Two Poachers Convicted

Two men from Gwondwa Village under Chief Shana were recently convicted by Victoria Falls Magistrate Ms Linda Dzvene for illegal possession of buffalo meat and an eight heavy gauge wire snare.

The two, Tinashe Nyoni aged 23 and Tavious Chuma aged 21, were arrested in Zambezi National Park by alert Zimbabwe Parks and Wildlife Management Authority rangers on 1 June.

The accused were facing 2 counts of contravening the Parks and Wildlife Act and the Trapping of Animal Control Act.

For the first count, the accused persons were handed a three months imprisonment wholly suspended for five years, while for the second count, they were sentenced to 12 months in prison.

Four months were suspended for five years on condition that the accused persons do not commit a similar offence.- ZBC News

Lumumba Blocked

Concerned faculty, staff, and students at the University of Cape Town have protested Professor Patrick Lumumba’s appearance at the EFF’s 10th anniversary festivities by starting a petition.
Lumumba must not be permitted to address the university community at the lecture that will take place in Sarah Baartman Hall, according to the concerned UCT LGBTIQA+ Staff and Allies.

Emeritus Professor Daya Reddy, the interim vice-chancellor of UCT, has been targeted by the petition, which objects and labels Lumumba as anti-LGBT.

This comes after Lumumba acknowledged in the past that he harbored homophobic views and publicly criticized homosexual Africans as being “unnatural” on multiple media channels.

However, as part of the EFF’s 10 year anniversary festivities, he has been invited by the organisation to give a public lecture on campus on July 24, 2023.

“We believe that by providing Professor Lumumba a platform on campus to deliver a public lecture, UCT signals its tacit acceptance of his homophobic and, in South Africa, unconstitutional pronouncements, which border on hate speech,” UCT’s sociology department’s Dr Natasha Vally said.

“He congratulated Uganda’s President Yoweri Museveni for signing into Ugandan law the Anti-Homosexuality Bill of 2023, which further criminalises LGBTQIA people in Uganda,” she said.

Vally argued that allowing a self-admitted homophobe to continue with a public lecture on their campus signalled to LGBTIQA+ staff and students that they were not valued or safe in their workplace and place of study.

“While we call on the UCT to not provide any space for Prof Lumumba to speak, we find it notably unacceptable that a lecture by such a hateful and divisive figure be held in a hall renamed to honour Sarah Baartman, an indigenous woman trafficked, kept in captivity, and sexually abused by colonialists who sought to dehumanise her,“ Vally said.

Vally added that preventing homophobic speech and denying access to public platforms for homophobes was not about silencing dissenting opinions or stifling debate.

In response, UCT spokesperson, Elijah Moholola, said that the event in question was not a UCT event, but an event that was scheduled to be hosted on the UCT campus by an external party.

“This is in line with similar previous external events hosted on campus, including but not limited to corporate or sporting events.

“It should be noted that UCT management is not in any way involved in the programme for events hosted by external parties on campus, nor does management necessarily align with the hosting external parties or any views held or expressed by any speaker,” Moholola said.

Moholola added that the university had noted with concern the comments that had subsequently been made by the speaker and the critical conversations that had emerged as a result. He urged the external host and the concerned parties to engage these accordingly.

As campaign for 23 August general elections begins in earnest, CCC Youth Taskforce today was in the dormitory town of Ruwa canvassing for support for CCC Presidential candidate, Nelson Chamisa ahead of polls.

Led by CCC Youth Taskforce coordinator, Takudzwa Ngadziore and organising champion, Wombe Nhende, today we held a voter mobilization campaign at Mavambo in Ruwa.

In line with our REAp campaign, our focus is now centred on making sure that citizens elect big in this year’s upcoming general elections.

We have a transgenerational mandate to make sure that we attain change. The transformational agenda can only be realised under the Presidency of our leader, Advocate Nelson Chamisa.

Youths and women have been on the deep end of a stinging economic meltdown under Emmerson Mnangagwa’s dictatorship.

Our clarion call to all change champions especially youths is that we must never lose focus concentrating on internal candidate selection process.

Mnangagwa and his fascist ZANU PF government are the big elephant in the room.

23 August we have a big chance to put Mnangagwa and his bunch of looters into political dustbins.

Voter mobilization must now begin in earnest in every part of the country.

Teenage Mum Dumps Baby In Toilet

The infant was retrieved, but regrettably passed away en route to the hospital, according to the Police’s Twitter account. The incident had place in the province of Matabeleland South’s Filabusi.

“Police in Filabusi are investigating a case of concealing birth which occurred at a secondary school on 07/06/23. A Form 4 student gave birth to a baby in the toilet before dumping it into the pit.

The baby died on the way to the clinic after being retrieved from the pit latrine alive.”

ZACC Arrested Car Robbers Released

Yesterday, two auto dealers who had been detained by the Zimbabwe Anti-Corruption Commission (ZACC) for allegedly importing vehicles using forged letters for rebates from the civil service made their court appearances.
Wilberforce Ruzvidzo (33) of Wiltec and Nyasha Muusha (31) of Naisha Motors both faced fraud charges when they appeared before Harare regional magistrate Mr. Stanford Mambanje.

They were held until July 28 on a $100,000 bail apiece. Mr. Pardon Dziva, the prosecutor, stated that Muusha purchased a 2013 silver Mercedes Benz from Japan sometime in April of last year.

He conspired with Ruzvidzo to facilitate the acquisition of a civil servant rebate letter from Yvonne Tambudzai Musoni, a Zimra officer who is still at large, despite knowing full well that he is not a civil servant and is ineligible for exemption of duty under the civil servant motor vehicle rebate scheme.

Without Jackson Joseph Chingondo’s knowledge, Musoni processed the rebate letter under his name as a member of the Zimbabwe Prisons and Correctional Services.

MASVINGO-Outgoing Zanu PF Gutu Ward 38 Councillor Takawira Chezhira has dragged a local businessman to Chief Gutu’s court on allegations that the latter is spreading rumors that he was caught red-handed with a married woman.

The case will be heard at 10 am tomorrow and Anderson Singende, who is being accused will pay an initial US$50 to the chief according to summons in the hands of The Mirror.
According to the summons dated June 5, 2023, Chezhira is said to have been caught red-handed with Priviledge Vanda who is married to Tungamirai Havana of Zvinowanda Village near Gutu Mission.

Vultureity Hits Zimbabwe: Mavaza

They won’t even consider the nation they will be destroying and demonising. We’ll have individuals who are satanic, demonic, and evil and who aim to harm the reputation of our nation.

This makes me think of the late South African journalist Kevin Carter.

A widely shared photograph of a vulture waiting for a malnourished little girl to die so it might feast on her corpse surfaced in the 1990s. Kevin Carter, a South African photojournalist who later won the Pulitzer Prize for this “amazing shot,” took the picture during the Sudanese famine of 1993–1994.

Kevin Carter only had a few months to enjoy his purported achievement and fame, as he eventually became despondent and committed suicide! *However, as he was relishing his feat and being praised for such a “exceptional photographic skill” on major news stations and networks around the world, Kevin Carter committed suicide!

*Kevin Carter’s sadness began when a caller inquired about the fate of the little girl during one of these conversations (a phone-in programme). I didn’t wait to find out after this photo since I had a trip to catch,” he merely said in response. “I put it to you that there were two vultures on that day, one had a camera,” the caller continued.

As a result, his persistent reflection on that statement eventually contributed to his melancholy and finally led to his death. If Kevin Carter had simply picked up the young child and carried her to the United Nations Feeding Centre, where she was seeking to reach, or at the very least taken her to somewhere secure, he might still be alive today and even far more renowned.

Sadly, Zimbabwe is currently experiencing this. Some people take pleasure in being foolish and acting cruelly towards others. They’ll circulate false information and give the impression that Zimbabwe is on fire. To appease their controllers, they will post fabricated images of violence. Their acts will never aid Zimbabwe; instead, they will ruin it. Kevin Carter should have pulled the girl out of that situation, and doing so would have cost him nothing, but he chose not to. “He had all the time to take his shot, but he had no time to save the girl’s life,” is the inhuman stance displayed here. Some people will have time to distribute false information about Zimbabwe but not enough time to do the opposite. Not harmful rumour mongers, but positive thinkers are what Zimbabwe needs.
We must all comprehend that life’s mission is to affect people, as well. How many lives will you touch during this election season? Are you a vulture as well? Let Zimbabwe be the priority in whatever we do, not what we stand to gain from the situation. Let’s keep Zimbabwe in mind at all times and consider how we might help the country. How we may offer support and wipe away tears would cheer up the masses of Zimbabweans who are willing to cast peaceful votes. Therefore, let’s consider how we might use information, income, fame, abilities, or even positions to help individuals and society as a whole. Instead of people who are paid to appease their masters, Zimbabwe needs people who are patriotic.
Keep in mind that you have the most to do with bringing about peace and tranquilly in Zimbabwe. Please think of Zimbawe and humanity rather than acting like Kevin Carter.
Tranquillity is the owner of the gate and misfortune would be upon if you misbehave, as my haughty primary school teacher from Mberi Primary School in Chitungwiza used to say. Making your country appear terrible by inciting violence simply to grab photos, you are the second vulture.
Don’t encourage violence and unrest; Zimbabwe can hold elections in peace. It is shocking and extremely disappointing how some of us are eager to commit acts of violence in order to satisfy the demands of our oppressors. The whole knee shaking thing.
Beware, if we lack humanity in whatever we do, we are not humans.
We can only claim one nation as our own. We only have Zimbabwe as a country. Stop defaming your nation.

In the clip, a group of youths tell him and his aides, “no one of going to vote for you this time, you are thick thieves; go away!,” said one of the youths as they physically chased the expensive white truck off the field area.

The last time something like this happened in the area in 2017, the sitting President was swiftly removed within weeks of the screams that said, “we no longer want to be ruled by Harare.”

Xenophobia Resurfaces In Diepsloot SA, As Residents Target Foreigners, Destroy Their Shacks

By James Gwati- Xenophonia has re-surfaced in Diepsloot, Gauteng Province, Friday with residents targeting foreign nationals accusing them of committing crimes in the area.

The residents are also destroying shacks belonging to foreign nationals calling for heads.

According to NewzRoom Afrika, the residents decided to take the law into their hands after being ‘let down’ by the police, whom they are also accusing of taking bribes from ‘illegal’ foreign nationals.

Last year in April, Diepsloot residents murdered Zimbabwean Elvis Nyathi.

Nyathi was assaulted and burnt to death by a group of Diepsloot residents.

Seven people were later arrested for the murder, and the case is still pending before the courts.

