A lot happened. So harassed,so persecuted,so arrested,so betrayed, so backstabbed,so scarred and so many assassination attempts.

Thank u all for believing. That’s why I say #Godisinit,” said President Chamisa in a brief statement.

The suspect, Tinashe Machando, is also accused of unlawful entry and theft.

He appeared before Shurugwi Magistrate Percy Mukumba on Tuesday last week facing arson, unlawful entry and theft charges.

Wadyajena Admits Own Trucks Bought By Cottco Money But Pleads Innocence

Gokwe Nembudziya MP Justice Mayor Wadyajena has filed an application challenging his placement on remand with suspended executives of the Cotton Company of Zimbabwe on fraud and money laundering charges, saying there was no evidence linking him and his company to the offences. Wadyajena argues that Cottco has not raised any complaints against him and his company, Mayor Logistics, which is also being charged with fraud. Suspended Cottco bosses Pius Manamike, Maxmore Njanji, Fortunate Molai, Chiedza Danha and her company, Pierpoint Moncroix, are appearing in court on similar charges. They allegedly used US$5 834 000 meant for importing bale ties to import trucks, buy fuel and make an assortment of other payments that had nothing to do with the ties. Danha and her company, Pierpoint Moncroix, have also filed an application for refusal of further remand. Wadyajena and Mayor Logistics, who are represented by lawyer Mr Oliver Marwa, argued that the State failed to outline the role they played in committing the alleged offences. They were included in the remand hearing because some of the allegedly diverted money was used to buy 22 trucks that are now owned by Mayor Logistics. Wadyajena’s legal team argues that the State is saying the fraud took place within Cottco and was perpetrated by those working in Cottco. This, they further argue, means that there is no link to Wadyajena and his company. For the remand to stick, the State had to at least allege knowing association by Wadyajena and his company to deceive Cottco and that Wadyajena was present when the plan was hatched or when the fictitious purchase was carried out, they said. Wadyajena and his company said the State also failed to link them with Pierpoint Moncroix or how they could have influenced it into committing the alleged offence. “We have combed through the Form 242 but failed to notice any allegation to the effect that the 25 Freightliner trucks whose details are itemised were imported under the guise of a consignment of bale ties destined for the Cotton Company of Zimbabwe. “The State actually concedes that the trucks were correctly described as road tractors for semi-trailers in the consignment papers. Most importantly, there is no positive allegation that they were paid for by any money belonging to the Cotton Company of Zimbabwe”. Thus, Wadyajena argues, there was no connection between him and the company on one hand and the alleged business or deals of the Cotton Company of Zimbabwe and Giant Equipment, US-based truck supplier. It was also argued that the State did not allege that the shipment and purchase of the trucks was made from Cottco funds. Wadyajena said the allegations were “purely made with the calculated intention of improperly colouring the court’s mind and inducing public indignation” against him and Mayor Logistics. “This allegation is not capable of being proved at trial because it is patently false. It was meant to manufacture a non-existent link between the two applicants and the alleged criminal infractions at the Cotton Company of Zimbabwe.” Wadyajena and his company argued that the State’s allegations amount to a supply contract which was breached, which will render the case a civil matter. “The allegations seem to be that the bale ties that were ordered were not duly delivered. If the court agrees with this conception of the charges, it ought to find that there is no sufficient basis to have placed the accused on remand in the first place. This becomes a supply contract that was breached. It is a civil matter,” they said. Danha and her company, who are represented by lawyer Mr Harrison Nkomo, also filed their application for refusal of further remand arguing that the State failed to establish a link between them and Cottco, Mayor Logistics and Giant Equipment LLC, USA. They said it was unclear how Danha had direct control of Pierpoint Moncroix. Danha and her company also denied money laundering charges they are facing and claimed that they did not launder any proceeds of any crime, nor benefitted from the truck imports. The State led by Mr Lancelot Mutsokoti is yet to respond to the two applications. Meanwhile, reports circulating in parliament have accused the corruption-charged, Gokwe Nembudziya MP, Justice Wadyajena of paying both the Speaker, and the Clerk of Parliament. How can the Clerk ignore this Wadyajena matter and only respond to the one of Blinart?, a whistleblower asked ZimEye. Wadyajena cannot chair a committee when he has a case of corruption against him.

The Speaker and the Clerk were still to comment on the allegations at the time of writing.

Anonymous sources also alleged that ZANU PF Makoni South MP  Misheck Mataranyika (Vice Chairperson of the African Parliamentarians Network Against Corruption (APNAC) is one of the officials paid by Wadjajena, and this was after Mataranyika had published the following response:

Honourable Chairman, Sir.

The issue that you address in that press statement is an important issue that we would all want to see being handled fairly and concluded logically within the dictates of the standing rules and orders of Parliament of Zimbabwe and laws of Zimbabwe.

However, I have strong reservations when you take and express the position of APNAC unilaterally without consulting fellow members. In my humble view a meeting of the Committee should have been called up and the matter tabled for discussion before agreeing on the course of action including drafting of a press statement, if that is the agreed direction to be taken by the Committee.

The problem with taking unilateral action is that it is likely to lack ownership by members of the Committee, and that is not good governance of an organisation. Members, or majority of members, should identify with the position and/ or line of action taken by the organisation, something that has not been tested in this particular case. This reasoning applies to this case and any other case that may come before the APNAC Committee in future.

With all due respect, I therefore call upon you, Hon Chair, to withdraw the statement and urgently call for a meeting of the Committee to deliberate on the matter. This is the correct, professional and transparent manner of running any Committee business, APNAC included.

I have written this response to your purported press statement in my capacity as both, a bona fide member and Vice Chairman of APNAC Zimbabwe.

M.D. Mataranyika (Hon)
Vice Chairperson APNAC Zimbabwe.

SA Accuses Zimbabweans Of Dodging Border Documentation

By-South Africa’s Home Affairs Department said Zimbabweans intending to pass through the Beitbridge border post to Zimbabwe were not being blocked.

Last week there were reports that the new Border Management Authority guards in Musina, Limpopo, were blocking the travellers.

Reads the statement issued by the department in response to the reports:

Border Guards are doing access control duties at the Beitbridge Border Post and they direct the Zimbabweans wanting to go back to their home country to the relevant queues so that they can be documented in accordance with the Immigration Act. This means that they need to be fingerprinted and have their demographic details taken.

However, there are people who have refused to be documented on their departure. They believe that now that they are going back home, nobody needs to ask them any questions at our border.

Nobody will be allowed to just waltz through our border to and fro without being documented. There are no exceptions in this regard, whether you go through a land port, sea port or an airport. This is regardless of your nationality.

There is no way South Africa will refuse anybody from going back home. But similarly, South Africa can’t just allow anybody to move in and out of the country without it being recorded anywhere.

Mai TT Opens Up On Her Countless Love Affairs

By-Mai TT reckons she has always attracted thieves and crooks in her numerous love affairs.

Since she broke up with Tapiwa Mutikani, whom she accused of infecting her with HIV, Mai TT has entered into five high-profile relationships in less than ten years.

The men she romantically got involved with after Mutikani, are artist Zizoe Pamyk, Nigerian businessman Obina Ugwa, the white fellow known as Chime, Tinashe Maphosa – whom she is now accusing of defrauding her.

There was also another man, identified as Shepherd, who was believed to be a married man who was part of her love life.

With relationships, about six men at the last count, since she started sharing her love life in public, one could wonder if she has a love charm which attracts men.

She has claimed publicly why some of her relationships went sour; she plays the victim of being used and taken advantage of by her lovers.

She is on record saying Zizoe used her for fame, as he wanted to boost his musical career while Tinashe defrauded her.

The relationship with Obina could not last as the Nigerian man wanted Mai TT to conduct herself like a typical subservient and well-cultured African woman.

