Information ministry spokesperson Nick Mangwana revealed the whereabouts of the deportees on twitter and saud:

“Reign In Lawbreakers Parking Their Vehicles All Over Town”

Dear OPC, City of Harare and Zimbabwe Republic Police

I wish to draw your attention towards the unauthorised parking of vehicles on stretch between S. Muzenda St/SNujoma St (Fourth St/2nd St ), on Hardwick House along Samora Machel and Charter House on the corner of J Nyerere/S Machel and last but not least on Linquenda House along Nelson Mandela.

The development is causing serious overcrowding on the above mentioned areas which is causing a lot of inconvenience to the other drivers.

We are also asking the Office of the President and Cabinet to reign in these individuals who are breaking the law with impunity. We should not have government officials who should be following the law by the book and leading by example breaking the laws that they have put in place. That is a NO NO.

As a law-abiding citizen I am calling for the law enforcement agencies to immediately ticket, clamp and tow away these law breakers who are disgracing the Zimbabwean Government that is striving so hard to bring sanity to the capital city.

Deportation Scam: Zim Ambassador Refused To Sign for 4 Suspected Relatives.

By A Correspondent | A Home Office deportation charter flight to Zimbabwe landed in Harare early Thursday morning with only around one-third of the passengers on board that UK had hoped to remove, after among other things, the ambassador to Zimbabwe’s refusal to sign the travel documents for some suspected to be his close connections.

Ambassador Christian Katsande

Last night was the first mass deportation flight to Zimbabwe in 10 years and the first of a series of planned ‘summer season’ of charter flight deportations to countries that include Vietnam and Jamaica that the Home Office is planning in the coming weeks.

The development was first revealed by ZimEye 3 weeks ago.

The flight was due to deport 55 people but only 14 took off from Stansted Airport.

41 remained.

Of those 41, the ambassador to Zimbabwe Christian Katsande refused to sign travel documents for 4.

Of the 37 remaining, 12 of them submitted High Court applications mentioning that circumstances have changed. Some of them had been deportation orders 5 years ago, and is now being enforced now.

Of these 12, is Mr Bryan Mucheriwa who obtained reprieve because the High Court ruled his case must be reviewed due to changes in circumstances.

25 couldn’t travel because where they are being held (Brook House Detention Centre) there was a COVID outbreak.

A deportation order does not expire. It is only cancelled by a successful appeal or court application.

The ambassador’s unusual behaviour comes at a time when a few months ago, there was another standoff when he waged a diplomatic silent war against her majesty’s government that lasted a year. Several Zimbabwean voluntary returnees got stuck in the UK for over a year after ambassador Katsande refused to sign their travel documents, and it had to take media intervention by ZimEye to force him to do it. He was refusing to sign their documents because he wanted the British Govt to title him His Excellency in letters mailed to his office. (WATCH THE DRAMATIC VIDEO MOMENTS HERE).

ZimEye reached ambassador Katsande for a comment and he was still to comment at the time of writing.

The Cost of Rest

Sabbath School Summary

By Elder Dr Masimba Mavaza

Bible

Lesson 4
We start this week with tears running down our chicks. We have lost many people due to CORONA VIRUS. Our prayers go to the Gamanya family. They lost pastor LeaRoy Gamanya. Elder Nyarota from Budiriro 2 lost his wife mai Nyarota . We lost Mai Moto from Gweru. The list is endless. Thank God you are still alive. May God comfort all who lost their loved ones. Be comforted that we will meet them one day when Christ comes again. That is the day we are all waiting for. God will wipe away all tears. Friends let us take comfort in the Lord.

Dr Masimba Mavaza

Memory Text: “Create in me a clean heart, O God, and renew a steadfast spirit within me” (Ps. 51:10, NKJV).

INTRODUCTION

Many people seem desperate to find a little peace and quiet. They are willing to pay for it too. In many big cities there are internet-free rooms, which can be rented by the hour. The rules are strict—no noise, no visitors. People are willing to pay to be able to sit quietly and just think or nap. There are sleep pods that can be rented in airports, and noise-reducing earphones are popular items. There are even canvas hoods, or collapsible privacy shields that you can buy to pull over your head and torso for a quick workplace break.

True rest also has a cost. While the spin doctors of the self-help media would like to make us believe that we can determine our own destiny and that rest is just a matter of choice and planning, yet, at least when we consider this honestly, we realize our inability to bring true rest to our hearts. In the fourth-century, Augustine put it succinctly in his famous Confessions (Book 1) as he considered God’s grace: “You have made us for yourself, and our hearts are restless, until they can find rest in you.”

SABBATH: In today’s do-it-all world, many men are busier than the bee & desperately crave for rest, even if it’s just for some few moments. To quieten their thoughts, take a nap, or have a quiet time to think, people are willing to pay for noise-reducing earphones, sleep pods, privacy shields & canvas hoods. Thus, true rest is costly. The study looks at how the man after God’s own heart, grasp the true cost of God’s rest.

SUNDAY: One aim of the Bible is to preach distrust in man & trust in God. Even David had a fall in life. Instead of being at the battlefield, he retired at home pacing the roof of his palace. The restless king slept with his trusted army officer’s wife & tried to cover up his sin. As a king, David was above the law of his land, but he was not above the law of God (2 Sam. 11:1-27). David, to cover his sins committed murder.

MONDAY: God’s light shines amid darkness. In the darker nights of David’s life, God sent a prophet & David’s friend, Nathan, to give the king a wake-up call (2 Sam. 12:1-14, cf: 2 Sam. 7). Being anointed on the lips by God, Nathan told a story instead of naming & shaming David. David marked himself as the unjust man in the story (2 Sam. 12:7), & knew that he had sinned against God (vs. 13, Ps. 51:4, PP, p. 722).

TUESDAY: With trembling lips, king David uttered that he had sinned & prayed for God’s grace. The results of his sin affected the newborn (the child would die) & his family will be in disarray (conflicts & deaths; such as that of Amnon & Absalom). The king knew that God’s grace is able to cover his sins & found rest in God (2 Sam. 12:10-23, Ps. 51:1-6). Publicly, he confessed his sins & cried for renewal of ties with God.

WEDNESDAY: In his cry for mercy, David referred to an aspect of the sanctuary service; “cleansing with hyssop”, which ultimately pointed to Christ who forgives & redeems. David knee joy & gladness is what follows a forgiven soul, so he asked for it (Ps.51:7-12, Lev. 14:4). When Adam & Eve sinned, they hid from God but David presented himself before God—the presence of God was all he needed to prosper.

THURSDAY: In Japan, a traditional art, kintsugi, is molding something new with beauty & value out of a broken pottery. God’s divine act of creation (making something out of nothing) & recreation (mending our broken pieces) is what we ought to yearn for (Ps. 51:13-19; 1 John 1:9). David counsels us not to throw our broken pieces away but to bring it to the master potter (God) for Him to mold us into His image.

FRIDAY: Out of a contrite heart, David publicly confessed his sin. His repentance was sincere & deep. Inspired by prayer, he desired not to escape the consequences of his sin. Instead, he desired for God’s presence which is able to help one overcome sin & trials (Ps. 51:16, 17). David had a fall, but God lifted Him up! King Saul despised reproof, but David humbled himself. Like David, all men struggle & need Christ.

Discussion Questions

? How can we find the balance between recognizing our inherent sinfulness and need for forgiveness and, at the same time, living like the forgiven sons and daughters of the King of the universe that we are?

? Why is all sin, ultimately, sin against God? What does it mean to sin against God?

? What can we say to someone, not a believer, who struggles with the suffering of innocent people, such as Uriah or the newborn son of David and Bathsheba? How do we explain the love and justice of God in such a situation? How does the perspective of the great controversy offer a helpful outlook?

? Why would God devote two full chapters of the Bible to the sordid story of David and Bathsheba? What purpose does the recounting of this story serve?

? Dwell on the idea that sin separates us from God as expressed in Psalm 51:11, 12. What has been your own experience with how this happens? How would you explain to someone what this separation feels like and why it’s so uncomfortable? Why is the promise of grace the only remedy?

Veteran Journaiist Burial On Today

By A Correspondent- Veteran journalist and war veteran Saul Gwakuba Ndlovu will be buried today at Lady Stanley Cemetery in Bulawayo, his family has said.

Gwakuba Ndlovu died early last Friday morning at the United Bulawayo Hospitals (UBH) from a heart ailment. He was 87.

Yesterday, his wife Mrs Caroline Gwakuba Ndlovu said Gwakuba Ndlovu’s funeral service will be held in the morning.

“My husband will be buried tomorrow at the Lady Stanley Cemetery at around 10AM.

“There will be a service at home, number 16 Jungle Road in Trenance from 7.30 AM. That is what we have organised as a family for the burial,” said Mrs Gwakuba Ndlovu.

Gwakuba Ndlovu was born on September 23, 1934 at Dombodema Mission in Bulilima District, Matabeleland South province.

In 2014, Gwakuba Ndlovu was among 21 pioneers of the liberation struggle who received the Liberation and Independence Medals, together with six serving ZDF members and three who were retired.

During the liberation struggle, Gwakuba Ndlovu was the director of publicity and information of the Zimbabwe African People’s Union (Zapu), between 1964 and 1978.

He once served as the diplomatic representative for Zapu based in Algeria responsible for Tunisia, Morocco, Mauritania, Niger and Mali.

He also covered countries such as Spain, Portugal, France, Belgium, Luxembourg, the Netherlands and the Federal Republic of Germany.

On behalf of Zapu he participated in a number of the then Organisation of African Unit summits, Afro-Asian People’s Solidarity Organisation meetings, United Nations, anti-colonialism committee conferences, Heads of State and several international journalism conferences at places such as in Prague, Pyongyang, Moscow, Berlin, Cairo, Kinshasa, Rome and New Delhi.

From mid-June to mid-July 1979, Cde Gwakuba Ndlovu and Dr Barnabas Dzingai Mutumbuka undertook a lecture tour in Canada on behalf of the Patriotic Front (PF) to apprise Canadians on the socio-political situation in the then Zimbabwe-Rhodesia and why the PF was strongly opposed to the treacherous Muzorewa-Smith regime.

In 1972, Gwakuba Ndlovu was sent to the Soviet Union by Zapu and among his group were now Brigadier-General (Retired) Abel Mazinyane, Colonel (Retired) Thomas “Menu” Ngwenya, late Jack Amos Ngwenya, Phebione Makonese, Easter Ndiweni and Josiah Ncube.

After independence Ndlovu joined the Chronicle as a senior editorial staff member. He was later appointed Features and Supplements Editor for both Chronicle and Sunday News.

The late journalist left Chronicle and The Sunday News in 1984 to join the Munn Publishing Company where he was the contributing editor and regional manager responsible for Matabeleland, the Midlands, Masvingo, Botswana and Zambia.

He left Munn Publishing Company in September 1987 after he was offered a post by Lonrho Zimbabwe as a Public Relations Executive with responsibility over the same region as that he covered with Munn Publishing. Lonrho Zimbabwe later sent him to Swaziland in January 1988, where his responsibility as a consultant at that country’s official newspaper, The Swazi Observer was to revive that publication by training the workers.- State media

SA Minister Made A Fool Of Himself On BBC By Denying ANC Failures And Yet “Slow Response Gave Rioters Field Day”

By Patrick Guramatunhu- The people responsible for the riots sparked by the jailing of former South African President Jacob Zuma failed in their insurrection because the ground for them was not fertile, the country’s transport minister has said,” reported BBC.

“While the government’s slow response to what was happening gave them a “field day”, they could not achieve what they wanted, Fikile Mbalula told BBC Hardtalk.

“More than 200 people died in the recent violence. It is estimated to have cost the economy in KwaZulu-Natal province alone at well over $1bn (£730m).

“South African President Cyril Ramaphosa has said that the riots were a “coordinated and well-planned attack”.

There is no denying that former South Africa President Jacob Zuma and his supporters very much hoped that the looting and burning following his arrest would spread nationwide, not just KwaZulu -Natal and one or two other areas, making the country ungovernable, an insurrection. The majority of South African did not agree with the position that Zuma should not face the wroth of the law for defying the court order, particularly since this was over very serious corruption charges. The people certainly did not want to endorse the foolish notion that anyone is above the law especially someone implicated in serious corruption charges.

There is evidence to show that most of the people behind the looting and burning in KwaZulu-Natal and other areas were venting their anger and frustration against the government for their sorry economic situation, nothing to do with supporting Zuma. After nearly 30 years since the end of the apartheid era, in which the whites were filthy rich and the expense of the impoverished back majority; things have not changed much, other than a few ruling elite blacks who have become filthy rich the overwhelming majority of blacks are still languishing in abject poverty.

“South Africa, according to many studies, is one of the most economically equal societies in the world,” Stephen Sackur, the Hardtalk presenter, pointed out. “ANC is failing the people!”

SA’s Transport Minister, Fikile Mbalula, gave a spirited defence of the ANC, the party that has ruled since independence in 1994, economic performance; arguing the party is on track to deliver economic prosperity and should not be expected to reverse the 300 years of white colonial exploitation and oppression in three decades. The facts on the ground tell the story of decades of wasted opportunity or worse.

President Thabo Mbeki and now Cyril Ramaphosa have been mediocre leaders who have blundered from pillar to post. In this case, to mobilize the security sectors to giving the rioters “a field day”, as Minister Mbalula and President Ramaphosa himself readily admitted. The delay has costed the nation billions of Rand in lost property and infrastructure and over 200 lives.

When former President Jacob Zuma was in office, SA quickly earned the reputation as just another African country ravished by gross mismanagement and rampant corruption. Yes, the ruling party ANC finally acted and had him removed from office and is now carrying out a thorough investigation into state capture. One hopes the investigation are very thorough and the rot is stamp out.

Still the ANC was very slow in nipping misrule in the bud and the experience has damaged the country’s standing as a stable democracy, one of the few in Africa. Investors shy away from pariah state; look at Zimbabwe, the one thing all South Africans should be scared stiff of is to be another Banana Republic like Zimbabwe.

Jacob Zuma and his supporters were hoping for a nationwide revolt demanding that Jacob Zuma should not be investigated for corruption and position him as above the law, a stance that would have confirmed SA’s position as a pariah state. As much as many people are disappointed with ANC government’s failure to address the nation’s economic challenges they, nonetheless, realised that the Zuma’s supporters’ agenda was to reject rule of law and democracy; they had the good sense to know this was throwing away the baby, democracy, with the bath water.

South Africa’s democratic institutions are strong and holding; former President Zuma is still in jail, where he belongs; the country’s next elections will hold free, fair and credible; etc.

However, there is no deny the country’s democracy has, so far at least, failed to elect a competent government and deal with the country’s economic challenges; the impoverished masses are not going to wait another 300 years! The anarchist did not get much support from the impoverished masses this time but as long as millions are forced to live in abject poverty, the anarchists know they have a chance of garnering nationwide support next time.

As long as poverty rules the roost, SA will remain fertile ground for a nationwide revolt to dismantle rule of law and democracy!

Former Army Captain Fights Businessman

A former captain in the Zimbabwe National Army (ZNA), Solomon Ndlovu, has slapped businessman Osfael Mazibuko and his manager with a US$20 million lawsuit over malicious prosecution.

