Bomb Scared Mnangagwa Back In Victoria Falls

By A Correspondent- President Emmerson Mnangagwa is back to Victoria Falls, barely a week after he was forced to make a u-turn last week Friday following a bomb scare at the airport.

Today, Mnangagwa landed safely is currently attending the 56th session of the Economic Commission for Africa Conference of African Ministers of Finance, Planning and Economic Development (ECA-COM2024) which is running until 5th March 2024.

Last week, Mnangagwa was forced to abort the trip midway after reports of a bomb scare from a John Doe was communicated to him.

He has since fired Airforce chief Elson Moyo over the issue and replaced him with Air Marshall John Jacob Nzvede.

Vic Falls Company With A Starlink Device Fined US$500 For Operating A Radio Station

By A Correspondent| Victoria Falls magistrates court has fined a Victoria Falls based company of operating a radio station without a license.

Actually, the company Zambezi Botique Private Limited does not operate a radio station but a mere Starlink device which they are using to access cheaper and fast internet.

According to the National Prosecuting Authority (NPA), the company was raided following a tip off and found with Starlink terminals at their reception area.

Sometime in September 2023, the Postal and Telecommunications Regulatory Authority of Zimbabwe received a tip off to the effect that the company was in possession of Star Link terminals. Acting on tip off a team from Potraz together with the Police proceeded to the company premises where they were led to the terminal connection located at the reception area.

Chamisa Says His Call To Scrap CALA Has Been Adopted

By A Correspondent| Former Citizens Coalition for Change leader, Nelson Chamisa has bragged that his call to scrap what is called the Continuous Assessment Learning Activities (CALA) has yielded results as the government has finally found sense in doing away with program that was giving both pupils and parents a difficult time.

Posting on X, formerly Twitter, Chamisa said the CALA experiment had jeopardized the education of a whole generation.

“During the election campaigns, I made a strong case for the scrapping of the Continuous Assessment Learning Activities (CALA)

“I see this week government finally scrapped the Continuous Assessment Learning Activities (CALA) amid escalating pressure from learners and parents, replacing it with a heritage-based education curriculum

“It admits of no debate that the CALA system, is an experiment that failed. It had unfairly jeopardized a generation,” said Chamisa.

He urged the government to subject future education policies to rigorous testing before implementation.

“Our education policies, and any policy for that matter, must undergo rigorous testing before implementation; our future is at stake. In the past, education policies have run into implementation headwinds due to the absence of public consultation,” added Chamisa.

Robson Mhandu Fired Over S*x Scandal

By Staff Reporter- The Zimbabwe Broadcasting Corporation (ZBC) has fired its Radio Services director, Robson Mhandu, over a sex scandal.

Mhandu was suspended late last year after an audio of him asking for sexual favours from a female DJ leaked.

In a statement issued on Friday, 01 March, the ZBC Board said Mhandu was on a fixed-term contract which ended on 29 Februrary while still under suspension.

BC said they did not renew this contract.

 Reads the statement:

The Director of Radio Services, Mr. ROBSON MHANDU, was on a fixed-term contract which lapsed by operation of law on 29th February 2024.

He was on suspension pending the outcome of disciplinary proceedings which had already commenced. His contract has not been renewed. He was given prior and adequate notice of the non-renewal.

Mr. Mhandu ceases to be an employee of the Corporation by operation of law and without prejudice to the ongoing inquiry by the Zimbabwe Gender Commission.

The Corporation will consider and implement any appropriate recommendations the Zimbabwe Gender Commission may make.

ZBC suspended Mhandu in September 2023 following allegations of sexual harassment. Mhandu reportedly demanded sexual favours from a female presenter, Farai Juliet Magada, also known as Farie Jules, in exchange for approving her transfer request.

Tshabangu, Eight Others March Into Parliament With Zanu PF Blessings

By Political Reporter-The Zimbabwe Electoral Commission (ZEC) has officially endorsed the nominations of eight members from the Citizens’ Coalition for Change (CCC), put forward by Sengezo Tshabangu, to assume roles in the National Assembly.

The appointed Senators are as follows: Mlilo Lilian, Phulu Kucaca Ivumile, Sibanda Linda, and Ndhlovu Collet, all hailing from the Bulawayo province; Mdhluri Maxwell representing Manicaland; Chapfudza Sam from Masvingo; Kabondo Teresa, Tshabangu Sengezo, and Mumpande Grace, all contributing from the Matabeleland North region.

This decision, set to come into effect on March 1, 2024, was officially communicated through General Notice 293 of 2024 in the Government Gazette by the Zimbabwe Electoral Commission.

This public announcement serves to inform citizens of the successful nomination and subsequent approval of Tshabangu and the aforementioned eight individuals as Senators.

The swearing-in ceremony for the newly appointed Senators is anticipated to take place in the upcoming week.

