FC Porto Establish Academy In Zim

Former European champions FC Porto have opened a football academy in Harare, Zimbabwe under their Dragon Force project.

The Portuguese club has partnered with GEA Sports Zimbabwe to set up the football school.

The launch comes after the successful hosting of FC Porto World Camp in the capital in March this year.

Porto said on their website: “After the opening in January of the football School in Fortaleza, Brazil, the implementation of the Dragon Force International Certification at FC Beira, in Mozambique, FC Porto opens now the Dragon Force Academy in Harare, Zimbabwe, making it the third project to be implemented internationally in 2023 by Dragon Force Academy.

“The Football Academy will be located in the Alex Sports Club Facilities, which have two 11-a-side soccer fields, a gym, support rooms and a restaurant.

“All the staff of GEA Sports Zimbabwe, FC Porto’s partner in the country, will be trained according to FC Porto’s working methodology, thus allowing the implementation of the Dragon Force International Certification. A multidisciplinary team (in the areas of management, technical expertise, psychology, education, and nutrition) will constantly monitor all the activities.”

Porto’s Dragon Force executive member Ricardo Frey Ramos said: “We are very pleased with this new partnership. GEA Sports welcomed us warmly and being willing to create all the conditions for the tremendous success of the FC Porto World Camp.

“The new expansion model now allows us to respond more confidently to market interests, sharing the good practices of Dragon Force football schools, capable of adapting to any reality.

“We have been working on processes and procedures for 15 years, thinking about the training of our players and coaches in detail, anticipating the day to day, with the ambition of showing that it is possible to make a difference and develop the capabilities of all those who believe in us.”

GEA Sports Zimbabwe Chairman, Mr Chimedza added: “This is the first step towards sustainable growth, but with the great objective of expanding horizons. We believe in the training methodology of Dragon Force, based on a Club with a lot of history, knowledge and victories, and which has a differentiating pedagogical component that will help develop many players, as well as the future citizens of Africa.”

Other top European teams that have established academies in Zimbabwe include Spanish La Liga side Real Betis and EPL club Everton.

Liverpool To Sign Zimbabwean Youngster

Liverpool are reportedly on the verge of signing Zimbabwean youngster Trey Nyoni.

Nyoni was with the Leicester City Academy for a decade before his departure this week.

He turned out for the Foxes in the U18 Premier League last season and also played for the under-21 side against Porto in the Premier League International Cup in December, while he was still 15.

The 16-year-old midfielder confirmed his departure in an Instagram post which read: “Thank you, Leicester. I am grateful to all the players and staff at the club who have helped me develop over the past 10 years and I wish nothing but success to everyone at the club.”

Following his departure, the Reds are reportedly in the final stages of negotiations to bring the teenager to Merseyside.

The Secret Scout tweeted: “Been told Liverpool have won the race to sign England international 16-year-old Trey Nyoni from Leicester. Liverpool been working on the deal for months. Central Midfielder one of the best in his age groups”

Nyoni is expected to join Liverpool’s under-18 squad when his move has been completed.

Born in the UK to Zimbabwean parents, Trey has represented England at U15 but is still eligible to switch this allegiance to Zimbabwe.

In 2021, WHO launched an intense period of prevention and response actions following the harrowing accounts of victims and survivors of SEA during the 10th Ebola outbreak in the Democratic Republic of the Congo encapsulated in the Management Response Plan that concluded in December 2023. To build on and institutionalize this progress, our future work is framed by the three-year strategy for preventing and responding to sexual misconduct.

Before you appoint a manager know your weakness and hire someone who will compliment your weakness. Secondly create a management team that involves you and him stop cellphone management of any kind . Cellphones are good for reports and analysis only . To your team third person in form of someone who compliments his weak ; it can be a blaster or cyanide plant manager depending on which area your manager is good at .

First attribute of your manager should be administration before anything then followed by one of the two pillars of mining leaching and mining. The security guard is not part of management must not be at whatever costs .

Your relatives ( including your wife and kids ) should get a job somewhere else or be prepared to take instructions from a management team never to directly report to you no matter what. Don’t discuss mining issues with them listen to their opinions silently unless if they qualify then appoint them . Paid management team and all your employees well and fire them for underperformance never rehire someone fired by management team .

Coup Looms As Soldiers Deface Mnangagwa Posters

By- Soldiers are defacing Zanu PF President Emmerson Mnangagwa’s election campaign posters in Harare as a sign of disgruntlement and revolt against their commander-in-chief.

NewsHawks Tweeted that Mnangagwa has called back to barracks all army officers on leave as he seeks to contain the looming coup.
This has now been extended to those at Cleveland Shooting Range in Arcturus, Harare. The decision was taken after reports that some soldiers were rampaging at night, defacing Mnangagwa’s campaign posters in Mabvuku, Harare, resulting in Zanu PF officials complaining. A source told The NewsHawks: “The regiments stationed at Cleveland Shooting Range in Harare are being dismantled today, 28 July, as soon as the Air Force competition ends. “Soldiers based at the range, especially from 2 Brigade in Harare, Artillery in Shamva and 3 Brigade in Mutare, were alleged to have had sprees of tearing Zanu PF President ED’s posters in Mabvuku. The Zanu PF Mabvuku leadership raised a complaint that the soldiers were a menace, especially at night. The order to totally demobilise the range is immediate. All soldiers are going back to their barracks where they were also forced to register at their polling stations.” A CIO-run structure, Forever Associates Zimbabwe (FAZ, has taken over the running of the upcoming elections, with the army playing a peripheral role. FAZ is led by CIO co-deputy director-general, retired Brigadier-General Walter Tapfumaneyi. This has created tensions within the security forces.

Elections Will Never Be Held Without Us, Vows Kasukuwere

By Jane Mlambo| Independent presidential candidate Saviour Kasukuwere made a defiant stand vowing that the 23 August 2023 elections would never be held without him.

Kasukuwere’s remarks follows the dismissal of his Supreme Court appeal challenging the High Court ruling that barred him from contesting the upcoming elections on the grounds that he was absent from Zimbabwe for the past 18 months.

In a defiant Twitter statement, Kasukuwere argued that the framers of the Electoral Act had never envisioned a candidate’s removal through disqualification under section 23(3) of the Act.

In his interpretation, the Act provided for voluntary withdrawal or removal by death, but not through the disqualification route.

“In the eyes of the law, the Act has missed the mark,” Kasukuwere proclaimed, confidently invoking the famous idiom ‘the law is an ass.’

He contended that the Act’s wording presented a catch-22 situation, leaving no clear path forward in case of disqualification.

As a result, he believed that the Act required a reexamination and that section 108 should come into play in his situation.

Chamisa Mocks Mnangagwa For Celebrating Ramshackle Helicopter Gift From Putin

MAIN opposition leader, Nelson Chamisa has taken a swipe at President Emmerson Mnangagwa for accepting a helicopter from Russian President Vladimir Putin and openly supporting his invasion of Ukraine.

Putin recently gifted his Zimbabwean counterpart a chopper as Moscow cements ties with the Southern African country, which is also under heavy sanctions.

The Information Ministry confirmed through Twitter the aircraft will soon be delivered to Zimbabwe.

Addressing thousands of CCC supporters at Gadzema Grounds in Chinhoyi on Monday, Chamisa said the Zanu-PF leader had taken an ill-advised stance in support of Putin in the devastating war.

“My brother (Mnangagwa) was in Russia the other day and was over the moon with joy after receiving a ramshackle helicopter, and he unashamedly declared we, as Zimbabwe, support Russia in its invasion of Ukraine. You and who, whom did you consult?

“A proper leader of Zimbabwe must not support or side with any country, but side with peace, side with unity, side with progress and side with multilateralism and unite the belligerent nations, Russia and Ukraine,” said Chamisa.

The aircraft will soon be delivered to Zimbabwe.

The CCC president chastised Mnangagwa saying he must stop acting like a puppet of the former Soviet Union.

“Don’t be a puppet, be a person who respects the norms of peace across the whole world and not side with aggression, which is not acceptable,” he said.

A new CCC government ushered through the ballot will pursue non-aggression and promote world peace, he added.

“CCC supports peace and harmony of all nations. We support global peace because joining a certain side is against facts and truth and lacks objectivity…there we don’t agree with my brother.”

Chamisa expressed confidence in annihilating Mnangagwa, derogatorily describing the 80-year-old Zanu-PF leader as a “customer” so easy to beat in the upcoming presidential election.

In a wide-ranging address to his supporters that lasted close to an hour, Chamisa promised to stamp out corruption bleeding the country of potential revenue, job creation and improving welfare of civil servants as well as restoration of basic social services like water and roads.

He also took the opportunity to introduce aspiring CCC Chinhoyi MP, Leslie Mhangwa, who pledged to “energise” the once vibrant town, which had the now defunct Cold Storage Commission (CSC) and mining giant Golden Kopje, among other key economic players.

Mhangwa, an engineer by profession, unveiled a manifesto to address myriad challenges facing Chinhoyi, which has lately witnessed exponential population growth burdening existing infrastructure resulting in service delivery collapse, particularly water provision.

Mutambara Rips Into Blind, Deaf And Dump Mnangagwa

President Emmerson Mnangagwa lost an opportunity to unite a fractious Zimbabwe after a military-assisted coup in 2017, failing to chart a new trajectory for the country.

In his recent assessment of the 2017 coup that toppled long-time ruler Robert Mugabe, former deputy prime minister Arthur Mutambara said: “I understand why people supported the coup and were not wrong. The idea was that if Emmerson Mnangagwa was clever, if he had ten percent of Mugabe’s intelligence he would have used that moment of the coup to do a team Zimbabwe approach not much for Zimbabwe but for himself but he was blind, deaf and dumb and missed the moment.”

Mnangagwa in 2017 ended Mugabe’s rule in Zimbabwe, in a moment critics hoped would mark a beginning of a new era in the country’s politics.

An aura of change engulfed Zimbabwe as people from across the political divide called for the resignation of Mugabe.

“A clever Mnangagwa who is strategic would have told Chinamasa to shut up. When I proposed this it was not much for Zimbabwe but for Mnangagwa’s own legacy,” said Mutambara.

Since 2017 polarisation has remained in Zimbabwe with opposition parties and the ruling party at loggerheads over the state of affairs.

However, the opposition has accused Mnangagwa of copying the handbook of Mugabe during his rule.

“There was an opportunity for change. There was so much goodwill in the country in Zimbabwe. So much goodwill in SADC and the continent and globally. The goodwill was squandered by a lack of intelligence, by lack of strategic thinking.

“A different leader in 2017 could have created an opportunity of delinking with the past. I am very clear that there was an opportunity because it was a Zimbabwean moment not Zanu-PF moment. There was a lack of leadership,” said Mutambara.

Supreme Court To Hear CCC Dozen Appeal

The Supreme Court will on Wednesday, 02 August, hear an appeal by a dozen CCC candidates for the National Assembly who were barred from running in the 23 August 2023 general elections.

The date was fixed by the apex court following a case management meeting on Monday.
A lawyer for the candidates, Welshman Ncube, said the appeal has been set down for 2 PM on Wednesday.

Twelve voters allegedly linked to ZANU PF, each from Bulawayo’s 12 constituencies, filed simultaneous applications at the High Court to have the CCC candidates and five others disqualified from contesting in the upcoming general elections.

The applicants argued that the candidates filed their nomination papers after the 4 PM deadline on 21 June.

In an appeal filed at the Supreme Court on 28 July, the 12 CCC candidates raised nine grounds of appeal, citing Justice Bongani Ndlovu for granting an application that they say was based on “objectively established falsehoods.”

The Zimbabwe Electoral Commission (ZEC) and the CCC candidates all opposed the applications which were consolidated into one because of similar facts.

ZEC argued that all candidates who were accepted had filed their papers by 4 PM.

The applicants relied on an internal ZEC document which has time stamps next to the names of candidates, arguing that the indicated times, all after 4 PM on 21 June, showed when CCC candidates filed their nomination papers.

ZEC, however, said the indicated times only showed when a candidate’s details were captured on their computer.

If the Supreme Court upholds the ruling by the High Court, it means that CCC cannot have any senators from Bulawayo or MPs under the youth and women’s quota.

This will be the case because the youth and women’s quotas are determined by the number of votes secured by National Assembly candidates.

Shops Cash In On Change Crisis Caused By USD Use

Zimbabwe is currently battling a local currency liquidity crisis which has resulted in large retail shops failing to give change to consumers who buy goods in United States dollars (US$), a local daily has reported.

Information gathered shows that retail shops are recording excesses of up to $1 million each day from the small amounts of less than US$1 that they fail to give to customers as change due to a shortage of the Zimdollar.

A till operator at one local retail shop told the local daily in an interview yesterday that she recorded excess funds of up to $200 000 each day from customers who buy in US dollars, but won’t get their change in local currency.

The till operators, the local daily heard, sometimes would buy groceries for themselves in-store using the excess funds from the change they withhold from the customers.

Consumers, however, said the retail shops were short-changing them as some deliberately refuse to give them change and maximise on their profits.

The Consumer Council of Zimbabwe (CCZ) yesterday confirmed receiving complaints from disgruntled customers.

“The Consumer Council of Zimbabwe notes consumer complaints relating to unfair conduct prevalent in the market due to shortages of the Zimbabwe dollar currency as some retail shops, commuter (omnibus) operators are forcing consumers, to purchase unbudgeted items such as trinkets, while others are given tokens as change, some leave small amounts in shops without being given an option to utilise their funds,” CCZ executive director Rosemary Mpofu said.