Ndlovu, who was a chaplain at Mbalabala Barracks, was in January 2018 convicted of theft of a motor vehicle by Beitbridge regional magistrate Mark Dzira after a full trial.

He was sentenced to six years in jail, with two months suspended for five years on condition of good behaviour.

A further five months were suspended on condition he restituted Mazibuko US$2 500, leaving him with an effective 65 months to serve.

Aggrieved by both conviction and sentence, Ndlovu, through his lawyer Abel Ndlovu of Dube and Associates, filed an appeal at the Bulawayo High Court citing the State as respondent.

In his grounds of appeal, Ndlovu said Dzira erred and misdirected himself by attaching a criminal liability to him for violating terms of an agreement that allowed him to take lawful possession of the vehicle.

He argued that the agreement he had with Mazibuko was purely a civil matter. The State did not oppose the application, saying both the conviction and sentence were improper.

As a result, two High Court judges, Justices Maxwell Takuva and Thompson Mabhikwa, on September 16 2019, set aside both conviction and sentence, and acquitted Ndlovu.

He had, however, already served one year and eight months at Khami Maximum Security Prison on the outskirts of Bulawayo.

Ndlovu, through his lawyers, T Hara and Partners Legal Practitioners, on July 9, 2021 wrote a letter to Mazibuko and his manager Dennis Ndlovu, demanding payment of US$20 million being damages suffered as a result of the malicious incarceration.

Ndlovu, through his lawyers, said Mazibuko made a malicious report to the police that he stole his car when there was an agreement to the effect that he bought it.

“In your malicious enterprise, you were assisted by Dennis Ndlovu, who is your manager. You even went to the extent of using numbers of the Central Intelligence Organisation to make sure that the police would arrest our client,” Ndlovu said.

The letter further states that Ndlovu suffered a lot during trial on the criminal charge, conviction and sentencing.

Lawyers said apart from the pain induced by the prison term, both physical and mental, Ndlovu lost a house valued at US$50 000, a total of 78 head of cattle, each valued at US$500, a tractor which he had to sell valued at US$16 000.

His wife deserted him as a result of the wrong and malicious conviction.

Ndlovu threatened legal action if Mazibuko failed to pay the US$20 million.

Marry Chiwenga’s Heartrending Birthday Wish

By A Correspondent- Vice President Constantino Chiwenga’s wife Marry who turns 40 today on Wednesday took to twitter expressing her wish to be reunited with her three children.

Marry, who is currently battling a serious illness poured her heart out on twitter where she posted:

“I am going to be 4ty (40 years) tomorrow and just wishing and wanting and waiting for my children Tendai, Christian and Michael to be with me,” Marry posted on her twitter handle.

“What kind of a father denies his children which he claims to love the right to be with their mother and vice-versa. Where is God when you need him?”

“I didn’t marry the material wealth, I married the wealth that was in his heart, the gentle touch of his hand, the knowledge of God, his understanding of what my heart wanted, he understood the person that I was, the me that I am today, focused, forgiving and forward-thinking.”

“As I turn 40 tomorrow, I thank God for the life that he has thrown at me, the weight I have had to carry, the humiliation that I suffered at the hands of my other half, the baseless accusations and the weight of his instructions and authority. Evil eye.”

Chief Ndiweni Pushes For Diaspora Vote

Dethroned Ntabazinduna chief, Felix Nhlanhlayamangwe Ndiweni, who is based in the United Kingdom, has formed a pressure group – MyRight2Vote – aimed at pushing President Emmerson Mnangagwa’s government to give Zimbabweans based in the diaspora their rights to vote.

Ndiweni said people in the diaspora were sustaining the country through remittances back home and should, therefore, be given the rights to vote.

MyRight2vote conducted a virtual meeting to discuss its course of action and strategies towards pushing government to consider legislating for diaspora voting.

Ndiweni chairs the group with Adrian Lunga as secretary, while Ntunja Mphoko is the deputy chairperson.

Speaking during the meeting, Ndiweni said MyRight2Vote was an independent, non-political and non-partisan organisation for Zimbabweans in the diaspora whose concerns were to be granted the right to vote considered.

“We are a people’s movement trying to bring diaspora people together for a cause,” Ndiweni said.

“MyRight2Vote is pushing for democracy and the rule of law so that we are not suppressed on what we want as citizens.”

He added: “In the 2018 elections, the total number of people who voted was 4,8 million. We are reliably informed that the Zimbabwe diaspora is in excess of five million people who have all along been denied their right to vote. They were denied through the High Court three times.”

Opposition parties have been pushing for people in the diaspora to vote, a demand rejected by the ruling Zanu-PF party.

Last month, acting Zanu-PF national commissar Patrick Chinamasa said diaspora votes could only be considered once the West removed travel restrictions imposed on ruling party bosses so that they could travel to Western countries.

He said people in the diaspora could vote through the postal ballot, arguing that if the police and top civil servants were allowed to do so, nothing could, therefore, stop people living in the diaspora to do the same.

“Zimbabwean people in the diaspora, in 41 years, have not uttered a word about the future of the country, the people who remit over US$1 billion to the country must have a say about how the country should be run. There must be no taxation without representation,” Ndiweni said.

Lunga urged those in the diaspora to join MyRight2Vote so that they fight for their rights together from across the world.

Chief Ndiweni was dethroned by Mnangagwa in December 2019 under controversial circumstances after he openly showed support to MDC Alliance leader Nelson Chamisa and also backed the Western-sponsored sanctions against the Zanu-PF government.

Trio’s Mysterious Disappearance After Plunging Into Pool Shocks Villagers

By A Correspondent- Three villagers from Mapanzure communal lands in Masvingo disappeared last Friday after plunging into a pool under mysterious circumstances.

The three, whose identities have not been disclosed, were apparently performing rituals on the banks of the Musogwezi River before jumping into a pool along with two other villagers.

They have not been seen since last week and relatives are said to be now conducting rituals for their safe return.

According to police, Victor Tazvigwira (41) and Blessed Dhombo (age not given) both of Tazvigwira village in the area, who also jumped into the water, re-emerged and were rescued after a prayer session led by Pastor Amos Chituru (49) of Manyangadze village in Mutasa, Manicaland.

Masvingo provincial police spokesperson Inspector Kudakwashe Dhewa said the police sub-aqua was ready to move in and search for the missing persons once relatives gave the go-ahead.

According to police, Pastor Chituri was invited to Tazvigwira village for prayers at Zishiri homestead on July 14.

He then reportedly prophesied that Victor needed to be cleansed in a river.

On July 16, Victor and his relatives teamed up with Pastor Chituri and went to Musogwezi River where they prayed while on the banks of the river.

There are fears that they may have drowned.

In 2019, Gift Dube, a 19-year-old prophet at 12 Apostolic Faith Mission Church, Bulawayo, drowned during a baptism ceremony while trying to save one of his cousins and congregant who had slipped into the water.

This was after he had prophesied that someone was to drown.

Kwekwe Deputy Mayor Shadreck Tobaiwa Dies

By A Correspondent- Kwekwe deputy mayor Shadreck Tobaiwa has died.

Tobaiwa who also once served as the mayor of Kwekwe between 20082013 is believed to have succumbed to Covid-19 complications.

Kwekwe Mayor Angeline Kasipo has confirmed the development.

“Its quite devastating that we have received the reports about the death of our deputy mayor Councillor Tobaiwa,” Kasipo said.

She said Tobaiwa is believed to have succumbed to Covid-19 complications.

“We have heard that the deputy mayor might have succumbed to Covid-19 complications. We are still awaiting final confirmation on what really happened,” she said.

“He tested negative for Covid-19 a few days ago although he said he was not feeling well. I am afraid the test could have been a false negative and that’s my worry that we now have cases of false negatives where one tests negative while they will be positive to Covid-19,” she said.

The now deceased is father to aspirant Kwekwe Central Parliamentary candidate Judith Tobaiwa who is set to represent Kwekwe in parliamentary polls under an MDC Alliance ticket.

Jacob Zuma Granted “Prison” Leave To Attend Brother’s Funeral

By A Correspondent- South Africa’s jailed ex-president Jacob Zuma was granted compassionate leave from prison on Thursday so he can attend his brother’s funeral, the government said.

Zuma, 79, was sentenced to 15 months in prison for contempt of court last month after snubbing graft investigators probing his presidency.

He turned himself in on July 8 at a jail in the eastern town of Estcourt, around an hour’s drive from his rural Nkandla home.

His incarceration sparked riots and looting that escalated into the worst violence since the end of apartheid, killing at least 276 people, according to the official count.

“As a short-term, low-risk classified inmate, Zuma’s application for compassionate leave was processed and approved,” the department of correctional services said in a statement Thursday.

It added that inmates were not required to wear “offender uniform” outside correctional facilities.

The funeral for Zuma’s brother Michael is expected to take place later on Thursday in Nkandla, where Zuma is particularly popular.

Zuma’s brother died aged 77 after a long illness, according to local media.

Inmates in South Africa are usually allowed to attend relatives’ funerals — a right denied to the country’s first black president Nelson Mandela when he was in jail for fighting the apartheid regime.

Zuma’s long-running corruption trial is expected to resume on August 10, despite his request to have the case postponed due to the pandemic and recent unrest.

After nine years in office, the charismatic ex-leader was ousted by the ruling African National Congress (ANC) party in 2018 over a mounting series of graft scandals.

He faces 16 charges of fraud, graft and racketeering, and has entered a not guilty plea.

He retains a fervent support base both within the ANC and among the general public.

GVE London Clears Air On Rolls Royce Issue

By Jane Mlambo| The United Kingdom luxury vehicles seller GVE London has apologised over a viral social media video where one of their employees announced that a Zimbabwean minister had purchased a Rolls Royce they were in the process of shipping to Harare.

In a statement, GVE London said the information shared by their employee that the Rolls Royce had been bought by a Zimbabwean minister was incorrect.

“GVE London would like to apologise for any misunderstanding caused by a recent video posted on our social media implying that a vehicle we recently sold was being sold to a Minister in Zimbabwe. This was incorrect, the employee that made the statement was not involved in the sale of the vehicle and did not know that this vehicle was actually being sold to a private individual. We apologise for any inconvenience caused,” the company said.

GVE London Statement clearing Machakaire

The video in question set social media ablaze with online publications reporting that Youths, Sports and Recreation deputy minister Tinoda Machakaire was the owner of the Rolls Royce.

Machakaire has since refuted the claims saying he already has a Rolls Royce.

He added that though he has capacity to buy a Rolls Royce, the one filmed on the trending video did not belong to him.

Commenting on the GVE statement, popular Hip Hop musician Stunner urged Zimbabweans to desist from buying into every social media story.

“Nyangwe mota isiri yenyu munobvira honorable @machakairetino . Its Our fault we believe everything said on social media, kuri kuuraiwa kwemunhu panotofiwa,” said Stunner.

Veteran Journalist Burial Set For Today

Armed Robber Nabbed In Mudzi

By A CorrespondentA suspected armed robber, who was on the police most wanted list, has been nabbed while hiding at his rural home in Mudzi, Mashonaland East province, following a chase that involved a sniffer dog.

Lazurus Chinobhururuka (36) is reportedly behind a spate of armed robberies across the country and has been on the run since June this year.

Mash East provincial police spokesperson Inspector Simon Chazovachii yesterday confirmed the arrest of the suspect.

He said the suspect was found in possession of a fake Zimbabwe Republic Police (ZRP) identity card.

“Police in Murewa have busted a suspect who is believed to be the mastermind of armed robberies that have been happening in the country,” Chazovachii said.

Upon his arrest, he was searched and a police identification card was recovered.

“It is believed the suspect committed a spate of armed robbery cases and has been terrorising several victims in different places throughout the country between October 2020 to June 2021. The suspect is currently in police custody and is assisting police with investigations.”

Police said on July 15, detectives from the Criminal Investigation Department (CID) Homicide Harare received information that Chinobhururuka, of Mabvuku in Harare, was hiding at his rural home in Chinobhururuka village under Chief Nyakuchena in Mudzi.

The detectives teamed up with ZRP Murewa Canine division to carry out a raid on the suspect’s homestead.

It is reported that while on their way to his homestead, the police officers reportedly saw him driving his vehicle along a dusty road they were using and they intercepted him.

Upon realising that he had been cornered, Chinobhururuka reportedly jumped off the vehicle and bolted into the bush, prompting the police officers to give chase. Police unleashed a dog, which caught him, leading to his arrest.

Teachers Still Languishing In Poverty Despite 45% Government Offer

Recent govt offer of 45% falls far short of teachers’ minimum expectations.

Fundamentally, the offer was unilateral and not a product of engagement and therefore, one-armed banditry in nature. Nothing was done to address salary discrepancies introduced in June 2020 between teachers and other govt workers. As such, the recent offer of 45% across govt workers has widened the gap between teachers and other govt workers.

The 45% has taken the lowest-paid teacher from $13300 to $20000 and highest-paid teacher to about $35000 which fall far short of teachers’ expectations.

Above all, teachers never asked for a salary increase but restoration of the purchasing power parity of their salaries as of October 2018, viz, US$520-US$550.

As Ptuz, we encourage govt to respect fair labour practice, collective bargaining and engagement with teacher unions, let alone to pay teachers a living wage. It is prudent to urgently address the welfare of teachers, so that when schools open, possibly in September, the main thrust would be on meaningful learning and teaching to prepare pupils for examinations. Incapacitated teachers will certainly not perform a herculean feat that teachers are called upon to perform when schools open. It is our hope that govt would seriously consider this professional advice in order to create a conducive environment to assist pupils in 2021.

Compulsory Vaccination For Civil Servants

By A Correspondent- The Public Service Commission (PSC) has directed that all civil servants get vaccinated as the private sector lobbies for compulsory Covid-19 vaccination to save lives and boost economic productivity.

In an internal circular last week, the Grain Marketing Board (GMB) directed all employees to get vaccinated or not report for duty next month.

Employees from leading retail supermarkets told Chronicle that they have been instructed to get vaccinated or risk losing their jobs.

Job seekers in the public transport sector have also said they now have to present Covid-19 vaccination certificates if they are to be recruited.

Government has embarked on mass vaccination for all eligible adults, and this comes at a time when countries that have achieved herd immunity through vaccination have started to open up their economies.

These countries have since made optional, the previously mandatory wearing of face masks while social gatherings are no longer restricted.

In an internal circular to permanent secretaries of ministries and heads of parastatals dated July 19, PSC secretary Ambassador Jonathan Wutawunashe said all civil servants are considered frontline workers and should get vaccinated.

“All civil servants are considered to be frontline workers as indicated by the health authorities. All heads of ministries are, therefore, directed to ensure that all civil servants under their jurisdiction are vaccinated,” said Ambassador Wutawunashe.

He said unvaccinated employees will no longer be allowed to board PSC buses.

Zimbabwe Teachers Association chief executive officer Dr Sifiso Ndlovu commended the PSC for taking a bold step, saying the decision was made in the interest of public health and protecting employees.

“The question is, are people safer when they are vaccinated or not? Science is now proving that those who are vaccinated – and according to the efficacy levels – are likely to survive more than die. So, the choices that we are making in the interest of public health are important,” said Dr Ndlovu.

He said the decision will in the long run protect employees from the adverse effects of contracting Covid-19, although this does not mean they will not be infected in case they are exposed to the deadly virus.

