Mnangagwa said the opposition will burn down buildings next year so people must not vote for them.

He said, “we have those in the opposition, who spend time demonstrating and burning down houses.

“The country is built by its own people. We will never ask another country to help us build Zimbabwe, it is ourselves, with our own resources, our own manpower and our vision, to build our own country. So to do so we need peace in the country; silence in the country.”

He said in full:

“Lastly, next year we are entering elections of councils and members of parliament.

“Now you see the journey we have traveled – most urban councils are headed by opposition but there’s nothing at all that they are doing.

“So I am hoping that the bi elections will be your chance to put your X on ZANU PF, so we create our own councils, and the parliamentary ones.

“ZANU PF is for peace, peace harmony and development….There is no province without ongoing projects, to build the country.

“The country is built by its own people. We will never ask another country to help us build Zimbabwe, it is ourselves, with our own resources, our own manpower and our vision, to build our own country. So to do so we need peace in the country; silence in the country.

“We have those in the opposition, who spend time demonstrating and burning down houses.

“We don’t want those things, we want silence in the country, we build our country while united, we shall rise of we do that. See they put sanctions on us thinking you shall rise against your nation.”

ZIFA Board Threatens Mapeza With Unspecified Action

THE suspended Felton Kamambo-led Zifa board has threatened Norman Mapeza with unspecified action if he accepts his appointment as Warriors coach by the Zifa secretariat. His appointment was announced on Thursday by Zifa acting CEO Xolisani Gwesela with the blessing of the Sports and Recreation Commission (SRC).

This came hardly a day after the board had indicated that it would be taking a back seat to avoid any confrontation with the SRC, but yesterday it acted otherwise.

In a statement, the suspended Zifa board also questioned Gwesela’s appointment as acting chief executive officer, arguing the appointment was not binding.

The Zifa board says the SRC cannot continue to make decisions on their behalf.

The SRC suspended the entire Zifa board on November 16 for alleged financial impropriety.

The statement read: “The Zifa board advises stakeholders that anyone who goes into contractual relationship with Zifa in the absence or without express authority of the legitimate Zifa board was doing so at its own risk and that Zifa will not honour any obligations arising out of such agreements even if such are on Zifa letterhead or purportedly signed by any member of the Zifa secretariat, but without express Zifa board authority. Of particular note is the fact that the Zifa board has not appointed any national team coach nor has it appointed any acting general secretary.”

The suspended board, which still holds the SRC in disdain, added: “The board has learnt through various media articles that certain decisions that are a preserve of the Zifa board are being taken on behalf of Zifa. The Zifa board would want to inform stakeholders that any such decisions, contracts or agreements reached under the auspices of Zifa are null and void ab initio (from the beginning) and therefore of no legal effect.”

On the appointment of Mapeza on Thursday, Gwesela said: “We got guidance from the SRC that Mapeza will continue as the Warriors coach for the Afcon finals, we had sought guidance on the matter. He will be allowed to choose his own assistants.”

The suspended Zifa board earlier appeared to have thrown in the towel and given up the fight against the sports regulator.

The board insisted that Joseph Mamutse was still the national football governing body’s chief executive officer.

“As mentioned in our previous releases, Mamutse remains the bona fide and substantive CEO of Zifa, but like the Zifa Board, has also been physically precluded from carrying out his lawful duties by the SRC even after an appeal was lodged.

We urge all stakeholders to be very careful on the agreements they may think they are entering with Zifa and the risk such may carry in terms of Fifa statutes,” the statement read.

“We urge these (Mapeza and Gwesela) to demand that they sign whatever contracts with the real institution they are contracting, which in this case is the SRC, to safeguard and enforce their interests in cases of defaults.

The Zifa board also notes that the SRC board has illegally usurped the Zifa board powers by clandestinely assuming the role of an interim committee and such is totally against Fifa and Zifa statutes.

“Once again, we urge for calmness and sober reflection by those that continue making the terrible blunders before we get to a point of no return.

There is still time, though limited, of self-correction by those responsible for the mess we are currently in and being perpetuated,” the Zifa board stated. – NewsDay

ZIFA Board Nullifies Mapeza Appointment

The appointment of Norman Mapeza as Warriors coach has been nullified by Felton Kamambo-led ZIFA board, casting further confusion as to who really is in charge of Zimbabwean football.

Mapeza, whose 3-month contract as head coach of the national team expired after the World Cup qualifiers, was reappointed to take charge of next month’s AFCON qualifiers, yesterday.

“In consultation and with guidance from the Sports and Recreation Commission, coach Norman Mapeza will continue as Head Coach and will guide Warriors to the Cameroon Afcon finals. The coach has been given latitude to come up with his assistants in the interest of teamwork,” wrote the association’s acting CEO Xolisani Gwesela.

What You Need To Know About Omicron Variant

On 26 November 2021, WHO designated the variant B.1.1.529 a variant of concern, named Omicron, on the advice of WHO’s Technical Advisory Group on Virus Evolution (TAG-VE). This decision was based on the evidence presented to the TAG-VE that Omicron has several mutations that may have an impact on how it behaves, for example, on how easily it spreads or the severity of illness it causes. Here is a summary of what is currently known.

Current knowledge about Omicron

Researchers in South Africa and around the world are conducting studies to better understand many aspects of Omicron and will continue to share the findings of these studies as they become available.

Transmissibility: It is not yet clear whether Omicron is more transmissible (e.g., more easily spread from person to person) compared to other variants, including Delta. The number of people testing positive has risen in areas of South Africa affected by this variant, but epidemiologic studies are underway to understand if it is because of Omicron or other factors.

Severity of disease: It is not yet clear whether infection with Omicron causes more severe disease compared to infections with other variants, including Delta. Preliminary data suggests that there are increasing rates of hospitalization in South Africa, but this may be due to increasing overall numbers of people becoming infected, rather than a result of specific infection with Omicron. There is currently no information to suggest that symptoms associated with Omicron are different from those from other variants. Initial reported infections were among university students—younger individuals who tend to have more mild disease—but understanding the level of severity of the Omicron variant will take days to several weeks. All variants of COVID-19, including the Delta variant that is dominant worldwide, can cause severe disease or death, in particular for the most vulnerable people, and thus prevention is always key.

Effectiveness of prior SARS-CoV-2 infection

Preliminary evidence suggests there may be an increased risk of reinfection with Omicron (ie, people who have previously had COVID-19 could become reinfected more easily with Omicron), as compared to other variants of concern, but information is limited. More information on this will become available in the coming days and weeks.

Effectiveness of vaccines: WHO is working with technical partners to understand the potential impact of this variant on our existing countermeasures, including vaccines. Vaccines remain critical to reducing severe disease and death, including against the dominant circulating variant, Delta. Current vaccines remain effective against severe disease and death.

Effectiveness of current tests: The widely used PCR tests continue to detect infection, including infection with Omicron, as we have seen with other variants as well. Studies are ongoing to determine whether there is any impact on other types of tests, including rapid antigen detection tests.

Effectiveness of current treatments: Corticosteroids and IL6 Receptor Blockers will still be effective for managing patients with severe COVID-19. Other treatments will be assessed to see if they are still as effective given the changes to parts of the virus in the Omicron variant.

Studies underway

At the present time, WHO is coordinating with a large number of researchers around the world to better understand Omicron. Studies currently underway or underway shortly include assessments of transmissibility, severity of infection (including symptoms), performance of vaccines and diagnostic tests, and effectiveness of treatments.

WHO encourages countries to contribute the collection and sharing of hospitalized patient data through the WHO COVID-19 Clinical Data Platform to rapidly describe clinical characteristics and patient outcomes.

More information will emerge in the coming days and weeks. WHO’s TAG-VE will continue to monitor and evaluate the data as it becomes available and assess how mutations in Omicron alter the behaviour of the virus.

Recommended actions for countries

As Omicron has been designated a Variant of Concern, there are several actions WHO recommends countries to undertake, including enhancing surveillance and sequencing of cases; sharing genome sequences on publicly available databases, such as GISAID; reporting initial cases or clusters to WHO; performing field investigations and laboratory assessments to better understand if Omicron has different transmission or disease characteristics, or impacts effectiveness of vaccines, therapeutics, diagnostics or public health and social measures. More detail in the announcement from 26 November.

Countries should continue to implement the effective public health measures to reduce COVID-19 circulation overall, using a risk analysis and science-based approach. They should increase some public health and medical capacities to manage an increase in cases. WHO is providing countries with support and guidance for both readiness and response.

In addition, it is vitally important that inequities in access to COVID-19 vaccines are urgently addressed to ensure that vulnerable groups everywhere, including health workers and older persons, receive their first and second doses, alongside equitable access to treatment and diagnostics.

Recommended actions for people

The most effective steps individuals can take to reduce the spread of the COVID-19 virus is to keep a physical distance of at least 1 metre from others; wear a well-fitting mask; open windows to improve ventilation; avoid poorly ventilated or crowded spaces; keep hands clean; cough or sneeze into a bent elbow or tissue; and get vaccinated when it’s their turn.

WHO will continue to provide updates as more information becomes available, including following meetings of the TAG-VE. In addition, information will be available on WHO’s digital and social media platforms. –

CBZ Wins Top Corporate Governance Awards

CBZ Holdings won the listed companies Overall Best Corporate Governance Disclosures Award for the second year running at the 2021 Excellence in Corporate Governance Awards, held at the Rainbow Towers Hotel in Harare on Wednesday evening.Its subsidiary, CBZ Bank, won the banking institutions Overall Best Corporate Governance Disclosures Award.

First Mutual Holdings won the insurance companies Best Corporate Governance Disclosure  Award, while TelOne took the top award for state-owned entities and parastatals.

The annual awards that acknowledge excellence in corporate governance are hosted every year by the Chartered Governance and Accountancy Institute in Zimbabwe, previously known as the Institute of Chartered Secretaries and Administrators in Zimbabwe.

Welcoming guests to the awards ceremony, CGAIZ president Taona Munzvandi said the importance of good corporate governance for the effective and efficient functioning of the country’s economy could not be over-emphasised.

First runner-up for the listed companies overall award was African Sun, while Delta Corporation  came third.

Second placed overall in the banking sector was FBC Bank, while Central African Building Society (CABS) took third place.

Among insurance companies, Fidelity Life Assurance of Zimbabwe came second. Cell Insurance Company came third.

Zimbabwe Revenue Authority was the first runner-up in the state-owned entities and parastatals category, followed by People’s Own Savings Bank.

There were other awards for different aspects of corporate governance among listed companies and banking institutions.

Among listed companies CBZ Holdings won the Best Shareholder Treatment Disclosures Award, followed by Bindura Nickel Corporation and Axia Corporation.

The Best Stakeholder Practices and Sustainability Reporting Disclosures Award went to Innscor Africa. African Sun was placed second in this category and Padenga Holdings third.

The Best Board Practices Disclosures Award was won by African Sun. Seed Co took second place in this category, while Delta Corporation came third.

Among banking institutions CBZ Bank, FBC Bank and CABS, took first, second and third place respectively not only for the overall award but for the Best Board Governance Practices Disclosures Award and the Best Risk Management Disclosures Award.

Public Service Commission chairman Vincent Hungwe, in a speech read on his behalf by commissioner Anthony Chigora, said the theme for this year’s award ceremony, which was Good Corporate Governance for Sustainable Economic Development, resonated well with the economic and structural reforms being implemented towards the Vision 2030 goal of attaining upper middle income economy status.

Congratulating the Corporate Governance and Accountancy Institute in Zimbabwe on its rebranding, he said the name change underscored the institute’s being the home of professionals in governance and accountancy who have a high level of competence in business administration, general management, accounting, company secretaryship, taxation and corporate governance.

He said the Public Service Commission was proud to be associated with the institute and its ideals and aspirations.

“The Public Service Commission in the Second Republic has geared itself to accelerate its pursuit of high performance, professionalism and high ethics, as this is the only way we can attain the national imperatives as espoused in Vision 2030.

“We are in the final stages of operationalising  our Public Service Academy for the purposes of deepening, sharpening and expanding the development of our human capital,” he said.

He said excellence in corporate governance meant an organisation’s processes were aimed at producing results which met the needs of society and organisational prosperity, while making use of available resources.

“The correct and consistent application of sound policies and principles, among other things, creates a healthy, compliant, transparent and accountable corporate culture that ensures  that member behaviour aligns with the values your organisation seeks to embody.

“This is the cornerstone for success, which enables the creation of opportunities for growth and a competitive advantage,” he said.

He pointed out that the Constitution recognises the importance of sound corporate governance as a tool for fostering national development and social cohesion.

A lot of organisations in Zimbabwe, whether private of public sector organisations, could now boast of at least meeting the minimum standards of corporate governance and having functional structures such as a board of directors, he said.

Prior to announcing the award winners, the report of the adjudicators  was read out. Among the shortcomings detailed by the adjudicators in respect of many listed companies was failure to disclose the essentials of their dividends policies, the mechanism that allows minority shareholders to influence board composition, directors’ and management’s shareholding and whether the chief executive’s or managing director’s performance had been evaluated annually and whether directors or management had undergone any training in corporate governance.

The adjudicators’ report also pointed out, in the light of Environmental, Social and Governance (ESG) reporting requirements, the failure of companies to explicitly mention their obligations to various stakeholders and the outcome of all their dealings with various stakeholder groups.

With respect to banking institutions, the report said most of them, while highlighting directors’ qualifications, did not articulate their skills, experience or age and any other directorships held. There was a lack of gender balance in the composition of boards.

The majority did not disclose their remuneration policies. They only disclosed remuneration paid to directors as an aggregated figure and not individually separated as required by best practice.

Most of them disclosed related parties transactions but improvements were needed in disclosing the limits and terms of such transactions as well as the approving and monitoring procedures.

Only three of the reports that were evaluated paid significant attention to sustainability issues.

“Given the rise in the use of environment, social and governance (ESG) criteria by investors and other stakeholders, institutions that lag behind in this respect expose themselves to risks that may irretrievably harm their businesses,” the report said.

With regard to insurance companies, the report said it was difficult to extract from annual reports whether ample notice of shareholders’ meetings was given and disclosure of  members’ voting rights.

The annual reports did not disclose the number of directorships in other organisations that each board member had or the balance in terms of age of board members.

Only about three percent of state enterprises and parastatals (SEPs) produced full annual reports for 2020. In the few reports evaluated the independence of board members was not disclosed.

None of the SEPs evaluated provided information on where else directors were serving.

Commendable were the efforts that SEPs had made to achieve gender balance, the report said. This could be attributed to enforcement of the Public Entities Corporate Governance Act, it added.

The adjudicators’ report said there were general disparities in disclosures across all four categories. Most participating entities were still to embrace sustainability reporting, which meant they did not integrate their financial and non-financial information.

“There is a high level of non-disclosure of some information that should ordinarily be made available to stakeholders. There is a general need for all reporting entities to avail reasonable and detailed information to stakeholders to improve on transparency, good governance and ethical standards, while striking a balance of these disclosures with business intelligence information,” the report said.

Shisha Smoking Potentially Increases TB Transmission: Expert

By A Correspondent- The smoking of shisha could increase the risk of one being infected with Tuberculosis (TB) as the hookah pipe is shared among a group of smokers at any given time, a local TB expert has warned.

Shisha smoking is increasingly becoming popular in Zimbabwe around some of the popular joints where multiple smokers take turns puffing on the pipes.

