Rights Lawyers Protest Halting Of School Head Trial Who Assaulted A Person With Disability

Human rights lawyers have protested against crass travesty of justice in a case in which the trial of a school headmaster for assaulting a person with disability, was halted for close to one year because of an alleged failure to secure a sign language interpreter to assist in trial proceedings.

In a complaint letter written and delivered to the Resident Magistrate at Mutoko Magistrates Court on 24 January 2024, Kelvin Kabaya and Tinashe Chinopfukutwa of Zimbabwe Lawyers for Human Rights, protested that the National Prosecuting Authority (NPA) had in March 2023 withdrew charges preferred before plea against Tendayi Nyambuya, the Headmaster at Kachimana Primary School in Mudzi in Mashonaland East province, who had been scheduled to stand trial answering to charges of assault as defined in section 89 of the Criminal Law (Codification and Reform) Act.

Nyambuya assaulted Karota, who was one of the people who were in attendance at a School Development Committee meeting held at Kachimani Primary School, where the school head had an altercation with a fellow teacher during the meeting in the presence of parents and guardians.

Karota was reportedly shoved by Nyambuya and fell on the ground resulting in him sustaining an injury on his hand.

Kabaya and Chinopfukutwa complained about the withdrawal of the charges before plea, by the NPA, whose prosecutors argued, was meant to enable the Magistrate to secure an interpreter to assist Kudzanayi Karota, the complainant in the matter, who suffers from a speech impairment.

The human rights lawyers charged that since the withdrawal of the charges and the stoppage of the assault trial in March 2023, the matter has not been re-enrolled and an interpreter has not been appointed for purposes of commencement of the trial of Nyambuya.

Kabaya and Chinopfukutwa protested that the inordinate delay in commencement of the trial of Nyambuya violates Karota’s right to equal protection and benefit of the law and the right to access to the courts as provided for in section 56 and 69 of the Constitution.

The human rights lawyers asked the Resident Magistrate to take immediate steps to appoint a requisite interpreter to facilitate the commencement of Nyambuya’s trial.

Kabaya and Chinopfukutwa asked the Resident Magistrate to bear in mind the individualised needs of Karota so as to ensure that she will be able to understand and follow court proceedings due to the unique nature of her disability.

The lawyers asked the Regional Magistrate to consider invoking the provisions of section 319A-H of the Criminal Procedure and Evidence Act, which entails appointing an intermediary or support person for Karota, for purposes of trial and to also consider an expert assessment in order to ascertain the nature and extent of her impairment, the nature and extent of her communication skills, and how to maximise effective communication with the court.

Sikhala Sentencing Set For 15 February

Former Zengeza West legislator Job Sikhala will be back in court on Thursday 15 February for sentencing by Harare Magistrate Feresi Chakanyuka.

Sikhala was last week convicted of communicating falsehoods.

In his mitigation, Sikhala’s lawyer Harrison Nkomo told the court that the former Citizens Coalition for Change member was convicted using a section of the constitution that was declared unconstitutional.

Nkomo also said Sikhala is a family man with 11 children and 14 dependants.

He also told the court that the High Court had earlier acquitted journalist Hopewell Chin’ono after he was arrested for a similar offence.

Nkomo pleaded with the court to give Sikhala a wholly suspended sentence.

ZEC Bemoans High Number Of Litigations Before 2023 General Elections

The Zimbabwe Electoral Commission (Zec) has revealed that it attracted over 100 court cases over the secrecy and controversy surrounding its handling of the August 2023 elections with some still pending.

Zec was taken to court over its refusal to release voters’ roll, controversy over the delimitation exercise, and nomination fees among others.

The opposition Citizens Coalition for Change (CCC) filed the majority of the courts’ cases as it raised various complaints against the electoral body.

Former CCC leader Nelson Chamisa has refused to accept the election results accusing the Zec of rigging the polls in favour of Zanu-PF.

Election observers also flagged Zec over its mishandling of some election processions in the lead up to the polls,denting its credibility.

In its 2023 harmonised election report submitted to Parliament last week, Zec described the court challenges as some lawfare to discredit the election management body.

Zec said the court cases derailed its preparation for the general elections, which resulted in delays in the deliverance of ballot papers in Harare and Bulawayo.

“The ballot paper and voters’ rolls for the 2023 harmonized elections were printed by the Printing and Minting Company of Zimbabwe (PMCZ) formerly Fidelity Printers,” Zec said in the report.

“The commission faced challenges in the production and distribution of ballot papers.

“These challenges emanated largely from what has now come to be called lawfare against the commission.

“The commission faced an unprecedented number of court challenges (more than 100 applications) arising from the outcome of the nomination courts.

“These court challenges derailed its preparations and road map as it sought to attend to the court challenges and to meet the proclaimed electoral timeline.”

CCC accused Zec of deliberately withholding ballot papers in Harare and Bulawayo, the opposition strongholds to assist Zanu-PF’s victory.

Voting was extended in Harare and Bulawayo as a result.

But Zec said it prioritised distant places rather than Harare, which was close to the printing company.

“The production and distribution strategy adopted by the commission prioritised the remote and more distant provinces to ease distribution challenges against limited timeframes,” Zec said.

“Thus it should be noted that delays were largely experienced in Harare because the printing and distribution was done last due to the province’s proximity to the printer.

“In a few reported cases of Bulawayo and other areas, delays were occasioned by the need to reprint ballots after it had been observed that there were errors on the ballots that had been sent to the affected polling stations.”

Zec said some of the cases that were filed during the run-up to the August 23 and 24 election were still pending.

Zec, however, said the litigious political environment was a testimony that Zimbabweans were becoming conscious of their rights.

“One will be tempted to submit that our society is becoming more and more litigious which is probably a sign that more and more people are becoming aware of their rights,” Zec said.

“However, such litigation was not without its drawbacks in the preparation for the conduct of the elections.

“Some cases are still pending before the courts, albeit many were dealt with before the polling day.

While debating the report in Parliament on Wednesday last week, Zanu-PF legislators commended Zec for managing the elections with transparency and accountability.

“There should be pre-defined periods whereby all court cases should be cleared to give the commission and the printer adequate time to print the ballots.

“The recommendation in (a) refers also to withdrawals by candidates, there should be a specified timeframe where candidates should not be allowed to withdraw in order to have adequate printing time.”

MJOLO BLAME: Women In Court After Viral Assault Video

In a shocking incident that has sparked widespread outrage on social media, five women from Hatcliffe Extension, Harare, have appeared in court over the weekend, facing assault charges. The group, identified as Zelpa Kanduza, Natasha Kanduza, Fortunate Tembo, Olleyn Vinyungwi, and their accomplice Mitchel Kariwo, were charged with assaulting Alice Chaichai, 32, whom they accused of having an affair with Zelpa’s husband.

The disturbing episode unfolded on February 1, around 1pm at stand number 4088 Hatcliffe Extension, Harare. According to prosecutor Ms. Grace Mugocheke, the accused persons sought out Chaichai, confronting her with allegations of an affair. Despite Chaichai’s denial, the situation quickly escalated as she was forcibly dragged out of her house by her braids, subjected to a brutal beating, and undressed by the group, leaving her unconscious and severely injured.

The court heard that the accused took turns punching and kicking Chaichai, stripping her of her clothes in a humiliating assault that was eventually halted by the intervention of a well-wisher. The victim sustained serious injuries, including an eye injury and bruises on her legs, requiring hospital admission.

The first of the accused, Mitchel Kariwo, was apprehended and brought before magistrate Mr. Dennis Mangosi on Friday, while the others appeared before magistrate Ms. Evelyn Mashavakure and were remanded in custody pending a bail application.

Zambia’s Opposition Official Arrested In Harare

By Political Reporter-a member of Zambia’s former ruling party, the Patriotic Front (PF), Chishimba Kambwili, was arrested and deported to Lusaka.

Kambwili was deported from Zimbabwe and returned to Zambia after spending at least nine days in custody.

Kambwili had sought refuge in Zimbabwe on January 30, 2024, allegedly for medical treatment with the assistance of a Zimbabwean citizen.

However, upon his arrival, Zimbabwean authorities arrested him.

Zambia’s Home Affairs Minister, Jack Mwiimbu, confirmed that Kambwili was handed over to Zambian authorities at the Chirundu border post on Thursday, February 8, 2024, at 23:00 hours.

Currently admitted to Maina Soko Hospital in Lusaka, Kambwili’s health condition is under assessment.

Minister Mwiimbu addressed the media in Mushindamo District, clarifying that Kambwili had entered Zimbabwe illegally and voluntarily surrendered his passport to immigration officers at the Chirundu border upon their request.

He stressed that the Zambian government did not seize Kambwili’s passport or impede his travel for medical purposes.

Minister Mwiimbu reiterated the collaborative efforts between the Zambian and Zimbabwean governments in locating Kambwili, deemed an illegal immigrant in Zimbabwe due to his unauthorized entry.

Consequently, Zimbabwean authorities decided to deport him, a decision Minister Mwiimbu commended.

Responding to social media claims of mistreatment, Minister Mwiimbu highlighted President Hakainde Hichilema’s directive to provide Kambwili with access to medical care, irrespective of his criminal record and political affiliation.

He underscored the government’s dedication to ensuring the well-being of all citizens, exemplified by Kambwili’s evacuation for medical attention.

Komichi Taints Job Sikhala New Political Project

By Political Reporter- In the aftermath of his release from prison, Job Sikhala’s efforts to establish a broad-based mass democratic movement in Zimbabwe have encountered scepticism due to his alignment with Morgen Komichi.

Critics argue that this association has diluted the momentum Sikhala initially gained upon his release in January 2024.

Sikhala, renowned for his role in launching the MDC-99 party, unveiled his new political initiative during a press conference in Harare on February 8, 2024.

Emphasizing inclusivity, he called for the involvement of various societal sectors, such as civic organizations, students, and the church, in the struggle for mass democracy.

Sikhala distanced himself from the Citizens Coalition for Change (CCC) and expressed his intention to address the perceived shortcomings of the MDC.