“In the interest of public health that position must be supported by all progressive Zimbabweans. That decision informed by scientific research is a decision that is taken in the interest of Zimbabweans. Therefore, let’s support it and ensure that everybody must get activated to vaccinate,” he said.

Confederation of Zimbabwe Retailers (CZR) president Mr Denford Mutashu said making vaccination mandatory will prevent economic disruptions.

He encouraged more business entities to compel their employees to be vaccinated.

“The CZR supports mandatory vaccination initiatives adopted by many companies in Zimbabwe as a way of acceleration towards attainment of a herd immunity as the third wave surges. More workers will be vaccinated and Government will not be compelled to shut down the economy completely as Covid-19 cases and deaths will be reduced. Business should take leadership of the vaccination drive across the economy and reduce the spread of the virus,” he said.

Confederation of Zimbabwe Industries vice-president Mr Joseph Gunda said in light of how first world countries are adjusting, mandatory vaccination might be the best option.

“We see what is happening in other countries where this thing started. For example, the United Kingdom, they have opened up from the 19th (of July). It’s all systems go for them, all courtesy of vaccination. Even at the recent Euro football championships, we saw crowds, 60 000 people were in Wembley, no social distance, no masks and where is that confidence coming from? In my perspective, it is coming from the achieving of herd immunity which is proof that vaccinations are working,” said Mr Gunda.

“I know it’s not compulsory, it’s up to each individual but it makes sense when you look at statistics of what is happening. We don’t seem to have a way out and the way out is vaccination. It will boost us as an industry.

“We will definitely have all our employees back at work, it will boost productivity and within a couple of months we may be able to go back to normal.”

However, Zimbabwe Congress of Trade Unions secretary general Mr Japhet Moyo said making vaccination mandatory should be a position that is implemented after it is agreed at national level through the Tripartite Negotiating Forum (TNF).

TNF brings together Government, industry and labour under one roof to discuss any relevant matter.

“Unfortunately, at the moment at national level, we have not engaged in that conversation. We had hoped that this issue would find its way at the TNF but as a labour body, I’m aware of the campaigns that have been done by other federations.

“For instance, in South Africa, Cosatu has made it clear that they expect the citizens to be vaccinated, it is because of the conversations that they had with social partners. There is an agreement at national level that let’s get everyone vaccinated,” said Mr Moyo.

Zimfact Dismisses George Charamba Remarks On COVID-19 Vaccines

Chinese, Russian and Indian COVID-19 vaccines registered for use in Zimbabwe have all been approved by the World Health Organisation and are part of the Covax scheme.

Source:
Presidential spokesperson George Charamba, via Twitter.

RATING:
Misleading. Only the two Chinese vaccines – Sinovac and Sinopharm – have received WHO approval. Russia’s Sputnik V and India’s Covaxin, the other vaccines approved by Zimbabwe, are yet to get WHO emergency use listing. Covax has indeed signed a deal to include the two Chinese vaccines in its scheme, but has not done so for Sputnik V and Covaxin.

This is only partly true. According to the latest available WHO information, Sinopharm and Sinovac did receive the global health watchdog’s nod on 7 May 2021 and 1 June 2021, respectively. On 12 July 2021, the Covax scheme, a multilateral facility set up to procure and distribute COVID-19 vaccines equitably to include low-income countries, announced an agreement to procure up to 550 million doses of both Sinopharm and Sinovac between July 2021 and mid-2022.

Neither Sputnik V and India’s Covaxin have been approved for emergency use by the WHO or contracted for purchase by Covax for distribution to participating countries. These two vaccines are at different stages of the WHO evaluation process.

CONCLUSION:
The claim that all COVID-19 vaccines approved by Zimbabwe and currently in use in the country have also been cleared by the WHO and signed up for distribution by Covax is misleading. This is only true for the Sinopharm and Sinovac vaccines, while Sputnik V and Covaxin still await WHO authorisation and have not been contracted by Covax.- Zimfact

Buffalo Gores Kariba Woman

A Kariba woman on Sunday afternoon sustained serious injuries when she was gored by a buffalo on the outskirts of the town with ZimParks saying that with overpopulation of wildlife in conservation areas animals will encroach on human lands in search of food.

Ms Kerry Murimbika (29), who is recuperating at Kariba District Hospital, was gored by the wounded buffalo on her left thigh with the beast’s horn protruding to the other side. She was attacked near the town’s sewage ponds while looking for manure.

ZimParks spokesperson Mr Tinashe Farawo described the attack as unfortunate and a direct result of growing wildlife populations in the area.

“The attack is one of many attacks that we have been witnessing across the country. While the attack is unfortunate, it is a sign that wild animals are overpopulated and as we are moving into dry months, they encroach into the human land in search for food.

“They have also become a danger to themselves, hence the need to depopulate the areas and translocate them to underpopulated areas,” he said.

Kariba District medical officer Dr Godwin Muza, said Ms Murimbika was now out of danger and would be discharged from the hospital soon.

According to eyewitnesses, the woman was thrown into the air before she was gored by the buffalo’s horns.

Kariba is seeing such attacks. A Kariba man was recently trampled to death by an elephant while a nine-year-old girl survived an attack by a stray elephant by a whisker.- The Herald

Looted Coffin Found

coffin

By A Correspondent- Nothing was safe from the looters.

The dead and anything associated with them are usually respected, but not by these people who looted a coffin.

On Monday 19 July, police tweeted that police recovered a coffin in the Ezinqoleni area in KZN after they raided a house

Residents could only look on in shock as the coffin was taken out of the home.

The recovery of the coffin shocked social media users who couldn’t believe anyone would loot a coffin.

It’s not yet clear why it was looted and for what it was going to be used for, or whether those who were found in possession of the coffin were arrested.

On Sunday 18 July, the National Joint Operational and Intelligence Structure, co-chaired by the National Defence Force, the police and the State Security Agency, encouraged those who had looted items to voluntarily return the goods or face possible arrest.

It said a total of 3 407 suspects had been arrested on various charges since the violence broke out over a week ago, with only one suspect being granted bail.

It said 1 122 people were expected to appear in various courts in Gauteng and KZN, and the remaining dockets were under investigation.

Cop spokeswoman Mathapelo Peters confirmed security forces had embarked on recovery operations with the collaboration of citizens who have gone out of their way to give tip-offs to the police.

Peters applauded community members who had been cleaning up their streets and business premises affected by the looting in the past week.

“A warning has also been issued to those who were not part of the looting spree but are buying stolen property from the looters that they too will be arrested for being in possession of stolen property,” she said.

Meanwhile in KZN, 92 suspects have been arrested over the weekend for being in possession of stolen property.

GVE London Clears Machakaire Of Controversial Rolls Royce Ownership

ZIFA Defends Logarusic

The Felton Kamambo-led ZIFA administration will not be pressured by the masses to into sacking Warriors coach Zdravko Logarusic.

Pressure continues to mount on the association to fire the under-fire Croat, amid a poor record of one win in 12 matches, worsened by the dismal display at Cosafa.

ZIFA though, will not rush to sack the outspoken coach.

“The position shared by the administration, even the president (Kamambo) is that sacking the coach is not our plan right now. We have the World Cup qualifiers coming up and if we fire him and go on to lose, the same people calling for his sacking right now, will criticise us,” a source at ZIFA, who chose to speak on condition on anonymity, told Soccer24.

“The coach stays, to continue with the mandates given by the association when he came in. We appreciate concerns from football stakeholders but we are very calculative in our decision-making,” he added.- Soccer24 Zimbabwe

Tobacco Smoking And Social Interaction

  1. Smokers have a greater risk of developing a severe case and dying from COVID-19.

Tobacco affects your looks almost immediately
  2. Everything stinks! From your skin, to your whole house, your clothes, and your fingers and breath.
  3. Tobacco causes teeth to yellow and creates excess dental plaque.
  4. Smoking tobacco and the use of smokeless tobacco cause bad breath.
  5. Tobacco makes your skin wrinkly, making you look older faster. Smoking prematurely ages the skin by wearing away proteins that give the skin elasticity, depleting it of vitamin A and restricting blood flow.
  6. These wrinkles are more apparent around the lips and eyes and tobacco also makes skin leathery and dry.
  7. Tobacco smoking increases the risk of developing psoriasis, a noncontagious inflammatory skin condition that leaves itchy, oozing red patches all over the body.

It threatens the health of your friends and family – not just you.

  1. Over 1 million people die every year from exposure to second-hand smoke.
  2. Non-smokers exposed to second-hand smoke are at risk of developing lung cancer.
  3. Cigarettes remain an important cause of accidental fires and resulting deaths.
  4. E-cigarettes also expose non-smokers and bystanders to nicotine and other harmful chemicals.
  5. Being exposed to second-hand smoke may increase the risk of progression from tuberculosis infection to active disease.
  6. Being exposed to second-hand smoke is associated with type 2 diabetes.

Smoking or using e-cigarettes around children compromises their health and safety

  1. Smokers’ children suffer reduced lung function, which continues to affect them in the form of chronic respiratory disorders in adulthood.
  2. Exposure of children to e-cigarette liquid continues to pose serious risks. There is a risk of the devices leaking, or of children swallowing the liquid.
  3. E-cigarettes have been known to cause serious injuries, including burns, through fires and explosions.
  4. School-aged children exposed to the harmful effects of second-hand smoke are also at risk for asthma through inflammation of the airways to the lungs.
  5. Children under 2 years of age who are exposed to second-hand smoke in the home could get middle-ear disease possibly leading to hearing loss and deafness.
  6. Quitting smoking decreases the risk of many diseases related to second-hand smoke in children, such as respiratory diseases (e.g., asthma) and ear infections.

Tobacco use has negative social consequences

  1. You want to be a good example for your kids, friends, and loved ones.
  2. Tobacco use can affect social interactions and relationships negatively.
  3. Quitting means there are no restrictions on where you can go – you can mingle socially, without feeling isolated or having to go outside to smoke.
  4. Quitting can make you more productive – you won’t have to stop what you are doing to have a smoke all the time.

It’s expensive – you could be spending your money on more important things

  1. One study found that smokers burn through an average of $1.4 million in personal costs, includes spending on cigarettes, medical costs and lower wages brought on by smoking and exposure to secondhand smoke.
  2. Tobacco use affects the health and productivity of workers making them prone to missed days at work.
  3. Tobacco use contributes to poverty by diverting household spending from basic needs such as food and shelter to tobacco.

Jah Prayzah, KVG Used To Advertise Residential Stands With Questionable Title Deeds

By A Correspondent| Popular musician Jah Prayzah and Star FM presenter Kudzai Violet Gwara have been roped in to advertise residential stands being sold at Pomona City using fraudulently acquired title deeds.

Jah Prayzah holding his offer letter for his Pokugara Estate property

The original title deeds for Pomona City which is Stand Number 654 Pomona Township were deposited at Coghlan, Welsh and Guest Legal Practitioners as part of an agreement between West Properties’ sister company Augur Investments OU and a construction company, Fairclot Investments and will only be released at the consent of both companies.

Augur Investments subcontracted Fairclot Investments trading as T&C Construction for the construction of Airport Road but the two have not agreed on payment terms forcing the latter to approach the court to stop any development until their conflict is resolved.

Augur Investments roped in the Sheriff of Zimbabwe to try and forcefully get the title deeds from Coghlan, Welsh and Guest to no avail.

KVG advertising stands at one of West Properties premises

“Please be advised that Augur Investments OU (Augur) and Fairclot Investments Private Limited trading as T and C Constructions (T and C) signed an agreement on the 25th of March 2013 wherein we were appointed escrow agents with the duty to hold the title deeds in issue in trust.

“We are therefore unable to release the title deeds to you without the consent of both Augur and T&C,” reads a letter from Coghlan, Welsh and Guest to Sheriff of Zimbabwe, Mcduff Madega.

Madega went on to file a High Court application to force Coghlan, Welsh and Guest to surrender the title deeds was also dismissed with costs.

“It is ordered that the claimant’s claim the immovable property known as stand number 654 Pomona Township situate in the District of Salisbury measuring 273,2923 hectares held under Deed of Grant 2884/2010 which was placed under attachment in  execution of the order in HC3931/19 be and is hereby dismissed,” reads the High Court ruling by Justice Edith Mushore.

Grounded, Sheriff of Zimbabwe then sought government endorsement to get a copy of the title deeds from the Registrar of Deeds which they are now using to sell the land.

The company, West Properties has since since ropped in Jah Prayzah and KVG to advertise Pomona City to home-seekers.

Attempts by T&C Construction to warn home-seekers against buying stands at Pomona City by erecting a billboard along Borrowdale road landed them in trouble as they were arrested for criminal nuisance.

The matter is still pending before the courts.

Meanwhile, Jah Prayzah and KVG are also advertising Pokugara Estate which is a subject of conflict between Ken Sharpe and Harare businessman George Katsimberis.

According to sources close to the conflict, Sharpe and Katsimberis entered into a joint venture agreement for the development of Pokugara Estate with former contributing land, the latter bringing in money for development of cluster homes.

The deal fell apart after Sharpe reportedly chickened out despite the fact that Katsimberis had invested over a million into the joint venture.

Police unleashed a dog, which caught him, leading to his arrest.-newsday

More Soldiers Deployed As Taxi Wars Escalate

By A Correspondent- More soldiers have been deployed to join the South African Police Service (SAPS) in Cape Town, to put an end to the ongoing taxi wars.

Since the start of the year, at least 80 people have been killed in taxi-related shootings.

eNCA reports that over the last two weeks, violence has erupted again in the city despite a peace agreement between warring factions.

Now, local government and police are focused on restoring calm.https://www.youtube.com/embed/4Z9a3iBbRcY?feature=oembed.

taxi wars

eNCA’s Monique Mortlock shares more details in the video above.

Violence is very common on South Africa’s various taxi routes.

Mini-bus taxi owners are part of a multi-billion Rand industry in South Africa and the recent killings in the Western Cape show just how far some are willing to go to take out competitors for a piece of the lucrative pie.

In February this year, Western Cape Transport MEC Bonginkosi Madikizela says efforts have been made by the provincial government to resolve the feuds between rival taxi associations but says the taxi industry has a tendency not to obey the law.

“Vaccines For MDC Alliance”: US Responds

By A Correspondent- The United States yesterday hit back at claims by the Zimbabwean government that it had provided over half a million vaccines to the opposition MDC Alliance.

In a terse statement following allegations by presidential spokesperson George Charam ba to the effect that the US had provided the opposition MDC Alliance with “unregistered Covid-19 vaccines”, the US embassy in Harare, through its public diplomacy section, said it would provide vaccines to African countries in a transparent manner through the Africa Union’s COVAX facility.

“United States government vaccine deployment is very transparent and will come to Africa through the COVAX/AU mechanism. The United States government has not provided any entity in Zimbabwe with vaccines to date,” the embassy said.

Charamba claimed on his Twitter handle @ Jamwanda2 that the MDC Alliance was stuck with half a million unregistered vaccines sourced by the US government.

He further claimed that the US embassy’s strategy was to “stampede” the Health ministry to force government to accept importation and administration of unregistered vaccines, using the COVAX facility.

Charamba added that the move would then provide cover to “this political donation”, further alleging that the MDC Alliance had plans to inoculate its supporters only.