“Lawyer Used Witchcraft”

Our family firmly maintained the position that Moreblessing Ali’s interment would not proceed until our family lawyer, Honorable Job Sikhala, was released from prison. We had engaged Hon. Sikhala to represent us when we were in the dark about Moreblessing Ali’s whereabouts following her disappearance in May 2022. His legal expertise guided us through the intricate legal landscape, enabling us to seek answers about our relative’s fate. We patiently awaited Hon. Sikhala’s release, recognizing the sacrifices he made on behalf of our family.

As a united family, we convened multiple meetings to ensure that the unfortunate events of June 14, 2022, would not recur. Our collective decision was clear: Moreblessing Ali’s burial would adhere strictly to the family’s wishes and desires. Politics, party affiliations, slogans, and any interference with the family’s intentions were categorically prohibited. The funeral program would unfold according to our internal arrangements.

Regrettably, certain individuals disrupted the solemnity of the occasion by injecting politics and slogans into the proceedings. Their actions led to violence and insults, which we find utterly unacceptable.

Furthermore, some even took it upon themselves to dictate the funeral program, disregarding the family’s expressed wishes.

As a family, we have taken the necessary steps to involve law enforcement in addressing the disruptive behavior during our loved one’s funeral. It is crucial that we curb this behavior promptly to foster a culture of respect for funerals and memorial services. The inhumane, insensitive, and reprehensible actions witnessed have deeply affected our family.

Road Accident- Mayor Collides With Zanu PF Vehicle

In a disturbing escalation of political tensions in Masvingo, an accident involving the immediate past Mayor, Advocate Collen Maboke, and a vehicle belonging to Zanu PF has left several injured, including the Zanu PF youth chairman, Darlington Mandebvu. Blue Card No Longer Coming

FIFA has ruled out the introduction of blue card in football, the world football governing body’s president Gianni Infantino has confirmed.

Reports emerged last month that the International Football Association Board (IFAB) had started the trials in the lower leagues in Europe.

The proposed card would have seen players removed from the field for ten minutes and sent to sin bins if they commit a cynical foul or show dissent.

The decision to drop the proposal was made at a meeting between officials from IFAB and FIFA.

“There will not be any blue cards used at elite level. This is a topic that is non-existent for us,” Infantino told reporters.

“Fifa is completely opposed to blue cards. I was not aware of this topic – as the president of Fifa. I think Fifa has a say in IFAB. If you want a title, ‘it is red card to the blue card.’

“We are always open to look at ideas and proposals. But once you look at it, you also have to protect the essence and tradition of the game. There is no blue card.”

Ambassador Chifamba spoke on the huge demand for housing in Zimbabwe, highlighting the sector as a priority investment area.

He said a number of opportunities exist in mining, tourism, farming, and renewable energy through partnerships, go-it-alone and investment in special economic zones.

“The preferred investment models depend on the preference of the investor”, he said.

He paid tribute to the Zimbabwean diaspora in America for contributing US$179 million in remittances last year.

He urged the diaspora to pool resources together and invest in Zimbabwe as blocks, adding that they can use the power of numbers to get credit from offshore financial institutions to invest home.

On the day of the coup announcement, Nzvede was notably seated beside Sibusiso Moyo during the televised address.

Rushwaya explained the presidential decision, stating, “His Excellency, President Dr. Emmerson Dambudzo Mnangagwa has, in terms of section 340 (1) (f) as read with sections 216(2) and 89 of the Constitution of Zimbabwe Amendment (No.20), retired Air Marshal Elson Moyo as Commander of the Airforce of Zimbabwe with effect from 15th March 2024.”

3million Building Abandoned

A US$3 million property owned by the Zimbabwe National Statistics Agency (Zimstat) in Harare has been left abandoned, leading to over US$600,000 in damages due to vandalism, as revealed by Truth Diggers. Students Slap MSU Over US Dollar Tuition

Warriors Seek Glory In Invitational Tournament

The Zimbabwe senior men national team, the Warriors, are set to feature in a four nations tournament between the 18th and 26th of this month in Malawi.

In a statement on their X-handle, the Zimbabwe Football Association said the tournament which will be held during the FIFA international window this month, will see Zimbabwe taking on Kenya, Malawi and Zambia.

The tournament set for Lilongwe is expected to give the Warriors an opportunity to face quality opposition in preparation for the upcoming 2026 FIFA World Cup and 2025 Africa Cup of Nations qualifiers.

ZBC Boss Resigns

ZBC Chief Executive Officer, Ms Adelaide Chikunguru has resigned.

Ms Chikunguru, who has been on suspension since Wednesday the 28th of February pending disciplinary proceedings which had been instituted, resigned this Friday the 1st of March 2024.

In a statement, the ZBC Board confirmed Ms Chikunguru’s resignation, adding Finance Director, Mr Assael Machakata will continue as Acting Chief Executive Officer pending the appointment of a substantive CEO.