H-Metro reached out to Mai TT on why her relationships do not last.
She said her problem was that she attracted thieves, though she did not want to include Mutikani, among the thieves.
“I am attracting thieves. Don’t talk about Mutikani, he has nothing to do with this,” she said. H Metro.

Mnangagwa Not In Office Because Of Ability

National Patriotic Front (NPF) party spokesperson, Jealousy Mawarire has said President Emmerson Mnangagwa is not in power because the people “who installed him” still want him there.

Mawarire, a journalist and the executive director and founding trustee for the Centre for Elections and Democracy in Southern Africa (CEDSA) says the “kingmakers” may opt for Chiwenga, “nothing will stop them.”

He was responding to a Twitter post by one Jonathan Chirandu who had said, “With both Mnangagwa & his guardian Chiwenga having badly failed the leadership test, can we not say that a Chiwenga presidency is all but dead?”

In response, Mawarire said Mnangagwa was not elected based on competency. He said:

Was ED elected on the basis of ability that he can be judged to have failed? As long as those who installed him still want him there, he will stay & if they want Chiwenga instead, nothing will stop them, failure is the least of their concerns.

Atletico Madrid Fans Insult Vinicious Jr

Real Madrid maintained their perfect start to the La Liga season after beating city rivals Atletico Madrid 2-1 at Wanda Metropolitano Stadium on Sunday.

The build-up to the encounter was marred by some members of the Atletico fanbase who chanted racist abuse towards Vinicius Jr.

The supporters shouted the words: “You are a monkey, Vinicius you are a monkey”.

The vile behavior came days after Vinicius was told to “respect rivals and stop playing the monkey” by Spanish agent Pedro Bravo after he celebrated scoring against Mallorca.

But the chants failed to kill Los Blancos’ spirit and the visitors controlled the proceedings in the first half, thanks to two goals from Rodrygo and Fede Valverde.

Rodrygo netted the opener in the 18th minute after linking up well with Aurélien Tchouameni.

Valverde doubled the cushion on minute 36 after mopping home a rebound.

The second half saw little goalmouth action with both sides failing to come clear at goal.

However, Atletico did find the passage later on and pulled one back through Mario Hermoso.

The defender, who had come in as a substitute, connected Antoine Griezmann’s corner kick in 83rd minute.

Hermoso went from hero to zero just moments later after picking up his second yellow card in three minutes .

Real Madrid managed to hold old and picked maximum points at Wanda Metropolitano, courtesy of the 2-1 victory.

The result put them back on the top of the table with eighteen points from six games.- Soccer24 Zimbabwe

Power Cuts Hit Country’s Mortuaries

Rolling power cuts being experienced across the country have severely affected operations of the country’s hospitals with reports that mortuaries are struggling to contain decomposing bodies.

Zimbabwe has endured acute power cuts for over a decade, while last week, the Zimbabwe Electricity Transmission and Distribution Company (ZETDC) warned of more severe load-shedding because of poor generation.

Health institutions are among the most affected by the crisis because of lack of funding for alternative power sources such as solar or generators.

NewsDay is reliably informed that morticians at Manicaland province’s biggest hospital, Victoria Chitepo Hospital are struggling to deal with dead bodies with its only functioning mortuary being overwhelmed with rotting bodies.

The other mortuary at the institution has been out of commission for months.

There was chaos at the hospital early this month following the death of six people in a horrific collision involving two Honda Fit vehicles in the border city.

Reports indicate that some of the rotting bodies were left lying on the floor.

Sources at the hospital confirmed the development to NewsDay yesterday saying the hospital was failing to maintain its mortuaries made worse by the current power cuts.

Latest On Mnangagwa, Musengezi Battle

Sybeth Musengezi who filed a High Court case challenging President Emmerson Mnangagwa‘s legitimacy says his life is in danger as he constantly receives death threats over the case.

Musengezi who claims to be a ZANU PF youth member is challenging the ascendancy of President Mnangagwa to the leadership of the party in 2017 following the demise of the late veteran leader Robert Mugabe saying the rise was unconstitutional.

He filed his challenge last year, but Mnangagwa’s lawyers have been pressing him to drop the High Court case while some ZANU PF activists promised to take unspecified action against him.

Musengezi last month filed another urgent High Court application seeking to stop Mnangagwa from calling and presiding over ZANU PF’s elective congress slated for October before the case he brought before the court is finalised.

Mnangagwa from calling and presiding over ZANU PF’s elective congress slated for October before the case he brought before the court is finalised.

Sources in the party believe Musengezi is a product of an alleged alliance between former G40 members and Vice-President Constantino Chiwenga in a bid to frustrate Mnangagwa’s bid to contest in 2023 elections, allegations which Musengezi has refuted.

Musengezi told NewsDay on Sunday that death threats escalated ahead of the court sitting on Wednesday this week.

He said:
“Yes, in recent weeks, I’ve seen a number of unmarked vehicles parked just outside of my yard. Sometimes they park when I’m not there and my colleagues would call me to say there is a vehicle or vehicles without plates parked at home.

I personally confronted those people and they just drive off. I can’t really say I’m safe because I don’t know what these people are up to, but if anything is to happen to me, obviously it is people linked to the case.

I have received threats since I launched the legitimacy application last year, with people trying to intimidate me to withdraw and at one point, was arrested and detained for 10 days on a spurious charge to try and force me to withdraw the matter.

So, after realising that threats and detention have failed, they have resorted to intimidation tactics.”- NewsDay

H Metro.

Real Madrid Overcome City Foes Atletico

DeMbare, Bosso Crash Out Of Chibuku Super Cup

Highlanders crashed out of the Chibuku Super Cup after losing 1-0 to Bulawayo Chiefs in Sunday’s quarterfinal clash played at Barbourfields Stadium.

The match was filled with drama, with Peter Muduhwa sent off twice.

The defender received a red card for a second bookable offence in the 22nd minute after the referee thought the player had fouled Obriel Chirinda inside the box.

Following consultation with both the players and his assistant, the match official rescinded the expulsion and called back Muduhwa to the pitch.

However, the 28-year-old still got his marching orders again in the last stages of the game after using his elbow to muscle out an opponent.

Chiefs, who started the match with discipline, could have grabbed a lead from the resultant penalty from Chiranda’s foul but the forward was denied by Ariel Sibanda.

Elvis Moyo failed to hit the rebound home and his effort went wide.

Nonetheless, Amakhosi secured the advantage on the 67th minute after Malvin Mkolo headed home Arthur Musiyiwa’s cross.

Chirinda later received a red card, leaving the hosts with a man short.

A few moments later, Muduhwa followed suit as Highlanders failed to recover from Mkolo’s goal.

Chiefs will will play Black Rhinos in their next fixture.

Rhinos reached the last four, thanks to a 10-9 penalty shootout victory over Chicken Inn.

The teams were tied at 1-1 at the end of the regular time.

The Gamecocks got their goal from Malvin Hwata in the 4th minute before Farai Banda’s effort cancelled the advantage early in the second half.

At National Sports Stadium, FC Platinum beat Dynamos 4-2 on penalties to progress to the semifinals.

The ninety minutes ended goalless and the game also had to be decided by a penalty shootout.

The Platinum Boys, who are the defending champions, will play Herentals in the next round.

The Students beat Manica Diamonds in Saturday’s match.

Pasuwa Fails To Break Champions League Hoodoo

Callisto Pasuwa’s Nyasa Big Bullets failed to progress to the preliminary round of the CAF Champions League following a 4-0 aggregate loss against Simba SC of Tanzania.

Bullets succumbed to a 2-0 slump in the return fixture played on Sunday in East Africa, having lost with a similar margin at home last week.

The aggregate result marked another unsuccessful run for the Zimbabwean gaffer in the interclub competition.

The Malawian champions have never passed the first round of the tournament under the former Warriors international.

