Man Rapes 6 Year Old

The harrowing case of a 26-year-old Magunje man was recently arrested for allegedly raping and murdering a six-year-old girl from the same area.

The body was later found in the bush.

It is alleged that Shingai Makura kidnapped the little girl, took her to a bushy area, raped her and then killed her by battering her with a stone.

The Zimbabwe Republic Police have the details on their X-handle page. The body was later found hidden between two huge rocks, with investigations leading to the arrest of Makura.

Meanwhile, police in the same area also arrested a 29-year-old man at a roadblock for stealing 11 goats.

Mashonaland West police spokesperson Inspector Ian Kohwera said Oliver Chizanga from Chief Nyamhunga, Magunje was arrested for stock theft when police officers manning a roadblock on Magunje road searched a Nissan Caravan and found 10 goat heads and two 50kg sacks of goat meat and offals belonging to Chizanga.

“Chizanga was arrested and a further search at his homestead led to recovery of 11 carcasses of goats hidden in his tobacco barn,” he said. A total of 20 goats had been reported stolen from grazing lands in October alone this year in the same village.

Lawyer Caught In Robbery Case

Prominent Lawyer and Accomplices Face Robbery Allegations.

Dotito, Zimbabwe – In a stunning turn of events, renowned Bindura lawyer Elatone Bonongwe, and several alleged accomplices are facing a harrowing robbery case that has sent shockwaves through the town. This incident unfolded on October 25 this year, as the nation was attending an anti-sanctions gala in Dotito.

According to the allegations, Elatone Bonongwe (54), a prominent figure in the legal community, allegedly orchestrated a brazen robbery by hiring a gang of eight individuals to target Engineer Emson Chitsungo of Pfura Rural District Council. The gang reportedly assaulted and robbed Engineer Chitsungo of a staggering US$30,000 in cash and valuable items.

The prosecution claims that Bonongwe instructed his own uncle, Musa Gandi (42), whom he had previously represented in another robbery case, to assemble a team of robbers for this criminal operation. Alongside Bonongwe and his uncle, the accused in this case include Agness Kunaka (41) of Chiweshe, Raby Gwenya (39) of Nyazvidzi, and Gutu, and Tafadzwa Obrey Chipashe (35) of Chiweshe. It’s worth noting that four additional suspects connected to the case are still at large.

The accused individuals, including the lawyer and his uncle, appeared before Bindura magistrate Mrs. Chimangu, facing charges related to robbery, and have been remanded in custody until November 13. The prosecutor, Mr. Garudzo Ziyadhuma, informed the court that only the High Court has the authority to grant bail in robbery cases.

The court proceedings revealed that on October 5, Bonongwe allegedly devised a plan to rob Engineer Chitsungo, enlisting the services of the gang his uncle had organized. The gang, armed with an AK47 bayonet and two sharp iron bars, traveled to Mt Darwin in a Sienta Redan vehicle, where they met with Bonongwe. He then directed them to Engineer Chitsungo’s residence before leaving.

Once at the residence, the gang scaled a precast wall and confronted Engineer Chitsungo. During the ordeal, they allegedly assaulted him, burning him with a hot iron, and demanding cash and valuables. They ransacked the house, making off with clothes, electrical appliances, and a significant sum of US$1,600.

However, their criminal escapade took a dramatic turn when they were stopped at a roadblock near Mazowe while en route to Harare. The police demanded to search the vehicle, prompting the gang to flee. In response, the police fired four shots, leading to the apprehension of the four suspects who have appeared in court. Regrettably, the other four members of the gang managed to evade capture.

A subsequent search by the police resulted in the recovery of some of the stolen property and the weapons used during the robbery. Moreover, during interviews, the fourth accused implicated Bonongwe and provided evidence, including WhatsApp chats and text messages, illustrating Bonongwe’s involvement in planning the robbery with his uncle Gandi.

In total, stolen property worth a staggering US$30,049 was reported, with US$21,000 worth of property recovered by law enforcement. This alarming incident has left the nation in disbelief and serves as a stark reminder of the need for justice and accountability.

Polio Outbreak Declared in Harare, Zimbabwe

Harare, Zimbabwe – The Ministry of Health and Child Care has issued a distressing declaration of a polio outbreak in three Harare neighborhoods, specifically Budiriro, Mbare, and Mufakose. This alarming development comes merely one month after a nationwide Polio Oral Vaccination campaign aimed at safeguarding 2.8 million children under the age of five.

In a compelling statement, Dr. Douglas Mombeshora, the Minister of Health and Child Care, underscored the critical need to swiftly activate the Incident Management System to confront this urgent situation. Dr. Mombeshora officially classified the outbreak as a circulating vaccine-derived poliovirus type 2 (cVDPV2) within the aforementioned suburban areas, highlighting the utmost significance of a unified and comprehensive response to contain the outbreak and avert its further propagation.

Mr Mnangagwa’s insatiable appetite to establish a military state has manifested through his unconstitutional appointment of the current Zimbabwe Commander of Defence Forces, General Valerio Sibanda to ZANUPF’s politburo as an ex-officio member. This is an attempt to create a one-party state through the capture of government institutions by the desperate and unpopular regime. It is now imperative for Zimbabweans to mobilize and radicalize to confront these despots.

Citizens should amplify their revolutionary voices castigating these dictatorial tendencies. ZANU-PF’s efforts to capture the army, judiciary, police, and all other state functionaries should be resisted with equal measure. The recent appointment made it bare that the army takes instructions from the Shake-Shake building which is against the ethos of the rule of law and constitutionalism. People should unite and demand respect for the supreme law of the land.

Mr Mnangagwa and his politically empty party violated section 208(3) of the 2013 Constitution which stipulates that members of the security sector must not be active members or office-bearers of any political organization or party such as ZANU-PF. This unpopular party is obliged to respect the citizenry by religiously adhering to the provisions of the Constitution. This appointment reflects the nature of authoritarianism Zimbabweans are faced with. That is why CCC Namibia submitted that citizens should not subcontract the struggle for democracy to President Advocate Nelson Chamisa.

It is clear for everyone to see that General Valerio Sibanda has been indirectly compelled to resign allowing Mr. Mnangagwa to appoint his son to the post of the Army Commander of the Defence Forces. It is rumored that General Sibanda might be appointed Vice President in the ZAPU slate replacing the ailing Mohadi. Appointing him a ZANU-PF politburo member when he is still serving in the army tears the sacred Constitution apart. We demand the country’s return to constitutionalism! Zimbabwe deserves leaders with democratic tenets, ZANU-PF must respect citizens.

Section 208 is very unequivocal on the conduct of security services;1) Members of the security services must act in accordance with the Constitution and the law. 2) Neither the security services nor any of their members may, in the exercise of their functions–a) act in a partisan manner; b) prejudice the law interests of any political party or cause;c) violate the fundamental rights or freedoms of any person. 3) Members of the security services must not be active members or office-bearers of any political organization or party.

The land between the Zambezi and Limpopo needs active citizens well-backed by the region and continent to force ZANU-PF to adhere to the Constitution. It is a joke for Zimbabweans to think that CCC alone can shake the corridors of ill-gotten power. Let’s all unite against the tearing apart of the supreme law of the motherland. All citizens across the political divide who are victims of abject poverty should rise and fight these belly politicians of plunder and self-enrichment.

ZANU-PF is now an unpopular party that has successfully captured all state institutions for political expediency. CCC as the leading and only genuine alternative deserves the support of all progressive citizens in the country and abroad during this time. Elections are rigged day and night, when citizens peacefully protest the fraud, the captured army shoots live ammunition on unarmed civilians as in the case of 1 August 2018. SADC, the African Union, and the United Nations should aid us in defeating totalitarianism in Zimbabwe.

They have armed soldiers, police, biased courts, and prison officers. The parliament is also compromised, what shall we do as a people? Help us to help ourselves as we demand fresh elections after the shambolic plebiscite. Zimbabwe deserves better livelihoods!

Hopewell Chin’ono Denounces Chamisa

By- Journalist-cum political activist Hopewell Chin’ono has denounced the country’s main opposition CCC leader, Nelson Chamisa, accusing him of dodging a question on the jailed CCC top official Job Sikhala’s political affiliation.

During a discussion on X, formerly Twitter, a person named George Matipa asked Chamisa if Sikhala is still part of the CCC and if the party is doing everything possible to secure his release. In response, Chamisa said:

Job is a Zimbabwean. He deserves freedom. His case is our cause and collective fight!!

The answer did not convince Chin’ono who argued that Chamisa was being evasive. He said: 

The question was not whether Job Sikhala is Zimbabwean or not, it was whether Job Sikhaka is still seen as part of CCC or not. This evasiveness is what makes people think and say that the CCC leadership is not doing enough. The question was a missed opportunity to unite us all by not being evasive but straight up. The response has othered Job Sikhala as just a Zimbabwean and not CCC, it has subcontracted the job to fight to everyone who is Zimbabwean and not CCC which is supposed to be his political home. But I know that there are some who are not yet ready to call a spade a spade.

Sikhala, a former Member of Parliament for Zengeza West, has been incarcerated since 14 June 2022 on allegations of inciting public violence during the funeral wake of slain CCC activist Moreblessing Ali in the Nyatsime area. However, Sikhala vehemently denies these charges and argues that he is a political prisoner, being persecuted for his confrontations with the ruling party, ZANU PF, regarding maladministration and the erosion of the democratic space.

This comes at a time when the outspoken commentator arrived in Washington, D.C., to address a gathering and openly call for the removal of Nelson Chamisa from the leadership of the CCC (Citizens Coalition for Change). The meeting, scheduled for tonight, comes on the heels of Chin’ono’s recent declarations on his platforms, wherein he reiterated controversial statements made to a military officer in January 2023, asserting that the CCC party should split shortly after the 2023 elections due to Chamisa’s perceived incompetence.* *Chin’ono’s strong criticism of Chamisa and the CCC reached a peak just last Sunday when he tweeted, suggesting that the party’s leadership has divided Zimbabweans. Dynamos are through to the final of the 2023 Chibuku Super Cup after beating city rivals CAPS United 2-0 in a semifinal clash played at the National Sports Stadium on Sunday.

The Glamour Boys will face Ngezi Platinum in the final set for the Baobab Stadium in Ngezi on 3 December.

The first half started with both teams taking turns to control possession, but it was the Green Machine who were more attacking.

Former Caps United Goalkeeper Dies

Former CAPS United goalkeeper Evans Chewe has died at the age of 45 years.

Chewe signed for the Green Machine from Zambian side Nchanga Rangers at the end of 2004 and played until 2006, winning the 2005 league title during his time in Harare.

He played at Makepekepe with other imports such as Hadji Tambala, Ian Bakala, Laughter Chilembe and Joseph Kamwendo.

Mwonzora Says Appointment Of Valerio Sibanda As Politburo Member Unacceptable

MDC leader Douglas Mwonzora has castigated President Emmerson Mnangagwa over his recent appointment of General Valerio Sibanda as an ex-officio of the ruling Zanu PF saying such violation of the country’s constitution was unacceptable.

Posting on Twitter now X, Mwonzora said Sibanda’s appointment marks a serious desecration of the constitution.

He said it signals serious and unacceptable conflation of the state, army and party.