“The Consumer Protection Act [Chapter 14:44] section 35 provides for the right to fair, honest dealing and protection from unconscionable conduct, the section explicitly states that every consumer has a right to be treated fairly, honestly in any transaction or promotional activity by any supplier, suppliers of goods and services are prohibited from using forms of coercion, undue influence, pressure, duress, physical force or unfair tactics against a consumer.”

A manager in one of the retail shops in Harare also confirmed the shortage of local bank notes.

“We are experiencing a serious shortage of bond notes. Customers use plastic money and US dollars mostly for their transactions,” he said.

“We do not have problems with plastic money, but the challenge is, we do not have smaller denominations for US dollars. Sometimes we give airtime for the Zimdollar change, but the service providers do not sell airtime of below $1 000.”

Confederation of Zimbabwe Retailers president Denford Mutashu confirmed that the industry was experiencing a shortage of the Zimdollar, but shop owners had to put in place measures to ensure consumer satisfaction for every transaction.

“Generally, there has been a Zimdollar liquidity crunch owing to the monetary policies which led to the stabilisation of the official exchange rate and also the reduction of prices of some commodities,” Mutashu said.

“There has always been a problem of change in shops since we adopted the multi-currency system in 2018 because we have no smaller denomination in United States dollars.”

He, however, said there was no justification for retailers to refuse giving change to their customers.

“It is theft and it is illegal for a retail shop to refuse to give change to consumers,” he said.

In May this year, government put in place a raft measures to curb the further depreciation of the local currency and increases in domestic currency for prices to control liquidity on the market.

Government measures included promotion of use of domestic currency by its agencies which further increased the demand for the local currency.

Disappointed Ndlovu Pens Letter

The inherent nature and often a weakness of law is that justice is predicated upon raw rules and time frames. The rules and time periods have not in them the advantage of facts and scenarios, they are just raw and divorced from the ” real” issues that cause ” real ” human beings to seek to find recourse in courts of law.

These rules of procedures and their time limits are essentially meant to achieve in aiding justice, but in most of times the whole judiciary process collapses into a tribunal of ” time keepers”.

While the issue of the ( CCC – 12) is about timekeeping and a plausible explanation by them is pending on appeal, an eye fixated beyond the cursory time keepers glance to the watch wonders-should it really be about minutes?

An election is about the ” people ” giving a mandate to their government. It takes a good five years for the ” we ” the people to decisively speak on issues of who must be the carrier of their message to government. The right to vote, and the right to contest an election are the fundamental issues that concern an election in it’s practical and jurisprudential context.

An election is not about ” short time ” or ” longest time ” . It is not about seconds and split seconds,it is the sacred exercise that bestows the right of governance to the elected.

Life is an enigma and it’s exigencies are difficult to fathom, it manifests in diverse ways. In a day are a thousand ” ifs” ,” but’s” and ” maybe”. At times it’s a car breakdown, at times it’s unexpected vomiting and at times it’s a wave of an unending congestion that determine availability or it’s lack in certain places at certain times. In all of this,the spirit of law must be to seek to achieve resolution of ” real ” issues and avoid the petty trap into the dungeon of ” timekeepers”.

The child in a ” towel” is more important and cannot compare to the towel. The towel is for the comfort of the child and the child is not for the towel. The references to court procedures and time frames must never be equated to the deep live issues of human existence embedded in Constitutional provisions like the right to vote and be voted into office.

The recent events if at all we must learn, teach us that provisions of legislation are not of the same value. There are some of a superior nature known as the ” essential features “.

The ” essential features ” doctrine also known as the basic structure doctrine is recognized in India,Bangladesh and Uganda amongst other jurisdictions. Developed in India in the 1960s and 1970s, it found expression in the famous case of Kesavananda Bharati v State of Kerala wherein then Justice Hans Raj Khanna noted correctly that in the reading of laws,some sections must essentially be viewed as superior.

Notwithstanding the fact that i understand and appreciate that the CCC-12 candidates were on time, the reasons to deny them presence in the ballot box ( even if ) we were to say they were late by some minutes ( of which they were not) would still not make proper legal sense.

It appears quite clear that what is essential far above these ” short time ” disputes of merely the clock is the right to vote and contest. Our courts must rise and see the rational and objective rhythm of the essential features doctrine.

Soldiers Ordered Back Into Barracks

Ahead of the crucial elections, army officers on leave have been called back to the barracks as President Emmerson Mnangagwa seeks to control the military.

This has now been extended to those at Cleveland Shooting Range in Arcturus, Harare.

The decision was taken after reports that some soldiers were rampaging at night, defacing Mnangagwa’s campaign posters in Mabvuku, Harare, resulting in Zanu PF officials complaining.

A source told The NewsHawks: “The regiments stationed at Cleveland Shooting Range in Harare are being dismantled today, 28 July as soon as the Air Force competition ends.

“Soldiers based at the range, especially from 2 Brigade in Harare, Artillery in Shamva and 3 Brigade in Mutare were alleged to have had sprees of tearing Zanu PF President ED’s posters in Mabvuku. The Zanu PF Mabvuku leadership raised a complaint that the soldiers were a menace, especially at night. The order to totally demobilise the range is immediate. All soldiers are going back to their barracks where they were also forced to register at their polling stations.”

A CIO-run structure, Forever Associates Zimbabwe (FAZ, has taken over the running of the upcoming elections, with the army playing a peripheral role.

FAZ is led by CIO co-deputy director-general, retired Brigadier-General Walter Tapfumaneyi.

This has created tensions within the security forces.

MASVINGO-Ezra Carlington (36), known as Dj Kwakatsva, who is in critical condition at Masvingo General Hospital after his vehicle rammed into a haulage truck yesterday, is charged with negligent driving. 

Masvingo Police Deputy Spokesperson Assistant Inspector Lorraine Ndlovu confirmed the charge to The Mirror. 

Dj Kwakatsva suffered a broken right leg and arm after his red single-cab Toyota Hilux rammed into a right front trailer axle tyre of a Masvingo-bound haulage truck driven by Passion Katiyo of Dulibadzimu in Beitbridge.

Kwakatsva was driving towards Chivi. He encroached onto the truck’s lane resulting in the accident.

Police Gun Down Suspected Robbers

TWO suspected armed robbers have died following a fire exchange with police officers who were trying to arrest them in Harare this Saturday.

Four other suspects were eventually arrested and are linked to 17 cases of armed robbery in Harare and other towns.

Zimbabwe Republic Police (ZRP) National Spokesperson, Assistant Commissioner Paul this Saturday confirmed the death of Mugove Chimuti and Ishmael Mutungira following a fire exchange that saw four other suspects being arrested.

Those arrested are Tinotenda Zhuwawo Dzvairo, Tinashe Ray Chirombo (31), Trymore Guta and Hebert Clayton Nyamangodo.

“The suspects are linked to several cases of armed robbery, one of which took place in Chegutu on the 11th of July 2023, where one of the suspects, Trymore Derere Guta was captured on CCTV while in the act. The suspects are also linked to a case which occurred at Unadale Farm, Beatrice on the of 6th July 2023 where various household goods were stolen. The suspects were arrested after the ZRP received a tip-off,” he said.

The ZRP is hunting for the other four suspected members of the gang.

Meanwhile, six people have died after a road accident, which occurred in Rusape along the Harare-Mutare Road on Friday evening.

“Three people died on the spot while the others died on admission at Rusape General Hospital.

The accident occurred when a commuter omnibus that was Harare bound side-swiped a haulage truck, as the driver tried to overtake at a sharp curve before Rusape tollgate,” noted Nyathi.

Six other people who were in the commuter omnibus are admitted at Rusape General Hospital after sustaining injuries.-ZBC News

Today, Zanu PF members unleashed violence against Citizens Coalition for Change [CCC] members at Sipambi Shopping centre, ward 11 in Masvingo West.

The CCC members were putting up CCC campaign posters when over 20 Zanu PF members wearing party regalia attacked them.

Also, Zanu PF members are tearing and destroying CCC posters in Masvingo West.

CCC members Mr. Admire Mufamba and Mr. Danson Gwaradzimba were badly injured after the Zanu PF attacks.

Mr. Gwaradzimba and Mr. Mufamba have reported the case of assault against Zanu PF members at Masvingo Central police.

Police report RRB REF 5432966, Constable Mukoko is the investigating officer.

In addition, Mr. Mufamba and Mr. Gwaradzimba are seeking medical attention.

CCC Masvingo West aspiring member of parliament, Mr. Pedzisai Gasva, said, “We, as CCC members, condemn the violence being perpetrated by Zanu PF members against our members. It’s sad that our members were injured and currently receiving treatment.”

Mr. Gasva said he is in Mvuma and will be in Masvingo town to help the injured CCC members.

Mr. Tichaona Mharadza Chiminya said, “We identified youth who beat our members. Masvingo urban ward 10 Zanu PF councilor, Mr. Manyanga, Delight Mandebvu, Milton Mutongi, ward 12 Masvingo West, Chauke, were among Zanu PF youth members who beat our members.”

In Masvingo Province, Zanu PF members have unleashed violence against CCC members in Gutu, Bikita, Mwenezi, Chiredzi, and Masvingo West, among others.

Interestingly, police are yet to arrest Zanu-PF members who are beating CCC members.

BREAKING: CCC Members Assaulted at Epworth Funeral, Investigation Underway

By A Correspondent | Epworth, Zimbabwe – In a shocking and distressing incident on Sunday, several members of the @CCCZimbabwe party were brutally assaulted during a funeral procession. The incident occurred at approximately 12 o’clock in the afternoon in Ward 1, Epworth.

According to a complainant who spoke to ZimEye, the assault took place while they were attending the funeral of a fellow CCC member. The victims, four in number, were wearing CCC T-shirts at the time of the attack. Unfortunately, they were unable to identify their assailants.

“I was beaten at the manhood. They beat me up with a metal rod to the point that it is still swollen up to this time. They beat me on the head to the point that right now I have a continuous headache, which is failing to heal,” stated the complainant.

The attackers used their hands and batons to inflict harm on the victims, leaving them with severe injuries and trauma. As of now, the motive behind the assault remains unclear, and the identity of the assailants is yet to be established.

The @CCCZimbabwe party, also known as the CCC (Citizens for Constitutional Change), is a political party that has been advocating for democratic reforms and positive change in the country. The incident has raised concerns about the safety and security of political party members during public gatherings and events.

25 Zanu PF Supporters Injured In ZUPCO Accident

By-At least 25 Zanu PF supporters have been injured in a ZUPCO bus carrying them from Lusulu in Binga to a campaign rally in Nkayi on Sunday.

The bus veered off the road and overturned, resulting in one passenger’s death and the injury of 25.

ZANU PF Matabeleland North provincial chairperson Richard Moyo told NewsDay that several people were injured in the accident. He said:
Yes, it is confirmed that one person was trapped under the bus and died and a few are injured and were rushed to hospital. Some of them were checked and discharged.
The Zimbabwe Republic Police (ZRP) also confirmed the accident on Sunday evening.

Zanu PF Supporter Dies In ZUPCO Accident

By-One Zanu PF died in a ZUPCO bus carrying bussed party supporters from Lusulu in Binga to a campaign rally in Nkayi on Sunday.

The bus veered off the road and overturned, resulting in one passenger’s death and the injury 25.

ZANU PF Matabeleland North provincial chairperson Richard Moyo told NewsDay that several people were injured in the accident. He said:
Yes, it is confirmed that one person was trapped under the bus and died and a few are injured and were rushed to hospital. Some of them were checked and discharged.
The Zimbabwe Republic Police (ZRP) also confirmed the accident on Sunday evening.

Mnangagwa Undresses Mphoko

By-Zanu PF President Emmerson Mnangagwa at the weekend humiliated his former co-Vice President, Report Phelekezela Mphoko, at the party’s election campaign rally in Nkayi.

Mphoko made a surprise public appearance at the Zanu PF Presidential Star Rally held at Nkayi Business Centre.

He was among members of the G40 group who were fired from the ruling Zanu PF party after the November 2017 military coup.
The party also fire him from the position of Vice President and Second Secretary for siding with the late President Robert Mugabe and his wife Grace.

Mphoko was fired on the day the party also displaced the militarty coup ousted President Mugabe from the position of party First Secretary and replaced him with Emmerson Mnangagwa.

Since the November 2017 coup, Mphoko has not been seen in public events, and Sunday was his first time appearing at a Zanu PF event.
Soon after taking to the podium to address the rally, Mnangagwa acknowledged Mphoko’s presence, before undressing him.

“Former Vice President Phelekezela Mphoko is here. Undoda lo sakhula sonke siyazana sasisenza izinto ezinengi kodwa angisoze ngazikhuluma. Ngiyabonga ukuthi namhla ubuye ngapha to support me. I’m am very grateful he came to support me (We grew up together with this gentleman and we did many things together, which I will not talk about. I am happy that today he came here to support me),” he said.

Chitando Kicked Out From Mutoko

High Court judge Justice Munamato Mutevedzi has kicked out Mines and Mining development minister, Winston Chitando through his company, Barrington Resources from mining lithium in Mutoko—Mashonaland East province.

The minister had attempted to block Pulserate, a company linked to the Moti Group from mining lithium in the area but the court ruled that he was abusing his authority.

Under Case number HC 8671/22, Barrington Resources made an application for the resolution of a boundary dispute relating to the boundaries of conflicting lithium claims owned by Barrington and Pulserate respectively, who both contend that their claim includes within boundaries the Good Days mine.

Chitando was accused of being conflicted in the matter as he was the minister as well as being involved in the company fighting over boundaries.

Chitando is also linked to Hanzu Resources, another mining company.

The minister was cited as the third respondent and some of the accusations traded by the parties tangled the minister in the dispute in his capacity.