Budding author exposes Tagwirei’s state  and church capture

By Rosemary  Mafara| An ex-communicated Seventh Day Adventist church pastor has written a book which seemingly attacks businessman Kuda Tagwirei’s growing influence in the politics of this country and the SDA church.

According to impeccable sources, the book ‘The Poor Men’s Cartel’ by Munyaradzi ‘Angero’ Savanhu is just a tip of the iceberg on the  divisions that have rocked the SDA church owing to  ‘KT’ s (Kuda Tagwirei) control of the congregation.

“A lot is happening in the SDA church and Angero has been brave enough to expose how money  being pampered by Kuda Tagwirei has blinded some pastors and elders in the church leaving a lot of undesirables things happening in the church,” said a source close to the development.

Another source claimed that a number of critical media outlets were paid to black out the book which was launched last month.

” The book is explosive and you would have expected to have  wide media reviews but we understand money exchanged hands to keep it under the lid,” claimed the source.

In the book, a character Mambokadzi whom one can easily assume as Kuda Tagwirei, became so powerful in ‘Zimbeland’ that no one would dare him.

” National assets were relinquished into the hands of the Mbinga, Mambokadzi the man. The nation was indebted to him, he used to lend it money and would be reimbursed by being given national assets and parastatals.

” In less than five years he was owning the soil that the masses walked on, and probably, every head present in the land. No one could speak his name freely in the marketplace, without fear of being chocked by his dogs,” writes Angero.

Detailing how Mambokadzi has a firm grip in the church, Savanhu says.

” Mambokadzi, was undoubtedly the most powerful captor of the day. He was a lion, garbed in sheep raiment. His money found its way into religious organisations as donations but with conditions.

” As the clergymen ate cakes in a poverty-stricken nation, they sang songs of  honour and praise. The holy pulpit was for Mambokadzi and his  symphathisers,”he adds.

According to a source, Tagwirei and advocate Thabani Mpofu do not see each other eye to eye and this is confirmed in the book.

” Farai Mhofu mocked the clergymen who acted like zombies while shielding their godfather Mambokadzi, “reads part of the book.

Interestingly, the book was dedicated to Thabani Mpofu.

” Dedicated to Advocate Thabani Sibangani Mpofu, for his exemplary bravery and courage in the fight for justice and equality, “.

The fiery author reveals the influence Tagwirei has in the SDA church which he chose to name Remnant.

” Outsiders to the spiritual gravy train of the Remnant Church would question the Mambokadzi  School of Thought, but their local Shepherds would dismiss this sentiments with a simple biblical reference :Then he said to the men, the one who is sinless should throw the first stone.

“Hear no evil and speak no evil,” the church was taught, by leaders who were Mambokadzi’s pawns, and benefitted from selling their goats and sheep in the temple, “.

Former Zanu PF activist Acie Lumumba a few years ago spoke of one Queen Bee whom he accused of being the architect of all the corrupt activities in the country but can’t be stopped because he is feared. It is not clear whether it is the same Queen Bee who is being referred to as Mambokadzi in the book.

Biti’s Defamation Challenge Struck Off The Roll

The US$1million civil lawsuit against CCC politician Tendai Biti for allegedly defaming the owner of land development company Augur Investments, Mr Kenneth Sharpe, his company and another senior executive can now proceed.

This follows the failure of his application for leave to appeal at the Supreme Court against a High court decision that Mr Sharpe could proceed. The application was struck off the roll, with costs. Augur and Mr Sharpe launched the defamation lawsuit against Mr Biti three years ago after the politician, in his Twitter handle, named him as the most corrupt person looting Zimbabwe’s resources.

However, Mr Biti objected to the lawsuit but lost the case at High Court by way of a default judgment entered against him.

Mr Biti then approached the Supreme Court seeking leave to appeal against the decision that had dismissed an exception to the defamation summons he had raised in the lower court.

But after hearing arguments on Wednesday, Justice Alfas Chitakunye, sitting in chambers, struck the appeal application off the roll with costs on the basis that the motion was improper before the court.

The judge noted that the order of the High Court, which Mr Biti sought to challenge, was a default judgment hence the politician had to purge his default in the lower court first, and so had jumped the gun by approaching the Supreme Court.

The application was also filed after the lapse of the mandatory 10-day period stipulated in the Supreme Court rules within which he had to approach the court after the High Court refused leave to appeal, said Justice Chitakunye.

In this case, Biti should have first sought condonation to file his application out of time but failed to comply with the rules of the court.

Augur Investments is seeking US$500 000 damages from Mr Biti, split as follows: Mr Sharpe US$400 000, and Chief Operations Officer Tatiana Aleshina US$100 000.

Mr Sharpe also cited the opposition party for pursuing a malicious agenda based on Mr Biti’s tweets.

Sometime in December 2020, Mr Biti is alleged to have further published two other defamatory statements concerning Mr Sharpe and Ms Aleshina and several other prominent business people that he named as amongst a coterie of elite looters that were allegedly bleeding Zimbabwe.

Advocate Daphne Sanhanga instructed by Mr Bright Mahuni of Scanlen and Holderness acted for Augur and its executives, while Professor Lovemore Madhuku represented Mr Biti.

Economy Being Run In An Amateurish Way, Says Biti

Former Finance Minister Tendai Biti said the Zimbabwean economy should not be run in an amateurish way and called for immediate dollarisation among a plethora of measures to stop the bleeding.

The Harare East Member of Parliament said there is need for immediate action to stop the economy from its current bleeding state and one of the actions to take is to pay civil servants in United States dollars and promote a culture of saving.

His comments come amid rising inflation and runaway exchange rate at formal and informal markets.

Prices of basic commodities have shot to levels beyond the reach of many.

“What it means is that (Finance Minister Professor) Mthuli Ncube and the government are failing to control the exchange rate which is running away and inflation that is running away,” Biti told Business Times last night.

“You cannot run an economy like a boozers (soccer) club. It’s like old-fashioned football of yesteryear, the kick and run kind of football hoping it will just hit the head of someone and just hope it will end in the nets.”

On what he would do to normalise the crisis, Biti said: “As a matter of urgency I would dollarise.”

“I would float the Zimbabwe dollar to find its actual mark, I will scrap the auction system, scratch export surrender requirements. I will pay the civil servants in US dollars and don’t tell me there is no money, there is the money,” he said, adding that there is also a need to pay pensioners in US dollars.

“I would call for the restoration of savings and most importantly, I will stop corruption. Zimbabwe is losing US$3bn from illicit financial flows. We have to stop the corruption.”

Speaking in Parliament yesterday, Makoni Central MP David Tekeshe said high inflation has eroded the Constituency Development Funds (CDF) before they are being disbursed.

“I went into a shop today and I was shocked to find that the local currency was around ZW$6 000 and ordinary people can no longer afford bread. We need to come to the point of CDF, which is just lying idle because no one wants the RTGS and they charge the black-market rate. The request is that Parliament could negotiate to benefit from the auction floor so that this is looked into because ZW$21 million has gone down to US$4 000 and is no longer enough for the constituency.”

Acting speaker of Parliament Tsitsi Gezi said Tekeshe was raising critical issues that needed to be immediately addressed.

“We are going to notify the responsible authority, particularly the Minister of Finance and Economic Development, so that he looks into the issue of the CDF which is ZW$21m. Indeed, it has been eroded by inflation and as inflation continues, it continues to lose its value.”

Mutambara Rates Mnangagwa As Average And Incompetent

By A Correspondent| Arthur Mutambara, the former Deputy Prime Minister, has expressed his support for Nelson Chamisa, the leader of the Citizens Coalition for Change (CCC), in the upcoming general elections on August 23.

In an exclusive interview with Heart & Soul TV (HSTV), Mutambara criticized Emmerson Mnangagwa, the leader of the ruling Zanu PF party and presidential candidate, describing him as an average and incompetent leader.

During the interview on HSTV’s FreeTalk program, Mutambara commended Chamisa’s leadership, stating, “I have a lot of respect for my colleagues in the CCC. I have a lot of respect for President Chamisa. He is doing a great job.”

Mutambara further mentioned that he privately advises the CCC and acknowledges that they have room for improvement.

Mutambara, who previously served as Deputy Prime Minister from 2009 to 2013 representing the MDC-M during the Government of National Unity, expressed concerns about the fairness of the electoral process.

He cited issues such as the voters’ roll, where names were missing, and the harassment of political opposition members.

Mutambara emphasized that an election cannot be considered legitimate when opponents are locked up and prevented from holding political rallies.

The former Deputy Prime Minister accused Mnangagwa’s government of corruption and incompetence, comparing him unfavorably to the late Robert Mugabe.

According to Mutambara, Mnangagwa lacks finesse and exhibits blatant corruption and incompetence.

Regarding his own political future, Mutambara hinted at a possible return to active politics if the current administration continues to fail.

Currently involved in teaching as a professor and director at the University of the Future of Knowledge, Mutambara stated, “If they continue failing, I might have to reconsider my retirement, but for now, I am keeping my options open.”

Supreme Court Bid To Reverse Joint Venture Deal Flops

A group seeking to reverse a 2007 joint venture deal between Harare City Council and Ken Sharpe’s Augur Investments failed at the Supreme Court on Wednesday, barely a year after a lower court had dismissed the case.

The Zimbabwe Homeless People’s Federation (ZHPF), Knowledge Kwabana and Warship Dumba approached the Supreme Court to get permission to appeal against a High Court ruling by Justice David Mangota. Last year, Justice Mangota dismissed their case on the basis that it has no locus standi.

In the Supreme Court on Wednesday. the matter could not be heard before Justice Nicholas Mathonsi as ZHPF failed to comply with rules.

ZHPF, Kwabana and Dumba approached the courts in 2021 for the land transfer to be undone and the joint venture between HCC and Augur cancelled and declared a nullity. The joint venture had created Sunshine Development.

The applicants alleged that those that signed the agreement were not authorised and that the transaction also broke the investment and procurement laws.

However, the application was dismissed by Justice Mangota, who ruled that the agreement was a matter of public record. The respondents argued that the claim was prescribed, the applicants had no locus standi and that the application was riddled with material disputes of facts which were incapable of being resolved on the papers alone.

“The applicant [ZHPF] which claims to have a keen interest in the affairs of good governance in Harare cannot suggest that it was unaware of the agreements which the parties signed in 2007 up until 2021 (14 years) when it filed the current application,” Justice Mangota said.

“Given its interest in the affairs of the City of Harare, the applicant cannot be said to have been unaware of the agreements from 2010 to 2021″.

In its assessment of all submissions, the court established that one of the applicants, Dumba, had been aware of the agreements because he did the land audit and was chairman of the special investigation committee from 2008 to 2013 which enquired into Harare City Council’s land sales and could not now say he did not know about agreements between 2010 to 2021.

