Biti Accused Of Delay

Lawyer and Member of Parliament, Tendai Biti, is facing accusations of employing delaying tactics in his defence against a defamation lawsuit. Biti is being sued for US$1 million by local businessman Mr Kenneth Raydon Sharpe and his subordinate, Ms Tatiana Aleshina, for alleged defamation.

During the civil trial process before High Court Judge Justice Tawanda Chitapi, Biti’s lawyer, Professor Lovemore Madhuku, requested a postponement, citing the pending determination of their appeal at the High Court for an application to appeal at the Supreme Court.

Biti had previously sought leave to appeal at the Supreme Court, but his application was dismissed due to procedural irregularities.

Although the High Court had ordered the civil trial to proceed after Biti objected to the lawsuit, he lost the application by default judgment.

However, Advocate Thembinkosi Magwaliba, representing Mr Sharpe and Ms Aleshina, opposed the latest request for a postponement. Advocate Magwaliba argued that Biti was taking advantage of the court rules to frustrate the other party and that the application was obstructing the proceedings.

Advocate Magwaliba contended that Biti and his legal team were aware that their proceedings at the Supreme Court had been dismissed, yet they made no effort to address the issue. He claimed that the application for a postponement was a deliberate attempt to prevent the trial from commencing.

“It is clear the application constitutes an obstruction to the proceedings. It is filed for the purpose of obtaining a postponement, and this application is for defeating the commencement of the trial. They just want to defeat the commencement of these proceedings,” Advocate Magwaliba stated.

He further argued that Biti should bear the costs incurred due to the delays and asserted that justice was being held hostage by the defendant.

The allegations of delaying tactics against Biti raise concerns about the fair and efficient administration of justice. The court will need to carefully consider the merits of the application for postponement and determine whether it is an abuse of the legal process. High Court Reserves Judgment in CCC Omission Challenge

The High Court in Bulawayo has reserved judgment in a case brought by the Citizens Coalition for Change (CCC), in which its members challenge their omission from the provincial council list. Led by Aquilina Kavidza Pamberi, the ten CCC members filed an urgent court application accusing the Zimbabwe Electoral Commission (ZEC) of depriving them of the opportunity to submit their party list nomination papers.

The CCC members sought an order from the Bulawayo High Court to compel ZEC to allow them to submit their candidate names and reverse the election of unopposed Zanu PF provincial council candidates. The case named Innocent Ncube, the ZEC Bulawayo Provincial Elections Officer (PEO), as the first respondent, as he presided over the Nomination Court, while ZEC itself was listed as the second respondent. The elected Zanu PF candidates, Manala Motsi, Eddie Dube, Kundai Nyika, Golden Ndlovu, Mnothisi Nsingo, Moleen Dube, and Mlungisi Moyo, were named as the third to tenth respondents, respectively.

The CCC members alleged that ZEC prohibited them from submitting their provincial council party list nomination papers. However, the PEO refuted these allegations, stating that the CCC had only provided party lists for the Senatorial, National Assembly, and Youth quotas, but not for the Provincial Council. According to the PEO, the CCC attempted to submit their provincial council party list along with amendments to their initial nomination papers, which was prohibited.

The case was heard by Justice Bongani Ndlovu on July 3, and judgment was reserved. Nqobizitha Ndlovu, a lawyer from Cheda and Cheda Associates representing the CCC members, explained that the judge required time to review the arguments and draft the judgment. The judgment is expected to be delivered in due course, and it is anticipated that it will be issued in the coming week.

At present, the CCC members remain without nominated members in Bulawayo’s Provincial or Metropolitan Council. The judgment is considered urgent due to the impending elections, and its timing is of paramount importance. The CCC members claimed that their nomination papers were lost during the Nomination Court proceedings. However, ZEC, through its lawyers Nyika Kanengoni and Partners, argued that there is no valid application before the court justifying the relief sought by the CCC members.

The PEO, Innocent Ncube, stated that he made decisions during the Nomination Court session in accordance with the Electoral Act, even if the CCC alleges otherwise. He clarified that the CCC did not include a provincial council party list in their original submission and only added it when returning with corrected nomination papers. Ncube emphasized that he did not lose their nomination papers as alleged by the CCC, and he acted fully within the confines of the law.

Ncube further argued that the High Court lacked jurisdiction in this matter and requested that the case be struck off the roll. He asserted that the court lacked a legal basis to issue an order that would effectively create a new proclamation or supplement the one made by the President, who has the authority to proclaim when the Nomination Court meets. The PEO contended that his decision cannot be interfered with by any court unless it contradicts the clear provisions of the statute.

ZEC’s lawyers also contended that the CCC members were afforded all the necessary facilities and rights prescribed by Section 45E of the Electoral Act, as per Rule 12 of the electoral (applications, appeal, and petitions) Rules S.I 74 of 1995. They claimed that the applicants were not denied the right to file nomination papers in accordance

with the law. They argued that the attempt at late filing does not meet the requirements set forth in the Electoral Act. The lawyers pointed out that the letter requesting corrective measures was dated June 22, 2023, one day after the sitting of the Nomination Court, at which point the nomination officer was already functus officio, meaning his mandate had expired.

The High Court now awaits the completion of the judgment. The outcome of this case holds significant implications for the CCC members and their eligibility to participate in the upcoming elections. As the judgment is expected to be delivered urgently, it will provide crucial clarity on the matter and will be eagerly awaited by the parties involved.

Professor Moyo dismissed the accusation, labeling it “daft” and provided a detailed explanation of his position.

In his tweets, jonso as he is fondly called, was confronted with a pointed question, stating, “Jonso, you criticize Chamisa and CCC for not having a constitution and structures, but you’re silent on Saviour Kasukuwere, who has no constitution and no structures. You’re a hypocrite!”

In response, Professor Moyo explained screaming back, “That’s daft. If, like Chamisa, who has the CCC, Kasukuwere had a party, he would contest as a candidate of his party, not as an independent candidate, and his party would need a constitution and structures to be taken seriously.”

Elaborating further, Professor Moyo emphasized the importance of political parties having a solid framework to ensure effective governance, transparent decision-making processes, and accountability. He asserted that criticizing a political party’s lack of constitution and structures should not be equated with the decision of an individual to run as an independent candidate.

“It’s crucial to differentiate between an individual running independently and a political party lacking a constitution and structures,” Professor Moyo said. “When a candidate chooses to run independently, they are not representing any party, and their campaign is based solely on personal beliefs and principles. However, when a party fields a candidate, it implies the existence of a structured organization that is accountable to its members and operates within a defined constitutional framework.”

Moyo emphasized the need for political parties to have a clear vision, internal democracy, and the ability to mobilize support from the electorate. He suggested that the absence of such structures could undermine the credibility and effectiveness of a party’s electoral campaign.

The exiled former minister, known for his outspoken nature and critique of political matters, expressed disappointment in attempts to brand him as a hypocrite. He maintained that his criticism of Chamisa and CCC was rooted in his conviction that a political party must possess a constitution and organizational structures to effectively participate in democratic processes.

While some critics may view Professor Moyo’s response as an attempt to justify his selective criticism, others argue that his position reflects a consistent stance on the importance of institutional frameworks within political parties. Most however said Moyo has simply flipped back to his party, ZANU PF, at a time his colleagues Kasukuwere and Walter Mzembi are also bouncing back to the political frontline.

Man Kills Colleague During Drinking Binge

A 35-year-old man from Harare is in trouble after allegedly killing his friend following a misunderstanding during a drinking spree.

A beer-drinking spree ended in tragedy after a man died at the hands of his friend.

The court heard that Dennis Magweta allegedly struck his friend twice in the face with an empty beer bottle after a misunderstanding during a drinking spree.

It is alleged that the victim reported the assault to the police before he was taken to hospital where he succumbed to the injuries.

The accused who appeared in court this Tuesday has been remanded in custody and advised to apply for bail at the High Court.

Meanwhile, the net is closing in on suspected fraudsters who allegedly abused the civil servants’ rebate letters to import vehicles.

This comes after another suspect, Timukudze Nhongo appeared in court this Tuesday.

ZANU PF Second Secretary, Cde Kembo Mohadi has rallied ruling party supporters to leave no room for electoral result contestations by resoundingly voting for the ruling party on the 23rd of August.

Cde Mohadi, who took the party’s campaign trail to Chegutu in Mashonaland West Province, urged party supporters to shame those with a penchant for discrediting elections in Zimbabwe by ensuring the ruling party wins by a wide margin to render electoral disputes useless.

Thousands turned up for the rally at Pfupajena Stadium in Chegutu where candidates from the district were introduced to the electorate.

“We want to win resounding to the extent that there won’t be any contestations. Unity between supporters of those who won in the primaries and those who lost is key to winning the elections. We need discipline. Those who lost the primary elections should not take a back seat as doing so is selling out,” Cde Mohadi said.

The ruling party’s Provincial Chairperson for Mashonaland West Province, Cde Mary Mliswa spelt out the investments made in Chegutu so far including the reopening of David Whitehead Textile and expansion works at Pickstone mine.

“There is massive investment made in mining and the textile sector in Chegutu with sewer reticulated works going on,” she said.

ZANU PF Secretary for Information and Publicity, Ambassador Christopher Mutsvangwa told the electorate of the giant strides the country has made to become the largest steel manufacturing country in Africa through the Manhize-based steel plant where thousands of jobs are being created.

He said, “The steel plant is set to be better than ZISCO Steel by many folds.”

The country goes to the polls on the 23rd of August with the ruling ZANU PF targeting at least five million votes.-ZBC News

Popular gospel musician Diva Mafunga has died. He was 53.

According to the late musician’s son Tinashe, the ‘Endai Naizvozvo’ hitmaker died this Tuesday morning after a car accident that occurred near Gweru.

Mafunga, who rose to fame in 2003 after the release of his debut album Endai Naizvozvo, is also known for albums which include ‘Fambai Nekutenda’, Pfuurirai Mberi, ‘Ndicharamba Ndichidana’ and ‘Zvangu Zvaita’.

For his contribution to the local music industry, Mafunga was honoured at the 2019 edition of Permican Awards with the Legendary Award.

Meanwhile, fellow musicians who include Baba Charamba and Clive Mono Mukundu, have taken to their social media pages to convey their condolences to the Mafunga family.

New Details On Diva Mafunga’s Death

By- The Zimbabwe Republic Police said the late 50-year-old musician Davies Diva Mafunga died after a car his driving lost control of another car it was towing.

In a statement, police spokesperson Assistant Commissioner Paul Nyathi said the accident occurred along the Harare-Bulawayo Road at the 261-kilometre peg on the 4th of July 2023 around 0520 hours.

Mafunga was driving a Nissan Vannette car that was towing a Nissan Navara vehicle towards Kwekwe with one passenger on board. The car reportedly swerved after passing an oncoming bus, causing the tow bar to break. The vehicle then veered off the road, plunged into a drainage ditch, and crashed into rocks and trees.

Mafunga was thrown out of the vehicle and hit his head on the rocks, resulting in his death. The driver of the Nissan Navara managed to stop on the left side of the road. The police cautioned the public against posting premature statements on social media platforms before investigations have been completed. Reads the statement:

The Zimbabwe Republic Police clarifies and sets the record straight on a fatal road traffic accident which occurred at the 261-kilometre peg along Harare-Bulawayo Road on 04th July 2023 at around 0520 hours in which a musician, Davies Mafunga (50), who was driving a Nissan Vannette vehicle which was towing a Nissan Navara vehicle, was killed.

The Nissan Vannette vehicle was travelling towards Kwekwe with one passenger on board when it swerved after passing an oncoming bus resulting in the tow bar’ breaking. Subsequently, the Nissan Vannette vehicle veered off the road and plunged in a drainage before crashing on rocks and trees. The victim was thrown out of the vehicle resulting in him hitting the rocks headlong.

The driver of the Nissan Navara vehicle managed to stop on the extreme left side of the road.