Pasuwa also had four unsuccessful runs with Dynamos in the Champions League, failing to reach the group stage on all occasions.

Meanwhile, the coach have so far won three successive domestic league titles since joining Nyasa in 2018.

He is on course to grab a fourth triumph as his side has a twelve-point lead gap at the top with eight games to play.

Medication Safety

Medications are the most widely utilized interventions in health care, and medication-related harm constitutes the greatest proportion of the total preventable harm due to unsafe care, let alone the economic and psychological burden imposed by such harm.

Acknowledging this substantial burden and recognizing the complexity of medication-related harm prevention and reduction, “Medication Safety” has been selected as the theme for World Patient Safety Day 2022.

The campaign is envisaged to provide the needed impetus to consolidate the efforts of the existing WHO Global Patient Safety Challenge: Medication Without Harm, emphasizing the need to adopt a systems approach and promote safe medication practices to prevent medication errors and reduce medication-related harm. Special consideration will be given to areas where most harm occurs. The key action areas are high-risk situations, transitions of care, and polypharmacy.

The global landscape of health care is changing with health systems operating in increasingly complex environments. While new treatments, technologies and care models can have therapeutic potential, they can also pose new threats to safe care. Patient safety is a fundamental principle of health care and is now being recognized as a large and growing global public health challenge. Global efforts to reduce the burden of patient harm have not achieved substantial change over the past 15 years, despite pioneering work in some health care settings.

Patient safety is a framework of organized activities that creates cultures, processes, procedures, behaviours, technologies and environments in health care that consistently and sustainably lower risks, reduce the occurrence of avoidable harm, make error less likely and reduce its impact when it does occur.

Every point in the process of care-giving contains a certain degree of inherent unsafety.

Clear policies, organizational leadership capacity, data to drive safety improvements, skilled health care professionals and effective involvement of patients and families in the care process, are all needed to ensure sustainable and significant improvements in the safety of health care.

Musengezi Intensifies Battle Against Emmerson Mnangagwa

Organisation Reports Mnangagwa To Motlanthe Over Yet To Be Implemented Commission Recommendations

Zimbabwean human rights organisations under the Crisis in Zimbabwe banner have engaged former South African president Kgalema Motlanthe, raising questions and seeking global support in dealing with the never-ending crisis that could have been solved with the implementation of recommendations by a 2018 commission.

President Emmerson Mnangagwa, in the aftermath of the bloody 1 August 2018 shootings of unarmed civilians by the military, appointed a commission then chaired by Motlanthe that made several recommendations that have been largely ignored four years on.

The recommendations included that those soldiers involved in the killing of six unarmed civilians be held accountable but, to date, nothing has happened to them.

Crisis in Zimbabwe Coalition chairperson Peter Mutasa confirmed engaging Motlanthe and other regional leaders to push Mnangagwa to implement the commission’s report.

Mutasa, on behalf of over 80 organisations under the Crisis in Zimbabwe banner, said there was a need for intervention to ensure the implementation of the report.

Motlanthe led South Africa following the departure of Thabo Mbeki from the political scene.

The commission had National Constitutional Assembly (NCA) leader Lovemore Madhuku as a member and also included lawyer Vimbai Nyemba, Zimbabwe’s ambassador to Rwanda Charity Manyeruke and others from different countries as members.

The organisation said it was a concern that four years later, Mnangagwa has continued to ignore the recommendation of the Motlanthe Commission while the country continues on a path of lawlessness and human rights violations.

“As the Crisis in Zimbabwe Coalition, we are deeply concerned over the lack of political will by the Zimbabwean government to implement recommendations of the Motlanthe Commission of Inquiry following the August 1, 2018 army shootings,” Mutasa told The NewsHawks this week.

Mutasa said what has become clear of Mnangagwa’s failure to act is his lack of sincerity in addressing issues raised by the commission.

It is becoming clear that when he instituted the Monthlante Commission, President Mnangagwa was simply playing politics and trying to give a picture of a government that was willing to reform. We have thus engaged His Excellency Kgalema Motlanthe highlighting our concerns over the non-implementation of the recommendations of the Motlanthe Commission of Inquiry,” Mutasa added.

“It is very unfortunate that almost four years after the commission gave its recommendations to the Zimbabwean government, we continue to witness consolidation of authoritarian rule and militarisation of key state institutions as well as the failure to implement reforms that will pave the way for credible polls.”

“The Crisis in Zimbabwe Coalition will continue to seek regional as well as global support in light of the continued closure of democratic and civic space in Zimbabwe. President Mnangagwa’s engagement and re-engagement drive should be anchored on genuine reforms back home. He must walk the talk.”

Zimbabwe has also ignored security sector reforms, electoral reforms, dialogue among other critical recommendations by the commission.

Observers said failure to implement the recommendations by the Monthlante commission will likely lead to another bloody and disputed 2023 elections.

The commission also recommended for those involved in the killing of innocent civilians should be held accountable and allow justice to take its course.

No information has been availed on whether the involved soldiers were punished or not with former Presidential Guard commander Anselem Sanyatwe now Zimbabwe’s ambassador to Tanzania.

Another recommendation from the Motlanthe Commission was the setting up of a “genuine” multi-stakeholder dialogue platform that would have seen the two biggest political rivals engage in talks.

Mnangagwa claims to have met this recommendation by putting up the Political Actors’ Dialogue (Polad) platform that has been snubbed by Citizens’ Coalition for Change (CCC) leader Nelson Chamisa, who described it as an aimless monologue.

CCC To Report Mnangagwa To Parly Over Sikhala Bail Denial

Citizens Coalition for Change (CCC) plans to lobby Parliament over government’s alleged failure to restore  the rule of law, claiming that the democratic space continues to shrink in the country ahead of the 2023 elections.

This follows an incident where CCC leader Nelson Chamisa’s motorcade survived a suspected petrol bomb attack in Chinhoyi while hosting a thank you rally last weekend.

The latest planned lobbying also comes after the courts have denied CCC’s Job Sikhala and Godfrey Sithole as well as 13 CCC activists from Nyatsime bail, a case that has attracted global attention.

“To this end, the CCC is calling for the return to constitutionalism, rule of law, and democratic practice. Our parliamentarians are going to be critical in pushing this envelope particularly to make sure that we advance the principles and values and issues that are raised by ordinary people,” CCC deputy spokesperson Ostallos Siziba said on Wednesday while addressing a Press conference.

“Parliament is going to be a very important zone of our citizens struggle to attempt to resolve some of the crises involving executive tyranny which is basically the control of the executive contrary to the provisions of the Constitution which provides for separation of powers and the current situation we see the dominance of the Executive without such powers provided for by the Constitution.”

Last month election watchdogs such as the Election Resource Centre raised the red flag over the Gokwe-Kabuyuni parliamentary by-election which was characterised by violence.

Political analysts have predicted that next year’s elections will be bloodier. Civic society organisations and the main opposition CCC have implored the United Nations to monitor 2023 polls.

“The visible characteristics of this crisis are continued political repression and of course attack on the members of the democratic contingent, the closure of democratic space, subversion of the Constitution and fundamental rights and freedoms, and the high cost of living,” Siziba added.

“It is, therefore, clear that Zanu-PF as the ruling establishment has absolutely failed to run this country, to resolve the economic crisis facing ordinary people to show care and to show love and necessary dignity that our people deserve as per the provisions of the Constitution.”

Earlier this year Zimbabwe’s human rights record came under the spotlight during a UN Human Rights Council Universal Periodic Review meeting recently.

Member States made extensive recommendations to improve the country’s human rights situation.

Government is yet to implement the recommendations.

Ugly Fights As Zanu PF Central Committee Elections Beckon

Factional fights have erupted in the ruling Zanu PF party ahead of elections for central committee members slated for this weekend.

