Chinhoyi Hospital Boss Arrested

CHINHOYI Provincial Hospital Medical Superintendent Collet John Mawire has been arrested by the Zimbabwe Anti-Corruption Commission (ZACC) on allegations of criminal abuse of office.

ZACC spokesperson Commissioner Thandiwe Mlobane confirmed Mawire’s arrest this Wednesday.

“I can confirm that Chinhoyi Provincial Hospital Provincial Medical Superintendent Collet John Mawire was arrested yesterday on allegations of criminal abuse of office and he is expected to appear in court this Wednesday,” she said.

Allegations are that sometime in 2021, Chinhoyi Provincial Hospital sought to procure a 500 EX HT Expandable PABX Machine which was then valued at more than ZWL$2 million.

It is alleged that to fast-track the process, Mawire and his accomplice who is still at large, authorised a request for quotations knowing fully well that the value involved was way above the required threshold.

According to ZACC, investigations revealed that Mawire approved a payment of the amount.

It is also alleged that despite the value of the goods procured being way above the required threshold for quotations, the co-accused proceeded to use the request without seeking approval and or exemption from the Procurement Regulatory Authority of Zimbabwe.

The accused is expected to appear at the Chinhoyi Magistrates Court this Wednesday.

71 Years In Prison For Robber(21)

A 21-year-old man from Domboshava has been sentenced to a cumulative 71 years in prison for rape and armed robbery.

Goodwill Mhandu proved to be an enemy to mankind just like his surname suggests, after his unkind actions toward women he raped and robbed in his neighborhood in Domboshava.

The 21-year-old will, however, pay for his inhumane actions as he will serve over 30 years behind bars.

Mhandu was initially sentenced to a cumulative 71-year jail term before some years were suspended.

He was slapped with a 15-year jail term each for three rape cases.
The years will run concurrently.

He was also given a cumulative 26 years for armed robbery and will serve an effective 19-year jail term, bringing his total jail term to 34 years.

Goodwill Mhandu committed the crimes over a two-year period in his neighbourhood of Domboshava.

Prosecutor Miss Ethel Mahachi proved that the 21-year-old’s crimes were premeditated and well-calculated as he targeted women selling in tuck shops whom he raped before robbing them of groceries.

His tricks started sometime in 2021 when he pounced on an unsuspecting victim who was sleeping in a tuckshop and raped her three times.

He also went on to rape another woman in Domboshava after waylaying her while armed with an iron bar and a knife.

Mhandu ran out of luck after he was arrested in Domboshava early this year after police acted on a tip-off.

Top Yester-Year Gospel Musician Arrested

By-Top yester-year gospel musician Ivy Kombo and her husband, Pastor Admire Kasi, have been arrested for fraudulently acquiring fake certificates to practice law in Zimbabwe after obtaining Bachelor of Laws degrees in England.

The couple appeared at the Magistrates’ court this afternoon to answer charges of fraud and perjury.

They were arrested by the Zimbabwe Anti-Corruption Commission investigations crack team.

The couple was among 12 lawyers admitted at the High Court early this year, using certificates fraudulently obtained with the assistance of the suspended Council for Legal Education official.

After completing a law degree and undergoing the minimum of supervised legal work, all lawyers are supposed to be sworn in as officers of the High Court, which allows them to practice law without supervision.

They take the dual oath of loyalty to Zimbabwe and oath of office.

Dhuterere Responds To Infidelity Rumours

By- Gospel musician Mambo Dhuterere has responded to infidelity rumours circulating on social media, challenging anyone with evidence to bring it on.

The rumours are that his wife deserted him after he allegedly impregnated a woman from his church.

Social media platforms have been awash with claims that Dhuterere’s wife and his alleged side chick clashed at an unnamed carwash after she discovered her husband’s alleged infidelity.

Mambo Dhuterere’s recent announcement that he had been depressed mentally, emotionally, and spiritually only added fire to the rumours.

Warriors Squad For World Cup Qualifiers

Rwanda Appoint New Coach

Zimbabwe’s 2026 World Cup Qualifiers Group C opponents Rwanda have appointed a new head coach, two weeks before the two sides meet.

Rwanda will open their qualifying campaign as hosts to the Warriors at Huye Stadium, Butare on 15 November.

The encounter will mark the new coach’s first assignment in charge.

The German gaffer succeeds Carlos Alós Ferrer, who left his job in July to become Belarus head coach after 16 months in charge.

A statement from Rwanda Football Federation (FERWAFA) confirmed the news by saying: “FERWAFA is pleased to announce that Torsten Spittler Frank has been appointed as the new head coach of the men’s Rwanda national team.”

Chinono had planned this meeting as part of his campaign to call for the removal of CCC President Nelson Chamisa.

The activist is currently facing a money laundering investigation, having failed to disclose the name of the UK bank that he claims gave him a “sportscar lifestyle” from a sp called £50,000 car loan in 1996. This lack of transparency has raised questions about his financial integrity.

Jealous man butchers wife, kills self

By A Correspondent- A jealous 37-year-old man from the Tshamutswilikiti area in Beitbridge who suspected his wife was cheating, brutally attacked her with a machete, before committing suicide.

Getmore Ndou is alleged to have had a fight with his wife (33) on Tuesday morning accusing her of spending a night away from the matrimonial home.

He had just returned to his home after having left his wife at the height of a domestic dispute.

The police officer commanding Beitbridge district, Chief Superintendent Tichaona Nyongo said on Monday, the complaint who was the now deceased’s customarily married wife went to Lutumba Business Centre to sell some water melons.

“She returned the next morning and found Ndou sleeping in the bedroom. The now deceased sent away one of their children to the shop, after which he struck the complainant several times on the head and she collapsed,” he said.

“The accused took a wire and hanged himself on the roof trusses of the bedroom hut suspecting he had killed his wife. His body and the complainant were later found by the child when she returned from the shops and she informed neighbours,” said Chief Supt Nyongo.

The matter was then reported to the police who took the woman to the hospital and the man’s body to the same hospital mortuary. The Chronicle

Abductions in Zimbabwe: A Case of Terror, Harvest of Fear, and Power

 By Liam Kanhenga| Dear Reader Following the abduction and torture of Harare Youth MP, Honourable Takudzaa Ngadziore, one can deduce that the regime has activated terror mode as a means to ringfence its power.

Remember that this is not the first of such actions, both this year and in our political history.

During the elections, Cnlr Womberaishe Nhende was subjected to the same; Hon. Joanna Mamombe (Harare West MP) was attacked  in her homestead in the middle of the night; and former Mabvuku lawmaker James Chidhakwa was also abducted.

So in case you wonder why the Harare regime is doing this, readers should remember that our country has a long history of disputed leadership, legitimacy crises, and authoritarianism that date as far back as the Mugabe era.

So to put this in context, Zanu PF, after realizing the potential reality of failing to access absolute power because of the existence of opposition, long developed a perception of dislike for multiparty systems and hence invested in creating a de facto one-party state.

They use terror, both physical and systemic, to close the civic and democratic space through passing draconian legislation, entrenching a military state, and using the Big Brother system (where the government spies on its own people).

Now that, after the elections, the result was disputed and the dynamics have turned to be incentivizing opposition,the regime will do all it can to ensure that any self-organizing group is repressed and demoblized. And in authoritarian philosophy, fear is the greatest source of power. Hence, terror on frontline activists and opposition.

Remember, in 2018, more than ten opposition members and leaders of the MDC Alliance, including the National Chairman Job Sikhala and Secretary General Charlton Hwende, were charged with treason after threatening to escalate the resistance campaign against Zanu PF.

The same script is being rewritten again, and this time it is about dismembering the opposition totally because their hundred and something seats are the only thing keeping Mnangagwa away from a third term.

Zanu PF can’t amend the constitution without a super majority, and because this time parliament is hung on a bipartisan bridge, the war is clearly aimed at undermining opposition.

Even when Mnangagwa rules by decree, the opposition will  challenge it , and that is why he is terrorizing opposition members.

This revelation comes on the heels of President Mnangagwa’s latest announcement that his government will block budgets prepared by these opposition-run councils, citing concerns over service delivery.

In the incendiary video, President Mnangagwa is allegedly heard saying, “all service delivery issues needing attention of the MDC, it doesn’t matter which MDC, must be stopped and they must crash at Harvest House building.” These startling remarks have ignited a firestorm of controversy, with many questioning the government’s commitment to improving the lives of Zimbabwe’s urban population.

President Mnangagwa had, just recently, decried the state of service delivery in opposition-run councils, highlighting the dire condition of infrastructure and the outbreak of medieval diseases like cholera and typhoid, particularly in the capital city, Harare. He officially launched a blueprint titled “A Call to Action — No Compromise to Service Delivery: First Stage of Interventions to Modernize the Operations of Local Authorities towards a 2030 Vision,” signaling his intent to address the service delivery crisis.

President Mnangagwa called for a collaborative effort to transform the unacceptable state of affairs in urban areas, expressing that “Service delivery must be prioritized, and ratepayers have a right to demand that heads roll for those who do not deliver.”

The conference, attended by mayors, chairpersons, councillors, town clerks, town secretaries, and chief executive officers from local authorities across the country, operated under the theme “A call to action, no compromise to service delivery.”

In his address, President Mnangagwa challenged councils to rise to the occasion and uphold the oath of office they took upon their election, emphasizing that failure is not an option.

Police Commits To End Vuzu Parties In Bulawayo

Bulawayo police have heightened their efforts to address Vuzu parties, where schoolchildren engage in sexual activities, drug use, and alcohol abuse at specific residences, according to Provincial police spokesperson Inspector Abednico Ncube.

Ncube made these statements during a recent meeting with journalists in response to concerns about increasing criminal activities in the city.

The police and various stakeholders are collaborating to combat Vuzu parties in Bulawayo.

Ncube emphasized that the police and the community are taking significant steps to address this issue, making it difficult for juveniles to organize such gatherings.

He mentioned that one contributing factor to Vuzu parties was the availability of venues, especially when parents were abroad or at work, leaving homes unattended during specific hours. Ncube praised the community for being diligent in reporting any unusual activities to the authorities.

According to Ncube, many schoolchildren who participated in Vuzu parties lived on their own. Initially, these gatherings were associated with simple celebrations like birthday parties but have since evolved into occasions marked by substance abuse and inappropriate sexual behavior. Some parties took place in private residences or lodges.

Ncube urged parents and the public to promptly report any gatherings or suspicious activities involving young people to the police.

Concern over Belarusian army general visit

The visit of Belarusian army general Viktor Sheiman has sparked concerns and controversy. Sheiman, who is under sanctions from the European Union and the United States for alleged human rights abuses and questionable business dealings, previously visited Zimbabwe to negotiate personal business deals.

During his recent visit, Sheiman led a Belarusian delegation that paid a courtesy call on President Emmerson Mnangagwa. The Zimbabwean Foreign Affairs minister, Fredrick Shava, stated that Sheiman’s mission was to strengthen bilateral relations, particularly in the field of agriculture. He emphasized the potential benefits of Belarusian dairy technologies for Zimbabwe’s dairy farms.

In a prior visit in 2018, Sheiman had negotiated business deals on behalf of the Belarusian government, including agreements to explore minerals like gold, platinum, and rare earths through a joint mining venture. However, subsequent revelations suggested that these deals were not as they initially appeared, with allegations of secret ownership and conflicts of interest.

According to reports, the joint venture, Zim Goldfields, was allegedly co-owned by Sheiman’s son, Sergei, with no Belarusian government involvement. An influential Belarusian businessman named Alexander Zingman, who served as Zimbabwe’s honorary consul in Belarus, was reported to be Sergei’s partner in the gold venture.

Leaked documents from the Pandora Papers revealed that Sheiman and his family had secretly owned an offshore company involved in dealings with a Zimbabwean State-owned mining company. The Pandora Papers is a large leak of documents shared with the International Consortium of Investigative Journalists, revealing various offshore corporate activities and potential conflicts of interest.