The ‘Zimbabwe Republic Police cautions the public against posting premature statements of accident scenes on social media platforms before investigations have been completed by the police.

High Court Reserves Judgement In Biti’s Application For Postponement Of Trial

Citizens Coalition for Change vice-president Tendai Biti has asked for a postponement of his defamation trial to give room for a determination of his appeal at the High Court.

Biti is being sued for US$1 million for defaming local businessman Kenneth Raydon Sharpe and his subordinate Tatiana Aleshina.

Appearing before High Court judge Justice Tawanda Chitapi for trial yesterday, Biti’s lawyer Lovemore Madhuku asked for a postponement saying they were still waiting for a determination of their appeal at the High Court for an application for leave to appeal at the Supreme Court.

The development comes after Biti’s leave to appeal at the Supreme Court was dismissed by the bench because the application was improperly before the court.

The High Court had ordered that the trial proceed after Biti objected to the lawsuit, but lost it by a default judgment.

However, the applicant’s defence counsel advocate Thembinkosi Magwaliba opposed the application.

He told Justice Chitapi that the court was being held to ransom by Biti, who has been asking for several postponements.

Magwaliba said rules of the court were not supposed to be taken advantage of and used to frustrate the other part.

“It is clear the application constitutes to obstruct the proceedings. It is filed for the purpose of obtaining postponement, and this application is for defeating the commencement of the trial,” he said.

“They knew the proceedings at Supreme Court were dismissed and they did nothing, they just want to defeat the commencement of these proceedings.

“I submit my Lord that the defendant cannot escape the costs and that justice is being held at ransom by the defendant.”

Madhuku, however, said the appeal could succeed and that would mean there would be no trial.

Justice Chitapi, however, reserved his judgment.

Joana Mamombe, Cecelia Chimbiri Acquitted

The High Court yesterday acquitted Citizens Coalition for Change (CCC) activists Joanah Mamombe and Cecilia Chimbiri, who were being accused of publishing falsehoods and fabricating their abduction by State security agents.

Mamombe and Chimbiri approached the High Court challenging a lower court’s decision to allow their criminal matter to proceed to the defence.

A Harare magistrate had ruled that the State had established a prima facie case against the duo.

Chief magistrate Faith Mushure had dismissed their application for discharge at the close of the State case.

However, Mamombe and Chimbiri approached the High Court for review of Mushure’s determination.

High Court judge Justice Priscilla Munangati-Manongwa upheld their application for review saying the lower court erred in dismissing the duo’s application.

She said State witnesses’ evidence was irreconcilable and the falsity of the alleged statement was simply absent.

She said the evidence of the State witnesses had been “discredited during cross-examination and had become so manifestly unreliable such that no reasonable court could safely convict on such evidence.”

Said Munangati-Manongwa: “The evidence of the State witnesses is simply irreconcilable and the falsity of the alleged statement is simply absent.

“The decision of the court is found to be grossly unreasonable, irrational characterised by bias and malice and cannot be in accordance with real and substantial justice.”

The judge said Mamombe and Chimbiri could not be pushed into a defence case to supplement the inadequacies of the State case.

She added that to adopt such an approach would be unconstitutional and against the principles that place the burden on the State to prove its case and in this case, on a prima facie basis at the close of the State case.

“It is not for the court to try and prop up a crumbling case, a court has to acquit in the absence of evidence to support an essential element of a charge, or where the evidence is manifestly unreliable that no reasonable court can act on it,” Munangati-Manongwa said.

“The application has merit and, therefore, succeeds. In that regard, the applicants are entitled to a discharge at the close of the State case.

“The accused persons Joanah Mamombe and Cecilia Revai Chimbiri be and are hereby found not guilty, discharged and acquitted at the close of the State case. There is no order as to costs.”

She also ruled that the lower court underplayed the contradictions in the State case, particularly the evidence of one Tapera Christopher Kazembe, a spectrum manager at the Postal and Telecommunications Regulatory Authority of Zimbabwe, and one Godfrey Mangezi.

“A judicial officer has to be impartial and where the parties reasonably perceive that a judicial officer is not impartial, that impacts upon the decision made. In reality, such an officer must recuse himself or herself,” she ruled.

The judge said the evidence of the State witnesses was so discredited during cross-examination and had become so manifestly unreliable such that no reasonable court could safely convict on such evidence.

Zimbabwe Bows Out Of Cricket World Cup

For the second time in two Qualifiers, Zimbabwe have fallen short at the final hurdle, and as a result they won’t be at the 2023 World Cup. They needed to win one of their last two matches, just as in 2018, and they failed to do it, just as in 2018.

It’s a fascinating quirk of sport that hindsight can completely colour the view of an event. When Scotland were being strangled by Zimbabwe’s bowlers throughout their innings, barely managing to keep their run rate at above four an over, it looked like Zimbabwe had by far the better of the proceedings.

When Scotland somehow clawed together a total of 234, courtesy a burst of 54 runs in the last five overs, it looked like they had got up to a fighting total but not one that would realistically trouble an in-form Zimbabwe batting line-up littered with experience – especially in front of a home crowd that has been electric all tournament.

But when Chris Sole’s express pace sent Joylord Gumbie, Craig Ervine and Sean Williams packing inside the first seven overs – the first caught behind, the other two clean bowled – that innings-long strangle began to take on a different sheen, one instead of steely resolve. And when all was said and done it was Zimbabwe that blinked first, falling 31 runs short, as Scotland knocked them out in dramatic fashion.

If ever there was a team victory, it was this. Before Sole’s heroics, there were no less than six batters pitching in for 20 runs at least, on a sticky surface in Bulawayo, of which Michael Leask was the pick of the bunch with a 34-ball 48 .

Leask aside, only Brandon McMullen (34 off 34) and Mark Watt (21 off 15) scored at even a 70-plus strike rate of the six batters who passed 20. But they ensured that Scotland ticked off the most important box on surfaces like this: they batted through their 50 overs.

Then, with the ball, every one of the six bowlers used picked up at least one wicket, driving home the team ethos. Together they weathered a Ryan Burl-led counterattack, which included fifth- and sixth-wicket stands of 54 and 73 with Sikandar Raza and Wesley Madhevere – both partnerships ticking along at nearly a run a ball. The required rate throughout all this was just a touch above four. The pressure was on the Scottish bowlers, but they never lost hope, knowing that a wicket would change the game’s complexion. In an innings filled with wickets falling to good balls, Raza holing out at long-off would go down as an unforced error. It was at this moment that Scotland may have begun to believe.

But then Madhevere – a player who hadn’t played an innings of note all tournament – strung together the game’s biggest partnership with Burl, as the pair found the odd boundary and milked the ones and twos. Enter Mark Watt, who had earlier stitched together 21 from 34, and he got one to grip and turn, trapping Madhevere in front to grab his only wicket of the game.

This left Burl with just the tail for company. Burl soldiered on to a career best 83 off 84, but it wouldn’t be enough. With 38 needed off the last 11.3 overs, and with only two wickets remaining, he mistimed a slog-sweep to midwicket, having dispatched the previous two deliveries for four and six. In a game with so much on the line, such heartbreaks were inevitable.

None more so than for Williams, the standout player of the tournament, with 600 runs at an average of exactly 100. He received a corker from Sole. This was a moment tailor-made for Williams but in life there are things you cannot quite account for – a 149kph thunderbolt nipping back in at your off peg being one of them.

On the flip side of heartbreak is euphoria. Scotland had now beaten three Full Member teams in this tournament. Had they lost today, they would not have had the chance to play ODIs for another year at the least.

They’ve topped league two on the way to these qualifiers, beaten sides more vaunted than them, and now have to go once more on Thursday against Netherlands. If they do what they need to do, they’ll have a whole lot more cricket to gear up for.

ZEC Files Opposing Papers Against Disgruntled CCC Members

The Zimbabwe Electoral Commission (ZEC) filed opposing papers in the matter in which 10 disgruntled Citizens for Coalition Change (CCC) members are challenging the electoral body’s decision to refuse them to file nomination papers for the candidature of Bulawayo Provincial Council.

The CCC members argue that they were unlawfully denied an opportunity to file nomination papers when the Nomination Court sat a few weeks ago despite submitting their papers after the 4pm deadline.

The Nomination Court sat on June 21 to accept candidates for Presidential, Parliamentary and Local Authority ahead of the harmonised elections scheduled for August 23.

ZEC has since published the final list of candidates participating in the polls.

The applicants Aquilina Kayidza Pamberi, Tinashe Kambarami, Memory Ndlovu, Promise Dalubuhle Mkhwananzi, Caroline Mapako, Garikayi Mugova, Kwanele Bango, Brian Gumbo, Gladys Mathe and Tawanda Ruzive, through their lawyers Ncube Attorneys, filed an urgent application at the Bulawayo High Court seeking a review of ZEC’s decision not to accept their nomination papers.

In papers before the court, Bulawayo provincial elections officer Mr Innocent Ncube, ZEC, and Zanu- PF party candidates for the Bulawayo provincial/metropolitan council Manila Motsi, Eddie Dube, Kundai Nyika, Golden Ndlovu, Mnothisi Nsingo, Moleen Dube and Mlungisi Moyo, were cited as respondents. The applicants argue that when the Nomination Court closed doors they were already there and ready to file their papers.

“The first respondent (Mr Innocent Ncube), therefore, violated the audi alteram partem rule by refusing to permit the applicants to present their nomination papers for consideration alongside those of Manila Motsi, Eddie Dube, Kundai Nyika, Golden Ndlovu, Mnothisi Nsingo, Moleen Dube and Mlungisi Moyo,” argued the CCC lawyers.

“Further, the refusal by the first respondent to allow the applicants to submit new nomination papers was grossly unreasonable and insupportable of the facts of this case.”

The applicants are seeking a relief declaring that ZEC acted contrary to the provisions of section 46(7) of the Electoral Act when it refused them the opportunity to present their nomination papers for the Bulawayo Provincial Council.

“Consequently, the first respondent’s decision to refuse applicants the opportunity to present nomination papers for the Bulawayo Provincial Council should be set aside,” argued the applicants.

They also want the court to nullify the election of the seven Zanu-PF candidates for the Bulawayo Provincial Council.

The applicants want ZEC to be directed to receive and consider their nomination papers for the Bulawayo Provincial Council.

In its notice of opposition, ZEC through its lawyers, Nyika Kanengoni and Partners said there is no valid application before the court warranting the relief sought by the disgruntled CCC members.

Mr Ncube said the decision that he took in his capacity as the Bulawayo provincial elections officer during the sitting of the Nomination Court was made in terms of the Electoral Act.

“This applies even where the applicants allege that I acted contrary to the provisions of the Electoral Act.

Mr Ncube argued that the High Court lacks jurisdiction in the matter and it should therefore be struck off the roll.

“The right to appeal is afforded to the sponsoring political party and not to the listed candidates on the party-list. In this instance, the right reposed in the CCC party. If such right is not exercised with the four-day period prescribed, the right to appeal shall lapse and the decision of the nomination officer shall be final,” he said.

“In the present matter, the applicants, following my decision not to accept their nomination papers, noted an appeal to the Electoral Court sitting in Bulawayo under case number EC02/2023. They did so in their individual capacities and not through their political party, thus making their appeal fatally defective.”

Mr Ncube contended that his decision is final in terms of section 45 (14) (c) of the Electoral Act.

“My decision cannot be interfered with in any manner by any court lest that court goes against the clear provisions of a statute. Nominations for party –list candidates are not considered in terms of section 46 (7) of the Electoral Act. They are considered under section 45E of the same Act,” he argued.

Mr Ncube said the sitting of the Nomination Court to receive and consider applicants’ papers is not possible in terms of the law as it is only the President who proclaims.

“The issuing of the proclamation is a function given to the Executive by the Constitution. The court sitting as the general division of the High Court, has no legal basis to make an order that effectively makes a new proclamation or supplements the one already made by the President,” he said.