The central committee is the principal and highest decision-making body of the party, and officials have opened the floor for aspiring members to submit CVs for vetting, with elections to be held on Saturday.

On Friday, the last day of submission, there was a last-minute rush by aspiring candidates to submit CVs.

Zanu PF national political commissar Mike Bimha recently issued a circular on set minimum qualifications for participation in the elections.

A party insider said they had set traditional conditions for one to take part in the central committee elections.

“The central committee can make the drastic decisions of the party and have the power to change the national leadership of the party by calling for a congress unlike all organs of the party. They have set conditions of at least 15 years serving in the party and at least five years in the provincial executive. If you have served at least 15 years in the party you might have a better appreciation of the party,” the source said.

In Manicaland sources, who spoke to this publication, said former Agriculture minister Joseph Made, former finance minister Patrick Chinamasa, former Information minister Christopher Mushohwe, and former local government deputy minister, Christopher Chingosho could fall by the wayside. The quartet will be eager to make it into the top four in the (Makoni) district where Information Communication Technology minister Jenfan Muswere and Shadreck Chipanga are ruling the roost.

“In Makoni district, there is a bid to inject new blood with the likes of Muswere and Chipanga expected to be elected into the central committee, and we are aware that Chingosho is being frustrated,” an official said.

Judge Harassing Me

Women’s Comfort Corner Foundation (WCCF) director Rita Mbatha has written to the secretary of the Judicial Service Commission (JSC) Walter Chikwana alleging threats and harassment by a top judge, Justice Catherine Bachi-Mzawazi.
Mbatha complained to Chikwana alleging that Justice Bachi-Mzawazi was trying to force her to consent to set aside a judgment under Case Number HC49862014.

Under the case, Mbatha was awarded US$180 000 by the High Court after she lost her job for reporting her former boss for sexual harassment in a nearly 20-year legal battle.

Mbatha reported former Confederation of Zimbabwe Industries (CZI) chief executive Farai Bwatikona Zizhou for sexual harassment when she worked as his personal assistant between 2002 and 2003.

The CZI responded by sacking her. In passing judgment last year, Justice Joseph Mafusire said Mbatha’s victory had come through “blood and sweat”.

In a letter dated September 16, 2022, in possession of NewsDay, Mbatha alleged that the judgment infuriated Justice Bachi-Mzawazi.

“She alleged that the judgment was irrational and that Zizhou deserved a second chance and did not deserve to lose property because of a minor infraction and I should, instead, pursue CZI, which had ignored the reports of sexual harassment. I was shocked and called out the judge and told her that it was not proper to make such averments or to invite me in chambers without the applicant present.

“She then alleged that Deputy Chief Justice Elizabeth Gwaunza and the Judge President of the High Court told her she was not the first judge whom I had complained about and that I was wasting my time writing complaints to the JSC as nothing would materialise therefrom,” the letter read.

Mbatha also accused the judge of being conflicted because she was offering legal advice to Zizhou.

“I also told Justice Bachi-Mzawazi that I was aware that she was legally advising Zizhou,” Mbatha said in the complaint.

After refusing to consent to the setting aside of the judgment, Mbatha alleges the judge started to harass and intimidate her.

“She changed from trying to persuade me to being hostile, began shouting at me alleging that I was intent on tarnishing her image. She began shouting in chambers alleging that I had made the same allegations against Supreme Court judges, this time without mentioning names.

“It is Justice Bachi-Mzawazi through her misconduct, conduct unbefitting a judge that has displayed that there is no justice, but an abundance of corruption in the (judicial) system. By her conduct, she has committed breaches of judicial ethics as articulated in the code,” the letter further read.

Allegations against Justice Bachi-Mzawazi come at a time when the Judiciary is under the spotlight for corruption and defeating the course of justice. —Newsday

Fake Products Hit City

A new crop of ‘entrepreneurs’ has invaded Bulawayo’s marketplaces where they sell fake branded products to unsuspecting consumers in broad daylight.

In essence, the traders pretend to sell popular brands at discounted prices, but are really offering low-quality counterfeit products at a profit. They have become notorious for putting fake stickers on products that they will be selling.

Notable products include baked beans, dishwashing liquids and deodorants.

It seems some of the products are smuggled into the country and find their way to markets that sell products at a cheaper price compared to supermarkets, thereby attracting a lot of shoppers.

For customers who know a product’s attributes, the problem starts when they are home when it is time for consumption.

A Chronicle news crew visited the marketplace and spoke to some people who throng the markets and they raised the red flag on the fake branded products.

Mrs Sihle Mlotshwa said she recently bought a tin of baked bins branded “Koo” when it was actually not a genuine product.

“I bought a tin of baked beans branded ‘Koo’, but to my shock when I opened it, the contents were completely different. I usually buy this product because I know the original taste of these beans,” she said.

“The most painful part is that they would have sold a substandard product at a high cost.”

Another consumer, who declined to be named, said selling fake brands is a risky enterprise, which also compromises health particularly for people with allergies.

“You can imagine buying something that you are allergic to without knowing. These traders are putting people’s lives at risk simply because they want to make quick money,” he said.

Mr Moffat Ndlovu who also fell prey to the scam, said he bought his “favourite” deodorant, which had a fake label.

“When l started using it, I developed some rash on my armpits and I had to visit a doctor. I have also noticed that some of the body lotions that these people sell would be half full,” he said.

The news crew also caught up with Ms Elizabeth Ndebele who was equally dismayed after falling into the same predicament.

“I bought a dish washing liquid which had a ‘Sunlight’ sticker, but what surprised me was that upon using it, it was not as thick as it was supposed to be. I went back to the seller and she claimed that she had also bought the products from South Africa,” she said.

“If customers receive a fake product of poor quality and do not realise it is a copy; it will undermine the brand’s reputation. If they realise it is a fake it will create uncertainty in the market and people will be reluctant to buy the product.”

A trader at the marketplace, Ms Lindiwe Nyoni admitted that there are some vendors who dupe customers.

“It is unfortunate that we have some people among ourselves who resort to unethical ways of doing business, which we do not condone as traders. However, in some cases, we would have bought these products from our suppliers who would have tampered with the stickers,” she said.

Bulawayo Vendors and Traders Association (BVTA) executive director Mr Michael Ndiweni said: “I doubt traders are involved in these malpractices because getting the stickers for those brands means one needs to have machines to print them out in large quantities of which most vendors don’t have that capacity.”

Consumer Council of Zimbabwe regional manager for Matabeleland region, Mr Comfort Muchekeza said selling fake products is tantamount to fraud and leads to prosecution of offenders.

“We are all guided by the laws of the country. It is clearly stated that anyone who is found guilty of violating a section of Consumer Protection Act is liable to a fine or imprisonment not less than three months,” he said.

“Those involved in selling such products should be reported to the police. This is tantamount to fraud and when you misinform consumers with regards to the nature and price of the goods.”

Mr Ndiweni, however, said as an organisation they will conduct their own investigations. Bulawayo police spokesperson Inspector Abednico Ncube said no report has been made so far regarding the matter. –Chronicle

Were Speaker And Clerk Of Parliament Bribed To Defend Wadyajena?

By A Correspondent | Reports circulating in parliament have accused the corruption-charged, Gokwe Nembudziya MP, Justice Wadyajena of paying both the Speaker, and the Clerk of Parliament.

The Speaker and the Clerk were still to comment on the allegations at the time of writing.

CIO Operatives Attack American Diplomates

By James Gwati- Diplomatic relations between Harare and Washington DC are at crossroads after President Emerson Mnangagwa’s administration unleashed members of the dreaded Central Intelligence Organisation, CIO on two visiting US senate aides.

In a story published by the US online news portal, foreignpolicy.com, members of the CIO filmed and later trailed two visiting American senate aides. The two diplomats were conducting a meeting with an unnamed human rights activist at a restaurant in the capital.