Zimbabwe has turned down vaccine donations from the United Kingdom and US, while giving preference to vaccines from eastern countries such as China, Russia and India.

Currently, government is rolling out a mass vaccination programme which targets to get 10 million people, about 60% of the population jabbed with vaccines from the three countries.

In another incident, police have warned the public in Harare against boarding an unregistered Toyota Wish with three occupants including the driver.

The suspects are offering unsuspecting members of the public lifts and later rob them of their valuables after diverting off the route.

In other news, iHarare had reported that a soldier with the elite Presidential Guard Infantry Ballation reportedly fled with a bullet lodged in his rib cage after he was shot by Criminal Investigations Department (CID) officers during an armed robbery shootout.

This comes after he and his co-accused robbed Chitungwiza fuel service station of cash, a firearm, and other valuables.

The soldier, Arnold Matetepa (38), was arrested last week as he sought medical treatment at a health centre in Harare and was brought to court on Saturday facing armed robbery charges.

Govt Cautioned Against Compromising Vaccine Cards Quality

By A Correspondent| Zimbabwe Lawyers for Human Rights (ZLHR) has asked the Ministry of Health and Child Care to issue proper vaccination cards to people who would have been vaccinated against coronavirus to avoid compromising the ongoing countrywide inoculation programme.

In a letter written to Health and Child Care Minister Constantino Chiwenga, ZLHR lawyer Paidamoyo Saurombe advised the Vice-President that the human rights organisation had observed that some vaccination centres were not issuing vaccination cards and were instead issuing out hand written papers as vaccination cards.

Saurombe stated that considering the efforts being made by the Ministry of Health and Child Care to roll-out coronavirus vaccines across the country, the failure to issue out proper vaccination cards will compromise these efforts.

The human rights lawyer said at the commencement of the vaccination programme, Chiwenga’s ministry indicated that paper vaccination cards were being issued as a stop-gap measure while electronic vaccination cards would be issued out.

However, Saurombe said instead of moving towards issuing electronic vaccination cards, it appears the Ministry of Health and Child Care is retrogressing to issuing out handwritten notes in place of electronic cards.

Saurombe reminded Chiwenga that the right to health-care and human dignity enshrined in the Constitution can only be realised when proper documentation is issued out to people.

He expressed fears that the vaccination programme will be derailed and compromised if proper documentation is not issued out to people accessing vaccination at some treatment centres hence it is in the government and people’s interest to have proper documentation issued out.

Saurombe asked Chiwenga to advise ZLHR on the progress that has been made in having electronic cards issued out and the immediate measures that the Ministry of Health and Child Care will take to have proper vaccination cards issued out.

Kazembe, Matanga Ordered To Compensate Woman Who Was Assaulted By Police During Demo

By A Correspondent| Harare Magistrate Victoria Mashamba has ordered Home Affairs and Cultural Heritage Minister Hon. Kazembe Kazembe and Zimbabwe Republic Police (ZRP) Commissioner-General Godwin Matanga to pay damages amounting to RTGS$175 000 to 67 year-old Lillian Chinyerere as compensation for the pain and humiliation which she suffered in 2019 when some law enforcement agents assaulted her during an anti-government protest.

Represented by Tinashe Chinopfukutwa of Zimbabwe Lawyers for Human Rights, Chinyerere sued Hon. Kazembe and Matanga on 22 January 2020 claiming payment of damages amounting to RTGS$175 000 arising from the assault by ZRP officers.

Chinyerere was assaulted by some truncheon-wielding ZRP officers on 16 August 2019 near Africa Unity Square in central Harare together with other protestors who were participating in a peaceful anti-government demonstration.

As a result of the assault by ZRP members, Chinyerere sustained injuries on her back, on her hands and a dislocated finger and had to seek medical treatment.

In court, Chinopfukutwa argued that Chinyerere’s dignity was severely impaired due to the inhumane and degrading treatment she was subjected to by ZRP officers as she is an elderly member of the society and was also humiliated by the vicious assault in full view of the public.

Chinopfukutwa said the 67 year-old Chinyerere was subjected to pain and suffering and nervous shock emanating from the injuries which she sustained as a result of the unlawful assault perpetrated upon her by ZRP officers.

The human rights lawyer argued that Hon. Kazembe and Matanga are liable to compensate Chinyerere for the damages which she suffered as a consequent of the unlawful assault by ZRP officers as the law enforcement agents were acting within the scope of their employment and under the control of the two.

By assaulting Chinyerere, Chinopfukutwa said ZRP officers had violated her right to human dignity, right to freedom of assembly and association and freedom to demonstrate and petition enshrined in the Constitution.

Out of a total of RTGS$175 000, Magistrate Mashamba said RTGS$100 000 is compensation for damages for affront to dignity, humiliation and embarrassment while RTGS$75 000 is payment for damages for pain and suffering.

This is the second time that the court has ordered ZRP and the Ministry of Home Affairs and Cultural Heritage to compensate Chinyerere as in 2018 the then High Court Judge Justice Nicholas Mathonsi ordered ZRP and Hon. Cain Mathema, who served as Home Affairs and Cultural Heritage Minister to pay $13 500 in damages to her after she was assaulted by some law enforcement agents on 26 August 2016 during an anti-government protest.

Govt Acts Tough On Vaccination For Civil Servants

All civil servants should now be vaccinated with Government boosting national vaccine supplies through an order of 1,5 million doses expected this week and another 1 million on Sunday, backing up the 2,5 million doses that have arrived since late last month to launch the present acceleration of the national programme.

Cabinet decided yesterday that as all civil servants should now be vaccinated, those unvaccinated will no longer be entitled to Covid-19 insurance and as it cuts duty staff to 25 percent to decongest offices on two-week rotations, vaccinated staff will be given priority.

The move to push forward faster on vaccination and the greater decongestion of civil service workplaces is part of measures to combat the spread of Covid-19, which has seen a surge in weekly cases from 8 013 in the week ending Tuesday last week to 21 346 new cases in the week ending yesterday.

Cabinet noted that the surge is attributable to general complacency in adhering to set Covid-19 preventive measures both in communities and at workplaces.

Speaking after yesterday’s Cabinet meeting, Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa said extra steps were being taken to manage the surge.

The Ministry of Health and Child Care has developed a Covid-19 third wave containment plan, the highlights of which include increasing the bed capacity at Mpilo and Sally Mugabe Central hospitals, strengthening private sector participation, and improving conditions of service for health workers, said Minister Mutsvangwa.

Beatrice Road Infectious Diseases Hospital and Ekusileni Hospital are being designated as Covid-19 district hospitals for Harare and Bulawayo, while virtual hospitals will be operationalised. This will see every district having a rapid response team to attend to cases of acute Covid-19 clinical distress.

The Covid-19 risk allowances are being reviewed. A locum-based Covid-19 risk allowance payment model will be adopted for the health personnel in the red zone as part of the incentive schemes.

Mthuli Ncube Attempting To Steal Biti’s Brain By Revoking Tendai’s Citizenship?

Mthuli Ncube

By Farai D Hove | A letter has been sent to the Minister Of Home Affairs requesting that the former finance minister Tendai Biti’s citizenship be revoked.

The letter’s author is set to be interviewed by ZimEye on Wednesday, just as the development was mocked by many who jested saying it is Finance Minister Mthulu Ncube’s attempt to steal Biti’s brains.

It comes against the backdrop of Mthuli’s boss, Mnangagwa being accused of trying to take away MDC Alliance supporters, and former President Robert Mugabe’s corpse to obtain for himself the intellectual magic to fix the economy.

Mthuli Ncube had not responded to the jibe at the time of writing.

Meanwhile, below was the letter:

Zanu Pf Youths Bash Soldiers

By A Correspondent- Twenty eight Zanu-PF youths mainly from Samba Ranch in Chiredzi North were on Monday arraigned before Chiredzi magistrate Simbarashe Gundani on charges of assaulting six Air Force of Zimbabwe soldiers.

The 28 youths are facing assault and malicious injury to property charges.

They were remanded in custody to Friday.

They were arrested after allegedly assaulting the six soldiers and shattering their vehicle’s windscreen.

The army truck was ferrying pylons for Masimbaevanhu Clinic, which is being built by the Air Force of Zimbabwe as part of its community project.

The court heard that on Fri day last week, Sifiso Kazela (17) of village 9 Samba Ranch, Triangle, and 27 others attacked the vehicle, resulting in the injury of its occupants.

The driver, Erick Moyo Mpilo, and five passengers are still nursing injuries they sustained during the attack.

The 28 youths are part of the 265 illegal settlers in Samba Ranch, who are resisting a High Court eviction order.

The farm, measuring 9 373,79 hectares, is owned by Moses Tonderayi Chingwena, AnneMarie Chingwena, Wesley Tazvish aya Chingwena and Farai Mat sika of Woolwork Investments P/L through title deed number 3909/79.

In April this year, Woolwork Investments (Pvt) Ltd trading as Samba Ranch through its lawyers Atherstone & Cook Legal Practitioners approached the High Court in a bid to get Muhlava Tsanganye and 264 others evicted from the farm.

The lawyers argued that the applicant purchased the entire shareholding of DM Bentley & Sons (Pvt) Limited in 2002 and started farming activities.

They also argued that in 2004, government issued a certificate of no present interest which was also produced in court.

It was also stated in court that in 2015, Woolwork filed an application for the delisting of the farm, and the eviction order was granted by Justice Esther Muremba who removed the property from being State land.

This did not go down well with the illegal farmers who are determined to stay put.

The 265 families forcibly occupied the private property in 2004 despite government issuing out a certificate of no present interest on the farm.

Obert Gutu Denies Joining Zanu Pf

By A Correspondent- Newly-appointed Commissioner of the National Peace and Reconciliation Commission (NPRC), Obert Gutu has said he never joined the ruling Zanu PF party.

Gutu who is a former spokesperson of the opposition MDC said he only expressed the intention to join ZANU PF but did not complete the process.

His denial comes as the Zimbabwe Human Rights Association (ZimRights), a National Transitional Justice Working Group Zimbabwe (NTJWG) member, filed an application demanding that Gutu be removed from NPRC as section 286 of the Constitution forbids political party actors from serving as NPRC commissioners.

The NTJWG statement read:

Dzikamai Bere, the executive director of ZimRights, who deposed the founding affidavit, had submitted that on March 17, 2021, Gutu joined Zanu PF amid pomp and fanfare at State House where he was welcomed to the political party by President Mnangagwa.

But in a shock response, while admitting the reports and the article (Sunday Mail, 21 March: Why I joined Zanu PF) explaining his decision to join Zanu PF, Gutu submitted that he was yet to submit a formal application and had not paid the required joining fee.  He said he had abandoned the idea of joining Zanu PF when he was appointed to NPRC.

Ironically, Gutu was in March paraded at State House by President Emmerson Mnangagwa, who announced that the former MDC-T vice-president had defected to the ruling party.

Some have been calling for Gutu’s dismissal from NPRC over his recent remarks on Gukuruhundi atrocities that killed over 20 000 civilians in the Matabeleland and Midlands provinces.

Gutu said Gukurahundi constituted a small fraction of the issues the NPRC was dealing with.

Civil Servants Gets 50 Percent Pay Rise

THE GOVERNMENT has increased civil servants’ salaries by between 45 percent to 50 percent as it fulfils a promise to stagger the wage increment for employees.

In April, Government increased civil servants’ salaries by 25 percent and committed to further increase the salaries mid-year.

Further, Government has availed numerous non-monentary incentives to cushion workers.

Civil servants’ unions yesterday confirmed that members have received a salary increment this month.

Public Service, Labour and Social Welfare Deputy Minister Lovemore Matuke said the civil servants’ salary increment is part of Government’s commitment to addressing their welfare issues.

He said Government will continue to fine-tune the non-monetary benefits of employees as it embarks on creating a conducive environment for workers.

“There are loans being provided to civil servants so that they can start businesses, there was also a vehicle scheme to import vehicles duty free, this has been rolling for about 10 years and is pending renewal.

“We also are looking into the issue of housing. We are working on providing civil servants with accommodation and this is gradually happening. There are a number of options and some of the options will be coming from their unions suggesting how we can improve their welfare but on the side of Government we welcome all suggestions that will benefit our employees,” he said.

Zimbabwe Teachers Association (Zimta) chief executive officer Dr Sifiso Ndlovu said he has also been notified that the lowest grades in public service received a 50 percent salary increment, more than the pledged 45 percent.

“Judging from the gross figures that I have seen, they have slightly gone beyond their promise in the general terms but in the specifics it’s not. The talk in general is that the increment would be 45 percent but they have effected a 50 percent increment. Meaning this is a sliding scale and how that sliding scale will affect the teacher is what we need to discuss and fine tune in the consultative process,” said Dr Ndlovu.

He said President Mnangagwa had highlighted the pay rise when he responded to a letter they wrote to him.

“We are aware of that position and as an association we received that confirmation from His Excellency. What has not been given are finer details to the beneficiaries who are the workers,” he said.

Dr Ndlovu said civil servants want to be more involved in decisions made on their welfare.

“I would say while that award is coming out of the previous negotiations, the future awards should be founded on collective bargaining. This is where they are running short in terms of creating the correct legal environment for consultation, negotiation and coordination of the results that we are looking for,” said Dr Ndlovu.

Apex Council chairperson, Mrs Cecelia Alexander said Government has honoured the pledge it made earlier this year.

“Yes, it has been implemented (salary increments). They have paid the 45 percent increment but it’s an increment that we had not reached an agreement on. And looking at the prevailing environment we can only accept the payments and hope that as soon as the Covid-19 situation improves, we want to get back to the matter because 45 percent is not what we can settle for,” said Mrs Alexander.

“This is an amount that was proposed by Government, it came as a 70 percent which was supposed to be staggered; 25 percent and 45 percent which they paid now. But to us it’s an issue and we hope that as soon as the situation stabilises, we would get back to the negotiating table.”

She said the rising Covid-19 infections are affecting the negotiation processes.

In response to a letter from the Zimta CEO, President Mnangagwa in April said he is touched by the plight of teachers and Government acknowledges that there is a need to improve civil servants’ remuneration.

The President said while Government is working to address civil servants’ income concerns, it is implementing policies that are against triggering hyper-inflation.

He said Covid-19 has affected Government programmes as it has led to depressed revenue inflows as a result of national lockdowns.

President Mnangagwa said despite those challenges, he has instructed ministries to come up with modalities that would result in the gradual improvement of civil servants’ salaries.

Wiwa: Road to People Power

Job Sikhala...

20 July 2020, Road to People Power :

By Hon Job Wiwa Sikhala :
MP Zengeza West.

They generally don’t call. This early morning call transmitted confusion to me when I was bathing. It always don’t happen that way. I quickly knew, some red alert message was coming. I knew it was no time to waste for a second. I answered the phone when I was already in my the bedroom ready to bolt out. Bathing was abandoned. It was a morning I was preparing to go to my office then mid morning appearance at Chitungwiza Magistrates Court to fight for other people’s freedom.

Job Sikhala...
Job Sikhala

I received the message and quickly jumped into my car in my undergarments and away I vamoosed. I immediately phoned Hopewell Chin’ono and Jacob Ngarivhume that I have received some dangerous news that the previous night JOC meeting had resolved to get us arrested and dumped us in prison for a long time. Hopewell told me that his house was already surrounded. Jacob said, he was already nabbed while on his knees praying in the church next to his house.