Mr Ncube said in the course of his duties towards the close of the Nomination Court at around 3.55pm, he announced in court that they were about to close and invited all those who were present to submit their nomination papers.

“I further instructed the police officers manning the court to go outside and collect all nomination papers save for those already inside the court, and began to deal with the papers on my desk,” he said.

“When I came to the party-lists for the CCC, the party had three party –list for Senatorial, National Assembly and Youth quota. They did not have one for provincial council. After checking the papers, I sent their representative back to make corrections on anomalies.”

Mr Ncube said at around 8pm when CCC representatives returned with the corrected party-list nomination papers, he noted that they had now added the provincial council party-list, which was not part of the original submission.

“The factual narration given by the applicants is thus not correct. I did not lose their nomination papers as they allege. There is, thus, no basis for this application at all. I acted fully within the law,” he said.

“The fatal defects in the application mitigate against this court granting any relief to the applicants,”

ZEC lawyers argued that in terms of Rule 12 of the electoral (applications, appeal and petitions) Rules S.I 74 of 1995, the applicants were afforded all the facilities and rights prescribed in terms of section 45E of the Electoral Act.

“They were not denied a right to file nomination papers in terms of the law. An attempt at late filing is not filing as contemplated in terms of the Electoral Act. The letter requesting corrective measures is dated 22 June 2023, a day after the sitting of the Nomination Court at which point the nomination officer was already functus officio (an officer or agency whose mandate has expired),” said the lawyers.

The lawyers said the application ought to be struck off the roll, arguing that it is fatally and incurably defective.

“If the court finds the appeal to be valid, it should be dismissed on the merits.”

Bulawayo High Court judge Justice Bongani Ndlovu reserved judgment after hearing the matter on Monday.

Head-On Collision Claims Nine People Along Harare-Chirundu

Nine people died, while 12 others were injured in a head-on collision involving a Nissan Caravan and Honda Hit vehicle that occurred along the Harare-Chirundu Highway on Monday evening.

The injured are receiving medical treatment at Sally Mugabe Central and Inkomo hospitals.

In a statement yesterday, national police spokesperson Assistant Commissioner Paul Nyathi said: “The ZRP [Zimbabwe Republic Police] confirms a fatal road traffic accident in which nine people died while 12 others were injured when a Nissan Caravan vehicle with yet-to-be-established passengers on board was involved in a head-on collision with a Honda Fit vehicle with seven passengers on board at the 53km peg along the Harare-Chirundu Road on July 3 at around 1800 hours.”

“The bodies of the victims were taken to Norton Hospital mortuary for post-mortem, while the injured are admitted to Inkomo and Sally Mugabe hospitals.”

Meanwhile, three people died while four others were injured in another accident involving a Toyota Hilux and a Mthethi bus early on Monday morning.

“In another fatal road traffic accident which occurred on 03/07/23 at around 0030 hours at the 140km peg along Bulawayo-Beitbridge Road, three people were killed, while four others were injured when a Toyota Hilux vehicle with nine passengers on board veered off the road to the right before hitting the trailer of a Mthethi Golden Dragon bus with six passengers on board,” Nyathi said.

“The bodies of the victims were taken to Gwanda Provincial Hospital mortuary for post-mortem, while the injured are admitted to the same hospital.”

Nyathi said commuters should avoid pirate taxis.

“We call upon the public to avoid boarding pirate taxis, imagine the Honda Fit involved in the accident had seven passengers.

“The driver died also. It is very sad. We also urge drivers to follow road rules and detest reckless driving which is also causing unnecessary loss of lives,” he said.

In a related incident, police have released the names of five people who died in a head-on collision on Saturday along the Harare-Masvingo Highway.

The accident, which occurred at the 81km peg along the highway, involved a Toyota Allion vehicle and a bus.

The victims were identified as Varaidzo Musapurwa (32), Maila Dungwizha (1) and Alexio Kamumvuri (48), all from Impala Plains in Rovangoma, Karoi.

The others were Tatenda Kisi (22) and Mudonhi Chihuri (33), both of Southerton, Harare.

Govt Reads Riot Act To Local Authorities

Government yesterday read the riot act to local authorities directing them to stop billing their services in United States dollars.

The move is seen as further attempts by the Treasury at promoting the use of the local currency.

In a statement, the Finance and Economic Development ministry issued a stern warning to local authorities and government agencies which had disregarded the directive to collect fees and levies in local currency.

The ministry also emphasised the need for compliance to promote wider use of the domestic currency.

The directive was also seen as means to maintain steady firming of the local currency against the US dollar after a huge fall experienced in May and June this year.

The country’s annual inflation rate more than doubled from May to June, to 175%, with economists indicating that severe depreciation of Zimbabwe’s struggling currency led prices to spiral.

Zimbabwe’s currency has also been showing signs of stability after its free-fall had pushed inflation to triple digits.

Last week, the Zimdollar gained for the first time this year, following a raft of policy measures implemented to stabilise it.

It firmed 9,4% against the greenback at a weekly-run central bank auction on Tuesday last week trading at $6,326 per US dollar.

The local currency gained further yesterday, trading at an average of $5 396 to the US dollar.

However, economic analysts were yesterday divided over the move by Treasury, with some supporting government, while calling for more projects to shore up the local currency.

Renowned economist Gift Mugano raised concerns about the future of the Zimdollar and the current exchange rate stability.

Mugano argued that the apparent stability was a facade, brought about by what he termed “forced fasting” — a strategy that mops up the money supply at the expense of aggregate demand, restricts payments, and denies civil servants fair salaries.

Mugano’s concerns stem from a snap survey he conducted on civil servants’ salaries, which yielded alarming results.

He said he discovered that some civil servants and university staff members had received payslips with negative balances, sparking widespread concern about the sustainability of the current economic situation.

According to Mugano, the “fasting period” would soon come to an end with the exchange rate experiencing a significant increase.

“I want to categorically make it clear that the Zimdollar has no future and the current exchange rate stability is a false one because it has been brought about by forced ‘fasting’ — mopping money supply at the expense of aggregate demand, restricting payments and refusing to award civil servants fair salaries.

“I did a snap survey on civil servants salaries and noted that civil servants and staff at some universities have received payslips with negative balance. This is not sustainable,” he said.

However, another economist Cornelius Dube said there was nothing wrong with the directive.

“But obviously, the issue is that businesses will still use exchange rate even if they charge in local currency. Everyone is still going to price in US dollars to come up with Zimdollar prices. That is what everyone will do anyway.

“What government is trying to do is more like a signal issue, what signals are being sent to the market especially with respect to whether we are dollarising or de-dollarising,” he said.

Zimbabwe Institute of Strategic Thinkers director Tinashe Muzamindo also argued that government’s directive was a necessary step towards promoting the wider use of the Zimdollar.

“The continued use of foreign currencies for transactions can hinder the development of the domestic economy,” he said.

Muzamindo said promoting the Zimdollar as the primary currency for domestic transactions could help stimulate local business and encourage investment in the country.

He, however, acknowledged the challenges that may arise from the directive, but emphasised the need for proper implementation and monitoring.

Muzamindo also suggested that government should provide support and incentives to encourage businesses and individuals to use the Zimdollar.

In the statement yesterday, Treasury said government in May this year directed all government agencies, including local authorities, to collect fees and levies in local currency to promote the wider use of domestic currency.

However, some local authorities and government agencies have either issued notices to the contrary or continue to charge services exclusively in United States dollars, in direct violation of the law.

“The behaviour is not only in contravention of the law, but also militates against government policy. Therefore, all government agencies and local authorities are reminded to comply with the government directive with immediate effect,” the ministry said.

The City of Harare has been identified as one of the culprits.

“This behaviour not only goes against the law, but also undermines government policy, which aims to promote the use of the Zimbabwe dollar for domestic transactions,” Treasury said in the statement.

Government re-introduced the Zimbabwean dollar in 2019 after abandoning the local currency during hyper-inflationary environment 10 years early.

Government introduced a basket of currencies before resuscitating the Zimdollar as the primary currency.

The aim of re-introducing the Zimdollar was to regain control over the country’s monetary policy and address the economic challenges.

However, the process of transitioning to the new currency has not been without difficulties.

The value of the Zimdollar has remained volatile, and the country continues to face economic challenges such as high inflation and limited access to foreign currency.

Kasukuwere Promises Title Deeds To Urban Voters

Independent presidential candidate Saviour Kasukuwere has pledged to dole out title deeds to house owners in urban areas if he wins the August 23 plebiscite.

President Emmerson Mnangagwa has also promised title deeds and regularisation of illegal settlements in urban centres.

Kasukuwere, who is in Kenya, told journalists in Nairobi that title deeds were a priority for him.

“If I emerge the winner in the polls, my top priority for the people is to give title deeds to Zimbabweans who have been suffering for decades,” he said.

Kasukuwere said he was in Kenya to compare his five governance pillars with that of Kenya’s government.

“President William Ruto’s bottom-up agenda is particularly interesting and worthy of attention,” he opined.

He also promised to revive the country’s economy.

Kasukuwere pledged to restore trust in the public service, where he claims corruption has become prevalent.

“I come with a clear agenda, and a deep appreciation of what Zimbabweans need,” he said.

The presidential aspirant also underscored the need to campaign peacefully and to allow all contenders to sell their manifestos to the people without intimidation and harassment by the State.

‘’It is an agenda-based campaign and the State should be tolerant, we want free and fair elections in August,” he told the media in Kenya.

Kasukuwere has previously held various government and political party positions and was former President Robert Mugabe’s last national political commissar and a central committee member in the ruling Zanu PF party.

The upcoming election is expected to feature Mnangagwa, and 10 other candidates, including Nelson Chamisa, who leads the main opposition Citizens Coalition for Change party.

Other candidates include Kasukuwere, Douglas Mwonzora, Trust Chikohora, Lovemore Madhuku, Blessing Kasiyamhuru, Joseph Busha, Harry Peter Wilson, Gwinyai Muzorewa and Wilbert Mubaiwa.

Kasukuwere is an independent candidate and is anticipated to enjoy support, particularly in Zanu PF strongholds.

The three main contenders — Mnangagwa, Kasukuwere and Chamisa — have all dangled title deeds to hundreds of thousands of homeowners as they try to win votes.

In April, Mnangagwa handed over securitised deeds of grants to 265 Epworth residents and pledged to avail more.

Headmaster In Deep Trouble Over Zanu PF Links

By A Correspondent| A Zimbabwe school head, who was nominated to contest local authority elections as a candidate for the ruling ZANU PF party and keeps on reporting for duty in contravention of the Constitution, has landed himself in trouble for his illegal and partisan conduct.

Human rights lawyer Innocent Gonese of Zimbabwe Lawyers for Human Rights on 29 June 2023 lodged a complaint with the Public Service Commission (PSC) over the illegal and partisan conduct of Nathaniel Marusho, a school head, who was nominated to contest local authority elections set for 23 August 2023 as a candidate for the ruling ZANU PF party.

Marusho is employed by the PSC under Ministry of Primary and Secondary Education as a Headmaster at Mvurwi High School in Mashonaland Central province.

In a letter, which was written by Gonese and delivered to PSC, the human rights lawyer protested that Marusho was still attending to his duties at Mvurwi High School after his nomination, which is a violation of section 200 of the Constitution as read with the provisions of section 119(2)(g) of the Electoral Act.

In the letter, Gonese stated that by associating himself with a political party, Marusho was violating the provisions of the Constitution and of the Electoral Act, which are designed to ensure the political neutrality of members of the public service.

Gonese indicated that Marusho’s employment with the PSC must have been terminated before his nomination by way of resignation and that he cannot continue working as a civil servant after the submission of his nomination papers.

The human rights lawyer stated that Marusho can either elect to be a politician or be employed as a civil servant but cannot do both.

Gonese asked the PSC to confirm within three days whether Marusho’s deemed resignation had come into effect and if he had stopped reporting for duty failure of which he would institute appropriate legal proceedings against him.