Viktor Sheiman has been a close ally of Belarusian President Alexander Lukashenko for many years. His role and alleged actions have led to sanctions from both the EU and the US, particularly related to human rights issues and the disappearance of Lukashenko’s critics during his tenure as Belarus’ prosecutor-general in 2004.

Local institute, EU partner to control livestock disease

By A Correspondent- The International Livestock Research Institute (ILRI), in partnership with government and the European Union (EU), has refurbished provincial veterinary laboratories in Matabeleland South and Masvingo provinces as part of efforts to control frequent livestock disease outbreaks in these areas.

The laboratories, which have been refurbished and well-equipped by the Livestock Production Systems in Zimbabwe (LIPS-ZIM) project, will enhance the provision of veterinary services and surveillance of notifiable diseases through early detection and effective control of livestock disease outbreaks.

The project, made possible through EU funding, seeks to address one of the major threats to livestock production among smallholder farmers.

Livestock production contributes significantly to the food, wealth, draught power and social well-being of many rural households in Zimbabwe with an estimated 90% of the national cattle herd, 98% of the goat flock, 90% of the sheep flock and 80% of the pig herd owned by smallholder farmers.

Since the early 2000s, the country has battled outbreaks of diseases such as January Disease, also known as theileriosis and foot-and-mouth with smallholder farmers facing the biggest risk.

In Zimbabwe, tick-borne diseases (TBDs) are the major cause of over 60% of ruminant livestock deaths, with theileriosis being the main cause of the country’s TBD-induced cattle deaths.

During the 2022/23 rainfall season, theileriosis claimed an unusually high number of cattle, surpassing previous records, which forced the country to declare war against the disease.

In a speech read on her behalf during the launch of a veterinary laboratory in Gwanda on Tuesday, Matabeleland South Provincial Affairs and Devolution minister Evelyn Ndlovu urged farmers to effectively utilise the facility.

I have no doubt that this will enhance the quality of our animals and improve disease detection, surveillance, control and research in Matabeleland South in particular and Zimbabwe at large,” she said.

The laboratory will be critical in the fight against animal and zoonotic diseases that currently bedevil our country, provinces, districts and those that can emerge; now and in the future.”

LIPS-ZIM project co-ordinator Sikhalazo Dube said because of their partnership with the EU in Zimbabwe, food would be less scarce, malnutrition less severe and hunger a thing of the past.

“We are grateful for the support of the European Union delegation in Zimbabwe in providing us the resources to help the people of Matabeleland and Masvingo find prosperity in livestock production,” Dube said.

Department of Veterinary Services (DVS) chief director Josphat Nyika said the decentralisation of the diagnosis process close to the farmer will go “a long way in ensuring wider coverage, high quality and accurate diagnosis of animal and zoonotic diseases”.

EU ambassador to Zimbabwe, Jobst von Kirchmann said the bloc was committed to strategically leveraging on livestock production for improved nutrition, food security and enhanced livelihoods in Zimbabwe.

“Our support to the LIPS-ZIM project reflects this strategic vision and contributes to making a tangible difference in the lives of smallholder farmers and in the broader agricultural landscape,” he said.

The €5 million (approximately US$5,3m) LIPS-ZIM project led by ILRI employs a comprehensive, sustainable approach to increase livestock production. According to the DVS, over 500 000 cattle have succumbed to January Disease since 2016, underscoring the urgency for effective veterinary services in Zimbabwe.

The EU has long supported Zimbabwe’s agriculture and livestock sector through initiatives like the Zimbabwe Agricultural Growth Programme, investing over €40 million (US$42 million) since 2018.

“He asked for my assistance for his campaign, can you see his phonecalls and messages here,” a friend of his who begged anonymity for fear of cyber-bullying told ZimEye.

Two other colleagues of the activist confirmed the allegations as they pointed ZimEye to his Monday post as the most authoritative public statement.

Chin’ono’s Monday morning threat was that the opposition should be careful of repeating the same mistake ZANU PF made when it caused the late Morgan Tsvangirai to start his own movement in 1999.

Chin’ono has in the past 3 years transformed his career into that of a political heavyweight by pressing a powerful ‘magic button’ against the entire Nelson Chamisa led civil society, accusing it of inaction on exposing corruption in May 2020. His (Chin’ono’s) social muscle over Chamisa popped out when the Zanu Pf led government slapped him with dismissable, baseless charges of incitement of violence.

“The idea that each time we disagree on a point relating to public affairs, the response is “Form Your Own Party” shows exactly why as a people wanting change we are failing to get it.

“Form Your Own Party is straight out of the ZANUPF playbook, that is what ZANUPF said to Morgan Tsvangirai and he formed it, and we all know what happened.

“It is depressing and backward for the alternative to embrace the same intolerant and authoritarian approach of pushing citizens away from questioning them instead of engaging them and making them see your reasoning on the decisions you make.”

On Sunday, Chin’ono also denounced the country’s main opposition CCC leader, Nelson Chamisa, accusing him of dodging a question on the jailed CCC top official Job Sikhala’s political affiliation.

During a discussion on X, formerly Twitter, a person named George Matipa asked Chamisa if Sikhala is still part of the CCC and if the party is doing everything possible to secure his release. In response, Chamisa said:

Job is a Zimbabwean. He deserves freedom. His case is our cause and collective fight!!

The answer did not convince Chin’ono who argued that Chamisa was being evasive. He said:

The question was not whether Job Sikhala is Zimbabwean or not, it was whether Job Sikhaka is still seen as part of CCC or not. This evasiveness is what makes people think and say that the CCC leadership is not doing enough. The question was a missed opportunity to unite us all by not being evasive but straight up. The response has othered Job Sikhala as just a Zimbabwean and not CCC, it has subcontracted the job to fight to everyone who is Zimbabwean and not CCC which is supposed to be his political home. But I know that there are some who are not yet ready to call a spade a spade.

Sikhala, a former Member of Parliament for Zengeza West, has been incarcerated since 14 June 2022 on allegations of inciting public violence during the funeral wake of slain CCC activist Moreblessing Ali in the Nyatsime area. However, Sikhala vehemently denies these charges and argues that he is a political prisoner, being persecuted for his confrontations with the ruling party, ZANU PF, regarding maladministration and the erosion of the democratic space.

This comes at a time when the outspoken commentator arrived in Washington, D.C., to address a gathering and openly call for the removal of Nelson Chamisa from the leadership of the CCC (Citizens Coalition for Change). The meeting, scheduled for tonight, comes on the heels of Chin’ono’s recent declarations on his platforms, wherein he reiterated controversial statements made to a military officer in January 2023, asserting that the CCC party should split shortly after the 2023 elections due to Chamisa’s perceived incompetence.*

Law Officer Nabbed Over Robbery

A well-known Mt Darwin lawyer, Elatone Bonongwe has turned villain after appearing in court facing charges of robbery.

This comes after he allegedly orchestrated a plan to rob Pfura Rural District Council engineer, Emson Chitsungo.

According to the State, Bonongwe planned the robbery sometime in October and contacted Tinotenda Bhunu to assemble a gang for the raid.

Bhunu, who is an uncle to the lawyer and his client in a separate robbery case, allegedly contacted Musa Gandi, Agness Kunaka, Raby Gwenya, Tafadzwa Chipashu and four others who are still at large.

Armed with two iron bars and a bayonet knife of an AK47 rifle, the eight forced entry into Chitsungo’s home where there were six other occupants.

They allegedly attacked the complainant with iron bars and burnt him with a hot iron, demanding cash before ransacking the house and stealing electrical appliances, clothing and US$1 600.

The suspects drove off towards Harare but were apprehended in Mazowe at a police-mounted roadblock.

Four suspects were arrested while the other four fled the scene.

The suspects were remanded in custody to the 13th of November and advised to apply for bail at the High Court.

Meanwhile, drama ensued outside the courthouse when an unidentified heavily built man tried to bar journalists from taking pictures of the lawyer and his accomplice.

The violent man attacked a freelance journalist who was on duty.

Bhunu, who is an uncle to the lawyer and his client in a separate robbery case, allegedly contacted Musa Gandi, Agness Kunaka, Raby Gwenya, Tafadzwa Chipashu and four others who are still at large.

Armed with two iron bars and a bayonet knife of an AK47 rifle, the eight forced entry into Chitsungo’s home where there were six other occupants.

They allegedly attacked the complainant with iron bars and burnt him with a hot iron, demanding cash before ransacking the house and stealing electrical appliances, clothing and US$1 600.

The suspects drove off towards Harare but were apprehended in Mazowe at a police-mounted roadblock.

Four suspects were arrested while the other four fled the scene.

The suspects were remanded in custody to the 13th of November and advised to apply for bail at the High Court.

Meanwhile, drama ensued outside the courthouse when an unidentified heavily built man tried to bar journalists from taking pictures of the lawyer and his accomplice.

The violent man attacked a freelance journalist who was on duty.

Health Experts Speak On Rising HIV Incidence

PLAYERS in the health sector have been challenged to include the elderly in their HIV prevention awareness campaigns as the number of people above the age of 50 living with HIV continues to grow.

According to a recent survey conducted by the United Nations Joint Programme on AIDS, 22 percent of people living with HIV are 50 and above.

Speaking during a media science cafe organised by the Health Communicators Forum World Health Organisation, Zimbabwe National Programmes Officer for Family and Reproductive Health, Dr Trevor Kanyowa attributed the increase to a number of factors.

“The first reason is that we now have effective ARVs of high quality and this has led to people living longer and healthier lives. They are managing to grow older. The other reason is that whilst we know that even among the younger age groups HIV is still being acquired.

“We have also noticed that the history of acquiring the virus at older age is also increasing owing to a number of things, for example, there is a general belief that it is for younger people, so therefore older people are less likely to use protective measures. We also notice that older persons may lose a partner and then may opt to go into a new relationship, but there is not that much effort to get tested,” he said.

A clinician, Dr Cleopas Chimbetete reckons the public health response to HIV must be re-aligned and pay more attention to the needs of senior citizens.

“When we see elderly people coming to our hospitals lets test them so that we reduce late diagnosis. We also need to highlight HIV prevention including elderly patients in our messaging so that they realise that they know that they are also at risk. We also realise that HIV is a risk for a number of other conditions so people living with HIV in old age are more likely to have other conditions such as hypertension, diabetes, mental health issues, cancer etc.”

51-year-old Angeline Chiwetani, who has been on ARVs for the past 15 years, attributes her long life to strict adherence to medication.

“I have been on treatment since 2008. A lot of people died and a lot of people moved because of the stigma associated a lot of landlords chased away their tenants. My husband and I were given separate toilets, just because we had HIV. But look at me now, I am healthy because of ARVs,” she narrated.

According to 2022 estimates, the population of people above the age of 50 living with HIV is 272 240.

Globally, the United Nations Joint Programme on AIDS estimates that the number of people above the age of 50 living with HIV has increased from 5.4 million in 2015 to 8.1 million in 2020.-ZBC News

Patrick Chinamasa, a senior Zanu PF official and the party’s treasurer general, lauded Tshabangu’s actions, hailing him as “a real man” for his bold move against the CCC’s former leader, Nelson Chamisa.

In a recent statement posted on X, Chinamasa praised Tshabangu for his decision to recall 30 CCC public office bearers without Chamisa’s approval, primarily targeting CCC MPs and councillors in the Bulawayo and Matabeleland regions. Duo nabbed for trying to marry off minors get bail

By A Correspondent- Two men from Karoi and a visiting Chinese citizen who allegedly made arrangements to marry off three underage girls in China by fraudulently acquiring travel documents for them, were yesterday granted bail by a Harare regional magistrate.

Chen Dehu (39), Joseph Rabson (44) and Shame Mafido (47), were remanded out of custody on US$100 bail each on human trafficking charges.