“The appointment of the Commander of the Zimbabwe Defence Forces General Sibanda into the Politiburo of Zanu PF is totally wrong. It marks a serious desecration of our constitution. It signals a serious and unacceptable conflation of the State, Army, and Party,” said Mwonzora.

Over the weekend, Mnangagwa announced that Sibanda had been appointed into the Zanu PF politburo as an ex-officio member in breach of the country’s constitution which says a serving military person cannot be a member of any political party.

Zanu PF “shakes off” own independent candidates

A total of 18 former Zanu-PF members forfeited their membership in the party due to their decision to run as independent candidates in the National Assembly and local authority elections during the recently concluded August 2023 harmonized elections.

This information is outlined in the Central Committee report presented by President Mnangagwa at the 20th Zanu-PF National People’s Conference, which was subsequently adopted.

The National Chairman’s report, overseen by Oppah Muchinguri-Kashiri, who also chairs the ruling party’s National Disciplinary Committee, disclosed that the party invoked its constitutional legal provisions against individuals who defied party regulations.

The report stated, “During the 2023 harmonized general elections, some members contested as independent candidates in the National Assembly and local authority categories. As a result, the National Disciplinary Committee observed that these members had automatically expelled themselves from the party in accordance with Article 3, Section 17 (2), as well as Article 550 (11) of the Party Constitution.”

Furthermore, the report mentioned that these charged members, who stood as independent candidates, failed to attend the conflict management meeting presided over by the National Chairman prior to the nomination day. The purpose of the meeting was to reconcile dissatisfied members and discourage them from running as independent candidates. Consequently, the report recommended imposing an appropriate deterrent penalty for this open defiance of Zanu-PF’s constitution, rules, regulations, values, and ethos, sending a clear message to potential offenders considering independent candidacy.

Among those who ceased to be Zanu-PF members after running as independent candidates in the National Assembly are individuals such as Mr. Thomas Munjoma (Mutare West), Zivanai Peter Musanhu (Mt Darwin West), Eunice Mangwende (Murewa North), George Vhengere (Gutu East), Tafadzwa Shumba (Mwenezi West), Jeremiah Ndlukuwani (Gokwe Chireya), and Ms. Siphathisiwe Mathema (Nkayi North).

The party’s legal department also reported that it was tasked with editing the party’s constitution, as presented and adopted during the 7th National People’s Congress held in October 2022. New provisions included the establishment of diaspora structures, council of elders, Standing Committee of the Central Committee, and the codification of the party’s code of conduct and detailed disciplinary procedures.

In another report, the Education, Ideology, and Research department expressed concerns about certain teachers’ unions aligning themselves with a regime change agenda. The department noted that some teachers’ unions and civil society organizations were involved in promoting a Western-funded regime change agenda in the country, facilitated by hostile foreign embassies.

Illicit funding of these teachers’ unions created a financial disparity between their leaders and the people they represented, as they had not been negotiating in good faith with the government and were primarily focused on destabilizing the education sector. As a response, the department initiated ideological training for teachers to counter this trend.

Byo robbers nabbed

In Bulawayo, the police have apprehended two suspected armed robbers believed to be responsible for a series of crimes, including robbing a Mukuru outlet, two Simbisa retail outlets, and multiple residences in the city. These criminal activities occurred between March and September.

National police spokesperson Assistant Commissioner Paul Nyathi confirmed the arrest of the two suspects, identifying them as Lenny Ryan Mupande (21) from Gweru and Bezel Chirova (21) from Njube suburb in Bulawayo. A third suspect, Ishmael Chipanga, is still at large, and a manhunt has been launched to locate him.

According to Asst Comm Nyathi, the arrests are connected to an attempted robbery at a Chicken Inn Drive-through in Bulawayo on March 19. The suspects tried to access the safe but abandoned the attempt when a vehicle arrived on the scene. Subsequently, they targeted an unidentified Chicken Inn outlet in the city center on April 29, stealing US$6,604. In June, they raided Athens Supermarket in Hillside suburb, during which a neighborhood surveillance team pursued them after the break-in. The suspects were driving a Honda Fit, and the driver lost control during a high-speed chase, causing the vehicle to end up in a ditch. They then fled on foot.

After remaining inactive for two months, the suspects targeted a family in their Entumbane suburb residence in September, making off with US$1,850. In the same month, they robbed a Mukuru outlet in Entumbane, taking R13,390. Additionally, they conducted multiple robberies in shopping centers in Pumula, stealing various sums from individuals. Victims lost amounts such as US$5, US$12, and US$447, while the suspects also robbed a shop in Khumalo suburb of US$990.

The two suspects were apprehended by the police last week, and the authorities are urging citizens to provide information that could lead to the arrest of the third suspect. They also advise individuals and companies not to carry large sums of money on their person.

Heavy Rainfall Expected This Week

Zimbabwe is expected to receive localized heavy rainfall, with precipitation of around 30mm, accompanied by strong winds and thunderstorms until the end of this week.

The Meteorological Services Department, in a statement, has encouraged the public to take precautionary measures to protect both plants and livestock from potential damage caused by thunderstorms. They also advise the public to remain indoors during thunderstorms and avoid using electrical appliances, as they are susceptible to lightning strikes.

The department explained that a cloud band originating from the Atlantic Ocean is gradually moving toward the country via Botswana. It started affecting the western borders of the country on Saturday evening and is expected to traverse the nation from yesterday through the end of this week, leading to the occurrence of scattered thunderstorms across the country.

In addition to these precautions, the public is advised to address any roof leakages, and, if possible, install surge protectors and lightning conductors.

Agricultural experts have also suggested that farmers should begin planting their crops if they receive at least 20 to 30mm of rainfall. Many farmers have already completed their land preparations and are eagerly awaiting the onset of rains to commence planting.

Manhunt for Mt Pleasant robbers

Nine armed robbers attacked a company in Mt Pleasant, Harare on Friday, and stole around US$32,000 in cash. The Zimbabwe Republic Police (ZRP) reported that the robbers had weapons like pistols, machetes, a bolt cutter, and a grinder.

In a statement, the police said if anyone has information about the incident, they should report it to the nearest police station. Read the report:

Police in Marlborough are investigating a case of robbery which occurred at a company in Mt Pleasant, Harare on 27/10/23 in which nine unidentified male suspects who were armed with pistols, machetes, bolt cutter and a grinder attacked three security guards who were on duty and tied them with shoelaces before breaking into the accounts office were they stole US$30 000 from the safe. The suspects went on to break into yet another office where they stole US$1 900 cash and went away. 

This robbery comes a few days after three armed robbers allegedly teargassed their victims in Kadoma before snatching US$10 500 cash and cell phones on Tuesday. Police said the suspects pounced at a house in Mashuma at around 7.30 PM and threw tear smoke in the house to unsettle victims. As the victims gasped for breath with tears running down their cheeks, the robbers ransacked the house and got away with cash, phones and jewellery.

Armed robbery cases have been on the increase countrywide with criminals targeting families and business premises during the night. Some of the suspects involved in such cases were arrested while others are still at large. Police have also been urging the public to avoid keeping large amounts of cash in their homes and business premises as they were likely to fall prey to criminals. 

More and more people are keeping their money at home instead of in banks. This is colloquially called “Mattress Banking.” Economists argue that members of the public lost trust in the traditional banking system because some lost their savings when the government changed from the US dollar to the Zimbabwe dollar in 2019. The government said the Zimbabwe dollar was equal to the US dollar, but its value dropped, causing people to lose a lot of money. Nevertheless, keeping money at home has made it easier for robbers to steal cash from individuals and businesses.

By Job Sikhala| Today, dear friends, I am celebrating my 51st birthday, this marks my second birthday anniversary under incarceration by the regime in Zimbabwe in Chikurubi Maximum Security Prison. I think you all heard that I was not feeling well. For seven (7) consecutive days, I was passing blood. In the process I have lost 3kgs, but I am recuperating well.

My doctors are doing a good job. Second year running, celebrating a birthday in prison under political persecution should remind all of you about our forebearers, Joshua Nkomo, Robert Mugabe, Nelson Mandela, Walter Sisulu, Patrice Lumumba, Sydney Malunga and many others, who celebrated theirs in similar fashion, equally, as victims of political repressions.

This year, I have advised my family not to attempt to bring a birthday cake present, as an attempt to do so last year, created astonishing accusations that the cake was a threat to national security. A note was written to me that, the cake was not allowed as it was a national security threat. I was not surprised because such paranoia is inherent in systems built in fear of the unknown, voodooism and witchcraft.

When you see your persecutors getting frightened by a mere birthday cake and growing goose pimples of hate over a birthday cake, you must be consciously informed that you have passed the threshold of rightness with distinctions. So dear friends, I am celebrating in memory of all of you. I might be in prison, but you might be free but in a prison of your own. Our suffering is the same. Malcom X informs us that, “it is only after extreme grief that the greatest joy can come”.

In the scheme of my enemies as recently confirmed by their own unstable fortune seeker Eddie Cross, there is no any other way, I must hang. I must be flashed out and destroyed. I am the spoiler of their comfort. An irritant causing people sleepless nights, disturbing the comfort of their power. Zimbabweans and the world at large have seen for what it is.

Persecution by prosecution, a tired old strategy by unpopular tyrannies. I have to be stopped damn the consequences. My mouth had become dangerous, more than a loaded gun, they say it is vicious and dangerous, it spits venom and causes havoc – I had to be silenced even if it means assassinating me.

My name became an Agenda item number one in the boardrooms of all agencies of the state. In the security sector, in the judiciary, in their politburo, its Job Sikhala everywhere. The amount of financial, human resources and logistical deployment to fight against me is estimated to have consumed nearly 10% of the national GDP, the resource that should have been deployed elsewhere to ameliorate the poverty and suffering of the masses of our people.

Even foreign aid intended for poverty alleviation programs was diverted to fight me. For one year four months in more than 100 days of my court appearances, you witnessed it by yourselves, the massive deployed of police trucks loaded with police officers in riot gear membership no less than 500 at every turn. Harare Magistrates Court because the haven of the Central Intelligence Organisation (CIO) hovering every space of the court premises never witnessed in the history of this country.

My name became a swear word, some puked at the sound of it and others cursed it. They declared almost an oath that they shall fight Job Sikhala, left, right and centre. Unbeknown to my persecutors, is that the day I chose the route to stand with the people, was the day I signed a lifetime testamentary, never to distance myself from the guilty realities of everyday struggles- the arrests, physical violence and the small and large humiliations associated with the odious journey to freedom. My 2nd birthday celebrations in prison, has informed me that prison is not a dungeon of shame but the haven of freedom and human dignity.

The home that underpins the conscience of the masses. From the oil dripping lips of Eddie Cross from the patronage loot, he postulates that telling the world the truth about what unpins my persecutions. We knew it before you laid it bare Eddie Cross. We have a solid network of informants and we are informed in full of every detail pertaining to instructions given to those tasked with my persecution.

It is not only Virginia Mabhiza, as you try to portray Eddie Cross. Her former boss at the Ministry of Justice was threatening bloodbath to anyone who would not carry out his instructions. I knew after receiving information that, everything was set so, dear Zimbabweans and my worldwide friends, never expect me to get any fair trial. Everything has been set.

This should inform all of you, who flood to my court hearings in solidarity, about the emotional charged prosecution of my cases. But let it be known dear friends. I long realized the Mandela moment correctly captured by what Martin Luther King Jnr said in his “Letter from Birmingham Jail” that, “let everyone and the world know, the hour to continuously plead my innocence before my oppressors is over. They hold a blank cheque to do whatever they want with me”.