CCC Candidates Take On ZEC Over Failure To Release Voters Roll

Opposition Citizens Coalition for Change candidates have taken the Zimbabwe Electoral Commission head-on over its failure to release the voters roll two weeks after the nomination courts sat.

Under the Electoral Act, Zec is required to give candidates copies of the roll soon after confirmation of their candidature.

Kuwadzana East legislator Chalton Hwende and David Coltart (Bulawayo ward 4 council candidate) accused the electoral management body of refusing to make the voters roll available to them.

Coltart yesterday tweeted: “It has been nearly two weeks since my nomination papers were accepted. Since then, my chief election agent has made numerous requests for an electronic copy of the voters roll, which I am entitled to under section 21 of the Electoral Act. Today, we have been informed that it is still unavailable. The ‘reasonable time’ referred to in section 21(1) has long since expired. Why is @ZECzim still refusing to hand over the voters roll?”

Hwende’s election agent also faced similar challenges after visiting Zec offices to obtain the voters roll.

He tweeted: “On Friday, my election agent for Kuwadzana East constituency, Mr Wellington Mariga, went to @ZECzim to request the voters roll for our constituency. Zec refused to provide him with a copy. How are we supposed to campaign without a voters roll?”

Zec chief elections officer Utloile Slaigwana yesterday said he could not comment on the matter as he was in a meeting.

Opposition political parties, non-governmental organisations and other stakeholders have expressed concern about the failure by Zec to provide the voters roll whenever it is requested.

Last year, opposition candidates failed to access the voters roll during the March by-elections, while their ruling Zanu PF counterparts had access to the document.

Recently, the Supreme Court dismissed an appeal made by Harare North lawmaker Allan Markham, who sought an order to overturn a High Court ruling denying him access to the electronic voters roll.

Last year, Markham filed an application demanding that Zec release the voters roll in electronic format, arguing that the electoral body was acting unconstitutionally by withholding it.

The High Court dismissed Markham’s request for the release of the electronic voters roll, citing security concerns.

Kasukuwere Sets Date For Return To Zimbabwe

Former Tourism minister Walter Mzembi has announced that Independent Presidential candidate Savior Kasukuwere will soon come to Zimbabwe to begin his campaign ahead of the 23 August harmonised elections.

Writing on Twitter on Wednesday, Mzembi said he will announce the date on which Kasukuwere will land in Zimbabwe.

“Today , i will announce when President @Hon_Kasukuwere will be coming to Zimbabwe ! Apologies i would have done it yesterday but was in the Region on debriefs. Indeed the X factor Passenger 34 heads home on the date to be pronounced today . Mazvita,” said Mzembi.

Kasukuwere has caused panic within the ruling Zanu PF party after he successfully filed his nomination papers to square off against his former colleague Emmerson Mnangagwa.

Mliswa Blasts Zanu PF

MASVINGO-The entire top Zanu PF Masvingo provincial leadership, including national secretary for security Lovemore Matuke and Minister for State Ezra Chadzamira, was conspicuous by its absence at the burial of independent candidate Christopher Mutonhori Rwodzi (53), who died in a road accident on Thursday evening.

Mutonho Mutonho, as he was popularly known, was buried yesterday at Aaron’s Village, Fairfields in Mvuma at the family’s shrine next to his parents, Aaron Simbanegavi Rwodzi and Otilia Rwodzi.
He turned independent for the August 23, 2023, national elections after being blocked from participating in the Zanu PF primary elections. Acrimony developed between him and the top provincial party leadership.

Speaking at the burial, vocal politician Temba Mliswa blasted Masvingo leadership for shunning one of their members even in death. He said it was ironic that the entire Midlands Province leadership and Politburo members from elsewhere were present when none from Masvingo could attend.

The ruling ZANU PF Party has pledged to do everything possible to improve the lives of the citizenry after opposition-led local authorities failed to deliver quality service to urban dwellers.

As ZANU PF supporters thronged the Mbare open space near Stoddart Hall in Harare this Monday, ZANU PF Vice President, and Second Secretary, General Rtd Dr Constantino Chiwenga enunciated party policy regarding the people’s welfare.

“I came here, speaking about Matapi and Shawasha Flats. Let us listen carefully. We also said such areas, including those in Sakubva in Mutare, Mkoba in gweru and Makokoba in Bulawayo must be revamped. Now the plans are here. The constructors came and CCC said no, if you do that you will take our votes. Not any more, we gave them that latitude. We will invoke the law that if we want to build houses for our people, we will do it whether the council likes it or not,” said VP Chiwenga.

Home of the country’s revolution and the road to independence, Mbare remains at the core of Zimbabwe’s sovereignty. However, failure by opposition-led councils has seen housing and road network deteriorating over the years, with the ZANU PF government vowing to intervene and rehabilitate infrastructure for the benefit of the people.

Dr Chiwenga further castigated the proposed move by the council to introduce a United States dollar-based billing system.

“The currency here is the Zimbabwe dollar. Council had started demanding rates in USD and we asked whether they print the American dollar. Where do the people get the American dollar? We say down with that. We pay our bills using the Zimbabwe dollar.”

“You had a council here, of the MDC, now CCC, and a combination of MDC and CCC. show me anything constructed by the MDC council. Show me anything built by the CCC. If they want their people to rule in Zimbabwe, why are they not building infrastructure for their people? We don’t want to see them anymore!”

He also spoke on the massive strides that the Second Republic has made in the rehabilitation of health, schools, tourism sites and dams infrastructure under the National Development Strategy One, pledging that more is yet to come.

“We shall continue building health facilities.

I want to assure you we shall upgrade and repair to make our facilities state-of-the-art. We shall start with Parirenyatwa Groups of Hospitals, then in Bulawayo, Mpilo Hospital. We shall identify two or three others for upgrading. You noticed we resumed open heart surgeries at Parirenyatwa. We have had two successful operations so far. The government under President Mnangagwa is revamping tourist attraction sites, even airports. You can see how the Robert Gabriel Mugabe International Airport has been revamped. We need foreign currency from the visitors. The new facility will be commissioned this month.

“We are also building schools, mining houses and accommodation for the civil service are some of the other programmes being undertaken by President Mnangagwa’s government,” he said.

Vice President Chiwenga also spoke on the sanction-busting policies that have been put in place by the government that have allowed the economy to grow as well as the message of peace and unity ahead of the August 23 general elections.

Zanu PF Heavyweights Boycott Mutonho Funeral

MASVINGO-The entire top Zanu PF Masvingo provincial leadership, including national secretary for security Lovemore Matuke and Minister for State Ezra Chadzamira, was conspicuous by its absence at the burial of independent candidate Christopher Mutonhori Rwodzi (53), who died in a road accident on Thursday evening.

Mutonho Mutonho, as he was popularly known, was buried yesterday at Aaron’s Village, Fairfields in Mvuma at the family’s shrine next to his parents, Aaron Simbanegavi Rwodzi and Otilia Rwodzi.
He turned independent for the August 23, 2023, national elections after being blocked from participating in the Zanu PF primary elections. Acrimony developed between him and the top provincial party leadership.

Speaking at the burial, vocal politician Temba Mliswa blasted Masvingo leadership for shunning one of their members even in death. He said it was ironic that the entire Midlands Province leadership and Politburo members from elsewhere were present when none from Masvingo could attend.

Nine (9) Perish In Gwebi Horror Crash

By-Nine people died while 12 others were injured after a Nissan Caravan and a Honda Fit were involved in a head-on collision along the Harare-Chirundu Road last night.The accident occurred at around 6pm near Gwebi College.
National police spokesperson Assistant Commissioner Paul Nyathi confirmed the incident.
“The ZRP confirms a fatal road traffic accident in which nine people died whilst 12 others were injured when a Nissan Caravan vehicle with yet to be established passengers on board was involved in a head-on collision with a Honda Fit vehicle with seven passengers on board at the 53 kilometre peg along Harare-Chirundu Road on July 3, 2023 at around 1800 hours.
“The bodies of the victims were taken to Norton Hospital Mortuary for post-mortem whilst the injured are admitted at Inkomo and Sally Mugabe Hospitals,” he said.
Meanwhile, in another fatal road traffic accident which occurred on Monday again at around midnight at the 140 kilometre peg along the Bulawayo-Beitbridge Road, three people were killed while four others were injured when a Toyota Hilux vehicle with nine passengers on board veered off the road to the right before hitting a trailer of a Mthethi Dragon Bus with six passengers on board.
The bodies of the victims were taken to Gwanda Provincial Hospital mortuary for post mortem while the injured are admitted at the same hospital. Herald

Chiwenga Blames Chamisa For Zanu PF Failures

By-Vice-President Constantino Chiwenga has accused the Nelson Chamisa-led opposition party, Citizens Coalition for Change (CCC), of the four-decade-long neglect of the Mbare flats.

Chiwenga said the Chamisa-led Harare city council rejected refurbishing the dilapidated flats.

 In 2018, Chiwenga promised to replace the old flats with modern structures but now claims that the opposition-led Harare City Council thwarted the central government’s efforts.

Speaking at a campaign rally in Mbare, Chiwenga said that after the elections, the ZANU PF government would pass laws to prevent opposition party-led councils from obstructing development projects, NewsDay reported. The former army boss said:

I came here in 2018 and talked about Matapi and Shawasha flats saying that places like these together with Sakubva (Mutare), Mkoba (Gweru) and Makokoba (Bulawayo), need to be fixed.

Plans came in for construction and Citizens Coalition of Change (CCC) denied the offer saying that ‘if you build those structures, you will take away our votes’.

It is now a thing of the past. We gave them latitude, and we will evoke the law that when we want to construct better housing for our people, we will do it whether the council likes it or not.

There are no questions about it. Laws are made by human beings and it is the human beings who revoke laws which are not amenable to our people. I urge you to vote for councils that belong to ZANU PF and we shall make Zimbabwe great.

I have come here with Local Government minister (July Moyo) so that we can uplift Mbare Musika to make it a world-class market like what other countries are doing, together with Mupedzanhamo Market.

Chamisa Settles Masvingo Double Candidacy Confusion

By-The Citizens Coalition for Change (CCC) in Masvingo has successfully negotiated for the withdrawal of two of its members who had registered to contest the upcoming elections without the party’s blessing.

One member contested as an independent, and the other allegedly forged signatures to create double candidates for the CCC in Masvingo West’s Ward 2. The two members, Frank Chirairo and Rocky Kamuzonda, have withdrawn from the elections after calls from their party to do so.

Kamuzonda confirmed his withdrawal, stating that he realised that running as an independent would bring confusion to the party. He said he withdrew out of respect for his party, saying that he is still a CCC member and urged his supporters to vote for the selected CCC candidate, Shantiel Chiwara. He said:

It is true that I have withdrawn my candidature at Zimbabwe Electoral Commission (ZEC). I have realized that I am still young and I still have more opportunities in the future.

I am still 100 percent CCC and I urge all my supporters to vote for the CCC-selected candidate.

Although Kamuzonda claims that his withdrawal was entirely his own decision, sources within the party suggest that Dzikamai Mavhaire convinced him to step down after being given some money. The sources also claim that the two members are not sincere in their support for Shantiel and may instead support Hwata, who they believe will be easier to remove once she is established.

After the chaotic candidate selection process, Chirairo, who was the residents’ favourite, filed his candidature on the CCC ticket. Kamuzonda came second, and Shantiel was the only female candidate in the race. Shantiel is the daughter of former Masvingo City Deputy Mayor James Chiwara who reigned between 2013-2018 before losing the 2018 primaries to Tarusenga Vhembo.

Since the withdrawal of the two members, fears of a vote split in favour of ZANU-PF have been cleared. Four candidates will now battle for the seat, namely Hwata, Chiwara, Charity Shoko, and Anderson Paradza.