However, the inclusion of Morgen Komichi in Sikhala’s political venture has stirred criticism.

Some individuals believe that Komichi’s involvement undermines Sikhala’s credibility and support, potentially jeopardizing the success of the movement.

Chaos At St Faith High School

There were chaotic scenes at St Faith’s High School outside Rusape, Manicaland province, this week after suspected “hired thugs” disturbed lessons at the Anglican Church-run school.

The thugs were allegedly hired by headmaster Arnold Makamba who is being accused of over enrolling for this year’s Form 1 places.

The development has also seen some parents who were captured in videos which have since gone viral, demonstrating at school.

Makamba is allegedly to have hired the thugs to attack Anglican Diocese of Manicaland leaders led by Bishop Eric Ruwona to cause confusion at the school.

The headmaster is also being accused of unilaterally hiking fees without the approval of the government.

There are also allegations of attempts by Makamba and some school development committee (SDC) members to depose the authority which runs the affairs of the school.

Makamba and SDC members have been reportedly fighting to control the school’s main account, a development that has led to the clashes.

Church member Amos Mabiya told NewsDay about the chaos at the school in an interview yesterday revealing that administrators were forced to mobilise security personnel with dogs.

“This is not the first time this has happened. We are seeing the same faces who are known friends of the headmaster [who] just want to cause confusion at the school after the over-enrolment of learners,” Mabiya said.

“The SDC wants to control the school’s main account and exclude the main authority which is the church and has made attempts to depose the church and appoint dubious characters to support this anarchy.”

A staff member, who spoke on condition of anonymity, said Makamba was at the centre of the disturbances even though he was recommended and serves at the pleasure of the responsible authority.

“The current situation at the school has been a result of anarchy brought about by school head with the support of the SDC and this has compromised the mission and values of the church,” he said.

Ruwona yesterday confirmed the disturbances saying they are investigating the matter and talking to the responsible authority.

Makamba did not answer his mobile phone.

According to the Mission Management and Guidelines and Policies and the Education Act gleaned by NewsDay yesterday, the bishop is the voice of the Anglican Diocese of Manicaland in all matters.

It also said the bishop of Manicaland by virtue of his divine position is the responsible authority of all Anglican schools in the Diocese of Manicaland.

Prosecutor Michael Reza In Abuse Of Power Storm

Zimbabwe’s acting deputy prosecutor-general, Michael Reza, is facing allegations of “conspiracy” and “sabotage” in connection with disputed gold claims in Bindura, documents obtained by Truth Diggers show.

Truth Diggers is Alpha Media Holdings’ investigative unit.

Blackgate Investments, a company embroiled in a 15-year battle to regain gold claims, has accused Reza of colluding with a rival company, Ran Mine and G&P Industries, to undermine their efforts.

Reza, the firm alleged in papers filed with the police last month, worked with Ran Mine and G&P Industries to ‘prejudice’ it of the claims, known as Kimberly 18, 19, 20 and 21, situated at Ran Mine in Bindura.

Two of the claims were awarded to Ran Mine and G&P Industries in 2021.

Reza’s alleged involvement in the dispute escalated when he allegedly dropped criminal charges reported over a year by Blackgate against Jack Murehwa, a director at Ran Mine.

Blackgate director Angeline Munyeza claimed that Reza’s decision was allegedly based on a ‘fake’ letter from the former permanent secretary in the Ministry of Mines, Professor Francis Gudyanga, which granted authority to Ran Mine.

However, during a dispute resolution committee meeting in February 2020, the same letter was disowned by Gudyanga.

“Mr Reza in his letter states that the former permanent secretary (in the Ministry of Mines) Prof F. P. Gudyanga unequivocally grants Ran Mines authority to proceed and work on the disputed claims and yet during the dispute committee meeting held on the 6th of February 2020, the same letter was disowned by the dispute committee,” Munyeza said in a letter, which forms part of the police dockets.

“The dispute between Blackgate and Ran Mines and G&P Industries is awaiting judgment in the High Court (HC 6425/21), therefore, meaning the case hasn’t been resolved yet.”

The letter was also copied to the National Prosecuting Authority (NPA), where Reza is a senior official.

The allegations against Reza are contained in several documents filed by Blackgate to the police against individuals, including former mines minister Winston Chitando.

Chitando last week refused to comment, saying the matter was still before the courts.

Blackgate’s director alleged that: “It is through our own private investigations that we have unearthed this glaring evidence and established that there are certain individuals within the police force that are working in unison with Mr Winston Chitando, Mr Jackson Peterson Murehwa, and Mr Michael Reza to sabotage our case”.

She said during a meeting convened by the Ministry of Mines and Mining Development in 2020 to resolve the dispute, Murehwa produced a letter that was allegedly written by Gudyanga, which stated that the gold claims belonged to Ran Mines.

However, Gudyanga, in a sworn affidavit, denied writing the letter, pointing out inconsistencies in the signatures and asserting that the letter did not originate from the Ministry of Mines and Mining Development.

“The undersigned do hereby take an oath and state as follows; I was the permanent secretary in the Ministry of Mines and Mining Development from September 2013 to May 2017,” Gudyanga said.

“There was a letter, which was purported to have been written/generated by me dated November 2013 (the date is not clear on the letter), directed to Messrs Atherstone and Cook in the matter between Blackgate Investments (Private) Limited vs. Mines (Private) Limited, G&P Industries (Private) Limited. I wish to state that I am neither the author nor generator of the letter dated November 2013 directed to Messrs Atherstone and Cook and my reasons are as follows; the signature on the letter is not mine. although it looks like mine, l did not sign that letter, the letter does not bear both my initials as I am addressed as Prof f.P Gudyanga,” he said in his affidavit.

In a docket filed under case number (Cr 1158/10/23), Blackgate re-opened its criminal case against Murehwa and other ran Mine directors.

“The evidence from (a government official), who stated that F.P. Gudyanga is the one, who authored the document and appended his signature, is blatantly misleading to the courts as this evidence was used by the head of prosecution Mr Michael reza to decline prosecution on Jackson Murehwa Cr822/01/22 and this resulted in prejudice to our mining rights. Therefore, the accused acted unlawfully,” the affidavit reads.

Last week the NPA, and ran Mine and G&P Industries’ legal counsel said they could not comment on the matter, saying it was subjudice.

“We cannot comment on an issue that is being investigated. We do not have the docket or full information about allegations and the extent of them,” Angeline Munyeriwa, spokesperson at the NPA, said, when asked about the case and allegations against Reza.

“So, until the docket is presented to the NPA and citing the involvement of PG (prosecutor general), we cannot comment until it is submitted to us.”

However, investigations show that the NPA received the dockets on January 24.

Chris Mhike, the legal counsel for ran Mine and G&P Industries directors, also said last week: “as you are fully aware, commenting on cases that are subjudice is improper and unethical. accordingly we are unable to render any factual or legal remarks on the matter at this stage.”

The Zimbabwe republic Police confirmed receiving the complaints but stated that they were still under review.

In a letter addressed to the ZrP, Pfungwa Kunaka, the current Mines and Mining Development permanent secretary, said the letter, which was purportedly signed by Gudyanga, “does not appear to have come from the ministry”.

“This office acknowledges that the letter said to have been produced by Jackson Murehwa from our Ministry and signed on the 25th of November 2013 by the then permanent secretary professor f.P. Gudyanga does not appear to have originated from this Ministry.

“The Ministry did not have the letter in its file. beyond that, records do not show that any specific use of the letter was applied to resolving the dispute referenced above,” said Kunaka.

His letter is part of documents submitted to the police.

Relief For Shamva Communities As Terror Thief Is Jailed

A 24-year-old man who for the past years has been terrorising the Shamva community, stealing, raping and mugging residents was last week sentenced to nearly two decades for murder.

Tinotenda Mangenjani (24), nicknamed ‘The Bully of Shamva’, was convicted of brutally stabbing a friend to death over a missing pint of beer.

The incident happened two years ago when Mangenjani and the deceased had a beer binge from morning to evening.

A scuffle broke out and resulted in the death of his friend. The court heard that Mangenjani was a known criminal who brandished a knife and various weapons, instilling fear in and around Shamva. On the day in question, his brother, watched as he butchered the friend.

He even attacked a third party who tried to restrain him. Mangenjani pleaded guilty to the offence. He argued that he was defending himself from his friend’s aggression.

High Court judge, Justice Munamato Mutevedzi, dismissed Mangenjani’s defence saying the court frowns at violent crime.

“The murder was a brazen attack on an innocent man who was peacefully enjoying his drink on the night in question.

“He is an acknowledged ruffian, a roughneck who instilled fear in those who knew his behaviour. His conduct brutalised that society. The police were, at the time this crime was committed, looking for the offender in connection with yet another crime he had allegedly committed,” ruled Justice Mutevedzi.

He said Mangenjani deserved the punishment and society needs to be protected from people like him.

“Absent the mitigating factors outlined in the guidelines coupled with the presence of the serious aggravation stated above, I find no basis to impose a sentence below the presumptive penalty. Instead I am compelled to go a little higher than that to illustrate how much the courts frown at violent crime.

“In the circumstances, the offender is sentenced to 19 years’ imprisonment,” said Justice Mutevedzi.

Prosecutor Reza’s head must be examined – Katsimberis

Property developer George Katsimberis has said prosecutor Michael Reza’s head needs to be examined for making “wild claims” accusing the businessman of doctoring court records to scandalise the courts.

Katsimberis, who is in court for alleged fraud emanating from a botched deal with businessman Ken Sharpe; is seeking a referral to the Constitutional Court alleging that his rights have been violated during the ongoing trial.

During his cross-examination by his lawyer Tino Chinyoka, Katsimberis accused the court of doctoring the court record of proceedings of his trial to prejudice his application to the ConCourt.

He cited missing pages and dates from the transcript, the doctoring of his responses together with his lawyer’s questions, omission of sections deemed helpful to his case as well as the omission of sections unfavourable to Sharpe’s Pokugara Properties, the complainant in the case.

