By Court Correspondent | ZimEye | HARARE, ZIMBABWE – In a ruling that has sparked debate over judicial logic and empathy, the Harare Magistrates Court has dismissed an application by Marry Mubaiwa, the estranged wife of Vice President Constantino Chiwenga, for a permanent stay of prosecution on medical grounds. Marry Mubaiwa, who faces charges including attempted murder, has been critically ill, with her health significantly deteriorating to the point of losing her right hand and left leg to lymphodema.

Her lawyer, Beatrice Mtetwa, expressed her bewilderment at the court’s decision, stating, “It’s logic that I simply cannot understand.” The magistrate’s ruling pointed to Mubaiwa herself as the cause of the trial’s delay due to her health issues, a stance that has raised eyebrows and concerns among legal observers and human rights advocates.

“The magistrate ruled that she cannot revisit delays before the trial. She says Marry is responsible for the delay because she is the one who was sick and was being remanded in hospital,” Mtetwa elaborated during a press conference following the ruling. Despite the acknowledgment of Mubaiwa’s illness in the ruling, the magistrate did not address whether Mubaiwa’s health condition and subsequent hospital stays prejudiced her case or if continuing the trial would serve the interests of justice.

Mtetwa argued that the section of the law being invoked requires the court to assess whether there has been a delay, if the accused has been prejudiced by such delay, and whether proceeding with the trial would affect the administration of justice. “She has accepted that there was a delay, so for her to then rule that that delay was caused by her when she was sick doesn’t make sense,” Mtetwa critiqued the magistrate’s logic.

This decision comes at a time when Mubaiwa’s health has been a focal point in the media, with reports consistently highlighting her severe health challenges. Critics argue that the court’s decision might overlook fundamental principles of justice concerning the health of the accused and the fairness of the trial process.

The case has not only legal implications but also casts a spotlight on the intersection of health, politics, and justice in Zimbabwe. Marry Mubaiwa’s situation has drawn attention to how the legal system handles cases involving high-profile figures, especially when health issues are a significant factor.

The ruling has left many questioning the balance between legal proceedings and humanitarian considerations. As this story develops, it continues to raise important questions about the administration of justice in Zimbabwe, particularly when it involves individuals whose health conditions severely impact their ability to participate in legal proceedings.

By A Correspondent| Former employees of the Zimbabwe United Passenger Company (ZUPCO) are decrying the company’s failure to settle outstanding salaries, with some arrears dating back to July 2023. The ex-workers allege they have been paid only in local currency, the Zimbabwe Gold (ZiG), instead of the US dollars stipulated in their contracts.

One former employee disclosed that the last US dollar payment was received in June 2023. “I left the company in May this year, and since then, they have failed to clear my arrears,” said the worker.

Another worker expressed frustration over the lack of communication from ZUPCO management. “We’ve formed a group of former workers and plan to engage lawyers to recover our outstanding salaries,” they revealed, adding that the company’s silence on the matter has worsened the situation.

For some, the experience has been emotionally draining. A former employee from Bulawayo recounted being sent from office to office while seeking clarity on her unpaid wages. “Whenever I approach the managers, they treat me with disrespect and claim that the finance personnel are unavailable,” she said. “We haven’t even received an apology or any updates. This is beyond frustrating—we are suffering.”

ZUPCO’s inability to honor its financial obligations comes amid allegations of widespread corruption and financial mismanagement within the company. Earlier this year, accusations surfaced suggesting that senior officials had manipulated reports to hide the company’s financial troubles. Reports also indicate potential retrenchments to pre-empt an impending audit and conceal irregularities.

Former workers allege that resources, including diesel and funds reportedly provided by ZANU-PF for election campaigns last year, were siphoned off for personal gain by senior officials. Meanwhile, ZUPCO’s once-dominant role in public transport has been undermined by its financial instability, leading to its placement under the Mutapa Investment Fund in a government-led effort to salvage the enterprise.

As unpaid salaries continue to mount, many former employees face significant financial hardships. With no resolution in sight, they are now turning to legal avenues to recover their dues. “We’ve been left with no choice but to fight for our rights through the courts,” one worker said.

ZUPCO management has remained tight-lipped on the issue. Kelvin depot manager Melody Dege declined to comment, stating, “I cannot comment on the issue of the unpaid salaries over the phone.”

