COVID-19 Update Zimbabwe April 4

Former first lady Grace Mugabe is reported to be worried over her son Robert Mugabe Jnr’s newfound associations in ZANU PF.
Robert Jnr graced the ZANU PF Chitungwiza rally two weeks ago in the company of self-proclaimed prophet Passion Java and other socialites.
Mugabe even shook hands with President Emmerson Mnangagwa and posed for a photo with the president’s son, Emmerson Mnangagwa Jr.
Grace is worried that Robert could get sucked into deadly ZANU PF fights given how his late father lost his position as party leader and Head of State.
The NewsHawks reported a family source as saying Grace is not happy with Robert Jr’s links with Java. Said the source:
She is worried and very angry with him at the same time. The former first lady only learnt about the Passion Java, Robert Jnr links a few weeks ago and she is not happy with that. Not only Amai is unhappy about that, but the whole family.
In a recent interview with a local online platform, Robert Jnr confirmed his relationship with Java. He said:
Our relationship is just natural. I first saw him on social media and thought he was a funny guy.
He is smart and I always wanted to meet him and it so happened we were in Zimbabwe at the same time.
One of my friends who knows him linked me and we linked up and we now spend a lot of time almost every day.
He is a spiritual guy, a decent and straight person and I look at him as a mentor. He is like a spiritual figure in my life. He is wise, a wise guy.

By-A 35-year-old Maphisa man is on the run after he allegedly killed his neighbour by stabbing him with a knife in the chest in a dispute over an undisclosed issue.
Matabeleland South provincial police spokesperson, Inspector Loveness Mangena confirmed the incident which occurred at Mathale Business Centre in Maphisa.
She said the suspect who was still at large, Pride Ndlovu had a fight with Brighton Mlambo and a fellow villager intervened. She said the pair had another confrontation the following day where Ndlovu stabbed Mlambo and he died on the spot.
“I can confirm that we recorded a murder case in Maphisa where a man fatally stabbed another. Pride Ndlovu and Brighton Mlambo were drinking at Mathale Business Centre when they had a misunderstanding over an undisclosed issue. They exchanged blows but a villager managed to restrain them.
“On the following day Ndlovu and Mlambo met at the business centre and they had an altercation which emanated from the previous grudge. Ndlovu retrieved a knife from his trousers pocket and stabbed Mlambo in the chest before fleeing the scene. Mlambo bled profusely and he staggered for a distance of about 10 metres before he collapsed and died. The matter was reported to the police who attended the scene and the now deceased’s body was taken to Maphisa District Hospital Mortuary,” she said.
Insp Mangena said police had launched a manhunt for Ndlovu and she appealed with members of the public with information on his whereabouts to visit any police station near them.
She appealed with members of the public to desist from resorting to violence in a bid to resolve disputes.
“As police we continue to emphasise restraint among people. People shouldn’t resort to violence to resolve disputes or keep grudges. These two men had a misunderstanding and two days later they still had a grudge which resulted in the death of one of them. Most of these murder cases are caused by issues that can be resolved amicably,” she said.
By- The 28 parliamentarians that won seats in the National Assembly elections held in the by-elections held on March 26 have been sworn in.
The MPs took their oaths before Clerk of Parliament Mr Kennedy Chokuda.
Citizens Coalition for Change won 19 seats, with Zanu PF grabbing nine.
By-The ruling Zanu PF party has vowed that it will never surrender power to opposition parties, saying it will “rule for a very long time”.
This was disclosed yesterday by Zanu PF secretary for administration Obert Mpofu in Harare while officiating at a send-off ceremony of 36 party members set for a training stint at the Julius Nyerere Leadership Centre in Tanzania.
The centre, which was built by the Chinese Communist Party on a US$40 million budget, specialises in policy and leadership studies.
Mpofu described Zanu PF as one of the most formidable political parties in southern Africa.
“We are going to be in power for a very long time. We are not going to surrender power. We will always be the governing party,” Mpofu said.
Mpofu revealed that in January 2019 during fuel protests, panicky President Emmerson Mnangagwa had to hastily dispatch the late Agriculture minister Perrance Shiri to Tanzania to lobby for support to quash the protests as he felt that his grip on power was under threat.
“President Mnangagwa had to dispatch the late Air Chief Marshal Perrance Shiri to lobby for support in Tanzania after the stay-away. The late Tanzanian President John Magufuli promised unwavering support and said all regime change machinations would be thwarted,” Mpofu said.
During the three-day protests, security forces used lethal force to crush nationwide demonstrations after government had announced a fuel price increase of 150%. Security forces fired live ammunition on unarmed civilians, killing 17 people.
Mpofu flaunted his liberation war credentials, claiming that he was trained in Tanzania during the liberation struggle.
“Tanzania was one of the first countries to train liberation fighters. I trained in Tanzania in 1968 where I was with the likes of Ambrose Mutinhiri who was an instructor then.”
Mpofu said the 36 trainees were drawn from the ruling party, the public service and other institutions.
The Julius Nyerere Leadership Centre prides itself in contextualising problems and their solutions. It draws from a wide variety of approaches, that include, innovative policy leading research, quality dialogues, youth training and mentoring, providing an important platform for distinguished African intellectuals and scholars. By-Fired Affirmative Action Group leadership led by Mr Mike Chimombe has challenged their ouster and said that it wanted to form a rival empowerment lobby.
They said they would accept the decision taken by founding president, Philip Chiyangwa, who remains the signatory to the AAG accounts.
Last week, Chiyangwa dissolved the AAG presidium with Mr Scott Sakupwanya taking over the reins from Mr Chimombe.
Mr Chimombe and his executive claimed they did not receive any formal communication from Chiyangwa about their expulsion saying they only knew of the development through the media.
“We are here to respond to the dissolution of AAG executive led by Mr Chimombe. We only say the dissolution was made through the media. We have never received any formal communication to date.”
Speaking at a media conference in Harare recently outgoing vice president responsible for operations, Mr Munyaradzi Kashambe, said they respected the decision made by Chiyangwa.
Chiyangwa said the decision was meant to strengthen and augment the zeal to empower the organisation.
“However, it is a bit of a surprise that an executive that has gone worldwide can be dissolved without any meeting or formal communication. It left us with no option, but to accept what Chiyangwa has done to us.
“We have realised that we cannot fight back or force ourselves to be part of AAG. This is a decision made by Chiyangwa,” said Mr Kashambe.
He confirmed that they were going to form a rival outfit saying consultations with relevant stakeholders were underway.
“We are leaving AAG to come up with a new baby after consultations with the relevant stakeholders and our national executive.
“We are coming up with a new name that is people centred, coming from the people, by the people, for the people.
“We want to come up with an empowerment lobby group that will cater for the people in the rural areas of Zimbabwe and abandon this elitist organisation,” said Mr Kashambe.
The new lobby, he said, was going to be broad-based with a national outlook. Herald
By- High Court judge Justice Gladys Mhuri Monday dismissed an application by activist Namatai Kwekweza, who sought to challenge the legality of the extension of Chief Justice Luke Malaba’s term of office by five years.
On May 16 last year, President Emmerson Mnangagwa extended Malaba’s term of office saying he was medically fit to continue as the country’s top judge despite being 70, the retirement age for judges.
Several human rights organisations, including Zimbabwe Human Rights NGO Forum executive director Musa Kika, contested the decision without success.
On May 20 last year, Kwekweza wrote to the Judicial Service Commission (JSC) through her lawyers Scanlen and Holderness requesting information relating to how the JSC had arrived at the decision to recommend the extension of Malaba’s term of office beyond retirement age. Kwekweza submitted in her letter:
How did the JSC come to a decision on the appropriate recommendation to make to the President under section 186(1) of the Constitution of Zimbabwe relating to … Malaba’s bid to continue as CJ for another five years? In particular, was a meeting held by the commissioners for this purpose? Was a resolution passed to make the appropriate recommendation? If so, may we have a copy of the resolution? If a resolution was passed … which commissioners of JSC voted in favour of recommending that … Malaba’s tenure be extended for another five years and which commissioners voted against?
The JSC responded through its legal practitioners Kantor and Immerman dismissing Kwekwedza’s request saying that it infringed on the individual’s rights. The JSC lawyers wrote back:
Kindly note that our client avers that the information request you have made is not in accordance with the applicable law. Any such request is subject to the rights of the individuals and institutions concerned. There’s no automatic right to the information.
Kwekweza was, however, not satisfied with the response and she filed a High Court application.
Justice Mhuri said the case confirmed the CJ’s position to remain in office for the next five years as accepted by the President. Mhuri added that the case sealed and brought to finality any challenge to the CJ’s extension of tenure and all the processes that led to it.