They were represented by Mr Rungano Makuni.

Magistrate Mrs Marehwanazvo Gofa also ordered Chen to surrender his passport at the Clerk of Court.

Chen is Rabson’s son-in-law, and he arrived in the country on October 3 to allegedly recruit teenagers so that he would traffic them to China for child marriages.

The three allegedly connived to recruit the three close relatives of Rabson and Mafido after deceiving them that there was a good educational sponsorship and good work conditions, when in fact they allegedly wanted to marry off the girls to Chinese men.

Prosecuting, Mr Pardon Dziva, alleges that on October 18, the three suspects facilitated transport for the three girls from Karoi to Harare by road and booked a room for them at a lodge where they stayed for four days, awaiting the processing of travel documents.

Since the required age of marriage in China is 20 years, the suspects allegedly fraudulently acquired new birth certificates and national identity documents for two of the girls, who were underage.

Chen, Rabson and Mafido allegedly facilitated the acquisition of a new Zimbabwean passport for the third girl by paying the amount required to achieve total control.

Detectives from CID Counter Terrorism Unit arrested the three suspects at the lodge in Belvedere, Harare, after receiving a tip-off to the effect that underage girls were being harboured.

Investigating officer Detective Constable Stephen Gandidzanwa yesterday strongly opposed bail on the grounds that there was a high likelihood of them influencing the girls not to come to court since they are related.

He said there was strong evidence that the three wanted to marry off the children and produced the necessary certificates from the Registrar General’s office showing the three girls were not already married. The Herald

Zim tops African countries experiencing high suicide rates

By A Correspondent- Zimbabwe is experiencing high depression and suicide rates among adults compared to other African countries the World Health Organisation (WHO) has revealed.

According to research conducted by mental health institutions, the main causes of mental health issues in Zimbabwe were socio-economic instabilities and marital problems.

WHO also said co-morbidity of people living with HIV and Aids and/or tuberculosis with mental health conditions was also common.

“Zimbabwe’s people experience higher rates of depression and suicide among older adults compared with other African countries,” the global health body said.

“Mental health awareness was ignored and only to be initiated recently. The ignorance was evidenced by the slight budget that was allocated to mental health expenditure in which most of the funds did not cater for the desired use.”

Socio-economic instability, high reliance on psychiatric hospitals, given lack of mental health services at primary healthcare levels, have made Zimbabwe susceptible to mental health challenges, WHO said.

“The Mental Health Act has not been updated since 1999 and does not reflect Zimbabwe’s ratification of the Convention on the Rights of Persons with Disabilities (2006). Lack of funding for medication, human resources and mental health promotion is also another cause,” WHO said.

It said 0,42% of the total healthcare budget was allocated to mental health expenditure, but most of the funds were used to maintain the country’s two psychiatric hospitals.

“Aside from these facilities, only two other hospitals in Zimbabwe have in-patient psychiatric units and there are only seven mental health facilities nationally. There are estimated to be no more than 18 psychiatrists, 13 psychologists and 13 clinical social workers in Zimbabwe to support a population of 15 million people. Most mental health services are supported by Zimbabwe’s 917 psychiatric nurses,” WHO said.

The organisation also noted that suicide cases surged over the past two years with higher percentages recorded in men than women.

Meanwhile, a research conducted by Macrotrends, an international statistics research platform revealed that Zimbabwe’s suicide-led deaths are quite high.

“Suicide mortality rate is the number of suicide deaths in a year per 100 000 population. Zimbabwe suicide rate for 2019 was 14,10, a 0,71% increase from 2018.

“Zimbabwe suicide rate for 2018 was 14,00, a 6,67% decline from 2017. Zimbabwe suicide rate for 2017 was 15,00, a 10,71% decline from 2016. Zimbabwe suicide rate for 2016 was 16,80, a 6,67% decline from 2015,” Macrotrends said.

In response to the increase in mental health issues, the Allied Health Practitioners Council of Zimbabwe introduced a mental health “first aider” three-day study course which seeks to mitigate or eliminate mental health-led deaths.

Truck driver nabbed over drugs

By A Correspondent- Police in Matabeleland South recently arrested a truck driver at the Beitbridge Border Post over unlawful possession of more than 14 000ml of pharmaceutical drugs.

Edison Kazingizi (29) was reportedly attempting to smuggle the drugs into Zimbabwe when he was intercepted by the police.

According to the police, the contraband was hidden in the truck which was carrying drums containing oil from South Africa.

“On October 26, police in Beitbridge arrested Kazingizi at Beitbridge Border Post in connection with unlawful possession of 48x100ml of Benylin Codeine, 50x100ml Adyco Salterpyn and 50x100ml Bron Cleer Cough Syrup,” the police statement read.

Meanwhile, police in Masvingo, acting on a tip-off, arrested Ammon Mataruse (27), Tinashe Matore (19) and Tatenda Mahachi (30) in connection with possession of illegal drugs.

Earlier this year, the International Criminal Police Organisation (Interpol) raised concern over drug trafficking in Zimbabwe.

“Drug syndicates use Zimbabwe as a transit country, especially for cocaine and cannabis bound for the rest of the world,” Interpol said on its website.

Interpol is an international organisation that facilitates worldwide police cooperation and crime control and is the world’s largest international police organisation.

Africa Organised Crime Index, in its 2021 report also said Zimbabwe had become a significant inland transit country for heroin, trafficked from Tanzania and Mozambique to western and southern African markets.

NGOs feel the heat on registration

By A Correspondent- Small non-governmental organisations (NGOs) have bemoaned the bureaucratic challenges impeding their registration saying debate around the Private Voluntary Organisations (PVOs) Bill had made the situation worse.

The organisations also argued that they were not consulted.

President Emmerson Mnangagwa has referred the PVOs Bill back to Parliament for further debate.

“There was no consultation really for us the small players. So we would read about it … A number of organisations have been trying to register and the process itself is very long and winding. The documents that are required just to register a PVO are a mammoth task to even think of,” We Act For Her (WAFH) founder Tsitsi Chitsike said.

“But small organisations have been making efforts to meet the requirements to make sure that they deliver and get registered.”

WAFH collaborated with the Talia Women’s Network to launch awards for various players in the NGO sector to help support and recognise the work being done to improve communities and the lives of the underprivileged in Zimbabwe.

The awards also seek to recognise, acknowledge and honour efforts made by NGOs, non-profit organisations and private sector organisations which are contributing to the enhancement of livelihoods in Zimbabwe.

Chitsike said: “We are working to ensure that we support NGOs’ work in our communities and make sure that they continue with their mandate. We have outstanding actors in disability inclusion.”

She noted that there were some NGOs making sure that people with disabilities were included in the work being done across the country.

“We have outstanding founders, for example. We have so many founders of NGOs. So we are looking to ensure that we recognise these founders and the work they are doing and the initiative that they took to just say we are registering something,” she said.

However, Talia Women’s Network founder Saliwe Zakariya said most small organisations were facing funding challenges.

“That’s the major issue that we have. Like I mentioned, we have limited funding coming into this country and so many players, such that the competition is high. Also new entrants into the sector find it difficult because of all the stringent requirements. Sometimes they will say three years audited accounts, yet you are in your first year of operation. How do I get there?” she said.

Meanwhile, Conscious Development and Empowerment Trust scooped the outstanding actor in community empowerment and social impact award, Sanitary Aid Zimbabwe received the outstanding actor in sexual and reproductive health award, while SayWhat was awarded the outstanding children and youth rights organisations gong, among other winners.

Internal squabbles haunt war vets

The Zimbabwe War Veterans Association (ZNLWVA) has been rocked by fierce power struggles after a “new“ leadership emerged claiming to have elbowed out War Veterans minister Christopher Mutsvangwa’s executive.

Mutsvangwa has been at the helm of the war veterans association for the past 10 years.

Two weeks ago, a new executive led by Andrease Mathibela claimed to have held a congress where a new leadership of the association was voted into office.

Other members of the new executive were identified as Edward Dube (secretary-general), Livingstone Chineka (finance secretary), Aloise Chimeri (information secretary) and Karen Kazingizi (welfare secretary).

Blessed Runesu Geza, who was allegedly elected as vice-president of the association, yesterday distanced himself from the grouping.

“I am not part of the group. They just woke up and said I am now the vic- president of the new executive. They did not have a proper congress, it was done on WhatsApp,” Geza said.

In an interview with NewsDay, the commissar of the Mutsvangwa executive, Jowell Mureremba and interim spokesperson Sam Parirenyatwa both described the Mathibela executive as bogus.

“One cannot just wake up and say they are the leaders of our association,” Mureremba said.

“We wanted to do a congress and President Emmerson Mnangagwa stopped us saying we should focus on the (August) election. It should be noted that we are products of Zanu PF and Zapu and we respect our political party.”

Mureremba said the association had been given the greenlight to hold an elective congress.

“Preparations are at an advanced stage and soon we will announce the date for the congress,” he said.

Said Parirenyatwa: “We do not recognise the recently-elected leadership. They are bogus and fleecing companies in the name of war veterans.”

However, Mathibela dug in insisting that he was the new chairperson.

Mathibela said the Mutsvangwa executive had ignored the plight of ex-combatants, as it lived lavishly while the majority of ex-fighters languished in poverty.

“The two main reasons why we went to war was to attain both political and economic freedoms. As war veterans, we are no longer respected. Our lives are now worse and at times you really ask yourself why you went to war? The wealth of this country is being enjoyed by only a few people,” he said.

Kazingizi, the executive’s welfare secretary, said their aim was to improve the welfare of the liberation fighters.

“The new executive takes off with a defined roadmap emanating from the congress resolutions and it’s no longer business as usual,” she said.

ZNLWVA has been Zanu PF’s main support pillar ahead of each electionsince its formation in 1990, with war veterans often accused of leading violent campaigns against the opposition.

In 2000, the war veterans led the invasion of farms in an operation that the ruling party deemed necessary to correct colonial land imbalances between blacks and whites.

The war veterans were also instrumental in the pre-and post-November coup in 2017 which ushered in President Emmerson Mnangagwa’s administration. NewsDay

Parliament hogs limelight over dubious tender processes

By A Correspondent- Parliament has come under scrutiny, following findings by the Auditor-General showing that goods and services worth over US$350 000 were procured without going to tender, in contravention of the Public Procurement and Finance Act (PPDPA).

Parliament is required by the PPDPA Act to invite bids for the procurement of goods above US$10 000 while quotations have to be sourced for purchases below the threshold.

However, findings by the new Auditor-General’s Appropriation Accounts and Fund Accounts in Arrear report which was tabled before the National Assembly shows that Parliament made procurements amounting to US$359 012 without floating a tender and without sourcing quotations.

“There was also no evidence that the entity (Parliament) appointed an Evaluation Committee to perform independent evaluations of the procurement of goods and services above the US$10 000 threshold. This is contrary to the PPDPA Act [Chapter 22:23],” reads the report.

“Failure to invite interested bidders or to secure or to source three quotations restricts competition such that procurement may not be made to the best advantage of the entity. The absence of an evaluation committee may result in lack of independence in the selection of suppliers.”

This is not the first time Parliament has been involved in dubious tender processes.

In September last year, Parliament found itself in the eye of a storm when leaked official communication revealed that it had awarded Blinart Investments (Private) Limited a tender to supply 173 laptops for a total of US$1 602 755.77, translating to US$9 200 per gadget.

Mid-End Computers and Hardware Ltd was awarded a tender to supply 79 desktops valued at US$3 000 each.

Treasury quickly cancelled the inflated tender and blacklisted the companies involved. In a statement dated 23 September, clerk of Parliament Kennedy Chokuda blamed Parliament staffers for the “corrupt deal”.

The state said Chokuda should have followed section 52 of the Public Procurement Regulatory Authority (Praz) which stipulates the conduct of an accounting officer in a case where the price of the lowest evaluated responsive bidder exceeds the budget.