The appalling silence of good people and good world leaders on the face of the most vicious attack on an innocent person calls upon serious reflection on the national and international discourse on Zimbabwe. Silence against repression is acquiescence and endorsement of the same.

While we celebrate together the celebrations of my 51st birthday, dear friends, I would like to thank hundreds of good people who have come onboard to help my family. Fees for my 4 children who are University attendees has been paid. Thank you very much and may God bless you all.

Mzembi Drops Bombshell On Zanu PF Succession

Walter Mzembi, the former Tourism Minister of Zimbabwe, has claimed that ZANU PF members were in agreement about the need to remove Zimbabwean former President
Robert Mugabe, but differed on the timing of his removal based on their individual and factional interests. 

According to Mzembi, party members were divided on the timing of Mugabe’s removal, as different factions and individuals sought to benefit from the situation.

Mzembi made these comments on social media, emphasizing that there were behind-the-scenes developments within ZANU PF that the public was not aware of. Responding to a ZANU PF member on X, Mzembi said:

Munoti ndimi makatanga nekuda kubvisa (You think you were the first to plot to remove Robert) Mugabe here, there was far much more happening inside than from outside, but interestingly it was a battle of timing and the conspirators. The team in office now was protecting him, they wanted to remove him themselves when it would benefit them only.

Political analysts have long argued that Zimbabwe’s founding leader, Robert Mugabe, intentionally fostered factionalism within his party, ZANU PF, by delaying the announcement of a successor. By doing so, he created a power struggle among party members who believed that aligning themselves with him would increase their chances of assuming power upon his retirement.

One notable manifestation of factionalism was the Tsholotsho Declaration in 2004. This secret meeting was allegedly organised by a faction loyal to Emmerson Mnangagwa, with the objective of elevating him to the vice presidency ahead of Simon Muzenda. Although Mnangagwa had the support of six out of ten provinces, Mugabe amended the party’s constitution to ensure that one of the vice presidents had to be a woman. This move resulted in Mujuru being appointed as vice president instead.

A 26-year-old man from Magunje in Mashonaland West Province has been arrested for the alleged rape and murder of a 6-year-old girl. According to a police report seen by Pindula News, the victim was discovered naked in a bushy location. The report does not mention how the authorities connected the suspect to this terrible crime. On 28/10/23 Police in Magunje arrested Shingai Makura (26) in connection with a case of murder in which a minor (6) was found lying naked between two big rocks in a bushy area in Mavhondo Village, Chief Dandawa, Magunje. The suspect allegedly raped the victim before he hit her with a stone on the head in a bid to conceal the rape case.

The rape and murder of a 6-year-old girl has sparked outrage and concern about the decay of society. Some people are urging authorities not to abolish the death penalty as punishment for such heinous crimes.

According to the Zimbabwe Gender Commission (ZGC), the country is facing alarming rates of sexual violence, with at least 22 women being raped daily and one in three girls experiencing rape or sexual assault before the age of 18. Many cases go unreported due to religious and cultural factors, as perpetrators are often protected within family units. The issue of child marriages has also revealed that victims are often subjected to rape by their own close family members.

Security guard accidentally shoots, kills colleague

A security guard accidentally shot and killed his colleague during a shift change at the Food Lovers Market in Greendale, Harare, Zimbabwe. The incident, believed to be a tragic accident, occurred when Privilege Chivanganye, 28, was handing over his firearm, a Taurus revolver, to Jaison Dhlamini.

Chivanganye informed Dhlamini about a problem with the gun and gave it to him along with six rounds of ammunition. As Dhlamini tried to load the gun, both men realized there was an issue and attempted to fix it. Unfortunately, Chivanganye accidentally squeezed the trigger, shooting Dhlamini in the stomach. Dhlamini was rushed to the hospital but later succumbed to his injuries.

Chivanganye has been charged with culpable homicide and appeared in court, where he was granted bail. His lawyer indicated that Chivanganye intends to plead guilty, claiming that he was unaware that Dhlamini had turned off the gun’s safety pin. The case will continue on November 17.

Culpable homicide refers to the criminal offence of causing the death of another person through negligence or recklessness. It is a form of unlawful killing that does not involve premeditation or intent to cause harm. The term “culpable” implies that the person responsible for the death can be held accountable due to their actions or omissions. In Zimbabwe, the likely sentence for someone found guilty of culpable homicide will depend on several factors. The court will consider the circumstances surrounding the offence, the degree of negligence or recklessness involved, and the harm caused to the victim.

The maximum penalty for culpable homicide in Zimbabwe is imprisonment for up to 20 years. However, the court has discretion in determining the appropriate sentence based on the specific details of the case. Factors that may influence the sentencing include the level of remorse demonstrated by the accused, their previous conduct, and their cooperation with the investigation.

Mitigating factors, such as showing genuine remorse and taking responsibility for the actions, may lead to a more lenient sentence. On the other hand, aggravating factors, such as a high degree of negligence or reckless behaviour, could result in more severe punishment.

VOA Journalists Denied Access To Cover Zanu PF Conference 

By A Correspondent| Annahstacia Ndlovu and Kudzanai Musengi journalists with the Voice of America Studio 7 were on 26 October 2023 reportedly denied access to cover the ruling Zanu PF’s annual conference which kicked off in the Midlands capital of Gweru on 27 October 2023.

According to Ndlovu, she only discovered that they were not on the list of journalists accredited to cover the conference after travelling from Bulawayo to Gweru in preparation to cover the event.

She said prior to this development they had submitted their application letters to cover the conference. Ndlovu said they duly received confirmation that their letters had been received, only to be advised that their names were not on the list of accredited journalists upon arrival in Gweru.

MISA Zimbabwe reiterates its call for all responsible authorities, to always promote equality and non-discrimination as espoused in the Constitution of Zimbabwe.

Between April and Sept 2023, two senior Zambian politicians, Harry Kalaba (presidential contestant) and SADC election observer mission head, Nevers Mumba, have recorded videos on behalf of and protecting the election-rigging #GoldMafia and continued to claim that Mnangagwa, and his partners are smuggling gold in order to bust western sanctions, at a time when the Reserve Bank of Zimbabwe announces that there are no sanctions at all and the rigging-operations are purely for the purpose of keeping the electorate of various African countries poor.

The two helped cover up for an announced (Uebert Angel video) USD240million war chest that Mnangagwa amassed to rig the 2023 elections.

Harry Kalaba and Mumba abused the Zambia govt’s coat of arms and the Zambian flag insignia to doctor video-documents making these claims, and Kalaba was exposed on election day, 23 Aug, after unwittingly talking with Simba Chikanza for over a month while confirming to that he was given a script to read paid for by Uebert Angel and notoriously assembled by @KMutisi…

Kalaba was engaged by @schikanza through a promise to hand him a 22-carat-golden iPhone15 as a reward to thank him for the Mafia job, and he gladly received the first fake iphone on 5 August 2023, via undercover agents and the second was to be physically handed on 23 August in Lusaka, when Kalaba met Chikanza face to face in a Levy Mall shop, an incident  that was beamed live to over 500,000 viewers. He was asked to explain himself and if he will now apologise to the Zambian government and to the Zim voters, whose USD24million election war-chest, he helped obfuscate in the day it was being used to rig elections and commit human rights abuses. Kalaba then went on TV to claim that he can’t be rigging elections when “my senior brother” who is in Zimbabwe monitoring elections, also recorded a video in support of the Mnangagwa.

@SADC_News’s Nevers Mumba was also engaged, but refused to fix his statements which endanger the Zimbabwean people for centuries to come as his allegations classify complaining citizens as sanctions-criminals working for the benefit of the warring west. He also said that he can’t be rigging elections when Emmerson Mnangagwa is after him. He then went on to support Harry Kalaba in a Facebook side-post.

Mumba’s and Kalaba’s “sanctions” claims which are really hate-speech used by ZANU PF members to incite violence and kill people who include former Zambian president Levy Mwanawasa, now serve to assist gold looters to continue their operations.

In the latest investigation, it is revealed that Mumba and Kalaba were phoned by Uebert Angel and told to record the videos, whose script writer was Kudzai Mutisi. Initial evidence which ZimEye followed up on are phone conversation records and bank transactions between Mutisi and Uebert Angel, between March and July 2023.

In a significant development, at least 18 former ZANU PF cadres have lost their membership to the revolutionary party. This decision came after they chose to stand as independent candidates in the National Assembly and local authority elections during the recently concluded August 2023 harmonized elections. The move has sent shockwaves throughout the political landscape of Zimbabwe.

The details of this expulsion were revealed in the Central Committee report, which was presented by President Mnangagwa just before the 20th ZANU PF National People’s Conference and subsequently adopted by the party.

The party’s National Chairman report, under the leadership of Cde Oppah Muchinguri-Kashiri, who also serves as the chairperson of the ruling party’s National Disciplinary Committee, explained that the party had to invoke its constitution’s legal statutes to deal with members who openly disregarded its regulations.

According to the report, “During the 2023 harmonized general elections, some members contested as independent candidates in the national assembly and local authority categories. By doing so, the National Disciplinary Committee noted that the members had automatically expelled themselves from the party as stipulated in Article 3, Section 17 (2) as well as Article 550 (11) of the Party Constitution.”

The report further stated that the expelled members had failed to attend a conflict management meeting addressed by the National Chairman before nomination day. This meeting was designed to reconcile aggrieved members and dissuade them from running as independent candidates. The open defiance of the party’s constitution, rules, regulations, values, and ethos was deemed a serious breach, and the party felt it necessary to impose an appropriate deterrent sanction.

This action is expected to send a strong message to any potential offenders who may consider running as independent candidates in the future, urging them to reconsider their intentions.

Some of the prominent figures who have been expelled from ZANU PF after standing as National Assembly independent candidates include Mr. Thomas Munjoma (Mutare West), Zivanai Peter Musanhu (Mt Darwin West), Eunice Mangwende (Murewa North), George Vhengere (Gutu East), Tafadzwa Shumba (Mwenezi West), Jeremiah Ndlukuwani (Gokwe Chireya), and Ms. Siphathisiwe Mathema (Nkayi North).

In addition to this major development, ZANU PF’s legal department reported that it was tasked with editorially cleaning up the party’s constitution, which was presented and adopted at the 7th National People’s Congress in October 2022. The new provisions included the establishment of diaspora structures, a council of elders, the Standing Committee of the Central Committee, and the codification of the party’s code of conduct and detailed disciplinary procedures.

Furthermore, the Education, Ideology, and Research department expressed concern over how some teachers’ unions have been involved in promoting a regime change agenda, purportedly funded by Western entities hostile to the country. They highlighted the financial divide that this illicit funding has created between union leaders and the teachers they represent, as negotiations with the government have not been conducted in good faith. In response to this, the department initiated ideological training for teachers to counter this trend.

The expulsion of 18 members and the party’s commitment to strengthening its constitution and addressing external influences highlight the internal dynamics and external pressures shaping Zimbabwe’s political landscape in the wake of the 2023 elections. During the war, Josiah Tongogara held the rank of a general and was part of the Dare of Herbert Chitepo. His deputy was responsible for operations within the Dare. This structure was designed to ensure that politicians had a representative from ZANLA in the Dare ReChimurenga.