Meanwhile, the national broadcaster has not renewed Robson Mhandu’s contract.

The ZBC Board confirmed in a statement that Mhandu, who was Director of Radio Services, was given prior and adequate notice that his contract which expired on the 29th of February 2024 was not going to be renewed.

Mhandu has since ceased to be an employee of the corporation by the operation of law and without prejudice to the ongoing enquiry by the Zimbabwe Gender Commission.

He had been on suspension since September 2023.

Chin’ono in the audio accuses the country’s most popular politician, Nelson Chamisa of neglecting the jailed legislator, Job Sikhala, saying he was wasting time tweeting while Job Sikhala was suffering in prison. He says Chamisa seemed more concerned over his register-to-vote rallies that over Sikhala’s plight.

Ironically Chin’ono has also accused Chamisa of not holding any register-to-vote rallies in the run up to the 2023 elections.

He accuses Chamisa of sending him pictures of his (Chamisa’s) rally during Sikhala’s trying moments.

“He sent me [rally pictures), I don’t tweet things like that,” says Chin’ono.

Sikhala’s best friend, Tafadzwa Musekiwa then answers back asking if the rally “is the Kariba one,” to which Chin’ono blows back saying,

“I was being tweeted to and would just ignore; everything I was getting tweeted and would just ignore. There is someone who is in prison [and he’s doing this],” he says in the clip captured by ZimEye in July 2022, comments which Zimbabweans have re opened as they connect them to Chin’ono’s allegation that Nelson Chamisa’s party is going to split because according to him (Chin’ono) the CCC leader is incompetent.

Since 2022 Chinono has continued berating Chamisa saying he focuses too much on citing Bible verses. while Sikhala is suffering.

Chamisa has chosen to ignore the commentator.

Meanwhile, Hopewell Chin’ono’s repeating behaviour is explained by an NHS mental health expert who among many others alleges on video she witnessed him engaging in credit card fraud and that he was once arrested over money laundering in UK, before changing his surname from Mukusha after leaving UK for Zimbabwe.

She also says she has to repeat these allegations in order to alert the nation over how he has hurt many people since his Marlborough High School days.

“What he did to me without remorse, if he does it to Zimbabwe without remorse, will there be any chance of a reversal?,” says Grace Mupfurutsa, around the time of Chin’ono’s first arrest by the Zimbabwe military government he’s been working for, on 18 Aug 2020.

The Premier Soccer League chairman Farai Jere has engaged Highlanders and Dynamos to iron out differences following his controversial claims made last week.

Jere characterised the two giants as violent teams, while explaining why the sides’ encounter was put in the opening round of the 2024 Castle Lager Premier Soccer League season.

He said: “We want to exorcise that ghost of having violence at Barbourfields whenever these teams are playing. If that happens we are going to fine both teams heavily. We want to have this match played early in the season because we cannot allow two clubs to hold the entire league at ransom; they can’t be allowed to bring the whole league into disrepute.”

The claims attracted harsh responses from both Highlanders and Dynamos.

Chaos At Moreblessing Ali Burial, Suspected Tshabangu Youths Claiming To Represent Chamisa Clash With Sikhala

By A Correspondent | There was chaos at the burial of the slain CCC activist, Moreblessing Ali where youths claiming to represent Nelson Chamisa clashed with those claiming to represent the murdered mother’s lawyer, Job Sikhala.

The disturbing event raises questions on the motives of youths who traveled to the funeral for the purpose of causing commotion.

It was during a singing session that a group of youths descended the burial into commotion when a woman was assaulted by a man only identified as Musonza.

“Musonza was beaten in the bi election, then went to join Tshabangu where he was also beaten, and so today he was now assaulting this lady. But what we want to hear known is that whether you like it or not this country will be ruled by Chamisa,” an unidentified woman narrated.

It was at that point that others exploded into singing against Sikhala.

“Mupanduki tevera ngwena, mupanduki!- traitor you must follow the crocodile,” one of the songs was sung at the funeral.

While a comment was awaited from Chamisa’s leadership, a series of state engineered events were noted since Sikhala’s first arrest on 21 Aug 2020 when a male state agent claimed to the Sikhala family that details of his (Sikhala’s) whereabouts had been leaked to the security forces by a Chamisa youth, and since then there have been more of such allegations accused against Chamisa..

In 2022, ZimEye witnessed two high profile state operatives variously communicating that they were creating divisions in Chamisa’s party while abusing the Sikhala family, an operation that led to Sikhala and a cousin of his being prosecuted for incitement to violence and terrorism utterances. In the latter case, there are live videos of ZimEye thoroughly exposing officials over influence from ZANU PF. Both Sikhala and the cousin were influenced into believing that they are Nelson Mandela characters, so that those statements can perchance cause division in the civil society.