The plight of ZUPCO’s former employees highlights the urgent need for transparency and accountability in the company’s financial management as it struggles to meet its obligations and rebuild its credibility.

The Elections Resource Centre (ERC) has raised significant concerns over proposed changes to Zimbabwe’s Constitution and Electoral Act aimed at introducing automatic voter registration for 18-year-olds ahead of the 2028 elections.

The amendments, championed by Justice and Parliamentary Affairs Minister Ziyambi Ziyambi, seek to shift voter registration responsibilities from the Zimbabwe Electoral Commission (ZEC) to the Civil Registry Department (CRD). ERC argues that this move poses serious privacy and constitutional issues.

The proposed changes aim to tackle low voter registration rates and simplify the registration process. However, ERC, a leading election watchdog, warns that using personal data without consent infringes on privacy rights. Under the current system, individuals voluntarily register and consent to providing personal and biometric data. The new amendments, according to ERC, would circumvent this process.

ERC highlighted that the proposals violate Section 10 of the Cyber and Data Protection Act, which requires explicit consent for processing personal information. “The current proposals seem to bypass the consent requirement, raising privacy concerns around the use of personal data,” ERC noted.

The organization further argued that transferring voter registration entirely to the CRD could jeopardize ZEC’s independence, a cornerstone of Zimbabwe’s electoral integrity. ERC emphasized the importance of collaboration between ZEC and the CRD but maintained that the electoral body should retain oversight of voter registration. “The government should support collaboration between ZEC and the CRD through practice or policy changes that enable coordination without stripping ZEC of its mandate,” ERC stated.

In its recommendations, ERC urged the government to allocate adequate resources to ZEC for periodic voter registration campaigns, especially in low-registration areas. The organization also called for partnerships between ZEC and civil society organizations to enhance voter registration, citing the success of such collaborations during the 2018 mass registration drive.

ERC also emphasized the need for extensive public consultations on the proposed amendments. It called for a clear roadmap for the 2028 elections, including timelines for public engagement and a multi-stakeholder platform to ensure inclusive reforms.

As Zimbabwe moves toward the 2028 elections, ERC’s concerns underscore the need to balance streamlined voter registration with the protection of citizens’ privacy and the independence of electoral processes. The proposed amendments are expected to spark heated debate in the coming months.

In a dramatic turn of events, a Ford Ranger Twin Cab hijacked at gunpoint in Bulawayo has been recovered in Gwanda less than 24 hours after the incident. Police confirmed the recovery as investigations continue into the daring hijacking that left the victim unharmed but shaken.

The incident occurred on Wednesday night at Chigumira Shopping Centre in Luveve, Bulawayo. According to Bulawayo police deputy spokesperson Assistant Inspector Nomalanga Msebele, the carjacking took place at approximately 9 PM when Mr. Jabulani Sibanda returned to his parked vehicle after shopping at Advance Supermarket.

“Two of the suspects were armed with pistols, while the third was unarmed. The armed suspects forced the complainant out of the car, and then fled with the vehicle,” Asst Insp Msebele explained.

The white Ford Ranger Twin Cab (Wild Track), valued at over US$40,000 and bearing registration AFN 6255, was taken along with groceries worth US$5, a Techno Canon 11 cellphone, a Nokia cellphone, and approximately 35 litres of diesel.

The vehicle’s owner, Ms. Sithembile Mkwite, confirmed its recovery in Gwanda, stating, “Yes, the car has been recovered. We travelled to Gwanda today, but police are still conducting forensic investigations.”

A Race Against Time

The swift recovery underscores the urgency with which police responded to the case. Fingerprints and other evidence are currently under analysis, as authorities piece together the movements of the suspects.

This incident follows closely on the heels of another car theft in Bulawayo, where a Toyota Fortuner, valued at US$22,000, was stolen from a car wash. The Fortuner, bearing South African registration plates, remains missing.

A Community on Edge

The recent spate of car thefts has sent ripples of anxiety through Bulawayo’s residents, particularly as the holiday season approaches—a time when criminal activity typically spikes.

Law enforcement has urged the public to remain vigilant, especially in high-risk areas like shopping centers and car washes. “We are committed to bringing these criminals to justice and ensuring the safety of our communities,” said Asst Insp Msebele.

