Tinashe Sambiri|Nkayi South MP Stars Mathe has poured cold water on the Gukurahundi mass killings in a bid to please the Zanu PF leader Emmerson Mnangagwa.
Mathe betrayed members of her own community when she described Mr Mnangagwa as a man of unity, peace and harmony.
Mathe even attempted to portray Mr Mnangagwa as a political saint.
Below is the MDC Alliance Youth Assembly response to Mathe’s remarks.
05-05-2021
ZANU PF Member of Parliament for Nkayi South constituency, one Stars Mathe yesterday threw her parliamentary role of community representation into the pit latrine in a bootlicking trance on Emmerson Mnangagwa.
In a bootlicking overdrive, Mathe left even the Speaker of Parliament stone faced when she applauded Mnangagwa for presiding over “unity, peace and harmony and not experiencing any spills of blood since independence”.
For someone who hails from Nkayi in Matabeleland where Gukurahundi mass murders and mass graves were experienced to speak like that, it is not only shocking but a great betrayal to those whom she purports to represent.
Mathe is an insult to the great people of Nkayi South constituency who gave her the mandate to represent them in Parliament.
That Nkayi is one of the hotspots of political violence since the days of Gukurahundi right up to the post 2008 elections yet we have a ZANU PF MP that did not witness nor hear of any bloodbath in that part of the country only shows that ZANU PF parliamentarians are detached from the realities facing those they claim to represent.
Indeed (dis)Honorable Mathe, there was no blood spill in Matabeleland but floodgates of bloodbath of more than 20 000 civilians!
And the arch-angel of terror in that bloodletting of 1980s, 2008 and 01 August 2018 is none other than Mathe’s saint, Emmerson Mnangagwa!
Only MDC Alliance representatives are genuine representatives of the people.

What leads to medication-overuse headache, and how can you reduce your risk?
Becky Upham By Becky Upham Medically Reviewed by Jason Paul Chua, MD, PhD April 28, 2021 Medically Reviewed
a variety of pills colorful Too-frequent use of acute migraine drugs can lead to chronic daily headache.
Do you have headache days — in addition to migraine attacks — more often than you have pain-free days? If so, you may have medication-overuse headache (MOH).
Also called chronic daily headache or rebound headache, MOH most commonly occurs in people with a primary headache disorder such as migraine, cluster headache, or tension-type headache, according to the American Migraine Foundation. It’s caused by too-frequent use of acute medications, although exactly what “too frequent” means can depend on the drug being taken.
Medication-overuse headache isn’t only troublesome because you have near-constant head pain: MOH can also cause headaches that are resistant to preventive migraine medications, making acute therapies less effective as well.
Stewart Tepper, MD, professor of neurology at the Dartmouth Geisel School of Medicine in Hanover, New Hampshire, spoke about medication-overuse headaches in his talk “Medications That Make Migraine Worse,” as part of the Sixth Annual Migraine World Summit, held March 17 to 25, 2021.
In addition to explaining how medication-overuse headache develops and how to reduce your risk, Dr. Tepper observed that the newest type of acute migraine treatment — a drug class called CGRP receptor antagonists, sometimes referred to as “gepants” (pronounced gee-pants) — does not carry the risk of medication-overuse headache.
Here’s what to know about medication-overuse headache.
Medication-Overuse Headache Has a Precise Definition The International Headache Society defines medication-overuse headache as a headache occurring on 15 or more days per month in a person with a preexisting primary headache disorder and developing as a consequence of regular overuse of acute or symptomatic headache medication for more than three months.
Different medications have different guidelines as to what constitutes overuse. The use of triptans, ergot alkaloids, combination analgesics (pain relievers), or opioids for 10 or more days of the month is considered overuse, according to the American Migraine Foundation.
MOST HELPFUL Is It a Migraine Attack or a Cluster Headache? Expert Advice on Managing Chronic Migraine How Long Will My Migraine Attack Last? Taking simple analgesics, including nonsteroidal anti-inflammatories (NSAIDs) — a drug class that includes aspirin, ibuprofen (Advil, Motrin), and naproxen (Aleve) — on 15 or more days a month also constitutes overuse.
Usually medication-overuse headaches resolve after the overuse is stopped, although people may undergo a period when their headaches get worse before they get better.
Quantity Matters in Medication-Overuse Headache, Not Quality Medication-overuse headache can feel different in different people, according to Tepper.
“What I tell people is that it doesn’t really matter if it’s front or back, right or left, up or down, mild, moderate, or severe. It’s not the quality of the headache, it’s the quantity of the headache,” he says.
The distinguishing feature of MOH is how often occurs, he says.
Any Day With Any Type of Headache Counts as a ‘Headache Day’ If you aren’t sure if what you’re experiencing is MOH, try keeping a calendar and counting the number of headache days you have. Don’t just count the days when you have symptoms of a migraine attack but rather all days with any type of headache, says Tepper.
Alternatively, he suggests counting the number of completely headache-free days you have. “How many days are crystal clear from the moment you open your eyes until the minute you go to bed at night, without a twinge of headache? The crystal-clear days should be at least 15 days per month in order to not be in chronic migraine,” he says.
Taking Certain Medications Just Once a Week Can Make Migraine Worse The two pain medications that are most likely to make migraine worse are butalbital, which is a barbiturate that is mixed with other pain medicines and is included in the medications Fioricet and Fiorinal, and opioids of any sort, says Tepper.
These types of medications can be used for emergency relief for a migraine attack but should be used with caution because of their risk for rebound headache, according to the American Migraine Foundation.
Opioids, also called narcotics, such as oxycodone and hydrocodone, can cause headaches to worsen or become more frequent by using them just once a week. Butalbital is linked with overuse when used four times a month or more, according to the American Migraine Foundation.
These medications alter the pain regulatory systems of the brain in a bad way, and they not only worsen migraine attacks in terms of frequency, severity, and duration but also often make them untreatable, says Tepper.
Pain Medications Taken for Any Reason Can Lead to MOH Taking analgesics for reasons besides your migraine can still cause medication-overuse headache, according to StatPearls.
“Say you’re taking it for low back pain, the brain does not know the difference,” says Tepper, adding that the frequency of use and the type of medication are associated with the transformation to MOH.
The More Headache Days You Have, the Higher Your Risk for Chronic Daily Headache “The more headache days a person has, the more likely they are to transform to chronic migraine,” says Tepper. Studies conducted both in the general population and in clinics show that people who have 10 to 14 headache days per month are 20 times more likely to develop daily headache than people who have fewer than five headache days per month, he says.
“The frequency of the headache days is actually a big risk for transforming, and the frequency of headaches is linked to how many times somebody reaches for an acute medication to treat,” says Tepper, adding that although these are separate risks, they feed each other.
“It’s why we try so hard to reduce the total number of headache days per month, as well as the number of acute medication days per month,” says Tepper.
Caffeine Can Contribute to Medication-Overuse Headache Caffeine at 100 to 200 milligrams (mg) per day is probably enough to contribute to medication-overuse headache, says Tepper.
For reference, 8 ounces of coffee has between 80 and 100 mg of caffeine, and 12 ounces of a caffeinated soft drink has between 30 and 40 mg, according to the Food and Drug Administration (FDA). The headache medication Excedrin has 65 mg of caffeine per tablet.
However, many people are fond of their caffeine-containing beverages.
“I tend to try to work around the caffeine, as long as it’s not high-dose caffeine, to see if we can help them without taking away one of their pleasures,” says Tepper…