The following was the interaction between one blue uniform clad youth with an HSTV reporter.

“What we demand is that Job Sikhala cannot address us, who on earth is he to us? We do not deal with sellouts. We cannot be addressed by traitors,” says the unidentified youth.

He continues saying –

“The only thing we refused is being addressed by Job Sikhala. We wanted to bury the person nicely, What we only refused is being addressed by Job Sikhala.”

Who should have addressed you?, the HSTV reporter asks, to which the youth says,

“Hon Zvaipa is there over here. Also, the place where Moreblessing was registered to vote in Chitungwiza South which belongs to Goddy Sithole.”

Who leads your party?

“It’s led by Nelson Chamisa, he is the one we are traveling with,” he replies.

Who?, further asks the reporter..

“We are following Nelson Chamisa,” the youth concludes.

By- President Emmerson Mnangagwa has fired Air Marshal Elson Moyo from the post of Commander of the Airforce of Zimbabwe, replacing him with Air Vice Marshal John Jacob Nzvede.

The President has also appointed Dr Christopher Pamhidzai Pasi as the Secretary to the Health Service Commission.

The appointments were announced by the Chief Secretary to the President and Cabinet, Martin Rushwaya, in a statement issued on Friday, 01 March. Reads the statement:

His Excellency, President Dr Emmerson Dambudzo Mnangagwa has in terms of section 340(1)(f) as read with sections 216(2) and 89 of the Constitution of Zimbabwe Amendment (No.20), retired Air Marshal Elson Moyo as Commander of the Airforce of Zimbabwe with effect from 15th March 2024.

Following the above retirement, His Excellency the President has in terms of sections 216(2), 89 and 110(2)(d) of the Constitution of Zimbabwe Amendment (No.20), appointed Air Vice Marshal John Jacob Nzvede, as the new Commander of the Airforce of Zimbabwe with effect from 15th March 2024.

His Excellency the President has in terms of section 10(1)(a) of the Health Service Amendment Act also appointed Dr Christopher Pamhidza Pasi as Secretary to the Health Service Commission.

Dr Pasi holds a Bachelor of Medicine and Surgery, a Masters in Medicine, a Diploma in Tropical Medicine and Hygiene, a Bachelor of Science Degree in Business Administration and is a Fellow of the College of Physicians in Central and East Africa.

Dr Pasi joined Government in 1993 and rose through the ranks to become Chief Medical Officer at Sally Mugabe Central Hospital, a post he held till this appointment.

The dispute gained widespread attention after a tweet from government spokesperson Nick Mangwana prompted Maropafadzo to publicly defend her actions.

Maropafadzo’s response to the controversy was direct and assertive. “There’s no evidence I used HE’s name or Matanga’s. I went through the proper legal route, everything I did was above board. ZRP has really sabotaged me by being very compromised. I am a young girl who came from the UK 5 years ago and worked my way up,” she declared, challenging the claims made against her and questioning the integrity of the Zimbabwe Republic Police (ZRP).

Yesterday, President Nelson Chamisa led a delegation to visit displaced villagers in Masvingo West.

The team included prominent officials such as Honorable Amos Chibaya, Gift Ostallos Siziba, Prince Dubeko Sibanda, Monica Mukwada, Vongai Tome, Bekezela Mapulanka, Martin Mureri, Matara, Pedzisai Gasva, Roswita Madziire, Maggie Chakabuda, Masvingo Deputy Mayor Mberikunashe, Former Masvingo Mayor Shantel Chiwara, and others.

Accompanied by journalists from Masvingo Mirror, TellZim, Midweek, among others, the delegation addressed the well-attended Masvingo Provincial Assembly before visiting Masvingo West, approximately 40 kilometers away from Masvingo town.

The villagers had been instructed by the court to vacate the land due to illegal occupation, resulting from the Zanu PF-led government’s Operation No to Land Barons.

This displacements compelled them to dismantle their homes and belongings.

During the visit, residents shared poignant stories of having to demolish homes they had occupied since 2002.

Allegations surfaced suggesting political motivations behind the evictions, with some residents claiming persecution for their support of opposition candidates in recent elections.

Former Senator Vongai Tome, overseeing President Chamisa’s welfare department, pledged resources to assist the neglected victims of land evictions.

Billiat To Return To Warriors Fold?

Yadah founder and owner Prophet Walter Magaya says he will persuade Khama Billiat to consider coming out of international retirement.

Billiat, who had a glittering career in the gold and green Warriors strip spanning over a decade, quit international football under unclear circumstances in November 2021.

Previous attempts to lure Billiat back into the Warriors fold have hit a brick wall but Magaya insists he can convince the pint-sized winger to play for Zimbabwe again.

“Well, the first thing is, he needs to play well and be wanted in the national team. But as far as convincing him is concerned, I’m very sure I can do so,” said Magaya.

