Covid-19 Curfew Hours Relaxed As Govt Prepares To Open Borders

Curfew hours have been relaxed from 8pm to 10pm for the convenience of travellers, while Government has resolved to open the country’s borders in phases beginning with private passenger vehicles and pedestrians from December 1, 2020, while assessments are undertaken regarding public transport.

Speaking at a post-Cabinet briefing in Harare yesterday, Information, Publicity and Broadcasting Services Minister Monica Mutsvangwa said border posts that fall into the first phase are Beitbridge, Plumtree, Victoria Falls, Chirundu, Nyamapanda and Forbes.

“The borders will open first to private passenger vehicles and pedestrian traffic as from December 1, 2020, while further assessment is being undertaken with regard to preparations for handling public passenger transport.

“Cabinet wishes to inform the public that border operating hours are being fixed between 0600 and 1800 hours until further assessment of the situation. Curfew hours are being extended beyond the current 2000 hours to 2200 hours for the convenience of those who are cleared late at ports of entry,” Minister Mutsvangwa said.

The extension of curfew hours takes effect after gazetting.

This development comes after the Department of Immigration recently advised Government to consider reopening land borders for passenger traffic in phases, particularly at Beitbridge Border Post where 500 000 people crossed per month in both directions before the national lockdown began on March 30.

Between 13 000 and 15 000 people are passing through Beitbridge Border Post each day from SADC countries, a situation that needs examination to guarantee safe movement of travellers and within health protocols against the spread of Covid-19.

Last month, Zimbabwe reopened airports to tourism-related travel, but passenger traffic by road and rail remained restricted until the latest announcement.

Only returning residents, commercial cargo, diplomats on Government business and human remains for burial were being allowed entry through the country’s land borders.

Minister Mutsvangwa acknowledged the continued assistance the country was receiving from partners to contain Covid-19 and implored citizens not to be complacent as the contagion was still to be vanquished.

“On this very positive note, the Government of Japan is supporting Zimbabwe in equipping four central and eight provincial hospitals with state-of the-art medical equipment comprising bedside intensive Care Unit monitors, an ultrasound scope, operation and examination equipment, a portable X-ray system, bedside Coronary Care Unit monitors, emergency ventilators, electrocardiographs, an anaesthesia workstation, and artificial resuscitators,” she said.

The equipment from Japan would soon be distributed to Parirenyatwa Group of Hospitals, Sally Mugabe Central Hospital, Mpilo Central Hospital and United Bulawayo Hospitals.

Other provincial hospitals that are set to benefit are Bindura, Chinhoyi, Gwanda, Gweru, Kadoma, Marondera, Masvingo and Mutare.

Three Cops Arrested For Stealing Clothing Bales

Three police officers from Mutare have been arrested for allegedly stealing 79 of the 143 smuggled clothing bales they had intercepted.

National police spokesperson Assistant Commissioner Paul Nyathi last night confirmed the arrest of the trio. “The police can confirm the arrest of detective Assistant Inspector R. Arovishi, Detective Sergeant K. Mushwete and Detective C. Chidakwa for criminal abuse of duty as public officers under the Criminal Law (Codification and Reform) Act [Chapter 9:23,” he said.

Asst Comm Nyathi said they were working closely with the Special Anti-Corruption Unit on the matter.

According to police,  the trio intercepted a truck with 143 bales at around 1am on October 19.

The accused are said to have connived with Edward Muhamba to steal part of the contraband and they stored 79 bales at the latter’s garage in the eastern border city.

The remaining 67 were surrendered to police and the three accused officers got US$2 000 from Muhamba.

Asst Comm Nyathi said the offence came to light after the police officers failed to honour some of the terms of the agreement with Muhamba who then made a police report.

FIFA President Tests Positive For Coronavirus

FIFA president Gianni Infantino has tested positive for coronavirus.

The 50-year-old is experiencing mild symptoms and has begun self-isolating, world football’s governing body confirmed on Tuesday.

“Fifa president Gianni Infantino has received confirmation today that he has tested positive for coronavirus,” a statement said.

“The Fifa president, who has reported mild symptoms, has immediately placed himself in self-isolation and will remain in quarantine at least for 10 days.

“All people who came into contact with the Fifa president during the last few days have been informed accordingly and they are being requested to take the necessary steps.

“Fifa sincerely wishes president Infantino a speedy recovery.”

Infantino is in his second term as Fifa president, having won re-election in June last year.

The former Uefa general secretary first took office in February 2016.

Infantino has spoken recently of his determination to make sure the 2022 World Cup in Qatar takes place with fans attending, despite the coronavirus pandemic forcing domestic competitions to continue to restrict the number of supporters going to stadiums or banning them entirely.

“I cannot imagine the Qatar 2022 World Cup without fans because playing a competition the size of the World Cup without spectators is almost no point in having, causing us big issues, and there is no doubt that the next World Cup will definitely be held in Qatar,” he said.

“We have sufficient time in order to contain the coronavirus pandemic, and the global community will have done this by winter 2022.

“At the present time the crisis threatens football and for the first time since World War II, football competitions around the world have been stopped. The situation has been very difficult, especially for those countries that depend on the income of fans attending.”

Infantino also spoke last week about the reported European Premier League, which would potentially replace the Champions League with a new league tournament for Europe’s biggest clubs.

The Fifa president refused to be drawn on whether he supported the proposal.

“As Fifa president, I’m interested in the Club World Cup, not the Super League,” Infantino told reporters in Switzerland.

“For me, it’s not about Bayern Munich against Liverpool, but Bayern against Boca Juniors.” — Goal

Zimbabwe Records Five More COVID-19 Deaths

FIVE more people have succumbed to Covid-19 in Zimbabwe and 27 positive cases have been recorded.

According to the Ministry of Health and Child Care, three of the latest deaths were recorded in Bulawayo province which has the highest number of active cases at 123.

Zimbabwe has 264 active cases.

The country has recorded 242 deaths so far.

“We recorded 27 new cases and five deaths reported in the last 24 hours and the seven-day rolling average for new cases rises to 21 today from 18 yesterday,” read a statement from the Ministry.

“All 27 are local cases and three of the deaths were reported in Bulawayo, one in Manicaland and the fifth one in Masvingo province. No new recoveries reported and the national recovery rate stands at 94 percent while active cases go up to 264.”

The Ministry said as of Monday, Zimbabwe had recorded 8 303 cases, 7 797 recoveries and 242 deaths.-Chronicle

MDC Alliance Unhappy With SADC Silence On Abuse Of Human Rights In Zim

The MDC Alliance led by Nelson Chamisa has castigated SADC for remaining mum while the human rights, economic and political situation in Zimbabwe implodes.

The development came to light on social media when the SADC secretariate Stergomena Tax on 25 October the Zimbabwe Anti Sanctions day tweeted a solidarity message with Zimbabwe and said:

MDC Alliance secretary for international affairs Gladys Hlatywayo responded to Dr Tax and said:

Since August 2018, more than 50 Zimbabweans have been killed, 105 were abducted including the three MDC young women who were se_xually abused by State agents. We never heard the voice of Sadc on these human rights violations. Why is it so Your Excellency?

Dr Tax did not respond to Hlatywayo. SADC has remained quiet while other entities including the African Union, South Africa, the United Nations have agreed that there is a crisis in Zimbabwe.

SADC only surfaced when the ruling party Zanu PF and the government increased their anti-sanctions campaigns and showed solidarity with them despite evidently being quite on other issues bedeviling the Southern African nation.-NewsDay

ZANU PF Says We’re Ready For Harare Bi-Elections

The Zanu PF Harare province has completed primary elections and is now geared for by-elections following the recall of seven MDC-T legislators and 22 councillors.

The party’s provincial interim chairman,  Godwills Masimirembwa confirmed the development saying the names of those who won the primary elections were forwarded to the national commiserate department.

“From the 10th to the 18th of October, we conducted primary elections in respect of the constituencies where MDC-T has recalled nine legislators, and 22 councillors. The referred constituencies being St Mary, Highfield West, Highfield East, Glenorah, Kuwadzana, Kuwadzana East, Mufakose, Harare Central, Epworth and of cause 22 wards in Harare Metropolitan province,” said Masimirembwa.

Masimirembwa said the polls were held peacefully. “The turn up for the primary elections was quite pleasing. The primaries were held in a peaceful and transparent environment, no violence and no mishaps.

“Generally, we are very happy with how the primary elections were held,” he said. He was not at liberty to disclose the names of those who successfully won the primary elections.

“As the norm with our internal process in Zanu PF, the results have been forwarded to the national commissariat department, once they have received the final approval we will then release those results.

“The primaries went on very well and we are raring to go as and when the by-elections will be conducted. The primary elections came at a time when the restructuring programme of cells was in progress,” he said.

The province is currently working on cell verification exercised and branches to strengthen party structures.

“What we are continuing with now is to complete the restructuring exercise and then proceed with branch elections and district elections.

“We expect to complete the restructuring process of the province by the end of November this year,” he said.

The Harare provincial structures were dissolved by the Politburo after reports of factionalism and divisions rocked the restructuring process. -Herald

Herald Says 1 Million Households’ve Been Given Presidential Pfumvudza Inputs

The state owned main newspaper reports saying Emmerson Mnangagwa’s administration has dished out presidential inputs to over 1,1 million households.

The report says in part: ‘more than 1,1 million households across the country have received inputs under the Climate-Proofed Presidential Inputs Programme popularly known as Pfumvudza.’

The report paints a picture that proposes that the distribution has already happened, but while in the same vein saying that it is still to be done.

A part of it reads: The inputs are being distributed to farmers by the Grain Marketing Board (GMB).