As the investigation deepens, the recovered Ford Ranger stands as both a victory for law enforcement and a chilling reminder of the dangers that lurk in the night. For now, its journey has ended where the sands of Gwanda whispered its return.

The SADC Extraordinary Summit has concluded at the Parliament Building in Mt Hampden.

In his address reading the summit’s communique, SADC Executive Secretary H.E. Mr. Elias Magosi announced that the summit had decided to extend the mandate of the SADC Mission in the DRC (SAMIDRC) for another year. This extension aims to support efforts toward restoring peace in the volatile eastern DRC.

The summit praised the Democratic Republic of Congo for its ongoing efforts to end the conflict, urging all parties to honor ceasefire agreements and peace initiatives in line with the Luanda Agreement, which the region is championing.

In addition, the summit discussed the security situation in Mozambique, with an update provided by President Filipe Nyusi on the progress there.

In his closing remarks, SADC Chairperson President Emmerson Mnangagwa commended the peacekeeping forces in the DRC. He emphasized that the extension of SAMIDRC operations reflects the regional bloc’s dedication to ensuring peace and stability in the country.

Mnangagwa further urged member states to uphold a shared commitment to peace and unity within the region, asserting that through continued dialogue, SADC would achieve its set objectives and bring lasting peace to the region.

In a dramatic turn of events, Chief Clayton Zimunya has decisively removed maverick Headman Chengetai Chigodora from his traditional leadership role, citing an extensive list of misconduct allegations and the expiry of his two-year acting tenure.

Chief Zimunya, speaking on Tuesday, confirmed the dismissal and emphasized that the decision was necessary to restore order and credibility to the traditional leadership system. “Despite the expiry of his tenure, an avalanche of complaints from hundreds of subjects whose cases he was handling, despite them being above his jurisdiction, led to his immediate dismissal,” the Chief explained.

Misconduct and Breaches of Authority
The embattled headman is accused of multiple transgressions, including coercing community members to consult specific traditional healers against their beliefs. Reports allege that Mr. Chigodora collaborated with healers to extort significant sums of money from vulnerable community members, with some victims claiming losses of thousands of dollars in foreign currency.

Chief Zimunya expressed outrage over these allegations, stating, “We recognize freedom of worship in this country, but Mr. Chigodora disregarded that right. People complained that he had syndicates of traditional healers he was working with to fleece them of huge amounts of money. Their voices were not being heard, rendering them powerless due to fear of victimization.”

One of the most shocking accusations came from Mr. Shepherd Rusanga, who claimed that his family was coerced into raising a staggering US$9,000 to appease an avenging spirit—an action that not only violates the Traditional Leaders Act but also traditional norms.

Social Media Scandal
Adding fuel to the fire, Mr. Chigodora reportedly broadcast proceedings from his court on his YouTube channel, a move Chief Zimunya described as highly inappropriate for a traditional leader. “I told him to choose between being a traditional leader and a social media influencer,” Chief Zimunya said. “His actions undermined the impartiality of his court and brought our customs into disrepute.”

Despite repeated warnings, Mr. Chigodora allegedly ignored directives to cease his online activities, prompting further erosion of trust in his leadership.

Wider Leadership Shake-Up
Mr. Chigodora is not the only headman affected by Chief Zimunya’s crackdown. Four of the Chief’s five headmen, including Chigodora, Nyamana, Munyoro, and Chitiyo, have been stripped of their roles due to expired acting tenures and failure to adhere to the stipulated two-year limit. Only Headman Nyakunu remains substantive.

Chief Zimunya has repossessed traditional paraphernalia, including knobkerries, badges, and stamps, from the dismissed headmen. He announced that all unresolved cases, particularly those involving witchcraft and avenging spirits, would now be handled directly by his court.

Denial and Defiance
In a telephone interview on Wednesday, Mr. Chigodora denied being relieved of his duties, claiming ignorance of the developments. He dismissed the allegations as rumors aimed at tarnishing his reputation, accusing the media of bias.

“I do not know what you are talking about. My court is not sitting because we are in November. Our tradition and customs regard it as taboo to conduct court sessions in November. However, my court will resume in December,” he said defiantly.