In a detailed judgement delivered by Mutevedzi, it was contended that the coordinates which Barrington Resources claimed are the correct ones cannot be proved without showing the court that due process was followed in their pegging.

The most critical issue, according to court documents, was whether Barrington Resources was the prior pegger of the mining location in dispute.

Barrington in its application claimed that it had acquired the mining rights in 2012, but the company was only incorporated in 2013 according to its registration number.

There was no pre-incorporation contract, according to the court papers to make the acquisition legal as required in law.

“If there isn’t a pre-incorporation contract, then the applicant’s claim to be the owner of the mining blocks in question can only be a fraudulent transaction,” Mutevedzi stated in his ruling.

Pulse Rate, according to the court papers, said it had carried out necessary due diligence before the acquisition of the mining blocks in question.

These investigations included obtaining information from the second respondent (the Mines Ministry) who confirmed to it that at the time the fifth respondent (Hope Mine syndicate) pegged the blocks the mining location was open for pegging.

Pulserate said Chitando was exerting overbearing influence throughout the allocation process as seen by the illegal procurement of its documents kept at the Ministry of Mines offices.

Pulserate stated that it is Barrington itself seeking to fraudulently take over its Good Days K claim citing that the arrangement between Chitando and Barrington Resources was illegal.

Pulserate had referred to press reports which contained these allegations which the Minister did not deny.

The allegation regarding the incorporation status of Barrington was made right from the start by Pulserate.

Using bare knuckles Pulserate did not only accuse Barrington of approaching the court with dirty hands but that it literally “dripped raw sewage”.

Pulserate alleged that the applicant (Barrington Resources) is a company owned by Chitando citing that this contravened section 364 of the Mines and Minerals Act, which states that such Minister cannot directly or indirectly be involved in any mining business.

The situation, according to the court documents was compounded by Chitando who chose to completely ignore the application and even failed to respond in the case of a personal attack on him.

Barrington, despite the challenge regarding its incorporation, remained mute on the issue and did not refute the allegation that it was incorporated in 2013 as shown by its registration number.

It equally did not disown that registration number.

According to the judgement, the court found that Barrington Resources had not been incorporated in 2012 and its purported acquisition of the mining rights from Andrew Zuze was a nullity in law.

Barrington’s failure to answer to the allegations by Pulserate about their incorporation and their attempt to shift the onus was nothing more than an admission by Barrington that there is no pre-incorporation contract when they purportedly acquired the mining rights in 2012.

Barrington also tacitly admitted a failure to comply with all other requirements that would have validated its transaction with Zuze.

Its acquisition of the mining rights was therefore defective at the very best and a nullity at worst.

According to the court papers, two entities can have mining certificates for the same mining location, and both can be deemed a pegger to the mining location.

To determine the rightful pegger one has to consider prior peggers, where the pegger has to ensure their mining rights are duly maintained, which means to abide by all the conditions for your mining rights not to be revoked.

According to the judgement, Barrington could not have properly acquired the mining rights from Zuze in 2012 as it was before their incorporation as it could not perform juristic acts.

Traditional Leaders Unhappy Over Kuvimba Mining House Bullying Tactics

Harare- One of the biggest mining companies in the country Kuvimba Mining House -whose formation was shrouded in controversy- is at loggerheads with traditional leaders in Midlands province, a local online has revealed.

According to the local online, the mining giant overstepped lithium mining boundaries in Mberengwa where they took over Sandawana mine.

This development was not welcomed by traditional leaders namely Chief Chingoma,Chief Mposi , Chief Mapiravana and Chief Mposi who feel that the miner is depriving youths and villagers who are not benefiting from the rich resources in the area.

“The chiefs met last week to map way forward over the bullying by Kuvimba and resolved or rather are contemplating to air their griviances to the presidium when they visit the province on August 10,” said our impeccable source .

It is further alleged that Kuvimba connived with police to confiscate mining equipment from youths in the Mberengwa community thereby depriving them of their rights and ore which is in complete negation of NDS1 and sustainable development and youth empowerment that is being championed by President Emmerson Mnangagwa.

Kuvimba owns quite a large array of assets either as 100% owner of major shareholder.

The entities include Freda Rebecca gold mine. Bindura Nickel Corporation,Jena Mines ,Sandawana Mine and Great Dyke investments among others.

The ownership of the mine has also been kept a well guarded secret although government has stake in the company through a public-private enterprise .

However, some speculative reports have linked it to tycoon Kuda Tagwirei a claim which has been rubbished by company authorities.

The said reports suggested that upon it’s formation, documents including leaked correspondence among executives and shareholders, show that weeks after Tagwirei was sanctioned by the US, his Mauritius-based Sotic International began planning to shift its assets to a newly created holding company – Ziwa Resources. Ziwa is the only private shareholder in the partnership in Kuvimba.

Efforts to get comment from the company’s youthful chief executive Simba Chinyemba- a qualified acturian- proved fruitless as he did not respond to questions we sent to him last week and also did not pick up phone calls made to his mobile number .

‘They Are Innocent’ – Court Says As It Clears Trio Of Dealing In Drugs

By A Correspondent| Three businessmen have been cleared of a charge of dealing in dangerous drugs following their arrest last November accused of engaging in a cocaine transaction.

Honest Shumba, Huggins Shumba and Stanley Lawrence Eze denied the allegations stating they were arrested while discussing a vehicle spare parts deal while at an apartment in Avondale.

It was alleged that on November 21 last year detectives from CID Drugs and Narcotics received information from a source that there was a drugs deal at number 3 David Morgen Road in Avondale.

Reports were that the detectives pounced on the apartment and conducted body searches on the trio and found a sachet of cocaine on the bed the trio were seated.

This resulted in the arrest of the three. The cocaine allegedly weighed 105grams.

Represented by Admire Rubaya, Malvern Mapako and Gift Nyandoro, the three denied the allegations when the trial opened before regional magistrate Feresi Chakanyuka.

They even alleged that their arrest was after a failed extortion attempt by the cops who wanted to siphon US$30 000 out of them.

Malema providing 500 buses for Zimbos “to home and vote. They are welcome back.” Juju will flip flop if Zanu PF rig and win.

By Wilbert Mukori- Julius Malema, the leader of SA’s Economic Freedom Fighters (EFF) party  is a demagogue and, like all demagogues, one cannot reason with him. He does not have the intellectual incapable of comprehending simplest facts! 

Malema has failed to understand that Zanu PF not just rigs elections but that the process has become so flawed and illegal the only rational solution is to stop participating. 

In 2008 Morgan Tsvangirai garnered 73% and that was not good enough to get him the keys to State House. ZEC has failed to produce a verified voters’ roll and Team Pachedu has since uncovered so many glaring and deliberate mistakes in the voters’ roll it is immediately clear why the regime did not want the roll properly audited. The regime has plans to frogmarch rural voters; etc., etc.

There is a mountain of evidence already that Zanu PF is rigging these elections and that participating will only serve to give SADC the excuse to grant Zanu PF political legitimacy. And yet Malema still insists that Zimbabweans must participate.

“We call on all Zimbabweans who are here in South Africa to go back home and vote. If it means coming back, they can come back, they are more than welcome, but they must do the right thing and go and vote,” he said  few weeks ago.

Well the demagogues has since put his money where his mouth is. EFF help pay for 500 buses to transport Zimbabweans travelling back to Zimbabwe to vote! 

Now that Malema has gone the extra mile and offered to pay for 50 000 (assuming 100 voters in @ bus), he will probably assume that 20 times that number will make their own way and so over 1 million of the 3 million Zimbabweans in SA alone will be voting to remove Mnangagwa. 

Many of those who do travel to Zimbabwe to vote will be denied the vote because their name is not in the Polling Station voters’ roll the expected it to be or has been deleted or some such reason as many in Zimbabwe will find out on voting day. But of course, Julius Malema will take another Zanu PF landslide victory as proof Zimbabweans are not fighting to end the Zanu PF dictatorship. 

The accusation that Zimbabweans were in SA because they are cowards who would not confront the Zanu PF dictatorship was the caucus celebre to justify the xenophobia attacks of Zimbabweans.

Credit where credit is due, Julius Malema and his EFF have condemned the xenophobia attacks. His language has changed, there is a razor sharp edge to it.

“No-one is going to fight for these Zimbabweans who are loitering the streets here. They are their own liberators. For once, they must take responsibility and get into buses and go home and vote.”

Julius Malema and his EFF cronies are renowned for their flip flops. Will another Zanu PF landslide victory; Malema will not care that the elections were rigged, he does not care about details especially when they are way above his head; force Juju to perform one of his notorious flip flops.  

If Zanu PF rigs and wins the 23 August elections, all signs are they will, then there will be new wave of Zimbabwean economic and/or political refugees. Those going to SA will be shocked to find increased anti-Zimbabwean vibes and the next xenophobia violence will be even worse than ever! 

Again, credit where credit is due, SA’s Minister Lindiwe Zulu did push Morgan Tsvangirai and his MDC friends to implement the democratic reforms during the 2008 to 2013 GNU. If the reforms were implemented Zimbabwe would have cured herself once and once for all this curse of rigged elections and bad governance. 

Sadly, all her effort was wasted, the MDC leaders turned out to be (and still are) corrupt and breathtakingly incompetent. They failed to implement even one token reform in five years. 

SADC leaders made one last minute attempt to have the 2013 Zimbabwe elections postponed until reforms were implemented. “If you take part in these elections, you will lose. The elections are done!” the regional leaders told Tsvangirai and company to their faces at the June 2013 SADC Summit in Maputo, Mozambique.

But again MDC leaders paid no heed to the warning. Zanu PF went on to rig the 2013 elections, as SADC leaders had warned and they did a volte-face of their own by granting vote rigging Zanu PF political legitimacy. And granted vote rigging Zanu PF legitimacy yet again in 2018. 

At its party congress SA’s ruling party, ANC, resolved that they would not allow regime change in Zimbabwe. This is most alarming because this suggests that SA will use it dominance in SADC to once again grant vote rigging Zanu PF political legitimacy in these 2023 elections regardless of the evidence these elections a flawed and illegal. 

It is infuriate that both EFF and ANC are completely ignoring the political reality that Zanu PF is blatantly rigging these elections, and are conniving in granting vote rigging Zanu PF legitimacy and thus perpetuating the dictatorship and yet have the chutzpah to blame the ordinary Zimbabwean economic and political refugee escaping the consequences the failed state they are nurturing! 

More toilets and borehole, “which I will fund”, promised “Bull” Mliswa. Turning Norton into an oasis in failed state desert

By Wilbert Mukori- Zanu PF is rigging these 2023 elections. It is insane to keep participating in these flawed elections only to give the vote rigging Zanu PF legitimacy, especially after 43 years of the Zanu PF mafiosi rigging elections. 

The opposition are participating out of greed, there are after the few gravy train seats Zanu PF is giving away as bait. Pure and simple.

As for the ordinary Zimbabweans they are participating in these flawed elections to give Zanu PF legitimacy and thus perpetuating their own suffering out of fear and ignorance. 

If you are in the rural areas, it is foolhardy to defy the dictates of the Zanu PF operatives who are frogmarching povo to party rallies in preparation to frogmarch them to vote on 23 August. The opposition has been telling them “Your vote is your secret!” They are smart enough to know that is just hot air. Zanu PF has increased the number of Polling Stations from 10 per constituency in 2008 to over 60 this year and the Zanu PF goons will marking a register of all who vote. As soon as the results of each Polling Station is announced, the goon will KNOW who did not vote for Zanu PF!

The so-called Zimbabwean intellectual and urbanites (so called because they should know better but they clearly don’t) are participating in these flawed elections even after all the warning about the sheer futility of doing so because they are seduced by the opposition leaders’ rhetoric.

“The Water and Sanitation program which I have been financing throughout my term in Norton continued this week with more boreholes and toilets unveiled for various areas in need,” post Themba Mliswa, Independent MP for Norton, “the Bull of Norton”, one of the luminaries in the opposition camp.

“The latest areas to benefit included Mutubva Secondary, Mutubva Compound and Skea Farm.

The school has an allocation of 10 toilets and a borehole which we commissioned on Saturday.”

Mliswa is campaigning to be re-elected MP in this election. He clearly does not understand why Zimbabwe is in this mess much less understand that his blundering incompetence and greed are the root causes we are stuck in this mess! 

Zimbabwe is a failed state because we have failed to hold free, fair and credible election, the prerequisite for competent and accountable government. Since the 2008 to 2013 Zanu PF has learned that the regime can continue to rig elections and get away with it as long as it allowed the opposition to win a few seats and thus maintain the facade the country is a healthy and functioning democracy. 

People like you Mliswa and Tendai Biti have had many, many man-hours in parliament to deliver your speeches “full of sound and fury” but when push came to shove Zanu PF has always done as it damn well pleased. I salute Tendai Biti, at least he was smart enough to realise the sheer futility of this political circus and bold enough to admit it.

“Look, you can’t keep on participating in flawed electoral processes that serve to give big benefits to dictators such as Robert Mugabe. Mugabe has perfected the art of winning elections. So it will be very foolish for the opposition to continue legitimizing these sham elections which don’t deliver. This country will go through a serious economic crisis in 2020 caused by Zanu PF. And yet, this is the only country where a government doesn’t perform, it is encouraged by a super majority in parliament,” said Tendai Biti in a 2015 interview with Isaac Mugabi.

“So you can’t continue subjecting Zimbabweans to processes where their hopes just get crushed.”

What Biti has lacked is the courage of his conviction to stop participating in rigged elections. Greed got the better of him. 

As for you Themba Mliswa you clearly do not have the intellect to see that the opposition are participating in these flawed elections to give Zanu PF legitimacy and thus perpetuate the dictatorship, the failed state and the heartbreaking suffering that entails to millions of Zimbabweans out there.