The Castle Lager Premiership will continue a with a full round of fixtures, starting on Friday.
ZTN will broadcast three matches on their Social Media platforms.
The games that will be screened are Harare City vs Tenax, Herentals vs Triangle United and CAPS United vs Yadah.
Other Matchday 11 fixtures are Highlanders vs Cranborne Bullets, Bulawayo City bs FC Platinum.
Recently-appointed Ngezi Platinum coach Benjani Mwaruwari will be looking for his first win in the ZPSL when his side hosts Dynamos.
Here is the full fixture schedule.- Soccer24 Zimbabwe
Ngezi Platinum gaffer Benjani Mwaruwari will arguably face the toughest challenge in his coaching career when his side faces Dynamos in an interesting Castle Lager Premier Soccer League clash this weekend.
The former Manchester City striker took over the reins at Madamburo two weeks ago and managed a 1-1 stalemate with struggling Bulawayo Chiefs in his first match last Sunday.
Up next for the Mhondoro-based side is the visit of a Dynamos firing from all cylinders.
Tonderai Ndiraya’s charges have won five consecutive games since they lost to log leaders Chicken Inn in February and are now just a point adrift of the Gamecocks heading into this weekend’s fixtures.
What makes the clash even more interesting is that Ndiraya himself is a former Ngezi coach, a team that also has former Dynamos within their ranks.
Midfielder Denver Mukamba will want to show his former paymasters that he still has what it takes to hurt them.
Ndiraya will hope that young Bill Antonio continues with the form he is currently in.
The former Prince Edward School pupil scored a sensational solo goal which sunk army side Black Rhinos in a tense match at the National Sports Stadium last Sunday.- Soccer24 Zimbabwe

Ovarian cysts are solid or fluid-filled pockets in or on your ovary.
They’re common, especially in women who are pregnant or who haven’t gone through qmenopause yet. Most of the time, they’re painless and harmless.
You might get one every month as part of your menstrual cycle and never know it. They usually go away on their own without treatment.
A cyst becomes a problem when it doesn’t go away or gets bigger. It can become painful.
There’s also the possibility of cancer, but it’s rare. The chances go up as you get older.
Ovarian Cyst Symptoms
Most ovarian cysts are small and don’t cause any problems.
When there are symptoms, you might have pressure, bloating, swelling, or pain in one side of your lower belly.
This pain may be sharp or dull, and it can come and go.
Sudden, severe belly pain
Pain with fever and throwing up
Dizziness, weakness, or feeling faint
Fast breathing
These things could mean your cyst has caused the ovary to twist.
Ovarian Cyst Causes
Most cysts are “functional.”
They’re a part of your monthly cycle.
Types of Cysts Follicle cyst.
Your ovaries usually release one egg each month. It grows inside a tiny sac called a follicle.
When th HBe egg is ready, the follicle breaks open and releases it.
If the sac doesn’t open, it causes a follicle cyst. These often go away in 1 to 3 months.
Corpus luteum cyst.
Once the egg is released, the empty follicle usually shrinks and helps get ready for the next egg.
It becomes a cyst when it closes back up and fluid collects inside. It may go away in a few weeks. But it may bleed or cause pain as it grows.
Others are nonfunctional. In some women, their ovaries make a lot of small cysts.
This condition is called polycystic ovary syndrome (PCOS).
It can make it hard to get pregnant. Other nonfunctional cysts may be caused by cancer.
Ovarian Cyst Risk Factors
Things that may make you more likely to get ovarian cysts include:
Hormonal problems. Taking the fertility drug to help you ovulate can increase your risk of cysts.
Pregnancy
The cyst that forms during ovulation may stay on your ovary after you get pregnant and throughout your pregnancy.
Endometriosis. Cells that usually line the inside of your uterus grow outside it.
These wayward cells can attach to your ovary and cause a cyst to grow.
A severe pelvic infection. If this spreads to your ovaries, it can cause cysts there.
A previous ovarian cyst. If you’ve had at least one ovarian cyst before, you’re more likely to get others
Ovarian Cyst Complications
Some women can have unusual complications with ovarian cysts. Your doctor might pick these up during a pelvic exam, so it’s important to get regular checkups.
Ovarian torsion. If cysts grow large, they can make the ovary move and twist.
This twisting (ovarian torsion) is very painful.
Rupture.
Cysts can break open, causing severe pain and bleeding, especially if the cysts are large. Vaginal sex and other activities can make a rupture more likely.
A ruptured cyst sometimes heals on its own, but often, it’s a medical emergency.
Infected ovarian cyst. An ovarian cyst can develop in response to a pelvic infection, forming an abscess. If the abscess bursts, dangerous bacteria can spread through your body.
Ovarian Cyst Treatment
Most cysts go away on their own. Your doctor may suggest watching and waiting for changes.
Your doctor can give you medicine for pain. They might also prescribe birth control pills.
The hormones in the pills won’t make the cysts go away, but they can help prevent new ones.
Some ovarian cysts need surgery. That includes those that are large, don’t go away, or cause symptoms.
You could also need surgery if you’re near menopause, because cysts are more likely to be cancerous.
Depending on your case, the surgeon may take just the cyst or the entire ovary.
There are different types of surgery:
Laparoscopy is for smaller cysts. The doctor makes a tiny cut above or below your bellybutton.
A small tool with a camera allows your doctor to see inside, and a different tool removes the cyst or ovary. You probably won’t have to stay in hi the hospital overnight.
Laparotomy is for cysts that may be cancerous. It is done with a bigger cut in the belly.

By Nomusa Garikai- “We have a situation where a snake sneaked into the house, swallowed all the kids and when we attempted to kill it, we did not finish it off … And now we want it to be part of the family. No. You can’t bandage a snake because when it heals it will bite you,” said Citizens Coalition for Change (CCC) interim chairperson Tabitha Khumalo.
“It’s frightening to hear some people suggesting that we should form a coalition with Mwonzora before the next elections. We are where we are today because of Mwonzora and Thokozani Khupe. We can’t work with such people. People rejected them long back, they rejected them in the recent by-elections and continue rejecting them right now,” she said
Since the March 2020 High Court ruling declaring Chamisa’s seizure of power in 2018 unconstitutional, MDC A has faced many trials and tribulations, and, worst of all, has failed to hold the rampaging Zanu PF regime to account on such matters as looting covid 19 aid, at least. Still, it is rich to blame Khupe and Mwonzora for this, calling them snakes, when it is clear Chamisa was the culprit.
Indeed, it MDC/CCC leaders’ corrupt and breath-taking incompetence that has always got the better of them making them fail to be objective and decisive even when the situation demanded it.
The greatest individual and collective failure of the MDC/CCC leaders was failing to implement even one meaningful democratic reform during the 2008 to 2013 GNU. All the parties’ big guns Morgan Tsvangirai, Thokozani Khupe, Nelson Chamisa, Tendai Biti, Douglas Mwonzora, David Coltart, Welshman Ncube, Tabitha Khumalo, etc., etc. where all in the GNU. For five years of the GNU not even one of them had the common sense to propose one reform!
It was USA ambassador to Zimbabwe 2004 to 2007, Chris Dell, who said in a leaked cable back to Washington that Morgan Tsvangirai was “a flawed and indecisive character who would become an albatross round the nation’s neck if he ever got into power!” He could have said the same about the wildebeest empty heads around Tsvangirai.
Tsvangirai and company did get into power, the GNU, and, as noted above, they proved utterly useless. MDC/CCC has remained the country’s main opposition party and has blundered from pillar to post.
“My brother Mnangagwa has done me a great favour by taking away the bad apples!” boasted Nelson Chamisa when he launched CCC in January 2022. If wishes were horses, the poor would win every horse-race!
Even if CCC does not take back Khupe and Mwonzora, the snakes, or Saviur Kasukuwere, Professor Jonathan Moyo and the other G40 leaders (Chamisa is so desperate to win, he will take anyone even Zanu PF thugs); CCC will still blunder from pillar to post because there is plenty of deadwood in the party from the GNU days including Chamisa himself.
Yes, the 26 March 2023 by elections results shows the people of Zimbabwe support CCC and have rejected Douglas Mwonzora and his MDC-T lot. Chamisa and company want the world to believe the elections result is proof he and his team are competent.
The truth is most of the people who voted for CCC have no clue what the 2008 GNU was about much less that Chamisa and company sold out big time. And the few who know MDC leaders sold out for them out of desperation; they are hoping against reason that CCC will deliver, finally, the democratic change the nation has been dying for decades now. Hardly a resounding endorsement of CCC’s competence!
What we can be certain of is that CCC will blunder from pillar to post, Chamisa and company are participating in the 2023 elections with no reforms in place. And Zanu PF will rig the elections and win and by participating CCC will give Zanu PF legitimacy. Even if CCC was to win the 2023 elections, they will NOT implement any meaningful democratic reforms; they are incompetent to implement the reforms but smart enough to know the excessive dictatorial powers will work in their favour.
The people of Zimbabwe have risked live and limb to elect MDC/CCC into office on the understanding they will implement the democratic reform and end the Zanu PF dictatorship. They have not only failed to implement even one reform but worse still they are now participating in flawed elections to give Zanu PF legitimacy and perpetuate the dictatorship.
Ambassador Dell was right, MDC/CCC leaders are now an “albatross round the nation’s neck”!
“CCC can’t work with Mwonzora and Khupe, snakes!” Whatever the two have done, it is nothing compared to the MDC leaders’ treasonous betrayal of failing to implement ever one democratic reform in 22 years, 5 of which in the GNU. The overwhelming majority of the corrupt and incompetent GNU are in the CCC already; he/she who did not sell out during the GNU must cast the first stone!

