Teachers up in arms with ZEC over payments

Teachers are up in arms with the Zimbabwe Electoral Commission (Zec) over outstanding payments after the electoral body engaged them as election officers for the disputed August polls.

According to unions representing teachers, educators who participated in various election-related duties are being sent from one office to the next when they inquire about payment.

This is not the first time Zec has clashed with teachers over non-payment for election-related work.

Educators Union of Zimbabwe secretary-general, Tapedza Zhou, threatened court action against the electoral body over the matter.

“Last time, we warned Zec against engaging teachers without contracts as this opened doors to abuse,” Zhou said.

Amalgamated Rural Teachers Union of Zimbabwe leader, Obert Masaraure, accused Zec of taking teachers for granted.

“Zec has been contacted by individual teachers and the unions with regards to the payment but the electoral body has been pledging but without fulfilling the promise.”

Zec deputy chairperson, Rodney Kiwa, referred to the chief elections officer Utloile Silaigwana when contacted for comment.

He added: “I would advise the unions to approach Mr Silaigwana with the necessary documents which show that they were indeed employed and at which station.”

Efforts to obtain a comment from Silaigwana were fruitless.

He also did not respond to WhatsApp messages sent to him.

Zimbabwe National Teachers Union chief executive, Manuel Nyawo, however, blasted Zec for dishonesty.

“Such dishonest behaviour is uncalled for because it puts the name of President Emmerson Mnangagwa and Zanu PF into disrepute because Zec acted on the instructions of the Zanu PF government that was and is still in power,” Nyawo said.

“It’s a miscarriage of justice to see teachers being abused to this extent considering that they are struggling to survive with the little earnings they are getting in the form of salaries.” NewsDay

Byo city council to kill stray dogs

By A Correspondent- Bulawayo City Council is mulling a tie-up order exercise where stray dogs will be shot as a means of controlling the population of dogs in the city.

The city’s director of health services Dr Edwin Mzingwane said: “Council from time to time conducts a tie-up order where we join other stakeholders in ensuring that dogs are within designated places at all times. During this time we shoot any stray dogs as a means of controlling the breeding of dogs and reducing the number of unregistered dogs which put residents at risk.”

“Unknown dogs are unvaccinated and can easily spread rabies to other dogs or humans which may put us in a tight situation as we know that rabies is incurable. Dogs are also a menace they tamper with refuse bins and create a mess that makes the city dirty. We also have a worrying trend where dogs are frequenting Mpilo Central Hospital and it’s unacceptable.” The Chronicle

Gvt, local authorities blamed for cholera

Human rights lawyers say government and local authorities must be held accountable for cholera deaths as the water-borne disease spreads across the country claiming lives.

The Zimbabwe Lawyers for Human Rights (ZLHR) accused authorities of “dereliction of duty” in the handling of the cholera outbreak.

Zimbabwe is grappling with a third cholera outbreak this year, with cases having been confirmed in all the 10 provinces.

According to the Health and Child Care ministry, Zimbabwe has recorded 200 cholera-related deaths and 130 hospitalisations since February 2023 when the outbreak first surfaced.

“The ongoing cholera outbreak is a chilling reminder of the devastating consequences of failing to provide necessities to the people. The government must act swiftly and effectively to protect lives and prevent further tragedy,” the ZLHR said.

The rights lawyers expressed outrage over preventable deaths from a “medieval disease” in Zimbabwe.

“It is a staggering indictment on both local and central governments that Zimbabwe is still haunted by a medieval disease like cholera,” the lawyers said.

They said officials should be held accountable for their “failure to invest in and adequately manage basic water, sanitation infrastructure and public health facilities”.

ZLHR criticised the sluggish response to the crisis, citing lack of access to clean water, sanitation and proper medical care in affected communities.

They warned that “this unacceptable failure of leadership” constituted a violation of the government’s constitutional obligations and international human rights commitments.

“The failure by central and local governments to swiftly respond to the cholera epidemic through providing basic health services, medical treatment and services, clean running water and sanitary facilities to people, is an unacceptable failure of leadership and represents a clear failure by local authorities and government to uphold their constitutional obligations as provided in the Constitution and other regional and international instruments,” ZLHR said.

The rights lawyers urged the government to significantly increase budgetary allocations for water, sanitation and hygiene.

“To arrest the cholera epidemic and prevent recurrent outbreaks of the primitive disease, ZLHR implores local and central governments to seriously embrace their social and economic rights, obligations provided in the Constitution and guarantee progressive realisation of the right to healthcare, the right to safe, clean and potable water for everyone and the right to a clean environment that is not harmful to people’s health or their well-being,” the organisation said.

As cholera spreads, across the country, the World Health Organisation (WHO) has intervened by setting up cholera treatment centres to save lives.

“This move aims to improve access to critical care and prevent further deaths and spread of the disease in vulnerable communities,” WHO said.

The global health agency said upgrading of the cholera treatment centres would lead to increased bed capacity through expanding the facilities to accommodate a larger number of cholera patients.

Health and Child Care minister Douglas Mombeshora said there was a need to improve community engagement to end the scourge.

“We recently received equipment from WHO and we need to identify places where these are needed the most so that we distribute them and help fight the outbreak,” he said.

WHO representative to Zimbabwe, Jean-Marie Dangou added: “These upgrades are crucial to ensure timely and effective care for cholera patients in rural areas. By expanding treatment capacity, improving hygiene and equipping healthcare workers, we can save lives and contain the outbreak.”

The water-borne disease, which spreads through drinking water or eating food contaminated with the cholera bacterium and causes severe diarrhoea and vomiting, is now endemic in the country.

Man kills uncle using wrestling technique

A Masvingo man, Vetengeni Kwaramba (35), tragically killed his 62-year-old uncle using the wrestling “sharpshooter” move, the court has been told.

This emerged when Kwaramba appeared before Masvingo High Court judge, Justice Munyaradzi Mawadze for trial.

He was initially charged with murder but the matter proceeded based on a statement of agreed facts and he was convicted of culpable homicide on his plea of guilty.

The two resided under Chief Makanganwi, Bikita, albeit in different villages.

On 7 March 2023, both the accused and the now deceased were among mourners attending a funeral wake of their grandfather in Romberai Village, Chief Mazungunye, Bikita.

During a church service, the two were among a group of men slaughtering a beast for relish at the funeral gathering.

The uncle and nephew engaged in-jokes, mocking each other as what usually happens at such funeral gatherings.

Kwaramba had exhibited a premature appetite for roasted beef and his uncle in turn mocked him.

“The accused resorted to some physically violent act akin to World Wrestling Entertainment (WWE) moves by tackling the 62-year-old.

“Kwaramba held the now deceased’s legs, lifted them to the accused’s chest level and folded them.

“The hapless now deceased was bent over and forced to lie on his waist with his legs pressed and folded.

“The now deceased was resting on his neck, a move called “sharpshooter” in wrestling parlance,” the court heard.

As a result, undue pressure was exerted on the now-deceased’s neck causing a neck fracture.

The now deceased was ferried to Silveira Mission Hospital and later transferred to Masvingo General Hospital where he died on 8 March 2023.

In sentencing Kwaramba the judge considered that soon after realising that he had inadvertently caused the injury on the now deceased he immediately stopped and tried to resuscitate the now deceased.

“The accused atoned for his conduct. The accused and the now deceased’s families are now reconciled and have accepted what happened.

“This gesture paves the way for reconciliation and both families are likely to move on in harmony despite the stigma attached to the accused. The question of restorative justice is critical,” said the judge before sentencing Kwaramba to three years wholly suspended for five years on condition the accused does not commit within that period any offence involving the use of violence or cause the death of a person. Sikhala solidarity rally blocked

By A Correspondent- Police have blocked a solidarity rally for opposition Citizens Coalition for Change (CCC) politician, Job Sikhala, set for Saturday, sparking outrage from his supporters.

The Job Sikhala Solidarity Council, which is behind the rally, had notified authorities of its intention to hold the event at Huruyadzo Community Hall.

The rally was meant to pile pressure on the government to release Sikhala, who has been in remand prison since June last year charged with incitement to public violence.

In a letter addressed to the organisers, police said the planned rally was a security threat as it did not meet provisions of the Maintenance of Peace and Order Act (Mopa).

“The notification to hold a procession rally in solidarity with Job Sikhala at Huruyadzo Community Hall on December 23 is prohibited. The notification does not meet the requirements of section 7 of the Mopa Act. Therefore, your event was not sanctioned,” the letter read.

In response, the organisers of the rally accused the police of using Mopa as a pretext to stifle dissent and deny citizens their constitutional rights.

“The Job Sikhala Solidarity Council notes with disgust the blocking of the December 23 solidarity rally by Zimbabwe Republic Police (ZRP), it said.

“The ZRP claims that the notification failed to meet the requirements of Mopa, an excuse that has been consistently used to deny citizens their freedom of association and assembly.”

They condemned the “systematic restriction of all activities done in the name of Job Sikhala by the Zimbabwean State”.

“It is apparent that the name Job Sikhala attracts repression from the regime of Emmerson Mnangagwa. The State has caged Sikhala for more than 18 months, but they still shiver at the mere mention of Sikhala’s name,” the council said.

“The council will not be deterred by this setback. A series of solidarity activities are lined up to rally the millions of pro-democracy campaigners in Zimbabwe and beyond to collectively demand the release of Job Sikhala.”

Sikhala has been in remand prison for more than a year and a half on charges of inciting party supporters to avenge the death of slain activist, Moreblessing Ali.

Ali was killed and her body cut into pieces. Her remains were found in a disused well.

Heartless Man Forces Self On Child(4)

A 59-year-old man from Harare who allegedly raped his 13-year-old daughter several times has been slapped with an effective 20-year jail term.

A 59-year-old man, who threatened to kill himself in an effort to pacify his daughter whom he sexually abused, will spend 20 years locked up in prison for the crime.

The man would abuse the child whenever he was home alone with her.

He told his daughter that if she disclosed the abuse to anyone, he would commit suicide.