Yester-Year Gospel Musician Diva Mafunga Dies

By- Yester-year gospel musician Diva Mafunga has died.
Reports said Mafunga was involved in a road accident, resulting in his untimely demise.
Fellow gospel artiste Pastor Charles Charamba announced the Endai Naizvozvo hitmaker’s death on Twitter and passed his condolences.

He said in a Twitter post:

It comes as a shock. In deed we have lost a good and dependable companion, someone who candidly demonstrated his love for God. May the Lord comfort the children and family at large. Rest in Power our own Compatriot Diva Mafunga.

The artist gained popularity with the release of his debut album’ Endai Naizvozvo’ in 2003. Mafunga began his musical journey in the rural areas of Mount Darwin in the 1980s, where he and his peers would hold jam sessions with banjos while herding cattle. He later began singing in church and, in 2003, decided to have some of his songs recorded.

After being turned down by Gramma Records for not being marketable, Mafunga remained undeterred and used his own resources to record ‘Endai Naizvozvo’ at Shed Studios. Upon its release, the album was well received by fans and eventually picked up by Gramma Records for marketing. Mafunga went on to release several other albums, including ‘Fambai Nekutenda’ (2004), ‘Pfuurirai Mberi’ (2005), ‘Ndicharamba Ndichidana’ (2007), ‘Spiritual Battle’, ‘Zvangu Zvaita’, and ‘Ndatenda Ndapinda’.

Mafunga’s dedication to his craft led him to engage the late Oliver Mtukudzi to feature on his album “Ndatenda Ndapinda”. The album featured two songs with Mtukudzi’s vocals and acoustic guitar. Mafunga was recognized for his contributions to music during his lifetime, winning the Legendary Award at the PERMICAN Ceremony held at the City Sports Centre in 2019.

Despite facing challenges, such as rumors that he was born blind and allegations of fraud against his employer, Mafunga remained committed to his passion for music. 

Mai Titi Says Her Conviction Is A Dream Come True

Recently convicted socialite, singer and comedian Mai Titi, born Felistas Murata, who on Sunday celebrated her 37th birthday behind bars at Chikurubi Female Prison saying she made a request to prison authorities to be locked up in order feel what fellow women behind bars felt.

In a touching message posted on her Instagram account, Mai Titi said two years ago she wrote to the authorities to be allowed to spend a night in prison but was turned down on the grounds that she did not commit a crime.

“It’s funny that I made a request two years ago when I visited Chikurubi Female Prison, donating goods to my fellow women in custody. I asked the authorities to grant me a request to spend a night in prison with female inmates because I wanted to see, have a feel, understand how they survived in this uncomfortable place,” Mai Titi’s message read.

“My request was denied as they told me I could only spend a night in prison if I commit a crime. Two years later, today I am writing this letter from prison because of a mistake I made, which turned to be a crime. Now I can see, feel, experience what it is to be in prison.

In her letter, Mai Titi promised to tell the people all about what she is experiencing while in prison once she gets out.

“I turned 37 years behind bars and I’m going to enjoy with my inmates. I know some of you miss me and I genuinely miss you too. I thank God for taking me this far. Even if I am in a dungeon, I still thank Him,” the message read.

“Every mistake I made in life is a lesson and, indeed, I am learning and growing. I got loads of stories to tell you when I see you again.”

Mai Titi is doing time in prison for using a hired vehicle as collateral security for a US$10 000 debt.

Harare magistrate Munashe Chibanda last month found her guilty of fraud and theft of trust property and sentenced her to 12 months imprisonment, with six of them suspended on condition that she does not commit a similar offence.

She was also sentenced to three months in prison for defaulting on community service in 2015 in a domestic violence case.

In the first count, allegations against her were that last September, she misrepresented to the complainant Rachel Mhuka that she wanted US$10 000 for her business venture and would give her a Mercedes-Benz vehicle as surety while aware that the car was not hers.

Mhuka gave her the money.

Mai Titi later retrieved the vehicle from Mhuka saying it did not belong to her and went on to give her another vehicle, an Audi Q5 as surety, which she later swapped with an invalid passport.

The complainant later discovered that the passport was not valid and returned it to Mai Titi, who then gave her back the Audi Q5.

In January this year, police seized the vehicle from complainant saying it belonged to Else Event Car Hire.

In the second count, Mai Titi approached the car rental company, which was represented in court by director Liberty Vazhura, intending to hire an Audi Q5 motor vehicle.

She entered into a lease agreement and undertook to pay US$770 weekly.

Mai Titi failed to make the weekly payments and was ordered to return the vehicle by the complainant, but she became evasive, prompting Vazhura to report the matter to the police.

Investigations were carried out, leading to the recovery of the motor vehicle from Mhuka’s residence.

“I have come here with Local Government minister (July Moyo) so that we can uplift Mbare Musika to make it a world-class market like what other countries are doing, together with Mupedzanhamo Market.”

He said councils led by opposition parties were failing the people.

“You have been voting councils from MDC and CCC. There hasn’t been any development which has been taking place. They have destroyed urban areas. There is litter everywhere to an extent that if you need fresh air these days, you will go to the rural areas,” Chiwenga said.

President Emmerson Mnangagwa toured the dilapidated flats in the suburb in the run-up to the 2018 polls and promised to have them renovated, but has not done so to date.

In 2011, a Bill and Melinda Gates Foundation-funded project to rehabilitate the Matapi Flats in Mbare failed to take off after the Zanu PF-linked Chipangano terror group blocked the programme.

The flats were built during the colonial era to accommodate male workers and have now become home to thousands of families who use communal toilets and water points.

By Leonard Koni | As Zimbabwe prepares for its upcoming elections, the political landscape is dominated by three main candidates: Emmerson Mnangagwa, Nelson Chamisa, and Saviour Kasukuwere. While the campaigning is in full swing, it is disheartening to witness the lack of substantive messages coming from the ruling party’s representatives.

Emmerson Mnangagwa, the leader of Zanu PF, has failed to provide a clear vision for the country’s future or outline how he plans to transform Zimbabwe into an economic powerhouse if given another term. His speeches have been vague and uninspiring, leaving the electorate wondering about his true intentions.

Not to be outdone in delivering empty promises, Vice President Constantine Guvheya Chiwenga addressed residents of Mbare in Harare, pledging to facelift Mbare Musika. However, the people of Mbare have not forgotten the destruction of their informal sector back in June 2005, which impacted a significant portion of the population reliant on this sector for their livelihoods. It is concerning that Chiwenga, who previously promised to build swimming pools for Mbare residents, has once again appeared with a new promise, despite failing to deliver on his previous commitment. It is time for the people to hold such leaders accountable for their actions or lack thereof.

It is evident that Zanu PF has run out of ideas, resorting to empty and unfulfilled promises to woo voters. The ruling party claims it will do everything possible to improve the lives of the citizens, while simultaneously blaming the opposition-led local authorities for the lack of quality service delivery. This tactic is transparently aimed at gaining political points during election season.

Zanu PF’s two-decade-long rule has yielded little progress and is merely associated with political rhetoric and slogans. When a ruling party suddenly starts promising service delivery at the eleventh hour of an election campaign, resembling an opposition party, it is a clear sign that the organization is out of touch with reality and lacks a genuine concern for the people and their future.

Zimbabweans should not let this opportunity slip away. They must seize the chance to vote for a new government that genuinely prioritizes creating a better future for all citizens. It is time for fresh leadership, innovative ideas, and a commitment to tangible progress. Empty political statements will not solve the challenges faced by the nation, and it is up to the electorate to demand more from their leaders.

The upcoming elections should serve as a turning point for Zimbabwe. The citizens must exercise their democratic right to vote wisely, choosing leaders who have a clear vision, a track record of delivering on their promises, and a genuine commitment to the betterment of the country. Zimbabwe deserves leaders who will prioritize the needs of the people and work tirelessly to create a prosperous and inclusive future.

Mwonzora Under Fire

Founding members of the Movement for Democratic Change (MDC) have accused current president Douglas Mwonzora of killing the once vibrant opposition political party.

Mwonzora wrested the MDC from Nelson Chamisa, who later went on to form the Citizens Coalition for Change (CCC) after he was hounded out of the MDC with the use of the courts.

However, there are fears that the MDC is facing imminent collapse after the August 23 harmonised elections this year.

MDC founding member Elias Mudzuri told NewsDay that it was a shame that the opposition members had failed to save the party.

“It’s a shame that we failed to uphold an institution which used to be very strong and known worldwide. It’s very painful looking at what used to a very big name,” he said.

“What Dougie (MDC-T leader Douglas Mwonzora) did is a shame. Everything that he did was to destroy the party. Whatever he did, he did that for himself and that is why he ended up fielding himself (as presidential candidate) and a few others. We have never heard of that (before).”

Mudzuri said Mwonzora should leave the party.

“He (Mwonzora) must resign so that we revive the party. We should get this party running,” he said.

Former MDC-T chairperson and Speaker of the National Assembly Lovemore Moyo said the party died with the death of founding leader Morgan Tsvangirai.

“By the way, that is not my former party (MDC-T). Mine was just MDC and later on MDC-T for electoral purposes. After the death of the founding president, Tsvangirai, there were some splinter formations and I can’t attach myself to any of those. I am not for Mwonzora or Nelson Chamisa. I was part of the Tsvangirai-led MDC,” he said.

In an interview with NewsDay at the weekend, political analyst and chairperson of the regional think-tank, Southern African Political Economy Series Trust, Ibbo Mandaza, concurred that Mwonzora had destroyed the opposition party.

“Mwonzora believed that he was moving with the movement that Tsvangirai led. He was wrong. We knew from the beginning that he had gotten lost.

“What happened, therefore, in essence is that Mwonzora and his little clique evicted themselves out of the MDC,” Mandaza said.

He added: “CCC is, in fact, the real MDC. It has not died. What died is the Mwonzora MDC. The movement which was led by Tsvangirai or the contents of MDC remains the same even if it’s renamed CCC.”

Mandaza said the contents of the old MDC led by Tsvangirai remained the same in terms of membership, orientation, affiliation and ideology.

“Even though Chamisa has tried to transform it into a new movement, it is not. On the other side, Chamisa is also wrong to think that he is leading a new movement. It’s not.

“It is regrettable that Chamisa changed the name. Some of us advised him to keep that brand MDC because we saw that, predictably, Mwonzora’s campaign was going to end up in disaster. We saw that a long time ago,” he said.

MDC-T spokesperson Witness Dube, however, blamed the Zimbabwe Electoral Commission (Zec) for the woes.

“This is no doubt (this is) the lowest that our party has reached since its formation. While Zec had a big hand in our failure to register some 87 candidates, the inescapable truth is that everything rises and falls on leadership.

“The foundations of the MDC are too deep to collapse the party overnight. We will make a very strong comeback. Our members are encouraged to vote fellow opposition candidates where we have none to keep the hope for change alive by all means possible,” Dube said.

The MDC, which was formed in 1999, was the first opposition party to garner a parliamentary majority against Zanu PF in the 2000 parliamentary election.

In 2008, Tsvangirai defeated the late former President Robert Mugabe without the acceptable margin to form a government, leading to a violent run-off that the MDC boycotted, leading to the formation of a coalition government.

FAZ Fails To Pay Its Workers Deployed In Communities To Mobilize For Mnangagwa

Forever Associates of Zimbabwe Trust (FAZ), a Zanu PF affiliate operating under the Central Intelligence Organisation (CIO) to primarily support President Emmerson Mnangagwa in the upcoming 2023 general elections, has encountered difficulties in paying its numerous recruits for the past three months.

According to a leaked FAZ strategic plan recently revealed to the media, the recruits are referred to as “volunteers” and are estimated to be around 5,910 in number.

Each of Zimbabwe’s 1,970 wards incorporates at least three volunteers, tasked with assessing the electorate and mobilizing support for Mnangagwa, who seeks a second five-year term as the Zanu PF presidential candidate.