However, after the Lancaster negotiations and independence, the practice of having a military figure in the Dare was discontinued. In contrast, in the Chinese system, a military figure is typically a part of the decision-making process.

Following independence, there were proposals to appoint the most senior military personnel to political leadership positions in order to prevent a coup. General Sibanda’s promotion serves two key purposes:

  1. It may be aimed at managing Constantino Chiwenga. Among those involved in the 2017 coup, only Chiwenga, Valerio Sibanda, and Anselem Sanyatwe remain. In China, Lin Piao, who was second in command to Chairman Mao Tsetung before 1949, was assigned to the Soviet Union and subsequently had his plane shot down, similar to Prigozhin’s fate. This is a characteristic of many communist setups, where political maneuvering can lead to dramatic changes.
  2. The promotion of General Sibanda may serve to keep Chiwenga off balance and prevent him from realizing that he is being outmaneuvered. Kembo Mohadi’s collapse suggests that he is on his way out, and the plan may be to elevate Jacob Mudenda and promote him. Section 208(3) of the constitution explicitly states, “Members of the security services must not be active members or office-bearers of any political party or organization.” This provision emphasizes the need for a clear separation between the military and political domains, preserving the non-partisan nature of the security services.

Furthermore, Section 211 of the constitution establishes the fundamental principles governing the Defence Forces. It mandates that the Defence Forces must be “non-partisan, national in character, patriotic, professional, and subordinate to the civilian authority as established by this constitution.” General Sibanda’s appointment to a political position within the ruling Zanu PF party raises questions about the military’s commitment to being non-partisan and subordinate to civilian authority, which is a core constitutional requirement.

This development suggests that General Sibanda, who holds a pivotal role in Zimbabwe’s military, may now be in a political subordinate position, igniting concerns about the military’s independence from political influence and its alignment with a specific political party.

In addition to the constitutional issues, this development lends credence to previous statements made by ZANU PF Spokesman Christopher Mutsvangwa. Mutsvangwa has alleged that the military has played a significant role in suppressing opposition movements, citing examples such as the 2008 elections, where the opposition MDC faced physical attacks, and the 2018 elections, raising suspicions of military involvement in electoral processes.

The controversial appointment of General Phillip Valerio Sibanda to the Zanu PF politburo has initiated discussions about the military’s role in Zimbabwean politics and the urgency of upholding constitutional principles that safeguard the nation’s democratic values. On another note however, video footage from the last 6 years exclusively provided by ZimEye below suggests that Valerio Sibanda has in reality been demoted over his refusal to use the army to attack Nelson Chamisa’s supporters during coups. The first clips unloaded by ZimEye show Valerio Sibanda vehemently defending Chamisa’s supporters when they were being accused by Emmerson Mnangagwa, his deputy Constantino Chiwenga and spokesperson, Chris Mutsvangwa of possessing firearms. Biggest African Businesses Trading on International Stock Exchanges

For African businesses, one of the biggest stock exchanges to get listed on is the Zimbabwe Stock Exchange, which registered a more than $170 billion Q3 market turnover this year, representing a nearly 30% increase from the previous quarter. While many African businesses are listed on the Zimbabwe Exchange, including Ariston Holdings Limited, Benso Oil Palm Plantation Limited, and BAT Zimbabwe Limited, we can also see multiple African businesses trading on popular international exchanges, including the New York Stock Exchange. 

Which African Businesses Are Trading on the New York Stock Exchange?

1) Mix Telematics Limited

Mix Telematics Limited is a South African fleet management service provider founded in 1955. Based in Stellenbosch, the company provides enterprise and small fleets with solutions for improving safety and increasing efficiency. Mix Telematics began trading on the New York Stock Exchange (NYSE) under the MIXT stock ticker in August 2013. For perspective, the New York Stock Exchange is one of the biggest stock exchanges in the world, and many of its listed stocks, as well as stocks from the Nasdaq, are included on the famous S&P 500 index. While companies outside of America are not part of this index, many international investors look to actively trade these index funds with tools like the ES1 futures contract. Trading with futures contracts allows for effective hedging strategies, access to leverage, and the ability to short-sell if an opportunity presents itself. 

2) DRDGOLD Limited

DRDGOLD Limited is another South African business listed on the NYSE, which operates in the commodities market. Specifically, DRDGOLD is a gold producer that also specialises in metal recovery from surface tailings retreatment. DRDGOLD is headquartered in Roodepoort and is also listed on the Johannesburg Stock Exchange. Unfortunately for the South African gold producer, it has had a weak quarter performance on the NYSE, with the share price dropping around 20%. With that said, on October 16th, 2023, the stock’s share price jumped around 200%, making it a stock to watch in terms of volatility as we move into the last few months of the year. 

3) AngloGold Ashanti Limited

Joining DRDGOLD Limited on the NYSE is gold mining company AngloGold Ashanti Limited. Based in South Africa, AngloGold was founded in 2004 following the merger of Ashanti Goldfields Corporation and AngloGold. The company began trading on the NYSE in September 2023 under the stock ticker AU. To date, the company has a robust global presence and has generated an extensive portfolio of projects, operations, and exploration activities.

4) Gold Fields Limited

Lastly, Gold Fields Limited, a gold mining firm based in Johannesburg, is also listed on the NYSE. Gold Fields Limited is considered one of the world’s largest gold mining firms, and in May 2022, the firm acquired Canadian mining company Yamana Gold. However, the deal fell through and was terminated in November 2022, with Gold Fields obtaining a $300 million break fee. The company continues to search for ways to build a portfolio of acquisitions to encourage future growth trends.  There are nearly 30 stock exchanges in Africa. While many successful businesses are trading on them, such as Ariston Holdings, African stocks are also on international stock exchanges like the New York Stock Exchange. In fact, given that AngloGold became listed this year in September, it reassures African businesses that there is space for them on these popular international exchanges.

We should maintain discipline and uphold party ethos under our sole leader the President and First Secretary of the party Cde Dr Emmerson Dambudzo Mnangagwa. Therefore, we do not want independent candidates from ZANU PF as that goes against the good order and discipline of our revolutionary party is renowned for,” he said.

ZANU PF Vice President and Second Secretary, Cde Kembo Mohadi said the National People’s Conference offers an opportunity to take stock of progress made and chart a new way forward for the country.

“As ZANU PF family, we are inspired to hold ourselves in high regard as a result of your bold and decisive leadership since the birth of the Second Republic. This conference is, therefore, not only an opportunity to take stock of the progress we have made but also to present a platform for laying a solid foundation for the future of Zimbabwe. I wish to take the opportunity on behalf of all of us gathered, as ZANU PF we are committed to hard work as we grow our party,” he said.

The party’s national chairperson, Cde Oppah Muchinguri-Kashiri said the conference theme speaks to transforming people’s livelihoods.

“The conference theme: Towards Vision 2030 through Devolution, Industrialisation and Modernisation is timely and ensures continuity of your people-centered policies delivering a prosperous and upper-middle-income society, you are laying a foundation not only for Zimbabwe but for the region and beyond. The 20th National People’s Conference is being held on the back of the party’s victory in the August 23 general elections.

Olinda Chapel Court Case, As Police Investigate CoS Frauds

Scandal Uncovered as Zimbabweans Seek UK CoS Jobs Amid Fraudulent Certification Practices.

By A Correspondent | In a latest revelation, as UK socialite Olinda Chapel faces a court hearing over alleged unfair labor practices tomorrow, more than 20,000 Zimbabweans have flocked to the United Kingdom in search of Certificate of Sponsorship (CoS) jobs in the care and health industries. Their pursuit of overseas employment has exposed a disturbing underbelly of fraudulent qualifications and corrupt practices.

Three years ago, the ZimEye news network initiated an in-depth investigation into the fraudulent activities taking place between Harare and London by recruiters. The investigation unveiled a disheartening trend where people were selling assets that did not belong to them, and desperate jobseekers were willing to go to great lengths, including breaking the law, to secure employment abroad.

In the quest for these coveted positions, many individuals resorted to obtaining counterfeit certificates in nurse aide and care work through unscrupulous insiders within institutions certified to issue such documents. While these institutions have now acknowledged the challenge, they claim to be in the process of enhancing their systems to eliminate the issuance of fraudulent qualifications.

The skyrocketing demand for caregivers, particularly in Western countries, prompted by the devastating effects of the COVID-19 pandemic, inadvertently created an avenue for criminal activities. The Sunday Mail Society has unearthed evidence that some staff members in local training institutions were actively involved in issuing fake certificates to desperate jobseekers in exchange for a fee.

Desperate individuals were paying exorbitant amounts for these forged qualifications. In some cases, these fake certificates were so well-made that they were nearly indistinguishable from genuine ones.

Employees at several leading training institutions were found to be manipulating the system, issuing certificates to individuals who had never attended classes, let alone engaged in the required industrial attachment.

Legitimate certification from top institutions would typically cost at least $250, with a requirement of attending classes for a minimum of 10 weeks, in addition to a month-long industrial attachment. However, for those willing to circumvent these processes, corrupt employees and trainers offered to provide fraudulent qualifications for amounts ranging between $150 and $200.

Following a tip-off from the public, the investigation confirmed the extent of the rot. Posing as a potential client, an investigator approached a staffer at a reputable local institution, requesting assistance to acquire qualifications “unprocedurally” for use in the diaspora. This led to the discovery that some corrupt staff members had even lowered the price after negotiations, accepting a deposit of $100, with the balance to be paid later.

The certificate issued came with the promise of being legitimate for life, with the added assurance that it would be entered into the institution’s database to avoid detection during background checks.

Despite repeated attempts to obtain an official comment from the institution in question, the organization recently urged the public to exercise caution in response to reports of bogus institutions offering counterfeit qualifications.

While this practice is not yet widespread, it poses a significant threat and is at risk of spreading to other institutions. The chain of individuals involved in this illicit activity includes staff from healthcare training centers, front-office workers, immigration agents, security guards, and even students, with jobseekers who wish to bypass formal training being the primary targets.

In response to these concerns, some institutions are working to enhance their security features, promote direct payments to facility accounts, and reduce opportunities for corruption. However, with organizations no longer routinely conducting background checks, this issue remains a cause for concern.

Authorities, including the police, have warned of the severe consequences of acquiring fake documents, emphasizing that it constitutes fraud and carries the potential for imprisonment. Employers are encouraged to diligently verify the qualifications of potential jobseekers, and the public is urged to report any information related to these fraudulent operations to assist in curbing this illicit trade.

Civil Servants Await Annual Bonuses in Zimbabwe Amidst Economic Challenges.

In the midst of Zimbabwe’s ongoing economic challenges and a rapidly weakening local currency, civil servants are eagerly awaiting their annual bonuses. The government and public sector representatives are currently engaged in discussions to determine the payment modalities for this year’s 13th cheque.

Traditionally, civil servants in Zimbabwe receive their annual bonuses in November and December, with last year’s payments staggered, beginning in mid-November. This year, however, there is increasing uncertainty surrounding the value of these bonuses due to the dilution of the Zim Dollar.

Public Service, Labour, and Social Welfare Permanent Secretary, Mr. Simon Masanga, confirmed that consultations on the bonus payments were ongoing. He stated, “We are expecting that they will be done soon, and the National Joint Negotiation Committee shall be convened to that effect. We are expecting it soon, and we will only comment more after considerations are completed.”