By A Correspondent| The opposition MDC-T has refuted claims that it has dismissed its Harare provincial spokesperson Fungai Chiposi saying there is no party position against his party membership.
Posting on Twitter in response to Chiposi’s earlier message announcing that he is walking away from the party, national spokesperson Witness Dube said the incident that happened at the National Council will be dealt with by the relevant party organs.
“I have just gotten off 15mins of the phone with my long time colleague @FungaiChiposi to explain that there is no party position against his membership. What he is alleging happened at the NC remains an INCIDENT that will be properly dealt with by the relevant party organs,” said Dube.
Following its dismal showing in the recently held by-elections, MDC-T leadership has engaged a vindictive gear and suspended its Epworth parliamentary candidate Zivai Mhetu and Chiposi for speaking out against party leadership.
By A Correspondent| The Douglas Mwonzora led MDC-T appears to be on a free-fall after the Harare provincial spokesperson and losing candidate for Kambuzuma parliamentary elections, Fungai Chiposi quit the movement following his fallout with the leadership.
This follows Chiposi’s interview in which he clearly stated that his by-elections loss was down to the leadership of the party which was rejected by voters.
His views landed him in deep trouble as he was barred from entering the party headquarters for the National Council meeting on Friday last week.
Chiposi later confirmed that he had been ejected from all party WhatsApp groups though the movement had not communicated its decision on him.
He has since walked away from the movement saying he accepts the decision of the party to expel him.
“I however accept the decision of the MDC-T to expel me from the party, as expressed in those actions and am therefore nolonger a member of the MDC-T,” said Chiposi.
By A Correspondent- The ruling Zanu-PF party has vowed that it will never surrender power to opposition parties, saying it will “rule for a very long time”.
This was disclosed yesterday by Zanu-PF secretary for administration Obert Mpofu in Harare while officiating at a send-off ceremony of 36 party members set for a training stint at the Julius Nyerere Leadership Centre in Tanzania.
The centre, which was built by the Chinese Communist Party on a US$40 million budget, specialises in policy and leadership studies.
Mpofu described Zanu-PF as one of the most formidable political parties in southern Africa.
It draws from a wide variety of approaches, that include, innovative policy leading research, quality dialogues, youth training and mentoring, providing an important platform for distinguished African intellectuals and scholars.-newsday
By A Correspondent- A standoff between markers and the Zimbabwe Schools Examination Council (Zimsec) has resulted in the examination board failing to release the 2021 Ordinary and Advanced Level results in time.
In previous years, Zimsec would release results in February, giving prospective “A” Level pupils time to enrol and learn for at least a month.
However, the first term ends on Thursday, with both “O” and “A” Level results for 2021 yet
to be released, affecting for high schools and universities plans.
Scores of markers boycotted marking of examinations midway after Zimsec failed to pay agreed allowances.
The delay in releasing the results has resulted in “O” Level pupils failing to enrol for Form 5 classes for the first term.
It has also seen some pupils awaiting “A” Level results failing to enrol with tertiary institutions such as the Zimbabwe Open University during the March intake window, while others like the Midlands State University have been forced to defer their intakes.
Zimsec spokesperson Nicholette Dlamini yesterday blamed the COVID-19 pandemic for causing a shift in the normal calendar of the marking and release of the examination results.
She said the board would release the results “soon”, but failed to provide the exact date.
“The year 2019 was the last year we had the normal school year. This is 2022 that we are now having a normal school year. If you look at 2021, the first term started in March and last year, the results came on April 23 and we haven’t reached the date,” Dlamini said.
By A Correspondent- A magistrate has been suspended over a litany of charges, including claims she made staff clean her mess in the toilet.
Oratile Nare, a former assistant to a High Court judge, was appointed a magistrate last year after escaping with a warning in another matter in which she was accused of sending a judge’s nudes to a WhatsApp group.
Nare has now been suspended pending investigations into alleged professional misconduct as a magistrate in Nkayi.
Judicial Service Commission secretary Walter Chikwana said: “The magistrate has been suspended to allow investigations into several complaints we have received over her conduct. There is an investigation in progress and we will advise of its findings at the appropriate time.”
ZimLive understands Nare threatened to get prosecutors sacked and verbally abused suspects.
A source said: “The complaints are many and varied. She allegedly made staff flush her mess in a toilet reserved for the magistrate; she allegedly ordered suspects not to look at her and deliberately left her handbag at work before ordering staff to bring it to her.
“Relations with prosecutors were particularly frayed. She would tell them that she’s powerful because she caused a judge to be suspended.”
Justice Thompson Mabhikwa is currently being probed by a tribunal for “gross misconduct” after images said to be of his penis, and intimate chats with a woman, were sent to various WhatsApp groups from his phone.
Mabhikwa has accused Nare of sending the images to spite him, allegedly after she discovered that he was seeing other women.
Nare, who was working as an assistant to Justice Maxwell Takuva of the Bulawayo High Court, escaped with just a warning over the incident, and was later appointed a magistrate.
“She’s aggressive and rude,” a legal source said.

By- That parliament said it was not going to issue cars to newly-elected CCC Members of Parliament.
The Parliament said these MPs got cars as MDC Alliance MPs before they were recalled by MDC-T .
Clerk of Parliament Kennedy Chokuda said this in an interview with The Sunday Mail.
Chokuda said the winners of the by-elections held on March 26 will be sworn in this week after the Zimbabwe Electoral Commission (ZEC) gives Parliament the full list of successful candidates. He said:
The swearing-in of members will be done at the earliest possible date, most probably the first week of April, once ZEC has officially written to Parliament giving us the full list of all the successful candidates.
We note that on 31st March 2022 ZEC gazetted the list of successful candidates and hence we expect that communication any time from now.
Chokuda said all new Members of Parliament (MPs) will receive the Constituency Development Fund (CDF) for this year and next year. Said Chokuda:
In respect of vehicles, this will be treated on a case by case basis depending on the status of the member. The new members will get a vehicle as expected.
Those returning to Parliament and who had received a vehicle during the life of this Parliament have already been covered and hence will not get a new vehicle.
The law says a Member is only eligible for one vehicle every five years.
However, if a Member was recalled before they received a vehicle they will still be eligible to receive a vehicle.
There are 28 new MPs, 19 from CCC, the majority are returning to Parliament, and 9 from ZANU PF.
By A Correspondent- Mashaba area in Matabeleland South province was the scene of bloody clashes at the weekend after Botswana cattle farmers teamed up with Gwanda villagers to attack suspected cattle rustlers.
The cattle rustlers were reportedly caught red-handed driving away donkeys and cattle, leading to the bloody clashes.
This came a few days after authorities from the two countries pledged to co-operate in fighting stocktheft.
A villager said cattle farmers from Botswana came to Gwanda last week to track their stolen cattle.
We then went to the Nhwali area using three cars. At the John dip tank, we found 11 stolen donkeys in a kraal. We apprehended two suspects and drove away the donkeys. The suspects had divided themselves into groups and others were driving stolen cattle. They then attacked and injured four of our members,” said a villager, who refused to be named.
He said those injured were taken to Manama Hospital, where they were transferred to Gwanda Hospital.
“Two of the suspects were apprehended and taken to Guyu Police Station, while one succumbed to injuries,” he said.
Matabeleland South Anti-Stock Theft Association chairperson Victor Sibanda appealed to security forces to intensify patrols along the border area.
Matabeleland South police spokesperson Inspector Loveness Mangena said she could not comment on the issue as she was not at work, while national police spokesperson Assistant Commissioner Paul Nyathi said he was not aware of the incident.-Newsday

By- Exiled former Tourism Minister Walter Mzembi said that the majority of top ZANU PF officials are so old they will be dead by 2028.
The South African-based former G40 kingpin suggested that the demise of “old things” will result in the emergence of a new system that rewards merit not entitlement.
Mzembi made the remarks while contributing to a heated Twitter conversation over the weekend.
A ZANU PF sympathiser had declared that the new parliament building under construction in Mt Hampden will not accommodate opposition members when it is finally commissioned. In response, Mzembi said:
Old things are passing away, by 2028 the remnants will be gone to be with the ancestors.

By- MDC-T has removed its Harare Provincial Secretary For Information and Publicity, Fungai Chiposi, from all internal social media groups.
That was on Friday it had blocked him from entering the party’s Morgan Richard Tsvangirai House headquarters.
In a statement, Chiposi, who ran as the party’s candidate in Kambuzuma Constituency in the 26 March by-elections, said he was blocked by security from entering the offices to attend a National Council meeting and was later removed from party groups. He said:
On Friday 1 April 2022 around 12pm, I was barred from attending the National Council by security at MRT House.
I was informed to contact Youth Chairperson Y. Musarurwa but she was not picking up her phone.
Around 2 pm, I was contacted by the then Chairman Mhetu who asked me to come back to MRT as he would go in with me. However, he was also denied entry.
I met Chairperson Musarurwa and asked her why I was barred and she told me in no uncertain terms to get out of the building. I duly complied.
Later that evening, I was removed from all MDC-T Harare Province groups by Secretary Mukunguma.
Notably, no one has explained to me why these actions were taken. I would like to think the party and its representatives have justification for the above drastic actions.
Chiposi was reportedly blacklisted by the party on allegations of trying to lead a coup against MDC-T president Douglas Mwonzora.
Mwonzora is facing internal revolt after the party failed to win a single parliamentary or local government seat in the 26 March by-elections despite getting $150 million under the Political Parties (Finance) Act.

Netherlands coach and former Man United boss Louis van Gaal has revealed that he’s battling a ‘pretty aggressive form’ of prostate cancer.
The 70-year-old head coach confirmed the diagnosis on Dutch television show Humberto to promote a new film about his life, and admitted that he had kept the news from his players.
“In each period during my time as manager of the national team I had to leave in the night to go to the hospital without the players finding it out until now, while thinking I was healthy, but… I am not,” he said.
“I think you don’t tell people you work with like that because it might influence their choices, their decisiveness. So I thought they shouldn’t know.”
The gaffer added: “You don’t die from prostate cancer, at least not in 90 per cent of the cases. It is usually other underlying diseases that kill you.
“But I had a pretty aggressive form, got irradiated 25 times. Then you have a lot of management to do in order to go through life
“I did have preferential treatment in the hospital. I was allowed in through the back door when I went to an appointment and was immediately pushed into another room.
“I have been treated wonderfully. You will of course tell your friends and relatives about it. The fact that nothing has come out yet also says something about my environment. That’s great.”