A Gutu man has been jailed for an effective 18 years for raping his five-year-old daughter.
The man (25) from Mazongororo village forcibly took his daughter from his mother-in-law on the pretext he wanted to send her to school but ended up raping her.
Masvingo regional magistrate Mr Bishard Chineka had initially sentenced the man to 20 years behind bars but conditionally suspended two years for five years on condition of good behaviour.
The agreed facts are that the child was staying with her grandmother in another area in Mazongororo village when the man approached his mother-in-law in mid April this year and demanded to have his daughter.
After facing resistance from the mother-in-law, he claimed he wanted to send his daughter to school and he took the daughter away by force.
He stayed with the daughter in his two-roomed house where he shared blankets with her. On 30 April, he raped her once.
The victim’s sister who was sleeping in the next room was alerted by the noise as the little girl cried the whole night after being raped by her father.
The next morning the sister alerted other villagers who approached the man and forcibly took the victim back to her grandmother.
A day later, the grandmother noticed some bruises on the girl as she bathed her and upon probing, she disclosed that she had been raped by her father.
A report was made to police and a medical examination conducted at Gutu Rural Hospital confirmed the rape leading to the man’s arrest
Mr Liberty Hove appeared for the State.
Meanwhile, a Chitungwiza man has been slapped with an effective 11-year jail sentence for raping a 17-year-old schoolgirl with disabilities.
The man lured the girl to his house where he abused her before he threatened her with a knife if she disclosed the abuse.
The girl uses crutches to walk.
Chitungwiza Magistrate Noel Mupeyiwa had initially sentenced Shepherd Mabvuto (39) to 14 years imprisonment but conditionally suspended three years of his sentence.
Prosecutor Lovet Muringwa convinced the court that on January 6 this year, Mabvuto went to the girl’s residence and asked her to follow him to his house and she complied.
On arrival, he pushed the girl to the bed and took a knife from a drawer threatening to kill her if she made any noise.- The Herald
By A Correspondent- Zanu PF lawmaker for Buhera South has challenged the government’s paymaster, Mthuli Ncube to pay government workers.
Chinotimba made the challenge in parliament when he was commenting on recent claims by the Finance Minister, that he had a surplus in his purse and at the same time failing to pay civil servants.
Buhera South legislator said it was ironic for Mthuli to claim that he had a surplus when government workers’ salaries were not sustainable.
“The salaries are inadequate, especially for those in rural areas. The current exchange rate is US$1 to ZW$130 and that is the rate that is being used by most shops, except shops such as OK who do not use the black-market rate. Such shops require that you pay what they charge. It is a ‘take it or leave it’ game,” he said.
“We expect immediate action to be taken on the matter, even if it means Minister Mthuli Ncube to be called into the House to answer questions and to address the matter. At one time, Honourable Mthuli Ncube said that the government has a surplus. How can you talk of surplus when the standard of living for the majority has not improved and they are earning peanuts?”, said Chinotimba.
By A Correspondent- Mthwakazi Republic Party said it will next week stage a mass protest against police brutality in Bulawayo.
The party said it had noted with concern the inhumane treatment of private transport operators, employees and clients by the Zimbabwe Republic Police.
“We can’t allow police to brutalise the very people enabling residents to commute to and from work daily,” said the party.
MRP President Cde Mqondisi Moyo, last year wrote a letter to the Home Affairs Minister the Minister a letter, complaining about police misconduct in handling transport issues in Bulawayo. The letter was copied Police Commissioner General-Godwin Matanga, Zimbabwe President Emerson Dambudzo Mnangagwa, Ministry of Transport, Police in Charge of Bulawayo Metropolitan Province, Bulawayo Resident Minister – Judith Ncube, Joint Operations Command (JOC), Bulawayo Transport Operators, and Bulawayo residents.
” It is against this background that we are calling for a total shutdown of Bulawayo on the 10th and 11th this month.
“We hold ZRP accountable for the death of our people in accidents as Kombies run away from violent police,” he said.
“Why should we have the Zimbabwe Republic Police causing fatal road accidents, beating poor passengers, and damaging people’s vehicles? We know they are doing this because they want to boost the wealth of those who have captured the State like Mr Tagwirei who happens to be the main beneficiary of Zupco’s monopoly of the transport industry”, Mthwakazi demanded.
By James Gwati- Former Deputy Prime Minister has warned President Emmerson Mnangagwa of civil arrest following his party’s engineered constitutional amendments that recently sailed through Senate.
Senate on Tuesday passed the controversial Constitutional Amendment Bill No 2 with 65 voting in favour of the mutilation of the Constitution adopted in 2013 through a popular referendum vote while 10 voted against.
The Bill went through after three senators from the Douglas Mwonzora-led MDC-T — Piniel Denga, Morgan Femai and Jane Chifamba — voted alongside Zanu PF, which needed only one vote to achieve a two-thirds majority.
The amendments include a provision for the scrapping of the running mate clause, which was supposed to come into effect in 2023 and another giving Mnangagwa unbridled power to appoint judges without subjecting them to public interviews, among others.
Mutambara yesterday took to microblogging site Twitter, accusing Zanu PF of “giving its detractors a big stick to whip its behind”.
“Zanu PF is begging for more economic sanctions,” he tweeted.
“Amendment No 2 gives its detractors reasons to maintain sanctions, constitutional violations, illegal judges, compromised Judiciary, corrupt imperial presidency. Zanu PF is giving its detractors a big stick to whip its behind. It is pure idiocy.”
He called for political action to stop the constitutional changes.

By A Correspondent- Mthwakazi Republic Party youth wing is planning to shut down the entire Bulawayo City and force the government to end its ban on kombies.
The disgruntled MRP youth league said they plan to hold the mass demonstrations on the 10th and the 11th of May.
In a statement, MRP said it was touched by the pain the people are made to endure daily because of Zupco’s incapacity to meet public transport demands.
“We urge Omalayitsha not to allow Zupco operating in South Africa if the government continues to ban them from operating.
“The people’s revolutionary party is, therefore, demanding that government immediately allow private commuters and Omalayitsha back on the road. An article in the government-controlled Sunday News of the 2 May 2021, announcing a ban on private commuters has left us with no option but to demonstrate our disapproval of the move,”said MRP.
“All progressive residents, Kombi owners and their employees, and other stakeholders are kindly called upon to ensure that the shutdown is a success,” the party said.
The government recently announced an indefinite ban on kombis and said directed the police to impound private cars seen carrying passengers.

“I consider it gross misconduct by our MPs, Senators including the presidium to give Zanu PF the needed two-thirds majority to pass the repressive Amendment Bill Number 2.

Tinashe Sambiri|The MDC Alliance has urged citizens to reject the Constitutional Amendment Bill.
The MDC Alliance Namibia, in a statement, took a swipe at Douglas Mwonzora for compromising the people’s struggle due to a cup of coffee.
Read the MDC Alliance Namibia full statement below:
It is now officially confirmed that MDC T is a Zanupf project, Mdc Alliance Namibia echoes.
04 Tuesday 2021
Mdc Alliance Namibia urges all those who were fooled and deceived by the greedy stomach politicians; Douglas Togarasei Mwonzora, Thokozani Khupe, Morgan Komichi, Mashakada and their cronies to smell the coffee and rejoin the democratic project led by none other than the able organic leadership of President Advocate Nelson Chamisa (Wamba Dia Wamba).
We are very grateful to hundreds in Matebeleland Province who were quick to regain their composure to come back to People’s Agenda. Not forgetting what transpired in Bindura yesterday when Mwonzora and Komichi were barred from meeting social democrats who accused them of selling the democratic project to Zanupf Satanists.
Today, Tuesday, the 4th of May, MdcT has assisted the rogue Zanupf regime pass the Constitutional Amendment Bill No 2. This bill is a sadist attempt to compromise the most fundamental provision of the Constitution in Constitutional Democracy which is the separation of powers.
Mdc Alliance Namibia continues to ponder how a democratic party can vote to reverse the gains we scored in the Constitution of 2013 which was voted by the people one purports to represent. These are clear signs of a monocratic nature of governance. Mwonzora and cabal have shown the world that they are belly politicians who masquerade as socio-economic transformers.
The people spoke clearly about the constitutional procedures in the recruitment of judges; that judges are recruited through public interviews undertaken by the( JSC) Judiciary Services Commission, an independent institution mend to fight nepotism and remote-controlled Judiciary Service Providers. In antithesis with the provisions of the 2013 Constitution, Mwonzora and his Zanupf cronies voted that the President can do whatever he wants in terms of appointments and dismissals as well extensions after the retirement age.
Moreover, this is a clear betrayal of everything the original Mdc formed on September 11 1999 stood for in terms values and principles. It is surely and truly a shameful and darkest day for those associated with the Zanupf-sponsored MdcT including my little known homeboy, Festus Dumbu(the former Zaka West MP) and my cde at Zinasu, Anorld Chidodo who seem to be active on Facebook supporting this Zanupf surrogate.
It is now confirmed that Mdc-T is a Zanupf project after aiding their political masters with a 2/3 majority to pass a bill that promotes the President to hire and fire judges willy nilly, extend the term of office of judges beyond the stipulated age of 70 years just to protect an individual by the name Luke Malaba who is supposed to retire on the 15 May 2021. We are quite aware that this haste to pass this satanic bill is driven by the dictators to protect this captured Malaba from retirement.
Furthermore, it is imperative for social democrats to realise that Zanupf did not donate to Mwonzora the army to capture our Hq, Morgan Tsvangirai House for nothing, donate to him Mdc Alliance MPs , Councillors, Senators and the money constitutionally belonging to the Mdc Alliance according to the Political Parties Finances Act. Togarasei has paid back astronomically by betraying representative democracy on this day. The judicially-constructed MdcT has unearthed that it is a Zanupf surrogate meant to decimate the People’s Agenda in a bid to establish a One-party state, that shall be resisted as per our culture of confrontation to authoritarianism.
Politically inept Zanupf doesn’t have 2/3 majority to pass these evil laws aimed at capturing the Courts, Parliament and all other government institutions.
In a nutshell, Mdc Alliance Namibia encourages the people of Zimbabwe to vote No to this satanic bill.
It is now open that MPs who are assisting Zanupf are no longer with the people. They are now detached from their constituencies in pursuit of money and diplomatic passports. Instead of being change agents they have become opportunity seekers, the organic President Advocate Nelson Chamisa promised to radically transform the criteria of candidate selection process. We accepted the apology from the People’s President, in 2023 we shall do it after a radical shift.