Each household will be supported with a standard input package comprising 5kg seed for maize, 1x50kg bag basal dressing, 1x50kg top dressing and traditional grain seeds for both oil seeds and cereals per household.

The standard input package is enough to cultivate three Pfumvudza plots, each plot measuring 16mx39m, two plots for cereals (maize and traditional grains) and a third one for oil seeds such as soyabeans in high rainfall potential areas and sunflower in the low rainfall potential.

Farmers in the drier parts of the country will be supported with other climate smart crops such as cow pea, groundnuts and roundnuts. GMB chief executive, Mr Rockie Mutenha yesterday confirmed that inputs distribution was at an advanced stage.

“We have distributed inputs to 1 197 787 households across the country. We received funds to transport inputs from the GMB depots to wards for easy access by farmers.

“This has accelerated delivery of inputs to farmers and to date we have distributed 6 000 tonnes of seed, 37 500 tonnes of basal fertiliser and 10 000 tonnes of ammonium nitrate,” he said.

“The rains are upon us and we are encouraging all transporters within the districts to assist in the movement of inputs,” he said.

Pfumvudza which is the flagship of the Agriculture Recovery Plan is aimed at increasing food output per unit area through the adoption of conservation agriculture and adoption of good agronomic practices such as mulching, population density management, crop rotations, fertilisation regime management and pest and weed management.

The programme received a major boost in terms of extension services through enhanced mobility for the agricultural extension officers with the support of 5 000 motor cycles from President Mnangagwa.

Over three million farmers have so far been trained on Pfumvudza with the majority being women. Lands, Agriculture, Water and Rural Resettlement Minister Dr Anxious Masuka recently said Pfumvudza had received overwhelming response from farmers as an alternative technique to boost productivity.

“We are clearly on target. Distribution of inputs is underway. “We are excited that farmers have embraced this alternative technique and certainly with predicted good rains we are going to have a better season,” he said.

Zimbabwe Commercial Farmers Union president Mr Shadreck Makombe applauded Government for distributing inputs to farmers early.

“There has been a remarkable improvement in the movement of inputs to farmers this year. We are taking it up from winter cropping season where all wheat inputs were in place.

“We have started on good pedestal. Those distributing inputs on the ground should move with speed since some roads are not accessible during the rainy season,” he said.

Mr Makombe urged farmers in marginal areas to continue growing traditional grains even when good rains are expected. -Herald

He was rushed to Musami Hospital for treatment.

Grandpa Arrested For Stealing From Neighbour

Farai Dziva|A 75-year-old man has been arrested for stealing bicycles and barbed wire from his neighbours.

A 75-YEAR-OLD Colleen Bawn man has been fined $1 500 for stealing two bicycles from his neighbour and barbed wire from a nearby farm.

Hassan Phiri was convicted on his own plea of guilty to theft by Gwanda magistrate, Miss Lerato Nyathi.

He was ordered to have paid the $1 500 fine by October 30 or risk being jailed for two months in case of default. In addition, he was sentenced to five months imprisonment which was wholly suspended on condition that he does not commit a similar offence within the next five years.

Prosecuting, Mr Noel Mandebvu said Phiri stole two bicycles from his neighbours as well as barbed wire from Bromley Farm in Collen Bawn in May.

“On 13 May at around 9PM Mr Foster Hlongwane retired to bed and left his bicycle parked by the verandah. On the following day at around 5AM his wife got up to sweep the yard and she noticed that the bicycle was missing and informed her husband. Mr Hlongwane tried to check the footprints of the accused person but couldn’t find any,” he said.

“Later during that month Mr Hlongwane heard that the police had found some bicycles at the accused person’s homestead while they were investigating another case of theft of a bicycle. On 31 May at around 10AM Mr Hlongwane then proceeded to the accused person’s homestead with the police to identify his bicycle and he found it. The bicycle is worth US$100.”

Mr Mandebvu said under the second count on May 28 at around 8PM the complainant Mr Mbuso Moyo went to visit his relatives who live close to Phiri and left his bicycle unsecured in the yard. He said at around 10PM the complainant decided to go back to his home and discovered that his bicycle was missing from where he had left it.

Mr Mandebvu said the following day at around 6AM the complainant with the assistance of neighbourhood watch committee members and some villagers tracked the bicycle tyre marks which led to them to Phiri’s homestead where they found the missing bicycle in the accused person’s field. He said the matter was reported to the police resulting in the arrest of the accused person. The value of the stolen bicycle is R2 000.

“Sometime during the period between the year 2018 and 29 May 2020 Phiri proceeded to Bromley Farm in Colleen Bawn and stole three rolls of barbed wire which had been used to fence the farm and took it to his homestead. On 29 May at around 6AM police who were investigating a case of theft of a bicycle arrived at Phiri’s homestead and found three rolls of barbed wire.

“Police carried out investigations which later revealed that Phiri had stolen the barbed wire from Bromley Farm leading to his arrest. The value of the stolen barbed wire is R1 000,” he said.

Latest On Bushiri Arrest

JOHANNESBURG – The bail application for self-proclaimed prophet Shepherd Bushiri, his wife, Mary, and their co-accused has been postponed to Friday by the Pretoria Magistrates Court.

The Bushiris and their three co-accused were arrested last week and face charges, including fraud and money laundering involving R102 million.

The Bushiris and their co-accused will spend another four nights in the Kgosi Mampuru Correctional Centre in Pretoria.

This after their case was rolled over to allow accused number one to explain to the court why he should be granted bail.

Lawyer for accused number two earlier said that the State had no case against his client, saying that it would be in the interests of justice to release her since she had a child who she was breastfeeding.

Earlier yesterday, Advocate Anneline van den Heever tried to persuade the magistrate to postpone the matter until today but the magistrate raised a number of concerns, saying that the court roll was full and she could only hear the matter on Friday.

“As with today, we are more than willing to come and sit and wait our turn. I would suggest, your worship, that it would be in the interest of justice with regard to the facts that the matter be rolled over until tomorrow.”

She also said that she was concerned about a large group of people outside the court building where social distancing was not being adhered to.-EyeWitnessNews.

I did not hear what he said about me because he is one guy I never ever listened to on all his various interviews he had in the past. What I am told is that he claimed that I have joined them. It must be on record that for many many years I never met this Khalipani Phugeni since he stopped attending MDC T meetings which I was a National Executive member as the Secretary for Recruitment and Mobilisation during the period of the late President Morgan Tsvangirai. He abruptly stopped to attend MDC meetings after the appointment of VaMudzuri and VaChamisa as Vice Presidents of the party. I coincidentally bumped into him at Holiday Inn Hotel soon after 2018 elections where he told me that he had come for the launch of POLAD. He was seated on top of his bag right on the entrance to the Hotel. I greeted him and had a few minutes chat where he told me that he is in Harare from SA for the launch of POLAD. I wonder what gave him the audacity to speak on my behalf as if I am dead. Even Fadzai Mahere has never dared speaking on my behalf on issues of my personal thinking. This man is astonishingly brave. But he must be told before hand that respect is very important. Don’t talk about other people who have never talked about you without their consent. It is not only dangerous but boarders on contempt of others.

What he must know is that I am rooted from the people. Millions from Zambezi to Limpopo, from Forbes Boarder to Victoria Falls and beyond our borders have strong belief in my fight for the emancipation of the Zimbabwean masses. Every politics must be rooted from the people. It must be people centered not personal interest. Zim Dollar Remains Fixed Against The US Dollar

ZIMBABWE dollar maintained its stability against the US dollar at the weekly auction floor after a marginal shift to trade at 81,35 from 81,34 last week.

According to the RBZ data released after Tuesday’s auction, the weekly movement of the official rate continues to be within the range of at least one percent.
The highest bidder on the main auction was at $89 while the lowest bid remained at $80.

On the SMEs auction the highest offered was at $86 while the lowest accepted bid was at $70.
University of Zimbabwe Business School Director, Dr Nyasha Kaseke says the continued stability of the local dollar will also depend on favourable fiscal and monetary policy measures.

“It is all about how the fundamentals in place are fine tuned in the context of stability,” he said.

Confederation of Zimbabwe Retailers president, Mr Denford Mutashu said the stable exchange rate has seen a slowdown in prices.

“The gradual trend is therefore for everyone to see in the form of stable pricing models,” he said.
Large scale firms were the biggest beneficiaries of this week’s auction after accounting for over 27 million United States dollars while smaller businesses received a total of one comma seven million United States dollars.

Advocate Thabani Mpofu Ready To Meet PG Hodzi In Court On Rushwaya Affair

Nelson Chamisa’s Lawyer Advocate Thabani Mpofu has dared Prosecutor-General Kumbirai Hodzi who he said was in a relationship with underfire Zimbabwe Mines boss Henrietta Rushwaya to ”bring it on”.

Last night Mpofu took to Twitter and revealed that Rushwaya was Hodzi’s live-in lover:

Henrietta is PG Kumbirai Hodzi’s live-in girlfriend. Did the PG not know anything about this smuggling? Why again was Gula-Ndebele dismissed? Hasn’t the question of Hodzi’s fitness to remain in office arisen? Is he going to properly prosecute his lady-love?

Hodzi who is denying the allegations filed criminal charges against Thabani Mpofu and Hopewell Chin’ono who also shared Mpofu’s tweet on his social media platforms.

Hodzi reportedly reported Chin’ono and Mpofu to the Police according to Prosecutor Michael Reza who said:

I can confirm that the Prosecutor General has filed criminal complaints against Advocate Thabani Mpofu and Mr Hopewell Chin’ono for their utterances against him.

Mpofu took to Twitter to confirm that he is ready for Hodzi and dared him to ‘bring it on’:

Govt Passes Law Prohibiting Citizens From Talking To Foreign Governments

CABINET has approved changes to the criminal law to to allow the criminalisation and prosecution of “unauthorised communication or negotiation by private citizens with foreign governments”.

