Tshabangu Fired!

By James Gwati-Self-styled Citizens Coalition for Change (CCC) interim national chairperson Maxwell Omen Murindagomo claims the party’s self-proclaimed acting secretary general, Sengezo Tshabangu has been suspended from his position with immediate effect.

In a letter sent to Local Government Minister Winston Chitando, dated 06 November 2023, Murindagomo said CCC’s Citizens Assembly Meeting held in Bulawayo on Sunday resolved to suspend Tshabangu for unilaterally recalling party representatives.

He also said Zibusiso Tshongwe has been appointed as the party’s interim National Secretary General, taking over from Tshabangu. Reads the letter:

Kindly be advised that the Citizens Coalition for Change (CCC), Political Party has fired its Interim Secretary General Sengezo Tshabangu with immediate effect. The Citizens movement reached this decision at its Citizens Assembly Meeting held in Bulawayo on Sunday 05 November 2023.

The reason for the expulsion emanates from the unilateral decision by Sengezo Tshabangu that led to the recall of Citizens Coalition For Change CCC Councillors.

As of today, you’re advised not to entertain any letter or correspondence from Sengezo Tshabangu.

The same meeting has appointed Zibusiso Tshongwe as interim National Secretary General for Citizen Coalition for Change (CCC)

Kindly proceed in terms of the relevant provision of the Constitution of Zimbabwe to notify the Zimbabwe Electoral Commission ZEC of our resolution.

Meanwhile, on 07 November 2023, Tshabangu ordered recalls on Harare mayor Ian Makone, his deputy Kudzai Kadzombe and seven other city councillors, saying they have “ceased to be members of the Citizens Coalition for Change”.

The councillors recalled by Tshabangu are Makone (Ward 18) Kadzombe (Ward 41), Denford Ngadziore (Ward 16), Lovejoy Chitegu (Ward 36) and Samuel Gwenzi (Ward 5), as well as PR Councillors Chido Hamauswa, Tariboyi Sabina, Florence Cheza and Fadzai Matimba.

Dynamos players refused to train ahead of their Castle Lager Premier Soccer League match against Chicken Inn scheduled for the National Sports Stadium this Sunday, citing outstanding signing on fees and winning bonuses.

Genesis Mangombe’s charges arrived on time for their training session at Alexander Sports Club but immediately informed interim team manager Desmond Mhene of their desire to speak to the club’s leadership before they could commence training.

According to a senior player who spoke to Soccer24 but asked not to be named, Dynamos players are owed winning bonuses for the entire second half of the season.

They were also not paid winning bonuses for the Chibuku Super Cup wins over FC Platinum in the quarter-finals and CAPS United in the semis.

“We are owed winning bonuses for all wins in the second half of the season, that is all I can tell you. We have been patient but today we decided to let the club’s leadership know of our grievances,” said the player.

“We had a meeting, during which they (the executive) told us that they are running around to look for money and pay us,” he added.

Some Dynamos players who joined the club at the beginning of the season have not been paid their signing on fees.

“Some players have not been paid their signing on fees, and in the second half of the season, we didn’t get any winning bonuses, which is weird considering that we were expected to fight for the championship,” said the player.

“No to give excuses, but there was no motivation at all,” he added.

Salaries for DeMbare players are paid by the club’s principal sponsor Sakunda Holdings, while winning bonuses are taken care of by the Moses Maunganidze-led executive.-Soccer24 News

Khayah Cement Restores Operations, Calls Cement Dealers to Order Over Price Madness

By A Correspondent| Giant cement producer, Khayah Cement has announcement the resumption of operations following the restoration of its mill at its Mabvuku plant.

In a press statement, Khayah Cement assured stakeholders and customers that the resumption of operations means they are now prepared to meet the current market demand.

Khayah Cement emphasized their commitment to keeping prices stable, dispelling any speculation about price hikes.

“The recommended retail selling price for PC15 and Supaset remains unchanged at USD 10.50 and USD 11.50, respectively,” said Khaya Cement.

The company’s swift response to restore operations comes amid concerns over a surge in cement prices by some retailers, sparking what many are calling “price madness” in the industry.

Khayah Cement has also appealed to cement dealers to act responsibly and adhere to the recommended retail prices, ensuring fair and reasonable pricing for end-users.

“We have not increased our prices and remain dedicated to providing a steady supply of quality cement to our customers at reasonable rates,” the statement read.

“It is crucial that our retailers recognize the importance of responsible pricing to maintain a healthy and sustainable market,” the company said.

Recently, government announced a raft of measures meant to stabilize cement prices including extending import licenses while also allowing those with free funds to import the product duty free.

No Fissures In CCC, Party Says

OPPOSITION Citizens Coalition for Change (CCC) has watered down rumours of fissures in the party following the recalls of Members of Parliament and councillors.

Tshabangu, the party’s self-appointed interim secretary general withdrew 15 MPs, councillors and senators, threatening to undo the gains of CCC in the August polls.

Speaking at a press conference CCC deputy spokesperson Ostallos Siziba, flanked by the party’s remaining MPs, downplayed any polarization in the opposition.

“There is no organisation without contradictions in this world. We have had debates in the party on which colour we should use. If you report that a certain leader had a different view on the colour which to use then you want to say there are fissures.

“There are no fissures, there are no contradictions, we are a democratic party, we have discourse and we defeat each other at the level of superior logic. Our difference with our opponents is that we do not criminalise holding a different view,” said Siziba.

CCC appears to be bursting in the aftermath of the disputed August elections with reports of disgruntled senior members rife.

Recently, Tshabangu called for the party to revert to 2019 leadership structures when it was MDC Alliance, giving life to purged senior members.

“This thing you are seeing is a Zanu-PF issue, Zanu-PF attacking the authentic opposition. All signs are clear CCC defeated Zanu-PF in this election. We reject the election results because we are very clear that it’s not only a CCC issue.

“They are going after CCC, we are being punished for defeating Zanu-PF. It is an engineered programme by Zanu-PF to try and destroy the authentic opposition in this country. We are very clear that we are not going to accept that. We remain focused. Our objective is to attain political power and govern differently. They do not want people who govern with a difference,” added Siziba.

CCC also professed ignorance over a letter that emerged Wednesday of Maxwell Omen Murindagomo claiming to be interim chairman and firing Tshabangu.

“I do not know that person. I am sure you have followed CCC. I am sure you have not heard that name. CCC does not know the said person,” said Siziba.

By Wilbert Mukori- You can count on MDC/CCC leaders to fight each other like wild cats. If it is not one thing it over half a dozen of the other – all trivial and irrelevant to the long suffering voters who elected them.

“Embattled Citizens Coalition for Change (CCC) has once again been thrown into a political tailspin as self-imposed secretary general Sengezo Tshabangu has recalled Harare Mayor Ian Makone and his deputy Kudzai Kadzombe.” reported Bulawayo 24.

“Barely three months after the general election, Tshabangu’s power trip continues in CCC as he has recalled nine more councillors.

“Ian Makone, Kudzai Kadzombe, Denford Ngadziore, Lovejoy Chitegu, Samuel Gwenzi, Chido Hamauswa, Tiriboyi Sabina, Florence Cheza. Matimba Fadzai, are the latest to be axed by Tshabangu.”

Until Chamisa finally get off his backside and sort out CCC’s constitution, structure and have proper elections; there will be more recalls. 

It was the then USA ambassador to Zimbabwe 2004 to 2007, Chris Dell, reported back to Washington in a leaked cable that Morgan Tsvangirai was “a flawed, indecisive character who would become an albatross round the nation’s neck if he was ever to get into power.” 

The ambassador could have said the same of all the MDC leaders, Tendai Biti, Welshman Ncube, David Coltart, Nelson Chamisa, etc., etc. After 23 years on the political stage, 5 of which in the GNU, MDC/CCC leaders have failed to implement even one token democratic change. 

During the GNU, Mugabe bribed the MDC leaders with the trappings of high office and they forgot about the reforms. And ever since the GNU MDC/CCC have participated in flawed elections to give Zanu PF legitimacy for a share of the spoils of power. 

Whilst ambassador Dell dismissed Tsvangirai as a disaster if he was to be a national leader after meeting the guy a handful of times. Many Zimbabweans have yet to come to the same conclusion even after 23 years and a mountain of evidence of MDC/CCC corruption and breath-taking incompetence. 

Many Zimbabweans are look to CCC to deliver the democratic changes the nation has been dying for, not knowing that Chamisa and company have given up on implementing reforms and have been participating in flawed elections for  share of the spoils. 

In many ways, one can understand why SADC leaders did not want to take Zanu PF to task over the damning SADC election report. It is all very well denying Zanu PF political legitimacy; one has to also consider what next. The prospect of having to work with Nelson Chamisa and his banded mongoose must have frighten the hell out of all the SADC leaders!

Nelson Chamisa and his entourage of MDC/CCC of banded mongoose are indeed the mile-stone round the nation’s neck. Sadly, the people, in their ignorance and naivety are not even aware of it! Ignorance is indeed a curse worse than death!

Fatal accident kills 1

By A Correspondent- The Zimbabwe Republic Police (ZRP) has confirmed a road accident that took place on Wednesday, November 8th, 2023, near Marondera. The accident involved a Mazda BT50 vehicle that veered off the road, hitting a pedestrian, and then overturning, resulting in the death of a passenger.

According to a police report, six other individuals sustained injuries in the accident. Read the report:

The ZRP confirms a fatal road traffic accident which occurred on 08/11/23 at 1230 hours at the 24-kilometre peg along North Road near Summerset area, Marondera where two people were killed whilst six others were injured.

Mazda BT50 vehicle veered off the road and hit a pedestrian before overturning resulting in a passenger being killed. The bodies were taken to Marondera General Hospital mortuary for post-mortem whilst the injured are admitted at the same hospital.

The report from the ZRP does not provide information on the cause of the accident or how the vehicle ended up veering off the road.

The most common causes of road accidents in Zimbabwe include human error, bad weather conditions, poor infrastructure, and mechanical faults. These factors contribute to road hazards and increase the risk of accidents. Road accidents often increase during festive seasons, so it is important for both motorists and pedestrians to remain vigilant at all times. The holiday period brings a higher volume of traffic and sometimes reckless driving, which can lead to more accidents.

This promise, highlighted during a visit to the Hwange Power Station by Energy and Power Development Minister Cde Edgar Moyo, aims to address the energy crisis and bolster key economic sectors.

The assurance hinges on the imminent return of the 300MW Hwange Thermal Power Station Unit 7 and ongoing negotiations to amplify electricity imports and expedite the refurbishment of aging thermal plant units. Minister Moyo attributes the power cuts to diminished domestic generation, primarily due to low water levels at Lake Kariba, severely hindering hydro-power production, and the temporary shutdown of Hwange Thermal Power Station Unit 7 for maintenance.

To ensure sustained power stability, the government is advocating for the modernization of Hwange’s aging units (1 to 6) and the implementation of innovative solutions, including floating solar technology at Lake Kariba and the activation of various independent renewable power producers.

Zimbabwe’s electricity generation recently plummeted to around 1,300MW against a demand of 1,800MW due to scheduled maintenance and reduced capacity at the Kariba Hydro-power Station. This scarcity has forced heavy reliance on Hwange Power Station and imports from regional producers.

Minister Moyo’s statement resonates hope with the expectation of Unit 7’s return, albeit cautioning intermittent breakdowns until the end of the month. ZESA executive chairman, Dr Sydney Gata, emphasized the critical water shortage at Kariba, underlining the pivotal factor contributing to the energy crisis. Dr Gata underscored the pursuit of alternative technologies, primarily PV solar, as a potential remedy to the chronic power deficit.

The announcement is met with understandable skepticism from a populace fatigued by prolonged power outages. The recurrent nature of unfulfilled promises to alleviate load shedding casts doubt on the credibility of this latest timeline. The prospect of the energy crisis being resolved within three weeks is viewed with cautious optimism, while the population remains vigilant for tangible results. Sengezo claims CCC funding

By A Correspondent- Self-imposed Citizens Coalition for Change (CCC) interim secretary general Sengezo Tshabangu has written to the Permanent Secretary of the Ministry of Justice, Legal and Parliamentary Affairs requesting for the disbursement of the political party funding due to the opposition party under the Political Parties Finance Act.

In a letter dated 06 November 2023, Tshabangu also provided the Ministry with the bank details, as he seeks to take full control of the Nelson Chamisa-led party. He wrote:

I am writing in terms of section 3(1) as read with section 3(3) of the Political Parties (Finance) Act (Chapter 2:11) to request the statutory allocation and disbursement of the funding that is due to the Citizens Coalition for Change (CCC) political party, which participated in the 2023 harmonised general election, in which it garnered sufficient seats to qualify for the funds.

Accordingly, we kindly request your good offices to process and disburse the allocation that is due to our party in terms of the Act…

We trust the foregoing is in order, and we stand ready to provide any further particulars that you may require.

The Political Parties Finance Act regulates the financing of political parties in Zimbabwe, and among other provisions, provides for state funding of political parties that receive at least 5% of the total votes cast in a general election.

Previously, the funds that were due to the MDC Alliance were given to the MDC-T led by Douglas Mwonzora. This decision came after the Supreme Court ruled that Nelson Chamisa, who was leading the MDC Alliance, was not the legitimate leader of the MDC party that was a part of the alliance.

This caused anger among the MDC Alliance and some analysts, who believed that the ruling ZANU PF party was using the funds to create divisions and weaken the opposition.

Ambitious Employee Tries To Steal from Boss

Attempted Fuel Theft Allegedly Orchestrated by Employee Ends in $4,500 Heist*

In an ambitious yet failed attempt at robbery, Davison Sibanda, an employee at Trek in Gwabalanda suburb, stands accused of masterminding a plot to steal vast quantities of diesel and petrol from the fuel station. Following the botched attempt, Sibanda reportedly vanished, absconding with $4,500.

The perplexing incident unfolded on Wednesday night, the designated start of Sibanda’s shift, but he inexplicably went missing. The aggrieved owners of the fuel station have taken legal action, filing a theft case against Sibanda at Luveve Police Station under case number 20/11/23.

Extracted WhatsApp messages and audio recordings from Sibanda’s phone, obtained by B-Metro, shed light on his discussions with an individual identified as Mukanya concerning the planned fuel theft. Sibanda appeared insistent on immediate action, stressing the urgency to carry out the theft that night before the owners’ return.

However, the alleged co-conspirator expressed skepticism about the plan’s success and proposed a postponement. Undeterred, Sibanda adamantly rejected the delay, emphasizing the need to proceed with the intended theft as initially planned.

This incident brings attention to a worrying trend of employee involvement in organized robberies targeting their employers within Bulawayo. Inspector Abdenico Ncube had previously highlighted a surge in inside job-related business thefts, raising concerns about security breaches within companies.

The distressed owners of Trek fuel station are earnestly appealing to the public for any information regarding Sibanda’s whereabouts. They encourage individuals with pertinent details to promptly contact the nearest police station to aid in the ongoing investigation.

Zesa employee in soup over US$20k fraud

By A Correspondent- A former Zesa Holdings employee was yesterday arraigned before Harare magistrate Dennis Mangosi on a charge of defrauding the power utility of US$20 456.

Joseph Wagusiwa (39) was granted US$200 bail and the case was remanded to December 1. The complainant in the matter is Zesa Holdings represented by Bodwell Masakadza, a forensic and loss control officer.

Prosecutor Thomas Chanakira alleged that between January 2018 and March 2021, Wagusiwa and his alleged accomplice, Darlington Chiputura, manipulated the firm’s credit systems and created fraudulent credits to Zesa Holdings clients for electricity tokens.

In January 2018, Wagusiwa allegedly advertised on social media that he was selling electricity tokens, and 242 clients purchased the tokens.

It is alleged that Wagusiwa gave Chiputura electricity meter numbers of the clients and he supplied them with electricity tokens. State papers indicate that Chiputura used his EcoCash number to buy electricity tokens for the clients.

The court heard that Wagusiwa would then supply Zesa Holdings with amounts less than the value of the tokens. The matter was uncovered by the complainant following an audit by Grant Thornton Forensic Auditors.

Sengezo Tshabangu Is Mnangagwa’s Son?

Mavis Tshabangu, originally from Gweru, shared a complex history with Mnangagwa. Despite not planning to marry him, she received child support from the current President after conceiving Sengezo during Mnangagwa’s tenure as Minister of State Security under Robert Mugabe.

Later, Mavis married Smart Chilenje, a Zambian national, and they left Sengezo in the custody of Mavis’ parents while starting a new life in Zambia. Sengezo maintained a close relationship with his father, visiting occasionally.

In a surprising turn of events, it has been revealed that Sengezo Tshabangu played a covert role in the 2018 Zimbabwean elections, working as a secret operative for Mnangagwa. His mission was to infiltrate the opposition MDC, then led by the late Morgan Tsvangirayi, providing crucial information to his father.

Sengezo’s intelligence proved pivotal in gaining leverage over political rivals, particularly against Joice Mujuru, the Vice President at the time. Mnangagwa, then Minister of Social Amenities, ultimately secured the Ministry of Defence in 2006 and played a significant role in shaping the political landscape.

Sengezo’s loyalty and valuable insights from within the opposition helped President Mnangagwa navigate critical moments, such as the formation of the Government of National Unity in 2008. Currently, Sengezo is reportedly on a mission to secure a two-thirds majority for ZANU PF, supporting his father’s bid for a third term.

The unfolding allegation sheds suggestions on the intricate political maneuvers within Zimbabwe, exposing the extraordinary relationship between a father and his determined son.

The ZANU PF President, Mnangagwa is still to comment on the matter.