The court showed that applicants did not have the right to sue as locus standi cannot come from simply being interested in something and must show a real relationship to the person they are suing.

The court further said the applicants did not have any rights to the land and “it is so far-fetched it can’t hold”, ‘it has no existing, future nor contingent right in that land’ and was “shooting in the dark”.

“The applicant should have foreseen that its prejudice allegations would be seriously disputed and should have proceeded by way of action” Justice Mangota ruled.

He ruled that the ZHPF cannot escape the sins of its own conduct.

“The Federation shall not be accorded a second bite of the cherry. Its case on the respondents stands on no leg. The application is in the result dismissed with costs,” Justice Mangota ruled.

Sunshine Development is a joint venture company with the objective of building middle income houses and a hotel at Mabelreign Golf Course, develop a commercial centre at Hopley and Mukuvisi.

Is Mnangagwa Conferment of Hero Status on Late Ndabaningi Sithole in Chipinge an Election Strategy?

By Jane Mlambo| President Emmerson Mnangagwa’s administration has announced its intention to officially confer national hero status on the late pioneering nationalist Ndabaningi Sithole in Chipinge on Saturday.

Ndabaningi Sithole, who served as the founding Zanu leader and was also a clergyman, passed away in the United States in December 2000.

During his lifetime, he was denied hero status by the late former President Robert Mugabe due to historical animosity stemming from the liberation struggle in the 1970s.

However, last year, Mnangagwa posthumously conferred national hero status on Sithole, a former lawmaker from Chipinge. The Ministry of Home Affairs issued a statement on Thursday announcing the Conferment of National Hero Status Ceremony for the late Reverend Ndabaningi Chandiwana Sithole, scheduled to take place on Saturday, June 10th.

Sithole is recognized as an unacknowledged hero of Zimbabwe’s liberation from colonial rule, having faced persecution from Mugabe over the years. His legacy still holds great significance in his former Ndau enclave in Chipinge.

The ministry further revealed that the main event would be held at Emerald Hill School in Mt. Selinda, Chipinge District, and would be open to the public.

Additionally, a private church service, led by the United Church of Christ in Zimbabwe (UCCZ), Sithole’s former church, will be conducted at the family homestead.

This particular service will be attended by the guest of honor, senior government officials, party officials, and a limited number of invited guests.

The move to confer hero status on Sithole has sparked debates, with critics arguing that it is a strategic maneuver by Mnangagwa’s government to gain political favor during the election season.

Mutambara Throws Weight Behind Chamisa

Former Deputy Prime Minister Arthur Mutambara has thrown his weight behind Citizens Coalition for Change (CCC) leader Nelson Chamisa’s candidature ahead of the August 23 general elections.

In an exclusive interview with a local online TV, Mutambara described Zanu PF leader and presidential candidate Emmerson Mnangagwa as an average and incompetent leader.

“I have a lot of respect for my colleagues in the CCC.  I have a lot of respect for president Chamisa. He is doing a great job,” Mutambara said.

“I try as much as I can to advise quietly, but they are doing a good job and they deserve our support.

“They could fix one or two things here and there but I communicate privately and tell them what I think can been done,” added Mutambara.

Mutambara, however, warned that it would be difficult to change the status quo citing the unfair playing field which favours the ruling Zanu PF party.

“It’s a tragedy because I don’t see anything positive coming out of this election because already there is the story around the voters roll, where people go and can’t find their names. The voters roll is not available to the opposition. The political opposition is being harassed. Job Sikhala (CCC MP for Zengeza West) and  (Transform Zimbabwe leader Jacob) Ngarivhume are locked up as we speak.

“What kind of election can we have when your opponents are locked up and cannot have political rallies?”

Mutambara accused Mnangagwa’s government of being a haven of corruption and incompetence.

“Mnangagwa is a crude version of the late Robert Mugabe on corruption, on tribalism,” he said.

“On incompetence, he is worse because he has no finesse. Mugabe had an element of finesse around him, but this one is very crude in terms of naked corruption and naked incompetence.”

Mutambara had no kind words for Mnangagwa who he said was very insecure.

“These guys are insecure, very insecure, very incompetent and they are very quick to use force because they doubt their legitimacy, yet Mugabe had a veneer of legitimacy as the founding father of the nation, who brought independence and carried out the land reform programme,” Mutambara said.

Mutambara hinted that he might return to active politics after the elections.

“If they continue failing, I might have to reconsider my retirement but for now I am teaching. I am a professor and director at the University of the Future of Knowledge, but I keep my options open.”

Expensive ZANU PF Cars For Judges Ahead Of 2023 Elections

“Against this background, the government has decided to pamper judges with US$400 000 housing loans.

This is not something new, last year the regime made similar generous payouts. The Central Intelligence Organisation directors received US$350 000, MPs and senators US$40 000 each and cabinet ministers and their deputies received US$500 000 and US$350 000 respectively.

It is now the norm that all Zanu PF parliamentary candidates receive new cars and this year was no exception. All Zanu PF candidate have received brand new off-road Toyota Hilux GD6s, Ford Rangers, Nissan Navaras or a comparable model. The party will pay their US$1 000 nomination fee plus all their campaign expenses.

No one knows for certain, Zanu PF will never ever an audited account of its election spending, but many believe the regime is spending a staggering US$ 4 billion plus on its many multifaceted vote rigging schemes. The huge government spending on elections takes on its true significance when viewed in the context of Zimbabwe IS a failed state that is failing to provide even the most basic needs to millions of its own people.

In 1980, the country had the potential to become the South Korea of Africa, a democratic and prosperous nation. Mugabe and his Zanu PF cronies rigged the first elections; the people were told if the party lost the vote the bush war would continue, and imposed a de facto one-party dictatorship and the rest is history!

The nation had many opportunities to end the Zanu PF dictatorship with the best chances coming during the 2008 to 2013 GNU. Morgan Tsvangirai and his MDC friends were entrusted the task of implementing the democratic reforms. Mugabe intervened, he bribed the MDC leaders with the trapping of high office and they forgot about the reforms.

“Mazivanhu eMDC adzidza kudya anyerere!” (MDC leaders have learned to enjoy the gravy train good-life, they will not rock the boat!) boasted Zanu PF leaders during the GNU when asked why MDC leaders were not implementing the reforms.

Of course, the Zanu PF leaders knew exactly what they were talking about because Mugabe had bribed them with the same trappings of high office to buy their silence. They did not rock the boat whilst Mugabe rod roughshod over the people denying them the freedoms and rights to create the Zanu PF dictatorship. Even at the peak of the Gukurahundi Massacre in 1983 to 1987, Zanu PF leaders said nothing to stop the madness.

Zanu PF has used the same dirty tactic of bribing people in positions of power and authority to neglect their set task to do the party’s bidding – undermining the rule of law to keep the regime in power at all costs. The judges, MPs, etc. are being bribed to stop regime change.

It is ironic that Zimbabwe’s vast mineral wealth which, per se, is a blessing to the nation is now the source of the wealth use to bribe and bankroll the Zanu PF dictatorship. The blessing, in the wrong hands, is now a curse!

It is very sad that 43 years after independence, 2 500 years after the Greeks proposed democracy in which everyone is compelled by law to treat others as they would like to be treated and no one is above the law; we are still failing to do the most basic thing like holding free elections. We are still stuck with autocracy in which the only law that matters is the primeval survival of the fittest, dominate or be dominated.

Zanu PF is rigging these 2023 elections. It is exasperating that Zanu PF is not only robbing the nation blind but is using the looted wealth to bankroll is corrupt the nation’s institutions and vote rigging juggernaut. After 43 years of rigged elections and tyrannical rule the need to end this madness has never been more urgent than it is now. Yellow Wednesday Takes Epworth By Storm

OPPOSITION Citizens Coalition for Change (CCC) supporters in Epworth has launched the Yellow Wednesday to augment the party’s nationwide rural mobilisation exercise code-named mugwazo ahead of the August 23 harmornised elections.

The CCC launched mugwazo to make inroads in areas considered to be Zanu-PF strongholds.

The launch of the Yellow Wednesday in Epworth North constituency was led by CCC aspiring candidate Zivai Mhetu as they distributed campaign material in the informal settlement south-east of Harare.

Other aspiring candidates under Epworth Local Board also participated in the campaign.

Speaking before the door-to-door campaign, Mhetu said the Yellow Wednesday initiative would run until voting day.

“As you are aware we have been conducting these campaigns every Saturday while mobilising support for our presidential candidate and champion-in-chief Nelson Chamisa, we chose Wednesday to remind our supporters of the Wednesday, August 23 voting day,” he said.

“The day has been set aside to increase our visibility in the constituency while complementing the party programme of Mugwazo so that we get maximum votes for our president.

 “Even when we are done with the citizens caucuses, our candidates who would have been chosen by the citizens would continue with the programme for an overwhelming win for our presidential candidate.”

CCC has deployed senior party leaders to areas such Murehwa, Mutoko and Uzumba in Mashonaland East province and several other provinces across Zimbabwe to drum up support for the opposition party.

The sight of one John Tumbwa (not his real name) a victim of drug and substance abuse who demonstrated how they mix illicit brews and honey to make dangerous stuff, surely calls for concerted efforts in tackling the menace.

“We are no longer safe as travellers because sometimes our drivers will be under the influence of alcohol due to the proximity of where they get these substances.

“We call for the Police to take action so that we save the public. The issue of drug and substance abuse has reached an alarming level in our country so we are no longer safe,” said travellers who spoke to the news crew.

Some of the witnesses who spoke off camera told this news crew that bus termini are now havens of drugs as flashy and posh cars frequent these places under the cover of darkness for purposes of drug peddling.

ZRP National Spokesperson Assistant Commissioner Paul Nyathi revealed that more than seven thousand suspects have been arrested since the launch of the operation code-named “No to Dangerous Drugs and Illicit Substances” launched early this year.

“Sadly, these people are selling illicit substances at ranks but I want to assure you that as police we will continue conducting raids in such places. We are also calling for the public to report such cases that we take action as the police,” he said.

The government set up a National Committee on Elimination of Drugs and Substance Abuse, with the structures cascading down to the community level to coordinate the fight against the scourge.- ZBC News

TRUE OR NONSENSE?- Magistrate Rules Murdered Livingstone Committed Suicide

The ‘slain schoolboy’ Livingstone Sunhwa committed suicide, according to a Mutasa magistrate who ruled out any foul play in the case.

When he vanished from St Mathias High School in Mutasa District on December 16, 2021, Livingstone was a Form Four student there.