However, hygiene etiquette is given scant regard, with shisha sessions often going for hours in bars and lounges.

This means users are exposed to a higher volume of harmful bacteria and susceptible to infections.

Often, shisha is smoked in large groups, rather than as individuals and as people share mouthpieces, various commensal and pathogenic organisms may be transmitted between the smokers through saliva.

The Ministry of Health and Child Care (MoHCC) National TB Program Manager Dr Charles Sandy said though there was no available data to quantify the extent to which smoking Shisha spreads TB, the practice increases the risk of TB transmission in the country.

Dr Sandy was speaking during a Stop TB partnership Social media campaign launch in Kadoma recently. He said:

On Shisha, we don’t have any data to say this is the amount of TB you get but I think with COVID-19 we know what’s happening with COVID.

Common sense is there that you actually increase your risk of infection by sharing the same air with somebody who is infected but we don’t have any data as yet that we can refer to and say according to this study by so and so.

Dr Sandy added that men were at greater risk of developing TB due to the high-risk behaviours they engage in.

Businessman’s Wife Hires MaShurugwi To Beat Up Hubby’s Small House

By A Correspondent- The wife to Decent Rimbi of Rimbi Travel and Tours was yesterday dragged to court after she reportedly conspired and formed a gang to rob a woman she suspected to be having an affair with her husband.

Everjoice Rimbi, 40, who is also the co-director of the bus company, was not asked to plead when she appeared before Harare magistrate Barbra Mateko.

She appeared together with her alleged accomplices Pamela Mutanhairi, Melissa Muzuva, Washington Njengwe, Richard Chikwaya, Givemore Mazerenganwa, Tafadzwa Mazerenganwa and Brighton Chiteka.

Rimbi and Mutanhairi were released on free bail as they were coming from home while the rest were ordered to pay $20 000 as bail.

The court heard that between August and November, Rimbi discovered some text messages between her husband and a female employee Nomalanga Thodlana which suggested that he had a soft spot for her and she suspected that they were in a secret affair.

Rimbi reportedly then engaged Muzuva through Mutanhairi after getting her contacts in a Whatsapp group and asked them to mobilise a gang that would harass Thodlana whom she wanted to resign voluntarily after the mission.

An initial payment of US$150 was paid to the gang and on December 7, an unknown person went to Decent Rimbi and advised him of the planned robbery and how it was going to be done and he alerted CID Homicide detectives who waylaid the gang.

Mwonzora Mulls Dr Khupe Recall

By A Correspondent-MDC-T leader, Douglas Mwonzora, is reportedly plotting to recall his deputy and the former party leader (on an interim basis), Thokozani Khupe, from Parliament.

Khupe is through her lawyers demanding minutes of a meeting where resolutions and recommendations were made to expel her and her allies.

She is alleging that some tribal remarks were made during the MDC-T National Council meeting held in Harare on 26 November 2021.

Khupe and Mwonzora were instrumental in purging MDC Alliance MPs from Parliament and their officials from councils. 

Below is a letter written by Khupe’s lawyers to the party’s Secretary-General: 

RE: PENDING AND EXPULSION RECALL OF PARTY MEMBERS 

The above matter refers.

We represent the Deputy President Hon Doctor Thokozani Khupe in this matter. Please note our professional interests.

We have been advised by our client that on the 26th of November 2021, and at Morgan Tsvangirai House, there was a National Council meeting which was held in the capital city. In that meeting, there were certain words that were used by some members that were clearly of tribalistic nature.

Further, we have been advised that it is in that meeting where certain recommendations were made to recall, Doctor Khupe and others from Parliament and local authorities. We are advised that your goad office is in possession of such minutes and resolutions.

We request that your good office share with our client, the minutes and the resolutions of the National Council of the 26th of November 2021 urgently so that we could be in a position to take full instructions.

Cop Hauled To Court For Pointing Gun At ShopOwner

A Correspondent- Rasin Zulu, a cop based at the canine Section at Chikato Police Station, appeared in court after allegedly pointing a gun at a woman for opening a shop after the curfew hours.

Zulu appeared before Masvingo Magistrate Ritaiswe Silaigwana this week for contravening the Firearms Act after he pointed firearms at a civilian.

The Mirror attended the case.

It is the State case that on September 4 2021, Zulu arrested the complainant for operating business after hours.

Tendai Maposa and her husband Frank Shepherd were initially taken to Masvingo Central then Chikato since the crime occurred in the latter’s policing area.

The two were released to go home after it was realised that they did not have their medication on them.

As they got to the court Zulu allegedly threatened Shepherd and the wife confronted him over those threats. Zulu then allegedly pulled out a gun and pointed it at Maposa and uttered the words “ndokulayita” meaning I will kill you. The accused person was restrained by his workmates.

Facts About Omicron Variant

On 26 November 2021, WHO designated the variant B.1.1.529 a variant of concern, named Omicron, on the advice of WHO’s Technical Advisory Group on Virus Evolution (TAG-VE). This decision was based on the evidence presented to the TAG-VE that Omicron has several mutations that may have an impact on how it behaves, for example, on how easily it spreads or the severity of illness it causes. Here is a summary of what is currently known.

Current knowledge about Omicron

Researchers in South Africa and around the world are conducting studies to better understand many aspects of Omicron and will continue to share the findings of these studies as they become available.

Transmissibility: It is not yet clear whether Omicron is more transmissible (e.g., more easily spread from person to person) compared to other variants, including Delta. The number of people testing positive has risen in areas of South Africa affected by this variant, but epidemiologic studies are underway to understand if it is because of Omicron or other factors.

Severity of disease: It is not yet clear whether infection with Omicron causes more severe disease compared to infections with other variants, including Delta. Preliminary data suggests that there are increasing rates of hospitalization in South Africa, but this may be due to increasing overall numbers of people becoming infected, rather than a result of specific infection with Omicron. There is currently no information to suggest that symptoms associated with Omicron are different from those from other variants. Initial reported infections were among university students—younger individuals who tend to have more mild disease—but understanding the level of severity of the Omicron variant will take days to several weeks. All variants of COVID-19, including the Delta variant that is dominant worldwide, can cause severe disease or death, in particular for the most vulnerable people, and thus prevention is always key.

Effectiveness of prior SARS-CoV-2 infection

Preliminary evidence suggests there may be an increased risk of reinfection with Omicron (ie, people who have previously had COVID-19 could become reinfected more easily with Omicron), as compared to other variants of concern, but information is limited. More information on this will become available in the coming days and weeks.

Effectiveness of vaccines: WHO is working with technical partners to understand the potential impact of this variant on our existing countermeasures, including vaccines. Vaccines remain critical to reducing severe disease and death, including against the dominant circulating variant, Delta. Current vaccines remain effective against severe disease and death.

Effectiveness of current tests: The widely used PCR tests continue to detect infection, including infection with Omicron, as we have seen with other variants as well. Studies are ongoing to determine whether there is any impact on other types of tests, including rapid antigen detection tests.

Effectiveness of current treatments: Corticosteroids and IL6 Receptor Blockers will still be effective for managing patients with severe COVID-19. Other treatments will be assessed to see if they are still as effective given the changes to parts of the virus in the Omicron variant.

Studies underway

At the present time, WHO is coordinating with a large number of researchers around the world to better understand Omicron. Studies currently underway or underway shortly include assessments of transmissibility, severity of infection (including symptoms), performance of vaccines and diagnostic tests, and effectiveness of treatments.

WHO encourages countries to contribute the collection and sharing of hospitalized patient data through the WHO COVID-19 Clinical Data Platform to rapidly describe clinical characteristics and patient outcomes.

More information will emerge in the coming days and weeks. WHO’s TAG-VE will continue to monitor and evaluate the data as it becomes available and assess how mutations in Omicron alter the behaviour of the virus.

Recommended actions for countries

As Omicron has been designated a Variant of Concern, there are several actions WHO recommends countries to undertake, including enhancing surveillance and sequencing of cases; sharing genome sequences on publicly available databases, such as GISAID; reporting initial cases or clusters to WHO; performing field investigations and laboratory assessments to better understand if Omicron has different transmission or disease characteristics, or impacts effectiveness of vaccines, therapeutics, diagnostics or public health and social measures. More detail in the announcement from 26 November.

Countries should continue to implement the effective public health measures to reduce COVID-19 circulation overall, using a risk analysis and science-based approach. They should increase some public health and medical capacities to manage an increase in cases. WHO is providing countries with support and guidance for both readiness and response.

In addition, it is vitally important that inequities in access to COVID-19 vaccines are urgently addressed to ensure that vulnerable groups everywhere, including health workers and older persons, receive their first and second doses, alongside equitable access to treatment and diagnostics.

Recommended actions for people

The most effective steps individuals can take to reduce the spread of the COVID-19 virus is to keep a physical distance of at least 1 metre from others; wear a well-fitting mask; open windows to improve ventilation; avoid poorly ventilated or crowded spaces; keep hands clean; cough or sneeze into a bent elbow or tissue; and get vaccinated when it’s their turn.

WHO will continue to provide updates as more information becomes available, including following meetings of the TAG-VE. In addition, information will be available on WHO’s digital and social media platforms. –

Kazembe In No Show At ED Officiated Event In Mazowe

By A Correspondent- Zanu PF Mashonaland Central provincial chairperson Kazembe Kazembe’s decision not to attend an event officiated by President Emmerson Mnangagwa in Mazowe recently left his boss “worried”.

Mnangagwa was in Mazowe to unveil a foundation stone to mark the construction of the University of Zimbabwe’s (UZ) quinary hospital.

Kazembe, who is also the Home Affairs and Cultural Heritage Minister, decided to go on a campaign trail in Mbire District for the retention of his chairmanship while he was fully aware of Mnangagwa’s visit, sources told NewZimbabwe.com.

Both Mazowe and Mbire districts are in Mashonaland Central province.

Mnangagwa is said to be worried by the act of “indiscipline” shown by Kazembe as it came when ZANU PF is in the throes of factionalism.

Said a source from Mashonaland Central Province:

Kazembe bunked the event, opting to go to Mbire for his campaigns.

He is the provincial chairperson and protocol demands of him to receive the president who is the party’s First Secretary.

This got Mnangagwa worried and the Office of the President (and Cabinet) concerned.

It is the worst act of indiscipline and exposes his (Kazembe) hunger for power.

Kazembe’s chairmanship is under threat from businessman Tafadzwa Musarara, who has in the past few months mounted a serious challenge.

Kazembe is said to be one of Vice President Constantino Chiwenga’s foot soldiers in the province.

Musarara, who is the Grain Millers Association of Zimbabwe (GMAZ) chairperson, is reported to be a Mnangagwa ally.

Fresh Details Emerge On Munatsi, Dzanya’s Legal Battle With BancABC

By A Correspondent- At the time of his demise, Zimbabwe Investment and Development Agency (ZIDA) chief executive Douglas Munatsi and his business partner Francis Dzanya were in a legal battle with BancABC Zimbabwe over US$14 134 357.32.

Munatsi played an important role in the founding of the African Banking Corporation, now trading as BancABC.

He was involved in the merger of Bard Discount House, First Merchant Bank, UDC and ULC Companies that were operating in Botswana, Mozambique, Malawi (LFC), Tanzania and Zambia.

Munatsi became the first CEO of the bank in 2000 while Dzanya was appointed group chief financial officer in 2005.

By the time the duo left BancABC in 2014, the institution has grown its assets to more than US$2 billion. The bank was taken over by Atlas Mara.

Court documents show that Munatsi and Dzanya had sued BancABC as they jointly sought US$14 million from the bank, in High Court case number 11582/17.

Munatsi was the first plaintiff while Dzanya was the second plaintiff. The joint pretrial conference minute shows that issues in contention were:

… whether defendant is liable to pay plaintiff USD$4 769,034.40 as follows, (a) the sum of USD$2 531,726.30 to the first plaintiff; (b) The sum of USD$2, 237,308.00 to the second plaintiff; (c) Whether defendant is entitled to interest on the sums set out above from the date of issue of Treasury Bills to the date of payment of the sums involved.

Whether defendant is liable to pay plaintiff damages as follows: (a) USD$4 971,746.88 to the first plaintiff; (b) USD$4 393,576.04 to the second plaintiff.

… whether plaintiffs breached the fiduciary duties they owed defendant; whether plaintiffs are entitled to a refund of only the capital sums they invested and whether the claim in reconvention is prescribed.

Munatsi died in a mysterious fire at his upmarket Harare apartment on 29 November.

His relatives and friends believe his death was not an accident but was a cold-blooded murder.

Chadcombe Armed Robbers Informant Hauled To Court

By A Correspondent- Shine Tanaka Nyamhunga who allegedly provided armed robbers with information in the deadly Chadcombe robbery case has appeared before a Harare magistrate this Saturday charged with armed robbery.

Nyamhunga (21) was remanded in custody by the magistrate to 28 December.

According to Zimbabwe Republic Police (ZRP) national spokesperson Assistant Commissioner Paul Nyathi, Nyamhunga had given his accomplices some information on some cash transactions by a company where he is employed.

Nyathi said Nyamhunga told his accomplices that the money was being kept at his employer’s house in Chadcombe.

He said Nyamhunga was in constant touch with Tariro Gora, a 21-year-old soldier killed in the shootout, with a view of having his employer targeted by the armed robbers.

Armed with the information, the five armed robbers, among them, serving members of the Zimbabwe National Army (ZNA) went to Chadcombe on Monday night.

However, their plan failed to work after the gang attacked the wrong house where three of the alleged robbers were killed in a shootout.

The robbers forcibly entered Joseph Nemaisa’s house, a former CID detective, who shot and killed three of them while two escaped unhurt but were eventually arrested by the police.-statemedia

National Assembly Adjourns Sitting To 2022

By A Correspondent- The National Assembly has adjourned for the year and will resume sitting in February 2022 unless they are summoned by the President.

The Lower House of Parliament adjourned after approving the Finance (2022) Bill and the Appropriation (2022) Bill.

The Finance Bill and the Appropriation Bill will be presented before the Senate which is expected to sit this coming week.

Senate (Upper House of Parliament), had adjourned on the 25th of November. However, not much debate is expected in the Senate as the Government is rushing to conclude the budget before the end of the year.

There are fears that the recent surge in new coronavirus infections may result in the country being put under lockdown.

The Ministry of Health and Child Care announced 4 996 new coronavirus cases on 8 November. New cases rose to 5 189 on 9 November, and on the 10th of November, 6 181 new cases were recorded.

Catholic School Authorities In Bullying Cover-Up Storm

By A Correspondent- A parent was forced to withdraw his child from Sacred Heart Primary School in Esigodini, Matabeleland South, after school authorities allegedly concealed a bullying incident and claimed the victim had tried to commit suicide.