Tungwarara, Scott Sakupwanya Dababy Show Chocks

By A Correspondent| Zanu PF aspiring member of parliament Scott Sakupwanya and Talkchart founder Tempter Tungwarara’s ambitious plan to bring American rapper Dababy to Zimbabwe has encountered a setback.

In a recent statement from Sakupwanya’s Roar Entertainment, the promoter revealed that the decision to cancel the highly anticipated Dababy concert, initially slated for November 17th, 2023, was based on pre-event surveys predicting a lackluster turnout.

The statement read, “Roar Entertainment, one of Zimbabwe’s leading entertainment companies, regrets to announce the cancellation of the highly anticipated Dababy concert, originally scheduled to take place on November 17th, 2023. The Zimbabwean market is currently not ready to host such an internationally acclaimed artist. Our findings highlighted certain challenges that would have compromised the overall success of the event.”

Despite the setback, Roar Entertainment expressed its commitment to providing unforgettable experiences for the Zimbabwean audience and introducing them to renowned artists from around the world.

Of Emmerson Dambudzo Mnangagwa’s Dreadful Error

In Parliament on Wednesday 08 November I submitted a policy question.

My question was pertaining to the recent announcement by ED that Army General Phillip Valerio Sibanda is now an ex officio member of Zanu PF.

Indeed the Leader of Government business in the House Minister Hon Felix Mhona admitted that no serving Civil Servant should be active in politics and must resign before joining Politics.

In my supplementary question I probed why the President had clearly violated the Constitution by announcing that Army General VP Sibanda was now a member of Zanu Pf.

In his response Leader of Government business indicated that Senior Army Officials are not civil servants.

Involvement of the Military in Politics is a grave and dangerous mistake as precedence in other Countries like Nigeria saw participation of the Military creating monsters like Sani Abacha and Ibrahim Bhabhangida.

The barrel of the gun has been on numerous occasions been cited as the tool which brought Independence to Zimbabwe. This makes it clear that the current regime and government believe in utilizing ammunition for attainment of Power

Sweswe Defends Billiat

Thomas Sweswe has explained why Khama Billiat is still clubless following his departure at Kaizer Chiefs at the end of July.

The departure happened under unclear circumstances and the player blocked every effort by the club to restart the contract negotiations.

Several teams have been linked with his signing but nothing concrete has come up.

Speaking to Soccer Laduma, Sweswe said Billiat is waiting to fully recover from several injuries that kept him out of action last season.

“I think he has his own reasons to leave Chiefs. I can’t blame him for that. I will support his decision. You know last season at Chiefs he was injury prone,” Sweswe revealed to the publication.

“So I think he wanted to heal first and see his next move. I think he needed this sabbatical leave to figure things out. What I am sure is that he has something cooking for him,” he continued.

“Something is coming up. You know he is quiet even on social media. He is not like that so he is cooking something for sure. There is talent there no doubt about that.

In Parliament on Wednesday 08 November I submitted a policy question.

My question was pertaining to the recent announcement by ED that Army General Phillip Valerio Sibanda is now an ex officio member of Zanu PF.

Indeed the Leader of Government business in the House Minister Hon Felix Mhona admitted that no serving Civil Servant should be active in politics and must resign before joining Politics.

In my supplementary question I probed why the President had clearly violated the Constitution by announcing that Army General VP Sibanda was now a member of Zanu Pf.

In his response Leader of Government business indicated that Senior Army Officials are not civil servants.

Involvement of the Military in Politics is a grave and dangerous mistake as precedence in other Countries like Nigeria saw participation of the Military creating monsters like Sani Abacha and Ibrahim Bhabhangida.

The barrel of the gun has been on numerous occasions been cited as the tool which brought Independence to Zimbabwe. This makes it clear that the current regime and government believe in utilizing ammunition for attainment of Power

Since he is contesting the losing gold mafia, Scott Pedzai Sakupwanya of ZANU-PF, there is a dire need for solidarity in cash or kind to ensure victory. It is on record that the gold mafia smuggles gold and other minerals out of the country with impunity. European Parliament Pulls The Trigger On PAP Following Chief Charumbira Scandals

Below is a full letter by the European Parliament to the Pan African Parliament over the sex scandals linking Chief Fortune Charumbira.

We would like to thank you for the invitation letter dated 3 April, the cooperation in view of holding an Interparliamentary Meeting (IPM) at the Pan-African Parliament in Midrand, 17-19 May and the preparatory work by the PAP secretariat.

As you know, the European Parliament attaches great importance to developing the inter-parliamentary relations with the PAP and wishes to see parliamentary institutions strengthened in Africa and at African Union level in particular. We believe that our first IPM in several years, hosted by the European Parliament in Brussels last December, was a clear indication of the political will in both Parliaments to move forward jointly. We were therefore very much looking forward to next week’s IPM in Midrand and to fruitful exchanges on important topics of mutual interest.

The charges recently brought against the President of the Pan-African Parliament, widely covered by media reports and potentially impacting the Pan-African Parliament as an institution, have been noted by the Members of the European Parliament with great concern and cast doubts on the appropriateness of holding this IPM at the current juncture.

The Members of our Delegation for Relations with the Pan-African Parliament are concerned that the issues that have been reported are likely to overshadow and negatively impact the deliberations as well as divert the attention from important diplomatic and political topics during the IPM at this point in time.

We consider that it is therefore advisable to wait until there is more clarity on the outcome of ongoing investigations and potential judicial proceedings, and to give your institution the necessary time to decide on the measures you will deem appropriate to take with a view to ensuring the credibility and the functioning of the Pan-African Parliament.

For this reason, very regretfully, we have come to the conclusion that it would be best to postpone the IPM foreseen for next week and to organise it once the circumstances will allow to dedicate our undivided attention to the issues on which we wish to build and further enhance our cooperation.

Tshabangu Cripples Harare Municipality Operations

The Citizens Coalition for Change (CCC) has been hit by another round of mass recalls after self-imposed secretary general Sengezo Tshabangu wrote to Local government minister announcing the withdrawal of Harare Mayor Ian Makone and his deputy Kudzai Kadzombe.

Barely three months after the general election, Tshabangu’s power trip continues in CCC as he has recalled nine more councillors.

Ian Makone, Kudzai Kadzombe, Denford Ngadziore, Lovejoy Chitegu, Samuel Gwenzi, Chido Hamauswa, Tiriboyi Sabina, Florence Cheza. Matimba Fadzai, are the latest to be axed by Tshabangu.

In a letter addressed to the Minister of Local Government and Public Works Winston Chitando, Tshabangu said the nine councillors no longer belong to the CCC.

“Kindly be advised that the following Councilors were under Citizens Coalition for Change political party, and have ceased to be members of the Citizens Coalition for Change,” read the letter.

Tshabangu is buoyed by a recent High Court judgment that upheld his recalls of 15 members of parliament in October.

The Bulawayo-based CCC “member” last weekend indicated that he was not done with recalls.

CCC leader Nelson Chamisa has distanced himself from Tshabangu labeling him an impostor working under the instructions of the ruling party Zanu PF.

In a dramatic twist, a letter has also emerged from Bulawayo claiming the CCC’s “interim” chairman has “fired” Tshabangu.

In a letter to the Zimbabwe Electoral Commission and Ministry of Local Government and Public Works, one Maxwell Omen Murindagomo said Tshabangu’s recalls should not be entertained.

“Kindly be advised that the Citizens Coalition for Change (CCC), Political Party has fired its Interim Secretary General Sengezo Tshabangu with immediate effect. The Citizens movement reached this decision at its Citizens Assembly Meeting held in Bulawayo on Sunday 05 November 2023.

“The reason of the expulsion emanates from the unilateral decision by Sengezo Tshabangu that led to the recall of Citizens Coalition For Change CCC Councillors. As of today, you’re advised not to entertain any letter or correspondence from Sengezo Tshabangu. The same meeting has appointed Zibusiso Tshongwe as interim National Secretary General for Citizen Coalition for Change (CCC),” read the letter.

Harare Gynaecologist Under Investigation For Running Illegal Abortion Centre

A Zimbabwe gynaecologist is under investigation for allegedly running an illegal abortion centre at his medical facility in Harare and conducting illegal surrogacy on women.

Specializing as an obstetrician and gynecologist, Innocent Zimbwa, Innocent, is under fire for allegedly luring sex workers and desperate women who want to terminate their pregnancies illegally to his surgery and in some cases illegally assists women in reproductive technology such a surrogacy and illegal collection of eggs which seriously damages women’s health and rights.

Sources within the health sector said Zimbwa was under probe for unethical conduct in discharging his duties.

His licence—if proved true could be revoked by the health council, a source said.

” Zimbwa will never admit that he does abortion work because he knows it will land him in trouble,” said a source at the health council.

“They has been a private investigation on this for some time now. He is a senior police officer and knows that if he is found guilty of this, his job as a cop will end. But the truth is he is doing this at his Central Avenue surgery,” said the source.

Several attempts to get a comment from Zimbwa proved fruitless as he did pick up his calls.

Under Zimbabwe’s 1977 Termination of Pregnancy Act, abortion is only legally permitted under certain circumstances. If conducted illegally, it carries a penalty of up to five years in jail and or a fine.

Yet many women, and even minors like 16-year olds allegedly flock Zimbwa’s surgery seeking to terminate pregnancies illegally.

Some of the people, sources said are commercial sex workers and want the procedure done smoothly.

Backyard abortion facilities are often run by unlicensed midwifes and deregistered medical practitioners and carry the risk of severe complications.

This puts Zimbwa, a registered medical practioner on spotloght as to why he would be running the procedures illegally.

Four out of 10 women who undergo abortions in Zimbabwe experience such complications, including hemorrhages or infection, with some even dying in the process, according to a survey of health professionals.

“Illegal abortions in Zimbabwe have increased from 60,000 to 80,000 per annum — which is very unsustainable.

Poverty has also seen many underage girls resorting to abortion.

“How do I keep doing my job as a sex worker if I allow myself to have a baby? How do I look after the baby if I have no reliable source of income?” said a sex worker in a questionnaire done by the health council when they were conducting the probe.

At his clinic, Zimbwa also works with other doctors who include Makoni, Nothanda Mutizirwa and N.Moyo although the other health practitioners are not being probed by the health council.

Under the country’s punitive abortion laws, for women and girls who want to terminate their pregnancies, they must find their own means — legal or otherwise.

Apart from deregistered doctors, public hospital staff are also in on the illegal abortions trade, helping them smuggle out abortion drugs.

“Per abortion, they make roughly $150 to $200 and in a good month most doctors attend to about 15 to 25 abortion cases. It’s a lot of money if you make your calculations,” said an official at health council.

The maternal mortality rate in Zimbabwe currently stands at 614 deaths per 100,000 live births, one of the highest worldwide, according to the UN Population Fund (UNFPA).

Zimbabweans Outraged by Attorney General’s Flagrant Display of Impudence.

By Dorrothy Moyo | HARARE, ZIMBABWE – Zimbabweans are expressing outrage over a recent photograph of Attorney General Virginia Mabhiza sitting uncomfortably close to President Emmerson Mnangagwa, with her uncovered legs on full display. The incident has been widely condemned as disrespectful and a sign of the growing disregard for public decency.

Mabhiza, a married woman, has enjoyed close ties with Mnangagwa since her days as his personal secretary at the Justice Ministry during the Robert Mugabe era. Her promotion to the powerful position of Attorney General has raised eyebrows, with many questioning her integrity.

The photograph in question was taken on the day she was sworn in. In the image, Mabhiza is seen sitting side-by-side with the president, her legs exposed right up to the underwear window, while the man putting on a chuckly face appears trying to look away. Her posture has been described as “flagrant” and “impudent.”

She was photographed this week with the ZANU PF President 48 hours after he was put to order at the just ended extra-ordinary summit in Luanda Angola, a meeting he sprung out of complaining that he is no longer presidential level, the leaders of other countries want him to behave like a president (referenced as a priest), when he is just far below the standard- he is an unconvertible sinner. “No, these things happen in society, not everybody is a priest,” said Emmerson Mnangagwa, while his political journalist Ruben Barwe was frantically trying to coach him on what to say on camera, to avoid the embarrassment.

In the picture, Virginia Mabhiza flagrantly exposes her uncovered flesh up to the underwear window seen to the camera view of the whole country.

Ordinarily such pictures are accompanied with a warning to viewers, according to broadcasting standards and institutions like Potraz would be on the task to put sanctions on the state media journalists, but none of that has neen done.

Mabhiza now takes over the powerful role of Attorney General.

About their affair, ZimEye has engaged Mrs Virginia Mabhiza and Mr Mnangagwa for a lengthy period to obtain their most comprehensive comments, and efforts have not been forthcoming. At one time, when Mabhiza told ZimEye via phone through her lawyer that she is not Mnangagwa’s girlfriend, ZimEye asked her to explain on what other basis she released Emmerson Mnangagwa’s brother in law, a notorious convicted armed robber, Paradzayi Kutyauripo if it was not that she is Mnangagwa’s girlfriend. She did not reply this last question.

Kutyauripo has in recent months been catapulted to government and is now the Director of all State House properties across the country, the buildings where election rigging agents run to hide since the 1st August 2018 military crackdown.

Zimbabweans have taken to social media to express their disgust at Mabhiza’s behavior. Many have questioned her professionalism and suitability for her position. Others have criticized Mnangagwa for failing to set a better example for his ministers.

“This is not the behavior we expect from our leaders,” said one social media user. “It’s disrespectful to the country and to the office of the Attorney General.”

“She should be ashamed of herself,” wrote another user. “She’s a disgrace to Zimbabwe.”

The incident has also sparked renewed calls for Mnangagwa to address corruption within his government. Many Zimbabweans believe that Mabhiza’s promotion is a sign of favoritism and cronyism.

Christians for Edgar Lungu And Their Horrors

UPND Party Consultant, Mark Simuuwe’s opinion article criticizes the actions of former Zambian President Edgar Chakwa Lungu during his presidency in relation to the church and various political issues. THE CHURCH MOTHER BODIES AND ECL

By Mark Simuuwe | During his reign as President of Zambia, Edgar Chakwa Lungu opted for the Christians for Lungu, dumped all the traditional churches and called them names. He did not want meetings with the Zambia Council of Catholic Bishops, Evangelical Fellowship of Zambia, Council of Churches in Zambia. The church does not put that to heart, due to biblical fundamentals.

ECL closed doors to them completely especially when he arrested President HH on a trumped up treason charge.

ECL further closed doors when it came to Bill 10, Cyber Security and Cyber Crime Law enactment, manipulation of Public Order Act, human rights violations and extra judicial killings.

The three church mother bodies have always meant well for the country.

Today, ECL has been deceived by the Christians for Lungu who do not want to apologize even for calling the three church mother bodies names simply because they wanted to continue in illegal deals at the expense of citizens; they have conceded they have no capacity to do anything for ECL and his team and are now deceiving ECL to visit the three church mother bodies.

This is what criminals do. The Christians for Lungu must be put where they belong and not allow them to adulterate the three church mother bodies.

I pray that the Three Church Mother Bodies will also pump sense in ECL and Lubinda team on the danger of the kind of games to expel others, they are playing in PF, and will also ask the ECL team to accept that when ECL held an illegal convention at the Mulungushi Rock of Authority, it marginalized others like Sampa and KBF.

Further, I hope the three church mother bodies will also teach ECL that politics is not provocation but is by way of persuading electorates.

At these meetings with the three church mother bodies; let the ECL team also disclose how much Mukula was exported illegally, who were the gassers, who were burning markets, why were they killing Citizens using police like Nsama Nsama, Joseph Kaunda, Mapenzi Chibulo as these are the issues the church was raising when ECL was not giving them audience.

The church should also remind ECL and his team that God forgives but the law requires that those appearing for various offences be answerable and that God does not like thieves because theft deprives the poor.

Further, ECL must repent of the atrocities he committed and be made to apologize to those ethnic groups he marginalized and fired through ethnic cleansing.

ECL must also be asked to apologize for dividing the country on ethnic grounds for political mileage and the church should remind ECL and his team that all tribes came from Adam and Eve and that they were created by God.

And since they have rushed to the church, as they ask for forgiveness, they should be told to stop evil divisions and dirty propaganda aimed at making some tribes look bad and that God hates that.

Since ECL has again started tribal politics, the church should also remind him on the danger of such divisive politics that should he be caged one day and be made to account through a legal process, it will not be persecution but prosecution.

As ECL and others are mourning their loss of PF to Miles Sampa, the church should also remind ECL that do unto others as you would like them to do to you.

Lastly, let ECL and his Ministers, like Zaccheus, hand over what they stole from citizens as reflected in the FIC report which made ECL vent at Mary Chirwa and allow God to take control of their lives.

Let them disclose where those ukwa bags found with money came from and how they got that money.

The church should also remind them to bring back the money the PF stole and took abroad and tell them that since government will start the process of bringing back that money, the PF should willfully bring it back so that they don’t cry persecution for the wrongs they did.

Lastly, let the Church remind ECL and friends on how tolerant their president HH is regardless of how much he is insulted day and night, that he is also human and some of the statements they are releasing are not expected from a statesman.

Tagwirei Accused of Creating Cement Shortage

By A Correspondent| Children of Zimbabwe War Veterans Association (COZWVA) have accused controversial businessman Kudakwashe Tagwirei of orchestrating an artificial cement shortage, resulting in a staggering 90% increase in commodity prices in the country.

In a recent Twitter post, COZWVA revealed the findings of their investigation, which implicated Tagwirei in a scheme to manipulate the cement market.