Six months later, his remains were located. Due to this, and in light of his sister’s statement to the police, an inquest into his death was mandated at Mutasa Magistrates’ Court by the Prosecutor-General’s Office.

Livingstone’s sister, who was a student at St. Mathias High School, asserted that she witnessed her brother being beaten by police just before he vanished.

The presiding magistrate, Mr. Artwell Sanyatwe, stated in his decision that the evidence available showed suicide by hanging, as described by the police.

“There is no doubt that Livingstone exhibited signs of truancy, which in my view contributed to his demise in this instance. He either could not stand the embarrassing conduct of being arrested at the school in full view of his peers or feared the worst, hence his decision to take his own life,” he stated.

Mr Sanyatwe added: “Detectives who dealt with the matter both testified on the findings at the scene of the recovered human remains which they said were found about a kilometre from St Mathias Tsonzo High School in a secluded and bushy area.

“A piece of cloth was found hanging from a tree, which matched a broken piece of cloth found among human remains or bones. Tests were conducted to establish whether these were Livingstone’s . Their evidence was corroborated by expert tests and analysis, although the cause of death could not be ascertained.

“With that in mind, the only logical conclusion that may be drawn is that the cause of death was due to suicide by hanging.

“The chain of events taken cumulatively from the time of the deceased’s arrest, being taken to the police station, then back to the school and leaving the dormitory on the following morning supports that conclusion or the findings above,” he said.

Mr Sanyatwe said it was important to address Livingstone’s behaviour.

“Most of the witnesses who testified before me appeared to turn a blind eye to Livingstone’s behaviour and character. Evidence which emerged from this inquiry suggests that the deceased lacked parental care.

“He was previously expelled from his former boarding school before being enrolled at St Mathias Tsonzo High School. He was expelled from that school having stolen some food from the school’s dining room.

“He also went missing from that school, only to be found after two days loitering outside the school premises. This was exactly his same conduct at St Matthias Tsonzo High School. There is no doubt that he exhibited signs of truancy, which in my view contributed to his demise,” he said.

Mr Sanyatwe said his assessment of Livingstone’s sister’s statements in court and to the police suggests that there were two versions of the same story.

“The statement to the police alludes to the use of a police button stick in beating Livingstone several times on the back. It also suggests this happened in her full view and in the staffroom.

“On the other hand, her testimony in court suggests otherwise, that she did not perceive or witness them going to the dormitory and could see her brother, Livingstone, being beaten and thereafter could not see him until after night studies when she saw him talking to the school headmaster,” he said.

Mr Sanyatwe said he had a torrid time in directing litigants on the objective or purpose of the inquest as most thought that the purpose was to find the killer.

“The minor sister’s statement was critical as it appears to point to foul play, hence its analysis and assessment was paramount in the determination of this matter.

“The rationale being that all other witnesses’ statements did not point directly to suspected foul play as they were either not present at the school upon the deceased’s arrest, or did not perceive anything which suggest foul play,” he said. – state media

Prophet Caught In Bed With Married Woman

Drama ensued when a Kwekwe self-styled prophet was caught trying to have sex with a married woman during a healing session at his shrine and fled completely nude.

The prophet, who has only been identified as Chikandamina and is currently missing from the Amaveni suburb, is said to have left in his birthday suit after being exposed by the woman’s husband.

Emmanuel Mahoko, a police spokesperson for the Midlands province, verified the event.

He claimed, “We confirm that we are hunting down a prophet who attempted to rape his client as he told her that he needed to sleep with her so as to cast out the evil spirit that was tormenting her,” he said.

According to legend, the woman went to a prophet named Chikandamina at his shrine in the Amaveni neighbourhood because she was so anxious to be healed.

He informed her that having intercourse with her was a requirement of the treatment session.

The woman informed her husband via WhatsApp that Chikandamina was enticing her into having sex with him while he was still trying to get her to do so. The report claimed that when the husband arrived on the scene, he discovered his wife lying on the ground as the prophet was changing into his pants and getting ready to attack her.

Chikandamina ran naked, holding his underwear and pair of pants, when he saw the woman’s husband.

Attempt to Reverse a Mugabe Land Deal Flops

A group attempting to overturn a Mugabe-era 2007 land agreement between Harare City Council and Augur Investments has failed to obtain permission to appeal a High Court decision dismissing it for lack of legal standing for a second time.
After losing at the High Court on the grounds that their application was submitted far past the legally required period, the Zimbabwe Homeless People Federation (ZHPF), a person named Knowledge Tinashe Kwambana, and former Harare City councillor Warship Dumba made the effort to appeal.

In 2007, Mr. Ken Sharpe’s Augur and Harare entered into a land and development joint venture in which Augur received 70% of the shares and the council received 30% of the company, Sunshine Development (Pvt) Ltd.

However, ZHPF and other parties have filed a lawsuit seeking that the transaction be reversed against the Harare City Council, Augur Investments, the Minister of Local Government and Public Works, Mr. Ken Sharpe, and others.

They claimed that the council gave Augur more than 239 hectares of land without authorization or compensation.

However, before the court considered the merits of the civil complaint, the lower court made decisions on three preliminary issues brought up by the Harare City Council, the investor, and the other parties sued.

The applicants’ allegations started in 2007, therefore three years had passed by the time the lawsuit was instituted in 2021, the council and Augur argued, saying that the application was lodged well after the deadline for a civil case.

The council and Augur further stated that the federation lacked the legal capacity to suit, that their claim presented important factual issues that, under the law, could not be settled by written documents, and that as a result, they had selected the incorrect civil method.

All three of the first issues were affirmed by Justice David Mangota in the lower court.

Regarding the first issue—the statute of limitations for a civil action—it is undeniable that the joint venture agreements, which were executed in June and September 2007, are public records.

ZHPF failed to follow standing orders once again, and as a result, they must now pay Augur’s costs at the Supreme Court on Wednesday before Justice Nicholas Mathonsi, who was present in his chambers.

In his ruling, Justice Mangota stated that ZHPF could not imply that it was oblivious of the agreements that the parties made in 2007 up until 2021 when it filed its case. ZHPF claimed to have a genuine interest in the concerns of good governance in Harare.

Clr. Dumba, in his capacity as chairperson of the special investigations committee that the City of Harare established between 2008 and 2013, could not have been unaware of this land deal between 2010, the deadline year, and 2021, the year they filed their lawsuit. The committee’s mandate was to look into the City of Harare’s land sales, leases, and exchanges from 2004 to 2009.

The federation and the two people indicated in their papers that they were aware of the transactions as early as 2010, when the matter was brought up in the land audit that the City of Harare performed. They did not deny this in their affidavits.

They were unable to provide an explanation for why they did not file a lawsuit right away after becoming aware of the parties’ identities and the relevant facts, which was three years ago.

The party making the argument is automatically entitled to have the plea upheld if the prerequisites for a plea of prescription have been proved by that party. However, the court kept considering the other two points.

According to the court, neither the ZHPF nor its co-applicants had a direct or significant stake in the agreement between the council and Augur.

They stated that they were suing on behalf of its unidentified members who would later demand land from the City of Harare after the land was returned to it, but the court concluded that their assertion was improbable and unpersuasive.

In addition, the court agreed with the council and Augur that ZHPF should have anticipated that its claims of fraud, corruption, and collusion would be severely contested before bringing the application rather than advancing through a lawsuit.

The kind of application ZHPF submitted necessitates the court hearing arguments and reviewing the files in private.

Harare was represented during the signing of the joint venture by Sekesayi Makwavarara, then-chairperson of the Commission administering Harare, and the then-town clerk Tendai Mahachi.

According to the contract, the joint venture would, among other things, construct middle-class homes, a hotel on a golf course, and a commercial hub in Hopley and Mukuvisi.

At Warren Hills Golf Course, Augur Investments is prepared to construct a cutting-edge tourism and hospitality complex.

This came when Warren Hills Golf and Residential Estate opened its doors in May 2022. Zimbabwe has never received services of this calibre before from the resort.

The impressive golf course will also include a clubhouse, upscale residences, and vacation homes linked to it.

Peter Matkovich, a well-known designer and former golfer, has recently been hired to create the multimillion-dollar infrastructure.

By State Media- A 26-year-old Bulawayo resident who was found guilty of bedding a 14-year-old girl he said was his lover was spared a 24-month prison sentence when he was ordered to complete 420 hours of unpaid work.
Tyson Maseko came before Vivian Ndlovu, a regional magistrate in Bulawayo, and admitted to having sex with a minor.

He received a sentence of 24 months in prison, with 12 months suspended for five years if he behaved himself.

Further suspension of the remaining 12 months was granted under the condition that he complete 420 hours of volunteer work at ZRP Hillside.

The magistrate took into account the fact that the defendant was a first-time offender who didn’t waste the court’s time by entering a guilty plea when deciding on the sentencing.- State Media

Led by CCC Youth Taskforce coordinator Takudzwa Ngadziore and organising champion Wombe Nhende, today we held a voter mobilization campaign at Mavambo in Ruwa.

In line with our REAp campaign, our focus is now centred on making sure that citizens elect big in this year’s upcoming general elections.

We have a transgenerational mandate to make sure that we attain change. The transformational agenda can only be realised under the Presidency of our leader, Advocate Nelson Chamisa.

Youths and women have been on the deep end of a stinging economic meltdown under Emmerson Mnangagwa’s dictatorship.

Our clarion call to all change champions especially youths is that we must never lose focus concentrating on internal candidate selection process.

Chamisa Aides Jailed

By-A Marondera magistrate has jailed two Citizens Coalition for Change (CCC) supporters accused of assaulting a Zanu PF supporter.

The CCC supporters Taurai Befura (47) and Dennis Chiradza (63) were each sentenced to 18 months imprisonment with six months suspended, with no option of a fine for assaulting a Zanu PF supporter in Mahusekwa on May 14, 2022.