“Khama is a natural leader and that leadership is still wanted in the national team if whoever will be the next coach sees it that way,” added Magaya.

Following Moyo’s retirement, Air Vice Marshal John Jacob Nzvede has been appointed as the new Commander of the Airforce of Zimbabwe. His appointment, in accordance with sections 216(2), 89, and 110(2)(d) of the Constitution of Zimbabwe Amendment (No.20), signals a new chapter in Zimbabwe’s air force command.

Moreover, in a separate development related to the health sector, Dr. Christopher Pamhidza Pasi has been appointed as the Secretary to the Health Service Commission. Dr. Pasi’s qualifications include a Bachelor of Medicine and Surgery, a Masters in Medicine, Diploma in Tropical Medicine and Hygiene, Bachelor of Science Degree in Business Administration, and fellowship in the College of Physicians in Central and East Africa. With a career spanning back to 1993 within the government, Dr. Pasi’s expertise and experience are expected to contribute significantly to the health service commission.

State Drops Charges Against Whistleblower Who Exposed Sewage Water Scandal

By Political Correspondent – The state has dropped charges against a Harare woman who bravely exposed a local water supply company for sourcing water from a sewage-contaminated river.

Sandra Mazviita Pamberi, the courageous whistleblower, was initially arrested and charged with spreading false information.

However, on Friday, the state found no grounds to proceed with the case against Mazviita Pamberi and consequently withdrew all charges.

In January, Mazviita Pamberi, a resident of Highlands in Harare, garnered widespread attention after she recorded a video exposing Adela Constructing, the water supply company, for allegedly tapping sewage water and distributing it to unsuspecting residents.

The video swiftly went viral across various social media platforms, sparking public outrage.

Pamberi’s allegations centred on the company’s purported extraction of sewage water, which it then purportedly supplied to the public as drinking water.

Initially accused of violating Section 164(C) and Section 95 of the Criminal Code, Mazviita Pamberi’s case has now been dismissed, marking a victory for transparency and accountability in water management.

Paul Pogba Speaks On Future

Paul Pogba has issued a statement in his first reaction to the four-year football ban imposed on him after being found guilty of doping.

The French international tested positive of a performance-enhancing drug in counter-analysis on a second sample following his anti-doping offence earlier in the season.

The test found heightened levels of testosterone and the Juventus star was immediately suspended before receiving the multi-year ban from football on Thursday.

Responding to the sanction in a statement, Paul Pogba professed his innocence and revealed plans to appeal the ban.

The statement reads: “I have today been informed of the Tribunale Nazionale Antidoping’s decision and believe that the verdict is incorrect.

“I am sad, shocked and heartbroken that everything I have built in my professional playing career has been taken away from me.

“When I am free of legal restrictions the full story will become clear, but I have never knowingly or deliberately taken any supplements that violate anti-doping regulations.

Magaya Wants Billiat Out Of International Retirement

Yadah founder and owner Prophet Walter Magaya says he will persuade Khama Billiat to consider coming out of international retirement.

Billiat, who had a glittering career in the gold and green Warriors strip spanning over a decade, quit international football under unclear circumstances in November 2021.

Previous attempts to lure Billiat back into the Warriors fold have hit a brick wall but Magaya insists he can convince the pint-sized winger to play for Zimbabwe again.

“Well, the first thing is, he needs to play well and be wanted in the national team. But as far as convincing him is concerned, I’m very sure I can do so,” said Magaya.

“Khama is a natural leader and that leadership is still wanted in the national team if whoever will be the next coach sees it that way,” added Magaya.

Billiat, inked a one-year deal to join Yadah, ending months of speculation over his future and Magaya reckons the Mufakose-bred winger is still good enough to light up the Castle Lager Premier Soccer League.

President Chamisa Sends Strong Delegation To Villagers Affected By Zanu PF Violent Displacements

Yesterday, President Nelson Chamisa led a delegation to visit displaced villagers in Masvingo West.

The team included prominent officials such as Honorable Amos Chibaya, Gift Ostallos Siziba, Prince Dubeko Sibanda, Monica Mukwada, Vongai Tome, Bekezela Mapulanka, Martin Mureri, Matara, Pedzisai Gasva, Roswita Madziire, Maggie Chakabuda, Masvingo Deputy Mayor Mberikunashe, Former Masvingo Mayor Shantel Chiwara, and others.

Accompanied by journalists from Masvingo Mirror, TellZim, Midweek, among others, the delegation addressed the well-attended Masvingo Provincial Assembly before visiting Masvingo West, approximately 40 kilometers away from Masvingo town.

The villagers had been instructed by the court to vacate the land due to illegal occupation, resulting from the Zanu PF-led government’s Operation No to Land Barons.

This displacements compelled them to dismantle their homes and belongings.

During the visit, residents shared poignant stories of having to demolish homes they had occupied since 2002.