I walked away into the bushes. Kwakaenda imbwa ndokwaenda tsuro. An old woman kept me before I moved to my rural village. What happens thereafter is a story for another day.

I heard that my friends Hopewell and Jacob were denied bail and thrown at Harare Remand prison. Bail was denied and I called upon and challenged myself that, the agenda to abort 31st July will not work. Even if they were going to arrest me someday, the impact of the people’s outcry against corruption, human rights abuses, torture and closure of political space must be heard loudly on all corners of the world.

I intensified the campaign from wherever I was and made sure that ndapinza regime and its surrogates busy. I vowed that even if I remain by myself I will make the noise that will be felt right on the doorsteps of the evil regime.

I was kept informed step by step and updated on the intensification of my man hunt. The regime released all its security apparatus to every corner of the country hunting for me. Everytime I received that message, I would kneel down and pray. Never underestimate the power of prayer. I am testimony to how much it kept me going.

I sharpened my intelligence skills to sniff every small detail of what was happening. This kept me going for sometime. The mistake was moving with a team. Big lesson learnt there.

I still had the desire and energy to keep them busy. The support among the people of Zimbabwe was unprecedented. The world was now focused on Zimbabwe. SADC countries were speaking. AU was speaking. The UN Human Rights Council was speaking. Former and present Heads of State where speaking. Zimbabweans were speaking. Everyone was speaking. It was folly for anyone to underestimate the wave of the moment. It was the people’s moment. I could feel it wherever I was.

Zimbabwe was ready for the time. Contacts from throughout the world urging me not to buckle kept me going. When the nation from rural villages, to townships, growth points and towns where shutdown, I look back with pride how Zimbabweans flexed their muscles.

That was the gigantic moment of the people. The regime was left nose bloodied, angry and in confusion. I liked every moment of it. The spirit of the emancipation of our people was at its peak. That was the 1960s, 1970s moment. When people were full of the euphoria for their freedom and independence.

Freedom and independence shall truly come. I ?.

Govt Reduces Workforce To 10%

By A Correspondent- Government has further decongested its workforce to 10 percent from 40 percent and temporarily closed some of its district offices in Hwange after staffers tested Covid-19 positive.

In a circular dated July 19, Public Service Commission (PSC) Permanent Secretary Ambassador Jonathan Wutawunashe directed Government departments to ensure that 90 percent of staffers worked from home to minimise physical interactions at offices and stem rising Covid-19 infections. Ambassador Wutawunashe said the new directive should be implemented with immediate effect.

“Reduce the number of staff coming to work from 40 percent to 10 percent for all the ministries, departments and agencies with the exception of the Ministry of Health and Child Care and designated critical services with immediate effect,” said Ambassador Wutawunashe.

“Line ministries to rotate staff in such a manner that no employee shall remain at home for more than 21 days stretch. There shall be strict monitoring and enforcement of staff attendance at workplaces.”

Ambassador Mutawunashe directed that social distancing be observed in PSC buses and that they carry a maximum of 35 passengers. Posting on microblogging site Twitter, Permanent Secretary in the Ministry of Information, Publicity and Broadcasting Services Mr Nick Mangwana said the necessary changes would affect service delivery.

“Only 10 percent of civil servants are going to work as the PSC takes measures to decongest workspaces as part of the fight against Covid-19. This may have serious effect on the quality of service the public will receive, please bear with us,” said Mr Mangwana.

Mr Nick Mangwana Meanwhile, some Government departments operating from the Hwange District Development Coordinator (DDCs) offices have temporarily closed after some staff members tested Covid-19 positive.

The DDC building houses Ministries of Local Government and Public Works, Women Affairs, Community and Small and Medium Enterprises Development, Information, Publicity and Broadcasting Services, and Mines and Mining Development. It also houses the Environment Management Agency, Registrar General office, ZimStats, District Development Fund, Forestry Commission and the Department of Lands, among others. Chronicle understands that six workers tested positive last week resulting in the closure of the whole complex on Friday for fumigation.

Those who tested positive are isolating at home. The premises were fumigated on Sunday paving way for opening of a few offices yesterday while others remained closed. Scores of people seeking to apply for birth certificates and National Identity cards were yesterday turned away as the Registry Office scaled down operations as a result of the positive cases.

Few staff at the office were serving clients who were seeking burial orders while those in need of other documents were being turned away. Hwange DDC Mr Simon Muleya said, “The premises have been fumigated and some are back at work. This is a busy place with citizens seeking various kinds of services. Those who tested positive are isolating at home,” he said.

Matabeleland North Provincial Medical Director Dr Munekai Padingani said Hwange remains the leading hotspot in the province. On Sunday the province recorded 60 new cases, 22 of them coming from Hwange. Dr Padingani said despite the increase in new cases in the coal mining town, uptake of vaccination exercise remains very low. He however, said the low number of people turning up for vaccination in the town could be a result of the huge number of positive cases as those who test positive are not vaccinated until they recover.

“There is no other institution hit by Covid-19 so far. On Sunday we reported 60 cases and a majority of them are from Hwange and we will continue intensifying sensitisation as we want people to come and get vaccinated,” he said.

Last week, Binga District Hospital was hit by the virus with a number of the positive cases comprising pregnant women housed at the institution.

A few days ago, the Zimbabwe Power Company announced that the Hwange station had recorded 110 cases.

“The station is having an upsurge in Covid-19 cases and has so far recorded 110 cases to date with three recoveries. Contact tracing is underway for all the affected employees. Everyone is encouraged to adhere to Covid-19 regulations to ensure risk reduction,” said the power station management in a statement.

Dr Padingani, who was in Bubi district yesterday, said there were queues in the area as people were getting vaccinated. He said about 60 returnees currently at a quarantine facility in Inyathi had tested negative and were waiting to be discharged.-statemedia

High Internet Costs Irk Consumers

By A Correspondent- Eight gigabytes (GB) of private internet data from Zimbabwe’s largest mobile network company at the beginning of 2021 cost US$15, or $1 300.

From March 10, the same 8GB shot to US$18, equivalent to $1 560, with 50GB of private internet data from Econet Wireless rising to US$47, which is about $4 000.

Beginning July 8, Econet, which has more than four million subscribers, revised its data pricing upwards. Subscribers have to part with US$23 to buy 8GB of private data while the highest private bundle of 50GB has been priced at the equivalent of US$73.

Indigenous dealers not spared

For many, like Gift Tseyani, 23, who is a high school dropout, but an avid internet-based news consumer, the latest hike in prices at Econet has crumbled his quest for news.

He said he could not afford the cost.

The secondhand mobile phone street vendor said reading news on the internet had suddenly become a luxury.

“I have stopped subscribing to private wifi internet on my mobile phone and yes, I have been a regular subscriber of Econet private wifi, but with the prices up again now, I just have to do without internet,” Tseyani told Anadolu Agency.

Even the popular WhatsApp messaging service monthly data package at Econet now costs more than US$5, leaving the price beyond reach for many like Tseyani.

Virtual learning under threat from expensive data The situation is worse for Harare-based Netty Chiwawa, 44, a teacher and mother of three school-going age children who had to switch to virtual learning during lockdowns to curtail the spread of the coronavirus.

Netty works as a government primary school teacher. Having capitalised on the lockdown to conduct private lessons with students to earn extra income, the stream of money has been curtailed by exorbitant internet costs as she has to conduct lessons virtually.

Her own children have also not been spared by the crisis given that they have a single parent whose monthly income can no longer meet their internet requirements for virtual learning during the lockdowns.

“I can’t continue with the online private lessons because internet data is now too expensive and that means loss of business for me,” Chiwawa told Anadolu Agency, adding that it means her children have no choice but to quit virtual learning.

Government workers most affected

Teachers employed by the government, like Chiwawa, currently earn US$200 monthly.

But according to the Zimbabwe Teachers Association (ZTA), teachers have been demanding salaries of about US$550. For Chiwawa, at least increased wages may revive her dream of affording her children’s virtual learning amid lockdowns. But the government has not acceded to the demands of its workers, like teachers.

Virtual trading threatened by high data costs

Businessmen like Petros Musasiwa, 36, a vehicle accessories dealer who trades his products via social media like WhatsApp, have been pounded by rising internet costs.

“I have pulled out of WhatsApp groups where I was advertising and actively selling my wares during these days of endless lockdowns. Surely, I have no capacity to stomach the internet costs which have kept rising,” Musasiwa told Anadolu Agency.

For Bernard Garwe, an academic research consultant based in Harare, it is no longer business as usual as internet costs have also drained him.

“I have always depended on the internet for all my research and with the high cost now, it means hard times for me. From now, I don’t know how I will cope,” he said.

Garwe said his business was waning as clients ditch him because he constantly went offline due to unaffordable internet costs.

“People requiring my academic consultancy in terms of their university research projects are also having a torrid time during this Covid-19 era battling to virtually link up with me as they are also victims to high internet costs,” he said.

Ranked 136th in the world for mobile data pricing in a study based on the cost of 1GB of mobile data, neighbouring South Africa’s data costs an average of US$2,67 (R38,93) for 1GB of data, with the cheapest data costing US$0,12, while the most expensive is $34,95. Sub-Saharan Africa has six of the 10 most expensive countries in the world for internet costs, with Equatorial Guinea the most expensive at US$49,67 for 1GB of internet data, according to Cable.co.uk.

Network companies passing costs on to consumers

As internet costs hound the majority of the population and companies in Zimbabwe, mobile network companies like Econet have gotten away with murder.

“The bundle price adjustment is an average 20 percent uplift across the board, and is essentially in response to rising input costs.

“Our pricing review is designed to ensure viability of the business and ensure that we continue to offer a reasonable quality of service to our valued customers,” Econet said in a statement after hiking prices on July 8.

Media not spared as data costs rise

Irked by rising costs during the peak of coronavirus cases last year, the Media Institute of Southern Africa Zimbabwe wasted no time in taking on mobile network firms like Econet.

Army Indiscipline Haunt ED Administration

By A Correspondent- Zimbabwe National Army (ZNA) commanders have convened several meetings over the past few weeks as they battle to contain rampant indiscipline among soldiers, characterised by the involvement of junior officers in high profile criminal activities like armed robberies as well as theft of rations.

This comes amid reports of heightening disquiet within the rank and file of the military, largely because of the worsening economic crisis which has left most low-ranking officers impoverished.

According to military sources, the meetings are being convened by the utmost decision-makers in the ZNA and, at a recent one held last week, it was resolved that stern punishment should meted against those caught on the wrong side of the law using internal army disciplinary and paralegal systems.

Sources said there was general concern among ZNA commanders that the level of indiscipline may spiral out of control and could further degenerate into a mutinous behaviour if left unchecked.

The generals, sources added, have in these meetings have openly expressed concern that the deteriorating economic situation in the country, underpinned by skyrocketing prices, high cost of living, has pushed the soldiers into a desperate condition: ill-disciplined, disorganised, poorly fed and poverty-stricken which is a perfect recipe for worse things.

To survive the hardships, the soldiers have had to engage in moneyspinning activities such as gold panning and street vending while others have turned to crimes like theft.

But nothing has jolted them into a panic mode more than the growing cases of soldiers getting involved in armed robberies.

“What is particularly troubling the generals is that some of these officers are part of the military’s elites and responsible for securing dignitaries. This has really worried the command element and meetings have been held to try and see what can be done to end the problem,” a source said.

“The command element’s concerns are largely over repeated acts of indiscipline by soldiers. Reports have been filtering in about members involved in crimes committed both within and outside the organisation. There are also cases whereby soldiers are involved in other activities in order to survive, for instance their involvement in activities such as gold panning, theft of rations and now armed robberies.”

“I am sure you have heard cases of soldiers who have been caught in violent clashes with illegal gold diggers and in armed robbery incidents. These have been increasing a lot and sometimes we only get to know that they are our members once they have been arrested. So this was one of the issues that was being addressed in these meetings.  What I can say is that things are not well at all these days,” the source said.

“The top people do acknowledge that the solution is not only found within the military but there is a political solution to it. For instance, the solution to the economic problems which are causing all these issues need to be politically addressed and it was resolved that the army civil relations department must take charge of the process of engaging the political leaders to alert them to the dangers facing the country if the economy is not fixed,” the source further said.

ZNA spokesperson Colonel Alphios Makotore confirmed that the meetings have been held but declined to divulge the details saying: “We do not share with the media outcomes of our meetings.”

He referred questions on the involvement of soldiers in criminal activities to the police.

“Armed robberies by their nature are acts of criminality and crime is the domain of the police. You are therefore advised to contact the Zimbabwe Republic Police (ZRP),” Makotore said.

Just last week a Presidential Guard army officer, Arnold Matetepa, was injured in a shootout with police during an alleged armed robbery incident. He managed to escape but was later arrested as he sought medical assistance.

His accomplices, still at large, got away with US$2 500 and valuables.

Another soldier from the 1 Commando regiment, another elite branch, Corporal History Sibanda, was arrested in Beit Bridge alongside a fellow state security agent, Constable Shepherd Gatsi after they allegedly robbed a businessman of R95 000 and 30 boxes of export cigarettes.

Zvidozvashe Dzuda, another army officer stationed at its Ordinance Directorate was in court recently after, alongside accomplices, he allegedly robbed Gateway School in Harare of US$25 000 and blew the institution’s safe open in search of valuables.

He is accused of having led a gang that robbed Chinese national and cannabis farmer Weng Dong of US$22 000.

A few weeks ago Chamunorwa Gingi of 2 Brigade was in the docks on similar allegations, having gotten away with US$60 000.

Home Affairs Minister Kazembe Kazembe is on record conceding army officers have become a problem.

“It is, indeed, true that most of these cases of armed robberies are being done by armed men and women from the police force as well as the army. I would like to emphasise and indicate that government is, indeed, working on that, but I would also like to indicate that such cases have decreased,” said Kazembe in Senate.

With a salary equivalent to just US$100 or less, civil servants are generally struggling to make ends meet as their wage is just a fraction of the Poverty Datum Line (PDL) of $34 626 for a family of six, currently estimated at US$350.

Woman Sustains Serious Injuries After Being Attacked By Buffalo

Logarusic Must Go- Alexander Maseko

SOUTH Africa-based football legend Alexander Maseko believes under fire Warriors’ coach Zdvarko Logarusic should not be at the helm of the national team technical set-up.

Maseko believes that while the Croat has flopped dismally based on statistics since his arrival, Zifa is also to blame for the mess.

The Warriors have managed a single win in 12 matches under Loga and they finished the last two Cosafa Cup tournaments at the bottom of the table.

They were also bottom of the 16-team Chan finals held in Cameroon at the beginning of the year.

“I don’t think this Loga guy will survive. In fact, he ought not to last any day longer. He is in the departure lounge because results speak for themselves. What is it that he has achieved? The guy is taking us nowhere and time is now for a new broom,” said Maseko.

The Cool Ruler also questioned the criteria used to select national team players and accused some player intermediaries with close Zifa connections and Warriors’ technical staff of heavily influencing the selection process.

“Firstly, when you employ a coach, you do a DD (due diligence) to make sure that his credentials suit what you are looking for.