“The accounting officer, (Chokuda) should have simply cancelled the contract and re-retendered, but he went on to negotiate price reduction showing favour to winning bidders and disfavor to other bidders,” reads the report.

The AG’s new report has also shown that Parliament is failing to account for money disbursed under the Constituency Development Fund (CDF), with over 100 constituencies failing to present proof of payment on utilisation of money allocated by the fund.

“Out of 175 Constituencies which received disbursements amounting to ZW$340 650 474, seventy constituencies did not submit to Parliament of Zimbabwe proof of payments that supported how US$140 000 000 allocated to them was utilised,” reads the report.

“I therefore could not confirm with certainty whether expenditure incurred related to the 70 constituencies. This was contrary to paragraph 6 (d) of the Constituency Development Fund Constitution which provides for submission of acquittals and quarterly reports.”

Parliament’s spending has also been under fire, amid indications that it exceeded the national budget by US$25 305 741, which ballooned to US$1 490 888 789 in 2016 and trebled to US$4 562 064 124 in 2017.

The government overshot the budget by US$3 560 343 130 in 2018.

In 2020, the government brought a Financial Adjustment Bill to Parliament as it sought condonation for the unapproved expenditure between 2015 and 2018 totalling US$9.6 billion.

The Finance ministry has also been failing to furnish the AG with the books, despite numerous requests.

The Public Accounts Committee has also failed to get access to the books despite summoning ministry officials four times between 2020 and 2022, stoking suspicions that there is an attempt to conceal how the money was spent. The NewsHawks

General Sibanda appointment into politburo- “Go to court”- Zanu PF

Zanu PF maintains that only the Constitutional Court can declare the appointment of General Phillip Valerio Sibanda to the Zanu PF politburo unconstitutional, rejecting growing criticism of President Emmerson Mnangagwa’s surprise decision.

Sibanda, the commander of the Zimbabwe Defence Forces, was named an ex officio member of the politburo on October 28 during the annual Zanu PF annual conference, triggering an outpouring of criticism from lawyers and the opposition who said the constitution prohibits security service members from being active in any political party or organisation.

Zanu PF says the criticism is unmerited.

“Firstly, it is saddening that for a people in a democracy we still fail to appreciate and respect the fact that only courts of law have the right to speak with finality on matters constitutional and legal,” Zanu PF’s director of information Farai Marapira said.

“The Constitutional Court is clearly created and alive for such matters. Anyone else claiming the right to speak as an authority or with finality is clearly misguided and a loose cannon. We unfortunately have personalities in our body politic who are prone to having engorged views of themselves and their opinions.

“Last Saturday’s announcement of General Sibanda as an ex officio member of the politburo is wrong in the eyes of a few who may consider themselves learned when they are not.

“Limiting interpretation of the appointment to one’s understanding of section 208 of the constitution of Zimbabwe alone is the result that has led to, in my view, a misguided take on matters.

“Section 67 of the Constitution, which is sacrosanct, says every Zimbabwean citizen has the right to make political choices freely.

“Let it be noted that Section 208 does not also prevent political choice but encourages members of the forces to not make partisan decisions in the execution of their duties.”

Critics are not convinced by Zanu PF’s arguments on the matter, and accuse Mnangagwa of breaching his oath to uphold the constitution by making Sibanda a partisan general.

Mnangagwa’s rivals say Sibanda can only have one of the roles at a time: general or Zanu PF politburo member, and not both.

“Zanu PF cannot keep breaking the law only to tell us to go to court,” Citizens Coalition for Change (CCC) spokesman Promise Mkwananzi said.

“They must observe the law. The appointment is both unlawful and politically problematic. The general must step down if he chooses to be a politician.”

Prominent lawyer Advocate Thabani Mpofu said it was “unconstitutional for General Sibanda to take up office in the Zanu PF politburo.”

He added: “That does not require any debate, not even a dishonest one. Can you imagine the general taking up a post in the CCC? Not only is this disturbingly inappropriate, it is also vulgar.

“If for instance we were to take the decision to agitate, to carry out nationwide protests, to be civilly disobedient; how is General Sibanda going to respond to us? Will he respond as a Commander of the Zimbabwe Defence Forces or as a member of the lootocracy that Zanu PF is?”

MDC-T leader Douglas Mwonzora, a lawyer, also weighed in, calling the appointment “totally wrong.”

“It marks a serious desecration of our constitution. It signals a serious and unacceptable conflation of the state, army, and party,” he said.

Mnangagwa, who is on his second and final term as president, is reported to favour Sibanda to succeed him and is trying to create a path for him into Zanu PF politics.

Former foreign minister Walter Mzembi said having General Sibanda “sit in a politburo where the fate of opposition parties is plotted and decided creates conflict for a military commander no matter how professional he may want to be seen.

“It’s untidy. It is these boundaries lately that relate to our state design that are being crossed with reckless abandon and disdain, and it should worry any right-thinking Zimbabwean,” Mzembi said.

Mohadi guard in soup over suspected thief’s murder

A police officer guarding the Harare residence of vice president Kembo Mohadi has been charged with murder after a man suspected of stealing building materials died following a brutal assault.

Blessing Zadzi, 28, was repeatedly struck with an iron bar and a hose pipe while his legs were pinned under what police described as “concrete lifting weights” on Sunday.

He was accused, together Emilington Machinga, of stealing six scaffold poles from a house under construction near Mohadi’s residence on Enterprise Road in Glen Lorne.

Police investigating Zadzi’s death have arrested five people including Sergeant Sanely Muchimba, 32, who was guarding Mohadi’s house and 32-year-old Dennis Tafirei Nyati, a soldier who was guarding another house nearby owned by retired Major General Nicholas Mahuhuba Dube.

Also arrested are three builders – Clever Malunga, 27, Tinashe Gama, 29, and Tanaka Nyabote, 22.

Police said Machinga and Zadzi stole six scaffold poles at 2823 Enterprise Road in Glen Lorne on October 28. A day later, they allegedly returned at around 10PM to steal more scaffold poles intending to sell them in Mbare.

Machinga was apprehended inside the property and he allegedly implicated Zadzi.

The five men now accused of murder allegedly teamed up and apprehended Zadzi at Chigayo Inn at Takura Shops and took him back to the site of the theft.

“Nyati started assaulting Zadzi inside a house under construction using an iron bar whilst his legs were pinned under concrete lifting weights. He continued to assault Zadzi with a hose pipe until he was unconscious,” an internal police memo of the incident, seen by ZimLive, said.

The other men jointly charged with Nyati were “looking on during the assault.”

Realising that Zadzi had lost consciousness, Nyati allegedly ordered Malunga and Trymore Tafirahuchena, who is still at large, to take him to his father who also lives on Enterprise Road in Glen Lorne.

“After seeing that his son was severely assaulted, James Zadzi refused to accept him,” police said.

Malunga and Tafirahuchena carried him out of the house and dumped him close to a Johanne Masowe shrine nearby.

Uebert Angel’s property bid raises eyebrows

Controversial cleric Uebert Angel‘s bid to acquire disused assets and land belonging to Chitungwiza municipality has raised eyebrows with allegations of underhanded activities being levelled against Citizens Coalition for Change (CCC) councillors.

Billion Group – a company that is allegedly linked to Angel wrote to Chitungwiza Municipality seeking to acquire land and disused properties to convert them into a hotel, conference centre, shopping mall, service station and construction of a medical centre.

The proposal is before the Chitungwiza municipality which will decide on the proposed deal.

The proposal has attracted concern from the residents of the dormitory town.

Chitungwiza and Manyame Residents Association director Marvelous Khumalo advised due diligence and “not pursue self-serving deals.”

“It is bad that Chitungwiza municipality has continued making negative headlines especially on issues involving the alleged corrupt allocation and management of land and abusing the disposal of public assets. It is even worse in this instance that this recent alleged case involves ‘a man of the cloth’ Prophet Uebert Angel.

“Recently we saw Uebert Angel featuring prominently in another alleged scandal dubbed, the Gold Mafia. As residents, we wonder what the ‘man of God’ through his company can offer to a struggling municipality like Chitungwiza other than swindling it of its diminishing land.

“We urge the council not to pursue these self-serving corrupt deals that are meant to benefit a few connected elites hiding behind religious robes at the expense of millions of residents and ratepayers as well as the quality of service delivery,” said Khumalo.

Angel, was earlier this year embroiled in a corruption scandal which was exposed by Aljazeera with him at the center of laundering, allegations which he has since trashed.

An official at the Chitungwiza municipality said worry over the proposal is premature as the councillors have not made a decision yet.

“Where a company or an institution comes to express interest, a council meeting is called the company presents. It is not the duty of the council to find out whose company has expressed interest as it would be discriminatory based on political lines. Woman Sues JSC Over Mandatory And Exclusive Use Of IECMS In Court Processes

By A Correspondent| An aggrieved Zimbabwean woman is suing the Judicial Service Commission (JSC) over its decision compelling litigants to exclusively use its newly introduced Integrated Electronic Case Management System (IECMS), for filing of court processes and conducting hearings in the country’s superior courts.

In the application, which was filed on 18 October 2023 at the Harare High Court, the woman, who is represented by Shadreck Masike of Shomwe and Partners Attorneys, in a matter supported by Zimbabwe Lawyers for Human Rights, wants the High Court to declare that the mandatory and
exclusive use of the IECMS platform in all superior courts in Zimbabwe for filing pleadings and conducting hearings, violates fundamental rights enshrined in the Constitution, which include the right to a fair hearing, the right to access to justice and the right to equal benefit and protection of the law.

In September, JSC advised its stakeholders that all litigation in superior courts will now be done on the IECMS platform and to use this, litigants or users needed gadgets such as laptops, computers,
tablets smartphones, adequate and stable internet connectivity and need to be registered on the IECMS platform and to be trained on how to use the IECMS.

The woman, resorted to take legal action against JSC after she failed to institute summons for a decree of divorce at Harare High Court in a matter in which she was a self-actor meaning that she would effectively be kept in a legal marriage which she has lost interest in.

The aggrieved woman was advised by the Registrar of the High Court that all superior courts in Zimbabwe including the High Court no longer accept the physical filling of hardcopy pleadings and instead all filings and hearings were now being done electronically on the IECMS platform.

The woman was told that as a self-actor, she should cause the summons to be issued out through logging onto the IECMS platform, which requires not only a compatible electronic device but a steady access to and connection of internet service as well.

To this end, the woman was directed to the IECMS hub to be assisted, only to experience a crowd of people waiting to be assisted including legal practitioners, whom she was told take precedence and this forced her to leave the High Court without getting the opportunity to be assisted.

Because of this experience at the High Court, the woman argues in her application that she was hamstrung to institute her divorce summons because she does not own a compatible device nor does she have funds to secure a steady supply and connection of internet to pursue her matter to its completion including not being conversant with manoeuvring the IECMS platform.

She argued that her fundamental rights such as the right to a fair hearing enshrined in section 69(2) of the Constitution, the right to access to justice guaranteed in section 69(3) of the Constitution and
the right to equal protection and benefit of the law provided in section 56(1) of the Constitution, will be violated if she is forced to make use of a system that appears complicated, expensive and
onerous to use.

The woman contended that the exclusive use of the IECMS platform discriminates on who accesses the court on the basis of class and social or economic status, which means that the less privileged and marginalised members of society will find it extremely difficult to access the courts through the JSC’s new system.

She further argued that a virtual court session is not a public trial or hearing and hence falls foul to the provisions of the Constitution.

The Harare woman wants Justice, Legal and Parliamentary Affairs Minister Hon. Ziyambi Ziyambi, who together with JSC are cited as respondents in the court application, to be ordered to reinstate the traditional physical filing of pleadings and physical hearings so that it co-exists with the IECMS platform in a manner that will not infringe fundamental human rights.