Allegations surfaced suggesting political motivations behind the evictions, with some residents claiming persecution for their support of opposition candidates in recent elections.

Former Senator Vongai Tome, overseeing President Chamisa’s welfare department, pledged resources to assist the neglected victims of land evictions.

The villagers appealed for support, particularly food, educational assistance for their children, and shelter due to adverse weather conditions.

Honorable Gift Ostallos Siziba underscored President Chamisa’s advocacy for providing title deeds to resettled Zimbabweans, highlighting the irony of Zanu PF’s actions contrary to their warnings about voting for the opposition.

Chiwenga Hijacks Vic Falls Meeting After Mnangagwa Bomb Scare

In response, the country’s security systems have been placed on high alert, and a thorough investigation into the source and credibility of the message is currently underway.

“While our country is peaceful, and all our ports of entry are well secured, such alerts on possible terrorist attacks are taken and treated very seriously, as nothing should be left to chance,” emphasized Charamba.
The nation has been urged to remain calm during this period of heightened security measures, assuring citizens that investigations are underway and that the results will be made public by relevant government authorities once concluded.

Bomb Scare At Vic Falls International Airport, Mnangagwa Abandons Trip

According to a ZimLive source, Victoria Falls International Airport received a call claiming there was a bomb on site, just minutes before President Emmerson Mnangagwa was due to land.

Following the scary moment, Mnangagwa abandoned the trip where he was due to attend the closing ceremony of the renewable energy conference and headed back to Harare where he has since landed safely.

Kenyan Airways flight from Nairobi was also forced to hold for several minutes before diverting to Livingstone.

Mnangagwa’s Third Term Bid, A Tall Constitutional Order

PRESIDENT Emmerson Mnangagwa’s bid to seek a third term in office, which he has set in motion, faces legal hurdles because the constitution bars incumbents from benefiting from an amendment allowing a third term.

The Zanu-PF leader, who clinched a narrow victory over his rival Nelson Chamisa in the August 2023 presidential race, is drumming support for his third term in office through proxies such as the ruling party’s youth league and other affiliated organisations.

He will be gallivanting across the country during his “Thank You” rallies which are now seen as a campaign for the controversial third term. Legal experts and analysts however say his proposed move will face obstacles.

Section 91 of the constitution, which outlines qualifications for election as President and Vice-President, sets a limit of two terms for presidential aspirants.

Section 91 (2) reads: “A person is disqualified for election as President or appointment as Vice-President if he or she has already held office as President under this Constitution for two terms, whether continuous or not, and for the purpose of this subsection three or more years’ service is deemed to be a full term.”

As first reported by The NewsHawks, Mnangagwa wants a third term in office at the expiry of his second term in 2028.

Mnangagwa rose to power after a military coup which toppled former president Robert Mugabe in November 2017. He served his first term between 2018 and 2023 after controversially winning the presidential elections.

He is serving his second term, which expires in 2028, after another controversial poll victory, which failed to meet provisions of Zimbabwe’s Electoral Act, constitution and Sadc Principles and Guidelines Governing Democratic Elections according the Sadc observer mission.

Mnangagwa has taken advantage of the recalls of CCC legislators by self-imposed secretary-general Sengezo Tshabangu to garner a two-thirds majority in the National Assembly to push for a constitutional amendment, to enable him to run for a third term.

Although Tshabangu is a product of divisions and discontent in the opposition, state actors, including the courts, were mobilised to assist him as they took advantage of fractures in the opposition to ensure that Mnangagwa’s thirdterm bid is aided.

Zanu-PF now has a two-thirds majority in the National Assembly but not in the Senate, whereas both houses should approve the proposal if it is to succeed. Section 328 (7) of the constitution however bars an incumbent from benefitting from a constitutional amendment.

It reads: “Notwithstanding any other provision of this section, an amendment to a term-limit provision, the effect of which is to extend the length of time that a person may hold or occupy any public office, does not apply in relation to any person who held or occupied that office, or an equivalent office, at any time before the amendment.”

Legal experts say any constitutional amendment for an extension of presidential term limits is cumbersome.

It requires a referendum. Lawyers say even if the presidential term limits extension is somehow achieved by Zanu-PF, Mnangagwa as an incumbent president will not benefit as any term extension does not apply to incumbents, according to the constitution.

Midlands State University constitutional law lecturer Valentine Mutatu, who has been practising as a lawyer for more than 18 years, told The NewsHawks a fortnight ago that a case study of Mupungu versus Minister of Justice and others recorded as CCZ07/21 can answer in legal terms whether Mnangagwa is at liberty to contest for a third term or not.