The Confederation of the African Football has postponed the upcoming World Cup qualifiers, including the game between Zimbabwe and South Africa, scheduled for June.
The decision was made at an emergency meeting on Monday after several host stadiums failed to get approval from the continental body due to their bad condition caused by the coronavirus.
Teams like Senegal, Mali, Malawi, Seychelles, Somalia, Namibia, Niger, and Liberia were among those affected.
According to a statement by CAF, the first two days of the qualifying campaign will now happen in September. This would give more time to the member associations to renovate the stadiums up to the minimum standards.
“The CAF Emergency Committee, in consultation with FIFA, decided to postpone the CAF qualifiers for the FIFA World Cup Qatar 2022 that were due to be played in June 2021 after taking into consideration the current challenges caused by the COVID-19 pandemic, and the need to ensure the optimal playing conditions for all participating teams,” the football body said.
“The qualifiers will now take place in the existing windows of September, October and November 2021, and March 2022.”
Zimbabwe’s National Sports Stadium got approval but the FA was told about the areas still needing improvements.
And the postponement will now allow more work to be done on the venue to avoid fines that may arise from organisational and technical violations during the games.

Jose Mourinho signed a three-year contract with Serie A side AS Roma on Tuesday but the coach accepted a accepted a pay cut.
Mourinho will start his reign at the club next season to mark his return to Italy eleven years after his departure at Inter where won a treble in the 2009-10 season. He will replace Paulo Fonseca who is leaving at the end of this campaign.
According to The Sun newspaper, Tottenham will pay part of José Mourinho’s salary in his first season at Roma.
The North Londoners agreed to pay him the shortfall in salary if he took another post on lower wages before the end of his contract next summer.
This means he will receive £5m from Roma and, for next season only, £10m from Spurs to match his previous £15m salary.
Meanwhile, Mourinho said he was convinced to join the club due to the passion of its fans.
He said: “The incredible passion of the Roma fans convinced me to accept the job and I cannot wait to start next season.- Soccer 24 Zimbabwe
The Zanu PF leader Emmerson Mnangagwa owes the nation an apology for being involved in the killing of innocent civilians during the Gukurahundi era.
This was said by MDC Alliance vice president Hon Tendai Biti.
Hon Biti accused the Zanu PF regime of killing thousands of innocent civilians at the height of the Gukurahundi era.
“The regime, through its mouthpieces, is determined to bar leaders of the Democratic Struggle from the 2023 election.
Desperate unconstitutional measures by an illegal fascist cult led by a desperate genocidalist will not stop change and transformation in Zimbabwe Gukurahundists now masquerading as national Leaders owe Zimbabwe a huge apology.
Fact of the matter is that this country will never move without transitional justice, without dealing with shame and tragedy of Gukurahundi.
Those with blood on their hands have no business to govern,” argued Hon Biti.
By A Correspondent| The City of Gweru is set for a business turnaround as a high powered Government delegation is expected to commission various projects in the city.
The projects are aimed at empowering indigenous Zimbabweans among them a service station and the touring of workspaces for informal traders that are under construction in Mtapa suburb in Gweru.
The projects are set to create employment for Zimbabweans and will see players in the fuel and retail sectors increasing among them Energy Park Service Station.
The commissioning of Energy Park, one of the fastest growing service stations in the country follows a recent visit by National Housing and Social Amenities Minister Daniel Garwe who said local authorities should prioritise building vending stalls small to medium enterprises, to bring sanity in the informal sector.
“I would like to encourage the council to speed up the process of allocation of land for the building of vending malls and factory shells meant to benefit those who are in the small and medium enterprises. The Government has put together resources meant for the construction of vending malls, but the only hindering factor is that local authorities have not given us the land to build from and this has affected the informal sector,” he said.
Dubbed the City of Progress, Gweru has been a sleeping giant in terms of infrastructure with a proposed $30 million shopping mall at North Gate Heights along the Harare-Gweru Highway still to take off.
North Gate Heights Phase Two has 882 serviced residential stands, 67 commercial stands, a primary school and a secondary school.

The release of our female youth leaders Hon Joana Mamombe and Vice National Chairperson Cecilia Chimbiri is welcome but must never be seen in the context of a favour by the oppressor.
The duo’s release was long over due!
In fact they were not supposed to be jailed in the first place.
It is the art of dictators to press their feet hard on citizens then lift it a little bit so as to give an empty and false sense of freedom.
There is nothing to celebrate about temporary freedoms of Mamombe and Chimbiri because in any case freedom is their birthright.
We demand for the unconditional release of all political prisoners including our Youth Commander Obey Tererai Sithole, Legwan Mavhunga, Munyaradzi Mpofu and Makomborero Haruzivishe who was convicted and sentenced for no crime at all.

Media statement by the Secretary-General of the ANC. comrade Elias Sekgobelo Magashule. about my suspension as Secretary-General of the ANC.
Date: Wednesday, 5 May 2021
I am issuing this media statement in my capacity as Secretary-General of the African National Congress (ANC).
I have received a letter under the signature of the Deputy Secretary-General, comrade Jessie Duarte, that temporarily suspends me for an initial period of six months. It is my understanding that this letter was issued to me in terms of a decision of the National Working Committee held on Monday the 3rd of May 2021, in terms of Rule 25.70 and Rule 13, to the effect that all members who have been indicted to appear in a court of law on charges. are to be temporarily suspended.
Other members who are similarly affected have received similar letters.
It is evident that the Deputy Secretary-General does not have the authority to issue such letters. Thus the letter is fatally flawed, and in fact unconstitutional. Furthermore, these letters are based on a selective and factional interpretation of the relevant Resolution.
I herewith announce that I am immediately, and formally, appealing this unconstitutional suspension. In terms of the ANC Constitution. my suspension is thus wholly suspended, until my appeal has been heard, and its final outcome announced.
For the sake of fairness and justice to all the affected comrades, who have received similarly unconstitutional letters, I as Secretary-General – who is duty-bound to uphold the ANC Constitution and all administrative processes – urge them to also follow the appropriate internal appeal processes. It follows that the suspensions of all affected members will also in terms of the ANC Constitution be suspended with immediate effect.
I have also in accordance with the powers vested in me as the Secretary-General of the ANC, and furthermore in full compliance with the relevant conference Resolutions summarily suspended the President of the ANC, comrade Cyril Ramaphosa.
This is done in terms of Resolution 8.2 of the 54th National Conference, which states that, “…Every cadre accused of or reported to be involved in, corrupt practices accounts to the Integrity Committee immediately. or laces DC processes and Resolution 8.3 that further provides for the suspension of, “. . people who fail to give an acceptable explanation, or to voluntarily step down while they face disciplinary, investigative or prosecutorial procedures”.
I call on all members of the African National Congress to act with revolutionary dignity and respect and to uphold the ANC Constitution. None of us should bow to illegal and unconstitutional actions. In doing so we must protect the unity of the ANC as leader of society.
Issued by the Secretary-General of the ANC Comrade Elias Sekgobelo Magashule.