“….Khupe was a dumb partner, a mute, ideologically. She only spoke through her person, nothing more…”
By Farai D Hove | Emmerson Mnangagwa’s spokesman George Charamba has described Douglas Mwonzora and Thokozani Khupe as the ZANU PF leader’s girlfriends.
Writing on his state media Jamwanda2 column, Charamba praised the two for taking down Mnangagwa’s political rival Nelson Chamisa during their riotous wrestle for the MDC Alliance organisation.
Charamba said in part:
Khupe picks the prize for ever daring to cross the line for inter-party dialogue, never mind that this was out of necessity. After all she had no way out after Humanikwa, did she? But she boldly moved over, and helped materialise POLAD which ED invented.
History will credit her, whatever her disastrous end.
Mwonzora the ideologue But she was a dumb partner, a mute, ideologically. She only spoke through her person, nothing more.
Yet ZANU-PF needed more than personification; it needed political literacy no iota of which she wielded.
Having created POLAD, ZANU-PF needed an ideologue who would run with, and elaborate on, the concept, through sheer logic and cogency of argument. ZANU-PF’s goal is to insert a new mores in our politics where elections are followed by a de-escalation, all to allow national consensus, national focus and national effort towards betterment of Zimbabweans.
That goal needed validation and echo from its opposite number, something well beyond Khupe conceptually. It needed the agile mind of Mwonzora, who swiftly outgunned Chamisa into an outcast, the black sheep of the Zimbabwe political family.
Political mubvandiripo
With Mwonzora at the helm of MDC —whether T, Alliance or both — POLAD got its mouth, which became a mouthful for Chamisa and all those who bankrolled him.
Even western embassies could not brush aside Mwonzora’s arguments for converged politics. Beyond this elaboration, the legally adept Mwonzora became a two-track menace to Chamisa.
In a series of brilliant legal moves, he rendered Chamisa homeless, both literally and figuratively.
Chamisa lost Harvest House.
And with the subsequent loss of MDC T/Alliance names, Chamisa ceased to be his father’s son, deserving of any heirloom. He became a political mubvandiripo — a political child from elsewhere brought into the fold of mummy’s second marriage! And he admitted to as much, birthing Triple C, his real paternity’s nickname. No DNA test was even necessary! The courts handled Tsvangirai’s political estate handsomely. This redounds to Douglas Mwonzora. Killing for sport Nor was that all. Chamisa’s woes mounted.
Unlike the rather cautious Khupe who recalled her adversaries piecemeal, possibly restrained by a motherly heart – or is it motherly breast too full of the milk of human kindness? — Mwonzora had no breast, no milk to ooze.
He wielded the axe with ruthless abandon,
Mwonzora wielded the axe with ruthless abandon, creating a massive heap of by-electoral rubble which Government had no choice but to clean through March 26 by-elections. If truth be told, Mwonzora forced Government’s hand on these by-elections which he himself, ironically, did not like, and which he would lose dismally. Mwonzora’s recalls became just too many for Government to ignore; the only cure was a round of by-elections which came on March 26.
To that extent, Mwonzora ran and ruled Zimbabwe politically, electorally. Significantly, he still holds the key and tempo to more such by-elections, triggering them by whim and caprice. Soon after results of March 26, he again swung his merciless axe, to recall several councillors, thus triggering the possibility of another round of by-elections, while retaining and fortifying his title as Leader of the Opposition in spite of his defeat. In respect of causing wasteful by-elections, he is some reckless god Shakespeare’s Gloucester had in mind when he remarked: ” As flies are to wanton boys are we to the gods/ They kill us for their sport!”
When nothing changes Mwonzora is not just the Leader of the Opposition in spite of Chamisa’s by-electoral win; he also keeps the purse issuing from national law by way of the Political Parties’ Finance Act.
Add to that the perquisites of the Leader of Opposition, then you have material in part which validates my thesis last week that Mwonzora won before the by-elections.
But it is as an ideologue that Mwonzora
By A Correspondent- A Kadoma pastor was last Tuesday arrested for failing to support his two children.
Pastor Learnmore Mutenha, who is based in Chakari, and belongs to one of the AFM factions, stands accused of allegedly failing to pay $12000, as ordered by the court, for maintenance.
Mutenha is also part of an online group of pastors ‘Kingdom Champions Network International’.
Pastor Mutenha’s former wife, Janet Badza, told H-Metro the man of cloth has not honoured a court order since October last year.
“He is my ex-husband and he has not been paying maintenance of $2400 for his two kids,” said Janet.
“He was arrested.”
H-Metro is reliably informed that Pastor Mutenha was detained at Harare Central Police Station and is expected to appear in court today.
Janet and Pastor Mutenha separated in 2015 and their divorce was granted in October 2019.
RECALLED Harare mayor Jacob Mafume and fellow People’s Democratic Party (PDP) councillors Simon Chabuka (Mutare) and Anorld Batirai Dube (Bulawayo) have approached the High Court challenging their dismissal by Local Government minister July Moyo.
They want their recalls to be declared null and void, saying their constitutional rights were violated.
Mayor Jacob Mafume
Moyo last week announced that the three positions were vacant after they were recalled by PDP in a letter dated March 28, 2022.
“In terms of section 278(i) of the Constitution of Zimbabwe, as read with section (l)(k), the wards the three represented were now vacant because the three had joined Citizens’ Coalition for Change (CCC),” Moyo said.
But Mafume and the two councillors argue that they belonged to the PDP led by Tendai Biti.
They cited Moyo, the town clerks of Harare, Bulawayo, Mutare and the Zimbabwe Electoral Commission as respondents.
Mafume won the 2018 local authority elections in ward 17 in Harare under the MDC Alliance.
Other PDP members who were recalled included Kucaca Phulu, Settlement Chikwinya, Dube, Chabuka, Willias Madzimure, Regai Tsunga, Biti and Chelesile Mahlangu who had won National Assembly seats under the MDC Alliance.
On April 14, 2021, the High Court ruled that only authorised representatives of the PDP led by Biti, in particular under Chikwinya as the secretary-general had the power to act on behalf of the PDP.
“In this regard, Moyo and those who communicated with him are violating our choice by seeking to ascribe us membership of a political party that is alien to us and is certainly not the PDP led by Biti and Chikwinya that we have always been members since 2017,” Mafume submitted.
They asked the town clerks to disregard Moyo’s letter. The matter is yet to be heard.- Newsday
CCC activists Joana Mamombe and Cecilia Chimbiri lost their bid to block the State from tendering documentary evidence that their phones were active in Harare during the time they claimed to have been abducted while a police witness on duty at the roadblock where they claimed to have been arrested said there were no arrests at all.
The two opposition activists are charged with communicating falsehoods prejudicial to the State after they allegedly faked their abductions.
Chief Magistrate Mrs Faith Mushure overruled the objection of Mamombe and Chimbiri allowing the State to tender documentary exhibits.
The defence lawyers failed to show that the phone records of the numbers owned by the two were not relevant for the State’s case.
Mrs Mushure then allowed the State to tender the documents that comprise call data records obtained from Econet and the base stations in Warren Park and Belvedere.
Prosecutor Mr Michael Reza wanted to tender the documents saying they would assist in showing that the SIM cards believed to be owned by the two opposition activists never left Harare on the day in question.
A police officer and State witness, Venenzia Muchenje, who was manning the roadblock near Exhibition Park from 2pm at the place Mamombe and Chimbiri claimed to have been arrested while on their way into the city centre from Warren Park, told the court that no one was arrested at all from 2pm when they assumed duty.
Ms Muchenje told the court that she never saw a Mercedes Benz with women on-board during the time she assumed duty at the roadblock at around 2pm. A man approached them about a few minutes after they went on duty asking whether they had arrested anyone and they told him they had not.
On the phone records, Engineer Christopher Tapera Kazembe told the court, during cross-examination by the duo’s lawyer Mr Alec Muchadehama, that the records only showed the numbers and under which base stations they were active, not the owners of numbers.
The records could only show where the phones were and could not show one way or the other what was happening around the base stations including whether the two were arrested at the roadblock, taken to police station, transferred to another vehicle driven by police, leaving all their belongings, including their vehicle and were driven to Muchapondwa Shopping Centre where they claimed to have been tortured before being dumped.
Asked to comment on whether there was a possibility that the police broke the passwords of the phones, Eng Kazembe said: “It is possible that one can broke the passwords but I am not confirming that the police broke into the cellphones.”
The matter continues today with police officer Muchenje testifying. -Herald

Suspected ZANU PF activists who allegedly murdered a Citizens for Coalition for Change (CCC) Kwekwe activist in February are reportedly threatening witnesses against testifying.
Mboneni Ncube was stabbed twice with a spear at a CCC rally held at Mbizo shopping centre and died on admission to Kwekwe Central Hospital.
The deceased’s sister, Judith Ncube, said she was kidnapped on Thursday evening by suspected ZANU PF activists who threatened to kill her if she continued demanding answers into Mboneni’s murder.
Speaking to The Standard, Judith said she now feared for her life following the abduction incident. She said:
It was around 4 pm when the incident happened. They grabbed and bundled me into their vehicle.
They took me to a ZANU PF base in Kwekwe where they threatened to make me disappear if I kept on pressing for answers to the killing of my brother.
His killers are known and all I want is closure and justice.
The incident was reported to the police and the case number is CRO/04/22.
Also speaking to The Standard, Judith’s lawyer Darlington Marange of the Zimbabwe Human Rights NGO Forum said:
She identified some of the culprits that were implicated in the murder, including some known ruling party bigwigs.
She has been saying that police are refusing to take the names of the perpetrators.
We are now considering visiting the police to iron this out because it falls under their duties to take the report as is and to investigate.
It appears there is some resistance but this is something that we have to iron out.
We are also considering getting a peace order against the people who have been harassing her.
She now lives in fear and we have to now take that route of a peace order to ensure her safety.
The issue of her safety is now of paramount importance outside other legal routes that we want to take.
Other people willing to testify against Ncube’s killers were being harassed constantly, Mbizo MP-elect Settlement Chikwinya claimed.
The Zimbabwe Republic Police (ZRP) arrested 16 ZANU PF youths for Ncube’s murder but later released 11 of them.
The late Ncube had recently remarried following the death of his first wife, with whom he had an eight-year-old daughter.- The Standard
By- Zanu PF councillor Sengerayi Manyanga has accused Masvingo City Council of using the local authority’s vehicles to ferry CCC supporters to attend Nelson Chamisa’s recent star rally.
He was joined in the statement by his colleague Councillor Against Chiteme who said that the vehicles carried supporters to the rally held at Rujeko in Masvingo on March 27 2022.
The councillors made the accusations during a full council meeting on Monday last week.
Mayor Collen Maboke however, said that there should be a separation of council vehicles at the rally and council vehicles ferrying supporters. He said that it was possible that council vehicles were at the rally for other business which he said was normal.
He however, said that investigation must be carried out on the matter.
“As councillors we must stop using council vehicles at political rallies. We saw council vehicles ferrying supporters to attend the Rujeko rally. We all have our parties if we do the same with our parties it won’t go down well with you,” said Manyanga.
“The town clerk has to make an investigation. The vehicles might have been doing council business and that there was a rally was just a coincidence,” said Maboke. Masvingo Mirror
By-Former first lady Grace Mugabe is reported to be worried over her son Robert Mugabe Jnr’s newfound associations in Zanu PF.