But on Wednesday, Reza accused Katsimberis of going into town and getting a document typed and then smuggling it into the court, which is not signed by the magistrate and the transcriber, ostensibly to scandalise the court.

The allegations did not go well with Katsimberis, who insisted he was given the document by the clerk of court.

He also disclosed that he asked for the recording of the proceedings but was given nothing. The transcript was provided at the instance of the magistrate.

But Reza, who remained combative throughour his cross-examination, said: “This document is your creation, you created it and you can not purport that it came from this honourable court because there is nothing that shows that it came from the court.

“You went to town and had this typed and you made all these alterations. That is what you did. You have brought your own forged document because you want to scandalise this court.”

But Katsimberis could not take the accusation lightly, telling Reza that he was responsible for the bastardisation of the court record and needed his head to be cross-examination for making the wild allegation.

“To answer you, it is obvious that you did it and for you to say I went to town and had it typed, you need your head to be cross-examined,” Katsimberis charged.

“In my view, if anything of what you say has an inch of logic, what is missing in there should not be to your benefit, the of Tatiana Aleshina (Sharpe’s aide) and the benefit of Pokugara, the complainant, but to myself.

“The document could not be against me. You need to be examined for those allegations.

Reza went on to claim that Katsimberis had no basis for going to the ConCourt because none of his rights were violated during the trial.

“If you don’t see any right that has been trampled on my constitutional rights in 20 ways, if in your view, you don’t see any right violated, you need to have your head examined,” said Katsimberis.

Magistrate Vongai Guriro had to intervene, ordering Katsimberis to stop making insinuations that Reza was insane.

Katsimberis’ decision to apply for a referral to the ConCourt resulted in the refusal of Guriro and Reza to recuse themselves from the case over “obvious” bias.

He accused them of acting as Sharpe’s hired guns, an allegation he repeated about Reza during Wednesday’s proceedings.

Chinyoka had to come to his client’s rescue against Reza’s combative cross-examination, warning the prosecutor to stick to questioning and avoid being personal when his name was mentioned.

He cautioned Reza to keen the proceedings to be “as objective, and not subjective as possible.”

“What he (Reza) cannot do is argue with the witness (Katsimberis),” Chinyoka said.

“The problem with this case is that Mr Reza is too close to the testimony. He is mentioned as a player in the evidence, so as a human being, he feels offended if something is said about him.”

He added: “What he cannot do here is to say Reza is mentioned and I should defend Reza. Mr Katsimberis is the one on trial and he should be allowed to make his answers and then the court will make an assessment.”

Before Reza’s cross-examination, Katsimberis told the court that the transcript was doctored to guarantee him a conviction and also to ensure that any appeal against that conviction would not succeed.

He said the doctoring was done to suit the interests of Reza, Aleshina, Pokugara and Sharpe to suit Reza’s plan.

He said the general pattern of omitted information and criminal distortion of the record was deliberate to suit Pokugara’s plan.

Asked by Chinyoka if it was not a possibility that Aleshina, who has been involving President Emmerson Mnangagwa’s name in the trial and barking orders to Harare City Council officials, that she visited the transcriber and masterminded the doctoring of the transcript, Katsimberis said he was 100 percent sure that this was what happened.

He dwelled on some letters by Aleshina and her lawyers, Chinawa Law Chambers presented in court as exhibit 2, which shows that Aleshina had several meetings with Harare City Council officials who were also accused people in a police report by Katsimberis, something he said was tantamount to interfering with witnesses.

Katsimberis said the objective of the meetings was to change the narrative to incriminate him.

He accused Reza of doctoring the letters dated 26 June 2019 to suit Pokugara Properties and denying providing a copy of the letter which does not even form a police record.

“This letter of 26 June is a creation of Mr Reza, it did not come from anywhere,” Katsimberis said.

“That is why we are asking for police record that Mr Reza will not supply because he created the letter when investigating the case to try to make it balanced. He is trying to do what he is paid for,” Katsimberis said, insisting Reza was very compromised, in an unprofessional relationship with Aleshina.

Chiefs Resisted Charumbira Re-election: ZEC Report

The Zimbabwe Electoral Commission (Zec) has revealed that the election of Chief Fortune Charumbira as the deputy president of the National Council of Chiefs was under objection.

Charumbira, who has served two terms in the chief’s council as president, was elected deputy president during the elections that were held on August 10, 2023.

Chief Khumalo Matshane, formerly the deputy president of the chiefs’ council, was elected president of the council during the elections.

But in its report on the 2023 harmonised elections presented in Parliament last week, Zec said some “quotas” had reservations over Charumbira’s election to the post after he had served for two terms as president in the same council.

Zec said there was a need to revisit the law under which the council of chiefs is constituted to address the concern.

“The election of the President and the deputy president of the Council of Chiefs saw the former Deputy president of the council being elevated to the post of President while the former president being elected as the deputy president,” Zec said.

“While there is no explicit law prohibiting this, there seems to be some quotas who have expressed reservations on having one elected as a deputy president of the council of Chiefs after serving at its helm for two terms, as president.”

Zec added: “There may be a need to look at the provision and consider its desirability or lack thereof going forward.”

Election of chiefs to the Senate was conducted in all the eight non-metropolitan provinces on August 24, 2023, to elect two chiefs in each province to be members of the Senate.

Latest On Rufaro Stadium Reopening

THE country’s ceremonial home of football, Rufaro Stadium is set to be inspected this Saturday by the ZIFA First Instance Board after extensive renovations at the match venue.

Rufaro Stadium has been closed since 2019 and has been undergoing renovations to meet Premier Soccer League standards.

One would be forgiven to think that this was national convention by pro‐democracy supporters of Advocate Nelson Chamisa. But alas, this was just a provincial meeting by the legitimate democratic alternative in Zimbabwe.

No words and/or superlatives are good enough to explain the huge turn out of Harare citizens who in clear terms expressed their support for President Nelson Chamisa and his decision to dump the contaminated CCC.

No bussing nor food baits but still citizens from Harare province thronged the opposition offices in Belvedere in their thousands.

This was a huge statement by the Blue Submarine of Harare in support of the former CCC leader, Nelson Chamisa.

Simply put, Chamisa is a loved man! A man of principle who has always chosen to stand with the masses over parochial interests.

That NC, as President Chamisa is affectionately addressed by his supporters, did not attend today’s meeting but still multitudes attended the program is a big big statement. Chamisa has become an idea whose time has come.

Neither vote rigging, arbitrary arrests, political killings, propaganda nor force can destroy this honorable man.

Football Action Set To Return To Rufaro Stadium

THE country’s ceremonial home of football, Rufaro Stadium is set to be inspected this Saturday by the ZIFA First Instance Board after extensive renovations at the match venue.

Rufaro Stadium has been closed since 2019 and has been undergoing renovations to meet Premier Soccer League standards.

The City of Harare is confident the facility is now ready to PSL host matches with the anticipated visit this Saturday.

Villagers Storm Chipinge Court Over Their Grabbed Land

By Claris Madhuku- Over 300 villagers from Mahachi village in ward 24, under Chief Musikavanhu, rallied at the Chipinge Magistrates Court on Friday, protesting a pending land dispute with the Chipinge Rural District Council.

The court, expressing scepticism about the proper presentation of the villagers, allowed them to return home while the Chipinge RDC organised its case.

The disarray was evident as warned and cautioned statements signed by the villagers were deemed shambolic, necessitating a reworking to articulate the charges accurately.

The perplexing situation of over 300 villagers being brought to court in a single day without processed dockets led to chaos at the Magistrates court.

Professor Lovemore Madhuku, the villagers’ legal representative, working through Advocate Tazvitya, maintains that his clients, indigenous natives of Mahachi village, have no case to answer since time immemorial.

Simultaneously, 500 households from Munyokowere village in ward 5, summoned by Chipangayi ZRP on February 9th, are scheduled to appear at Chipangayi police station on February 10th, 2024, facing similar charges of residing illegally on gazetted land.

The case is already in court, with Chipinge RDC restrained by a High Court order from interfering with Munyokowere and Kondo villagers.

The looming threat of displacement and dispossession hangs over Munyokowere, Mahachi, Kondo, and Maunganidze villagers due to a land dispute dating back to 2018 when the second republic replaced the Mugabe regime.

Former opposition MDC National Chairperson Morgan Komichi has rallied opposition forces to unite and save the country from total collapse saying the prevailing situation is nearing 2007.

Popular musician Seh Calaz, also known as Tawanda Mumanyi, is overjoyed after receiving a brand new motor vehicle from controversial businessman Wicknell Chivayo.

Seh Calaz had previously expressed his support for Zanu PF and even publicly appealed to Chivayo for a new car.Observers have criticized Seh Calaz, suggesting that he compromised his principles in exchange for the car.

In a statement, Seh Calaz expressed his gratitude, saying, “Sir Wicknell, my dream Jagwa, which I posted four years ago, has finally become a reality. I believe that what I cannot afford, God will provide for me. I am truly grateful for this generous gift from Exquisite Cars Dealership. From a full tank of fuel to regular servicing, everything is taken care of. I used to doubt my ability as a brand ambassador, but now I see that I can market anything by the grace of God and the support of the people.”

Mnangagwa Arrests & Deports Zambia’s Opposition Leader

By Political Reporter-Authorities in Harare have arrested and deported Lusaka Times reported that Chishimba Kambwili, a member of Zambia’s former ruling party, the Patriotic Front (PF).

Kambwili was deported from Zimbabwe and returned to Zambia after spending at least nine days in custody.

Kambwili had sought refuge in Zimbabwe on January 30, 2024, allegedly for medical treatment with the assistance of a Zimbabwean citizen.

However, upon his arrival, Zimbabwean authorities arrested him.

Zambia’s Home Affairs Minister, Jack Mwiimbu, confirmed that Kambwili was handed over to Zambian authorities at the Chirundu border post on Thursday, February 8, 2024, at 23:00 hours.

Currently admitted to Maina Soko Hospital in Lusaka, Kambwili’s health condition is under assessment.