No medical affidavit was produced in court as evidence of the assault.
And the Zanu PF T-shirt that was said to have been torn during the clashes was not presented as an exhibit.
The two State witnesses also gave contradictory statements in court, with the complainant admitting that he was not injured.
But when passing the sentence, Marondera magistrate Esther Mabika said the duo was being charged with a violent offence that the court frowned upon, especially in the prevailing political climate.
She justified the sentence saying it would be a deterrent measure in line with the new dispensation and head of State’s mantra that political violence should not be tolerated.
Mabika said given that the country has a history of political violence and the fact that the case had some political elements, the court intended to send a message to the accused persons and the rest of the community that political violence is not tolerated.
They were represented by Lynnet Phiri, of the Zimbabwe Human Rights NGO Forum.
According to the State, Befura and Chiradza assaulted Stephen Musengeyi at Chiriseri business centre with open hands and fists.
The court heard that on May 14, 2022, Musengeyi proceeded to Mudzimuirema School to watch a soccer match organised by Zanu PF.
In the company of Rodwell Makoni, Musengeyi went to Chiriseri business centre to buy food where they met Befura and Chiradza wearing CCC T-shirts.
Musengeyi, who identified himself as a Zanu PF supporter, stated that the two opposition supporters were seen wearing CCC regalia at the local shops.
He told the court that he approached one of the CCC supporters and told them to leave the place.
He told the court that there was a Zanu PF meeting at the shops that is why he wanted the pair to leave.
The other State witness, Makoni stated that there was no meeting at the shops but they were there to get some drinks and relax with friends.
Musengeyi told the court that Befura and Chiradza brought 10 or more unidentified persons and assaulted him. No medical affidavit was produced in court and Musengeyi stated that he did not suffer any serious injuries. Makoni also said there were no visible injuries on Musengeyi. Newsday

Mwonzora Drops Mnangagwa Election

By-The leader of the MDC, Daglous Mwonzora, has dumped the challenge on the proclamation of elections dates he initiated with the courts and set this Thursday as the deadline for members aspiring to represent the party in the 2023 elections to submit their applications.

MDC leader Douglas Mwonzora told the CITE that the party would host one-day primaries across the country in constituencies with two candidates for one seat.
He said the party’s 50 sitting Members of Parliament were unchallenged and primaries will be conducted if there are at least two candidates for a constituency in the remaining 160 constituencies. Said Mwonzora:
Preparations for the elections are going on very well and as the MDC, we are finalising our candidate selection process and the deadline for all provinces to submit the names is Thursday.
If there is more than one candidate, we do a two-stage process where the first process is for the candidates to persuade each other on who must stand down and who must contest. This is possible and sometimes, this strategy works.
When the candidates don’t agree with each other, then we will do primary elections. Our primaries will be done in one day in the areas supposed to have those.
MPs in about 50 constituencies were not opposed internally. These candidates will be vetted by security and if by Thursday, the vetting has taken place, the candidates will straightaway submit their papers to the Zimbabwe Electoral Commission (ZEC).
Mwonzora said the primaries will be confined to only party structures who have to vote for their preferred candidate when there is no consensus in the 60 remaining constituencies. He said:
We will give these candidates the weekend to make their consensus. If they don’t come up with one candidate, then we will fix a day countrywide.
The MDC primaries are not going to involve everyone but will be confined to the MDC structures at each level to vote.
So a smaller group of people will be voting and it is our hope that we have candidates in all the 210 constituencies.
Mwonzora also said MDC was also finalising its election manifesto which would be launched at the end of June.
The MCD failed to win a single parliamentary or local government seat in by-elections held since the last general elections in 2018.

Former Parly Speaker Predicts Chamisa, Mnangagwa Presidential Election Deadlock

By- Former Speaker of the National Assembly, Lovemore Moyo, has warned that the 2023 harmonised elections will produce a disputed outcome as happened in the 2018 elections.
In a statement released on Monday, ahead of the 23 August general elections, Moyo said the international community is tired of Zimbabwe’s cycle of disputed elections. He said:
Once more, the repeat of the 2018 plebiscite, which was disputed, may be in the making and inevitable.
Zimbabweans want an opportunity to make their choices and vote for their preferred party or candidates without fear, intimidation, harassment and election manipulation.
Further, it must be known that the Southern African Development Community, African Union, European Union, America and South Africa, in particular, are exhausted by our recurrent electoral mismanagement, disputes and violence.
Moyo implored the Government and its agencies to ensure a level electoral playing field to prevent a disputed electoral outcome. He said:
In that regard, we call upon the government, law enforcement agencies, political parties, civic society, Zimbabwe Electoral Commission and election observer missions to adhere to election best practices and standards in the execution of their respective duties conscientiously and without fear or favour.
In the same vein, we call upon the police, military, and other law enforcement agencies to remain true and loyal to their oath of service during election time and beyond.
In 2018, the main opposition presidential contender Nelson Chamisa unsuccessfully challenged the results at the Constitutional Court alleging rigging by the Zimbabwe Electoral Commission (ZEC) in favour of the ruling ZANU PF party.
ZEC declared that the ZANU PF presidential candidate, President Emmerson Mnangagwa, had won the poll, a result which was upheld by the Constitutional Court.
Moreover, security officers opened fire on protestors in Harare on 01 August, killing seven people and injuring several others.

Zim CSOs Take Stand Against ‘Judicial Capture’

By A Correspondent| A group of eighteen local and regional civil society organizations (CSOs) have taken a stand against what they perceive as “judicial capture” and the perversion of justice in Zimbabwe.

In a petition addressed to President Emmerson Mnangagwa, these CSOs accuse the country’s Judiciary of manipulating the legal system to target government critics, pointing to the “persecution” of opposition politicians and pro-democracy activists as evidence.

The CSOs express deep concerns about the increasing trend of judicial persecution and the abuse of the legal system by Zimbabwean authorities.

They argue that these actions are aimed at stifling civic engagement and targeting human rights defenders and pro-democracy activists.

The statement, dated June 1, was also copied to Chief Justice Luke Malaba, Justice, Legal and Parliamentary Affairs Minister Ziyambi Ziyambi, and Acting Prosecutor-General Nelson Mutsonziwa.

One prominent case highlighted by the CSOs is that of Job Sikhala, a legislator from Zengeza West, who has been in pre-trial detention since June of the previous year.

Sikhala is charged with incitement to violence at the funeral of opposition activist Moreblessing Ali. The CSOs find it alarming that Sikhala has been denied bail repeatedly, claiming that this highlights the weaponization of the law against government critics.

They further criticize the courts for deviating from the provisions of the Criminal Procedure and Evidence Amendment Act, particularly in relation to bail.

They argue that there is no legal justification for denying Sikhala bail on multiple occasions and continuing to detain him for over ten months.

The CSOs point out the inconsistency in granting bail to Sikhala’s co-accused while he remains in custody, raising suspicions of targeted persecution against the opposition MP.

According to the CSOs, the Sikhala case exposes the absence of the rule of law in Zimbabwe. They demand that any individuals within the Executive or Judiciary, including those affiliated with the ruling ZANU-PF party or any other organization unduly influencing the courts, should be identified, apprehended, prosecuted, and convicted for their actions that violate the principle of separation of powers.

The CSOs emphasize that Sikhala deserves equal access to judicial remedies without discrimination based on political grounds, as guaranteed by national and international law.

Numerous CSOs have joined forces in this petition, including residents’ associations, the Anti-Corruption Trust of Southern Africa (ACT-SA), Zimbabwe Organization for Youth in Politics (ZOYP), Voice of Justice, NamRights Inc (Namibia), Zimbabwe Exiles Forum (South Africa), and international organizations such as the Restoration of Human Rights (United Kingdom), Zimbabwe Diaspora for Democracy (United States), Political Prisoners in Africa (SADC), DITSHWANELO — The Botswana Centre for Human Rights (Botswana), Mozambique Human Rights Defenders Network (Mozambique), Centre for Democracy and Development (Mozambique), Civic Space Network (SADC), and Southern Africa Human Rights Defenders Network (SADC).

Efforts to obtain comments from Information Minister Monica Mutsvangwa, her deputy Kindness Paradza, and Information Ministry Permanent Secretary Ndavaningi Mangwana were unsuccessful at the time.

‘Patriot Bill’: Ball Now In Mnangagwa’s Court

THE Zanu PF-dominated Senate yesterday passed the controversial Criminal Law (Codification and Reform) Amendment Bill, also known as the Criminal Code, paving way for President Emmerson Mnangagwa to sign it into law anytime from now.

The proposed law, also known as Patriot Bill, sailed through the National Assembly last week despite objections from the opposition benches.

“The Senate has passed the Patriotic Bill. The Bill will be sent for Presidential assent to become a law,” legislative watchdog Open Paly tweeted last night.

The Bill has provisions that seek to criminalise citizens found guilty of “wilfully damaging the sovereignty and national interest of Zimbabwe”.

The Bill, which seeks to amend the Criminal Code, penalises Zimbabweans charged with campaigning against or “hurting the interests” of the country including having any correspondence with foreign governments.

Other penalties include revocation of citizenship, prohibition from being registered as a voter or voting in an election for a period of at least five years.

Rights lawyers said some of the penalties were manifestly unconstitutional and are meant to silence government critics and close civic space ahead of general elections set for August 23 this year.

Following passage of the Bill in the Lower House last week, the Zimbabwe Lawyers of Human Rights said the penalties were an assault on democratic and civic spaces.

“The penalty of prohibition of registration as a voter or voting at an election violates political rights as provided for in section 67 of the Constitution as read with paragraph 2 of the Fourth Schedule to the Constitution,” the ZLHR said.

“The proposed provisions will result in the closure of the civic space and violate human rights at a time when Zimbabwe has committed to implement critical reforms under the Structured Dialogue on Arrears Clearance and Debt Resolution process.”

In Parliament last week, opposition CCC legislators took turns to criticise the Bill — which was initially tabled in August last year  after being introduced by former Zanu PF secretary for youth affairs Pupurai Togarepi, who is now the party’s chief whip.

The Patriot Bill is among several contentious pieces of legislation introduced by Mnangagwa to entrench his power since coming into office via a military in 2017. Some of the laws include the Cyber Security Act, Constitutional Amendments 1 and 2, and the Private Voluntary Organisations Amendment Bill that has been awaiting his signature since February.

I Was Drunk, Lone Protestor Pleads Guilty

A Chinhoyi man appeared before Harare magistrate Simon Kandiyero yesterday on charges of disorderly conduct after he staged a lone protest in the capital.

Itayi Uthant Makombe (51) pleaded guilty to the charge saying he was drunk on the day.

Allegations are that on June 5, 2023, at around 0600hrs, Makombe blocked traffic  at the intersection of Josiah Magama Tongogara Avenue and Sam Nujoma Street, Harare, with his Landrover Defender during the protest.

He climbed on top of his vehicle shouting: “Ambuya Nehanda vamuka, ropa zhinji rakadeuka uye richiri kungodeuka” meaning, “Nehanda has resurrected, a lot of blood spilled and is still spilling.”

Constables from ZRP Harare CBD Traffic ordered him to remove his vehicle, and he refused before he was forcibly taken away. 

His lawyer Gift Mtisi said Makombe was drunk.

“When he was arrested he was drunk. When he became sober, he showed remorse and told the officers that he was drunk at the time,” Mtisi said.

Kandiyero said Makombe must be taken for mental examination.