He was caught red-handed in bed with the child by his second wife.

Meanwhile, in another case, a man who raped his four-year-old daughter was given a 15-year jail term.

The 24-year-old violated his child in August this year.

A neighbour heard the child screaming and upon being quizzed, the four-year-old narrated how she was being abused by her father who at times took baths with her.

Both men were convicted after full trials with the state managing to prove that the two committed the alleged crimes.

In passing sentences, magistrates in the two cases noted the prevalence of such cases, hence the need for deterrent sentences.

HIGHLANDERS are set to go for another rebuilding exercise, with a player mass exodus looming at the Bulawayo giants over contractual disputes.

Highlanders’ woes are far from being over and after the club parted ways with coach, Baltermar Brito, the club is on the verge of losing several key players.

Gweru City Threatens To Convert ED Bonds Into US Dollar Debts

GWERU City Council has issued a stern ultimatum to its debtors, demanding settlement of outstanding dues by December 31. Those failing to meet the deadline face the prospect of their arrears being converted into United States dollars, according to a public notice released by the local authority.

The city council is grappling with the challenge of recovering a staggering $54 billion owed by residents, businesses, and government entities. In an effort to compel payment, the council has also threatened legal action against defaulters.

A statement from Gweru City Council read, “Clear your bills before 31 December 2023, and failure to comply may result in your bill being converted into USD. Failure to clear your bills will result in litigation.”

Gweru City Council spokesperson Ms Vimbai Chingwaramusee revealed that, as of October 31, ratepayers owed the council $54 billion. She attributed the mounting debt to the failure of ratepayers to fulfill their monthly payment obligations.

The council is struggling to maintain essential services due to the substantial outstanding debt. Ms Chingwaramusee emphasized, “We need to use that money to meet service delivery expenses such as buying fuel and other such expenses.”

Due to non-payment by ratepayers, the city council is now grappling with significant arrears owed to service providers, including Zimbabwe Revenue Authority (Zimra), Zimbabwe Electricity Transmission Distribution Company (ZETDC), and the Local Authorities Pension Fund (LAPF).

Gweru Mayor Councillor Martin Chivhoko expressed his concern over the situation, attributing it to the reluctance of ratepayers to settle their bills. He highlighted the critical need for funds to fulfill the council’s obligation of providing services to residents and the business community.

“If residents and other ratepayers pay their bills, council will also be able to pay its service providers as well as meet other financial obligations,” said Clr Chivhoko.

Director of the Gweru Residents and Ratepayer Association (GRRP) Mr Cornelius Selipiwe urged defaulting residents to clear their arrears, emphasizing the importance of consistent payments to enable the council to operate.

Earlier in the year, the council implemented debt recovery measures, including the suspension of interest on arrears, and threatened legal action against defaulters in a bid to address the financial challenges.

Activist Hopewell Chin’ono Levels New Accusations Against CCC President, Saying He’s Paying Women To Expose Him.

By A Correspondent | In a new round of rapturous statements, activist Hopewell Chin’ono, who for over 27 years has a recorded pile of unchallenged serious allegations by various women in the grooming-category, has opened accusations against CCC President Nelson Chamisa who was a minor during the days when the first reports surfaced against Chin’ono running by a different surname back then.

While Chin’ono did not explicitly mention Chamisa by name, all of his connotations were pointed at Chamisa, whose character he has been weekly ambushing throughout the year. This ongoing saga began on January 1, 2023, when Chin’ono falsely accused Chamisa of neglecting a voter registration campaign.

Subsequently, he accused Chamisa of incompetence, going as far as stating that his Citizens Coalition for Change party, CCC, must split at the end of 2023 due to what Chin’ono alleges is Chamisa’s incompetence.

Writing on Monday afternoon, Chin’ono randomly accused Chamisa of using journalist Simba Chikanza to pay women who will soil his name.

“I have no interest in running for office. There is a politician who thinks I want to run for office and is working with Simba Chikanza, offering money to women to scandalize me so that, according to them, I don’t run in 2028! I don’t know why people are so obsessed with me running for office; I have no interest! The obsession has become so ridiculous; I am a journalist and filmmaker, my influence stays there!” stated Chin’ono in response to the accusations.

Chin’ono, who prefers a community title proven in courts for grooming women for sex, insisted that he harbours no political ambitions. However, he believes there is a coordinated effort to undermine his potential candidacy in the upcoming presidential race.

Simba Chikanza, responding to the allegations, expressed surprise and questioned the motives behind the accusations. “Those seeking my assistance on detecting frauds, here’s a case study: Did you see the Multi-Award Winning Daddy’st’s allegation that I’ve offered women money to expose him over his ambition to run for presidency in 2028?” said Chikanza, refuting claims of collaboration with Chamisa.

Chikanza drew parallels to a previous investigation involving Walter Masocha, emphasizing that Chin’ono’s use of the online-grooming salutation “Daddy” sets him apart. “Any professional who pops out and starts making people salute them as a ‘Daddy’ knows very well they are using a tag line for groomers and rapists,” he added.

Chikanza further remarked that of all the multiple women who have blown the whistle on Hopewell Chin’ono over the years, none of them has a financial need to be paid by any politician or journalist, as they are well established in their careers.

Nelson Chamisa did not provide any comment on the allegations, and the CCC leader has, for over the year, chosen to ignore the Daddy-vist when he opens accusations against his name.

Meanwhile, Hopewell Chin’ono has continued conversations where he concludes debates by flaunting wealth, while failing to disclose the name of the bank or company he says gave him a £50,000 sports car loan in 1996, that he claims is the real source of his real estate acquisitions.

Mamelodi Sundowns To Decide On Lunga Future

Mamelodi Sundowns are reportedly set to make a decision on the future of Divine Lunga when the January transfer window opens.

Lunga returned to Sundowns from a season-long loan stay at Golden Arrows last term but has not featured for the DStv Premiership champions this season.

Initial indications were that the club is waiting for the defender to get his permanent residency permit for him to be registered as a local player.

Zimbabwean Entertainment Has Cinema at Its Core

Now that the internet has spread throughout Africa, many nations are putting a greater focus on entertainment. In 2023, Zimbabwe’s internet penetration stands at around 35 per cent of the population, but that figure is rising sharply. In recent years, film festivals have played a crucial part in helping Zimbabwean cinema progress. Events like the International Images Film Festival for Women and the Zimbabwe International Film Festival have provided platforms for local talents to showcase their work, network with international filmmakers, and gain exposure to diverse cinematic styles.

Who is Alex Gwaze and What is His Mission?

There are many leaders in the film industry in Zimbabwe who want to help ensure it survives and flourishes in the years ahead. Zimbabwe needs to learn from the success of Nollywood in this regard and could even look at the burgeoning scenes in South Africa and Kenya as well. As platforms like Netflix increase their customer base in Zimbabwe, these people will be hungry for local content. The film industry in the country could be poised to benefit from this, and there will be more chances for movies to shoot to worldwide acclaim thanks to the accessibility of streaming services around the globe.

Two cops, 4month old baby drown

By A Correspondent- Two police officers and their four-month-old daughter drowned after their vehicle was swept away as they attempted to cross the flooded Kana River which cuts across the road between Gomoza in Lupane and Kambe in Manoti, Gokwe.

Two other passengers aged 19 and 5 escaped from the Ford Ranger and swam to safety in the December 17 incident.

Police have named the dead as Moses Manyongodo, a 35-year-old police constable based at ZRP Lupane Traffic; his wife 30-year-old detective constable Ireen Muzamba and their daughter Hellen Manyongodo.

Manyongodo was driving towards Kambe Business Centre in Manoti when he found the Kana River flooded.

“He drove the vehicle into the flooded river in an attempt to cross. After getting to the middle of the bridge, the vehicle was swept away by the current for about 45 meters before it got submerged in the water. The three victims drowned whilst still in the vehicle. Their bodies were ferried to Gokwe South District Hospital mortuary,” police said.

Police Condemned For Blocking Job Sikhala Solidarity Rally

By A Correspondent| In a startling turn of events, the Job Sikhala Solidarity Council has expressed its deep disappointment at the Zimbabwe Republic Police (ZRP) for blocking the much-anticipated Solidarity rally scheduled for 23 December. The ZRP cites alleged non-compliance with the Maintenance of Peace and Order Act (MOPA) as grounds for the denial, a justification that the Council deems as a consistent ploy to curtail citizens’ Freedom of Association and Assembly.

The Council, in a strongly worded press statement issued by National Organizer Obert Masaraure, condemned what they view as a systematic restriction on activities associated with Job Sikhala by the Zimbabwean State. The statement suggests a targeted repression against anything associated with Sikhala, implying that the mere mention of his name rattles the regime of President Emmerson Mnangagwa.

Job Sikhala, a prominent figure, has been detained for over 18 months, yet the authorities continue to exhibit apprehension at the mention of his name. The Council warns the Mnangagwa regime against treating the Sikhala Solidarity movement as a terrorist group, asserting that their activities are constitutionally grounded, aimed at applying pressure for the release of Sikhala, who they argue is a political prisoner.

The Council remains undeterred by this setback, announcing a series of Solidarity activities designed to mobilize pro-democracy campaigners both in Zimbabwe and beyond. They emphasize the constitutional right to demand the release of Job Sikhala and express their determination to continue the fight for justice.

In response to the rally’s cancellation, the Council has unveiled the #WiwaWednesday Lecture series, set to launch on X space, with further programs promised in the near future. The message is clear: “Free Job Sikhala now!”

Two Armed Robbers Shot Dead In Shootout With Police

HARARE – Two suspected armed robbers were killed in a shootout with detectives in Harare on Tuesday, including a South African national, police said.

Four other men, three of them South African and one Zimbabwean, were arrested and face charges of conspiracy to commit armed robbery and possession of firearms.

Jabulani Ngobeni, 45, of Tzannen in Limpopo was shot dead after firing at detectives at a guest house in Harare while Godknows Machingura, 44, was shot dead while fleeing from police.