“The Water and Sanitation program which I have been financing,” you boast. How nauseating! 

You are paying for these basic needs because the people cannot afford to pay because unemployment in Norton, like every where else in the country, is 80% plus. These people would pay for all these things for themselves and lots more besides if they have the opportunity to work and earn a living wage. They do not want charity because even you cannot meet all their needs.

The people of Norton are not going to wake up one day living in posh houses with running water, no power cuts, five star schools and hospitals, all their roads paved with gold; an oasis in the desert. All thanks to the generosity of their independent MP, the Honourable Themba Mliswa. 

The number one task for any MP in Zimbabwe today is to end the Zanu PF dictatorship that is holding the nation to ransom by implementing the democratic reforms and thus stopping the regime rigging the elections. How anyone can think that participating in flawed elections to give Zanu PF legitimacy for selfish gain is the answer beggars belief! 

Mnangagwa’s Penchant For Wasting State Cash Continues

PRESIDENT Emmerson Mnangagwa has dismissed allegations that ZANU PF is interfering with the operations of the judiciary, saying such claims are either motivated by mischief or ignorance of the laws of the land.

President Mnangagwa said this at the Robert Gabriel Mugabe International this Saturday on arrival from Russia.

It has been a busy couple of weeks for the country’s courts, which made significant judgments ahead of the 23 August general elections.

Firstly, it was Elizabeth Valerio, who won her appeal to run for presidency after her nomination papers had not been accepted on 21 June.

Then, another presidential aspirant, Savior Kasukuwere had his nomination nullified by the High Court, a ruling that was then upheld by the Supreme Court on Friday after the two courts proved that he was not in the country for a period of 18 months as stipulated by the constitution.

In Bulawayo, 12 CCC candidates were also barred by the High Court from contesting after it was proved they had submitted their nomination papers after the closure of the nomination court on 21 June.

“He made several donations of thousands of metric tonnes and then of course you are fully aware of the geo political situation in the country, there is now a mood of creating a new world order and its unfolding and we all are contributing to creating a new world order where everybody is treated equally and where international law is observed.”

While in Russia President Mnangagwa met with his Russian counterpart, President Vladmir Putin, paving way for the signing of several Memoranda of Understanding (MOUs) in the fields of ICT, agriculture, higher and tertiary education, media, as well as industry and commerce between Russia and Zimbabwe.

Mnangagwa Claims Does Not Influence Court Decisions

PRESIDENT Emmerson Mnangagwa has dismissed allegations that ZANU PF is interfering with the operations of the judiciary, saying such claims are either motivated by mischief or ignorance of the laws of the land.

President Mnangagwa said this at the Robert Gabriel Mugabe International this Saturday on arrival from Russia.

It has been a busy couple of weeks for the country’s courts, which made significant judgments ahead of the 23 August general elections.

Firstly, it was Elizabeth Valerio, who won her appeal to run for presidency after her nomination papers had not been accepted on 21 June.

Then, another presidential aspirant, Savior Kasukuwere had his nomination nullified by the High Court, a ruling that was then upheld by the Supreme Court on Friday after the two courts proved that he was not in the country for a period of 18 months as stipulated by the constitution.

In Bulawayo, 12 CCC candidates were also barred by the High Court from contesting after it was proved they had submitted their nomination papers after the closure of the nomination court on 21 June.

Chamisa Slaps Mnangagwa: No 2023 Election Without My 12 MPs

CCC President Nelson Chamisa Threatens Election Boycott Over Disqualified Candidates.

*Marondera, July 31, 2023* – By Farai D Hove | The Citizens Coalition for Change (CCC) President, Nelson Chamisa, has declared that the 2023 elections in Zimbabwe will not take place if his 12 parliamentary candidates from Bulawayo are not reinstated. The announcement was made during a campaign rally held outside Rudhaka Stadium in Marondera yesterday.

The selection process for CCC candidates has been marred by chaos, with about 20 constituencies, particularly in Harare, witnessing double or triple candidates. The situation in Bulawayo was particularly contentious, as Nelson Chamisa attempted to gain an advantage by keeping his candidates in the dark while others submitted their nomination papers after the 4 pm deadline.

In response to this situation, 12 concerned registered voters from Bulawayo sought legal intervention and approached the High Court to have all 18 candidates who filed their nomination papers after the deadline disqualified. The Bulawayo High Court subsequently ruled in favor of disqualifying the 18 candidates, leading to three ZANU PF candidates winning unopposed in Cowdray Park, Bulawayo South, and Bulawayo Central.

Frustrated by the court’s decision, Nelson Chamisa publicly threatened to boycott the upcoming August 23 elections if his 12 Bulawayo candidates are not reinstated. He stated that if President Mnangagwa refuses to reinstate their candidates, it would be tantamount to declaring there will be no election in the country.

“Akaramba ma MP edu 12 (anenge) ataura kuti munyika muno hamuna ma election (If he refuses to reinstate our 12 candidates, he would have declared that there is not going to be an election in this country),” remarked Mr. Chamisa during his address at the rally.

In response to the opposition leader’s stance, President Mnangagwa emphasized that his administration has not filed any cases against political parties and should not be held responsible for candidates’ ignorance of electoral laws. He urged the opposition to familiarize themselves with the laws and challenged them to seek reimbursement for their tuition fees if they had studied law.

Amid the election dispute, Mr. Chamisa also made promises about bringing back the US dollar as the national currency, dismissing the local currency. However, his statements were met with criticism for ignoring the existence of the Minister of Finance and the local currency, which is currently pegged at about US$1 to $4,500.

As tensions escalate between political parties, Mr. Chamisa maintained that if his candidates are not reinstated, it would be a vote of no confidence in the elections and the Zimbabwe Electoral Commission (ZEC). He also hinted at the possibility of seeking alternative solutions, such as a Transitional Authority.

“We will now be saying if you don’t want elections, we shall now go for a Transitional Authority,” said Mr. Chamisa. “If he refuses our 12 MPs, he has done a couple on the ballot. It’s a vote of no confidence in the elections. It’s a vote of no confidence in @ZECzim. We will not accept that… Mnangagwa underestimates us. He has no clue what we are capable of… we come in peace, let’s fix the country,” he added.

Mr. Chamisa also referenced the exile of some political figures, stating, “I saw what he did to @Hon_Kasukuwere… why is he in SA? Why is @ProfJNMoyo in Kenya? I might not agree with them, but they cannot be denied their rights.”

With just weeks left until the scheduled election date, the situation remains tense as the CCC’s position on the boycott continues to draw attention and debate across the country.

Bosso Eye South African Player

Highlanders are assessing South African Thabo Lunga Zikode as they look to bolster their attack before the end of the mid-season transfer window.

Zikode is formerly of Uthongathi FC in the South African National First Division.

FC Platinum’s title defence hit another stumbling block after losing 2-1 to Sheasham at Mandava Stadium in Zvishavane on Saturday.

Chamisa Warms Up For State-House

By-The opposition CCC Presidential aspirant Nelson Chamisa said he would only serve for one term as President of Zimbabwe and retire to be a preacher.

The CCC leader told party supporters at a rally held at Muchakata Business Centre in Masvingo Central last week that late former President Robert Mugabe and former Prime Minister Morgan Tsvangirai said he was the right person to fix all the country’s problems. Chamisa said, as quoted by The Mirror:

I will not stay long in power, I will only be in power for one term and leave others to lead the country. I have been telling you ndakasiirwa basa naTsvangirai and Mugabe kuti basa rako kuti ugadzire nyika ive nechimiro, yava nechimiro ngakuite mumwe (Tsvangirai and Mugabe gave me task to fix the country until all issues are resolved and leave the presidency to others). I will then go and rest in Gutu, teaching about leadership, and preaching the word of God.

He also said he will redraw the country’s provincial boundaries and reduce them from the current 10 to only 5, and also rename the provinces in order to do away with tribal connotations. Said Chamisa:

Midlands will be the administrative capital of our land, Masvingo will be known as the ancient capital also retaining our culture and tradition, Bulawayo as the Industrial capital, Manicaland as the horticultural capital.

The country will be reduced from 10 provinces to five regions, North, South, East, West and Central. We are currently dividing each other because of tribalism.

Chamisa said if he wins but fails to deliver, citizens are duty-bound to remove him from office. He said:

If I win the election and fail, the country should remove me from power. Leaders must know that they come and go. We want to stop the abuse of power.

He also pledged to have a lean and mean Government with a maximum of 15 competent cabinet ministers.

ZEC Speaks On Ballot Papers

By- The Zimbabwe Electoral Commission (ZEC) has said they have started printing ballot papers for the presidential election.

ZEC said this started following the conclusion of all court cases related to the election last weekend.
The process began soon after the Supreme Court dismissed an appeal on Friday by presidential aspirant Mr Saviour Kasukuwere seeking to overturn a High Court ruling barring him from contesting the August 23 election.
In an interview with The Sunday Mail, ZEC vice chairperson Ambassador Rodney Kiwa said: “We have no problem with the presidential ballot papers now that the courts have cleared us.
“We have started printing those ballot papers.
“However, the current court cases relating to National Assembly candidates are impacting the printing of ballot papers.”
He, however, refused to divulge whether ZEC had begun printing ballot papers for elections in National Assembly constituencies that have not been affected by court challenges.
Delays in finalising cases, he added, were hindering other election-related processes, such as postal voting.
“We have not yet distributed voting material to those taking part through postal voting.
“We received applications, and ZEC closed the receipt of applications.
“Our challenge now is to send three ballot papers for the presidential, National Assembly and local authority elections to those who qualify for postal voting.
“Although we are clear on the presidential ballot, we are not yet clear on the National Assembly.”
Postal voting is open to members of the uniformed forces and election officials intending to cast their votes ahead of the August 23 polls when they will be on official duty.
Those who qualify for postal voting include members of the disciplined forces, electoral officers, diplomatic and consular officials working outside the country and their spouses.
The process is open to those who apply not more than 14 days after sitting of the Nomination Court.
Successful applicants receive their voting material in advance and will be required to send their votes in sealed envelopes to the chief elections officer at least 14 days before polling day, which is Wednesday next week.
The chief elections officer is then supposed to distribute the postal votes to their respective constituencies within seven days of the date of the actual poll.
Chiefs Council
On Thursday, ZEC will conduct elections for members of the National Council of Chiefs, marking the first stage of the 2023 harmonised elections.
In an earlier separate interview, ZEC chief elections officer Mr Utloile Silaigwana said preparations for the elections to the council, which is constituted by an Act of Parliament to represent traditional chiefs across the country, were on course.
“The commission has already prepared the ballot paper for the election,” he said.
“It is important to note that the ballot paper is blank since the commission does not know the names of chiefs who will be nominated for election on August 3, 2023.
“The provincial assemblies of chiefs will meet on August 3, 2023 to elect members to their respective provincial council of chiefs.
“The combined provincial councils of chiefs become the National Council of Chiefs or simply the Council of Chiefs,” he said.
Thirty-six chiefs will be elected into the council — Manicaland (5), Mashonaland Central (4), Mashonaland East (4), Mashonaland West (4), Masvingo (5), Matabeleland North (5), Matabeleland South (4) and Midlands (5).

Six Perish In Rusape Horror Crash

By-Six (6) people died in a road traffic accident in Rusape along the Harare-Mutare Road on Friday evening.

Zimbabwe Republic Police (ZRP) spokesperson Assistant Commissioner Paul Nyathi confirmed the accident to ZBC News, saying three people died. In contrast, the others died on admission at Rusape General Hospital.

Asst Comm Nyathi said that a Harare-bound commuter omnibus side-swiped a haulage truck as the driver tried to overtake at a sharp curve before Rusape tollgate.

Six other people in the commuter omnibus were admitted at Rusape General Hospital after sustaining injuries.

Zanu PF Thugs Torch CCC Chiredzi Activist’s House

By- Suspected Zanu PF thug in Chiredzi have torched a house belonging to a well-known CCC activist, Cephas Magezani.

This happened a few days after they burnt and tore CCC’s Chiredzi South candidate Douglas Gumbo’s posters.

Magezani told TellZim News that although he was not running for any post, his influence in opposition politics is very significant.

He said the fire incident could be a warning to him and other party supporters. Said Magezani:

It’s nothing else, from my perspective other than political violence. A day before, ZANU PF supporters who we suspect had been sent by ZANU PF candidate Joey Sithole, burnt down Douglas Gumbo, our candidate for Chiredzi South,’ posters and a day after, I woke up to the shock of my life seeing my house which I use as a storeroom, gutted by fire. There is no such coincidence.

This is not the first time I have faced politically motivated incidents. In 2008 I was abducted by suspected ZANU PF goons and many thought I was not going to make it. This is the same skill they are trying to use to scare people.

Police are said to be investigating the burning of Magezani’s house which many believe to be a politically motivated incident.

Meanwhile, in Chiredzi Central, members of the Forever Associate Zimbabwe (FAZ) have reportedly been openly spray painting and tearing off campaign posters for CCC’s Ropafadzo Makumire.

Makumire is a seasoned town planner, urban designer and one of the founding directors of Makums Town Planning Consultants (Pvt) Ltd.

Kasukuwere Knocked Out Of Presidential Elections Race

Independent presidential candidate Saviour Kasukuwere is now out of the race for the country’s top office in August 23 elections after the Supreme Court has dismissed an appeal filed by the exiled politician who was challenging a poll ban imposed on him by the High Court.

Supreme Court judges ruled Friday that the appeal filed by the former Zanu PF political commissar “lacked merit”.

“We carefully considered the evidence and oral submissions by both counsels. Court is of view the appeal lacks merit. Appeal be and is hereby dismissed,” read the court ruling in part.