By-South Africa President Cyril Ramaphosa has denounced operation Dudula.
Ramaphosa said the ruling African National Congress (ANC) cannot support the anti-foreign nationals campaign by Operation Dudula, describing the movement as a “vigilante-like force”.
Speaking during the ANC’s Mpumalanga conference over the weekend, Ramaphosa said Operation Dudula seeks to divide African people. He said:
We cannot support a vigilante-type-of move against a group of people and particularly targeting them as foreign nationals because what we are doing then is just to divide our people on the African continent.
Operation Dudula emerged in recent months and its members, led by Nhlanhla “Lux”, have been moving door to door in parts of South Africa and kicking out foreigners.
Supporters of the movement accuse foreign nationals of “stealing our jobs” and selling illicit drugs in the country.
Lux was recently arrested and charged while members of the group have pledged their undying support for the movement.
Meanwhile, Fees Must Fall activist Bonginkosi Khanyile has voiced his support for Operation Dudula and urged the South African Government to address the group’s concerns.
Khanyile said Operation Dudula is not against foreign nationals, it is against illegal foreign nationals.
By- The eight Bulawayo City Council (BCC) councillors who won in the 26 March by-elections were sworn in on Monday.
The swearing-in ceremony, which was held at the council chamber, was attended by the newly-elected councillors, other councillors, heads of council departments, and invited guests.
All the eight councillors were elected on Citizens Coalition for Change (CCC) tickets, with five of them formerly MDC Alliance councillors who were recalled from Council by the MDC-T.
The eight are Edwin Ndlovu (Ward 8), Donaldson Mabutho (Ward 9), Lilian Mlilo (Ward 12), Concilia Mlalazi (Ward 13), Christopher Dube (Ward 19), Alderman Earnest Rafamoyo (Ward 20), Tinevimbo Maphosa (Ward 21) and Mpumelelo Moyo (Ward 26).
The swearing-in ceremony was presided over by BCC Town Clerk Christopher Dube while council chamber secretary Sikhangele Zhou assisted the councillors in reciting the oath.
In his remarks soon after the swearing-in ceremony, Bulawayo mayor Solomon Mguni urged all the councillors to work together across the political divide. He said:
For the first time in 20 years, we now have a multiparty chamber and we should work together as councillors for the City of Bulawayo.
We have been given the mandate to serve our people and we call upon unity in the cockpit and serve everyone equally and equitably and the committees should embrace each and every one of us.
Our mandate is to serve the people of Bulawayo. Our main mandate is carrying upon our shoulders the vision of the city, which is to be a smart and transformative city by the year 2024 and we expected all of us to champion this vision and be guided by the values of the city that is integrity, transparency, innovation, accountability, fairness and consultation.
By-Citizens Coalition for Change interim chairperson Tabitha Khumalo has rejected the proposed reunion of MDC-T leader Douglas Mwonzora and his rival Thokozani Khupe, describing them as venomous serpents ready to strike at any time.
While Mwonzora has not expressed a desire to work with CCC, Khupe formally endorsed CCC candidates ahead of the March 26 by-elections.
Khumalo was among the first MDC Alliance MPs to be recalled by Mwonzora and Khupe in 2020 after the Supreme Court installed Khupe as MDC-T acting president. She said:
We have a situation where a snake sneaked into the house, swallowed all the kids and when we attempted to kill it we did not finish it off … And now we want it to be part of the family. No. You can’t bandage a snake because when it heals it will bite you.
It’s frightening to hear some people suggesting that we should form a coalition with Mwonzora before the next elections. We are where we are today because of Mwonzora and Thokozani Khupe.
We can’t work with such people. People rejected them long back, they rejected them in the recent by-elections and continue rejecting them right now.
We just had by-elections in which people expressed their feelings. It’s important to have coalitions but people are saying we should not work hand in hand with Mwonzora and (Thokozani) Khupe. We can’t do what people don’t like.
MDC-T spokesperson Witness Dube said they are willing to work with all opposition political parties, including CCC, ahead of the general elections scheduled for 2023.
Dynamos kept the pace at the top after picking up maximum points against Black Rhinos on Sunday.
The Glamour Boys won the match 2-1 to remain a point behind log leaders Chicken Inn in second place.
Emmanuel Paga set the early tone in the tie when he opened the scoring in the first minute. The Ghanaian import headed home Brandon Mpofu’s cross, leaving the keeper with no chance.
More drama followed when Rhinos got a penalty just before the midway point of the half. The kick was retaken twice, first, after the keeper took his foot off the line and then when some players encroached on the second attempt.
But Blessed Mbavarira finally succeeded on the third time to bring the game to level.
With the game seemingly heading for a draw, Bill Antonio scored a screamer to put Dynamos ahead with two minutes left on the clock.
The effort proved to be the decider as Dembare collected maximum points in the game.
Elsewhere, Benjani Mwaruwari began his tenure as the Ngezi Platinum coach with a 1-1 draw against Bulawayo Chiefs, while Highlanders managed to conjure a goalless stalemate at Triangle.

2 Chinese male nationals have been caught on camera doing borehole drillings in Chitungwiza, while wearing ZANU PF regalia
The CCC MP is trying to provide borehole facilities for residents left stranded when when a losing candidate last week began demanding ZANU PF party cards for people to qualify for drawing water out of a nearby community resource borehole.
It has since been discovered that the problem is worse than earlier assumed: people drilling the boreholes are doing it while dressed in ZANU attire, and some of them are Chinese nationals.
The political posturing will certainly threaten people who do no belong to ZANU PF.

Bill Antonio will have to wait again after missing his scheduled trial stint in Belgum.
The Dynamos youngster was invited at Pro League side KV Mechelen for assessment from the 1st of April to the 30th.
However, following a disagreement between the player’s father and the agent, the teen forward failed to secure the necessary documentation for the trip.
Explaining the rift, Antonio’s father, Nowell, said there have been differences between him and the agent, Placcedes Jefferson, who is understood to be handling the teenager’s affairs.
“The people in Belgium called and said they wanted Bill for trials to see if he has the qualities that they would want,” Nowell was quoted as saying last week.
“I feel this is a very good opportunity for Bill and as a father I can only encourage him to remain focused on his game, put in a lot of effort and give it a try because it’s all about his career.
” But the issue now is that the people who are supposed to be fronting this are not operating in good faith and there is a danger that the boy could run into problems in the future.
“As a father, I am duty-bound to avoid that at all costs because I came a long way in supporting my son’s education and his fledgling football career.
“I want Bill to be successful in his football career. I also want him to have a good education to widen career options.”
The father added:” The documentation was being done behind my back. Apparently, they manipulated Bill’s mother to get the papers signed.
“So I have asked to see the documentation pertaining to the contracts that he has signed with Prince Edward Academy, the agent and Dynamos, but they are not being availed.”
Antonio, however, seemed unmoved by the setback and went on to feature for Dynamos on Sunday. He scored a beautiful effort which won the match for his side 2-1 against Black Rhinos.- Soccer24 Zimbabwe
By Tafadzwa Muranganwa| A newly formed interdenominational organisation has vowed to unite people across Africa to spearhead development.
Speaking at the launch of Council for Churches in Africa ,Zimbabwe chapter, founding president Bishop Dr Rocky Moyo said the thrust of the organisation was to bring all and sundry in Africa together despite varying backgrounds.
“We founded this organisation with the purpose of uniting Christians and politicians in Africa. We can’t speak of uniting politicians when we are divided as a church,” said Bishop Dr Rocky Moyo.
This was also reiterated by Bishop Albert Chikuni who leads the Interreligious Association for Peace and Development Zimbabwe(IAPDZ) ,who was among the guest and has been on a whirlwind tour of the country preaching peace.
“What makes our message unique is that everyone loves peace and so we are a sanctuary to all peace-loving citizens,” Chikuni said.
Addressing the hundreds of congregants who gathered at the Bulawayo Large City Hall,Pan-Africanist Joshua Maponga called the churches to take advantages of its huge numbers to start to think of financial independence to empower themselves.
“It’s now high time churches start to think of setting up its own bank given the number of congregants they have.
“This is attainable and will go a long way in reducing poverty among its members,”Maponga urged .
A young gender activist Kuda Kunze advocated for churches to strongly condemn child marriages and gender-based violence.
“The churches should condone child marriage and gender abuse out rightly and not any form of doctrine that support such should be tolerated,” she said.
Meanwhile ,there was a graduation ceremony at the event which witnessed over 40 clerics being awarded with certificates, diplomas and degrees in Theology Studies from Immanuel University of Theology International.
Leading the graduation, Professor Edward Alfred Van den Berg said the South-African headquartered institution is in 15 African countries and has been influential in raising religious leaders.
“Established a few year ago ,we are now in 15 African countries with other branches in the world, we have so far trained 90 professors and 15 000 leaders ,”revealed Prof Edward Alfred Van den Berg.

New kit, new month, same old script- Bill Antonio made the difference for Dynamos.
The sensational 19-year old, once again, and certainly not for the last time, ensured that Tonderai Ndiraya’s charges collect maximum points.
In a tightly-contested match with army side Black Rhinos at the National Sports Stadium, the Dzivaresekwa-bred youngster made the difference, in some style.
DeMbare drew first blood in the first minute, when Ghanaian striker Emmanuel Paga headed home a Brandon Mpofu cross.
In the 27th minute, the referee awarded Rhinos a penalty, which was saved by Tymon Mvula before the linesman ordered a retake.
From the retake, Blessed Mbavarira levelled matters for Chauya Chipembere.
When it appeared the two sides were set for a share of the spoils, Antonio had other ideas.
He dazzled his way past three defenders in the box before slotting home past the Rhinos goalkeeper.