Finance and Investment Promotion Minister Professor Mthuli Ncube assured civil servants that they would receive their bonuses “on time.” He emphasized that the 13th cheque was a long-standing tradition for civil servants in Zimbabwe.

However, the economic context in which these bonuses are being paid raises concerns. Government workers currently receive a $300 monthly allowance, with the majority of their remuneration denominated in the local currency. The Zimbabwean Dollar has been grappling with severe inflation and devaluation, which has made it increasingly challenging for workers to make ends meet.

Throughout the year, the government has attempted to alleviate these economic hardships by implementing regular salary adjustments. In March, government workers received a 100 percent salary increase, along with a review of their Covid-19 allowance, except for health sector workers.

The key question on the minds of civil servants is how much their annual bonuses will be worth after accounting for the ongoing depreciation of the Zim Dollar. As the government and public sector representatives finalize the bonus payment details, many workers hope for a meaningful and fair resolution that takes into account the economic realities they face.

Sundowns Coach Speaks On Relationship With Steve Khomphela

Mamelodi Sundowns coach Rulani Mokwena has opened up on his relationship with former coaching colleague Steve Komphela, who unexpectedly left the club ahead of the 2023/24 season.

The two coaches initially worked together as co-head coaches at Sundowns.

When Mokwena was made the sole head coach, Komphela was “promoted to become First Team Coach”, a role which had lesser influence.

Komphela subsequently left the Pretoria-based club amd later admitted that he felt “he was not in the plans of the head coach”.

Speaking on Metro FM, as cited by IDiski Times, the Sundowns boss insisted he has a good relationship and retains respect for Komphela, who gave him his first breakthrough in coaching.

The Sundowns gaffer said: “I am where I am today because coach Steve Komphela gave me an opportunity at Platinum Stars to be an assistant coach when I was an U19 coach way back, way back in 2011 – 2009 and 2010 in fact.

“So there is a great sense of pride, there is a great sense of appreciation towards him and what he did but for sure I know that he had his own ambitions of still remaining a head coach.

Corruption behind release of suspected notorious robbers?

By A Correspondent- Residents of Beitbridge are expressing outrage at local police officers, accusing them of negligence for allowing two suspected armed robbers, who were arrested following a community tip-off, to escape custody. Some residents believe that corruption may have played a role in the suspects’ release.

National police spokesman Assistant Commissioner Paul Nyathi responded to the allegations, stating that reports from Beitbridge indicated that the two suspects escaped to South Africa while leading the police during investigations. He mentioned that the information provided by residents differs from official reports but assured that both scenarios would be investigated.

The incident began when a local resident, who frequented the Limpopo River area, encountered three men, one of whom was armed with a pistol. He promptly alerted security agents patrolling the border as part of the “No To Cross Border Crimes” operation. A swift response led to the arrest of two of the suspects, while the one believed to be armed managed to flee.

Following their arrest, the suspects were taken to Beitbridge Police and handed over to the Criminal Investigation Department officers. During their questioning, the suspects claimed that their criminal activities were primarily conducted in neighboring South Africa.

Local residents are concerned about the circumstances of the suspects’ escape and have raised questions about missing handcuffs, the mode of escort, and whether police attempted to use force to prevent the escape. Beitbridge has witnessed a series of violent armed robberies involving firearms, putting residents on edge.

The Officer commanding Beitbridge Police District, Chief Superintendent Tichaona Nyongo, confirmed the reports of a recent armed robbery in the eastern suburbs of Beitbridge where a firearm was used. The robbers, some believed to be from Musina, South Africa, have been targeting money changers in Beitbridge, a town with a significant number of such operators.

Police joy turns to sorrow

By A Correspondent- The joy at ZRP Triangle Police camp over the long-awaited arrival of a pool vehicle after 15 years was abruptly extinguished when the new addition was involved in a fatal accident on October 22, 2023, resulting in the death of a senior police officer and injuries to three others.

The vehicle, identified as a Mahindra with registration number ZRP 3627, was driven by a trainee driver when the accident occurred at the 11.5km mark along the Bulawayo – Victoria Falls road.

For over a decade, ZRP Triangle in Chiredzi District, located 20 kilometers from Chiredzi District Police Headquarters (DHQ), had been operating without a dedicated vehicle. During critical situations, they relied on the DHQ’s Toyota Revo.

According to a police memo, the vehicle was involved in a fatal road accident during a Mahindra familiarization course. Sergeant Manono, a trainee stationed at ZRP Triangle, was driving the vehicle, and Sergeant Masuku was the driving instructor. Three other trainees were in the loading box.

As they approached the intersection of Nyamandhlovu and Victoria Falls road, the trainee driver accelerated and attempted to make a turn onto the Victoria Falls road. However, the vehicle lost control, rolled over, and landed with its roof on top. Tragically, Assistant Inspector Chiwara, stationed at ZRP Chikombedzi, sustained fractures and lost his life at the scene.

The Mahindra was the only vehicle at the station, as it had gone without one for nearly 15 years. It was not included when Toyota Revos were distributed across the country, benefiting Ndali, Chikombedzi, Sango Border post, and DHQ.

The shortage of police vehicles has been a persistent challenge in the district, impeding timely reporting of crimes in remote areas and hindering the swift apprehension of offenders. Sources indicate that this recent accident was not an isolated incident, as several vehicles from the same station have been involved in accidents, contributing to the extended period without a dedicated vehicle.

Zimbabwean to be deported from South Africa over fraud

By A Correspondent- A foreign national has been sentenced in the Randburg Magistrate’s Court in Gauteng on Thursday on charges of fraud, identity theft, and contravention of the Immigration Act.

Prince Mbaiwa from Zimbabwe defrauded the Unemployment Insurance Fund (UIF).

The provincial spokesperson for the Directorate for Priority Crime Investigation (known as Hawks), Warrant Officer Wendy Nkabi, said Mbaiwa applied for UIF as a temporary employee during the National State of Disaster on November 26, 2022.

“The application was then submitted by his employer, San Antonio at Spur restaurant in Sandton, using fraudulent identity documents belonging to Kabole James Puane, and he benefited an amount of R7,594.64,” Nkabi said.

She said an intense investigation was conducted by the Hawks’ Serious Corruption Investigation team based in Johannesburg.

“It was discovered that the suspect is a foreign national who secured employment at the Spur restaurant in Rosebank as a manager,” Nkabi said.

Mbaiwa was convicted of fraud, theft of identity, and contravention of the Immigration Act on Thursday, October 19.

The court sentenced Mbaiwa to six years imprisonment for fraud, three months imprisonment for theft of identity and to be deported to Zimbabwe, and eight months imprisonment for contravention of the Immigration Act, with sentences to run concurrently.

2 minors suffocate inside vehicle

By A Correspondent- Tragedy has struck in Shamva after two children, both under the age of five, suffocated in a vehicle they were playing in.

Four-year-old Kudakwashe Magombo and Kuziva Koffi aged three, died on Sunday after the vehicle allegedly locked them inside.

Mashonaland Central Police spokesperson, Inspector Milton Mundembe said the two kids were left alone by their parents Concilia and Susan Chirupani.

The parents left the children at 10:30 in the morning only to return at around half past three in the afternoon.

Their bodies were taken to Shamva Hospital mortuary for a post-mortem.

Mother’s ordeal at the hands of the horror rains

By A Correspondent- Ever Mutamba (31) never imagined that the supper she had with her four children was their last together.

Like any mother, she retired to bed hoping to see all her children the following morning.

But, alas, fate had other ideas as the night ended in tragedy.

It is October 16, and the rains marked the beginning of the summer season, an anticipated moment by communal farmers in this semi-arid area.

But for Mutamba of Wadzenenga village under Chief Nyashanu in Buhera, the rains which pounded most parts of Zimbabwe that night left her in misery.

Her children died after a bolt of lightning struck her thatched house, causing an inferno that claimed the lives of her children.

That she survived with a badly scorched leg did not hurt her compared to the deep wound she carries after the unfortunate incident.

Her children Mavis (11), Melinda (9), Michael (4) and Hara (2) were buried side by side on the same day.

Mutamba still stares at the graveyard each day when the sun sets as she counts another day without her children.

Speaking to NewsDay Weekender recently, her voice was full of pain as she tried to hold back tears while narrating the story of losing all her children within a flash of a moment.

“I do not know how it happened because I was asleep together with my children. I woke up after feeling an extenuating pain as my leg was burnt. As I was still trying to figure out what was happening, the whole house caught fire.

“I held my little child tightly in my hands, but the other three were still sleeping. Disaster started when I could not find the door to rescue myself and the children,” she said.

Mutamba remembers that the house was engulfed in smoke, and she was immediately blinded by the fumes.

“I do not know how I managed to crawl out of the house. I screamed as I was running to my neighbour’s place. At that moment, I almost lost my memory,” she recalled.

Several people gathered at Mutamba’s homestead during that night as she cried out in despair.

Their screams and shouts increased her fears as she had hoped that the children had escaped the fire.

“My first born, Mavis, was very intelligent at school. She always promised to break the chain of poverty in our family and had a dream of flying to America one day.

“The other two were also good at school. My children always helped me to do household chores. Mavis could take care of her siblings when I was not around,” Mutamba said.

“During our spare time, I would teach my children to sing various songs from the hymn book and teach them the Word of God.

“Now that they are gone, I do not know where to start from. May God have mercy on me. I wish he could bless me with twins one of the days, but it will never be the same. I am heartbroken.”

Conrad Muchena (54), who was the first person to arrive at the scene, could not hide his pain as he narrated the events of that night.

“The house was exploding in orange flames. I could hear a child who was crying for help. I was the first to get to the scene and the situation was unbearable.

“At that time, I cast all my fears though it was not easy. The small boys who were there could not even assist as they were scared to approach the fire.

“Moments later, two other men rushed to the scene and we tried to open the door but there was an unusual force pushing it,” he said.

Muchena said the men tried chipping the walls with stones to create an opening on the other side of the house.

“The girls and women in the village rushed with buckets of water to extinguish the fire, but all the efforts were in vain. Some started pouring sand to extinguish the fire.

“We could hear the poor, hapless voices coming from inside the house as the children were choking from the smoke. They could not even help themselves,” Muchena said.

The children’s father, Happyson Hara, was pacing up and down during the interview, trying to get to grips with reality.

He had left his home the day before tragedy struck.

“I left my family in a good state, and they were all happy and even requested for the items which they wanted me to buy. Little did I know that those were the goodbyes,” he said.

“I felt like the world was falling apart and I could not believe what I heard on the call. It is the same number I used to receive good news from my family, but it turned out to be my worst enemy in three seconds.”

His children had escorted him to the bus station when he left the previous day.

“I tried to work hard for the sake of my children though things are not going well this side. I even thatched the roof of the house that caught fire before I returned to work, all in the name of doing it for my kids, but where are they now?

“I could not believe my eyes. I was devastated after seeing the four bodies lying on the ground. The worst part of it was that they were severely burnt in the fire,” Hara said.

The tragedy is also being felt throughout the whole village.

Titus Wadzenenga (75), the village head, expressed grief as he explained how the incident happened.

“I have never witnessed such an incident, even our forefathers never experienced that. What a loss and we are finished.

“The children had a bright future ahead of them and you could tell because they were very intelligent. I thought they were growing up to become parents and future leaders just like us, but it all turned to dust,” he said.