Despite his denials, the allegations against Mr. Chigodora have raised serious questions about accountability and governance within the traditional leadership system.

Calls for Reform
Senator Chief Mutasa weighed in on the controversy, emphasizing the importance of upholding the law and traditions. “If a headman behaves this way, they must be reprimanded. Operating outside the law undermines our traditions and constitutes fraud,” he said.

As the dust settles on Mr. Chigodora’s dismissal, the spotlight turns to the selection of new, substantive leaders who can restore the integrity and trust of the community. For Mr. Chigodora, however, the end of the road seems certain.- state media -agencies

Retired army general Engelbert Rugeje has come under fire from loyalists within the 2030 Mnangagwa Anenge Achipo faction, according to sources.

The attack took place during a recent Provincial Coordinating Committee (PCC) meeting in Masvingo.

Political strategist Chabata Lawrence, who closely follows ZANU PF’s internal dynamics, strongly condemned the verbal assault on Rugeje.

“The disgraceful attack on Politburo member Lt. Gen. Engelbert Rugeje at the Masvingo PCC meeting marks a new low in the party’s internal politics,” Lawrence said.

“It is both shocking and troubling that a lower-level party organ would feel emboldened enough to manufacture baseless accusations against a distinguished military figure and respected party veteran.”

The Minister of Finance and Investment Promotion, Mthuli Ncube, is set to present Zimbabwe’s 2025 National Budget to Parliament next week.

According to Ncube, the total funding requests for the 2025 budget have surpassed ZiG$700 billion, well above the ZiG$140 billion ceiling outlined in the second budget call circular. This represents a fivefold increase and exceeds 18% of the country’s GDP.

During the budget consultation process, Ncube revealed that a review of these bids would be conducted, taking into account the current economic conditions ahead of the budget presentation later this month.

“The total bids for the 2025 National Budget are over ZiG$700 billion, far exceeding the budget ceiling of ZiG$140 billion set in the second budget call circular. This is five times the ceiling, which was pegged at 18% of GDP,” Ncube said.

He explained that the second budget call circular was issued prior to the depreciation of the domestic currency, and as such, the fiscal framework will be updated to reflect the new economic realities, allowing for an upward revision of the budget ceiling.

Ncube also emphasized that the 2025 budget aims to strengthen the economy in the face of both domestic and international challenges.

Despite a downward revision in Zimbabwe’s 2024 economic growth forecast—now expected to be 2% instead of the earlier projection of 3.5% due to severe drought—the Treasury is forecasting a robust recovery in 2025, with GDP growth projected at 6%, largely driven by improvements in the agricultural sector.

It is my profound honour to address thisinaugural International Conference on Sanctions, Business and Human Rights. I wish to express Zimbabwe’s gratitude to the Special Rapporteur on the negative impact of unilateral coercive measures on the enjoyment of human rights, Professor Alena Douhan and the Group of Friends in Defence of the Charter of the United Nations for organizing this important and timely meeting to exchange views on an issue of serious concern to our countries.

I wish from the outset to thank the Special Rapporteur for her sterling efforts in creating awareness on the negative and        far-reaching impact of unilateral coercive measures on the generality of the populations in the targeted countries. Zimbabwe welcomes her extensive research on the widespread use of sanctions, including secondary sanctions and over-compliance. Let me assure you, Madame Special Rapporteur, of my country’sfull support for your continued work towards identifying and proposing concrete measuresagainst the use of these injurious UCMs andyour strong advocacy for their removal. 

Your Excellencies,

For more than two decades, Zimbabwe has been subjected to unilateral sanctions imposed by the United States of America and the European Union. In 2019, the United Kingdom of Great Britain and Northern Ireland imposed its own regime of sanctions against my country when it adopted the Zimbabwe (Sanctions) (EU Exit) Regulations. All these measures, mischievously packagedas targeted and isolated, have in reality been sweeping, indiscriminate and detrimental to the livelihoods of all Zimbabweans.  

Zimbabwe’s justified, historically corrective and irreversible Land Reform Programmeprompted the United States of America (USA) to impose illegal and unjustified sanctions under the Zimbabwe Democracy and Economic Recovery Act (ZIDERA) of 2001, which was amended to further tighten its provisions and is extended annually. In it, the US Government, inter alia, “instructs the US Executive Director to each International Financial Institution to oppose and vote against any extension by the respective institution of any loan, credit, or guarantee to the Republic of Zimbabwe or any cancellation or reduction of indebtedness by the Republicof Zimbabwe to the US or any International Financial Institution”. 