The Grade Four boy was on November 6 taken for treatment at United Bulawayo Hospitals (UBH) where the doctor noted that he had suffered very serious injuries and that severe force was used to inflict them.
The schoolboy is said to have been brutalised by Grade Seven boys as he was on the verge of testifying in an investigation into sexual relations among pupils at the boarding school.
He was allegedly blindfolded, tied, assaulted, tied with a shoelace on the neck and thrown out of a window, an incident that saw him losing consciousness.
The father of the Grade Four pupil, who cannot be named to protect the identity of the minor, said while there is evidence that his son was a victim of bullying, authorities at the Roman Catholic Church-run learning institution covered up the matter.
He said the incident occurred on October 24.
After the incident, the boy’s father was called and informed that his son had attempted to commit suicide.
He said he rushed to the boarding school in Esigodini to find his son with marks on the neck following the alleged strangulation and his eyes red from choking.
The parent said of concern is that while the incident had occurred at about 3PM, with his son falling unconscious for about 10 minutes, the school only informed him two hours later about the case.
The father, however, said upon getting to the school, his son dismissed the claim that he tried to commit suicide.
“What shook me is that I was told that my child had fallen unconscious for about 10 minutes two hours later.
I was called at 5PM and arrived at the school at about 6PM and only to be informed that the incident occurred at 3PM.
It did not make sense why the school would delay informing me about such a worrying case.
“I was shocked when I was told that my child tried to commit suicide.
This occurred as he was supposed to testify the following Monday in a case involving claims that some pupils were having sexual relations.
But that wasn’t to be as he was attacked on Sunday,” said the concerned parent.
He said upon asking his son what could have transpired leading to him to try and take his life, the boy refuted that he wanted to commit suicide.
“When I quizzed him, he said he never tried to commit suicide using shoelaces.
He told me that he was attacked by a group of Grade Seven boys who blindfolded him using socks and took him to a window where one of them pushed him outside. He said his son told him that he tried to call his friend to help him,” he said.
He said upon learning about the circumstances relating to the matter, he engaged the school as he believed that his son was being bullied.
“The school and the Ministry of Primary and Secondary Education promised to carry out investigations and nothing has come out.
I then went to the Ministry’s district offices in Esigodini to meet the District Education Director (DEO).
The DEO was not there and I was advised to write a letter and send it through their email which I did and they saw that letter.
I continued to make follow ups with the DEO and on Monday he told me that he has been consulting and the issue is confidential,” said the parent.
“My concern is that such bullying cases are being swept under the carpet.
I had wanted the Ministry to make an investigation on what is going on. We entrusted our kids to them and we expect them to account because we are in constant contact with them and never at any point, did they raise alarm over my child’s behaviour.”
He said he was worried by the lack of action from both the school and ministry officials.
The parent said the lack of decisive action on the matter forced him to withdraw his son from the school.
The school’s headmistress Mrs Sindi Mpofu could not be reached for comment.
Umzingwane DEO Mr Raxon Phiri referred questions to the Provincial Education Director who was not reachable.
Primary and Secondary Education communication and advocacy director Mr Taungana Ndoro said he had not been briefed about the Sacred Heart incident.
“However, the Ministry’s position is that such issues should be investigated at the district level and resolved amicably.
There is also a need to protect the learner by providing pycho-social services through our district and provincial psychologists to ensure that the learner is of sound mind which is necessary for them to continue wanting to go to school and learn.
“These are the normal process that we take. I had wanted to get the exact details from Matabeleland South officials but I couldn’t get through to them,” said Mr Ndoro.
Incidents of bullying are on the rise in schools and recently police had to be called to quell violence after rivalry gangs started attacking each other at Msiteli High School in Mpopoma suburb. Chronicle

The multi-award winning Winky D made the remarks in his acceptance speech after winning the ONE, Accountability Labs, and Trace Africa sponsored gong that celebrates artists who speak against corruption through music.
Chosen through an online voting system which closed on November 30, Winky D was announced the winner on Thursday when the world commemorated International Anti-Corruption Day.
“I would like to express my sincere gratitude to the organisers Accountability Lab for recognising my project Njema which simply describes the shambles of the true prison that we often ignore,” he said.
“It was not that easy to put up this project since poverty itself is a devices state, representing the truth about it is even more contentious given the varied vested interest and opinions around it.”
“This prison is deep in our mental states as driven by lies, corruption, poverty cowardice and all the other societal ill that you can imagine. These mental shambles continue to limit our dreams, our hopes, our aspirations for a better and more sustainable world.”
He added; “The words in music are a common currency that people can enjoy without worrying about fluctuations. Music is always best when driven by experience rather than hearsay or imagination.”
“Be that as it may, no one can dispute that every human being matters and deserves to be unshackled from the chains, Njema.”
The song Njema is of Winky D’s 2019 album with the same title.

White Employer In Trouble Over The Death Of His 86 Year Old Maid

By A Correspondent- Mr Peter Simon Berry of Vainona in Harare is in trouble by the family of his 86-year-old domestic worker who was found dead in his backyard cabin on Tuesday.

H-Metro reports that, Margaret Muzanago Sibanda, who has been working for the Berry family for 57 years, was reported to have been denied access to health care and ablution facilities as well as payment for years.

She was found dead by the Berrys’ gardener only identified as Simon clad in her uniforms.

In ire, the Muzanago family dumped her belongings in protest against the alleged abuse of Gogo Margaret under the mercy of her white man Paul Simon Berry.
Reports say Gogo Margaret had one child Christopher Muzanago who also worked as a gardener at Berry’sBerry’s house in Vainona.
He died at the same house in 2012.
The late Gogo Margaret is also said to have refused to remove Christopher’sChristopher’s belongings from the room he used to occupy over unpaid salaries.
Berry told H-Metro that he was not in a position to give his side of the story referring questions to one of his relative only identified as Mary.
“”Sorry we are mourning, get in touch with Mary,”” said Berry.
Muzanago family spokesperson Leticia Muzanago, 32, narrated to H-Metro the ill-treatment Gogo Margaret under went as a maid since 1964 when she started working for Berry family.
“”Gogo died a poor person under the roof of a rich family,”” said Muzanago.
“”She passed on wearing her kitchen uniform in a cabin room located between the two better houses belonging to Berry and his son.
“”She started working for the Berry family in 1964 in Gweru and when her first employer who happen to be the present Berry’sBerry’s parents died she was taken to Vainona in Harare in 2008 to work for the son Paul Simon Berry.
“”Gogo had agreed with her employer that she wanted them to keep her salaries till they buy a house for her.
“”Paul promised to pay for a Gweru residential stand three years ago but nothing materialized.
“”She was never taken to medical doctors but had to continue working while sick.
“”I visited her many times and discover that she was no longer had energy to visit a toilet which some meters away from her cabin.
“”She had to do a bucket system till her time of death.
“”When she died they were quick to call a funeral parlour to remove the body without engaging any of us,”” said Muzanago.
When H-Metro visited the house, one Mary was ordering Muzanago to hire a lorry and remove all belongings of Gogo Margaret and that of her late son Christopher Muzanago and take them to their home village in Chirumhanzu.
“”Hire a lorry and collect everything of Margaret and that of her late son,”” said Mary.
In an interview, Mary told H-Metro that Margaret was very lucky to have worked for a caring family who would never do anything against her wishes.
“”Margaret refused to go to the doctor so we always had to organise a house visit which was very costly,”” said Mary.
“”Margaret was well looked after by my partner’spartner’s brother Paul.
“”Paul organised his maid to cook for Margaret every day.
“”I tried to persuade Margaret to move into a room where her late son Christopher used to stay which was close to the toilet and shower in the staff quarters but she refused.
“”In that room there is her double bed which was given to her by Paul’sPaul’s mother and a cupboard which belonged to Christopher.
“”When Paul’sPaul’s mother died she should have gone back to Chilimanzi but she would not go.
“”When I met her about 11 years ago, she would spend all day in the kitchen roasting chicken and boiling water.

Fuel Queues Resurface

By A Correspondent- Fuel queues resurfaced in the capital this week, with a number of service stations not having the commodity, sparking panic buying as the festive season approaches.
A snap survey by NewsDay Weekender revealed that most service stations across Harare had no fuel with petrol being the biggest challenge.
National Oil Company Infrastructure of Zimbabwe board chairperson Daniel Mackenzie Ncube told NewsDay Weekender that fuel shortages were being caused by an unscheduled maintenance exercise at pumping stations in Mozambique.
“We had a problem in Mozambique where they were maintaining the port so they were not pumping,” he said.
But Ncube said there was no need to panic as the situation was expected to return to normalcy in “a day or two”.
“We have started pumping now. The problem should normalise in a day or two. The scheduling in Mozambique caught us offside when they closed the port for maintenance.”
Motorists had begun to panic and reminisced on the days they used to queue for several days on end to access fuel.
“What we were holding was a bit low because of the pricing of petrol, so the dealers tend to sell each time they get fuel. They put it to the market instead of holding some of it,” Ncube added.
“I can’t tell you in terms of numbers, but for a few days we were not pumping but we normally pump around four million a day, but for diesel we were holding stocks, but for petrol our stocks were a bit on the low side and that is why they depleted very quickly.
“We have been massaging the problem since last week hoping that it won’t get this far, but fortunately we are now pumping.”
According to the Zimbabwe Energy Regulatory Authority, petrol consumption in the country declined by 12,53 % in the first three months of this year, compared to the same period last year due to the impact of the COVID-19 pandemic. Newsday

Parliament Closes After MPs Test Positive For Covid

By A Correspondent- Parliament has stopped all physical meetings, switching to virtual, which will include sittings of the National Assembly and Senate, after a number of Parliament staff tested positive to Covid-19 recently.

In a statement, acting Clerk of Parliament Ms Helen Dingane, said all meetings will with immediate effect be held virtually.

“The acting Clerk of Parliament wishes to advise all Honourable Members of Parliament that today 9 December 2021, there will be no physical presence in the Chamber. All members must connect virtually. No one will be allowed into the building. Please continue to mask up and sanitise and social distance,” said Ms Dingane.

On Wednesday, acting Speaker Mr Martin Khumalo had indicated that a decision was imminent on how to respond to the ever rising figures of staff of Parliament and legislators who had tested positive to the disease.
This was after legislators led by Norton Member of Parliament Mr Temba Mliswa called upon Parliament to adjourn the House arguing that from his enquiries at least half of staff at Parliament had tested positive.
The issue drew a lot of debate with some legislators rallying behind Mr Mliswa while others said there was no statistics that Mr Mliswa had brought forward to support his assertions.

Debate eventually resumed as portfolio committee chairperson presented their reports of Ministries they shadow.
The portfolio committee on Information, Publicity and Broadcasting Services bemoaned poor funding to the digitalisation programme.
Its chairperson and Matabeleland South Proportional Representative MP Ms Sipho Mokone (MDC-T) said the huge discrepancy between the requested funds and the allocated funds will significantly hamper the progress of the digitalisation project.
“Currently, the revised target for completion of the project is 2023, and this milestone will be impossible to achieve without adequate funding. The committee notes with concern that the project is moving at a slow pace and the committee calls for early disbursements of funds, if approved, to minimise exchange losses,” said Ms Mokone.
“The slow pace of implementation of the ZimDigital project leads to violation of Sections 61 and 62 of the Constitution which calls for freedom of expression and freedom of the media and access to information.”
The Lands and Agriculture committee also noted that the use of International Monetary Fund Special Drawing Rights in establishing an Export Revolving Fund was noble.

“The Committee also appreciates that part of the SDR from the IMF will be used in the agriculture sector. The establishment of an export revolving fund for agriculture targeting floriculture, blueberries, and macadamia, which is to be financed to the tune of US$30 million from the SDR funds is noted.
However, given the current challenges with respect to repayment of loans, it is critical to ensure that safeguards are in place so that the facility becomes a revolving fund with those benefiting repaying so that other farmers can also benefit,” said committee chairperson and Gokwe Nembudziya MP Justice Mayor Wadyajena.

By A Correspondent- The wife to Decent Rimbi of Rimbi Travel and Tours was yesterday dragged to court after she reportedly conspired and formed a gang to rob a woman she suspected to be having an affair with her husband.

Everjoice Rimbi, 40, who is also the co-director of the bus company, was not asked to plead when she appeared before Harare magistrate Barbra Mateko.

She appeared together with her alleged accomplices Pamela Mutanhairi, Melissa Muzuva, Washington Njengwe, Richard Chikwaya, Givemore Mazerenganwa, Tafadzwa Mazerenganwa and Brighton Chiteka.

Rimbi and Mutanhairi were released on free bail as they were coming from home while the rest were ordered to pay $20 000 as bail.

The court heard that between August and November, Rimbi discovered some text messages between her husband and a female employee Nomalanga Thodlana which suggested that he had a soft spot for her and she suspected that they were in a secret affair.
Rimbi reportedly then engaged Muzuva through Mutanhairi after getting her contacts in a Whatsapp group and asked them to mobilise a gang that would harass Thodlana whom she wanted to resign voluntarily after the mission.
An initial payment of US$150 was paid to the gang and on December 7, an unknown person went to Decent Rimbi and advised him of the planned robbery and how it was going to be done and he alerted CID Homicide detectives who waylaid the gang.
The gang armed with machetes went to the garage in New Ardbennie to commit the offence but were intercepted and arrested before executing the mission and they implicated Rimbi, Mutanhairi and Muzuva to have hired them to rob and harass Thodhlana.

Footbridge Saves Nyanga Community As Rainy Season Kicks Off

An estimated 400 households in Nyanga, including schoolchildren, are set to benefit from the recently constructed Nyabombwe footbridge as students were failing to access their schools during the rainy season.

The Nyabombwe footbridge was swept away by Cyclone Idai in 2019.

The Nyautare community and Simukai Child Protection programme in partnership with Nyanga Rural District Council, with the support of ActionAid Zimbabwe (AAZ), has completed the construction of the footbridge, putting to rest fears of the community before the rains.

“I am greatly honoured to be part of this project, being here to witness what was done by the community, our partner and the local authority and support from my office,” ActionAid Zimbabwe country director Joy Mabenje said.

The Nyabombwe footbridge connects four villages with the primary and secondary schools.

AAZ provided US$6 000 to finance the project.“Nyanga Rural District Council provided machinery, equipment, skilled labour and engineering expertise and also designed the structure, ” he said

“The Nyautare community contributed in different forms with Nyautare Primary School providing electricity that was used to join the steel base of the bridge and offered accommodation.”

Tendai Mangenda who led a local committee on the construction of the bridge said: “It was so painful because parents  go with their children to school every morning so they would help them to cross the footbridge and take them after school especially young kids.”

Ward 8 councillor Ezeria Masamvù was applauded for playing a key role in the building of the footbridge.

Zanu PF Nyanga North MP Chido Saunyatwe was represented at the event.

State Media Says ZIFA Boss Is Against National Interest

The state media on Saturday used political jargon to criticise Zifa president Felton Kamambo and his committee member Philimon Machana

The state owned Chronicle said the two have decided “to go against national interest after publicly threatening Zifa secretariat and Warriors coach Norman Mapeza.”

The paper did not elaborate or clarify what it means by National Interest. It has for weeks to date been claimed that ZANU PF politicians are after snatching away the ZIFA leadership post

The Sports and Recreation Commission which banned them is led by Emmerson Mnangagwa’s son in law, Gerald Mlotshwa. The development comes at a time when the latter was accused of having ulterior motives against Kamambo.

The report continued stating:

The duo, despite having issued a statement this week to finally accept a Sports and Recreation Commission ban, said anyone who has entered into a contractual relationship with Zifa in the absence or without express authority of the legitimate Zifa board is doing so at their own risk and that Zifa will not honour any obligations arising out of such agreements even if such are on Zifa letterhead or purportedly signed by any member of the Zifa secretariat but without express Zifa board authority.

Despite the rest of the board members having long back stepped aside and accepted the SRC suspension order, the duo that clearly still consider themselves as the Zifa board also said the ‘board’ has not appointed any national team coach nor acting general secretary (chief executive officer).