Minister Mwiimbu addressed the media in Mushindamo District, clarifying that Kambwili had entered Zimbabwe illegally and voluntarily surrendered his passport to immigration officers at the Chirundu border upon their request.

He stressed that the Zambian government did not seize Kambwili’s passport or impede his travel for medical purposes.

Minister Mwiimbu reiterated the collaborative efforts between the Zambian and Zimbabwean governments in locating Kambwili, deemed an illegal immigrant in Zimbabwe due to his unauthorized entry.

Consequently, Zimbabwean authorities decided to deport him, a decision Minister Mwiimbu commended.

Responding to social media claims of mistreatment, Minister Mwiimbu highlighted President Hakainde Hichilema’s directive to provide Kambwili with access to medical care, irrespective of his criminal record and political affiliation.

He underscored the government’s dedication to ensuring the well-being of all citizens, exemplified by Kambwili’s evacuation for medical attention.

Sikhala Dumps Chamisa, Commits Political Suicide

By Political Reporter – Former Zengeza West MP Job Sikhala Thursday committed political suicide by dumping his longtime comrade and former Citizens’ Coalition for Change (CCC) leader, Nelson Chamisa, in his expressions of gratitude for those who supported him during his imprisonment.

The notable omission occurred during Sikhala’s press conference in Harare, where he not only distanced himself from the CCC but also unveiled his ambitious new political initiative, showcasing remarkable courage against the oppressive Zanu PF government.

Chamisa is the most popular politician and the country’s only alternative leader.

Brandishing the CCC as a “carcass,” Sikhala declared his departure, asserting that relying on the CCC as a catalyst for democratic change in Zimbabwe was futile.

During the press conference, Sikhala emphasized the importance of a people-driven movement, declaring:
“The mass democratic struggle is people-driven and owned. Every successful struggle in the world has thrived when the people have claimed ownership. Regardless of my personal involvement, considering the persistent threats to my life by unidentified enemies, this process must continue unhindered. Whether we have resources or not, the people must spearhead this crucial phase in our history—the people’s struggle against tyranny for freedom, dignity, and prosperity.”

While extending well wishes to those opting to remain with the CCC “carcass,” Sikhala acknowledged their democratic right, underscoring the urgency for the people to assume control in the impending critical phase of Zimbabwe’s struggle against tyranny.

Sikhala’s announcement closely follows Nelson Chamisa’s recent departure from the CCC, who attributed his exit to alleged ZANU PF infiltration just two weeks ago.

Having spent an astonishing 595 days in pre-trial detention on charges of inciting public violence, Sikhala, recently released, now faces another legal battle.

Byo Man In Court For Attacking Parking Marshall

A motorist captured on video recently attacking a Tendy Three Investments (TTI) parking marshal was granted bail when he appeared in court facing an assault charge.

Washington Nhenderere was not asked to plead when he appeared before Bulawayo magistrate Maxwell Ncube, last week.

He was granted US$200 bail and remanded to February 12 for trial.

It is the state’s case that on January 26, Nhenderere assaulted a TTI marshal who had asked him to pay US$1 for parking fees.

The TTI marshal was hit by Nhenderere using open hands and fists.

Nhenderere was later arrested by police officers from Bulawayo Central Police station.

The incident comes at a time when the traffic management company in conjunction with the police and the Central Vehicle Registry department have launched an operation targeting motorists that have broken or confiscated their clamping gadgets.

It is said that tampering with a clamping gadget attracts a US$150 fine and in the event that the offending vehicle is towed to an impounding yard, the owner is liable to pay US$30 per hour.

Chinese Lithium Miners Exploiting Zimbabwean Workers

Workers unions have flagged deteriorating labour standards at Chinese lithium mines.

Chinese investors own most of the best producing lithium mines in Zimbabwe.

These are Sinomine Resource Group Co Ltd which owns Bikita Minerals, Zhejiang Huayou Cobalt Company Ltd, the parent of Arcadia Mines, and Suzhou TA&A Ultra Clean Technology Co Ltd with an interest in Premier’s Zulu Lithium.

During a recent multi-stakeholder conference organised by the Centre for Natural Resource Governance (CNRG), Zimbabwe Diamond and Allied Workers Union (ZDAMWU) secretary-general Justice Chinhema flagged the deteriorating working conditions at Chinese-owned mines.

He said there was a total disregard for health and safety standards during lithium extraction.

“Chinese investors do not respect the labour rights in the sector, we need to have routine visits at their mining sites given their history of labour violations. The jobs brought by these investments are not linked to any standards, but to self-created cheap and free labour and sometimes supported by our government,” he said.

“The current situation in the lithium sector is so sad, if not addressed urgently we are going to face another wave of colonisation, slavery and cheap and free labour. As labour and as a trade union, we advocate systems that balance the power between capital and labour through approaches that guarantee the improvement, promotion and protection of workers’ rights and interests characterised by economic equality, good governance and justice for all in society.”

He said about 5 000 employees were working at lithium mining companies in Zimbabwe under constrained labour conditions in a “wave of colonisation, cheap labour and violations of human rights”.

Additionally, ZDAMWU alleges that Chinese-owned mining companies are offering employees short-term fixed contracts while terminating black indigenous company subcontracting in preference for Sino firms linked to parent mining companies for rudimentary services.

ZDAMWU found that the sidelining of locally-owned companies in the provision of basic services including stone crushing and compacting is a drawback on opportunities for local value addition and beneficiation.

“One thing about subcontracting is that the Chinese are bringing in fellow companies and they are terminating the contracts of black indigenous companies and awarding subcontracts to companies linked to the mother companies in China,” Chinhema said.

CNRG found unequal job opportunities in the mining sector, male dominance, and sexual exploitation, necessitating an interrogation into how the extraction of transitional minerals impacts labour practices.

CNRG deputy programmes director Tracy Mutowekuziva said labour challenges in the sector were not limited to formally employed workers but extended to child labour and exploitation of women in the lithium sector.

“There have been reports of forced labour, child labour, and exploitation of vulnerable populations, further exacerbating the suffering of these communities,” she said.

“Our role as a civic organisation is to engage with government institutions, policymakers and industry stakeholders to advocate policy reforms that promote transparency, accountability, and community participation in natural resource management.”

Government has in the past been notified of such practices by Chinese investors but has been accused of not responding to such concerns given that China is a big investment partner.

According to the Zimbabwe Investment and Development Agency, China had US$2,79 billion worth of investment licences issued as of the third quarter of last year.

Land Contestations Resurface In Chipinge

By A Correspondent| Today on the 9th of February 2024,over 300 villagers from Mahachi village in ward 24 under Chief Musikavanhu stormed and jammed the Chipinge Magisttates court over a pending land dispute with Chipinge Rural District Council.

The Magistrates court in Chipinge was not convinced that the villagers were properly brought before it and had to allow the villagers to go back home as Chipinge RDC puts her house inorder.

Some of the warned and cautioned statements signed by the villagers were shambolic and needed to be reworked to correctly state the charge for the villagers .

It was also embarassing to fathom why more than 300 villagers would be brought to court on one single day without processed dockets,thereby causing chaos at the Magistrates court.

The lawyer for the villagers Professor Lovemore Madhuku working through Advocate Tazvitya, remains convinced that his clients who are indigenous natives of Mahachi village since time immemorial have no case to answer.

Meanwhile, 500 households from Munyokowere village in ward 5 of Chipinge RDC have been summoned by Chipangayi ZRP today on the 9th of February to come to Chipangayi pilice station on the 10th of February 2024 over similar charges of staying illegally on a gazetted land.

This case is before the courts with Chipinge RDC having been given a High Court order not to interfere with the villagers of Munyokowere and Kondo.

Munyokowere, Mahachi, Kondo and Maunganidze villagers are facing the threat of displacement and dispossessions due to a land dispute backdated to 2018 when the second republic replaced the Mugabe regime .

Platform For Youth and Community Development – PYCD is working closely with a number of national based civic society organisations to defend and protect the rights of the villagers.

Only dialogue and not the courts and the police will be able to provide a sustainable solution to this land dispute in question.

Hailstorm Hits Zvishavane

A destructive hailstorm wreaked havoc at Gresham Primary School in Zvishavane this Wednesday, causing extensive damage to property worth thousands of dollars.

The storm tore off the roofs of three classroom blocks, leaving a trail of destruction in its wake.

The aftermath of the hailstorm left 159 learners stranded, as asbestos sheets were ripped off and textbooks, exercise books, and furniture were destroyed.

Mr. Chrispen Moyo, the Head of Gresham Primary School, confirmed the incident and the extent of the damage.

“We experienced a hailstorm on Wednesday that caused significant destruction at our school, resulting in the classroom roofs being blown away.

Additionally, large trees in the vicinity of the school were uprooted.

We have already submitted a report to the local authorities, and fortunately, there were no fatalities recorded. While all pupils are safe, the damage to property is extensive,” Mr. Moyo stated.

Zvishavane District Development Coordinator, Mr. Darlington Chokera, is actively assessing the damage on the ground alongside the District Civil Protection Unit (CPU).

“We are currently on-site assessing the extent of the damage and addressing any emergency cases. With support from the CPU, we are determining the best course of action to assist those affected,” Mr. Chokera explained.

Blue Card For Unruly Soccer Players Coming

Football, often hailed as ‘the world’s most beautiful game,’ is on the brink of embracing a new innovation: the introduction of sin bins, accompanied by a new card.

The familiar yellow and red cards will soon have a new companion – the blue card, set to make its debut in the sport.

The blue card will signify sin bins, or temporary dismissals, allowing players to temporarily exit the field to deter abuse directed at referees.

According to reports, players will face a 10-minute expulsion from the game for committing cynical fouls or displaying dissent, as reported by The Telegraph.

In the event a player receives a second sin bin during the same match, they will not be permitted to return to play, although they can be substituted if their team has remaining substitutes. This approach offers a somewhat more lenient consequence compared to the traditional method of receiving two yellow cards, which results in a team playing with ten players.

This development aims to address player conduct and enhance respect for match officials, bridging the gap between yellow and red card offenses.