The report suggests that Khaya Cement Zimbabwe a company linked to Tagwirei colluded with specific individuals to curb the importation of affordable cement from Zambia. This action intentionally generated a shortage, subsequently driving up the prices of his product.

“Ref Cement exorbitant prices:- An investigation by COZWVA has revealed that, Tagwirei took over Lafarge (Khaya Cement Zimbabwe) & pushed gvt to ban cheap cement imports licensing from Zambia creating an artificial shortage. This is the same Cartel Boss for Fuel, Banks & Gold cartel. He has destroyed Zim,” reads the tweet.

Previously, a 50-kilogram bag of cement was available in the price range of US$9 to US$13. However, the construction material’s cost has skyrocketed, now ranging from US$16 to US$20.

Zimbabwe’s annual cement production averages around 2.6 million tonnes. According to records, Pretoria Portland Cement (PPC) and Khaya Cement Zimbabwe control more than 70% of the domestic market.

In response to the crisis, government has allowed those with free funds to import cement as a way of curbing shortages.

The Zimbabwe Revenue Authority has warned that those caught importing cement without valid permits may face fines of up to US$2,000.

18-Year Old’s Death Causes Pandemonium In Kwekwe

THE death of an 18-year-old male in Kwekwe from a suspected case of cholera on Saturday has left the gold mining city gripped with fears of a cholera outbreak, this publication reports.

The country has so far recorded 5964 suspected cholera cases, with 1055 confirmed cases, 5696 recoveries and 123 suspected deaths as of late October.

Cholera cases have been reported in Chitungwiza, Buhera, Harare, Mutare, Gutu, Zaka, Chipinge, Chegutu and Sanyati.

Kwekwe City’s Acting Health Director Precious Shumba confirmed the death but indicated that tests conducted in local laboratories excluded cholera.

“It is true that there’s an 18-year-old male who works in Chicago who presented at Kwekwe Hospital yesterday morning at 10 am, with a history of severe headache and pain around the umbilical region.

“He was admitted and later passed yellowish stool with mucus. They sent the specimen to the lab to establish what could be causing the mucoid stool. A rapid diagnostic test to exclude cholera was also done, which came out positive. Unfortunately, he passed away around 4:30 pm yesterday,” Shumba said.

Kwekwe has since sent the specimen to Gweru where tests were conducted Sunday awaiting official results.

“A confirmatory diagnostic test is going to be conducted today (Sunday) in Gweru. We are availing a vehicle to ferry the specimen to Gweru,” she said.

Meanwhile, a team from Kwekwe’s health department was dispatched to the deceased’s home to conduct tests.

“A team went to Chicago yesterday evening for surveillance and 17 people were assessed at the compound. None presented with any signs and symptoms of cholera. We are currently treating the case as a suspected cholera case because there are no signs and symptoms and history suggestive of cholera from the history and investigations conducted so far. Otherwise, the results from Gweru will give us a true reflection of what we are dealing with. Our team is going to visit Lancashire where the deceased stays…though he didn’t go there from the time he started to be sick,” she said.

She added that Kwekwe is on high cholera alert.

“Our team remains vigilant and prepared to respond to the scare. Meanwhile, the IDH is ready to admit the first case of cholera,” she said.

ZWL$3.4 Billion Disappears From Loss Making ZUPCO

THE loss-making Zimbabwe United Passenger Company (Zupco), which has been embroiled in numerous corruption scandals, has failed to account for ZW$3.4 billion in revenue it generated in urban areas, due to non-submission of information, raising the risk of possible fraud.

Zupco, which has been under fire for being a cashcow for politically-connected elites, is struggling to operate, with most buses having disappeared from the roads after the re-introduction of privately owned commuter omnibuses.

In May last year, the parastatal’s operations opened a can of worms amid reports that Parliament was blocked from making inquiries on the procurement, ownership and whereabouts of over 500 purchased buses in the wake of a severe transport crisis.

While thousands of Zimbabweans, particularly in urban centres, struggle for transport on a daily basis, President Emmerson Mnangagwa has on several occasions officially unveiled buses that are rarely seen on the roads except on Zanu-PF occasions, a puzzle that has raised questions.

Findings by acting Auditor-General (AG) Rheah Kujinga in her report on State-Owned Parastatals for the year ended 31 December 2022 have shown that the parastatal has been struggling to account for the revenue generated from its operations in urban areas, amid indications of late payment of other payables.

“I was unable to obtain sufficient appropriate audit evidence that management had properly accounted for urban revenue amounting to ZW$3.4 billion due to the non-submission of information to support the reported figures. I was therefore unable to confirm the accuracy and completeness of the revenue recorded through other alternative means,” read the report.

“Included in cost of sales is diesel amounting to ZW$3.4 billion and operator fees ZW$2.6 billion. The system of control over the recording of diesel and expenses of mini-buses operators’ fees was not effective. I was unable to verify these expenses due to the state of the accounting records and non-submission of information by management in support of these expenditures. I was unable to perform other alternative procedures in order to confirm that cost of sales had been accurately recorded.”

The acting AG said she was also unable to obtain sufficient appropriate audit evidence on cash and cash equivalents balances totalling ZW$36 million due to non-submission of information, making it difficult to confirm Zupco’s cash and bank balances.

Zupco has also failed to maintain accounts for money owed to operators who have been leasing their vehicles to Zupco, with payments during the year not supported by invoices, raising fears of fraud.

“There were no accounts payable sub-ledgers for bus operators who were leasing out mini[1]buses to Zupco. As a result, management did not provide a list of individual creditors and supporting third-party documents. There were no reconciliations of individual creditor balances to creditor statements. I was therefore not able to verify the trade and other payables balance of ZW$749.5 million,” reads the report.

“The Company was earning some rental income from properties it was leasing out during the year. However, these properties were classified as part of property and equipment in the Company’s financial statements. This was contrary to the provisions of IAS 40 – ‘Investment Property’, which requires assets to be accounted for as investment property. I also noted that management was processing payments using manual records maintained by the depot managers which were not adequately supported. As a result, there were variances amounting to ZW$241.9 million between balances disclosed in the financial statements and balances in the company records.”

Zupco is also operating on the brink, with current liabilities exceeding current assets, which the AG said is likely to plunge the parastatal into economic uncertainty.

“I draw attention to the fact that the Company had a net liability position (current liabilities exceed current assets) of ZW$312.8 million (2019: ZW$368.1 million) as at December 31, 2020. In addition, the Company incurred an operating loss of ZW$3.8 billion (2019: ZW$2.7 billion),” reads the report.

“These conditions indicate the existence of material uncertainty that may cast significant doubt about the Company’s ability to continue as a going concern. My opinion is not modified in respect of this matter. The controls around the Company’s revenue collection systems were inadequate. There were no reconciliations being done on the banking summary to the revenue posted into the system. As a result, there were variances of ZW$26.48 million from cash collected to the cash deposits/banking.”

The acting AG also flagged Zupco over inadequate controls on fuel procurement, amid indications of fraud, as there were no documents to support expenditure for procurement of diesel amounting to ZW$290 million.

“In addition, there were variances between the quantities of diesel invoiced by suppliers and the quantities of diesel received,” reads the report.

“There were no adequate controls over billing for bus hire customers as waybills which are used as primary source documents for billing were not properly completed by the customers. As a result, some waybills did not show key details important for accurate billing such as the route and the distance covered.”

Chief Left With Egg On The Face After Court Reverses Fine Imposed On Village Woman

The Bindura Civil Court has ordered Chief Nyamaropa to return a cow and $1 200 forcibly taken from a woman in his village at gunpoint as maintenance for her co-wife’s children.

The court set aside proceedings conducted by Chief Nyamaropa on April 30, and ordered the chief to return a cow and US$50 taken from Judith Gonye in November, 2022.

The court also ordered Chief Nyamaropa to return US$1 150 which was given to his debt collector identified as Godfrey Chari, within 30 days.

Gonye, who was represented by Mrs Priscilla Muchada from the Legal Aid Directorate approached the court seeking her wealth back.

This was after the second wife, Loice Mukumba obtained a maintenance order from the chief of US$80 per month against their husband Rayson Bhobho.

After marrying Mukumba, Bhobho allegedly neglected his first wife Gonye and their three children.

According to court papers, Gonye relocated to their husband’s rural home at Takawira Village in Shamva.

An unnamed brother-in-law helped Gonye to settle and taught her tobacco farming.

She single-handily acquired five cows which were registered in the brother-in-law’s stock card.

Bhobho later lost his job, abandoned his second wife and relocated to South Africa where he is reportedly staying with another wife.

Mukumba relocated to the same rural home. After realising Gonye’s financial stability, she claimed maintenance through the chief resulting in Gonye losing a cow and US$50 in November last year.

On April 30, Mukumba made another claim of US$480 maintenance, US$110 arrears, US$150 school fees and US$330 debt she wanted repaid.

Chief Nyamaropa’s messengers Chari and one Hwata went to Gonye’s kraal to attach the remaining cows.

They did not find the cows and drew a gun which they pointed at Gonye ordering her to go back home and give them the money.

They loaded 10 first-grade tobacco bales and gave her 48 hours to raise the money.

She then paid US$1 150 including storage fees to get back the tobacco bales.

Her lawyer, Mrs Muchada told the court that chiefs do not have jurisdiction to entertain maintenance cases.

She said pointing a gun at a person is a criminal act and the duo, Chari and Hwata are not official chief’s messengers and debt collectors.

These do not fall under the Traditional Leaders Act nor the Customary Law and Local Court Act

Mnangagwa Accused Of Failing To Uphold Constitution

Prominent lawyer Beatrice Mtetwa has accused President Emmerson Mnangagwa of failling to “uphold, defend, obey and respect the constitution” after he failed to appoint a tribunal to look into the suitability of Justice Webster Chinamora to hold office as recommended by the Judicial Service Commission (JSC).

The JSC early this year recommended that Mnangagwa set up a tribunal to investigate the suitability of Chinamora and former Bulawayo High Court judge Martin Makonese to hold office.

Although Mnangagwa instituted a tribunal to investigate Makonese, leading to his resignation, he has inexplicably not acted on the recommendation to investigate Chinamora.

Section 187 sub-section 3 makes it mandatory for the President to appoint a tribunal once the JSC makes a recommendation.

In an open letter to Mnangagwa and the JSC, Mtetwa said the President had failed to uphold the constitution.

She said: “The Constitution of Zimbabwe has founding values and principles which include the rule of law, recognition of the equality of all human beings and good governance. To emphasize the Importance of good governance, its principles are specifically delineated and the delineation includes, ‘respect for the people of Zimbabwe from whom the authority to govern is derived’.

“Good governance also includes: “transparency, justice accountability and responsiveness”.

“Sadly, the President has failed to abide by these principles in so far as his obligations under Section 187 (3) are concerned. Section 187 (3) provides as follows: ‘if the Judicial Service Commission advises the President that the question of removing any judge, including the Chief Justice, from office ought to be investigated, the President must appoint a tribunal to enquire into the matter”. Subsection of section 187 in turn provides for the suspension of the concerned judge once the question of removing the judge has been referred to a tribunal for investigation’.”

As revealed by The NewsHawks in previous articles, Mnangagwa does not want Chinamora removed from the bench as he sees him as a pro-establishment judge who has ruled in favour of the government in crucial matters.

Following the JSC’s recommendations, there have been high-level moves involving senior Justice ministry officials to save Chinamora. Mtetwa however said Mnangagwa’s manoeuevre was unconstitutional.

She also questioned why the Judicial Service Commission, Zimbabwe Human Rights Commission and Law Society of Zimbabwe were failing to act in the matter.

“Chinamora continues to sit as a High Court judge more than six months after his colleague had opted to resign. Legal practitioners whose clients are involved in the complaints against him are forced to appear before him in other matters,” Mtetwa said.

“. . . The public, which is entitled to justice dispensed by independent, impartial and fair judges who expeditiously act without ‘fear, favour or prejudice’, continue to have their matters heard by a judge who has been adjudged to have a case to answer by a panel of three judges.” Mtetwa said Mnangagwa had failed in his duties by failing to uphold the constitution. She also took a swipe at oversight institutions for ignoring the matter.

“Section 90(1) of the constitution requires the President to “uphold, defend, obey and respect” the constitution. And Section 324 of the constitution requires that, ‘all constitutional obligations be performed diligently and without delay’, yet the President has, for a period of close to a year since referral, has been anything but expeditious and diligent in discharging an extremely important obligation which goes to the very root of the founding values and principles of Zimbabwe,” Mtetwa said.

“Despite this blatant disregarded of an important constitutional obligation, Zimbabwe’s oversight institutions and civil society organisations have remained mute. One of the functions of the JSC is to tender advice to the government ‘on any matter relating to the judiciary or the administration of Justice and the government must pay due regard to such advice’. Despite the constitution requiring the JSC to conduct its business in a just, fair and transparent manner, the people of Zimbabwe do not know whether or not the JSC has in fact discharged its Constitutional obligation of tendering advice to the President particularly with regards the need to diligently and expeditiously discharge constitutional obligations.

“Then there is the Zimbabwe Human Rights Commission whose various functions include ‘to protect the public against abuse of power and maladministration by the state and public institutions’. Has the ZHRC done anything to ensure that the JSC referral of the matter to the President is acted on diligently and expeditiously as is required by the Constitution? Is there any reason why it has not sought a mandamus to compel to the President to discharge his constitutional obligations or is the ZHRC as complicit in these failures as the JSC and the rest of us?”

Mtetwa said lawyers had also failed by failing to take up the matter through the Law Society of Zimbabwe.

“If the lawyers cannot decisively act to protect their own interests, why should the litigating public believe in their capacity to protect their interests? What sorts of professionals are these who are not protecting the integrity of their own institutions and processes? How does it feel to be the lawyer whose client made the complaints but who, a year later, still has to appear before the judge complained against? And can the public have confidence in our justice delivery system when there are such epic failures that no one is attending to? “And where are our civil society organisations when we need them?”

Mtetwa urged Chinamora to respect the oath of office he took.

“Where is your respect for the office of the High Court judge? Where is your respect for the office of the litigating public? Do you not crave public confidence and respect for the justice system that you serve? And when you receive all the emoluments that go with your office, do you feel that you have earned these in line with the principles that are supposed to guide you in dispensing justice?” asked Mtetwa.

The complaint against Chinamora was filed by Advocate Thabani Mpofu. A panel set up by the JSC to review the complaint comprising judges Anne-Marie Gowora, Alfas Chitakunye and Custom Kachambwa concluded that Chinamora has a case to answer.

Mpofu filed a complaint in a case in which another attorney, Advocate Taona Nyamakura, lodged a complaint against Chinamora for alleged conflict of interest in a legal dispute between Zimbabwe’s Delta Beverages (Pvt) Ltd, Schweppes Zimbabwe Ltd and Blakey Plastics (Pty) Ltd, a South African company.

Chinamora was already facing a series of accusations ranging from conflict of interest, judicial misconduct, bribery to different forms of corruption.

Losing Zanu PF Candidate Wanted For Vehicle Theft

A losing Zanu-PF candidate in last August’s parliamentary elections is wanted by police for stealing a vehicle.

Tafadzwa Chidawa, of Warren Park in Harare, allegedly stole a vehicle from the ZIMRA car yard at Chirundu border post on September 28, according to a police alert sent to all police stations seen by ZimLive.

The notice signed by Detective Seargent C Mabhidi of CID Chirundu says “all stations be on the lookout” for Chidawa, and advises that “if seen arrest, detain and advise ZRP Chirundu for escort.”

The memo does not disclose the type of vehicle stolen.

Chidawa was a well-beaten loser in the August 2023 elections, polling 3,992 votes to Shakespear Hamauswa’s 19,609 votes for the Citizens Coalition for Change.

Zimbabwean Pastor Found Dead With Bullet Wound At The Back

A murder case has been opened with the police after an e-hailing driver who went missing on Saturday was found dead.

Ison Mthombeni was found at a mortuary in Johannesburg with a bullet wound at the back of his head on Monday.

His car was found abandoned at the Golden Highway, near Eldorado Park, earlier that day with a pool of blood on the backseat.

This prompted the Soweto United E-hailing Association (SUEA) to launch a search party which resulted in his body being found at the Chris Hani Baragwanath Academic Hospital mortuary in Diepkloof, Soweto.

Mthombeni, a pastor who stayed in Meredale, south of Johannesburg, hails from Zimbabwe. He has a five-year-old child.

Mthombeni’s friend Bubuya Dube said he was a spiritual person.

“The SUEA organised the search and his car was found with a pool of blood and white substance that looked like brains,” Dube said.

After the gruesome discovery, he reported this on a WhatsApp group with other drivers and the leader of the association called to assist.

“They started searching across the field close to where the car was found. When we went to the SAPS in Eldorado Park to open a missing person’s case, we were directed to Bara forensics after a body had been found. They told us that his body was dumped near a river, which is commonly used for cleansing ceremonies,” he said.

Dube said Mthombeni’s last trip was on Saturday at midnight to a popular casino in Johannesburg’s northern suburbs.

“He was on duty and we suspect that it was an attempted hijacking. This is so barbaric.”

Dube said he was sad to see Mthombeni lose his life in such a senseless manner especially as he was the one who introduced the deceased to the e-hailing industry.

“He was a very spiritual person who loved God and he was a pastor who worshipped at House of Treasures Ministries,” said Dube.

Gauteng police spokesperson Col Dimakatso Nevhuhulwi could only confirm that Mthombeni was reported missing.

Bolt’s regional manager in East and Southern Africa, Takura Malaba, said the company was aware of the incident, confirming that the driver was registered on its platform.