Zifa secretariat, in consultation with the country’s sports regulating body, SRC, on Thursday appointed Mapeza as Warriors coach who will lead the national team at the Afcon finals in Cameroon early next year.

“The Board has learnt through various media articles that contain decisions that are a preserve of the Zifa board and being taken on behalf of Zifa. The Zifa board would want to inform all stakeholders that any such decisions, contracts or agreements reached under the auspicies of Zifa are null and void ab unitio and therefore of no legal effect.

The Zifa board advises stakeholders that anyone who goes into contractual relationship with Zifa in the absence or without express authority of the legitimate Zifa board is doing so at their own risk and that Zifa will not honor any obligations arising out of such agreements even if such are on Zifa letterhead or purportedly signed by any member of the Zifa secretariat but without express Zifa board authority.

Of particular note is that the Zifa board has not appointed any national team coach neither has it appointed any acting general secretary,” read the duo’s press release yesterday.

They said anyone entering into any agreements purportedly with Zifa but without express authority of the board to be careful of the risks which such may carry “in terms of Fifa statutes,” which however they did not bother to mention explicitly.

“We urge all stakeholders to be very careful on the agreements they might think they are entering with Zifa and the risks such may carry in terms of Fifa statutes. We urge these to demand to sign whatever contacts with the real institutions they are contracting in this case the SRC, with to safeguard their interests in case of defaults. The Zifa board also notes that SRC board has illegally usurped the Zifa board powers by clandestinely assuming the role of an interim committee and such is totally against Fifa and Zifa statutes,” reads the statement.

Meanwhile, the SRC may view such threats by the duo as a direct contravention of Article 30(1)(c) of the SRC Act which prohibits persons or associations from going against national insterest especially as it threatens Zimbabwe’s smooth preparations for the Afcon finals.

Reads the Act;

“(1) Where the Board considers that any registered national association—: conducted itself in a manner which is contrary to national interest; the Board may, after affording the association concerned an opportunity of making representations in the matter, do either or both of the following–, I. suspend all or II. any of its officers.”

While Kamambo and Machana are officially suspended, the fact that they used the Zifa letterhead may attract the attention of the SRC.

ZIFA Heavyweights Clash Over Mapeza Appointment

THE suspended Felton Kamambo-led Zifa board has threatened Norman Mapeza with unspecified action if he accepts his appointment as Warriors coach by the Zifa secretariat. His appointment was announced on Thursday by Zifa acting CEO Xolisani Gwesela with the blessing of the Sports and Recreation Commission (SRC).

This came hardly a day after the board had indicated that it would be taking a back seat to avoid any confrontation with the SRC, but yesterday it acted otherwise.

In a statement, the suspended Zifa board also questioned Gwesela’s appointment as acting chief executive officer, arguing the appointment was not binding.

The Zifa board says the SRC cannot continue to make decisions on their behalf.

The SRC suspended the entire Zifa board on November 16 for alleged financial impropriety.

The statement read: “The Zifa board advises stakeholders that anyone who goes into contractual relationship with Zifa in the absence or without express authority of the legitimate Zifa board was doing so at its own risk and that Zifa will not honour any obligations arising out of such agreements even if such are on Zifa letterhead or purportedly signed by any member of the Zifa secretariat, but without express Zifa board authority. Of particular note is the fact that the Zifa board has not appointed any national team coach nor has it appointed any acting general secretary.”

The suspended board, which still holds the SRC in disdain, added: “The board has learnt through various media articles that certain decisions that are a preserve of the Zifa board are being taken on behalf of Zifa. We urge all stakeholders to be very careful on the agreements they may think they are entering with Zifa and the risk such may carry in terms of Fifa statutes,” the statement read.

“We urge these (Mapeza and Gwesela) to demand that they sign whatever contracts with the real institution they are contracting, which in this case is the SRC, to safeguard and enforce their interests in cases of defaults.

Obey Sithole: I Have No Links At All With Gunned Down Robbers

MDC Alliance National Youth Chairperson Obey Sithole has reacted to social media claims that he has links with one of the suspected armed robbers gunned down by detective-turned-lawyer, Joseph Nemaisa early this week.

Following the widely publicised report of a former Central Investigations Department officer Nemaisa gunning down three robbers who broke into the house, Sithole posted on social media that he knew one of the deceased.

Speaking to ZimEye, Sithole said he only got to know Chirara through his brother whom he spend time with at Harare Remand Prison during his incaceration.

“Stop misleading the nation, it is not true that he was my friend. His elder brother was my prison cell mate in the D – Section of Harare Remand prison and during my stay there, the deceased came to visit at least four times a week. That is how I knew him and that doesn’t make him a friend,” wrote Sithole.

“He would visit at least 4 days a week and that was also at the time when I was in incarceration on trumped up political charges,” said Sithole.

He added that he still had the courage to speak out against the regime and was not afraid to die for a worthy cause.

“We know the regime is so mischievous, they always want to divert people from the real problems we are facing. We shall continue to fight for a better Zimbabwe, a Zimbabwe which respects our millitary personnel well so that they are not involved in armed robbery cases. We are not afraid to die for this,” he added.

Another Warriors Star Pulls Out Of AFCON Tournament

The Warriors squad for the coming Afcon 2021 continues to weaken after Tendayi Darikwa became the latest key player to withdraw.

The Wigan Athletic captain was named in the forty-man preliminary team for the tournament registered at CAF last month.

ZIFA, through Warriors team manager Wellington Mpandare, sent a letter to both the player and his club informing them about the selection.

But the 29-year old has revealed to Mpandare that he is not coming for the games due to what he called “personal reasons”.

“Yes, Tendayi (Darikwa) was among the forty players I sent invitations to their clubs requesting for their clearances ahead of the Afcon finals,” the team manager told H-Metro.

“I do not only send invitations to clubs, but also the players, and he told me that he is not available for the Cameroon showdown.

“He said he is excusing himself for personal reasons.”

Darikwa also excused himself from the final two games in the World Cup Qualifiers, and there was talk that he is considering his future with the Warriors.

Other key players unavailable for the tournament include Khama Billiat, Marshall Munetsi and Brendan Galloway.

Billiat quit international football last month over frustrations with the national team, while Galloway and Munetsi suffered injuries that will sideline them for months.

According to the party, an official calendar shall be released in due course via appropriate channels.

Zanu PF confiscated Masvingo Rural District Ward 16 Government Agricultural Inputs from GMB sidelining the elected Councillor Edmore Demba.

When Clr Demba approached GMB to collect the ward’s allocation he was told that ZanuPF ward 16 had already taken the inputs.

“How can GMB give inputs to unelected officials ? GMB is a government institute which must act above political lines.This all shows that GMB is acting in a partisan distribution of inputs.If MDC Alliance leaders were to go to GMB were they to give them the inputs?” fumed Clr Demba.

ZanuPF’s Samuel Tranos Zambuko, Last Jazi, Tranos Mahuni and Elias Mutema were the ringleaders in this partisan confiscation and distribution of inputs.

ZanuPF has tried all tricks in the book to frustrate MDC Alliance elected Councillor Edmore Demba but the more they do so the popularity he gains.

ZanuPF leaders were shocked last week at Muchemwa Primary school after distributing the inputs , hundreds of supporters chanted slogans in praise of Clr Demba and MDC Alliance President Nelson Chamisa.

Concern Over Cellphone Levy

By A Correspondent- Mashonaland East Provincial Education Director (PED), Anatoria Ncube says the US$50 cellphone levy announced by the Minister of Finance and Economic Development Mthuli Ncube will have a negative impact on the education sector.

Presenting the 2022 National Budget Statement in Parliament last month, Mthuli Ncube proposed the introduction of the US$50 duty on cellphones.

He said the tax will be refunded within 30 days if import duty had been paid on the cellphone when it was imported.

This comes as online learning has gradually been taking centre stage since the emergence of the novel coronavirus which forced schools to shut down a few times since early 2020.

Speaking during an interview with The Mirror, PED Ncube said rural parents are not going to afford the gadgets needed for their children’s education.

She said:

The levy will have a gross and negative impact on the rural people who are the majority of our population.

Parents will not afford these gadgets and this will negatively impact rural education.

… We are trying to digitalise as a nation, E-learning is becoming popular in schools and boom we introduce new taxes on gadgets.

Amalgamated Rural Teachers Union of Zimbabwe (ARTUZ) president, Obert Masararure said that the cellphone levy if implemented, will cripple education.

The combative unionist implored the Government to scrap the levy as Zimbabwe was lagging far behind other countries in terms of digitalisation.

Facts About Omicron Variant

On 26 November 2021, WHO designated the variant B.1.1.529 a variant of concern, named Omicron, on the advice of WHO’s Technical Advisory Group on Virus Evolution (TAG-VE). This decision was based on the evidence presented to the TAG-VE that Omicron has several mutations that may have an impact on how it behaves, for example, on how easily it spreads or the severity of illness it causes. Here is a summary of what is currently known.

Current knowledge about Omicron

Researchers in South Africa and around the world are conducting studies to better understand many aspects of Omicron and will continue to share the findings of these studies as they become available.

Transmissibility: It is not yet clear whether Omicron is more transmissible (e.g., more easily spread from person to person) compared to other variants, including Delta. The number of people testing positive has risen in areas of South Africa affected by this variant, but epidemiologic studies are underway to understand if it is because of Omicron or other factors.

Severity of disease: It is not yet clear whether infection with Omicron causes more severe disease compared to infections with other variants, including Delta. Preliminary data suggests that there are increasing rates of hospitalization in South Africa, but this may be due to increasing overall numbers of people becoming infected, rather than a result of specific infection with Omicron. There is currently no information to suggest that symptoms associated with Omicron are different from those from other variants. Initial reported infections were among university students—younger individuals who tend to have more mild disease—but understanding the level of severity of the Omicron variant will take days to several weeks. All variants of COVID-19, including the Delta variant that is dominant worldwide, can cause severe disease or death, in particular for the most vulnerable people, and thus prevention is always key.

Effectiveness of prior SARS-CoV-2 infection

Preliminary evidence suggests there may be an increased risk of reinfection with Omicron (ie, people who have previously had COVID-19 could become reinfected more easily with Omicron), as compared to other variants of concern, but information is limited. More information on this will become available in the coming days and weeks.

Effectiveness of vaccines: WHO is working with technical partners to understand the potential impact of this variant on our existing countermeasures, including vaccines. Vaccines remain critical to reducing severe disease and death, including against the dominant circulating variant, Delta. Current vaccines remain effective against severe disease and death.

Effectiveness of current tests: The widely used PCR tests continue to detect infection, including infection with Omicron, as we have seen with other variants as well. Studies are ongoing to determine whether there is any impact on other types of tests, including rapid antigen detection tests.

Effectiveness of current treatments: Corticosteroids and IL6 Receptor Blockers will still be effective for managing patients with severe COVID-19. Other treatments will be assessed to see if they are still as effective given the changes to parts of the virus in the Omicron variant.

Studies underway

At the present time, WHO is coordinating with a large number of researchers around the world to better understand Omicron. Studies currently underway or underway shortly include assessments of transmissibility, severity of infection (including symptoms), performance of vaccines and diagnostic tests, and effectiveness of treatments.

WHO encourages countries to contribute the collection and sharing of hospitalized patient data through the WHO COVID-19 Clinical Data Platform to rapidly describe clinical characteristics and patient outcomes.

More information will emerge in the coming days and weeks. WHO’s TAG-VE will continue to monitor and evaluate the data as it becomes available and assess how mutations in Omicron alter the behaviour of the virus.

Recommended actions for countries

As Omicron has been designated a Variant of Concern, there are several actions WHO recommends countries to undertake, including enhancing surveillance and sequencing of cases; sharing genome sequences on publicly available databases, such as GISAID; reporting initial cases or clusters to WHO; performing field investigations and laboratory assessments to better understand if Omicron has different transmission or disease characteristics, or impacts effectiveness of vaccines, therapeutics, diagnostics or public health and social measures. Countries should continue to implement the effective public health measures to reduce COVID-19 circulation overall, using a risk analysis and science-based approach. They should increase some public health and medical capacities to manage an increase in cases. WHO is providing countries with support and guidance for both readiness and response.

In addition, it is vitally important that inequities in access to COVID-19 vaccines are urgently addressed to ensure that vulnerable groups everywhere, including health workers and older persons, receive their first and second doses, alongside equitable access to treatment and diagnostics.

Recommended actions for people

The most effective steps individuals can take to reduce the spread of the COVID-19 virus is to keep a physical distance of at least 1 metre from others; wear a well-fitting mask; open windows to improve ventilation; avoid poorly ventilated or crowded spaces; keep hands clean; cough or sneeze into a bent elbow or tissue; and get vaccinated when it’s their turn.

WHO will continue to provide updates as more information becomes available, including following meetings of the TAG-VE. In addition, information will be available on WHO’s digital and social media platforms. –

COVID-19 Hits Bulawayo Hospital

NINETEEN nurses, who work in the same ward at the United Bulawayo Hospital (UBH), tested positive for COVID-19 after admitting several patients infected by the virus.

Bulawayo provincial medical director Maphios Siamuchembu said the hospital was still to ascertain which COVID-19 variant infected the nurses.

The new Omicron variant of COVID-19 was discovered in South Africa and Botswana recently.
“About 19 members of staff tested positive at UBH. We are doing the standard antigen COVID-19 tests, and we haven’t done genetic sequencing to identify the Omicron variant.

“In short we are not sure which variant we are dealing with,” Siamuchembu said.

“All people are screened and sanitised at the hospital entrance.

“All admitted patients are sent to Arundel COVID-19 hospital, while all symptomatic staff members are tested.

Top Cop Arrested For Stealing Fines

By A Correspondent- Former Marange Police Station’s officer-in-charge, Francis Ruzungunde, has been hauled before the courts on allegations of stealing US$14 330 paid by offenders as fines.

The varying amounts which were captured in the receipt books were not banked since 2018, and the missing money was only detected this year during a hand-over take-over exercise with a new boss at the station.

Ruzungunde (49) who is now stationed in Nyanga appeared before Ms Perseverance Makala facing theft charges.

He was granted $10 000 bail, and the case goes for trial on January 5 next year.
Mr Farai Matinhure of Gonese and Ndlovu Legal Practitioners represented Ruzungunde, while Ms Sharon Chibvongodze prosecuted.
The court heard that on May 27, the informant, Inspector Easter Muruko, was transferred from Nyanga District to ZRP Marange as Officer-In-Charge, while the accused was transferred to ZRP Nyanga District Headquarters.
“On June 1 to 3, the two conducted station hand-over take-over procedures under the supervision of the Manicaland Provincial Quartermaster, Chief Inspector Chimanyiwa.
During the process, the informant discovered that receipt books were filed in the General Record Book, but were not available for checking. Inspector Muruko asked Assistant Inspector Mugari who was in charge of administration, and was told that the books in question were not filed as indicated in the General Record Book.
He further revealed that the books were at his home where he was compiling charge sheets as per Ruzungunde’s instructions.
Inspector Muruko requested to see the books and they were given to her after several requests.
“That is when she discovered that cash amounting to US$14 330 had been receipted but could not be accounted for. She then notified the Officer Commanding Mutare Rural District of the discrepancy,” said Ms Chibvongodze.
On December 6, the case was referred to CID Mutare for further investigations.
It was revealed that the accused person had converted the US$14 330 to his own use. Manica Post

Aunt In Court For Forcing Minors To Eat Their Waste

By A Correspondent- A Penhalonga woman has been arrested for reportedly forcing her sister’s two children aged five and 11 to relieve themselves in a tin and eat their waste.