Mnangagwa assumed power in November 2017 following a military-assisted takeover, succeeding the late Robert Mugabe, who had been in office since the country gained independence in 1980. He served in a caretaker capacity until the July 2018 elections, narrowly winning against Nelson Chamisa of the MDC-A, who unsuccessfully contested the presidential election result that same year.

NewHub interviewed FAZ volunteers, many of whom were transported to Chipinge in Manicaland province for the Zanu PF election launch in June. These volunteers confirmed that they had not received payment for the past three months.

The volunteers, who disclosed that they had not signed contracts for their involvement in the campaign, were initially receiving a monthly stipend of US$380 since the beginning of this year.

“Our working conditions are challenging. It’s been three months without salaries, yet our superiors continue to instruct us to go out daily and recruit new members, ensure that registered individuals in the wards are approached, and gather intelligence on opposition activities,” said one of the recruits, speaking anonymously.

Similar to most other volunteers, this individual is unemployed and operates within a rural ward in the Midlands province.

The recruits also mentioned that tablets were provided to them to input information about potential voters, including phone numbers, addresses, voter registration status, and party affiliation. Individuals who haven’t registered as voters or whose party affiliation remains unclear are categorized as “pending,” requiring constant follow-ups.

“We have to fund our own campaigns. Personally, I constantly rely on my parents for money to buy data and airtime. What exacerbates the situation is the lack of clarity regarding whom to approach to address our concerns, as FAZ’s organizational structure is unclear,” added another recruit from Masvingo. “We’re just holding on because we hope that our hard work will be rewarded with projects and employment.”

The volunteers stated that their main contact points were junior CIO operatives, who would gather situation reports from them.

Reports suggest that FAZ, which allegedly received US$10 million from the government and other undisclosed sources recently, had been allocating over US$2 million per month to compensate the recruits.

The recruits interviewed by NewsHub expressed concern that the association might have depleted its funds or that the allocated funds were being misused for personal gain by the higher-ups.

Although earlier reports indicated that FAZ had received 200 off-road vehicles for mobilization campaigns across the ten provinces, the volunteers revealed that they were utilizing their personal resources for intra- and inter-ward travel.

Although they were promised a minibus per province, none had been provided.

Initially, the volunteers were restricted to their respective wards, but they have now been instructed to target voters from outside their areas.

In contrast, they noted that members of Heritage, a secretive military group with a similar role to FAZ recruits, were equipped with motorcycles for their operations.

The recruits accused FAZ leadership of favoring Heritage in terms of fund allocation.

The Heritage operatives are considerably fewer in number, with only three assigned to each province.

CCC All Talk and No Chalk in 2023 Elections: Mavaza

By Dr. Masimba Mavaza | In the upcoming 2023 elections in Zimbabwe, it is evident that the opposition parties have failed to provide a credible alternative to the ruling ZANU PF party. The absence of a strong and competent opposition has become a significant hurdle, making it unlikely that a proper opposition will emerge before the August 23, 2023 election date.

Throughout the world, it is often the incumbent government that loses elections rather than the opposition winning them. Merely pointing out the flaws of the ruling party is insufficient for the opposition to secure victory. They must prove their competency and pass a basic test to be considered for office. Unfortunately, no party in Zimbabwe currently resembles a credible opposition or a government in waiting.

The largest opposition party, CCC (Constitutional Crisis Coalition), has failed to unite the people and faces a significant challenge in doing so. This absence of a strong opposition is particularly striking given the precarious position of the government. The ruling party has demonstrated its capability to unite the country and instill hope in the citizens.

When it comes to changing the party in power, it is less about a positive vote for the opposition and more about a negative vote against the governing party. In Zimbabwe, the people clearly understand that ZANU PF has maintained its hold on power through internal structures that safeguard the country’s democracy. This resolute independence has made ZANU PF a party worth voting for as it has shown its commitment to defending the principles that the people hold dear. Over the past five years, President Emmerson Dambudzo Mnangagwa has displayed the ability to defend the government through unity in the cabinet, instilling confidence in the citizens through his credibility, personality, and policy scrutiny.

The new dispensation has introduced significant changes, demonstrating that ZANU PF can bring fresh ideas and run effective campaigns against the opposition. It has also gained the support of both domestic and foreign media. The success of the new dispensation can be attributed to its effective media campaigns, developmental initiatives, and the elevation of Zimbabwe to a middle-income economy. On the other hand, the CCC politicians are well aware that their party will not come into power until the electorate becomes disillusioned with the government and decides to vote them out. Consequently, they resort to sabotaging the country in hopes of inciting rebellion among the population.

In light of these factors, it is clear that the CCC is ill-prepared to win the election because Zimbabweans are not yet sufficiently dissatisfied with President Mnangagwa and ZANU PF to vote them out. The CCC must patiently wait until enough people are unhappy with ZANU PF. Changing the party in power after just one term is a daunting task, as the incumbent holds the advantage unless a majority of voters become disenchanted. It is unlikely that President Mnangagwa can be removed from office before 2028, as he has assembled a strong cabinet and front bench team that is politically aligned with him.

Unfortunately, the challenges facing the opposition extend beyond the CCC. Mwonzora’s MDC (Movement for Democratic Change) has also failed to fulfill its role as a proper opposition. The formation of the CCC has thrown the opposition into disarray. The leadership contest within the MDC was marred by farcical proceedings, barring the most credible candidates for procedural reasons. The reluctant winner, Mwonzora, has been vocal but largely inactive. The situation escalated into violence during an MDC meeting, further deepening the disarray. Komichi, the leadership frontrunner, and Mudzuri have since left the party, stating that it is in a ‘death spiral’. The opposition’s financial constraints have also hindered it.

Chamisa Tells His Supporters To Attend Zanu PF Rallies For Their Safety

Opposition Citizens Coalition for Change (CCC) leader Nelson Chamisa has advised his supporters to attend Zanu PF campaign rallies for their safety, but vote it out in the ballot box on August 23.

This comes amid reports of rising political tension mostly in the rural areas, where members of a shadowy Zanu PF affiliate, Forever Associates Zimbabwe, are said to be conducting door-to-door campaigns warning villagers against voting for opposition candidates.

Addressing hundreds of party supporters and aspiring councillors at an opposition member’s homestead in Mahusekwa, Marondera West constituency on Saturday, Chamisa bemoaned the continued victimisation of his supporters.

“Let’s go and vote, but in the meantime, apply the mango strategy — yellow inside and green outside. When they chant Zanu PF slogans, join them. We don’t want you to get killed for politics. But when you go to vote, you just know whom you will vote for,” he said.

“I acknowledge the presence of traditional leaders here. I have received information that some were being victimised. If one has support, he can’t victimise people. When you see a man carrying a stick to bed, it means there is no longer love at all.

“Zanu PF knows it does not have support at all. When we get into power, we will not change the traditional leadership. When we get into power, we will not seek the support of the traditional leadership. We will make them stay out of politics for them to perform their mandate of being the custodians of our culture,” he said.

Chamisa accused the ruling party of paying some of its members to contest the upcoming polls as CCC candidates to confuse the electorate and divide the opposition vote.

“I see the police have tightened security in this locality, but it does not surprise me. I know it. Panofamba mhondoro, mashizha anodonha. Where a giant walks, leaves scatter.

“They (Zanu PF) are panicking. Change is nigh but you need to be strong. Some of us are now getting paid because they know that they will not win in a fair competition.

“That is why they fielded double candidates in some constituencies for our party. But it will not destroy us. Our faith is in Jesus.

Four Appear In Court For Lesotho Broadcaster’s Murder

Four suspects accused of murdering the Lesotho broadcaster Ralikonelo Joki are expected to appear in court on 4 July 2023.

The four, Mothusi Tlelase (31), Sootho Liphoto (35), Kamo Phakoe (35), and Moabi Sesioana (32), appeared before a magistrate on 26 June 2023 and were remanded in custody to 4 July 2023. 

Police say investigations are still ongoing.

Joki, popularly known as Leqhasha, was shot and killed outside his workplace in Maseru, Lesotho’s capital. 

“In that upon or about May 24, 2023 and at or near Tšenolo FM, Lower Thamae in the district of Maseru, the said accused sharing common intention or purpose to pursue an unlawful act together and in the pursuit of such purpose did perform an unlawful act or omission with intention of causing the death of Ralikonelo Joki, such death resulting from their act or omission,” reads the charge sheet.

“The said accused did thereby contravene the provisions of the code as aforementioned.”

The four, who face another murder charge have been advised to apply to the High Court for bail.

He attributed this achievement to improved power generation capacity, including the completion of the Hwange Thermal Power Station Units 7 and 8 expansion projects, solar park developments, and increased output from the Kariba Hydro-Power Station. While the government hails these milestones, critics argue that the delays in project completion, corruption, and the upcoming elections overshadow the progress made in the power sector.

Medical Doctor Arrested for Allegedly Stealing 254 Cows

By A Correspondent | In a shocking turn of events, a retired medical doctor from Chiredzi, Tungamirai Rukatya, has been arrested on charges of stealing 254 cattle with an estimated value of US$101,600. Dr. Rukatya appeared before Magistrate Brian Munyaradzi this week to face the accusations, which allegedly took place between 2013 and 2021. The case, registered as CR179/02/23, has been adjourned to July 5, 2023, for further trial proceedings.

According to court documents, the retired doctor was entrusted with the management of a farm owned by Tony Sarpo. As part of an agreement, Gary Warth paid 24 cattle annually to graze in the fields on the farm. However, Dr. Rukatya is accused of taking control of 96 cattle paid by Warth and an additional 158 cattle that belonged to Sarpo himself.

Solomon Mateta, the loss control officer from Hothfield Enterprises, provided testimony in court. Mateta revealed that Tony Sarpo held full ownership of Oscro Farm and Hothfield Enterprises, and he was also a 50% shareholder in Towfin Investment, a farm owned by Dr. Rukatya. Sarpo had a total of 158 cattle across these properties.

The agreement between Tony Sarpo and Gary Warth dates back to 2009 when it was mutually decided that Warth’s cattle would graze in Hothfield and Oscro farms. In exchange, Warth would annually pay 24 cattle as grazing fees. The initial payment of 24 heifers was made in 2010.

During the investigation, it was discovered that Theresa Warth had sent an email to Tony Sarpo, confirming that the cattle payments were made between June 2009 and June 2010. However, when Sarpo demanded his cattle back, Dr. Rukatya allegedly informed him that nothing remained. Subsequently, after police intervention, Gary Warth confirmed that he had given Dr. Rukatya a total of 96 cattle, resulting in the alleged theft of 254 cattle in total.

In addition to the cattle theft charges, Dr. Rukatya is also facing separate allegations of stealing a 15,000-litre tank valued at US$8,000. It is alleged that he sold the tank to ICP in Chiredzi. This case has been registered as CRB 619/23.

As the trial continues, authorities are investigating the full extent of Dr. Rukatya’s involvement in these alleged crimes. The retired doctor, who currently operates a butchery, will have to await the next trial date to defend himself against the charges he faces.

School Closes Over Satanism Fears

MASVINGO – Shindi Secondary in Chivi has closed after allegations that pupils are collapsing at school and after that they see a teacher (named) having magical sex (mubobobo) with them.

The school which is in Ward 26 was closed on June 13, 2023, after an outcry from parents over the satanic allegations. Sources said about 20 pupils, mainly girls collapsed every day.

The school is expected to reopen after the accused teacher leaves the School.

Chivi District Schools Inspector (DSI) Isaac Gwamuri, confirmed the closure but could not comment to The Mirror as he said he was away in Chinhoyi.

“The school is closed after parents complained about suspected satanic activities. But I cannot comment right away because I am in Chinhoyi,’’ said Gwamuri.

Shindi Deputy Head, Tavonga Chakawa referred all questions to the DSI.

The Mirror has a letter dated June 13, 2023, written to the DSI by Chief Shindi accusing the teacher of belonging to a satanic cult and causing problems in the school.