She also wants the High Court to declare the exclusive use of the IECMS platform in all court processes in the country’s superior courts as unconstitutional as it violates section 69 of the Constitution which guarantees the right to a public trial and public hearing among other fundamental rights.

Takudzwa Ngadziore Abducted, Dumped In Christon Bank

By A Correspondent| Citizens Coalition for Change (CCC) Youth Coordinator, Takudzwa Ngadziore, found himself in a harrowing situation this morning when he was forcibly abducted by unidentified men wielding AK47 rifles, only to be later abandoned in the remote area of Christon Bank in Mazowe.

Remarkably, Ngadziore managed to capture a chilling seven-second video of the moment of his abduction, which he bravely shared on his Facebook page.

In the video, an armed assailant brandishing AK47 gun is seen approaching him and he is heard shouting “I am being followed”.

“Our Youth Taskforce coordinator, @ngadziore, has been abducted by armed men. He recorded a video of the moment they aggressively approached him with AK47 guns to abduct him,” said CCC in a message posted on X.

This distressing video quickly went viral, drawing widespread attention on social media platforms.

One of the abductors, caught in the frame, has become the subject of intense scrutiny and discussion online.

Gift Ostallos Siziba, the CCC Deputy Spokesperson, later provided an update on Ngadziore’s condition saying he was subjected to torture before being abandoned in Christon Bank, Mazowe.

“We have received information that Hon Takudzwa Ngadziore was tortured and dumped in Christon Bank in Mazoe. Our welfare and legal teams have been dispatched to locate him,” Siziba stated, underscoring the urgency of the situation and the organization’s commitment to ensuring Ngadziore’s well-being.

This shocking incident bears a chilling resemblance to a recent case involving former Mabvuku-Tafara legislator, James Chidhakwa, who was also reportedly subjected to severe torture by suspected state security agents just two weeks ago.

SA Home Affairs Minister Pays Heavy Price For Attempting To Shut Doors On Foreigners Including Zimbabweans

The Constitutional Court has ordered Home Affairs Minister Aaron Motsoaledi and Director-General Livhuwani Makhode to pay, from their own pockets, some of the legal costs incurred by Lawyers For Human Rights (LHR) for their “appalling” conduct in a case concerning the rights of undocumented immigrants.

The minister was ordered to pay 10% and Makhode 25% for their “culpability in the shambles”.

The court has also barred their former legal representative Adv Mike Bofilatos from claiming any fees for the case. This after he made two “inexplicable” ex parte (without the other side present) applications. One was made to the high court and one to the Constitutional Court. He sought an “extension” of a previous ruling that declared sections of the Immigration Act to be unconstitutional and giving Parliament 24 months to rectify the legislation.

Pending the changes to the legislation, the apex court ruled that any person arrested on charges of being illegally in the country must be brought before a court within a certain time frame for an inquiry into whether the detention was in the interest of justice. But that ruling lapsed, and six years later there was still no remedial legislation.

Because of this, magistrates were refusing to hold the inquiries. This meant that some detainees were simply being released when they should have been deported. Others were being detained for months.

The minister and director-general, without notice to LHR, then sought an extension of the Constitutional Court ruling.

In a scathing judgment, Judge Steven Majiedt said the court had now stated in five judgments that it did not have the power to extend a deadline of suspension after that deadline had expired.

He said the applicants had inexplicably vigorously opposed the LHR’s application to intervene, castigating it for pointing out the four previous decisions, saying they felt “affronted by this” and asking the State Attorney to investigate the conduct of the LHR deponent to the affidavit.

“All this amounts to extraordinarily lax and arguably even foolhardy litigating,” Judge Majiedt said.

He said the director-general, in his “feeble affidavit” had attempted to blame the inordinate delay in the enactment of the remedial legislation on the Covid pandemic and the fire at Parliament, but these had occurred long after the 24-month deadline had passed.

Another “grim” excuse was that Members of Parliament were focussed on the national elections in 2019, “an acknowledgement, on the face of it, that campaigning for re-election was far more important to Members of Parliament than meeting the deadline for the enactment of remedial legislation”.

Until the minister and the director-general were called upon by the court to state why they should not be ordered to pay costs out of their own pockets, there had been “not the remotest hint of an apology for the deplorable state of affairs and neglect of Constitutional duty”.

In his affidavit, opposing a personal costs order, the minister made “troubling allegations”, the judge said.

He claimed to have no knowledge whatsoever of the application. When he became aware of it, he was very angry, he was astounded that it had been brought ex parte. He said the steps taken to effect the legislative amendments had not been fully explained. He apologised for the “mess” and said he had fired his legal team.

The director-general also apologised and said he had not properly applied his mind.

They asked that they be given permission to withdraw the application.

LHR, however, argued that the excuses were “untenable”. The application should not be withdrawn. Instead, the court must intervene and remedy the constitutional defects.

In written submissions, Advocate Bofilatos said he had always acted properly and there could not be any accusation of negligence levelled against the legal representatives.

At worst, there was “a mere error of judgment”, he claimed.

Judge Majiedt said, “To err is human. All of us are fallible. But what we have here goes far beyond human error and good faith mistakes.”

“It can hardly be disputed that this litigation has been conducted in a dreadful manner. A higher duty is imposed on public litigants, as the Constitution’s principal agents, to respect the law … to tread respectfully when dealing with rights.

“The applicants legal representatives had abysmally failed in their duty to represent their clients in a manner required by their professional rules. The legitimacy of our judicial system will fall into disrepute if the shockingly poor conduct of litigation, as in the present instance, is allowed to continue unchecked.

“In order to mark this court’s displeasure, an order depriving the legal practitioners of their fees is warranted.”

Judge Majiedt said he accepted that the minister and director-general were largely dependent on the advice of their lawyers but that did not absolve them from culpability.

“I accept, as troubling as it may be, that the minister was in the dark about this litigation … on that basis, I take the view that he should be held liable in his personal capacity for 10% of the LHR’s costs.”

Regarding the director-general, the judge said on his own version he had admitted to gross negligence and had advanced wholly unsustainable reasons for the failure to pass the remedial legislation. For that, he must pay 25% of the costs.

Regarding the outcome of the application, Judge Majiedt said the applicants had ignored an order of the court for six years and further delay would be seriously detrimental to the interests of justice and highly prejudicial to those affected.

The court ordered that Parliament enact the remedial legislation within 12 months. The court made similar orders as it did in 2017 regarding the detention of those accused of being in South Africa illegally, including court oversight into the extent of the detention.

Mohadi’s Security Charged With Murder

A police officer who was on duty at Vice President Kembo Mohadi’s residence in Harare has been charged with murder after a man suspected of stealing building materials died from a severe assault.

Blessing Zadzi, aged 28, was brutally beaten with an iron bar and a hose pipe, while his legs were pinned under “concrete lifting weights.”

The incident occurred near Mohadi’s residence on Enterprise Road in Glen Lorne. Zadzi was accused of stealing scaffold poles from a nearby construction site.

Police investigations into Zadzi’s death have led to the arrest of five individuals, including Sergeant Sanely Muchimba, who was guarding Vice President Mohadi’s house, and Dennis Tafirei Nyati, a soldier responsible for guarding another nearby property owned by retired Major General Nicholas Mahuhuba Dube. The other three arrested individuals are Clever Malunga, Tinashe Gama, and Tanaka Nyabote, who were builders at the construction site where the incident occurred.

The incident unfolded when Zadzi and Emilington Machinga were accused of stealing scaffold poles from the construction site. When they returned to the scene to steal more poles the following day, Machinga was apprehended and allegedly implicated Zadzi.

The five individuals charged with murder reportedly apprehended Zadzi at Chigayo Inn at Takura Shops and took him back to the site of the theft. There, Nyati is alleged to have assaulted Zadzi inside a house under construction using an iron bar while pinning his legs under concrete lifting weights. The assault continued with a hose pipe until Zadzi became unconscious. The other men present at the scene were said to be looking on during the assault.

Realizing that Zadzi had lost consciousness, Nyati instructed Malunga and Trymore Tafirahuchena to take him to his father’s residence, also on Enterprise Road in Glen Lorne. However, when they arrived, Zadzi’s father refused to accept him. Malunga and Tafirahuchena then carried Zadzi to a location near a Johanne Masowe shrine nearby.

Following a report from Zadzi’s father, Highlands police responded to the scene, and Malunga led them to Zadzi’s body, which was covered with a duvet.

Gvt to introduce dual prevention pill for HIV, pregnancy

By A Correspondent- Government will soon be introducing the dual prevention pill (for HIV and pregnancy), which will add to the list of other biomedical HIV prevention tools that seek to reduce the pill burden in women’s contraceptives.

Speaking during the Biomedical HIV Prevention Forum in Harare recently, Dr Pamela Mukwekwerere from University of Zimbabwe’s Clinical Trials Research Centre said:

“The dual prevention pill adds to the list of other biomedical HIV prevention tools Zimbabwe has adopted over the past few years, which is yet to commence.

“The package addresses the adherence issue as well as the pill burden women face, and has an alternative between contraceptives, PrEP or PEP and other medications.”

National Aids Council chief executive officer Dr Bernard Madzima said Zimbabwe needs to take a very active role to both prevent new HIV infections in children and keep mothers alive.

“In order to prevent new HIV infections in children, we need to take a very active role on the biomedical HIV prevention tools Zimbabwe has adopted over the past few years.”

By A Correspondent| Epworth North legislator Zivai Mhetu has vowed to use his five-year term as the Member of Parliament to transform the area into a Borrowdale.

Speaking at his victory celebrations at Overspill shops on Sunday, Mhetu said he has lined up a number of projects to facelift Epworth.

Mhetu said his development focus which includes the regularization of certain areas, construction of a community hall and other projects will help change people’s perceptions about Epworth.

I want to thank you for voting for CCC President Nelson Chamisa, myself and CCC Councilors in the last elections.

“I want to promise you that by the end of my five year term, i would have moved mountains, Epworth would have developed, every Epworth resident would be shining, Epworth will not be looked down upon by anyone, Epworth will be at the same level with Borrowdale in terms of development,” said Mhetu.

The victory celebrations were attended by over 2500 people and concluded with a raffle ticket draw which saw some residents walking away with bicycles, solar panels, groceries and stationary among other things.

Mhetu promised to construct a community hall which will house a music recording studio and a disability centre.

This centre he said will help address rampant drug abuse among youths in Epworth.

Samutoko in soup over pangolin

By A Correspondent- Police in Mutoko, Mashonaland East province have arrested Takudzwa Charles Chinomona for illegal possession of a live pangolin.

Chinomona was arrested on October 25 after police received a tip off that he was selling the animal.

It alleged that one of the police officers posed as a buyer and approached Chinomona for the transaction.

It is reported that Chinomona told the officer that he had left the pangolin at home and asked him to wait at Gwanza Business Centre under Chief Nyamukoho.

Allegations are that the officer proceeded to Gwanza Business Centre and waited until 3am the next day for Chinomona to return with a live pangolin concealed in a sack.

Police spokesperson for Mashonaland East province Inspector Simon Chazovachiyi confirmed the incident.

“It is reported that he brought the live pangolin and told the officer that he was selling it for US$3000. He was asked to produce a licence authorising him to sell the pangolin but he failed to produce it and he was immediately arrested.”

By A Correspondent- Government ministries and local authorities have failed to implement recommendations of the Auditor-General, with new statistics showing an increase in findings that have gone unaddressed in previous reports, amid evidence that state institutions lack accountability.

The country has been grappling under increased illicit financial flows, which have been facilitated by poor public procurement procedure and bad governance.

Latest findings by acting Auditor-General Rheah Kujinga published in her report for the year ended 31 December 2022 show that government ministries have failed to implement key reforms recommended as far back as 2021, particularly on governance.

“I would like to acknowledge the ministries which have taken steps to implement my findings. Out of the 226 audit findings raised during the 2021 financial year, 73 (32%) were implemented, 24 (11%) were in progress and 127 (57%) were yet to be implemented,” reads the report.