Kasukuwere had approached the apex court to challenge the ban imposed on his candidacy by High Court judge David Mangota, who ruled in favour of a Zanu PF activist’s application seeking the disqualification of President Emmerson Mnangagwa’s nemesis.

Gems Fall

THE Zimbabwe senior netball team, the Gems kicked off their 2023 Netball World Cup campaign on a poor note after an 86-30 defeat to heavyweights Australia in their opening match at the Cape Town Convention Centre in South Africa this Friday.

After a great opening quarter in which the Gems matched the mighty Australians, the team sadly failed to keep up for the rest of the match as the world’s highest-ranked nation showed their class.

Buoyed by a vociferous crowd in South Africa, the Gems came out of the blocks firing and took the game to their more fancied opponents as they matched their intensity in the first quarter despite Australia taking a 20-11 lead.

Shocked by the determination of the Gems, Australia made a few tactical changes that worked well in their favour, and they started creating some breathing light between the two teams.

In the second quarter, Zimbabwe only added eight points as the two teams went for halftime with Australia leading 41-18.

The third and fourth quarters were more of the same and even the changes made by the Gems technical department failed to change the flow of the game.

It was not exactly what the Gems were hoping for, but the coach is taking some positives from the game.

“We need to be more consistent on the offensive side and be more clinical in defence, after the match today the girls are in a positive mood, we have seen that we can hold them, but we did that in phases,” said Gems assistant coach, Tatenda Shinya.

Zimbabwe take on Fiji in their second Pool A match this Saturday looking for nothing short of victory to keep their tournament alive.

Meanwhile, in the other Pool A match, Tonga edged Fiji 56-51.

The top three teams from each of the four Pools will progress to the next round.

Today, Zanu PF members unleashed violence against Citizens Coalition for Change [CCC] members at Sipambi Shopping centre, ward 11 in Masvingo West.

The CCC members were putting up CCC campaign posters when over 20 Zanu PF members wearing party regalia attacked them.

Also, Zanu PF members are tearing and destroying CCC posters in Masvingo West.

CCC members Mr. Admire Mufamba and Mr. Danson Gwaradzimba were badly injured after the Zanu PF attacks.

Mr. Gwaradzimba and Mr. Mufamba have reported the case of assault against Zanu PF members at Masvingo Central police.

Police report RRB REF 5432966, Constable Mukoko is the investigating officer.

In addition, Mr. Mufamba and Mr. Gwaradzimba are seeking medical attention.

CCC Masvingo West aspiring member of parliament, Mr. Pedzisai Gasva, said, “We, as CCC members, condemn the violence being perpetrated by Zanu PF members against our members. It’s sad that our members were injured and currently receiving treatment.”

Mr. Gasva said he is in Mvuma and will be in Masvingo town to help the injured CCC members.

Mr. Tichaona Mharadza Chiminya said, “We identified youth who beat our members. Masvingo urban ward 10 Zanu PF councilor, Mr. Manyanga, Delight Mandebvu, Milton Mutongi, ward 12 Masvingo West, Chauke, were among Zanu PF youth members who beat our members.”

In Masvingo Province, Zanu PF members have unleashed violence against CCC members in Gutu, Bikita, Mwenezi, Chiredzi, and Masvingo West, among others.

Interestingly, police are yet to arrest Zanu-PF members who are beating CCC members.

Printing of Ballot Papers Commences Without Kasukuwere’s Face

In a significant development for Zimbabwe’s upcoming presidential election, the printing of ballot papers has commenced without the inclusion of presidential aspirant Mr Saviour Kasukuwere’s face. ZRP Cops Gun Down 2 Suspected Robbers in Budiriro

Budiriro- In a gripping and intense encounter at the break of dawn on Friday, police gunned down two suspected robbers in a thrilling shootout that sent tremors throughout the area. The daring raid took place at a hideout in Budiriro, where the suspects had been allegedly masterminding a string of robberies.

The suspects, identified as Mugove Chimuti (36) and Ishmael Mutungira (30), met their fate during the exchange of fire with law enforcement officers. However, the encounter didn’t end there, as four other members of the notorious gang were swiftly apprehended, bringing a measure of justice to the community.

The gang, consisting of Tinotenda Zhuwawo Dzvairo (27), Tinashe Ray Chirombo (31), Trymore Derere Guta (30), and Hebert Clayton Nyamangodo, is believed to be responsible for a staggering 17 robberies that have occurred between January and July.

Police spokesperson, Assistant Commissioner Paul Nyathi, confirmed the thrilling incident and provided insight into the successful operation. He revealed that detectives from CID Homicide, Harare, acted on crucial information received on July 25. The information linked Zhuwawo Dzvairo, Nyamangodo, and Chirombo to a series of robbery cases around Harare. Acting on the lead, detectives managed to apprehend the three suspects as they were traveling in a Toyota Mark II vehicle towards the Harare central business district.

The initial arrests proved fruitful, as police were able to recover significant evidence, including a bolt cutter, two cellphones, a watch, eight pairs of shoes, and seven baby blankets. The seized items further strengthened the case against the suspects.

Following the initial arrests, Guta was implicated and subsequently apprehended at Munyuki Shopping Centre in Epworth. His arrest yielded additional evidence, including a video camera, a watch, jewelry, 10 cellphones, five pairs of sneakers, and new baby clothing found at his residence. Guta then provided information that led to the identification and location of the two deceased suspects, Mutungira and Chimuti.

On receiving a tip-off about the whereabouts of the two remaining suspects, detectives descended on a hideout in Budiriro. A fierce shootout ensued during which both Chimuti and Mutungira sustained injuries. Despite being rushed to Sally Mugabe Hospital, they tragically succumbed to their wounds upon admission.

While the operation was undoubtedly a success, the police are not resting on their laurels. They are now appealing to the public for any information that could lead to the arrest of the remaining accomplices, who have been identified as Brighton Mangondo (alias Mombe), Jonna, Satan, and Ishewekunze.

This is not the first time that Mugove Chimuti has found himself in a life-threatening exchange with law enforcement. In 2019, he was arrested after a bloody gunfire confrontation with police detectives in Chinhoyi. At that time, he was part of a 15-member gang responsible for an astonishing 15 robberies in a single day.

Chimuti and his accomplice were charged with armed robbery and kidnapping, but it remains unclear how he was released from custody on that occasion. Prior to that incident, Chimuti faced similar charges in 2017 alongside Gift Dandemutande, Ishmael Mutungira, Musarurwa Gutsa, and Tinashe Munhanga, after a spree of 23 armed robberies.

The recent shootout in Budiriro highlights the bravery and dedication of law enforcement in their efforts to tackle crime and keep communities safe. However, it also serves as a stark reminder of the dangers they face while fulfilling their duty to protect and serve the public.

About Drowning

Drowning has caused over 2.5 million deaths in the last decade. The overwhelming majority of these deaths (90%) happen in low- and middle-income countries. Globally, the highest drowning rates occur among children aged 1–4 years, followed by children aged 5–9 years.

Mane Leaves Bayern Munich

Bayern Munich and Saudi Arabian club Al Nassr have reportedly reached a verbal agreement for the transfer of Sadio Mane.

The Senegalese star set to leave the Bavarians after only a season.

The 31-year-old moved to Germany last year from Liverpool but battled for consistency in his first season.

UEFA Ban Juventus

UEFA has banned Juventus from taking part in all European inter-club competitions for one season over financial irregularities.

The sanction means Juve have been disqualified from this season’s Europa Conference League and will likely be replaced by Fiorentina, who finished eighth in Serie A last season.

The club has also been ordered to pay a €10m fine.

A statement by UEFA’s financial monitoring board reads: “The CFCB First Chamber concluded that Juventus (ITA) violated the UEFA’s regulatory framework and breached the settlement agreement signed in August 2022. As a result, the CFCB First Chamber terminated the settlement agreement concluded with the club and decided:

“To exclude Juventus from the 2023/24 UEFA men’s club competition;

“And impose an additional financial contribution of €20 million on the club. Of this amount, €10 million is conditional and will only be enforced if the club’s annual financial statements for the financial years 2023, 2024 and 2025 do not comply with the accounting requirements as defined in Annex G of the UEFA Club Licensing and Financial Sustainability Regulations.”

Juventus confirmed they would not appeal the decision, with club president Gianluca Ferrero saying they “can now face the new season by focusing on the field and not on the court”.

The club was docked 10 points in the Serie A table in May for artificially inflating transfer fees to boost capital gains.

That saw them ultimately drop down from third place to seventh, qualifying not for the Champions League or even Europa League, but the Conference League.-Soccer24 News

Zimbabwe: Elections in the Context of Systematic Human Rights Violations and Criminalization of State Critics

Statement: Zimbabwe’s upcoming general election will take place in the context of five years of systematic, brutal crackdowns on human rights, including recent restrictions on political opposition gatherings, the violent suppression of protests and the criminalization of state critics, Amnesty International said today, ahead of the vote on 23 August.

Over the past five years, the rights to freedom of expression, association and peaceful assembly have been relentlessly suppressed. Amid a sustained crackdown against those who have demanded accountability from the government or organized protests against allegations of corruption, journalists, members of the political opposition and human rights activists have all been targeted for criticizing the government. Almost a fortnight ago, President Emmerson Mnangagwa signed into law the Criminal Law Codification and Reform Amendment Bill, 2022, commonly referred to as the “Patriotic Bill”, further criminalizing dissent for among others, “upsetting” a constitutionally elected government. Health workers who protested poor working conditions and salaries have also not been spared either. They were criminalized for demanding their rights. For example, the then acting president of the Zimbabwe Hospital Doctors Association (ZHDA), Peter Magombeyi was abducted and tortured in September 2019 for being vocal about health workers’ plights. He was freed after few days of his ordeal.

“What we have seen in Zimbabwe over the past five years amounts to a brutal crackdown on human rights, especially the rights to freedom of expression, peaceful assembly and association. Respect for socio-economic rights has also declined dramatically, leaving many people in abject poverty with no means to put food on the table,” said Khanyo Farisè, Amnesty International’s Deputy Director for Southern Africa.



“The Zimbabwean authorities have revealed their brazen contempt for basic freedoms and shown that there is no space for dissent in the so-called ‘second republic’. The police have also repeatedly resorted to excessive use of force to suppress human rights, including the right to peaceful assembly.”



Criminalizing political opposition



The Zimbabwean authorities have increasingly targeted leaders of the political opposition, journalists and activists by weaponizing the law against them for exposing allegations of corruption or demanding accountability. Hopewell Chin’ono, a prominent journalist who exposed a multimillion-dollar Covid-19-related corruption case, and Jacob Ngarivhume, a political activist who called for a nationwide protest against allegations of corruption on 31 July 2020, were arrested and detained in July 2020 to stifle their criticism.



Chin’ono and Ngarivhume later faced various trumped-up charges for being vocal critics of allegations of corruption. Chin’ono was jailed in November 2020 in part for exposing a woman who tried to smuggle undeclared gold through the Robert Mugabe International Airport, and the alleged looting of government funds by individuals with political connections during the Covid-19 pandemic.



As punishment for exposing allegations of corruption and doing his investigative journalistic work, Chin’nono was arrested several times and detained for about 94 days between 2020 and 2021 at Chikurubi Maximum Prison. In a clear attack on Chin’ono, the court also barred his lawyer Beatrice Mtetwa from representing him. After appeals, the High Court has acquitted Hopewell Chin’ono three times over trumped-up charges. Ngarivhume, meanwhile, is serving a four-year jail sentence after he was convicted and sentenced in April for calling for nationwide protests against corruption.



In May, Job Sikhala, a member of parliament for the opposition party Citizens Coalition for Change (CCC), was convicted on charges of “obstructing justice” and handed a six-month suspended sentence. Sikhala’s trial was linked to a video shared online in which he is accused of saying that the ruling Zanu-PF party had killed Moreblessing Ali, a CCC activist, in June 2022. Sikhala, who has been detained since June 2022, denied making the video and an expert witness testified in court that the footage had been tampered with.



In September 2022, Zimbabwean author and activist Tsitsi Dangarembga and fellow protester Julie Barnes were each convicted of “inciting violence” after participating in the 31 July 2020 protests against economic hardship and handed a fine of 70,000 Zimbabwean dollars (US$193). They were each handed a six-month suspended sentence, yet later successfully challenged their sentence in court.



On 10 June 2020, three ex-MDC-Alliance youth leaders – now members of the main opposition Citizens Coalition for Change, Joana Mamombe, Cecillia Chimbiri and Netsai Marova, were arrested and charged with falsifying their abduction and torture at the hands of suspected state security agents. The trio were abducted after the police arrested them at a roadblock in Warren Park amid a protest against the denial of socio-economic rights at the height of the Covid-19 pandemic. They were prosecuted for three years, before eventually being acquitted earlier this month, apart from Netsai Marova, who went into exile before the trial was concluded.



Rights to freedom of expression, association and peaceful assembly curtailed



President Emerson Mnangagwa’s rise to power was against the background of the killings of protesters following post-election violence on 1 August 2018, after the 31 July 2018 election. Six people were killed, and 35 others injured, after soldiers fired live ammunition at people fleeing post-election protests in Harare.



The protesters had demanded that official election results be released. Some of those killed and injured were shot from the back, yet five years later, no one has been held accountable. And despite the establishment of a commission to probe the circumstances that led to the killings, no justice has been served. The victims continue to be denied access to justice and effective remedies.