“We are currently investigating this incident internally to confirm if this incident took place on the Bolt platform. We are aware that drivers often drive with multiple apps, and if this incident occurred on a trip on our platform, we will fully cooperate with the SA Police Service’s (SAPS) investigation into this incident, providing any information possible that may lead to the conviction of the perpetrators,” said Malaba.

“This heinous and senseless act disheartens Bolt and it unequivocally condemns any form of violence directed toward ride-hailing drivers. We believe that every person has the right to earn a living and move around without risk of harm, intimidation, coercion or fear of death or injury.

“Crimes against ride-hailing drivers continue to be a national issue of great concern, and the safety of passengers and drivers who use the Bolt platform is of utmost importance to us. Bolt is continuously engaging with national, provincial and local government and SAPS at local and national levels to address this scourge of violence and work together to improve safety for e-hailing drivers in SA,” he said.

Family spokesperson Perseverance Mhlaba said the family needed answers.

“We would like to know what transpired on that day. His mother, father, brothers and sisters are in Zimbabwe and they are in a state of shock.”

Mhlaba said she would miss Mthombeni, describing him as a man of peace.

“Ison was a very humble and kind-hearted person. He was never aggressive. He loved to solve problems in a peaceful way,” she said.

SUEA chairperson Thato Ramaila said he was shaken by the murder, adding e-hailing drivers were always living in fear of being hijacked and killed.

“Mthombeni’s last trip was to a casino. Though we don’t know what happened, the modus operandi is that criminals make a trip request, and once they are in the car, the criminals cancel the trip from the driver’s phone.

“By so doing, they know that the trip will not be recorded. They then shoot and kill the driver and leave with the car,” he said.

Ramaila said e-hailing companies needed to invest in technology that would make it easier for associations to track down drivers who were reported missing.

Former Mt Pleasant Legislator Loses Donnybrook Land Ownership Wrangle

A LOCAL land developing company, Eastwinds Trust, has come out guns blazing accusing former Mt Pleasant legislator Jason Passade (Zanu PF) of misrepresenting to home-seekers that he owns land at Donnybrook Farm despite losing a case in court.

Passade recently lost the legal battle over ownership of residential stands at Donnybrook Farm near Mabvuku in Harare.

High Court judge Justice Benjamin Chikowero on October 11 this year ordered the ex-MP, through his company Homegram, to vacate the land and restore it to Eastwinds.

In a statement yesterday, Eastwinds accused Passade of misrepresenting facts on the latest legal developments on the ownership of the land.

“We have noted with great concern the move by Mr Passade to misrepresent to his clients and home-seekers that he owns land at Donnybrook Farm.

“We found out that there is a fake court order circulating to the effect that he won the case, which is not true. We, through our lawyers, checked with the courts and what we found is contrary to Passade’s claims,” part of the statement read.

The land developing company accused Passade of forging some court papers in a bid to grab their land, which is meant for residential purposes.

There had been running battles at Donnybrook Farm, as parties clashed over ownership of the land until the court ruled in favour of Eastwinds.

“The first and second respondents shall restore to the applicant possession of all and any land occupied, possessed controlled by the applicant situate at the remainder of Donnybrook Farm Salisbury Township in Mabvuku-Tafara.

“It further ordered that the Sheriff of Zimbabwe, with the assistance of police where necessary, shall restore to the applicant peaceful and undisturbed possession and occupation of the land,” the judgment read.

According to Homegram’s High Court provisional order dated November 3, that was circulated, Passade claimed that he was the owner of the property and wanted the police to eject Eastwinds from the piece of land.

PRESIDENT Emmerson Mnangagwa has sworn in the new Attorney General, Mrs Virginia Mabhiza at the State House in Harare today.

Mrs Mabhiza, who is a judicial member and also a legal adviser to the cabinet, is the first woman to take that office after working in the Ministry of Justice, Legal and Parliamentary Affairs for over ten years as permanent secretary.

Speaking to journalists, Mrs Mabhiza said she is happy to take the office, adding that she will discharge her duties diligently.

President Mnangagwa also swore in three members of the Gender Commission, who are Mr Walter Mufuka, Mr Tigu Katsande and Ms Angeline Vhere.

The three come into the commission to fill in gaps left by other members following their resignation.

THE High Court has acquitted jailed socialite Felistas Murata popularly known as “Mai TT” after she was cleared of theft of trust property charges.

After serving at least five months of her nine-month jail term, Murata is now a free citizen after she was acquitted by the High Court on the basis that the Magistrate’s Court wrongfully convicted the socialite.

Speaking after the court session this Monday, Murata’s lawyer Mr Tafadzwa Muvhami explained the new development.

“The judges noted that Murata was wrongfully convicted and quashed the conviction and sentence. This is what we wanted all along as it was our argument that there was no crime committed. She is now a free woman. She has served that part of her sentence from her previous conviction which she defaulted community service which means that she will be out of jail any day from today,” he said.

Asked if Murata had plans to sue the state for wrongful conviction and sentencing, Mr Muvhami said he awaits instructions from his client.

Murata appealed against both conviction and sentence, arguing that the circumstances surrounding the case did not constitute a crime.

She will be released from prison after the necessary paperwork is completed.

Murata was convicted of breaching an agreement with a car hire after using a hired vehicle as surety for a loan.

Government Panics As Shortage Of Cement Beckons

THE government has liberalised the importation of cement in the wake of production challenges being faced by the country’s two leading producers.

The acute shortage of cement has seen dealers in the commodity capitalising on the dire situation by hiking prices amid concerns that if unabated, the situation may hamper the growth of the construction industry which has been on an upward trajectory.

Vice President of the Zimbabwe Building and Construction Association (ZBCA) Dr Tinashe Manzungu said of late demand for cement has outstripped supply by huge proportions.

“The industry has faced persistent challenges of cement availability. What is happening is that dealers are taking advantage of the situation by hiking prices of cement and sometimes by 100 per cent, hence we implore the government to find measures to ease the situation,” he said.

Industry and Commerce Deputy Minister, Honorable Roy Bhila revealed that plans are underway to improve the cement supply situation within two weeks.

“Two of our leading cement producers in Lafarge and Sino are having problems with production issues, hence we have given them import licenses to ensure that we have no shortages while they are attending to their situation. I can tell you that the situation will be back to normal within the next two weeks,” he said.

Zimbabwe’s combined annual cement production capacity stands at 2,6 million tonnes while demand has been steadily rising over the years due to the construction boom currently underway.

Warriors coach Baltemar Brito has urged the nation to rally behind the country’s senior men’s national team in the upcoming 2026 World Cup qualifiers.

Tshabangu vehemently asserted that these individuals, by using the party’s name and symbols, these MPs were in clear violation of legal mandates.

He stressed that utilising the party’s symbols and claims to represent the CCC is unauthorised and should be promptly discarded by the ZEC.

“The Nomination Court closes at 4pm today and ZEC has the administrative authority to enforce that court order. The court was clear on how party procedures go and we will be surprised if their papers are accepted on the basis of representing CCC. If ZEC accepts those individuals, we are not going to hesitate to seek recourse through the normal legal processes but for now. We await for 4pm,” said Mr Tshabangu.

This raises questions about who is behind Tshabangu’s actions.

No joy for mbanje users

A prospective user of marijuana had his application seeking an order legalising the cultivation, possession and recreational use of marijuana by adults thrown out after the High Court ruled mbanje has potentially harmful health effects, if left unchecked.

The Government legalised marijuana farming only for medicinal and scientific uses in 2018.

The ruling comes after Tapiwanashe Mukandi approached the High Court last year challenging the law which deemed cannabis as a dangerous substance and drug, last year.

He wanted the court to strike down provisions which criminalised the cultivation, possession and/or use of cannabis including section 157 (1) (a) and (b) of the Criminal Law (Codification and Reform) Act (Chapter 9:23) and section 3 as read with Section 6 of Dangerous Drugs Act (Chapter 15:02).

Through his legal counsel, Advocate Terry Mafukidze, Mukandi argued that the laws criminalising the use, possession, cultivation and consumption of cannabis in Zimbabwe infringed on his rights to privacy, equal protection and benefit of the law, as well as to bodily and psychological integrity.

He said cannabis users are not given the same benefit and protection that users of more harmful and dependence-producing substances such as alcohol and tobacco enjoy.

In addition, Mukandi argued that to penalise cannabis users for engaging in a practice that is no worse than tobacco smoking and alcohol is profoundly disrespectful of human personality and violates the equal protection and benefit clause.

He also sought to argue that if users of other more dangerous substances such as alcohol and nicotine are permitted to possess and consume alcohol and nicotine, it follows that users of less dangerous substances should be allowed the benefit of the law in this respect, read part of the application.

But Justice Gladys Mhuri rejected his arguments and dismissed his application with costs of suit. She ruled that the effects of cannabis are hazardous cannabis is a mind bending and habit forming drug which the court has to be seen to be discouraging its use with all its dangerous consequences to the youth and community at large, citing a previous judgment by the same court.

“ . . . cannabis remains a dangerous drug with the potential of magnifying or increasing crime if not properly handled or controlled,” said Justice Mhuri.

She said Zimbabwe is a democratic society that is part of the global village hence it subscribes to various international conventions and treaties.

As such, the judge agreed with the submissions by the Ministry of Health and Child Care that cannabis is an internationally controlled substance by the International Narcotics Control Board (INCB).

The Convention of Narcotic Drugs 1961 establishes strict controls on the cultivation of cannabis plant and their products and Zimbabwe subscribes to this Board and to the Convention thereby undertaking to limit the production, manufacture, export, import distribution . . . trade in, use and possession of cannabis, with the exception of use for medicinal purposes as provided for in the Dangerous Drugs (Production of Cannabis for Scientific Use) Regulations, 2018 SI 62 of 2018.

Although the court accepted submissions by Mukandi that other jurisdictions have decriminalised the use, possession, cultivation of cannabis, Justice Mhuri found the submissions unhelpful to his case.

“Further, I am not persuaded by the submission that a consumer of cannabis is not treated equally with a consumer of alcohol,” she said.

“These two are different and are not comparable. If the argument was that one consumer of cannabis is not treated equally with another consumer of cannabis, the argument will hold water. Applicant (Mukandi), therefore, cannot compare himself to a consumer of alcohol. They are not in a similar position.”

Ministers of Health and Child Care, Justice Legal and Parliamentary Affairs, and Home Affairs who were listed as respondents opposed the application.

In 2018, the Constitutional Court in neighbouring South Africa passed down a judgment making it legal for adults to cultivate and smoke marijuana in their homes.

The Constitutional Court in that country ruled that the right to privacy was violated by prohibiting the possession, purchase, or cultivation of cannabis for personal consumption by an adult in a private dwelling.

The case was pursued by various parties, including a Cape Town lawyer, Gareth Prince, who is a practicing Rastafarian.

It was opposed by, among others, the country’s ministers of Justice and Constitutional Development, Police and Health, the country’s National Director of Public Prosecutions and the NGO Doctors for Life International. The Herald

ZESA mulls another tariff increase

By A Correspondent- Power utility, Zesa Holdings, is mulling more tariff increases to recoup losses and supply more stable electricity to consumers despite a recent increase, it has been revealed.

Recently, the Zimbabwe Energy Regulatory Authority awarded a US$0,02 per kilowatt hour tariff increase to the Zimbabwe Electricity Transmission Distribution Company (ZETDC), the distribution arm of Zesa.

This comes as ZETDC reported that the utility had lost about US$3 billion during the past quarter century, US$120 million annually, owing to under-charging consumers for power.

The average price per kilowatt hour for electricity in the region is US$0,1254 but locally, Zesa was charging US$0,10, leaving it operating from a loss-making position. With the recent increment, Zesa is now charging US$0,12 per kilowatt-hour which is still below the regional average.

“We are a regulated authority even with the tariff that we were awarded, let me say we are not yet there. We are almost 79%. The tariff has been so suppressed; this leads to difficulties in the recapitalisation of Zesa. We have aged machinery. We saw it fitting that we structure everything. We have been driving this vehicle since the 1930s or 1940s,” ZETDC acting managing director Abel Gurupira said, during the State of the Mining Industry report breakfast seminar held in Bulawayo last week.

“We need a mind-set shift to say Zesa is government so everything from the government must be cheap. This business of the vehicle will collapse then we will realise that what is better is to have the right price with stable electricity or to have erratic delivery of electricity at a cheap price.”

The power utility was plagued by challenges such as the low water levels at Kariba South Hydro Power Station, the nation’s largest power generation source, owing to the effects the impending El Nino drought.

The power utility is looking to charge cost-effective prices to stay afloat and deliver electricity more regularly.

Gurupira said there were initiatives even on a regional scale to tap into the more than 2 000 megawatts (MW) of power stranded in Angola due to transmission challenges.

Gurupira added that they have just finished carrying out a master plan and had noted that Zimbabwe will require 2 000MW in the next two to five years.

Currently, the power utility is producing less than 1 000MW of power.

“We are looking at US$2,8 billion that we need for rehabilitation and repowering, maintenance and the construction of Hwange Units 1 to 6. Unfortunately, the country has ceased to be credit worthy. Who will want to invest when you cannot recoup. We have lost almost US$3,7 billion because of below costs tariff,” Gurupira said.

Current power shortages were, however, temporary in that the Hwange unit 7 was undergoing its 30 days mandatory maintenance process which would be followed by unit 8, ZETDC said.

Valerio Boycotts By-Elections

Opposition political parties in Zimbabwe are divided over participating in by-elections slated for 09 December 2023, amid concerns that voter apathy is deepening in the southern African country.

The by-elections were triggered by the recalls initiated by the Citizens’ Coalition for Change (CCC)’s self-proclaimed interim secretary general Sengezo Tshabangu.

The United Zimbabwe Alliance (UZA) party led by Elisabeth Valerio said that it will not participate in the 9 December by-elections despite some opposition political parties such as ZAPU declaring that they will field candidates for the polls.

In a statement released this Tuesday, 07 November, UZA National Spokesperson Elvis Dzvene said the party prefers inclusive dialogue to address the country’s “political crisis” and the implementation of reforms. Said Dzvene:

The United Zimbabwe Alliance (UZA), will not participate in the December 9 by-elections.

This decision was reached after extensive consultations with our National Directorate, our members, and our supporters across the country.

We have also taken into account the views of other democratic forces, civil society organizations and the international community.

Our decision is a principled one, driven by the belief that real change must come through reforms that guarantee fairness, transparency and justice in the Zimbabwe electoral process.

We emphasize that this decision is not an attempt to shirk our democratic responsibilities, but a bold stand against a flawed system.

We urge other political actors, both major and minor, to consider joining in this collective effort to demand the change that Zimbabwe so desperately needs.

UZA said it has decided to boycott the by-elections because it does not have confidence in the Zimbabwe Electoral Commission (ZEC) that it will hold credible elections. Said Dzvene:

We do not have confidence in the Zimbabwe Electoral Commission (ZEC), which has proven to be biased and has not implemented any meaningful electoral reforms since the disputed 2023 harmonized elections.

The August 2023 elections were condemned by local and international observers as neither free nor fair, yet ZEC has not addressed the issues of intimidation, militarization of staff, lack of transparency and the shambolic voters’ rolls that marred the elections.

Dzvene said the party does not recognise the by-elections as legitimate due to the unconstitutional and undemocratic recall of CCC’s elected representatives.

The opposition party also said that participating in the by-elections will not advance the cause of democracy and the welfare of Zimbabweans.

Tendai Biti ruling on today

Harare magistrate Mrs Vongai Guwuriro will today deliver a ruling in Tendai Biti’s third application for referral to the Constitutional Court of his assault matter.

The lawyer had his two previous applications of the same nature dismissed by the same magistrate.

Biti is facing charges of assaulting businesswoman and investor, Mrs Tatiana Aleshina at the Harare Magistrates Court in 2020.

The lawyer raised constitutional questions while submitting evidence in his defence.

He is arguing that his constitutional rights were being infringed.

Deputy Prosecutor-General Mr Michael Reza responded saying Biti’s application was frivolous and vexatious.

“He made such applications before and they were dismissed. I don’t know whether to cry or laugh (but) this application ought to be dismissed,” said Mr Reza.

He said the court was now functus officio (its mandate has expired).

During the previous sitting, Biti insisted he did not physically assault Mrs Aleshina.

The trial is now in its third year, with the matter going at a snail’s pace due to postponements at the instigation of the defence.

Submitting his defence, Biti told the court that putting the charge on him as done by the State was invalid from a common law point of view.

He said it was an infringement of his constitutional rights.

“Your worship if you say ‘I’m an idiot’, I will just laugh at you because the word means nothing to me,” said Biti.

He added that even if the court were to also call him a witch, he will still laugh. The Herald

Prospective candidates file nomination court papers today

By A Correspondent- The Nomination Court will today sit to receive papers from prospective candidates for the December 9 by-elections.

This comes after the High Court on Saturday dismissed an application by 23 CCC members to reverse their recalls from Parliament.

Government last week approved a US$5,3 million budget for the Zimbabwe Electoral Commission (ZEC) to conduct the by-elections to fill nine vacant seats in the National Assembly that were prompted by the recall of opposition legislators last month.

Yesterday, ZEC deputy chairperson, Ambassador Rodney Kiwa, said: “Everything is set for the Nomination Court sitting scheduled for tomorrow (today), if we fail to deliver we as an organisation would have failed.”

Ambassador Kiwa said the approved budget also covers funding for the Gutu West by-election scheduled for Saturday.

Voting in the constituency was delayed due to the death of a duly nominated candidate, Mr Christopher Rwodzi, before the 2023 harmonised elections.