The European Union (EU) also introduced its own sanctions in February 2002. While the EU lifted most of its sanctions in 2014, an arms and equipment embargo and assets freeze against the Zimbabwe DefenceIndustries, remain in place. The maintenance of these sanctions has placed a heavy burdenon the dutiful efforts of the Zimbabwe Defence Forces to support humanitarian activities in situations of distress, carry out search and rescue operations as well as to assist with reconstruction in the aftermath of the calamities such as the devastating Cyclone Idai. 

These sanctions violate Article 41 of the United Nations Charter, which states that sanctions can only be decided on by the UN Security Council. The Vienna Declaration and Programme of Action calls on States to refrain from any unilateral measures not in accordance with international law and the UN Charter as they create obstacles to trade relations among States and impede the full realisation of human rights.

The United Nations Conference on Trade and Development (UNCTAD) at its 14^thMinisterial Session held in Nairobi, Kenya in 2016, strongly urged States to refrain from promulgating and applying any unilateral economic, financial or trade measures not in accordance with international law and that impede the full achievement of economic and social development, particularly in developing countries.

Your Excellencies,

The impact of these sanctions is both profound and multifaceted. Zimbabwe has lost well over US$42 billion in revenue over the past twenty years. This includes losses in bilateral donor support estimated at US$4.5 billion annually since 2001, US$12 billion in loans from the International Monetary Fund, the World Bank and African Development Bank, commercial loans of US$18 billion and a GDP reduction of US$21 billion. Consequently, the significant progress that Zimbabwe had made in the development of infrastructure, as well as health, education and other social service delivery systems has been severely undermined and reversed. This has not only resulted in the most vulnerable sections of the population sinking deeper into poverty, but has also eroded the country’s capacity to attain the Sustainable Development Goals (SDGs).

Your Excellencies,

Zimbabwe’s Balance of Payments position has deteriorated significantly since the imposition of the sanctions. The country’s access to international credit markets was blocked following the enactment of ZIDERA. Due to declining external budgetary support, Zimbabwe’s budget deficit has largely been financed from domestic borrowing, which has forced the country to operate on a cash budget and triggered high inflation.

The combined effect of the external debt arrears and the sanctions has made it difficult for Zimbabwean companies to access offshore loans, or they have done so at punitive and exorbitant interest rates. In the same vein, Zimbabwean importers have to pay cash up front, resulting in a significant squeeze on private sector cash flows. 

Zimbabwean banks and money transfer agencies also face challenges in meeting customer obligations, including Diaspora remittances into the country, owing to the termination of correspondent bank arrangements between local banks and international financial institutions. Funds are periodically intercepted, and money transfer companies become victims of long and tedious investigations on specific transactions.

Furthermore, the imposition of secondary sanctions, civil and criminal penalties for alleged circumventing or assisting in the circumvention of primary sanctions regimes,has resulted in      de-risking and over-compliance by entities. Over-compliance has compelled the Government, businesses, humanitarian organizations and individuals to explore alternative ways to procure critical goods and services, leading to high costs of goods and services.

In addition to the impact on the financial services sector, the sanctions brought a myriad of challenges on all other sectors of the Zimbabwean economy. In the agricultural sector, failure to access lines of credit and toattract investment, seriously impededdevelopment, rehabilitation and modernisationof equipment and machinery, leading to a reduction in productivity. 

The market access for horticultural products, sugar, beef and cotton, among other produce, was also negatively affected as the country lost its niche and lucrative markets. 

The capital-intensive mining sector suffered a lack of much-needed investment and lines of credit due to bad publicity and propaganda.Diamond mining companies are forced to sell on an ex-works basis instead of free-on-board or delivered basis and at discounted prices of more than 25 percent below normal prices.

The limited access to credit lines and financial support also impacted negatively on the rate of implementation of capital projects, resulting in the deterioration of the country’s infrastructure. In the energy sector, this has led to unreliable power supply and prolonged power outages. 