The children’s mother, who is based in South Africa, left the children in Zvevamwe’s custody.
She pleaded guilty to charges of ill-treatment or neglecting children as defined in Section 7 (3) of the Children Protection Act when she appeared before Mutare magistrate, Ms Prisca Manhibi.
She was remanded in custody to December 30 for sentencing.
Prosecuting, Ms Tafadzwa Chiwanza said on an unknown day in November, the accused ordered the complaints to relieve themselves in a tin and eat their waste as she watched.
“She threatened to kill the children if they disobeyed her orders. On another day, Zvevamwe used plastic to burn one of the complaints on her back, stomach and hands.
“She would also pull their tongues using a pair of pliers as punishment,” said Ms Chiwanza.
The court heard that the accused would also assault the children with a whip and cooking stick.
The abuse the children suffered at the hands of their aunt only came to light on November 30 through an anonymous tip-off.
Police in Penhalonga and some child protection organisations reacted to the tip-off and went to Zvevamwe’s residence to investigate the matter.
Their findings led to her immediate arrest. The children were medically examined and taken to Simukai Child Protection Programme where they are being offered safe shelter.
Child abuse includes all types of physical, emotional and sexual abuse, or negligence which results in harm to the child’s health, development or dignity.

Robbers Pounce On Mine, Steal 130Kgs Of Gold Ore

By Are Correspondent- Armed robbers pounced on Atlas 16 Gold Mine in the early hours of Wednesday 8 December and got away with 130kgs of pregnant gold carbon worth about US$62 000.

In the gold industry, activated carbon is used to recover gold from the gold-cyanide complex also known as the cyanide process. It is a technique for extracting gold from low-grade ore by converting the gold to a water-soluble coordination complex.

The Zimbabwe Republic Police (ZRP) say the robbers were armed with knives and iron bars. Pindula News presents a police statement on the case:
The ZRP is investigating a case of robbery which occurred at Atlas 16 Gold, Mine on 08/12/21 at about 0300 hrs. Eight unknown suspects who were armed with knives and iron bars attacked two security guards who were on duty at the mine and tied them with barbed wire before proceeding to the gold carbon room where they stole 130 kgs of pregnant gold carbon worth approximately US$62 000.

ZRP officers are also investigating another robbery case in which a truck driver was robbed after a breakdown. Police said:

Chamisa Armoured Car Arrival Imminent

By A Correspondent- As of Friday 10 December 2021, US$121 555 000 had been raised towards buying an armoured car for opposition MDC Alliance leader, Nelson Chamisa.This is against a set target of US$120 000.

The organiser of the gofundme initiative, T Basvi, says the drive to buy Chamisa an armoured vehicle was triggered by “countless merciless attacks (on Chamisa) by the ruling party, aided by the government security sector.”

He cites an attack on Chamisa’s convoy on the 11th of October 2021 by a group of suspected ZANU PF youths as evidence that Chamisa’s life was in danger.

The attack left Chamisa’s vehicles damaged and many of his aides seriously injured and hospitalized. The convoy was on its way to engaging the rural community in Masvingo to understand their issues in the aftermath of the pandemic’s 3rd wave. 

Basvi believes chances that violence will intensify during the 2023 elections are high hence the need to beef up Chamisa’s security before any unfortunate eventuality occurs. Basvi added:

As concerned global citizens, we have come up with this initiative to raise funds for the purchase of an amour plated vehicle as well as security apparel for his safety and security.

He also said it was clear that the regime wants to continue to frustrate democracy by attacking the main opposition.

Siamuchembu said Bulawayo had been hit by the COVID fourth wave and urged people to get vaccinated.
“The number of COVID-19 cases is increasing in Bulawayo. We are effectively in the fourth wave. Vaccination is the number one tool we have to fight the pandemic,” he said.
“We should continue exercising hand hygiene, physical distancing and masking up properly. Residents need to be wary of people coming from outside the country.
“They should make sure such people are coming from the appropriate quarantine or isolation centres.
“If you are symptomatic please go to the nearest health facility for testing and treatment.”
Several institutions, including Parliament, the courts, schools and non-governmental organisations were forced to close after they recorded a surge in COVID-19 infections.

Mliswa Accuses Fellow MPs For Spreading Covid-19 In Parliament

By A Correspondent- Norton Member of Parliament, Temba Mliswa who tested positive for Covid-19, Thursday, said fellow MPs were responsible for spreading the pandemic in the house of assembly.

The candid and out-spoken independent law-maker announced this through his ever-busy Twitter handled Wednesday evening.

Mliswa said he had immediately self-isolated as a responsible way of curbing the spread of the deadly pandemic.

“1/ Dear Colleagues, Honourable MPs, Parliament staff, Norton constituency and friends. Just to let you know that despite taking all precautions and testing negative on both Monday at Norton Hospital and Tuesday at Parly, I have just tested positive for Covid-19,” he posted.

Mliswa blamed fellow parliamentarians for promoting the spread of the pandemic after they contradicted him Tuesday when he suggested that they should all go on self-isolation because some parliament staff had tested positive for covid.

“This was exactly my point yesterday, I think I should be known as Prophet Mliswa forthwith. Forewarned is forearmed and disclosure is critical in mitigating the spread of the virus. It’s sad Togarepi couldn’t comprehend this point. For now my symptoms are mild, and I’ll rest,” he said.

86 Year Old Maid Found Dead At Employer’s Back-Yard

By A Correspondent- An 86-year-old Vainona domestic worker was found dead in her employer’semployer’s backyard cabin on Tuesday.

Margaret Muzanago Sibanda, who has been working for the Berry family for 57 years, was reported to have been denied access to health care and ablution facilities as well as payment for years.

She was found dead by the Berrys’Berrys’ gardener only identified as Simon clad in her uniforms.

In ire, the Muzanago family dumped her belongings in protest against the alleged abuse of Gogo Margaret under the mercy of her white man Paul Simon Berry.
Reports say Gogo Margaret had one child Christopher Muzanago who also worked as a gardener at Berry’sBerry’s house in Vainona.
He died at the same house in 2012.
The late Gogo Margaret is also said to have refused to remove Christopher’sChristopher’s belongings from the room he used to occupy over unpaid salaries.
Berry told H-Metro that he was not in a position to give his side of the story referring questions to one of his relative only identified as Mary.
“”Sorry we are mourning, get in touch with Mary,”” said Berry.
Muzanago family spokesperson Leticia Muzanago, 32, narrated to H-Metro the ill-treatment Gogo Margaret under went as a maid since 1964 when she started working for Berry family.
“”Gogo died a poor person under the roof of a rich family,”” said Muzanago.
“”She passed on wearing her kitchen uniform in a cabin room located between the two better houses belonging to Berry and his son.
“”She started working for the Berry family in 1964 in Gweru and when her first employer who happen to be the present Berry’sBerry’s parents died she was taken to Vainona in Harare in 2008 to work for the son Paul Simon Berry.
“”Gogo had agreed with her employer that she wanted them to keep her salaries till they buy a house for her.
“”Paul promised to pay for a Gweru residential stand three years ago but nothing materialized.
“”She was never taken to medical doctors but had to continue working while sick.
“”I visited her many times and discover that she was no longer had energy to visit a toilet which some meters away from her cabin.

In an interview, Mary told H-Metro that Margaret was very lucky to have worked for a caring family who would never do anything against her wishes.
“”Margaret refused to go to the doctor so we always had to organise a house visit which was very costly,”” said Mary.
“”Margaret was well looked after by my partner’spartner’s brother Paul.
“”Paul organised his maid to cook for Margaret every day.
“”I tried to persuade Margaret to move into a room where her late son Christopher used to stay which was close to the toilet and shower in the staff quarters but she refused.
“”In that room there is her double bed which was given to her by Paul’sPaul’s mother and a cupboard which belonged to Christopher.
“”When Paul’sPaul’s mother died she should have gone back to Chilimanzi but she would not go.
“”When I met her about 11 years ago, she would spend all day in the kitchen roasting chicken and boiling water.
“”The kitchen is tiny and there was no space for anyone else! I ended up persuading Peter to buy a small stove which we put in the cottage.
“”However thanks to Covid Margaret was told to stay in her cottage,”” said Mary refusing to answer on salaries issue.

Warriors team manager Wellington Mpandare says the process to persuade Khama Billiat to bounce back into the national team fold for next month’s AFCON finals is work in progress.

Effectiveness of current tests: The widely used PCR tests continue to detect infection, including infection with Omicron, as we have seen with other variants as well. Studies are ongoing to determine whether there is any impact on other types of tests, including rapid antigen detection tests.

Effectiveness of current treatments: Corticosteroids and IL6 Receptor Blockers will still be effective for managing patients with severe COVID-19. Other treatments will be assessed to see if they are still as effective given the changes to parts of the virus in the Omicron variant.

Studies underway

At the present time, WHO is coordinating with a large number of researchers around the world to better understand Omicron. Studies currently underway or underway shortly include assessments of transmissibility, severity of infection (including symptoms), performance of vaccines and diagnostic tests, and effectiveness of treatments.

WHO encourages countries to contribute the collection and sharing of hospitalized patient data through the WHO COVID-19 Clinical Data Platform to rapidly describe clinical characteristics and patient outcomes.

More information will emerge in the coming days and weeks. WHO’s TAG-VE will continue to monitor and evaluate the data as it becomes available and assess how mutations in Omicron alter the behaviour of the virus.

Recommended actions for countries

As Omicron has been designated a Variant of Concern, there are several actions WHO recommends countries to undertake, including enhancing surveillance and sequencing of cases; sharing genome sequences on publicly available databases, such as GISAID; reporting initial cases or clusters to WHO; performing field investigations and laboratory assessments to better understand if Omicron has different transmission or disease characteristics, or impacts effectiveness of vaccines, therapeutics, diagnostics or public health and social measures. More detail in the announcement from 26 November.

Countries should continue to implement the effective public health measures to reduce COVID-19 circulation overall, using a risk analysis and science-based approach. They should increase some public health and medical capacities to manage an increase in cases. WHO is providing countries with support and guidance for both readiness and response.

In addition, it is vitally important that inequities in access to COVID-19 vaccines are urgently addressed to ensure that vulnerable groups everywhere, including health workers and older persons, receive their first and second doses, alongside equitable access to treatment and diagnostics.

Recommended actions for people

The most effective steps individuals can take to reduce the spread of the COVID-19 virus is to keep a physical distance of at least 1 metre from others; wear a well-fitting mask; open windows to improve ventilation; avoid poorly ventilated or crowded spaces; keep hands clean; cough or sneeze into a bent elbow or tissue; and get vaccinated when it’s their turn.

WHO will continue to provide updates as more information becomes available, including following meetings of the TAG-VE. In addition, information will be available on WHO’s digital and social media platforms. –

Duo Nabbed In India Over Drugs

By A Correspondent- Two Zimbabwean nationals have been arrested at Mumbai’s Chhatrapati Shivaji International Airport, India for possession of a large consignment of drugs. 

According to officials, the Airport Intelligence Unit (AIU) took this action on the input of The Directorate of Revenue Intelligence (DRI).

The drug consignment, of 35kg of heroin, is said to be worth around US$32 million (Rs 247 crore.) 

This is the first case of seizure of such a large quantity of drug consignments at the airport so far. The two arrested Zimbabwean nationals have been identified as 46-year-old woman and a 27-year-old male passenger.

Both have been taken into custody by the Airport Intelligence Unit.

Both the foreign nationals had left Harare in Zimbabwe and had arrived in Mumbai after receiving the consignment at Addis Ababa. The case has been handed over to AIU by DRI.

The identity of the duo has not been disclosed.

Zanu PF Seizes Farming Inputs

Zanu PF confiscated Masvingo Rural District Ward 16 Government Agricultural Inputs from GMB sidelining the elected Councillor Edmore Demba.

When Clr Demba approached GMB to collect the ward’s allocation he was told that ZanuPF ward 16 had already taken the inputs.

“How can GMB give inputs to unelected officials ? GMB is a government institute which must act above political lines.This all shows that GMB is acting in a partisan distribution of inputs.If MDC Alliance leaders were to go to GMB were they to give them the inputs?” fumed Clr Demba.

ZanuPF’s Samuel Tranos Zambuko, Last Jazi, Tranos Mahuni and Elias Mutema were the ringleaders in this partisan confiscation and distribution of inputs.

ZanuPF has tried all tricks in the book to frustrate MDC Alliance elected Councillor Edmore Demba but the more they do so the popularity he gains.

ZanuPF leaders were shocked last week at Muchemwa Primary school after distributing the inputs , hundreds of supporters chanted slogans in praise of Clr Demba and MDC Alliance President Nelson Chamisa.

Digital Evidence Is Vital To Solve Munatsi’s Death

By Engineer Jacob Kudzayi Mutisi- The grief from an unexpected death may be even more difficult to deal with than loss from a disease because there is always a question “WHY” ,there is always a third party.

It is important for people to understand that gradually in your own time, you can begin to find some solace with what has happened. In these situations such as sudden death/ unexpected death, it is important to understand that we have a legal system, not necessarily a justice system.

May Douglas Tawanda Munatsi’s soul rest in eternal peace. While we wait for our law enforcement to complete their investigations on the death of Douglas, there are more questions than answers and most of the answers are in the technology that existed around him.

In this age of technology there is nothing like, “A perfect murder” anymore, if he was indeed murdered, the individual or individuals will definitely be caught. Technology might not be able to stop a crime from taking place, but it has significantly increased the probability that law breakers will be caught and be punished. Technology has changed everything including crimes and the way police investigate crimes is no exception. Therefore,they should build a war chest of digital evidence and recreate what led to the death of Zimbabwe’s top banker.

Internationally digital evidence touches all investigations and in Zimbabwe there is now a growing emphasis on such evidence which is mostly handled by the Zimbabwe Republic Police (ZRP) cyber lab.

Douglas was staying  at one of the most expensive apartments. The average price for his type of apartment is over  one million dollars, which has one of the best security setup which includes CCTVs, security guards who record who comes and goes. Above that this is a block of apartments which is directly opposite the home of the President of Zimbabwe which is heavily guarded by our heavily armed soldiers.

In this case the CCTV footage is only going to be useful in this death case.  It is going to be relevant for this case as it captures who came to the apartment and who left indicating the time of entry and time of exit.

Other technological solutions like mobile phone records and social media tended to are more often effective in solving homicides. Doug’s Smartphone site analysis is vital as it places where he was and who he was with at the time of his death.

Just like any other evidence, investigators to have probable cause and a search warrant to search and seize smartphones, computers, tablets, and other devices. Our smartphones are always with us, so if the investigator can get hold of doug’s smartphone that is usually the treasure trove of evidence that is needed to solve this case.

In crime, Social media also plays a role in many cases. The fact that people are using their smart phones to take photos and they post or send those out to family members helps to solve the identity of individuals who were with the individual.

That is where our detectives really have to go through and comb through social media platforms phone evidence. Surveillance evidence and the technology really ended up linking other people to the crime that were either there or involved.