“All other required materials like ballot papers, stationery, tents, lights and ink are available. The commission has heavily invested to meet the requirements of the upcoming by-elections,” Ambassador Kiwa said.

He said the Nomination Court’s requirements have been duly met.

“We have authorised signatures (of party officials) from the parties that we will use to receive nomination papers from prospective candidates.

“We began preparations for the Nomination Court when President Mnangagwa proclaimed dates for the by-elections,” Ambassador Kiwa said.

Each National Assembly candidate is expected to pay a US$1,000 nomination fee.

The by-elections will take place in Beitbridge West, Binga North, Bulawayo South, Cowdray Park, Lobengula-Magwegwe, Lupane East, Mabvuku-Tafara, Mpopoma-Mzilikazi, and Nketa constituencies. The Herald

“Zimbabweans living in perpetual insecurity”: ZimRights

By A Correspondent- Zimbabweans have a duty to restore and sustain a culture of human rights as the ruling Zanu PF government continues to deprive them of civil liberties and govern with an iron fist, the Zimbabwe Human Rights Association (ZimRights) has said.

The country’s human rights record continues to falter under the second republic with human rights watchdog Amnesty International currently lobbying the African Union (AU) to compel the Zimbabwean government to uphold human rights.

However, in a statement, ZimRights said citizens were the key to fostering a culture of human rights.

“At ZimRights, we have great confidence in the power of communities to lead in creating and sustaining a culture of human rights,” the organisation said in a statement on Sunday.

“Our 2022 State of Peace Report has unpacked the multiple layers of vulnerabilities for the people of Zimbabwe, with many citizens living in a state of perpetual insecurity.”

ZimRights said the insecurity shaped their approach and attitude to participation in social, economic and political life.

“We live in a country where the State has collapsed and, in its place, the party rules through fear and intimidation. Social protection systems have disappeared, and the social service delivery mechanisms have failed,” the rights organisation said.

The latest figures by the World Justice Project Rule of Law Index revealed that Zimbabwe was slowly sliding into a failed State ranking low in the absence of anti-corruption activities, fundamental rights, civil justice and criminal justice factors.

“The recent electoral heist has shown us the determination of politicians to destroy the country for political gain while the election industry, which profits from this perennial meaningless ritual, is equally determined to tick the boxes and look the other side. The people suffer the greatest loss as the bickering continues,” ZimRights said.

President Emmerson Mnangagwa was declared winner of the largely controversial August 23 and 24 polls, which were followed by retributive violence against opposition supporters.

The opposition Citizens Coalition for Change (CCC) has revealed that at least 1 500 of its supporters have abandoned their homes and are living in safe houses following post-election violence.

Several election observers including the Sadc election observer mission flagged the polls as not credible and failing to meet local, regional and international guidelines on holding free, fair and credible elections.

Meanwhile, human rights lawyers in Zimbabwe have flagged the continued use of the criminal justice system to clamp down on dissent through denial of bail to perceived political opponents.

The lawyers said there was an upsurge in cases of arrests, repeated denial of bail to human rights defenders and prolonged pre-trial incarceration.

In a report released last Friday by the Zimbabwe Human Rights NGO Forum titled Trial by Pretrial Incarceration: Detention without Trial and Delayed Trials in Zimbabwe, the lawyers said failure to issue bail in deserving cases and commence timeous trial proceedings, in several high-profile political cases was a cause for concern.

The lawyers said the justice system was being used as a tool to directly intimidate and close off the constitutionally guaranteed rights of arrested and detained persons.

“The Zimbabwe Human Rights NGO Forum (the Forum) has identified a disturbing pattern of manipulation of the criminal justice system by State personnel to intimidate and punish perceived voices of dissent,” the report said.

“This is achieved through denial of bail in deserving political cases or prolonged pre-trial incarceration.”

The rights defenders accused the State of abusing the procedures of detention of accused persons before trial.

“This method involves repeatedly denying the arrested person bail and stalling the process of commencing a trial. As a result, the arrested person stays in detention for a prolonged period, which itself gives the semblance of them already serving time in detention.”

Several opposition figures who include Fadzayi Mahere, Godfrey Sithole, Johanna Mamombe, Netsai Marova, Cecilia Chimbiri, Job Sikhala and Jacob Ngarivhume, among others, have endured lengthy incarcerations after having been denied bail at the courts.

“There was also observation of the trend spilling over to affect not only opposition political actors and activists, but this method of denial of bail and prolonged pre-trial detention was used to punish perceived sympathisers of the opposition political party,” the rights defenders said.

CCC Party Spokesman Humiliates Hopewell Chin’ono’s Persistent Anti-SADC, Chamisa Attack

Promise Mkwananzi the spokesman for the Citizens for Change Coalition (CCC) party, has exposed the self-proclaimed “Daddy” character Hopewell Chin’ono who has constructed a four-year reputation for himself through the repetitive tactic of getting arrested, so to outshine the entire Nelson Chamisa-led opposition party. Chin’ono’s claims have been that they were not taking effective action against ZANU PF, claiming he could do better than entire the Nelson Chamisa-led civil society. However, his stance has been shaken after the CCC party made a powerful impact at the recent SADC Extraordinary Summit in Luanda, where they ZANU PF leader Emmerson Mnangagwa came out screaming that the regional body is now full pastors, of whom he can’t qualify.

“Not everyone is a Priest,” said Mnangagwa after his claim to presidency were nullified.

On the same day, Chinono threw celebrations while saying Chamisa created what he termed “the mess.”

Hopewell Chin’ono’s rise to prominence as a “Daddy” character grew from his role in undermining torture reports related to the 2018 and 2019 military crackdowns that affected Nelson Chamisa led civil society. He directed Vice President Constantino Chiwenga and President Mnangagwa to target the Chamisa-led civil society, arguing it was essential for a better future in Zimbabwe.

Chin’ono began his anti-Chamisa campaign in January 2019, advising Vice President Constantino Chiwenga to meet with the tortured civil society leaders, including doctors treating injured activists and rape victims. This operation assisted Mnangagwa in discrediting well-researched UN rapporteur reports linking him to the crackdowns. Mnangagwa’s spirited challenge in a France24 interview further solidified Chin’ono’s reputation.

Fast forward to May 28, 2020, Chin’ono declared that he could outperform Nelson Chamisa’s entire party in exposing and combating corruption. He argued that the opposition would achieve nothing through legal means, given Mnangagwa’s control over the judiciary. Within 60 days of that tweet, Chin’ono obtained an arrest, in which he was slapped with baseless charges of incitement to violence. This act catapulted him to “Daddy” hero status, seemingly surpassing the entire opposition.

In 2023, Chin’ono continued to undermine the Chamisa-led party by expressing his desire to see it split and criticizing Chamisa’s priorities, particularly regarding voter registration efforts, despite Chamisa’s well recorded significant efforts in 2022.

Chin’ono has also continued to claim that Chamisa’s MPs are corrupt through USD40,000 remuneration payments, the very same disbursements which ZimEye’s Simba Chikanza spent over 3 years pushing for to be paid them (USD667 per month for 5 years) as part of their dues. His accusations that Chamisa’s MP got bribed by ZANU PF with the USD40,000 come at a time when he (Hopewell Chin’ono) has failed to disclose the UK bank that he claims funded his extremely suspicious sportscar lifestyle since 1996 during the period many of his closest friends were convicted and jailed for money laundering offences.

Following the SADC Extraordinary Summit at the weekend, Chamisa’s party spokesman, Promise Mkwananzi, chose to ignore Hopewell Chin’ono’s latest claims that the CCC was ineffective, instead opting to mock ZANU PF on Twitter.

In response, Hopewell Chin’ono took to the microblogging website on Tuesday to further suggest that Nelson Chamisa’s party lacks viable solutions. This ongoing clash highlights the intricate dynamics within Zimbabwean politics, where individuals strive to shape the narrative and influence the direction of both the opposition and the government, bust most importantly how Chin’ono has manufactured career for himself from ZANU PF assisted arrests so he can be seen as the “Daddy” the country has been waiting for.

Mining accidents claim 120 lives

The mining industry recorded an increase in mining accidents during the period January to July 2023, compared to the same period last year.

According to the latest State of Mining Industry Survey Report for 2024 released by the Chamber of Mines last week, the mining industry reported 110 fatal accidents during the period January to July 2023, compared to 106 fatal accidents during the same period last year.

The 110 accidents resulted in 120 fatalities and 92 percent of the accidents reported during the period under review occurred underground, with large-scale operations contributing 18 percent to the total accidents. Part of the report reads:

Of the 20 accidents reported for large-scale mines, 80 percent were in underground operations. Illegal mining operations contributed 22 percent to the total number of accidents. The small-scale mining industry contributed 60 percent to the total number of fatal accidents.

Speaking to the Chronicle, Chamber of Mines president, Thomas Gono, said that there is a need to educate miners on safe mining methods. He said:

We are in the process of segmenting the country into different mining districts and identifying large and small-scale miners.

On a quarterly basis, we are going to have stakeholder meetings to discuss safe mining practices to indicate to miners that sustainable mining is more beneficial than haphazard mining.

We are of the view that the awareness programmes will reduce mining accidents.

Most accidents happen because of unsafe methods of mining, therefore, we need to also consult the Government.

Young Miners Foundation chief executive officer, Payne Kupfuwa, said they are concerned over deaths and injuries that occur in disused mines. He said:

As an organisation, we have come up with deliberate programmes where we are encouraging people to formalise by grouping themselves into syndicates of six to secure mining rights in different provinces and areas.

Meanwhile, the Chamber of Mines said that most mining companies have adopted zero-harm initiatives, such as occupational safety and health accidents promotion and environmental protection in order to reduce fatal accidents and other negative impacts of mining on society.

Chief ordered to return cow, US$1.2k

The Bindura Civil Court has ordered Chief Nyamaropa to return a cow and US$1 200 forcibly taken from a woman in his village at gunpoint as maintenance for her co-wife’s children.

The court set aside proceedings conducted by Chief Nyamaropa on April 30, and ordered the chief to return a cow and US$50 taken from Judith Gonye in November, 2022.

The court also ordered Chief Nyamaropa to return US$1 150 which was given to his debt collector identified as Godfrey Chari, within 30 days.

Gonye, who was represented by Mrs Priscilla Muchada from the Legal Aid Directorate approached the court seeking her wealth back.

This was after the second wife, Loice Mukumba obtained a maintenance order from the chief of US$80 per month against their husband Rayson Bhobho.

After marrying Mukumba, Bhobho allegedly neglected his first wife Gonye and their three children.

According to court papers, Gonye relocated to their husband’s rural home at Takawira Village in Shamva.

An unnamed brother-in-law helped Gonye to settle and taught her tobacco farming.

She single-handily acquired five cows which were registered in the brother-in-law’s stock card.

Bhobho later lost his job, abandoned his second wife and relocated to South Africa where he is reportedly staying with another wife.

Mukumba relocated to the same rural home. After realising Gonye’s financial stability, she claimed maintenance through the chief resulting in Gonye losing a cow and US$50 in November last year.

On April 30, Mukumba made another claim of US$480 maintenance, US$110 arrears, US$150 school fees and US$330 debt she wanted repaid.

Chief Nyamaropa’s messengers Chari and one Hwata went to Gonye’s kraal to attach the remaining cows.

They did not find the cows and drew a gun which they pointed at Gonye ordering her to go back home and give them the money.

They loaded 10 first-grade tobacco bales and gave her 48 hours to raise the money.

She then paid US$1 150 including storage fees to get back the tobacco bales.

Her lawyer, Mrs Muchada told the court that chiefs do not have jurisdiction to entertain maintenance cases.

She said pointing a gun at a person is a criminal act and the duo, Chari and Hwata are not official chief’s messengers and debt collectors.

These do not fall under the Traditional Leaders Act nor the Customary Law and Local Court Act

After SADC Summit, Mnangagwa Is Now A Caretaker President

Former Zanu PF legislator Savior Kasukuwere has urged Zimbabweans to respect the caretaker authority led by Emmerson Mnangagwa while the country prepares for fresh elections to address legitimacy issues.

Posting on Twitter, Kasukuwere who is currently exiled in South Africa said said the adoption of the SADC SEOM report by the bloc creates a Presidential vacancy which means Mnangagwa becomes a caretaker leader.

Double murder bodies retrieved from borehole

By A Correspondent- Bodies of two men who were reported missing last week were discovered in a community borehole in Bhulu village near Ingwizi Center in Mangwe District, Matabeleland South.

The Zimbabwe Republic Police (ZRP) has arrested one suspect related to the case, while another suspect is still on the run. Chronicle reporter Mkhululi  Ncube says villagers were surprised to find “bloody water” coming from the borehole. 

A community leader who spoke on condition of anonymity said:

We are in shock and disbelief over the double murder in our village. The bodies were removed this morning from the borehole and police picked one suspect while another is on the run.

Army redeployments imminent

By A Correspondent- As President Emmerson Mnangagwa continues to make surprise post-election appointments amid political manoeuvres by the military to reposition itself for a more influential role going forward, Zimbabwe’s Military Intelligence Directorate (MID) commander Major-General Thomas Moyo is set to be redeployed, security sources say.

The changes in the army reflect a fightback by the military, which installed Mnangagwa in power following a coup in November 2017, after it was recently sidelined from politics, including the elections. Zimbabwe’s politics is militarised.

The sources said Moyo, who is related to Air Marshal Elson Moyo and the late Foreign Affairs minister Retired Lieutenant-General Sibusiso Moyo, is likely to be posted to Kinshasa, Democratic Republic of Congo (DRC), to replace the late Johannes Tomana or deployed to Minsk, Belarus.

“More changes in the army are coming,” a security source said.

 “The MID commander Tom Moyo is likely to be redeployed and sent to DRC. Some say he might be going to Belarus. DRC is open after Tomana’s death in August. Belarus might be tricky because a new ambassador, Graham Mudzimba, was appointed in July, coming from Cuba/Guyana.”

 Sources said there are still going to be new changes in the military in line with post-election politics.

“More changes are coming in the army. The changes are mainly driven by the military, something which Mnangagwa can’t resist,” the source said.

 This comes soon after shock changes within the Zimbabwe Defence Forces (ZDF) led by General Philip Valerio Sibanda.

Mnangagwa, who promoted five colonels, including a woman, to become brigadier-generals a few days ago, last week appointed Sibanda an ex officio member of Zanu-PF’s decision-making administrative organ, politburo, a move widely criticised as unconstitutional and unlawful.

Before that, Mnangagwa had recently redeployed former ambassador to Tanzania retired Lieutenant-General Anselem Sanyatwe to be  the new Zimbabwe National Army (ZNA) commander.

He replaced the retired General David Sigauke who had taken over from the late Lieutenant-General Edzai Chimonyo in 2021. Sanyatwe is a close ally of Vice-President Constantino Chiwenga, a retired general.

“Whether Moyo is going to DRC or Belarus, Sanyatwe will be replaced by Police Commissioner-General Godwin Matanga. Deputy Commissioner-General Stephen Mutamba will then take over the police,” the source said.

“If Sibanda, who was not happy with Sanyatwe’s appointment, ends up quitting to join politics fulltime, then it would be interesting to see who becomes the ZDF commander. Will they quickly promote Sanyatwe again to take over that role or bring back someone like retired Lieutenant-General Engelbert Rugeje, whom Mnangagwa does not want and blocked from replacing Chimonyo as ZNA commander? If Sanyatwe goes up again, who takes over the ZNA? Perhaps Major-General Hlanganani Dube. Such changes can only happen if Chiwenga has regained control. These sort of changes would signify a military manoeuvre and a strong bouncing back, meaning Mnangagwa will be on his way out.”

These changes are happening amidst speculation Mnangagwa wants a third term of office.

When Mnangagwa and his military allies seize power through a coup in November 2017, there was a deal on how to share the spoils of victory over the late former president Robert Mugabe, although a fight broke soon after that.

 The deal collapsed after Mnangagwa reneged on serving one term and leaving power to Chiwenga.

This has caused political tensions between the two, which sometimes explode into the open. The political war of attrition between Mnangagwa and Chiwenga most prominently found expression in the President’s controversial 2021 biography as internecine unresolved leadership issues linger on.

Former independent Norton MP Temba Mliswa previously said Mnangagwa’s former adviser Chris Mutsvangwa, now War Veterans minister, has been plotting to remove Chiwenga from his position.

Mutsvangwa was recorded by Chimonyo discussing the issue. Mnangagwa and Chiwenga are fighting over the spoils of the November 2017 military coup.

Chiwenga, who engineered the coup and put Mnangagwa in power, thought the President would serve only one term and hand over the reins of power to him in 2023, but that has been publicly rejected, fuelling tensions and hostilities.

Chiwenga feels betrayed. Mnangagwa’s authorised biography titled A Life of Sacrifice: Emmerson Mnangagwa exposes the rift between the two.

 The 154-paged biography, which Mnangagwa described as a “brief window” into his life, was authored by Eddie Cross, a former opposition MDC high-ranking official and MP who became the President’s adviser.

 It depicts Chiwenga in negative light through its narrative. Cross, Mnangagwa’s biographer and new loyalist, said the President will brook no nonsense from those threatening his hold on power, a warning to Chiwenga.

Mnangagwa, who at the time of the coup had fled the country to South Africa after his mentor-cum-tormentor Mugabe had hounded him, only returned after Chiwenga led the coup that ended the late dictator’s 37 years in power.

 Mugabe later described Mnangagwa as his “tormentor”. The book reveals that Chiwenga’s appointment as co-deputy, together with Kembo Mohadi, was part of Mnangagwa’s coup-proofing ploy.