Two Zimbabweans have been jailed for a total of 50 years for a series of armed robberies in Limpopo province, South Africa.

Makhado is about 100km south of Beitbridge in the neighbouring country.
According to reports, the duo was linked to a series of armed robberies committed in the neighbouring country since 2014.
In one incident, Matamba on December 8, 2018 robbed a 65-year-old woman of her handbag containing an undisclosed amount of money after breaking into the victim’s house.
“Moyo was sentenced to 30 years imprisonment for business robbery and illegal possession of a firearm and ammunition without the option of a fine, while Matamba was sentenced to 20 years imprisonment for his cases of house robbery and burglary,” Limpopo province police spokesperson Lieutenant Colonel Mamphaswa Seabi said.

The Zimbabwe Schools Examination Council (ZIMSEC) has failed to release the 2021 Ordinary and Advanced Level results in time.
In previous years, the examinations body would release results in February, giving ample time for schools to enrol Lower Sixth pupils in the first term.
The first term ends on Thursday, 7 April 2022, with both “O” and “A” Level results for 2021 yet to be released.
The delay in the release of “A” Level results has forced some universities such as the Zimbabwe Open University (ZOU) and Midlands State University (ZIMSEC) to defer their intakes.
Speaking to NewsDay on Sunday, ZIMSEC spokesperson Nicholette Dlamini said the COVID-19 pandemic disrupted the normal school calendar resulting in delays in the writing and marking of examinations.
Dlamini said the ZIMSEC board will release the results “soon”, but did not provide the exact date. She said:The year 2019 was the last year we had the normal school year.
This is 2022 that we are now having a normal school year.If you look at 2021, the first term started in March and last year, the results came on April 23 and we haven’t reached the date. Our examinations were written last year.
They started in December and they finished on January 31, so according to the cycle and the timeline, we have not yet reached that. The results will be released soon.
Teachers’ unions have, however, cited a dispute between ZIMSEC and examination markers over allowances early this year as the major reason behind the delay in the release of results.

Outspoken Citizens Coalition for Change (CCC) interim chairperson Tabitha Khumalo has declared there is no room in the party for erstwhile colleagues, Thokozani Khupe and Douglas Mwonzora, equating them to snakes creeping into the house.
While Mwonzora has not expressed any desire to join the Nelson Chamisa-led outfit, Khupe has been seen with CCC interim vice president Welshman Ncube, prompting speculation she was making moves to join the party.
Ahead of the March 26 by-elections, she also formally endorsed CCC candidates.
But Khumalo, who was among legislators recalled by Mwonzora in 2020, said there was no way the two would be allowed to join the CCC since they caused so many problems.
She said the current tense political situation was caused by Mwonzora and Khupe.
“We have a situation where a snake sneaked into the house, swallowed all the kids and when we attempted to kill it we did not finish it off … And now we want it to be part of the family. No. You can’t bandage a snake because when it heals it will bite you,” Khumalo said.
“It’s frightening to hear some people suggesting that we should form a coalition with Mwonzora before the next elections. We are where we are today because of Mwonzora and Thokozani Khupe. We can’t work with such people. People rejected them long back, they rejected them in the recent by-elections and continue rejecting them right now,” she said.
“We just had by-elections in which people expressed their feelings. It’s important to have coalitions but people are saying we should not work hand in hand with Mwonzora and (Thokozani) Khupe. We can’t do what people don’t like,” she added.
However, MDC-T spokesperson Witness Dube said they are willing to work with all progressive people in Zimbabwe, including CCC, ahead of the general elections.
“The MDC-T’s foundations are on solidarity and togetherness in order to achieve our goals. That’s the reason we contested the recent by-elections as MDC Alliance which comprises six political parties. We have realised that when we go for elections, it’s important to work with other political parties or any organizations with the same vision of transforming Zimbabwe. We can work with any political party that opposes Zanu PF in order to bring change,” he said.

Divorce orders obtained fraudulently by some greedy men with a view to stripping their spouses in the Diaspora of matrimonial property, are now on the increase amid reports that a Deputy Sheriff was recently fired while another is under investigation for fraudulent service of court documents.
Some couples are now living separately as women leave the country for greener pastures.
Men who remain in Zimbabwe, at times, rope in some corrupt elements at the Sheriffs office to misrepresent to the court that they would have personally served the wives with divorce papers.
Proof of service is filed at court, with the Sheriff confirming personally serving the parties for the case.
The court will then treat the cases as if they were unopposed.
Judges end up granting divorce orders without the wives’ knowledge.
In some cases, men engage female friends who pose as their spouses to obtain decrees of divorce and favourable sharing of property without their wives’ knowledge.
The men use the “hired” women to file fake divorce proceedings, file consent papers and agree to a property sharing model which favours the husbands.
Judicial Service Commission (JSC) Secretary Mr Walter Chikwana this week said an officer had since been fired while another is under investigation for fraudulent service of documents.
“We have one case where we fired an officer at the Sheriff’s office over fraudulent service of documents. In respect of the story published last week where fraudulent divorce was exposed, another officer who handled the case, is now under investigation.
“If found guilty, the officer will be discharged,” he said.
Mr Chikwana said the new electronic court system will help to end corruption in the serving of court papers.
“We are introducing electronic service of court documents and the Sheriff will not be involved in that.
“The electronic system will end such challenges,” he said.
This month the High Court exposed the case of a woman who wedded an ailing married man in the week he died and sought to take over the property he acquired together with his wife who was fending for the family in the Diaspora.
Mrs Martha Singizi, who has been based in the United Kingdom for almost 20 years, got the shock of her life upon discovering that her late husband had “divorced” her using fraudulent documents.
The discovery sparked fears that the Sheriff of the High Court’s office could have played a role in the fabrication of service papers.
Presented with fraudulent return of service documents from the Sheriff’s office confirming Mrs Singizi had been personally served with divorce papers at her Chitungwiza house, but decided to default court, Justice Tendai Uchena in 2015 granted the divorce in favour of the now late Mr Edmore Singizi.
Two houses, one in Waterfalls and the other one in New Zengeza 4, Chitungwiza, that were jointly owned by the couple, were awarded to Mr Singizi.
Mrs Singizi’s travel documents show she never set foot in Zimbabwe during the period of the said service, but the Sheriff’s papers filed on record claiming she had personally been served with the divorce papers.
Based on the fraud, the husband started living with another woman Ms Josephine Makuwaza.
Mr Singizi fell sick and tied the knot with Ms Makuwaza under the monogamous Marriages Act, Chapter5:11.
Barely a week after the marriage, he passed on. Ms Makuwaza then registered the estate at the Master of High Court’s office as the surviving spouse.
In another case, Justice Garainesu Mawadze urged lawyers to be on the lookout for fraudsters in divorce cases.
He made the remarks while setting aside a judgment in which a UK-based nurse Mrs Lucia Vela had been “divorced” and lost property as a result of fraud.
“In view of the apparent increase in the number of cases of fraud of this nature in divorce proceedings (I dealt recently with a chamber application for substituted service in which I recommended the investigation as applicant in that matter also claimed not to have instituted any divorce proceedings like in casu), I have directed the Registrar of the High Court to bring this judgment to the attention of the Law Society of Zimbabwe so that legal practitioners are alerted to prevalence of this obnoxious practice which threatens to erode confidence in our judicial system in unopposed divorce matters . . . ” said Justice Mawadze.
This was after Ms Vela’s lawyer Mr Cephas Mavhondo of Mhishi Legal Practice convinced the court that the judgment was fraudulent.
The judge said the practice was dangerous in the sense that judges can even be duped into believing that the parties before them are the correct ones and subsequently grant the orders sought.
Mrs Vela married Mr Costa Magolis in 1998 in terms of the Marriages Act Chapter 5:11 and the union was blessed with three children.
The woman relocated to the UK in 2001 and is staying there with her children.
Mr Magolis later followed his wife to the UK and they had marital problems that culminated in a separation in 2007.Ms Vela later returned to Zimbabwe where she discovered that she had been fraudulently divorced.
The records showed that she had been divorced in 2009 when she neither filed any divorce papers nor consented to any divorce proceedings.
Investigations by the woman’s lawyers revealed that Mr Magolis approached a lawyer, only identified as Mr Mapondera of Mapondera and Company, accompanied by a certain woman who posed as Ms Vela seeking legal representation in the divorce case.
They indicated that they were agreeable to divorce and the manner in which property would be shared.
The court granted the order. In a related pending court case, Harare businessman Mr Rochford Biggie Munjoma allegedly engaged a woman who forged his wife’s signature and obtained a divorce order.
Mr Munjoma’s wife, Febby Christina Munjoma, at the time of the filing of the summons, was in a Chinese prison where she was serving a sentence for smuggling ivory.
She only discovered the divorce when she returned to Zimbabwe and took the matter to court.
Justice Tendai Uchena nullified the fraudulent divorce.
“The divorce proceedings issued out under HC4789/09 on the 7th of October 2009, processed by the respondent (Mr Munjoma) and another person known to the respondent who purported to be Febby Christina Munjoma (nee Ushamba), the real and actual applicant herein and which proceedings were finalised by this Honourable Court granting an order of divorce between the applicant and respondent are hereby declared null and void.
“The divorce order granted by consent as a result of those defective proceedings referred to in paragraph 1 herein above is hereby revoked.
“Everything that done by the divorce in case number HC4789/09 granted on the 20th of November 2009 by the Honourable Justice Chitakunye is hereby declared null and void,” reads part of the court order.