Two prominent MDC activists, Charles Zvenyika who is the information secretary for Gutu North and Edward Chagonda who holds the same position in a branch in Gutu Central have been arrested for allegedly wearing red masks inscribed MDC Chamisa Chete Chete.
Nelson Chamisa is the president of the MDC Alliance.
The two who were arrested at Mpandawana Growth Point on April 13, 2021 will appear at the Gutu Magistrates Court tomorrow after they spend almost a week in custody.
They are being charged with the crime of criminal nuisance. They are represented by Knowledge Mabvuure of Chihambakwe Legal Practitioners who during discussions with prosecutors expressed shock that someone can be incarcerated and lose freedom over such a minor offence.
State witnesses Constable Munyaradzi Mashamba and Rufaro Kufakunesu said they arrested the two at the main bus rank at Mpandawana for touting and Chagonda has an additional offence of not properly wearing a face mask.
They alleged that they were shouting Harare, Harare at a Mukumba Bus where they were calling for passengers. They also accused Zvenyika of loading passengers into his personal vehicle.
However, the accused in their defense outline said that they neither worked for Mukumba Bus nor did Zvenyika own a car. They said, instead they are well known MDC activists and they were on the day wearing red masks inscribed Chamisa Chete Chete.
They were allegedly advised by the arresting cops that Police in Gutu did not recognize opposition party masks. They were taken to the Police Station for payment of fine but they were shocked to see the charge being changed to touting. They were locked until in the cells until Mabvuure applied for their bail.
The international community is increasingly worried by the worsening human rights violations and harassment of opposition supporters by the Police and the ruling party.
One of Zimbabwe Miners Federation president Henrietta Rushwaya’s alleged accomplices in the 6kg gold-smuggling saga has filed a notice to apply for refusal of further remand, citing delays in commencement of trial.
Rushwaya, who is being charged together with Ali Mohamed, two police officers Steven Cherai and Rafius Mupandauya, and Gift Karanda, who allegedly masqueraded as a Central Intelligence Organisation operative, yesterday had their case remanded to June 18 after they appeared before Harare magistrate Stanford Mambanje.
Cherai’s lawyer Admire Rubaya filed a notice to apply for removal from remand, saying his client had been religiously attending court without being furnished with a trial date.
The State represented by Netsai Mushayabasa asked for postponement of trial, saying it was still to weigh the gold that was confiscated from Rushwaya at the Robert Gabriel Mugabe International Airport as she was about to fly to Dubai on October 26, 2020.
The State then promised to give a trial date on the next remand hearing on June 18.
Rushwaya was arrested with gold valued at US$333 000 stashed in her handbag.
She, however, denies the charge of intentionally attempting to smuggle the gold, saying she had picked a wrong bag as she rushed to the airport.
The Zanu PF Harare Province is expected to hold a cell restructuring exercise this weekend to accommodate new members joining the party.
This comes as the party’s progressive policies that resonate with the public and its open door policy have resulted in many people, including former MDC legislators joining the party.
New members, some of whom have never been members of any political party, are also flocking to Zanu PF, which they say has the future of the nation at heart. The party is targeting to mobilise 5 million votes for the 2023 harmonised elections to ensure a resounding victory.
The party’s provincial Secretary for Administration Ephraim Fundukwa said the province will embark on cell restructuring exercise as directed by the party leadership
“We have been tasked by the party leadership to set up structures of the party. The youth league led by Emmanuel Mahachi, the War veterans league and the Women’s League led by Betty Kaseke have already submitted their mobilisation strategy. We are rearing to go,” said Fundukwa. Fundukwa said the completion of restructuring would attract new membership and woo opposition supporters.
“We want to make sure that our cells are intact. Since the outbreak of Covid-19 pandemic some of our cell structures have been affected. We want to re-ignite the revolutionary train,”.
After the cell restructuring exercise, he said the province will set up the branch and then the district structures.
By A Correspondent- Residents of Southlea Park in Harare yesterday stormed a local community school in protest over government’s threat to withdraw teachers from the institution after landowners secretly registered the school under private ownership.
The residents claimed they built Southlea Park Primary School using their own funds, hence it could not be registered as a private entity.
They accused former Odar Housing Development Consortium (OHDC) administrators of registering the school as a private institution without their knowledge, which prompted government to transfer the 40 teachers.
When NewsDay visited the school, more than 300 parents were at the school gate, singing and chanting slogans accusing the former OHDC administration chaired by Benny Matenga of fraudulently registering the school under private ownership.
The parents ordered their children to go back home saying they would resume schooling after the ownership wrangle has been resolved.
Acting head Memory Chivhima said she was not authorised to speak to the media.
But a teacher who spoke on condition of anonymity confirmed that they had been ordered by government to transfer from the school as the institution was now under private ownership.
“We were in the midst of conducting lessons when parents stormed into the school premises and ordered their children to go back home,” the teacher said.
“They were demanding to know why the teachers had been ordered to transfer. We received a directive from the district schools inspector since the school is now a private entity. We are yet to be advised the new schools we will be assigned to.”
Highglen district schools inspector Joseph Kabasa refused to comment on the matter and referred question to ministry spokesperson Taungana Ndoro.
Ndoro said: “If the parents do not have supporting documents that they are the rightful owners of the school such as a registration certificate, they cannot control it.”
“Those who registered the school are the responsible authority and the ministry cannot resolve that dispute. If there is a case, aggrieved parties can take the legal route.”
Matenga confirmed to NewsDay that the school had been registered as a private institution because the land was owned by the consortium.
“The land was initially State land until 2017 when the consortium acquired the deeds for private ownership of the land. Even if the school is registered as a private ownership, the residents still own the school,” he said.
Parents, who spoke to NewsDay, called on government to stop a few individuals from assuming ownership of the school as it disadvantaged pupils.
“We are against private ownership of the school. We want it to remain a public entity under government regulation,” Esther Musukuma, a member of Southlea Park Residents Association, said.
“We are demanding answers from government on why they would allow some few selfish community members to change the school into a private property.”
Southlea Park is the only primary school in the residential area. It has an enrolment of over 2 000 pupils.
The Zimbabwe Devolution Campaign, a coalition of Civic Society Organizations and Residents Associations in Zimbabwe, is deeply concerned with the Government’s reluctance to devolve power and functions to lower tiers of government as is stipulated in the Constitution of Zimbabwe.
While we acknowledge the prioritization of the devolution agenda by the 2nd Republic, the trajectory and the nature of devolution in the proposed legislation to effect devolution and emerging practice within our local governance system fall short from the devolution enshrined in Chapter 14 of the Constitution as envisaged by citizens.
We are gravely concerned that the recent events that include the appointment of the local government board and the intention to impose an Inter-ministerial “Taskforce” to monitor urban local authorities are a clear violation of the principle of self-governance by local authorities as is provided for by the Constitution.
Citizens of Zimbabwe had pinned hopes on the Constitution as a foundation of establishing and retaining a democratic society. The path that has been taken by the Government to mutilate constitutional provisions that keep the executive powers checked is not healthy in any democratic society.
We note with deep sadness, that the same constitution is now a victim of politically motivated constitutional amendments 1 and 2 that serve to re-centralize power into the hands of the political elite contrary to the letter and spirit of devolution. Apart from being unpatriotic, the move is not good for the country and a betrayal of the people of Zimbabwe.
We assert that the rot and incapacitation within our local authorities (both urban and rural) is partly linked to interference by the central government in the management and running of these local authorities.
In addition to that, the stripping of revenue streams of local authorities by central government has further compromised the capacity of these local authorities to effectively deliver services. A clear example is the ZINARA takeover of vehicle licensing from local authorities, which left local authorities being burdened with an unfunded mandate to maintain local roads.
The Government of Zimbabwe cannot celebrate the paltry conditional funds it is disbursing to local authorities and claim that these are “devolution” funds. Once they are conditional, they become grants and not devolution funds. In any case they have fallen below the constitutional prescription of at least 5% since their disbursement from 2019 to date!
Devolution funds are a constitutional obligation in terms of section 301 of the Constitution and there is a need to develop a clear distribution framework that is transparent and gazetted for all stakeholders to exercise their right to hold government and local authorities to account on the use of such funds.
Furthermore, we strongly discourage politicization of service delivery and reaffirm that the funds disbursed by the government to local authorities is taxpayers’ money and those funds should not carry a political party tag.
We expect the central government to strengthen and capacitate local authorities than taking over their constitutional mandate. Section 276 (1) gives local authorities the right to govern on their own initiative the affairs of the people within their jurisdiction and they have “all the powers to do so.”
We stand guided by the supreme law of the land which states that local authorities are managed by councils composed by Councilors and any other arrangement outside these provisions is unconstitutional.
We believe that devolution is a catalyst to improved service delivery and therefore we call for meaningful devolution of governmental powers and functions to sub national and lower tiers of government.
We recommend the following;
· The need for equal representation of women, young women, youth, people with disabilities and any other special needs groups in the composition of auxiliary structures of the provincial council and all elected and non-elected local authorities’ structures.
· Legal and institutional frameworks that facilitate operationalization of devolution must conform to the principles of devolution envisaged in Chapter 14 of the constitution. Some provisions of the Provincial and Metropolitan Councils Administration Bill are not compatible with the constitution.
· So early in the life of our constitution, the proposed amendments should be halted forthwith or subjected to a national referendum in the spirit of promoting democracy and self-governance reflective of the will of the majority of Zimbabweans as expressed in the extant Constitution.
· The inter-ministerial cabinet committee which will oversee devolution is inaccessible to the public and central government cannot be an independent arbiter in a process of sharing power with other tiers where it is an interested party. We call for an independent body to preside over devolution implementation as this facilitates a more inclusive process which will gain greater public support.
· Devolution is not only a domain of local government. It should be extended to all service delivery functions including environment, natural resources governance, health, water, roads and infrastructure and the attendant fiscal resources to mitigate against unfunded mandate.
· Recruitment of senior officials of local authorities and provincial councils should be done at the local level and not through an appointed local government board.
· There is need for government to promulgate a law for the “at least 5%” revenue sharing formula to allow for predictability of the funds that are to be disbursed to other ties of government.
· The appointment of a Provincial Minister of State and Devolution in a governance and political space presided by a Provincial Council Chairperson is duplicitous with the potential to create a role conflict and is therefore undesirable apart from being an extra burden to the tax-payer. It is therefore recommended to dissolve the post of provincial Minister of State and Devolution.
Norris Nyathi, the former Victoria Falls deputy mayor and senior executive in the Douglas Mwonzora-led MDC-T has resigned from the party in protest over its legislators’ voting alongside Zanu PF to amend the national Constitution.
Eleven MDC-T senators on Tuesday voted with 54 Zanu PF members to pass the Constitutional Amendment No 2 Bill, which now awaits President Emmerson Mnangagwa’s assent.
The Bill opposed by 10 opposition senators, required a two-thirds majority — or 54 votes to pass through the Senate.
In a letter dated May 4, addressed to the party’s secretary-general and copied to the MDC-T Matabeleland North provincial office in Hwange, Nyathi said as a result of that “deception”, he had decided to sever ties with the opposition party.
Nyathi served as Victoria Falls deputy mayor from 2013 to 2018.
Part of the letter read: “Failure to protect the citizens of Zimbabwe, I consider it gross misconduct by our MPs, senators, including the presidium to give Zanu PF the needed two-thirds majority in order to pass the repressive Constitutional Amendment Bill No 2. This is a direct provocation to the electorate who are the custodians of the Constitution which you have amended without going through a consultative process. Your soft tone to the injustices perpetrated against the people of this nation leaves a lot to be desired,” Nyathi wrote.
He also raised concern over the composition of the party’s top leadership, saying it did not reflect inclusivity.
“Your composition of top leadership does not reflect inclusiveness or nationalism, you continue to sideline the people of Matabeleland from powerful positions like any other party headquartered in Harare. I want to also speak to the implementation of the Supreme Court judgment, it is a fact that part of the 27th December congress delegates were not the proper structures as at February 2018, this whole process was carried out to consolidate power and control of Richard Morgan Tsvangirai House,” he said.
“In the spirit of democracy and integrity the party was supposed to bring together all party members who were in the structures before the death of President Morgan Tsvangirai (MHSRIP) including those you regarded as your enemies. Your exclusion of other members was illegal, undemocratic and selfish.”
Efforts to get a comment from MDC–T spokesperson Witness Dube and his deputy Khalipani Phugeni were fruitless.
Own Correspondent | Young ladies around the country are unhappy with Masvingo preacher and slay queens godfather Isaac Makomichi’s threats to “close wombs of those who snatch married women’s husbands.”
The outspoken preacher reportedly returned from Ghana with a charm that can “close a woman’s womb.”
Makomichi recorded a video footage as he was leaving Ghana aboard a British Airways plane.
In the video footage, Makomichi said : “If someone takes your husband or boyfriend then that person anoora chibereko.”
S*x workers and slay queens are reportedly planning to take to the streets to push government to stop Makomichi from distrubuting the charm.