Mnangagwa appointed Sibanda to succeed Chiwenga as ZDF commander as he saw him as loyal, although the army’s project remains intact.

 Sibanda, according to the book, is “possibly the best soldier in southern Africa and a man that was deeply respected in the army”, which brings into focus Mnangagwa’s decision to appoint him an ex-officio member of the Zanu-PF politburo.

 “Mnangagwa’s actions drew little attention, but what the President was doing was closing the door on any possibility of the military assisted transition (military coup) being repeated. He needed to know that the security services were led by men in whom he had confidence as professionals,” the book says.

Differences between Mnangagwa and Chiwenga played out when the latter demanded that a state of emergency — Martial Law — be declared during the 2019 riots which had been triggered by a 150% increase in the price of fuel.

 “When it became known that a state visit to Russia was planned for the week beginning the 14th January 2019, disturbing intelligence was received that disturbances were planned,” the book reads.

“The President consulted his security chiefs about the threat and gave instructions about what was to happen in his absence…The acting President retired General Chiwenga, demanded that a state of emergency be declared and that Martial Law be introduced. This would have effectively meant that the armed forces took over the administration of the state and the commander-in-chief of security services, but General Sibanda refused. He said his orders from the President were very clear.”

 This suggested a new rift between Chiwenga and Sibanda, although insiders say it was only a question of timing and strategy, not rivalry.

Internet services were suspended during the protests after security forces were deployed to quell the disturbances.

The coup deal between the coup-plotters was: Oust Mugabe, then install Mnangagwa and Chiwenga, then ZDF commander, and Mohadi as co-vice-presidents.

Mnangagwa was to be the political and civilian face of the coup to avoid a backlash from the Southern African Development Community, African Union and the international community, including the United Nations.

Chiwenga was the military architect of the coup. He was at the centre of the planning and execution of the putsch, whose strong roots go back to 2008 when the army rescued Mugabe after he had lost to the late main opposition MDC-T leader Morgan Tsvangirai. Mugabe told journalists in interviews in March 2018 at his Blue Roof Borrowdale mansion in Harare that Chiwenga was the architect.

Mnangagwa, with Chiwenga as the point man, engineered a contrived run-off between Mugabe and Tsvangirai when the opposition leader had actually won the presidential poll outright to save Mugabe.

The MDC-T defeated Zanu-PF by one parliamentary seat in the March 2008 elections. Security sources say soon after the 2008 election fiasco for Mugabe and Zanu-PF, and the army’s subsequent intervention, Mnangagwa and Chiwenga effectively took control.

After rescuing Mugabe, their only stumbling block was retired army commander General Solomon Mujuru who had managed to leverage his power and influence as a kingmaker to impose his wife Joice as vice-president at a Zanu-PF congress at Sheraton Hotel (now Rainbow Towers) in Harare in December 2004.

This followed Mnangagwa’s Tsholotsho Declaration fiasco, which triggered purges within the party. Mujuru and his faction defeated Mnangagwa’s group and took over control in December 2004 after congress.

Their influence was hugely felt and manifested itself two years later at Zanu-PF’s annual conference in Goromonzi in 2006 where leadership succession undertones grew louder.

Things went off the rails in 2007 when Mujuru, strongly supported by the late Dumiso Dabengwa, forced an extraordinary congress in December 2007 ahead of the 2008 elections after a dispute over Mugabe’s candidature which played out in the politburo for months that year.

When Mugabe shrugged off Mujuru’s challenge in 2007, the former Zanla and ZNA commander plotted “bhora musango” (internal sabotage) — whose manifestation through centrifugal forces was the ead political actor Simba Makoni and his Dawn/Mavambo/Kusile project underwritten by Mujuru.

 After the 2008 elections and the subsequent Government of National Unity which lasted from 2008 to 2013, Mujuru’s star started waning, although his wife remained vice-president. Mujuru remained a hindrance to Mnangagwa and Chiwenga’s coup project.

 After heightened internal strife, Mujuru died in a mysterious fire on 15 August 2011. Three years later, his wife Joice was kicked out as vice-president in a military operation executed through party structures in the form of recalls and dissolution of structures.

Mnangagwa came in to replace her. Phelekezela Mphoko was appointed by Mugabe another vice-president from nowhere in 2014 to replace John Nkomo who had died the previous year.

From 2014, Mnangagwa and Chiwenga started planning how to remove Mugabe as his succession battle intensified. Efforts to get comment on Moyo’s looming redeployment were unsuccessful.

At this time SADC had publicly announced one very clear thing, that the Zimbabwe election was and is on the extraordinary summit agenda.

ED approves 7 member Mutapa Investment Fund board

President Mnangagwa has approved the appointment of a seven member Mutapa Investment Fund board to be chaired by Dr Chipo Mutasa.

A recent Statutory Instrument gazetted by President Mnangagwa invoked his Presidential Powers to temporarily amend the Investment Laws to rename and upgrade the old Sovereign Wealth Fund and transfer the shares in 20 State-owned enterprises to the Mutapa Fund.

The Government shareholding in a large block of 20 State-owned companies has been transferred to the Mutapa Investment Fund, the upgraded and renamed Sovereign Wealth Fund, including mines, major power stations, the National Railways of Zimbabwe, Air Zimbabwe, NetOne and TelOne, Cottco and Zupco.

ZESA Plotting Another Tariff Hike

Power utility, ZESA Holdings, is pushing for another tariff hike to recoup losses and supply more stable electricity to consumers, reported NewsDay.

Recently, the Zimbabwe Energy Regulatory Authority (ZERA) awarded a US$0.02 per kilowatt hour tariff increase to the Zimbabwe Electricity Transmission Distribution Company (ZETDC), a subsidiary of ZESA Holdings.

Before the recent tariff increase, ZESA was charging US$0.10 per kilowatt-hour, leaving it operating from a loss-making position.

The average price per kilowatt hour for electricity in the region is US$0.1254, and ZESA is now charging US$0.12.

Speaking during the State of the Mining Industry report breakfast seminar held in Bulawayo last week, ZETDC acting managing director Abel Gurupira said:

We are a regulated authority even with the tariff that we were awarded, let me say we are not yet there. We are almost 79%.

The tariff has been so suppressed; this leads to difficulties in the recapitalisation of ZESA. We have aged machinery.

We saw it fitting that we structure everything. We have been driving this vehicle since the 1930s or 1940s.

We need a mindset shift to say ZESA is government so everything from the government must be cheap.

This business of the vehicle will collapse then we will realise that what is better is to have the right price with stable electricity or to have erratic delivery of electricity at a cheap price.

He said there were initiatives by SADC countries to tap into the more than 2 000 megawatts (MW) of power lying idle in Angola due to transmission challenges.

Gurupira added that Zimbabwe will require 2 000MW in the next two to five years.

Currently, the Zimbabwe Power Company, a ZESA subsidiary, is generating just above 1 000MW of power.

“CCC gone”: Mliswa

By A Correspondent- Former Member of Parliament for Norton Constituency, Temba Mliswa, stated that the opposition party Citizens Coalition for Change (CCC) is “effectively gone.”

This comes after the High Court rejected an application made by 14 CCC Members of Parliament and nine senators who wanted to reverse their expulsion from Parliament. The recalls were started by Sengezo Tshabangu, who asserts that he is the interim Secretary-General of the party.

Said Mliswa:

CCC is effectively gone! Let them have an immediate Congress, structure themselves properly and contest the by-elections as a new party. This wapusa wapusa thing, in an environment such as ours, is only fodder for the opponents. Be structured, have order.

Otherwise, as things stand Tshabangu is the main man running CCC. It’s very likely that some current MPs & Cllrs won’t agree to the resignation approach. They would rather talk to Tshabangu. We saw that last time with Douglas Mwonzora. The timid & selfish refused to switch sides.

However, as a nation this incident is pathetic. We are wasting a lot of time on politics and politicking instead of national development. So much money will be wasted on running the by-elections while various sectors of the country such as Health and Education are in dire state.

Mliswa said the opposition needs to reflect and learn from their mistakes. He also expressed concern that they have not performed well particularly in Parliament and should have been more effective in holding the government accountable. He mentioned the EFF in South Africa as an example of a smaller party that is impactful and clear in its narrative.

Mliswa believes the opposition should be more radical and principled, willing to sacrifice for the greater goal. He also criticised the internal divisions caused by the way Nelson Chamisa handled the party’s primary elections and the exclusion of prominent members including Tendai Biti, Welshman Ncube and Kucaca Phulu. He suggested that the recalled members could run as independents in by-elections and have a good chance of winning. However, he personally has moved on from politics and is focused on other things.

SADC’s Full 43 Page Report Nullifying Mnangagwa’s Claim To Presidency Under the Region’s Legal Standards

The following is the regional body, Southern African Development Community, SADC’s full combined 43 page report legally notarised at Luanda, Angola during its extra-ordinary summit, nullifying Mr Emmerson Mnangagwa’s claim to an electoral win, according to regional standards.

SADC’s Principles and Guidelines Governing Democratic Elections provide a framework for assessing whether member states have conducted free and fair elections. These principles are based on universally accepted standards for democratic elections, which are essential for the legitimacy of government and the maintenance of peace and stability.

SADC member states are bound by these principles, which include ensuring the full participation of citizens in the political process, freedom of association, political tolerance, regular intervals for elections, and equal opportunity for all political parties to access the state media, among others. These principles also emphasize the importance of impartial and accountable electoral bodies, safeguarding civil liberties, providing adequate resources for elections, and ensuring transparency throughout the electoral process.

Election observation is a crucial component of upholding these principles, as it provides international validation of elections and adds to their credibility. SADC observer missions are guided by specific criteria, including assessing the constitutional and legal guarantees of citizens’ rights, the conducive environment for free and fair elections, and non-discrimination in voter registration. However, it’s important to note that the participation of SADC observers in elections is not mandatory, which can lead to inconsistencies in their application.

Finally, SADC member states could submit periodic reports to the SADC Organ on Politics, Defence, and Security Cooperation to demonstrate their commitment to conducting free and fair elections in line with the SADC Principles.

In conclusion, the SADC Principles and Guidelines Governing Democratic Elections serve as a valuable framework to assess the conduct of elections in SADC member states. Election observation plays a crucial role in upholding these principles and ensuring that elections meet international standards of fairness and transparency.

THE REPUBLIC OF ZIMBABWE

HELD ON

23-24 AUGUST 2023

1. INTRODUCTION

On behalf of the Southern African Development Community(SADC), it is my distinct honour to welcome you all to this important event where I will present the SADC Electoral Observation Mission (SEOM)’s Preliminary Statement on the conduct of the 2023 Harmonised  Elections in the Republic of Zimbabwe.

The elections were observed in line with the revised SADC Principles and Guidelines Governing Democratic Elections (2021) and the relevant laws of the Republic of Zimbabwe.

I was appointed as the Head of the SADC Electoral Observation Mission to the Republic of Zimbabwe by His Excellency Hakainde Hichilema, President of the Republic of Zambia, in his capacity as the Chairperson of the SADC Organ on Politics, Defence and Security Cooperation. I maintained close collaboration with members of the Organ Troika, currently comprised of the Republics of Zambia and Namibia and the United Republic of Tanzania, regarding the Harmonised Elections in Zimbabwe.

The SEOM also benefitted from the Pre-election Goodwill Assessment Report of, and advice from the SADC Electoral Advisory Council (SEAC).

The SADC Electoral Observation Mission  comprised 68 observers, 50 were deployed to the ten provinces of Zimbabwe, and the rest were based at the SEOM headquarters here in the Rainbow Towers Hotel.

Our observers were deployed to Harare, Bulawayo, Masvingo, Matabeleland North, Matabeleland South, Midlands, Manicaland, Mashonaland East, Mashonaland Central and Mashonaland West.

During the pre-election phase, the Mission consulted key stakeholders such as the Zimbabwe Electoral Commission (ZEC), key Government Agencies, leaders of political parties, representatives of faith-based organizations, media, Civil Society Organisations, and the Heads of International Election Observation Missions.

This Preliminary Statement covers the Mission’s observations of the pre-election period and voting day activities. The Mission’s final report will cover, in more detail, the observations of the pre-election, election and post-election phases, and is aimed at supporting and strengthening the democratic electoral processes in the Republic of Zimbabwe as a SADC Member State.

2.      SUMMARY OF FINDINGS

Your Excellencies, Ladies and Gentlemen

I now wish to share the summary of the Mission’s key findings:

       (a)    Political and Security Environment

After consulting widely with stakeholders, the consensus was that the country was generally calm and peaceful. 

       (b) Constitutional and legal framework for the elections

The Mission noted that the 23 August 2023 Harmonized Elections in Zimbabwe were regulated by the Constitution of the Republic of Zimbabwe and the Electoral Act [2:13]. According to Section 158 (1)(a) of the Constitution of Zimbabwe of 2013, General Elections should take place not more than thirty days before the expiry of the five year period specified in Section 143 of the Constitution.  The Mission noted that this section applies to the duration and dissolution of Parliament, and stipulates that Parliament is elected for a five year period which commences from the date the President-elect is sworn in and assumes office.

The Mission further noted that Section 144 of the Constitution requires the President, by proclamation call, to set a date for a General Election after consultation with the Zimbabwe Electoral Commission. Pursuant to this provision, His Excellency Emmerson Dambudzo Mnangagwa, on 31 May 2023 issued a proclamation fixing the 23 August 2023 as the date for Presidential, Parliamentary, and Local Government Elections, referred to as the Harmonised Elections.  The Mission was informed that a further proclamation was issued rendering 24 August 2023 as a polling day because of the delays experienced at certain polling stations. Furthermore, President Mnangagwa also proclaimed 2 October 2023 for the run-off election to the office of president if such a poll becomes necessary.

The Mission noted that this Proclamation was in line with Paragraph 4.1.3 SADC Principles and Guidelines Governing the Democratic Elections, which requires that the date or period of elections is prescribed by law. 

       (c)    Election management

The Mission noted that the Elections in Zimbabwe are managed by the ZEC which is one of the five Chapter 12 (of the Constitution) commissions, that is, independent commissions whose purpose is to support democracy in Zimbabwe. In terms of section 235 of the Constitution, the Commissions must act in accordance with the Constitution; and they must exercise their functions without fear, favour or prejudice.

       (d) Delimitation of constituencies

The mission was informed that the delimitation exercise that was conducted in 2022 by the ZEC was marred with controversy. In one way or another, concerned stakeholders claimed that the report that ZEC submitted failed to observe the constitutional requirements for such an exercise, and that there were also divisions amongst serving commissioners of the ZEC regarding the veracity of the report. The main allegations made against the report was that it constituted gerrymandering, and that it failed to observe the correct methodology for calculating the 20% variance constitutional rule with respect to minimum and maximum sizes of the 210 electoral constituencies.  The courts dismissed legal challenges brought against the Delimitation Report of 2022. The Mission, however noted that there remain questions regarding the delimitation exercise for the following reasons:

  • In its Delimitation Report of 2022, the ZEC rightly states that, “the Constitution recognises the impracticability of having equal number of voters in each constituency by allowing the Commission to depart from this requirement within a stipulated margin. In this case, the Constitution in section 161(6) stipulates that ….“no constituency may have more than 20% more or fewer registered voters than other such constituencies”. The constitution in section 161(6)a-f also lists factors that need to be considered when delimiting since they are important during the exercise.” However, the ZEC goes on to also state that,  “Based on the provision of section 161(6) the Zimbabwe Electoral Commission then calculated the 20% deviation from the national average voter registration expected in each constituency which was 27 640. This yielded a deviation of 5,528 voters. Since the average number of registered voters was regarded as a stable benchmark against which delimitation of constituencies was conducted, the deviation figure was added to the national average to determine the maximum number of registered voters that a constituency delimited would contain i.e., 33 168.”
  • The Mission noted that the use of the average number of voters per constituency is  inconsistent with the provision of section 161(6) of the new Constitution that was adopted in 2013. The word “average” appears in section 61A(6) of the old Constitution of Zimbabwe, under which it was permissible to calculate the minimum and maximum permissible number of voter per constituency by using the national average as the baseline. The word “average” does not exist in section 161(6) of the new Constitution, which deals with the same subject matter. The difference between section 61A(6) and section 161(6) of the old and the new constitutions, respectively is far from being merely technical.
  • In the new Constitution, and in the context of section 161(6), the maximum deviation is 20% of the voters registered in the constituencies. The new Constitution uses actual constituency by constituency registered voter population, not the national average number of constituency voter population, to calculate the permissible deviation from the requirement that constituencies must have an equal number of voters. Mathematically, the two methods produce very different results and affect the equality of the vote  concerning the elections to parliament. On the other hand, since the country votes as a single constituency in the presidential election, the difference in the methods has no particular impact on the equality of the vote in that election. It was, therefore not unexpected that ZEC would receive substantial criticism on this aspect of its latest Delimitation Report.

       (e)           The voters roll

Some stakeholders decried the delay in  releasing the voters roll in a searchable and analyzable format as prescribed by the Electoral Act. Some stakeholders expressed displeasure that the delay in releasing the voters roll resulted in missed opportunities for them to audit the voters roll and therefore give the public confidence about the veracity of the voters roll. According to the ZEC, there was however, an opportunity that was provided for  interested parties to inspect the voter roll as provided by the Electoral Act.

In this regard, the Mission took note of section 62 of the Constitution. This section provides that every Zimbabwean citizen has the right to access any information held by the state or by any institution or agency of government at every level in so far as the information is required in the public interest.