“The answer is found in the case of Mupungu v Minister of Justice and others CCZ07/21 where the court commented as follows about section 328 (7) ‘. . . the prescribed term limits cannot be extended so as to apply to sitting incumbents without contravening the provisions of section 328 (8)’. The case involved the debate around the extension of the term of office of the Chief Justice. The interpretation would be correct in the context of your inquiry,” Mutatu said.

“My view is that it is possible to amend the constitution regarding term limits but the incum bent will be precluded from benefiting as per the judgment of the constitutional court.”

The judgment in the case was delivered by Constitutional Court judges Rita Makarau and Bharat Patel in September 2021. The case was brought by Marx Mpungu on 15 May 2021 when Chief Justice Luke Malaba reached 70, the retirement age.

A few days before that date, on 7 May 2021 to be precise, the Constitution of Zimbabwe Amendment (No. 2) Act (No. 2 of 2021) came into force.

Among other provisions, it amended section 186 of the constitution to provide for the tenure of judges in the following terms: “(1) The Chief Justice and the Deputy Chief Justice hold office from the date of their assumption of office until they reach the age of seventy years, when they must retire unless before they attain that age they elect to continue in office for an additional five years; Provided that such election shall be subject to the submission to, and acceptance by the President, after consultation with the Judicial Service Commission, of a medical report as to their mental and physical fitness so to continue in office.”

Mnangagwa therefore extended Malaba’s term of office, prompting Mpungu to approach the Constitutional Court to challenge the extension. Makarau and Patel’s judgment which declared that Malaba’s term limit was unconstitutional went on to highlight that an incumbent president could also not benefit from a term limit extension.

Part of the judgment reads: “By way of contrast, the Constitution abounds with a myriad of provisions that unquestionably constitute specific term limit provisions within the parameters of section 328.

First and foremost, there is section 95(2) which expressly stipulates that the term of office of the President is 5 years and coterminous with the life of Parliament … “. . . As is self-evident, the tenure of all public offices is undoubtedly subject to a specific ‘term-limit provision’ within the meaning of section 328 (1). Consequently, an amendment to any such provision, the effect of which is to extend the length of time that a person may hold or occupy the public office in question, falls squarely within the ambit of section 328 (7). Therefore, by dint of the restriction imposed by section 328(7), such amendment does not apply in relation to any person who held or occupied that office, or an equivalent office, at any time before the amendment came into force and effect.”

Lawyer and former Mutare Central legislator Innocent Gonese told The NewsHawks that Mnangagwa cannot benefit from any presidential term limit extension because of section 328 of the constitution.

“A reading of section 328, particularly paragraph 7, makes it very clear that the intention of the framers of the constitution was to prevent a situation where term limits can be easily extended,” Gonese said.

“In other words, there are various office bearers whose terms are limited by the constitution, you’ve got the Clerk of Parliament, you’ve got the President and so on and so forth. So the intention was to make it really difficult for anyone to have that extension. But more importantly, sub-section 7 makes it very clear that any such amendment cannot then benefit the person who is in occupation of that particular office.

“So the intention was to try to prevent abuse so that people like the president of the Chiefs’ Council, for example, who also have term limits, are not in a position to have or to initiate or to promote an extension in which they would stand to benefit.”

Gonese added that section 328 was meant to provide for a situation where any such extension would then benefit people who would subsequently come into occupation of that office to benefit from the extension of term limits.

“So, the framers of the constitution also made it particularly difficult in the sense that those two provisions, sub-section 6 and sub-section 7, can only be amended after being subjected to a referendum,” said Gonese.

“And in fact, you would need two referendums to do that, because the first one would be to remove the provisions of the particular section concerned. And again, for it to apply, you would need a second referendum, as the wording of that sub-section clearly provides.”

Gonese added: “Now going to the issue of whether an amendment can be made under the current composition of the National Assembly and the Senate. One must bear in mind that a Parliament consists of two Houses, and each House is to vote and proceed separately. You combine the total of both Houses and then look at the two-thirds. So when you look at the political issue now in terms of the composition, in the National Assembly after the recent by-election, it’s quite evident that the governing party now has a majority. In terms of the Senate, technically speaking, in terms of the numbers, that majority is not there.”

The former MDC chief whip highlighted that one must remember that this is not necessarily a legal question as it can also be a political issue, with a recent example being Amendment No. 2 in the 9th Parliament when some members of the MDC led by Douglas Mwonzora voted in favour of the amendment.

How Effective Is Government’s New Learning System?

GOVERNMENT is implementing the Heritage-Based model aimed at transforming the education system to produce citizens with relevant skills, applied knowledge, and dispositions that are key in national development.

In a bid to revolutionise the country’s education system, government has adopted the Heritage-Based Education 2024-2030 policy which is anchored on science and technology.

Addressing journalists during a Post Cabinet briefing in Harare this Tuesday, the Minister of Information, Publicity and Broadcasting Services, Dr Jenfan Muswere said the education system will foster critical thinking and innovation.