By A Correspondent- The trial of former Labour minister Priscah Mupfumira on criminal abuse of office charges resumed yesterday where she claimed that her charge sheet did not specify the duties she allegedly abused.
Mupfumira, who is being charged together Ngoni Masoka, who was permanent secretary in the Labour ministry, appeared before magistrate Ngoni Nduna.
Represented by Admire Rubaya, Mupfumira said she did not instruct anyone at the National Social Security Authority (NSSA) to violate rules as she did not run the organisation on a daily basis.
“The first accused (Mupfumira) is at a loss as to how to defend herself without embarrassing herself in her defence in that the charge sheet read to her does not set out the specific duty or duties that she allegedly unlawfully and intentionally abused,” Rubaya said.
“It does not set out how the alleged duty or duties should have been carried out and it does not outline how she derogated from the lawful discharge of the undisclosed duty or duties as a minister in the government of the Republic of Zimbabwe.”
Mupfumira denied giving instructions to the NSSA management on the institution’s investment projects.
She said NSSA management was made up of many individuals, making the allegation by the State in the charge sheet inconceivable.
“Mupfumira denies ever giving Masoka any alleged instruction for him to allegedly enter into any offtake housing project contracts on behalf of NSSA without a NSSA board approval and/or without going through the tender process,” Rubaya submitted.
He said Mupfumira was just a government minister and not an executive official at NSSA.
The former minister said she was targeted because she was accused of financing a Zanu PF faction known as Lacoste, which was allegedly aligned to then Vice-President Emmerson Mnangagwa.
She said the allegations were raised by the late former President Robert Mugabe’s nephew, Patrick Zhuwao.
Zhuwao is currently in exile after fleeing the country following a November 2017 military coup which catapulted Mnangagwa to power.
The matter was postponed to May 26 for trial continuation.
Meanwhile, Mupfumira’s application to be tried separately from her co-accused, Masoka, was dismissed by Harare magistrate Munamato Mutevedzi.
Mupfumira is jointly charged for graft with Masoka, who is former permanent secretary of the Labour ministry.
She said since they were jointly charged, Masoka could not be compelled to give evidence on her behalf as an accused person yet he was her competent and compellable witness.
In his ruling, Mutevedzi said it would be difficult for the prosecution to prove their case against Mupfumira without linking them to the actions of the accused, hence it would jeopardise the State’s case.