 Below is the story:

On a late morning in mid-August, two U.S. Senate aides were sitting at an outdoor cafe in Harare, Zimbabwe, with a civil society activist, when someone approached them with a warning.

They were being tailed and filmed by another man in the cafe, whom the spotter suspected was a member of the Zimbabwean government’s security services.

The two aides work for the Senate Foreign Relations Committee and were on an official visit to the southern African country organized in concert with the U.S. Embassy to meet with human rights advocates and other civil society leaders and hear first-hand accounts of Zimbabwe’s deteriorating political and human rights situation under President Emmerson Mnangagwa.

They requested meetings with the Zimbabwean government, most of which were declined.

After departing their meeting with the activist, they got into a U.S. Embassy vehicle, one of a fleet of clearly marked American government cars with diplomatic plates driven by an embassy staffer.

They were driving away when several cars slotted into the road in front of them, to the side, and behind them. Suddenly, their car was boxed in.

At one point, according to one official briefed on the matter, they tried to call the U.S. Embassy for help, but their phones all lost reception, apparently simultaneously.

They were on their own. After a tense standoff, as the phalanx of cars crawled along the road, the driver of the U.S. Embassy car saw an opening and swerved onto a side road to escape the tail.

They rushed back to the U.S. Embassy compound before the pursuing cars could intercept them.

From there, the U.S. Embassy worked to quickly ferry the two Senate staffers out of the country without further incident.

The ordeal, described to Foreign Policy by four current and former U.S. officials familiar with the matter, stunned U.S. diplomats and left them questioning what would have happened to the two Senate aides had the embassy vehicle not been able to make its escape.

All officials spoke on condition of anonymity, as they were not authorized to speak on the matter publicly.

The officials, who suspected Zimbabwean security services orchestrated the entire incident, said it underscored the increasingly brazen tactics of Mnangagwa’s government to suppress and intimidate political opponents and civil society activists as he strengthens his grip on power ahead of national elections next year.

However, all of the officials cautioned that they couldn’t say with certainty who followed the staffers and chased the U.S. Embassy car.

The incident incensed U.S. Sen. Robert Menendez, the chairman of the Senate Foreign Relations Committee, who sent a letter to President Joe Biden informing him of the harassment and car chase his staffers experienced.

In the letter, he urged Biden to step up U.S. attention on the “dire” repressive political atmosphere in Zimbabwe and boost support for the country’s increasingly embattled civil society organizations and pro-democracy activists.

“This blatant aggression towards congressional staff, one of whom—as the Zimbabweans surely know served as a senior advisor to you for many years when you were Chairman and Ranking Member of the Foreign Relations Committee—was meant to intimidate the staff themselves, and to send a message to the United States: our support of Zimbabweans working to defend democracy is unwelcome by those who hold power,” Menendez wrote in his letter to Biden dated Sept. 12, a copy of which was obtained by Foreign Policy. Menendez did not name the two staffers in his letter.

“Such outrageous behavior highlights the Zimbabwean regime’s reckless disregard for international norms. If American officials are deliberately targeted, you can well imagine the violence that will be directed to Zimbabweans who dare to criticize the government.”

Menendez in his letter pushed Biden to bring up the political situation in Zimbabwe with South African President Cyril Ramaphosa during their scheduled meeting at the White House on Friday. Menendez’s office did not offer additional comment on the matter.

Galloway Receives Marching Orders

Plymouth Argyle defender Brendan Galloway received a red card just twenty minutes after coming on as a second half substitute in the League One 2-2 draw against Portsmouth.

The Warriors right-back started on the bench and came on in the 70th minute.

With his team leading 2-1 in the 89th minute, Galloway received a caution for delaying the restart on a throw-in.

The 26-year-old was then involved in an altercation with the opposite player a few moments later.

The incident resulted in another yellow card for the fullback.

The expulsion proved costly for Argyle, who left short at the back, and conceded a goal with the last kick of the match.

This is Galloway’s first red card in eight years, and a second in his senior career.

City Shoot To EPL Summit

Manchester City Saturday beat Wolves by three goals to nil to leap above Arsenal on the log table. Arsenal have a game in hand and can still reclaim the spot if they win against Brentford tomorrow.

Highlights:

The reigning champions got their first goal in less than a minute after De Bruyne played the ball into the centre for Grealish to poke home.

Haaland scored City’s second to bring his Premier League goal tally to 11 in seven games. The Norway international who was named the Player of the Month of August became the first player in Premier League history to score in their first four away games.

Wolves’ Collins saw a straight red card after a reckless challenge on Grealish, which certainly did not help Wolves’ attempt to get back into the game.

Despite the home side looking brighter in the second half, City were just too good, and they scored a third through Foden.

Belgian playmaker, Kevin De Bryne made two assists, one for Jack Grealish and another for Phil Foden.- Pindula News

Facts About Basic Hygiene

Half of health care facilities worldwide lack basic hygiene services with water and soap or alcohol-based hand rub where patients receive care and at toilets in these facilities, according to the latest Joint Monitoring Programme (JMP) report by WHO and UNICEF.

Around 3.85 billion people use these facilities, putting them at greater risk of infection, including 688 million people who receive care at facilities with no hygiene services at all.

“Hygiene facilities and practices in health care settings are non-negotiable.

Their improvement is essential to pandemic recovery, prevention and preparedness. Hygiene in health care facilities cannot be secured without increasing investments in basic measures, which include safe water, clean toilets, and safely managed health care waste,” said Dr Maria Neira, WHO Director, Department of Environment, Climate Change and Health.

“I encourage Member States to step up their efforts to implement their 2019 World Health Assembly commitment to strengthen water, sanitation and hygiene (WASH) services in health care facilities, and to monitor these efforts.”

The latest report, “Progress on WASH in health care facilities 2000–2021: special focus on WASH and infection prevention and control”, has for the first time established this global baseline on hygiene services – which assessed access at points of care as well as toilets – as more countries than ever report on critical elements of WASH services in their hospitals and other health centres. For hygiene, data are now available for 40 countries, representing 35% of the world’s population, up from 21 countries in 2020 and 14 in 2019.

The newly established global estimate reveals a clearer and more alarming picture of the state of hygiene in health care facilities. Though 68% of health care facilities had hygiene facilities at points of care, and 65% had handwashing facilities with water and soap at toilets, only 51% had both and therefore met the criteria for basic hygiene services. Furthermore, 1 in 11 (9%) of health care facilities globally have neither.

“If health care providers don’t have access to a hygiene service, patients don’t have a health care facility,” said Kelly Ann Naylor, UNICEF Director of WASH and Climate, Environment, Energy, and Disaster Risk Reduction (CEED).

“Hospitals and clinics without safe water and basic hygiene and sanitation services are a potential death trap for pregnant mothers, newborns, and children. Every year, around 670 000 newborns lose their lives to sepsis. This is a travesty – even more so as their deaths are preventable.”

The report notes that contaminated hands and environments play a significant role in pathogen transmission in health care facilities and the spread of antimicrobial resistance.

Interventions to increase access to handwashing with water and soap and environmental cleaning form the cornerstone of infection prevention and control programmes and are crucial to providing quality care, particularly for safe childbirth.
Coverage of WASH facilities is still uneven across different regions and income groupings:

Facilities in sub-Saharan Africa are lagging on hygiene services. While three-quarters (73%) of health care facilities in the region overall have alcohol-based hand rub or water and soap at points of care, only one-third (37%) have handwashing facilities with water and soap at toilets.

The vast majority (87%) of hospitals have hand hygiene facilities at points of care, compared to 68% of other healthcare facilities.
In the Least Developed Countries, only 53% of health care facilities have access on-premises to a protected water source.