The report shows that ministries and commissions have been blighted by recurring issues, involving the non-delivery of vehicles, despite them having been paid for, raising fears of more illicit dealings.

“The Ministries and Commissions procured a number of motor vehicles from various service providers during the year, of which 74 motor vehicles had not been delivered at the date of finalising my audits. The number includes sixteen (16) motor vehicles that were purchased in 2021,” reads the report.

“There is a need for Ministries and Commissions to have tighter clauses in contracts and monitor contract performance as some suppliers lack the capacity to deliver the motor vehicles as per the contract awarded. Public service delivery is compromised if assets procured are not delivered on time.”

Government ministries have also been failing to submit financial statements as required by the Public Finance Management Act (PFMA), raising fears of mismanagement of funds.

“There was a variance of ZW$1 205 890 897 between expenditure amounts reflected in the PFMS of ZW$616 206 644 245 and the Sub-Paymaster General Accounts of ZW$617 960 373 460. The Ministries did not produce reconciliation statements showing the sources of differences. As a result, the completeness or accuracy of those figures could not be validated,” reads the report.

“The budget allocated for Voted funds in terms of the Appropriation (2022) Act, 2021 and Appropriation Supplementary for the twenty-nine (29) Ministries and Commissions included in this report was ZW$1 455 657 861 432. The budget for the six (6) Constitutional and Statutory Appropriations in this report was ZW$145 486 659 150.

“Budget utilisation was ZW$1 263 167 309 927 and ZW$139 720 373 703 respectively. The underutilisation of the budget was mainly as a result of the non-release of funds by the Treasury due to low revenue inflows. Consequently, this affected the achievement of some programme targets and service delivery by the affected Ministries and Commissions.”

Local authorities have also failed to implement the AG’s recommendations from the previous report, with 39 out of 221 findings being fully addressed, 28 partially addressed and 154 yet to be addressed.

According to the report, governance issues were the most dominant, accounting for 129 unaddressed matters.

“The audit findings in my report warrant the attention of management and those charged with governance. The audit revealed that most findings relate to governance issues, revenue collection and debt recovery,” according to the report.

“Governance issues dominated my findings as they increased from ninety-one (91) issues in 2021 to one hundred and thirty-nine (139) in 2022. The same has remained high in all my reports over the last five years.

“Concerted efforts from those charged with governance are required to put in place measures to address weaknesses reported in my report. There is still room for improvement on accountability and transparency in all the Local Authorities if, among other things, audit recommendations are implemented.”

Local authorities have also been struggling to send financial statements for audit, with the trend showing a sharp increase since 2019.

The report shows that a total of 109 financial statements were not yet submitted for audit as at 31 May 2023.

The financial statements not submitted for audit related to the financial years ended 31 December, with one being submitted in 2019, 2020 (5), 2021 (28) and 2022 (75).

“The audit of 64 financial statements from fifty-eight (58) local authorities were in progress while five were at signing stage, at the time of concluding my report,” it reads.

As previously reported in February, Parliament’s Public Accounts Committee (PAC) gave the Zimbabwe Anti-Corruption Commission (Zacc) a 23 July deadline to carry out systems compliance audits across all local authorities after it emerged that several of them were last audited between 2017 and 2019, raising the risk of corruption, and mismanagement of funds.

PAC also ordered local authorities to, with immediate effect, put in place back-up systems for information, while ordering the ministry of Local Government to procure current accounting software by 30 June 2023, a deadline which several local authorities have failed to meet.

15 Injured In Munenzva Bus Horror Crash

By-A Munenzva Bus Services bus was involved in an accident along the Tokwe–Mhandamabwe Road

 resulting in 15 of the passengers sustaining various degrees of injuries.

According to the Zimbabwe Republic Police (ZRP), the bus, which had 33 passengers on board, at around 10.30 PM on Sunday veered off the road before overturning and landing on its right side at the 20-kilometre peg along Tokwe–Mhandamabwe Road.

The driver of the bus lost control of the bus as he avoided ploughing into a herd of cattle that were on the road. A post on the ZRP X page reads:

The ZRP confirms a road traffic accident in which 15 people were injured when a Munenzva bus with 33 passengers on board veered off the road before overturning and landing on its right side at the 20-kilometre peg along Tokwe–Mhandamabwe Road on 29/10/23 at around 2230 hours.

The driver was allegedly trying to avoid hitting a herd of cattle which was on the road.

A 33-year-old woman from Shurugwi, who allegedly dumped her newly-born baby in a blair toilet, has appeared in court charged with infanticide.

It is the State’s case that on the 11th of October this year, 33-year-old Sarah Makokoba of Nhema Village in Shurugwi, who was nine months pregnant told her husband, Chenjerai Tumba that she was having a stomach ache.

The court heard thatbduring the night, Makokoba went to the toilet and gave birth before throwing the baby into the blair toilet.

The court further heard that her husband only realised that she was no longer pregnant in the morning and noticed some bloodstains on the floor.

He then took her to the hospital for medical examination.

Results of the medical examination revealed that Makokoba had given birth.

The baby’s body was found in the toilet.

Makokoba was remanded in custody to the first of next month.

A Police source has told The Midweek Watch that a man in Chivi killed a 2 year old child of his girlfriend after he visited her and did not find the lover at home.

Man Rapes, Brutally Kills Girl(6)

A 26-year-old Magunje man has been arrested in connection with the rape and murder of a six-year-old girl whose lifeless body was found in a bushy area.

It is alleged that Shingai Makura kidnapped the six-year-old girl before taking her to a bushy area where he raped her.

Gruesome details of how Makura allegedly raped and murdered the girl were revealed by the Zimbabwe Republic Police on their X page.

Allegations are that after raping the young girl, the accused went on to kill her using a stone to conceal evidence.

The girl’s naked body was later found hidden between two huge rocks in a bushy area, with investigations leading to the arrest of the suspect.

Meanwhile, a security guard who shot and killed a colleague during a change of guard at a supermarket in Harare has appeared in court facing charges of culpable homicide.

Preliminary investigations indicate the accused accidentally fired the gun.

Privilege Chivanganye, aged 28, appeared in court this Monday and was released on US$80 bail. He was remanded to the 17th of next month.

It is alleged that during a change of guard, the accused advised his colleague that there was a problem with the firearm before the two unsuccessfully tried to fix it.

In the process, the accused is alleged to have squeezed the trigger and shot his colleague once in the stomach.

The colleague was rushed to hospital where he later died.

SADC Ignores Zimbabwe Crisis 

By-The SADC virtual Extra-Ordinary Summit held on Tuesday, 31 October, adjourned after preliminary discussions on the political and security situation in the Democratic Republic of Congo.

The SADC leaders decided to resume the discussions in Luanda, Angola on Saturday, 04 November 2023.

A statement issued by the SADC Secretariat in Gaborone, Botswana, reads:

The virtual Extra-Ordinary Summit of the Southern African Development Community (SADC) Heads of State and Government which started today the 31st October 2023, will reconvene in person in Luanda, Republic of Angola on 04th November 2023.

The Summit will finalise discussions on the consolidation of peace, security, and governance in the SADC region.

The SADC Summit is responsible for the overall policy direction and control of function of the Community.

SADC endorsed Zimbabwe’s general elections held on 23 and 24 August this year.

The SADC Chairman and President of Angola João Manuel Gonçalves Lourenço commended Zimbabwe and Eswatini for conducting elections in an “orderly manner”, saying it is a major victory for democracy.

The Musicians Seh Calaz, and Baba Harare as well as social media personality Shadaya have defended Executive Chairman and Founder of Nash Holdings Tinashe Mutarisi after he clashed with Java and singer Mudiwa hood on social media.

Mutarisi lambasted Java and Hood, saying they were jealous of him for “the love and respect from the people of Zimbabwe” that he receives without putting any effort.

He also claimed that Java and Hood have continuously attacked him and his Nash Paints business “without any valid reason.”

Mnenzva In Horror Crash

A Munenzva Bus Services bus was involved in an accident along the Tokwe–Mhandamabwe Road

 resulting in 15 of the passengers sustaining various degrees of injuries.

According to the Zimbabwe Republic Police (ZRP), the bus, which had 33 passengers on board, at around 10.30 PM on Sunday veered off the road before overturning and landing on its right side at the 20-kilometre peg along Tokwe–Mhandamabwe Road.

The driver of the bus lost control of the bus as he avoided ploughing into a herd of cattle that were on the road. A post on the ZRP X page reads:

The ZRP confirms a road traffic accident in which 15 people were injured when a Munenzva bus with 33 passengers on board veered off the road before overturning and landing on its right side at the 20-kilometre peg along Tokwe–Mhandamabwe Road on 29/10/23 at around 2230 hours.

The driver was allegedly trying to avoid hitting a herd of cattle which was on the road.

Former Zanu PF MP for Chivi South Constituency, Killer Zivhu, has sensationally claimed Sengezo Tshabangu is a mere political tool being used to disturb CCC leader President Nelson Chamisa.

Zivhu on Tuesday accused Hopewell Chin’ono of hiring Tshabangu to soil President Chamisa’s image.

Hopewell Political Party: “Even His Goats, Will They Vote For Him?”

By A Correspondent | The commentator and activist Hopewell Chin’ono has threatened to start his own political party if CCC leader Nelson Chamisa’s supporters continue their criticism of him.

Chin’ono made these remarks on Monday morning.

He said the opposition should be careful of repeating the same mistake ZANU PF made when it caused the late Morgan Tsvangirai to start his own movement in 1999.

Chin’ono has in the past 3 years transformed his career into that of a political heavyweight by pressing a powerful ‘magic button’ against the entire Nelson Chamisa led civil society, accusing it of inaction on exposing corruption in May 2020. His (Chin’ono’s) social muscle over Chamisa popped out when the Zanu Pf led government slapped him with dismissable, baseless charges of incitement of violence.

The activist, who has failed to disclose the name of the UK bank he claims made him rich through a £50,000 car loan in 1996, and who to date makes Zimbabweans salute him by the hypnotique “Daddy” title, medically proven in various court cases to subdue the will power of sex-grooming victims (minors and elderly), announced in part saying,

“The idea that each time we disagree on a point relating to public affairs, the response is “Form Your Own Party” shows exactly why as a people wanting change we are failing to get it.

“Form Your Own Party is straight out of the ZANUPF playbook, that is what ZANUPF said to Morgan Tsvangirai and he formed it, and we all know what happened.

“It is depressing and backward for the alternative to embrace the same intolerant and authoritarian approach of pushing citizens away from questioning them instead of engaging them and making them see your reasoning on the decisions you make.”

Just yesterday Chin’ono also denounced the country’s main opposition CCC leader, Nelson Chamisa, accusing him of dodging a question on the jailed CCC top official Job Sikhala’s political affiliation.

During a discussion on X, formerly Twitter, a person named George Matipa asked Chamisa if Sikhala is still part of the CCC and if the party is doing everything possible to secure his release. In response, Chamisa said:

Job is a Zimbabwean. He deserves freedom. His case is our cause and collective fight!!

The answer did not convince Chin’ono who argued that Chamisa was being evasive. He said:

The question was not whether Job Sikhala is Zimbabwean or not, it was whether Job Sikhaka is still seen as part of CCC or not. This evasiveness is what makes people think and say that the CCC leadership is not doing enough. The question was a missed opportunity to unite us all by not being evasive but straight up. The response has othered Job Sikhala as just a Zimbabwean and not CCC, it has subcontracted the job to fight to everyone who is Zimbabwean and not CCC which is supposed to be his political home. But I know that there are some who are not yet ready to call a spade a spade.

Sikhala, a former Member of Parliament for Zengeza West, has been incarcerated since 14 June 2022 on allegations of inciting public violence during the funeral wake of slain CCC activist Moreblessing Ali in the Nyatsime area. However, Sikhala vehemently denies these charges and argues that he is a political prisoner, being persecuted for his confrontations with the ruling party, ZANU PF, regarding maladministration and the erosion of the democratic space.