The mission also noted that in terms of section 21 of the Electoral Act, “The Commission shall within a reasonable period of time provide any person who requests it, and who  pays the prescribed fee, with a copy of any voters roll, including a consolidated roll referred to in section 20(4a), either in printed or in electronic form as the person may request.”

Access to the voters roll is also premised on the constitutional requirement that the ZEC must deliver fair elections. In the exercise of this function, the Constitution requires the ZEC to ensure that those elections are conducted efficiently, freely, fairly, transparently and in accordance with the law. Following consultations with the ZEC, the mission was informed of: “The conflict created by the introduction of the Cyber and Data Protection Act which enjoins all institutions and agencies to protect the privacy of information entrusted to them vis the provisions of section 21 of the Electoral Act where the voters roll although containing the personal information of voters (i.e. names, date of birth, ID Number, Address, Sex) is a public document open to inspection by the public. Such conflict has resulted in there being litigation around the voters roll as aforementioned, where in one case an Applicant does not want his information public and in yet another the Applicant seeks an order directing that the voters roll be availed.”  

The Mission acknowledged the concerns the ZEC raised above regarding difficulties related to releasing electronic versions of the voters roll. However, the mission also noted that the law gives the Commission discretion to impose reasonable conditions to prevent the voters roll from being used for commercial or other purposes unconnected with an election. In particular, the mission noted that section 21 of the Electoral Act provides that: 

        “(7) Where a voters roll is provided in electronic form in terms of subsection (3), (4) or

(6), its format shall be  such as allows its contents to be searched and analysed: 

              Provided that— 

  • the roll may be formatted so as to prevent its being altered or otherwise tampered with; 
  • the Commission may impose reasonable conditions on the provision of the roll to prevent it from being used for commercial or other purposes unconnected with an election.”  

Apart from the above safeguard measure against the abuse of the voters roll, there is also room to note that as a constitutional body, the ZEC is obliged to give effect to the constitution as the supreme law, in this regard, the requirement for transparent and fair elections, instead of relying on legislation (the Cyber and Data Protection Act) that negates the specific requirement. In addition to the fees levied for access to the printed voters roll, the mission notes that the above scenario is restrictive  regarding access to the voters’ roll by interested persons, including political parties. 

       (f)   Freedom of assembly

The Mission noted the controversy emanating from the Maintenance of Peace and Order Act (MOPA), which sets out a process for notifying the Zimbabwe Republic of Police of the intention to hold a campaign activity. In this respect, there were stakeholder concerns about the right to freedom of assembly for election campaign purposes, whereupon the CCC reported that their rallies were being subjected to unreasonable cancellation by the

Zimbabwe Republic Police. We also noted reports that there was inconsistent application

of the notice period for election campaign gatherings, with certain political parties stating that the ZRP required a seven-day notice instead of the three-day notice that is applicable during election periods in accordance with section 7(1)(b)(ii) of the Maintenance of Peace and Order Act.

       (g) Freedom of expression

The Mission received concerns from several stakeholders that the recent amendment to the Criminal Law (Codification and Reform) Act [Chapter 9:23] (No. 23 of 2004), which amendment is commonly referred to as the Patriot Act has resulted in a severe restriction of the freedom of expression which is guaranteed by section 61(1) of the Constitution. The Patriot Act creates the offence of “Wilfully injuring the sovereignty and national interest of Zimbabwe”.  Stakeholders were particularly concerned that this offence is vague, too general, and it criminalises “any communication between two or more persons, whether happening in person or virtually or by a combination of both, which involves, or is facilitated or convened by, a foreign government or any of its agents, proxies or entities.” Of note was also the concern that even the consultations between these stakeholders and international observation missions could fall afoul of this law. 

The Mission noted that the Patriot Act is incompatible with the spirit of section 61(1) of the Constitution, and paragraph 4.1.2 of the SADC Principles and Guidelines Governing Democratic Elections, which requires Member States to uphold, amongst others, the freedom of expression.

       (h) Nomination of candidates and nomination fees

The Mission noted the unprecedented amount of litigation surrounding the elections, amongst others, concerning the nomination process of of candidates. In this respect, we further noted the protest and litigation of Mr. Saviour Kasukuwere, who believes that he was unfairly disqualified as a presidential candidate; however the courts dismissed this particular complaint.

The Mission further noted stakeholder concerns that nomination fees for a person to stand for election have become too high and, therefore restrictive to political participation. In June, the government, through the Statutory Instrument 144 of 2022, increased the presidential nomination fee from 1,000 to 20,000 U.S. dollars. Nomination fees for a constituency election increased from 50 to 1,000 U.S. dollars. These amounts were also cited as unduly restrictive to less well-off members of the community such as women who lack the means. In this context, we also take note of the significance of paragraph 4.1.7 of the SADC Principles and Guidelines, which requires Member States to guarantee an environment of open contest with no undue exclusion and restrictions on anyone eligible and qualified to stand as a candidate in any election.

       (i) Participation of women as candidates

Stakeholders that also included political parties acknowledged the significance of section 80 of the Constitution and the SADC Protocol on Gender and Development, which require that women be given equal opportunities as men in political, social and economic activities. Despite the innovations that Zimbabwe has made, such as the provision of the 30% female quota in respect of councillors for local authorities, the Mission noted that a lot more still needs to be done to achieve gender parity in contested/elected political positions. In this regard, our Mission was advised that in 2023 fewer women actually succeeded at their parties’ primary elections, and effectively less women stood for the National Assembly, whilst only one woman stood for the presidency. Amongst others, this could also be attributed to the high nomination fees.

       (j) Independence of the Judiciary

In view of their significance in the event of legal challenges in the context of the electoral process, some stakeholders expressed the view that the  Government compromises the judiciary. A key justification for this perception was information received from these stakeholders that the judiciary recently received large financial and material incentives, which the stakeholders viewed as an attempt by the Government to buy the loyalty and allegiance of the judiciary.

       (k)     Alleged intimidation of voters

The Mission was informed that the rural vote may be compromised by alleged intimidation attributed to a group called Forever Associates Zimbabwe (FAZ), which is said to be a quasi-security intelligence organisation. The group was said to have been deployed to wards and around 36,000 villages. The allegations were that people were intimidated to vote in a particular manner and were warned that it would be easy to determine who voted against certain parties.

       (l)        Postal voting controversy

There was considerable concern from the opposition that postal voting by the officers of the Zimbabwe Republic Police was compromised by the alleged coerced voting.  There were allegations that police officers undertaking postal voting were coerced to vote in a particular way in the presence of their supervisors, thus compromising the secrecy of the vote.

       (m) Coverage of the elections by State-owned Media

It was the contention of several stakeholders that the State-owned media houses remain biased against the opposition political parties and candidates. While the Mission noted some improvement compared to the 2018 electoral processes, we also noted that the content of the public broadcaster and the State-owned newspapers were in favour of one political party, contrary to the relevant provisions of the Constitution, the Electoral Act, and the Revised SADC Principles and Guidelines Governing Democratic Elections, which requires State-owned media to be impartial.   

3. OBSERVATIONS ON ELECTION DAYS (23-24 AUGUST 2023)

On the Election Days, the SADC Electoral Observation Mission observed the voting process in 10 Provinces of the Republic of Zimbabwe. The deployed observer teams covered 172 polling stations in their respective areas. The political contestants have continued to call for peace during this election period and after. The SEOM observed the following critical aspects at the 172 polling stations that we visited:

  • The environment at the polling stations was relatively calm and peaceful. 
  • Several voters expressed concern due to a lack of, or late arrival of ballot papers and poor administration at some polling stations. However, voters remained patient to exercise their constitutional right to vote.
  • Professional and attentive police presence enhanced the overall peace and secure environment in all the polling stations observed. 
  • 64% of the voting stations observed opened on time, 36% did not open on time for the 07:00am stipulated opening time. Some polling stations opened more than 12 hours after the stipulated time. The reason provided by ZEC for this unprecedented development was the unavailability of ballot papers, particularly for the local authority elections, and also due to previous litigation. This challenge was, however, specific to Harare and Bulawayo Provinces. Due to the delays, some voters left without casting their votes, while others remained in the lengthy queues throughout the day and night. By 06:00am on 24 August 2023, some voters in these two provinces had still not voted. Consequently, these delays also had a knock-on effect as they dissuaded voters from voting in the first place. Against this observation, we further note as follows:
  1. Section 52(1) of the Electoral Act provides that for any election, the ZEC shall ensure that every constituency elections officer is provided with polling booths or voting compartments and ballot boxes and shall provide papers, including ballot papers.
  1. Before election day, ZEC had assured our Mission and other stakeholders that all necessary voting materials, including ballot papers, were available and ready for use. This communication was made in the context of section 52A(2) of the Electoral Act which requires ZEC to provide information on the number of ballot papers and publication of details regarding them.  Based on these two considerations, the subsequent information from ZEC that they did not have adequate ballot papers has the unfortunate effect of creating doubts about the credibility of this electoral process.
  • The voters roll was unavailable at 1% of the polling stations observed and was therefore not displayed outside the polling stations for the convenience of the voters and verification by party/candidates agents.
  • During the voting period, and at 26% of the polling stations observed, not all voters who turned out could vote. The reasons advanced for this included:
  1. Voters were identified, but their names  were not found on the voters’ roll; 
    1. It was not possible to establish the voter’s identity; 
    1. Voters  were at the wrong polling station; and
    1. Voters did not have a national identity card or passport, or due to the absence of an official witness confirming an elector’s identity.
  • 8% of the polling stations observed were not accessible to voters living with disabilities.
  • At 50% of the polling stations, voters living with disabilities, the elderly, and pregnant women were not given priority to vote.
  • In 3% of polling stations observed, indelible ink was not checked on the voters before allowing them to cast their vote.
  • At 97% of the polling stations observed, voting was free from irregularities.
  • Voting proceeded in an orderly manner at 95% of the polling stations observed.
  • Ballot boxes did not remain locked and/or sealed at 2% of the polling stations.
  • As a result of the excessive delays in the opening of polling stations in Harare and Bulawayo provinces, at least 36% of the voting stations observed did not close at the scheduled closing time of 1900hrs, while some had not even opened by that time. It was announced that voting would be extended to proceed into 24  August 2023 to compensate for the late opening. 
  • In previous stakeholder consultations, a shadowy organisation  called Forever Associates Zimbabwe was accused of conducting a country-wide exercise of electoral intimidation. Our observers confirmed the existence of this group as its officials or agents were easily identifiable at some polling stations as they were dressed in regalia emblazoned with the FAZ name and were accredited local observers. These, and other unidentified persons who were not polling officials were also observed taking down the voters’ names before they cast their votes. In some areas, voters were intimidated by the actions of these individuals.
  • The Mission observed the closing and vote counting processes. A proper analysis

of these two processes shall be provided  in the final SEOM Report.

4.   Recommended improvements in the electoral process

At this juncture, allow me to recall that the SEOM is continuing the process of electoral observation in the post-election phase. As such, the Mission will not be rendering comprehensive recommendations and detailed qualifications of the election at this stage.

However, the Mission has observed the following areas of the electoral process and system that relevant stakeholders may wish to consider improving:

  • Access to the voters roll: In order to improve perceptions amongst the public, political parties and candidates, ZEC is advised to strictly follow the provisions of the Constitution on transparency, access to information, and timeously avail the voters roll in accordance with the stipulations under the Electoral Act.
  • Nomination fees: In order to enhance the openness and inclusivity of the political process, ZEC is urged to engage with all key stakeholders in the process of revising nomination fees for candidates and attempt to benchmark the revised fees in the context of the SADC region and Zimbabwe’s economic realities.
  • State-owned media coverage: The relevant media regulatory authorities are urged to ensure the implementation of measures that require impartiality in the coverage of political events by State-owned media.
  • Voting materials: ZEC is urged to strengthen transparency in the procurement process , and delivery of all voting materials, including ballot papers, and put in place a monitoring system that includes the participation and verification by electoral stakeholders. In addition, there is need for the Electoral Act to be revised to put in place clear timeframes within which these processes should be completed.
  • Participation of women: Effective and practical measures should now be put in place at the earliest sitting of the next parliament to enhance the equal participation of women as candidates in electoral processes.

5.    CONCLUSION  

In conclusion, the Mission observed that the pre-election and voting phases, on 23-24 August 2023 Harmonised Elections were peaceful, and calm. However, for reasons outlined above, the Mission noted that some aspects of the Harmonised Elections, fell short of the requirements of the Constitution of Zimbabwe, the Electoral Act, and the SADC Principles and Guidelines Governing Democratic Elections (2021).

The Mission commends the people of Zimbabwe for maintaining a peaceful political environment during the pre-election period, and on voting day. The Mission will release its final report after the validation and proclamation of final results, as provided for in the SADC Principles and Guidelines Governing Democratic Elections

The final report will be shared with the ZEC and all stakeholders. 

In terms of the SADC Principles and Guidelines Governing Democratic Elections, our long term observers will remain on the ground to continue with the post-election observation until the 1st of September 2023. The SEAC shall return at an appropriate time, to undertake a postelection review to determine the extent to which the recommendations of SEOM have been implemented and the nature of support, if any, that the Member State holding elections may require from the SADC region, to implement those proposals.  

In the event of any electoral disputes, the Mission appeals to all contestants to channel their concerns through established legal procedures and processes. The Mission urges all political parties and the people of Zimbabwe, and all other stakeholders to allow the ZEC to announce the final results as legally mandated.

Latest On Southerton Robbery

A suspected armed robber who is believed to be part of the armed robbery syndicate that mugged an unidentified victim in Southerton, Harare on Thursday was gunned down yesterday in Chitungwiza in a shootout with a detective from the CID homicide.

The now-deceased Sam Mudzuri died this Saturday on admission at a local hospital.

In a statement by the Zimbabwe Republic Police, detectives from CID Homicide received information on Saturday that Mudzuri was hiding at his girlfriend’s house in Unit A, Chitungwiza.

When police tracked him down to his hiding place, the now deceased opened fire on the police before he got shot on the legs.

The injured Mudzuri was referred to a local hospital in Harare where he died upon admission.

Police also indicated that they are pursuing other Southerton robbery Suspects, Paul Chinake alias Pauros, Lovejoy alias Shorty, Teddie and Betto.

Meanwhile, police have arrested Tawanda Chivizhe (28), Terrence Nyasha Mugocha (21) and Tawananyasha Kaguda (21) in connection with a murder case in which Panashe Nyamurova (26) was killed this month at corner Sixth Street and Samora Machel, Harare, after confronting the suspects for allegedly stealing US$90.00 from a lady of the night.

DYNAMOS failed to capitalize on Ngezi Platinum’s loss after being held to a goalless draw by Black Rhinos at the National Sports Stadium this Sunday.

Unaware of the proceedings at the Colliery Stadium, Dynamos missed out on a golden opportunity to renew their chance of clinching the 2023 Castle Lager Premier Soccer League title after failing to find the back of the net against Black Rhinos.

Despite enjoying the home advantage, Dynamos fired blanks against Black Rhinos to miss up on a valuable set of three points which would have been useful in their title push, as runaway log leaders Ngezi Platinum Stars fell to Hwange by a goal to nil.

Zim In Cement Crisis?

THE government has liberalised the importation of cement in the wake of production challenges being faced by the country’s two leading producers.

The acute shortage of cement has seen dealers in the commodity capitalising on the dire situation by hiking prices amid concerns that if unabated, the situation may hamper the growth of the construction industry which has been on an upward trajectory.

Vice President of the Zimbabwe Building and Construction Association (ZBCA) Dr Tinashe Manzungu said of late demand for cement has outstripped supply by huge proportions.

“The industry has faced persistent challenges of cement availability. What is happening is that dealers are taking advantage of the situation by hiking prices of cement and sometimes by 100 per cent, hence we implore the government to find measures to ease the situation,” he said.

Industry and Commerce Deputy Minister, Honorable Roy Bhila revealed that plans are underway to improve the cement supply situation within two weeks.

“Two of our leading cement producers in Lafarge and Sino are having problems with production issues, hence we have given them import licenses to ensure that we have no shortages while they are attending to their situation. I can tell you that the situation will be back to normal within the next two weeks,” he said.

Zimbabwe’s combined annual cement production capacity stands at 2,6 million tonnes while demand has been steadily rising over the years due to the construction boom currently underway.

AmaZulu Confirm Death Of Leading Marksman

South African top-flight side AmaZulu have confirmed the death of their striker Bonginkosi Ntuli.

The 32-year-old striker died at Midland Medical Center in Pietermaritzburg on Sunday 5 November after battling an “aggressive form of cancer”.

A statement by the club reads: “It is with a very heavy heart that we inform you of the untimely passing of our beloved centre-forward and loyal servant, Bonginkosi Ntuli.

“Ntuli was (very recently) diagnosed with an aggressive form of cancer, which metastasized and ultimately led to his death at the Midlands Medical Centre Private Hospital, in Pietermaritzburg this afternoon.

“May his beautiful soul rest in eternal peace. The club requests privacy and patience be granted his family and friends at this difficult time.”

Ntuli started his professional career with Golden Arrows back in 2012 before playing for Mamelodi Sundowns between 2014 and 2019.

During his time at Sundowns, he was sent on several loan spells with other clubs.

Munetsi Injury Blow For Warriors

The Zimbabwe national team has suffered an injury blow ahead of their games against Rwanda and Nigeria in the 2026 World Cup Qualifiers.

The blow comes after star midfielder Marshall Munetsi suffered a broken nose which kept him out of action over the weekend.

According to a report by French outlet, L’Union, the Stade de Reims medical team barred him to play in the game against Nentes even with a protective face mask.

The report further states that Munetsi’s absence could even extend into next week ahead of the game against Paris Saint-Germain.