This is not the first that a teacher had caused problems with mubobobo at a school. At a certain school in Buhera, a teacher had to be removed after allegedly terrorizing female teachers both married and unmarried.

Sources said the teacher uses mubobobo on girls both at school and at home. At school, pupils allegedly shouted out the teacher’s name after collapsing, according to Chief Shindi’s letter in the hands of The Mirror.

PRESIDENT Emmerson Mnangagwa says the current generation has the duty to protect the vision and legacy of the founding fathers to ensure the country remains in the hands of its people.

He was speaking at a ZANU PF rally in Bulilima District of Matabeleland South this Saturday.

The rally coincided with the 24th anniversary of the death of Father Zimbabwe, Dr Joshua Nkomo.

President Mnangagwa began his address by honouring the late national hero and other luminaries from Matabeleland South Province who were instrumental in the liberation struggle.

“We have come to the province that gave our country some of our revolutionary luminaries like Dr Nkomo. Most importantly we chose 1 July because it is Father Zimbabwe, Chibwechitedza’s 24th anniversary,” said the President.

President Mnangagwa said the current generation has the burden to carry forward the vision of the founding fathers to ensure Zimbabwe’s sovereignty is protected.

The President noted that the thousands who attended the rally are a clear indication to the country’s detractors that ZANU PF is loved by its people. He emphasised that Zimbabweans will remain united despite efforts to sow seeds of disharmony by Western powers.

“Well done Matabeleland South, you support your party and this is a vivid demonstration to our detractor. They should come and see how ZANU PF is loved by its people. They wish to divide us but no, we shall never be divided. You can spend your money but we the people of Zimbabwe shall remain united against all odds.”

The call for peace, love and unity remains at the core of President Mnangagwa’s message during this election season.

“The journalists who are representing the white people, tell them that ZANU PF is loved by the people, others will be barking, and we will be ruling. We will maintain peace, no one should teach us democracy, we are democrats,” he said.

President Mnangagwa used the platform to address some of the issues affecting the economy, particularly price hikes. He warned those hoarding basic commodities, seeking to sell them at higher prices.

“We are being attacked currently with price hikes, just when we announced that we are going for elections some decided to hike prices. I am told that there are Indians who are stocking goods to then sell at high prices. Let me warn them, if they want to hoard goods they should do it in their own countries. We will investigate them,” he said.

School Blocks Auditors

MASVINGO – Ndarama High School head in Masvingo, Oddy Matongo has barred an external forensic auditor from looking into the school’s books of accounts much to the chagrin of parents who have always complained against the alleged misuse of school funds.

Ndarama SDA chairman Martin Makweza said the auditor went to the school on Monday last week to get certain books of accounts but the head refused to hand them over insisting that the auditor must first look into previous sets of books. However, the same books he wanted looked into are missing from the school and are allegedly being kept by a former SDA chairperson Enesia Chekacheke.Parents told The Mirror that the current SDA suspects systematic embezzlement of funds from the school.

Incidentally parents had to go to court to remove a previous chairperson Ray Muzenda who refused to step down after serving in that position for 18 years.

Matongo declined to comment and referred The Mirror to the District Schools Inspector (DSI) Ismael Chigaba. Chigaba said Ndarama is a Government school which can only be audited by Government auditors. “We have Government auditors, they are the ones who can only carry out an audit at a Government school and not external auditors, that’s the procedure and parents may not be aware of that. There are Government auditors who carried out an audit in January and the results were sent to the Ministry and they responded. Facts About Sanitation And Hygiene

Half of the world’s population still does not have adequate access to safe drinking water, sanitation and hygiene (WASH) which could have prevented at least 1.4 million deaths and 74 million disability-adjusted life years in 2019, according to the latest report by the World Health Organization (WHO) and an accompanying article published in The Lancet.

“With growing WASH-related health risks seen already today through conflicts, the emergence of antimicrobial resistance, the re-emergence of cholera hotspots, and the long-term threats from climate change, the imperative to invest is stronger than ever” said Dr Maria Neira, Director, WHO Department of Environment, Climate Change and Health. “We have seen improvements in WASH service levels over the last 10 years, but progress is uneven and insufficient”

Burden of disease attributable to unsafe drinking water, sanitation, and hygiene: 2019 update presents estimates of the burden of disease attributable to unsafe drinking water, sanitation and hygiene for 183 WHO Member States disaggregated by region, age and sex for the year 2019. The estimates are based on four health outcomes – diarrhoea, acute respiratory infections, undernutrition, and soil-transmitted helminthiases.

Diarrhoeal disease accounted for most of the attributable burden, with over one million deaths and 55 million DALYs. The second largest contributor was acute respiratory infections from inadequate hand hygiene, which was linked to 356 000 deaths and 17 million DALYs.

Among children under five, unsafe WASH was responsible for 395 000 deaths and 37 million DALYs, representing 7.6% of all deaths and 7.5% of all DALYs in this age group. This included 273 000 deaths from diarrhoea and 112 000 deaths from acute respiratory infections.

These diseases are the top two infectious causes of death for children under five globally.

Important disparities were noted between regions and income groups. More than three-quarters of all WASH-attributable deaths occurred in the WHO African and South-East Asia regions, while 89% of attributable deaths were from low- and lower-middle income countries. However, even high-income countries are at risk, as 18% of their diarrhoeal disease burden could be prevented through improved hand hygiene practices.

While these estimates included four health outcomes for which data were available to quantify the impact, the true burden is likely to be much higher.

The impacts of unsafe WASH on health are wide-ranging and go beyond disease by affecting social and mental well-being. In addition, climate change is likely to exacerbate many WASH-related diseases and risks which are not fully captured in the present estimates.

To reduce the WASH-attributable burden of disease, WHO urges governments to take the following actions with support from UN agencies, multilateral partners, the private sector and civil society organizations:

Radically accelerate action to make safe WASH a reality for all.

The mid-term comprehensive review of the International Decade for Action Towards the Sustainable Development Goals saw renewed commitments from governments to accelerate progress towards the goal of universal access to safe WASH.

By quantifying for the first time the health gains associated with higher WASH service levels, the updated estimates provide strong evidence to support efforts to take these commitments to action.
Focus efforts on the poorest and most disadvantaged.

The burden of disease is largely driven by inadequate access in low- and middle- income countries, and national estimates on WASH access often hide disparities within countries. Access to WASH services is typically lower among rural populations and lower socio-economic groups.

Even in high-income countries, where access to safely managed drinking-water and sanitation services is generally high, certain marginalized communities are underserved and face higher risks.

Adapt national monitoring systems to improve data on population exposure to safely managed services.

Data on higher levels of WASH services remain sparse in many countries. Governments should adapt national and local monitoring systems taking into consideration the higher service levels called for in the SDG framework, enabling a more accurate reflection of the full burden of disease associated with unsafe WASH.

“It is clear that inadequate access to safe water, sanitation, and hygiene services continues to pose a significant, and preventable, health risk, particularly to the most vulnerable populations,” said Mr. Bruce Gordon, Head, WHO Water, Sanitation, Hygiene and Health Unit. “The health benefits, as quantified in the report, are immense. Prioritizing those most in need is not just a moral imperative; it is key to addressing the disproportionate disease burden in low and middle-income countries and among marginalized groups in high-income countries.”

To support governments, WHO also today released a new tool to model disease impacts from different WASH scenarios. The tool will foster informed policy-making, guide targeted interventions, and support strategic resource allocation for WASH programming.

Chitembwe Speaks On Caps United Loss

CAPS United coach Lloyd Chitembwe believes his charges played good football despite losing to Highlanders in Sunday’s Castle Lager Premiership matchday 13.

The Green Machine suffered their second successive loss after going down 2-1 at Barbourfields Stadium.

The Harare giants, who were forced to host the tie in Bulawayo due unavailability of standard. grounds in the capital, opened the scoring in the 8th minute through Joseph Tulani.

Mubobobo Teacher Causes Havoc At School

MASVINGO – Shindi Secondary in Chivi has closed after allegations that pupils are collapsing at school and after that they see a teacher (named) having magical sex (mubobobo) with them.

The school which is in Ward 26 was closed on June 13, 2023, after an outcry from parents over the satanic allegations. Sources said about 20 pupils, mainly girls collapsed every day.

The school is expected to reopen after the accused teacher leaves the School.

Change Chorus Spreads Rapidly

Fresh fears grip Belgravia residents after murder at pub

By A Correspondent| Residents of Belgravia in Harare have raised fresh fears over violence and robbery following the recent tragic events in which a man was callously murdered at a local pub.

David Matambo was allegedly killed by Calisto Murawo at Afro 161 Bar and Restaurant popularly known as KwaBelinda.

The death of the reveler comes in the midst of Belgravia residence call for the local authorities to intervene in the probing of certain recreational activities in which a casino Sunshine City is at the center of the storm.

Residence from Belgravia recently wrote a letter to the Zimbabwe Anti-Corruption Commission (ZACC) alleging illegal operations at the casino red flagging it as a haven of violence and thuggery.

In a letter to ZACC that has been seen by this publication, residents said, “It has become a cause of concern among residents that the establishment of the casino in the neighborhood is posing a serious threat to the peace and security of the residents which has further raised questions over the casino’s compliance with city by-laws.

“It is our wish that ZACC authorities make security compliance checks into the casino establishment including its legal fulfillment to the regulating laws governing the operations of casinos in the country,” reads the letter.

Zimbabwe National Organisation of Association of Residents Trust (ZNOART) chairperson Cde Shalvar Chikomba has called for the closing of the casinos and bars designated in local residential areas.

“Initially when Harare City council executed a change of land use they were supposed to engage us residents, however because of corruption they went on without our engagement.

“Currently, Belgravia has noise pollution, values are declining and as residents, we think casinos should not be located in areas where people live because it affects them due to crime imagine we already have the recent murder of the reveler, we call for the shut down of this casino too, ” said Chikomba

The business community in Belgravia has implored local authorities to probe ownership and control patterns of certain businesses in the neighborhood.

“It is important that certain business activities be monitored and vetted so that local residents are safer from certain criminal activities, usually some of the businesses do not comply with the country’s registration laws as they will be some corrupt political leaders benefitting from these set-ups and at times if any crime is committed they tend to go unattended because of the political influence they exert on the justice systems,” said a member of the Belgravia business community.

Recently, the country’s immigration police pounced on the casino allegedly investigating the Chinese business owners over the lack of relevant paperwork needed in the operations of the casino.

An official with the Ministry of Home Affairs and Cultural Heritage revealed that several casinos run by Chinese are not licensed as they tend to be cleared through political lines, “all we know is that licenses are not issued properly and vetting of casinos is not a transparent process, that’s all I can say,” said the official who declined to be named.

The New Conservatives Group on Monday will demand the struggling PM adopt their extreme plan for immigration.

Peeping Tom In Court On Attempted Rape Charges

A 40-year-old man from Esigodini who used to masturbate while peeping through the bathroom window when his cousin’s wife was bathing has appeared in court facing rape charges.

This was after he allegedly sexually attacked his cousin’s wife while she was bathing.

He appeared before Esigodini resident magistrate Jeconia Prince Ncube.

He was not asked to plead and was remanded in custody to 5 July where he is set to appear at Gwanda regional magistrate court for commencement of trial. A court heard that on a date not known to the prosecutor but during this month Mpofu was requested by his cousin to accompany his wife from her workplace to her home every day after knocking off from work.

The court heard that while on the way Mpofu would propose love to his cousin’s wife who would turn him down.

It is alleged that upon noticing that his love proposals were not being accepted he resorted to groping her breasts and bums.

When they got to her home most of the time he would leave intending to go to his home but would return after a few minutes to peep through the bathroom window when his cousin’s wife was bathing, the court heard.

The court further heard that while peeping through the window he would be self-pleasuring himself with his eyes glued on her naked body.

His luck, however, ran out the day he failed to control his feelings when he forcefully opened the door and allegedly sexually attacked his cousin’s wife.