Just because our smart devices are providing evidence in criminal investigations, does not mean that such evidence will be admissible in Zimbabwe’s court. Just as with many of our modern scientific evidentiary milestones, from DNA evidence, to ballistics, to handwriting exemplars, the evidence as we included in the newly signed Cyber Security and Data Protection Bill to be admissible.

Digital evidence is not just creeping into criminal investigations. It is already making an impact in civil suits, Zimbabweans are reporting social media abuse and physical abuse using their digital evidence. 

Are Zimbabwe’s Courts Ready for digital evidence? Courts are likely to struggle with the increase in digital evidence, at least initially. How are they going to store it and where? Is it secure and who will secure it.

There is a lot of controversy now about collecting data from personal devices of individuals or even the company-enabled devices which is included in the new Cyber Security and Data Protection Bill. There is more and more data, more privacy concerns, collections concerns, possession, custody, and control concerns.

Using the digital evidence collected for today’s Internet of Things (IOT) which includes his CCTV, smartphone, social media communications and smart car the law enforcement agencies will be able to put together how Douglas Tawanda Munatsi lost his life. Technology has become part and parcel of today and future investigations.

Crisis Coalition Concerned Over The Continued Clampdown On Civil Society Actors

Crisis in Zimbabwe Coalition notes with concern the latest unfounded and misleading claims by the government mouthpiece [The Herald] that some foreign embassies are training civil society activists to engage in anti-government protests. 

The story appeared in the Herald of 9 December 2021.

These false accusations are meant to justify the Government of Zimbabwe’s continued clampdown on civil society actors, human rights defenders and ordinary citizens who continue to question the government’s chequered human rights record and failure to deliver basic social services and economic development for the country’s citizens. 

It has become apparent that the Government of Zimbabwe does not want to be held accountable by its citizens, despite proclaiming to be a democratic government. 

The same modus operandi was used during the August 2018 and January 2019 persecutions which resulted in a spate of abductions, murder, torture and arrest of civil society actors.

We are concerned that the so-called New Dispensation led by President Emmerson Mnangagwa continues to persecute civil society and human rights defenders based on unsubstantiated claims being parroted by the public media.

It is unfortunate that the Government of Zimbabwe continues to use the state controlled media in creating false narratives that are meant to justify its continued promulgation and abuse of draconian laws to persecute civil society actors as well as criminalization of civil society work. 

The level of unethical journalism with which the Herald article was authored is disquieting and highlights a hidden agenda to smear civil society actors.

This points to a ploy to further shrink the democratic space ahead of the 2023 elections.

President Mnangagwa’s administration has failed to live up to its pledge of a New Dispensation and continues to perfect the art of persecuting dissenting voices as was witnessed during the days of the late authoritarian, Robert Mugabe.

Zimbabwe has already begun a treacherous slide into a fully-fledged military dictatorship and as the Crisis in Zimbabwe Coalition, we shall continue with local, regional as well as international engagements to seek the intervention of pro-democracy forces in stopping authoritarian entrenchment and moving towards the genuine resolution of the Zimbabwean crisis.

Attempts at silencing civil society actors and other dissenting voices point to a move to create a one party state in Zimbabwe and this goes against the dictates of a democracy. 

We urge civil society actors in the country to remain vigilant in light of the continued onslaught from the State media and the government. Zimbabwe belongs to all its citizens and no government will take our rights to defend its genuine progression and development.

“Swindlers Have Extended Their Looting Activities”

By Wilbert Mukori- “The Zimbabwe Anti-Corruption Commission (ZACC) said it had seized property worth over $700 million,” reported Zimeye.

“The anti-corruption body has also filed 18 unexplained wealth order case files with the National Prosecuting Authority (NPA).”

I could not hear myself think from the super slow thunderous applauding; no one with half a brain would not feel insulted by this!

In 2016 Robert Mugabe revealed that the country was “swindled out of US$15 billion in diamond revenue alone”! He never arrested one diamond swindler or recover one dollar of the swindled bounty.

We all know the looting has continued because the then Minister of Finance, Patrick Chinamasa, told parliament in 2017 that government was only receiving 1/6 of the expected revenue from diamond mining.

When Mnangagwa took over from Mugabe following the military coup of November 2017, he promised “zero tolerance to corruption!” Over four years later, he too is yet to arrest one swindler and/or recover one swindled dollar.

We know the swindlers have extended their looting activities to other areas such as gold smuggling, fuel procurement and even donated aid to help corona virus victims has been looted. The Reserve Bank of Zimbabwe Governor, Dr John Mungudya, said Zimbabwe was losing US$1.2 billion per year to gold smugglers.  

So the US$700 million ZACC has recovered is 0.6% of what the gold smugglers loot in just one year or 0.05% of what Mugabe admitted back in 2016 was being swindled in diamonds alone!

The looted gold  Speaking at the commemoration of the International Anti-Corruption Day in Harare on Thursday, the Commission’s chairperson, Justice Loice Matanda-Moyo, said ZACC was on course in its mission to eradicate corruption in the country. She said:

“It is with great pride that I pronounce that Zimbabwe has made great strides in ensuring maximum cooperation is given to state parties during Mutual Legal Assistance Requests” ZACC chairperson, Justice Loice Matanda-Moyo, announced at the commemoration of the International Anti-Corruption Day in Harare.

“The fight against corruption is real and it takes tireless efforts and undivided dedication for us to totally weed out corruption.”

ZACC has recovered US$700 million constituting 6% of the gold smuggled in one out of four decades of Zanu PF misrule! And we, the people, millions of whom are now living in abject poverty because of the wholesale looting of the nation’s wealth, are expected to applaud ZACC for the “great strides” in stamping out corruption!

I have said it once and will say it again; Zanu PF ruling elite appointed ZACC officials and the same ruling elite are the Godfathers of all the corruption and wholesale looting of the nation’s wealth.

It is no secret that each of the country’s security arms; the Police, Army, CIO and Prison Services; have a diamond mining concession in Marange and Chiadzwa. The concession allows the holder to mine for diamonds without having to declare the quality and quantity of diamonds, to whom they are sold and for how much and who benefited from the sell; as revealed in a 2012 parliamentary report chaired by the late Zanu PF MP, Edward Chindori Chininga. In short, the mining concession are a licence to loot!

A Canadian based NGO specialising in diamonds reported that Robert Mugabe earned US$2 billion plus in 2012 alone! All the Zanu PF bigwigs are benefiting from the looting of Zimbabwe’s resources.

Other countries like many of the Arab States have built beautiful new cities out of the dessert and have investment portfolios worth hundreds of trillion dollars from their oil bonanza. We, in Zimbabwe, have absolutely nothing to show for our diamonds, gold, etc. Nothing!

Indeed, our diamonds, gold, etc. have become a real curse to the nation. Zanu PF ruling elite and their foreign and local backers will never ever risk losing political power by allowing the country to hold free, fair and credible elections. They will stand to lose the fresh loot if corruption was stamped out, to lose their amassed loot and, in many cases, they dread their murderous past being dragged out into the open.

If we are serious about stamping out corruption then we must first be serious about implementing the democratic reforms to ensure free, fair and credible elections. As long as Zimbabwe remains a pariah state ruled by corrupt and incompetent thugs who continue to use the vast looted wealth to bankroll their vote rigging juggernaut to secure their iron grip on power; nothing will change. 

The pressure for a competent and accountable government is greater now than ever given the extra health and economic hardships brought by the corona virus. The global changes brought by climate changes will bring new challenges. 

Zimbabwe cannot afford another one of MDC A’s foolishness of participating in the flawed elections to give vote rigging Zanu PF legitimacy. 

If reforms are not implemented before the elections then the process must be declared null and void!

Actor Nash Mphepo Under Siege

By A Correspondent| Award-winning actor Nash Mphepo says he is being harassed by the police following some of the productions that he features which are being deemed offensive.

The revelations by Mphepo comes barely months after the death of fellow actor George ‘Jiggaz’ Tanjani and actress Sitshengisiwe Olinda Siziba.

According to Nash Mphepo ,he was detained a few days ago by police and quizzed on his roles in a play that is yet to be showcased.

“I was arrested while coming from a rehearsal of a play of Flipside where I am playing the role of a fetish police boss who is in the habit of abusing sex workers in return for protecting them since sex work is criminalized in the country.

“I don’t know how they got to know about this when the play is not yet running and I strongly believe I am under surveillance,”said Mphepo.

He says  after  the suspicious  death of  George Tanjani and Sitshengisiwe Olinda Siziba,he fears he could be the next targeted.

“I am now fearing for my life looking at how Jiggaz and Sithengy died.

“Artists should have freedom of expression but it seems the ruling government has not yet reformed in guaranteeing artistes’ safety for their works,” revealed the petrified Mphepo.

The 45-year-old artiste said he does not know what awaits him after the detention where one of the police officers boasted that ‘will deal you just like we did to your friends’.

“I don’t know the pending harm to me after the detention because when I was being interrogated one police officer openly said we will deal with you just like we did to your friends, ”added  the revered actor.

In 2007 ,Nash acted in the play Super Patriots and Morons which was a   political satire that was subsequently banned by the then Mugabe regime for being offensive.

ZESA Issues Apology Over Power Outages In Harare

By A Correspondent- Zimbabwe Electricity Transmission and Distribution Company (ZETDC), a subsidiary of the Zimbabwe Electricity Supply Authority (ZESA) has apologised to its customers in some parts of the Harare Region. Pindula News presents the statements ZETDC released to that effect.

The Zimbabwe Electricity Transmission and Distribution Company (ZETDC) would like to apologize to its valued customers in Harare Region 14 the power outage due to an underground cable fault.

Areas affected Hatfield: Seke Road, Jongwe corner. Rockwood, St David’s road, Panther close, St Patrick’s road, Verona road. Liquid cargo service station, Hatfield gates local, SPCA kennels, and the surrounding areas.

ZETDC Engineers and technicians are working to rectify the fault.

The inconvenience caused is sincerely regretted.

Mandiwanzira, Mutodi Capped

By A Correspondent- The Chancellor of the University of Zimbabwe, President Emmerson Mnangagwa Friday officiated at the university’s 40th graduation ceremony where 5 483 graduands are being conferred with degrees.

Among the graduands were Supa Mandiwanzira, former ICT Minister and Energy Mutodi, former Deputy Minister of Information who graduated with Law degrees.

The President physically capped students with first-class, special honours, masters and doctorate degrees, while the rest of the graduands are following proceedings virtually.

Also graduating is the first batch of medical doctors trained at the Midlands State University under the mentorship of the University of Zimbabwe.

Two Zimbos Nabbed In India With 35Kg Of Heroin Drugs

Two Zimbabweans from Harare have been arrested at Chhatrapati Airport in India for smuggling 35Kg of the Heroin drug worth US$32 million (Rs 240 crore).

Chadcombe Robber Hauled To Court

By A Correspondent- One of the two surviving alleged armed robbers who hit the Chadcombe home of retired CID Homicide detective Joseph Nemaisa appeared in court Thursday charged with 12 counts of armed robbery.

Former police constable Francis Takura (33) was not asked to plead to the charges when he appeared before magistrate Mrs Barbra Mateko, who remanded him in custody to December 28.

Takura was arrested on Wednesday along with Private Virimai Nyandaro, a soldier who is yet to appear in court.

He was found in possession of a UBL green speaker, a Rolex wristwatch, a Samsung Galaxy Note 8, a red pipe wrench, a bottle of Johnny Walker black label, a red libo wristwatch, small Samsung, USB cable, which were positively identified by those he had stolen them from.

The State led by Anesu Chirenje alleges that on December 6, at around 8.45 pm Fadzanai Musarurwa arrived at home and saw three men walking near her house.

She closed the gate, parked her car and entered the sitting room through the main door joining her family.

After about five minutes, she heard her dogs barking viciously before she instructed her brother Masimba Musarurwa to lock the main door.

As Masimba was locking the door, she then heard that there was someone who was trying to force open the door.

Courage Nemaisa then quickly phoned his father Joseph Nemaisa telling him that there were intruders at the house.

The household was assaulted and Masimba handed over US$850, Samsung M20, Black Acer laptop and a shotgun.

But as the gang was about to leave the house, Joseph Nemaisa arrived armed with a 9mm Stribog pistol and exchanged fire.

Three members of the gang, Brian Koga Tendere, Charles Chirara and Tariro Gora were shot dead while Takura and Nyandaro escaped through the window.

Police attended the scene and recovered various weapons, 9mm Norinco Pistol with six rounds of ammunition.

Evidence gathered there led to the arrest of the other two suspects.

The suspects were also involved in other robbery cases. 

The state alleged that on November 5, while armed with an AK47 assault rifle and a pistol, the suspected robbers pounced on James Rikonda and his family and stole US$11 550, a wallet, iPhone 12 Pro Max, a pair of shoes, a baby bag, a Rolex wristwatch and a 9mm Norinco pistol.

They went to his workplace where they stole US$10 000 and drove the couple back to their house where they allegedly assaulted Learnmore Ushe before robbing him of a laptop Xiaomi Note 7 and stole Tichaona Maworere’s tablet, Nokia, Itel, Samsung, HP620, six pairs of shoes, jewellery and other valuables.

On December 1, the suspected robbers went to Mabelreign and robbed Tonderai Nunurai, Edith Madanhi, Daniel Nadzo of US$600 and shoes. They also blindfolded Nunurai and took him into the dining room along with his wife where they allegedly plugged in the iron and burnt him on the stomach and hands before further assaulting him with an iron bar.

They allegedly demanded keys to the Silver Opel Astra, Toyota Avensis and Honda Fit before finally ransacking the house and stealing six bottles of whiskey and a Samsung television set which they later left in the dining room.

On November 30 at around 10 pm, Takura allegedly teamed up with his gang and went to Cold Comfort and robbed Faith Mukombwe, Berita Mozala and Ancilla Muroiwa.

They forced open the screen door, entered the house and robbed the household of US$2 100, a solar battery and inverter, 48 inch Samsung Curved TV set, cellphones and other valuables.

Mukombwe told Pindula News that they only recovered a Samsung Note 8.

ZIMRA Remits Over US$4Ob To Treasury

By A Correspondent- The Zimbabwe Revenue Authority (ZIMRA) has been commended for its role in domestic resource mobilisation (DRM) at a time when international funding has dwindled.

Among the revenue authority’s key milestones have been the facilitation of exports worth US$58 billion and imports worth US$86 billion since 2003.

Since 2001, the Government has been setting a target for ZIMRA to collect an average revenue of US$1.84 billion every year and authority obliged by surpassing the targets after US$1.99 billion was collected every year.

Official figures show that ZIMRA only missed the revenue target by small margins in 2001, 2009, 2014 and 2016 due to different internal shocks that the revenue collector had to grapple with.

Cumulatively, ZIMRA managed to contribute a total of US$39.8 billion to the national purpose from 2001 to 2020.

While officiating at a dinner celebration to mark ZIMRA’s 20th anniversary on Wednesday evening, Finance and Economic Development Minister Professor Mthuli Ncube said:

Since 2001, ZIMRA has helped the country stand on its feet by providing over 90 percent of the country’s budgetary resources annually.

 Coincidentally, the birth of the ZIMRA in 2001 coincided with the imposition of sanctions by western imperial forces on Zimbabwe which took effect in 2002 resulting in lines of credit being cut off by many development partners.