It’s still unknown if he will be cleared to travel to Africa for the Warriors’ World Cup Qualifiers.

Sengezo Tshabangu Defies Chamisa, Hijacks CCC

By- CCC self-imposed Secretary General Sengezo Tshabangu has hijacked the movement and activated the MDC structures from the 2019 Gweru Congress.

In a statement, Tshabangu said individuals elected at that Congress must now stand up and be counted by fusing and uniting as per their collective mandate to restore the party to its constitutional foundation. 

He added that there is a need to reset it towards its historical and traditional constitutional pathway, per the landmark decisions of the party’s National Council meeting that founded CCC on 22nd January 2022. Read the statement:

We note and welcome the judgment handed down on 4 November 2023 by the High Court in Harare which dismissed with the costs the application by the recalled MPs who ceased to be members of the party, following their election to Parliament in the August 2023 harmonised general election. As a people’s movement, we are deeply concerned that, because the general election was marred by electoral malpractices it, failed to redress the widespread and deepening social, economic and political crisis in the country. This mainly because it was held on the back of longstanding crippling challenges associated with previous elections that remain unresolved, along with, and because of, the failure to implement the recommendations made by various international election observer missions after the 2018 general election, especially from the African Union (AU) and the Southern Africa Development Cooperation (SADC). It is an open matter of palpable consternation among our party’s membership that our party, that was formed by the toiling working masses with the agenda to fight for democratic constitutionalism, job creation and sustainable livelihoods, ended up operating structureless, without a constitution, having wantonly and inexplicably disregarded the resolutions of the party’s 5th National Congress held in Gweru in 2019.

Also, our party’s membership and supporters were profoundly perturbed and watched helplessly when the party’s National Leadership elected at the Gweru Congress in 2019 was quietly but effectively and unceremoniously purged unconstitutionally and displaced through opaque processes under dark circumstances that left a gaping vacuum that was illegally filled by a handful of scheming individuals with a nefarious agenda — some of them with no history in the democratic movement — who had neither a mandate nor the requisite experience to implement the people’s agenda and programme of action for the change that the citizens expect and deserve.

In the circumstances, we call on these leaders who were elected at the Gweru Congress to now stand up and be counted by coalescing and uniting as per their collective mandate to restore the party back to its constitutional foundation and to reset it towards its historic and traditional constitutional pathway, as per the historic decisions of the party’s National Council meeting that founded CCC on 22th January 2022.

The time has come for all of us to close ranks by closing the chapter of divisions and individualism to focus on service delivery, internal party cohesion, democracy and to refocus the movement on addressing the plight of the people and on spotlighting their aspirations. Our elected officials in Parliament must now focus their attention on the legislative reform agenda, provide an alternative and robust voice and act on behalf of the public by holding the executive to account.

It is a matter of a grave national concern that local authorities are confronted with raging cholera outbreaks in various parts of the country, and that this is but just one out of a myriad of ills afflicting citizens to the detriment of their lives and livelihoods. 

To effectively deal with these challenges, the party must as a matter of urgency return to Constitutionalism and manage its affairs through constitutional and formal structures in the interest of collective responsibility to ensure efficiency and accountability to restore stability and certainty.

It is clear that discordant and irreconcilable views on how to achieve the necessary democratic breakthrough in the country can easily lead to the total breakdown and collapse of the movement. This risk is made worse by the current failure to rely on the party constitution, party values and party organs as the premises for collective decisions and actions, as well as shared and collective responsibility. In the circumstances, going forward henceforth, we are committed and resolved to: Finalise the correction of processes and conduct that undermined the party’s Internal democracy and collective decision-making through ego-tripping, self-aggrandisement, fear-mongering and corruption. This is because we are aware that most of the party’s faithful deployees who enabled the corrupt practices did so out fear and desperation and had nowhere and nothing to fall back on, in the wake of the demobilisation of the party’s constitution, formal structures and processes.

Resume the holding of the party’s mandatory constitutional meetings at all levels of the party to enable members to regain their decision-making power. As a social democratic and people-driven party, the participation of citizens in decision-making process is paramount and thus non-negotiable.

Commence the preparation for Congress in terms of the interim constitution of the party, beginning with the election of branch committees.

Ensure that the preparatory process for the National Congress crystalizes an inclusive programme of mobilisation and ground action in preparation for the next harmonised general election due in 2028. We expect compatriots with the MDC and CCC DNA and blood in their political veins to be reinvigorated, re-energised and motivated to once again take their place in history and play their part to participate meaningfully and to assume their vanguard roles as we depersonalize the agenda for change in Zimbabwe to ensure that it is truly led and owned by the citizens.

We Are The Real Government : President Chamisa

CCC leader President Nelson Chamisa has boldly declared that Mr Emmerson Mnangagwa’s administration is illegal.

This comes at a time pressure is increasing on the Zanu PF leader whose controversial win in the August 23 polls has become a boiling point in the region.

According to President Chamisa, Mnangagwa does not know which button to press due to relentless local and international pressure.

EIA Crucial In Mining

By Farai D Hove | Zimbabwe’s self-inaugurated president, whose position has already been widely condemned by the Southern African Development Community (SADC), found himself mired in yet another embarrassing situation. The latest fiasco involves the appointment of his girlfriend, Virginia Mabhiza, as the country’s first female Attorney General.

Mnangagwa’s decision to appoint his romantic partner to such a crucial role has raised eyebrows. It has added to the growing list of concerns about the legitimacy of his government and its commitment to ethical governance.

What makes this situation even more cringe-worthy is the Information Ministry’s recent statement, where they described Virginia Mabhiza as a “gem.” While this could potentially be a typo or a slip of the keyboard, the timing and context of the statement leave little room for doubt that it was an intentional dig at the president. It’s a clear reference to his highly publicized love affair with Virginia Mabhiza, who was reportedly a married woman before her meteoric rise to power.

This “gem” reference may well have been a sarcastic attempt to underline the Mnangagwa’s questionable judgment and decision-making. The entire scenario not only reflects poorly on the president but also serves as a glaring example of the nepotism and cronyism that has plagued his administration.

Adding salt to the wound is the recent SADC Extraordinary Summit, where the regional body de-recognized the president’s authority over Zimbabwe due to the discredited 2023 elections. The use of soldiers to manipulate the election results has further eroded the president’s credibility, and this appointment of his girlfriend only adds to the mounting criticism against his rule.

The situation in Zimbabwe remains highly volatile, and the president’s actions continue to undermine the country’s democratic institutions and rule of law. The “gem” reference may have been a simple typo, but it serves as a poignant reminder of the turbulence and embarrassment that have characterized his presidency, leaving many to question the true nature of his leadership and the future of Zimbabwe.

The development also happens on the anniversary of Mnangagwa’s firing from government 6th November 2017 over his unsuitability.

Complainants In Corporate Rescue Practitioner’s Case Described As ‘Dishonest’

By A Correspondent| Harare Magistrate Marehwanazvo Gofa has cleared Corporate rescue practitioner Knowledge Hofisi of allegations of fraud and concealing a transaction from a principal emanating from a US$17 000 payment involving Redwing Mine.

Magistrate Gofa described the two complainants in the case Patricia Mutombgera and Stanley Motto as dishonest for implicating Hofisi despite paying US$7000 to persons not directly linked to the Accused.

The two had alleged that they paid US$7 000 to Hofisi for the purposes of registering a new company yet he bought a shelf company contrary to what the parties had allegedly agreed.

It however emerged that the money was paid to a legal practitioner Listen Zinyengere and not directly to Hofisi as had been alleged by the two with the court stating that there is no evidence to even support that the payment to the lawyer was influenced by Hofisi.

The two also alleged Hofisi fraudulently prepared a joint venture agreement involving Probadeck, Duatlet and Betterbrands and emerged that their lawyers had drafted the agreement.

Represented by Admire Rubaya, Hofisi argued that there was nothing criminal about the allegation and that had they not been happy the only recourse was to sue for specific performance in the civil courts.

It was also alleged that Hofisi received US$10 000 without revealing it to the Master of the High Court which appointed him corporate rescue practitioner.

His lawyer argued that Hofisi was not an agent of the master and that even the master praised him for a job well done and kept him on the job even after a criminal complaint had been filed against him.

“The complainant actually made an application to have the accused removed as a corporate rescue practitioner for Redwing mining Company but the Master confirmed that his department did not see anything wrong with the accused’s conduct and there was no reason whatsoever to remove the qccused from the post.

“There is no employment contract between the Master and the accused person but the accused’s duties are set out in the Insolvency Act. Thus, an independent corporate rescue practitioner cannot with respect be adjudged to be an agent of the Master of the High Court in the circumstances,” Rubaya argued.

It was his further argument that the alleged US$10 000 was part of the the agreed US$90 000 hence no point of informing the Master of the High Court since the law allowed the corporate rescue practitioner to agree with the concerned parties regards his remuneration.

“In terms of the signed agreement in question the accused was actually entitled to be paid 3% of 3 million dollars which was supposed to be paid within seven days. This means that the parties had in actual fact agreed that the accused was to be paid $ 90,000.00 within 7 days from the date of signing.
“The payment was made in the sum of US $10,000 which is less than $US 90,000 which was the agreed fee since there was an extant and valid agreement upon which the payment of US $10,000 was predicated, then in reality and at law, there was no need for the Master of the High Court to be informed before the accused could receive such a payment.

“This is because US $10,000.00 was well below the agreed $US 90,000.00. Thus, the allegations relating to the payment of US $10,000.00 are without any sense since the facts do not satisfy the requirement for the accused person to be said to be an agent of the Master of the High Court,” he argued.

Dealing with all the counts, regional magistrate Marehwanazvo Gofa said the “witnesses were dishonest.”

The court said from the evidence, all the money was paid to Zinyengere and that the joint venture mining agreement was also drafted by the lawyer.

The court also stated that State witnesses, the lawyer, Zinyengere and the Master of High Court, Gapara, all exonerated Hofisi from any wrong doing.

The court also stated that the majority of what Mutombgwera denied in her evidence in chief she in turn confirmed almost everything following intense cross examination by Rubaya who used documentation to prove the she had been lying to the court during evidence in chief.

Sikhala responds to “lying” Tshabangu

By A Correspondent- Jailed CCC member Job Sikhala has responded to Sengezo Tshabangu’s claims that he is negotiating his release on behalf of opposition CCC adding that the self appointed interim secretary general talks “hogwash, rubbish and lies”.

A source who visited Sikhala this morning at prison said he was furious after he was told that Tshabangu had posted on social media that he was engaging the state for the release of Sikhala.

Sikhala responded with a plea that a message be put out for him forthwith where he was responding to the claims.

Said Sikhala:

“Tshabangu is an idiot. I do not want him to associate himself with me on anyway. He talks hogwash, rubbish and lies”.

CCC will not win rigged elections

According to Jonso ZANU PF cannot and will not reform itself out of power. In Africa any NTA is naturally headed by the army and in Zimbabwe’s case we know who controls the levers of power and that person is now an ex officio member of the Politburo,” commented Prudence Paula Tete.

You are right, Zanu PF will never reform itself out of office or ever allow any meaningful democratic reforms to be implemented to dismantle the now well established Zanu PF autocracy. If Zanu PF is in the new GNU or NTA, we can be certain of one thing they will be there to throw the spinner in the works at every opportunity.

Morgan Tsvangirai and his MDC had the golden opportunity to implement the democratic reforms during the 2008 to 2013 GNU. Mugabe bribed them with the trappings of high office, the ministerial limos, very generous salaries and allowances, a US$4 million mansion for Tsvangirai himself, etc., etc. It worked! No even the constant nagging by SADC leaders such as Minister Lindiwe Zulu could get MDC leaders to implement even one token reform. 

MDC leaders have managed to get away with the treasonous betrayal of failing to implement even one reform because most Zimbabweans had no clue the primary purpose of the GNU was to implement reforms. They did not know what the reforms are much less how they are implemented. Even to this day most people do not know what the reforms are much less that MDC/CCC leaders sold out. 

MDC/CCC have taken full advantage of the people’s ignorance to create the narrative the nation does not need reforms implemented because they, the opposition, have devised winning in rigged elections strategies. “God is in it!” Chamisa has often argued. The ignorant and gullible public have swallowed the hook, sinker and line. 

How anyone would give up their right to free and fair elections for the oxymoronic promise of winning rigged elections, beggars belief; especially after 43 years of Zanu PF mafiosi rigging elections!

Nelson Chamisa and his CCC friends are not interested in implementing any reforms but they also know they will not win rigged elections. They have been participating in flawed elections knowing this will give Zanu PF legitimacy; they did care as long as they win a few gravy train seats making them the country’s main opposition. 

MDC/CCC know that 43 years of gross mismanagement and rampant corruption have left the country in economic ruins and the people desperate for change. They will wait for Zanu PF to burn the country down or for the people to risk all in violent protests, which ever comes first, to deliver power to them in a silver platter. 

If CCC ever got into power, their number one priority would be to consolidate their hold on power by making sure the key players in the Zanu PF autocracy switch their allegiance to CCC. Indeed, one of the reasons MDC failed to implement any meaning reforms during the 2008 GNU was the belief MDC could talk the top brass in the Army, Police and CIO to switch by promising them all the benefits they were getting from Zanu PF!  

The solution for Zimbabwe must be a NTA composed of technocrats who can be trusted to implement all the reforms. This is not  viable solution only because many people fear that Zanu PF will make the country ungovernable. The only relevant question one must therefore ask is: Are we going to let Zanu PF hold this nation to ransom?

“I am negotiating with the state for Sikhala’s release”: Tshabangu

By A Correspondent- Sengezo Tshabangu, the self-proclaimed Secretary General of Citizens Coalition for Change (CCC), has pledged to work towards securing the release of imprisoned opposition member Job Sikhala. Tshabangu holds the top leadership and Nelson Chamisa accountable for Sikhala’s continued incarceration.

Sikhala has been in prison since June 2022, facing charges of inciting violence during a funeral wake for a slain CCC activist, Moreblessing Ali. He had multiple unsuccessful attempts to obtain bail.

Tshabangu revealed in an interview with local radio station ZiFM Stereo that he plans to send a delegation from CCC to negotiate Sikhala’s release. Tshabangu believes that a political solution is necessary for Sikhala’s freedom. He said:

 I am negotiating with the State for Sikhala’s release. I will be sending a delegation to meet the State authorities that Job is not supposed to be where he is because he was thrown under the bus by our movement and this is sad that our movement can go and visit Sikhala and cry and yawn for his release yet they know behind their back.

I am saying this because I am inside CCC. I will be meeting Ziyambi Ziyambi, the minister of justice. I will also be meeting in the near future Obert Mpofu, the Secretary General of Zanu PF. These are the people that I have sent emissaries to meet with. It is underway.

Tshabangu revealed that he is seeking the support of the regional organisation, Southern African Development Community (SADC), regarding Job Sikhala’s imprisonment. Nelson Chamisa has also mentioned that they have reached out to SADC and the African Union (AU) for assistance, but have not received a response. Tshabangu argued that pursuing legal avenues has been ineffective since Sikhala is considered a political prisoner, similar to Nelson Mandela during the apartheid era in South Africa. He added:

A political prisoner is different from a criminal. We are going to negotiate. I have written to SADC. I have informed them that we are engaging Zanu PF for the release of Job Sikhala. So we will be sending a delegation to SADC for the summit. They will be talking about Job Sikhala’s release. We have tried legally, we have failed.

Tshabangu accused Nelson Chamisa’s associates of being responsible for Job Sikhala’s continued imprisonment. Sikhala has been in pre-trial detention since June 2022 and celebrated his 50th and 51st birthdays in Chikurubi Maximum Security Prison. Tshabangu claimed that individuals with criminal backgrounds influenced Chamisa to avoid pursuing a political solution for Sikhala’s release.

US$5 million budget for by- elections

The Government last week approved a US$5 million budget for the Zimbabwe Electoral Commission (ZEC) to conduct the by-elections to fill nine vacant seats in the National Assembly that were prompted by the expulsion of the opposition legislators last month.

ZEC deputy chairperson Ambassador Rodney Kiwa told The Sunday Mail that the approved budget also covers funding for the Gutu West by-election scheduled for Saturday. Voting in the constituency was postponed following the death of a duly nominated candidate, Cde Christopher Rwodzi, before the August 23-24 harmonised elections. Kiwa said:

The budget required for the 2023 by-elections is US$5,3 million, equivalent to $35 billion.

The commission is prepared to conduct the by-elections comfortably without any challenges.

We began preparations for the Nomination Court when President Mnangagwa proclaimed dates for the by-elections.

We have authorised signatures (of party officials) from the parties that we will use to receive nomination papers from prospective candidates.

Kiwa announced that each National Assembly candidate will need to pay a nomination fee of US$1,000. Only those who registered to vote before October 25 will be eligible to vote in the by-elections. The voter registration system is ongoing, but the voters’ roll for the by-elections closed two days after the proclamation of the elections on October 23.

The Nomination Court will meet on Tuesday to receive nomination papers from candidates for the December 9 by-elections. The way is clear for the by-elections to proceed after the High Court rejected an application by 23 Citizens Coalition for Change (CCC) members who wanted to overturn their recalls from Parliament. The recalls were made by CCC’s self-proclaimed interim secretary-general, Mr. Sengezo Tshabangu.

The Zimbabwe Electoral Commission (ZEC) is now finalizing preparations for the elections, which will be held in Beitbridge West, Binga North, Bulawayo South, Cowdray Park, Lobengula-Magwegwe, Lupane East, Mabvuku-Tafara, Mpopoma-Mzilikazi and Nketa.