The arrested suspects have been named as Andrew Masubelele, 38, of Atteridgeville in Pretoria; Ndiafhi Makhado, 39, of Thsakhuma in Limpopo; Emmanuel Makamo, 22, of Alberton in Johannesburg and Paul Zhou, 55, of Waterfalls in Harare.

The gang allegedly had a plan to rob a Chinese national with business operations in Kwekwe by ambushing his vehicle as he drove to Harare.

Detectives were put on the tail of the gang after learning that some of the suspects had entered the country through Beitbridge border post, driving in a Ford Ranger with registration number JG-04 GH GP.

Investigators tracked them to a guest house on Mauritius Road in Arcadia, Harare. On seeing the detectives, Ngobeni allegedly opened fire with his 9mm Star Pistol but was shot and disarmed.

Police arrested him, Makhado, Masubelele, Makamo and Zhou who told investigators that his role had been to secure accommodation and hire vehicles for the gang – a Toyota Fortuner and a Honda Fit.

Interviews with the suspects led police to Shamva where Machingura was allegedly monitoring the movements of the Chinese man who works on Birmingham Road in Kwekwe.

With the help of the suspects, police lured Machingura to Morgan High School in Arcadia. Upon seeing detectives, he allegedly drove off at high speed leading to a chase during which he was shot in the groin and disarmed of a 9mm Taurus Pistol. He was declared dead upon arrival at Parirenyatwa Hospital.

Police spokesman Assistant Commissioner Paul Nyathi says they are concerned by the growing number of foreign nationals committing armed robberies in the country.

“The police is concerned with the involvement of8 foreign nationals in some of the robberies. A case in point is the recent Kadoma-Chegutu shootout and the Victoria Falls incident where some foreign nationals ran away after a shooting incident,” Nyathi said.

“The police assures the public that it will account for all criminals and ensure the law takes its course. Any form of confrontation with the police will be met with an appropriate response.”

Another Horror Crash In Masvingo

By- A passenger in a Toyota Hilux double cab vehicle involved in a head-on collision with a haulage truck near Gokomere Mission on Monday died yesterday at Masvingo Provincial Hospital.

Masvingo Police Spokesperson Inspector Kudakwashe Dhewa identified the deceased as McAulife Itai Nhika (27) of Gondo Village in Marondera.

The accident happened around 2 pm at the 281 km peg after the Harare-bound Hilux encroached into the lane of the truck.

Four passengers were aboard the Hilux, one died on admission at Masvingo Provincial Hospital, and the other is at the same hospital with severe injuries.

The other two are in a stable condition.

The truck driver was alone and did not suffer any injuries.

Meanwhile, Police are investigating and appealing for information about a hit-and-run accident which happened on Monday morning around 5 am at Sikato Business Centre resulting in the death of a pedestrian.

Masvingo Police Spokesperson Inspector Kudakwashe Dhewa said the unidentified vehicle hit and killed Prosper Marashani.

“The deceased was crossing the Masvingo-Nemamwa Road when he was hit. His body was taken to Masvingo Provincial Hospital and investigations are ongoing.

“It is a crime not to stop after an accident and every accident should be reported within 24 hours,” he said.

Hired Mshikashika Kills Six (6) Family Members

By- A hired Mshikashika Honda Fit has killed six Mashonaland Central Province family members.

The six are a pregnant mother, her husband and four of their children who were travelling from Marymount in Rushinga to Chinhoyi in the early hours of Monday.

There were among the nine people killed early in the head-on collision between two Honda Fit vehicles in Mazowe.

Expecting mother Loice Kapinga and her husband Silas Gomo were travelling with their four children, including five-year-old Tanyaradzwa and eight-year-old Angela who have already been identified.

The father-in-law, Mr Edson Kapinga, said they were failing to accept that six members of their family died in the accident.

Lovemore Chibanda from Murehwa also died in the accident, including Tashinga Chitsike from Mt Darwin.
Chitsike’s father Mr Badwell Chitsike said he was failing to understand what kind of problem the vehicle had.
The driver of the Honda Fit, Mr Promise Makopo (22), managed to get out of the burning car, but died from burns sustained on both legs.
His father, Mr Pardon Makopo, said his son was hired by four artisanal miners and one lady to move them around.
“He was born at Concession Hospital and did his primary education at Mazowe Citrus and Mazowe Mine schools. He was my favourite child and God has taken him away from me,” he said.
His childhood friend, Mr Nomore Jongwe, was in disbelief and visited the accident scene.
“They were drinking at the Nduku Shopping Centre and when the beerhall closed, they proceeded to Glendale. Promise was a pirate taxi driver plying the Mazowe Inn-Jumbo route,” he said.
Minister of State for Provincial Affairs and Devolution for Mashonaland Central, Christopher Magomo, visited the accident scene yesterday and consoled the bereaved families.
He said when nine lives are lost at once, it is a disaster.
Minister Magomo said the three burnt beyond recognition were being identified through the police forensic team.
“We have declared war against pirate taxis and police are manning the highways. Those caught on the wrong side of the law will be punished severely. Motorists must not drive when fatigued and travelling during the night is risky. Driving and drinking is a crime. Rest when fatigued and continue with the journey later.”
Officer commanding Mazowe district Chief Superintendent Enock Masimba said: “The festive season is associated with excitement and people should hire registered vehicles. We appeal to people not to drive while drunk.
“From preliminary evidence, there is a possibility of speeding. The engine flew almost 10 metres away indicating that the vehicle was not roadworthy.”
Provincial Medical Director Dr Clemence Tshuma said four of the injured, including a six-year-old girl, were rushed to Concession Hospital before three were transferred to Parirenyatwa for specialist care.
A sombre atmosphere engulfed Concession Hospital where families of the deceased gathered to identify the bodies of their loved ones.
Meanwhile, the acting director in the Department of Civil Protection Mr Farai Hokonya said the Government had offered to assist families with funeral expenses.
He called on people to use regularised public transport when travelling.
“We urge drivers to observe road rules and regulations because we cannot continue to lose innocent lives due to negligence. Be a watchdog for the other drivers and road users,” said Mr Hokonya.
Bereaved families will get coffins, transport, foodstuffs and assistance with the burial process.
Meanwhile, more than 30 vehicles operating as pirate taxis have been impounded by the Mazowe traffic department.

Smith Faces Lengthy Sentence on 40 Fraud Charges

By A Correspondent| Michael Gordon Smith aka Mike Smith, a beleaguered Harare entrepreneur, is now confronted with 40 charges related to defrauding a co-director and fellow shareholder at MA Auto Spares.

Smith initially appeared before the courts in February of this year, accused of defrauding Michael Asher of almost US$22,000 and R124,000.

He appeared in court on 20 November 2022 where his defence lawyers requested for further particulars carrying the evidence to be paginated before they can officially accept and acknowledge receipt.

The presiding magistrate warned the defence lawyers against delaying the court’s time by asking for more to be done by the state.

The rulling on the defence council application was handed on 12th December 2023 with the magistrate throwing out the application on the basis that pagination is not a requirement at law in criminal matters.

The accused who is now facing 22 more charges of defrauding MA Auto Suppliers ,T/A Mr Cruiser, of at least US$38 000 and R124 000 and theft of trust property, in addition to the 16 counts he was facing when he was initially charged.

Smith is currently out on ZWL $100 bail.

He first brought before the Court in February this year, charged with defrauding MA Auto Suppliers represented by Michael Scot Asher, who is the complainant in the case.

The offences were allegedly committed while Mr Asher was away in Australia during the Covid-19 era when travelling was restricted.

However the court gallery were shocked with the amount of evidence that was produced by the investigating officer nailing Smith in the matter.

Key evidence was extracted from several devices by the Zimbabwe Republic Police (ZRP) Cyber Lab and prove key to the case.

Should all charges against the accused be proven, he is likely to face a lengthy jail sentence, according to the State prosecutor.

Section 136 of the Criminal Law (Codification and Reform) Act; [Chapter 9:23] states:

“Any person who makes a misrepresentation (a) intending to deceive another person or realizing that there is a real risk or possibility of deceiving another person; and (b) intending to cause another person to act upon the misrepresentation to his or her prejudice, or realizing that there is a real risk or possibility that another person may act upon the misrepresentation to his or her prejudice; shall be guilty of fraud if the misrepresentation causes actual prejudice to another person or is potentially prejudicial to another person, and be liable to (i) a fine not exceeding level fourteen or not exceeding twice the value of any property obtained by him or her as a result of the crime, whichever is the greater; or (ii) imprisonment for a period not exceeding thirty-five years; or both.”

The matter has been postponed to January 15 , 2024 for continuation of trial.

Meanwhile, the acting director in the Department of Civil Protection Mr Farai Hokonya said the Government had offered to assist families with funeral expenses.

He called on people to use regularised public transport when travelling.

“We urge drivers to observe road rules and regulations because we cannot continue to lose innocent lives due to negligence. Be a watchdog for the other drivers and road users,” said Mr Hokonya.

Bereaved families will get coffins, transport, foodstuffs and assistance with the burial process.

Meanwhile, more than 30 vehicles operating as pirate taxis have been impounded by the Mazowe traffic department.

Chamisa writes to ZEC

CITIZENS Coalition for Change (CCC) leader Nelson Chamisa has written to the Zimbabwe Electoral Commission (ZEC) blocking self-imposed Secretary General Sengezo Tshabangu from using his face.

This comes as the opposition is gripped by internal fights with Tshabangu recalling CCC Members of Parliament on the pretext of him being the SG a position that the party has claimed is non-existent.

Tshabangu Monday endorsed his candidates to run for the February 3 by-elections using CCC symbols which include Chamisa’s face.

In a letter addressed to ZEC, Chamisa through his lawyers said the use of party symbols by individuals outside those provided by him is an illegality.

“We act for and on behalf of Advocate Nelson Chamisa, at whose instance we write. Kindly note our professional interest.

“Our client is the president of Citizens’ Coalition for Change political party formed on 22 January 2022.