The relatives have secured another stand for the family in that same village.

Wadzenenga appealed to well-wishers around Zimbabwe to assist the family.

“Incidents like these need experts in counselling. The parents need counselling and assistance from all of us. We are also appealing to well-wishers to assist with building materials for the construction of a new home,” he said.

“The villagers and other relatives can assist, but they cannot do it alone considering the issue of cement and building sheets.”

Zimbabwe and the rest of the southern African region will this year experience the El Niño weather phenomenon with normal to below normal rains.

However, when the rains come, they are sometimes violent and accompanied by winds and lightning, posing extreme danger to humans and animals.

According to the Meteorological Services Department, deaths by lightning are under-reported by 30% in Zimbabwe.

In 2002, 10 people died on the spot, while 60 others were injured after being struck by a bolt of lightning at an apostolic shrine in Chitungwiza.

Zimbabwe entered the Guinness Book of Records in 1975 after 21 people sheltered in a hut in Mutare were killed by lightning.

According to research conducted in 1991, about 100 people died annually due to lightning strikes in Zimbabwe.

Chitungwiza-based Johane Masowe eChishanu apostolic church leader Madzibaba Simbarashe Nengomasha said there is need to conduct prayers at the homestead to deal with bad omen and avoid a recurrence of the tragedy.

But for Mutamba, it was unbearable to see the pall bearers lowering down four coffins containing the charred remains of her children.

She concluded that maybe the gods of joy have abandoned her for eternity.

Warriors To Play Two World Cup Qualifiers In Rwanda

THE Government has assured the nation that adequate measures have been put in place for the senior men’s football team, the Warriors, to play their first two 2026 World Cup qualifiers in Rwanda next month.

With the country yet to have an approved stadium for hosting international matches, the Warriors will host the Super Eagles of Nigeria in Rwanda for their second World Cup qualifier soon after playing the hosts in the first match.

In an interview with ZBC News after presenting a lecture on Sport as a Tool for Peace and Development at the Zimbabwe National Defence University in Mazowe this Thursday, the Minister of Sports, Recreation, Arts, and Culture, Honourable Kirsty Coventry assured the nation that all logistics are in place for the national football team to play their two matches in Rwanda next month.

“I met with the ZIFA Normalisation Committee yesterday and discussed that the team will be staying there and they are finalising a few things. Of course they are disappointed we wanted the first match to be played at home,” she said.

She also gave an insight into the roadmap for the National Sports Stadium to be approved for international matches.

“CAF came and toured the facility and they are happy with the upgrades that were made and the sticking points is still the turnstile, we can’t put them till the buckets seats have come in. There are a number of bucket seats that have been procured and they are waiting for the committee to sign off which hopefully should be next week once that is done, the importation will commence,” said the Minister.

On when Zimbabweans will get to watch the Warriors on home soil, Dr Coventry said she is confident that at least one stadium would have been approved by April next year.

“Once we put in the order, then I can come back to you on a more specific timeline, we can’t do that until we have chosen the specific seats and have them approved, we don’t want to put the wrong seats and then CAF or FIFA comes and says that not the right level.”

Meanwhile, a Sport Integrity Bill set to handle cases of sexual harassment in sport is now with the Attorney General’s office.

Mvurwi Resident Acquitted Over Destruction Of Mnangagwa’s Election Campaign Posters

A MVURWI resident has been acquitted after standing trial on charges of destroying President Emmerson Mnangagwa’s election campaign posters used during harmonised elections held in August.

Tendai Dandajena, a 43 year-old resident of Mvurwi in Mashonaland Central province and a supporter of the Citizens Coalition for Change (CCC) political party had been on trial at Bindura Magistrates Court after he was arrested by Zimbabwe Republic Police officers on 9 July 2023 in Concession while on his way to attend a political campaign rally in the capital city of Mashonaland Central province, which was scheduled to be addressed by CCC political party leader Nelson Chamisa.

Dandajena was charged with destruction of political posters in contravention of section 152(1) of the Electoral Act.

In court, prosecutors alleged that Dandajena unlawfully removed and tore ZANU PF political party campaign posters bearing President Mnangagwa’s picture, which were displayed on a wooden utility electricity pole in Concession.

One torn poster was produced during trial in court as part of the political campaign material, which had been allegedly destroyed by the Mvurwi resident while three state witnesses including the complainant Paradzai Bhobho testified against Dandajena.

However, Dandajena was recently acquitted at the close of the prosecution case after his lawyer Ernest Jena of Zimbabwe Lawyers for Human Rights applied for discharge after arguing that his client was actually a victim of assault by some ZANU PF political party supporters, who apprehended him and insulted him for wearing CCC political party regalia in a no-go area for the opposition party.

Do As You Wish, Marry Mubaiwa Tells Magistrate As Beatrice Mtetwa Quits

Marry Mubaiwa, the former spouse of Vice-President Constantino Chiwenga, instructed Harare Magistrate Feresi Chakanyuka to proceed as he saw fit after her attorney disassociated from her case.

Mubaiwa, who is facing charges related to an alleged attempt to harm her estranged husband, was asked by Chakanyuka whether she was comfortable proceeding to trial without her legal representation.

Her attorney, Beatrice Mtetwa, had disassociated herself from the case in protest against the way it was being handled. Mtetwa had initially requested a postponement, citing her client’s pain following a recent leg surgery.

Chakanyuka, however, adjourned the proceedings for nearly 20 minutes and also requested that Mubaiwa provide medical documents confirming her surgery. Mtetwa argued that a photograph showing an incision on Mubaiwa’s thigh should have sufficed as evidence.

Chakanyuka then asked Mtetwa to provide the medical documents within an hour. However, when the court reconvened, Mtetwa withdrew her representation due to her dissatisfaction with the court’s determination regarding her client.

The magistrate subsequently sought guidance from Mubaiwa, suggesting that she could either seek another attorney or proceed with the trial without legal representation. Mubaiwa instructed Chakanyuka to proceed as he saw fit, and the magistrate granted her one day to find alternative legal representation.

The trial is scheduled to continue today, with former Deputy Health Minister John Mangwiro expected to testify.

Police Hunt Down Two Zanu PF Members Who Assaulted Officers On Duty

In Goromonzi South, Mashonaland East province, the police are actively searching for two Zanu-PF members who forcefully entered a police station, assaulted on-duty law enforcement officers, and unlawfully released their fellow party member from police custody. The incident occurred at the Gazebo Police Base in Caledonia on Monday, resulting in injuries to some police officers.

The arrested individual, youth leader Freddy Madzinga, known as Marhino, had been detained following confrontations related to illegal land sales. Zanu-PF ward 14’s defeated candidate, Menard Gazi, and Zanu-PF Bvumazvipere district chairperson, Jimmy Matanda, reportedly stormed the police base in an attempt to secure their colleague’s release.

Gazi also serves as Zanu-PF’s Nehanda Nyakasikana district chairperson. The police have sought assistance from both the Zanu-PF district and provincial leadership in locating the individuals involved in the incident. The case is currently under investigation at Mabvuku Police Station.

Harare provincial police spokesperson Inspector Luckson Chakanza stated that he was unaware of the incident. However, a prominent Zanu-PF provincial member, who chose to remain anonymous, confirmed the incident. The party official emphasized that such actions represented lawlessness and would not be tolerated by the party, and the individuals involved should be held accountable under the law.

ZIFA Coach Prosecution: Where’s The Complainant?

-Allegations of Bullying Emerge in Mlauzi’s Trial for Indecent Assault

The trial of Shadreck Mlauzi, head coach of the Mighty Warriors, faced an unexpected delay yesterday as the complainant in the case failed to appear. Mlauzi is currently out on bail and is defending himself against two counts of indecent assault, with proceedings taking place before Harare magistrate Ms Yeukai Dzuda.

Mlauzi, represented by his lawyer, Mr Kossam Ncube, vehemently denies the charges brought against him. The accusations revolve around alleged incidents of molestation involving a female member of the technical team, which purportedly occurred in both Zimbabwe and South Africa on separate occasions.

The State’s case hinges on two specific incidents. On September 26, the Mighty Warriors team was in Glen Lorne, Harare, at the Pandhari Lodge for preparations leading up to the Cosafa Women Championships held in South Africa. The complainant, who has not been named, requested the training program from Mlauzi. He allegedly instructed her to collect it from his room but later stated he would email it to her.

It was during this encounter that Mlauzi stands accused of making unwanted advances. He allegedly asked the complainant for a kiss on the lips, and when she refused, he forcibly attempted to kiss her. This incident forms the basis of the first assault charge.

The second count involves events that transpired on October 4 in South Africa at the Garden Court Hotel, where the team was staying. Mlauzi reportedly instructed the complainant to report to his room to give him a massage when handing over the hotel room keys. The following day, she informed him that they lacked resistance bands for training, and he instructed her to collect money from his room. When she did so, he allegedly made inappropriate advances towards her.

After turning down his advances, the complainant faced continued harassment by Mlauzi following a match. Subsequently, she reported the incidents to the Cosafa safeguarding officer, who later provided counseling. These actions culminated in the charge of indecent assault.

While these allegations cast a dark cloud over Mlauzi’s trial, the absence of the complainant at the scheduled proceedings today raises questions. It is essential to keep in mind that the complainant’s non-attendance does not automatically negate the validity of her claims. 19-Year-Old Student In Court For Stealing Client’s Mercedes Benz

A 19-year-old student on attachment in Bulawayo has appeared in court facing charges of allegedly stealing a Mercedes Benz that belongs to a client.

Adonia Muzondi from Cowdray Park suburb who was attached to BMW and Mercedes Benz Service Centre appeared before Bulawayo regional magistrate Collet Ncube facing a charge of theft of a motor vehicle.

He was not asked to plead and was remanded in custody to 7 November.

Allegations against Muzondi are that on 20 October at around 5pm, Munyaradzi Sibanda brought his vehicle, a black Mercedes Benz, to Daniel Grotol Millar’s workshop to be attended to after it had a mechanical fault.

On the next day, Millar notified Sibanda that his vehicle had been fixed and was ready for collection. At around 3pm, Millar together with all his employees including Muzondi knocked off before Sibanda came to collect his vehicle and they left the vehicle’s keys inside the car at the workshop.

After a while, Muzondi went back to the workshop and took the car keys and drove the vehicle away.

The matter came to light when Sibanda arrived at the workshop to collect his car and found it missing.

He then called Millar who quickly came back to the workshop.

Millar then viewed the CCTV footage which showed that the vehicle had been stolen by Muzondi.

The matter was reported to the police and on 22 October, Muzondi was intercepted by the police along Khami Road while driving the vehicle leading to his arrest and recovery of the vehicle valued at US$5 000.

Magtom Media partners ZBC, ‘Heartless Father’ and ‘The Family’ to be screened on ZBC TV

LOCAL film production house, Magtom Media, famed for its YouTube productions, has entered into a partnership with the Zimbabwe Broadcasting Corporation (ZBC) which will see its films being screened by the national broadcaster.

The films ‘Heartless Father One’ and ‘Heartless Father Two’, were produced and directed by Kwekwe-based creative Thompson Muzondiwa affectionately known as Slimi in the world of make belief.

The films that tackle issues surrounding gender-based violence(GBV) will be aired on ZBC TV to raise awareness of the issues.