“It is not admissible that the accused was under the influence of alcohol,” the magistrate said.

“The behaviour and words that were uttered by the accused person makes the court wonder if he was in his right mind at the time. If his behaviour is repeated again, he will end up on the court’s corridors again.”

He will appear in court on June 2 after mental examination.

Major Stumbling Block In Kasukuwere’s Presidential Bid

Exiled former Cabinet minister Saviour Kasukuwere has filed an application seeking the cancellation of his warrant of arrest to allow him to contest in the August 23 presidential race.

The warrant of arrest was issued on January 17, 2019.

In early 2020, the National Prosecuting Authority (NPA) sought extradition of Kasukuwere from South Africa but failed after Interpol claimed the issue was political.

Kasukuwere has shown his intention to challenge for the presidency.

The warrant was issued by retired Harare magistrate Hosea Mujaya after the former Cabinet minister in the late President Robert Mugabe’s administration failed to appear for trial on four counts of criminal abuse of office.

In his application, which was filed on June 2, Kasukuwere, through his lawyers, Mhishi and Nkomo Legal Practitioners, said the warrant was issued in error.

According to his lawyers, Kasukuwere appeared before Mujaya on November 29, 2018 to answer to four counts of criminal abuse of duty.

The former Cabinet minister then took exception to the charges saying they lacked essential elements of the offence of criminal abuse of duty.

Mujaya, however, dismissed the application and Kasukuwere approached the High Court for review of Mujaya’s decision.

The High Court ruled in his favour.

After upholding Kasukuwere’s application for exception, the High Court then ordered that the warrant of arrest issued by the lower court be cancelled by Mujaya who issued it.

“It is accordingly submitted that the applicant (Kasukuwere) has managed to show on a balance of probabilities that the warrant of arrest should be cancelled. It serves no purpose for it to remain in force,” Kasukuwere’s lawyers submitted.

“It was rendered void by the High Court in a judgment.”

Kasukuwere was one of the leading persons in a faction known as Generation40 (G40) during Mugabe’s era.

Corporate 24 CEO Faces Fraud Charges

By A Correspondent| In a surprising turn of events, Mike Joka, the founder and CEO of Corporate 24 Medical Centre, alongside company representative Naison Muza, appeared before a Harare magistrate yesterday on charges of defrauding Premier Service Medical Aid Society (PSMAS) of a staggering ZW$108,860 in 2021.

During the court hearing before Magistrate Marewanazvo Gofa, the accused were granted bail of ZW$500,000, a decision that has raised eyebrows in the community.

Their legal counsel, Levious Mundieta, is now tasked with mounting a defense against the allegations.

The case unfolded when PSMAS engaged the services of Forensic RBG Auditors to conduct an extensive audit spanning from 2015 to 2022. Shockingly, the auditors uncovered multiple instances of fraudulent activities.

According to the court documents, Corporate 24 Medical Centre allegedly devised a cunning plan to deceive PSMAS through the submission of fraudulent claims.

The accused allegedly provided non-emergency medical services to various PSMAS members but invoiced for unnecessary procedures using different codes, which were designed to exempt patients from any charges.

Trusting the false representation, PSMAS reportedly made payments to Joka’s bank accounts, resulting in substantial losses for the health insurer.

The state contends that PSMAS suffered a direct financial prejudice of ZW$108,860.91, and no funds have been recovered to date.

Although the court papers did not specify the value of the alleged fraud in US dollars at the time, a brief internet search indicates that during the relevant period, the US dollar was valued at just over ZWL$6.

This calculation suggests that the amount involved in the scam surpassed US$18,000.

This scandalous case has sent shockwaves through the medical community, as patients and medical aid members express concerns over the integrity of the healthcare system.

As the trial proceeds, all eyes will be on the courtroom, awaiting justice to be served and the recovery of the ill-gotten funds.

The family wasted no time in reporting the incident to the authorities, leading to the subsequent arrest of the two impostors. Tinashe Mataga, aged 38, and Freedom Phiri, aged 30, were taken into custody and later revealed that Elias Magumise, aged 32, had provided them with the reptile used in their deceitful act.

Appearing before Kwekwe Magistrate Ms Mildred Matuvi, the trio faced charges under the Parks and Wildlife Act Chapter 20:14, specifically for the unlawful removal of animal parts from any land. They were each granted bail of $150,000.

According to official documents, on June 1, 2023, Nakai Gono, a 72-year-old resident of Mbizo 18 in Mbizo, fell ill, prompting her daughter, Stella Ziya, aged 45, to seek the assistance of traditional healers who claimed expertise in purifying homes.

The court proceedings revealed that Mataga and Phiri approached Magumise, who supplied them with a live python. The plan was to surreptitiously place the snake at the Gono residence, creating an illusion of cleansing having taken place.

During the ritual, Ziya was instructed to retrieve water and salt, which would supposedly be used to dispel the “object” responsible for her mother’s illness. Upon her return, Ziya noticed the two fraudsters retrieving a python from their bag and discreetly planting it behind the wardrobe.

The suspicions surrounding the traditional healers heightened when one of them unexpectedly vomited beer during the prayer session, leaving Ziya even more skeptical of their actions. Promptly recognizing the gravity of the situation, she promptly reported the incident to the police, resulting in the arrest of Mataga and Phiri, who subsequently implicated Magumise.

The approximately three-meter-long python has been handed over to the Zimbabwe National Parks and Wildlife Management (Zimparks) for appropriate handling.

Mwonzora Vows To Spring Up Candidates for 2023 Elections

Govt Rushes To Enact Law Punishing Sanctions Debates Ahead of 2023 Elections

The Criminal Law (Codification and Reform) Amendment Bill, which attempts to penalise those who advocate for sanctions and trade boycotts against Zimbabwe through lobbying and engagement with foreign governments and harm to regular citizens, was approved by the Senate yesterday.
Emmerson Mnangagwa will now receive the bill for his approval.

Ziyambi Ziyambi, Minister of Justice, Legal, and Parliamentary Affairs, stated that the Bill was not intended to limit criticism of the Government or the President but rather to punish people who collude with foreign governments or their agents to harm Zimbabwe’s sovereignty or national interest.

“We are not trying to inflict pain on anyone, but we want to deal with those individuals who engage foreign governments or their agents in meetings, calling for trade boycotts or imposition of sanctions against the country and causing suffering to ordinary people,” he said.

Minister Ziyambi denied claims by members in the British House of Lords that the Bill was meant to stop criticism of the President, saying it was evidence of their “ignorance to discuss something which is not there”.

The proposed amendments on Clause 2 (3) read as follows: “Any citizen or permanent resident of Zimbabwe who, within or outside Zimbabwe, intentionally partakes in any meeting, whose object or one of whose objects the accused knows, or has reasonable grounds for believing involves the consideration of or the planning for the implementation or enlargement of sanctions or a trade boycott against Zimbabwe (whether those sanctions or that boycott is untargeted or targets any individual or official, or class of individuals or officials), but whose effects indiscriminately affect the people of Zimbabwe as a whole, or any substantial section thereof, shall be guilty of willfully damaging the sovereignty and national interest of Zimbabwe…”

The clause provides penalties that include a fine not exceeding level twelve or imprisonment for a period not exceeding 10 years, or both.

Other proposed penalties include termination of the citizenship of the convicted person if that person is a citizen by registration or a dual citizen, prohibition of being a registered voter for a period ranging between five and 15 years and prohibition of standing for a public office for a prescribed period.

Other amendments in the Bill include Clause 5 that seeks to amends section 174(1) of the principal Act after it was felt that the current framing of the offence of criminal abuse of office as provided was very broad in its scope in that it gives room for public officers to be prosecuted for honest mistakes made during the course of their duties.

The proposed amendment will limit the crime to include an essential element of knowledge on the part of a public official that his or her conduct was illegal.

The Bill also provides for a mandatory minimum sentence in rape and murder cases and expands the definition of “dangerous drugs”.

Residents Drink Contaminated Water

CHIPINGE -Three people have died of cholera in Chipinge district, and seventeen cases have been recorded.
Acting District Medical Officer Dr Ozzimo Matekenya confirmed the deaths in the last three weeks.
He said seventeen cases recorded in the district are from Chipangai, Middle Sabi and Mutema hot spots. The cause of cholera in the hot spots is contaminated water from unprotected sources, according to Matekenya. He discouraged the use of home remedies to treat diarrhoea.

“People are drinking contaminated water from canals and Save River. The main challenge we have with the people from the affected areas is that there say safe water from boreholes does not taste good. They prefer water from Save River. Most of the affected people are from farms where there are no toilets. We went to those areas and met with farmers so that they fix temporary toilets and stop drinking water from canals and rivers,” he said.
“Basically, it’s about health promotion. We strongly advise people to exercise maximum hygiene to prevent cholera. They shouldn’t eat cold food and stop open defecation.

“Our appeal to everyone who has diarrhoea is they should just come to the hospital and must not do home remedies. These remedies will delay people from being treated. Let us treat diarrhoea as cholera for now…Masvingo Mirror

“We have the ZEC and other organs, their importance is to check the performance of the media, Section 160 (g) to 160 (j) in the Electoral Acts compels the media to act equitably, in particular ZBC and other electronic platforms. Cattle Rustler Nabbed

A suspected cattle rustler has been arrested in Marondera for allegedly stealing four cattle in the farming area.

The 40-year-old Elson Chimutunga of Chiyanike village under Chief Nenguo in Marondera District was arrested after being found in possession of two slaughtered beasts and two other live cattle tied to a nearby tree.

ZRP Mashonaland East Province spokesperson, Inspector Simon Chazovachii noted, “I can confirm the arrest of Chimutunga of Nenguo on stock theft charges and he is expected to appear in court soon.”

Operating under the cover of darkness, Chimutunga’s luck ran out after the owner of the beasts was alerted by an unusual sound and upon investigating, realised his cattle were missing.

He then alerted other villagers who conducted a search and recovered two beasts which were tied to a tree.

Further investigations led to the recovery of the two slaughtered beasts leading to the arrest of the accused.

“I was awakened by a strange noise which led us to investigate it is sad we still have people who are stealing other people’s property in this way,” said Julius Marondera, a farmer.

Chief Svosve said, “We are very much concerned about stock-theft cases in this area which are increasing daily.”

Chimutunga is understood to be a habitual offender who was arrested and convicted in 2013.- ZBC News

Kaizer Chiefs have reportedly decided on Khama Billiat’s Chiefs as his contract is coming to an end.

PSL Cancels All Matches

The Premier Soccer League confirmed the suspension of all league games with immediate effect.

The suspension is due to maintenance work on water reticulation at National Sports Stadium in Harare.

This leaves the capital without certified venues to host the games.