To compare, the global figure is 78% with hospitals (88%) doing better than smaller health care facilities (77%), and the figure for eastern and south-eastern Asia is 90%. Globally, around 3% of health care facilities in urban areas and 11% in rural areas had no water service.

Of the countries with available data, 1 in 10 health care facilities globally had no sanitation service.

The proportion of health care facilities with no sanitation services ranged from 3% in Latin America and the Caribbean and in eastern and south-eastern Asia to 22% in sub-Saharan Africa. In the Least Developed Countries, just 1 in 5 (21%) had basic sanitation services in health care facilities.
The data further reveals that many health care facilities lack basic environmental cleaning and safe segregation and disposal of health care waste.
The report is being launched at World Water Week taking place in Stockholm, Sweden.

The annual conference, which runs from 23 August to 1 September, explores new ways to tackle humanity’s greatest challenges: from food security and health to agriculture, technology, biodiversity and climate.

Police Miss Fidelity Armed Robbers

By-Police in Bulawayo Saturday missed armed robbers who pounced on Fidelity Building in Bulawayo and got away with US$6270 and ZAR5 000.

Fidelity is a 12-story building between 11th Avenue and Fife Street in Bulawayo’s Central Business District (CBD).

ZRP said the robbers escaped before officers arrived and cordoned off the area.

Police spokesperson Paul Nyathi further confirmed the incident saying the suspected robbers pounced on a Women Empowerment Trust housed in the building that also acts as a money transfer agent.

He said they also harassed customers queuing to get their money and allegedly locked into a room. Nyathi told Sunday News:

The ZRP is investigating an armed robbery incident which occurred at a Women Empowerment Trust at 6th Floor, Fidelity Building, Bulawayo where two armed robbers pounced and got away with US$6 270 as well as R5 000. The company is also involved in money transfer. They also harassed customers who wanted to collect and deposit their money.

He said police reacted swiftly to information and cordoned off the building with initial reports indicating that the robbers were still inside the building.

Nyathi said on entering the building, the police realised that the robbers had already sneaked out when they got to the scene.

Sources said police then looked at the closed-circuit television (CCTV) footage in the building, and observed the two suspected robbers in the act.

The suspects reportedly fled in a white Honda Fit vehicle, and by the time security personnel in the building alerted the police, the suspects had escaped.

Armed Robbers Escape With US$6K

By-Armed robbers Saturday pounced on Fidelity Building in Bulawayo and got away with US$6270 and ZAR5 000.

Fidelity is a 12-story building between 11th Avenue and Fife Street in Bulawayo’s Central Business District (CBD).

Reports suggest that the robbers escaped before police arrived and cordoned off the area.

National police spokesperson Assistant Commissioner Paul Nyathi confirmed the incident saying the suspected robbers pounced on a Women Empowerment Trust housed in the building that also acts as a money transfer agent.

He said they also harassed customers queuing to get their money and allegedly locked into a room. Nyathi told Sunday News:

The ZRP is investigating an armed robbery incident that occurred at a Women Empowerment Trust at 6th Floor, Fidelity Building, Bulawayo where two armed robbers pounced and got away with US$6 270 as well as R5 000. The company is also involved in money transfer. They also harassed customers who wanted to collect and deposit their money.

He said police reacted swiftly to information and cordoned off the building with initial reports indicating that the robbers were still inside the building.

Asst Comm Nyathi said on entering the building, the police realised that the robbers had already sneaked out when they got to the scene.

Sources said police then looked at the closed-circuit television (CCTV) footage in the building, and observed the two suspected robbers in the act.

The suspects reportedly fled in a white Honda Fit vehicle, and by the time security personnel in the building alerted the police, the suspects had escaped.

Political Paranoia and Mud Smearing Tactics Season

By Womberaiishe Tirivangani Nhende

For avoidance of assumed positions , let me be clear as l begin that whatever l write remains my right as l write and anyone with contrary assertion shall be free to engage at whatever level and to whatever extend except the extent to silence my keypad.

I write what l want !!! Let me depart !!I have opined before on various occasions and matters in the political matrix of then MDC Alliance and now the CCC and l shall continue to do so .

As President Nelson Chamisa envisioned the 2023 plebiscite, his modus oparandi became non conformed to what used to be and what some assume used to be. This strategy has brewed anxiety not only within but also outside the confines of the party as those who scheme politically are left schemeless and guessing of President Chamisa’s next move except for a few in the know.

This remains a very smart move !!Any person inteligent or otherwise can agree that scheming for internal or external forces has been relegated to the periphery leaving political trajectories highly skewed towards paranoia.

As the paranoia increased time and again internal jostling for favour has gained traction thus the beginning of a new era of mud smearing , name calling and bootlicking on steroids , whilst all this is shaping on Facebook, Twitter and not sparing wordpress ; political competence has already been shelved.

The fight for proximity to number 1 is already messy and Zanu PF as usual is focused on its campaign trail and on the periphery is also focused on influencing narrative in the opposition camp and this has been a long term project which included media capture and many other social media shenanigans ( a topic for another day).

Excitable social media characters must fasten seat belts as facebook and Twitter shall be the arena for mud smearing and bootlicking as camps in the political matrix seek to outsmart and taint each other in the opposition. Not to be spared shall be civil society and much to the delight of Zanu PF and its PVO bill ( we are such a bunch of fools).

As you watch biggest loser on Dear Steve , opposition will suffer same fate as a result of PVO and internal mud smearing.I speak from a perspective of someone who has learnt what it means sending an audio to an inbox and then listen to it later on an online tabloid.

We have witnessed many being recorded whilst having discussions and such recordings being publicized for political millage.

President Nelson Chamisa has made it very difficult for those with ambitions to focus on zvigaro because noone knows the process which guarantees chigaro thus all are working hard to register voters , some post fake stats on that ( a story for another day).

This has actually managed to stabilise the party towards the plebiscite as well as increase kugwaza, although rumours and political grapevine remains vile on candidate selection and purported formation of a new structure.

This has increased the Paranoia and Mud smearing tactics. Behold and lo this is the season, brace yourselves as its going to be an interesting season of Facebook and Twitter mud smearing and bootlicking.

Happy Sunday Everyone

Bruce Grobbelaar and his sports betting scandal

Bruce Grobbelaar was voted Liverpool’s second-best goalkeeper and seventh in Zimbabwe. In his long career, he has achieved many heights, won several important titles, and earned himself a good name, but he has not been without negative stories.

It turned out that during his career, he had bet several times on the matches he took part in and then influenced the course of the game to make money. Many soccer players and athletes around the world gamble and bet. But it’s one thing to go to topcadcasinos.net to find casinos for Canadian dollars and another to bet on your own games in which you take part.

For example, according to the Sun newspaper, in November 1994, Grobbelaar arranged for Chris Vincent to place a bet on Newcastle to win the upcoming game against Liverpool. Recall that Bruce, at that time, was the main goalkeeper of the Merseyside team and may well influence the result.

In that game, Newcastle won 3-0, and Andy Cole scored all three goals. And one of the goals was quite ridiculous: Grobbelaar suspiciously missed the ball between his hands, although he could have obviously grabbed it. For this match, Bruce earned 40 thousand pounds, but later on, soccer experts said it was impossible to catch the ball in that situation.

The second contracted match by Grobbelaar was Southampton against Coventry. At the time, he was on loan at Southampton and apparently needed some extra money. Despite his best efforts and an own goal, Bruce failed to cash in on the bet as his team rallied and made a combo, winning the game 3-1 at the end.

The third time, Grobbelaar also failed to make money on a bet on his own team, although he did his best to do so. He was promised £50,000 if Manchester City beat Southampton by a margin of one goal. Luck again turned away from Bruce, and that meeting ended with a score. Experts also stated that the goalkeeper could not have influenced any of the missed goals.