The results since he took over are not enticing, worse still in the Cosafa competition. Obviously, his head is on the chopping block,” Maseko said.- Chronicle

Open Letter To Mr Mnangagwa

By Talent Rusere

Dear Mr Mnangagwa

20 July 2021

Firstly ,i would like to apologize for finding it difficult to call you a president due to your incompetence and ignorance towards us as a nation. Since you become president, the human collective has been treated with such huge disrespect by you, your fellow Zanu pf leaders, for way too long. You have lied to us in all ways.

Be it through saying you will do something while trying to get us to vote for you and then not delivering or changing your mind. Be it through hiding some erroneous error you or your staff has made.

Be it through hiding some scandal you have willingly participated in and then lying about it. Be it stating one reason for something when the real reason is something completely different.

Or, be it through allowing corruption to still exist at all levels of your governments, while still doing nothing effective to stamp it out, but, instead, paying billions to so-called ‘government’ investigations, programs and law enforcement strategies that never seem to ‘get’ the really’ big’ guys.

The list of lies you have told us are endless… But I wonder, what or who are you covering up and working for?

Please stop lying to our people about sanctions. Stop lying about policy decisions. Stop lying about history. Stop lying about who really controls the Zimbabwean markets and currency. In fact please stop lying about anything to do with money and budgets and credit card debt and mortgage foreclosures and interest and taxes – when you and your children are looting to hold the rest of us to ransom.

Talk to your fellow leaders I am sure they’ll tell you something is up.
Yes, ‘people’s patience and anger’ with you, your decisions and your way of ‘governing’ is what’s ‘up’.

Emerson Mnangagwa you believe you were either born to do, have a right to do, or have undemocratically been elected to do.
Yes, you did storm into power illegitimately after the 2018 elections ofwhich your behavior and lack of true and honest action in power has left the people of Zimbabwe turning away from you in droves. Almost as quickly as they celebrated you in 2017,Why? Because you’re simply not doing your job: which is serving us as a nation …you are destroying our nation Governing our country like a flea market. But why? Is it because you are clueless or you are just ignorant?

You promised us a transparent administration , we are seing some truths coming to light,But not through you, Rather, it’s been though more brave whistleblowers having to fear for their lives as they speak out against those who are the perpetrators of wrong doings why? Why are you looting our national resources Mr Mnangagwa why?

Why are big state criminals always fined while small criminals are rotting in Chikurubhi why?

Where are state criminals getting the money to pay these fines? Why are all state fraudsters free while our youths are rotting in jail for opposing your daft policies Sir why?

And yes, we’ve finally seen the truth about Zanu pf and, no doubt, most other surveillance programs and organizations in Zimbabbwe are upto spying on those who raises their voices for the best interest of the population every day why in a democratic nation? Why massive political persecutions in a democratic why?

Why are opposition activists vanishing and disappearing without a trace in a country with such a strict military like ours? Why Mr Mnangagwa?

What is our true history between the Chinese and Zanu Pf? What are the agreements behind your relationship? How did you promised to pay back the Chinese for training your army, the weapons and the loans they gave you?

Why is the judiciary, lawyers and others re-writing the truth to suit your needs and agendas?

Why do you keep covering up the presence of our prevailing economic and political crises to the world?
Why is it that just ONE per cent of the people in Zimbabwe are so rich politicians around you and their children that they own nearly everything and rule so many aspects of our lives?

Can you please tell us who is really running Zimbabwe? Who runs the banks? Why do we not have a stable currency? Why are our depts over 40% of our GDB? Why did you took loans that are supposed to be paid up in more than 20 years to come when your life expectancy is even less than 15 years? Who is benefiting from such loans and who will pay them?

Who is administrating our country? You or the Chinese? If it’s you,why are you giving them our mines? Why are you quite while they are shooting us in our own country?

Did you really sold our country to the Chinese? Who owns the Zimbabwe’s mineral markets and other resources?

Who is protecting and empowering our gold smugglers? why are all of them related to the first family?

Why does your government run more like a corporation? And why do you bend on hands and knees to do what big corporations want, rather than all of us as citizens?

Why are people really living in poverty when you, your wife and children are driving cars worth more than a million US dollars?

Can you also explain on how you and your ill gotten rich political surrogates claim to be fighting corruption yet are individually profiting from our gold ,diamonds and our public funds?

And why are you still shoving sewage into the water we drink each day – the most vital thing for life?

Sincerely

Mnangagwa Administration Speaks On UK Deportations

THE British government is deporting around 50 Zimbabwean nationals who have been released from detention after serving jail terms for various offences.
This comes as the Second Republic agreed with the United Kingdom in June that Zimbabweans, some of whom have been in the European country on false pretences, can safely return home.

Those affected are involuntary returnees who have exhausted the administrative and legal procedures and have lost the legal right to remain in that country.

In a statement the UK government said the two countries will be working closely to provide a safe landing for the returning citizens, particularly in view of the Covid-19 pandemic.

“We agreed returnees who presented a regular Covid-19 test taken less than 48 hours before arrival in Zimbabwe would be allowed to quarantine for 10 days from their chosen location”.

Part of the agreement between the UK embassy and the Zimbabwean Government, as represented by the Ministry of Foreign Affairs and International Trade is that no more than 100 people will be arriving on a monthly basis, while for logistical reasons only 50 will arrive tomorrow (today), the first batch in many years as the Second Republic opens its arms to its citizens.

Zimbabweans, however, need not fear for the returnees as adequate measures have been put in place to ensure everyone is tested before being released.

“We discussed the issue of some returnees potentially refusing to undertake the Covid-19 testing in the UK prior to the flight and agreed that they would be tested in Zimbabwe,” read the statement from the UK Harare Embassy.

Foreign Affairs and International Trade Ministry acting spokesperson Mr Livit Mugejo confirmed the development saying the individuals are classified as Foreign National Offenders.

“Any country in the world has a right to deport any foreigner from its country. The advent of Covid-19 had slowed down involuntary repatriations,” he said.

Mr Mugejo said there is nothing amiss in the deportations as they have always been taking place with nationals from other African countries and the Caribbeans also going to be affected by the latest spate of deportations from the UK.

Last week South Africa deported 220 Zimbabweans via Beitbridge border post as the neighbouring country moves to decongest migrants holding centres and minimise the rate of new Covid-19 infections.

Most of those deported had violated immigration laws (undocumented and overstaying).

“There is nothing unique in the deportations, as South Africa last week deported 220 Zimbabwean citizens, including some who were released from jails,” he said.

In the case of voluntary returns, he said the UK government is offering support through various programmes for reintegration back into the community in co-operation with the International Organisation for Migration (IOM).

“This category of deportees from the UK is different from voluntary returnees, who are our citizens who opt to come back home on their own. These are involuntary returnees who have utilised the administrative and legal procedures and have lost the legal right to remain in that country,” said Mr Mugejo.

Zimbabwe, he said, cannot refuse to accept its citizens and will welcome them back into the country. The deportees will receive the necessary social psycho support to help them with reintegration. -Herald

Obert Gutu:” I Don’t Belong To Any Political Party”

Obert Gutu

WEDNESDAY, APRIL 15, 2020

Since the Supreme Court judgment was handed down on Tuesday, March 31,
2020, I have been inundated with numerous inquiries from MDC cadres,
friends, relatives, colleagues and, of course, members of the Fourth
Estate, wanting to know whether I am going to be actively involved in
politics and proceed to participate in the forthcoming MDC extraordinary
congress to elect a substantive President to replace the late iconic
founding President Morgan Richard Tsvangirai. The main purpose of this
press release is to clear the air regarding my position in active politics,
more particularly, my continued association with the MDC.

On Saturday, January 18, 2020, I resigned from the MDC-T led by
Hon.Dr.Thokozani Khupe for purely private and personal reasons. As a
direct consequence of the Supreme Court judgment aforementioned, the MDC-T
Congress that was held at Stanley Square, Bulawayo, in April 2018, was
declared null and void. Mutatis mutandis, the MDC Congress that was held in
Gweru in May 2019 was also declared null and void. In the interim, the MDC
is currently led by Hon.Dr.Thokozani Khupe as Acting President pending the
holding of an extraordinary congress within the time limit ordered by the
Supreme Court.

As a firm believer in the rule of law and constitutionalism, I would like
to fully associate myself with and also recognize and hereby unequivocally
and unreservedly accept and uphold the decision of the Supreme Court. For
the avoidance of doubt, I do hereby accept that an extraordinary congress
of the MDC shall be held solely for the purpose of electing a substantive
President. For purely personal and private reasons, I will not be offering
my candidature for the office of President although I am absolutely
convinced that I have got what it takes to contest for the party’s
Presidency if I wanted to. I shall also not continue to occupy the position
of National Spokesperson /Secretary for Information & Publicity, again, for
purely private and personal reasons.

Going forward, I am not going to be involved in any political party
politics. I will remain an independent activist and analyst in addition to,
of course, practising law and pursuing other private business interests.
Let me take this opportunity to warmly wish my comrades in the struggle a
peaceful and successful extraordinary congress.

Two Arrested For Attempting To Enter Mnangagwa Residence

Two people have been arrested and dragged before the courts facing charges of impersonation and trespassing after attempting to get into President Emmerson Mnangagwa’s official residence.

Emmerson Mnangagwa

Nigel Rutsito was arrested Saturday outside the State House after attempting to get into the place claiming that he is a member of the spy network, the Central Intelligence Organization.

His alleged accomplice, Dylan Kanyungwe, allegedly demanded to meet with Vice President Constantino Chiwenga.

Rutsito was allegedly denied entry into President Emmerson Mnangagwa’s residence after he failed to produce a state security identity document and Kanyugwe turned violent when he was told that Chiwenga did not live at the State House.

The Harare duo’s motives are still unknown.

Local magistrate, Barbara Mateko, granted the two free bail.

Obert Gutu Says I Never Joined ZANU PF | IS HE TELLING THE TRUTH?

NEWLY-appointed commissioner of the National Peace and Reconciliation Commission (NPRC), Obert Gutu has denied ever joining the ruling Zanu PF party, adding that he only expressed the intention to do so, but did not complete the process.
Gutu was in March paraded at State House by President Emmerson Mnangagwa, who announced that the former MDC-T vice-president had defected to the ruling party.

After Gutu was appointed NPRC commissioner recently, the Zimbabwe Human Rights Association (ZimRights), a National Transitional Justice Working Group Zimbabwe (NTJWG) member, filed an application demanding that the former MDC-T vice-president ceases to be a member of the NPRC as section 286 of the Constitution forbids political party actors from serving as NPRC commissioners.

“Dzikamai Bere, the executive director of ZimRights, who deposed the founding affidavit, had submitted that on March 17, 2021, Gutu joined Zanu PF amid pomp and fanfare at State House where he was welcomed to the political party by President Mnangagwa,” the NTJWG statement read.

“But in a shock response, while admitting the reports and the article (Sunday Mail, 21 March: Why I joined Zanu PF) explaining his decision to join Zanu PF, Gutu submitted that he was yet to submit a formal application and had not paid the required joining fee. He said he had abandoned the idea of joining Zanu PF when he was appointed to NPRC,” the NTJWG said.

ZimRights, represented by the Zimbabwe Human Rights NGO Forum, is yet to file a response.

Gutu torched a storm last month when he said the Gukuruhundi atrocities that killed over 20 000 civilians in the Matabeleland and Midlands provinces was one of the many “tiny” cases the NPRC would be looking at. – Newsday

Mnangagwa’s Dance With Failure

Tinashe Sambiri|Hard-hitting MDC Alliance Youth Assembly spokesperson, Stephen Sarkozy Chuma, has accused the Zanu PF leader Emmerson Mnangagwa of misleading the nation in a bid to score political marks.

Chuma released a statement lashing out at the Zanu PF President.

According to Chuma, Mr Mnangagwa’s rate of progress is only 2%.

Read full statement below:

Mr 2%: Mnangagwa’s Dance With Failure

16-07-2021

It’s just 2% pass rate for Emmerson Mnangagwa!

Out of a whole 237 electoral promises he pledged to the electorate in 2018, Emmerson Mnangagwa managed to fulfil only 5 and that constitute only 2%.

This was revealed by a credible and independent research body, Sivio Institute.

Never mind about his useless and senseless “huge progress” rhetoric, Mnangagwa is failure personified!

Among a plethora of lies that he promised, Mr 2% failed to fulfil his 1,5 million housing program, 2000 new schools and employment pledges.

Here is a father of lies who besides dwarfing the democratic space by has virtually done nothing to improve the standards of living for the masses.

Instead of employment creation, Mnangagwa decimated the remaining informal sector through demolition of vending stalls.

Thousands of jobs were lost through criminalization of private players in the commuting transport business.

Many who were surviving from vending and commuting transport business can no longer afford to put food on the table -all thanks to Mr 2%.

Imagine all the kombi drivers, hwindis and vendors who lost their sources of income due to anti-people policies of Mr 2%!

This is a wake up call to all Zimbabweans that we should elect servant leaders who honour their promises. A pro-people and God-fearing leader in the mould Advocate Nelson Chamisa can surely do better if given a chance.

It’s time to reject Mr 2 % and all that he represents -failure!

Chimbuya and one of the accomplices were picked up by Police on Saturday while the third suspect is on the run. Chimbuya is also a tout who operates from Glow Service Station rank in the city centre.

Prophet Shaves Married Woman’s Privates

A 19-year-old married woman reportedly had her privates and head shaved during a cleansing ceremony held at a Johanne Masowe yeChishanu shrine. The shaving was conducted during a night prayer and the shaved hair were taken to a sacred cave (ninga).

Irked by the act, Moreblessing informed her mother identified as Mai Kuzivamunhu before dragging Zenda to Chief Mangwende’s court. The case against Zenda is reportedly for forcing Moreblessing to undergo the exorcising act.

Moreblessing told H-Metro that she was shaved while three men were pressing her from her back in the absence of her husband Gilfas Mundicha, 27. “I had not been going to church for long and my mother in law invited me citing that the spirit wanted to say something to me.

“Upon arriving at the shrine, one of the prophets stood up and gave prophecy on me that with or without my consent I was not going to leave the shrine until I get my hair removed. “One of the church members was quick to say she had a pair of scissors and three men who assigned to stand at my back during the cleansing.

“I was shaved while someone was pouring water all over my body and their reason was to protect my pregnancy,” she said. Moreblessing said she was told to take the hair to the cave.

“They gave me the hair in which I was told to mix it with charcoal and put it in a white cloth before taking it to the cave around 9 pm. “Some few days we had a quarrel with my mother in-law over an issue before I ended up apologizing.

“That was the reason I could not deny to undergo the cleansing ceremony she suggested for me. “Upon returning home I informed my husband who was bitter about it, to which I told my mother the following morning,” said Moreblessing in tears.

Gilfas told H-Metro that the cleansing ceremony was carried without his blessings and is not a member of the Johanne Masowe yeChishanu who conducted the unholy prayers on Moreblessing.

“I am not a follower of that church although I used to believe some of their prayers. “As for the shaving of my wife, I was not informed and I do not believe in such prayers as well,” he said.

Zenda told H-Metro that the shaving was conducted while she was asleep at the shrine although she was the one who took Moreblessing for the cleansing ceremony. “To be honest the shaving was done the time I was asleep and I do not know who exactly shaved her.