In November, The Guardian reported that blue cards have undergone trials in English football since the 2019-20 season, involving 31 grassroots leagues.

The International Football Association Board (IFAB) is anticipated to make an official announcement soon.

The Football Association (FA) of England disclosed that 72% of players, 77% of managers, and 84% of referees in grassroots football endorsed the sin bin rule, contributing to a 38% reduction in dissent.

One would be forgiven to think that this was national convention by pro‐democracy supporters of Advocate Nelson Chamisa. But alas, this was just a provincial meeting by the legitimate democratic alternative in Zimbabwe.

No words and/or superlatives are good enough to explain the huge turn out of Harare citizens who in clear terms expressed their support for President Nelson Chamisa and his decision to dump the contaminated CCC.

No bussing nor food baits but still citizens from Harare province thronged the opposition offices in Belvedere in their thousands.

This was a huge statement by the Blue Submarine of Harare in support of the former CCC leader, Nelson Chamisa.

Simply put, Chamisa is a loved man! A man of principle who has always chosen to stand with the masses over parochial interests.

That NC, as President Chamisa is affectionately addressed by his supporters, did not attend today’s meeting but still multitudes attended the program is a big big statement. Chamisa has become an idea whose time has come.

Neither vote rigging, arbitrary arrests, political killings, propaganda nor force can destroy this honorable man.

Football, often hailed as ‘the world’s most beautiful game,’ is on the brink of embracing a new innovation: the introduction of sin bins, accompanied by a new card.

The familiar yellow and red cards will soon have a new companion – the blue card, set to make its debut in the sport.

The blue card will signify sin bins, or temporary dismissals, allowing players to temporarily exit the field to deter abuse directed at referees.

According to reports, players will face a 10-minute expulsion from the game for committing cynical fouls or displaying dissent, as reported by The Telegraph.

In the event a player receives a second sin bin during the same match, they will not be permitted to return to play, although they can be substituted if their team has remaining substitutes. This approach offers a somewhat more lenient consequence compared to the traditional method of receiving two yellow cards, which results in a team playing with ten players.

This development aims to address player conduct and enhance respect for match officials, bridging the gap between yellow and red card offenses.

In November, The Guardian reported that blue cards have undergone trials in English football since the 2019-20 season, involving 31 grassroots leagues.

The International Football Association Board (IFAB) is anticipated to make an official announcement soon.

The Football Association (FA) of England disclosed that 72% of players, 77% of managers, and 84% of referees in grassroots football endorsed the sin bin rule, contributing to a 38% reduction in dissent.

Football has a history of embracing innovations, evidenced by the introduction of goal-line technology in 2014, Video Assistant Refereeing (VAR), and the adjustment of the number of substitutes permitted from three to five.

Hailstorm Hits Mnangagwa Home Town

A destructive hailstorm wreaked havoc at Gresham Primary School in Zvishavane this Wednesday, causing extensive damage to property worth thousands of dollars.

The storm tore off the roofs of three classroom blocks, leaving a trail of destruction in its wake.

The aftermath of the hailstorm left 159 learners stranded, as asbestos sheets were ripped off and textbooks, exercise books, and furniture were destroyed.

Mr. Chrispen Moyo, the Head of Gresham Primary School, confirmed the incident and the extent of the damage.

“We experienced a hailstorm on Wednesday that caused significant destruction at our school, resulting in the classroom roofs being blown away.

Additionally, large trees in the vicinity of the school were uprooted.

We have already submitted a report to the local authorities, and fortunately, there were no fatalities recorded. While all pupils are safe, the damage to property is extensive,” Mr. Moyo stated.

Zvishavane District Development Coordinator, Mr. Darlington Chokera, is actively assessing the damage on the ground alongside the District Civil Protection Unit (CPU).

“We are currently on-site assessing the extent of the damage and addressing any emergency cases. With support from the CPU, we are determining the best course of action to assist those affected,” Mr. Chokera explained.

Vubachikwe, A Case of False Promises And Uncertainty

The damning report, which was conducted by ForFar Forensics, a South African forensic company, may be the figurative black cloud hovering over the heads of the workforce that still hoped to be bread winners again.

Vubachikwe Gold Mine in Gwanda closed on the 8th of November 2022, after workers downed their tools due to outstanding salary payments, poor working conditions and other issues. According to the report Duration Gold, who are the owners of Vubachikwe Gold Mine, and its subsidiary Forbes and Thompson (Pvt) Ltd, are swimming in murky waters due to a ballooning debt of over US$ 8 592720.00 and ZWL 3 556 917 841.00 as of November 2023. A monthly debt increase is estimated at approximately US$250 000.00 and there is no laid out plan or strategy to service the debts.
The forensic investigation report was conducted between the period of January 2022 to November 2023. The aim was to look into the overall management of Forbes and Thompson (Pvt) Ltd and its associated group companies in Zimbabwe. The results show a number of irregularities that do not portray a positive position for the company to get back on its feet. Much of the problems apparently emanate from the major shareholder’s incompetence, over-expenditures and mismanagement of funds. MR Allan Brent Dolan is the major shareholder and Managing Director of Forbes and Thompson and seems to have an appetite for traveling yet failing to own up to the bills. The investigation report notes that hotel bills are accumulating with some hotels now only accepting Mr. Dolan as guest if there is a deposit paid in advance. Bronte Hotel in Harare and Musketeers in Bulawayo are cited as some of these hotels. Apart from the extensive traveling, Mr Dolan is said to have been involved in ‘reckless trading’ that include engaging new creditor liabilities despite the company’s inability to pay the new appointees, undervaluing asset sale transactions to benefit related parties at the expense of creditors, and failing to own up to promises made to creditors. This has resulted in Forbes and Thompson losing credibility with its suppliers.
What led to Vubachikwe employees going on strike on that fateful day of 8 April 2022 was not because of their own greed but one can imagine a father spending so much time in the mine only to come home empty-handed. The over 800 employees have been reeling in poverty and yet working in an industry regarded as one of the country’s biggest foreign currency earners does not augur well with President Mnangagwa mantra of leaving no place and no one behind. The Forfar Forensic report notes that during the period of January 2023 to November 2023 workers at Vumbachikwe were receiving a stipend of US$ 100.00 and food hampers worth approximately US70.00, which were only given to the 107 essential services employees. Despite coming up with such a fuzzy selection criterion, the company failed to own up to the stipend.
Mr Dolan as the major shareholder, is being accused of embarking on cash-demanding Exclusive Prospecting Order (EPOs) soil sampling project, which has no bearing to the operations of Forbes and Thompson/Duration Group operations. The EPOs are said to be personally owned by Mr. Dolan and instead of funding from his personal coffers he is diverting cash generated by other subsidiaries such as Met Solutions. As a result, even Met Solutions have been struggling to pay their employee salaries and wage bill. According to the Forensic report, Duration Gold has failed to allocate funding to the Vubachikwe human disaster but instead funded the purchasing of camping equipment and paying samplers engaged on the EPOs project.

Apart from the employee salaries, other creditors in the queue include the Zimbabwe Revenue Authority (ZIMRA), Zimbabwe Electricity Supply Authority (ZESA), and ZINWA. By November 2023, ZESA was being owed US$1 116 000.00, and the money was accumulating at approximately US$60 000.00 per month. The Forensic report indicates that an audit was done into Forbes and Thompson ZIMRA non-compliance and issues of tax evasion that includes, nonpayment and/or inaccurate payment of Pay As You Earn (PAYE) and nonpayment of withholding tax. ZIMRA issued an assessment to the value of US$2 671 6658.00 withholding tax accrued but not remitted. Such action is not only at the detriment of employees and staff of Forbes and Thompson but also to the National fiscus. In simple terms, Forbes and Thompson (Pvt) Ltd has not been conforming to the legislative requirements expected in the country.
With all these findings, one would wonder if the idea of reopening Vubachikwe mine is not just a dummy sold to quiet the creditors. Mr. Dolan has pilling hotel bills, employee salaries dating back to 2022, and a train of other service providers waiting for their pay day. Despite all these pending responsibilities, he goes on to have soil sampling projects that are not benefiting the overall company but an individual. Vubachikwe was one of the biggest mining companies in Matabeleland South and its coming back online would create job opportunities for the community, contribute to the province’s gold output and the national gross domestic product. Alas, this may just be another fallacy.

Tshabangu, Teresa Kabondo and Grace Mpande will represent CCC in Matabeleland North Province in the Senate, Maxwell Mdhluri will be the senator for Manicaland, Sam Chapfudza will represent Masvingo, while Lilian Mlilo, Kucaca Ivumile Phulu, Linda Sibanda, and Collet Ndhlovu are the new CCC senators for Bulawayo.
Those who were recalled include Zivira Hellen, Shoko Gideon, Ncube Siphiwe, Sibanda Felix Magalela, Chimhini David Antony, Madzikanda Godfrey, Mativenga, Moyo Anastasia, Gabuza Gabbuza Joel and Sibanda Tenda.

Brandishing the CCC as a “carcass,” Sikhala declared his departure, asserting that relying on the CCC as a catalyst for democratic change in Zimbabwe was futile.

During the press conference, Sikhala emphasized the importance of a people-driven movement, declaring:
“The mass democratic struggle is people-driven and owned. Every successful struggle in the world has thrived when the people have claimed ownership. Regardless of my personal involvement, considering the persistent threats to my life by unidentified enemies, this process must continue unhindered. Whether we have resources or not, the people must spearhead this crucial phase in our history—the people’s struggle against tyranny for freedom, dignity, and prosperity.”

Sikhala, characterising the CCC as a “carcass,” declared his departure during a press conference in Harare on Thursday, boldly asserting that relying on CCC as the catalyst for democratic change in Zimbabwe was futile.

Emphasising the importance of a people-driven movement, Sikhala stated:
“The mass democratic struggle is people-driven and owned. Every struggle waged throughout the world has succeeded when people own it. The masses must own the next decisive stage of our struggle. Whether I will be there with you or not, as my enemies have not shelved their plan to assassinate me for reasons known only to themselves, this process must proceed uninhibited to finality. With or without resources, the people shall carry out this most important task in the decisive phase of our history and our people’s struggle against tyranny for their freedom, dignity, and prosperity.”