The development was confirmed by information publicity and broadcasting services minister, Senator Monica Mutsvangwa, at Tuesday’s post-cabinet media briefing.

“… the Vienna Convention on diplomatic Relations (1961) only recognises States as legitimate players in foreign relations and negotiations,” said the minister.

“Private players thus have no business in foreign relations and negotiations between countries.”

At the weekend, Zimbabwe and the region marked the second SADC Day against sanctions imposed by the West to punish Harare for its land reforms.

Now in place for two decades, the crippling sanctions were imposed at the active instigation of local opposition parties and anti-Zimbabwe civil society groups.

“The amendments will criminalise the conduct of isolated citizens or groups who, for self-gain cooperate or continue to connive with hostile foreign governments to inflict suffering on Zimbabwean citizens and to cause damage to national interests,” said Minister Mutsvangwa.

Wilful misinformation of foreign governments will also be liable to prosecution under the changes, including the staging of protests “deliberately designed to coincide with major international, continental or regional visits.”

The minister added; “There are also various unsubstantiated claims of torture and abductions that are concocted to tarnish the image of government, and (the) amendments will criminalise such conduct.”

Rushwaya Demands For Quick Trial “To Clear Her Name.”

Zimbabwe Miners Federation president Henrietta Rushwaya, who was late Tuesday afternoon remanded in custody after being charged with smuggling involving US$333 000 worth of gold is ready to submit for the court to give her a quick trial.

Her lawyer Mr Tapson Dzvetero had in an out of court determination with the state agreed to proposed bail conditions and demanded that trial kicks off when they return to court on November 13.

“The accused wishes to clear her name and have the trial commences. I am advised that the State completed its investigations and we hope that on the next remand date, November 13, trial commences,” said Mr Dzvetero.

Magistrate Ngoni Nduna postponed the hearing to Wednesday to hear the defence bail request and consider the conditions agreed by the State and her defence team.

The State led by Mr Charles Muchemwa had consented that Rushwaya be granted $90 000 bail. Had also agreed that Rushwaya be ordered to report twice a week at CID Minerals Flora and Fauna Unit, Harare and not to interfere with investigations and witnesses.

The State had agreed that Rushwaya be ordered to surrender title deeds to her lawyer Mr Tapson Dzvetero’s No. 709 Crowhill Estate, Borrowdale in Harare.

MDC Alliance MPs Walk Out On Khupe As She Delivers Maiden Speech In Parliament

MDC Alliance MPs allegiant to Nelson Chamisa on Tuesday braved axing from parliament when they walked out on MDC-T interim leader Thokozani Khupe as she made her maiden speech in parliament.

Khupe, recently seconded herself into parliament as a proportional representative MP for Bulawayo replacing MDC National Chairperson Thabitha Khumalo who she recalled following a supreme court ruling which made her interim leader of the opposition party.

As the MDC Alliance MPs walked out Khupe was cheered by Zanu PF MPs throughout her speech.

The defiant MPs left as soon a as Parliament deputy speaker Tsitsi Gezi recognised Khupe during a debate on the State of the Nation Address (SONA) by President Emmerson Mnangagwa last Thursday.

As they left the legislative chamber, some MPs from both benches all clapped for Khupe who was hailed by some who shouted, “Seva”.

MDC Alliance legislators last Thursday also boycotted President Mnangagwa’s speech as they have done so since the 2018 disputed elections claiming Chamisa was robbed of his victory by the incumbent.

Rushwaya Refused To Pay A US$5 000 Bribe At Harare Airport Leading To Her Arrest

Award winning journalist Hopewell Chinono had hinted that Henrietta Rushwaya would not pay a US$5000 bail to unnamed officials at Harare’s RGM Airport which led to her arrest.

Chinono made the revelation in a Tweet on Tuesday which exposed police double standards in handling suspects. According to Chinono, Rushwaya was treated like a rockstar when she was taken to court compared to how they were treated on their arrest couple of months ago.

Five More People Die Of Coronavirus, Three Of Them In Byo

FIVE more people have succumbed to Covid-19 in Zimbabwe and 27 positive cases have been recorded.

According to the Ministry of Health and Child Care, three of the latest deaths were recorded in Bulawayo province which has the highest number of active cases at 123.

Zimbabwe has 264 active cases.

The country has recorded 242 deaths so far.

“We recorded 27 new cases and five deaths reported in the last 24 hours and the seven-day rolling average for new cases rises to 21 today from 18 yesterday,” read a statement from the Ministry.

“All 27 are local cases and three of the deaths were reported in Bulawayo, one in Manicaland and the fifth one in Masvingo province. No new recoveries reported and the national recovery rate stands at 94 percent while active cases go up to 264.”

The Ministry said as of Monday, Zimbabwe had recorded 8 303 cases, 7 797 recoveries and 242 deaths.

Rushwaya Remanded In Custody After Excited State Bundled Her Clearly Directed Case

Zimbabwe Miners’ Federation President Henrietta Rushwaya has been remanded in custody.

The state is not opposing the granting of bail.

State Prosecutor Charles Muchemwa messed up the case which was clearly predetermined after he begged Harare Magistrate Ngoni Nduna to grant Rushwaya bail before her lawyers submitted the bail request.

Nduna had to remind Muchemwa of the need to follow procedure and allow Rushwaya’s lawyer Tapson Dzvetero to make a formal bail application before the court.

“You can’t just bring your consent for me to rubberstamp. So bail application has to be done before me to give basis of the consent,” said Nduna to Muchemwa.

Dzvetero then asked for time to apply for bail, but Nduna said it was too late before postponing the matter to Wednesday.

The state had consented to Rushwaya being granted ZWL$90 000, residing at the given address and surrendering her passport to the police among other conditions.

A determination on the bail hearing will now be made tomorrow.

She is accused of attempting to smuggle out of Zimbabwe 6kg of gold.

Army Boss Threatens to “Kill” Workers At Prophet T Freddy Mine

By A Correspondent| Popular Harare prophet, T Freddy has filed urgent High Court application to stop Zimbabwe National Army (ZNA) boss, Colonel Richard Mapanda from invading his mine in Mazowe.

According to Prophet T Freddy, Colonel Mapanda last week invaded the mine with a loaded gun threatening to shoot anyone who comes back on the pit head.

Through his lawyer Jivas Mudimu of Mudimu law chambers, Prophet T Freddy who is the director of Lazania Gold Mine said holds the license and certificates to carry mining activities at the mine in question.

“Applicant is a Mining company which is in the business of mining prospect for gold on an area of approximately 100 hectares situated within RA 1566 in the Mining District of Mashonaland central under special grant is attached hereto as “Annexure “A”,” wrote Prophet T Freddy in his founding affidavit.

He said his company had gone through all required processes for registration and for Environmental Impact Assessment Certificate and no objection was raised concerning the land in question which is under his name.

“Despite all this effort which Applicant did which was at the knowledge of the 1st Respondent, he never objected, now that the applicant started its operation the 1st respondent is now disrupting the operations of the mine using force and threats. The Applicant efforts to stop the 1st respondent has proved to be abortive with fears that more confrontational approach will lead to violence” reads the affidavit.

“The Likelihood that the 1st respondent would unleash terror on the Applicant’s members is not imagined one since he came with a gun, and promised to shot anyone who comes back to the mine,” said Freddy.

He said it is his belief that there is no basis upon which the Respondent conduct is premised and that left him with no choice than to approach the court for an urgent relief.

Prophet T Freddy said he treated the matter as urgent since the respondent chased away all workers threatening to kill them if they disobey his orders hence the operation of the mine has stopped.

Provincial Mining director Mashonaland East Province has been cited as the second respondent.

BREAKING: Cabinet Okays Law That Criminalises Conversations With Foreign Govts

The cabinet of Zimbabwe has approved a bill that among others criminalises conversations with foreign governments. Below was the announcement roll by information minister Monica Mutsvangwa:

According to the Constitution, the foreign policy of Zimbabwe must be based on the promotion & protection of the national interests of Zimbabwe; respect for international law; peaceful co-existence with other nations & the settlement of international disputes by peaceful means.

It was noted that the current law does not criminalise the unauthorized communication or negotiation by private citizens with foreign governments.Such communication or negotiation has a direct or indirect implication on Zimbabwe’s foreign relations and policy.

Other actions that will become punishable include planned and timed protests deliberately designed to coincide with major international, continental or regional events or visits. Unsubstantiated claims of torture and abductions will also be criminalised.

The amendments will criminalise the conduct of isolated citizens or groups who, for self-gain co-operate or connive with hostile foreign governments to inflict suffering on Zimbabwean citizens and to cause damage to national interests.

PARLIAMENT has played a critical role in unearthing corruption and white-collar crime by high profile public figures leading to some of them serving time in jail.

This was revealed by the Speaker of the National assembly, Advocate Jacob Mudenda during an interactive meeting with the media and Civic society organisations in Chinhoyi this Tuesday.

Responding to a question from a representative of a civic society organisation on the role parliament is playing in fighting corruption, Advocate Mudenda revealed that a number of high-profile cases were exposed by parliamentary committees leading to the arrest and conviction of public figures.

He singled out the NSSA report by the public service commission as well as the committee on energy whose reports revealed some corrupt activities at the Pension Fund and the energy ministry resulting in high-profile figures, including former ministers being arraigned before the courts.

“The problem with white collar crimes is that they tend to be intricate. But now some high profile public figures have been convicted. Some are serving sentence. Apart from the Auditor-General, we have some Parliamentary committees that came up with reports that reveal corruption like for example the NSSA reports the committee on public service came up with a report indicating there is something wrong in NSSA causing the conduct of a forensic audit which then came up with a report indicating the depth of corruption and the matter is in the courts now.