“I was aware of the prophecies made on Moreblessing concerning her pregnancy and that was what I wanted it be done to safeguard her from the spirit of witchcraft. “Iye anoziva zvakaitika saka taida kuti zvisadzokorore,” she said.

Mai Kuziwomunhu reported the case to a village head and the matter was referred to chief Mangwende where Zenda was expected to appear last Friday. The case was postponed to another date to be advised by the traditional court following the suspension of hearing cases in line with Covid-19 restrictions.- H-Metro

Pardon The Rioters And Fix The “Apartheid” Failures

By Benjamin Anyagre | This is an appeal to the government of SA to stop and not prosecute the underprivileged hungry Souls who were involved in the civil unrest in some parts of the South Africa.

Endemic hunger and want led to the loot because of non- existence or little sources of income for the masses.

The ” act” in public eyes were just a means for man to survive in a human world.

Government should therefore deal with the root causes of hunger, poverty and misery that necessitated that ” act”.
The NEO- apartheid/colonial structural system should be replaced with a pro-people/healthy socio- economic one that guarantees HOPE and prosperity.

Let us note that, these same people and many conscious ones all over the world were in some few years ago in trenches fighting for political and socio- economic liberty in SA.

Families paid with their lives and some were exiled while dead bodies littered the streets of SA with- one basic goal to end ” the obnoxious and inhuman aparthied”.
Hence, this is the epoch for the sons and daughters of SA and Africa to enjoy the wealthand fruitsof their country.

The National Question- remains ?: Why are the vast majority of citizens- still in the quagmire of pain, subjugation and sufferings ?

The recent riots in KwaZulu-Natal, Guateng and et cetera with people rushing for social needs- including mattresses, fridges, plastic chairs, food and so on……. gives enough information to leadership in SA, especially the ANC of the unsavoury plight of the people- without turning away from their predicaments.

GOVERNMENT can on an emergency note- at the Executive and Legislature discuss/ debate and provide answers to the ” SA- National Question” towards the urgent application of a progressively assuring directive principle of state policy which will provide the NEEDFUL for all.

Indeed, to refuse the culprits a pardon- will mean some kind of a control hand of apartheid- behind the curtains directing the affairs of Statehood.

Quitting Smoking Decreases Risk Of Contracting Diseases

Stop Lying To Citizens- Open Letter To Emmerson Mnangagwa

Sincerely

Talent Rusere

VIDEO: London Taxi Driver Spills The Beans On Zimbabwe Rolls Royce Purchase

By A Correspondent | A Black Taxi driver on Tuesday night speaking on live camera, reveals to ZimEye that 2 young Zimbabwean women in their early 30s who hired his vehicle a few weeks ago, arrived in Uxbridge, London where they offloaded hundreds of thousands of pounds to purchase a Rolls Royce Phantom at GVE London, the same company from whom Deputy Minister Tino Machakaire reportedly bought the same model for over USD760,000.

The Deputy Minister Of Sport is still to explain the source of his wealth.

Machakaire has been labelled a thief by his own party ZANU PF, and responding to the story at the weekend he said he “is innocent until proven guilty.”

Luke Malaba Removal Court Case, Prepare For National Referendum

PREPARE FOR REFERENDUM.

By Brian Mari | I was watching the proceedings of the constitutional court very carefully. I am interested in it right from beginning.

I must be honest. I was impressed by presence and presentation by advocate Eric Matinenga.

I was pleased to see his grey hair. Sign of wisdom. He knew for certain that these captured judges would never recuse themselves in a matter they are conflicted.

Instead of fighting to win the recusal he changed the fight to one of having the judges make some pronouncements they cannot change when the matter progress.

As far as possible stretch the judges pronounce their interests. Nothing presented was going to change their pre determined verdict on whether to recuse themselves or not.

Without realising, the judges have made very important pronouncements that Advocate Matinenga wanted very much. I thank him for that.

That is to say, they cannot recuse themselves because there is no one with judicial authority to remain after their recusal.

They also admitted that a Chief Justice is the one who can appoint acting Judges. More important from Justice Patel is that Judges do not give themselves authority.

These are the crucial points that will hang the judges and remove them from the stolen bench.

Pleasing to note that this application was brought by a Zanu pf member. It is assumed he was send to rescue judges of country.

Instead these Judges have committed a crime and not just a mere breach of constitution. Rather it is intentional crime committed.

Here is why Eric Matinenga and Musa Kika would lift us to glory.

The High Court record still hold an order that say the listed Judges cannot benefit from section 186 as amended.

Whether one wants to pursue Luke Malaba or Elizabeth Gwaunza or Garwe or Patel or any from the list, it does not matter. The process here suggested is the same and directed to each individual.

As long as the record has list of judges who are listed by name the High Court record is the sole legal document that will stand until referendum. It reads “Disposition. ln the result, we make the following order:

IT IS DECLARED THAT:

1. The second respondent in HC 2128/21 who is also the second respondent in HC 2166121 ceased to hold the office of the Chief Justice of Zimbabwe and judge by operation of law on I5 May 2021 at 0400 hours.

2. The extension of the length of time in the office of the judge beyond the age of 70 years provided for in section 186 of the constitution does not apply to the second to fourteenth and the eighteenth respondents.

3. There shall be no order as to costs.”

While the debate is focused on retirement age, however for one to fully debate this issue, you need to direct attention to section 186 as relating to Judges of Constitutional Court and then direct attention in relation to Supreme Court Judges.

Take note that to say Judge of Constitutional Court does not mean the name of a person. Just as it is to say Chief Justice.

However when a name is mentioned in relationship to the office it mean we are referring to personal interests of the named person in relation to the office.

For now I only need to look at the amended s186(2) which relate to Judges of Constitutional Court.

It reads: “Subsection 2. The Judges of the Constitutional Court are appointed for a non-renewable term of not more than 15 years but they must retire earlier if they reach the age of 70 years unless before they attain that age they elect to continue in office for an additional five years provided that such election shall be subject to the submission to and acceptance by the president after consultation with Judicial Service Commission of a medical report as to the mental or physical fitness of the Judge so to continue in office.”

If a person is seeing benefit or the non applicability of the amendment on the present judges only in relationship to time in office then you miss the point.

This section talks about being appointed as a Judge of Constitutional court for a non renewable term of 15 years

Before one argues on retiring of those same judges at 70 years or extending their tenure to 75, the first point is “do the listed Judges qualify to be appointed as constitutional court Judges for a non renewable term”?

Rather, as of 15 May 2021 was any of these Judges on a term of 15 year in office of Judge of Constitutional Court?

That is the first benefit which by the date when the High Court application was made, these judges would get by the amendment number 186 before we even get to talk about their retirements.

You do not talk about extending a term that you are not yet appointed to.

While Musa Kika could have brought these things direct to the listed judges during first hearing, the fact that the judges chose not to participate also left issues relating to them without any need to open them up. Focus was left to single benefit of retirement as was opposed by the Judicial Service Commission and Minister of Justice.

Now that they have chosen to hear the matter then section 186(3)(e) must be invoked. “No law can limit the right to fair trial”. This is coming from the constitution itself. Either way these listed judges who also make up “the bench” are going to respond to all the facts related to these points. It is unfortunate that they chose to respond to them in the shoes of judges.

Never the less, they are duty bound to accord the respondents their full right to fair trial.

What is the first call? The first call is to identify each judge listed in the record, each by name and Surname. Put on each one of them, the date when they assumed office as at 15 May 2021. Put date of birth of each of them.

Then hold your constitution on your right. Then talk with names of individuals and prove that it is not mere citation of these judges but it is the unique information in each of the judges which after summarising these facts below, then the same verdict is reached.

No one can answer on behalf of each of the Judges beside themselves. Even the ones making up the bench. Each has individual data that make him or her disqualified from benefitting from section 186.

The point is to prove that “The second respondent in HC 2128/21 (Luke Malaba) who is also the second respondent in HC 2166121 ceased to hold the office of the Chief Justice of Zimbabwe and judge by operation of law on I5 May 2021 at 0400 hours.

2. The extension of the length of time in the office of the judge beyond the age of 70 years provided for in section 186 of the constitution does not apply to the second to fourteenth and the eighteenth respondent”

The judgement specified the individuals as listed. No judgement can avoid this. The reason for not extending the tenure beyond 70 may be numerous but one fact remains. You extend your own individual tenure in your personal record.

You do not extent tenure in the constitution then assume it relates to you. It is like conflating public office to individuals.

Lets go.

Go to section 13 of sixth Schedule and read this clause:

“ Existing officers 13. Any person who, immediately before the effective date, held or acted in a public office under the former Constitution continues to hold or act in that office, or the equivalent office under this Constitution, on the same conditions of service until the expiry of his or her term of office under those conditions of service or until he or she resigns, retires or is removed from office in terms of this Constitution or those conditions of service, as the case may be.”

Now by checking from each of the listed judges’ date of appointments on the posts of Supreme Court Judges, which is the post all of them held on date of publication of 2013 constitution, it must be proven that all the listed judges were Supreme Court Judges on this said date 21 May 2013.

After having proven that, then it must be clear to everyone that these listed judges, Malaba included are serving not on a tenure and conditions of service as of section 186 of 2013 constitution. Amended or not amended.

These Judges are serving a tenure as prescribed by old constitution section 86. Amending or not amending 2013 constitution does not change the tenure and conditions service of these judges.

The section 86 of old constitution reads as follows “86 Tenure of office of judges (1) Subject to the provisions of section 87, a judge of the Supreme Court or the High Court shall retire when he attains the age of sixty-five years unless, before he attains that age, he has elected to retire on attaining the age of seventy years:

Provided that— (a) an election under this subsection shall be subject to the submission to, and acceptance by, the President, after consultation with the Judicial Service Commission, of a medical report as to the mental and physical fitness of the judge so to continue in office;

(b) the provisions of this subsection shall not apply to an acting judge or a judge who has been appointed for a fixed period of office;

[Subsection as amended by section 13 of Act 25 of 1981 – Amendment No. 2, by sections 3 and 7 of Act 4 of 1984 – Amendment No. 4 and by section 20 of Act 23 of 1987 – Amendment No. 7] (2) A judge of the Supreme Court or the High Court may at any time resign his office by notice in writing to the President. [Subsection as amended by section 13 of Act 25 of 1981 – Amendment No. 2] (3) The office of a judge of the Supreme Court or the High Court shall not, without his consent, be abolished during his tenure of office.

[Subsection as amended by section 13 of Act 25 of 1981 – Amendment No. 2] (4) A judge of the Supreme Court or the High Court may, notwithstanding that he has attained the age at which he is required by subsection (1) to retire, sit as a judge for the purpose of giving judgment or otherwise in relation to any proceedings commenced before or heard by him while he was in office. [Subsection as amended by section 13 of Act 25 of 1981 – Amendment No. 2]

Few points to note from this tenure which have strong bearing to our case are-

The Judges of Supreme Court retire at age of 65 and not 70 as prescribed s186.

They can extend to 70 and not to 75 as with s186 of new constitution.

The driving force leading to their admission into new constitution under section 13 of sixth schedule is that the post of Judge of Supreme Court could not be abolished without the consent of the judge before the end of his/her tenure.

It must now be clear that by operation of section 13 of sixth Schedule , a Supreme Court Judge is a public officer. All these judges were public officers serving as Supreme Court Judges as at 21 May 2013.

This means they were admitted into new constitution with an existing tenure from old constitution. Now section 13 of sixth schedule allowed these listed Supreme Court Judges to continue to serve under the same old constitution tenure until they retire.

It does not show that they had option to serve under the conditions of new constitution before they retire or change tenure to one of 15 year non renewable while still serving the s86 of old constitution.

This is critical in the sense that in old constitution retirement age of Supreme court Judge was 65 years with a condition of extending by 5 years if one elect to do so and has good medical record.

This tenure is totally different to any of the two versions of section 186 of 2013 constitution. The amended and the original section 186.

Now to seal their fate is to read section 2 of sixth schedule. It reads “Effect of Sixth Schedule. 2.This Schedule prevails, to the extent of any inconsistency, over all other provisions of this Constitution.”

This must then silence anyone who want to refer to section 186, whether amended or not amended. It is clear that these listed judges were carried over from previous constitution so until they retire they serve under those conditions. Period.

Any provision in sixth schedule supersedes anything else in constitution.

The next point of benefit, like I have explained above, is to see if these same judges could be appointed as Judges of constitutional Court, Substantive or Acting?

This is so because for one to extend or not extend a term , that term to be extended has to first legally exist. Actually the argument in record is whether section 186 apply to the listed judges.

So many reason can cause section 186 not to apply to each of the listed Judges.

By mere reference to section 13 of 6th schedule these Judges have to serve under the conditions of old constitution until they retire. It is common cause that Judges of section 166 Constitutional Court are appointed on a non renewable term of 15 years.

This term is not the same as the one these judges are serving and non of them has retired under such terms as the previous constitution. They cannot assume any other tenure before retiring or leaving office of tenure under the dictates of s13 of sixth Schedule.

It is clear from reading section 186, amended or not amended that the Constitutional court has a separate tenure to Supreme Court tenure. It is also clear that the amendment of 186 brings in a new tenure to Chief Justices and Deputy Chief Justice. Which again are different tenures which non of these Judges can qualify to be.

Whatever way one may want to take it. This is not the same tenure on which these judges are serving. You cannot just jump from one tenure to another before section 13 of sixth schedule is fully satisfied. Serve the tenure according to old constitution until you retire or resign. Then if you qualify you can be appointed on a fresh tenure.

The next point of reference to show why these judges cannot benefit the amendment on section 186 is on the appointment of Judges of constitutional Court on a 15 year non renewable term is in section 18(2) and 18(3) of sixth schedule.

From looking at the list of Judges cited, one can see that all the purported judges of constitutional court served a full term as Constitutional Court judges in terms of section 18(2) of sixth Schedule.

Section 18(2&3) of sixth schedule reads “(2)Notwithstanding section 166, for seven years after the publication date, the Constitutional Court consists of—(a)the Chief Justice and the Deputy Chief Justice; and(b)seven other judges of the Supreme Court; who must sit together as a bench to hear any constitutional case.(3)A vacancy on the Constitutional Court occurring in the first seven years after the publication date must be filled by another judge or an additional or acting judge, as the case may be, of the Supreme Court.” . Points to take note from this are as follows-

This Court was not a section 166 court. It had a term of 7 years.

The court “consisted of” Chief Justice , Deputy Chief Justice and seven other Judges of Supreme Court. This clears that these Judge are all Judges of Supreme Court seating as Judges of Constitutional Court.

If vacancy arises in the said Court it was replaced by only a Judge of Supreme Court.

It is now a known fact, whether by old section 186 or by amended 186 of constitution that a term in constitutional Court is non renewable. It is also clear that 7 year term is still a term of not more than 7 years. These judges cannot benefit from being appointed again as Judges of Constitutional Court. The time of serving Constitutional Court is non renewable.

As can be seen from section 18(3) of sixth Schedule, when ever a vacancy was to arise in the section 18(2) of sixth schedule court, it could be filled only by Judges of Supreme Court for the first 7 years from date of publication of constitution. However the original section 180 directed that when ever a vacancy arise in any court, it would be filled by way of public interviews.