This comes at a time when the outspoken commentator arrived in Washington, D.C., to address a gathering and openly call for the removal of Nelson Chamisa from the leadership of the CCC (Citizens Coalition for Change). The meeting, scheduled for tonight, comes on the heels of Chin’ono’s recent declarations on his platforms, wherein he reiterated controversial statements made to a military officer in January 2023, asserting that the CCC party should split shortly after the 2023 elections due to Chamisa’s perceived incompetence.*

Chin’ono’s strong criticism of Chamisa and the CCC reached a peak just last Sunday when he tweeted, suggesting that the party’s leadership has divided Zimbabweans. His persistent repetition of the phrase “opposition has done nothing” both before and after his dramatic arrest in July 2020, has raised questions about the motives behind his high-profile detainment by ZANU PF.* *Furthermore, the timing of Chin’ono’s latest actions raises questions about the sincerity of his persecution profile, as he had recently been criticized for operating a disinformation campaign by @OpenSecretsZA. Chin’ono is now seemingly backed by Tafadzwa Matinenga, who is actively organizing meetings in the United States to denounce Chamisa. Notably, Matinenga, the daughter of lawyer Eric Matinenga, has not yet commented on the reasons for her involvement in these divisive meetings on US soil.

The meeting details can be found on the attached poster. Hopewell Chin’ono’s transformation from a former supporter of the ZANU PF regime to a vocal critic of the CCC has left many wondering about his motivations and the future of Zimbabwean politics.

This development promises to be a significant moment in the ongoing political landscape of Zimbabwe, as Chin’ono’s influence and the CCC’s leadership face intense scrutiny.

Space biology- a first for Africa

It will be a first for Africa: One innovative step by the North-West University (NWU) and one giant leap by the continent. The NWU’s Faculty of Natural and Agricultural Sciences is set to launch the research area SpaceBiology@NWU.

According to one of the project leaders, Prof Henk Bouwman, this multidisciplinary research area – which is going encompass expertise from other NWU faculties such as Engineering too – will look at how biology can assist with living in space.

“Humans will be back on the Moon in a few years, but colonisation of the Moon and Mars is still some time away. That is why we need research to assist in the process. In situ production of fibre, carbohydrates, fats, protein, nutrients and oxygen will be key for sustained living in space under confined, constrained and extreme conditions. This means organisms must be sustained at productive rates, which implies functional ecosystems based on regolith. Regolith refers to unconsolidated, non-biologically enriched rock and dust.

“The only way to do that is to select and test organisms and communities under simulated (analogue) conditions on Earth, and then to replicate the experiments in space (eventually the Moon and Mars). Knowledge of how microorganismsplantsanimals and ecological combinations react in space and on the Moon and Mars is required. Africa has many harsh conditions that harbour organisms that may be candidates for space flight and colonisation on the Moon and Mars. Our deserts, poor soil areas (often also classified as regolith), mine shafts, isolated islands, aquatic systems and other ecologies have organisms that can sustain and transform regolith into sustainable and arable soils,” says Prof Bouwman.

 The rise in spaceflight and space exploration by national (such as NASA, the National Aeronautics and Space Administration, and SANSA, the South African National Space Agency), international (ESA, the European Space Agency) and commercial entities (such as SpaceX and Blue Origin) has increased the need for space biology research, and groundbreaking research by the NWU has already shown that earthworms are able to grow normally and reproduce relatively normally at up to six times Earth’s gravity. Now it is time to see how they function under microgravity conditions.

“One of the challenges we will be looking at is how to use microbes and earthworms to convert regolith to soil in order to plant plants. There are so many possibilities. We have the best ecotoxicologists in Africa, and we have so many exceptional researchers who are able to measure stress and the effect of stress on biological systems. I think we are perfectly positioned to conduct such research. We have the expertise at the NWU to conduct research to facilitate long space flights and the future colonisation of the Moon and Mars. It may take many months to years to reach Mars, and that requires about 1,4 tons of food per person. We will have to be able to grow our own food in microgravity situations,” Prof Bouwman explains.

The African continent is home to some of the harshest conditions on the planet, and the NWU’s expertise regarding ecosystems in these conditions is an invaluable resource.

“There are a vast number of plants, animals and microbes that not only live but thrive under these harsh conditions, and we need to exploit and harness our knowledge about them as we embark on this new adventure for our species. Just think of the multitude of practical developments that can be brought back to Earth and have practical applications for conditions in Africa.”

This includes growing edibles in conditions previously deemed unsuitable for that purpose.

The escape velocity needed to pummel through Earth’s thick atmosphere and the grip of gravity is immense. The same can be said of the out-of-the-box thinking required to make a success of the next great human endeavour.

“We sit at the bottom of Africa, largely removed from the body of space researchers in Europe and America. This means we have students and researchers who think differently and more creatively, as they are not confined by previously established norms concerning such research. We are much more inclined to think broadly than our northern counterparts.”

It is a space odyssey, a voyage to the final frontier. 

“It is exciting, it is dangerous, it is new, and it is challenging. Why not embark on this journey?” Prof Bouwman asks with a gleam in his eyes.

Prof Jonathan Moyo’s critical review of General Sibanda appointment

APPOINTMENT OF THE COMMANDER DEFENCE FORCES [CDF] GENERAL PV SIBANDA AS AN EX OFFICIO MEMBER OF THE ZANUPF POLITBURO: A CRITICAL REVIEW

The bottom part of this announcement of appointments to the ZanuPF politburo made on Saturday at the party’s 2023 people’s conference in Gweru by

@edmnangagwa has gotten political tongues wagging and has triggered heated national debate: “Comrade Delegates;The amended 2023 Party Constitution gives impetus, urgency and renewed focus to the socio-economic and political realities of our country towards lifting many out of poverty and into prosperity.

During the course of the year, we lost one of our Party stalwarts, Cde Joshua Teke Malinga who was the Secretary for People with Disabilities.To fill the vacancy, I am appointing, Cde Rose Mpofu of Matabeleland South Province as a Politburo Member and the new Secretary for People with Disabilities.Additionally, “Cde Gwenzi”, General, Phillip Valerio Sibanda, as an Ex Officio Member of the Politburo”.

Unsurprisingly, and indeed understandably, the announcement has raised eyebrows and precipitated predictable and even emotive conclusions – based on section 208 of the Constitution of Zimbabwe – that the appointment is unconstitutional. Yet there is in fact nothing from a literal reading or interpretation of section 208 of the Constitution which invites or leads to a conclusion that General Sibanda’s appointment to the ZanuPF politburo is unconstitutional by definition. In any event, I do not share the conclusion that the appointment is unconstitutional. But before proffering my reasons for this position, two preliminary observations are in order.

Firstly, it is important to note that in a constitutional democracy only competent courts of law have the binding say on what is constitutional and what is not, and in Zimbabwe that authority or power or responsibility ultimately lies with the Constitutional Court as the country’s apex court. It’s not healthy in a mass society under the rule of law for pronouncements on what is or is not constitutional to be a free for all jungle affair.

This is important to point out and to underscore because some sections of society; especially but not only opposition politicians, their supporters and their aligned or associated media in the Zimbabwean body politic have become notorious for branding anything or any view or any position they do not politically agree with or like as illegal or unconstitutional by definition with no argument, let alone evidence. Surely, an issue cannot be unconstitutional or illegal simply because the loudest political mouthpieces declare it to be so.

The scourge of branding contrary or unpalatable views or positions or anything that the opposition does not agree with or like as illegal or unconstitutional has gone too far in Zimbabwe to the point of being bizarre. Secondly, and going by the loudest mouthpieces, the opposition spectrum in Zimbabwe today has come to define itself under a propaganda matrix that encompasses five unacceptable extremes, namely that: ·

CCC Chamisa is the only authentic opposition in Zimbabwe;· Anyone who disagrees with or does not like the views or positions of CCC Chamisa as the purported “only authentic opposition in Zimbabwe” is by definition ZanuPF;· ZanuPF is by history and definition irredeemably evil and must on account of that allegation and presumption go by definition;· Anything that goes wrong in CCC Chamisa or is not working well therein is necessarily and only caused by ZanuPF; and,· ZanuPF seeks a one party state in Zimbabwe, particularly but not only in the context of the recent recalls of CCC Chamisa MPs and Councillors who have ceased to be members of the original CCC formally formed and unveiled in January 2022.

There’s a lot to be said and it will be said in some detail and with the requisite nuances on other occasions about each of these five extremes and their impact on public discourse and state politics in Zimbabwe today, suffice to say the branding of anything or any view or any position that does not agree with or fit in the CCC Chamisa propaganda matrix as illegal or unconstitutional is manifestly predictable and useless.

Otherwise, as already intimated above, while the appointment of General Sibanda as an EX Officio member of the Zanu PF politburo may have political and administrative issues to debate or iron out, it nevertheless cannot be said to be unconstitutional or unlawful. Here is why.

Firstly, it is important to have regard of the all-important section 67 of the Constitution which provides as follows: 67 Political rights(1) Every Zimbabwean citizen has the right—(a) to free, fair and regular elections for any elective public office established in terms of this Constitution or any other law; and(b) to make political choices freely.

(2) Subject to this Constitution, every Zimbabwean citizen has the right—(a) to form, to join and to participate in the activities of a political party or organisation of their choice;(b) to campaign freely and peacefully for a political party or cause;(c) to participate in peaceful political activity; and(d) to participate, individually or collectively, in gatherings or groups or in any other manner, in peaceful activities to influence, challenge or support the policies of the Government or any political or whatever cause.

(3) Subject to this Constitution, every Zimbabwean citizen who is of or over eighteen years of age has the right—(a) to vote in all elections and referendums to which this Constitution or any other law applies, and to do so in secret; and(b) to stand for election for public office and, if elected, to hold such office.(4) For the purpose of promoting multi-party democracy, an Act of Parliament must provide for the funding of political parties.

Political rights are the mother of all rights. No other right is meaningful without political rights, not even the right to life because life without political rights is not worth living. In other words, no human being – regardless of their work station in society or office – can live or function without having and enjoying his or her political rights. This is why under section 67(1)(b), every Zimbabwean citizen has the right “to make political choices freely”.

This is an inalienable fundamental human right which is not “subject to the Constitution”, save for the permissible limitations of rights and freedoms under section 86(2). General Sibanda is therefore entitled to make political choices freely under section 67(1)(b), notwithstanding his position as CDF. Against this backdrop, as CDF, General Sibanda’s appointment as an EX Officio member of the Zanu PF is governed by section 208 of the Constitution, which has been specifically cited by those who are claiming that the appointment is unconstitutional.

The section provides these terms: 208 Conduct of members of security services(1) Members of the security services must act in accordance with this Constitution and the law.

(2) Neither the security services nor any of their members may, in the exercise of their functions—(a) act in a partisan manner;(b) further the interests of any political party or cause;(c) prejudice the lawful interests of any political party or cause; or(d) violate the fundamental rights or freedoms of any person.

(3) Members of the security services must not be active members or office-bearers of any political party or organisation.(4) Serving members of the security services must not be employed or engaged in civilian institutions except in periods of public emergency.

It is expressly clear from section 208 of the Constitution that – whether he is an Ex Officio member of the ZanuPF politburo or not – as Commander of the Zimbabwe Defence Forces, General Sibanda may not: · act in a partisan manner;· further the interests of any political party or cause;· prejudice the lawful interests of any political party or cause; or· violate the fundamental rights or freedoms of any person; or· be an active member or office-bearer of any political party or organisation.

But, and this is key to appreciate, understand and to underline: there is nothing in section 208 of the Constitution which provides that “members of the security services may not be members of any political party or organisation”. All that the section provides is that “members of the security services must not be active members or office-bearers of any political party or organisation”.