“The committee on energy for example also came up with recommendations that revealed some corruption in the ministry and the then minister is currently serving sentence in jail. The committee on local government revealed some corruption activities in the Midlands and the former minister of state was fingered, brought to court and is now serving sentence in jail,” he said.

A representative of the Southern African parliamentary support trust, Mr Israel Chilimanzi said the Zimbabwean parliament is open and accessible.

“There are numerous examples that show that our parliament is open and accessible. What the speaker is doing by conducting the speaker*s forum in our view is to demystify the institution. But not only demystifying it but also he is giving a practical application of the Constitution,” he said.

The Speaker of the National Assembly has been moving across the country interfacing with communities, articulating the role of parliament and how citizens should be involved in the law-making process.

King 98 Courts International Producer On New Project

The promising album is being recorded with several producers that include COG and award winning Nigerian producer Speroach.

Clearing his way for an album, the young musician will be releasing a single on November 13 with a video.

His determination of success has seen him recording sixteen songs in the past three weeks with Speroach who has left the country today (Tuesday) after days of recording with the young musician.

A fusion of local and international producers will make the album rich and good for the African market.

Already local producers have already endorsed the young musician saying he has already done enough in raising the hip hop bar.

King 98 said he will be releasing a single titled “I bet” with a video on November 13.

“I have been working, recording songs and one of the singles is already done with a video on it. I will be releasing it on November 13,” he said.

For three weeks he has been with Speroach, he said it was a great experience.

Speroach who has worked with a number of international acclaimed musicians such as Davido, echoed the same sentiments in an interview on Monday.

“King 98 is determined for success, imagine recording sixteen songs within three weeks is not easy. I am impressed by his determination,” he said.

He said working with King 98 will do best in pushing his music on the African market.

“King 98 is good I tell you, and I have told him that we should do all beats so that he penetrate on the African continent,” the producer added.

Speroach who turned 31 on Monday night got a surprise when the young musician hosted birthday celebrations for him.

“This makes me feel at home and I am falling in love with Zimbabwe. I want to thank King 98 for this gesture,” he said.

He promised to do his best in producing the young musician.

Court Throws Out Obadiah Moyo Request For Relaxation Of Bail Conditions

FORMER Health Minister Obadiah Moyo’s bid to have his bail reporting conditions scrapped flopped after a Harare magistrate dismissed his application.

Regional magistrate Mr Trynos Utahwashe dismissed Moyo’s application saying his it was among a number of similar applications made by prominent people ‘seeking preferential treatment’ from the court.

Mr Utahwashe said such applications by prominent people should be discouraged as the courts do not discriminate against accused persons who appear before them.

In his ruling, Mr Utahwashe said such applications are usually made when there are no changed circumstances in their cases.

Moyo had applied for variation of his bail reporting conditions saying they were costly and making it difficult for him to plan for business that needs time beyond two days.

He was ordered to report to police thrice a week.

State had opposed to his application saying he consented to the conditions and should have contested them when he was initially granted bail.

A Central Intelligence Organisation employee who was implicated in the Rushwaya gold heist was reportedly relieved of his duties by President Emmerson Mnangagwa.

I was shocked when my sister Gladys Hlatshwayo phoned me when I was driving from the Parliament car park rushing to go and read in preparation of my final Master of Laws degree Exams coming next week about what Khalipani Phugeni is alleged to have said about me.

I did not hear what he said about me because he is one guy I never ever listened to on all his various interviews he had in the past. What I am told is that he claimed that I have joined them. It must be on record that for many many years I never met this Khalipani Phugeni since he stopped attending MDC T meetings which I was a National Executive member as the Secretary for Recruitment and Mobilisation during the period of the late President Morgan Tsvangirai. He abruptly stopped to attend MDC meetings after the appointment of VaMudzuri and VaChamisa as Vice Presidents of the party. I coincidentally bumped into him at Holiday Inn Hotel soon after 2018 elections where he told me that he had come for the launch of POLAD. He was seated on top of his bag right on the entrance to the Hotel. I greeted him and had a few minutes chat where he told me that he is in Harare from SA for the launch of POLAD. I wonder what gave him the audacity to speak on my behalf as if I am dead. Even Fadzai Mahere has never dared speaking on my behalf on issues of my personal thinking. This man is astonishingly brave. But he must be told before hand that respect is very important. Don’t talk about other people who have never talked about you without their consent. It is not only dangerous but boarders on contempt of others.

What he must know is that I am rooted from the people. Millions from Zambezi to Limpopo, from Forbes Boarder to Victoria Falls and beyond our borders have strong belief in my fight for the emancipation of the Zimbabwean masses. Every politics must be rooted from the people. It must be people centered not personal interest. What I know is that, several approaches were made by many people from Phugeni’s side for me to go and become their President. Several times I told them I am not inspired by positions in a struggle. Relevance to a struggle is not shaped by someone’s position in the society but by the character of an individual. Positions are sources of false importance and I am a Che Guevara who just want Zimbabwe to be free from the evils of the ZANU PF regime. In addition they have got several choices and options in VaMudzuri, VaKomichi, Mama Khupe naVaMwonzora. My loyalty is to the people of Zimbabwe and my focus is on leading a revolution to liberate our country.I am a freedom fight and a revolutionary. To amplify my position, I have got few questions for Mr. Khalipani Phugeni,

Mnangagwa Fires His Top CIO Who Was Caught Up With Rushwaya At The Airport

Reports just received indicate that a Central Intelligence Organisation (CIO) operative who has been President Emmerson Mnangagwa’s security aide, Steven Tserayi, has been fired after being arrested together with Henrietta Rushwaya while trying to smuggle 6.09kgs of gold bars to Dubai.

Tserayi worked in the pool of motorcade chauffeurs for President Mnangagwa.

The value of the gold is worth an estimated US$360,000 and police confirmed the arrest.

“The ZRP confirms the arrest of Henrietta Rushwaya at RGM International Airport this afternoon after scanners at the airport checkpoint indicated that there was something in her hand luggage.

“As a result, searches revealed that the suspect had 6,09kgs of gold which had not been legally and properly cleared with Customs and relevant offices for export. This is a suspected smuggling case and police are now conducting investigations.”

According to the Criminal Investigation Department (CID), the 53-year-old who is the president of the Zimbabwe Miners Association, failed to produce documents indicating that she had been cleared by Customs to export the gold to Dubai.

Impeccable CID sources indicated that Tserayi, a CIO with links to senior government officials, was also arrested at the RGM International Airport. However, police would not officially confirm his arrest and the statement made public by the police makes no mention of his name at all.

Bosso, Zim Crackers Clash Over Proceeds From Kapini Transfer

A defunct football club, Zimbabwe Crackers, has written to Highlanders, demanding their share of the money in Tapuwa Kapini’s transfer to Platinum Stars of South Africa fourteen years ago.

Kapini joined Bosso in 2001 and part of the deal was to see the Bulawayo giants give 30% of the fee to Crackers in the player’s next transfer.

The goalkeeper’s former club tried to make the claims soon after the Platinum Stars move in 2006, but they were unsuccessful.

They have now approached Highlanders again seeking their outstanding money.

Bosso CEO Nhlanhla Dube confirmed the developments to the Chronicle, saying: “Yes, it’s true but to be honest we will not even respond to that, this is as guided by our legal department.”

The news comes at a time Highlanders have received their share in the recent European transfers of Teenage Hadebe and Marvelous Nakamba who were once in the books of the club.

Machaya Probing Kurauone’s Unlawful Arrest, Lengthy Prison Detention After RTGs$2m Lawsuit

THE Attorney-General (AG’s) Office is investigating complaints filed against President Emmerson Mnangagwa’s government and other accomplices of unlawful arrest, detention and malicious prosecution of Masvingo Urban Ward 4 Councillor Godfrey Kurauone, who recently spent more than 40 days in prison before he was acquitted of charges of obstructing free movement of traffic.

Kurauone, who serves as the National Organising Secretary for the MDC-Alliance political party’s Youth Assembly, was acquitted by Masvingo Magistrate Patience Madondo on 10 September 2020 after undergoing trial on charges of obstructing the free movement of
traffic during an anti-government protest to demonstrate against rampant corruption.

He had been arrested on 31 July 2020 by Zimbabwe Republic Police (ZRP) officers and charged with obstructing or endangering the free movement of persons or traffic as defined in Section 38(c) of the Criminal Law (Codification and Reform) Act. During his trial at Masvingo Magistrates Court, prosecutors alleged that Kurauone blocked roads by
putting stones and burnt tyres along Gaths Mine to Chirumanzu road for a stretch of 500 metres on 31 July.

Kurauone had also been charged with criminal nuisance as defined in section 46 of the Criminal Law (Codification and Reform) Act for allegedly circulating a video on WhatsApp on 20 July 2020 showing him singing a song with lyrics which authorities deemed derogatory to President Mnangagwa.

But prosecutors later withdrew the criminal nuisance charge and prosecuted him over the charge of obstruction of free movement of persons and traffic of which Magistrate Madondo acquitted him after his lawyer Martin Mureri of Zimbabwe Lawyers for Human Rights applied for discharge at the close of the prosecution case thereby ending his
much publicised prison ordeal.

In a notice of intention to sue, which was recently served on Home Affairs and Cultural Heritage Minister Kazembe Kazembe, ZRP Commissioner-General Godwin Matanga, Prosecutor-General Kumbirai Hodzi, Detective Constable Muonde, who arrested him and the Officer In Charge at Masvingo Central Police Station, Kurauone asked the respondents to take appropriate action in paying him RTGS$2.4 million as compensation for gross violation of his rights.

