisi axed Gertrude on her left leg and she had to be rushed to hospital for treatment.

“The risk of death was high in her case because she was bleeding profusely. The fact that death did not occur was entirely a matter of good fortune and we are glad the incident was reported to the police,” said a relative privy to the issue.

The village head of the area, Mehluli Ndlovu confirmed the case.

“Gertrude stays with her husband and two children in their homestead. We were scared because the husband is very violent. Recently he axed Gertrude and as we speak, she is in hospital,” said Ndlovu.

He added: “Mxolisi was always fighting with neighbours and he also threatened to kill people. Since he was in the habit of threatening to kill everyone it’s a relief he got arrested.”- B-Metro