The late legendary musician Zex Manatsa’s son, who was born out of wedlock, wants to be identified with his real family and has since filed a change of surname notice.
Givemore Kudakwashe Madziya (38), said his relationship with his late father was good, despite being raised by a stepfather. He said:
Waking up each and every single day knowing that my dad is there always gave me that extra strength to face life’s obstacles and also wanting to emulate him.
He was a role model to many, and he was to me, as well.
On changing his surname at 38, Givemore said it was not his decision, but “God’s”. He added:
Besides, I have been a Manatsa since birth. It is now, where I am only making a correction of what might have been a mistake so that I re-discover the inner me.
I cannot keep running away from my own shadow, my blood is Manatsa and I have to do what is right by carrying my true identity.
He also said he was on good terms with Manatsa’s other children, Green, Aaron, Tendai, Freedom, Shingi and Taku.
He, however, refused to reveal his mother’s identity but spoke highly of his stepfather who raised him up. Said Givemore:
My mom is a very reserved person, hence publishing her name might drag her into the limelight from the media.
All I can say is that she is my number one role model and I am very proud of her.
… Growing up under the wings of my stepdad helped me a lot in becoming the man that I am today.
He was very supportive and did not segregate me from my other siblings (his kids).
We were all treated equally and for that, I will always be thankful to him. He has a golden heart.
Givemore’s half-brother, Green Manatsa, said he has always been part of his family. Said Manatsa:
He is one of us and there is no way we can hide it. He made the right decision to change his surname because it is every child’s wish to be identified with his blood.
We are always in touch and we do consult each other when there are family matters.
Zex Manatsa died in January this year after a long battle with cancer. He was 78.-HMetro

Brighton Ndlovu (27) of Madonjwa Village in Chief Mabhikwa was arrested for rape following the attack which happened on 25 March this year.
Ndlovu had met the complainant, who is 25-years-old, on 18 March and proposed love to her and she agreed.

By- Victoria Falls villagers on Saturday had a CAG Travellers bus accident to thank as they took several tonnes of free meat from the carcasses of three elephants that were killed in the accident.
A CAG Travellers bus travelling to Victoria Falls rammed into a herd of elephants, killing three of the animals on the spot.
The accident occurred about 35km outside Victoria Falls, just after 5 AM on Saturday near Mbizha turn off along the Bulawayo-Victoria Falls road.
The bus suffered extensive damage but all 18 passengers and the bus crew were not injured.
Passengers were switched to another bus and proceeded with their journey.
Villagers from nearby Masikili and Mbizha villages, as well as some from as far as Lupinyu (about 20km away), some from Victoria Falls City, Chikandakubi and Chenamisa gathered at the accident scene to get a share of the meat.
According to The Sunday News, some of the villagers came on bicycles, cars and scotch carts while some boarded public transport from Victoria Falls.
Zimbabwe Parks and Wildlife Management Authority rangers and police officers were on the scene monitoring the situation.
The bus driver, Daniel Mapfumo, said he could not avoid hitting the jumbos because they appeared “suddenly” in the middle of the road. He said:
I suddenly saw the elephants and applied breaks while swerving to the left.
There were three groups so as I avoided the first, I saw another herd ahead.
The three were in the middle of the road and suddenly they turned at once, giving their back to the bus and they were hit at once.
Meanwhile, ZANU PF Hwange District Coordinating Committee chair Matthew Muleya urged drivers to be careful when driving along the Victoria Falls-Bulawayo road. He said:
Animals cross from the national park to communities so drivers should be cautious so that we save lives.
These buses travel at night and we urge them not to speed on this road.
By- MDC-T leader Douglas Mwonzora is reportedly facing a revolt from senior party members who blame him for the party’s poor performance in the 26 March by-elections.
The MDC-T, which contested the polls as the MDC Alliance, failed to win a single seat in all the contested Parliamentary and Local Government seats.
MDC-T party officials are now accusing Mwonzora of lacking strategy by, among other things, openly associating with President Emmerson Mnangagwa and the ruling ZANU PF party.
The Standard reported a source as saying party bigwigs openly expressed their displeasure with Mwonzora’s leadership during a national council meeting that was held on Friday. Said the source:
Members were calling for a change of strategy to gain momentum, but the strategy is centred on the leadership.
Clearly, Mwonzora has lost ground. He can still claim to be the leader but the national council was a true reflection of how the party members felt about him. They have lost confidence in his leadership.
Reports suggest some senior party members are considering defecting to Nelson Chamisa’s Citizens Coalition for Change (CCC).
Mwonzora recently suspended MDC-T Harare provincial chairperson Zivanai Mhetu after he blamed him for his loss in Epworth in the by-elections.
Speaking to The Standard, Mhetu, who was on Friday blocked from entering Harvest House to attend the national council meeting chaired by Mwonzora, said:
I wanted to tell Mwonzora to step down as the party leader. Since the party was formed in 1999 we have never failed so dismally in elections.
Being the president means you are the chief executive officer of the party and so for us failing to win a single seat, we attribute it to the incompetent leader.
I can clearly state that Mwonzora is dining with ZANU PF.

I’m extremely disappointed with the performance and the result.
By-Some teenage girls in Ntabazinduna who had dropped out of school after falling pregnant when schools were closed due to the COVID-19 pandemic have returned to school.
An estimated 5 000 school girls countrywide fell pregnant last year during the lockdown and had to drop out of school.
According to the National Aids Council (NAC), Nhlambabaloyi Secondary in Matabeleland North Province had about 30 girls who dropped out of school in September 2021 after they fell pregnant during the lockdown.
The majority of the girls have reportedly returned to school after they were assisted with funds by Plan International. Councillor for Ward 6 in Ntabazinduna, Alexander Mkandla said:
These figures are from last year and the school children did drop out of school due to pregnancy and some have returned to school already, after giving birth.
They were taken by Plan International, however, not all of the girls returned to class.
The high rate of teenage pregnancy has been blamed on the prevalence of gold panning in the area.
Mkandla said some learners failed to return to school because they were ashamed of their situation while others got married.
He said the community welcomed the move to have the girls return to school.
The Government’s new position is that pregnant learners should be allowed to give birth and return to school to continue with their studies.
Previously, pregnant learners would be expelled from classes and fail to complete their studies.
It was considered unfair since only girls were expelled from school while the boys responsible for the pregnancies were allowed to continue with their education.

Tsotsi Complex, one of the oldest commercial structures in Karoi town, formerly owned by the late businessman Brian James Rhodes, now houses at least 70 tenants who are resisting paying rent to a man claiming to be an agent of the new owners.
The said owners have never visited the property in the past 15 years.
Only a handful of the small-scale indigenous businesspeople occupying the premises have been paying monthly rentals to a man called Mr Tavengwa Foya while the majority have vowed not to pay until he produces proof of ownership of the property.
Interestingly, a report by the executor to the estate of the late Mr Rhodes, lists the complex among the properties that are yet to be distributed to the family members.
According to the executor’s report, the property still belongs to the late Mr Rhodes but a local company, whose directorship is questionable, claims to have purchased it.
Mr Rhodes’ widow, Elizabeth Anne, has since left for the United Kingdom after the death of her husband in 2007. Children of the late businessman are believed to be scattered all over the world.
The yellow dilapidated structure sitting on a hectare at number 370 Bouganvillea Way in Karoi, requires extensive renovations despite accommodating entrepreneurs.
The resistant occupants question the legitimacy of the transfer of the property from BJ Rhodes Private Limited to Simbal Pvt Ltd, a company that Mr Foya claims to be representing.
Simbal claims ownership of the property and claims the property now has a new title deed registered under its name (6892/04).
However, when The Herald checked with the Registrar of Deeds, the new document could not be found.
The Registrar, Ms Nyagura only managed to retrieve the 1985 deed of transfer 4387/1985 registered under BJ Rhodes Pvt Ltd.
The Herald had to proceed with the story after a fruitless two-weeks’ wait.
This comes at a time reports of the scramble for the estate of the late Mr Rhodes have gone viral with a number of local individuals trying to fraudulently grab assets.
Simbal Pvt Ltd was named after its late director, Mr Simbarashe Sakutukwa, who died on 7 June 2010.
Since his death, Mr Foya and other agents have been collecting rent from tenants.
New structures have been erected on the same stand and it is not clear who really owns them. However, the majority of the tenants have now become defiant, refusing to pay rent to Mr Foya of Simbal Pvt Ltd citing ownership issues.
A check with the Companies’ Registry shows that Simbal Pvt Ltd was owned by the late Mr Simbarashe Sakutukwa who died in 2010. A copy of the CR14 form filed at the Companies’ Registry in 2011, a year after the death of Mr Sakutukwa, shows he was a living director. He was listed among the living directors, raising suspicion that the papers could have been cooked up for fraudulent purposes.
The same document shows that the stated two directors, the late Mr Sakutukwa and his daughter Chidochangu, had their identity numbers added on the CR14 forms after Mr Sakutukwa’s death in 2011.
The other directors, according to the document, are Mr Sakutukwa’s widow Getrude and one Gardener Madzongo.
The current CR14 which was later filed in 2018, is also suspicious.
The updated document communicates the death of Mr Sakutukwa but wrongly spells his surname.
For unknown reasons, the surname was now written as “Satukwa” instead of Sakutukwa, sparking fears of fraud.
Mr Foya, who collects rent, visited The Herald after being asked to comment on the case but he could not even state where Simbal offices are, neither did he reveal the names of the directors of the company.
“I just wanted to meet you but I cannot comment on anything. I am forwarding the text to the director who will formulate the response modality. I will update you accordingly once I get the response from the director,” he said. By the time of going to print, Mr Foya had not sent a response to a set of questions asked by The Herald.
Mr Sakutukwa’s estate has since been wound up but nothing much was said of the immovable property in question.
The property was mentioned in a letter to the Master of High Court by the widow who indicated that the family had since lost control of it. To that end, Mrs Getrude Sakutukwa pleaded with the Master of High Court not to include the Karoi property when calculating the Master’s fees.
“The shares of Simbal Pvt Ltd have been valued at $413 522. What constitutes the bulk of this figure is the value of a property owned by the deceased in Karoi.
“The truth of the matter is that this property is registered under the name of the deceased but I have no control over it . . .” reads a letter to the Master of High Court dated 31 October 2012.
She added: “I humbly request that since this final account is based on the Simbal Shares which basically is an empty shell now, you consider waivering payment of the estate duty.
“In 2011, the National Indigenisation and Econonic Empowerment Board (NIEB) through its general manager compliance Z Lunga, wrote to the tenants advising Simbal had no legal right to collect rent from the property formerly owned by BJ Rhodes.
“We however, understand that due to peculiar circumstances of Lorely Investments, Tsotsi Complex under Karoi Properties is being managed by individuals who have no legal right or mandate to do so.
“In our view, such actions are criminal and we will be advising the police to investigate their activities. In the meantime, we encourage that all issues dealing with the aforesaid company be done through Nemic Investments, the intended indigenous partner of Loreley Investments,” reads the letter dated April 11 2011.
However, details of the said Nemic Investments are still sketchy.
Since then, most tenants are now paying rates and water charges directly to council without Simbal’s involvement but they are not paying a cent to Simbal.
They are also paying electricity bills directly to the Zimbabwe Electricity Transmission and Distribution Company (ZETDC) and the account is still under BJ Rhodes.
ZETDC and the Karoi Town Council accounts are currently up-to-date as the tenants are religiously paying every month.
A locksmith who occupies Tsotsi Complex, Mr Shadreck Packet, said he moved into the property in 1998. “During that time, Mr Rhodes was still alive and were paid rent through his agent called Mr Patridge Guru.
“Simba Sakutukwa, under unclear circumstances, took over in 2007 and started collecting rent from us. He later died in 2010 and Mr Foya and others started collecting rent,” he said.
“Around 2011, we stopped paying rent to Mr Foya, demanding to see the owner of the property. He simply told us he is an agent but we do not know who the legitimate property owner is.
“Even the Sakutukwa family does not even visit the property. We heard they are now based in the United Kingdom. We doubt Mr Foya is forwarding the money to the owners.
“For now, we are only paying water bills, electricity bills and rates to council but we stopped paying rent to Mr Foya.
“If we are occupying an abandoned property, we better pay rent to the Government,” he said. Another tenant, Mr Alphonse Chidemo, said there was confusion on who really owns the company considering that another man identified as Robert Gana, at one point separately demanded rent from the tenants.
“Another man, claiming to be from Simbal, once demanded rent separately, creating more confusion on who is the legitimate owner or beneficiary of the property.
“That is when I stopped paying rent,” he said. Mr Diamond Gwekwe, who runs a hardware shop at the complex, said those who collected rent were failing to pay the bills at council and ZETDC, prompting the tenants to pay directly.
“Those collecting rent were not paying rates to council. They were not paying electricity for a long time, prompting us to pay directly without their involvement.
“As we speak our accounts are up to date but I am currently not paying anything to Mr Foya of Simbal,” he said. – Herald
Tinashe Sambiri|Veteran political commentator Dr Pedzisai Ruhanya says Mr Emmerson Dambudzo Mnangagwa’s Zanu PF party will be heavily defeated in Harare in the 2023 polls.
Addressing a Zanu PF rally in Shamva, Mr Mnangagwa vowed to “win back” Harare.
“Harare used to be a sunshine city during colonial times, but now it is an eyesore due to dirtiness. This is being caused by opposition councillors who are running it down. Let me assure you that in this coming election, we are going to get Harare municipality,” Mr Mnangagwa said.
Dr Ruhanya commented:
“He says he wants to wrestle Harare from CCC when he has been failing to wrestle his home town Kwekwe Central, parts of Midlands including Gweru. May be its not about people’s vote. If its about real votes of the people ED cant take even many rural areas.
ZANU PF cannot win an election in which the vote counts, where the people turn out in the huge numbers to vote and protect their vote. For this to happen the challenge is beyond parties like CCC alone but the ordinary citizens must take it upon themselves to register, VOTE.
Want to see on the ground an organised and robust CCC RURAL STRATEGY on mobilisation, voter registration of young people and how people organise themselves to protect each other from violence, protecting the voter. Going into rural areas during campings is NOT A STRATEGY.