Murewa, Mashonaland East Parliamentary candidates from Mashonaland East who contested in the 2023 elections under the former Citizens Coalition for Change (CCC) party, led by President Nelson Chamisa, convened in Murewa yesterday to reaffirm their steadfast support for President Chamisa.

The gathering in Murewa was prompted by concerns over the alleged infiltration of the CCC party by ZANU-PF, facilitated by the manipulation of their proxies, including Sengezo Tshabangu, who falsely claimed the position of Secretary General, alongside vice presidents Tendai Biti and Professor Welshman Ncube.Advocate Willard Madzimbamuto, representing all the parliamentary candidates from the 2023 elections, presented the following resolutions:To stand firmly behind Advocate Nelson Chamisa.

To disassociate themselves entirely from any association with the CCC party, effective immediately.

In an interview with Change Radio, Advocate Madzimbamuto emphasized the unwavering confidence of all 23 constituencies in Mashonaland East in the capable leadership of President Chamisa.

In the harmonized elections on 23rd August 2023 in Mashonaland East, a region traditionally aligned with ZANU-PF, the CCC, under former President Chamisa, secured four out of 23 available seats.

However, subsequent recalls initiated by Tshabangu et al led to the removal of two CCC parliamentarians, Advocate Madzimbamuto from the Seke constituency and Chagwiza from Goromonzi South.

Consequently, these vacant seats were reclaimed by ZANU-PF, suggesting indirect support from Tshabangu, Biti, and Ncube for ZANU-PF’s electoral success.CCC clinched victories in Seke, Marondera Central, Ruwa, and Goromonzi South.

Particularly noteworthy were CCC’s wins in the rural constituencies of Seke (encompassing six rural wards, two wards in newly resettled farming areas, and three wards in peri-urban zones) and Goromonzi South rural constituency, marking significant achievements for President Chamisa’s CCC.

In the Seke constituency’s 2023 harmonized elections, Advocate Willard Madzimbamuto of CCC secured victory with 14,032 votes, surpassing ZANU-PF’s Munyaradzi Kashambe who garnered 13,277 votes.

However, ZANU-PF reclaimed the Seke constituency seat in a subsequent by-election, with Munyaradzi Tobias Kashambe emerging victorious with 8,586 votes, while the CCC candidate, Everisto Chisi, secured 669 votes, and independent candidate Willard Madzimbamuto obtained 2,401 votes.

Similarly, in 2023, President Chamisa’s CCC won the parliamentary seat in Goromonzi South, with CCC’s Stephen Chagwiza clinching victory after securing 16,312 votes, defeating ZANU-PF’s Tinashe Chikonye who obtained 15,216 votes.

However, ZANU-PF reclaimed the Goromonzi South seat following the recall of the hardworking and popular Chagwiza by Tshabangu and his associates.

Chagwiza was barred from contesting the subsequent by-election by the High Court, resulting in ZANU-PF’s candidate, Washington Zhanda, winning with 6,865 votes, while CCC’s Tshabangu candidate, Rueben Chikudo, received 1,067 votes.

Furthermore, Tshabangu and his allies recalled three CCC Marondera district wards, leading to ZANU-PF’s victory in these contested wards during the by-elections held on 3rd February 2024, namely wards 5, 8, and 10.

One would be forgiven to think that this was national convention by pro‐democracy supporters of Advocate Nelson Chamisa. But alas, this was just a provincial meeting by the legitimate democratic alternative in Zimbabwe.

No words and/or superlatives are good enough to explain the huge turn out of Harare citizens who in clear terms expressed their support for President Nelson Chamisa and his decision to dump the contaminated CCC.

No bussing nor food baits but still citizens from Harare province thronged the opposition offices in Belvedere in their thousands.

This was a huge statement by the Blue Submarine of Harare in support of the former CCC leader, Nelson Chamisa.

Simply put, Chamisa is a loved man! A man of principle who has always chosen to stand with the masses over parochial interests.

That NC, as President Chamisa is affectionately addressed by his supporters, did not attend today’s meeting but still multitudes attended the program is a big big statement. Chamisa has become an idea whose time has come.

Neither vote rigging, arbitrary arrests, political killings, propaganda nor force can destroy this honorable man.

Former political detainee Job Sikhala has severed ties with the Citizens Coalition for Change (CCC), likening the opposition group to a lifeless entity, and has established his own political movement.

Sikhala, recently released from incarceration, had remained silent regarding his future political endeavors following the disintegration of the CCC subsequent to Nelson Chamisa’s resignation.

Speaking to the press on Thursday in Harare, Sikhala unveiled his new political initiative, emphasizing its inclusive nature with involvement from civil society, students, and religious institutions.

“We’re not merely announcing the formation of a political entity but rather a wide-ranging mass democratic movement that welcomes all in the advancement of the mass democratic struggle, reminiscent of the United Democratic Front (UDF) of 1980s apartheid South Africa,” Sikhala declared.

“This endeavor is inspired by the noble principles upheld by countless Zimbabweans who sacrificed during the liberation struggle, Gukurahundi, and those who have perished since the revival of the goals and aspirations of the mass democratic struggle in February 1999.”

Sikhala joins a growing list of prominent figures exiting the CCC amid allegations of infiltration and internal discord.

While another faction within the party had proposed a leadership role for Sikhala as deputy chairman, he opted to forge ahead with his own movement, aiming to rectify the flaws of the Movement for Democratic Change (MDC) since its inception in 1999.

“The flaw in our 1999 approach was the top-heavy nature of constituent body meetings, with only the ZCTU possessing grassroots structures. This imbalance in participation from the grassroots to the national leadership level eventually led to conflicts of interest. Zimbabwe requires a forward-looking approach to address the national dilemma,” Sikhala reflected.

“The roadmap for progress will be charted by the people through a Mass Nationwide Democratic Consultative Process. This national consultation will entail Nationwide Democratic Consultative Conventions.

“Crucially, this consultative process will engage all vital constituent bodies, including the general populace, labor unions, students, traditional leaders, religious groups, civil society organizations, business figures, professionals, residents’ associations, informal traders, women’s groups, farmers, youth organizations, progressive political entities, war veterans, artists, corporate sector representatives, and individuals with disabilities,” Sikhala affirmed.

Cabinet’s Move To Abolish Death Penalty Marks Progress: Amnesty International

Responding to a move by Zimbabwe’s cabinet to back abolition of the death penalty, Amnesty International’s Deputy Regional Director for East and Southern Africa, Khanyo Farise, said:

“Zimbabwe has taken the right step towards ending this abhorrent and inhuman form of punishment that has no place in our world.

“Now that the cabinet has given its nod, Parliament must ensure the death penalty is truly abolished by voting to pass legislation that will make this a reality.”

Amnesty International opposes the death penalty in all cases without exception because it violates the right to life as proclaimed in the Universal Declaration of Human Rights.

Zimbabwe carried out its last execution in 2005 but death sentences have continued to be imposed. At independence, there were nine crimes punishable by death under Zimbabwean law.

Offenders can currently be sentenced to death for three offences, namely treason; where the act of insurgency, banditry, sabotage or terrorism results in the death of a person; for murder and for attempted murder or incitement or conspiracy to commit murder.

Jah Prayzah Drills Borehole For Chikurubi Inmates

In his continued acts of benevolence to the Zimbabwe Prisons and Correctional Service (ZPCS), contemporary musician Mukudzeyi Mukombe, famously known as Jah Prayzah, yesterday drilled a borehole for Chikurubi Prison Complex.

Present at the groundbreaking ceremony was Deputy Commissioner-General Manetswa C Manhivi responsible for Operations and the Deputy Officer Commanding Harare Metropolitan Province, Assistant Commissioner George Mutimbanyoka.

The borehole is expected to bring an end to the erratic water supplies that inmates and officers within Chikurubi Prison Complex have been experiencing.

Jah Prayzah has been working with the Zimbabwe Prisons and Correctional Service (ZPCS) on a number of projects. The lead member of the band Third Generation has a program in which he scouts for talent amongst inmates and records their music at his JP Studios free-of-charge.

Posting on Twitter, Jah Prayzah had this to say about his act of generosity:

“In a heartfelt commitment to bettering the lives of those within Chikurubi Maximum Prison, I’ve embarked on a transformative journey, leading to the installation of a borehole to address the water needs of the inmates. I presented this borehole to The DCG who was representing the Commissioner General ZPCS. In the past year we have been working closely with Zimbabwe Prison and Correctional Services and have also embarked on projects that highlight on the consequences of crime and fostering rehabilitation. One such project to note is Mhosva which is hosted by (Dual Sim). It’s a step towards not just quenching physical thirst but nurturing hope and humanity within the prison walls.”

The musician also has a media company that is currently producing Mhosva, a television production that seeks to reconcile the offender and the offended in preparation for reintegration of the offender into society upon completion of their sentence.

Affair With Married Man Turns Violent

A shocking incident unfolded at Tshapho business center in Matopo, Matabeleland South province, as a confrontation between two women over an alleged affair with a married man turned violent, leaving one woman injured and traumatized.

Sanelisiwe Ncube, a 33-year-old resident of Domboshava village, found herself at the center of a public spectacle when Siduduzile Ndlovu, 37, confronted her at the bar on December 3 last year. Accusations of infidelity quickly escalated into a heated altercation, with tempers flaring.

According to witnesses, as Ncube attempted to de-escalate the situation by excusing herself to the restroom, Ndlovu pursued her and launched a vicious attack. Armed with a knife, Ndlovu stabbed Ncube twice in the buttocks and once in the thigh, causing her to collapse in agony and scream for help.

Following the brutal assault, Ndlovu fled the scene, leaving Ncube bleeding profusely on the ground. Concerned bystanders rushed Ncube to a nearby hospital for urgent medical attention, where she underwent treatment for her injuries.