Chelsea Wednesday beat Real Madrid by two goals to nil at Stamford Bridge to proceed to the final of the Uefa Champions League where they will face Manchester City.
Chelsea won by a 3-1 aggregate after they shared spoils with the Whites in Madrid in the first leg of the semi-finals.
They got Wednesday’s goals from Timo Werner just 28th minutes into the first half and from Mount who squared a Pulisic pass towards stoppage time.
Chelsea were denied a number of chances and could have won by a great margin if they had clinical finishes.
It’s now official, the Uefa Champions League will be between English Premier League rivals Chelsea and Manchester City.
They last met in the FA Cup match won by Chelsea.
Both teams are enjoying some good form at the moment with City poised to win the Premier League – they are one win away while Chelsea have been great since Thomas Tuchel’s arrival.
By Patrick Guramatunhu- “Mwonzora and his lot joined hands with Zanu-PF today to destroy the Constitution. The MDC-T has officially enabled Zanu-PF to mutilate the Constitution of Zimbabwe,” said a statement from the Chamisa led MDC Alliance.
Spare us the chutzpah.
Zanu PF’s 54 senators was enough to pass Constitution Amendment Bill No 2 with 2/3 majority even if the Mwonzora’s 11 MDC-T senators had rejected it.
The truth is Zimbabwe’s 2013 Constitution was a weak and feeble document “dictated by Mugabe”, boasted Paul Mangwana, the Zanu PF MP on the parliamentary committee that drafted the constitution. Morgan Tsvangirai and his MDC friends heralded it as a democratic constitution and an “MDC child” because they were desperate to have something to show for the wasted 2008 to 2013 GNU years.
The 2013 Constitution failed its litmus paper test – deliver free, fair and credible July 2013 elections – before Zanu PF had amended it.
It is rich that Nelson Chamisa, Tendai Biti, David Coltart, Welshman Ncube and many of the other MDC A leaders should be pointing the accusing finger at Mwonzora and company the ones who joined Zanu PF and “today destroyed the Constitution” when they were all in the MDC family that sold-out and fostered this stillborn “MDC child!” constitution on the nation.
One does not destroy “today” something that was stillborn 8 years ago, in 2013.
Zimbabwe is in this seemingly never ending economic and political mess because the nation has been stuck for 41 years and counting with this corrupt and tyrannical Zanu PF regime that has rigged elections to stay in power.
The people of Zimbabwe have risked life and limb to elect the now late Morgan Tsvangirai and his MDC friends on the understanding the party will bring about the democratic changes the nation needed to end the Zanu PF dictatorship. After 21 years, 5 of which in the 2008 to 2013 GNU, MDC has failed to deliver even one meaningful democratic change. Not even one!
Worse still, MDC leaders are now participating in flawed and illegal elections giving the vote rigging Zanu PF regime legitimacy. MDC leaders are now helping to perpetuate the Zanu PF dictatorship, the political system the people have, all these years, risked life and limb to end.
Zimbabwe’s economic and political mess was grown worse since MDC was launched back in 1999 and, today, it is now a serious existential crisis. Unemployment has soared to 90% and 49% of our people now living in abject poverty. Basic services such as education and health care have all but completely collapsed. The corona virus pandemic has turned a tragic situation into a Biblical catastrophe.
Zimbabwe’s economic and political existential crisis demands our immediate and undivided attention. The solution to ending the crisis is for the nation to implement the democratic reforms, the pre-requisite for free, fair and credible elections. This is the same task the nation has risked life and limb to elect MDC leaders to do.
Zimbabweans must now, after 21 years of MDC inaptitude, to open their eyes to the harsh reality that MDC leaders – Chamisa, Mwonzora the lot – are corrupt and breathtakingly incompetent. They had many golden opportunities to deliver the democratic changes needed to end the Zanu PF rule and they wasted them all. MDC leaders will never deliver the democratic changes the nation needs to end the economic and political crisis we are facing.
MDC leaders are going to drag the nation into yet another flawed and illegal 2023 election process. The people of Zimbabwe must refuse to follow MDC leaders. People must put their foot down and demand the implementation of the reforms before elections.
“Mwonzora and his lot joined hands with Zanu-PF today to destroy the Constitution!” It was stillborn “MDC child”, fathered by all the MDC leaders, and Zimbabweans should have rejected it back in 2013.
By A Correspondent- Suspended ANC secretary-general Ace Magashule has hit back, announcing that he has suspended party president Cyril Ramaphosa and that he would appeal his “fatally flawed” suspension.
A defiant Magashule, who was this week suspended for failing to step aside, described his suspension from party activities as “fatally flawed”, while questioning his deputy’s authority to issue him with such a letter.
As part of his suspension, Magashule has been barred from addressing public rallies or handling party-related matters while serving his suspension and facing criminal charges in a court of law.
He was served with a letter on Wednesday following a national working committee (NWC) meeting on Monday.
A defiant Magashule, who issued his statement in his capacity as the secretary general of the ANC through a Gmail account, said deputy secretary general Jessie Duarte had no authority to issue him with a suspension letter.
He also said he was using his powers as secretary general to “summarily” suspend Ramaphosa “in full compliance with the relevant conference resolutions”, he said.
“This is done in terms of Resolution 8.2 of the 54th National Conference, which states that, “… Every cadre accused of, or reported to be involved in, corrupt practices accounts to the Integrity Committee immediately, or faces DC processes….,and Resolution 8.3 that further provides for the suspension of, “… people who fail to give an acceptable explanation, or to voluntarily step down while they face disciplinary, investigative or prosecutorial procedures”.
“I call on all members of the ANC to act with revolutionary dignity and respect, and to uphold the ANC Constitution. None of us should bow to illegal and unconstitutional actions. In doing so we must protect the unity of the ANC as leader of society,” said Magashule.
In challenging his suspension letter, which was signed by Duarte, he said: “It is evident that the deputy secretary-general does not have the authority to issue such letters. Thus the letter is fatally flawed, and in fact unconstitutional.
“Furthermore these letters are based on a selective and factional interpretation of the relevant resolution.
“I herewith announce that I am immediately, and formally, appealing this unconstitutional suspension. In terms of the ANC Constitution, my suspension is thus wholly suspended, until my appeal has been heard, and it’s final outcome announced.
“For the sake of fairness and justice to all the affected comrades, who have received similarly unconstitutional letters, I as Secretary General – who is duty bound to uphold the ANC Constitution and all administrative processes – urge them to also follow the appropriate internal appeal processes,” said Magashule.
Other party members who have been suspended include former North West Premier Super Mahumapelo, who is understood to be a close ally of Magashule.
Meanwhile, Duarte refused to comment when contacted by IOL on Wednesday night, diverting queries to ANC spokesperson Pule Mabe.
Mabe said he had yet to speak to Magashule after the statement emerged.
“I have been trying to verify the authenticity of the letter because one does not know where it comes from,” he said, explaining that the ANC’s position on the matter remained as per the resolutions of the NWC.
When asked if Magashule’s letter had been communicated to the ANC, he said: “I am not aware, but I have seen the letter, but I cannot speak to the authenticity of the letter.”

The party would also replace the former President Robert Mugabe affiliated G-40 party members with new members, some of whom have never been members of any political party.
Zanu PF provincial Secretary for Administration Ephraim Fundukwa confirmed the restructuring to the state media Wednesday.