The Masvingo Urban Ward 4 Councillor charged that his arrest by some ZRP officers and prosecution by representatives of Hodzi was motivated by malice and improper motives.
In response to Kurauone’s lawsuit, a representative of Machaya only identified as Magunde, said the “matter is receiving attention” and promised to furnish Kurauone’s lawyers with a detailed response in “due course”.

Out of the RTGS$2.4 million that he is demanding, RTGS$500 000 is for damages for unlawful and wrongful arrest, RTGS$800 000 for unlawful and wrongful detention, RTGS$800 000 for malicious prosecution and RTGS$300 000 for legal expenses incurred while defending himself against the malicious allegations levelled against him.

Latest On Senzo Meyiwa Murder

South Africa’s minister of Police, Bheki Cele, says the information they have obtained doesn’t indicate that Senzo Meyiwa was killed in a botched robbery and the motive behind the murder of the Orlando Pirates goalkeeper might be “bigger than previously understood”.

Meyiwa was shot dead on 26 October 2014 at the home of then-girlfriend, singer and actress Kelly Khumalo in Vosloorus, Ekurhuleni. Five suspects in the case have so far been nabbed, and more arrests are expected to follow.

Speaking at the late player’s family home on Monday, Cele said, according to TimesLive: “The investigations are not really confirming that it was a robbery gone wrong, but are also not conclusive that it was a hit.

“The investigation must take us there, but we believe that the death of Senzo might have been bigger than we previously understood.

“The investigations will lead to what exactly happened. Some of the people either already arrested or still going to be arrested will tell us.”-Soccer 24

Prophet Beats Up Wife’s Boyfriend, Jailed

By A Correspondent- A self proclaimed Bindura-based apostolic prophet Forget Mahachi (33) was yesterday sentenced to a month in jail for assaulting his wife’s boyfriend with a stick.

Mahachi was sentenced on his own plea when he appeared before magistrate Samantha Dlamini. The magistrate wholly suspended the sentence on condition of good behaviour for five years.

Prosecutor Vincent Marunya told the court that Mahachi discovered through text messages that his wife was cheating on him with Chipika Chigwida (36) .

Upon being interrogated, the wife admitted to the cheating, accusing him of spending most of his time at the shrine.

Mahachi called Chigwida to resolve the matter. When Chigwida arrived, Mahachi, in a fit of rage, struck him with a stick.

Chigwida was injured and medically examined.

In mitigation, Mahachi pleaded for a lighter sentence saying his wife had since deserted him.

“Your worship, may you please give me a lighter sentence because my wife has since left our matrimonial home. I assume she has followed the complainant who is her boyfriend,” he said.-Newsday

Kundai Benyu Applies For New Passport Ahead Of Warriors, Algeria Clash

Kundai Benyu has started the process of acquiring a new Zimbabwean passport ahead of the Warriors’ back-to-back Afcon qualifiers next month.

The UK-born midfielder, who recently joined Wealdstone in England’s fifth tier league, is expected to be part of the national team squad for the assignments. He last played for Zimbabwe in 2017 in a friendly match against Namibia.

Benyu, 22, was named in the selection for the match against Malawi early this month but failed to travel to join the team because his passport had expired.

He has now started the process of applying for a new one at the Zimbabwean Embassy in London.

How To Save Lives Of “Preterm Babies”

Accurate pregnancy dating and quality care combined with the steroids are key to survival

The results of a new clinical trial, published today in the New England Journal of Medicine, show that dexamethasone—a glucocorticoid used to treat many conditions, including rheumatic problems and severe COVID-19— can boost survival of premature babies when given to pregnant women at risk of preterm birth in low-resource settings.

The WHO ACTION-I trial resolves an ongoing controversy about the efficacy of antenatal steroids for improving preterm newborn survival in low-income countries. Dexamethasone and similar drugs have long shown to be effective in saving preterm babies lives in high-income countries, where high-quality newborn care is more accessible.

This is the first time a clinical trial has proven that the drugs are also effective in low-income settings.

The impact is significant: for every 25 pregnant women treated with dexamethasone, one premature baby’s life was saved. When administered to mothers at risk of preterm birth, dexamethasone crosses the placenta and accelerates lung development, making it less likely for preterm babies to have respiratory problems at birth. 

“Dexamethasone is now a proven drug to save babies born too soon in low-income settings,” says Dr Olufemi Oladapo, head of maternal and perinatal health unit at WHO and HRP, and one of the coordinators of the study. “But it is only effective when administered by health-care providers who can make timely and accurate decisions, and provide a minimum package of high-quality care for both pregnant women and their babies.”

Globally, prematurity is the leading cause of death in children under the age of 5. Every year, an estimated 15 million babies are born too early, and 1 million die due to complications resulting from their early birth.

In low-income settings, half of the babies born at or below 32 weeks die due to a lack of feasible, cost-effective care.

The study notes, healthcare providers must have the means to select the women most likely to benefit from the drug and to correctly initiate the treatment at the right time – ideally 48 hours before giving birth to give enough time to complete steroid injections for maximal effect.

Women who are in weeks 26-34 of their pregnancy are most likely to benefit from the steroid, so healthcare providers must also have access to ultrasound to accurately date their pregnancies. In addition, babies must receive sufficiently good-quality care when they are born. 

“When a minimal package of care for newborn babies – including management of infection, feeding support, thermal care and access to a CPAP machine to support respiration – is in place in low-income countries, antenatal steroids such as dexamethasone can help to save preterm babies’ lives,” says Dr Rajiv Bahl, head of the newborn health unit at WHO and one of the study coordinators.

Conducted from December 2017–November 2019, the randomized trial recruited 2852 women and their 3070 babies from 29 secondary and tertiary level hospitals in Bangladesh, India, Kenya, Nigeria, and Pakistan.

Beyond finding a significantly lower risk of neonatal death and stillbirth, the study also found there was no increase in possible maternal bacterial infections when treating pregnant women with dexamethasone in low-resource settings.

Grandpa(75) Steals Bicycles, Barbed Wire From Neighbours…

Farai Dziva|A 75-year-old man has been arrested for stealing bicycles and barbed wire from his neighbours.

A 75-YEAR-OLD Colleen Bawn man has been fined $1 500 for stealing two bicycles from his neighbour and barbed wire from a nearby farm.

Hassan Phiri was convicted on his own plea of guilty to theft by Gwanda magistrate, Miss Lerato Nyathi.

He was ordered to have paid the $1 500 fine by October 30 or risk being jailed for two months in case of default. In addition, he was sentenced to five months imprisonment which was wholly suspended on condition that he does not commit a similar offence within the next five years.

Prosecuting, Mr Noel Mandebvu said Phiri stole two bicycles from his neighbours as well as barbed wire from Bromley Farm in Collen Bawn in May.

“On 13 May at around 9PM Mr Foster Hlongwane retired to bed and left his bicycle parked by the verandah. On the following day at around 5AM his wife got up to sweep the yard and she noticed that the bicycle was missing and informed her husband. Mr Hlongwane tried to check the footprints of the accused person but couldn’t find any,” he said.

“Later during that month Mr Hlongwane heard that the police had found some bicycles at the accused person’s homestead while they were investigating another case of theft of a bicycle. On 31 May at around 10AM Mr Hlongwane then proceeded to the accused person’s homestead with the police to identify his bicycle and he found it. The bicycle is worth US$100.”

Mr Mandebvu said under the second count on May 28 at around 8PM the complainant Mr Mbuso Moyo went to visit his relatives who live close to Phiri and left his bicycle unsecured in the yard. He said at around 10PM the complainant decided to go back to his home and discovered that his bicycle was missing from where he had left it.

Mr Mandebvu said the following day at around 6AM the complainant with the assistance of neighbourhood watch committee members and some villagers tracked the bicycle tyre marks which led to them to Phiri’s homestead where they found the missing bicycle in the accused person’s field. He said the matter was reported to the police resulting in the arrest of the accused person. The value of the stolen bicycle is R2 000.

“Sometime during the period between the year 2018 and 29 May 2020 Phiri proceeded to Bromley Farm in Colleen Bawn and stole three rolls of barbed wire which had been used to fence the farm and took it to his homestead. On 29 May at around 6AM police who were investigating a case of theft of a bicycle arrived at Phiri’s homestead and found three rolls of barbed wire.

“Police carried out investigations which later revealed that Phiri had stolen the barbed wire from Bromley Farm leading to his arrest. The value of the stolen barbed wire is R1 000,” he said.

Rushwaya was arrested yesterday after being busted by police with 6kgs of gold which she wanted to smuggle to Dubai.

In a statement today, Takavarasha said he spoke to Rushwaya who maintained that she was innocent of the crime she was facing.

“The ZMF has learnt of the arrest of its President Ms Henrietta Rushwaya and is following the case closely. As an organisation we are aware that every accused person is presumed innocent until proven guilty. We have had the privilege to hear Ms Rushwaya’s side of the story and believe in her innocence. We anticipate that Ms Rushwaya will be taken to court tomorrow for possible initial appearance as part of due process. In the interim we remain committed towards executing our mandate and vision as an organisation,” said Takavarasha.

According to the government, over USD$1O0 Million is being lost every month to gold smuggling with middle east countries being the top countries where the yellow metal is being sold on the black market.

Fake Doctor “A Danger To Society”. Denied Bail

By A Correspondent- A Harare magistrate Judith Taruvinga yesterday denied bail to a bogus doctor who served in the Parirenyatwa Group of Hospitals casualty unit for seven months before he was unmasked.

Taruvinga described Admire Chisi (25) of Zimre Park, Ruwa as a danger to society.