Membership of or belonging to a political party or organisation is not prohibited by section 208 of the Constitution. What is prohibited is being an active member of a political party or being an office bearer – such as being a political commissar or speaking for a political party, addressing public meetings for the party and so forth.

Being an Ex Officio member of the ZanuPF politburo is not and cannot be tantamount or be equivalent to being “an active member” or being an “office bearer” of ZanuPF. As such, the appointment is arguably not unconstitutional, under section 208 of the Constitution of Zimbabwe.

I say, “arguably”, because I associate myself with the position that only the competent courts of law in the homeland have the authority, power and responsibility to say what is or is not constitutional, with the Constitutional Court of the Republic of Zimbabwe having the final say

Planned Shutdown Of Beitbridge Border Post Flops

A planned shutdown of the Beitbridge border last Thursday was foiled due to a very low turnout, as a South African court canceled the protest organized by some Zimbabweans living in South Africa at the last minute. The South African court cited security concerns as the reason for canceling the demonstration, following leaked information suggesting that Zimbabwean intelligence and security agents had crossed into South Africa to suppress the protests.

The protesters, part of the social movement Progressive Zimbabweans in SA, had initially been granted permission to stage a protest at the border. They intended to voice their concerns about Zimbabwe’s disputed August 23-24 elections, in which the Zimbabwe Electoral Commission declared President Emmerson Mnangagwa as the winner. The protesters were also calling for a fresh election under the supervision of the Southern African Development Community.

In a letter dated October 23, the Head of Court at Musina’s Department of Justice and Constitutional Development, T.J. Davhana, stated that the permission for the peaceful protest march scheduled for October 26 at Beitbridge Border Post was revoked due to safety concerns. The protest was planned to take place from 10 a.m. to 2 p.m. at the Beitbridge Border Post on the South African side.

Q Nyoni, the Chairperson of the social movement, confirmed the cancellation of the protest. He explained that the decision was made to prioritize the safety of the protesters after concerns that they might face violence or abduction during the demonstration. Nyoni mentioned that the cancellation was not due to direct intervention from President Cyril Ramaphosa or President Mnangagwa, but rather a precautionary measure taken by the movement itself upon realizing the potential risks. Intelligence officers from Zimbabwe reportedly arrived at the location, which further contributed to the decision to call off the protest.

Hopewell Chinono Threatens To Start Own Party If Chamisa’s Supporters Criticise Him Again

By A Correspondent | The commentator and activist Hopewell Chin’ono has threatened to start his own political party if CCC leader Nelson Chamisa’s supporters continue their criticism of him.

Chin’ono made these remarks on Monday morning.

He said the opposition should be careful of repeating the same mistake ZANU PF made when it caused the late Morgan Tsvangirai to start his own movement in 1999.

Chin’ono has in the past 3 years transformed his career into that of a political heavyweight by pressing a powerful ‘magic button’ against the entire Nelson Chamisa led civil society, accusing it of inaction on exposing corruption in May 2020. His (Chin’ono’s) social muscle over Chamisa popped out when the Zanu Pf led government slapped him with dismissable, baseless charges of incitement of violence.

The activist, who has failed to disclose the name of the UK bank he claims made him rich through a £50,000 car loan in 1996, and who to date makes Zimbabweans salute him by the hypnotique “Daddy” title, medically proven in various court cases to subdue the will power of sex-grooming victims (minors and elderly), announced in part saying,

“The idea that each time we disagree on a point relating to public affairs, the response is “Form Your Own Party” shows exactly why as a people wanting change we are failing to get it.

“Form Your Own Party is straight out of the ZANUPF playbook, that is what ZANUPF said to Morgan Tsvangirai and he formed it, and we all know what happened.

“It is depressing and backward for the alternative to embrace the same intolerant and authoritarian approach of pushing citizens away from questioning them instead of engaging them and making them see your reasoning on the decisions you make.”

Just yesterday Chin’ono also denounced the country’s main opposition CCC leader, Nelson Chamisa, accusing him of dodging a question on the jailed CCC top official Job Sikhala’s political affiliation.

During a discussion on X, formerly Twitter, a person named George Matipa asked Chamisa if Sikhala is still part of the CCC and if the party is doing everything possible to secure his release. In response, Chamisa said:

Job is a Zimbabwean. He deserves freedom. His case is our cause and collective fight!!

The answer did not convince Chin’ono who argued that Chamisa was being evasive. He said:

The question was not whether Job Sikhala is Zimbabwean or not, it was whether Job Sikhaka is still seen as part of CCC or not. This evasiveness is what makes people think and say that the CCC leadership is not doing enough. The question was a missed opportunity to unite us all by not being evasive but straight up. The response has othered Job Sikhala as just a Zimbabwean and not CCC, it has subcontracted the job to fight to everyone who is Zimbabwean and not CCC which is supposed to be his political home. But I know that there are some who are not yet ready to call a spade a spade.

Sikhala, a former Member of Parliament for Zengeza West, has been incarcerated since 14 June 2022 on allegations of inciting public violence during the funeral wake of slain CCC activist Moreblessing Ali in the Nyatsime area. However, Sikhala vehemently denies these charges and argues that he is a political prisoner, being persecuted for his confrontations with the ruling party, ZANU PF, regarding maladministration and the erosion of the democratic space.

This comes at a time when the outspoken commentator arrived in Washington, D.C., to address a gathering and openly call for the removal of Nelson Chamisa from the leadership of the CCC (Citizens Coalition for Change). The meeting, scheduled for tonight, comes on the heels of Chin’ono’s recent declarations on his platforms, wherein he reiterated controversial statements made to a military officer in January 2023, asserting that the CCC party should split shortly after the 2023 elections due to Chamisa’s perceived incompetence.*

Chin’ono’s strong criticism of Chamisa and the CCC reached a peak just last Sunday when he tweeted, suggesting that the party’s leadership has divided Zimbabweans. His persistent repetition of the phrase “opposition has done nothing” both before and after his dramatic arrest in July 2020, has raised questions about the motives behind his high-profile detainment by ZANU PF.* *Furthermore, the timing of Chin’ono’s latest actions raises questions about the sincerity of his persecution profile, as he had recently been criticized for operating a disinformation campaign by @OpenSecretsZA. Chin’ono is now seemingly backed by Tafadzwa Matinenga, who is actively organizing meetings in the United States to denounce Chamisa. Notably, Matinenga, the daughter of lawyer Eric Matinenga, has not yet commented on the reasons for her involvement in these divisive meetings on US soil.

Man Arrested for Allegedly Raping Grade 7 Pupil

In a disturbing incident, a 50-year-old man from Seke has been apprehended on charges of allegedly raping a 14-year-old Grade 7 student. The incident occurred while the young girl was bathing in an outdoor bathroom.

The alleged perpetrator, identified as Tsaurai Kamundaranga, is reported to have gained access to the bathroom where the 14-year-old girl was bathing. He proceeded to sexually assault her, subjecting her to a traumatic experience.

Assistant Inspector Faith Mapisa, the deputy police spokesperson for the Harare province, confirmed the arrest, stating, “Police have arrested a man from Seke for the alleged rape of a minor.”

During the ordeal, the victim reportedly cried out for help, but regrettably, no one came to her rescue, as her parents were not at home at the time. After the assault, the accused allegedly pressured the young girl to keep the matter a secret. Despite this, the courageous victim confided in her father, which led to the arrest of the suspect.

Evans Chewe Dies

Former CAPS United goalkeeper Evans Chewe has died at the age of 45 years.

Chewe signed for the Green Machine from Zambian side Nchanga Rangers at the end of 2004 and played until 2006, winning the 2005 league title during his time in Harare.

He played at Makepekepe with other imports such as Hadji Tambala, Ian Bakala, Laughter Chilembe and Joseph Kamwendo.

CAPS United paid their tribute in a statement posted on their socials, saying:

Job Sikhala is a political prisoner who is being targeted and persecuted solely for his political beliefs.

Man Rapes 6 Year Old

The harrowing case of a 26-year-old Magunje man was recently arrested for allegedly raping and murdering a six-year-old girl from the same area.

The body was later found in the bush.

It is alleged that Shingai Makura kidnapped the little girl, took her to a bushy area, raped her and then killed her by battering her with a stone.

The Zimbabwe Republic Police have the details on their X-handle page. The body was later found hidden between two huge rocks, with investigations leading to the arrest of Makura.

Meanwhile, police in the same area also arrested a 29-year-old man at a roadblock for stealing 11 goats.

Mashonaland West police spokesperson Inspector Ian Kohwera said Oliver Chizanga from Chief Nyamhunga, Magunje was arrested for stock theft when police officers manning a roadblock on Magunje road searched a Nissan Caravan and found 10 goat heads and two 50kg sacks of goat meat and offals belonging to Chizanga.

“Chizanga was arrested and a further search at his homestead led to recovery of 11 carcasses of goats hidden in his tobacco barn,” he said. A total of 20 goats had been reported stolen from grazing lands in October alone this year in the same village.

Lawyer Caught In Robbery Case

Prominent Lawyer and Accomplices Face Robbery Allegations.

Dotito, Zimbabwe – In a stunning turn of events, renowned Bindura lawyer Elatone Bonongwe, and several alleged accomplices are facing a harrowing robbery case that has sent shockwaves through the town. This incident unfolded on October 25 this year, as the nation was attending an anti-sanctions gala in Dotito.

According to the allegations, Elatone Bonongwe (54), a prominent figure in the legal community, allegedly orchestrated a brazen robbery by hiring a gang of eight individuals to target Engineer Emson Chitsungo of Pfura Rural District Council. The gang reportedly assaulted and robbed Engineer Chitsungo of a staggering US$30,000 in cash and valuable items.

The prosecution claims that Bonongwe instructed his own uncle, Musa Gandi (42), whom he had previously represented in another robbery case, to assemble a team of robbers for this criminal operation. Alongside Bonongwe and his uncle, the accused in this case include Agness Kunaka (41) of Chiweshe, Raby Gwenya (39) of Nyazvidzi, and Gutu, and Tafadzwa Obrey Chipashe (35) of Chiweshe. It’s worth noting that four additional suspects connected to the case are still at large.

The accused individuals, including the lawyer and his uncle, appeared before Bindura magistrate Mrs. Chimangu, facing charges related to robbery, and have been remanded in custody until November 13. The prosecutor, Mr. Garudzo Ziyadhuma, informed the court that only the High Court has the authority to grant bail in robbery cases.

The court proceedings revealed that on October 5, Bonongwe allegedly devised a plan to rob Engineer Chitsungo, enlisting the services of the gang his uncle had organized. The gang, armed with an AK47 bayonet and two sharp iron bars, traveled to Mt Darwin in a Sienta Redan vehicle, where they met with Bonongwe. He then directed them to Engineer Chitsungo’s residence before leaving.

Once at the residence, the gang scaled a precast wall and confronted Engineer Chitsungo. During the ordeal, they allegedly assaulted him, burning him with a hot iron, and demanding cash and valuables. They ransacked the house, making off with clothes, electrical appliances, and a significant sum of US$1,600.

However, their criminal escapade took a dramatic turn when they were stopped at a roadblock near Mazowe while en route to Harare. The police demanded to search the vehicle, prompting the gang to flee. In response, the police fired four shots, leading to the apprehension of the four suspects who have appeared in court. Regrettably, the other four members of the gang managed to evade capture.

A subsequent search by the police resulted in the recovery of some of the stolen property and the weapons used during the robbery. Moreover, during interviews, the fourth accused implicated Bonongwe and provided evidence, including WhatsApp chats and text messages, illustrating Bonongwe’s involvement in planning the robbery with his uncle Gandi.

In total, stolen property worth a staggering US$30,049 was reported, with US$21,000 worth of property recovered by law enforcement. This alarming incident has left the nation in disbelief and serves as a stark reminder of the need for justice and accountability.