“The future of the country will increasingly be shaped by science and technology, hence the bias in the education system to foster critical thinking, innovation, creativity, problem-solving, and programming. As the learners enroll for secondary school level, they are then categorised according to their areas of proficiency. Central to the delivery of quality learning is the capacitation of teachers since the heritage-based curriculum requires a different approach. Focus will be placed on in-service teacher training and coaching, using locally available resources,” he said.

Dr Muswere said the National E-Learning Strategy will also come into force.

“Suitable and appropriate physical and digital infrastructure will be provided. Closely related will be the provision of adequate and appropriate infrastructure including classrooms; workshops; laboratories; internet connectivity; technical equipment and teachers’ houses; to achieve the intended goals. The workshops and laboratories shall be tailor-made according to the unique geographical needs and locally available resources that learners can observe, manipulate, and explore during their learning processes. Access to electricity, either from the national grid or renewable sources of energy will be a priority for every school. This is to bridge the gap between the rural and urban schools. The focus will be more on learning by doing,” he added.

The Minister of Higher and Tertiary Education, Innovation, Science and Technology, Professor Amon Murwira noted that the country is adopting an education system that produces skilled professionals to develop the country.

The Minister of Primary and Secondary Education Dr Torerai Moyo also indicated that Continuous Assessment Learning areas have been reduced to six for Grade sevens, as the education system becomes vocationalised, “The revised curriculum is intended to rationalize CALA, they used to do 27 areas from eight areas per subject to one. Now grade 7 will do six areas and students will do school-based learning.”

Dr Muswere also informed the nation that the 2024 independence celebrations will be held in Murambinda, Manicaland province.

By Political Reporter- Former CCC leader Nelson Chamisa, has responded to Sengezo Tshabangu’s urgent court application demanding the party’s properties from the charismatic politician.

Since he resigned from CCC on 25 January 2024, Chamisa has not publicly stated his plans despite some of his key allies, such as Amos Chibaya, Gift Siziba and Prince Dubeko Sibanda, holding mini-rallies where he is eulogised.

Chamisa deposed an opposing affidavit at the Bulawayo High Court on 27 February 2024 in response to Sengezo Tshabangu, who, posing as the interim CCC Secretary General, filed an urgent chamber application in early February to recover the party’s provincial offices in Bulawayo.

Tshabangu argued that the CCC party offices had been seized by some youths who claimed to be Chamisa’s supporters after he resigned from the party on 25 January 2024.

Chamisa alleges that “many people” who have no connection to him misappropriated his name and image.

In the CCC’s urgent court application, Tshabangu stated that their office – the Gertrude Mthombeni House – situated at Number 41 Fort Street between Second and Third Avenue in Bulawayo is where all provincial party documents are kept, party activities and programmes are conducted.

Tshabangu stated that Chamisa’s supporters forcibly took “control, occupation, and possession” of the building and painted the whole office and precast wall in blue and black.

Blue is the colour associated with the so-called the Democratic Alternative in Zimbabwe movement allegedly led by Chamisa.

However, in his opposing affidavit filed at the Bulawayo Division of the High Court, Chamisa said:

4.1. I deny all the allegations of fact and conclusions of law made in this application in their entirety. I did not despoil any person of any premises or offices anywhere in Zimbabwe and I have certainly not done so in Bulawayo. I have set of offices which are located in Harare. I am presently not with any movement, grouping political party. I did not direct, require, or encourage anyone to take over the premises which are referred to by the deponent to the founding affidavit as attributed to me. I resigned as the leader of the Applicant and since that resignation I have not physically been to Bulawayo. I completely have nothing to do with the Applicant.

4.2 If there is anyone in occupation the deponent to the founding affidavit knows who they are and that its not me. The Applicant must sue those people, if ever they exist, and instead of harassing me.

4.3 I submit that this application is a revolting abuse of Court process to grandstand and seek relevance by the deponent to the founding affidavit through dragging my name into this charade. The claims that I have despoiled the Applicant because some premises which I have no connection to have been painted blue and my face has been painted on the wall of the premises is completely bizarre. My image and name have been appropriated by many people who have no connection to me. In fact, the irony of the application is that since I resigned as the leader of the Citizens Coalition for Change, the Applicant and the deponent to the founding affidavit have continued to use my face on their preferred logo. I wish to reiterate that I have no special association with any colour, any political organisation or any movement.

4.4 The present application is a nuisance and a frivolity in the highest degree which seeks to drag the Court into the deponent’s tired and base political schemes. It is an egregious violation which has been concocted by the deponent to the founding affidavit and other similar minded persons. I believe that for this reason, the deponent to the founding affidavit must be made to pay my costs of suit de bonis propriis on the scale of legal practitioner and client.

WHEREFORE, I pray that the application be dismissed with my costs of suit being paid on the scale of legal practitioner and client by Sengezo Tshabangu.