Subsequently, Ndlovu was apprehended and appeared before Kezi magistrate Busani Sibanda, where she pleaded guilty to assault charges. The magistrate, taking into account the severity of the offense and the use of a dangerous weapon, sentenced Ndlovu to 18 months imprisonment. However, he suspended eight months of the sentence on the condition of good behavior for five years, with the remaining 10 months suspended on the condition of 350 hours of community service at White Water Primary School.

In her mitigation plea, Ndlovu cited her responsibility as a mother of four minor children and her meager income from fetching water for community members. Meanwhile, Ncube expressed the physical and emotional toll of the attack in a victim impact statement, detailing her struggles with sitting, sleeping, and performing daily chores, as well as the financial burden of medical expenses.

The incident serves as a stark reminder of the consequences of unchecked jealousy and violence, underscoring the need for peaceful conflict resolution and respect for the rule of law. Trio Murders Colleague Over Cellphone Theft Allegations

Police in Inyathi have arrested three suspected murderers for allegedly assaulting and murdering a colleague over allegations of cellphone theft.

The trio suspects; Kulekani Nyathi (25), Nkanyido Tshuma (26) and Bukhosi Mgucini all from Inyathi are held in Police custody pending further investigations.

Circumstances are that on February 04 and at around 2000 hours, the seven suspects were drinking beer at the farmhouse shop together with the now deceased Fight Phiri who is aged 27.

The suspects started accusing the now deceased of stealing an Itel cell phone belonging to Hapyson Ncube who is the shopkeeper at that place.

A misunderstanding arose between the two parties prompting one of the suspects to assault the now-deceased Phiri once on the face using open hands.

The now deceased person got outside the shop and ran with his life with two suspects giving a chase towards the bush whilst the other five suspects were following behind.

The other suspect who was following a chase found the now deceased person crying, lying on the ground facing upwards bleeding from the forehead and pleading for mercy to the two suspects who were standing on top of him.

The suspec then joined and further assaulted the complainant several times before leaving him unconscious in the bush which is about 50 meters away from the farm shop.

On February 5, the now deceased went back home where he narrated his fate to the informant who later took him to Inyathi hospital where he was certified dead upon admission.

A report was filed at ZRP Inyathi where the scene was attended and a smelling substance suspected to be a cattle dipping chemical was observed.

All three suspects were arrested and are under police custody at ZRP Inyathi. The body of the now-deceased person was taken to Inyathi District Hospital Mortuary post-mortem at United Bulawayo Hospitals.

Matabeleland North Province Police Spokesperson Inspector Glory Banda confirmed receiving a murder report of Fight Phiri.

Marozva Village in Midlands Province is reeling from a shocking incident, as a 94-year-old grandmother was allegedly fatally assaulted by her own grandson amidst accusations of witchcraft.

On the evening of February 3, the tranquility of Marozva Village was shattered by the disturbing events that unfolded at the homestead of Esther Marozva.

Accompanied by her son, Chamunorwa Mugariri (50), and daughter-in-law, Soneni Mpofu (36), Esther found herself the target of her grandson’s violent outburst.

Oliver Rimai, aged 43, stands accused of snatching an iPhone from a woman while she was driving along 7th Street. The court remanded Rimai in custody until February 26, pending further investigations.

According to the State, the incident occurred on February 1 around 7:45 pm.

Chido Mnangagwa, driving her Mercedes-Benz, had stopped at a set of traffic lights on 7th Street, preparing to turn left onto Hebert Chitepo Avenue.

It was during this momentary pause that Rimai allegedly seized the opportunity to strike.

Rimai, known for targeting motorists at traffic lights, swiftly reached through the open passenger’s side window and snatched Mnangagwa’s iPhone 15 Pro Max before making a hasty escape.

However, Chido Mnangagwa promptly informed her brother, Tichaona Viano, about the incident.

Man Brutally Kills Own Grandmother

Marozva Village in Midlands Province is reeling from a shocking incident, as a 94-year-old grandmother was allegedly fatally assaulted by her own grandson amidst accusations of witchcraft.

On the evening of February 3, the tranquility of Marozva Village was shattered by the disturbing events that unfolded at the homestead of Esther Marozva.

Accompanied by her son, Chamunorwa Mugariri (50), and daughter-in-law, Soneni Mpofu (36), Esther found herself the target of her grandson’s violent outburst.

According to Midlands Provincial police spokesperson, Inspector Emmanuel Mahoko, the assailant, Takudzwa Mugariri (25), arrived home and began accusing his grandmother of practicing witchcraft.

What followed was a horrifying sequence of events, as Takudzwa reportedly burned Esther’s clothes in a fit of rage, despite the futile attempts of Chamunorwa and Soneni to intervene.

In a desperate attempt to seek help, Chamunorwa hurried to his elder sister’s residence in Mujau Village, hoping to alert her to the unfolding tragedy.

For nearly two years, since the 14thof June 2022 to January 30, 2024, I was a subject of repression and kept in prison, being denied bail. I took the challenge in the stride, taking it as we go. When you are under attack, I learnt not to panic but repel everything thrown at you and use it to sustain oneself
against all adversities. I am hardened ladies and gentlemen. There is nothing that would be thrown at me that will either shake or frighten me.

In reflection, when I came out, I issued the following thanksgiving statement.

“For nearly two years, I suffered in my oppressor’s dungeon.

You prayed for
me to be released from the jaws of my tormentors. You clamored loudly for
my release as you knew that I was innocent. You stood with my family. I am
crying as I type this statement. Your love strengthened me throughout. I
deeply understand the pain and agony we shared together during the period
of my unmitigated oppression but let me reassure all of you that;

I am prepared to pay any price for the love of my country,

I am prepared to pay any price for the love of Zimbabwe,

I am prepared to pay any price in defense of democracy, freedom and the
happiness of our people.

To all Zimbabweans in the country and the diaspora, I thank you.

Let me thank all progressive organizations in politics, in the media, civic society, student bodies, professionals, members of parliament both
domestically and internationally for ceaseless condemning the tyrannical
persecutions perpetrated upon me by my enemies.

Let me also thank members of the Diplomatic Corp from world democracies
and Africa whose solidarity was priceless.

I also want to thank the World Governments who remained alert to what was transpiring on my persecution.

To the Free Job Sikhala Solidarity Movement, you were the missing link in
Zimbabwe’s political equation. To my lawyers, words alone are insufficient to
express my gratitude. To Mai Sikhala and family, thank you very much for your love.

With all my love, may the Almighty God bless all of you.
If I omitted or overlooked to thank others who devoted their time, energy and
emotions for my freedom, my sincere apologies. I sincerely thank you. The
new democratic culture which we will ever strive to achieve, even if it means
with our own blood, does not absolve me from criticism on omissions which I
could have done. This is the cornerstone of the democratic struggle we have
been engaging in, and which we desire to build in Zimbabwe.

It is sad that for the past two years when I was in prison, things have turned for the worse. I still found people in abject poverty, struggling for a meal a day, shrinking democratic space, entrenched dictatorship, fear and
hopelessness of the direction the country is going. Elections came and went
when I was in prison, amid an extreme toxic political environment, and the clamor for economic and electoral reforms. Before going further, any form of
electoral process in our country under the same usual conditions and without
the necessary reforms to deliver the will of the people, has been a challenge
confronting us as Zimbabwe since the emergency of the mass democratic
struggle in our Country. This is the center of the democratic struggle for any
future political trajectory in Zimbabwe. The call for reforms shall be the forte
of our struggle and shall position and give the people of Zimbabwe a golden
chance to choose leaders of their own choice. The question to ask is whether
the mass democratic struggle is going to achieve a different result from our
experiences of the past? What is the strategy? I will come to this subject at
the later stage.

What is currently happening in the opposition is not uncommon. It is the
common political strategy that has happened and implemented by despots
throughout the world down the centuries. Mobutu Sese Seko used the same
strategy of distributing patronage and buying of individuals in opposition
ranks to destroy and disorganize it by exploiting the discovered weaknesses
in the opposition superstructure. During the mass democratic revolt against
imperialism and colonialism in our own country, the Rhodesian kingpin, Ian
Douglas Smith implemented the strategy with perfection to the extent of
delivering an internal settlement. Series of Apartheid leaders applied the same
strategy and tactics and ended up establishing homelands which purportedly
gave a façade of independence to black self-governed enclaves. Dear
Zimbabweans and worldwide friends, Zimbabwe is at the crossroads.
Coming back to the question of whether the mass democratic struggle in our
nation is going to achieve a different result from our experiences of the past?

Yes, it will be. Yes, it will be. How? Our seemingly unsurmountable struggle for freedom and emancipation needs everyone on board, whether black, white
or yellow. It is our challenge together. Our struggle should not be restricted
by narrowness, lack of initiative and hesitation. The question on what to do next is answered by the authors and originators of the mass democratic
struggle in Zimbabwe who are the people who, in February 1999, spoke through the People’s Working Convention, where all constituents bodies were
represented. The People’s Working Convention was an affirmation to Martin
Luther King Jnr’s proclamation that:

“There comes a time when people get tired of being trampled over by the
iron feet of oppression. There comes a time when people get tired of
being flunk across the abyss of humiliation where they experience the bleakness of nagging despair.”

The weakness of our 1999 approach was that the meeting of the constituent
bodies was heavy at the top with only the ZCTU having grassroots structures.
It was the meeting of constituent bodies at the national leadership level with
less participation from the shopfloor and village level which eventually led to the clash of egos. Zimbabwe needs a way forward to answer the national
question, of whereto from here. The way forward on what should be done from
here will come from the people through a Mass Nationwide Democratic
Consultative Process. The national consultative process will convene
Nationwide Democratic Consultative Conventions. The Consultative process
will involve all important constituent bodies, that is, the general masses of
our people, labor, students, traditional leaders, churches, civic society,
businesspersons, professionals, residents’ associations, informal traders,
women clubs, farmers, peasants, youth organizations, progressive political
organizations, war veterans, war collaborators, artists, corporate business
sector, and people living with disabilities.

It will start from the village, to the
ward, district and the provincial level. This process will be conducted by the
representatives of different constituent bodies at every level.