“We are advised that in June 2023, he gave consent to specific candidates from the political party he leads, to use his face image as a logo in the harmonized elections held between 23 and 24 August 2023.

“Those who were granted permission to use the image of his face had their nomination papers, as more fully appears in your records, signed by the names appearing in a letter dated 15 June 2023 and received by yourselves on the same day. A copy of the said letter is attached hereto for your case of reference.

“We are advised that some individuals, other than the individuals mentioned above, have resorted to misappropriation of the image of our client’s face for purposes of misrepresenting and misleading the electorate. We advise that this is illegal,” read the letter.

Last month, Tshabangu’s candidates used CCC party symbols in the by-elections.

Dangerous Culinary Drive: Gas Stove Cooking Lands Truck Driver in Critical Condition with Giblets and Chicken Feet Onboard

A truck driver who was cooking a meal of giblets and chicken feet on a gas stove while driving is in a critical condition after he lost consciousness.

Midlands EMS advanced life support paramedics were dispatched to the N3 in Tweedie on Tuesday, where the truck came to a stop after the driver passed out from inhaling gas from a portable stove.

“On arrival it was found that bystanders had broken the driver’s window and removed him from the truck that came to a stop across the N3.

“The driver was found to be in a critical condition with carbon monoxide poisoning and required advanced life support treatment,” said spokesperson Roland Robertson.

He said once stabilised, the driver was taken to hospital.  Police as well as traffic authorities cleared the busy road.

Zimbabwe Leads Global Beer Drinking Survey

Zimbabwe has been ranked one of the countries with a high alcohol consumption rate per capita, according to the latest survey.

According to a survey by Wise Voter, an individual Zimbabwean consumes 62,8 litres of pure alcohol annually, dwarfing the figures of other countries on the list.

Tunisia came second with 36,6 litres of consumption per capita.

Wise Voter is an American global institute researching politics, health, climate and economy.

“Zimbabwe 62, 8 litres, Tunisia 36,6 litres, Eswatini 34,4 litres, Maldives 33,7 litres, Afghanistan 33,5 litres, Namibia 32,4 litres, South Africa 29,9 litres, Algeria 29,1 litres, Turkey 28,5 litres and Iran 28,4 litres,” the report read.

“Zimbabwe has the highest alcohol per capita globally. An individual Zimbabwean may consume 62,8 litres of pure alcohol when comparing the alcoholic beverages they would have taken in 12 months, with a prevalence of alcohol dependence of 2,2%,” read the report.

The survey report mentioned that one serving of alcohol was classified as 0,0177 fluid litres of alcohol.

“This corresponds with a 0,354 litre can/bottle of beer, one 0,148 litre glass of wine, or one 0,044 litre shot of liquor. When comparing alcohol consumption across countries, organisations will look at litres of pure alcohol,” it said.

The Kingdom of Eswatini was placed in third place with 34,4 litres of alcohol consumption per capita, with a prevalence of alcohol dependence of 2,5%.

All top three countries, according to the report, do not have alcohol illegality but drinking is allowed to people above the age of 18.

According to Delta Beverages, Zimbabweans drank record amounts of lager beer in 2022, handing the country’s biggest brewer revenues of US$713 million.

Sorghum beer broke past the four million hectolitre market.

Pregnant Mum, Kids Killed In Honda Fit Accident

By Dorrothy Moyo | In a heart-wrenching incident during the festive season, a pregnant mother, Loice Kapinga, her husband Silas Gomo, and four children lost their lives in a collision between two Honda Fit vehicles in Mazowe. The devastating crash claimed a total of nine lives early Monday morning.

Among the victims were identified five-year-old Tanyaradzwa and eight-year-old Angela. The grief-stricken father-in-law, Mr Edson Kapinga, struggles to accept the loss of six family members.

The collision also took the lives of Lovemore Chibanda and Tashinga Chitsike, leaving their families grappling with the sudden tragedy. Mr Badwell Chitsike, father of Tashinga, expressed confusion about the circumstances leading to the accident.

The driver of one Honda Fit, Mr Promise Makopo (22), escaped the burning vehicle but succumbed to severe burns on both legs. His father, Mr Pardon Makopo, mourned the loss of his favorite child, describing Promise as a diligent young man who tragically met his end while transporting passengers.

According to reports, Makopo was hired by four artisanal miners and a lady. His childhood friend, Mr Nomore Jongwe, revealed that they had been at a local beerhall before the accident occurred.

Government intervention was announced to aid bereaved families with funeral expenses. Minister of State for Provincial Affairs, Christopher Magomo, visited the accident scene, declaring the loss of nine lives a disaster. The three victims burnt beyond recognition are undergoing identification by the police forensic team.

Minister Magomo urged stringent measures against pirate taxis, emphasizing the risks associated with driving under the influence, fatigue, and night travel. Chief Superintendent Enock Masimba highlighted preliminary evidence pointing to possible speeding and the unroadworthy condition of one vehicle.

Provincial Medical Director Dr Clemence Tshuma reported four injured individuals, including a six-year-old girl, receiving medical attention. A somber atmosphere enveloped Concession Hospital, where families gathered to identify their loved ones.

Mnangagwa Free Education Lies Exposed As He Announces US Dollar School Fees 

By James Gwati – President Emmerson Mnangagwa’s administration has officially introduced school fees denominated in foreign currency, exposing the hollowness of the promise to provide free primary education for Zimbabweans.

In the run-up to the August national polls, Mnangagwa said his government would provide free primary education.

This surprising policy shift has raised concerns about the accessibility of education for many Zimbabwean families, placing a financial strain on parents and prompting scepticism about the government’s commitment to its electoral promises.

This unexpected announcement, detailed in a gazette notice, has ignited controversy, particularly given that 80 percent of the population, predominantly government workers, receive their salaries in the local currency. 

The move to US dollar-denominated fees burdens parents who are already grappling with insufficient incomes to cover basic living expenses.

Minister of Primary and Secondary Education Torerayi Moyo, communicated the fee structure in a statement to the public via state media on Monday.

 Rural government primary schools are instructed to cap fees at US$10 per term, while their urban counterparts should not exceed US$20 per term.

Despite the fees being quoted in US dollars, parents and guardians are afforded the flexibility to make payments in the local currency, pegged to the prevailing exchange rate on the payment date for Zimbabwean pupils.

For secondary schools, Statutory Instrument 240 of 2023, Education (Tuition and Boarding Fees) (Government Schools) (Amendment) Regulations, 2023 (No. 1), delineates the fee structure. S1 schools in low-density suburbs set tuition fees at US$40 per term, S2 schools in high-density suburbs at US$20 per term, and S3 schools in rural areas at US$10 per term.

Crucially, parents contribute only a fraction of the total costs, as the government covers teachers’ salaries in government schools and certain additional expenses. 

The gazetted fees for pupils residing outside Zimbabwe, without taxpayer support, underscore the extent of government assistance—US$300 per term for primary tuition and US$400 per term for secondary schools, payable exclusively in US dollars.

While the published tuition fees seem comprehensive, the government’s expanded BEAM program aims to ensure coverage for pupils from the most economically disadvantaged families.

 Additionally, some government schools retain the option to request a top-up levy from parents through school development associations, contingent on approval by the majority of parents and the Ministry.

Roman Catholic Okays Gay Marriages

By-Pope Francis has allowed priests to bless same-sex couples, with a new document issued on Monday explaining a radical change in Vatican policy.

BBC News reported that the head of the Roman Catholic Church said priests should be permitted to bless same-sex and “irregular” couples, under certain circumstances.

However, the Vatican said blessings should not be part of regular Church rituals or related to civil unions or weddings.

It added that it continues to view marriage as a lifelong sacrament between a man and a woman.

The Vatican emphasized that blessings in question must be non-liturgical and should not be conferred at the same time as a civil union, using set rituals or even with the clothing and gestures that belong in a wedding.

It said people seeking a “blessing” should not be subject to “an exhaustive moral analysis” as a precondition for receiving it. The Vatican said:

Ultimately, a blessing offers people a means to increase their trust in God. The request for a blessing, thus, expresses and nurtures openness to the transcendence, mercy, and closeness to God in a thousand concrete circumstances of life, which is no small thing in the world in which we live. It is a seed of the Holy Spirit that must be nurtured, not hindered.

In the new document, the Vatican stressed that people in “irregular” unions of extramarital sex — gay or straight — are in a state of sin. But it said that shouldn’t deprive them of God’s love or mercy.

Cardinal Víctor Manuel Fernández, the prefect of the Church, who introduced the text, said that the new stance does not validate the status of same-sex couples in the eyes of the Catholic Church.

In 2021, the Pope said priests could not bless same-sex marriages because God cannot “bless sin”.

However, Pope Francis had suggested in October that he was open to having the Church bless same-sex couples.

ZLHR Condemns Cholera Deaths And Failure to Contain Recurrent Outbreaks

Zimbabwe Lawyers for Human Rights (ZLHR) implores central government and local authorities to contain the outbreak and spread of cholera in Zimbabwe, which has led to the unnecessary deaths of several people across the country.

According to Ministry of Health and Child Care, more than 200 people are suspected to have fallen victim to the cholera outbreak in several parts of the country, while more than 130 people have been hospitalised since February 2023, when the first cases were publicly confirmed.

ZLHR is saddened that the ongoing deaths owing to cholera, which is a medieval disease, are a result of dereliction of duty by public officials and have brought desolation to the affected families and communities and the nation at large.

It is extremely worrying that such a medieval and preventable disease continues to claim precious lives in Zimbabwe, 15 years after the country was afflicted by a deadly cholera outbreak, which was eradicated centuries ago in some countries.

It is an indictment on both local and central government that Zimbabwe is still stalked by a medieval disease such as cholera.

ZLHR holds both local and central government accountable for the recurrent cholera outbreaks and the unwarranted deaths of people because of their failure to invest in and manage basic water, sanitation infrastructure and public health facilities.