The court heard that Chisi allegedly illegally attended to patients and wrote medical affidavits and prescriptions until a senior doctor discovered his shenanigans.

He is being charged with impersonating a public official and fraud.

The prosecution led by Sebastian Mutizirwa had opposed bail, saying Chisi was a flight risk.

Chisi argued that the State had not previously mentioned the alleged danger.

He said he was a proper candidate for bail and was of fixed abode.

But the magistrate ruled that Chisi was a danger to society and a flight risk.

It is the State’s case that between April and Tuesday last week, Chisi went to Parirenyatwa Group of Hospitals, where he attended to patients masquerading as a medical doctor.

He was apprehended after doctor Tapiwa Nyakudya noticed that Chisi was not acting like a professional doctor and handed him to police, leading to his arrest.-Newsday

The MDC-T also recalled five Marondera town councillors, including mayor Chengetai Murova, a move that has since paralysed the local authority.

In a bid to reclaim the lost wards and constituency, the Nelson Chamisa-led party is mobilising the youths to register to vote ahead of the by-elections which were recently indefinitely suspended by government.

The ban has, however, been challenged in court and the matter is still pending.

MDC Alliance Marondera district organising secretary Misheck Manyere confirmed the development, saying they would continue to mobilise the youths as the party seeks to get more new voters.

“We are out there in full force mobilising the youths and other citizens to register to vote. As we are gearing for a by-election. It is different from the harmonised one, hence we need new voters. We are happy about the response from the youths,” he said.

The opposition party has since announced that no by-elections are to be held in all wards and constituencies affected by recalls. Matewu yesterday told NewsDay that his party’s mobilisation exercise was targeting the youths.

Meanwhile, the hunt for a candidate in Marondera Central has begun in the Zanu-PF party.

It is reported that party stalwart Lawrence Katsiru is set to bounce back and contest against educationist Cleopas Kundiona in the primary elections.

Kundiona defeated Katsiru in the 2018 primary elections, with the former subsequently losing to Matewu in the July 31 harmonised elections. NewsDay is reliably informed that a faction within the Zanu-PF party is pushing for Kundiona to go unopposed.-Newsday

Something that is installed in us from birth. A dangerous culture that we follow as Africans, particularly Zimbabweans.

Something that we have accepted, a system that is passed on from generation to generation. A life of competition.

We are taught to measure success by our position in respect to others instead of the actual results from our efforts.

I remember when i was doing my primary education, the first question back home on end of term closing day was “waita number ani?” (what class position are you?).

My parents were more concerned about my position than my subject perfomance. They would punish me if I did not make it into the top 5, even with excellent grades.

They would celebrate and reward me if I came out tops even with poor grades. I remember clearly when i brought my report book home with a 40% mark in Mathematics and he was like “Why did u fail maths?”

My answer was, “But dad i am the highest”… and that was it. He smiled and congratulated me. “Thats my boy… akunda vese.” meaning you have beaten everyone.

I failed but because i was number one, it was a success to him and to me as well.

Recently, i was talking to a friend of mine, a teacher at one of the rural schools. I asked her why they were staying away from work.

Her answer was shocking. “The government is not recognising us. They are giving police and army more than half of our salary yet we are all civil servants.”

To me, it was clear that she is fighting a good fight but for the wrong reason. She is much more worried about being given less than a soldier than being given what she deserves as a qualified teacher.

A police officer or a soldier can go in the streets and beat up anyone who goes against the government not because he is earning enough but because he is earning more than other civil servants.

Having the knowledge that he is earning more than a teacher, who is much more educated than him, at its own is a motivating factor.

He doesn’t care whether the amount is enough to make him escape from extreme poverty he is stuck in. Because he is number one, he is comfortable and will defend the government.

In the barracks he is told “If u let these people win and take over, there will be a new government and you will be earning less than these teachers.”

Those words are enough for him to kill anyone who calls for change of government. He doesn’t even realise its much better for him to earn less than everyone but being able to leave a better life with that amount. All he wants is being number one.

Politicians have mastered this pattern and use it as a weapon to divide people, while they enjoy power and loot resources meant for everyone. The earlier we realise its not about getting more than the other but about getting enough, the better.

The earlier we realise we are being used and come together as a nation irregardless of our professions, political affiliation, age, gender and origin to fight these greedy politicians, the better.

The earlier we abort the life of unnecessary competition and consider whats good for our future and future generations the better.

The quicker we realise the divide and rule system is affecting all of us, the best. Let’s all know that the same politicians we are looking forward to to solve our problems are exactly the ones who created them.

Ziyambi Ziyambi, VP Chiwenga, Mthuli Ncube Hauled To Court Over Deplorable Prison Conditions

By A Correspondent- Inhuman conditions at the country’s prisons have been exposed in a court application by human rights lobby group, the Zimbabwe Human Rights NGO Forum and a former inmate, Taurai Mbewe who are seeking to compel Treasury to release funds for the construction of more prison facilities.

The applicants cited the Commissioner-General of Zimbabwe Prisons and Correctional Service (ZPCS), Justice minister Ziyambi Ziyambi, Health minister Constantino Chiwenga as well as Finance minister Mthuli Ncube as respondents.

Mbewe was detained at Harare Remand Prison between June 15 and August 19, 2020 on charges of unlawful entry and is awaiting trial at Mbare Magistrates’ Court.

He is challenging the respondents over the inhuman conditions in prisons which he was exposed to during his detention.

In his founding affidavit, Mbewe said the section where he was detained, which is generally reserved for Class C inmates, was extremely over-crowded with between 50 and 55 inmates in place that should accommodate less than 30.

“During transportation to court from prison, and back to prison from court, the congestion in the prison trucks was always extreme. On each trip, there could be as many as 50 to 60 or more inmates in that truck, whose ventilation is poor, and whose capacity is well below those high numbers,” Mbewe and the NGO Forum said.

“These cramped conditions at prison, on the vehicles that transport us to court, in the holding cells at the courts, and in many other instances within the prison system, eliminate the opportunity for us inmates to socially distance, as per the recommendations of health experts.”

Mbewe said in respect of COVID-19 prevention, prison authorities supplied him with a face mask only and was not supplied with sanitisers.

“Medical facilities in prison are underresourced. For instance, during the time of my detention, I once asked for stomach pain medication, but was told by prison officials that I should just drink water, and I would be fine,”

Mbewe claimed many people in the cells were not in good health and constantly coughed and sneezed and many were afflicted with diarrhoea, but were not separated from the rest.

“The cells are generally dirty, and there are constant water shortages. As prisoners, we did not get bath soap from the prison, the diet was very poor. I did not feel safe at all in prison as I realised that the potential for contracting COVID-19 or other commonly known diseases was extremely high. I survived by the grace of God.”

NGO Forum executive director Musa Kika also submitted an affidavit in support of Mbewe, saying the application was particularly tied to prevailing COVID-19-related problems, threats and risks.

“This issue being clearly tied to the right to life and the right to health, among other rights and freedoms; and the question of enforcement and protection of human rights being part of the forum’s mandate, we humbly submit that first applicant is a suitable party to institute these proceedings, in representative and institutional capacities; acting in the public interest,” Kika said.-Newsday

Missing ZimParks Official Who Survived Plane Crash Found

By A Correspondent- A Zimbabwe Parks and Wildlife Management Authority (ZimParks) ecologist who was reported missing from the wreckage of a crashed light aircraft was located on Monday.

This followed the deployment of four light aircraft and helicopters, sniffer dogs and a party of 25 people by ZimParks on Saturday.

The official, whose age is unknown, set off on foot Saturday in a bid to get help after their Cessna 182 crashed on an escarpment in the Chewore area on Friday.

A South African national died in the accident while two other men – the Zimbabwean pilot and a South African wildlife expert – were critically injured and are admitted at a local hospital.

ZimParks spokesman Tinashe Farawo told ZimLive that he was yet to make contact with the search team but a member of the search party, speaking to the publication on condition of anonymity said the missing person had been found.

He said:

He was fine but very dehydrated. He most probably couldn’t have survived another night in the heat surrounded by dangerous animals.

It is not yet clear what caused the light aircraft to come down but the ZimParks official has commended the pilot for his heroics in trying to save the plane.

We understand the pilot made a heroic effort to save the aircraft. The particular area they were flying over is mountainous, and we understand the pilot battled to land the aircraft as best as he could on a gentler escarpment, possibly saving three lives.-ZimLive

Another Covid-19 Allowance For Health Workers On The Cards

By A Correspondent- Health Services Board (HSB) chair Paulinus Sikosana has said healthcare workers will get another COVID-19 allowance in addition to the standard relief allowance for all Government staff.

Sikosana told The Herald last night that only health workers considered being in the red zone, that is, those who work in the wards with people who have contracted the coronavirus will receive the additional allowance.

Everyone working in the red zone including doctors, nurses to general hands will get the additional COVID-19 allowance.

Said Sikosana:

There was an additional allowance for those in the red zone. Not all of them are in the red zone.

It is those who work in the wards with people that have been actually diagnosed with Covid-19, and it includes everyone from doctors, nurses to general hands.

For healthcare workers, there is low, medium, high risk and red zone.

The red zones are the ones in the thick of things. It is correct that the frontline workers received Covid-19 risk allowances from the Treasury last week but so far, the allowance was received by those in the red zone.

Meanwhile, Vice President and Health and Childcare Minister Constantino Chiwenga criticised nurses for leaving their patients to die as a strategy to force the government to increase their salaries.

Without taking away the freedoms enshrined in our Constitution, surely can we allow the ministry to maintain registers of health professionals who frequently abandon their patients?

Police Details Resort To Face Masks Extortion

By A Correspondent- Zimbabwe Republic Police (ZRP) officers deployed in the Harare Gardens are reportedly extorting money from citizens for allegedly not wearing face masks properly.