On 16 August 2018, baton-wielding police mounted a vicious assault on peaceful protesters who had gathered in Harare in anticipation of the 16 August national protests against deteriorating socio-economic conditions in the country. Scores of people were left injured following the crackdown. On 15 August, the day before the march, Zimbabwean police announced they were banning the protests through a press statement, saying the demonstrations would turn violent. After the aborted protest, about 128 activists were arrested and placed on remand. Other protests that were planned to take place in four other cities around the country were also banned and some activists were arrested.

In another violent escalation at the beginning of 2019, Amnesty International documented at least 15 killings by police when nationwide protests erupted on 14 January, sparked by fuel price hikes. The state carried out mass arrests, which saw hundreds of people arrested, including prominent activists who were suspected of being behind the protests, on charges including public violence. By the end of April of the same year, close to 400 people had been convicted by the courts, most of them through hastily conducted trials.

During the protests, the police used lethal and excessive force such as tear gas, batons, water cannons and live ammunition. They also launched a house-to-house hunt to track down and apprehend the organizers of the protest and other prominent civil society leaders and activists. Those arrested included Evan Mawarire, a well-known local cleric and activist, and trade union leader Peter Mutasa, who were subjected to trumped-up treason charges in connection with the protests. The state charged 22 people in relation to the protests for attempting to “subvert” a constitutional government.

“Over the past five years, the Zimbabwean authorities have demonstrated little or no respect for human rights and have repeatedly flouted the rule of law. As political campaigning enters full swing, the authorities must ensure that people are able to freely exercise their rights to freedom of expression, association and peaceful assembly. Authorities must respect, protect, promote and fulfil the human rights of everyone before, during and after the election,” said Khanyo Farisè.

Gems In Awful Start

THE Zimbabwe senior netball team, the Gems kicked off their 2023 Netball World Cup campaign on a poor note after an 86-30 defeat to heavyweights Australia in their opening match at the Cape Town Convention Centre in South Africa this Friday.

After a great opening quarter in which the Gems matched the mighty Australians, the team sadly failed to keep up for the rest of the match as the world’s highest-ranked nation showed their class.

Buoyed by a vociferous crowd in South Africa, the Gems came out of the blocks firing and took the game to their more fancied opponents as they matched their intensity in the first quarter despite Australia taking a 20-11 lead.

Shocked by the determination of the Gems, Australia made a few tactical changes that worked well in their favour, and they started creating some breathing light between the two teams.

In the second quarter, Zimbabwe only added eight points as the two teams went for halftime with Australia leading 41-18.

The third and fourth quarters were more of the same and even the changes made by the Gems technical department failed to change the flow of the game.

It was not exactly what the Gems were hoping for, but the coach is taking some positives from the game.

“We need to be more consistent on the offensive side and be more clinical in defence, after the match today the girls are in a positive mood, we have seen that we can hold them, but we did that in phases,” said Gems assistant coach, Tatenda Shinya.

Zimbabwe take on Fiji in their second Pool A match this Saturday looking for nothing short of victory to keep their tournament alive.

Meanwhile, in the other Pool A match, Tonga edged Fiji 56-51.

The top three teams from each of the four Pools will progress to the next round.

Zanu PF Goons Violently Attack CCC Members

Today, Zanu PF members unleashed violence against Citizens Coalition for Change [CCC] members at Sipambi Shopping centre, ward 11 in Masvingo West.

The CCC members were putting up CCC campaign posters when over 20 Zanu PF members wearing party regalia attacked them.

Also, Zanu PF members are tearing and destroying CCC posters in Masvingo West.

CCC members Mr. Admire Mufamba and Mr. Danson Gwaradzimba were badly injured after the Zanu PF attacks.

Mr. Gwaradzimba and Mr. Mufamba have reported the case of assault against Zanu PF members at Masvingo Central police.

Police report RRB REF 5432966, Constable Mukoko is the investigating officer.

In addition, Mr. Mufamba and Mr. Gwaradzimba are seeking medical attention.

CCC Masvingo West aspiring member of parliament, Mr. Pedzisai Gasva, said, “We, as CCC members, condemn the violence being perpetrated by Zanu PF members against our members. It’s sad that our members were injured and currently receiving treatment.”

Mr. Gasva said he is in Mvuma and will be in Masvingo town to help the injured CCC members.

Mr. Tichaona Mharadza Chiminya said, “We identified youth who beat our members. Masvingo urban ward 10 Zanu PF councilor, Mr. Manyanga, Delight Mandebvu, Milton Mutongi, ward 12 Masvingo West, Chauke, were among Zanu PF youth members who beat our members.”

In Masvingo Province, Zanu PF members have unleashed violence against CCC members in Gutu, Bikita, Mwenezi, Chiredzi, and Masvingo West, among others.

Interestingly, police are yet to arrest Zanu-PF members who are beating CCC members.

Chiwenga Frog-Marches Tsvangirai Villagers, Forces Them To Vote For Zanu PF

By-Zanu PF vice President Constantino Chiwenga on Friday frog-marched hundreds of villagers of Buhera West Constituency and forced them to vote for his party.

Among the villagers were those from Humanikwa Village, home of former opposition leader and Prime Minister, the late Morgan Tsvangirai.

The local headman, Chivara Makuvise, led the forced villagers in giving a speech at a rally that Chiwenga addressed at Mutasa Business Centre, Buhera West Constituency.

Chiwenga was garnering support for Tafadzwa Mugwadi, the ruling party’s parliamentary candidate for Buhera West.

Tsvangirai was the face of opposition politics in the country from 1999 until his death on February 14, 2018, and at one time became Prime Minister of the country from 2009 to 2013 under the inclusive Government.

“I heard that headman Humanikwa is coming with all his people, coming back to the ruling Zanu PF party, the party they looked after during the war of liberation,” said Chiwenga.
“I am saying this because I operated in this area. I was here in Manicaland Province with General Nyambuya, who is here today.
“I came here in 1977 when Chimoio was attacked, and a lot of people were killed. I was here in Buhera, and then we returned to Mozambique in November 1977.
“My journey was to go to Mhondoro to open a new detachment. I want to say to Headman Humanikwa, you have done well,” said Chiwenga, intimidating villagers.

Chadzamira Unleashes Terror In Masvingo West

Today, Zanu PF members unleashed violence against Citizens Coalition for Change [CCC] members at Sipambi Shopping centre, ward 11 in Masvingo West.

The CCC members were putting up CCC campaign posters when over 20 Zanu PF members wearing party regalia attacked them.

Also, Zanu PF members are tearing and destroying CCC posters in Masvingo West.

CCC members Mr. Admire Mufamba and Mr. Danson Gwaradzimba were badly injured after the Zanu PF attacks.

Mr. Gwaradzimba and Mr. Mufamba have reported the case of assault against Zanu PF members at Masvingo Central police.

Police report RRB REF 5432966, Constable Mukoko is the investigating officer.

In addition, Mr. Mufamba and Mr. Gwaradzimba are seeking medical attention.

CCC Masvingo West aspiring member of parliament, Mr. Pedzisai Gasva, said, “We, as CCC members, condemn the violence being perpetrated by Zanu PF members against our members. It’s sad that our members were injured and currently receiving treatment.”

Mr. Gasva said he is in Mvuma and will be in Masvingo town to help the injured CCC members.

Mr. Tichaona Mharadza Chiminya said, “We identified youth who beat our members. Masvingo urban ward 10 Zanu PF councilor, Mr. Manyanga, Delight Mandebvu, Milton Mutongi, ward 12 Masvingo West, Chauke, were among Zanu PF youth members who beat our members.”

In Masvingo Province, Zanu PF members have unleashed violence against CCC members in Gutu, Bikita, Mwenezi, Chiredzi, and Masvingo West, among others.

Interestingly, police are yet to arrest Zanu-PF members who are beating CCC members.

20 Fake Chamisa MP Candidates Win Court Case

By- Twenty fake CCC MP candidates who fraudulently filed nomination papers using the opposition’s name have been granted permission to go ahead by the High Court.

ZRP Warns Perpetrators of Violence

By A Correspondent- The Zimbabwe Republic Police (ZRP) has warned perpetrators of political violence before, during, and after elections that the long arm of the law will catch up with them.

The warning comes after presidential aspirant Saviour Kasukuwere’s supporters on Friday announced nationwide protests over a court judgement that barred the former cabinet minister from running for the presidency in this year’s elections.

Speaking to The Herald, Nyathi warned that the Police will not tolerate any form of violence that seeks to discredit the polls. He said:

The law is very clear. Anyone who incites people to engage in acts of violence will face the due consequences of the law.

We are not going to tolerate any form of political violence meant to discredit these important national processes.

We want the people of Zimbabwe to exercise their voting right in a peaceful and tranquil environment.

Police officers are going to arrest all perpetrators of violence regardless of their political affiliation.

Addressing the media in Harare on Friday, Jim Kunaka, one of the members leading Kasukuwere’s campaign, said they will go ahead with their planned protests even without Police approval. He said:

We are going to hand in our petition to the relevant authorities. Our knuckles are itching for a bare fight until the end.

We are not afraid of anyone else. We are Zimbabweans and we are allowed to demonstrate.

We are not going to fold our hands, expect us to act as politicians, something is coming on board we are going to mobilise our people.

We will notify them if they don’t accept our notification. We will go ahead. We are ready for anything on our way, we cannot have a revolution without obstacles and challenges.

Justice Antonia Guvava of the Supreme Court, sitting with Justice Chinembiri Bhunu and Justice Felistas Chatukuta on Friday upheld the High Court’s decision to bar Kasukuwere from contesting in the upcoming elections.

Police Investigating CCC Activist’s Politically Motivated Violence

By A Correspondent- Renowned Citizens Coalition for Change (CCC) activist, Cephas Magezani’s house was recently gutted by fire during the night on July 19, 2023, a day after suspected Zanu-PF supporters had burnt and torn CCC’s Chiredzi South candidate, Douglas Gumbo’s posters, TellZim News reported.

Police are said to be investigating the matter which happened which many believed to be a politically motivated incident.

Magezani confirmed the incident to TellZim News and said though he was not running for any post, his influence in opposition politics is very significant and said the incident could be a warning to him and other party supporters.

“It’s nothing else, from my perspective other than political violence. A day before, Zanu-PF supporters who we suspect had been sent by Zanu-PF candidate Joey Sithole, burnt down Douglas Gumbo, our candidate for Chiredzi South,’ posters and a day after, I woke up to the shock of my life seeing my house which I use as a storeroom, gutted by fire. There is no such coincidence,”said Magezani

He went on to say the incident was not the first time as he was once abducted and tortured in 2008 having joined opposition politics during the inception of the Movement for Democratic Change in 1998.

“This is not the first time facing politically motivated incidents. In 2008 I was abducted by suspected Zanu-PF goons and many thought I was not going to make it. This is the same skill they are trying to use to scare people,” said Magezani.

Efforts to get a comment from Zanu-PF’s Sithole were fruitless as his call went unanswered several times.

A former police officer and businessman, Sithole is set to battle it out with CCC’s Gumbo in Chiredzi South.

In Chiredzi Central, the Forever Associates for Zimbabwe (FAZ) an alleged parallel structure of the Central Intelligence Organization (CIO) has been openly spray painting and tearing off campaign posters for CCC’s Ropafadzo Makumire who will square it off with Zanu-PF’s Francis Moyo and independent candidate Gibson Hwende.

Zion Bishop Send Nudes To Daughter In Law

By A Correspondent- The Zion Christian Church Kumuka Kwavakafa Nhaudzashe (ZCCKK), has expelled a bishop for putting the church into disrepute.

The defrocked cleric, Lyphet Matenda Mugaviri, allegedly tried to lure his daughter-in-law into an illicit sexual relationship.

Mugaviri reportedly sent his nudes to Olinda Mashavave, who is the wife of his brother’s son, Lesly Mugaviri.

After she had been bombarded with nudes and love proposals by the bishop via WhatsApp, Olinda reported the matter to her husband, Lesly.

Lesly then trapped his uncle by chatting with him using his wife’s WhatsApp, and he took the bait.

ZCCKK representative, Elder Ngonidzaishe Hungwe, confirmed to H-Metro that Bishop Mugaviri had been excommunicated. He said:

The bishop’s act has put the church in a bad light. The church has expelled him.

The bishop was recently accused of attempting to commit adultery with his daughter-in-law.

The church distances itself from such immoral acts and views them as contrary to our core values, doctrines, beliefs and practices.

After monitoring and investigating the issue, the church noted that the bishop not only damaged his personal reputation but also portrayed the entire church in bad light.

Hungwe said they will meet in August at a memorial service of one of the church members and they will announce a new bishop at the event.

Who’s to Blame For CCC Bulawayo Fiasco?

By Shelton Muchena and Desmond Nleya in London | Acussations and counter accusations have been traded over what went wrong in Bulawayo leading to the nullification of the CCC candidates on Thursday.

FACT: 12 CCC candidate nominations in Bulawayo were nullified. At least for now.

But who is to blame?

Accused number 1: CCC

Some sections of the public, including ZANU PF supporters and a small group of CCC, blame the party leadership of being disorganised while lamenting that their “ambiguity strategy ” have come to haunt them.

Some journalists and analysts also accuse CCC of plotting its downfall by not having structures and centralizing everything to Harare leading to the late submission of papers.

“…A tragic reality that could have been avoided if only the local leadership had been empowered to run things. This is the problem with centralising decisions and processes..

Nomination court was open on June 10, there was NO reason to file papers last minute”, said Hopewell Chin’ono, an international award winning journalist.

Logically, those celebrating and blaming CCC are ZANU PF supporters and sympathisers.

The party is blamed for being disorganised leading to submission of papers well after the 4pm cut off time as outlined by the law. Ironically, CCC’s lifeline now lies with the double candidates in some constituencies who submitted ‘on time’ BUT are not recognized by the party leadership.