Despite the accumulated experience in match-fixing, luck turned away from Grobbelaar in the future. For example, in the game against Manchester United, he purposely jumped to the wrong side of the ball but still accidentally kicked it, which cost him £125,000 in potential winnings.

But the story didn’t end there. The independent media found out that Vincent, a friend of Grobbelaar, who told all these facts about rigged matches, was promised 33,000 pounds by the Sun for detailed data, which discredited him.

Mwonzora Says Let’s Dialogue With Mnangagwa To Get Much Needed Electoral Reforms

MDC-T leader Douglas Mwonzora on Wednesday said political and electoral reforms in the country will only come through dialogue, not confrontation.

Mwonzora said ZANU PF has a huge majority in Parliament, therefore, political parties should come to the negotiating table to discuss ways to move the country forward.

Addressing journalists at the Bulawayo Media Centre on Wednesday, Mwonzora said:Our position as a party is that we cannot avoid dialogue in order to achieve key reforms. The reality we have to live with is that ZANU PF enjoys a supermajority in Parliament, and they have been the majority since 2013.

If we are to go via dialogue, it means that we agree and what we would have agreed will then be processed through Parliament. If we are to amend the Electoral Act, for example, we need to agree and cooperate with legislators from across the political spectrum.

Mwonzora said in the history of Zimbabwe, key political reforms have come through dialogue and he cited the Lancaster House agreement of 1979 which brought about the majority rule in the country and the 1987 Unity Accord which brought an end to Gukurahundi.

He said:This is what happened throughout the history of the country. In 1979, the issue of majority rule was a key political reform, and it came via dialogue. The disturbances in Matabeleland after independence were stopped via dialogue which led to the signing of the Unity Accord between the warring parties.

People can argue about the content of the Unity Accord itself and whether one party won more than the other, but that is beside the point at this point and time. The fact of the matter is that the Accord came via dialogue.

Mwonzora also cited the talks between ZANU PF and the two MDC formations facilitated by SADC in 2008 which culminated in the signing of the Global Political Agreement (GPA) and the formation of the Government of Unity (GNU) in 2009.

Former Minister Appeals Against Conviction For Corruption

FORMER Public Service, Labour and Social Welfare minister Petronella Kagonye (pictured), who was slapped with a 36-month jail term in June this year for corruption, has appealed for bail pending appeal at the High Court while also filing papers to overturn the conviction and sentence.

Advocate Lewis Uriri, who represented the disgraced former minister and was instructed by lawyer Rungano Mahuni, confirmed the development.

The matter is being handled by Justice Pisirai Kwenda.

Kagonye was found guilty of converting to her own use some 20 computers which were donated through her by the Posts and Telecommunications Regulatory Authority (Potraz). The equipment was meant to benefit schools in the Zanu-PF politician’s Goromonzi South constituency in 2018.

Harare magistrate Vongai Muchuchuti,  who found her guilty of the charge, set aside 12 months of the imprisonment term for five years on condition of good behaviour.

A further eight months were set aside on condition she restituted US$10 000, equivalent to the laptops she stole.

The politician’s woes began in June 2018 when she wrote to then Information Communication Technology minister Supa Mandiwanzira requesting computers to donate to schools in her constituency.

On 20 June 2018, Mandiwanzira then wrote to Potraz requesting facilitation of the donations through its e-learning project to Goromonzi South schools.

Potraz donated the computers to Kagonye, who sent her brother Evans Kagonye to collect them on her behalf.

Potraz later made a follow-up on the donation, but the computers could not be accounted for.

The NewsHawks gathered that a few days after her conviction, she made frantic freedom bids to get out of jail, but her husband was advised that the appeals could only be tabled after 10 working days.

After the lapse of the days, she immediately filed papers for appeal under case number HACC (B) 112/22 at the High Court.

In her heads of argument as presented by Uriri, Kagonye said she was seeking her admission to bail pending appeal against both conviction and sentence on a charge of theft of trust property as defined in terms of section of the Criminal Law (Codification and Reform) Act [Chapter 9:23] by the regional magistrate, Eastern Division [Anti-Corruption Court] sitting at Harare on 8 June 2022.

“The primary issue for determination is whether applicant is in the circumstances entitled to bail pending appeal. The applicant has in her application canvassed the considerations relating to the grant of an application for bail pending appeal.  It is submitted that the application has merit and ought to be allowed,” Uriri argued.

“These heads were filed when the applicant has not had an opportunity to consider the respondent’s papers. Therefore, they might not touch on issues that the respondent might raise in their response. The heads focus on issues arising from the application and motivate the application for bail pending appeal filed before the court. These heads start by addressing the legal principles applicable in bail pending appeal applications.”

The former minister also argued that the provisions of section 123 (1) (b) (ii) of the Criminal Procedure and Evidence Act as augmented by the provisions of section 123 (2) of the Act make her a deserving candidate for bail pending appeal.

“The import of the above provisions when as appropriately modified, is that bail pending appeal is a right on the same footing as bail pending trial. It therefore necessarily follows that the grounds set out in sections 117(2) and (3) of the Act come into play together with the common law on bail pending appeal suitably adapted to the statutory framework of section 117 (1) thereof,” read part of the heads of argument.

Uriri confirmed that the arguments had been put to the High Court.

“We are now at a stage where we are waiting for the judgement. It was reserved, but we are confident that the courts will rule in our favour,” he said.

The NewsHawks also obtained papers of Kagonye’s notice of appeal against conviction and sentence which is under case number CRB ACC/10/21 at the High Court.

Through her lawyers, again led by Advocate Uriri, Kagonye said the magistrate who convicted her misdirected herself.

“The court a quo erred and misdirected itself on the principles relative to the discharge of an accused person at the close of state case and in not acquitting the appellant at the close of the state case in view of the fact that, at that stage, no evidence had been lead relative to the essentials of the charge vis a trust agreement in the terms alleged by the state and appropriation of trust property or failure to account for the same.”

“The court a quo erred and misdirected itself on the facts and the evidence in holding as it did, that the property the subject of the charge was held in trust for schools in the Goromonzi constituency and in thus regarding direct real evidence that the direct real evidence that the said property was for the benefit of the needy in the said constituency.”

“The property having been donated for a specific person, and the purpose having been properly undertaken, the court a quo erred in holding that the appellant had a duty to account for the same and failed to do so,” reads the appeal papers.

Other Zanu-PF officials who have been prosecuted for acts of corruption by Zimbabwean courts still walk free.

They include former Local Government minister Ignatius Chombo, Gokwe Nembudziya legislator Justice Mayor Wadjajena, former Public Service minister Prisca Mupfumira as well as former legislator Psychology Mazivisa.

Zimbabwe Plans to Legalise Online Gambling to Boost Revenue Collection

Apart from being known for its landscapes and epic safari, Zimbabwe boasts many active gamblers. In fact, due to economic hardship in the country resulting in unemployment, income loss, and job instability, gambling is one of the residents’ resources. Gambling has always been practised in the country but has grown over the last few decades.

When previously Zimbabweans viewed gambling as a harmless entertaining activity, it started becoming popular among them as it was exposed to various technological advancements. The Lotteries and Gambling Board (LGB) controls and monitors the gaming industry operations in Zimbabwe, which is completely outdated and irrelevant to how online gambling works. Today, the country is moving forward with plans to legalise online gambling to boost revenue collection.

Gambling Regulation in Zimbabwe

Gambling is completely legal in Zimbabwe and is under the responsibility of the Lotteries and Gambling Board (LGB), established with the enactment of the Lotteries and Gaming Act in 2000. This body regulates and supervises gambling areas such as the popular state-run lottery, land-based casinos, sports betting, and horseracing.

Online gambling has shown incredible growth in Zimbabwe, with most players using their mobile devices to access online casinos. Nevertheless, it remains an unregulated sector with no specific laws prohibiting or legalising online gambling. As the current Lotteries and Gaming Act is obsolete and does not adequately cover online gambling, the laws need to be set for revision.