National Police Spokesperson Assistant Commissioner Paul Nyathi said a team has been dispatched to Harare Gardens to investigate the matter but said he suspected the victims were swindled by fake cops.

The victim further told The Mirror that she was supposedly arrested for violating coronavirus regulations, something which she claimed the police officers were also guilty of.

She said:

I am so disgusted and shocked by the rogue behaviour of the Police that I am ready to identify the culprits if a professional parade is to be put together…

Those cops were so rude and menacing you don’t understand why they are so angry. A female cop said her speciality in the force is to torture and beat up suspects.

A Zimbabwe Central Intelligence Organisation (CIO) operative who is President Emmerson Mnangagwa’s security aide, Steven Tserayi, has also been arrested together with former ZIFA chief executive Henrietta Rushwaya for trying to smuggle 6.09kgs of gold bars to Dubai.

The value of the gold is worth an estimated US$360,000 and Tserayi works in the pool of motorcade chauffeurs for President Mnangagwa.

This comes as it emerges that Rushwaya, who was arrested yesterday the Robert Gabriel Mugabe International Airport in Harare, is related to President Emmerson Mnangagwa, drawing special interest to how her case is going to be handled.

In a tweet, police confirmed the arrest saying Rushwaya is expected to appear in court on Tuesday facing charges of violating some Customs regulations.

“The ZRP confirms the arrest of Henrietta Rushwaya at RGM International Airport this afternoon after scanners at the airport checkpoint indicated that there was something in her hand luggage.

“As a result, searches revealed that the suspect had 6,09kgs of gold which had not been legally and properly cleared with Customs and relevant offices for export. This is a suspected smuggling case and police are now conducting investigations.”

According to the Criminal Investigation Department (CID), the 53-year-old who is the president of the Zimbabwe Miners Association, failed to produce documents indicating that she had been cleared by Customs to export the gold to Dubai.

Her arrest has drawn considerable interest as she is a relative of the President, who has publicly vowed to fight corruption without fear or favour.

In a charge sheet, the CID claimed that Rushwaya indicated that she obtained the gold from a person only identified as Ali.

“The accused was questioned about the origin of the gold and she indicated that she obtained it from one only identified as Ali of number 32 Lanark Road, Alexandra Park, Harare. She indicated that Ali is a licenced gold buyer using the name Ali Japan 786 Private Limited. She alleged that she had been instructed by Ali to leave the gold to an unidentified person at Dubai Airport.”

However, Ali Japan78 is an automobile company and has no known history of involvement in gold trade.

It has also emerged that Rushwaya’s organisation, the Zimbabwe Miners Federation, signed three strategic partnerships with CBZ Bank, Ali Japan786 and the Central Mechanical and Engineering Department a few weeks ago.

Impeccable CID sources told the Zimbabwe Voice that Tserayi, a CIO with links to senior government officials, was also arrested at the RGM International Airport. However, police would not officially confirm his arrest and the statement made public by the police makes no mention of his name at all.

President Mnangagwa is related to the Rushwaya family. This became public a few months ago when Gogo Mary Rushwaya, mother to Defence Secretary Martin Rushwaya, died at the Avenues Clinic in Harare.

President Mnangagwa was accompanied by his two Vice Presidents — Constantino Chiwenga and Kembo Mohadi — Chief Secretary to the President and Cabinet Dr Misheck Sibanda, service chiefs and other high-ranking Government officials to pay his condolences.

At the same funeral, Henrietta Rushwaya paid tribute to Gogo Rushwaya who she said was her aunt, adding that the granny was a woman of valour and a pillar of strength in the family, according to the State-owned Herald.

Reports indicated that Gogo Rushwaya was sister to President Mnangagwa. She received a top drawer memorial service at One Commando Barracks, a rare feat for a mere civilian.

Rushwaya’s ZMF Signed Gold Funding Deal With Ali Japan 786 On Friday

THE Zimbabwe Miners Federation (ZMF) on Friday signed three strategic partnerships, which are aimed at capacitating small-scale miners in their quest to ramp up production and feed into the US$12 billion mining economy by 2023.

The partnership deals saw the small-scale miners’ body signing a deal with the country’s largest bank by assets, the Commercial Bank of Zimbabwe (CBZ), Ali Japan786 — a company that is in the automobile industry and the Central Mechanical and Engineering Department (CMED).

CBZ are coming on board as a banking partner and have committed to cover the funding gap that has for long dogged the small scale mining sector.

The Ali Japan786 deal will see small-scale miners getting access to motor vehicles and mobile mining machinery on flexible payment terms.

The signing of the deal immediately saw the Japanese investor committing to ship in at least 200 vehicles for distribution to the small-scale miners and these will be delivered before the end of this year.

With power challenges identified as one of the biggest setbacks bedevilling the sector, CMED are coming on board as a partner in the provision of fuel on flexible terms that will ensure miners can get on with production with minimum disruptions.

Mines and Mining Development Minister Winston Chitando, who is also ZMF patron, graced the signing ceremony last Friday. He said the deals were a step in the right direction towards addressing some of the biggest challenges threatening the viability of small-scale mining.

The Government’s wish, said Minister Chitando, is to grow their operations to a stage where they can be viewed in the same breath as large scale miners.

“I also wish to recognise the importance of the event we are having,” said Minister Chitando.

“One could be tempted not to realise the importance of this event. One of the key inputs, which have constrained the development of the small scale miners is funding structures for equipment and for working capital.

“And the very important initiative, which has been done today between ZMF and the three partners we say well-done.

“It is very important that our mining industry facilitates the growth of small scale miners by size and also for them to graduate from ZMF and join the Chamber of Mines of Zimbabwe when they are now large scale miners.

“With initiatives like what we have today it’s the beginning of a process of that happening and I know it’s a dream, which the president of the federation has,” he said.

Minister Chitando also challenged the ZMF president, Ms Henrietta Rushwaya, and her executive to continue striving to establish partnerships that help to capacitate the small scale miner.

He also announced that Government will soon unveil other initiatives, in consultation with ZMF, which are meant to capacitate small scale miners.

Speaking at the signing ceremony, Ali Japan786 representative Mr Ali Mohammed said his company sees a lot of potential in the small scale mining sector and is coming in to play a part in the realisation of that potential.

“These are people with a big role in the development of the Zimbabwean economy as highlighted by Minister Chitando,” said Mr Ali.

“So, we are coming in as a company to make sure that we support them with logistics in the operation of their businesses. For a start we will be bringing in a total of 200 vehicles before the end of this year, which we will avail to the miners.

“We will be advancing the vehicles on very flexible terms where people can pay in three to six months,” he said.

Rushwaya Freely Walks Home After Police Arrest.

By Jane Mlambo| Small scale miners association boss, Henrietta Rushwaya was yesterday arrested while attempting to smuggle gold to United Arab Emirates, a leaked police memo has revealed.

According to the document, detectives from CID Minerals Flora and Fauna Unit (MFFU) Harare Airport received information this morning that Rushwaya intended to smuggle gold to Dubai through the Airport.

The detectives identified her as she commenced check in processes and immigration formalities and immediately alerted the Civil Aviation Authority of Zimbabwe (CAAZ) scanner operators to thoroughly examine her bag.

“Gold was detected by the scanner in the accused’s bag which formed part of her hand luggage. The bag was searched in the presence of the accused by CID MFFU detectives whilst other stakeholders at the Airport witnessed the search. A total of approximately 6kg of gold whose value is yet to be determined was recovered stashed in the accused’s personal luggage in her bag” reads the memo.

Further questioning made her reveal the origins of the gold where she indicated that she obtained it from one only identified as Ali of number 32 Lanark Road, Alexandra Park, Harare.

“She indicated that Ali is a licenced gold buyer using the name Ali Japan 786 Private Limited. She alleged that she had been instructed by Ali to leave the gold to an unidentified person at Dubai Airport.”

Rushwaya failed to supply export documents in respect of the gold leading to her arrest.

“The recovered gold will be taken for assay to determine quantity and value. It will be lodged at Fidelity Printers and Refiners for safekeeping.”

OPINION ANALYSIS – How former ZIFA President Henrietta Rushwaya was caught with gold worth USD300K in her handbag.

Henrietta Rushwaya has gold mines in Midlands, and she is also in the business of buying gold. The 6kg of gold was hers and Mnangagwa’s son’s. This is one of Mnangagwa’s sons from his first wife (Josiah Tongogara’s sister).

She had a disagreement after she demanded a share of profits. They did not agree.

By now the gold is now in the hands of Mnangagwa’s sons.

The person who was a link based in Dubai is an Indian who had linked her with a buyer in the UAE.

There was no way for her to carry 6kg of gold in her handbag.

Cornered ED Recruits 5k More Teachers

By A Correspondent- Primary and Secondary Education Minister Cain Mathema said that Government has recruited over 5 000 teachers this month and plans to recruit more.

Mathema added that Government was working on hiring every qualified teacher in Zimbabwe – approximately 20 000 – as part of measures to ensure social distancing in schools.

He said:

The Government has just recruited 5 000 teachers in a drive to employ the over 20 000 unemployed qualified teachers that we had by last November.

I don’t have a breakdown of how many teachers were allocated to each province during the last recruitment but the process has been completed and we are working towards hiring more.

Mathema said Zimbabwe needs more than 3 000 additional schools to cater for the growing number of learners at both primary and secondary levels.

This naturally entails that once the schools are constructed, more teachers will be needed.

All 107 People Involved In Zim – Pakistan Cricket Match Test Negative For Coronavirus

A total of 107 Covid-19 tests, conducted on the players and player support personnel of Zimbabwe and Pakistan sides as well as the match officials, have returned negative.