“We have ‘Heartless Father one and two’ and a 13-episode series ‘The Family’ which tackles GBV against women. I was prompted by societal issues to come up with such films. With funding we can do more, we are currently resource-constrained but with resources, we can match international standards. We have entered into a partnership with ZBC which means our productions will be screened on the national broadcaster. This is a platform for our films to be seen nationwide,” said Thompson Muzondiwa the film producer/director.

Muzondiwa is well known for his YouTube productions which include ‘Partners in Crime’, ‘The Runner’ and Complicated Affairs’.

The partnership between ZBC and Magtom Media will see the national broadcaster airing Magtom Media productions which include ‘Heartless Father One and Two’, and ‘The Family’ to raise awareness on issues surrounding gender-based violence, to mark 16 Days of Activism against Gender-Based Violence which run from 25 November to 10 December.

In his recent statement Nelson Chamisa described the citizens movement as a structureless structure.

When we say strategic ambiguity and a structureless structure, it’s just to confuse our opponent, and It doesn’t mean that we are not structured. We are thoroughly structured. We have a footprint far and wide across the whole country.

You go to rural areas. We are everywhere in every village… we have dominated and this is what explains even in a flawed and bogus election like the one we had, we won emphatically, the Presidency…We won but we were not declared, Mr Mnangagwa is the one who was declared but he did not win, and there is no better evidence to that than what he has shown.

There has not been ability and capacity within their rank and file to even celebrate because they know that they did not win. Even amongst themselves, they know that they did not win this election.

So we did win because of a structured approach, a formidable approach. We won the majority in parliament.

Change Champions in Rundu, Namibia are greatly saddened by the untimely passing on of the academic giant, Mr. Mutambudzi who was the Principal at Masvingo Teachers College. As Rundu Branch and the Namibia district at large, we would like to express our heartfelt condolences to the bereaved Mutambudzi family. Mr. Mutambudzi perished in a fatal car accident on his way from Harare with his colleagues. He succumbed to the accident injuries.

We blame the poor road network in Zimbabwe. We are losing lives through these fatal road accidents. The unfortunate part of it is that our hospitals are also dilapidated. Our health fraternity can no longer save lives. It is now a death trap. The ZANU-PF regime should service our roads and make sure that hospitals are capacitated to save lives. The satanic regime must be put to task. They must respect the sanctity of life.

Solidarity is a core value of Social Democracy hence the spirit of Ubuntu should be exhibited during these trying times. It is wise for change champions in Harare, Masvingo, and the entire family of change champions to give support morally, materially, and financially as some form of bereavement. Tinashe Mutambudzi, the son of the deceased is a pragmatic and energetic member of the organic Citizens Coalition for Change Namibia Rundu Branch. He needs support from all change champions at this particular juncture.

This is a loss to the Matumbudzi family, CCC, and the country. Masvingo Teachers College will never be the same again after this great loss. Chamisa Throws Tshabangu Under The Bus

By- The leader of the country’s main opposition CCC, Citizens Nelson Chamisa, has disowned the party rebel, Sengezo Tshabangu, and said he is working for Zanu PF.

Speaking in an interview that was released on Wednesday, Chamisa claimed that Tshabangu was not a member of the CCC.

Chamisa also revealed that CCC will not participate in the upcoming 09 December by-election, saying the recalls of the party’s MPs and councillors which were initiated by Tshabangu and triggered the by-elections were criminally conducted. Said Chamisa:

I have told you that. I’m sick and tired of commenting about ZANU or FAZ. I’m not a member of ZANU. I’m not a member of FAZ.

I’m sure if you want a proper comment about those people, that name – the moment you mentioned it, you remind me that I’m talking to the wrong person because you see Tshabangu or Twabam guy is not a CCC member, he belongs elsewhere. He is being imposed on the CCC to particularly achieve certain ends.

Chamisa said ZANU PF was complicit in the recalls in order to distract CCC from its call for fresh elections following the disputed 23 and 24 August Harmonised Elections. He said:

(ZANU PF) knows that we defeated them in the election. They want us to focus internally and not focus on the issue.

They want us to take our eyes off the need for a proper election and focus on these stupid and useless by-elections that have been created unlawfully, criminally and unconstitutionally and we will not waste our time on unconstitutional things.

The fact that we have a Speaker who chooses to act not just in error but on the basis of a crime, a ZEC that chooses to act on the basis of a crime and a ‘president’ of a country who chooses to act on the basis of a crime makes it a criminal syndicate. Zimbabwe has become a big crime scene when it comes to tearing apart the constitution of the land.

Chamisa insisted that CCC will not field candidates to participate in the by-elections. He said:

We don’t participate in crime. It would be a different ball game had this position or these vacancies been created by a proper case of law and the course of law.

You can’t choose to criminally produce and impose a fraudster, (have) a bogus recall, which is not from CCC.

  1. Those of you who were too blind to take note or accept that Tshabangu is a proxy … you heard him saying: “his Excellency the President”, even though he had earlier pretended to have a dispute with him in his very 1st letter and even referred to stolen elections.
  2. As the days have gone by, he is starting to get comfortable in his borrowed robes. In addition to this, the increase in attention and interviews means that it is virtually impossible to stick to the rehearsed script.

A betting company Bezbets is involved in a fraud scandal after it has failed to pay a winner more than US$5 000 for placing more than US$50 which is not part of their betting policy.

Since last year the complaint has been placing bets of more than US$50 and according to his account he once won more than $5 000 and has been withdrawing the money until today the Bezbets refused to pay him his money.

Bezbets also failed to give payout to other punters who have placed bets of more than US$50.

The complaint said from the US$5 400 he won today, Bezbets is saying the can give him a payout of US$1 800 which is equivalent US$50 per stake.

The company reported issued a verbal statement saying they do not give payout of more than US$50.

“They have been paying me my money all along using the same bets which I used to place the similar bets which I have been placing. Today, because I have won more than US$5 000, they do not want to pay me my money.

“This is total fraud because they have not put a maximum stake on their terms and conditions policy.

My worry is why is it that they do not want to give my today after they have been giving me all my stakes before,” said the complaint.

According to the Bezbets terms and the minimum stake per transaction is pegged at $2 000 and it does not mention any USD stakes.

On Bezbets payout limits, a single bet is US$15 000.

Efforts to get a comment from Mr Bernard Zieve from the betting company were fruitless as he refused to talk to the media.

Chinese lithium miner unsettles Mutoko villagers

By A Correspondent- Scores of villagers in Mutoko, a mineral-rich district about 140 kilometres east of Harare, said they were being haunted by prospects of displacement by Chinese investors searching for lithium in their ancestral lands.

They said they were also worried that should the Chinese go ahead to establish operations, swathes of virgin lands would be turned upside down, with serious ramifications on the environment, previously protected by generations.

Villagers disclosed how the Chinese, who had earlier been ordered by the courts to stop prospecting, were striking fear in them by saying they had been granted exclusive rights by the Office of the President and Cabinet to proceed with their activities.

The miners do not have requisite paperwork to carry out mining in the area, according to information obtained by the Zimbabwe Independent.

In an effort to protect their land, villagers have approached the courts and the local leadership for assistance.

Villagers said Labenmon Investments and Undertreasure Mining Consultancy have ‘muscled their way’ back, scouting for granite, in addition to their interest in lithium.

Official documents show that Labenmon started local operations in 2006, focussing on gold and nickel mining, after being granted an investment licence giving it rights to claims in Mazowe and Guruve districts.

Labenmon shareholders include Yan Huo, Xu Yongxu, Huo, Wencai and Jin Xiaoling, according to its investment licence from the Zimbabwe Investment and Development Agency (Zida).

Both firms do not have websites or social media accounts. But a quick search on the internet shows that in 2018, Undertreasure Mining was listed among companies then accused of ignoring and neglecting an amnesty on the declaration and repatriation of funds.

The externalisation list by the government includes companies and individuals who externalised funds through non-repatriation of export proceeds, funds externalised through payment of goods not received in Zimbabwe, and funds externalised to foreign banks in cash or under spurious transactions.

In 2016, Makaha Mining Co-operative Society demanded US$1,2 million from Underteasure Mining for breach of contract.

According to articles from 2016, the two companies entered into a joint venture in 2010. Under the deal, Makaha was expected to transfer 70 blocks of chrome — on 1 750 hectares — to Undertreasure in exchange for funding, mining equipment and marketing services.

 Investigations carried out by the Independent, in collaboration with Information for Development Trust, a non-profit organisation supporting investigative reporting focusing on communities, exposed that the companies don’t have documentation but abuse the Office of the President and Cabinet to instil fear among the villagers.

It is the latest of a series of confrontations between Chinese investors and villagers in Mutoko, as the Sino lithium and granite rush in the district continues.

In May this year, villagers approached Mutoko Magistrates Court seeking an interdict to stop Labenmon from carrying out any prospecting, exploration and mining activities in Moyosvii, Chibanda, Gumbeze and Kadore without following due processes.

According to court documents, Labenmon pegged about 150 hectares, covering grazing pastures, cultivation land and traditional and cultural sites in these villages.

Community vulnerability

In July, the court ordered Labenmon to stop operations.However, villagers say a sense of uncertainty had returned after people claiming to be officials from the President’s office directed them to allow the firm to carry out its activities.

“We have a legal way to stop the mining activities but it seems like it is in vain. We feel like the community’s feelings and views are not taken into consideration when we are the most affected,” George Makanjera, a villager from Moyosvii village, said.

Makanjera is one of the villagers who took Labenmon to court, saying he was not consulted about the miner’s intentions to deprive him of his land in order to carry out mining activities.   

“The miners say they are acting on instruction from the Office of the President and will go ahead with their mining operations. We are back to square one. We are between a rock and a hard place. The community is left vulnerable and defeated by the current developments. We fear we might lose our land,” he said.

Daniel Mlalazi, human resources and operations manager at Labenmon, said the company was operating legally.

“What we are doing in Mutoko is within the confines of the law. The villagers have the rights to seek audience with courts if they feel that there is an order which is being violated,” Mlalazi said.

The Zimbabwe Lawyers for Human Rights which represented villagers in court, said if the firm presses ahead, it was ready to continue with the legal battle.

Pfungwa Kunaka, permanent secretary in the Ministry of Mines and Mining Development, said the ministry’s officer in Mashonaland East indicated that everything was in order.

“I have checked with our provincial office, and we do not have the facts about the issues you raise,” Kunaka said.

Presidential spokesperson George Charamba referred questions to the Ministry of Mines and government authorities in Mutoko.

Environmental Management Agency Mashonaland East education and publicity officer Astus Mabwe said Lebanmon submitted its Environmental Impact Assessment (EIA) document to EMA.

“The document is still under consideration. They are yet to be issued with an EIA licence, meaning legally they shouldn’t be operating. We are reviewing the document that was submitted to us to see if we can proceed to give an EIA certificate,” Mabwe said.

 Violation of mining procedure

Labenmon did not consult villagers when it pegged in their agricultural and grazing land to conduct mining activities, which is a requirement under Section 31 (1) of the Mines and Minerals Act.

The Independent’s investigation revealed that Labenmon’s licence only limits it to gold mining in Mazowe and Guruve, not Mutoko.

The licence says Labenmon should work in these areas and seek written consent to expand to other areas.

 Mining activities to impact villagers

If mining activities proceed, villagers will lose their grazing pastures, farms, traditional and cultural shrines.