In fact, the initial version of gambling regulations was introduced in 1998 and was amended in 2001 and 2002. It has not yet been updated for over 20 years. Therefore, Zimbabwe should ramp up efforts to legalise online gambling for the purpose of enabling players to bet freely on overseas online casino sites without fear of prosecution.

Amendments to the Lotteries and Gaming Act

As Zimbabwe’s original version of gambling laws was introduced in 1998, it is no longer appropriate to the players’ needs. As stated by the Minister of Home Affairs Kazembe Kazembe, the cabinet had received and approved the amendments to the Lotteries and Gaming Act with the goal of increasing revenue from the gambling industry.

Kazembe explained that essential amendments to the Act included provisions enabling top websites for online gambling to embrace innovations adapted to LGB acts for monitoring and control purposes. The Minister of Home Affairs also stated that the government missed the opportunity on a profitable sector with the profits from which are remitted to unregulated gambling operators.

The regulator, the Lotteries and Gaming Board, would continue to supervise and guide the unregulated operators. Kazembe added that the new laws ensured that operators applied for a licence and reduced criminal activities related to gambling in the country. The President’s advisor Christopher Mutsvangwa was confident that the change would ensure revenue for the country while reducing money-laundering risks.

Benefits of Future Changes Regulation of Virtual Gambling

Increasing Revenue Collection

Apart from the tourism sector, gambling is also a considerable contributor to the economy of Zimbabwe. Actually, the country is one of the largest concentrations of land-based casinos in the African continent, with up to 22 gambling establishments spread across 11 cities.

The gambling winnings in this country are generally subject to a flat 10% tax for sports betting and horse racing and 15% for casino gambling. This means that gambling revenues represent a significant part of the GDP in this southern African country.

For example, by 2020, the online casino market is set to be worth $60 billion, meaning a huge amount of tax revenue. In 2017, online gambling experienced a growth of 50.8%, which is chiefly driven by social networking sites like Facebook and WhatsApp. The lack of proper regulation in the flourishing industry permits black market operators to accumulate vast amounts of revenue.

Safer Gaming Environment

Web-based gambling industry is prone to different types of gambling-related crimes. Money laundering, underage gambling, and frauds are common problems related to gambling. Hence, heavy regulation is needed to fight against these issues. In Zimbabwe, the lack of relevant regulation leaves Zimbabwe gamblers unprotected.

Therefore, under the supervision of state regulation, the gambling environment is ensured to be safe, fair, and transparent. All gambling sites operating in the country should comply with any laws to promote responsible gambling and minimise gambling-related crimes.

Moreover, when legalising the online gambling industry, the state is also responsible for supporting and treating players with gambling problems. Zimbabwe should learn from other countries and experiences to help make the right decision regarding online gambling regulation. For instance, Zimbabwe can use the experience of the UK, where strict regulations allow the gambling environment to grow in a supervised and responsible way.

Conclusion

Gambling is a thriving industry in Zimbabwe, with several land-based casinos spreading throughout the country. The Lotteries and Gambling Board is a regulatory body that covers the regulation of land-based casinos, national lotteries, sports betting, and horseracing.

This body was set up under the Lotteries and Gaming Act in 1998 and was reformed in 2002. Nonetheless, the country hasn’t yet made internet gambling laws despite the booming of this sector. Zimbabweans, hence, turn to offshore online casinos, which can be insecure. The state plans to legalise the online gambling sphere by reforming the gambling laws there.

This new regulation will boost the country’s revenue and provide a safer gambling environment. The players will be able to choose trustworthy sites while applying responsible gambling.

Mwonzora “Pours Cold Water” On Gukurahundi

By-MDC-T leader Douglas Mwonzora has sanitised the Gukurahundi massacres and heaps of praises on Zanu PF.

Mwonzora, who was in Bulawayo Wednesday, said like what happened to end the Gukurahundi atrocities in the 1980s, political and electoral reforms in the country would only come through dialoguing with Zanu PF.

Addressing journalists at the Bulawayo Media Centre , Mwonzora said:

Our position as a party is that we cannot avoid dialogue in order to achieve key reforms.

The reality we have to live with is that ZANU PF enjoys a supermajority in Parliament, and they have been the majority since 2013.

If we are to go via dialogue, it means that we agree and what we would have agreed will then be processed through Parliament.

Mudha Says Mnangagwa Has Won 2023 Polls

FORMER State Security minister Owen Ncube yesterday described the opposition Citizens Coalition for Change (CCC) as an enemy of the ruling party and encouraged Zanu PF supporters to defend the party against the opposition’s inroads.

Ncube, who is the Zanu PF Gokwe-Kana Member of Parliament, made the statement while addressing ruling party supporters at a Gweru inter-district meeting in the Midlands capital on Tuesday.

“Our President (Emmerson Mnangagwa) has won the 2023 presidential election. It is only Zanu PF which must rule this country not the opposition because liberation fighters sacrificed for this country,” Ncube declared.

He then turned his anger on the divisions in Zanu PF particularly in the Midlands province saying: “The enemy is not in our (Zanu PF) party. The enemy is the CCC led by Nelson Chamisa.

“So do not waste your time fighting in Zanu PF. Midlands should be united under the chairmanship of Larry Mavima. As we approach the 2023 elections, the enemies of the revolution are growing in number and, therefore, as youths you should be defending the revolutionary party and Mnangagwa.”

CCC deputy spokesperson Gift Siziba said Ncube’s statement exposed Zanu PF’s fear of electoral defeat in the 2023 elections.

“For the former minister Mudha to say this, it shows the level at which the country is in dire need of leadership,” Siziba said.

“The words are a clear sign that the centre is failing to hold. It is a clear sign that Zanu PF is focusing on power retention instead of addressing the welfare of our people. Zanu PF is failing to address the plight of teachers and other public workers, students are failing to access education because of its failed policies.”

Ncube was alleged to be linked to a violent mob known in the Midlands province as Al Shabaab before his appointment as State Security minister.

He was fired as minister in January this year on charges of instigating post-election violence in Zanu PF’s Midlands province after the party’s disputed December provincial elections.

In 2019, the United States cited him for “gross violations of human rights” and added him to its sanctions list.

“In his role as the minister of National Security, Ncube, with the support of other Zimbabwean government officials, ordered the Zimbabwean security services to identify, abduct and mistreat individuals assumed to be supporters of a Zimbabwean opposition group,” the US State Department said then.

“In addition, while in his position, the government of Zimbabwe has at times used so-called “ferret teams” to abduct and beat individuals deemed to be a threat to the ruling Zimbabwe African National Union Patriotic Front. Ncube is being designated for being responsible for, or participating in, human rights abuses related to political repression in Zimbabwe.”

Ncube’s threats against the CCC follows recent acts of political violence against opposition members by suspected Zanu PF activists, with Chamisa raising fears over his safety after a suspected hand grenade exploded a few metres from the venue of his campaign rally in Chinhoyi on Sunday.

A latest human rights’ situational report by the Zimbabwe Peace Project, listed Zanu PF as the leading perpetrator of violence in August during which 257 rights abuses were recorded.

Zanu PF has, however, denied the charges.

This is not the first time that senior Zanu PF officials have declared that only a Zanu PF leader should rule this country.

In June this year while addressing ruling party supporters at Bata Shoe Company in Gweru, Mnangagwa said the opposition would never rule Zimbabwe because Zanu PF was the sole custodian of the country’s liberation history.

President Chamisa In Crucial Meeting With Councillors

Tinashe Sambiri|CCC councillors have declared they will never abandon the people’s struggle.

The CCC councillors assured party leader President Nelson Chamisa they were ready to fight for freedom from Zanu PF oppression.

President Chamisa held a crucial meeting with CCC councillors in Harare on Thursday.