The failure by central and local government to swiftly respond to the cholera epidemic through providing basic health services, medical treatment and services, clean running water and sanitary facilities to people, is an unacceptable failure of leadership and represents a clear failure by local authorities and government to uphold their constitutional obligations as provided in the Constitution and other regional and international instruments.

To arrest the cholera epidemic and prevent recurrent outbreaks of the primitive disease, ZLHR implores local and central government to;

· Urgently take corrective measures to prevent further deaths from cholera, contain the epidemic, and prevent further outbreaks;

Provide clean running water and sanitary environs to all affected communities and others at risk of infection to halt the spread of the deadly disease;

Urgently provide all affected people with rapid free medical assistance and treatment;

Increase budget allocation on water, sanitation and hygiene to achieve 15% allocation to health as provided in the Abuja Declaration to enhance the quality of life of citizens.

Seriously embrace their social and economic rights obligations provided in the Constitution and guarantee progressive realisation of the right to healthcare, the right to safe, clean and potable water for everyone and the right to a clean environment that is not harmful to people’s health or their well-being.

His Excellency Andry Nirina Rajoelina, President of the Republic of Madagascar was inaugurated on 16th December 2023 following his re-election in the First Round of the Presidential Election which were held on 16th November 2023 in Madagascar.

The inauguration ceremony was attended by multitudes of Malagasy citizens and esteemed foreign dignitaries including Heads of State and Government from the Southern African Development Community (SADC) region and their respective representatives.

In his speech after taking oath of office, H.E. President Rajoelina, pledged his commitment to steer Madagascar towards a stronger and a prosperous nation through prioritising human capital development, industrialization and good governance in the next five years of his administration.

H.E. President Andry Rajoelina thanked the Malagasy people for maintaining peace during the election process and committed to unite the people of Madagascar for the good of the country.

Zimbabwean Professor Runs Away From Mnangagwa Regime, Forms Own Sovereign State

A DECLARATION of a new State thousands of kilometres from Zimbabwe’s outlying rural area of Hurungwe into the Pacific Ocean may sound fictitious and strange.

Zimbabwean-born academic, professor Webiston Jokonya, on September 5 made history after declaring a new sovereign State at the heart of the world’s waters.

The new State is called United Republic of Delvin (URD) and has only 36 registered citizens so far.

URD was formed from what was known as Howland Island, located just north of the Equator in the Central Pacific Ocean, about 1 700 nautical miles southwest of Honolulu. It is just 160 hectares big and also lies almost halfway between Hawaii and Australia.

It was unclaimed and uninhabited until 2023
when it was declared a country or sovereign
State by Jokonya.

Mkwananzi Denies Unfounded Ouster Claims Amidst Allegations of Regime-Backed Disruption

By A Correspondent| Citizens Coalition for Change (CCC) Spokesperson Promise Mkwananzi has categorically refuted and dismissed the baseless assertions propagated by a Twitter account under the name Sengezo Tshabangu, claiming that he has been ousted from his role within the party.

Mkwananzi emphatically denied any communication with Tshabangu and accused him of colluding with Zanu PF to undermine the opposition. In response to the allegations, Mkwananzi clarified, “Please note that this is false and unfounded. I have not been removed from my position, and I have never, at any point in my life, engaged with this individual who is operating under ZANU-PF directives to sabotage the movement that countless individuals have sacrificed for, some paying the ultimate price for Zimbabwe’s freedom.”

Asserting his unwavering commitment to the cause, Mkwananzi declared, “I remain steadfast in my dedication to the struggle, pledging full allegiance to the capable leadership and guidance of our President Advocate Nelson Chamisa and the CCC party. My loyalty is not contingent on holding a specific position; it is rooted in the values and principles driving our just and legitimate pursuit for the total liberation and ultimate emancipation of all our people.”

The Twitter account, in question, circulated a message that seemingly ignited reactions from pro-regime elements on the platform, who accused Chamisa of dictatorial tendencies. The message purportedly conveyed a call from Mkwananzi, claiming unjust removal from his position by Chamisa, expressing concerns about Chamisa’s leadership style, and expressing a desire to engage in dialogue. Mkwananzi, however, vehemently denied the accuracy of this account, maintaining his commitment to the party’s objectives and leadership.

In concluding his statement, Mkwananzi underscored, “My allegiance is unwavering, and I remain resolute in my dedication to the struggle, the party, and President Nelson Chamisa. It transcends any individual position and is grounded in the collective vision for a just and liberated Zimbabwe.”

To be or not to be! Ostallos Speaks On Filing As CCC Candidate

A friend who is among the progressive forces called me to ask why in the face of a clear window to be an independent candidate against my party CCC, I chose not to?

There was an extensive debate about the path to take in the face of the carnage we saw in the past few months post the August sham general election.

A carnage sponsored, coordinated and executed by Zanupf!

Many people held and still hold different views including yours truly.

The task was and remains that of finding an exit point that can best save the people’s project with minimum damage to the same and our nation.

In the discussions most people were informed albeit in a rational way, by self preservation opinions.

I was also not spared from thinking in the same manner.

But it came a time when l thought l must apply mind and deploy the necessary thought process to things unfolding.

I knew this was going to pass but the question was if it ends what does it leave me at.
Two things controlled my opinions:

  1. My training and grounding as a student of mordern scientific thought. I was naturally inclined to think logically even if it inconvenienced my personal interests.
    At times even if you want to drive a Mercedes benz- with $700 in your bank account- it’s logical to accept that for now l cannot. An organic intellectual (in the Gramscian sense), ought to, at least, be truthful to themselves even if they can for other reasons deploy a different message or feeling. We operate from the truth for the great Amilcar Cabral taught us to “tell no lies to the masses of our people.”
  2. Ideologically, I’m was raised and trained by the International Socialist Organisation (ISO) at the then illustrious UZ. At the time ISO was headed by Cde Munya Gwisai. Of all the things in this world of politics ISO instilled critical ideological values, principles & clarity that even today- in a centre left Organisation we belong to, those principles guide us as individual leaders. The principles we were taught is that this struggle is about the people & the transformation of their material conditions not individual cdes getting obsessed with leaderships positions of titles !
    Everyone has their own campus and convictions before they become part of the collective.
    So, this is a time for me to make a personal choice and l said to myself Never! I will never go against my convictions and worse my leader Nelson Chamisa. Even if it means that I lose being an MP, so be it. I was not born with this national responsibility.
    Parliament was and remains to us a platform to advance the collective interests of our people, our Movement and the nation at large. And these interests can be summed up as the genuine desire to see the establishment of a Modern Democratic Developmental State in Zimbabwe anchored on the values of Freedom, Justics & Solidarity.The people of Tshabalala expressed their preference in August but the regime was not happy- it’s obvious why would Jonathan be happy? It will be illogical for me to expect him and the class of 2017 to be.The reality is that I’m not the only person who can work for them as an MP. ( how l hate using “l” for we were taught in the ISO to stick to ‘we’. It guides against a sense of entitlement, impunity and individualism). There were MPs before me, and like them l will come and go.
    No one person can live beyond what is apportioned to them.
    The principles installed to me by the international Socialist Organisation a decade ago live a full life within me.
    I cruise without fear or favor because l know that within me is a burning desire to genuinely see a democratic society.
    A society whose economy works for the MANY and not the few.
    All revolutionaries ought to be tested- some fall by the way side. But it is my strong conviction that even if we are to fall we will rise up , crawl, walk and then run to victory. That is, victory against Kleptocracy, victory against nepotism, victory against corruption, victory against hunger, lack & poverty, victory against destitution, victory against underdevelopment, hopelessness & a moribund economy, victory against nihilism, victory against tyranny & lastly victory against fear!
    The question to some is what if your principles don’t pay off at the end.
    My response is simple- principles are never about profit or self preservation. One cannot and must never bend principles for personal gain or political expediency. We cannot and we shall not disregard our principles. Never!
    For me life is about a legacy- after all we are all gonna die but what matters, at least to me is that what history and contribution am l leaving behind.
    What will the same people who supported me to be part of the leadership collective that supported us say. Thats my legacy question.
    Remember without the people- there was not gonna be the task to be part of the leadership.
    So we have to at all material times serve the people.
    Without the power(support) of the people, we in leadership have no authority and whatever privilege that comes with it.
    Until this is achieved some of us, as long as we live- we will fight!

Today marks exactly one and half years, that is, the full 18 months under persecution, incarceration in a meter by two and half meters solitary confinement in Chikurubi Maximum Security Prison by the regime in Zimbabwe since my arrest on the 14th of June 2022.

During this period hot weather and electricity blackouts in the dark solitary dungeon where you can hold the thick of darkness, I wake up during the middle of the night, the room is fully flooded with my sweat, mosquitos having completed feasting breakfast, lunch and supper from my bare body.

I taught myself that decency is only for free. I am under repression and I must conquer the mental motives of my persecutors. What must be known my dearest friends is that there is no amount of suffering that I have not gone through in my life. I slept on an empty stomach days to no end, but was never tempted to steal from anyone all my life.

I, and my late parents labored in other people’s fields for school fees, food and clothing. Railway stations and bus terminuses became my shelter in search of a better life.

I used thatched slums built of poles as accommodation going to school. I used to travel 46 Kilometers daily to and from school, living in Zaka, walking round Siya Dam to Mazunguye Secondary School in Bikita. Crossing paths with hippopotamus from Siya Dam and Leopard harbored in the mountains separating Zaka and Bikita during dark hours coming from school. There is no difficult situation insurmountable to me

I am a typical field Negro. This must inform everyone about the comfort and satisfaction I get by living among the poor people. We share our poverty together. That is why I am passionately prepared to die for the poor and the downtrodden. They deserve complete protection and shelter from those who wield power.

I lived the experience and the new experience I am going through has strengthened me.

Armed robbery cases haunt ZRP

By A Correspondent- Police have admitted challenges in fighting cases of armed robbery that have rocked Beitbridge over the past fortnight.

This is despite a new crop of officers in the Criminal Investigation Department (CID) mainstream having been deployed between May and June in the border town.