Women will suffer the most since they remain a critical part of every community playing crucial roles.

These include ensuring the health, nutrition, education and security of their families.

The women interviewed were afraid to speak, with all stated they feared for their lives, now that the Office of the President and Cabinet was reportedly in support of the mining project.

 Laws on mining

Under the Mines and Minerals Act, a prospecting company is supposed to consult the local authority, the rural district council in this case, and affected people.

Section 31 (h) of the Act states that no prospecting can take place “upon any communal land occupied as a village without written consent of the rural district council established for the area concerned”.

The current legislative framework for mining under the Act, which dates back to 1983, has become antiquated and out of touch with latest national and international mining law developments.

The disputes between investors and villagers in Mutoko demonstrate how existing laws have been violated by investors.

They also expose policy and legislative gaps, according to experts.

A community-based organisation in Mutoko, Youth Initiative for Community Development (YICD), has been educating villagers on the amended Mines and Minerals Bill — that has been in the pipeline since 2012.

The amendments seek to effect several changes to old mining laws and bring them up to speed with current dynamics.

Kudakwashe Makanda, the programmes officer for YICD, said going forward, a collaborative effort between the community and civil society organisations, bringing in legal officers, could help communities affected by such mining activities.

Mutoko, which is located 150km north-east of Harare in the sprawling Mashonaland East province, is currently a hotspot of granite and lithium mining projects.

China has strong historical ties with the southern African nation, with the Zida saying it licenced 160 investments from China during the first half of this year, an increase from 53 last year.

International’s Deputy Director for East and Southern Africa, said: “Job Sikhala’s prolonged detention while he awaits trial is a gross miscarriage of justice and an indictment of Zimbabwe’s judicial system. It exemplifies how authorities are abusing the courts to silence opposition leaders, human rights defenders, activists, journalists and other critical dissenting voices.

“Authorities must stop weaponising the law to target opposition figures and ordinary
citizens. The relentless harassment and intimidation of activists and human rights defenders via the courts must end. Everyone should be able to exercise their freedom
of expression without any fear of reprisals.

“The right to a fair trial is recognised internationally as a fundamental human right
and Zimbabwean authorities are required to respect it. The charges against him are
politically motivated as based solely on the peaceful exercise of his human rights. The
authorities have also failed to demonstrate the necessity of his detention awaiting
trial. We call for his immediate and unconditional release. The international
community must strongly condemn the continued harassment against him.”

Torture victim to be compensated by errant prison guards

A Zimbabwean court has ordered the Salary Service Bureau (SSB) to garnish US$100 each per month from the salary accounts of two Zimbabwe Prisons and Correctional Services (ZPCS) officers until they fully settle a debt amounting to US$5 200 after the duo was successfully sued by a Harare man, whom they tortured last year.

On Friday 20 October 2023, the SSB was ordered by a Magistrate at Harare Civil Magistrates Court to deduct US$100 each per month from the salaries of two ZPCS officers namely Michael Nduna and Florence Chihambakwe, to satisfy payment of a US$5 200 judgment debt, which was granted against the prison officers for their barbarism when they tortured Alex Tendai Gombedza.

Gombedza was severely assaulted and tortured together with his friend Evidence Kutsawa by Nduna and Chihambakwe, who accused them of passing through a prohibited area while they were walking through Chikurubi Prison garden in Harare in January 2022.

During the torture, Nduna and Chihambakwe instructed Gombedza and Kutsawa to lie down on the ground before assaulting them on their feet using wooden pick handles. After the assault, the ZPCS officers instructed some prisoners whom they were supervising to also assault the duo.

As a result, Gombedza and Kutsawa sustained severe injuries and had to seek medical attention.

Gombedza sustained injuries on his legs and feet and had to be admitted at Parirenyatwa Group of Hospital for treatment. The Harare resident suffered excruciating pain on his feet, which he still feels to date.

According to a medical report, Gombedza suffered three percent residual disability as a result of the injuries, which he sustained from the assault.

During trial at Harare Civil Magistrates Court, Gombedza’s lawyers  Tinashe  Chinopfukutwa  and Paidamoyo Saurombe of Zimbabwe Lawyers for Human Rights, who assisted him to sue Nduna and Chihambakwe for damages, argued that their client felt greatly humiliated, embarrassed, dehumanised and degraded with the assaults and ill- treatment that he received at the hands of the ZPCS officers.

The human rights lawyers stated that Nduna and Chihambakwe treated Gombedza as if he was a dangerous criminal yet he was unarmed and posed no security threat whatsoever.

Furthermore, Chinopfukutwa and Saurombe argued that there was no justification for the excessive use of force against Gombedza as he had not committed any crime but was just going about his business walking on his way to Harare’s central business centre.

After the assault and torture, an aggrieved Gombedza engaged  Chinopfukutwa  and  Saurombe , who in August 2022 sued Nduna and Chihambakwe for damages amounting to US$5 250 arising from the physical attack and ill-treatment for pain and suffering, humiliation, affront to dignity and embarrassment. Gombedza also cited Justice, Legal and Parliamentary Affairs Minister Hon. Ziyambi Ziyambi and ZPCS Commissioner-General Moses Chihobvu among the respondents.

Gombedza resorted to asking the SSB to garnish the two ZPCS officers’ salaries after proceeds realised from the sale of somehousehold property belonging to Nduna at an auction held in Harare in April 2023 to recover the US$5 250 debt only amounted to US$49 leaving an outstanding debt of US$5 200.

The Harare resident said no attachable property was found at Chihambakwe’s residence.

Apart from garnishing salaries of delinquent ZPCS, SSB has in recent years also deducted salaries of Zimbabwe Republic Police officers, who would have been sued by ZLHR for misdemeanours committed against human rights defenders and ordinary citizens.

Fix Perennial Water Shortages And Help Contain Cholera Outbreak, Zlhr Challenges Murambinda Local Board 

By A Correspondent| Human rights lawyers have asked authorities at Murambinda Local Board to help fix the perennial water shortages and improve the provision of sanitation services to help contain the cholera outbreak that has spread to other parts of the country.

In a letter written to the Chairperson of Murambinda Local Board in Buhera District in Manicaland province, Tatenda Sigauke and Peggy Tavagadza of Zimbabwe Lawyers for Human Rights (ZLHR), said their clients, who are residents of Murambinda and are members of Buhera Residents Network Trust, were peeved by the perennial water supply problems and poor sanitation services in Murambinda.

Sigauke and Tavagadza said while they appreciate that the Murambinda Local Board is managing a transitional phase from its previous status of being a Growth Point, the need to ensure good service delivery remains paramount.

The human rights lawyers registered their concern over the non-collection of refuse particularly at Murambinda bus terminus and the non-availability of reliable water supplies in Murambinda.

Sigauke and Tavagadza challenged Murambinda Local Board to immediately attend to the provision of reliable water supplies and to improve sanitation in the area so as to ensure that residents can enjoy their right to safe, clean and potable water as guaranteed in section 77 of the Constitution as well as an environment that is not harmful to their health and well-being as provided in section 73 of the Constitution.

The lawyers asked Murambinda Local Board to provide residents with information on the concerns of poor service delivery, which they highlighted above and the interventions which the local authority is making to ensure efficient service delivery through the provision of safe, clean and potable water and regular refuse collection.

VP Chiwenga’s ex wife hauled back to court

Vice-President Constantino Chiwenga’s ex-wife, Marry Mubaiwa, yesterday told Harare magistrate Feresi Chakanyuka to do as she wishes after her lawyer had renounced agency.

Mubaiwa, who is facing a charge of attempting to kill her estranged husband, was asked by Chakanyuka if she was comfortable to proceed to trial without her lawyer.

Her lawyer, Beatrice Mtetwa, had renounced agency in protest over the way the case was being handled.

Mtetwa had asked the court for a postponement, arguing that her client was in pain following a leg surgery.

Chakanyuka, however, adjourned the matter for close to 20 minutes.

She also asked Mubaiwa to provide doctors’ documents that showed she had surgery.

Mtetwa, however, argued that a picture of a hole on Mubaiwa’s thigh should have served as enough evidence.

Chakanyuka then requested Mtetwa to bring the medical documents after an hour.

However, when the court resumed, Mtetwa renounced agency citing the harsh determination against her client.

The magistrate then asked Mubaiwa for directions, adding that she could look for another lawyer or to proceed with the trial without legal representation.

Mubaiwa told Chakanyuka to do what she wanted before the magistrate gave her a day to look for another lawyer.

The trial is set to continue today with former Health deputy minister John Mangwiro expected to testify.-NEWSDAY

Potraz hikes tariffs

By A Correspondent- The Postal and Telecommunications Regulatory Authority of Zimbabwe (Potraz) has more than doubled the data and voice tariffs to rescue the capital-intensive sector, reeling from the sharp depreciation of the local currency.

This is the third time that tariffs have been increased this year after reviews in February and April.

Since April, the local currency has depreciated by 444%, against the greenback, to US$1: ZWL$5 695,9159 on Wednesday, meaning that telecommunications needed to raise prices to maintain the value of their services.

In an interview with NewsDay Business yesterday, Potraz director-general Gift Machengete said tariffs were reviewed based on the changes with the transitions performance index.

“The sector, that is the postal and telecommunications, has been applying on using the telecommunication’s price index to determine the cost of providing telecommunication services. The last computation for the sector was done in February 2023. At that time, we were using the July to December 2022 post information,” he said.

“Now, the changes with telecommunication’s price index are used to review tariffs and we did that in February and April 2023. At that time we produced the tariffs of ZWL$94,41 for voice, ZWL$14,93 for data per megabyte, and ZWL$19,41 for SMS. These are the tariffs that we had. They are no longer viable and fall way below regional average tariffs.”

Resultantly, he said, they applied new increments to the tariff regime since the last change.

“Now, with the increase it then means that for voice it is taking us to US$0,40 per minute which is still way below the regional average. It is moving from US$0,20 per minute to US$0,40 per minute. Data is US$0,63 (per megabyte),” Machengete added.

With the old prices, the Potraz boss said the ZWL$94,41 for voice was equal to US$0,20 per minute at the time against a regional average of US$0,84.

Thus, even with the new prices, Zimbabwe’s voice and data tariffs still lag the regional average, he said.

“When we look at the cost of providing the services, it means the cost will be high and hence the problems that we face right now where we have very serious problems in terms of quality of services,” Machengete added.

Local internet service provider, Liquid Home Zimbabwe, notified its clients that the 100% data increase would go into effect at the start of next month with another 50% increment to be effected on December 1, 2023.

While tariffs lag those of regional competitors, the Potraz increment remains high for consumers as most of workers in both the public and private sectors earn their salaries in local currency.

While telecoms providers may get reprieve in terms of costs, consumers will see theirs rise exponentially.

A February 2022 report by the Zimbabwe Coalition on Debt and Development ‘A Pricing Cap on Data Tariffs Now Critical to Protect the Poor’ explained that the problem was the telecoms and internet sector was dominated by monopolistic interests.

“Private sector players cite various reasons to justify the price increases including price adjustments by Potraz, rising operating costs, power-cuts and extensive vandalism of its infrastructure,” the coalition said.

“As long as the telecoms and internet sector are dominated by a monopolistic interest in a context of poor regulatory oversight and weak consumer protection mechanism, rising internet charges will continue making poor Zimbabweans even poorer,” the report said.