Yes vacancies arose in the section 18(2) of sixth schedule court during the first 7 years. The then Chief Justice, Godfrey Chidyausiku, who was a judge of Supreme Court by appointment of old constitution, whose terms and conditions he was serving under, retired. By dictates of section 18(3) of sixth schedule, only a Judge of Supreme Court qualified. Luke Malaba who was deputy Chief Justice was appointed and in turn his post also became vacant and what ever criteria was used to appoint Elizabeth Gwaunza, the point is she was appointed into a section 18(2) of sixth Schedule constitutional Court as a Supreme Court Judge. She is still a Supreme Court Judge. In that case she cannot benefit the status of being Judge of Constitutional Court.

Equally so, Malaba despite being appointed as Chief Justice, he remained a Judge of Supreme Court by appointment. He even sat in a 9 member bench of Supreme Court Judges until the end of the expiry of the term.

No where did Malaba or Gwaunza ended up being Judges of s166 constitutional court.

Actually the 7 years which a Supreme Court Judge, acting or substantive can be a Chief Justice or Deputy Chief Justice are long time over.

Without being sworn in by a Chief Justice or Deputy Chief Justice of a section 166 constitutional Court, no ways these other Judges can stand as substantive Judges of Constitutional Court as they claim to be. Actually they claim to be Judges of Constitutional court but their Deputy Chief Justice is a Supreme Court Judge by appointment. How is it so.

Section 18(4) of sixth schedule directed how Rules of Constitutional court can be made. It reads “(4)Until different provision is made by or under an Act of Parliament—(a)rules may be made under the Supreme Court Act[Chapter 7:13] to regulate the procedure of the Constitutional Court;(b)the rules of the Supreme Court apply, with any necessary changes, to the procedure of the Constitutional Court in relation to any matter that is not provided for in rules made in terms of subparagraph (a);but any such rules, in so far as they apply to the procedure of the Constitutional Court, must be consistent with section 85 and Chapter 8”.

In 2016 ,through a Statutory Instrument , Rules of the constitutional Court were made.

Rule number 2(2) of constitutional court define “court” as ,

“court means the Constitutional Court established by section 166 of the Constitution;” .

It must be clear that the Rules applies to a section 166 constitutional court while section 18(2) of sixth schedule constitutional court applied Supreme Court rules by express direction of section 18(4) of sixth schedule. These courts cannot be conflated.

The same rule 2(2) define a Judge as follows, “Judge” means a judge or acting judge of the Court appointed in terms of section 177 of the Constitution sitting otherwise than in open court;”

For avoidance of doubt the Judges of Constitutional court are appointed in terms of section 177 however in accordance with section 180 of constitution. Check carefully the word usage of “in terms of” against “ in accordance with” as they are used. The Rule 2(2) direct to terms in section 177 which talk of only Constitutional Court Judges and then section 180 relates to appointment of judges of all courts whose terms differ.

As we all now know that Malaba was appointed as Chief Justice in 2017 and Elizabeth Gwaunza was appointed Deputy Chief Justice in 2018 replacing a vacancy that had arisen in section 18(2) of sixth Schedule. Gwauza’ and Malaba’s oaths of office is that of section 18(2) constitutional court.

They were never ever appointed as Judges of s166 court in terms of section 177 and cannot swear other Judges to be s166 Court Judges without them being anointed of same court appointment.

Again these Judges cannot benefit from section 186 tenure because they are not Constitutional Court Judges. The tenure start from date of being appointed. The life of section 18(2) of sixth schedule constitutional court is long gone. You cannot reconstruct it.

As the Rule 2(2) on definition direct us to section 177 of constitution, it is prudent to see if these Judges can benefit section 186 as amended.

The said section 177 reads “177Qualifications of judges of Constitutional Court(1)A person is qualified for appointment as a judge of the Constitutional Court if he or she is a Zimbabwean citizen, is at least forty years old and has a sound knowledge of constitutional law and, in addition, possesses one of the following qualifications—(a)he or she has been a judge of a court with unlimited jurisdiction in civil or criminal matters in a country in which the common law is Roman-Dutch or English, and English is an officially recognised language; or(b)for at least twelve years, whether continuously or not, he or she has been qualified to practise as a legal practitioner—(i)in Zimbabwe; or(ii)in a country in which the common law is Roman-Dutch or English and English is an officially recognised language; and is currently so qualified to practise.(2)To be appointed as a judge of the Constitutional Court a person must be a fit and proper person to hold office as a judge”.

This section requires close look at to see if the listed Judges could ever be appointed as Judges of constitutional Court in terms of section 177. If one is to look at wording of section 177(1)(a) you will see it reads “he or she has been a judge of a court t”.

Without reading other Court’s qualification requirements, one may miss the meaning of this very important clause. One need to read section 178(1)(a) and 179(1)(a) to see for yourself that for one to qualify as a High Court Judge or Supreme Court the candidate can be someone who “is” a serving Judge as a distinct alternative candidate, and then those that have been Judges can then be second alternative, however “is a Judge” was never used an alternative for candidates for appointment as Judges of section 166 constitutional Court.

With terms in section 177(1)(a) we can safely say these Present Judges, despite section 13 of sixth schedule having stated clearly that they will serve under conditions of old Constitution until they retire, despite having served a full term as Constitutional court Judges of section 18(2) they still do not qualify as candidates of section 166 constitutional court in terns of section 177 because they are or rather they were serving judges of Supreme Court to the date of purported appointment to Constitutional Court Judges. One cannot be appointed into section 166 constitutional court if he is a serving Judge at all.

Just as Rule Define a Judge it is clear that a serving Supreme Court Judge Can not even Act as a Judge of Constitutional Court.

This automatically rubbishes the Gwaunza led Court which in their own admission had an Acting Judge who is serving in Supreme Court. That is not a Judge of Constitutional Court.

Again if they fail to qualify as Judges of s166 Constitutional Court they cannot benefit the provision in s186 which talks about Judges of constitutional court.

Section 183 is clear “Except as otherwise provided in this Constitution, a person must not be appointed as a judicial officer of more than one court.”.

It is clear that Malaba and Gwaunza were appointed Chief Justice and Deputy Chief Justice of a section 18(2) of sixth schedule, which was a court of 9 Supreme court Judges who always sit together as a bench. That court’s term expired. Gwaunza cannot sit in the s166 constitutional Court using expired mandate. Just as Malaba. Neither could she swear in Judges after May in 2020 acting as Deputy Chief Justice.

Section 190(4) of Constitution reads as follows “(4)An Act of Parliament may confer on the Judicial Service Commission functions in connection with the employment, discipline and conditions of service of persons employed in the Constitutional Court, the Supreme Court, the High Court, the Labour Court, the Administrative Court and other courts.”

Reading from above it can be seen that an Act of parliament shall spell the conditions of service for persons “employed in the Constitutional Court, Supreme Court and High Court”. Word to take note is persons. This may include other staff members.

This then take us to Judicial Service Act. It can be seen from section 3 of the Judicial Service Act that Judges of Constitutional Court are not members of Judicial Services. Why is it so?

The simple reason is they serve on a non renewable contract which is agreed between Judicial Service Commission and each Judge. It depends also on the age of the Judge. For example, a judge contracted at age of 60 years will sign a ten year contract when a 50 year old is signing a 15 year contract.

On completion of 15 years the 50 year old has 5 years to rich 70. He/she can be admitted into Supreme Court or High Court.

These issues relate to appointment of a tenure. Before we can talk of extending that tenure, It must be clear that these listed judges do not hold such appointment or valid appointment.

While the whole reason why we are here is because someone believes the amendment of section 186 is a valid law and is their sole basis of why Malaba must extend or all these judges could enjoy amended section 186, the answer is in section 133(3) of constitution. “Validity of an Act of parliament does not depend on enrolment of the Act”. Period.

The onus to prove its validity is with the one who want to use it or rely on it.

Otherwise section 2 of constitution is simple. Any law that is inconsistent with the existing provisions of constitution is invalid. Period. After going through all the stated provisions, without even dealing with section 328, which is equally important, it can be seen that any appointments, swearing in of judges, composition of Judges sitting as court, oaths of office, extensions of tenure or self given authorities as court officials which are inconsistent with constitution are invalid. Including this particular hearing. It is invalid from onset.

The rest on questioning, if President can extend Malaba’s tenure, has no bearing. You do not extend a non existent tenure. Malaba is not serving on the section 186 tenure and cannot extend his. Period .

There stands a question asked by these Judges. Can the whole bench be removed? The simple answer there is a non existent bench so there is nothing to remove.

However let me say this from onset, section 166 constitutional court had to be “established” after the publication of Constitution while Supreme Court and other courts were rather “constituted” as there were from previous constitution in terms of section 18(5) of sixth schedule. So yes. From design of constitution this current bench, as it wants to potrey itself, was meant to be removed at end of 7 years. As an entire bench and a new bench of section 166 be established. So nothing is amiss that these judges can all be removed.

The next point is that of the Judicial authority. Section 162 is clear that Judicial authority is derived from people of Zimbabwe. Period. It does not come from president or parliament. President is given executive authority only so he cannot give that which he does not have.

The reason why original section 180 directed that every vacancy be filled by way of interview is to confer Judicial authority.

I am surprised with Justice Patel that he thinks Judicial authority comes from president or Chief Justice. That is not it.

This means one thing. Only the people of Zimbabwe can decide over the Composition of section 166 constitutional court.

The political games were allowed to play in the Judicial while the transition Court was still valid. Now only a referendum can solve this. Nothing else.

Let it be known to the learned Judges that it is the best opportunity they have given Zimbabweans that these facts presented before you and make it clear that you are not Judges of Constitutional court or have Judicial authority as well as valid terms of office. What ever response you give on these direct facts which no one besides you can answer, that response need someone to test if it is valid. That person is no where.

Clear we go to referendum.

Section 35 of constitution is clear. We equally share the responsibility to confer Judicial authority to Courts.

#BREAKING- Mali’s Interim President Attacked By Two Armed Men

By A Correspondent- Mali’s interim President Assimi Goita has been attacked by two armed men, including one who wielded a knife, according to AFP news agency.

The attack on Tuesday took place during prayers in the Great Mosque in the capital, Bamako, amid festivities for the Islamic festival of Eid al-Adha.

Goita has since been taken from the scene, according to an AFP journalist who witnessed the attack. It was not immediately clear whether he had been wounded.

Religious Affairs Minister Mamadou Kone told AFP that a man had “tried to kill the president with a knife” but was apprehended.

The president, 37, was sworn into office last month despite facing a diplomatic backlash over his second power grab in nine months.

In August 2020, Colonel Goita had led a military coup that removed embattled President Ibrahim Boubacar Keita after months of anti-government protests over perceived corruption and the failure to tackle a deteriorating security crisis that first emerged in 2012.

In late May, Goita, who was serving as Mali’s vice president in a transitional government tasked with leading the country back to civilian rule in February 2022, seized power again after accusing interim President Bah Ndaw and Prime Minister Moctar Ouane of failing to consult him about a cabinet reshuffle.

Duo Nabbed For “Trespassing” Into ED’s Residency

state media

By A Correspondent- Two people have been arrested and dragged before the courts facing charges of impersonation and trespassing after attempting to get into President Emmerson Mnangagwa’s official residency.

NewsDay reports that Nigel Rutsito was arrested Saturday outside the State House after attempting to get into the place claiming that he is a member of the spy network, the Central Intelligence Organization.

Mnangagwa has since 2018, particularly after the White City Stadium explosion where many people died, been reshuffling his security personnel.

Chipinge Farmer Fined For Pointing Firearm at Neighbour’s Farm Manager

By A Correspondent- A Chipinge macadamia farmer, Lameck Bvurere(62), was last week fined $120 000 for pointing a firearm at his neighbour’s farm manager.

Bvurere of Stilfontein, Umzila Farm, appeared before Chipinge magistrate, Mrs Elizabeth Hanzi. He was facing charges of contravening Section 27(B) of the Firearms Act, Chapter 10:09.

He pleaded not guilty to the charge.

However, Mrs Hanzi convicted Bvurere due to overwhelming evidence against him.

Bvurere was represented by Mr Chris Ndlovu of Gonese and Ndlovu Legal Practitioners and was ordered to pay a fine of $120 000 or serve six months in prison.

Bvurere and his neighbour’s farm manager, Jimmy Mbiro, who is the complainant in the matter, have a pending case at the High Court over the ownership of Stilfontein Farm.

Mbiro is employed as a manager at Plot 2, Stilfontein Farm.

Prosecuting, Mr Timothy Katsande said on March 21, Bvurere was invited to the Criminal Investigations Department’s Chipinge offices after detectives had intercepted a UD90 truck with stolen macadamia nuts.

“Upon his arrival at the CID offices, Bvurere bumped into Mbiro and accused him of causing his arrest.

“Bvurere threatened to shoot Mbiro. He produced a Taurus revolver that was loaded with six live rounds and pointed it at Mbiro,” said MrKatsande.

Mbiro managed to grab the firearm from Bvurere before he could pull the trigger.

Detectives who were manning the reception rushed outside and arrested Bvurere. They also recovered the pistol.

Auditor General Threatened By “Corrupt” Companies

By A Correspondent- Auditor-General, Mildred Chiri, has said her office has been threatened by some companies reported as corrupt in her previous audit reports.

Chiri added that as a result of the threats, her office resorted to not naming the companies involved in underhand dealings in order in the recently released 2019 report to avoid lawsuits.

Giving oral evidence to the Public Accounts Parliamentary Portfolio committee on Monday, Chiri said:

Regarding the naming of companies with issues in the annual report, the approach of naming suppliers and companies was not done in order to manage the risk associated with potential litigation.

There have been comebacks with some suppliers on some of our findings in the past. Those that have approached us in the past were saying naming them in our reports had resulted in them losing business.

They think just mentioning their names taints them as this takes away their future businesses. Some would sort of like threaten and when we checked with our secretariat. They warned us that we would face a litany of lawsuits if we continued with naming companies.

Chiri promised to satisfy all stakeholders in future as her office was now in the process of finding ways to deal with such matters.

Her remarks confirm reports in the public domain that she had been “arm-twisted” by companies and or political elites involved in underhand dealings not to state their names.

Commenting on the 2019 report, law lecturer, Alex Magaisa, said the “report appears to have been edited so that where it used to identify a company by its name, now it simply refers to “a local company”.

Previously, Chiri has been naming corrupt companies although little to nothing was being done following the report.

Observers say naming the companies is essential for transparency and accountability, both key constitutional values and principles.

Obert Gutu Dumps Zanu PF

Despite being paraded at State House by President Emmerson Mnangagwa, former opposition MDC-T spokesman Obert Gutu says he never formally joined the ruling Zanu PF party in what many see as an attempt to protect his National Peace and Reconciliation Commission (NPRC) job.

Former MDC-T spokesperson Obert Gutu and former opposition MDC Alliance Senator for Chitungwiza James Makore formally joined Zanu PF and were paraded at State House by President Emmerson Mnangagwa and Vice President Constantino Chiwenga.

Gutu was reported to have joined Zanu PF in March together with former MDC Alliance Senator for Chitungwiza James Makore. They were received by Mnangagwa and Vice President Constantino Chiwenga.

On July 1, the Zimbabwe Human Rights Association (ZimRights) and National Transitional Justice Working Group (NTJWG) filed an application at the High Court challenging Gutu’s appointment citing it “came shortly after he publicly joined a political party namely the Zanu PF.