Further, the termination of credit facilities to oil importers, affected the country’s ability to secure adequate fuel supplies, thereby increasing the cost of production, public transportation costs as well as prices of goods and services.

Your Excellencies,

Zimbabwe has continued to introduce reforms in human rights, governance, and socio-economic policies to improve citizens’ welfare and strengthen international relations. Yet, despite these concerted efforts, my countryfaces continued criticism from sanctioning states in order to justify their machinations. Zimbabwe is not only being punished for asserting its people’s right to repossess theland that we were forcibly disinherited of by the former colonisers, but is also being used as an example to deter other countries in the region from pursuing a similar decision towards reparative justice. 

In this regard, I reiterate Zimbabwe’s denunciation of these unilateral coercive measures which are foreign policy instruments deliberately aimed at subverting our Governments and undermining our sovereignty. We call for the immediate removal of these illegal sanctions.

We reject the claims that sanctions are “targeted on a few individuals”. This narrative by the sanctioning States is grossly misleading and hypocritical, especially in light of well-documented evidence of the devastating impact of unilateral coercive measures on the innocent populations that the sanctions are purportedly designed to protect. 

Your Excellencies,

Zimbabwe calls upon the international community to recognise that sanctions are an affront to our sovereignty and our people’s right to self-determination. We urge all nations to adhere to international law and to the purposes and principles as enshrined in the UN Charter. We seek not charity but fairness, not favouritism but justice – a level playing field that allows us to fairly engage in global trade, attract investment, and fulfil the aspirations of our people to live in dignity and prosperity. Zimbabwe stands ready to engage in constructive dialogue, foster mutual respect and understanding, and build bridges that unite rather than divide our global community.

I wish to conclude by welcoming the Special Rapporteur’s effort to ensure the adequate monitoring and assessment of the impact of UCMs and over-compliance, and call for its implementation at the United Nations level through a universal, inclusive, comprehensive, systematic, transparent, and evidence-based monitoring and impact assessment mechanism.

We take note of the Guiding Principles on Sanctions, Business, and Human Rights developed by the Special Rapporteur and look forward to the exchange of views in this august gathering to strengthen this important document for possible adoption and implementation.

Grace Mugabe Weeps in Court Over Stolen Property

Harare, November 21, 2024 | Former First Lady Grace Mugabe broke down in tears in court yesterday as she identified her late husband, former President Robert Mugabe’s, suits among items allegedly stolen by four former employees. The emotional moment prompted Magistrate Esthere Chivasa to adjourn proceedings briefly to allow Mrs. Mugabe to regain her composure.

The suspects—Allen Chinamonya (42), Danmore Chinamonya (35), Samson Karonga, and Tendai Bunganirwa—are facing charges of unlawful entry in aggravating circumstances. They allegedly broke into 11 containers belonging to the former First Family, stealing household items, including clothing, television sets, cutlery, and bath towels, valued between $3.5 million and $4 million.

In her testimony, Mrs. Mugabe claimed Allen Chinamonya, a former driver, was caught red-handed with some stolen goods. She also accused him of misusing a family vehicle to transport the stolen property.

“I suspected him because some of the goods could not be carried manually but required a car,” she told the court.

She further testified that Samson Karonga was implicated in prior theft incidents and was reportedly seen attempting to unlock one of the containers by an eyewitness.

When questioned why she only reported the four suspects out of her 60 employees, Mrs. Mugabe said they had a history of theft. Searches conducted at their homes led to the recovery of stolen goods, including men’s suits, a Zanu PF shirt, and household items.

The suspects, however, denied the charges. They claimed the property had been given to them as gifts for their loyalty to the late President Mugabe after his resignation in 2017. One of the accused, Tendai Bunganirwa, asserted that the items found in his possession were handed to him personally by Robert Mugabe.

The State alleges that the theft occurred between 2018 and May 2024, after Mrs. Mugabe brought the containers from Zimbabwe House to her Borrowdale home following her husband’s retirement.

The theft came to light on May 22, 2024, when Mrs. Mugabe discovered broken locks on the containers while selecting artefacts to donate to the Museum of African Liberation. Police investigations led to the suspects’ arrest and the recovery of some of the stolen goods, reportedly worth $2,000.

The trial continues as the State seeks to prove its case against the accused.