The alleged victim reported the incident to the police leading to his arrest.

Mbare Woman Backtracks On Rape Charges Against Hubby

A Mbare woman claims she made a false rape report against her husband after he failed to buy maternity preparation.

Kesy Hwengwere, 37, of Daniel Street, told H-Metro that her sister forced her to lodge a police report against her husband, Munyaradzi Hugh, 29, and is now regretting the decision.

Kesy claimed that Munyaradzi raped her sometime in January and she fell pregnant before they started living together as husband and wife.

“I feel sorry for being forced to lodge a police report against my husband,” said Kesy.

“My sister was affected when she learnt that Munyaradzi was failing to buy maternity preparation for the baby I was expecting.
Our marriage started sometime in May, after Munyaradzi impregnated me in January.

“We even made false reports that we are related when the truth is that Munyaradzi is the younger brother to the husband of my sister.

“Panezvatakanga tabvumirana naMunyaradzi zvaasina kuzadzisa saka takazofunga zvekumusungisa.

“I regret my actions but Munyaradzi is in police holding cells at Stodart Police Station,” said Kesy.
Harare provincial police spokesperson, Inspector Luckmore Chikanza, confirmed the arrest of Munyaradzi.

“Police arrested a Mbare man for rape,” said Insp Chakanza.

“Circumstances are that the complainant and accused are aunt and uncle,” he said.

Munyaradzi is expected to appear in court today.

Super Dad Refuses To Pay Maintanance For 13th Child

A Harare man on Friday refused to pay US$250 to support his nine-year-old daughter saying he had a maintenance bill for 12 of his other children.

Simbarashe Jari told Harare magistrate Ayanda Dlamini that his ex-wife Yvette Kutyauripo was making outrageous demands before offering to pay US$20.

“She will have to manage with the US$20 offer because my other 12 kids require money for upkeep,” he said.

Kutyauripo refused the offer saying Jari was a man of means.

“He told me that he was a director of a company and earned US$1 000,” she said.

“He is also into the business of buying and selling cars and owns a grocery store in Mazowe.”

She said her ex-husband only had six other children, not 12. Dlamini ordered Jari to pay US$60 towards maintenance.

By-President Emmerson Mnangagwa has singled out Indian businessmen and Innscor Africa Limited for allegedly hoarding products resulting in artificial shortages and price increases.

Speaking at a ZANU PF rally at Nyele Primary School in Bulilima, Matabeleland South Province on Saturday, 01 July, Mnangagwa said those “unscrupulous” businesses are enemies of the Government.

He warned that if the allegations are true, the Indians will be deported, and their goods will be confiscated and distributed to ZANU PF members.

The Sunday Mail quoted Mnangagwa as saying:
We are being attacked, currently, nema price achikwira (through price increases). Why? Just when we announced that we are going for a general election, our enemies decided to cause problems among our people, ma-prices kutanga kukwira kunana Inscor (Inscor started to increase prices).
I have been told today that some Indians in Harare are stocking basic goods in Harare.

If they want to hoard, ngavadzokere vanoita hoard kunyika dzekwavo (they should go back and do that in their countries of origin) not in Zimbabwe.

Mthuli Blocks US Dollar Council Billing Proposal

By- The Finance Ministry has blocked a move by the Harare City Council (HCC) to start billing its clients in US dollars. The council had recently announced that it would begin charging its services in foreign currency from July 1, 2023, to preserve value for money and hedge against inflation. The council said:

The need to preserve value against rate losses has necessitated this move. City of Harare thanks its valued residents for the support in funding service delivery through payment of rates and other services.

However, the Finance Ministry’s Secretary, George Guvamatanga, has described the proposal as unlawful, stating that it violates Statutory Instrument (SI) 142 of 2019. The SI prohibits the use of foreign currency for domestic transactions, except if provided for by the law or if exempted in terms of the Exchange Control Regulations. He further explained that any person with free funds may elect to pay for goods and services chargeable in Zimbabwe dollars, in foreign currency using their free funds at the ruling rate on the date of payment. Guvamatanga has ordered the HCC to withdraw its notice and comply with relevant laws. He said:

Under this, in March 2020, the government published SI 85 of 2020 which, in section 2(2) provides that any person with free funds may elect to pay for goods and services chargeable in Zimbabwe dollars, in foreign currency using his or her free funds at the ruling rate on the date of payment.

The payment, in foreign currency by any person paying for goods and services should be at his/her option unless otherwise exempted and cannot be compelled to pay in foreign currency.

The charging and billing in US dollar by the City of Harare or any local authority is unlawful and contravenes the above-cited laws. As the city council falls under your purview, may you ensure that the City of Harare withdraws its notice and all local authorities comply with relevant laws. Be guided accordingly.

Lawsuits To Disqualify Chamisa’s CCC Party

Lawsuit Challenges Zimbabwe Electoral Commission Over Alleged Irregularities, Sparking Political Controversy.

In a significant legal development ahead of Zimbabwe’s upcoming August 23 harmonized elections, the Zimbabwe Electoral Commission (ZEC) is facing a lawsuit from registered voters in Bulawayo. The lawsuit alleges that ZEC accepted nomination papers and candidatures from various political parties, including the Citizens Coalition for Change (CCC), outside the legally prescribed timeframes. While the court processes appear to be routine, there are claims of a government plot aimed at sabotaging Nelson Chamisa’s CCC party members’ chances of winning parliamentary and presidential power.

The Nomination Court, which convened on June 21 to accept papers from aspiring candidates, was followed by ZEC’s decision to extend the deadline to the next day in order to accommodate candidates who failed to file their nomination papers on time.

However, it has come to light that candidates from different parties, including the CCC, Zapu, Free Zim Congress, and the Zimbabwe African National Congress (ZANC), submitted their nomination papers after the 4 PM deadline.

In response to these alleged irregularities, twelve registered voters in Bulawayo filed urgent chamber applications for a declaratory order at the Bulawayo High Court on Friday night. The applicants are challenging ZEC’s decision to accept the nomination papers from opposition party candidates and are seeking the disqualification of the aspiring Members of Parliament who filed their papers outside the legally prescribed timeframes.

One of the applicants, Ms. Rachel Dube, a registered voter in the Mpopoma/Mzilikazi constituency, filed the application under case number HC 1362/23 through her legal representatives, Cheda and Cheda Associates. In her founding affidavit, Ms. Dube argues that ZEC’s decision to accept the nomination papers from the cited respondents is illegal and should be declared null and void.

Ms. Dube claims that prospective election participants were given ample time to ensure that their paperwork and affairs were in order ahead of the nomination day. However, she alleges that some political outfits, including the CCC, failed to meet the requirements. According to her affidavit, the nomination papers of the CCC and other respondents were in disarray, resulting in their initial rejection by the Nomination Court. She further contends that the respondents did not resubmit their nomination papers before the 4 PM deadline and were absent from the Nomination Court room or premises.

Ms. Dube asserts that the actions taken by the provincial elections officer were solely aimed at accommodating specific candidates and their colleagues from the same political parties in other constituencies in Bulawayo. She argues that ZEC violated the Electoral Act by accepting the candidature of the respondents after the 4 PM deadline, despite their absence from the Nomination Court.

Seeking urgent court intervention, Ms. Dube’s application requests an order prohibiting ZEC from including the names of the respondents in the preparation of ballot papers for the general elections. She clarifies that, as a registered voter and not a candidate, her application is within the jurisdiction of the High Court.

Ms. Dube’s application also seeks an order declaring the decision by the provincial elections officer to accept the respondents’ nomination papers null and void. Additionally, she requests that the respondents jointly and severally bear the legal costs.

The respondents, including ZEC, the mentioned candidates, and others, are yet to respond to the lawsuit. However, the legal challenge has attracted attention, and some individuals, such as Zanu-PF Treasurer General Cde Patrick Chinamasa, have expressed their views. Cde Chinamasa stated that it was illegal for ZEC to receive nomination papers awaiting the signature of CCC officials in Harare at the time the Nomination Court closed

on June 21. He also criticized the acceptance of nomination fees after the 4 PM deadline.

It is important to note that while claims of a government operation to sabotage Nelson Chamisa’s CCC party members’ candidature have been made, they remain unproven and disputed.

Northern Region Soccer League log leaders Black Mambas underlined their title credentials with an impressive 1-0 victory over Golden Eagles at Ellis Robins on Saturday.

John ‘Toto’ Ncube’s charges remain the only team yet to taste defeat this season.

Tafadzwa George’s 63rd minute free kick was all the Police side needed to collect maximum points in front of a decent crowd at the ‘Eagle’s Nest’.

The loss was Eagles’ second in their last three matches, having lost 1-2 to Omnia on June 17.

FC Platinum Bounce Back

FC Platinum coach Norman Mapeza believes his charges have rectified the defensive mistakes which resulted in their slow start to the 2023 Castle Lager Premier Soccer League season.

The Platinum miners did not have the best of starts to their title defence, as they lost three of their opening nine games and conceded 11 goals in the process.

But after four wins on the trot, in which they have not conceded, Mapeza feels his charges are back on track.

“We are moving in the right direction now, we just have to keep the momentum going,” Mapeza said after side’s 2-0 victory over Chicken Inn at Mandava Stadium today, courtesy of goals on either side of the half time break from Thandolwenkosi Ngwenya and Walter Musona.

“A few weeks ago, people were saying we were conceding and conceding, we have rectified our problems.

“It’s always good to out there and get a clean sheet, it gives the goalkeepers, the defenders and everybody else, some confidence,” added the former Warriors captain.

Despite the resurgence, Mapeza insists the defending champions, who face Dynamos at Babourfields Stadium next week, still have a lot of work to do.

“We still have to keep working hard. We have a difficult game coming next week against Dynamos, so we have to keep working hard,” said Mapeza.

Mapeza also confirmed that Musona, who limped off with six minutes left of play and was replaced by Perfect Chikwende, just had cramps and the injury isn’t a serious one.-Soccer24 News

MASVINGO – A prominent bishop and leader of Zion Christian Church Kumuka Kwavakafa (ZCCKK), Nhaudzashe Lyphet Matenda Mugaviri has been suspended from conducting church services after he allegedly proposed love and sent his nude pictures to his elder brother’s daughter-in-law.

Bishop Matenda Mugaviri whose church is headquartered in Rutenga has three wives.

Lesly Mugaviri, the husband to Olinda Mashavave who received the nude messages confirmed the story to The Mirror. He said that his uncle started making advances towards his wife in March after a visit to his family in Harare where he was also attending a church meeting.

The Mirror has the bishop’s nude picture and steamy chats he made on WhatsApp.

The Mirror called Matenda- Mugaviri for a comment but he quickly said it’s a wrong number after realizing that he was speaking to The Mirror. Lesly said his uncle undertook to pay him three beasts by April 4, 2023, after he was caught but has since reneged on the pledge.

Illegal Miners Disrupt Farming Scheme

OVER 100 farmers from the Bannockburn Irrigation Scheme in the Mhondongori area of Zvishavane have expressed concern over illegal chrome miners who have encroached into the scheme, thereby disrupting farming activities.

Although mining has been identified as key to achieving the National Development Strategy One goals, illegal mining activities at the irrigation scheme are hindering development and threatening food security in the area.

Belated Desertification and Drought Day commemorations in the area saw farmers from the scheme lamenting the rampant illegal mining activities which are disrupting productivity.

“This has been going on for years and our hope for food security is fading because these illegal miners are killing our irrigation scheme. If they were to do sustainable mining it was going to well but look now it is bad. Some villagers have fallen and died in the pits, and our livestock is also dying as a result,” said farmers who spoke to the ZBC News crew.

According to the Environmental Management Agency in the Midlands province, security measures are being put in place to protect the irrigation scheme.

The Second Republic is on a drive to promote irrigation agriculture to mitigate the effects of climate change and guarantee food security.-ZBC News