CCC however maintains that they submitted ON TIME with the party President, Advocate Nelson Chamisa saying Bulawayo had two party officials who were responsible for the signatures.

“Facts: -Citizens in Bulawayo elected their representatives. -Our two signatories for Bulawayo candidates lists were local leaders in Bulawayo. Mlilo and S. Ncube’.

Is CCC to blame?

Accused number 2: ZANU PF

ZANU PF went to court seeking nullification of the nomination of the candidates involved. It was the complainant in the case and also a competitor, so it is safe to say ZANU PF is to blame by the simple fact that it doesn’t want CCC on the ballot box.

Bulawayo have been the opposition stronghold for almost two decades and it is common sense that ZANU PF was bound to try every trick to reverse that. They found a loophole and utilised it.

A simple statement from Kudzai Mutisi, a ZANU PF activist cements this assertion.

“ZANU PF is not a Charity Organisation, it is a political party… ZANU PF has no obligation to babysit opposition parties or to donate power to them… It’s intellectual laziness to expect ZANU PF to not use any legal means to win political power… Put your house in order, simple!”.

But Who alerted ZANU PF of the loophole?

Accused number 3: Prof Jonathan Moyo

The good Prof stand accused of being the chief culprit behind the court route taken by the complainant, ZANU PF.

It is in the public knowledge that after the 21 June nomination court day, the Prof raised a red flag on why ZEC officials accepted CCC candidates’papers after the 4 PM cut off time.

On 27 June 2023, Moyo wrote on his timeline: “FOR THE RECORD: ZEC UNLAWFULLY ADJOURNED BULAWAYO NOMINATION COURT TO 22 JUNE TO BENEFIT CCC’.

A group of activists followed and joined the fray accusing ZEC of bending laws to accommodate CCC.

As a result, ZANU PF ended up approaching the High Court seeking nullification of the nomination of the candidates involved on 29 June 2023, 8 days later after the nomination court.

Is Prof Moyo to blame for simply alerting the ‘public on the anomaly and interpretation of law’.? Did he actually order ZANU PF to take the legal route or he simply interpreted the law?

But how did Prof Moyo know that CCC submitted papers late?

Accused number 4: CITE

It is again in the public domain that on the nomination day CITE did a wonderful job covering the process.

And yet it now stands as one of the accused.

Why?

Because it simply, fairly and objectively reported on what actually transpired on the day including in some cases putting timelines.

“BulawayoNomCourt: Felix Mafa Magalela from CCC is trying to submit papers. The Provincial Elections Officer is telling him he missed the deadline and there will be no new submissions. This is a similar occurence for other CCC candidates as Eric Gono, Pashor Sibanda who were told to fix page 5 of their nomination forms. The PEO says, “ it’s those who come late that know their papers are in order. If not sure, you must come early”.

Such coverage has also been used to nail the media house of being an accomplice in the matter. But is it a FACT, can it be used as evidence in a court of law?

However, that being the case, if such reporting can be used to blame a professional media house like CITE for informing the public, logic is lost on impartiality and fairness.

But what is ZEC saying?

Accused number 5: ZEC

ZEC being the administrative institution of the elections fought in the corner of the CCC represented by its lawyer Tawanda Kanengoni.

These are facts by ZEC also being seconded by CCC:

1. ZEC said they received CCC forms ON TIME
2. CCC candidates say they submitted ON TIME
3. Zanu applicants say they HEARD the forms were late.

But are these “FACTS backed by evidence?

If yes, accused number 6.
The courts.

The High court ruled that 12 CCC candidates,ZEC and the other 6 serve for only one acted illegally hence the nomination was nullified.

While a signed affidavit by a police officer was produced as evidence that the applicants were on time, High Court Judge Bongani Ndlovu said;

1. Giving papers to a police officer was unlawful.

2. Candidate/agent must be inside court with his/her papers.

3. Papers in court without candidate/agent means nothing.

Again are these facts as said by the courts?

Justice Bongani Ndlovu presided over the case and made the ruling. Justice Nokuthula Moyo delivered the ruling.
While this might be within the confines of law, are we not missing something here.

Was Justice Ndlovu not brave enough to deliver the ruling?

Surely, who is to blame, is it CCC, ZANU PF, Prof Jonathan Moyo, CITE, ZEC, Judiciary or simply our emotions?

Prof Alexendar Rusero once said “_You will see how complex Zimbabwe politics is when for the first time ZEC and CCC are fighting in the same corner!_ Rusero (2023).

Cheated Job Seekers Besiege Recruitment Agency

By A Correspondent- Several job seekers have besieged a Bulawayo-based recruitment agency, Cosmopolitan Eagle Company, demanding refunds after the agent allegedly failed to facilitate overseas jobs and work permits for the applicants in violation of its promises.

Cosmopolitan Eagle Company, operating from Pioneer House in the city, placed advertisements claiming it was dealing in securing jobs and work permits as well as processing all travel documents for job seekers abroad.

Thandolwenkosi Ngwenya from Bulawayo told B-Metro that he paid more than 1 000 to the recruitment agency but failed to secure the job that had been promised. He said:

A relative told me about Cosmopolitan Eagle Company saying it was helping people in securing employment in Poland, Germany and Turkey and l became interested before I went to inquire about the company.

I visited the company premises at Pioneer House and met Linah Mugondomukandapi who is the owner and she told me everything about their services and how the process was being done. She assured me that if l didn’t succeed she was going to refund me.

Ngwenya said in May 2021 he paid US$1 230 to Linah including US$1000 being application fee for a visa and US$230 travel insurance. He said:

After six months I was informed that my work permit was ready and had to organise money to go to the Polish Embassy in Pretoria, South Africa.

When l went to the Polish Embassy l was informed that l had a high chance of being denied a visa and I informed the agency about the matter and she advised me to apply.

After applying for the visa l got denied and when l came back home, I asked for a refund from Linah and she started telling me stories.

Just imagine I used US$400 to go to South Africa and back home. I got fed up and Linah had also stopped answering my calls.

It’s really painful that l lost US$1 630 and R1800 to this agent. I trusted this lady and yet she seems heartless considering that things are hard these days.

I still owe people the money that l borrowed and ties have also been broken with friends and family as they are all asking why there is no refund and some are even suspecting that I squandered the money.

Another victim who declined to be identified told B-Metro that she paid Linah US$920 in April claiming it was for visa processing.

She said Linah’s sister only paid her US$95 last month out of the US$920 she had paid.

Another victim who also requested anonymity said she was swindled of US$1 300 by Linah. She said:

To this day l have not been paid a cent from the total amount of US$1 300 which l paid to her to facilitate my recruitment abroad.

Linah has also not given me back my passport. When I reported the matter to the police they advised me that it was a civil matter and I’m now planning to sue her.

When reached for comment by the publication, Linah said it wasn’t her fault that some of her clients were not successful in getting their visas.

She said she was working with her international partners to ensure that all her clients are refunded.

Jilted Kaseke Burns Home

By A Correspondent- In a shocking turn of events, a man’s desperate attempt to win back his estranged wife led to a fiery tragedy at his in-laws’ house in Chitungwiza.

The incident, which took place on Wednesday, has left the man battling for his life with severe burns all over his body.

The man, identified as Godfrey Kaseke, 44, was deeply upset by his wife, Juliet Dzumbunu’s, decision to end their marriage and pursue a new relationship.

Sources suggest that he had relentlessly pleaded for a reunion, but she stood firm in her decision to move on.

Fuelled by anger and heartbreak, the man allegedly hatched a disturbing plan to confront his wife at her brother’s home.

He reportedly armed himself with a bottle of petrol, a kitchen knife, and a copper cable, intending to harm her.

Witnesses said that he even strangled the wife and threatened her with a knife before she escaped through a window.

Neighbours and passers-by came together to extinguish the fire. Unfortunately, the blaze consumed all the belongings within the house, reducing everything to ashes.

Authorities are investigating the incident, a local news report said. It added that the wife’s family was disappointed in the jilted man’s family as they didn’t respond promptly to the disturbing incident.

Fake “Child Psychologist” Jailed

 By A Correspondent- A man who used false documents to secure employment as a child psychologist and “live a fake life” has been jailed for four years.

Nikiwe Dube (41) with an address at Colpe Drive, Deepforde, Drogheda, Co Louth pleaded guilty to four charges of using a false instrument on dates between November 2019 and February 2022 including a psychological transcript with a false garda stamp, a false identification badge purportedly from the Psychological Society of Ireland (PSI) and a fake medical certificate.

He further pleaded guilty to two counts of deception in that he dishonestly induced TTM Healthcare to put him on their books of employment, causing a loss, on a date between August 15th, 2021 and September 9th, 2021 and that he did dishonestly induce the HSE to give him an interview towards employment on August 18th, 2022.

Dube used false documents to secure employment as a child psychologist in the public and private healthcare sectors when he didn’t have the required academic qualifications, the court heard.

Imposing sentence on Wednesday, Judge Elva Duffy said Dube had put himself “out there” as a medically-trained professional and was working with children and adolescents who were clearly in a very vulnerable position because they had come looking for help.

‘A Complex fraud’

She said Dube knew what he was doing and described it as “a complex fraud”. She said he had chosen to “live a fake life” where he abused trust and received significant money for his work.

Judge Duffy said Dube carried out this fraud “without an apparent purpose” and “set himself out to be someone he was not”.

She also noted that the State confirmed that the gardaí have not been able to confirm Dube’s true identity and said “that is of some concern to the court”.

Judge Duffy acknowledged that Dube made immediate admissions, has expressed remorse and that his plea of guilty was valuable as it would have been a difficult case to prove. She further acknowledged a positive probation report and governor’s report and the fact that Dube is a diabetic.

She said the case warranted a headline sentence of five and half years before she imposed a sentence of four years, having taken the mitigation into account. The sentence was backdated to when Dube first went into custody on August 5th, 2022.

The court heard that in February 2022, Dube was put forward for a senior post as a child psychologist with an annual salary of €80,000 by recruitment agency, TTM Healthcare.

Application

This application was reviewed by the head of psychology at Avista Medical, who had some concerns that the submitted documents, including a letter of validation, did not conform with the standard content and format.

This person brought his concerns to the attention of the human resources department.

Separately on March 15th, 2022, an assistant principal officer in the Department of Health’s professional regulation unit, which is responsible for the validation of foreign psychology qualifications, told gardaí they had been contacted by Avista in relation to the letter of validation included in Dube’s application.

The Department of Health staff member said the unit had checked their archives and had no record of Dube.

As such, the letter of validation was not issued by the Department of Health. Further enquiries determined the letter of validation to be false.

Gardaí then contacted the recruitment agency TTM Healthcare, who provided them with documents including a letter of validation, a GNIB card, transcripts from the University of Zimbabwe and a Zimbabwean police clearance certificate.

The court also heard Dube was employed by Gateway Residential Care in Sligo between November 2019 and November 2021 as a child psychologist. He received €172,000 in wages and expenses during this period.

Gateway Residential Care provided gardaí in March 2022 with documents including a letter of good standing from the PSI and documentation from the University of Zimbabwe including a qualification in psychology.

Gardaí also spoke with a recruitment consultant working for TTM Healthcare who said Dube contacted them in August 2021 about a vacancy for a HSE clinical post. Dube was screened, and it was confirmed that he met the requirements of the post.

Dube provided documents to TTM Healthcare including a Master of Science in clinical psychology transcript, a diploma in cognitive behavioural therapy, his GNIB card and a letter of validation. Garda vetting forms for TTM Healthcare and the HSE were also completed.

Dube was approved for a locum post in November 2021, however TTM paid his wages of €11,628 during this period due to outstanding garda vetting.

The investigating garda confirmed that much of Dube’s work was carried out remotely due to the Covid-19 pandemic and he had limited interaction with patients, both supervised and unsupervised.

Dube also had an identification badge purportedly from the PSI, however the society does not issue badges. The PSI contacted the University of Zimbabwe, whose staff confirmed that Dube had not studied there.

In May 2022, a garda at the Navan Garda Immigration Office confirmed that a stamp on a transcript did not originate from that office.

Gardaí arrested Dube in August 2022 in Drogheda. After caution, he told gardaí that he had been expecting this, but not at that moment.

He told them that he had paid over €4,300 online for a pack of documents and that he knew he should not have done it.

Dube made no comment when interviewed. He has no previous convictions and has been in custody since August 5, 2022.

The investigating garda agreed with Gerardine Small SC, defending, that her client made admissions when first approached by gardaí. He also confirmed that Dube had been in custody since his arrest and that his guilty plea avoided what would have been a complex trial.

No victim impact statements were provided to the court.

Ms Small asked the court to take into consideration her client’s early guilty plea, immediate admissions and expressions of remorse. She said her client had educational attainment in this area.

Dube was born in Zimbabwe and worked as a LGBT counsellor for six years, the court heard. He had to flee the country due to concerns for his safety and applied for international protection in 2018.

A governor’s report and an education report were handed to the court. Dube is an enhanced prisoner and works in the prison laundry. He also volunteers as a listener with the Samaritans.

A letter of apology was also handed to the court. Dube is diabetic and has issues with cholesterol for which he takes medication.

Ms Small said Dube is aware of the “serious breach of trust” and the seriousness of the offence. She noted that he accepts that he sought refuge in a country and his “behaviour towards that country is wholly unacceptable”.

Lover Hits Back, Pours Boiling Oil On Boyfriend

But what happens when you discover that your loved one is cheating on you?

Wonder no more!

Tofara Masendu (28) from Bulawayo was left groaning in agony after his girlfriend Sithandazile Ncube (20) scalded his face and genitals with boiling cooking oil after he assaulted her as punishment for allegedly double-crossing him.