The Gwanda Fire Brigade faced significant challenges while attempting to put out a fire that consumed a Toyota Runx outside Gwanda town, near the NSSA complex along the Bulawayo-Beitbridge Road, on Monday afternoon.

According to Chronicle, the fire brigade struggled when their rear water pump malfunctioned and failed to load water. In a desperate attempt to control the blaze, they resorted to using a small dish provided by a well-wisher, alongside a suction hose to collect water from a nearby source. This improvisation frustrated onlookers, who could only watch as the fire spread uncontrollably.

The vehicle, which was en route from Beitbridge to Gwanda, is believed to have experienced a mechanical issue. The driver had engaged a mechanic to address the fault, but while repairs were underway, the car unexpectedly caught fire.

Despite the fire brigade’s efforts, the vehicle was ultimately destroyed by the flames.

According to Chronicle, the fire brigade struggled when their rear water pump malfunctioned and failed to load water. In a desperate attempt to control the blaze, they resorted to using a small dish provided by a well-wisher, alongside a suction hose to collect water from a nearby source. This improvisation frustrated onlookers, who could only watch as the fire spread uncontrollably.

The vehicle, which was en route from Beitbridge to Gwanda, is believed to have experienced a mechanical issue. The driver had engaged a mechanic to address the fault, but while repairs were underway, the car unexpectedly caught fire.

Despite the fire brigade’s efforts, the vehicle was ultimately destroyed by the flames.

The man, identified as Everton Sithole, was struck on the head by the right side of a train bumper after he awoke too late to move from the tracks. Sithole, who is homeless, is currently admitted to Mpilo Hospital with head injuries and bruises on both legs.

According to Bulawayo provincial police spokesperson Inspector Abednico Ncube, the incident occurred as a train operated by the Beitbridge-Bulawayo Railway approached the site.

“The engineman initially thought he saw a heap of garbage on the railway sleepers,” said Inspector Ncube. “When the train was just two meters away, he realized it was a man with his head covered by a cloth. The victim raised his head, but it was too late to avoid being struck.”

The train driver managed to bring the locomotive to a stop approximately 15 meters from the point of impact and immediately called for an ambulance, which rushed Sithole to Mpilo Hospital.

The National Railways of Zimbabwe (NRZ) confirmed the incident and expressed concern over an increase in accidents involving trains and pedestrians.

NRZ spokesperson Andrew Kunambura highlighted that this was not an isolated case. “In the last week of October alone, eight separate incidents involving trains and humans occurred, injuring five people. One man in Mashonaland West was found with a broken leg after being struck on the tracks in Makwiro.”

The High Court, presided over by Justice Nyaradzo Priscilla Munangati-Manongwa, ordered the illegal occupants of the Chisipite residence, Demetria Zirenga and Harrison Marange, to vacate the premises within 15 days. The judgment declared the original title deed held by Dr. Mutumbuka as valid, and the competing title deed presented by fraudsters as fake and invalid.

Dr. Mutumbuka, who has owned the property since 1988, fell victim to a carefully orchestrated scheme. His original title deed was removed from the Deeds Office by Lynna Mlambo, a supervisor, and handed to her boyfriend, Tatenda ‘Shaft’ Wakatama. The deed was forged and returned to the registry with altered ownership details.

The fraudulent deed was then used by Jonah Ngome, who sold the property for a mere US$140,000 — significantly below its market value. Zirenga and Marange, the purchasers, paid just US$45,000 initially and took possession of the house. Dr. Mutumbuka, represented by Advocate Edley Mubayiwa, was evicted in 2023 but swiftly sought legal recourse.

Court Ruling

Justice Munangati-Manongwa’s ruling dismantled the fraudulent transaction, affirming Dr. Mutumbuka’s ownership and ordering the Deeds Office to expunge the fraudulent title from its records. The judge criticized Ngome’s suspicious absence during court proceedings, stating, “Ngome is silent. He accepts the fraud to his deed by remaining silent.”

The judgment also exposed flaws in Zirenga and Marange’s case. They relied on a flawed agreement of sale and a fraudulent title deed, which Justice Munangati-Manongwa described as “replete with fraud.” Their lawyers, Hope Ndanaka Tirivavi and Advocate Method Ndlovu, were chastised for pursuing a meritless case, resulting in the dismissal of their application with costs.