The robbers target well-to-do residents, with particular interest in cross-border transporters and money changers living in the affluent SDP area, named after its spatial development programme.

Residents in the suburb are having sleepless nights, apprehensive that robbers can break in anytime.

“We have a challenge in that area. It is not lit because it is a new suburb. We are working on it,” national police spokesman Assistant Commissioner Paul Nyathi said in an interview.

“We are planning to establish a police base in that area and we are appealing to residents to work with us and we will bring these culprits to book.”

He denied claims that police were incapacitated to deal with the vice.

Residents are, however, convinced that police patrols are few and far apart.

They also allege mainstream CID concentration is inside the Beitbridge Border Post, where police officers allegedly line their pockets through corrupt activities and by extorting money from travellers.

“We are in trouble because no one is patrolling our suburb. There is little police visibility and we are at the mercy of the robbers. Every night, there has been an incident in the last two weeks,” residents’ representative Abel Hindi said.

A victim, Livison Ncube, said he lost US$3 000 and R87 000 and all his electrical gadgets to armed robbers recently.

“Only one wore a mask. They never gave me a chance to look at them and (they) hit me with a bar when I attempted to,” he said.

Sources at Beitbridge police said the newly-deployed CID officers were corrupt.

“They are a group of people deployed here because they paid their way. Most of them are officers who came to Beitbridge on ‘Operation No To Cross Border Crime’ and realised there was financial activity,” one of the sources said.

Recently, Nyathi said police were investigating their human resources officer after it emerged that some of the new deployments paid between US$400 and US$600 to be moved to Beitbridge.

Blow for Tshabangu

Nelson Chamisa, the leader of the Citizens Coalition for Change (CCC), has formally objected to Secretary General Sengezo Tshabangu using his image on campaign materials.

This development arises amidst internal conflicts within the opposition party, with Tshabangu recalling CCC Members of Parliament based on his claimed position as the Secretary General, a role the party asserts does not exist.

On Monday, Tshabangu endorsed his candidates for the upcoming February 3 by-elections, incorporating CCC symbols, which prominently feature Nelson Chamisa’s face.

In a letter directed to the Zimbabwe Electoral Commission (ZEC), Chamisa, through his legal representatives, emphasized that the use of party symbols by individuals not authorized by him constitutes a legal violation.

“We represent Advocate Nelson Chamisa, on whose behalf we communicate. Please acknowledge our professional involvement.

“Our client is the president of the Citizens’ Coalition for Change political party, established on January 22, 2022.

“We understand that in June 2023, he granted specific candidates from the party permission to use his image as a logo in the harmonized elections conducted between August 23 and 24, 2023.

“Those granted permission to use his image had their nomination papers, as outlined in your records, signed in a letter dated June 15, 2023, and received by your office on the same day. A copy of the mentioned letter is attached for your reference.

“We have been informed that some individuals, not among those mentioned earlier, are illicitly employing our client’s image for the purpose of misrepresentation and misleading the electorate. We wish to highlight that this is unlawful,” stated the letter.

Last month, Tshabangu’s candidates employed CCC party symbols in the by-elections, asserting his continued use of CCC symbols as a legitimate Secretary General.

Another accident claims 9 along Harare Mukumbura road

Two Honda Fit vehicles collided head-on in Mazowe early yesterday killing nine people, with Acting Home Affairs and Cultural Heritage Minister Ambassador Chris Mutsvangwa expressing concern over the high number of fatal accidents which have claimed 15 lives in less than a week.

Minister Mutsvangwa said drivers should exercise caution on the roads to avoid the loss of lives.

National police spokesperson Assistant Commissioner Paul Nyathi said yesterday’s accident occurred around 2:30am near the 43km peg along Harare-Mukumbura Road.

Besides the nine people killed, three others were injured.

This fatal accident came after six people were killed last week in another accident involving a Toyota Hiace and a Nissan Caravan kombis and a bus, in Warren Park, Harare.

“A Honda Fit vehicle with four passengers on board, which was travelling towards Bindura, was involved in a head-on collision with another Honda Fit vehicle with seven passengers on board, which was travelling in the opposite direction,” said Asst Comm Nyathi.

“As a result of the accident one of the vehicles caught fire, resulting in three victims being burnt beyond recognition. The bodies of the victims were taken to Concession Hospital mortuary for post-mortems while the injured are admitted to the same hospital.”

Ambassador Mutsvangwa urged drivers to exercise due safety and extra care.

“The festive season has started on a painful and tragic note with two terrible car accidents,” he said.

“Taking due cue from the Head of State, the Ministries of Home Affairs and of Transport, the Zimbabwe Republic Police and other Government traffic safety agencies are imploring the driving public to exercise due safety and extra care on our highways,” he said.

Asst Comm Nyathi said DNA tests would be conducted on three of the bodies that were burnt beyond recognition to ascertain the identities of the deceased.

One of the vehicles had family members while the other vehicle had people coming from a night out.

It is understood that at around 2:30 am, a white vehicle that was being driven by a 24-year-old man with four passengers encroached into the lane of an oncoming silver Honda Fit with seven people which was heading towards Harare.

On impact, the silver vehicle caught fire and three people were burnt beyond recognition.

Ambassador Mutsvangwa called on the nation to heed President Mnangagwa’s plea for cautious driving.

“H.E. the President Dr. Emmerson D. Mnangagwa issued an impassioned plea for safe driving with an emphasis against drinking and driving in his address at the final Politburo meeting of 2023.

“Every driver owes it to all fellow road users to exercise maximum alertness once one takes to the highway,” he said.

During the Zanu-PF Politburo meeting last week, President Mnangagwa cautioned motorists to desist from complacency as it would lead to the unnecessary loss of lives.

He implored drivers to follow all laid down road rules and regulations saying it was the general citizenry’s duty to ensure accidents were avoided.

“As we go for our festive holidays and into the new year, I call upon the nation to continue upholding the culture of unity, love and hardwork and let us also drive safely on our roads,” said the President.

“Let us drive carefully. Those who want to drink, drink at home, kana wadhakwa wovata (when you get drunk retire to bed).”

In another head-on collision, three people were killed when a Sino truck with three passengers on board was involved in a head on collision with a DAF truck with one passenger on board at the 50km peg along the Mutare-Juliasdale on Sunday at around 3pm.

Two victims were identified by their next of kin as Patience Muzarerawetu a female adult of Wattle Company and Garikayi Charamba, a male adult of Watsomba Business Centre.

LAWYER HITS PRISON OFFICER WITH LAWSUIT OVER PARTISAN CONDUCT

A lawyer has approached the High Court seeking an order for the dismissal of a prison officer, who is vigorously involved in partisan politics, in contravention of constitutional provisions that bar civil servants from engaging in active partisan politics.

Harare lawyer Takudzwa Edward Mudzuri is also suing the Commissioner-General of Zimbabwe Prisons and Correctional Service (ZPCS), the Chairperson of the Prisons and Correctional Service Commission and Justice and Legal and Parliamentary Affairs Minister Hon. Ziyambi Ziyambi, for enabling the brazen violation of the country’s Constitution.

Mudzuri, represented by Zimbabwe Lawyers for Human Rights (ZLHR) lawyer, Innocent Gonese, recently filed an application at Harare High Court after prison authorities failed to respond to his letters requesting disciplinary action to be taken against a prison officer, Caroline Majongo.

Despite being a civil servant, Majongo was actively involved in mobilising votes for the ruling ZANU-PF party during harmonised elections held on 23 and 24 August.

So prominent was her role that that senior ZANU-PF political party provincial officials, such as Mashonaland East Secretary for Security Jeremiah Chiwetu and Retired Lieutenant-Colonel Samuel Makureya, both wrote to ZPCS officials requesting leave of absence for Majongo from 1 June 2023 up to the end of elections.

In their request, Chiwetu and Retired Lieutenant-Colonel Makureya said the prison officer needed leave from official ZPCS duties so that she could carry out “national duty” such as party voter mobilisation programmes for ZANU-PF political party.

Majongo also holds the position of provincial deputy secretary in the ruling political party’s Women’s League.

In his application, Mudzuri wants the High Court to declare that Majongo’s active engagement in politics as a member and an office bearer of ZANU PF political party in Mashonaland East province while she is employed as a Prison Officer is a direct violation of the provisions of Section 208(3) of the Constitution.

Mudzuri also wants the High Court to declare that the Chairperson of the Prisons and Correctional Service Commission and Justice, Legal and Parliamentary Affairs Minister Hon. Ziyambi, failed to ensure Majongo’s compliance with the requirements of the Constitution after releasing her to engage in partisan politics as a member and an office bearer of ZANU PF political party to be in direct violation of section 231(1)(d) of the Constitution as read together with section 208(3) of the Constitution.

The case is not isolated.

ZLHR has over the years intervened to stop the continued violation of the Constitution by civil servants and security agents, who are actively involved in partisan politics, particularly taking up posts within the ruling ZANU PF political party.

Recently, an intervention by ZLHR forced President Emmerson Mnangagwa, to rescind the appointment of Zimbabwe Defence Forces Commander General Philip Valerio Sibanda into the ruling ZANU PF political party’s Politburo.

Hopewell Chin’ono Suddenly Accuses Chamisa Of Paying Women To Expose Him

Activist Hopewell Chin’ono Levels New Accusations Against CCC President.

By A Correspondent | In a new round of rapturous statements, activist Hopewell Chin’ono, who for over 27 years has a recorded pile of unchallenged serious allegations by various women in the grooming-category, has opened accusations against CCC President Nelson Chamisa who was a minor during the days when the first reports surfaced against Chin’ono running by a different surname back then.

While Chin’ono did not explicitly mention Chamisa by name, all of his connotations were pointed at Chamisa, whose character he has been weekly ambushing throughout the year. This ongoing saga began on January 1, 2023, when Chin’ono falsely accused Chamisa of neglecting a voter registration campaign. Subsequently, he accused Chamisa of incompetence, going as far as stating that his Citizens Coalition for Change party, CCC, must split at the end of 2023 due to what Chin’ono alleges is Chamisa’s incompetence.