The stadium currently hosts at least four games per week, which is almost half of the games per matchday.

Eight out of eighteen teams have been using the ground as their home stadium.

The games will resume on the 1st of July 2023.

A statement by the league reads: “This serves to advise that the Castle Lager Premier Soccer League is taking a break with immediate effect and will resume on the 1st of July 2023.

“This has been necessitated by the maintenance work on water reticulation being carried out at the National Sports Stadium and to allow the playing field to regenerate.

ZRP Mashonaland East Province spokesperson, Inspector Simon Chazovachii noted, “I can confirm the arrest of Chimutunga of Nenguo on stock theft charges and he is expected to appear in court soon.”

Operating under the cover of darkness, Chimutunga’s luck ran out after the owner of the beasts was alerted by an unusual sound and upon investigating, realised his cattle were missing.

He then alerted other villagers who conducted a search and recovered two beasts which were tied to a tree.

Further investigations led to the recovery of the two slaughtered beasts leading to the arrest of the accused.

“I was awakened by a strange noise which led us to investigate it is sad we still have people who are stealing other people’s property in this way,” said Julius Marondera, a farmer.

Chief Svosve said, “We are very much concerned about stock-theft cases in this area which are increasing daily.”

Chimutunga is understood to be a habitual offender who was arrested and convicted in 2013.- ZBC News

Cholera Kills 3 In Chipinge

CHIPINGE -Three people have died of cholera in Chipinge district, and seventeen cases have been recorded.
Acting District Medical Officer Dr Ozzimo Matekenya confirmed the deaths in the last three weeks.
He said seventeen cases recorded in the district are from Chipangai, Middle Sabi and Mutema hot spots. The cause of cholera in the hot spots is contaminated water from unprotected sources, according to Matekenya. He discouraged the use of home remedies to treat diarrhoea.

“People are drinking contaminated water from canals and Save River. The main challenge we have with the people from the affected areas is that there say safe water from boreholes does not taste good. They prefer water from Save River. Most of the affected people are from farms where there are no toilets. We went to those areas and met with farmers so that they fix temporary toilets and stop drinking water from canals and rivers,” he said.
“Basically, it’s about health promotion. We strongly advise people to exercise maximum hygiene to prevent cholera. They shouldn’t eat cold food and stop open defecation.

“Our appeal to everyone who has diarrhoea is they should just come to the hospital and must not do home remedies. These remedies will delay people from being treated. Let us treat diarrhoea as cholera for now…Masvingo Mirror

Chamisa Sets Out Post Elections Plans

By- The leader of the opposition CCC, Nelson Chamisa has vowed to ensure that State institutions operate professionally without being corrupted by the Executive if he is elected the country’s next president on 23 August.
Chamisa narrowly lost to President Emmerson Mnangagwa in 2018 after he garnered 44.3% of the vote, while the latter got 50.8% of the vote, according to the Zimbabwe Electoral Commission (ZEC).
On Wednesday, 07 June, Chamisa said he would ensure that Government officials and civil servants are non-partisan and act professionally in discharging their duties. He said:
THE WORST CRIME any sitting Head of State can ever commit is to corrupt state institutions and functionaries.
In a NEW REPUBLIC under a CITIZENS’ GOVERNMENT, we will not pollute and contaminate those who preside over the affairs of the state using trinkets, trappings and other pollutants.
Public officials shall never be allowed to be partisan, sloganeer, or parrot political party nonsense in the corridors of government.
Zimbabwe’s resources and money shall not be abused to buy political survival. It’s time for new leaders!
Critics say ZANU PF has corrupted State institutions such as the Judiciary, security forces, and traditional leaders, among others, so that they have become extensions of the ruling party.
ZANU PF has been accused of abusing the courts to punish opposition politicians, with the arrest of Zengeza West MP Job Sikhala, being used as an example of the capture of the judiciary by the ruling party.
Sikhala, who has been in pre-trial detention since June 2022, was recently denied bail for the fifteenth time.
He was arrested and charged with inciting violence, accused of threatening to avenge the murder of opposition activist, Moreblessing Ali, an allegation that has been dismissed by critics as politically motivated.

Tsvangirai Aide Predicts Mnangagwa’s Defeat

By- Former Speaker of the National Assembly, Lovemore Moyo, has warned that the 2023 harmonised elections will produce a disputed outcome as happened in the 2018 elections.


In a statement released on Monday, ahead of the 23 August general elections, Moyo said the international community is tired of Zimbabwe’s cycle of disputed elections.

He said:
Once more, the repeat of the 2018 plebiscite, which was disputed, may be in the making and inevitable.
Zimbabweans want an opportunity to make their choices and vote for their preferred party or candidates without fear, intimidation, harassment and election manipulation.
Further, it must be known that the Southern African Development Community, African Union, European Union, America and South Africa, in particular, are exhausted by our recurrent electoral mismanagement, disputes and violence.
Moyo implored the Government and its agencies to ensure a level electoral playing field to prevent a disputed electoral outcome. He said:
In that regard, we call upon the government, law enforcement agencies, political parties, civic society, Zimbabwe Electoral Commission and election observer missions to adhere to election best practices and standards in the execution of their respective duties conscientiously and without fear or favour.
In the same vein, we call upon the police, military, and other law enforcement agencies to remain true and loyal to their oath of service during election time and beyond.
In 2018, the main opposition presidential contender Nelson Chamisa unsuccessfully challenged the results at the Constitutional Court alleging rigging by the Zimbabwe Electoral Commission (ZEC) in favour of the ruling ZANU PF party.
ZEC declared that the ZANU PF presidential candidate, President Emmerson Mnangagwa, had won the poll, a result which was upheld by the Constitutional Court.
Moreover, security officers opened fire on protestors in Harare on 01 August, killing seven people and injuring several others.

Chamisa Warns Rogue Party Officials

By James Gwati- Citizens Coalition for Change (CCC) leader, Nelson Chamisa, has warned his senior party official who failed to make it in the 2023 elections candidates’ nomination against contesting the results.

Chamisa said this on Twitter Wednesday amid reports several of his lieutenants were disqualified and were planning to appeal against the results.

The CCC leader said anyone who opposes these pending results would be punished.

He tweeted:

NOT DIGGERS AND DEALERS…The Citizens representatives have been chosen by communities across Zimbabwe. It’s so exciting that we have credible representatives for Parliament and Council. Whoever is after self gain or self care will not serve in the new! Whoever uses money and trinkets to buy citizens or bribe voters can’t serve. Whoever is tainted, compromised or plays for the other team can’t serve! Zimbabwe needs change and deserves truly new leaders! Blessings to you!

 Most losers are in Bulawayo Province and were reportedly disqualified during the verification process.

The verification process started on Friday and ended on Saturday in Bulawayo.

According to NewsDay, most of the sitting councillors and some Members of Parliament were disqualified as the opposition party tries to remove suspected secret agents from genuine members.

Some aspiring candidates were reportedly disqualified for vote-buying and bussing supporters. Said a source:

Besides the 11th-hour disqualification of almost all incumbents, the process proceeded smoothly in all wards except in ward 24, where the caucus didn’t take place on numerous allegations of bussing (in of voters).

CCC deputy spokesperson Gift Siziba who will represent the party in Pelandaba-Tshabalala said:

I have just received a report from our security department that some of my good friends have been vetted out because you know this struggle has taken too long, so we are dealing with sell-outs and nincompoops in our midst.

Siziba made the remarks at the launch of the Deputy Prime Minister in the 2009-13 Government of National Unity, Arthur Mutambara’s book on Friday.

In Bulawayo’s Ward 25, there were alleged attempts to disqualify Alderman Mzamo Dube after he was overwhelmingly nominated. Said a source:

The process was chaotic because whoever was able to transport people was ahead. The process was also slow, and there was sheer disregard for people’s time.

Vote-buying allegations were flying all over as some candidates were buying people with US$5 notes and alcohol.

In Cowdray Park, former Deputy Prime Minister Thokozani Khupe will face Finance and Economic Development Minister Mthuli Ncube.

In Nkulumane, CCC will be represented by Desire Moyo, while Tendai Nyathi will represent the opposition party in Lobengula-Magwegwe where Kucaca Phulu is currently the MP.

PSL Suspends All Matches

The Premier Soccer League confirmed the suspension of all league games with immediate effect.

The suspension is due to maintenance work on water reticulation at National Sports Stadium in Harare.

This leaves the capital without certified venues to host the games.

The stadium currently hosts at least four games per week, which is almost half of the games per matchday.

Eight out of eighteen teams have been using the ground as their home stadium.

The games will resume on the 1st of July 2023.

A statement by the league reads: “This serves to advise that the Castle Lager Premier Soccer League is taking a break with immediate effect and will resume on the 1st of July 2023.

Billiat To Stay At Chiefs

Kaizer Chiefs have reportedly decided on Khama Billiat’s Chiefs as his contract is coming to an end.

The Zimbabwean midfielder’s five-year deal is set to expire at the end of this month and the talks only started after the South African season ended late last month.

According to Soccer Laduma, Billiat received few offers, including one from Tanzanian giants Young Africans, and his representatives decided that staying at Naturena for another season was, in their opinion, his best possible option.

The publication adds that negotiations have progressed well, and the parties have agreed on a new one-year deal.

What are common cold symptoms?
Cold symptoms usually begin with a sore throat, which usually goes away after a day or two. Nasal symptoms, runny nose, and congestion follow, along with a cough by the fourth and fifth days. Fever is uncommon in adults, but a slight fever is possible. Children are more likely to have a fever with a cold.

With cold symptoms, the nose teems with watery nasal secretions for the first few days. Later, these become thicker and darker. Dark mucus is natural and does not usually mean you have developed a bacterial infection, such as a sinus infection.

Most flu symptoms gradually improve over two to five days, but it’s not uncommon to feel run down for a week or more. A common complication of the flu is pneumonia, particularly in the young, elderly, or people with lung or heart problems. If you notice shortness of breath, let your doctor know. Another common sign of pneumonia is fever that comes back after having been gone for a day or two.

Just like cold viruses, flu viruses enter your body through the mucous membranes of the nose, eyes, or mouth. Every time you touch your hand to one of these areas, you could be infecting yourself with a virus, which makes it very important to keep hands germ-free with frequent washing to prevent both flu and cold symptoms.

Family Of Six Now Require ZWL$1 Million To Survive

The Consumer Council of Zimbabwe (CCZ) says a family of six now requires $1 million a month to survive, up from $611 275 in April, reflecting the depth of the Zimdollar’s crash and resultant price spikes.

Zimbabwe is now caught up in a vortex of a rapidly weakening currency, rising inflation, price spikes that have left workers facing impoverishment as wages and earnings fail to keep pace.