As most of the international credit lines closed when the sanctions were imposed on Zimbabwe, ZIMRA became key in domestic resource mobilisation which ensured that budgetary funding gaps were closed to a greater extent.

ZIMRA is a product of Government reform and modernisation processes, which saw the amalgamation of the then Department of Taxes and the Department of Customs and Excise into one Revenue Administration.

It has grown to become critical in DRM enabling the Government to spearhead education, healthcare, water, and infrastructure development projects across the country.

Analysts believe the authority could be collecting more revenue if tax evasion and the sponginess of borders and other issues causing revenue leakages have been fixed.

Missing Zim Woman Confirmed Dead

Yvonne Chasi was involved in a car accident and died on spot, a colleague confirmed.

Chigumba Says ZEC Is Not In Bed With Zanu PF

The Zimbabwe Electoral Commission (ZEC) chairperson Justice Priscilla Chigumba has refuted widely held claims that they are in bed with the ruling Zanu PF saying their role is purely administrative and political parties and other stakeholders do not grasp that.

Speaking during a gender reporting workshop in Kariba recently, Chigumba said claims that they are biased are just a figment of people’s imagination and an unfair criticism on the commission.

“It has been long perceived that the Zimbabwe Electoral Commission somehow favours or is biased towards the ruling party. I believe it’s a figment of people’s imagination, it’s also an unfair criticism of the commission’s activities because it’s given all its powers and its independence in terms of the constitution,” Justice Chigumba said at a question-and-answer session during a workshop on Gender with station managers from different radio stations.

She said the Commission follows the law and does not set policy.

“Those that are aggrieved by us following the laws of the country believe we should have a role outside our constitutional role, they believe that in executing our mandate it is alleged we interpret the provisions of the constitution restrictively and we are encouraged and sometimes shouted at them to say your interpretation of the law is incorrect,” Justice Chigumba said.

She said any political party that has any grievances should approach the responsible authorities such as the Electoral Court and the police.

However, aggrieved parties do not want to go to the police because the criminal process is a long one, it does not give them immediate relief, Justice Chigumba said.

“They go for low-hanging fruits, they then say they reported to ZEC and they did nothing. ZEC was never ever going to do anything because it’s not its mandate so I believe the perception of ZEC being in bed with certain political parties is just frustration expressed by those who do not understand the role of the commission,” she said.

ZEC, Justice Chigumba said, would embark on an awareness campaign with their stakeholders so that they understand how they operate.

The World’s Worst Domestic Violence Case: Acid Attack

By A Correspondent |This is arguably the world’s worst domestic violence case ever seen; and this is Primrose who was savagely burnt by her husband in an acid attack on the 17th Feb 2020.

Prim, currently under the care of the US based, Phumulani African Women Against Violence NGO, recounts how she spotted warning signs at the beginning but did not take any action.

She met Mr Fungai Muriri (42) in 2014, and their relationship would develop further.

She says however, over the years, “it took time for his behaviour to show up.”

Primrose begins her account saying:

It happened on the 17th February 2020.

“This is my boyfriend, Fungai Muriri; I met him in 2014; We met again in 2015 and over the years, it took time for his behaviour to show up.

“It was later when I discovered that his character is terrible; I tried to leave the house twice but at each turn he would come back and appear like he has changed.

“It was later that I discovered that there is no difference at all nothing has changed. I was doing my job in South Africa.

“So I got to a point where he told me to stop working because he was employed as a land surveyor, and we continued like that until the day he lost his job. It was after he had become unemployed that I discovered that things are now terrible.

“He was now employed as a bouncer, and was doing a lot of bodybuilding.

” He had no respect for me and neither towards my parents.”

In February 2020, Muriri’s degenerated into full blown violence when he splashed liquid acid over her face, before fleeing.

Phumulani is now in the process of assisting Prim with face reconstruction medicals, among other forms of help granted.

Commenting on the development, the director of Phumulani, Comfort Dondo said, “this is really hard for me. I had to do this, to bring Prim here in order for people to see the work that I do and to understand what domestic violence is.”

“Prim is the face of the pain women end up going through.”

Dondo suggested saying Prim was attacked after she had wanted out of the relationship.

Meanwhile, Muriri was still to respond to questions at the time of printing.

Man Robbed By Passengers

By A Correspondent- A motorist was robbed of his Toyota Rav 4 by four passengers he picked along the Harare – Bulawayo Highway on 4 December.

The Zimbabwe Republic Police (ZRP) said the passengers who were picked at Harare Show Grounds were destined for Kwekwe in the Midlands Province. Reads a police statement on the case:

The ZRP is warning members of the public against giving lifts to strangers who end up robbing them.

This follows an incident on 04/12/21 along Harare-Bulawayo Road where a Harare man (23) driving a Toyota Rav 4 picked four passengers destined for Kwekwe at Harare Show Grounds before being robbed of the vehicle and other valuables at the 50km peg.

This is not the first time for such cases to be reported suggesting that robbers 

In September this year, Shepherd Dzapasi, a taxi driver based in Masvingo was robbed of his vehicle by a man only identified as Ronald who had hired the taxi from Jerera to Masvingo for US$4.

When they arrived in Masvingo, Ronald told Dzapasi that he had to take care of some business at Nemamwa. Dzapasi agreed to a US$25 deal to ferry him to the Business Centre.

The two arrived at Nemamwa Business Centre around 10 pm and they got into a nightclub and started drinking beer. After some time Ronald told Dzapasi that he was tired and wanted to rest in the car. Dzapasi gave Ronald the keys while he remained behind in the club.

Dzapasi later went outside the club and found Ronald and his car missing. He waited for some time but Ronald did not show up. He called him and Ronald hung up. When he called again, the phone was no longer reachable. 

Chief Ndiweni Brings A Breath Of Fresh Air

By Mari Matutu | There was a long debate I had with varakashi on the decision taken by the People’s Chief, Chief Ndiweni over his petitioning of Britain on his right to vote from Britain in Zimbabwean elections.

Most people call it diaspora vote. For a long time it has been the people in Zimbabwe who were demanding diaspora vote and those outside the country were aloof.

There are few things that I want to share as eye opener over this. After this article everyone must be able to understand that diaspora vote can be demanded by those outside the country and diaspora vote is never meant to be demanded from ZEC.

I will just take a bit of winding route to clear misunderstandings I observed from Varakashi. If this article is taken seriously then zanu is gone.

1) The promotion and protection of all human rights and fundamental freedoms is considered as a priority objective of the United Nations in accordance with its purposes and principles, in particular the purpose of international cooperation.

2) In the framework of these purposes and principles, the promotion and protection of all human rights is a legitimate concern of the international community.

3) In the past, when human rights were still regarded as a country’s internal affair, other States and the international community were prevented from interfering, even in the most serious cases of human rights violations, such as genocide. That approach, based on national sovereignty, was challenged in the twentieth century, especially as a consequence of the actions of Nazi Germany and the atrocities committed during the Second World War – and subsequently by the international community’s failure to prevent mass atrocities in Cambodia, Rwanda and Bosnia and Herzegovina.

4) Today, the concept of sovereignty as prohibiting foreign interference has been largely replaced by one of responsibility, making States accountable for the welfare of their people.

5) Paragraph 4 of nternational community’s World Conference on Human Rights, Vienna, 1993, Vienna Declaration and Programme of Action, stated it clear on this.

6) The United Nations’ covenant, the International Covenant for Civil and Political Rights ICCPR gives two forms of rights.
(i) The collective rights of people joined together as one and
(ii) Individual rights.

7) To explore and expound the diaspora vote and clear all the excuses that may be given by zanu regime, one has to first and foremost look at the collective right given by the ICCPR. Identify the rights and enumerate them. This will help understand what one can claim as individual and what we can claim as a nation.

8) Article 1. Of the ICCPR reads
“1. 1. All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.

  1. 2. All peoples may, for their own ends, freely dispose of their natural wealth and resources without prejudice to any obligations arising out of international economic co-operation, based upon the principle of mutual benefit, and international law. In no case may a people be deprived of its own means of subsistence.
  2. 3. The States Parties to the present Covenant, including those having responsibility for the administration of Non-Self-Governing and Trust Territories, shall promote the realization of the right of self-determination, and shall respect that right, in conformity with the provisions of the Charter of the United Nations.”

9) While a lot can be said about this article, including the Chilonga, Mutoko and Hwange people’s rights, I am more interested in the right to self determination as it apply to us as a nation. People are given right to determine their political status and pursue their economic, social and cultural development.

10) This right is the one that gives birth to constitution. Because a nation includes millions of people with different views, influence, strengths and weaknesses, it was seen that a written contract that regulates and binds how this collective right is observed and enjoyed is the best way. The constitution becomes a collective expression of what a group of people want to determine their destiny. Anything outside the constitution inconsistent with it is not a collective expression. It is not binding.

11) The process of having this collective expression of people’s right, includes wide consultation and voting for the draft. Once it is voted for, it becomes law that binds the said people.

12) I have brought this to rubbish the notion that Zanu or any political party has a right to regard itself as the custodian of the nation. I have brought this to remove the conflation of other individual rights to be regarded as collective right. Where if Chief Ndiweni go and petition Britain over the violation of his individual right, then some other individual want to conflate the nation to his or her personal opinion on the petition. Some were saying Chief Ndiweni is putting Zimbabwe into disrepute. Some say he should have Zimbabwean issues resolved by Zimbabweans. Such conflation come because people fail to separate what are regarded as collective rights and individual’s rights. As can be seen in article 1 of ICCPR, the right to vote is not a collective right and collective right of people to self determination is for us collectively to determine a political status and not political choices. In short , although right to vote and right to self determination are related, it must be noted that these rights are two distinct and stand alone rights. One exercised as individual and the other as collective.

13) Coming now to article 2. I urge everyone to read this article very carefully. Those that have been demanding diaspora vote must take closer look at the provisions. Those that are residing in other states other than UK must also read it and consider their actions.

14) Article 2 of ICCPR reads
” Article 2 .1. Each State Party to the present Covenant undertakes to respect and to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the present Covenant, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status.

  1. 2 Where not already provided for by existing legislative or other measures, each State Party to the present Covenant undertakes to take the necessary steps, in accordance with its constitutional processes and with the provisions of the present Covenant, to adopt such laws or other measures as may be necessary to give effect to the rights recognized in the present Covenant.
    2.3. Each State Party to the present Covenant undertakes: (a) To ensure that any person whose rights or freedoms as herein recognized are violated shall have an effective remedy, notwithstanding that the violation has been committed by persons acting in an official capacity; (b) To ensure that any person claiming such a remedy shall have his right thereto determined by competent judicial, administrative or legislative authorities, or by any other competent authority provided for by the legal system of the State, and to develop the possibilities of judicial remedy; (c) To ensure that the competent authorities shall enforce such remedies when granted. “

15) While this whole article is pregnant with points to take note of, I will stick to that which relate to Chief Ndiweni’s concern and diaspora vote. If one is to read article 2.1 carefully, you will notice that-
(i) There are States that are party to the covenant.
(ii) Each state party has jurisdiction which it controls as territory.
(iii) In that jurisdiction of the territory there are individuals living in it.
(iv) From the article, it can be seen that, individuals in a territory may have many distinctive characters that include race, colour, sex and so on but in relationship to our issue, I want us to take one distinction mentioned, “Nation”.
(v) It is clear that each state party with jurisdiction over a territory can have individuals of different nations. In this case Britain has jurisdiction of the territory where Chief Ndiweni is legally residing but Chief Ndiweni is of Zimbabwe .
vi) From the article’s own wording, it is the duty of the state whose territorial jurisdiction the individual concerned is domiciled to ensure that the individual concerned’s rights as provided for in the covenant are recognized.
vii) It is Critical to note from the wording of the article, that those that spend their effort demanding diaspora vote from ZEC will be wasting time and approaching the wrong people.
viii) If you are staying in UK then the article is clear that it is UK, which is the state party to the covenant that has a duty to make sure an individual who is in its jurisdiction enjoy the right recognized in the Covenant. To claim your right you go to Prime Minister of Britain. If You are, in South Africa, Zambia, Botswana , Australia name it, go to the authorities of that country and demand the right.

ix) It may look funny but this is what the covenant says. The article does not give duty to Zimbabwe to ensure its citizens vote from wherever they are.

xi) If Zimbabwe is obliged to give right to vote it only gives right to only those that are in its jurisdiction.

xii) Here is the tricky part, when states give right to vote which is in article 25, they must give this right without distinction on nationality. That is where the whole matrix begins. Enjoy it as I unpack it.

16) The wording of article 2.1 of ICCPR must clear the confusion that elections of Zimbabwe can only be held in Zimbabwe or must only be conducted by ZEC. No. From the wording of the treaty, it is clearly possible for 4 Million Zimbabweans living in South Africa to hold elections in South Africa and elect a President of Zimbabwe, as long as all the electoral laws are followed. I shall add that when we deal on Zimbabwe constitution.

17) Article 2.2 shows that if a state has not taken steps through its laws to give effect to the rights in the covenant then the duty to do so is upon the state to do so. If Zimbabwe want to give right to its citizen around the world the right to vote, then the duty is upon them to do so and not the citizen. If, like what Chigumba says, Zimbabwe has no laws of its own to give the right to vote to those that are outside its jurisdiction, then it ceded its right to control how votes for those outside are run.
What it means in short is article 2.1 takes over. The countries with diasporans remain bound by the covenant.

18) Again article 2.3 shows clearly that if one’s right is infringed, in this case Chief Ndiweni, the state party in whose jurisdiction the person is living in is the one that has a duty to ensure that the person whose rights or freedoms as recognized by ICCPR and are violated, shall have an effective remedy, notwithstanding that the violation has been committed by persons acting in an official capacity.
Take good care that, the person in diaspora does not seek remedy from Zimbabwe or put his or her claim against Zimbabwe. No. The claim is against the state in whose jurisdiction you are. The infringement is not by ZEC or Zimbabwe. The infringement is by the state whose jurisdiction the individual is.

19) I am more interested in article 2.3(b), it reads “To ensure that any person claiming such a remedy shall have his right thereto determined by competent judicial, administrative or legislative authorities, or by any other competent authority provided for by the legal system of the State, and to develop the possibilities of judicial remedy” . Pregnant with facts. Once the person has raised a claim of infringement, like Chief Ndiweni, it has to be determined by competent authorities as provided by legal system of the state. Critical. The legal system that provide the remedy is not of Zimbabwe but the legal system whose jurisdiction the individual concerned is domiciled. This means while Zimbabwe has its own legal system, when it comes to claim of a violation of a right recognized in the covenant, it is the legal system of the state whose territorial jurisdiction the individual concerned is living.

20) Then comes 2.3(c), “ensure that competent authorities enforce it once granted”. The competent authorities may include UN, AU, SADC, the Electoral bodies in the state and if credit still exist maybe ZEC.
It is very important to follow this as I shall look at independent electoral authorities further down.