Writing on Monday afternoon, Chin’ono randomly accused Chamisa of using journalist Simba Chikanza to pay women who will soil his name.

“I have no interest in running for office. There is a politician who thinks I want to run for office and is working with Simba Chikanza, offering money to women to scandalize me so that, according to them, I don’t run in 2028! I don’t know why people are so obsessed with me running for office; I have no interest! The obsession has become so ridiculous; I am a journalist and filmmaker, my influence stays there!” stated Chin’ono in response to the accusations.

Chin’ono, who prefers a community title proven in courts for grooming women for sex, insisted that he harbours no political ambitions. However, he believes there is a coordinated effort to undermine his potential candidacy in the upcoming presidential race.

Simba Chikanza, responding to the allegations, expressed surprise and questioned the motives behind the accusations. “Those seeking my assistance on detecting frauds, here’s a case study: Did you see the Multi-Award Winning Daddy’st’s allegation that I’ve offered women money to expose him over his ambition to run for presidency in 2028?” said Chikanza, refuting claims of collaboration with Chamisa.

Chikanza drew parallels to a previous investigation involving Walter Masocha, emphasizing that Chin’ono’s use of the online-grooming salutation “Daddy” sets him apart. “Any professional who pops out and starts making people salute them as a ‘Daddy’ knows very well they are using a tag line for groomers and rapists,” he added.

Chikanza further remarked that of all the multiple women who have blown the whistle on Hopewell Chin’ono over the years, none of them has a financial need to be paid by any politician or journalist, as they are well established in their careers.

Nelson Chamisa did not provide any comment on the allegations, and the CCC leader has, for over the year, chosen to ignore the Daddy-vist when he opens accusations against his name.

Meanwhile, Hopewell Chin’ono has continued conversations where he concludes debates by flaunting wealth, while failing to disclose the name of the bank or company he says gave him a £50,000 sports car loan in 1996, that he claims is the real source of his real estate acquisitions.

Robbers Attack Mutendi

CHIKOMBA—Herbert Mutendi (63), brother to Zion Christian Church (ZCC) leader Bishop Nehemiah Mutendi was shot twice by armed robbers who got away with cash and goods amounting to US$4,000 from his Beatrice farm on Sunday.

Mashonaland East Police Spokesperson Inspector Simon Chazovachii said the bullets grazed Mutendi on the left leg and hand. The incident happened around 11 pm.

Five armed robbers arrived at the farm and one of them fired once into the air while others broke into the farmhouse through a kitchen door and window.

The gang tied down two maids before proceeding to a bathroom Mutendi was in. They demanded cash and other valuables from him.

SA Dominates CAF African Schools Football Championships

THE CAF African Schools Football Championships came to an end at Gateway High School in Harare this Saturday as South Africa proved their dominance for the second year running.

South Africa, the winners of the inaugural tournament in the COSAFA region, won both the boys and the girls’ gold medals in the this year’s tournament.

South Africa were represented by Ubuntu Academy in the boys’ section and they beat Malawi to bag gold, while Edendale Technical High beat Botswana by three goals to one to clinch the championship on the girls’ side.

Meanwhile, the greatest takeaway from the tournament is the story of how hosts, Zimbabwe, were among the medal winners despite participating in the games for the first time.

Zimbabwe’s Under 15 boys football team beat Namibia by a solitary goal to clinch bronze.

Zimbabwe U-15 captain, Tadiwa Chakuchichi said, “We feel like we could’ve done better and won the gold. We could have woken up in the first game to beat Malawi and win the final game.”

“We worked hard, it wasn’t enough, but we could have done better. I’m proud of the squad we have and how far we’ve made it,” Zim U-15 player El Shaddai Sadomba said.

Another player, Darrel Zulu said, “We’ll clinch trophies because we’ve done our homework. Unfortunately in the opening match we underestimated Malawi because of their size and we lost, but going forward we’ll prove we’re the best.”

Mwonzora Backs Tshabangu

By James Gwati-MDC-T leader Douglas Mwonzora has condemned the CCC leadership for endorsing independent candidates in the upcoming February 3, 2024, by-elections.

Mwonzora, taking to his X account, cautioned that these CCC-backed candidates could face recall challenges, emphasizing their lack of affiliation with any political party.

The MDC-T leader’s remarks, seemingly applauding the removal of Chamisa’s MPs by Sengezo Tshabangu, self-proclaimed CCC interim secretary general, underscore growing tensions within the opposition.

Tshabangu and CCC unveiled their candidates on Monday, with Chamisa running independently.

The development raises concerns about potential dual candidates in the approaching by-elections slated for February 3, 2024.

Such a scenario could lead to voter confusion, prompting questions about the unity and coherence of the opposition forces.

Monday, the Nomination Court processed and accepted papers from candidates contesting various constituencies, including Pelandaba-Tshabalala, Mkoba North, Chegutu West, Zvimba East, Seke, and Goromonzi South.

These vacancies resulted from the recall of prominent figures such as Gift Ostallos Siziba, Stephen Chatiza, Madzimbamuto Tapfumanei, Admore Chivero, Mutasa Oliver, and Chibaya Amos by the CCC’s self-imposed Secretary General, Sengezo Tshabangu.

Tshabangu’s Candidates Barred from Using Chamisa’s Face

The revelation unfolded through legal documents obtained by ZimEye, shedding light on a contentious issue surrounding the unauthorized use of Chamisa’s image.

The Zimbabwe Electoral Commission (ZEC) ascented to instructions from CCC President Nelson Chamisa, outlined in a letter addressed to the Chief Elections Officer in Harare. Shava Law Chambers, representing Chamisa, voiced concern about the unapproved utilization of Chamisa’s face image by individuals not officially sanctioned.Quoting the letter, Chamisa’s legal representatives clarified that specific CCC candidates had been granted consent to feature Chamisa’s face as a logo during the August 23 to 24, 2023 harmonized elections. However, the letter revealed that some unauthorized individuals had illicitly appropriated Chamisa’s image for potentially misleading purposes, intending to use it on nomination papers.

The letter strongly emphasized the illegality and fraudulent nature of such actions, asserting, “Any unauthorized use of our client’s face constitutes a violation of his constitutional right to privacy as well as compulsory deprivation of his property rights.”Shava Law Chambers explicitly warned the Zimbabwe Electoral Commission not to accept any nomination papers bearing Chamisa’s image, except for those specifically authorized in the June 15, 2023 letter.

The legal representatives also conveyed Chamisa’s intent to take legal action against anyone found using, accepting, or permitting the unauthorized use of his property.The unfolding situation adds complexity to the political landscape, prompting questions about the repercussions for candidates who may defy these legal directives.

Lawyer Hits Prison Officer With Lawsuit Over Partisan Conduct

A lawyer has approached the High Court seeking an order for the dismissal of a prison officer, who is vigorously involved in partisan politics, in contravention of constitutional provisions that bar civil servants from engaging in active partisan politics.

Harare lawyer Takudzwa Edward Mudzuri is also suing the Commissioner-General of Zimbabwe Prisons and Correctional Service (ZPCS), the Chairperson of the Prisons and Correctional Service Commission and Justice and Legal and Parliamentary Affairs Minister Hon. Ziyambi Ziyambi, for enabling the brazen violation of the country’s Constitution.

Mudzuri, represented by Zimbabwe Lawyers for Human Rights (ZLHR) lawyer, Innocent Gonese, recently filed an application at Harare High Court after prison authorities failed to respond to his letters requesting disciplinary action to be taken against a prison officer, Caroline Majongo.

Despite being a civil servant, Majongo was actively involved in mobilising votes for the ruling ZANU-PF party during harmonised elections held on 23 and 24 August.

So prominent was her role that that senior ZANU-PF political party provincial officials, such as Mashonaland East Secretary for Security Jeremiah Chiwetu and Retired Lieutenant-Colonel Samuel Makureya, both wrote to ZPCS officials requesting leave of absence for Majongo from 1 June 2023 up to the end of elections.

In their request, Chiwetu and Retired Lieutenant-Colonel Makureya said the prison officer needed leave from official ZPCS duties so that she could carry out “national duty” such as party voter mobilisation programmes for ZANU-PF political party.

Majongo also holds the position of provincial deputy secretary in the ruling political party’s Women’s League.

In his application, Mudzuri wants the High Court to declare that Majongo’s active engagement in politics as a member and an office bearer of ZANU PF political party in Mashonaland East province while she is employed as a Prison Officer is a direct violation of the provisions of Section 208(3) of the Constitution.

Mudzuri also wants the High Court to declare that the Chairperson of the Prisons and Correctional Service Commission and Justice, Legal and Parliamentary Affairs Minister Hon. Ziyambi, failed to ensure Majongo’s compliance with the requirements of the Constitution after releasing her to engage in partisan politics as a member and an office bearer of ZANU PF political party to be in direct violation of section 231(1)(d) of the Constitution as read together with section 208(3) of the Constitution.

The case is not isolated.

ZLHR has over the years intervened to stop the continued violation of the Constitution by civil servants and security agents, who are actively involved in partisan politics, particularly taking up posts within the ruling ZANU PF political party.

Recently, an intervention by ZLHR forced President Emmerson Mnangagwa, to rescind the appointment of Zimbabwe Defence Forces Commander General Philip Valerio Sibanda into the ruling ZANU PF political party’s Politburo.

Chief Chikwaka Refuses to be dragged Into Headman Mungoni’s Shenanigans

By Staff Reporter| Controversial Headman who hogged the limelight in June this year for terrorizing his subordinates through unlawful seizure of their ancestral land and subsequent sale of plots to his cronies for personal gain is at it again.

In June this year, the headman reported six villagers to the police on allegations that they had pulled down a perimeter fence that had been erected at one of the land that he had grabbed.

The six who include three senior citizens aged 80, and two 75-year-olds were dragged to Murehwa Magistrate Court where they were convicted and ordered to pay fine.