By A Correspondent- A 17-year-old Bulawayo girl was stripped naked and stabbed on Saturday during a robbery, police have confirmed. The incident took place around 7 PM at corner Intemba and Khami road.
The teenager was coming from town when the incident occurred. Bulawayo provincial police spokesperson Inspector Abednico Ncube confirmed the case saying investigations are underway.
“On Saturday at around 7 PM, the complainant was coming from Bulawayo CBD when she disembarked from a bus at the intersection of Intemba and Khami Road, Bulawayo.
“On her way home, she met one accused person who stopped her and demanded some money which the complainant indicated that she did not have. “The other two accused persons emerged from the bush, undressed the complainant and left her naked. The accused persons took away the complainant’s purple jacket, white jean trousers, t-shirt, grey pair of socks, orange pair of shoes and a black hat.
“One of the accused persons stabbed the complainant with a knife once on the left buttock whilst one other accused kicked her once on the forehead before leaving the scene with all her property” said Insp Ncube.
The teenager who made a report at Ross Camp on Sunday was taken to Mpilo Central Hospital for treatment.
Insp Ncube appealed to members of the public who might have information that might help in the arrest of the suspected persons to report to the nearest police station.
“Police in Bulawayo are appealing to anyone with information which can lead to the arrest of the accused persons to visit any nearest police station,” he said.
By A Correspondent- The People’s Democratic Party (PDP) has reported its member Benjamin Rukanda to the police for fraudulently and misrepresented the political grouping to the parliament.
Rukanda allegedly masqueraded as the party’s secretary-general and wrote to the Speaker of the National Assembly Jacob Mudenda to have the six legislators — Tendai Biti PDP President and Harare East MP, Willias Madzimure (Kambuzuma), Settlement Chikwinya (Mbizo), Kucaca Phulu (Nkulumane), Sichelesile Mahlangu (Pumula) and Regai Tsunga (Mutasa South) — recalled.
PDP youth secretary for mobilisation Lloyd Madzimure last week reported Rukanda at the Harare Central Police Station under case number IR 041348.
“I only got to know Rukanda in connection with this matter, and in the United PDP, he was in lower structures in Masvingo,” Madzimure said. In his statement to the police, Madzimure said Rukanda misrepresented to Mudenda that he was the secretary-general of the party when it was Chikwinya who held the position.
“On March 17, 2021, the accused authored a letter to the Speaker of the National Assembly Advocate Jacob Mudenda, claiming to be PDP secretary-general while the secretary-general was Settlement Chikwinya,” Madzimure said.
“The accused person had no legal right to call for the recalling of the above MPs, and in doing so he greatly misdirected the Speaker (Mudenda) to make lame decisions against them.” Contacted for comment, Rukanda said he was busy. “In the meantime, I am busy,” he said.
Efforts to get a comment from PDP leader Lucia Matibenga were in vain as her mobile phone was not being answered.
Biti and his colleagues recently had their recall set aside by the High Court and are now set to resume their parliamentary duties.
By Mari Matutu | Emmerson Mnangagwa’s huff to change the Constitution has hit a hard brick wall, despite receiving support from his surrogate Douglas Mwonzora.
It’s 9 days to Luke Malaba’s retirement. I see a lot of people are so worried with the passing of bill number 2, while on the other hand Mr Emmerson Mnangagwa is totally knocked down in fear.
My findings are supported by experts such as Dr Alex Magaisa wrote: If the retirement age is raised to 75 years as proposed, it has the effect of extending the length of time that a person may hold or occupy the office of a judge. This is precisely what is covered in section 328(7).
It states that an amendment that extends the length of time that a person may hold or occupy public office does not apply to any person who holds or held office before the amendment.
Even if the retirement age is raised to 75yrs, the current Chief Justice and other judges cannot benefit from it. They must retire at 70. To allow them to remain in office beyond age of 70 would be a breach of section 328(7) and an indirect and unlawful amendment of the same provision.
The Constitution is very clear in section 328(2) that any amendment to its terms must be done in express terms. If the government wants to amend section 328(7) and allow the extension of term-limits to benefit incumbents, then it must do so in express terms.
This is the test to your leadership and lawyers. If you see a National leader mourning about passing of bill number 2 by senate, then go and read Jeremiah 9v17-18.
We all participated in 2013 constitutional making. If this bill ever comes into law or if Zanu go past 15 May 2021, then do not Mwonzora or Zanu. Stop hiding behind fingers. These are known criminals but you have more duty than any one else to take over.
If Chamisa cannot take charge of a clear ground like this then he is not worth voting for because he will give away power to anybody. Actually he will be a security risk to the nation. Everything is now in his favour. Correct moves is what is left.
I) Here is why I say so A) The 2013 constitution gave three distinct authorities to three arms of state. Unlike the old constitution where we had three arms of state which did not state origin of authority to exercise in Executive or Legislature or Judiciary, the 2013 constitution is specific and clear.
B) The 2013 constitution puts every citizen at equal level and give citizens rights and duties which are above those given by constitution. Section 67(2)(d) gives right to a citizen to challenge in any manner as long it is peaceful the actions of government or any cause. Section 149 allows every citizen to challenge a bill or an Act of parliament to be repealed. Section 167(3) allows any interested person to challenge the constitutionality of bills of parliament. C) The 2013 constitution is clear to state that authority held by public officers is public Trust which must be exercised in consistent with the constitution . The public officers must be ready to serve the people of Zimbabwe and not to rule them. D) Members of security sector were given a well spelt conduct 208 Conduct of members of security services (1) Members of the security services must act in accordance with this Constitution and the law. (2) Neither the security services nor any of their members may, in the exercise of their functions- (a) act in a partisan manner; (b) further the interests of any political party or cause; (c) prejudice the lawful interests of any political party or cause; or (d) violate the fundamental rights or freedoms of any person. (3) Members of the security services must not be active members or office-bearers of any political party or organisation. (4) Serving Members of the security services must not be employed or engaged in civilian institutions except in periods of public emergency. E) Members of civil service’s conduct was well spelt as 200.
Conduct of members of Civil Service (1)Members of the Civil Service must act in accordance with this Constitution and the law.
(2)No member of the Civil Service may obey an order that is manifestly illegal. (3)No member of the Civil Service may, in the exercise of their functions— (a)act in a partisan manner; (b)further the interests of any political party or cause; (c)prejudice the lawful interests of any political party or cause; or (d)violate the fundamental rights or freedoms of any person. (2)Members of the Civil Service must not be office-bearers of any political party. (3)An Act of Parliament must make provision to ensure the political neutrality of the Civil Service. F) The 2013 constitution made the courts be independent by stating the following 164 Independence of the judiciary (1) The courts are independent and are subject only to this Constitution and the law, which they must apply impartially, expeditiously and without fear, favour or prejudice. (2) The independence, impartiality and effectiveness of the courts are central to the rule of law and democratic governance, and therefore— (a) neither the State nor any institution or agency of the government at any level, and no other person, may interfere with the functioning of the courts; (b) the State, through legislative and other measures, must assist and protect the courts to ensure their independence, impartiality, dignity, accessibility and effectiveness and to ensure that they comply with the principles set out in section 165. (3) An order or decision of a court binds the State and all persons and governmental institutions and agencies to which it applies, and must be obeyed by them. G) The constitutional Court was made the highest decision making body. The decision of President, or parliament or Speaker are subject to determination of a properly constituted, competent, impartial and independent court. Section 167(3) The Constitutional Court makes the final decision whether an Act of Parliament or conduct of the President or Parliament is constitutional, and must confirm any order of constitutional invalidity made by another court before that order has any force. H) The 2013 constitution made it clear in section 86(3)(e) that there is no law that can be put in pace to limit a fair trial. II) Having said this it is clear. Crystal clear that the regime can only survive with our own consent. All the tools are available at our disposal. We must stop trusting people like Innocent Gonese, Tendai Biti, Job Sikhala or Jameson Timba. If we trust them or their judgement it is at our own peril. These are the professional mourners put to rail road our democracy doom. I am not interested in talking much about them. Except to say we gave them a year to challenge the nonsense. Beside being louder in mourning they do not take correct action when needed. That is for another day. Strategy to be taken by citizens direct is three fold A) The section 149 approach. Do not expect the regime to accept your petitions. It is procedural. Raise 2million petitions that must tell the Speaker to stop any proceedings of these bills because they violate a lot of other provisions and violate fundamental rights of citizens as well as ICCPR. That petition serve as proof that the bill is unlawful
B) Use section 67(2)(d) to create a manner of challenging the bills and action of regime in a Court that is impartial where you use section 35(4) as your duty that is over and above the ones imposed by constitution. You sue UN, AU, SADC and the regime to attend to the collapse of Judicial arm of state which we cannot allow to be molested while we watch.
C) Approach the Clerk of Constitutional Court, apply that the Court that sat as CC by Makarau , Patel and Gorowa be declared unconstitutional. Apply that no one must purport to be CC in terms of s166 if the law has not been followed. III) If we cannot stand up on this then lets shut up. If Chamisa cannot command this then lets give up. Malaba has to retire in 10 days. All what they do after is in dispute. Once Malaba retires there is no CC, SC or HC. It will be our own choice to legitimise those courts.
Instead who so ever shall be arrested and stand before anyone purporting to be court after 15 May is regarded as a political prisoner. That court has no section 162 Judicial authority. We laid out how Judicial authority is conferred as a people. No one can come behind our back giving some other judicial authority to someone.
I have also. in accordance with the powers vested in me as the Secretary-General of the ANC, and furthermore in full compliance with the relevant conference Resolutions summarily suspended the President of the ANC, comrade Cyril Ramaphosa.