21) This then takes us to article 25 of ICCPR. It reads “Article 25 Every citizen shall have the right and the opportunity, without any of the distinctions mentioned in article 2 and without unreasonable restrictions: (a) To take part in the conduct of public affairs, directly or through freely chosen representatives; (b) To vote and to be elected at genuine periodic elections which shall be by universal and equal suffrage and shall be held by se cret ballot, guaranteeing the free expression of the will of the electors; (c) To have access, on general terms of equality, to public service in his country. “

i) This is the right Chief Ndiweni is claiming. It says “every citizen”,( It does not identify a country or say “every citizen of a country”), shall have a right and opportunity without any of the distinctions mentioned in article 2.
ii) Without going back to article 2 and see the distinctions mentioned you will fall into zanu narrative. One of the distinction that must not be included is nationality. This then separate nationality from citizen. While most Zimbabwean nationals are living in Zimbabwe and become citizens of Zimbabwe in their country, it must be noted that there are many Zimbabwe citizens who are not residing in Zimbabwe. They remain Zimbabwean nationals where ever they are but their citizenship is for Zimbabwe. There are also nationalities living in Zimbabwe but not citizens of Zimbabwe yet remain citizens of their respective states.

22) By reading this article many people then get confused. Why?
i) Because people believe the state is the one that GIVES individuals the right to vote.

ii) Because people think the state has sovereign right over right to vote.

iii) A better way to explain this is to look at the wording of the Preamble of the ICCPR
iv) The Preamble to ICCPR reads
“Preamble The States Parties to the present Covenant, Considering that, in accordance with the principles proclaimed in the Charter of the United Nations, recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world, Recognizing that these rights derive from the inherent dignity of the human person, Recognizing that, in accordance with the Universal Declaration of Human Rights, the ideal of free human beings enjoying civil and political freedom and freedom from fear and want can only be achieved if conditions are created whereby everyone may enjoy his civil and political rights, as well as his economic, social and cultural rights, Considering the obligation of States under the Charter of the United Nations to promote universal respect for, and observance of, human rights and freedoms, Realizing that the individual, having duties to other individuals and to the community to which he belongs, is under a responsibility to strive for the promotion and observance of the rights recognized in the present Covenant, Agree upon the following articles individuals and to the community to which he belongs, is under a responsibility to strive for the promotion and observance of the rights recognized in the present Covenant, Agree upon the following articles”

v) Without fully understanding that the right to vote is inherent to a citizen of a country and it is not a commodity that you receive at the pleasure of someone or state, you are bound to fall prey to the rhetoric given by some zanu people.

vi) By going back to article 25’s wording it means a person walks around the globe with his or her inherent human right. You do not drop your right to vote as a citizen. Now we are not always in our country of birth at all given time and as we have read from preamble no state gives a person the right, all what states do is promote, respect, protect and fulfil the rights without distinction.

vii) When issues relating to Zimbabwe are being discussed, the state with territorial jurisdiction has to ensure these citizen participate. This means that even when citizens of Zimbabwe are voting in Zimbabwe, the state is giving this right not because its their citizens because if that is the case then its a distinction on nationality, When Zimbabwe is letting people to vote for any post in Zimbabwe, it is just exercising the duty in article 2.1 without distinction. The people in Zimbabwe have the inherent right to vote and are not being given the right by the state. It is only the jurisdiction of the territory that make them give right to those that are under its jurisdiction.

23)There comes a question. Who will run the election, how will ZEC run the election? Who will fund the election exercise?

i) I will first share paragraph 20 of General Comment 25 of United Nations, just to clear doubt about role of ZEC . It reads

“20. An independent electoral authority should be established to supervise the electoral process and to ensure that it is conducted fairly, impartially and in accordance with established laws which are compatible with the Covenant. States should take measures to guarantee the requirement of the secrecy of the vote during elections, including absentee voting, where such a system exists. This implies that voters should be protected from any form of coercion or compulsion to disclose how they intend to vote or how they voted, and from any unlawful or arbitrary interference with the voting process. Waiver of these rights is incompatible with article 25 of the Covenant. The security of ballot boxes must be guaranteed and votes should be counted in the presence of the candidates or their agents. There should be independent scrutiny of the voting and counting process and access to judicial review or other equivalent process so that electors have confidence in the security of the ballot and the counting of the votes. Assistance provided to the disabled, blind or illiterate should be independent. Electors should be fully informed of these guarantees”

ii) Please take a good look at this General comment. It relates to the covenant and an Electoral authority that is established is an independent authority. It is not a state organ. It does not belong to anyone. It is not bound by other laws other than electoral laws.

iii)This is critical to note because it is a mistaken belief that Elections can only be run by ZEC. It is also mistaken belief that elections must be run in terms of Zimbabwean laws. That is why we find Khupe in parliament on arguments of civil litigation. That is why we have not had by elections Zimbabwe for 2 years. It is all because people believe Zimbabwe elections can only be run in Zimbabwe and only by a Zimbabwean electoral authority.

iii) The easier way of looking at this is using examples of football. Every country that plays soccer has a referees and each referee register in the association board that officiate local games. If Dynamos is playing Caps it is usual a referee is contracted to officiate. More often a local referee. If a Dynamos and Caps choose to play in England and a referee from England is used it does not change the results of the game and the referee will always use the soccer rules.

iv) It is evident that an electoral authority is not established in a state to run an election for that particular state only, otherwise it violates the article 25 and it becomes discrimination.

v) It is also evident that an election authority does not run elections on laws that are not compatible to the covenant but only laws that are compatible with covenant.

24) The General Comment then force us to look at our constitutional provision on Zimbabwe Electoral authority.

i) Section 235 of constitution talks of Independence of Commissions and (1)The independentCommissions— (a)are independent and are not subject to the direction or control of anyone; (b)must act in accordance with this Constitution; and (c)must exercise their functions without fear, favour or prejudice; although they are accountable to Parliament for the efficient performance of their functions. (2)The State and all institutions and agencies of government at every level, through legislative and other measures, must assist the independent Commissions and must protect their independence, impartiality, integrity and effectiveness. (3)No person may interfere with the functioning of the independent Commissions.

ii) Section 238 talks of the Establishment and composition of Zimbabwe Electoral Commission and reads ” (1) There is a commission to be known as Zimbabwe Electoral Commission consisting of— (a)a chairperson appointedby the President after consultation with the Judicial Service Commission and the Committee on Standing Rules and Orders; and (b)eight other members appointed by the President from a list of not fewer than twelve nominees submitted by the Committee on Standing Rules and Orders. (2)The chairperson of the Zimbabwe Electoral Commission must be a judge or former judge or a person qualified for appointment as a judge. (3)If the appointment of a chairperson to the Zimbabwe Electoral Commission is notconsistent with a recommendation of the Judicial Service Commission, the President must cause the Committee on Standing Rules and Orders to be informed as soon as practicable. (4)Members of the Zimbabwe Electoral Commission must be Zimbabwean citizens and chosen for their integrity and experience and for their competence in the conduct of affairs in the public or private sector. (5)Members of the Zimbabwe Electoral Commission are appointed for a sixyear term and may be re-appointed for one such furtherterm, but no person may be appointed to or serve on the Commission after he or she has been a member for one or more periods, whether continuous or not, that amount to twelve years.

iii) While section 238(4) of the constitution states that members of Electoral Commission must be Citizens of Zimbabwe, it does not follow that ZEC is for Zimbabwean election or is an arm of the state or accountable to the state. It still remains that ZEC is an ELECTORAL AUTHORITY in Zimbabwe as opposed to an Electoral authority of Zimbabwe.

iv) As we have seen that states ensure individuals have their right to vote as individuals and not as nationals, within its jurisdiction without distinction, it must be seen that the state uses its local courts, local electoral authorities, police and army fulfil this obligation to individuals and not nationals without any distinction.

v) It must then be noted that the Duty ZEC is playing is of agency to United Nations which is the guarantor of all human rights.

25) Section 239 of constitution states Functions of Zimbabwe Electoral Commission as follows
“The Zimbabwe ElectoralCommission has the following functions— (a)to prepare for, conduct and supervise— (i)elections to the office of President and to Parliament; (ii)elections to provincial and metropolitan councils and the governing bodies of local authorities; (iii)elections of members of the National Council of Chiefs established by section 285; and (iv)referendums; and to ensure that those elections and referendums are conducted efficiently, freely, fairly, transparently and in accordance with the law; (b)tosupervise elections of the President of the Senate and the Speaker and to ensure that those elections are conducted efficiently and in accordance with the law; (c)to register voters; (d)to compile voters’rolls and registers; (e)to ensure the propercustody and maintenance of voters’rolls and registers; (f)to delimit constituencies, wards and other electoral boundaries; (g)to design, print and distribute ballot papers, approve the form of and procure ballot boxes, and establish and operate pollingcentres; (h)toconductand supervise voter education; (i)toaccreditobservers of elections and referendums; (j)to give instructions to persons in the employment of the State or of a local authority for the purpose of ensuring the efficient, free, fair, proper and transparent conduct of any election or referendum; and (k)to receive and consider complaints from the public and to take such action in regard to the complaints as it considers appropriate.”

i) If one is to read this section blindly he is bound to fall prey to the narrative that ZEC is there only to run Zimbabwe election based on list of functions in that section and only ZEC can run the elections mentioned.

ii) I did it deliberately to quote this provision that list the functions of ZEC but bear in mind that it is not the state that gives you the right to vote nor the state that guarantee the right vote neither the right to vote a collective right.

iii) All what the state is doing is regulating how it intend to protect a right in Chapter 4 of the Constitution, that is to say section 67, in line with its obligation in section 44 which reads
“The State and every person, including juristic persons, and every institution and agency of the government at every level must respect, protect, promote and fulfil the rights and freedoms set out in this Chapter.”

iv) The state is bound in terms of section 47 to fulfil its duty of giving right to EVERY Zimbabwean citizen the right to vote yes as clearly spelt in section 67 not because it is a sovereignty duty but because it is the state with territorial jurisdiction in Zimbabwe . However it is impossible for every Zimbabwean to be in Zimbabwe at any given time and it is impossible to regulate how other state chooses to ensure each individual enjoys his or her right.

v) This is where article 2.3(b) of ICCPR stated that the claim of violation of right will be determined by an authority provided for by legal system of the state.

vi) So yes the functions of ZEC are spelt by the legal system of Zimbabwe for those that are under the jurisdiction of Zimbabwe but as section 47 of Constitution state, “that does not preclude the existence of other rights and freedoms that may be recognised or conferred by law, to the extent that they are consistent with this Constitution.”

vii) Citizens of other nations who are under Zimbabwe’s territory have right to have their right to vote for elections in their countries and Zimbabwe has same duty to fulfill that right and ZEC as the independent electoral body in Zimbabwe has the function to run those elections again.

26) Better way to look at ZEC is to look at its objective than its function as stated on the basis of territory.

i) Section 233 reads

“Objectives of independent Commissions

The independent Commissions have the following general objectives in addition to those given to them individually— (a)to support and entrench human rights and democracy;
(b)to protect the sovereignty and interests of the people;
(c)to promote constitutionalism; (d)to promote transparency and accountability in public institutions; (e)to secure the observance of democratic values and principles by the State and all institutions and agencies of government, and governmentcontrolled entities; and (f)to ensure that injustices are remedied.

ii) I feel like saying waaal. While Independent commissions in Zimbabwe have functions of their own, the general aim of them is clearly spelt in section 233.

iii) Of note is 233(b)- ” to protect the sovereignty and interest of the PEOPLE. It does not say “sovereignty and interest of the state”.

iv) Note 233 (e), “to secure the observance of democratic values and principles by the State and all institutions and agencies of government, and government controlled entities”.

v) This must clear doubt that ZEC is an electoral authority aimed at securing sovereignty of Zimbabwean state or sovereignty of Zimbabweans only. It says “protect sovereignty and interest of people” which is “without distinction” on grounds mentioned article 2.1 of ICCPR and repeated in section 56(3) .

vi) No doubt ZEC is an Electoral Authority that administer a right in chapter 4. It cannot do it just for Zimbabweans living in Zimbabwe and not for other nationals without violating section 56(3).

v) That means in simple terms ZEC is an electoral authority in Zimbabwe with duty to “secure the observance of democratic values and principles by the Zimbabwean State and all its institutions and agencies of its government, and governmentcontrolled entities”

27) This then means all electoral authorities in UN member states have exactly the same mandate to individuals living in their territory.

28) As I conclude I will use section 88 to explain but one can also read section 117 and 162 to get the point.

i) Section 88 of Zimbabwe constitution reads ” Executive authority (1)Executive authority derives from the people of Zimbabwe and must be exercised in accordance with this Constitution. (2)The executive authority of Zimbabwe vests in the President who exercises it, subject to this Constitution, through the Cabinet.”

ii) From the wording it can be seen that authority is derived from people of Zimbabwe and not people in Zimbabwe.

iii) Section 35 of constitution put citizens of Zimbabwe to equal status and equal protection from where ever they are.

iv) This means it is possible for people of Zimbabwe from where ever they are to individually claim right of vote from the state where they are domiciled, and the authorities of that state grant an order directing the relevant authorities to accord the right.
v) Where People of Zimbabwe living in South Africa are 4million can get an order from South African Constitutional Court with exclusive jurisdiction to hear and determine matters relating to human rights. As the ICCPR 2.1 states that the duty to protect the right to vote is on the state whose jurisdiction the concerned individual is, the South African constitutional Court can only direct the authorities of South Africa .

vi) By this it means 4 million Zimbabweans if they all vote for Chamisa and zanu get 2million from Zec then Chamisa is president.

What are you waiting for. Get MDC structures in South Africa, Botswana, Namibia, Zambia, Australia, UK, USA get court orders directing those states to give them the right.
The duty to give diaspora vote is with the state in whose jurisdiction the individual is.

The petition that was initiated by one Gaffa Kusvika Ndafa had, as of the time of writing, been signed by 34 people out of the required 100. Reads the petition:

This is a petition to Winky D and the management team Of the Vigilance brand. Firstly, we would like to thank you for dropping one of the best albums in Zim Dancehall. Many people doubted the impact it would make at the very first stages of its release, but later on, everyone became conscious about the message you were communicating to us. We appreciate your brilliance in penning down lyrics that open our eyes in these times where we have a lot of distractions blurring our vision of reality.

This petition is to appeal for a new album that might as well give us something fresh for our ears to consume. We have enjoyed quite a number of tracks released during the course of this year from other artists but igaroziva kuti kana tapinda summer time mowanzotipa zvinyowani [you usually give us some music for Summer].

Man Slapped With 279yrs Behind Bars

By A Correspondent- A man has been sentenced to three life terms and a combined 279 years in the North West High Court for 27 offences he was charged with, including rape and murder.

Thabang Gordon Moloi, 28, was sentenced to life imprisonment on each count of murder and two of rape.

North West NPA spokesperson Henry Mamothame said in a statement yesterday:

Moloi’s unrelated charges include murder, attempted murder, multiple robberies with aggravating circumstances, multiple kidnappings, multiple housebreakings, theft, attempted escaping from lawful custody and escaping from lawful custody.

According to the regional NPA, he kidnapped several women, some he met on the street, dragged them to isolated locations and raped, and or robbed them.

He also assaulted and killed some people.

Moloi was subsequently arrested on December 19 2017 and charged and on December 21, 2017.

After several attempts, Moloi managed to escape police custody when he freed himself of the foot-cuffs, jumped out of a police truck, and escaped.

Following his escape, Moloi committed several other crimes only to be re-arrested on August 20 2018 on more charges.

The regional NPA says Moloi was currently serving a 15-year sentence on a charge of kidnapping and robbery, and he has another pending rape case that was unrelated to the 27 offences he was sentenced for.

He has four other convictions to his name, including theft, two robberies with aggravating circumstances, and kidnapping.