However, they have appealed against their conviction at High Court eventually suspending the ruling from Murehwa Magistrate.

Unaware or as a way of punishing the villagers, Headman Mungoni summoned them to appear before Chief Chikwaka’s traditional court which they appeared today.

The alert and astute traditional leader dismissed the sitting saying he can not preside a matter that is still before the courts.

Villagers under headman Mungoni claim that anyone who dares to challenge his actions is promptly branded an enemy and summoned to his court, where they face harsh repercussions.

To further deepen the concerns surrounding Mungoni’s conduct, it has been alleged that he maintains strong connections within the Murehwa Magistrates Court.

Government Reduces Passport Fees

By James Gwati- The government has revised downwards the application fees for an ordinary Zimbabwean passport from US$200 to US$150.

The new fee marks a substantial reduction from the previously proposed US$200, as announced in the 2024 national budget proposals by Finance Minister Mthuli Ncube.

The announced adjusted fee in the national budget led to a surge in passport applications, with many individuals opting to apply earlier than planned.

This heightened interest underscores the immediate impact that adjustments in government policies can have on public behaviour.

On Monday, a commercial state radio station, Star FM, announced that the reduced fees would be effective from January 1, 2024.

This decision represents a noteworthy response to the public outcry following the initial proposal to increase passport application fees.

The initial discontent among citizens stemmed from the perceived financial strain imposed on those seeking to obtain or renew their passports.

This public outcry became a central point in broader public discourse, shedding light on ordinary Zimbabweans’ economic challenges in meeting essential documentation requirements.

“Opposition is incompetent”

Zimbabweans love burying their heads in the sand and see and hear only what they want to see and hear – even in the face of a mountain of evidence saying otherwise. There is a dear price to be paid for such foolishness and we have and are paying for it!

“Chamisa has done a lot of great things, like his remarkable showings in 2018 and 2023 against a formidable Zanu-PF machinery, backed by the state and millions of dollars, which gave the country hope for change. That is why he remains the main authentic voice of the opposition and plausible alternative. Everything else is wishful thinking – at least for now,” Newshawk/ Bulawayo 24 reported.

Newshawk has written many very informative contributions to the economic and political discourse in Zimbabwe; this article is completely off the mark!

Zanu PF would have lost the elections to a troop of monkeys years ago if the elections were free, fair and credible and the monkeys were the only alternative to Zanu PF. For such has been the nation’s desperate desire for change. 

Zanu PF has managed to stay in power all these years only because the party has retained its carte blanche power to rig elections. 

The people of Zimbabwe have risked livelihoods, limb and even lives to elect MDC/CCC leaders into office for the primary purpose of implementing the necessary democratic reforms to restore the people’ freedoms and rights including the right to a meaningful say in the governance of the country. After 23 years, including 5 in the GNU, Nelson Chamisa and company have failed to implement even one token democratic change. Not one!

Worst of all, ever since the GNU debacle, MDC/CCC leaders have participated in flawed elections to give Zanu PF legitimacy out of greed. What is more the opposition leaders themselves have known this all along.

“Look, you can’t keep on participating in flawed electoral processes that serve to give big benefits to dictators such as Robert Mugabe. Mugabe has perfected the art of winning elections. So it will be very foolish for the opposition to continue legitimising these sham elections which don’t deliver,” said Tendai Biti in a 2015 interview with Isaac Mugabi.

“So you can’t continue subjecting Zimbabweans to processes where their hopes just get crushed.”

David Coltart went one step more and revealed the reason why the opposition were hell bent on participating in these flawed elections to perpetuate the Zanu PF dictatorship.

“The (2013) electoral process was so flawed, so illegal, that the only logical step was to withdraw, which would compel SADC to hold Zanu PF to account. But such was the distrust between the MDC-T and MDC-N that neither could withdraw for fear that the other would remain in the elections, winning seats and giving the process credibility,” confessed David Coltart in his Book, The Struggle Continues 50 years of Tyranny in Zimbabwe.

So the opposition leaders could not withdraw from the flawed elections even when it was clearly the only rational thing to do because they “feared the others would remain and win the (gravy train) seats”. Greed!

When Chamisa was asked repeatedly why MDC A was participating in the 2018 elections when ZEC had failed to produce something as basic for elections as a verified voters’ roll. “MDC A has stringent measures to stop Zanu PF rigging the elections.” he answered.

Fast forward to 2023, when he was asked the same searching questions he claimed that he had “plugged all the vote rigging loop holes”. 

Zanu PF blatantly rigged the 2018 and 2023 elections, as we all know, Chamisa was lying to hide the real reason why he and his friends were participating in these flawed elections “no matter what” was greed. 

It is therefore shocking that the article singled out Chamisa’s treasonous participation in the flawed 2018 and 2023 elections as one of Chamisa’s “great things” achievements!

“Yet he has made a lot of mistakes. The main reason is that he is trying,” the article argued, with name one of these acknowledged mistakes. 

Well failing to implement even one democratic reform in five long years was NOT a mistake. And his continued participation in these flawed elections out of greed and then lying to hide his greed shows he has not learned much less repented from his treasonous betrayal.

Zimbabweans have knack for burying our heads in the sand so we see only what we want to see even in the face of a mountain of evidence proving otherwise. In 1980s and early 1990s many Zimbabweans would bend over backwards to blame ministers around Robert Mugabe for the country’s worsen economic and political situation. They would not accept that Mugabe himself was to blame even when he was the one appointing and keeping these incompetent and corrupt ministers.  

It took nearly 20 years before the nation finally accepted that Mugabe himself was a corrupt and ruthless dictator but it was too late because by then de facto one party dictatorship was deeply entrenched in Zimbabwe society. Up rooting it was never going to be a walk in the park and certainly not with these corrupt and incompetent CCC leaders.

Zimbabwe is seemingly stuck with this Zanu PF dictatorship not because the party is “formidable” but because the opposition has turned out to be corrupt and breathtakingly incompetent. Chamisa and company have failed to implement even one democratic reform in 23 years especially during the GNU when they had the trump cards, it is naive, to say the least, to expect them to do so not when Zanu PF holds all the trump cards. 

Chamisa and his CCC friends are corrupt and breathtakingly incompetent showering them with praise will not change that reality and more significantly, will not get the country out of this hell-on-earth Zanu PF landed us in. We need competent opposition leaders who will implement the democratic reforms Chamisa et al are not up to the task! 

Chamisa Dribbles Tshabangu, Mnangagwa

By-The main opposition leader, the Citizens Coalition for Change (CCC), Nelson Chamisa, has decided to field his recalled legislators and councillors as independent candidates.

These candidates are filing their papers today to contest the February 3 by-elections.

This decision will counter threats of further recall by self-proclaimed Secretary General Sengezo Tshabangu.

The nomination court will sit tomorrow to confirm candidates that will contest in six constituencies that fell vacant following the recalls of CCC legislators by Tshabangu.

The six constituencies that will hold by-elections are Pelandaba, Goromonzi South, Seke, Chegutu West, Zvimba East and Mkoba North.

The nomination court will sit at Tradegold Building in Bulawayo, Marondera magistrates court, Chinhoyi magistrates court and Gweru magistrates court.

Last week, the country held by-elections to fill other vacant seats but recalled CCC members were barred from contesting the polls after Tshabangu approached the High Court challenging their participation.

He argued that the recalled MPs could not participate in the elections under the CCC banner because they had been expelled from the party.

The High Court ruled in Tshabangu’s favour in a ruling delivered in the middle of the night on the eve of the elections last Saturday on December 9.

CCC spokesperson Promise Mkwananzi yesterday said this time their candidates would contest the upcoming by-elections as independents.

“We are CCC and our leader is Advocate Nelson Chamisa. We are contesting in the elections and we are winning,” said Mkwananzi.

In November, Harare High Court judge Justice Tawanda Chitapi issued an interim interdict stopping Tshabangu, from recalling the opposition party’s legislators and councillors pending the finalisation of court cases on the ownership of the CCC.

There are several court matters over the ownership of the CCC that Chamisa unveiled last year after his former ally-turned opponent, Douglas Mwonzora, snatched the MDC from him.

Eyebrows have also been raised after the Zimbabwe Electoral Commission cancelled a gazetted by-election set for Victoria Falls on Tshabangu’s orders.

Last month, Tshabangu axed four CCC Victoria Falls councillors paving way for by-elections.

But in a dramatic turn of events, Tshabangu rescinded his earlier move prompting Zec to cancel the polls that were set for February 3.

Zec deputy chairperson Rodney Simukai Kiwa said the electoral body acted within the confines of the law, but legal experts said the move was illegal.

“The commission received a letter from the (Victoria Falls) town clerk explaining that they have been recalled by error,” Kiwa told The Standard yesterday.
“Further the ( Local Government minister Winston Chitando) also sent a letter to that effect.”

Lawyer Dumisani Dube said Zec’s move was illegal and unconstitutional as there were certain protocols to be followed before cancelling the polls.

“I think it’s irregular for ZEC as an administrative authority to cancel a gazetted election before the election date in the absence of extraordinary circumstances such as death or a natural disaster,” Dube said.

“It’s a violation of administrative rights in the constitution and Administrative Justice Act and the Electoral Act and that conduct is irregular, unprocedural and unconstitutional and smacks of bias, unfairness and illegality.”

Another lawyer Jeremiah Bamu said the electoral body exposed its double standards as opposed to how it acted in the past by-elections.

“Zec has no power to cancel the by-election,” Bamu said. “In this instance it was not up to Tshabangu to say he made an error, if he had made an error.

“He should have gone to court and said I have made an error and only then a court order would intervene.”
Bamu added: “It is the same as what took place in Chegutu West when Gift Konjana won the election, Zec announced the wrong results and recognised its error and it went on to say it has noticed and accepted its error, but it can do nothing more except report.”

Bamu said Zec should act in the same manner it did in the Konjana case and allow the by-elections to go ahead.