A 35-year-old man has been fined $15 000 or risks spending a month in jail for chewing ballot papers he had been handed to cast his vote during the just-ended by-elections on March 26.
Tendai Artwell Gonye was fined after admitting to chewing the ballot papers when he appeared before Harare magistrate Mrs Barbra Mateko.
Gonye (35) of Mabvuku, went to Simudzai Primary School to cast his vote in Ward 21 for the local authority by-election at around 4pm.
Upon arrival at the polling station, Gonye produced his particulars and was given a ballot paper to vote.
He then proceeded to the voting booth and marked the ballot paper.
Gonye then came out of the voting booth and walked away without placing the ballot paper in the ballot box.
He was stopped by police officers who advised him to place the ballot paper in the box.
Gonye refused and became violent.
He then stashed the ballot paper in his mouth, chewed it and spit the pieces on the ground, leading to his arrest.
Meanwhile, Elizabeth Chinyoka (36) and Tafadzwa Mupanguri (37) appeared at Mbare Magistrates Court last week for also violating the Electoral Act.
The State had it that Chinyoka of Mufakose at around 3pm went to Crowborough Sewage Works polling station to cast her vote during the just ended by-elections on March 26.
She then allegedly produced a national identity card in the name of Zvanyadza Chinyoka, who happens to be her sister. It is said that Chinyoka was given two ballot papers one for Member of Parliament and the other for local authority.
She then went on to cast her vote using her sister’s ID and went away.
After 30 minutes of casting her vote, Zvanyadza went to the same polling station to cast her vote.
It was when she was told that she had already voted. Upon being questioned, Zvanyadza indicated that it could have been her sister who had used her ID.
Mupanguri, of Highfield, allegedly went to Mbizi Primary School, Ward 25 in Highfield East to cast his vote.
He then produced a national identity card in the name of Zvikomborero Mupanguri. A polling officer told him that the ID belonged to Zvikomborero Mapanguri, but he insisted that he was the owner of the identity card.
He was taken to the police where he was found with a birth certificate with his actual name, Tafadzwa Mupanguri.– Herald
Company (NatPharm) are now free after the Supreme Court acquitted them of corruption charges, overturning a High Court decision made last year that they must stand trial.
The six were facing criminal abuse of office for charges for allegedly failing to retire managing director, Florah Nancy Sifeko, when her tenure of office lapsed.
They unsuccessfully sought to have the charges quashed through an application for an exception to the charges in July last year.
But last week, former board chairman Billy Rigava, his then deputy Rachael Chibaya, board members Johnson Shonhe, Notburga Chifamba, Charles Maponga and Gerald Gore, were a relieved lot after the superior court allowed their appeal.
A three-judge panel of Justices Lavender Makoni, Alfas Chitakunye and Hlekani Mwayera, unanimously found merit in the appeal and quashed the lower court’s judgment.
“The appeal be and is hereby allowed. The judgment of the court a quo is set aside and substituted with the following: (i) The application for review be and is hereby granted (ii) the applicant’s exception to the charges relating to the contravention of Section 174 (i) of the Criminal Law (Codification and Reform Act) Chapter 9: 23 be and is hereby upheld and the charges against the applicants be and are hereby quashed,” read the judgment.
Mr Rodgers Matsikidze, who instructed Advocate Lewis Uriri to argue the appeal for his client Chifamba, described the Supreme Court ruling as ground-breaking.
“This is quite a landmark ruling in that it dealt with the controversy around policy makers and decision implementers,” he said.
“In particular, whether a policy maker who is a board member can be charged with abuse of office on issues that require another person to implement.
“More importantly the issue or where you draw a line between abuse of office and mere omission.
“The matter dealt with issues of to what extent an exception can be sustained. Overall, a good and sound judgment.”
The six approached the High Court last year on review of regional magistrate Ms Estere Chivasa’s decision dismissing their request to have the charges dropped.
It was their argument that the exceptions taken were on the basis of that factually and legally no offence was disclosed in the charge. The reasoning was that, an extant judgment which they argue was binding existed and has pronounced that Natpharm was not a public entity.
Its officers, therefore, did not owe a public duty and could not be charged in terms of the charge preferred.
But the prosecution opposed the application arguing that the six could only raise an exception where the charge fell short in terms of the provision of the law under which they were being charged.
It was on that basis that High Court judge Justice Phildah Muzofa found no misdirection on the part of the trial court and threw out the application.
The judge ruled that if the six alleged that the charge was based on falsehoods and that the prosecution withheld facts known to it invariably means the court had to be favoured with what the applicants allege is the truth.
This, she said, could only be done through evidence and the court would have to interrogate the veracity of each party’s evidence before a substantive decision is made.
In their application at the High Court, the six’s contention was that the trial court failed to consider a binding decision granted in NatPharm’s favour that had declared the company to be privately-owned and thus did not have any public duty in relation to the conduct of its officials and employees.
They argued, the trial magistrate had erred in ordering the trial to proceed when it was apparent that the factual basis on which the charge sheet was based was false. -Herald

DStv’s updated pricing for 2022 took effect yesterday, 1 April, with prices on some services increasing by 4.89%.
The average increase across DStv’s pay-TV packages is 2.7%, which MultiChoice highlighted was significantly less than projected inflation for 2022.
MultiChoice said it had considered the challenges facing South African consumers and absorbed as much of the cost increase as possible. MultiChoice South Africa’s CEO, Nyiko Shiburi, said:
We realise that customers remain under pressure two years into the Covid-19 pandemic.
These adjustments will help us to ensure that South Africans continue to enjoy the best value, and unrivalled access to entertainment, anywhere, anytime, and at the most affordable price.
DStv’s Premium and Compact Plus subscribers will pay R10 per month more from Friday — less than a 2% increase in both cases.
DStv Compact subscribers will have to fork out an additional R20 per month, an increase of 4.89%.
DStv also increased the access fee from R105 to R110 but left its Box Office, Showmax, EasyView, and Add Movies pricing unchanged.
The changes apply to DStv’s decoder and streaming-only products.
MultiChoice’s price hikes come after it restricted the number of simultaneous streams for DStv.
Since 22 March, DStv subscribers may only stream to a single device at a time. This change did not impact decoder-based viewing or Showmax.
The table below summarises DStv’s increases across its product offerings.