The tests were conducted on Monday as part of the PCB’s Covid-19 Protocols following the assembling of the two sides in Islamabad.

All 107 participants have now entered the bio-secure bubble in a five-star luxury hotel and are now allowed to interact with each other and move freely within the bio-secure bubble.

The two sides will train at the Pindi Cricket Stadium today from 1pm.

The three-match series, which is part of the ICC Men’s Cricket World Super League, commences on Friday.

Gumbura To Appear In Court In Fresh Freedom Bid

INCARCERATED RMG End Time Message church leader Robert Gumbura, who is serving a 20-year effective jail term for sexually assaulting his female congregants, has approached the High Court seeking bail pending leave to appeal his sentence at the Supreme Court.

Gumbura was initially slapped with a 40-year effective jail term by regional magistrate Hosea Mujaya, but the sentence was this year slashed to five years by the High Court on appeal.

But Gumbura, who is no longer represented by a lawyer, last Thursday filed an application for bail pending leave to appeal the reduced sentence at the Supreme Court on the basis that the High Court misdirected itself when it considered reducing his jail term instead of acquitting him.

National Prosecuting Authority (NPA) representative Editor Mavuto opposed the cleric’s move and challenged him to avail the court record.

Mavuto said Gumbura should show the presiding judge where the court allegedly misdirected itself when it reduced his sentence.

“The most important factor in considering the present application is whether or not there are prospects of success on appeal against conviction. In other words, the applicant (Gumbura) is obliged to point in the judgment by the appeal court where exactly the misdirection is. Thus, there is a need for the applicant to attach the record of proceedings together with the judgment of the High Court so that this honourable court can be put into the right picture on the alleged misdirection,” he said.

“Without the complete record of proceedings and judgment of the appeal court, it is submitted that the application is incomplete. It is impossible for this court to access the prospects of success on appeal without the above-mentioned material documents.”

Gumbura is today expected to appear again before Justice Moses Foroma for the determination of his application for freedom.

Rushwaya’s Case Will Just Fizzle Away – Opinion

University of Kent law lecturer Alex Magaisa believes Zimbabwe Miners Federation (ZMF) president Henrieta Rushwaya, who was arrested on Monday, will be out on bail soon and her case will eventually die a natural death.

Rushwaya was arrested at Robert Gabriel Mugabe International Airport where she was found with 6kg of gold destined for Dubai.

As a politically exposed person (PEP), the prosecution will set up the Rushwaya matter to fail, like the Delish Nguwaya affair, Magaisa observed. Below is Magaisa’s full thread on Twitter:

Reading the comments regarding the arrest of Henrietta Rushwaya for attempting to smuggle gold, most people do not believe she will be held accountable. That’s how low the justice system ranks in the public estimation because it bends towards PEPs and political elites.

Gold is one of the country’s biggest forex earners. A person smuggling gold out of the country is sabotaging the nation.

If Henrietta Rushwaya has been connected to the MDC Alliance, state media would be having a field day. But she’s one of their own, looting in broad daylight.

Just a few days ago, Rushwaya was with the Minister of Mines, Winston Chitando where big deals were announced.

Also present at the ceremony was that Ali Mohammed of Ali Japan786, the chap who Rushwaya is implicating as her principal in the gold smuggling. The Herald covered it.

If Rushwaya’s confession is correct, this means Minister Chitando was dealing with a criminal element.

Do the intelligence guys ever do any due diligence or they just focus on going after government critics? Remember the Drax affair and that dodgy Albanian chap?

It looks like criminals masquerading as investors see Zimbabwe as a haven for their heists.

And how many more Zimbabweans out there are acting as couriers, like Rushwaya? She was probably bleating about sanctions yesterday. But they are the ones looting in broad daylight.

She will probably be bailed shortly. And after a few remand hearings, the matter will die quietly. It will be set up to fail, like the Nguwaya affair.

There will be technicalities that will be exploited and that will be it. It all depends on who her political godfather is.

South Africa Covid-19 Deaths Surge Over 19 000

JOHANNESBURG – Health officials are warning of a second wave of COVID-19 infections in the country.

Last week, Health Minister Zweli Mkhize said he was concerned about a nine percent increase in novel coronavirus cases over a seven-day period countrywide.

The health department reported 891 new COVID-19 cases in South Africa in the last 24 hours.

This brings the total number of cases to 716,759.

There have been 40 additional COVID-19 deaths recorded, 10 of these occurred in the past 48 hours.

South Africa’s COVID-19 death toll has increased to 19,008.

Recoveries currently stand at 646,721, which translates to a 90% recovery rate.

Govt Goes Ahead With Massive Teachers Recruitment

GOVERNMENT has recruited 5 300 teachers in a drive that will result in about 20 000 unemployed but qualified teachers being hired as part of measures to ensure social distancing in schools.

Primary and Secondary Education Minister Ambassador Cain Mathema said Government was working on hiring every qualified teacher in Zimbabwe, a project which will be done in consultation with the Ministries of Finance and Economic Development and that of Public Service, Labour and Social Welfare.

This comes at a time when schools reopened yesterday for the second phase that saw Grade Six, Form Three and Form Five classes returning to school.

Schools closed prematurely towards the end of the First Term in March as part of measures to curb the spread of the Covid-19 pandemic.

Government resolved to reopen schools in three phases to allow room to monitor challenges that may arise.

The examination classes reopened on September 28 while the last batch will reopen on November 9.

The Ministry recently came up with Standard Operation Procedures (SOP) to guide the safe reopening of schools as learning institutions adopt a new normal in view of the global pandemic.

The measures include reducing class sizes to a maximum of 35 pupils to decongest classrooms in adherence to social distancing requirements.

In an interview, Minister Mathema confirmed the recruitment of more than 5 000 teachers this month and plans to recruit more.

I don’t have a breakdown of how many teachers were allocated to each province during the last recruitment but the process has been completed and we are working towards hiring more,” said Minister Mathema.

He said the outbreak of the global pandemic which has claimed 227 lives in Zimbabwe had necessitated the recruitment of more teachers.

“Covid-19 has also encouraged us to hire more teachers, it has necessitated us or forced us to increase the number of teachers because of social distancing. It is our wish that we employ every qualified teacher and procedure states that this has to be done in consultation with the Ministry of Public Service and Ministry of Finance,” added Minister Mathema.

“The establishment that we have requires more teachers but it is dependent on the availability of funds but as a ministry we are ready to employ all the teachers that are trained. In any case we still need 3 000 new schools in Zimbabwe and that will require more teachers than what we have.”

According to Minister Mathema, in rural areas, 500 families should have their own primary and secondary school, a requirement which has not yet been met.

“Zimbabwe needs more than 3 000 additional schools to cater for the growing number of learners in both primary and secondary schools. We need to work together with councils, churches and other private players so that we construct these schools,” added Minister Mathema.

He said Government was still negotiating with disgruntled teachers who are on strike.

“We are still engaging them in negotiations and hope that soon we will reach a compromise and they return to work.”

Judicial Services Commission Defends Magistrate Bianca Makwande Against Joana Mamombe Onslaught For Improper Imprisonment

The Judicial Service Commission (JSC) has moved in to protect provincial magistrate Bianca Makwande from being sued in her personal capacity, in a matter where she committed Harare West MP Joanah Mamombe to remand prison for mental examination by two government medical doctors.

Mamombe, who is out of custody on charges of publishing or communicating false statements prejudicial to the State or alternatively defeating or obstructing the course of justice, was last month sent to remand prison after being forcibly removed from a private hospital where she was being treated for mental disorder.

According to court papers, Mamombe was supposed to stand trial on September 15, 2020 but failed to attend court as she was being treated at a local hospital.

The State then went on to invoke the provisions of section 26 of the Mental Health Act to force Mamombe to be examined by two medical practitioners while in prison, a decision that has since been overturned by the High Court.

Following her incarceration, Mamombe filed for review at the High Court and in her draft order sought to sue Makwande for the costs of suit, prompting JSC secretary Walter Chikwanha to intervene.

High Court judge Justice Esther Muremba condemned Mamombe’s incarceration saying the magistrate’s decision was not warranted.

“…In the circumstances of this case, the applicant (Joanah Mamombe) was already out of custody on bail which she had been granted by this court. Nothing shows that she had breached her bail conditions. It is not disputed that when a warrant of arrest was issued against her for failing to appear in court on September 15, 2020, she was in hospital.

“The police arrested her from there and took her to court. In the circumstances it cannot be said that she was in a wilful default when she did not attend court. Nothing, therefore, warranted her placement in custody for the purposes of her mental examination,” Justice Muremba ruled.

The application by JSC is yet to be set down for hearing.

Businessman Delish Nguwaya has denied allegations made by Norton MP Themba Mliswa that he facilitated the release of property developer Felix Munyaradzi who was detained in Remand Prison over a land scam.

Mliswa, Nguwaya said wrote to the Prosecutor General accusing him of visiting Munyaradzi together with Special Anti-Corruption Unit official Tabani Mpofu.

“Honourable Temba Mliswa has been on a whirlwind of attacks against my person on several media platforms. He has called me various names including that I am a criminal and that I control state organs”, Nguwaya said in a statement.

“Mr Mliswa has done this without any shred of evidence to support such unfounded allegations. The following is my position as regards his unlawful denigrations and attacks on my person.

“I am not capable of releasing accused persons who are under the lawful custody of the Zimbabwe Prisons and Correctional Services as I am neither a bail court nor a Prison Warden. I cannot possibly promise to do that which I am not capable of.

Munyaradzi was freed in August on $55 000 bail and other stringent conditions after the High Court found no compelling reasons to keep him in custody pending trial on charges of selling State land and unserviced stands-