Yesterday, the Zimbabwe dollar further crashed to $3 555 from $2 577 against the US dollar, where the highest bid was at $4 100.

On the parallel market, the Zimdollar was trading at 1:6 000 against the greenback.

CCZ director Rosemary Mpofu said the cost of living rose by 62% between April and May, while the prices of goods and services in United States dollars had gone down by 31,4 %.

“The Consumer Council of Zimbabwe low-income urban earner monthly basket for a family of six stands currently at $1 015 962,61,” Mpofu said.

“This is a sharp increase because the basket has shot from the month of April, where it was $611 275. When we look at the basket as we measure it, we find out that the low-income earner is mainly earning in the Zimbabwean dollar.

“But the cost of living has really increased from the April figure to the May figure and it has constituted a percentage increase of 62,2%.

“The new analysis that we use in US$ has decreased by 31,4% so prices have increased in Zimbabwe dollar terms and yet in US$ have decreased by 31,4%.”

Last month, the Zimdollar tumbled by nearly 60% on the official market, the biggest collapse in one month since the auction system was introduced three years ago.

Latest statistics by the Zimbabwe National Statistics Agency show that the annual inflation shot by 11,3 percentage points from April to 86,5% in May.

Monthly inflation has reached double digits after rising sharply from 2,4% in April to 15,7% in May.

Steve Hanke, a professor of Applied Economics at Johns Hopkins University, argues that Zimbabwe’s inflation is at 717%.

Harare Magistrate Vongai Muchuchuti, Prosecutor Michael Reza Accused Of Alleged Bias Against Katsimberis Lawyers

Top lawyer Advocate Tino Chinyoka has accused Harare magistrate Vongai Guwuriro-Muchuchuti of allowing a toxic environment to prevail in court due to her alleged negative and biased attitude towards property developer George Katsimberis’ legal representatives.

Chinyoka said Muchuchuti has been showing bias in her attitude towards deputy prosecutor-general Michael Reza’s determination to have court processes proceed against Katsimberis in the absence of his lawyers.

He said Reza’s impartiality in the case raised suspicion that he might have been incentivised.

Chinyoka made the accusations on Monday while responding to Reza’s response to his application for Muchuchuti to recuse herself from the case where Katsimberis is being accused by controversial businessman Ken Sharpe’s Pokugara Properties of fraud.

The application for recusal came after Muchuchuti was sued by lawyer Millicent Moyo, of Mutumbwa, Mugabe and Partners for allegedly making false statements in court.

Muchuchuti berated Moyo claiming the lawyer lied in court that Chinyoka had travelled to South Africa for medical treatment while applying for postponement of Katsimberis’ case earlier this year.

The magistrate’s claims were followed by a media onslaught branding the lawyer as a liar and that saw her being summoned by the Zimbabwe Law Society.

A transcript of the court proceedings showed that Moyo never uttered the statements that were attributed to her and she is now claiming US$170 000 from Muchuchuti for damages.

Chinyoka said as a result of the lawsuit, Muchuchuti was now conflicted to hear a case involving someone represented by Moyo like Katsimberis.

Reza responded to Chinyoka’s application for the magistrate’s recusal by accusing the veteran lawyer and Moyo of creating an “artificial crisis.”

He claimed Chinyoka misled the court in his application.

However, Reza said the magistrate could have misunderstood Moyo but downplayed the gravity of her actions saying that cannot warrant a recusal.

But Chinyoka described Reza’s response as a testimony or opinion rather than a legal opinion.

He demanded that the deputy prosecutor general should be called to the stand to testify how he came to know about Muchuchuti’s interpretation of Moyo’s submission that led to the mischaracterisation.

He said Reza’s spirited defence of the magistrate in his response confirmed that the two were working in cohorts against his client.

Chinyoka said previously Muchuchuti and Reza had tried four times to have court proceedings against Katsimberis proceed in the absence of his lawyers even when they knew that the lawyers were engaged in matters involving the property developer in superior courts.

“The magistrate has allowed a toxic environment to prevail based on her negative and biased attitude towards the defence,” Chinyoka said.

“The magistrate, egged on by the State, has created such a toxic atmosphere that even observers’ attempts to diffuse the situation will not help.

“The State gets away with making these demands for the trial to proceed without counsel because the magistrate has created an impression that she is on their side.

“The submissions filed on her behalf by the State, complete with an explanation for her false statements, seem an appropriate quid pro quo when viewed in this context.”

Chinyoka said the lack of respect for Katsimberis’ lawyers proved that Reza was biased.

“And there is a real possibility that he and his office have been incentivised to do all they can to assist the complainant in this case,” he said.

He said Reza’s claims that the lawyers were making an artificial crisis were absurd because they implied that “we were aware that the magistrate would lie.”

Chinyoka said Reza also gave an impression that he was aware that the magistrate was confused, and as required of his duty, was supposed to clarify the situation, but failed because he was happy since he wanted the court to proceed without the defence counsel.

He said to achieve an artificial crisis, he was supposed to know that the magistrate will lie in court and make defamatory statements against Moyo, which would be widely covered by the media and that the LSZ would sanction the lawyer for misconduct.

Chinyoka also queried why Reza filed a response on behalf of Muchuchuti, who is a judicial officer.

“The second challenge is that the entire reply by the State is highly irregular and improper,” he added.

“An application for the recusal of the judge or magistrate is one between the party making it and the judicial officer.”

Chinyoka demanded to know whether the State was representing the magistrate in the matter and whether the State took instructions from the magistrate.

He also wanted to know whether the State had the magistrate’s instructions that there was an error of comprehension and if so, how the State knew that the magistrate erred in understanding.

He asked whether the magistrate saw Reza’s responses before they were filed.

“If the answers to these questions are in the negative, then the State has put the magistrate in an invidious position where she cannot be seen to be rewarding the State for its unsolicited representation of her position,” Chinyoka concluded.

Mnangagwa Swallows Pride On Invitation Of Foreign Observers

President Emmerson Mnangagwa appears to have swallowed his pride on his threats to bar foreign observers from observing the August 23 harmonised elections.

The Zimbabwe Electoral Commission (Zec), which has largely acted on Mnangagwa’s cue, has flighted a notice inviting international observers to register for the upcoming elections, two months after the Zanu-PF leader threatened to bar them.

In a notice, Zec said the deadline for submitting applications is August 18, four days before the country goes to the polls.

“Applications are hereby invited from all persons or international organisations wishing to observe the electoral processes, the conduct on polling day and the counting and collation of ballots,” Zec said.

“Applications shall be considered for accreditation from the following persons: (a) individuals representing foreign countries or international organisations and foreign eminent persons who have applied to be accepted as observers; and

“(b) individuals representing local organisations and eminent persons from within Zimbabwe who have applied to be accepted as observers; and

“(c) individuals representing bodies that exercise functions similar to those of the commission and that have been invited by the commission to observe an election; and

“(d) individuals representing foreign countries or international organisations and foreign eminent persons who have been invited by the minister responsible for Foreign Affairs to observe an election; and

“(e) individuals representing local organisations and eminent persons from within Zimbabwe who have been invited by the minister responsible for Justice and Legal Affairs to observe an election.”

In April, Mnangagwa hinted at barring international observers from “hostile countries” from monitoring the country’s polls.

Writing in his weekly column in a State-controlled newspaper early this week, Mnangagwa said government would only consider countries which have invited Zimbabwe to observe their own elections.

“Going forward as a country and nation which is proudly African and sovereign, we shall be insisting on the principle of reciprocity when it comes to the practice of international election observation,” Mnangagwa wrote.

“The time will soon come when we will not accept that condescending and even racist view of a pecking order when it comes to measuring electoral democracy unfolding in our sovereign countries, and which, in any event, is meant for our people.”

His threats were in stark contrast to his 2018 stance when he invited several observers from Western nations previously banned by his predecessor, the late Robert Mugabe.

Analyst Rejoice Ngwenya said: “Zec is very genuine. ED is sabre-rattling. He needs international observation to legitimise his crooked electoral practices.”

In 2020, Mnangagwa also hinted that Zimbabwe in future may not invite foreign observers for elections, saying the Malawi presidential elections had proven that they were not necessary.

Recently, the European Union said it was ready to send its election observer mission to Zimbabwe to ensure the country holds free and fair elections.

In its notice, Zec pegged the accreditation fee for local observers at US$10, while observers from within the continent will pay US$100.

Observers from foreign embassies in Zimbabwe will pay US$300, while observers from countries outside Africa will pay US$400.

Zimbabwean media practitioners working for foreign media houses will pay an accreditation fee of US$100.

Media practitioners from the continent will pay US$100, while local journalists will pay US$10.

Some observers, however, believe that because Zec is mandated by the Electoral Act in Part IXB sections 40G-40J to accredit or deny accreditation to applicants, foreign observers can still be denied observer status.

“Basically the election period is defined in the Electoral Act as the period between the calling of the election and the declaration of the result of the presidential election or the last result of other elections such as constituency elections,” Zec says on its website.

“Subject to such conditions as may be prescribed, accredited observers may do any of the following things during the election period: Observe the election process; observe the conduct of the polling; be present at the counting or collating of votes cast and the verification of polling station returns by presiding officers; and bring any irregularity or apparent irregularity in the conduct of the poll or the counting or collating of the votes to the attention of the commission.”

Zimbabweans Are On Their Own

Former Speaker of the National Assembly, Lovemore Moyo, says Zimbabweans are now on their own in the push for credible elections because regional countries and watchdogs were now tired of the country’s endless poll disputes.

In a statement ahead of the August 23 general elections, Moyo said the country was headed for yet another disputed poll given that there had been no electoral reforms since the last election in 2018.

“Once more, the repeat of the 2018 plebiscite, which was disputed, may be in the making and inevitable,” Moyo said in the statement released on Monday.

“Zimbabweans want an opportunity to make their choices and vote for their preferred party or candidates without fear, intimidation, harassment and election manipulation.

“Further, it must be known that the Southern African Development Community, African Union, European Union, America and South Africa, in particular, are exhausted by our recurrent electoral mismanagement, disputes and violence.”

Moyo called on government and its agencies such as the police to ensure a level electoral playing field to allow for the holding of free and fair elections.

“In that regard, we call upon the government, law enforcement agencies, political parties, civic society, Zimbabwe Electoral Commission and election observer missions to adhere to election best practices and standards in the execution of their respective duties conscientiously and without fear or favour,” Moyo, who leads the United Movement for Devolution, said.

According to Moyo, the Judiciary has to interpret the law impartially, especially during and after the election period to de-escalate tensions over election disputes.