A source close to the incident said Masendu was relaxing on the bed with his girlfriend at his place at a flat in the city centre when they had a fallout.

“Masendu told her that he bumped into raunchy chats on her phone which she was exchanging with another man. After that he accused her of cheating on him,” the source said.

The source said in the midst of that the pair exchanged harsh words which resulted in Masendu bashing her.

“He grabbed her before throttling her. He then punched her and kicked her all over the body while accusing her of disrespecting him and cheating on him,” said the source.

After bashing her, Masendu relaxed on the bed and subsequently fell asleep and it was during that time when things turned nasty for him.

“His girlfriend boiled cooking oil and poured it on his face and genitals. After that she fled leaving him groaning in agony,” the source said.

Masendu reported the incident at Bulawayo Central Police Station leading to the arrest of his girlfriend.

Bulawayo police spokesperson Inspector Abednico Ncube confirmed the incident.

He said: “We urge community members to engage third parties such as friends, relatives or pastors rather than resorting to violence because such unbecoming behaviour might lead to an unnecessary loss of life.”

Efforts to get a comment from Masendu were fruitless

6 Die In Rusape Accident

By A Correspondent- Six (6) people died in a road traffic accident that occurred in Rusape along the Harare-Mutare Road on Friday evening.

Zimbabwe Republic Police (ZRP) spokesperson, Assistant Commissioner Paul Nyathi confirmed the accident to ZBC News, saying three people died on the spot while the others died on admission at Rusape General Hospital.

Asst Comm Nyathi said that a Harare-bound commuter omnibus side-swiped a haulage truck, as the driver tried to overtake at a sharp curve before Rusape tollgate.

Six other people who were in the commuter omnibus are admitted at Rusape General Hospital after sustaining injuries.

Chigodora Family In Soup Over Missing Corpse

By A Correspondent- A Chigodora family is in hot soup after it discreetly reburied its six-year-old child’s empty coffin following the vandalisation of the grave, coffin and body.

Three years down the line, the whereabouts of the corpse that was dug up soon after its burial remain unknown.

Although the father’s child, Joe Mureyani, later passed on under mysterious circumstances and his wife relocated to South Africa, members of the Mureyani family were dragged to Headman Chigodora’s court last Saturday to explain why they never bothered to inform the local traditional leadership following the incident.

The issue has since been transferred to Acting Chief Zimunya’s court and will be heard on August 6.

Headman Chigodora’s court heard that three years ago, the Mureyani family did not report to the traditional leadership that its son’s body and coffin had vanished from the grave after burial.

However, the family made a police report.

Headman Chigodora said the coffin was later found, but the body is still missing, three years later.
Asked why they did not report the matter to their Village Head or Headman Chigodora, the family begged for forgiveness.

Derrick Mureyani narrated: “My aunt was walking past the grave when she discovered that it had been tampered with. The grave had been dug and the coffin removed. This happened a few days after the child’s burial. We told our elders, and we conducted a search, but found nothing.

“However, days later, someone saw a child’s coffin inside the house of a villager who is mentally-challenged. The coffin looked like the one that we had buried the child in.

“Police were alerted and the villager was arrested. He was taken to the psychiatric unit where he was evaluated and was released recently.

“However, the body is yet to be found up to this day,” said Mureyani.

Inside the coffin that was found in the villager’s house was the shroud that the child’s body was wrapped in, as well as his clothes that had been put in his grave.

Headman Chigodora accused the family of performing rituals at the cemetery without notifying the traditional leadership.

“As far as I am concerned, that child’s spirit is roaming around this area because the body is yet to be found. This is probably why your family is suffering from mysterious illnesses.

“You had no right to visit the cemetery and perform your rituals without notifying the local leadership.

“You reburied the empty coffin on your own without informing anyone. This shows that you were trying to cover up something. Since you do not want to tell this court why you never reported this matter, it is proper for me to transfer the matter to Chief Zimunya’s court,” said Headman Chigodora.

The family then said the traditional healers they consulted over the matter accused the family’s patriarch, Zacharia Mureyani, of being behind the corpse’s disappearance; as well as Joe’s death.

“After the mysterious disappearance of the child’s corpse, Zacharia ordered Joe to deliver some red cloth to Clever’s home. Joe was not aware that this was a ploy to kill Clever.

“However, this backfired on Joe and he died shortly afterwards. This matter was also kept under wraps for three years.

‘‘This means that both Joe and his son’s restless spirit are still roaming around this area,” said Shepherd Mureyani, a family member.

“We were told by a traditional healer that the late family members’ spirits are roaming around Zacharia’s homestead and there will be no peace within this family until he confesses.

“Zacharia confessed on that day, but has not done anything to save the situation,” said Shepherd.

However, Zacharia vehemently denied being responsible for the disappearance of the child’s corpse.

“The truth is that there are a lot of witches and wizards in our family and people should not only accuse me,” he said.

HC Barring 12 CCC Contesting 2023 Is Foolish And Symptomatic Of Judiciary Rot

By Wilbert Mukori| I have had the opportunity to read the High Court judgement barring the 12 CCC Bulawayo candidates from contesting the 23 August 2023. I am not a lawyer but one does not have to be a lawyer to see the judgement was absurd, so absurd not even a kangaroo court would come up with such foolish judgement.

If at all possible, everyone must try to read the judgement for yourself. It really is a must read! You will know why Zimbabwe is a failed state, with this corrupt and utterly useless public institutions it is no surprise we are a failed state!

Here are some the extracts from the 24 page judgement.

“The applicants are moving me to grant them a declarator and consequential relief, ” reads the High Court judgement, dated 27 July 2023

“The premise of this application on the provisions of the Electoral Act Chapter 2:13 (the ACT). Their bone of contention is that the commission which sat as the nomination court at the Bulawayo Magistrates Court, Tredgold Building on 21 June 2023 violated the law, in particular, s 46/ 7 & 8 of the Act when it accepted (my emphasis) the Respondents’ (12 CCC candidates) nomination papers for elections to members of the National House of Assembly of Zimbabwe in the the election which are to be held on 23 August 2023 after 16.00 hour and proceeded to sit to the early hours of 22 June 2023.”

It should be noted from the onset that the law accepts the principle that all those already in the queue at the designated closing time, will have their nomination papers processed. This is nothing new, the same principle is applies on voting day. And so we can zoom in to establish who was in the queue before the cut off hour of 16.00.

The Magistrate or a Judge presides over the nomination court but the person responsible for processing the nomination papers, the payment of the nomination fees, etc. and, for our purpose, the flow of the candidates submitting their nomination papers is the ZEC official, the 1st Respondent, in this case.

“The 1 st Respondent stated that he did not receive any nomination papers other than in terms of the law i.e. between 10 am and 4pm on nomination day and did not adjourn the nomination court beyond the prescribed nomination day,” state the HC judgement.

“The nomination courtroom was very small and could accommodate between 12 and 15 people at a time. The balance could queue outside and wait for their turn. At 15.55 hours he instructed a Police Officer deployed at the Nomination court to collect nomination papers from any person with nomination papers outside and bring them to him.

“The Police Officer complied and collected between 40 and 50 nomination papers and handed them over to him.

“ At 4 pm he declared the Court closed.

“Annex B is a register that records the times when the nomination forms were captured in the system by the Secretary and not the time when they were submitted by the candidates.

“The affidavits of the staffers are broadly in support of the averments of the 1 st Respondent.”

Case closed, you would think. The surprise was the judge’s contemptuous disregard of the facts!

“ I have accepted the facts as pleaded by the 1st respondent,” acknowledged the judgement before the volte-face.

“The 1 st Respondent stated in his affidavit that he only interacted with the individual Respondents when they submitted their nomination papers. Annex B shows when each Respondent submitted his or her nomination papers. Annex B is a document compiled by public officials during the course of their duty in service of the stateLong after 4 pm the majority of the Respondents filed their nomination papers.

“The 1st Respondent and his staffers have said the times indicated in Annex B are not what they purport to be. I find this explanation to be strange and improbable to the extend of being false.”

“Annex B speaks for itself.It does not need to be explained away by anyone including the 1 st Respondent and his staffer. In all probability, the 1 st Respondent comes up with this explanation upon realising that this application has put him and ZEC on trial.”

The 1 st Respondent has said he collected all the nomination papers of all those in the courtroom and in the queue outside at 15.55 hours – this marks the time the last nomination papers were ACCEPTED. Annex B gives the time when each nomination paper was entered and captured in the system. Why the judge is insisting on the Annex B time must be the time the nomination papers were accepted does not make any sense if the principle that all those already in the queue at 16.00 hours can be processed.

Please note Annex B was NOT included in the judgement I have seen. If it was, one could compare how many nomination papers were processed after 16.00 hours and compare that with the 40 or 50 the 1 st respondent said he collected at 15.55 hours.

“From the evidence available which is the 1st Respondent’s affidavit where he says that he only interacted with the Respondents when they submitted their papers, Annexe B, the allegations, and denials all taken together I come to the conclusion that the Respondents except one, submitted their nomination papers in violation of the law,” continued the judgement.

“The Nomination Court closed at 4 pm. Once closed it was no longer sitting in open court and by the time the respondents sat before him they were not doing so in open court. The separation of the papers from the Respondents through the medium of the Police Officer was unlawful.

“The statute says the candidate or his/her agent must be in court and ready to submit at 4 pm. It does not say that the candidate’s papers alone must be in the courtroom.”

What was wrong with 1st Respondent collecting all the nomination of those in the queue just before 4 pm?

The courtroom could only hold 12 or 15 candidates and so to insist that only those “in court and ready to submit at 4 pm” could be processed is just being pedantic and foolish.

The CCC contestants have appealed the shamelessly partisan High Court, it is hard to image any judge giving such a judgement if the candidate were Zanu PF. After all it was the same judiciary that said the 2017 military coup was “justifies, legal and constitutional!”

Read the judgement if you can and you will know why it is hopeless to ever think Zimbabwe can ever become a healthy and functioning democratic nation without first implementing the democratic reforms and overhauling all state institutions. Why MDC leaders failed to implement even one token reform when they had the golden opportunity to do so beggars belief!

CCC Appeals Against Ouster Of 12 Parly Candidates

HARARE – Citizens Coalition for Change (CCC) has vowed to exhaust both legal and regional diplomatic remedies to reverse the ouster of 12 party candidates from contesting for Bulawayo parliamentary seats with party spokesperson Fadzayi Mahere describing the court ruling as unconstitutional.

Bulawayo High Court judge Bongani Ndlovu on Thursday ruled in favour of Zanu PF activists who had argued the affected candidates surrendered their right to take part in the August 23 poll after filing their nomination papers out of the stipulated 4PM deadline.

The judgement meant that Finance Minister Mthuli Ncube could walk into parliament unopposed as his Cowdray Park challenger Pashor Sibanda of CCC has been disqualified.

Other seats that have been presented to Zanu PF on a silver platter include Bulawayo Central where Tendayi Charuka of Zanu PF was set to contest CCC’s Surrender Kapoikilu while in Bulawayo South, Zanu PF’s Raj Modi was set to face CCC’s Jane Nicola Watson.

The ruling has been met with a groundswell of disapproval from CCC and the broader civil society which accuse the ruling Zanu PF authority of manipulating the judiciary to gain poll advantage.

In a statement Thursday, Mahere said the party will use both legal and diplomatic solutions to the challenge.

“The CCC will urgently file an appeal against today’s judgment as well as invoke all legal, political and regional measures available under Zimbabwe’s Constitution as well as the SADC and African Union mechanisms to ensure that the ability of the citizens to choose their leaders as required by our supreme law is respected and duly safeguarded.

“As we challenge today’s decision, we remain unshaken in the fight for change and a New Great Zimbabwe that works for everyone and where the authority to govern is derived from the people, and not from those who wish to undermine the Constitution and the voice of the citizens,” Mahere said.

“Even at his worst, Robert Mugabe never tried to remove opponents whom he feared from the ballot paper.

“Zanu PF’s removal of 12 Bulawayo candidates renders this a full-blown dictatorship and an outpost of tyranny,” Mahere said, adding that the court decision militated against citizens’ right to elect leaders of their choice.

High Court Ruling On 12 CCC Candidates Could Backfire On ZANU PF

By A Correspondent| The High Court ruling which barred 12 CCC candidates from contesting for parliamentary seats in Bulawayo could backfire on Zanu PF after it was discovered that Deputy Industry minister Raj Modi filed his nomination papers after the 4PM deadline.

According to journalist, Mduduzi Mathuthu, a registered voter in Bulawayo is in the process of taking Modi to court over his failure to file nomination papers before 4PM.

“I understand a registered voter is taking Raj Modi to court for filing his nomination papers for Bulawayo South “out of time”. This document was interpreted by Justice Bongani Ndlovu as the time when candidates filed nomination papers, and it says 4.20PM for Modi,” said Mathuthu.

Usafarisa, Chamisa Tells Mnangagwa

CCC leader Nelson Chamisa has launched an angry tirade against President Emmerson Mnangagwa whom he accuses of masterminding a court ban on 12 party parliamentary candidates in Bulawayo.

Addressing party supporters at a campaign rally in Kadoma on Thursday, Chamisa said Mnangagwa should take responsibility for driving the country into anarchy through disqualifying opponents from the electoral process.

“Usafarisa (stop being too excited).

“No one will be in power forever. He (Mnangagwa) should ask (former President Mugabe) on this matter.

“He should ask (former Libya President Gadaffi), he should ask (former DRC President) Mobutu Sese Seko; no matter how strong a dictator, your time will come.”

Chamisa vowed to resist the disqualification of party candidates in Bulawayo.

He further accused Mnangagwa of unnecessarily bringing anarchy into the country by resorting to underhand tactics to gain poll head start.