South Africa is considering a legal change for drivers of South African-registered commercial vehicles that will end recognition of driving licences for some classes obtained in foreign countries and insist that all licences for such drivers must be obtained in South Africa.
The South African Road Freight Association sees this as a back-door route to preventing foreigners from being employed by South African freight companies.
While the proposed changes do not ban foreigners, they would, if enacted, require foreigners to undergo the long and expensive process of training and testing to get the South African licences, and that would probably require, at least for the testing stage, that they were legal residents of South Africa.
Yet residence requires the employment that comes once the licences have been obtained.
Many South African transport companies are happy to hire foreigners, especially for vehicles travelling outside the country, since there are a limited number of South African drivers prepared to undertake these long trips.
But at some stage in their journeys they need to drive on South African roads.
At present the special permits needed in South Africa for commercial vehicles can be issued against the production of recognised foreign drivers licences, along with other requirements, but the system does allow those who trained and were tested in several foreign countries to qualify fairly quickly for the required public vehicle permits.- The Herald
I have also. in accordance with the powers vested in me as the Secretary-General of the ANC, and furthermore in full compliance with the relevant conference Resolutions summarily suspended the President of the ANC, comrade Cyril Ramaphosa.
Hon Daniel Molokele, Joana Mamombe’s mum and others
By Hon Daniel Molokele | I was at the High Court earlier today when Justice Chitapi finally granted bail to Hon. Joana Mamombe and Ms. Cecilia Chimbiri
However, I do have some mixed feelings about this whole drama at the courts
On one hand, I greeted the positive judgment with a huge sense of relief.
My mood even improved a few minutes later after i personally witnessed how so much the ruling today meant to the mothers of both our dear comrades.
Indeed, both mothers were so visibly relieved and very happy in the aftermath of the judgment.
Honestly speaking, it has been a very difficult start to the year for both of them. I have no doubt that is only God who really knows as to how much stress both these wonderful parents have experienced for over two months since their beloved daughters were unjustly incarcerated and unfairly denied bail.
So in the end, I really had no choice but to also swim along the high emotional tide that was prevailing at that particular moment.
As such, l ended up heartily joining them and helped them to celebrate this rather rare moment of bliss for both of them.
On another hand, I could not help but fully appreciate the negative spasm or excruciating tinge of pain that not only transcended but also profoundly permeated my heart at that particular moment when we were still standing outside the Harare High Court.
What matters worse is that we were all standing less than five meters away from a statue at the entrance that symbolizes JUSTICE.
The High court is supposed to overflow with endlessly waters brimming with justice for all. All are supposed to be treated equally, justly and fairly before the eyes of the law.
Yet all evidence related to the circumstances of these two brave and heroic young Zimbabweans was overwhelmingly showing that theirs was clearly an exceptional case.
They were not treated equally, nor fairly, and most certainly not justly by both the Harare Magistrates court and the High court in the last two months.
Like every other citizens of this country they were both fully entitled to be regarded as innocent until proven guilty through a fair and just trial process.
Added to that, the right to bail is enshrined in our national Constitution; but this was not so in their particular case. If anything it was mysteriously reduced into a privilege for them.
Put in the most specific of all terms; our justice system seems to have totally failed both our comrades.
Indeed, there is certainly some overwhelming evidence that the charismatic duo were clearly singled out and isolated for political victimisation in the most blatant abuse of our justice system.
To put in more specific terms, there is no doubt that a cursory glance through the video recording of the press conference that led to their arrest at the end of February, reveals the following curious facts:
1. The duo were not the only ones who conducted the press confererence. They were actually part of a group of about ten people. Yet it was only them who were singled out for arrest in the most bizarre example of selective justice ever.
2. Worse still for Cecilia Chimbiri, she was standing at the back row; while at the same there were several people standing in front of her. Yet none of them was even called for questioning up to this day.
3. The press conference participants went out of their way to observe the recommended COVID-19 regulations by standing several spaces apart from each other. Added to that, they were all clearly wearing face masks. Yet, this still did not deter the law enforcement agents not only from disrupting their press conference but also arresting them.
4. The impromptu press conference was attended by a few journalists. There was no crowd at all in sight. But still, the law enforcement officials were somehow convinced that the event was a potential super-spreader for COVID-19.
The irony of it all is that only this past week, a well known faith based leader literally brought the Bulawayo city centre to a standstill.
Throughout his show-stopping performance he was not wearing a face mask at all. Worse still, a large vociferously crowd surrounded him.
The event was by all accounts a potential COVID-19 super-spreader.
Yet instead of the law enforcement officers arresting this man, they simple issued a so-called strong warning against using a press statement.
But this was just one example of the law enforcement officers turning a blind eye simply because of someone’s assumed political connectivity to the highest office in the land.
5. Listening to both the first and second judgments in both the provincial Magistrates court and the High court; it is evident that the judicial officers treated both young women as mischief mongers and political delinquents.
They were clearly judged not on the facts or merits of the case before the courts. Instead, they were openly accused of deliberately and wilfully violating the law as a perpetual habit or crazy hobby.
Both courts desperately tried to paint a picture of them as a nuisance to society that even did not deserve the full protection of the justice system as enshrined i the Bill of Rights of our national Constitution.
6. The right to bail is strongly promoted by our justice system. However in this particular case, both courts were curiously determined to fix or teach a life-lesson to the two accused persons by deliberately denying them their constitutional right to bail.
In the end, they were forced to stay behind bars for an unnecessarily lengthy period. It is so disappointing that by the time they were finally granted bail today, they had already over-served for the worst sentence they could ever get if they eventually get convicted for violating the COVID-19 regulations.
In the final analysis, it is now so evident that both their arrest and subsequent lengthy incarceration has totally got nothing to do woth the judicial administration of justice at all.
But it was more of a politically motivated process than a normal judicial process.
Theirs was definitely more of a classic case of political persecution using criminal prosecution
Yet these two are not in way criminals at all.
Instead, all evidence around how they have conducted themselves in the last few years can only lead to one clear conclusion; that they are some of the most patriotic Zimbabweans ever.
Indeed, they are not corrupt citizens at all. Neither are they rogue criminals.
But they are very passionate patriots who are inspired by their true and pure love for their beautiful motherland.
All that they are seeking for is a clear return to justice and the rule of law.
All that they are campaigning for is a new peaceful, free, democratic and prosperous Zimbabwe.

Schools should not withhold examination results for non-payment of fees but should instead take action against the defaulting parents or guardians, Primary and Secondary Education Minister Ambassador Cain Mathema said last night. This week, the Zimbabwe Schools Examination Council released O-level results and some candidates have been blocked from getting their results, which they need immediately to secure A level places.
Minister Mathema wants the debt recovery process to be strictly between schools and parents.
The children were not part of the contracts between schools and parents hence they should never be disadvantaged.
Heads of government schools that continue withholding pupils’ results will face disciplinary action while private schools risk being sanctioned or completely deregistered for not adhering to the rules.
“Schools are not allowed to withhold results of learners,” said Minsiter Mathema. “It is illegal for schools to withhold results over non-payment of fees.
“Whether private or public, schools should find means of recovering what is owed to them by parents and guardians without punishing learners.
“Learners should be allowed to access their results timeously and continue with their education while school authorities engage defaulting parents.”
It is not the intention of Government to financially cripple the operations of schools but pupils cannot be punished fo their parents’ failure to pay fees.
Schools authorities can take legal action against defaulting parents. -Chronicle

Two people are said to have died early Sunday morning after the vehicle they were travelling in veered off the road and uprooted this tree along Robert Mugabe Way in Bulawayo

Atwell Seremani who appeared before Magistrate Dennis Mangosi remanded in custody together with his accomplice Nation Machaya.
The two applied for their bail and the ruling is expected today . Allegations are that sometime in 2020 the complainant was tasked to apply for work permits by the dire tors of the company at the department of immigration for their foreign employees.

The police officer commanding Beitbridge district (Dispol) Chief Superintendent Tichaona Nyongo said the suspects Patriot Mbedzi, Bornbright Mbedzi (20), and Dunmore Mbedzi (21) were now in police custody pending further investigations.

The MoUs which Mnangagwa is claiming to have signed with the Indians span various sectors that include mining, manufacturing, trade, banking and finance, tourism and pharmaceuticals among others.

The Confederation of African Football (CAF) has informed ZIFA about the areas still needing improvements at the National Sports Stadium following another temporary homologation of the venue to host international matches.
The country was at risk of hosting next month’s World Cup qualifying match against South Africa elsewhere due to the condition of the Harare stadium, but the continental football body gave the greenlight for the game to happen there.
The giant facility, however, does not meet all the minimum standards and CAF has warned ZIFA that the venue still needs some touch ups to get a long term approval to host international matches.
Here are the areas in need of upgrade:
Pitch condition Bucket seats for spectators Toilets for spectators Signage in & around the stadium Dressing rooms floors, showers & toilets Offices floors CCTV Access controls Venue Operations Center Failure to complete the renovations on time will result in fines that may arise from organisational and technical violations observed during the upcoming matches.
This has happened before after the FA was fined US$2,000 for uncleanliness of the stadium and lack of bucket seats when the Warriors hosted Zambia at the NSS, in the last AFCON qualifier in March.- Soccer 24 Zimbabwe