The process will
eventually lead to the convening of the National People’s Democratic
Convention. The input and ideas that will come from the people will be
collated and coalesced by the National Democratic Taskforce made up of
seconded persons from different constituent bodies who will be the conveners
of the National Democratic Peoples Convention. Each ward, in this process,
shall elect a delegate to attend the National People’s Democratic Convention
which will debate the views collated and coalesced during the Democratic
Consultative Conventions held at the shopfloor and grassroots level
throughout the country. This will be our guide to the future.

Critics are pointing out that some constituent bodies have been hijacked by
ZANU PF like what they have done to the CCC. Let me give you as an example,
bodies such as ZCTU, or any other constituent body do not mean persons at
leadership level. ZCTU is the worker who is at the shopfloor level. It is not its
leadership. There is no ward, district or province without a student, a worker
or a church elder.

Those are the ones that will constitute the Democratic
Consultative Convention.

Therefore, there will be no one left without being
consulted from Malipati to Matusadonha, from Kotwa to Manama, from
Sipepa to Muzarabani. We are embodied by the declaration of Nelson Mandela
that;
“Action without vision is only passing time, vision without action
is merely daydreaming, but vision with action can change the world.”

We are not here to pronounce the emergence of a political organization but a
broad-based mass democratic movement for everyone in advancement of the
mass democratic struggle in the fashion of the United Democratic Front (UDF)
of the 1980s in apartheid South Africa. This is motivated in remembrance of
the great ideals held by many Zimbabweans who perished during the period
of the liberation struggle, Gukurahundi and those who died since the
resuscitation of the goals and aspirations of the mass democratic struggle in
February 1999.

Dala Costa had this message for all the leaders,
“Do not promise what you cannot deliver, do not misrepresent, do not
hide behind spin doctored evasions, do not suppress obligations, do not
evade accountability, do not accept the survival of the fittest pressures”.

We promise that we will stand by our word and deliver in terms of our pact.

We are not men and women of empty threats. We are decisive in our
declarations.

The mass democratic struggle is people driven and owned.

Every struggle
waged throughout the world has succeeded when people own it.

The masses
must own the next decisive stage of our struggle. Whether I will be there with
you or not, as my enemies have not shelved their plan to assassinate me for
the sins best known to themselves, this process must proceed uninhibited to
finality.

With or without resources, the people shall carry out this most important task
in the decisive phase of our history and our people’s struggle against tyranny
for their freedom, dignity and prosperity.

To all those who have returned their democratic right to cling to the CCC carcass, I wish them all the best in their
project.

We pray to the God of David to give us strength not to be shaken by the antics
of our enemies and to bless the fruits of our labour and efforts.

With or without resources, the people shall carry out this most important task in the decisive phase of our history and our people’s struggle against tyranny for their freedom, dignity, and prosperity.”

In a courageous move, Sikhala extended his well wishes to those choosing to remain with the CCC carcass, recognising their democratic right while highlighting the urgency of the people taking charge of the forthcoming critical phase in Zimbabwe’s struggle against tyranny.

Sikhala’s announcement follows closely on the heels of CCC’s founding leader Nelson Chamisa’s departure, who cited ZANU PF infiltration as the reason for his exit just two weeks ago.

Sikhala, recently released after spending an astonishing 595 days in pre-trial detention on charges of inciting public violence, faces another legal battle.

On Wednesday, he was convicted by Harare Magistrate Feresi Chakanyuka for publishing falsehoods prejudicial to the state.

The court is set to deliver its sentence on 16 February, adding another layer of adversity to Sikhala’s ongoing commitment to Zimbabwe’s democratic evolution.

Zimbabwe’s political equation. To my lawyers, words alone are insufficient to
express my gratitude. To Mai Sikhala and family, thank you very much for your love.

If I omitted or overlooked to thank others who devoted their time, energy and
emotions for my freedom, my sincere apologies. I sincerely thank you. The
new democratic culture which we will ever strive to achieve, even if it means
with our own blood, does not absolve me from criticism on omissions which I
could have done. This is the cornerstone of the democratic struggle we have
been engaging in, and which we desire to build in Zimbabwe.

It is sad that for the past two years when I was in prison, things have turned for the worse. I still found people in abject poverty, struggling for a meal a day, shrinking democratic space, entrenched dictatorship, fear and
hopelessness of the direction the country is going. Elections came and went
when I was in prison, amid an extreme toxic political environment, and the clamor for economic and electoral reforms. Before going further, any form of
electoral process in our country under the same usual conditions and without
the necessary reforms to deliver the will of the people, has been a challenge
confronting us as Zimbabwe since the emergency of the mass democratic
struggle in our Country. This is the center of the democratic struggle for any
future political trajectory in Zimbabwe. The call for reforms shall be the forte
of our struggle and shall position and give the people of Zimbabwe a golden
chance to choose leaders of their own choice. The question to ask is whether
the mass democratic struggle is going to achieve a different result from our
experiences of the past? What is the strategy? I will come to this subject at
the later stage.

What is currently happening in the opposition is not uncommon. It is the
common political strategy that has happened and implemented by despots
throughout the world down the centuries. Mobutu Sese Seko used the same
strategy of distributing patronage and buying of individuals in opposition
ranks to destroy and disorganize it by exploiting the discovered weaknesses
in the opposition superstructure. During the mass democratic revolt against
imperialism and colonialism in our own country, the Rhodesian kingpin, Ian
Douglas Smith implemented the strategy with perfection to the extent of
delivering an internal settlement. Series of Apartheid leaders applied the same
strategy and tactics and ended up establishing homelands which purportedly
gave a façade of independence to black self-governed enclaves. Dear
Zimbabweans and worldwide friends, Zimbabwe is at the crossroads.
Coming back to the question of whether the mass democratic struggle in our
nation is going to achieve a different result from our experiences of the past?

Yes, it will be. Yes, it will be. How? Our seemingly unsurmountable struggle for freedom and emancipation needs everyone on board, whether black, white
or yellow. It is our challenge together. Our struggle should not be restricted
by narrowness, lack of initiative and hesitation. The question on what to do next is answered by the authors and originators of the mass democratic
struggle in Zimbabwe who are the people who, in February 1999, spoke through the People’s Working Convention, where all constituents bodies were
represented. The People’s Working Convention was an affirmation to Martin
Luther King Jnr’s proclamation that:

“There comes a time when people get tired of being trampled over by the
iron feet of oppression. There comes a time when people get tired of
being flunk across the abyss of humiliation where they experience the bleakness of nagging despair.”

The weakness of our 1999 approach was that the meeting of the constituent
bodies was heavy at the top with only the ZCTU having grassroots structures.
It was the meeting of constituent bodies at the national leadership level with
less participation from the shopfloor and village level which eventually led to the clash of egos. Zimbabwe needs a way forward to answer the national
question, of whereto from here. The way forward on what should be done from
here will come from the people through a Mass Nationwide Democratic
Consultative Process. The national consultative process will convene
Nationwide Democratic Consultative Conventions. The Consultative process
will involve all important constituent bodies, that is, the general masses of
our people, labor, students, traditional leaders, churches, civic society,
businesspersons, professionals, residents’ associations, informal traders,
women clubs, farmers, peasants, youth organizations, progressive political
organizations, war veterans, war collaborators, artists, corporate business
sector, and people living with disabilities.

It will start from the village, to the
ward, district and the provincial level. This process will be conducted by the
representatives of different constituent bodies at every level.

The process will
eventually lead to the convening of the National People’s Democratic
Convention. The input and ideas that will come from the people will be
collated and coalesced by the National Democratic Taskforce made up of
seconded persons from different constituent bodies who will be the conveners
of the National Democratic Peoples Convention. Each ward, in this process,
shall elect a delegate to attend the National People’s Democratic Convention
which will debate the views collated and coalesced during the Democratic
Consultative Conventions held at the shopfloor and grassroots level
throughout the country. This will be our guide to the future.

Critics are pointing out that some constituent bodies have been hijacked by
ZANU PF like what they have done to the CCC. Let me give you as an example,
bodies such as ZCTU, or any other constituent body do not mean persons at
leadership level. ZCTU is the worker who is at the shopfloor level. It is not its
leadership. There is no ward, district or province without a student, a worker
or a church elder.

Those are the ones that will constitute the Democratic
Consultative Convention.

Therefore, there will be no one left without being
consulted from Malipati to Matusadonha, from Kotwa to Manama, from
Sipepa to Muzarabani. We are embodied by the declaration of Nelson Mandela
that;
“Action without vision is only passing time, vision without action
is merely daydreaming, but vision with action can change the world.”

We are not here to pronounce the emergence of a political organization but a
broad-based mass democratic movement for everyone in advancement of the
mass democratic struggle in the fashion of the United Democratic Front (UDF)
of the 1980s in apartheid South Africa. This is motivated in remembrance of
the great ideals held by many Zimbabweans who perished during the period
of the liberation struggle, Gukurahundi and those who died since the
resuscitation of the goals and aspirations of the mass democratic struggle in
February 1999.

Dala Costa had this message for all the leaders,
“Do not promise what you cannot deliver, do not misrepresent, do not
hide behind spin doctored evasions, do not suppress obligations, do not
evade accountability, do not accept the survival of the fittest pressures”.

We promise that we will stand by our word and deliver in terms of our pact.

We are not men and women of empty threats. We are decisive in our
declarations.

The mass democratic struggle is people driven and owned.

Every struggle
waged throughout the world has succeeded when people own it.

The masses
must own the next decisive stage of our struggle. Whether I will be there with
you or not, as my enemies have not shelved their plan to assassinate me for
the sins best known to themselves, this process must proceed uninhibited to
finality.

With or without resources, the people shall carry out this most important task
in the decisive phase of our history and our people’s struggle against tyranny
for their freedom, dignity and prosperity.

To all those who have returned their democratic right to cling to the CCC carcass, I wish them all the best in their
project.

We pray to the God of David to give us strength not to be shaken by the antics
of our enemies and to bless the fruits of our labour and efforts.
